  1. 1The petitioner instituted these possessory information proceedings so that the following property would be recorded in the Registro Público de la Propiedad through this procedure: “LOT ONE: pastureland and woodland, consisting of approximately one hectare of woodland and one and one-half hectares of pastureland, located in Guacimal, Puntarenas, [Dirección1] , , measuring 2 hectares 5.772 square meters, bounded on the North by the Veracruz River; on the South by [Dirección2], with frontage of 279 meters and 87 centimeters (from point 1 to 2, from 3 to 4, and from 7 to 19); on the East by Danilo Anchia Méndez and [Dirección3], with frontage of 61 meters 27 centimeters (from point 4 to 7); and on the West by the Veracruz River and [Dirección2], with frontage of 52 meters 54 centimeters (from point 2 to 3), cadastral survey plan (plano catastrado) number P-1690661-2013. LOT TWO: land consisting of zero pastureland and 8985 square meters of woodland, located in Guacimal, Puntarenas, [Dirección4] , measuring 8985 square meters, bounded on the north by the Veracruz River, on the south and west by Quebrada Ojo de Agua, and on the east by [Dirección2], with frontage of 201 meters and 76 centimeters (from point 1 to 14), according to cadastral survey plan P- 1690665-2013.LOT THREE: grazing land and woodland consisting of 13 hectares of woodland and 38 hectares of pastureland, located in Puntarenas, [Dirección5] , measuring 51 hectares 3197 square meters, bounded on the north by [Nombre2] and [Dirección2], with frontage of 242 meters and 74 centimeters (from points 19 to 31); on the south by [Nombre3] , [Nombre4], with Quebrada Ojo de Agua lying between them, and [Dirección2], with frontage of 62 meters 52 centimeters (from point 1 to 6); on the east by [Nombre5]; and on the West by [Dirección2], with frontage of 369 meters and 63 centimeters (from point 6 to 19), under cadastral survey plan number 1690659-2013.” (See physical case file of the Juzgado Civil y Agrario de Puntarenas, initial petition at pages 14 and 15, new plan at page 62, and description of lots at page 79).-

  3. 3Attorney Karol Valverde Miranda, Judge of the Juzgado Agrario de Puntarenas, ruled as follows in judgment 2020000007 at fifteen hours and sixteen minutes on January twenty-two, two thousand twenty: “THEREFORE: Pursuant to Articles 1,4,6,15,16, and 19 of the Ley de Informaciones Posesorias and Articles 853, 856,and 860 of the Código Civil, these possessory information proceedings ARE APPROVED, without prejudice to any third party with a superior right. The Registro Público de la Propiedad is ordered to record in the name of [Nombre1] ,, married once, farmer, resident of La Guaria de Guacimal [Dirección6], identity number CED6 , the property described as follows: LOT ONE: land consisting of one and one-half hectares of pastureland and one hectare of woodland, located in Guacimal, Puntarenas, [Dirección1] , , measuring 2 hectares 5.772 square meters, bounded on the north by the Veracruz River; on the south by [Dirección2], with frontage of 279 meters and 87 centimeters; on the [Dirección7] by Danilo Anchia Méndez and [Dirección3], with frontage of 61 meters 27 centimeters; and on the west by the Veracruz River and [Dirección2], with frontage of 52 meters 54 centimeters, cadastral survey plan number P-1690661-2013.LOT TWO: land consisting of zero pastureland and 8985 square meters of woodland, located in Guacimal, Puntarenas, [Dirección5] , measuring 8985 square meters, bounded on the north by the Veracruz River, on the south and west by Quebrada Ojo de Agua, and on the east by [Dirección2], with frontage of 201 meters and 76 centimeters, according to cadastral survey plan 1690665-2013. LOT THREE: land consisting of 38 hectares of grazing land and a woodland area of 13 hectares, located in Puntarenas, [Dirección5] , measuring 51 hectares 3197 square meters, bounded on the north by [Nombre2] and [Dirección2], with frontage of 242 meters and 74 centimeters; on the south by [Nombre3] , [Nombre4], with Quebrada Ojo de Agua lying between them, and road [Dirección8], with frontage of 62 meters 52 centimeters; on the east by [Nombre5]; and on the West by [Dirección2], with frontage of 369 meters and 63 centimeters, under cadastral survey plan number 1690659-2013, as indicated in cadastral survey plans numbers P-1690661-2013, P-1690665-2013, 1690659-2013.The basis of acquisition was purchase. The property was valued at ¢5.600.000.00, and the lots subject to title (titular) in these proceedings are valued as follows: LOT ONE in the amount of ¢700.000, 00(seven hundred thousand colones exactly). LOT TWO: in the amount of ¢300.000.00(three hundred thousand colones exactly), and LOT THREE: in the amount of ¢10.250.000,00 (ten million two hundred fifty thousand colones). The notice was published in Boletín Judicial N°199 of Tuesday, October 18, 2011. It is further ordered that the property subject to title shall remain subject to the reservations concerning rights-of-way (derechos de vía) for public roads prescribed by Article 4 of the Ley General de Caminos Públicos and Article 19, subsection a), of the Ley de Informaciones Posesorias. The area adjoining the waterways constitutes a protection area (área de protección) pursuant to Article 33, subsections a) and b), of the Ley Forestal, and the cutting or removal of trees is prohibited.The surface water and groundwater existing on the property are in the public domain and do not form part of the property (Ley de Aguas, Articles 1, subsections a and b, and 3, subsection III, and Código de Minería, Article 4°. Once this decision becomes final, the corresponding certification shall be issued.” (See virtual case file of the Juzgado Civil y Agrario de Puntarenas, judgment entered 22/01/2020 15:16).-
  4. 4Attorney Lydiana Mayela Rodriguez Paniagua, in her capacity as representative of the State, filed an appeal (recurso de apelación), expressly stating the grounds on which she relied to refute the position of the trial court. (See virtual case file of the Juzgado Civil y Agrario de Puntarenas, pleading entered 31/01/2020 09:01).-
  5. 5The legal requirements were not observed in the conduct of the proceeding, and errors or omissions capable of rendering the judgment null and void are apparent.-

Judge Alvarado Paniagua drafts the opinion; and,

WHEREAS:

I.This Court adopts the statement of facts found to have been established in the appealed judgment, as it accurately reflects what occurred in the record. The following evidence is added to the first proven fact: cadastral survey plans at pages 67, 70, and 73 of the physical case file; certificates of conforming land use (uso conforme de suelo) at images 55 to 65 of the electronic case file in PDF format. The witness testimony (declaraciones testimoniales) in boxes 26, 28, and 32 of the electronic case file is added as evidence supporting the fourth proven fact. The error cited in the evidence supporting fact seven is corrected insofar as it refers to the document at page 2, whereas the correct references are the certifications appearing at pages 76, 77, 78.

II.The judgment issued at 15 hours 16 minutes on 22 de enero de 2020, available on the virtual desktop of the Agrarian Court of Puntarenas in PDF format, images 77 to 81, is appealed. That decision approved the possessory title proceedings (información posesoria) for three parcels. The appeal is signed by the State’s representative, [Nombre6], at entries 86 to 95. In her view, the evidence submitted and the findings in the judgment establish that the land is forested. She adds that forestlands and forests within national reserves are subject to the public domain as part of the State’s natural heritage. She states that this has been the case at least since Ley Forestal 4465 de 1969 artículo 33, as amended by the law of the same name, 7174, and supplemented by Ley 7575. She asserts that, although Ley Forestal permits title to property outside protected wilderness areas if the applicant proves legitimate ten-year possessory rights, together with the other required conditions, such as protecting the resource and having the property boundaries demarcated, she asks that the aforementioned declaration of forest public domain be taken into account.

Relying on judgment number 4587-97 of the Constitutional Chamber of the Supreme Court of Justice, she contends that forested lands may be titled only if acquisitive prescription (usucapión) had been completed before they entered the State’s natural heritage. She considers that such properties are immediately designated by law as part of the public domain. She then transcribes several judicial precedents and opinions issued by the Office of the Attorney General concerning the foregoing. She states that repealed law continues to govern legal situations that arose under it. She refers to the protection of forest public-domain rights established by prior legislation against retroactive applications detrimental to those rights. She cites the aforementioned case law of the Constitutional Chamber pursuant to canon 13 of the Ley de Jurisdicción Constitucional and understands that it is necessary to prove ten-year possession sufficient for acquisitive prescription, meeting the statutory requirements, before forests and forestlands were designated as part of the public domain.

She partially transcribes judgments numbers 4587-97, 15753-2005, [Telf1] and 738-2003 of that High Chamber. Regarding the legal impossibility of obtaining title to public-domain property (bienes de dominio público), she also cites opinion number C-321-2003 issued by that State representative body. As to the prohibition against private parties exercising possession as owners over public-domain property, she asserts that the inalienability of public-domain assets (bienes demaniales) precludes their voluntary or compulsory transfer, whether partial or total, as well as possession under the terms of Private Law. She argues that numerous repeatedly cited rulings of the Constitutional Chamber reaffirm that public-domain property cannot be subject to private possession and that “administrative action replaces possessory actions (interdictos) for recovery of ownership” or possession. She refers to judgments 480-90, 2306-91, 2557-91, 98-92, 1055-92, 1207-93, 5399-93, 5976-93, 220-94, 914-94, 1763-94, 2767-94, 6785-94, 3793-94, 4619-94, 6079-94, 31445-96, 3227-96, 422-96, 4815-96, 5026-94, 623-98, 7294-98, 00790-2001.

To support her position regarding the impossibility of obtaining title to forested property, she cites judgment 9282 de 1987 of the First Section of the Contentious-Administrative Court, and rulings numbers 10019, 10166 and 10418 de 1988; as well as ruling 1851 de 1976 of the Contentious-Administrative Court and ruling N° 910 de 1987 of the First Section of the Second Superior Civil Court. She asserts that titling proceedings or judicial disputes concerning the tenure or possession of public-domain areas, to the detriment of the State’s ownership and possession by operation of law, are unacceptable. In her view, the contrary would conflict with the rules of inalienability and immunity from prescription (imprescriptibilidad) governing such property and barring situations that could create possessory rights in favor of third parties sufficient for acquisitive prescription. Concerning the inadmissibility of acquiring by prescription and obtaining title against the public domain, she quotes from the Court of Cassation judgment number 122 de 16 horas 15 minutos del 16 de noviembre de 1965; as well as judgments number 007-93 and 733-F-2000 of the First Chamber of the Supreme Court of Justice, and judgments 523 -1997 and 665-2002 of the Agrarian Court, concluding with a reference to opinion C-146-2008 of that entity.

She further mentions the principle of inalienability insofar as it removes public-domain assets from private commerce or legal transactions, with a statutory prohibition against transferring ownership or creating other rights in rem (derechos reales) through Civil Law procedures. She states that the non-commercial nature of public-domain holdings makes them incapable of private appropriation for the satisfaction of individual interests. For that reason, from her perspective, they cannot be the subject of legal acts or contracts involving the transfer of ownership to private parties. She says that they cannot be acquired through possession and cites Constitutional Chamber judgments 3085-92, 3712-93, 6189-93, 1653-97, 4868-97, 2006-10900; the aforementioned First Chamber judgment number 733-F-2000; and Agrarian Court judgment number 116-F-06, among others. Lastly, concerning immunity from prescription, she asserts that it is a direct consequence of the principle of inalienability, explaining that it is implicit in the exclusion of public-domain property from commerce; such property cannot be subject to private possession or ownership, and therefore it is legally impossible to acquire it by prescription.

She refers to legal scholarship and the aforementioned First Chamber judgment 07-1993. She considers that title is being sought to property belonging to the public domain, namely the State’s natural heritage. She finds that the witnesses’ statements do not prove ten-year possession sufficient for acquisitive prescription. She asks that the appeal be admitted, the judgment reversed, and, in its place, the proceedings denied pursuant to artículo 11 de la Ley de Informaciones Posesorias and artículos 13 y 14 de la Ley Forestal vigente..- (See notice of appeal in file dated 24/01/2020 15:58:30).-

III.The grievances raised by the appellant are not accepted for the following reasons: The soil studies prepared by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA) show that the properties described in plats P-1690661-2013, P-1690665-2013 and P-1690659-2013 consist largely of regenerating scrubland (tacotal), thickets (charrales), and secondary forest (bosque secundario). (See soil studies in the submissions inbox file dated 23/07/2019 10:47:59). Although it is true that a majority of a differently constituted panel of this Court held that the ten-year period of possession of forested land must be counted from before it became subject to the public domain pursuant to Ley Forestal of 1969, that holding does not apply to this specific case, because it should be noted that this property consists of regenerating scrubland, thicket, and secondary forest, which means that the land was regenerated by its possessor; moreover, the judicial inspection shows that this resource has been cared for.

The Comisión Nacional de Certificación Forestal de Costa Rica defines secondary forest as “... land with woody vegetation of a secondary successional nature that develops once the original vegetation has been removed by human activities or natural phenomena; with a minimum area of 0.5 ha and a density of no fewer than 500 trees per ha of all species, with a dbh of no less than 5 cm” (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999. Estándares y procedimientos para el manejo sostenible y la certificación forestal en Costa Rica. San José,. Costa Rica. 54 p.) Based on this definition and the INTA technical study appearing at folios 77-90, the original forest was converted into pastureland and subsequently gave rise to a secondary forest that, as stated, has been cared for by its possessor. Declaring this type of regenerating scrubland, thicket, and secondary forest to be public-domain property (bien demanial) would discourage this type of forest-regeneration activity, because possessors would prefer to keep their land as pastureland so that it would remain within their estate and they would not risk having it declared state-owned.

Silvicultural activity and the regeneration of secondary forests are necessary activities for capturing carbon from the atmosphere and, therefore, are environmental measures against global warming. These activities benefit the environment, and it would consequently be inconsistent to punish possessors who engage in this type of forest-regeneration activity by denying them title to their property. Nor is the property located within any protected zone, as was initially stated to be the case for 4% of it; following its subdivision into three plats, that restriction no longer exists, as shown by the certifications of the Área de Conservación Pacifico Central appearing at folios 76, 77 and 78 of the physical case file, which place the properties outside protected wilderness areas (áreas silvestres protegidas). Based on the foregoing, the witness testimony referring to ten years of possession establishes a period sufficient for acquisition by prescription (usucapión), because the requirement of exercising possession publicly, peacefully, continuously, and in good faith for ten years has been met.

There is no need to address possession for ten years prior to Ley Forestal because the land was converted into secondary forest, an activity undertaken by the possessors that it would be contradictory to punish by refusing to recognize it as valid for acquisition by prescription. The derived possession (posesión derivada), which the appellant claims was not established, has been proven, because the statements of [Nombre7], [Nombre8] and [Nombre9] consistently affirmed that they knew [Nombre10] as the original owner approximately forty years ago; that [Nombre1] purchased the property from [Nombre10] approximately twelve years ago and has since remained its sole owner; that its boundaries are clearly marked by barbed-wire fences; and that he has had no dispute concerning possession with any person, but instead has continuously possessed the properties for more than ten years. (See statements in files dated 16/03/2018 07:41:31 16/03/2018 07:37:55).-The witness [Nombre8] (image 26) stated that he was 66 years old and had lived in the area for a long time.

He stated that he had known the land for approximately 55 years. At that time, it belonged to an uncle named [Nombre11]; it later belonged to [Nombre10], who sold it to [Nombre1]. He knew the land as a single property, but two roads crossed it and divided it into three sections. He stated that the sections include primary and secondary forest, while others are pastureland. A small house and a wooden corral are located in one section. He stated that the property is enclosed by barbed-wire fencing in some sections, while in another section its boundaries are formed by a river or streams, which are natural boundaries. He added that the forested sections have always been preserved, that he has not seen timber being removed, and that the bodies of water have remained protected. The witness [Nombre9] (frame 28) stated that he was 63 years old and had known the land since childhood. The first owner he remembered was [Nombre11], who later transferred it to [Nombre10], who held it for approximately 10 years or more; it then passed to a man named [Nombre12], who possessed it for a period similar to the previous one, and subsequently to [Nombre1], who, according to the witness, had held it for approximately 5 years.

He stated that some sections of the land are pastureland, others are preserved forest, and one contains a small shelter. Some boundaries of the property, which he described, are enclosed by barbed-wire fencing, while the remaining boundaries are natural. He mentioned that the forested sections have always been preserved and that no timber has been removed; the bodies of water are protected by forest and vegetation. Lastly, [Nombre7] (image 32) testified that he was 75 years old and had known the property for 40 years because their properties adjoin. The property belonged to [Nombre10] before [Nombre1] purchased it approximately 12 years ago. The land is bounded by three-strand fencing, and bodies of water form other boundaries. He stated that no timber has been removed and that the property is divided by the roads. The land has been used for pasture, thicket, and a small preserved forest.

In this matter, the possession stated to have lasted between 40 and 60 years was exercised in accordance with the chain of possession (cadena posesoria), as shown by the aforementioned document dated July 28, 2011, folio 4 of the physical volume, and by the testimony. In view of the foregoing, the witness evidence clearly establishes the requirements for exercising possession sufficient for acquisition by prescription pursuant to Article 856 of the Código Civil and, consequently, the right to register this title with the Registro Nacional.- In view of the soil studies conducted on the properties, it is recommended that their natural regeneration be maintained, that the growth of native forest species be encouraged, and that signs promoting the prevention of fires and hunting on the properties be posted.-

IV. In view of the foregoing, the appealed judgment must be affirmed as to the matters challenged on appeal.-

VOTO N° 468-F-2020 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las diecisiete horas y treinta minutos del veintiséis de mayo de dos mil veinte.- INFORMACIÓN POSESORIA promovida por [Nombre1] , mayor, casado una vez,agricultor, vecino de Guacimal, Puntarenas, cédula de identidad CED1 - - . En el trámite se tuvo como parte a la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por la Procuradora Agraria Magda Inés Rojas Chaves, mayor, casada, abogada, vecina de Heredia, cédula de identidad CED2 - - y al INSTITUTO DE DESARROLLO RURAL, cédula jurídica CED3 - - - , representado por su apoderada general judicial Carmelina Vargas Hidalgo, mayor, divorciada, abogada, vecina de Escazú, cédula de identidad CED4 - - . Actúa como apoderado especial judicial de la parte actora, el licenciado Lenín Segura Bolaños, colegiado catorce mil cuatrocientos veinte y como apoderada del Estado la licenciada Susana Fallas Cubero, cédula de identidad CED5 - - . Tramitado ante el Juzgado Agrario de Puntarenas.-

RESULTANDO

  1. 1El promovente interpuso las presentes diligencias de información posesoria para que por medio de esta vía se proceda a inscribir en el Registro Público de la Propiedad lo siguiente: "LOTE UNO: terreno de pastos y montaña, aproximadamente una hectárea de montaña y una hectárea y media de pastos, sita en Guacimal de Puntarenas, [Dirección1] , , mide 2 hectáreas 5.772 metros cuadrados, linda al Norte: río Veracurz, al Sur: [Dirección2] con un frente de 279 metros con 87 centímetros (Desde punto 1 al 2, del 3 al 4 y del 7 al 19) al Este Danilo Anchia Méndez y [Dirección3] con un frente de 61 metros 27 centímetros (Desde el punto 4 al 7) y al Oeste Río Veracruz y [Dirección2] con un frente de 52 metros 54 centímetros (desde el punto 2 al 3), plano catastrado número P-1690661-2013. LOTE DOS: terreno de pastos cero y montaña 8985 metros cuadrados, sita en Guacimal de Puntarenas, [Dirección4] , mide 8985 metros cuadrados, linda al norte Rio Veracruz , al sur y oeste Quebrada Ojo de Agua, al este [Dirección2] con un frente de 201 metros con 76 centímetros (desde el punto 1 al 14), según plano catastrado P- 1690665-2013.LOTE TRES: terreno de repastos y montaña de 13 hectáreas de montaña y 38 hectáreas de pastos, sita en Puntarenas, [Dirección5] , mide 51 hectáreas 3197 metros cuadrados, linda al norte [Nombre2] y [Dirección2] con un frente de 242 metros con 74 centímetros, (desde elpuntos 19 al 31) al sur [Nombre3] , [Nombre4] y Quebrada Ojo de Agua en medio y [Dirección2] con un frente de 62 metros 52 centímetros (Des punto 1 al 6) al este [Nombre5] y al Oeste [Dirección2] con un frente de 369 metros con 63 centímetros (del punto 6 al 19), bajo el plano catastrado número 1690659-2013." (Ver expediente físico Juzgado Civil y Agrario de Puntarenas escrito inicial folios 14 y 15, plano nuevo folios 62 y descripción lotes folio 79).-
  2. 2La Procuraduría General de la República y el Instituto de Desarrollo Rural se apersonaron al proceso. ( ver expediente físico Juzgado Civil y Agrario de Puntarenas folios 32 al 34 y 38 respectivamente).-

3- La licenciada Karol Valverde Miranda juez del Juzgado Agrario de Puntarenas en sentencia 2020000007 de las quince horas y dieciséis minutos del veintidós de enero de dos mil veinte, resolvió: "POR TANTO: De conformidad con los artículos 1,4,6,15,16, y 19 de la Ley de Informaciones Posesorias y 853, 856,y 860 del Código Civil SE APRUEBAN las presentes diligencias de Información Posesoria, sin perjuicio de tercero de mejor derecho. Se ordena a Registro Público de la propiedad inscribir a nombre de [Nombre1] ,, casado una vez,agricultor, vecino de La Guaria de Guacimal [Dirección6] de identidad número CED6 , la finca la cual se describe a continuación :LOTE UNO: terreno de pastos una hectárea y media y de montaña una hectárea,sita en Guacimal de Puntarenas, [Dirección1] , , mide 2 hectáreas 5.772 metros cuadrados, linda al norte: río Veracurz, al sur: [Dirección2] con un frente de 279 metros con 87 centímetros al [Dirección7] Danilo Anchia Méndez y [Dirección3] con un frente de 61 metros 27 centímetros y al oeste Río Veracruz y : [Dirección2] con un frente de 52 metros 54 centímetros, plano catastrado número P-1690661-2013.

LOTE DOS: terreno de pastos cero y montaña 8985 metros cuadrados, sita en Guacimal de Puntarenas, [Dirección5] , mide 8985 metros cuadrados, linda al norte Rio Veracruz , al sur y oeste Quebrada Ojo de Agua, al este [Dirección2] con un frente de 201 metros con 76 centímetros , según plano catastrado 1690665-2013. LOTE TRES: terreno de repastos de 38 hectáreas y área de montaña de 13 hectáreas, sita en Puntarenas, [Dirección5] , mide 51 hectáreas 3197 metros cuadrados, linda al norte [Nombre2] y [Dirección2] con un frente de 242 metros con 74 centímetros, al sur [Nombre3] , [Nombre4] y Quebrada Ojo de Agua en medio y calle [Dirección8] con un frente de 62 metros 52 centímetros, al este [Nombre5] y al Oeste [Dirección2] con un frente de 369 metros con 63 centímetros, bajo el plano catastrado número 1690659-2013 , tal como lo indica los planos catastrados números P-1690661-2013, P-1690665-2013, 1690659-2013.

La causa adquisitiva fue compra . Se estimó el inmueble en la suma ¢5.600.000.00 y las presentes diligencias se estiman los lotes a titular de la siguiente manera: LOTE UNO en la suma de ¢700.000, 00(setecientos mil colones exactos). LOTE DOS: en la suma de ¢300.000.00(trescientos mil colones exactos) y el LOTE TRES: en la suma de ¢10.250.000,00 (diez millones doscientos cincuenta mil colones). El edicto fue publicado en el Boletín Judicial N°199 del martes 18 de octubre del 2011. Asimismo,que el inmueble a titular queda afecto a las reservas en cuanto a derechos de vía de los caminos Públicos que dispone los artículos 4 de la Ley General de Caminos Públicos y 19, inciso a) de la Ley de Informaciones Posesorias. Que el área contigua a las corrientes constituye área de protección según el artículo 33,inciso a) y b) de la Ley Forestal y que queda prohibida la corta o eliminación de árboles.

Las aguas superficiales y subterráneas existentes en el inmueble, son de dominio público y no forman parte de la finca (ley de Aguas, artículos 1, inciso a y b y 3 , inciso III y Código de Minería, artículo 4°. Firme esta resolución, expídase la certificación correspondiente." (ver escritorio virtual Juzgado Civil y Agrario de Puntarenas sentencia incorporada 22/01/2020 15:16).-

  1. 4La licenciada Lydiana Mayela Rodriguez Paniagua, en su condición de representante de Estado, interpuso recurso de apelación con indicación expresa de las razones en que se fundamenta para refutar la tesis del juzgado de instancia. (ver escritorio virtual Juzgado Civil y Agrario de Puntarenas escrito incorporado 31/01/2020 09:01).-
  2. 5En la substanciación del proceso no se ha observado las prescripciones legales, y se nota la existencia de errores u omisiones capaces de producir la nulidad del fallo.-

Redacta la Jueza Alvarado Paniagua, y;

CONSIDERANDO:

I.Este Tribunal prohija la relación de hechos tenidos por demostrados en el fallo recurrido al ser reflejo de lo acaecido en autos. Al primer hecho probado se le adiciona como elementos de prueba: planos catastrados de folios 67, 70 y 73 del expediente físico; certificaciones de uso conforme de suelo en imágenes 55 a 65 del expediente electrónico en modo PDF. Al hecho probado cuarto se le adiciona como elemento de prueba las declaraciones testimoniales en cuadros 26, 28 y 32 del expediente electrónico. Se corrige el error citado en la prueba del hecho siete, en cuanto cita el documento de folio 2, cuando lo correcto son las certificaciones visibles a folios 76, 77, 78.

II.Se recurre la sentencia de las 15 horas 16 minutos del 22 de enero de 2020 visible en el escritorio virtual del Juzgado Agrario de Puntarenas en modo PDF, imágenes 77 a 81. En tal decisión se aprobó la información posesoria de tres lotes. La impugnación es rubricada por la representante del Estado [Nombre6] de cuadros 86 a 95. A su entender, de las pruebas aportadas y acreditado en la sentencia la naturaleza de los terrenos es boscosa. Agrega los terrenos forestales y bosques de las reservas nacionales están afectos a dominio público, patrimonio natural del Estado. Indica eso es así, al menos desde la Ley Forestal 4465 de 1969 artículo 33, reformada por la Ley de ese mismo nombre 7174, y adiciona la Ley 7575. Manifiesta, aunque se permite por la ley forestal titular inmuebles fuera de las áreas silvestres protegidas si el promovente demuestra sus legítimos derechos de posesión decenales, con las demás condiciones exigidas, como proteger el recurso y tener el predio deslindado, pide se tenga en cuenta la declaratoria de dominio forestal indicada.

Afirma con sustento en el voto de la Sala Constitucional de la Corte Suprema de Justicia número 4587-97 los terrenos boscosos solo podrán titularse si la usucapión se había consolidado antes de ingresar al patrimonio natural del Estado. Estima tales fundos tienen una afectación legal inmediata a dominio público. De seguido trascribe algunos precedentes jurisprudenciales y pronunciamientos emitidos por la Procuraduría con relación a lo antes citado. Indica hay una supervivencia del derecho derogado para regular las situaciones jurídicas que nacieron a su abrigo. Se refiere a la protección del derecho de dominio público forestal establecido por la legislación anterior contra aplicaciones retroactivas en su perjuicio. Menciona la jurisprudencia de la Sala Constitucional citada, según el canon 13 de la Ley de Jurisdicción Constitucional y entiende hay necesidad de demostrar una posesión decenal apta para usucapir con los requisitos de ley antes de las afectaciones a dominio público de los bosques y terrenos forestales.

Trascribe parcialmente las sentencias de esa Alta Cámara números 4587-97, 15753-2005, [Telf1] y 738-2003. Agrega, sobre la imposibilidad jurídica de titular en bienes de dominio público el dictamen de esa Representación Estatal número C-321-2003. En cuanto al impedimento de los particulares de ejercer posesión con ánimo de dueños sobre los bienes de dominio público afirma, la inalienabilidad de los bienes demaniales imposibilita su traspaso, parcial o total, voluntario o forzoso, y la posesión en los términos del Derecho Privado. Aduce, en múltiples resoluciones de la Cámara Constitucional de reiterada cita, reafirman los bienes de dominio público no pueden ser objeto de posesión privada y que "la acción administrativa sustituye a los interdictos para recuperar el dominio" o la posesión. Remite a las sentencias 480-90, 2306-91, 2557-91, 98-92, 1055-92, 1207-93, 5399-93, 5976-93, 220-94, 914-94, 1763-94, 2767-94, 6785-94, 3793-94, 4619-94, 6079-94, 31445-96, 3227-96, 422-96, 4815-96, 5026-94, 623-98, 7294-98, 00790-2001.

Para sustentar su tesis, de la imposibilidad de titular bienes boscosos cita sentencia del Tribunal Contencioso Administrativo Sección Primera 9282 de 1987, y de 1988 las resoluciones números 10019, 10166 y 10418; así como del Tribunal Contencioso Administrativo la resolución 1851 de 1976 y del Tribunal Superior Segundo Civil, Sección Primera la N° 910 de 1987. Afirma, son inaceptables las titulaciones o discusiones judiciales relativa a la tenencia o posesión de espacios de dominio público en detrimento de la titularidad y posesión de pleno derecho del Estado. Lo contrario, a su entender, entran en contradicción con las reglas de la inalienabilidad e imprescriptibilidad que gobiernan esos bienes de las situaciones que pudiera originar derechos posesorios a favor de terceros, aptos para usucapir. Tocante a la improcedencia de usucapir y titular contra el dominio público, extracta la sentencia de Casación, número 122 de 16 horas 15 minutos del 16 de noviembre de 1965; así como la número 007-93, 733-F-2000 de la Sala Primera de la Corte Suprema de Justicia; del Tribunal Agrario 523 -1997 y 665-2002, concluye refiriendo el dictamen de ese ente C-146-2008.

Por otra parte, menciona el principio de inalienabilidad, en cuanto los bienes demaniales los sustrae del comercio o tráfico jurídico privado, con la prohibición legal de enajenar el dominio o construir otros derechos reales por los procedimientos del Derecho Civil. Hace referencia al carácter extracomercial de las dependencias del dominio público las hace inhábiles de apropiación privada para satisfacer intereses individuales. Por esa razón no pueden ser, desde su perspectiva, objeto de actos jurídicos o contratos que impliquen transferencia de la propiedad a particulares. Dicen son insuspectibles de adquirirse por posesión; hace mención a los votos de la Sala Constitucional en referencia 3085-92, 3712-93, 6189-93, 1653-97, 4868-97, 2006-10900; de la Sala Primera ya mencionada número 733-F-2000 y del Tribunal Agrario el voto número 116-F-06, entre otros. Por último, concerniente a la imprescriptibilidad, afirma es consecuencia directa del principio de inalienabilidad, pues explica va implícita en la incomercialidad del demanio; no son objeto de posesión y dominio privado, y por eso hay imposibilidad jurídica de usucapirlos.

Refiere doctrina y la sentencia 07-1993 de la Sala Primera en referencia. Estima, por pretenderse la titulación de un bien perteneciente al dominio público como lo son el patrimonio natural del Estado. Considera las declaraciones de los testigos no demuestran la posesión decenal apta para usucapir. Pide admitir la apelación para revocar la sentencia, en su lugar, procedan a improbar las diligencias, conforme al artículo 11 de la Ley de Informaciones Posesorias y los artículos 13 y 14 de la Ley Forestal vigente..- (Ver escrito de apelación en archivo del 24/01/2020 15:58:30).-

III.No se comparte los agravios expuestos por la apelante por las siguientes razones: De los estudios de suelos elaborados por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA), se desprende que los inmuebles descritos en los planos P-1690661-2013, P-1690665-2013 y P-1690659-2013 son terrenos de tacotal en su gran mayoría, charrales y con bosque secundario. (ver estudios de suelos en archivo de la bandeja de escritos con fecha 23/07/2019 10:47:59). Si bien es cierto, por mayoría de otra integración de Tribunal se considera el conteo el plazo decenal de posesión de terrenos boscosos los es antes de la afectación de dominio público según Ley Forestal de 1969, ello no es de aplicación a este caso concreto, pues nótese se trata de un inmueble compuesto de tacotal, charral y bosque secundario, lo que implica esos terrenos fueron regenerados por parte de su poseedor además del reconocimiento judicial se desprende se ha cuidado ese recurso.

La Comisión Nacional de Certificación Forestal de Costa Rica define el bosque secundario como “... aquella tierra con vegetación leñosa de carácter sucesional secundaria que se desarrolla una vez que la vegetación original fue eliminada por actividades humanas o fenómenos naturales; con una superficie mínima de 0,5 ha y una densidad no menor a 500 árboles por ha de todas las especies, con dap no menor a 5 cm” (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999. Estándares y procedimientos para el manejo sostenible y la certificación forestal en Costa Rica. San José,. Costa Rica. 54 p.) Partiendo de esta definición y del estudio técnico del INTA visible a folios 77-90, el bosque original fue convertido en potrero, para luego dar lugar a un bosque secundario el cual como se dijo ha sido cuidado por su poseedor, declarar ese tipo de tacotal, charral y bosque secundario como bien demanial sería no incentivar ese tipo de actividad regeneradora de bosques, pues los poseedores preferirían mantener sus terrenos de naturaleza de potreros para tenerlos bajo su patrimonio y no correr el riesgo sean declarados estatales.

La actividad silvícola y la regeneradora de bosques secundarios son actividades necesarias para la captación de carbono en la atmósfera y por ende medidas ambientales contra el calentamiento global, actividades beneficiosas para el medio ambiente por lo que sería incoherente castigar a los poseedores que tienen ese tipo de actividad regeneradora de bosques denegándoles la obtención de su título de propiedad. Dicho inmueble tampoco está dentro de alguna zona protectora como inicialmente se indicó lo estaba en un 4%, luego de la segregación en tres planos, ya esa afectación desapareció según se desprende las certificaciones del Área de Conservación Pacifico Central visibles a folios 76, 77 y 78 del expediente físico, pues se les ubica fuera de áreas silvestres protegidas. Con base en lo anterior, las declaraciones testimoniales en las que se hace referencia a una posesión decenal, es tiempo apto para usucapir, pues se cumple con el requisito del ejercicio de una posesión decenal en forma pública, pacífica, continua, y de buena fe, sin que sea necesario referirnos a la posesión decenal anterior a la Ley Forestal, pues el terreno fue convertido a bosque secundario, actividad ejercida por los poseedores que sería un contrasentido castigar no teniendo esa actividad como válida para usucapir.

Se ha cumplido con la demostración de la posesión derivada que indica la inmpugnante no fue así, pues de las declaraciones de [Nombre7] , [Nombre8] y [Nombre9] , fueron contestes en afirmar conocen como propietario incial a [Nombre10] hace unos cuarenta años, luego [Nombre1] le compra a [Nombre10] hace unos doce años y desde entonces se mantiene como único dueño, siendo sus colindancias bien delimitadas con cercas de alambre de púas, así como no ha tenido problema alguno de posesión con alguna persona, sino que se ha mantenido por más de diez años en forma continua poseyéndolos. (Ver declaraciones en archivos del 16/03/2018 07:41:31 16/03/2018 07:37:55).-El declarante [Nombre8] (imagen 26), dijo tener 66 años y mucho tiempo de vivir en la zona. Afirmó conocer los terrenos desde hace unos 55 años. En ese momento le pertenecía a un tío llamado [Nombre11] ; luego de [Nombre10] y él se lo vendió a [Nombre1] .

Conocía el terreno como uno solo pero le pasaban dos calles que lo dividen en tres sectores. Adujo se encuentran en bosque primario y secundario; otros sectores de repasto. En un sector pequeño, se encuentra una casita y un corral de madera. Relató, la propiedad está cercada con alambres de púas en algunos sectores, otro es por río o quebradas que son colindancias naturales. Agregó los sectores del bosque siempre se han mantenido en conservación, no ha visto se saque madera y los cuerpos de agua se han mantenido protegidos. El declarante [Nombre9] (cuadro 28), dijo tener 63 años, conocer el terreno desde que estaba pequeño. El primer dueño que recuerda era [Nombre11] , luego lo traspasó a [Nombre10] quien la tuvo como 10 años o más; luego un señor llamado [Nombre12], poseyéndolo por un plazo similar al anterior, y luego a [Nombre1] , de quien relata tiene como unos 5 años de tenerla. Manifiesta, los terrenos están en potreros, otros sectores montaña en conservación y en uno hay una ranchita.

La propiedad está cercada con alambres de púas en unas colindancias que describe y las restantes son naturales. Menciona los sectores de bosque siempre se han mantenido en conservación, no han sacado madera; los cuerpos de agua se protegen con bosque y vegetación. Por último, declaró [Nombre7] (imagen 32), quien indicó tener 75 años; conoce la propiedad desde hace 40 años porque son colindantes. El inmueble era de [Nombre10] antes que [Nombre1] lo comprara como hace 12 años. El terreno esta delimitado con cercas a tres hilos y hay cuerpos de agua en otras colindancias. Afirma, no se ha sacado madera y la heredad se divide por los caminos. El terreno ha sido dedicado a pastos, charral y una pequeña montaña la cual se encuentra en conservación. En este asunto la posesión declarada entre los 40 a 60 años la ha ejercido de acuerdo con la cadena posesoria, según el referido documento que data del 28 de julio de 2011, foja 4 del tomo físico y lo extraído de las declaraciones.

Por lo expuesto, la prueba testifical es clara en demostrar los requisitos sobre el ejercicio de la posesión apta para usucapir de conformidad con el artículo 856 del Código Civil, y por ende su derecho a inscribir este título de propiedad en el Registro Nacional.- Observado los estudios de suelos realizados en los inmuebles, se recomienda mantener su regeneración natural, favorecer el crecimiento de especies forestales nativas, colocar rótulos motivando la prevención de incendios y la cacería en los predios.-

IV. Por lo expuesto deberá confirmarse el fallo recurrido en lo que ha sido objeto de apelación.-

POR TANTO:
