I.By decision N° 54-2020 issued at fourteen hours and forty minutes on 27 February 2020, the trial judge declined jurisdiction (se inhibe) to hear this matter, finding that the counterclaimant’s claims include matters concerning public-domain property (bienes de dominio público), such as water. *
II.In this case, the counterclaimant requests the following: : “1. That the property recorded in the Public Registry under the real-property folio system, registration number [Placa1], consisting of pastureland and a house, with an area of nine hundred twenty-eight thousand four hundred seventy-four square meters and twenty-five square decimeters, with the boundaries and adjoining owners indicated in the Registry, owned by Ganadera Agrícola Santa Clara Sociedad Anónima, is, as the dominant estate (fundo dominante), the beneficiary of a water-intake and pipeline easement (servidumbre de toma de agua y tubería) acquired by agreement and acquisitive prescription (prescripción adquisitiva) over the servient estate (finca sirviente), owned by Comercial Agrícola Monte Carmelo S.R.L, number CED11, Alajuela registration district. 2. That the judgment order the registration of the aforesaid water-intake and pipeline easement in favor of the property registered under number [Placa1], and against the aforesaid servient property 401761, described as follows: The easement has the following characteristics: it begins at georeference point Latitude [Dirección1] Longitude 84°28'2.20"O; at this starting point, the water intake is located within a strip measuring four meters by four meters, at the center of which is a reinforced-concrete, drinking-trough-type structure measuring one meter and twenty centimeters long, sixty centimeters high, and the same depth, modified to draw the water.
From the water-intake point, on a bearing of 341°N0, the easement is two meters wide and contains an existing four-inch-diameter pipeline, fifty meters long, that conveys the water to a cylindrical metal structure used to filter leaves, stones, and sand. From the filter tank, the pipeline is reduced to two inches in diameter. It continues in the same direction, within a strip two meters wide and two hundred meters long, until reaching an electrical utility pole owned by Cooperativa de Electrificación Rural COOPELESCA RL, identified as CED12; at this point, it crosses [Dirección2] at [Dirección3] . From the electrical utility pole, the easement and the water-conveyance pipeline cross [Dirección2] toward [Dirección4] for approximately two hundred meters. Throughout the right-of-way (derecho de vía) of Ruta Nacional 35, the water-conveyance pipeline runs underground. It continues across the property of Ganadera Agrícola Santa Clara Sociedad Anónima at [Dirección5] .
The water-conveyance pipeline continues underground and parallel to Ruta Nacional 35 through the property of Ganadera Agrícola Santa Clara Sociedad Anónima for approximately eight hundred twenty meters. 3. That the defendants be ordered to complete the appropriate procedures before Ministerio del Ambiental and Acueductos y Alcantarillados so that a concession for the use of the water may be granted. Should they fail to do so, that the plaintiff be authorized to complete the procedures in their name. 4. Should the defendants oppose this action, that they be ordered to pay both sets of costs (ambas costas).” (pleading correcting the counterclaim, added to the pleadings tab of the virtual case file for this matter on 10/06/2019 at 16:30:58).*
III.This particular case concerns a series of matters seeking the restoration of land to the plaintiff company and the payment of damages for the encroachment upon and usufruct of several parcels of land belonging to the plaintiff, which the counterclaiming defendant uses as an allegedly nonexistent water easement (servidumbre de aguas). Likewise, counterclaimant Ganadera Agrícola Santa Clara Sociedad Anónima requests a declaration establishing a water easement in its favor through positive prescription (prescripción positiva), and an order requiring the counterclaim defendant to apply for the water concessions; should it fail to do so, the counterclaimant asks to be allowed to apply for them. Like the trial judge, this Chamber finds that this case may involve public-domain assets (bienes de demanio público), because water is a public-domain asset by express provision of Ley de Aguas. Acueductos y Alcantarillados has even appeared in this proceeding as an interested third party and has stated that no water concession has been granted to the counterclaimant over the property belonging to the plaintiff.
Likewise, among the facts alleged in the counterclaim, Ganadera Agrícola states that the easement even passes underground beneath the public road [Dirección6] , which confirms that the court below was correct to join EL ESTADO as a party to this proceeding. This is so not only because the disputed easement crosses the public-road property, but also because the water resource is apparently being used without any concession, even though it too is a public-domain asset. Although the facts as recounted appear to indicate that the easement was established before the road was built and at the former owner’s request, the reality is that, when the road was constructed, the easement apparently had not been registered as a real encumbrance (carga real) against that portion of land; and if EL ESTADO expropriated or received those lands by donation, it was unaware of the easement when it took possession of them.
It is insufficient to state that EL ESTADO need not be joined because the easement runs underground, since land purchased, expropriated, or donated in favor of EL ESTADO entitles it to be joined in any proceeding in which a portion of its land would be burdened by a real encumbrance. Likewise, declaring a water easement over private property and over property belonging to EL ESTADO, such as a national highway, requires this matter to be heard in the Contentious-Administrative jurisdiction (jurisdicción Contenciosa Administrativa), because public-domain assets are involved ([Dirección7] and [Dirección8] public domain). Article 10 of Código Procesal Contencioso Administrativo provides that the purpose of the contentious-administrative jurisdiction is to protect every person’s legal situations, guarantee or restore the lawfulness of any conduct of the Public Administration governed by Administrative Law, and hear and decide the various aspects of the legal-administrative relationship; consequently, this proceeding falls within the contentious-administrative jurisdiction.
Based on the facts alleged by the plaintiff, the matter cannot be heard in the agrarian jurisdiction (jurisdicción agraria); rather, jurisdiction lies with the contentious-administrative courts because the dispute concerns, in part, public-domain assets. It is clear that the matter must be heard in the contentious-administrative jurisdiction. That jurisdiction is not intended exclusively to challenge acts of the Administration (under the terms of Article 1 of Código Procesal Contencioso Administrativo), but also to safeguard public interests—and, consequently, public assets. To the same effect, see decision of this Chamber n° 530-F-S1-2008, issued at 14 hours 25 minutes on 1 August 2008. For these reasons, jurisdiction over this matter lies with the contentious-administrative courts. The procedures shall be adjusted as necessary to the requirements of Código Procesal Contencioso Administrativo. The present case file shall be forwarded to the indicated Tribunal so that it may process the matter and bring it to conclusion in accordance with the procedural rules in force. *
IV.DISSENTING OPINION (VOTO SALVADO) OF JUDGE [Nombre6] .- Although the undersigned respects the majority opinion, he disagrees with it for the following reasons: In this case, the Tribunal has already issued decisions 585, 586, 908, and 909 of 2019. AyA and Procuraduría have made submissions (see pleadings dated 17 September and 3 October). This is essentially a substantive claim of an agrarian nature, because it concerns a dispute over real rights (derechos reales) involving an agrarian easement. This is so regardless of whether a water concession exists, an issue on which the court below must, in due course, decide whether that claim should be joined. In reality, the properties affected are the dominant and servient estates, while the concession is a separate issue. Accordingly, the undersigned judge rejects the declination of jurisdiction (inhibitoria) and orders the agrarian ordinary proceeding to continue.*
POR TANTO* The declination of jurisdiction ordered by the trial court is upheld, and it is declared that jurisdiction over this proceeding lies with Tribunal Procesal Contencioso Administrativo. I.Mediante resolución N° 54-2020 de las catorce horas cuarenta minutos del 27 de febrero de 2020, el Juzgador de instancia se inhibe de conocer el presente asunto al considerar que las pretensiones de la contrademandante incluyen asuntos sobre bienes de dominio público como lo es el agua. *
II.La contrademandante en este caso solicita lo siguiente: : "1. que la finca inscrita en el Registro Público, bajo sistema de folio real, matrícula [Placa1], que es terreno de pastos y una casa, Con una medida de novecientos veintiocho mil cuatrocientos setenta y cuatro metros con veinticinco decímetros cuadrados, con los linderos y colindantes que indica el Registro propiedad de Ganadera Agrícola Santa Clara Sociedad Anónima es propietaria, como fundamento dominante, de una servidumbre de toma de agua y tubería adquirida por convenio y prescripción adquisitiva, de la finca sirviente, propiedad de Comercial Agrícola Monte Carmelo S.R.L, número CED11, partido de Alajuela. 2. Que se disponga en sentencia la inscripción de la servidumbre de toma de agua y tubería antes indicada a favor del fundo matrícula [Placa1], y en contra de la finca sirviente 401761 antes indicada que se describe de la siguiente forma: La servidumbre tiene las siguientes características: inicia en el punto de georreferencia Latitud [Dirección1] Longitud 84°28'2.20"O en este punto de partida se ubica la toma de agua en una franja de cuatro metros por cuatro metros y en el centro se ubica una estructura de concreto armado tipo bebedero de un metro con veinte centímetros de largo, sesenta centímetros de alto e igual fondo, modificado para hacer la toma del agua.
Del punto de la toma de agua en orientación 341°N0 con un ancho de dos metros y con una tubería existente de cuatro pulgadas de diámetro y cincuenta metros de longitud que conduce el agua a una estructura cilíndrica de metal que se utiliza como filtro para hojas, piedras y arena. Del tanque para filtro, la tubería se reduce a dos pulgadas de diámetro. Discurre en la misma dirección con un ancho de dos metros por doscientos metros de longitud y se llega a un poste para tendido eléctrico propiedad de la Cooperativa de Electrificación Rural COOPELESCA RL que se identifica como CED12 en este punto atraviesa la [Dirección2] en el [Dirección3] . Del poste para tendido eléctrico la servidumbre y la tubería para la conducción del agua cruza la [Dirección2] en dirección [Dirección4] con una longitud de doscientos metros aproximadamente. La tubería de conducción del agua en todo el derecho de vía de la Ruta Nacional 35 lo hace de forma subterránea.
Sigue atravesando la propiedad de Ganadera Agrícola Santa Clara Sociedad Anónima en el [Dirección5] . La tubería para la conducción del agua sigue de forma subterránea y en forma paralela a la ruta nacional 35 por la propiedad de Ganadera Agrícola Santa Clara Sociedad Anónima por aproximadamente ochocientos veinte metros. 3. Se ordene a las demandadas realizar el trámite correspondiente ante el Ministerio del Ambiental y Acueductos y Alcantarillados para que se otorgue la concesión sobre el uso del agua. Si no acudieren se autorice a la demandante a realizar los trámites a su nombre. 4. En caso de que las demandadas se opongan a la presente demanda, se les condene al pago de ambas costas." III.En este caso particular se discute sobre una serie de aspectos que tienden a que se repongan terrenos a favor de la sociedad actora y se paguen daños y perjuicios por la usurpación y usufructo de una serie de terrenos pertenecientes a la actora utilizados por la demandada reconventora como una servidumbre de aguas que se alega inexistente. Igualmente la reconventora Ganadera Agrícola Santa Clara Sociedad Anónima solicita la declaratoria de una servidumbre de aguas a su favor por prescripción positiva y se obligue a la actora reconvenida a solicitar las concesiones de aguas y en caso de no hacerlo se le conceda la posibilidad a la contraventora de hacerlo. Al igual que lo hace el juzgador de instancia considera esta Cámara podría en este caso estarse discutiendo sobre bienes de demanio público, ello por cuanto el agua es un bien demanial por disposición expresa de la Ley de Aguas. En este proceso se ha apersonado incluso Acueductos y Alcantarillados como tercero interesado, quien ha manifestado no hay concesión de aguas concedida a la reconventora sobre el inmueble perteneciente a la actora.
Igualmente entre los hechos establecidos en la contrademanda la empresa Ganadera Agrícola señala que incluso pasa la servidumbre de manera subterránea a una calle pública la [Dirección6] , lo cual hace lleve razón el a quo, en cuanto a traer al Estado como parte en este proceso. En este caso no solo por lo referido al bien calle pública, que atraviesa lo que ellos denominan servidumbre aquí en discusión sino también por el recurso hídrico que se aprovecha en apariencia sin concesión alguna, al ser también este, un bien demanial. Si bien pareciera según relatan los hechos la servidumbre fue realizada antes de la construcción de la carretera y por voluntad del anterior dueño, la realidad es que al momento de la construcción de la carretera la servidumbre pareciera no estaba inscrita como una carga real contra esa porción de terreno y si el Estado expropio o le fueron donados esos terrenos, a la hora de tomarlos en posesión, se desconoció por parte del Estado la existencia de la misma, y no basta con decir que al ser una servidumbre que va bajo tierra no es necesario llamar al Estado, por cuanto al ser un terreno comprado, expropiado o donado en favor del Estado, este tiene derecho a ser integrado en un proceso donde se afectaría parte de sus terrenos con una carga real.
Igualmente el declarar una servidumbre de aguas sobre un bien privado y sobre un bien perteneciente al Estado como lo es una carretera nacional implica este asunto deba ventilarse en la vía Contenciosa Administrativo al estar bienes demaniales de por medio ([Dirección7] y [Dirección8] dominio público). El artículo 10 del Código Procesal Contencioso Administrativo dispone, la jurisdicción contencioso administrativa tiene por objeto tutelar las situaciones jurídicas de toda persona, garantizar o restablecer la legalidad de cualquier conducta de la Administración Pública sujeta al derecho Administrativo, así como conocer y resolver los diversos aspectos de la relación jurídico administrativa, por lo que este proceso corresponde a la jurisdicción contencioso administrativa. De los hechos expuestos por la demandante el asunto no puede ventilarse en la jurisdicción agraria, sino que corresponde su conocimiento a la jurisdicción contencioso administrativo, al tratarse sobre la discusión en parte sobre bienes del demanio público.
Es claro que el asunto debe ser de conocimiento de la jurisdicción contenciosa. Esa sede no está ideada, en exclusiva, para atacar actos de la Administración (en los términos del artículo 1 del Código Procesal Contencioso Administrativo), sino también para el resguardo de los intereses –y en consecuencia de los bienes- públicos. En igual sentido puede consultarse el voto de esta Sala n° 530-F-S1-2008 de las 14 horas 25 minutos del 1 de agosto del 2008. Por esas razones, el conocimiento de este asunto corresponde a la jurisdicción contencioso-administrativa. Deberán de ajustarse los procedimientos a los requerimientos del Código Procesal Contencioso Administrativo, en lo que fuere necesario. Remítase el presente expediente al Tribunal indicado para que lo tramite y fenezca conforme a la normativa procesal vigente. *
IV.VOTO SALVADO DEL JUEZ [Nombre6] .- El suscrito, si bien respeta el voto de mayoría, no lo comparte por lo siguiente: En este caso, ya el tribunal ha dictado los votos 585, 586, 908 y 909, del 2019. Hay manifestaciones del AyA y la Procuraduría (ver escritos del 17 de setiembre y del 3 de octubre). Se trata en esencia de una pretensión material de naturaleza agraria, pues es propia de una discusión de derechos reales de servidumbre (agraria). Lo anterior, independientemente a si existe o no concesión de aguas, sobre lo cual el a-quo deberá en su momento resolver lo relativo a la acumulación, o no, de dicha pretensión.. En realidad aquí lo que se afecta es el fundo dominante y sirviente, y el tema de la concesión es un tema aparte. Por ende, el suscrito juez rechaza la inhibitoria, y ordena continuar el proceso ordinario agrario*
POR TANTO* Se acoge la inhibitoria decretada por el juzgado de instancia y se declara que el conocimiento del presente proceso corresponde al Tribunal Procesal Contencioso Administrativo. Remítase el presente expediente al Tribunal indicado para que lo tramite y fenezca conforme a la normativa procesal vigente.
