WHEREAS:
3- Co-defendant [Nombre2] also filed a counterclaim (reconvención) against plaintiff [Nombre1], seeking a judgment declaring the following: “... That the property registered in the Heredia Registry District under number CED7 is not subject to any restriction or easement in favor of the counterclaim defendant’s property described in plan number H-732985-2001. That the property owned by the counterclaim defendant and described in plan H-732985-2001 does not adjoin my property and is not landlocked, because it has an easement providing access to a public road through another area and not through my property. That the property owned by the counterclaim defendant and described in plan H-732985-2001 is located within the inalienable zone of [Dirección1]. That the document identified as deed number CED8, executed before Notary Rita Herrera Durán, does not describe the imposition of any easement over the property registered in the Heredia Registry District under number CED9 in favor of the property described in plan number H-732985-2001, because it does not state the property number upon which the purported easement is imposed.
That the document identified as deed number CED8, executed before Notary Rita Herrera Duran, is already time-barred because it was not recorded in the Registro Público de la Propiedad and because the acts necessary to validate and protect the purported right contained therein were not performed, given that more than 16 years elapsed from the date of the instrument to the filing of this proceeding. That, once the judgment becomes final, the counterclaim defendant be ordered to refrain from entering my property, whether personally, through his laborers, or through other persons traveling toward his property. And that he also refrain from entering my property on foot, horseback, or by vehicle, or with animals. That the counterclaim defendant be ordered to pay me for the use of and permission to cross my property that I have granted him throughout the duration of this proceeding, from the filing of the action until the judgment becomes final.
The amount shall be assessed by an expert, whose appointment I request be deferred until the judgment-enforcement phase (ejecución de sentencia), if necessary” (see counterclaim at folios 78 through 83).
5- By decision entered at seven hours and eight minutes on dos de junio de dos mil diez, the Agrarian Court of the Second Judicial Circuit of the Atlantic Zone, Guápiles, partially granted the defense of failure to join indispensable defendants and ordered that the State and JAPDEVA be joined as defendants.
Judge Castro García issues the ruling; and,
CONSIDERANDO
I- Given the manner in which this appellate court will rule, no determination is made regarding the proven and unproven facts set forth in the appealed judgment.
II.Claimant [Nombre1] appeals judgment number 2019000190, issued at 10:44 on 15 de mayo del 2019 (images 774 to 808 and 814 to 817 of the digital case file in PDF format), stating that it was established that he has conducted agricultural activity throughout his land. He further states that the land comprises three properties that he acquired from [Nombre3] in 1994. He consolidated them and established an agricultural estate that he demarcated for cattle ranching and forest management. The property is shown on plan 732985-2001. He also states that, for many years, he has exercised and enjoyed a right of way or easement over defendant’s estate, corresponding to the property registered under number CED10. He states that 54% of appellant-claimant’s estate is in the border zone, while the remaining 46% is located within Refugio de Vida Silvestre Maquenque. As grounds for his appeal, he argues that the agrarian courts must decide this matter on its merits because it involves agricultural activity conducted for more than ten years that has been affected by unlawful conduct.
He therefore requests that, regardless of title to the dominant estates, consideration be given to the fact that production activities may be conducted on land belonging to others and that the mere exercise of environmental agricultural activity must be respected, as is the case in the matter sub judice. He contends that, although the State holds title and the aforementioned protected wildlife area is involved, agricultural enterprises have in fact operated there as a result of State policies and have remained over time. Consequently, that activity merits legal protection, and the entrepreneur is entitled to protection in these proceedings. He argues that his claim therefore has legal support because he seeks permission to continue conducting his activity. Accordingly, he requests that defendant fulfill his obligation to allow passage, regardless of whether, as the judgment states, the properties are adjoining, whether the instrument creating the easement was never recorded, or whether ten years have already elapsed.
The appealed judgment established that claimant had enjoyed use of the easement and that defendant had attempted to obstruct it. He states that these proceedings seek to safeguard the real property right benefiting his land, which is an environmental agricultural unit created by defendant’s intent. He asserts that he is not claiming a new right, but rather the continued exercise of a real property right created by agreement of the parties and previously exercised. This applies regardless of whether claimant’s estate is registered or whether it is located within the Patrimonio Natural del Estado. He adds that Refugio Nacional de Vida Silvestre Maquenque was created in mayo del año 2005; therefore, estates then subject to ten-year agricultural-environmental possession cannot be affected with respect to their ownership. He consequently retains all possessory rights over that area, and it is eligible for registration under the Ley de Información Posesoria.
He states that public instrument number CED8 created the easement at issue, which he has always used, and that [Nombre3] transferred the parcels and that right of way to him; he further states that this is an area eligible for titling. He explains that he seeks enjoyment of that right, which predates the creation of the protected wildlife area, a mixed wildlife refuge (with public and private property), and that restoration of the right does not affect State-owned land or protected areas (áreas de protección). The State has never expropriated any land from owners or possessors. He notes that no evidence has been presented in this case establishing which portion lies within the Refuge in question and that he holds a lawfully executed agreement. He argues that this jurisdiction must hear the matter and order the reopening and unrestricted exercise of the easement created in 1994 for the benefit of his estate.
He further argues that the Refuge was established by decree on 23 de mayo del 2005 and therefore cannot affect his ownership. He also notes that the possessory-information proceeding (proceso de información posesoria) remains pending.
Section 26 of the Ley de Jurisdicción Agraria establishes that the courts may declare nullities and order the reinstatement of proceedings (reposición de trámites) in order to correct irregularities that could affect the validity of the proceeding. In another respect, concerning appeals, section 60 of the cited law states that the proceeding shall be governed, as applicable, by the provisions of the Código de Trabajo. Article 502 of that law (applicable to this case because the proceeding began before the procedural reform, Transitorio I.3 Ley 9343) provides that, upon receipt of the record by the Court, it shall first review the proceedings; and if it finds that any formality capable of causing actual denial of the right to a defense (indefensión) has been omitted, it shall declare null and void such proceedings or decisions as appropriate and to the extent necessary to restore the normal course of the trial.
The provision in question stipulates that the omissions to be remedied and the corresponding disciplinary measure must be precisely identified. This Court has likewise insisted on the principle of preservation of procedural acts (principio de la conservación de los actos procesales), in order to avoid unnecessary delays, except in cases where the omission or defect affects fundamental rights, including due process or the right of defense. In this specific case, the judgment contains defects that cannot be remedied at this level and that require the challenged judgment to be vacated. First, the reasoning section of the judgment analyzed and stated the grounds for rejecting the statute-of-limitations defense (excepción de prescripción) raised by the defendant and the Procuraduría General de la República, but that ruling was not included in the operative portion of the judgment. Similarly, that portion of the challenged decision contained rulings only on the cited defense, the complaint filed by [Nombre1] against [Nombre2], and the latter’s counterclaim (reconvención) against [Nombre2].
It then stated generically that the complaint against the group of defendants was dismissed. Nothing was stated regarding the complaint against the Procuraduría General de la República and JAPDEVA. Nor was anything stated regarding the claims against [Nombre4], Gogo Roemi San Carlos S.A. and Conservación Ambientales Rama S.A., ordered by Voto 185-F- at 14:30 hours on 27 de febrero del 2013 (physical folios 381 to 388, Volume II). Those matters had to be included given the importance of the ruling contained in the operative portion of the judgment. The foregoing is essential in a decision on the merits such as the one issued, because only the operative portion of the judgment has the force of res judicata (cosa juzgada), pursuant to Articles 162 and 163 of the repealed Código Procesal Civil, applied supplementarily by virtue of section 26 of the Ley de Jurisdicción Agraria and Transitorio I.3 of Ley 9343.
Regarding the effects of res judicata, this Court has ruled: “The doctrine of res judicata plays a very important role in legal certainty, because by recognizing the immutability of a matter adjudicated with the force of res judicata, it prevents the possibility of repeating proceedings concerning the same issues and between the same parties. In this regard, the Sala Constitucional de la Corte Suprema de Justicia, in decision 5079-95 at 18 hours 36 minutes on 13 de setiembre de 1995, stated: ‘Procedural doctrine holds that a proceeding is not an endless succession of acts and that a point is reached when, for obvious and perhaps practical reasons, it must be brought to an end. In turn, the effects of the judgment ultimately rendered depend on the legal circumstances under which it is issued. For that very reason, this Chamber departs from the line of argument advanced by the plaintiff in support of her constitutional objection, since it begins from the premise that where the Constitution states “the reopening of cases decided with the force of res judicata is prohibited,” this must be understood or assumed a priori to mean that “every case is decided with the force of res judicata,” or, similarly, that “every judgment, regardless of the proceeding in which it is rendered, produces res judicata and, consequently, what it decides may not be litigated again.” These latter interpretations, which would be incorporated into the text and purpose of the phrase contained in Article 42 of the Constitution, are overbroad and conflict with the approach taken by procedural doctrine in this area.
This is not so for the simple reason that not all proceedings receive the same treatment under ordinary legislation; thus, in some proceedings, the adversarial process has dimensions different from those established for others, which accounts for the classic distinction between summary and plenary proceedings (procesos sumarios y plenarios). For that very reason, the legislature may legitimately grant different effects and consequences to judgments depending on whether or not they belong to one of those types of proceedings.’ For its part, the Sala Primera de la Corte Suprema de Justicia, in decision 315-03 at 11 hours 30 minutes on 4 de junio de 2003, stated: ‘Regarding the doctrine at issue, this Chamber has indicated: “... In definitively resolving disputes submitted for its consideration, the State, through the Judiciary, assumes and exercises one of the most important functions entrusted to it: the jurisdictional function.
For that function to be performed effectively, the decisions inherent in the authority conferred in parallel possess two fundamental characteristics: absolute immutability and finality. Only in exceptional cases provided for by law may those characteristics be relative. This particular feature of the jurisdictional function has been called RES JUDICATA in legal doctrine and case law. Through it, the will of the State, as contained in the law, is established as final and immutable for the specific case, which is fundamental to legal certainty and security. That will is declared by the judge in a judgment. The purpose is therefore to bring matters decided by judicial ruling to an end and to prevent the dispute from being raised successively, thereby avoiding legal uncertainty, all of which promotes the effectiveness of the State’s jurisdictional function. In our system, judgments rendered in ordinary or expedited proceedings, as well as those other decisions exhaustively specified, have the force of substantive res judicata (cosa juzgada material).
Subject to the qualification stated below, this is limited to the operative portion of the judgment; that is, it does not encompass its reasoning. For a judgment to affect other proceedings through res judicata, the parties, cause of action, and subject matter must be identical in both proceedings.”’ The Court agrees with the arguments presented by both Chambers in the cited decisions, which have been reiterated and are also consistent with Articles 162 and 163 of the Código Procesal Civil, applied supplementarily, under which final judgments rendered in ordinary and expedited proceedings have the force and effect of substantive res judicata, as do those to which the law expressly grants such effect, limited to the operative portion of the judgment, provided that the parties, subject matter, and cause of action are identical in both cases.” (decision 798-F-09).- It is therefore necessary to issue a judgment whose operative portion addresses all the cited omitted matters.
IV- In addition to the foregoing, the challenged judgment also contained no assessment of each of the claims against the persons joined to the proceeding (personas integradas) by the cited Court decision, which appear in the pleadings at folios 396 to 402. This is because it did not analyze their position in relation to the subject matter of the proceeding. Instead, the judgment merely stated that the dismissal of the complaint applied to the group of defendants. This is insufficient in light of section 54 of the Ley de Jurisdicción Agraria. It should be noted that the body of the judgment omitted any ruling on those claims and failed to provide any actual analysis concerning the joined parties, even though the complaints were cited in the heading. This resulted in an infra petita inconsistency (incongruencia por infrapetita). The operative portion of trial-court judgment number 2019000190 at ten hours and forty-four minutes on quince de mayo de dos mil diecinueve ruled: “POR TANTO: In accordance with the foregoing and in light of the cited case law and statutory provisions, with respect to the COMPLAINT, the defenses of lack of standing to sue and be sued (falta de legitimación activa y pasiva) are rejected; only the failure-to-state-a-right defense (falta de derecho) is granted.
Consequently, the complaint filed by [Nombre1] against the group of defendants is DISMISSED in its entirety. With respect to the COUNTERCLAIM, the defenses of failure to state a right and lack of standing to sue and be sued are rejected. Accordingly, the COUNTERCLAIM is PARTIALLY GRANTED, solely as set forth below, and any points on which no ruling is made shall be deemed denied, as follows: It is declared that the property of defendant-counterclaimant [Nombre2], namely the property registered in the Heredia Registry under number CED7, is not subject to any restriction or easement (servidumbre) in favor of the property of the counterclaim defendant, described in plan H-732985-2001. Counterclaim defendant [Nombre1] is ordered, once this judgment becomes final, to refrain from entering the property of [Nombre2], namely the property registered in the Heredia Registry under number CED7, whether personally or through his laborers or other persons traveling to his property.
Mr. [Nombre1] must refrain from entering the land of defendant [Nombre2] on foot, on horseback, by vehicle, or with animals. This matter is decided without a special award of costs. IV- Therefore, pursuant to Articles 1, 2, 26 and 54 of the Ley de Jurisdicción Agraria and the foregoing explanation, judgment number 2019000190 at ten hours and forty-four minutes on quince de mayo de dos mil diecinueve must be declared null and void so that a new decision may be issued.
POR TANTO
Judgment number 2019000190 at ten hours and forty-four minutes on quince de mayo de dos mil diecinueve is vacated.

RESULTANDO:
3- Asimismo el codemandado [Nombre2] , planteó reconvención en contra del actor [Nombre1] , para que en sentencia se declare lo siguiente: "... Que sobre la finca inscrita en el Partido de Heredia con el número CED7, no existe ninguna limitación o servidumbre a favor de la finca del actor reconvenido descrita en el plano numero H-732985-2001. Que la finca propiedad del actor reconvenido descrita en el plano H-732985-2001, no es colindante con mi finca y no es un fundo enclavado pues tiene una servidumbre de salida a calle pública por otro sector y no por mi finca. Que la finca propiedad del actor reconvenido descrita en el plano H-732985-2001 se encuentra ubicada dentro de la zona inalienable de la [Dirección1] . Que el documento identificado como escritura número CED8 otorgada ante la notaría Rita Herrera Durán, no describe ninguna imposición de servidumbre sobre la finca inscrita en el partido de Heredia con el número CED9, a favor de la finca descrita en el plano número H-732985-2001, pues no indica el número de finca a la cual se impone la supuesta servidumbre.
Que el documento identificado como escritura número CED8 otorgada ante la notaria Rita Herrera Duran, ya está prescrito por no haberse inscrito en el Registro Público de la Propiedad, y por no haberse ejecutado actos necesarios para convalidar y tutelar el supuesto derecho que contenía, ello pues has pasado más de 16 años desde la fecha del escrito a la interposición de este proceso. Que se le ordene al actor reconvenido que una vez firme la sentencia, se abstenga de ingresar a mi propiedad, ya sea en forma personal o por medio de sus peones u otras personas que vayan hacía su propiedad. Y además que se abstenga de ingresar a pie, a caballo, o en vehículo y con animales por mi finca. Que se ordene al reconvenido a pagarme el uso y permiso que le he dado de pasar sobre mi finca durante todo el tiempo que dure este proceso, desde la interposición de la demanda hasta que quede en firme la sentencia. 5- El Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles resolución de las siete horas ocho minutos del dos de junio de dos mil diez, admitió de forma parcial la excepción de litis consorcio pasivo necesario y se ordenó demandar al Estado y a JAPDEVA.
Resuelve la jueza Castro García; y,
CONSIDERANDO
I- Por la forma en que se resolverá en esta instancia se omite pronunciamiento respecto a los hechos probados y no probados contenidos en la sentencia recurrida.
II.La parte actora recurre [Nombre1] recurre la sentencia número 2019000190 de las 10:44 horas del 15 de mayo del 2019 (imagen 774 a 808 y 814 a 817 de expediente digital modo pdf) citando que se tiene por demostrado que ha realizado actividad agraria en todo su terreno. Así como que tal esta conformado por tres fincas que hubiere adquirido de [Nombre3] desde el año 1994. Las reunió y constituyó un fundo agrario que ha deslindado para ganadería y manejo de bosques. Propiedad con plano 732985-2001. Además que por muchos años ha ejercido y disfrutado el derecho de paso o servidumbre sobre el fundo del demandado que corresponde a la finca con matrícula CED10. Cita, un 54% del fundo del actor apelante es zona fronteriza y el restante 46% se ubica dentro del Refugio de Vida Silvestre Maquenque. Agravia, la jurisdicción agraria debe resolver por el fondo este asunto, al estar involucrada la actividad agraria ejercida por más de diez años, afectada por una conducta ilegal.
Por lo que solicita, que independientemente de la titularidad de los fundos dominantes, se considere que la actividad de producción puede ejercerse en terrenos ajenos y debe ser respetado el simple ejercicio de la actividad agraria ambiental; como sucede en el subjúdice. Reclama, si bien el Estado es titular y se relaciona el área silvestre protegida citada, en la realidad se han desarrollado actos de empresas agrarias, que nacen por políticas estatales y se han mantenido a lo largo del tiempo. Por lo que esa actividad merece la tutela jurídica y el empresario tiene derecho a ser protegido en esta vía. Por lo que su pretensión tiene respaldo legal, pues se pide se le permita seguir desarrollando su actividad. Por lo que requiere que el demandado cumpla su obligación de permitir el paso, sin interesar, como dice el fallo, sean terrenos colindantes o que la escritura de constitución de la servidumbre no se hubiera inscrito y que ya pasaran diez años.
En la pieza apelada, se acreditó que el actor ha gozado del uso de la servidumbre y que el demandado ha tratado de obstaculizar. Menciona, se pide en el proceso se garantice el derecho real que beneficia a su terreno que es una unidad agraria ambiental que nació por voluntad del demandado. Afirma, no reclama un derecho nuevo, sino la continuación del ejercicio del derecho real constituido por convenio de partes, que se ha ejercido. Lo anterior sin que interese que el fundo del actor, se encuentre o no inscrito o que se ubique dentro del Patrimonio Natural del Estado. Agrega, el Refugio Nacional de Vida Silvestre Maquenque se creó en mayo del año 2005, por lo que los fundos sometidos a posesión agrario ambiental decenal a esa época no pueden resultar afectados respecto a su titularidad . Por lo que sobre esa área mantiene todo su derecho de posesión y es apto para ser inscrito registralmente al amparo de la Ley de Información Posesoria.
Cita, por escritura pública número CED8 se constituyó la servidumbre en litis que siempre ha utilizado y [Nombre3] que le transmitió las parcelas y ese derecho de paso y es una zona apta de titularidad. Reseña, se pretende ese goce que data de fecha anterior a la creación del área silvestre protegida que es un refugio mixto de vida silvestre (con propiedad púbica y privada) y el restablecimiento de tal derecho no afecta terrenos estatales ni áreas de protección . Nunca se ha expropiado por el Estado terreno alguno a los propietarios ni poseedores. Alude a que en este caso no ha existido prueba sobre cual porción se ubica dentro del Refugio en cuestión y ostenta un contrato constituido a derecho. Reprocha, que debe esta jurisdicción conocer el asunto y ordenar la reapertura y libre ejercicio de la servidumbre en beneficio de su fundo creada en 1994. Aunado a que el Refugio se decretó el 23 de mayo del 2005; por lo que no le puede afectar la titularidad. Además de que el proceso de información posesoria se encuentra en trámite.
El ordinal 26 de la Ley de Jurisdicción Agraria establece, los tribunales podrán declarar nulidades y disponer la reposición de trámites, con la finalidad de corregir irregularidades que pudieran afectar la validez del proceso. En otro orden, en materia recursiva, el numeral 60 del cuerpo legal en cita, señala el trámite se regirá en lo pertinente por las disposiciones del Código de Trabajo. El artículo 502 de ese cuerpo legal (aplicable a este caso dado que el proceso inicia antes de la reforma procesal Transitorio I.3 Ley 9343), expone, recibidos los autos en el Tribunal, éste revisará en primer término los procedimientos; y si encontrare que se ha omitido alguna formalidad capaz de causar efectiva indefensión, decretará la nulidad de actuaciones o de resoluciones que proceda y hasta donde sea necesario para orientar el curso normal del juicio. Estipula la norma en mención, se debe hacer indicación precisa de las omisiones que deban subsanarse y de la corrección disciplinaria que corresponda.
Igualmente este Tribunal ha insistido en el principio de la conservación de los actos procesales, con la finalidad de evitar retrasos innecesarios, salvo en aquellos casos que la omisión o defecto afecte derechos fundamentales, entre otros, como el debido proceso o el de defensa. En el caso concreto, se observan vicios de la sentencia que resultan insalvables en esta instancia que obligan a anular la sentencia recurrida. En primer orden en la parte considerativa del fallo se analizó y motivó el rechazo de la excepción de prescripción interpuesta por el demandado y la Procuraduría General de la República, sin que ese pronunciamiento se hubiese consignado en la parte dispositiva de la sentencia. En igual sentido, en esa parte de la resolución impugnada solamente medió pronunciamiento sobre la excepción citada, la demanda de [Nombre1] contra [Nombre2] y la reconvención de éste último contra [Nombre2] .
Y se procedió a indicar que se rechazaba la demanda contra la comunidad de accionados en forma genérica. Sin que se mencionase nada respecto a la demanda contra la Procuraduría General de la República y JAPDEVA. Así como tampoco respecto a las acciones contra [Nombre4] , Gogo Roemi San Carlos S.A. y Conservación Ambientales Rama S.A., ordenadas mediante Voto 185-F- de las 14:30 horas del 27 de febrero del 2013 (folios físicos 381 a 388 Tomo II). Lo que era necesario citar, a efectos de la importancia del pronunciamiento de la parte dispositiva de la sentencia. Lo anterior resulta fundamental en una decisión de fondo como la emitida, al tener carácter de cosa juzgada solamente esa parte dispositiva del fallo, acorde con el artículo 162 y 163 del Código Procesal Civil derogado aplicado supletoriamente, en virtud del ordinal 26 de la Ley de Jurisdicción Agraria y Transitorio I.3 de Ley 9343.
Sobre los efectos de la cosa juzgada este Tribunal ha resuelto: "El instituto de la cosa juzgada juega un papel de seguridad jurídica muy importante, pues al reconocer inmutabilidad a lo resuelto con autoridad de cosa juzgada, impide la posibilidad de repetición de proceso sobre los mismos puntos y entre las mismas partes. Al respecto, la Sala Constitucional de la Corte Suprema de Justicia en voto 5079-95 de las 18 horas 36 minutos del 13 de setiembre de 1995, señaló: "La doctrina procesal afirma que el proceso no es una sucesión de actos sin fin, y que llega un momento en que por razones obvias, prácticas si se quiere, hay que ponerle fin. A su vez, los efectos que tenga la sentencia que llegue a dictar, depende de las circunstancias legales en que se produzca. Por eso mismo, esta Sala se aparta de la secuencia argumentativa que imprime la actora a su objeción de constitucionalidad, desde que ella tiene como punto de partida que donde la Constitución dice "se prohíbe reabrir juicios fallados con autoridad de cosa juzgada" debe entender o asumirse como un a priori, "todo juicio se falla con autoridad de cosa juzgada" o de la misma manera "toda sentencia, no importa el proceso donde recaiga, produce cosa juzgada y consecuentemente lo que ella decida no puede ser discutido nuevamente".
Estas últimas lecturas que se integrarían al texto y propósito de la frase que se contiene en el artículo 42 Constitucional, son desbordadas y chocan contra el enfoque que la doctrina procesal ha tenido en esta materia. No es así por la sencilla razón de que no todos los procesos gozan del mismo tratamiento en la legislación ordinaria, y entonces hay algunos donde el contradictorio tiene unas dimensiones distintas a las que se acuerdan para otros y de ahí la clásica división entre procesos sumarios y plenarios. Por eso mismo, es legítimo que el legislador otorgue efectos y consecuencias distintas a las sentencias, según pertenezcan o no a alguno de esos tipos de procesos." Por su parte, la Sala Primera de la Corte Suprema de Justicia en voto 315-03 de las 11 horas 30 minutos del 4 de junio de 2003, señaló: "Sobre el instituto de mérito ha indicado esta Sala: "... Al resolver en forma definitiva de las controversias sometidas a su conocimiento, el Estado, a través del Poder Judicial, asume y pone en operación una de las más importantes funciones en él recaídas: la jurisdiccional.
Para que tal función pueda efectuarse en forma eficaz, las decisiones inherentes a la potestad paralelamente otorgada, revisten dos características fundamentales: inmutabilidad y definitividad absolutas. Solamente en casos de excepción, contemplados por la ley, tales características pueden ser relativas. A esta particularidad de la función jurisdiccional, se le ha denominado en doctrina y en jurisprudencia, COSA JUZGADA. Por medio de ella se establece que la voluntad del Estado, contenida en la ley, es definitiva e inmutable para el caso concreto, lo cual es básico para la certeza y seguridad jurídicas. Esa voluntad es declarada por el juez en sentencia. De esa manera se busca ponerle fin a los asuntos decididos en fallo judicial, impedir el sucesivo planteamiento del conflicto, evitando así la incertidumbre jurídica, todo lo cual propende a la eficacia de la función jurisdiccional del Estado.
En nuestro medio, las sentencias dictadas en proceso ordinario o abreviado, así como aquellas otras resoluciones señaladas en forma taxativa, producen la autoridad de cosa juzgada material. Esta se halla limitada -con la salvedad que adelante se consignará a la parte resolutiva del fallo. Sea, no comprende sus fundamentos. Para que la sentencia incida en otros proceso mediante la cosa juzgada, es imprescindible que en ambos procesos exista identidad de partes, causa y objeto." El Tribunal comparte los argumentos expuestos por ambas Salas en los pronunciamientos citados, los cuales han sido reiterados y responden además, a lo dispuesto por los artículos 162 y 163 del Código Procesal Civil aplicado supletoriamente, según los cuales, las sentencias firmes dictas en procesos ordinarios y abreviados producen la autoridad y la eficacia de la cosa juzgada material, así como aquellas a las cuales la ley confiera expresamente ese efecto, limitándose a la parte dispositiva del fallo, siempre que en ambos casos sean iguales las partes, el objeto y la causa". (voto 798-F-09).- De tal forma que resulta necesario se emita una sentencia en donde la parte dispositiva considere todos los aspectos omitidos citados.
IV- Aunado a lo anterior, sobre las demandas a las personas integradas mediante el voto del tribunal citado, visibles en escritos de folios 396 a 402, tampoco medió valoración en la sentencia recurrida respecto a cada uno. Ya que no se hace un análisis sobre su posición en relación con el objeto del proceso. Sino que se limitó a indicar el fallo que el rechazo de la demanda lo era contra la comunidad de accionados. Lo que es insuficiente a la luz del ordinal 54 de la Ley de Jurisdicción Agraria. Cabe mencionarse, que se omitió resolver en el cuerpo de la sentencia sobre esas acciones, sin analizar realmente respecto a los integrados; a pesar de que en el encabezado fueron citadas las demandas. Incurriéndose en incongruencia por infrapetita. La parte dispositiva de la sentencia de primera instancia número 2019000190 de las diez horas y cuarenta y cuatro minutos del quince de mayo de dos mil diecinueve, resolvió: "POR TANTO: De conformidad con lo expuesto, a la luz de la citas jurisprudenciales y normativas consignadas, en cuanto a la DEMANDA, se rechazan las excepciones de falta de legitimación activa y pasiva; se admite únicamente la falta de derecho.
En consecuencia, se RECHAZA en todos sus extremos la demanda incoada por el señor [Nombre1] en contra de la comunidad de accionados. En relación a la RECONVENCIÓN, se rechazan las excepciones de falta de derecho, falta de legitimación activa y pasiva. Así las cosas, se DECLARA CON LUGAR PARCIALMENTE la CONTRADEMANDA, admitiendo la misma únicamente en lo que se dirá, entendiéndose por denegado aquellos puntos en los que no haya pronunciamiento, en ese sentido: Se declara que sobre el fundo del demandado recoventor [Nombre2] , sea la finca del partido de Heredia matrícula número CED7, no existe ninguna limitación o servidumbre a favor de la finca del actor reconvenido, descrita en el plano H-732985-2001. Se le ordena al actor reconvenido [Nombre1] , que una vez firme está sentencia, debe de abstenerse de ingresar a la propiedad del señor [Nombre2] , sea la finca Partido de Heredia matrícula número CED7, sea de forma personal o por medio de sus peones u otras personas que vayan hacia su propiedad.
Debe don [Nombre1] , abstenerse de ingresar a pie, a caballo, o en vehículo y con animales al terreno del accionado [Nombre2] . Se resuelve éste asunto, sin especial condenatoria en costas. HÁGASE SABER “ (ver escritorio virtual del Juzgado Agrario de Guápiles, documentos asociados, 15/05/2019 10:44:33).
IV- Por lo que, con fundamento en el artículo 1, 2, 26 y 54 de la Ley de Jurisdicción Agraria y lo explicado, deberá decretarse la nulidad de la sentencia número 2019000190 de las diez horas y cuarenta y cuatro minutos del quince de mayo de dos mil diecinueve a fin de que sea emitida una nueva resolución.
POR TANTO
Se anula la sentencia número 2019000190 de las diez horas y cuarenta y cuatro minutos del quince de mayo de dos mil diecinueve.
