CONSIDERANDO

I. PRELIMINARY MATTER

The precautionary measure requested by the plaintiff shall be decided on the terms presented upon filing the complaint and in the correction submitted in response to the court’s request for correction. None of the arguments or evidence offered on appeal constitutes evidence before the lower court (a quo). Therefore, arguments on the merits, corrections, or evidence from the moving party presented before the appellate court (ad quem) do not constitute arguments or evidence to be analyzed by this judge. The moving party is obligated to state its request for precautionary relief clearly, since the precautionary measure must be specific and the burden of proof (onus probandi) rests with that party. The judge is not obligated to presume which act or acts the party seeks to have stayed; therefore, the analysis shall be strictly limited to the acts whose stay is expressly requested. Consequently, the precautionary measure shall be analyzed on the terms presented by the party before this court on September 30, 2019 and November 18, 2019 in the Precautionary-Measure Case File, taking into account that this is a summary proceeding (proceso sumario), not a plenary proceeding (proceso plenario), and that the substantive right at issue shall be adjudicated in the merits proceeding (proceso de conocimiento).

Separately, by virtue of the principle of judicial independence, any ruling issued in another case file does not prejudge this matter, since the factual and legal elements, as well as the judge’s analysis, are independent.

II. PROCEDURAL HISTORY

1. By filing dated September 30, 2019, a merits proceeding seeking a precautionary measure was instituted.

2. By procedural order (providencia) issued at three minutes past three p.m. on November fourteenth, two thousand nineteen, the plaintiff was ordered to submit a copy of decision R-CU-522-17- DEL 29 DE SETIEMBRE DE 2017.

3. By filing dated November 18, 2019, the plaintiff stated that, due to a clerical error, it had requested a stay of decision R-CU-522-17- DEL 29 DE SETIEMBRE DE 2017, when the correct decision was R-CU-519-17- DEL 29 DE SETIEMBRE DE 2017.

4. By procedural order issued at nine fifteen a.m. on December second, two thousand nineteen, the party was given an opportunity to be heard regarding the decision submitted.

5. The Municipalidad de Desamparados did not respond during the period granted above.

6. By decision number 2066-2019, issued at one fifty p.m. on November fourteenth, two thousand nineteen, the requested precautionary measure was denied.

7. By decision 250, issued at 14:00 on April 30, 2020, the lower court’s decision was vacated by the Tribunal de Apelaciones.

III. RELIEF SOUGHT AND ARGUMENTS OF THE MOVING PARTY

As relevant here, the plaintiff seeks the following precautionary measure (image 31):

The correction made by the plaintiff concerning the official communication (oficio) it seeks to have stayed is noted, in the sense that the official communication whose stay is requested is number R-CU-519-17- DEL 29 DE SETIEMBRE DE 2017. In support of adopting the measure, the plaintiff argues that destroying the telecommunications tower would have irreversible and extremely serious consequences because it would entail the demolition of a civil-engineering structure. Regarding the likelihood of success on the merits (apariencia de buen derecho), the party contends that Article 74 of the Ley de la ARESEP declares the establishment, installation, expansion, renewal, and operation of public telecommunications networks to be in the public interest, and that the Sala Constitucional held in Voto 15763-2011 that the interests of the Municipalidades may not take precedence over the public interest in telecommunications infrastructure.

It further argues that the tower as built causes no environmental harm and violates no urban-planning standards concerning height or setbacks (retiros). Regarding the risk posed by delay (peligro en la demora), it cites the high cost of constructing or demolishing a telecommunications tower, together with the harm to service users. Regarding the particular harm, the plaintiff alleges that the company maintains a series of contracts with third parties that would be directly affected, and submits a CPA certification establishing the existence of a lease agreement for the property where the tower is located, as well as contractual relationships with the telecommunications operators CLARO Y TELEFÓNICA, to which a substantial monthly rent is paid. Specifically, it alleges the following regarding the harm (image 17):

Regarding the balancing of interests (ponderación de intereses), the plaintiff contends that denial of the measure would harm the company and its users.

ARGUMENTS OF THE MUNICIPALIDAD DE DESAMPARADOS: For its part, in responding during the period granted, the defendant entity stated that there is no governmental action or administrative act (acto administrativo) ordering the demolition of the specified tower; rather, what exists is the denial of a construction permit. It also argues that the allegations in the complaint lack a connection to the measure and that no demolition order has been identified, such that the precautionary measure fails to satisfy the requirement of instrumentality (instrumentalidad).

IV. REQUIREMENTS FOR GRANTING A PRECAUTIONARY MEASURE

As developed by the Sala Constitucional, precautionary relief (justicia cautelar) responds to the need to safeguard the constitutional principle of prompt and effective justice by preserving the factual conditions essential to the issuance and enforcement of the judgment (Decision 7190-1994, issued at 15:24 on December 6). Consistent with this principle, Article 19 of the CPCA provides that the purpose of ordering a precautionary measure is to provisionally protect and safeguard the subject matter of the proceeding and the effectiveness of the judgment. Legal scholarship has stated that precautionary relief is not intended to declare a fact or responsibility, establish a legal relationship, enforce an order and satisfy an undisputed right, or resolve litigation, but rather to prevent harm that the litigation may cause or that may arise from an abnormal situation (Gallegos Fedriani, Nombre41.

Pursuant to Article 21 CPCA, when determining whether a request for a precautionary measure is warranted, the judge must verify that the claim in the merits proceeding is not reckless or manifestly lacking in seriousness. This constitutes a preliminary assessment of the merits to determine whether the matter presents what legal scholarship and case law have termed a likelihood of success on the merits, or fumus boni iuris. In addition, the same Article 21 of the Code provides that a precautionary measure is warranted when the execution or continuation of the conduct challenged in the proceeding causes serious actual or potential damage or injury. Legal scholarship has defined this situation as periculum in mora, or risk posed by delay—that is, when the pathological delay inherent in judicial proceedings creates a present, real, and objective danger that the moving party will suffer serious harm (Jinesta Lobo, Ernesto.

Manual del Proceso Contencioso-Administrativo. 1 ed. San José, Costa Rica, Editorial Jurídica Continental, 2008). Finally, Article 22 CPCA establishes the judge’s obligation, in light of the principle of proportionality, to balance the interests at stake—that is, the private party’s circumstances, on the one hand, against the public interest and the interests of third parties that may be affected by the adoption of the precautionary measure, on the other. Only when all three elements are present—namely, a likelihood of success on the merits, a risk posed by delay, and a determination from the balancing of interests that the harm suffered by the private party must be protected above the other interests at stake—may the Court grant the requested precautionary measure.

V. ANALYSIS OF THE SPECIFIC CASE

In the matter at hand, the plaintiff seeks the following precautionary measure:

The correction made by the plaintiff concerning the official communication it seeks to have stayed is noted, in the sense that the official communication whose stay is requested is number R-CU-519-17- DEL 29 DE SETIEMBRE DE 2017. To determine whether granting a precautionary measure is warranted, the requirements that it must satisfy must be analyzed, along with the preliminary characteristics it must possess, namely provisionality (provisionalidad) and instrumentality. As to instrumentality, precautionary proceedings (proceso cautelar) are not autonomous; they are always linked to a principal proceeding, which they serve by safeguarding the effectiveness of its outcome. Provisionality, in turn, means that the effects of precautionary measures are temporary and remain in place until the judgment issued in the principal proceeding becomes final. As to the likelihood of success on the merits, which is analyzed under the parameters set forth in the CPCA—that is, whether the claim is not reckless or manifestly lacking in seriousness—the claim in this specific case consists of the following:

A review of the record and of the decision whose stay is requested, issued by the Unidad de Control Urbano de la Municipalidad de Desamparados and appearing at image 46 of the electronic case file, shows that it is an official communication that DENIES THE CONSTRUCTION-PERMIT APPLICATION submitted by CONTINENTAL TOWERS SRL. It states that certain requirements have not been met, including the authorization and identity cards of the owners of rights CED19082, and that environmental approval (viabilidad ambiental) was likewise not submitted for the proposed construction. The official communication refers to an opinion issued by the Procuraduría General de la República concerning the environmental-approval requirement, which concludes that the procedure under Article 93 of the Ley de Construcciones presupposes that the granting of a municipal license, in the case of structures erected without first obtaining one, is subject to compliance with the requirements established by the applicable regulations, and that such compliance therefore cannot be waived. Article 93 provides:

Article 93.- When a building, structure, or installation has been completed without a license or a project approved by the Municipalidad, and without notice of completion of the work having been given to it, an investigation shall be opened, granting the owner a non-extendable period of thirty (30) days to comply with the provisions of this Law and its Regulations by submitting the project, license application, etc.

In the plenary proceeding (proceso de conocimiento), the plaintiff seeks a declaration of nullity (declaratoria de nulidad) of a series of official communications (oficios), including the one whose suspension is sought. In this judge’s opinion, the nullity of administrative acts (actos administrativos) and incidental damages may be sought in this jurisdiction, pursuant to Articles 36 and 42 of the CPCA. The plaintiff has not established that it has a construction permit for the towers, but neither has the respondent municipality shown that it granted a period for compliance as established in Article 93 cited supra. Therefore, in principle, the action is not considered frivolous, and thus, at least preliminarily, there is a likelihood of success on the merits (apariencia de buen derecho). Under the terms of Article 21 of the CPCA, it must be established that the implementation or continuation of the administrative conduct at issue in the proceeding would cause serious, actual, or potential harm or loss to the petitioner’s legal position.

This judge considers that demolition of the tower, as argued by the plaintiff, would entail a high financial cost, as would its reconstruction, in addition to the agreements entered into and obligations undertaken. With respect to the particular harm, the plaintiff alleges that the company maintains a series of agreements with third parties that would be directly affected, and submits a CPA certification establishing the lease agreement for the property on which the tower is located, together with its contractual relationships with the telecommunications operators CLARO AND TELEFÓNICA, to whom substantial monthly rent is paid, THE COSTS OF DEMOLISHING THE TOWER (IMAGES 25 26), WHICH AMOUNT TO $250.304 DOLLARS. Specifically, they allege the following regarding the harm (image 17):

With respect to the balancing of interests (ponderación de intereses), the plaintiff contends that denial of the interim relief (medida cautelar) would cause harm to the company and users, since, when balancing the interests at stake, demolition of the tower would affect THE PUBLIC TELECOMMUNICATIONS SERVICE, with the greater impact falling on users. Therefore, granting the requested relief would not place any general interest at risk; on the contrary, it would protect the interests of the majority by allowing telecommunications service to be provided. CONSEQUENTLY, BASED ON THE REVIEW OF THE RECORD, IT IS DEEMED APPROPRIATE TO GRANT THE REQUESTED INTERIM RELIEF.

POR TANTO

The present application for interim relief filed by CONTINENTAL TOWERS SRL AGAINST THE MUNICIPALIDAD DE DESAMPARADOS is GRANTED, and the immediate suspension of official communication R-CU-519 DATED 29 DE SETIEMBRE DE 2017 is ordered. Consequently, consequently, the Municipalidad de Desamparados is ordered to refrain from demolishing the telecommunications tower until this proceeding has concluded by a final judgment (sentencia en firme). CONSIDERANDO

I.DE PREVIO Se procederá a resolver la medida cautelar peticionada por la parte actora en los términos presentados con la interposición de la demanda y la subsanación remitida al momento de la prevención. Todas las argumentaciones y prueba ofrecida en alzada, no es prueba del a quo. Por lo que, argumentos de fondo, subsanes o prueba de la parte promovente esbozadas ante el ad quem no constituyen argumentos ni prueba a analizar por esta juzgadora. Es obligación de la parte promovente ser clara en su pretensión cautelar, siendo que la medida cautelar debe ser puntual y el onus probandi es de la parte. No es obligación del juez presumir cual o cuales actos pretende suspender la parte, por lo que el análisis será restrictivo a los actos cuya suspensión se pretende expresamente. En consecuencia, se analizará la medida cautelar en los términos planteados por la parte ante esta instancia el 30 de setiembre de 2019 y el 18 de noviembre de 2019 en el Legajo de Medida Cautelar, considerando que este es un proceso sumario y no plenario y que el derecho de fondo se conocerá en el proceso de conocimiento. En otro orden de ideas, en virtud del principio de independencia judicial, lo que se haya resuelto en otro expediente no prejuzga, toda vez que los elementos fácticos y de derecho, así como el análisis del juzgador es independiente.

II. DE TRÁMITE

1. Mediante memorial del del 30 de setiembre de 2019, se interpuso proceso de conocimiento con medida cautelar.

2.Mediante providencia de las quince horas y tres minutos del catorce de noviembre de dos mil diecinueve, se le previno a la actora presentar copia de la resolución R-CU-522-17- DEL 29 DE SETIEMBRE DE 2017.

3.Mediante memorial del 18 de noviembre de 2019, indica la parte actora que por error material se pidió suspensión de resolución R-CU-522-17- DEL 29 DE SETIEMBRE DE 2017, siendo lo correcto, R-CU-519-17- DEL 29 DE SETIEMBRE DE 2017.

4. Mediante providencia de las nueve horas y quince minutos del dos de diciembre de dos mil diecinueve, se dio audiencia a la parte sobre resolución aportada.

5. La Municipalidad de Desamparados no atendió la audiencia concedida supra.

6. Mediante resolución número 2066-2019 de las trece horas y cincuenta minutos del catorce de noviembre de dos mil diecinueve, se rechazó medida cautelar peticionada.

7. Mediante resolución 250 de las 14:00 horas del 30 de abril de 2020, se anuló resolución del a quo por parte del Tribunal de Apelaciones.

III. PRETENSIÓN Y ARGUMENTOS DE LA PARTE PROMOVENTE

En lo conducente, pretende la parte actora como medida cautelar (imagen 31):

Se toma nota de la rectificación que hizo la actora respecto del oficio que pretende suspender, el sentido de que el oficio cuya suspensión se pretende es el número R-CU-519-17- DEL 29 DE SETIEMBRE DE 2017.Argumenta la actora para la adopción de la medida que la destrucción de la torre de telecomunicaciones tiene consecuencias irreversibles y gravísimas, por ser una demolición de obra civil. Respecto de la apariencia de buen derecho, aduce la parte que según el artículo 74 de la Ley de la ARESEP se declara de interés público el establecimiento, instalación, ampliación, renovación y operación de redes públicas de telecomunicaciones y que la Sala Constitucional en el Voto 15763-2011 dispuso que los intereses de las Municipalidades no pueden anteponerse al interés público de la infraestructura de telecomunicaciones. Argumenta además que, la torre construida no provoca daño al ambiente ni vulnera normas urbanísticas de altura o retiros.

Respecto del peligro en la demora, refieren el alto costo de construir o demoler una torre de telecomunicaciones, aunado al daño a los usuarios del servicio. Respecto del daño particular, alega el actor que la empresa mantiene una serie de contratos con terceros que se verían directamente afectados, aportando certificación de CPA en el que acredita contrato de arrendamiento del inmueble donde se ubica la torre aunado a las relaciones contractuales con los operadores de telecomunicaciones: CLARO Y TELEFÓNICA, a quienes se les paga una renta mensual considerable. En concreto alegan respecto del daño (imagen 17):

Respecto de la ponderación de intereses, aduce el actor que el rechazo de la medida causaría un perjuicio para la empresa y los usuarios.

ARGUMENTOS DE LA MUNICIPALIDAD DE DESAMPARADOS: Por su parte, la entidad demandada al atender la audiencia concedida manifestó que no hay una actuación o acto administrativo que haya dispuesto el derribo de la torre indicada, sino que lo que existe en un rechazo a un permiso de construcción. Asimismo, aducen que los hechos de la demanda carecen de conexidad con la medida y se echa de menos una orden de demolición, siendo que la medida cautelar entonces incumple con el requisito de instrumentalidad.

IV. LOS PRESUPUESTOS PARA LA ACEPTACIÓN DE UNA MEDIDA CAUTELAR

Tal y como ha sido desarrollado por la Sala Constitucional, la justicia cautelar responde a la necesidad de garantizar el principio constitucional de una justicia pronta y cumplida, al conservar las condiciones reales indispensables para la emisión y ejecución de la sentencia (Resolución 7190-1994, de las 15:24 horas del 6 de diciembre). En este mismo sentido, el artículo 19 del CPCA establece que el fin de la fijación de una medida cautelar es proteger y garantizar, provisionalmente el objeto del proceso y la efectividad de la sentencia. La doctrina ha indicado que la justicia cautelar no tiene como fin declarar un hecho o una responsabilidad, ni la de constituir una relación jurídica, ni ejecutar un mandato y satisfacer el derecho que se tiene sin ser discutido, ni dirimir un litigio, sino prevenir los daños que el litigio pueda acarrear o que puedan derivarse de una situación anormal (Gallegos Fedriani, Nombre41.

Las medidas cautelares contra la Administración Pública. 2 ed. Buenos Aires, Argentina: Ábaco, 2006). De conformidad con el artículo 21 CPCA, el juez, a la hora de determinar la procedencia de una solicitud de medida cautelar, debe verificar que la pretensión del proceso de conocimiento no sea temeraria o, en forma palmaria, carente de seriedad, lo que constituye una valoración preliminar del fondo para determinar si existe en el caso en cuestión lo que la doctrina y la jurisprudencia han llamado apariencia de buen derecho o fumus boni iuris. Por otro lado, el mismo numeral 21 del Código establece la procedencia de la medida cautelar cuando la ejecución o permanencia de la conducta sometida a proceso produzca graves daños o perjuicios, actuales o potenciales, situación que ha sido definida en la doctrina como el periculum en mora o peligro en la demora, es decir, que en virtud de la demora patológica del proceso judicial, concurra un peligro actual, real y objetivo de que se genere a la parte promovente un daño grave (Jinesta Lobo, Ernesto.

Manual del Proceso Contencioso-Administrativo. 1 ed. San José, Costa Rica, Editorial Jurídica Continental, 2008). Por último, el artículo 22 CPCA establece la obligación del juzgador de realizar, a la luz del principio de proporcionalidad, una ponderación de los intereses en juego, es decir, entre la circunstancia del particular, por un lado y el interés público y los intereses de terceros que puedan verse afectados con la adopción de la medida cautelar, por el otro. Sólo en la concurrencia de los tres elementos, es decir, de la apariencia de buen derecho, del peligro en la demora y que del análisis de la ponderación de intereses se considere que daño sufrido por el particular debe tutelarse por encima de los demás intereses en juego, puede proceder el Despacho a conceder la medida cautelar solicitada.

V. ANÁLISIS DEL CASO CONCRETO

En en el caso de marras, la actora pretende como medida cautelar que:

Se toma nota de la rectificación que hizo la actora respecto del oficio que pretende suspender, el sentido de que el oficio cuya suspensión se pretende es el número R-CU-519-17- DEL 29 DE SETIEMBRE DE 2017. Para valorar la procedencia o no del otorgamiento de una medida cautelar, deben analizarse los presupuestos que debe cumplir la misma; y de previo las características que debe cumplir como lo son la provisionalidad e instrumentalidad. Respecto de la instrumentalidad, se tiene que el proceso cautelar no es autónomo, por lo que siempre va vinculado a un proceso principal, al que sirve, garantizando la efectividad de su resultado. La provisionalidad, por su parte, hace referencia a que los efectos de las medidas cautelares son temporales, se mantienen hasta que adquiera firmeza la sentencia dictada en el proceso principal. En cuanto a la apariencia de buen derecho, la cual se analiza según los parámetros contenidos en el CPCA, es decir, que la pretensión no sea temeraria o en forma palmaria carente de seriedad, la cual en el caso concreto consiste en:

De una revisión de los autos y de la resolución cuya suspensión se pretende dictada por la Unidad de Control Urbano de la Municipalidad de Desamparados, visible a imagen 46 del expediente electrónico, se desprende que la misma constituye un oficio que RECHAZA LA SOLICITUD DE PERMISO DE CONSTRUCCIÓN para la empresa CONTINENTAL TOWERS SRL, en el que se indica que no cuenta con ciertos requisitos como la autorización y cédula de identidad de los propietarios de los derechos CED19082 y donde indica que tampoco aportó la viabilidad ambiental, para la construcción solicitada. Remite dicho oficio a criterio rendido por la Procuraduría General de la República respecto del requerimiento de viabilidad ambienta donde concluye que el procedimiento del artículo 93 de la Ley de Construcciones presupone que el otorgamiento de la licencia municipal, en caso de construcciones levantadas sin haberlo obtenido previamente está sujeta al cumplimiento de requisitos que la normativa establece, por lo que no se puede obviar su cumplimiento. El artículo 93 establece:

Artículo 93.- Cuando un edificio o construcción o instalación ha sido terminado sin licencia ni proyecto aprobado por la Municipalidad y sin que se haya dado aviso a ésta de la terminación de la obra, se levantará una información, fijando al propietario un plazo improrrogable de treinta (30) días, para que dé cumplimiento a lo estatuido en esta Ley y Reglamento, presentando el proyecto, solicitud de licencia, etc.

En el proceso de conocimiento pretende la declaratoria de nulidad de una serie de oficios, dentro de los cuales se encuentra el que pretende suspenderse. En criterio de esta juzgadora, se puede solicitar en esta jurisdicción la nulidad de actos administrativos y los daños y perjuicios accesorios, según artículo 36 y 42 CPCA, la actora no ha acreditado que cuente con permiso de construcción de las torres, pero tampoco ha demostrado la municipalidad recurrida que haya otorgado plazo para cumplir según lo establece el artículo 93 indicado supra. Por lo que, en principio la demanda no se considera temeraria, concurriendo así al menos preliminarmente, la apariencia de buen derecho. En los términos del artículo 21 CPCA, se establece que la ejecución o permanencia de la conducta administrativa sometida al proceso produzca daños o perjuicios graves, actuales o potenciales, en la situación jurídica del promovente.

Estima esta juzgadora que la demolición de la torre, según lo argumentado por la actora, implicaría un alto costo económico, igual que su reconstrucción, aunado a los contratos suscritos y compromisos adquiridos. Respecto del daño particular, alega el actor que la empresa mantiene una serie de contratos con terceros que se verían directamente afectados, aportando certificación de CPA en el que acredita contrato de arrendamiento del inmueble donde se ubica la torre aunado a las relaciones contractuales con los operadores de telecomunicaciones: CLARO Y TELEFÓNICA, a quienes se les paga una renta mensual considerable LOS GASTOS DE DEMOLICION DE LA TORRE (IMÁGENES 25 26), LOS CUALES ASCIENDEN A $250.304 DOLARES. En concreto alegan respecto del daño (imagen 17):

Respecto de la ponderación de intereses, aduce el actor que el rechazo de la medida causaría un perjuicio para la empresa y los usuarios, siendo que ante una ponderación de los intereses en juego, la demolición de la torre afectaría EL SERVICIO PÚBLICO DE TELECOMUNICACIONES, siendo la afectación mayor a los usuarios. Por lo que, acoger la medida peticionada, no pone en riesgo ningún interés general, por el contrario, protege el interés de la mayoría al permitir proveer el servicio de telecomunicaciones. EN CONSECUENCIA, SOBRE LA BASE DEL ANÁLISIS DE LOS AUTOS SE ESTIMA PROCEDENTE ACOGER LA MEDIDA CAUTELAR PETICIONADA.

POR TANTO

Se ACOGE la presente solicitud de medida cautelar interpuesta por CONTINENTAL TOWERS SRL CONTRA LA MUNICIPALIDAD DE DESAMPARADOS y se dispone la suspensión inmediata del oficio R-CU-519 DEL 29 DE SETIEMBRE DE 2017. En consecuencia, en consecuencia se ordena a la Municipalidad de Desamparados abstenerse de demoler la torre de telecomunicaciones hasta tanto no finalice por sentencia en firme el presente proceso.
