San Ramón, at fifteen hours and twenty-five minutes on ocho de mayo de dos mil veinte.

APPEAL OF JUDGMENT filed in the present proceeding brought against [Nombre1], a Costa Rican national, identity document number CED1, for the offenses of USURPATION AND VIOLATION OF THE LEY FORESTAL, to the detriment of [Nombre2] AND NATURAL RESOURCES. Judges Francisco Lemus Víquez, Adriana Escalante Moncada, and [Nombre2] Alberto Rojas Chacón participated in deciding the appeal. The defendant, [Nombre1], and Criminal Prosecutor Ileana Bolaños Cubillo appeared in the appeal proceedings.

BACKGROUND:

  1. 1By judgment number 2018-00873, issued at ten hours on nueve de noviembre de dos mil dieciocho, the Trial Court of the Second Judicial Circuit of Alajuela, Ciudad Quesada, ruled: “POR TANTO: In accordance with the rules of sound judicial reasoning (sana crítica) and Articles 35, 39, 41, and 50 of the Political Constitution of the Republic of Costa Rica; 11 of the Universal Declaration of Human Rights; 8 of the American Convention on Human Rights; 1, 2, 4, 11, 18 to 20, 30, 31, 45, 50, 51 to 53, 59 to 63, 71 et seq., 75 et seq., and 225 of the Criminal Code; 3, 58 subsections a and b, 61 subsections a and c, and 62 of the Ley Forestal; 1 to 8, 75 et seq., 341, 360 to 365, and 367 of the Code of Criminal Procedure; Decreto Ejecutivo 32493-J, published in La Gaceta No. 150 on viernes 05 de agosto de 2005, in finally adjudicating the present case, the Court DECIDES: Pursuant to the cited provisions, the objections alleging lack of standing to sue, standing to be sued, and environmental standing (falta de legitimación activa, pasiva y ambiental), raised by [Nombre3], are denied; consequently, the accused, [Nombre1], is found to be the sole responsible perpetrator of ONE OFFENSE OF USURPATION AND THREE OFFENSES OF VIOLATION OF THE LEY FORESTAL, IN THE FORMS OF ENCROACHMENT UPON PROTECTED AREAS, the first; UNLAWFUL HARVESTING OF FOREST PRODUCTS AND LAND-USE CHANGE (CAMBIO DE USO DE SUELO), the second; AND CONSTRUCTION OF ROADS OR TRAILS ON FOREST LAND, the third, committed in a MATERIAL CONCURRENCE OF OFFENSES (CONCURSO MATERIAL), to the detriment of [Nombre2] AND NATURAL RESOURCES.For those acts, the following terms of imprisonment are imposed: SIX MONTHS FOR THE FIRST, THREE MONTHS FOR THE SECOND, ONE MONTH FOR THE THIRD, AND ONE YEAR FOR THE FOURTH, FOR A TOTAL OF ONE YEAR AND TEN MONTHS’ IMPRISONMENT, to be served at the place and in the manner prescribed by prison laws and regulations, with credit for any time spent in pretrial detention. Because the accused meets the statutory requirements, he is granted the BENEFIT OF A CONDITIONALLY SUSPENDED SENTENCE (BENEFICIO DE EJECUCIÓN CONDICIONAL DE LA PENA) for a probationary period of THREE YEARS, and he is advised that this benefit shall be revoked if, during that period, he commits a new intentional offense punishable by more than six months’ imprisonment. Once this judgment becomes final, it shall be entered in the Judicial Registry, and certified copies of the relevant records shall be forwarded to the Sentence Enforcement Court and the Instituto Nacional de Criminología.The convicted person is ordered to pay the attorney’s fees and procedural costs of this matter; for that purpose, attorney’s fees are prudently set at one million colones. Procedural costs shall be determined during the judgment-enforcement phase. Notice shall be given by reading. Luis F. Calderón Ugarte. Adjudicator.”
  2. 2The defendant, [Nombre1], filed an appeal of judgment against the foregoing ruling.
  3. 3Following the corresponding deliberation, in accordance with Article 465 of the Code of Criminal Procedure, the Sentence Appeals Court of the Third Judicial Circuit of Alajuela, San Ramón, proceeded to hear the appeal.
  4. 4The relevant statutory requirements have been observed throughout the proceedings.

Sentence Appeals Judge Lemus Víquez authors this decision; and,

CONSIDERING:

I.The defendant, [Nombre1], exercising his right to conduct his own defense (defensa material) and represented by Lic. [Nombre4] Moreira González, files an appeal of judgment against decision number 2018-000873, issued by the Trial Court of Ciudad Quesada, San Carlos, at 10:00 hours on 09 de noviembre de 2018, which convicted him of one offense of usurpation and three offenses of violating the Ley Forestal and imposed a total sentence of one year and ten months’ imprisonment with the benefit of a conditionally suspended sentence.

II.In a first ground for appeal (agravio), the appellant alleges a violation of due process, the principle of legality, and the presumption of innocence, because the private criminal complaint (querella) filed by the private complainant (querellante) does not meet the formal requirements established in arts. 74 and 303 of the Code of Criminal Procedure (Código Procesal Penal), since it does not provide a precise and detailed account of the alleged criminal acts, cite the applicable legal provisions, or state the legal classification assigned to the eight acts, expressly omitting formal requirements that cannot be cured, pursuant to art. 15 of the CPP. He maintains that the private criminal complaint was based on entirely false allegations and that even the prosecutor requested a final dismissal (sobreseimiento definitivo) because the offense of unlawful dispossession (usurpación) did not exist, but rather there had been an error on his part due to lack of criminal intent (dolo); and, regarding the offense of Violation of the Ley Forestal, it was not established who committed the act, contrary to what the private criminal complaint states and what the challenged judgment unlawfully upheld.

He further argues that the private complainant is not, in fact, an injured party in this matter because he lacks “standing on the merits (legitimidad ad causam)” and because the reported incident is untrue. He also asserts a lack of statutory definition as an offense (tipicidad), supporting his assertion with extensive citations to domestic and foreign criminal-law scholarship. He contends that the private criminal complaint does not actually charge him with any offense, since he has not engaged in conduct that is statutorily defined as an offense, unlawful, culpable, and intentional. He emphasizes that his actions resulted from an error arising from his victory in the agrarian proceeding based on the same grounds as this criminal case, and that section 34 of the CP provides that a person who acts under a mistake is not culpable. He considers the private criminal complaint illegitimate and contends that it should have been dismissed as inadmissible or that a final dismissal should have been entered in his favor.

He concludes that the challenged judgment lacks an adequate statement of reasons and is tainted by an absolute procedural defect because it is based on an unlawful private criminal complaint. Accordingly, he requests that the judgment be vacated and that he be acquitted of all punishment and liability or, alternatively, that a retrial be ordered. As a second ground for appeal, he invokes a violation of the rules of reasoned judicial evaluation (sana crítica racional) and due process, pursuant to arts. 11, 33, 39 and 41 of the Political Constitution (Constitución Política); 180, 181, 182 and 184 of the Code of Criminal Procedure, as well as extensive citations to constitutional case law and legal scholarship on due process and the assessment of evidence. He argues that the judgment’s assessment concerned evidence that could not rationally produce certainty; referred to a fact contrary to common experience; arbitrarily analyzed an item of evidence; and employed evidentiary reasoning that demonstrated something different from what was found.

He adds that the judgment violated the Constitution and the American Convention on Human Rights because it failed to consider that no evidence exists implicating him in the offense of criminal defamation (calumnia) with which he was charged. For those reasons, he considers that a judgment of acquittal should have been entered in his favor under the in dubio pro reo principle, since there is no evidence that he committed the offenses of which he was convicted, as the representative of the Public Prosecution Service (Ministerio Público) correctly stated. He requests that the appeal be granted, that the judgment be declared absolutely null and void, and that he be acquitted of all punishment and liability or, alternatively, that a retrial be ordered. As a third ground for appeal, he alleges a violation of arts. 11, 33, 39 and 41 of the Political Constitution and the corresponding provisions of the Code of Criminal Procedure; 162-165 and 168 of the Organic Law of the Judiciary (Ley Orgánica del Poder Judicial); and 13, 287, 457, 458, 459, 461, 464 and 466 of the repealed Code of Civil Procedure (Código Procesal Civil).

He states that, as the prosecutor correctly indicated at the hearing when requesting a final dismissal, the offense of unlawful dispossession did not exist, but rather there had been an error on his part due to lack of criminal intent; and that, regarding the offense of Violation of the Ley Forestal, it was not established who committed the act, bearing in mind that the ordinary agrarian action concerning the same facts was dismissed by the Agrarian Court (Juzgado Agrario) and that dismissal was affirmed by the Agrarian Tribunal (Tribunal Agrario); consequently, there is substantive res judicata (cosa juzgada material). He argues that the private complainant should have pursued summary possessory proceedings (vía interdictal) by filing a possessory injunction (interdicto) for protection of possession, restitution, and replacement of boundary markers, since all he did was replace the adjoining fence’s living posts with dead posts.

However, because the time limit for filing the possessory injunction had expired (art. 458 del CPC), the private complainant should then have pursued declaratory proceedings (vía declarativa) (art. 287 del CPC), and never criminal proceedings, because no offense existed. He contends that the facts alleged in the private criminal complaint concern a land dispute governed by articles 364 to 382 of the Civil Code (Código Civil), regarding possession, usufruct, transformation and disposition, defense and exclusion, and restitution and compensation, which is being confused with art. 225 del CP, since the private criminal complaint does not clearly state what the violence, threat, deception, or total or partial dispossession of the property right consisted of; nor does it describe the acts of invading and taking possession of the disputed land, which he had even inherited; likewise, it does not state the land’s actual area or its boundaries.

He states that the disputed property was used for agriculture and livestock farming for many years by his father and brothers until his father died. He states that his father acquired the property in 1958 and owned it until 04 de junio de 2003, the date on which he acquired it pursuant to a deed executed before notary Miguel Vargas Araya in Ciudad Quesada. He asserts that the property was invaded using survey plats that overlapped the plat of the property registered in Alajuela under registration number [Placa1], which belongs to him, and on the basis of false deeds, by Mr. [Nombre2], in his capacity as President, vested with the powers of a general plenipotentiary attorney-in-fact without limitation as to amount, of the corporation known as Praderas Doradas de Betania S.A; and by attorney William Rodríguez Acuña, counsel for Mr. [Nombre2], who advised him in all acts of unlawful dispossession carried out on his property, thereby appropriating nearly the entire property as squatters (precaristas).

In his view, the legal dispute must be addressed in declaratory rather than criminal proceedings, and the objection of lack of subject-matter jurisdiction should therefore have been granted. On those grounds, he requests that the appeal be granted, that the challenged judgment be vacated, and that he be acquitted of all punishment and liability or, alternatively, that the case be remanded for retrial. Because the grounds asserted are repetitive and intermingled, they are resolved jointly in the interest of procedural economy and to avoid unnecessary repetition, and are denied. In general, the appellant contends that the trial judgment is illegitimate because it violates due process. Specifically, he argues that (i) it was based on an inadmissible private criminal complaint that failed to meet the legal formalities; (ii) the private complainant lacks standing to bring the action (legitimación activa); (iii) the underlying dispute is civil rather than criminal in nature, and lack of subject-matter jurisdiction should therefore have been declared; (iv) the disputed facts were already adjudicated in agrarian proceedings, resulting in substantive res judicata, and he committed no offense because he acted under a mistake of law (error de prohibición); and (v) moreover, he is not culpable because he was neither charged with nor shown to have committed any offense, and the rules of reasoned judicial evaluation were disregarded in assessing the evidence.

Nevertheless, for the reasons stated below, none of the assertions raised can be accepted. It must first be noted that the argumentative technique underlying the claims is highly general and poorly substantiated; that is, it does not identify the portions of the judgment’s analysis alleged to be erroneous or invalid. Instead, it describes the issues or matters debated and disagrees with how they were resolved, while avoiding the judgment’s specific reasons for its decision. In any event, addressing the claims in order, (i) a review of the judgment does not show that it was based on an inadmissible private criminal complaint that failed to meet the legal formalities. To begin with, this is an issue that the appellant challenged at trial and that the court rejected in its judgment, finding: “That issue was also finally resolved not only in the rulings issued at the preliminary hearing concerning this matter, but also at the outset of the aforementioned adversarial proceeding; therefore, nothing further need be decided in that regard.

Notwithstanding the foregoing, it should be stated that this Judge reviewed the aforementioned filing and found no defect or omission therein; on the contrary, it fully and clearly complies with the cited statutory requirements.” According to the appellant, the private criminal complaint did not clearly, precisely, and fully describe the alleged criminal acts—for example, what the violence, threat, deception, or total or partial dispossession of the property right consisted of; nor the acts of invading and taking possession of the disputed land, its actual area, or its boundaries. The claim is unfounded. The private criminal complaint’s statement of facts reads: «FIRST: My client, Mr. [Nombre2], is the owner and possessor of the property registered in Alajuela under registration number CED2CED3, which is described as follows: Land for agriculture, forest, and pasture, located in Betania, District of San Rafael, canton of Guatuso, province of Alajuela, with an area of 29 hectares 4865,31 square meters, as depicted on survey plat A 719991-2001.

According to the National Registry (Registro Nacional), its boundaries are: North: Quebrada Timacar and [Nombre5]; South: [Nombre6] and [Nombre7]; East: [Nombre2]; West: [Nombre8] and Quebrada Timacar. Most of this property is used as pasture for livestock; it also contains a forested area with several springs (nacientes de agua), and this forested area has been conserved and protected. SECOND: Along its southeastern side, the actual boundary of my client’s property adjoins land possessed by the Accused Private Defendant (Querellado), between [Dirección1], in accordance with survey plat A-719991-2001; since my client acquired that property in 2001, fences have existed between the two parcels, clearly demarcating both properties. THIRD: The acts of possession exercised over time by my client on the land have related to livestock farming, namely, clearing pastures, cutting brush, improving fences, raising and maintaining breeding and dairy cattle, and conserving and protecting the forested area; all of these activities have been carried out by his farmworkers and by him personally.

FOURTH: On 21 de enero de 2011, the caretaker of my client’s property, [Nombre9], observed [Nombre3], accompanied by several of his workers, unlawfully entering and taking complete possession of the land described in the first paragraph for the purpose of dispossessing my client of the possession he had been exercising over it. To that end, he removed the fence that existed along the eastern side of the property for a distance of approximately three hundred fifty meters and, for the purpose of annexing that land to the property that Mr. [Nombre1] is acknowledged to possess, as stated in the second paragraph, began erecting a fence running in the direction of [Dirección2], with an approximate length of three kilometers. FIFTH: From that moment onward, the cattle owned by my client and kept on the land in question were expelled by the Accused Private Defendant. Furthermore, to retain the possession he unlawfully assumed, through threats made against Mr. [Nombre2]’s workers, he prevented them from performing their work or even entering the land; on at least 26 y 27 de enero de 2011, two confrontations occurred between Mr. [Nombre1] and his workers, on the one hand, and Mr. [Nombre9] and other farmworkers, on the other, during which the latter were threatened and intimidated, clearly involving the use of violence.

SIXTH: Without specifying the exact date, but between the month of March and the first days of the month of April 2011, Mr. [Nombre3], while unlawfully remaining on my client’s property and as part of his acts of dispossession (desposesión), and lacking the authorizations and permits required from the competent MINAET authorities, brought in a crawler tractor and proceeded to direct the opening, within the property, of a trail or internal road measuring four meters wide by nine hundred forty meters long, oriented [Dirección3] - , crossing three streams and encroaching upon a forested area that my client had preserved until then. SEVENTH: Through this work, Mr. [Nombre3] caused a series of environmental and property-related damages, as follows: 1. Ordering the removal of 18 Laurel trees; two Gallinazos, one Yema de huevo, 3 Papayos de Montaña; and one Chilamate; all with diameters ranging from 20 to 35 centimeters, which were uprooted using a crawler tractor; he lacked State permits and my client’s authorization for that action. 2.

He obstructed the water flow of three streams by piling up logs of various species—the same ones he had uprooted—and by placing soil produced by the earthworks (movimiento de tierra) generated in opening the trail, all for the purpose of constructing bridges and/or (sic) crossings to connect pastures. 3. One of the streams was blocked with the intention of raising the water level so that, through the use of a channel that was constructed, a recently built basin could be filled on the land that the Accused Private Respondent (Querellado) was recognized as having possessed before the events. 4. Sedimentation of the streams due to erosion of the material removed for construction of the trail. 5. Opening a road approximately two hundred meters long within the forested area, thereby removing the understory (sotobosque) and affecting an area of half a hectare. The purpose of this road was to connect the property known to have been held by Mr. [Nombre1] with the property he usurped from my client.

This set of damages was valued, through appraisal SBM-OB-095-11, from the standpoint of environmental damage, at  1.267.412,64. EIGHTH: Without specifying the exact date, but at the beginning of the month of September 2011, the Accused Private Respondent herein vacated my client’s entire property of his own accord, but did not restore matters to their original condition.” (sic).» (The bold emphasis has been supplied). A simple reading confirms that the private criminal complaint (querella) did specify when, where, and how [Nombre3] perpetrated the alleged criminal acts, while also describing the characteristics, measurements, and boundaries of the property in dispute. Indeed, the judgment found them proven and, in the section setting forth its legal reasoning (fundamentación jurídica), determined that the conduct attributed to [Nombre3] in the fourth and fifth facts constituted the offense of usurpation (usurpación), defined in section 225 of the Código Penal, while the sixth and seventh facts constituted three offenses under Ley Forestal, in the forms of encroachment upon protective areas (invasión de áreas de protección), unlawful harvesting of forest products (aprovechamiento ilícito de productos forestales), and land-use change (cambio de uso de suelo), as well as construction of roads or trails on forest lands, as provided in arts. 58 subsections a) and b), 61 subsections a) and c), and 62 of Ley Forestal.

Likewise, regarding the manner in which the criminal acts were charged, the judgment reasoned: “Mr. [Nombre4] also asked: Where are the acts of actual possession by [Nombre1] that effected the dispossession: Encroachment, exclusion, expulsion, or continued occupation? It follows from the evidence already analyzed that Mr. [Nombre1] did in fact engage in all those acts, because by moving the boundary fence between the properties possessed by the latter and by Mr. [Nombre2], he dispossessed the latter of a substantial portion of the land he possessed. Mr. [Nombre1] therefore did commit acts of encroachment that entailed the exclusion and even the expulsion of Mr. [Nombre2] and, at least, of his farmhand, Mr. [Nombre9], which in turn entailed the defendant’s continued occupation of the area from which he had dispossessed him, all as found established in the proven facts of this judgment and based on the reliable information obtained from the analysis of all the evidence relating to this matter.” The appellant does not identify any errors in this reasoning, and this Court detects no defects in the statement of reasons that would invalidate it.

(ii) As to the alleged lack of standing (legitimación) of the private complainant (querellante) to bring the criminal action (acción penal), this is a procedural objection (excepción procesal) that was denied in the judgment on the following grounds: “In the present case, Mr. [Nombre2] is the person directly harmed by the dispossession unlawfully caused by Mr. [Nombre1], who in turn ordered and participated in the work that affected the natural resources. Accordingly, the former has the authority to report—and therefore to pursue criminally through a private criminal complaint—in accordance with the provisions of paragraph 2 of article 50 of the Constitución Política, in conjunction with sections 71 and 75 of the Código Procesal Penal. It is therefore concluded that Mr. [Nombre2] has both active and environmental standing (legitimación activa y ambiental) to prosecute both the offense of usurpation adjudicated herein and the alleged violations of Ley Forestal in this matter.

At the same time, the person against whom this private criminal complaint must be directed is precisely the perpetrator responsible for those unlawful acts, namely [Nombre3] [Nombre1] herein, who therefore has passive standing (legitimación pasiva) to be named in these proceedings; consequently, those objections must be denied.” The appellant does not rebut the reasoning presented. In any event, the trial court’s reasoning is sound. In the case at bar (sub júdice), the private complainant had standing to prosecute [Nombre3] criminally for committing offenses under Ley Forestal to the detriment of natural resources, for the simple reason that the proven acts were not perpetrated on State forest land (art. 13 ibídem), but on private forest land (art. 19 ibídem), whose registered owner is the injured party and who was therefore a victim directly affected by the offense under art. 70 subsection a) of the CPP.

Consequently, he could appear as a private complainant and bring the criminal action on his own behalf, independently of any participation by the Ministerio Público or the Procuraduría General de la República, in accordance with arts. 16, 71 subsection g), and 75 of the CPP. (iii) As to the claim that the present matter is civil rather than criminal in nature, the judgment under review rejected it, ruling as follows: “Regarding this Court’s subject-matter jurisdiction (competencia por la materia): Attorney [Nombre4] Moreira González, privately retained defense counsel for defendant [Nombre1] herein, insisted throughout the trial preceding this judgment that the criminal courts lacked jurisdiction over the present matter. That issue was conclusively resolved during the preliminary stage and at the beginning of the adversarial proceedings, since it was clear that the relief sought by the private complainant, Mr. [Nombre2], is a determination that the defendant engaged in acts constituting the offense of usurpation and the offenses provided for in sections 58, 61, and 62 of Ley Forestal and, if so, that the penalty established in those provisions be imposed upon him.

The present matter is plainly a criminal dispute that, for the time being, does not involve civil-law matters such as recovery of ownership (reivindicación), replacement of boundary markers, etc. Accordingly, under subsection 4 of article 96 of the Ley Orgánica del Poder Judicial, this court has full jurisdiction to hear the present matter, as, it bears repeating, had already been conclusively declared in ruling N° 2018-00714, issued by the Sección Segunda del Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela at 10:50 horas on 28 de agosto de 2018 (See file 22/10/2018 08:26:45 in the associated-documents tray of the electronic case file).” Later, the trial judges added: “It must also be made clear that, for purposes of the offense of usurpation—one of the offenses adjudicated in this judgment—issues of ownership are neither relevant nor subject to analysis; only issues concerning possession or mere custody (mera tenencia) of real property are relevant, as expressly stated in article 225 of the Código Penal.” As with the remaining claims, the appellant does not adequately specify why the reasons stated are untenable.

Indeed, this Chamber agrees that the Tribunal Penal de Juicio de Ciudad Quesada was authorized to hear this matter upon a private criminal complaint concerning publicly prosecutable offenses (delitos de acción pública), because, under arts. 45 of the Código Procesal Penal and 96 subsection 1) of the Ley Orgánica del Poder Judicial, it had full subject-matter jurisdiction to conduct the trial. This is so notwithstanding that the property at issue in the criminal dispute was connected to a civil ownership dispute, especially because the “existence of criminal proceedings shall under no circumstances give rise to a preliminary issue requiring prior adjudication (prejudicialidad),” pursuant to art. 34.2 of the Código Procesal Civil, which demonstrates that these are independent proceedings. (iv) The appellant argues that the facts at issue were already adjudicated in the agrarian courts, such that substantive res judicata (cosa juzgada material) exists, and that he committed no offense because he acted under a mistake of law (error de prohibición).

This issue was also resolved in the challenged judgment, which analyzed the relevant matter as follows: “[…] this Court does not accept the theory that any mistake of law, whether direct or indirect, occurred in this case, because during the adversarial proceedings it was not even established—much less proven—what was at issue in the proceeding that gave rise to that purported judgment; nor was the judgment offered into evidence, nor was testimony from the aforementioned legal professional offered. Thus, there is no evidence whatsoever of that mistake, its source, or any other information that could, even on the basis of doubt, support acceptance of that theory. Accordingly, what has been argued, far from assisting the defense, supports the private complainant’s position, because, for the reasons stated, article 34 of the Código Penal is inapplicable. But even assuming solely for the sake of argument that the missing judgment had granted some right to [Nombre3] [Nombre1], Mr. [Nombre1] could not take justice into his own hands (self-help [autotutela]); rather, he was required to resort to judgment-enforcement proceedings (procedimiento de ejecución de sentencia) to be placed in possession of the property he usurped.

Still less could that judgment have granted him any authorization to affect natural resources in the manner found proven in this judgment.” As is clear, the judgment rejected the defense theory of a possible mistake of law arising from a purported judgment in another judicial proceeding, on the ground that the accused private respondent submitted no supporting evidence. The appellant disregards and does not challenge that reasoning, and thus the claim of purported res judicata is plainly unfounded. (v) Finally, the appellant asserts that he is not culpable because he was neither charged with nor proven to have committed any offense, and that the rules of sound judicial assessment (sana crítica) were disregarded in evaluating the evidence. These arguments must be rejected because they amount merely to disagreements based on subjective assessments.

To begin, upon review of the judgment, it is found that the trial judges, after analyzing the testimonial and documentary evidence received at trial, deemed the alleged facts proven and found the accused criminally responsible as the perpetrator of one count of unlawful occupation (usurpación) and three offenses under the Ley Forestal, to the detriment of Natural Resources and the private complainant (querellante), [Nombre2]. Furthermore, the appellant does not identify specific defects in the evidentiary reasoning or legal grounds that would cast doubt on their validity and effectiveness, nor does this Chamber find any fundamental defects or due process violations that would invalidate the judgment. Consequently, by majority vote, the appeal filed by the accused in the exercise of his right to conduct his own defense (defensa material) is denied. Judge Escalante dissents on the issue of the private complainant’s standing (legitimación activa) to pursue criminal proceedings for environmental offenses.

III.Dissenting opinion (voto salvado) of Judge Escalante Moncada. The undersigned respects the view expressed by the other judges; however, I do not share the legal position under which a person is allowed to file a private criminal complaint (querella) for a publicly prosecutable offense (delito de acción pública) in cases where the offense being prosecuted is an environmental offense, by virtue of the legally protected interest (bien jurídico) safeguarded by this category of crime. Although this case does have its particularities, the fact remains that, regarding the issue under discussion and raised by the appellants, concerning [Nombre2]’s lack of standing (legitimación activa) to file a private criminal complaint for publicly prosecutable offenses in order to prosecute crimes defined and punishable under the Ley Forestal, I believe that the appellants are correct, for the following reasons.

In this regard, and insofar as relevant to the resolution of this matter, Article 70 of the Code of Criminal Procedure establishes various categories of victims. The first is described in subsection a), which grants this status to the person directly harmed by the offense; subsection d) grants victim status to associations, foundations, and other registered entities when collective or diffuse interests are affected, provided that the purpose of the organization is directly related to those interests (emphasis added). This definition and classification established by our criminal procedure system is relevant to the resolution of this specific case because, as shown by the facts alleged in the private criminal complaint, there is a series of events described in paragraphs one through five of the private accusation (acusación particular) that constitute the offense of unlawful dispossession (usurpación), for which the injured party, [Nombre2], has proper standing to file a private criminal complaint for a publicly prosecutable offense because he is the person directly harmed by that crime, since the possessory right that was violated belonged to him.

However, in the undersigned judge’s view, the situation is different with respect to the facts described in the private criminal complaint in paragraphs six and seven, which were stated as follows: SIXTH: Without specifying an exact date, but between March and the first days of April 2011, Mr. [Nombre3], while unlawfully remaining on my client’s property and as part of his acts of dispossession, and lacking the authorizations and permits required from the competent MINAET authorities, brought in a crawler tractor and directed the opening of a trail or internal road within the property, measuring four meters wide by nine hundred forty meters long, oriented [Dirección3] - , crossing three streams and encroaching upon an area of forest that my client had preserved until then. SEVENTH: Through this work, Mr. [Nombre3] caused a series of environmental and property damages, as follows: 1. Ordering the removal of 18 Laurel trees; two Gallinazos, one Yema de huevo, 3 Papayos de Montaña; and one Chilamate, all with diameters ranging from 20 to 35 centimeters, which were uprooted using a crawler tractor; he lacked State permits and my client’s authorization to carry out that action. 2.

He obstructed the water flow of three streams by piling logs of various species—the same trees he had uprooted—and placing soil produced by the earthworks (movimiento de tierra) generated by opening the trail, all for the purpose of constructing bridges and/or (sic) crossings to connect pastures. 3. One of the streams was blocked with the intention of raising the water level so that, through the use of a channel that was constructed, a recently built basin could be filled on the land that [Nombre3] was acknowledged to have possessed before the events. 4. Sedimentation of the streams due to erosion of the material removed for construction of the trail. 5. Opening a road approximately two hundred meters long within the forest area, thereby removing the understory and affecting an area of half a hectare. The purpose of this road was to connect the property known to have been held by Mr. [Nombre1] with the property he unlawfully dispossessed from my client.

This set of damages was assessed under appraisal SBM-OB-095-11, from the standpoint of environmental damage, at the sum of 1.267.412,64. EIGHTH: Without specifying an exact date, but in early September 2011, the private complainant herein vacated my client’s entire property on his own initiative but did not restore matters to their original condition.” (sic).» (Bold emphasis added). With respect to this account of the facts, this judge agrees with the legal classification adopted by the lower court, which found that these events constituted three offenses under the Ley Forestal, in the forms of encroachment upon protected areas, unlawful harvesting of forest products, and land-use change (cambio de uso de suelo), as well as the construction of roads or trails on forest land, as defined in arts. 58 subsections a) and b), 61 subsections a) and c), and 62 of the Ley Forestal. The point on which I differ from the majority opinion is that the undersigned believes that, with respect to these facts, Mr. [Nombre2] does not have victim status and therefore lacked standing to file a private criminal complaint for publicly prosecutable offenses, for the following reason.

The legally protected interest underlying forestry offenses is the environment, as shown by a systemic analysis of the following provisions. The second paragraph of Article 50 of the Political Constitution states: “Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek reparation for the damage caused. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties.” At the statutory level, this provision is supplemented by Article 1 of the Organic Environmental Law number 7554, which defines the environment as the system comprising the various natural elements that make it up and their interactions and interrelationships with human beings. Likewise, Article 1 of Ley Forestal number 7575 establishes that the State shall ensure the conservation, protection, and management of natural forests and the production, harvesting, industrialization, and promotion of the country’s forest resources.

Furthermore, regarding environmental protection, the Constitutional Chamber has held that the environment is a diffuse interest (interés difuso) belonging to people generally; that is, it has no single holder, and when environmental damage is committed, the first injured party is an indeterminate group of persons. Another characteristic of this type of legally protected interest is its indivisibility, since it cannot be divided among those who enjoy it. Returning to the case under review, and proceeding from the premise that the offenses contained in the Ley Forestal protect the environment as a legally protected interest and that its defense entails protecting a diffuse interest, the undersigned believes that, under our criminal procedure rules, the legal entities identified in Article 70 subsection d) of the Code of Criminal Procedure, in addition to the State, may appear as victims of this type of offense.

In other words, the Code of Criminal Procedure did not expressly grant an individual the right to conduct a criminal prosecution (persecución penal) for environmental offenses; such prosecution was reserved for the legal entities described in subsection d) of the Code of Criminal Procedure, or for the Public Prosecutor’s Office or the Office of the Attorney General of the Republic, as provided in Article 16 of the Code of Criminal Procedure. I also believe that this position is consistent with Article 38 of the Code of Criminal Procedure, which grants the Office of the Attorney General of the Republic standing to seek damages arising from criminal acts affecting collective or diffuse rights. Another central issue in resolving the matter under discussion is that, as stated in Article 2 of the Code of Criminal Procedure, statutory provisions restricting personal liberty must be interpreted narrowly.

In the undersigned’s view, the filing of a private criminal complaint for a publicly prosecutable offense inherently entails the exercise of criminal prosecution, which is the highest expression of the State’s punitive activity, and its exercise must be rational and proportionate because it carries with it the possibility of restricting the accused person’s liberty. In this regard, in decision number 13820-2014, the Constitutional Chamber stated the following concerning the exercise of the State’s punitive authority: “The Constitution recognizes clear limits on the State’s punitive power, which unquestionably includes prosecutorial authority with all its exceptional powers exercised during criminal proceedings. This is reflected in the prohibition against perpetual, cruel, and inhuman punishments, as provided in Article 40 of the Constitution; moreover, punitive power exercised through the imposition of imprisonment must promote the convicted person’s rehabilitation, as provided in the sixth paragraph of Article Five of the American Convention on Human Rights.

All these cited rules demonstrate that the powers exercised in criminal proceedings require precise limits and may not be exercised without reasonable restriction.” Based on the foregoing constitutional precedent and the provisions previously cited, I believe that an express rule authorizing an individual to institute criminal proceedings (acción penal) for publicly prosecutable environmental offenses is required; an expansive interpretation of the rules to grant such standing to an individual is impermissible, as is a case-by-case interpretation. I must emphasize here that, with respect to any property damages suffered by the injured party, [Nombre2], on his property, he would have standing to bring a civil action (acción civil), as provided in subsection a) of Article 70 of the Code of Criminal Procedure, in relation to Article 37 of the Code of Criminal Procedure, but not to institute criminal proceedings through a private criminal complaint for a publicly prosecutable offense.

In this connection, it should be emphasized that, as the record shows, this matter proceeded to trial solely on the basis of the private criminal complaint filed by [Nombre2], without the participation of the Public Prosecutor’s Office or the Office of the Attorney General of the Republic, hence the significance of the appellants’ claim. For the reasons set forth above, I grant this claim. Consequently, because Mr. [Nombre2] lacks standing to institute criminal prosecution for environmental offenses, the appropriate disposition is to acquit the accused of the three offenses under the Ley Forestal, in the forms of encroachment upon protected areas, unlawful harvesting of forest products, and land-use change, as well as the construction of roads or trails on forest land, as defined in arts. 58 subsections a) and b), 61 subsections a) and c), and 62 of the Ley Forestal.

POR TANTO:

By majority decision, the appeal filed by the accused in the exercise of his personal defense is denied. Judge Escalante dissents on the issue of the private complainant’s standing to institute criminal proceedings for offenses against the environment. Let notice be served.

RECURSO DE APELACIÓN DE SENTENCIA interpuesto en la presente causa seguida contra [Nombre1] , costarricense, documento de identidad número CED1, por el delito de USURPACIÓN E INFRACCIÓN A LA LEY FORESTAL en perjuicio de [Nombre2] Y LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los jueces Francisco Lemus Víquez, Adriana Escalante Moncada y [Nombre2] Alberto Rojas Chacón. Se apersonan en apelación de sentencia, el imputado [Nombre1] y la Procuradora Penal Ileana Bolaños Cubillo.

RESULTANDO:

  1. 1Que mediante sentencia número 2018-00873 de las diez horas del nueve de noviembre de dos mil dieciocho, el Tribunal de Juicio del Segundo Circuito Judicial de Alajuela, Ciudad Quesada, resolvió: "POR TANTO: De conformidad con las reglas de la sana crítica y artículos 35, 39, 41 y 50 de la Constitución Política de la República de Costa Rica, 11 de la Declaración Universal de Derechos Humanos, 8 de la Convención Americana de Derechos Humanos, 1, 2, 4, 11, 18 a 20, 30, 31, 45, 50, 51 a 53, 59 a 63, 71 y siguientes, 75 y siguientes, 225 del Código Penal; 3, 58 incisos a y b, 61 incisos a y c y 62 de la Ley Forestal, 1 a 8, 75 y siguientes, 341, 360 a 365, 367, del Código Procesal Penal; Decreto Ejecutivo 32493-J, publicado en La Gaceta N° 150 del viernes 05 de agosto de 2005, al resolver en definitiva la presente causa, el Tribunal DECIDE: En aplicación de las normas citadas, se rechazan las excepciones de falta de legitimación activa, pasiva y ambiental interpuestas por el [Nombre3] y, en consecuencia, se declara al encartado [Nombre1] , único autor responsable de UN DELITO DE USURPACIÓN Y TRES DELITOS DE INFRACCIÓN A LA LEY FORESTAL, EN SUS MODALIDADES DE INVASIÓN DE ÁREAS DE PROTECCIÓN, el primero, APROVECHAMIENTO ILÍCITO DE PRODUCTOS FORESTALES Y CAMBIO DE USO DE SUELO, el segundo, ASÍ COMO DE CONSTRUCCIÓN DE CAMINOS O TROCHAS EN TERRENOS DE BOSQUE, el tercero, cometidos en CONCURSO MATERIAL, y en perjuicio de [Nombre2] Y DE LOS RECURSOS NATURALES, y por tales hechos se le imponen las siguientes penas de prisión: SEIS MESES POR EL PRIMERO, TRES MESES POR EL SEGUNDO, UN MES POR EL TERCERO Y UN AÑO POR EL CUARTO, PARA UN TOTAL DE UN AÑO Y DIEZ MESES DE PRISIÓN, que deberá descontar en el lugar y forma en que lo determinen las leyes y reglamentos carcelarios, previo abono de la preventiva que hubiere sufrido.En virtud de que el acusado reúne los requisitos de ley, se le confiere el BENEFICIO DE EJECUCIÓN CONDICIONAL DE LA PENA por un perÍodo de prueba de TRES AÑOS, y se le advierte que se le revocará tal gracia, si dentro de ese lapso comete nuevo delito doloso sancionado con pena de prisión mayor a seis meses. Firme esta sentencia se inscribirá en el Registro Judicial y se testimoniarán piezas para ante el Juzgado de Ejecución de la Pena y el Instituto Nacional de Criminología. Se condena a dicho sentenciado a pagar las costas personales y procesales de este asunto y para tal efecto, prudencialmente se fijan los honorarios de abogado, en la suma de un millón de colones. Las procesales se determinaran en la fase de ejecución de sentencia. Notifíquese mediante lectura. Luis F. Calderón Ugarte. Decisor/a".
  2. 2Que contra el anterior pronunciamiento, el imputado [Nombre1] , interpuso recurso de apelación de sentencia.
  3. 3Que verificada la deliberación respectiva, de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal de Apelación de Sentencia del III Circuito Judicial de Alajuela, San Ramón, procedió a conocer del recurso.
  4. 4Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez de Apelación de Sentencia Lemus Víquez; y,

CONSIDERANDO:

I.El imputado [Nombre1] , en ejercicio de su defensa material, y bajo el patrocinio letrado del Lic. [Nombre4] Moreira González, interpone recurso de apelación de sentencia contra la resolución número 2018-000873, dictada por el Tribunal de Juicio de Ciudad Quesada, San Carlos, de las 10:00 horas, del 09 de noviembre de 2018, la cual, lo condenó por un delito de usurpación y tres delitos de infracción a la Ley Forestal, imponiéndole una pena total de un año y diez meses de prisión con beneficio de ejecución condicional.

II.En un primer agravio, el recurrente alega violación al debido proceso, el principio de legalidad y de inocencia, porque la querella presentada por el querellante no cumple con los requisitos formales, previstos en los arts. 74 y 303 del Código Procesal Penal, pues no indica una relación precisa y circunstanciada de los hechos punibles atribuidos, ni la cita de los preceptos jurídicos aplicables, tampoco se menciona la calificación legal otorgada a los ocho hechos, omitiéndose expresamente los requisitos formales no saneables, según el art. 15 del CPP. Sostiene que, la querella se basó en hechos absolutamente falsos, inclusive, el fiscal solicitó un sobreseimiento definitivo, porque no existe un delito de usurpación, sino un error de su parte por falta de dolo, y sobre el delito de Infracción a la Ley Forestal, no se acreditó quién cometió el hecho, contrario a lo que indica la querella y aprobó ilegalmente la sentencia recurrida.

Asimismo, aduce que el querellante no es en realidad ofendido en este asunto, por falta de “legitimidad ad causam”, y porque el hecho denunciado no es cierto. También menciona que existe falta de tipicidad, lo cual apoya en amplias citas de doctrina penal nacional y extranjera. Arremete que la querella no le endilga en realidad delito alguno, puesto que no ha incurrido en una conducta típica, antijurídica, culpable y dolosa. Recalca que su actuación se debió a un error por ganar el proceso agrario originado en los mismos motivos de esta causa penal, y que el numeral 34 del CP dispone que no es culpable quien realiza el hecho en error. Estima que la querella es ilegítima y debió rechazarse por improcedente o dictarse un sobreseimiento definitivo a su favor. Concluye que la sentencia recurrida carece de una debida fundamentación, está viciada de una actividad procesal defectuosa absoluta, en tanto se basa en una querella ilegal.

En virtud de ello, solicita se anule el fallo, y se le absuelva de toda pena y responsabilidad, o bien, se ordene el juicio de reenvío. Como un segundo agravio, invoca violación a las reglas de la sana crítica racional y al debido proceso, con fundamento en los arts. 11, 33, 39 y 41 de la Constitución Política; 180, 181, 182 y 184 del Código Procesal Penal, y amplias citas de jurisprudencia constitucional y doctrina sobre el debido proceso y apreciación de la prueba. Argumenta que la valoración del fallo versó sobre una prueba que racionalmente no es capaz de producir certeza; se refiere a un hecho contrario a la experiencia común; se analiza arbitrariamente un elemento de juicio; y el razonamiento probatorio que se hizo demuestra algo distinto a lo que se estableció. Añade que la sentencia violentó la Carta Magna y la Convención Americana sobre Derechos Humanos porque no analizó que no existe prueba que lo inculpe del delito de calumnia que se le imputó.

Por lo dicho, considera que debió dictarse una absolutoria a su favor, en aplicación del principio in dubio pro reo, pues no existe prueba de que cometiera los delitos por los que fue condenado, como bien lo dijo el representante del Ministerio Público. Solicita que se declare procedente el recurso y se declare la nulidad absoluta de la sentencia, y se le absuelva de toda pena y responsabilidad, o bien, se ordene el juicio de reenvío. En un tercer agravio, alega violación de los arts. 11, 33, 39 y 41 de la Constitución Política, y concordantes del Código Procesal Penal; 162-165 y 168 de la Ley Orgánica del Poder Judicial; 13, 287, 457, 458, 459, 461, 464 y 466 del derogado Código Procesal Civil. Menciona que como bien indicó el fiscal en la audiencia, solicitando el sobreseimiento definitivo, no existe el delito de usurpación, sino un error de su parte por falta de dolo; y sobre el delito de Infracción a la Ley Forestal no se comprobó quién cometió el hecho, teniendo en cuenta que, la demanda ordinaria agraria por los mismos hechos fue declarada sin lugar por el Juzgado Agrario y confirmada por el Tribunal Agrario, por tanto, existe cosa juzgada material.

Aduce que el querellante debió acudir a la vía interdictal a interponer un interdicto de amparo de posesión, restitución y reposición de mojones, pues lo único que hizo él, fue sustituir la cerca colindante de postes vivos por postes muertos. Sin embargo, como el plazo para presentar el interdicto caducó (art. 458 del CPC), debió entonces acudir a la vía declarativa (art. 287 del CPC) y nunca a la vía penal, por no existir delito alguno. Arguye que los hechos de la querella se enmarcan en un problema de tierras donde prevalece la aplicación de los artículos 364 a 382 del Código Civil, en cuanto a la posesión, el usufructo, la transformación y enajenación, la defensa y exclusión y la restitución e indemnización, que se confunde con el art. 225 del CP, pues la querella no indica en forma clara en qué consistió la violencia, la amenaza, engaños, el despojo total o parcial del derecho real; tampoco las acciones de invasión y apoderamiento del terreno que inclusive se heredó a él; igualmente, no se indica cuál es la medida real del terreno y su colindancia.

Menciona que el inmueble en disputa fue explotado en agricultura y ganadería durante muchos años por su padre y sus hermanos, hasta que falleció su papá. Señala que su padre adquirió la finca en 1958 y fue dueño hasta el 04 de junio de 2003, fecha en que él la adquirió, según escritura otorgada ante el notario Miguel Vargas Araya, en Ciudad Quesada. Comenta que dicha propiedad fue invadida con planos traslapados al plano de la finca del partido de Alajuela, matrícula [Placa1], que le pertenece, y con base en escrituras falsas, por el señor [Nombre2] , en su calidad de Presidente con facultades de apoderado generalísimo sin límite de suma de la sociedad denominada Praderas Doradas de Betania S.A; y por el licenciado William Rodríguez Acuña, abogado director del señor [Nombre2], y que lo ha asesorado en todos los actos de usurpación realizados en el inmueble de su propiedad, apropiándose de casi la totalidad del inmueble, en condición de precaristas.

En su criterio, el problema legal debe tratarse en la vía declarativa y no en la penal, por lo que debió acogerse la excepción de incompetencia en razón de la materia. Por lo expuesto, solicita se acoja con lugar el recurso, se anule la sentencia impugnada, se le absuelva de toda pena y responsabilidad, o bien, se ordene el reenvío. En virtud de que los agravios invocados son reiterativos y entremezclados, por economía procesal y para evitar repeticiones innecesarias, se resuelven de manera conjunta, declarándose sin lugar. En general, el recurrente apela que la sentencia de instancia es ilegítima, por violatoria del debido proceso. En específico, porque (i) se basó en una querella improcedente por no reunir las formalidades de ley; (ii) el querellante carece de legitimación activa; (iii) el origen del conflicto es de índole civil y no penal, por lo que debió declararse la incompetencia por la materia; (iv) los hechos en discusión ya fueron juzgados en la vía agraria, por lo que existe cosa juzgada material y no delinquió porque actuó bajo un error de prohibición; (v) además, no es culpable porque no se le endilgó ni demostró la comisión de ningún delito, y se inobservaron las reglas de la sana crítica en la apreciación de las pruebas.

Ahora bien, por las razones que se dirán, ninguna de las alegaciones planteadas es de recibo. Lo primero que debe adelantarse es que la técnica de argumentación en que se apoyan los alegatos es muy genérica y poco fundada, es decir, no se puntualizan los análisis de la sentencia que se estiman erróneos o inválidos, en vez de ello, se describen tópicos o extremos debatidos y se discrepa de cómo se resolvieron, pero eludiendo las razones concretas de decisión del fallo. En cualquier caso, y siguiendo el orden de los reclamos, (i) revisada la sentencia, no se detecta que esta se haya basado en una querella improcedente, sin reunir las formalidades de ley. Para empezar, se trata de un tema que el recurrente protestó en el debate y que el tribunal rechazó en sentencia, estableciendo: “Ese punto también fue resuelto en firme no solo en los pronunciamientos emitidos en la audiencia preliminar relativa a este y al inicio del citado contradictorio, por lo que nada debe resolverse al respecto.

No obstante lo anterior, debe indicarse que este Juzgador procedió a hacer una lectura del citado escrito y no encontró la existencia de algún vicio u omisión en él, sino que, por el contrario, se ajusta plena y claramente a las previsiones legales indicadas.” Según el recurrente, la querella no describió de manera clara, precisa y circunstanciada los hechos punibles atribuidos, por ejemplo, en qué consistió la violencia, la amenaza, engaños, el despojo total o parcial del derecho real; tampoco las acciones de invasión y apoderamiento del terreno disputado, su medida real ni su colindancia. El reclamo es infundado. La relación de hechos de la querella reza: «PRIMERO: Mi representado, don [Nombre2] ; es el propietario y poseedor de la finca del Partido de Alajuela matrícula CED2CED3; la cual se describe de la manera siguiente: Terreno para la agricultura, bosque y pastos, situado en la localidad de Betania en el Distrito de San Rafael, cantón de Guatuso en la provincia de Alajuela, tiene una cabida de 29 hectáreas 4865,31 metros cuadrados, siendo que la describe el plano topográfico A 719991-2001.

Según el Registro Nacional colinda: Norte; Quebrada Timacar y [Nombre5] ; Sur, [Nombre6] y [Nombre7] , Este: [Nombre2] ; Oeste [Nombre8] y Quebrada Timacar. Dicha heredad está destinada a pastos para la ganadería en su mayoría, siendo que posee además un sector de bosque en el cual hay varias nacientes de agua, esta zona de bosque se ha conservado y protegido. SEGUNDO: Por el costado sureste, en forma real, la finca de mi representado colinda con un terreno que es poseído por el Querellado, entre los [Dirección1] acorde al plano A-719991-2001; siendo que desde que mi representado adquiere dicha heredad, ello en el año 2001; entre ambos fundos ha existido las cercas que las delimitan claramente ambos inmuebles. TERCERO: Que los actos de posesión ejercidos a lo largo del tiempo por mi representado en el terreno, han sido relativos a la actividad ganadera; sea limpieza de potreros, chapias, mejoramiento de ceras, desarrollo y mantenimiento de ganado de cría y leche, conservación y protección del área de montaña; todo lo cual es realizado por medio de peones suyos así como de manera personal.

CUARTO: El 21 de enero de 2011; el cuidante de la finca de mi representado, [Nombre9] ; observa que el aquí [Nombre3] en compañía de una serie de trabajadores suyos, de manera ilegítima y con el fin de despojar a mi representado de la posesión que venía ejerciendo sobre el terreno que se describe en el punto primero, se introduce y se apodera en forma total del mismo. Para tales fines elimina la cerca que existía al costado este del inmueble, ello en una longitud de unos trescientos cincuenta metros; y con el fin de anexar dicho terreno al que se reconoce don [Nombre1] posee según se dijo en el punto segundo; inicia el levantamiento de una cerca que lleva rumbo [Dirección2] , con un longitud de tres kilómetros en forma aproximada. QUINTO: A partir de ese momento el ganado propiedad de mi representado y que era mantenido en el terreno que interesa, es expulsado por el Querellado. Además para mantenerse en la posesión que de manera ilícita toma; mediante amenazas proferidas a trabajadores de don [Nombre2], evita que estos desarrollen sus labores e incluso que ingreses al terreno, siendo que por lo menos los días 26 y 27 de enero de 2011; se dan dos episodios de confrontación de don [Nombre1] y trabajadores suyos con don [Nombre9] y otros peones, quienes son amenazados e intimidados, siendo evidente el uso de la violencia.

SEXTO: Sin precisar fecha exacta, pero entre el mes de marzo y los primeros días del mes de abril de 2011, el señor [Nombre3], manteniéndose de manera ilegítima en la finca de mi representado y como parte de sus actos de desposesión, careciendo de las autorizaciones y permisos que se requieren por parte de las Autoridades competentes del MINAET, introduce un tractor de orugas y procede a dirigir la realización de la apertura dentro de la finca de una trocha o camino interno que tiene un ancho cuatro metros por novecientos cuarenta metros de longitud, con orientación [Dirección3] - , atravesando tres quebradas, e invadiendo un área de bosque que hasta entonces mi representado conservaba. SÉTIMO: Con esta obra, el señor [Nombre3] causa una serie de daños ambientas y patrimoniales, a saber: 1. Ordenar la eliminación de 18 árboles de Laurel; dos Gallinazos, un Yema de huevo, 3 Papayos de Montaña; y un Chilamate; todos ellos con diámetros que oscilan entre los 20 y los 35 centímetros, los que fueron desraizados mediante el uso de un tractor de orugas, para tal acción carecía de permisos del Estado y de la Autorización de mi representado. 2.

Obstruye el curso del caudal de agua de tres quebradas, ello mediante el apilamiento de trozas de madera de diferentes especies, que son las mismas que desraizó, además de la colocación de tierra producto del movimiento que está generado en la apertura de la trocha, todo ello con el fin de construir puentes y/o (sic) pasos pata comunicar potreros. 3. Una de las quebradas fue taponeada con la intención de levantar el nivel de agua, para con ello y mediante el uso de un canal que se construyó, llenar una pileta recientemente construida en el terreno que se reconoce poseía hasta antes de los hechos el Querellado. 4 Sedimentación de las quebradas, ello por la erosión del material que se removió para la construcción de la trocha. 5. Apertura de un camino de unos doscientos metros de longitud dentro del área de bosque, con la cual se eliminó el sotobosque y se afecto un área de media hectárea.

Este camino es con el fin de comunicar la finca que se sabe tenía don [Nombre1] con la que usurpó a mi representado. Este conjunto de daños fue estimado mediante el avalúo SBM-OB-095-11, desde el punto de vista del daño Ambiental en la suma de  1.267.412,64. OCTAVO: Sin precisar fecha exacta pero a inicios del mes de setiembre de 2011, el aquí Querellado, desalojó por cuenta propia la totalidad de la finca de mi representado, pero no restituyó las cosas a su estado originario." (sic).» (Lo resaltado en negrita es suplido). De una simple lectura, se comprueba que la querella sí detalló cuándo, dónde y cómo el [Nombre3] perpetró las acciones delictivas atribuidas, a su vez que describió las características, medidas y colindancias de la finca en disputa. Tan es así, que la sentencia los tuvo por demostrados, y en el apartado de fundamentación jurídica, determinó que las conductas achacadas al [Nombre3] en los hechos cuarto y quinto, constituían el delito de usurpación, tipificado en el ordinal 225 del Código Penal, mientras que los hechos sexto y séptimo, configuraban tres delitos de Infracción a la Ley Forestal, en sus modalidades de invasión de áreas de protección, aprovechamiento ilícito de productos forestales y cambio de uso de suelo, así como de construcción de caminos o trochas en terrenos de bosque, previstos en los arts. 58 incisos a) y b), 61 incisos a) y c), y 62 de la Ley Forestal.

Asimismo, en relación a la imputación modal de las acciones delictivas, la sentencia razonó: “También se cuestionó don [Nombre4]: ¿Dónde están los actos de posesión ejecutiva de [Nombre1] que materialicen el despojo: Invasión, exclusión, expulsión o permanencia? Pues resulta que, conforme se obtiene de la prueba ya analizada, efectivamente el señor [Nombre1] incurrió en todos esos actos, pues al correr la finca divisoria entre las heredades poseídas por este último y por don [Nombre2] , aquel despojó a este de una importante cantidad del terreno que poseía, por lo que don [Nombre1] sí realizó actos de invasión que implicaron la exclusión y hasta la expulsión de don [Nombre2] y, al menos, de su peón, don [Nombre9] , lo que, a su vez, implicó la permanencia del encausado en el área que despojó, todo conforme se tuvo por acreditado en los hechos probados de esta sentencia y con base en la información de calidad que se obtuvo del análisis de todas las probanzas relativas al presente asunto.” Contra esta argumentación el recurrente no contradice qué yerros presenta, sin que este Tribunal detecte vicios de fundamentación que la invaliden.

(ii) En cuanto a la aducida falta de legitimación del querellante para el ejercicio de la acción penal, se trata de una excepción procesal que fue denegada en el fallo, con fundamento en lo siguiente: “En el presente caso, don [Nombre2] es la persona directamente agraviada por la desposesión que ilícitamente le provocó don [Nombre1] , quien, a su vez, ordenó y participó en los trabajos que afectaron los recursos naturales, para este último, tiene la facultad de denunciar --y por tanto de perseguir penalmente por medio de una querella-- de conformidad con lo establecido en el párrafo 2° del artículo 50 de la Constitución Política, en relación con los numerales 71 y 75 del Código Procesal Penal, por lo cual se concluye que don [Nombre2] está activamente y ambientalmente legitimado para realizar la persecución penal tanto del delito de usurpación que aquí se dilucida como de las infracciones a la Ley Forestal alegadas en este asunto, al tiempo que la persona contra quien debe dirigirse esta querella es, precisamente, el autor responsable de dichos hechos ilícitos, sea el aquí [Nombre3] [Nombre1] , por lo que este está legitimado pasivamente para figurar en este proceso, razón por la cual, esas excepciones deben ser rechazadas.” El apelante no rebate los razonamientos expuestos.

En cualquier caso, la argumentación del a quo es adecuada. En el sub júdice, el querellante estaba legitimado para perseguir penalmente al [Nombre3] por la comisión de delitos de infracción a la Ley Forestal en perjuicio de los recursos naturales, por la sencilla razón de que los hechos acreditados no se perpetraron en un terreno forestal del Estado (art. 13 ibídem), sino en un terreno forestal privado (art. 19 ibídem), cuyo dueño registral es el ofendido, y por tanto, era víctima directamente afectada del delito, al tenor del art. 70 inciso a) del CPP, y por consiguiente, podía constituirse en parte querellante y ejercer la acción penal por su cuenta, con independencia de la participación que tuvieran el Ministerio Público o la Procuraduría General de la República, acorde con los arts. 16, 71 inciso g) y 75 del CPP. (iii) En cuanto al agravio de que la naturaleza del presente asunto es de naturaleza civil y no penal, la sentencia bajo análisis lo rechazó, resolviendo lo siguiente: “En cuanto a la competencia por la materia de este Tribunal: El licenciado [Nombre4] Moreira González, defensor particular del aquí encartado [Nombre1] , insistió a lo largo del debate que precedió a este fallo, que la sede penal no es la competente para conocer del presente asunto.

Ese aspecto quedó resuelto en firme desde la etapa preliminar y al inicio del contradictorio, en el tanto quedó claro que la pretensión del querellante, don [Nombre2] es que se determine que dicho imputado incurrió en hechos que configuran el delito de usurpación y los previstos en los numerales 58, 61 y 62 de la Ley Forestal y, que de ser así, se le imponga la pena prevista en tales normas. Evidentemente, el presente, es un conflicto claramente penal que no reviste, por el momento, aspectos de orden civil como la reivindicación, la reposición de mojones, etc. por lo que, de conformidad con lo establecido en el inciso 4 del artículo 96 de la Ley Orgánica del Poder Judicial resulta este despacho judicial plenamente competente para conocer del presente asunto, tal cual como, se insiste, ya había sido declarado en firme mediante la resolución N° 2018-00714, emitida por la Sección Segunda del Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela, a las 10:50 horas del 28 de agosto de 2018 (Véase el archivo 22/10/2018 08:26:45 de la bandeja de documentos asociados del expediente electrónico).” Más adelante, los Jueces de instancia añadieron: “También resulta menester dejar claro que, para los efectos del delito de usurpación --uno de los que se dilucida en el presente fallo--, no interesan ni deben ser analizados aspectos de propiedad, sino únicamente los que se refieran a la posesión o mera tenencia de un bien inmueble, conforme lo señala expresamente el artículo 225 del Código Penal.” Al igual que en los reclamos restantes, el apelante no concretiza debidamente por qué las razones esbozadas no son atendibles.

En efecto, esta Cámara coincide en que el Tribunal Penal de Juicio de Ciudad Quesada estaba facultado para conocer este asunto, por querella de delitos de acción pública, pues de conformidad con los arts. 45 del Código Procesal Penal y 96 inciso 1) de la Ley Orgánica del Poder Judicial, tenía plena competencia material para sustanciar su juzgamiento. Esto, sin importar que la finca objeto de controversia penal, estuviera relacionada con un conflicto de propiedad de naturaleza civil, máxime que la “existencia de un proceso penal en ningún caso dará lugar a prejudicialidad”, acorde con el art. 34.2 del Código Procesal Civil, lo cual evidencia que se trata de litigios independientes. (iv) El apelante cuestiona que los hechos en discusión ya fueron juzgados en la vía agraria, por lo que existe cosa juzgada material y no delinquió porque actuó bajo un error de prohibición. Este extremo también se aprecia que fue resuelto en el fallo recurrido, analizándose en lo que interesa: “[…] no admite este Tribunal la tesis de un error de prohibición alguno en este caso, sea directo o indirecto, por cuanto en el contradictorio ni siquiera, ni mucho menos probó, qué era lo que se discutía en el proceso que originó esa eventual sentencia, ni esta fue ofrecida como prueba, ni se ofreció la declaración del citado profesional en derecho, por lo que no existe prueba alguna de ese error, ni de su origen ni ningún otro dato que, al menos por duda, pudiera generar que esa tesis fuera de recibo, de manera que lo que se viene diciendo, lejos de ayudar a los intereses de la defensa, abona a favor de los de la parte querellante, pues, por lo dicho, no resulta de aplicación lo establecido en el artículo 34 del Código Penal.

Pero, aún admitiendo solo en gracia a la argumentación, que la sentencia que se ha echado de menos hubiera concedido algún derecho al [Nombre3] [Nombre1], no podía don [Nombre1] hacerse justicia por propia mano (autotutela) sino que debía acudir al procedimiento de ejecución de sentencia para ser puesto en posesión del inmueble que usurpó y, menos aún, dicho fallo le podría dar autorización alguna para afectar los recursos naturales de la forma en que se ha tenido por demostrado en esta sentencia.” Tal y como se verifica, la sentencia descartó la tesis defensiva de un posible error de prohibición por motivo de una supuesta sentencia de otro proceso judicial, aduciéndose que la parte querellada no aportó prueba en apoyo, argumentación que el recurrente pasa por alto y no contradice, de modo que la queja por una presunta cosa juzgada es a todas luces infundada. (v) Por último, el impugnante señala que no es culpable porque no se le endilgó ni demostró la comisión de ningún delito, y se inobservaron las reglas de la sana crítica en la apreciación de las pruebas.

Las alegaciones deben desecharse por tratarse de meras discrepancias a base de apreciaciones subjetivas. Para empezar, revisado el fallo, se encuentra que los Juzgadores, analizada la prueba testimonial y documental recibida en el juicio, tuvieron por demostrada la especie fáctica querellada, y declararon al sindicado autor responsable de un delito de usurpación y tres delitos por infracción a la Ley Forestal, en perjuicio de los Recursos Naturales y el querellante [Nombre2] . Luego, el apelante no puntualiza vicios concretos de los razonamientos probatorios, o de la motivación jurídica, que hagan dudar de su validez y eficacia, sin que esta Cámara detecte vicios absolutos o de debido proceso que la invaliden. En consecuencia, por mayoría, se declara sin lugar el recurso de apelación interpuesto por el imputado, en ejercicio de su defensa material. La jueza Escalante salva el voto sobre el extremo de la legitimación activa del querellante, respecto del ejercicio de la acción penal por delitos contra el ambiente.

III.Voto salvado de la jueza Escalante Moncada. La suscrita respeta el criterio emitido por los compañeros jueces, sin embargo, no comparto la postura jurídica mediante la cual se admite la posibilidad para que una persona interponga una querella por un delito de acción pública en aquellos casos en los que el delito perseguido es un delito ambiental, en virtud del bien jurídico que esta categoría de delincuencia protege. Este caso, si bien es cierto tiene sus particularidades, lo cierto es que, en lo que respecta al punto en discusión, y reclamado por los apelantes, concerniente a la falta de legitimación activa que ostenta [Nombre2] , para presentar querella por delitos de acción pública, para perseguir penalmente delincuencias previstas y sancionadas en la Ley Forestal, estimo que le asiste razón a los recurrentes por las siguientes consideraciones. En este sentido y en lo que interesa para la resolución de este asunto, el artículo 70 del Código Procesal Penal establece diversas categorías de víctimas, la primera de ellas descrita en el inciso a), en la que se le confiere esta condición a la persona directamente ofendida por el delito, y el inciso d) que le otorga la condición de víctimas a las asociaciones, fundaciones y otros entes que tengan carácter registral, en los que afecten intereses colectivos o difusos, siempre que el objeto de la agrupación se vincule directamente con estos interés (el resaltado es suplido).

Esta definición y clasificación que hace nuestro sistema procesal penal, es relevante para la resolución del caso concreto, ya que según se desprende de los hechos querellados, hay un una serie de eventos descritos en los acápites del uno al cinco de la acusación particular, que constituyen el delito de usurpación, por los cuales el ofendido [Nombre2] está debidamente legitimado para presentar querella por delito de acción pública, por cuanto es la persona directamente ofendida, por dicha delincuencia, ya que el derecho de posesión que se violentó le pertenecía. Sin embargo, para la suscrita juzgadora, la situación es diferente, en torno a los hechos descritos en la querella y que comprenden en los acápites sexto y sétimo, los cuales quedaron descritos de la siguiente manera: SEXTO: Sin precisar fecha exacta, pero entre el mes de marzo y los primeros días del mes de abril de 2011, el señor [Nombre3], manteniéndose de manera ilegítima en la finca de mi representado y como parte de sus actos de desposesión, careciendo de las autorizaciones y permisos que se requieren por parte de las Autoridades competentes del MINAET, introduce un tractor de orugas y procede a dirigir la realización de la apertura dentro de la finca de una trocha o camino interno que tiene un ancho cuatro metros por novecientos cuarenta metros de longitud, con orientación [Dirección3] - , atravesando tres quebradas, e invadiendo un área de bosque que hasta entonces mi representado conservaba.

SÉTIMO: Con esta obra, el señor [Nombre3] causa una serie de daños ambientas y patrimoniales, a saber: 1. Ordenar la eliminación de 18 árboles de Laurel; dos Gallinazos, un Yema de huevo, 3 Papayos de Montaña; y un Chilamate; todos ellos con diámetros que oscilan entre los 20 y los 35 centímetros, los que fueron desraizados mediante el uso de un tractor de orugas, para tal acción carecía de permisos del Estado y de la Autorización de mi representado. 2. Obstruye el curso del caudal de agua de tres quebradas, ello mediante el apilamiento de trozas de madera de diferentes especies, que son las mismas que desraizó, además de la colocación de tierra producto del movimiento que está generado en la apertura de la trocha, todo ello con el fin de construir puentes y/o (sic) pasos pata comunicar potreros. 3. Una de las quebradas fue taponeada con la intención de levantar el nivel de agua, para con ello y mediante el uso de un canal que se construyó, llenar una pileta recientemente construida en el terreno que se reconoce poseía hasta antes de los hechos el [Nombre3]. 4 Sedimentación de las quebradas, ello por la erosión del material que se removió para la construcción de la trocha. 5.

Apertura de un camino de unos doscientos metros de longitud dentro del área de bosque, con la cual se eliminó el sotobosque y se afecto un área de media hectárea. Este camino es con el fin de comunicar la finca que se sabe tenía don [Nombre1] con la que usurpó a mi representado. Este conjunto de daños fue estimado mediante el avalúo SBM-OB-095-11, desde el punto de vista del daño Ambiental en la suma de 1.267.412,64. OCTAVO: Sin precisar fecha exacta pero a inicios del mes de setiembre de 2011, el aquí Querellado, desalojó por cuenta propia la totalidad de la finca de mi representado, pero no restituyó las cosas a su estado originario." (sic).» (Lo resaltado en negrita es suplido). Sobre este elenco de hechos, esta juzgadora comparte la calificación jurídica que le dio la Cámara de instancia, al estimar que estos sucesos configuraban tres delitos de Infracción a la Ley Forestal, en sus modalidades de invasión de áreas de protección, aprovechamiento ilícito de productos forestales y cambio de uso de suelo, así como de construcción de caminos o trochas en terrenos de bosque, previstos en los arts. 58 incisos a) y b), 61 incisos a) y c), y 62 de la Ley Forestal.

El punto en el que difiero con respecto al voto de mayoría es que la suscrita estima que, por estos hechos, el señor [Nombre2] no ostenta la condición de víctima, y por ende carecía de legitimación activa para presentar querella por delitos de acción pública por lo siguiente. Los delitos forestales tienen como bien jurídico el medio ambiente, ello se desprende de un análisis sistémico de la siguiente normativa. El artículo 50 de la Constitución Política indica que en su párrafo segundo lo siguiente: “Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello, está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes.” Esta norma se ve complementada a nivel legal por el artículo 1 de la Ley Orgánica del ambiente número 7554, en el que se define como ambiente el sistema constituido por los diferentes elementos naturales que lo integran y sus interacciones e interrelaciones con el ser humano.

De igual manera el artículo 1 de Ley Forestal número 7575, establece que el Estado velará por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país. Además, en torno a la tutela del medio ambiente la Sala Constitucional ha indicado que el medio ambiente es un interés difuso que le pertenece a una generalidad de personas, es decir no existe un único titular, en caso de perpetrarse un daño ambiental, el primer damnificado es una generalidad de sujetos indeterminado. Asimismo, una característica de este tipo de bienes jurídicos es su indivisibilidad ya que no puede ser fragmentado, entre quienes disfrutan de este. Volviendo al caso bajo examen, y partiendo de la premisa que los delitos contenidos en la Ley Forestal tutelan el medio ambiente, como un bien jurídico y su defensa implica la protección de un interés difuso, estima la suscrita que, según nuestra normativa procesal penal, por este tipo de delitos, pueden figurar como víctimas, a parte del Estado, las personas jurídicas previstas en el artículo 70 inciso d) del Código Procesal Penal.

En otras palabras, el Código Procesal Penal, no le confirió de forma expresa a una persona física ejercer la persecución penal por delitos ambientales, esta quedó reservada para ser promovida por las personas jurídicas descritas en el incido d) del Código Procesal Penal, o por el Ministerio Público, o la Procuraduría General de la República, según lo dispone el artículo 16 del Código Procesal Penal. Asimismo, estimo que esta postura es acorde con lo preceptuado por el artículo 38 del Código Procesal Penal, que le reconoce a la Procuraduría General de la República, la legitimación activa para reclamar los daños ocasionados por hechos punibles que afecten derechos colectivos o difusos. Otro punto medular para resolver el asunto en discusión es que, según lo indica el artículo 2 del Código Procesal Penal, deben interpretarse restrictivamente las disposiciones legales que coarten la libertad personal.

A criterio de la suscrita, la interposición de una querella por delito de acción pública, conlleva intrínseco el ejercicio de la persecución penal, la cual es la máxima expresión de la actividad represiva del Estado, y su ejercicio debe ser racional, y proporcional, porque conlleva aparejada la posibilidad de restringir la libertad de la persona acusada. En este sentido la Sala Constitucional mediante voto número 13820-2014, en relación con el ejercicio de la potestad represiva del Estado indicó lo siguiente“La Constitución reconoce claros límites al poder punitivo del Estado, lo que incluye, sin duda alguna, la potestad persecutoria con todos sus poderes excepcionales ejercidos durante el proceso penal, así se aprecia con la prohibición de penas perpetuas, crueles e inhumanas, según lo prevé el artículo 40 de la Constitución; además, el poder punitivo ejercido al imponer una pena carcelaria, debe propiciar la rehabilitación del condenado, según lo prevé el apartado sexto del artículo quinto de la Convención Americana de Derechos Humanos.

En todas estas reglas que se han citado, se aprecia que los poderes ejercidos en el proceso penal, requieren límites precisos, no pueden ejercerse sin una limitación razonable”. Del anterior precedente constitucional y de las normas previamente citadas, estimo que, para que un particular de forma individual pueda promover la acción penal por delitos de acción pública en delitos ambientes, se requiere de norma expresa que así lo habilite, no siendo factible una interpretación extensiva de las normas para otorgarle dicha legitimidad a una persona en forma individual, así como tampoco una interpretación casuistica. Aquí debo de destacar, que en lo concerniente a los daños patrimoniales que el ofendido [Nombre2] , hubiere sufrido en su propiedad, sí estaría legitimado para presentar la acción civil, según lo preceptuado en el inciso a) del artículo 70 del Código Procesal Penal, en relación con el artículo 37 del Código Procesal Penal, no así para ejercer la acción penal mediante una querella por delito de acción pública.

En este orden de ideas, hay que destacar que según consta en autos, este asunto llegó a juicio únicamente por la querella formulada por [Nombre2] , sin que se contara con la intervención del Ministerio Público o la Procuraduría, de ahí la relevancia del reclamo formulado por los recurrentes. Por las razones antes esbozadas declaro con lugar este reclamo. En consecuencia, al no ostentar el señor [Nombre2] legitimación activa para promover la persecución penal por delitos ambientes, lo procedente es absolver al encartado de los delitos tres delitos de Infracción a la Ley Forestal, en sus modalidades de invasión de áreas de protección, aprovechamiento ilícito de productos forestales y cambio de uso de suelo, así como de construcción de caminos o trochas en terrenos de bosque, previstos en los arts. 58 incisos a) y b), 61 incisos a) y c), y 62 de la Ley Forestal.

POR TANTO:

Por mayoría, se declara sin lugar el recurso de apelación interpuesto por el imputado, en ejercicio de su defensa material. La jueza Escalante salva el voto sobre el extremo de la legitimación activa del querellante, respecto del ejercicio de la acción penal por delitos contra el ambiente. Notifíquese.
