SUMMARY TREE-FELLING PROCEEDING (PROCESO SUMARIO DE DERRIBO) filed by [Nombre1] , of legal age, resident of Pavones, identity card CED1 - – ; against UNKNOWN. The PROCURADURÍA GENERAL DE LA REPÚBLICA participates in the proceeding, represented by [Nombre2] , of legal age, married, attorney, resident of San José, identity card CED2 – . Attorney Miguel Ángel Hernández Ureña, whose personal particulars are not shown in the record, acts as public defender for the plaintiff. Heard before the Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón.
RESULTS:
1. The plaintiff files a summary proceeding, requesting that the judgment declare the following: “1. That the felling of the aforementioned trees be ordered and that I be granted disposal of the timber,” (see the virtual desktop of the Juzgado Agrario de Pérez Zeledón, filing entered on 02/10/2019 02:53:54).
2. The Procuraduría General de la República entered an appearance (apersonamiento) in the proceeding, (see the virtual desktop of the Juzgado Agrario de Pérez Zeledón, filing entered on 28/10/2019 10:05:43 and 28/10/2019 10:06:59.).
3. Judge Alejandro Li Ruiz, of the Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, in judgment number 2020000053, issued at fourteen hours and twenty minutes on March fifth, two thousand twenty, ruled: “The present possessory tree-felling action (demanda interdictal de derribo) filed by [Nombre1] is PARTIALLY GRANTED, as set forth below, with any relief not expressly granted deemed denied: The plaintiff is authorized to: a) Completely cut down trees numbered 1 and 2, of the Cedro Amargo species. The costs of felling shall be borne by the requesting party, who must also take all safety and technical measure[s] (sic) to prevent harm to third parties, as well as unnecessary harm to the environment and natural resources, which must be affected only to the extent strictly necessary. If applicable, notice must be given to third parties who may be affected by a falling branch, and any necessary permits must be obtained, (for example, to enter other properties), on the basis of the judicial authorization hereby granted.
Regarding the timber harvesting (aprovechamiento maderable) of the trees authorized to be cut, the plaintiff is advised that the authorization empowers him only to cut down the trees, at his own expense. The use of the timber obtained from the trees and branches that are cut, if usable, is granted to the Junta de Educación de la Escuela mas (sic) cercana, which must report within THREE DAYS and submit its proper acceptance thereof (Article 65 of the Ley Forestal); the beneficiaries, in turn, must obtain the permits for the extraction, sawing, and transportation of the timber and bear the respective costs generated by that work. MINAE is authorized to verify that everything ordered in this decision is duly carried out. In view of the manner in which the proceeding is concluded, no special award of costs is made. The plaintiff is urged, once the felling authorized herein has been completed, to endeavor to conserve the protection area (área de protección) of the Quebrada sin [Dirección1] and even to reforest it.
Once this judgment becomes final, it is ordered that notice thereof be given, for purposes of the authorizations granted and matters within its responsibility, to La Oficina Regional del MINAE de Pérez Zeledón, which, in the performance of its duties, must eventually grant any permits necessary for sawing or transporting the timber produced by the tree[s] (sic) whose cutting or branch removal is ordered. Such notification[s] (sic) shall be sent to the contact information provided in the record by MINAE. The participants are advised that this decision may be challenged; therefore, if any party files an appeal (recurso de apelación) against it, please also send the appeal electronically to the address [...] This is due to the introduction of oral proceedings in agrarian matters. Furthermore, if a party wishes the appellate court to grant an oral hearing, it must so state in the same appeal brief.
Likewise, the parties are advised to designate, as a matter of priority, an email address at which to receive notifications, because documents recorded in audio or video format (oral judgment) may be sent to them by that means,” (see the virtual desktop of the Juzgado Agrario de Pérez Zeledón, associated documents, trial-court judgment entered on 05/03/2020 14:20:57).
4. Attorney Miguel Ángel Hernández Ureña, in his capacity as public defender for the plaintiff, filed an appeal expressly stating the grounds on which he relied to refute the trial court’s position, (see the virtual desktop of the Juzgado Agrario de Pérez Zeledón, filing entered on 06/03/2020 10:56:26).
5. The legal requirements have been observed in the conduct of the proceeding, and there are no errors or omissions capable of rendering the judgment null and void.
Judge Díaz Bolaños drafts the opinion; and,
CONSIDERING:
I.The established facts (hechos probados) are adopted in their entirety because they are well supported by the record, with the exception of the fact numbered three. Its wording is amended as follows: 3) The trees described in the first and second facts are located within the protection area of an unnamed stream (MINAE report in table 4 and video number two in the compact disc on file).
II.The judgment issued at 14 hours 20 minutes on 05 March 2020, shown in images 57 through 63 of the virtual case file of the Juzgado Agrario de Pérez Zeledón, is appealed. That decision partially granted the summary tree-felling proceeding; the cutting of two Cedro Amargo trees was authorized. Taken together, it ordered that the costs be borne by the petitioner; that use of the timber be granted to the Junta de Educación of the nearest educational center; and that no special award of costs be made. The appeal is signed by agrarian public defender Miguel Ángel Fernández Ureña on behalf of [Nombre1] . The sole ground for challenge is the provision granting use of the forest species to the local Junta de Educación. He asserts that it must be granted to the true owner pursuant to Articles 505 and 506 of the Código Civil. He invokes this Chamber’s judgment number 1098-F-2018. He states that tree-felling proceedings are generally requested by persons of limited means who must negotiate for the cutting by offering part of the timber. He reasons that, at present, timber is of no use to schools and creates a conflict for them because they use other materials and working methods. He requests that the judgment be reversed solely to grant the timber to the petitioner (tables 66 through 67).
III.In the case at hand, it has been established that the two tree species pose a danger because they are located near one of the two dwellings situated on the property. In this regard, official letter SINAC-ACLA-P-SRPZ-1047-2019, dated 27 de setiembre de 2019, following a field inspection conducted on 25 de setiembre of that same year, explained: “…it was determined that there are indeed two trees that endanger human life, due to the height of the trees in relation to their distance from two single-family dwellings. One of these dwellings was built within a stream protection area (área de protección de quebrada) and therefore presents a risk” (table 4). In addition to the foregoing, the second video of the judicial inspection (reconocimiento judicial) conducted on 24 de enero de 2020 documented the existence of a body of water. It is identified as a stream or gully (quebrada o yurro), which forms a kind of lagoon.
According to the additional information in the third audio recording, that body of water is approximately three or four meters away. However, as indicated, the MINAE report determined that both tree species are located within the protective zone (zona protectora) on the applicant’s property, registered in the San José district under number CED3. In order to resolve the issue on appeal, it is relevant to cite this Chamber’s analysis concerning the use (aprovechamiento) of timber resulting from the felling of tree species: “...For these purposes, the Court finds that the judgment does contain contradictory and confusing statements. With respect to the applicable legislation, there is indeed no provision that directly justifies the decision made and issued by the judge. This is demonstrated by the fact that the judgment cites no article whatsoever in support of it. The decision denying the request for clarification and supplementation (aclaración y adición) cites Article 65 of Ley Forestal 7575 because it is mentioned by the representative of the State in the appeal under review, filed following the denial of those requests.
The Procurator states that this provision is inapplicable because it concerns criminal proceedings involving unlawful acts, which is a situation different from that raised in these proceedings. In this regard, it must be noted that the provision in question states verbatim: “ARTICLE 65.—Auction of seized products. Violations of this law shall be reported to the competent judicial authority and, if timber or other forest products are seized, that authority, following an appraisal conducted by the Administración Forestal del Estado, shall sell them at public auction within a period not exceeding one month from the date on which the complaint was filed. Such forest products may not be auctioned for less than the value established by the Administración Forestal del Estado. If, after that period has elapsed, the timber or forest resources have not been auctioned, any person may use them after depositing with the Court the value assigned by the Administración Forestal del Estado.
The proceeds of the auction shall be deposited into the account of the corresponding judicial authority while the relevant proceedings are resolved. If the accused is acquitted, the money shall be delivered to that person; otherwise, fifty percent (50%) shall belong to the Administración Forestal del Estado and the other fifty percent (50%) to the municipalities of the place where the property from which the raw material was extracted is located, or where the industry is located, or to the indigenous association if it is on an indigenous reserve, to be used for the development of forestry projects, without prejudice to any criminal liability determined with respect to the offenders. The Ministerio del Ambiente y Energía is authorized, through the Administración Forestal del Estado, to donate to the Ministerio de Educación Pública any timber that comes into its possession as a result of a natural disaster or road widening, provided that the owners are unknown.
It shall also donate seized timber once the conviction has become final, provided that it was neither awarded at auction nor requested by any person meeting the legal requirements. The Ministerio de Educación Pública shall use that timber to manufacture furniture or repair infrastructure in public schools and secondary schools, or as raw material in cabinetmaking, woodturning, carpentry, and other subjects taught by state schools and secondary schools. (These final two paragraphs were added by Article 1, subsection b), of Law No. 7609 of 11 de junio de 1996).” A reading of the provision shows that it does not, in fact, offer a specific solution for the present case, heard in summary possessory proceedings (sede interdictal), because it concerns timber seized as a result of unlawful acts. Nevertheless, there are no provisions resolving this case, either in the Ley de Jurisdicción Agraria or in Articles 474 to 476 of the Código Procesal Civil, which applies on a supplementary basis.
In that situation, because a provision exists concerning the disposition and use of trees, even though it addresses unlawful acts, it may be applied by analogy. In this regard, Article 12 of the Código Civil states: “Provisions may be applied by analogy when they do not contemplate a specific situation but regulate another similar situation in which the same rationale is present, unless a provision prohibits such application”; and no provision of the Ley de Jurisdicción Agraria prohibits application by analogy. Article 65 cited above, insofar as relevant to this case, delegates the appraisal and auction of timber or other forest products, when the timber is seized, to the Administración Forestal del Estado, granting it a period not exceeding one month for that purpose. In this case, the timber has not been seized because, according to the information in the case file (expediente), its felling remains pending.
The judgment did not establish a deadline for cutting the five laurel trees, an omission that must be remedied so that the ruling may be enforced and the risks that could result from their falling may be managed; however, it stated that, once they had been felled, the Ministry was to appraise them, a task that the Court considers inherent in the functions assigned to it by law, since it is staffed by officials with expertise in the subject. The provision further states that the property must be sold at public auction within one month for the amount established by the Ministry; and only if the timber or forest resources cannot be auctioned may any person use them after depositing with the Court the value assigned by the Administración Forestal. In this case, because the forest product does not arise from an unlawful act but from a preventive measure, the possibility of its use by any person must yield to the priority that should be afforded to the plaintiff, because the trees are located on property possessed by Mr. [Nombre3], and he is therefore the person who may use them while taking the corresponding preventive measures, on the understanding that he must allocate the value of those forest resources to restoring the area affected by the removal of those trees.
Such restoration must necessarily be carried out by Mr. [Nombre3] in coordination with the experts designated by the Oficina Regional del Ministerio de Ambiente y Energía, because, as this is a protection zone (zona de protección), endemic or native trees from that zone must be planted. Accordingly, the plaintiff must not be left free to replace the laurel trees to be felled with any other species, but only with those designated by the aforementioned Ministry. The provision sets out a circumstance unrelated to these proceedings: if the person is acquitted of the unlawful act, the appraisal proceeds shall be delivered to that person; otherwise, 50% of the amount shall belong to the Administración Forestal del Estado and the other 50% to the municipality where the property is located, to be used for the development of forestry projects. Similarly, the Ministerio del Ambiente y Energía is authorized, through the Administración Forestal, to donate to the Ministerio de Educación Pública any timber that comes into its possession as a result of a natural disaster or road widening, provided that the owners are unknown.
This case does not involve forest products connected with an unlawful act such that their value should be distributed 50% to the Administración Forestal del Estado and the other 50% to the municipality. With respect to the participation of educational institutions, the provision allows the Ministerio del Ambiente y Energía to donate to the Ministerio de Educación Pública any timber that comes into its possession as a result of a natural disaster or road widening, provided that the owners are unknown; it also permits the donation of seized timber once the conviction has become final, provided that the timber was neither awarded at auction nor requested by any person meeting the legal requirements. This case does not involve a natural disaster, because the purpose of the proceedings is to prevent one, nor does it involve road widening; and although those circumstances could be considered analogous to the present case, the situation contemplated by the provision differs in that it presupposes that the owner of the property where the trees are located is unknown.
In this case, the plaintiff submitted a registry certificate establishing that he is the registered owner of the property; and although summary possessory proceedings (procesos interdictales) may not address matters relating to ownership rights, as provided in Article 457 of the Código Procesal Civil, which applies on a supplementary basis, that information is particularly relevant in determining whether the forest resources are located within the plaintiff’s land, thereby ruling out the possibility that the owner of the property where the trees are located is unknown. It must further be added that the allocation to the Ministerio de Educación Pública of forest resources resulting from unlawful acts or, in general, from any judicial proceeding must be made in accordance with the purposes established in the provision—that is, so that the timber is used to “manufacture furniture or repair infrastructure in public schools and secondary schools”—and not merely to seek to allocate to it financial resources derived from the trees without a specific purpose or designated use, as the representative of the State correctly observes.
From the quoted text, the Court concludes that the judgment is unclear; however, it cannot be considered void …. In view of the foregoing, pursuant to Articles 50 of the Constitución Política; 6 subsection g), 31, 49, and 65 of Ley Forestal 7575; 12 of the Código Civil; 474 to 476 of the Código Procesal Civil; and 1, 6, 26, 54, and 79 of the Ley de Jurisdicción Agraria, the judgment must be reversed insofar as it orders that the forest products be donated specifically to the Escuela de Iroquois de Guácimo and requires the plaintiff to pay the value of the forest products established by the Ministerio de Ambiente y Energía. In all other respects under appeal, the judgment must be affirmed insofar as it authorizes Mr. [Nombre3], once this decision becomes final, to remove the five laurel trees at issue in the litigation, in which case he must take all necessary preventive and precautionary technical measures to avoid causing harm to persons or property.
The Ministerio de Ambiente y Energía must take the necessary preventive measures and ensure that the felling of the laurel trees is carried out in compliance with the provisions of Ley Forestal; and once the cutting has been completed, that Office shall proceed to appraise the aforementioned forest products.
The plaintiff may use the timber without being required to make any deposit, since the trees are located within the property registered in his name, in which case the Ministerio de Ambiente y Energía must grant him the transportation, processing, or other permits necessary for its use ….” In the case under consideration, the judge determined, based on the judicial inspection (reconocimiento judicial) and the report issued by MINAE for that purpose, that the trees are located where previously described. The plaintiff, acting responsibly, sought the respective permits for the forest species located within her property. For her part, she complied with the procedures and formalities for the felling (derribo), which was technically approved because of the imminent danger. It is considered that those species form part of her estate (fundo), in accordance with Articles 505 and 506 of the Código Civil.
In that regard, the Sala Constitucional de la Corte Suprema de Justicia ruled in Voto 2007-10578 of July 25, 2007, on the substance of the right to property (derecho de propiedad) as follows: “The right to property has an essential content that the Chamber has defined as the authority to enjoy and use property for personal benefit (private property) or for public use (public property). Therefore, under the pretext of imposing certain limitations in the ‘social interest,’ the public authority, whether the Legislature or the Executive, may not eliminate one or more of its essential attributes. In such a situation—that is, if the limitations imposed on property infringe the essential content of the right to property—the owner is entitled to compensation. In this regard, the Chamber has stated: ‘In other words, the attributes of property may be limited provided that the owner retains the possibility of making normal use of the property, excluding, of course, the portion or function affected by the limitation imposed by the State.
Outside these parameters, if social welfare requires a sacrifice from only one or a few persons, compensation must be paid, as also occurs when the sacrifice imposed on the owner is of such a nature that it causes the owner to lose the property in its entirety. Thus, a limitation on property withstands constitutional scrutiny when the effect on the essential attributes of property—those that permit the natural use of the thing within current socioeconomic conditions—does not eliminate the nature of the property or make use of the thing impossible because the State imposes authorization or approval requirements so complex that they effectively make it impossible to derive benefit from the property.’ (Judgment N° 2345-96).” For the reasons explained above, it is determined that the rule requiring timber products (producto maderable) to be granted to the Juntas de Educación applies when they arise from circumstances entirely different from those created by the felling of a tree because it poses a danger to human life.
The foregoing position is further supported by the provisions of the Código Civil concerning the scope of the right to property. This situation does not change because the species are located in a protected zone (zona protectora), since the existing environmental restrictions concern exploitation, but may in no way be extended to the use of the trees under the circumstances analyzed here. The authority to find a commercial use for that resource, under the cited civil legislation, forms part of the right to use, enjoy, and derive benefit from her estate and its products.
IV.In accordance with provisions 505 and 506 of the Código Civil, the appealed ruling shall be reversed solely insofar as it grants the use of the timber resulting from the trees and branches to be cut, if usable, to the Junta de Educación of the nearest school, which must report within THREE DAYS and submit its duly executed acceptance thereof (Article 65 of the Ley Forestal); the Junta must, in turn, obtain the permits for the extraction, sawing, and transportation of the timber and bear the corresponding costs arising from such work. Instead, the plaintiff shall be recognized as having the right to use the timber obtained from the trees authorized to be felled, subject to duly obtaining and complying with the permits and legal requirements for that purpose, as well as observing the necessary safety measures during the felling, transportation, and sale process.
POR TANTO:

VOTO N° 000304-F-2020 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las diez horas y siete minutos del uno de abril de dos mil veinte.
PROCESO SUMARIO DE DERRIBO interpuesto por [Nombre1] , mayor, vecino de Pavones, cédula de identidad CED1 - – ; contra IGNORADO. Interviene en el proceso la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por [Nombre2] , mayor, casada, abogada, vecina de San José, cédula de identidad CED2 – . Actúa como defensor público de la parte actora, el licenciado Miguel Ángel Hernández Ureña, de calidades desconocidas en autos. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón.
RESULTANDO:
1. La parte actora presenta proceso sumario, solicitando que en sentencia se declare lo siguiente: "1. Se ordene el derribo de los árboles mencionados y se me otorgue la disposición de la madera”, (ver escritorio virtual del Juzgado Agrario de Pérez Zeledón, escrito incorporado el 02/10/2019 02:53:54).
2. La Procuraduría General de la República se apersonó al proceso, (ver escritorio virtual del Juzgado Agrario de Pérez Zeledón, escrito incorporado el 28/10/2019 10:05:43 y 28/10/2019 10:06:59.).
3. El juez Alejandro Li Ruiz, del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, en sentencia número 2020000053, de las catorce horas y veinte minutos del cinco de marzo de dos mil veinte, resolvió: "Se ACOGE PARCIALMENTE la presente demanda interdictal de derribo interpuesta por [Nombre1] , en la forma que se dirá, entendiéndose por denegado lo que expresamente no se conceda: Se autoriza al actor a: a) La corta total de los árboles enumerados 1 y 2, de la especie Cedro Amargo. Los gastos de derribo corren a cargo de la parte gestionante, quien debe además tomar todas las medida (sic) de seguridad y técnicas, para evitar daños a terceros, así como evitar daños innecesarios al ambiente y los recursos naturales, que deben verse afectados solo en lo estrictamente necesario. Si es del caso, debe dar aviso a terceros que puedan verse afectados con la caída de alguna rama, y requerir los permisos que fueran necesarios, (por ejemplo, para ingresar a otros terrenos), con fundamento en la autorización judicial que se le concede.
En cuanto al aprovechamiento maderable de los árboles que se autoriza cortar, se aclara a la parte actora que la autorización únicamente le faculta para realizar la corta de los árboles, a su costo. El aprovechamiento de la madera resultante de los árboles y ramas que se corten, en caso de que sea aprovechable, se concede a favor de la Junta de Educación de la Escuela mas (sic) cercana, la cual deberá informar en el plazo de TRES DÍAS y aportar la debida aceptación de la misma (artículos 65 de la Ley Forestal), quienes a su vez deben gestionar los permisos para la extracción, aserrío y traslado de la madera, y asumir los costos respectivos que generen esas labores. Queda autorizado el MINAE para verificar que todo lo ordenado en esta resolución se verifique en la forma debida. Por la forma como se concluye el proceso, se resuelve sin especial condenatoria en costas. Se le insta a la parte actora a que una vez realizada la tala aquí autorizado deberá de procurar conservar el área de protección de la Quebrada sin [Dirección1] e incluso reforestarla.
Una vez firme esta sentencia, se ordena le sea notificada, para efectos de las autorizaciones concedidas y para lo de su cargo, a La Oficina Regional del MINAE de Pérez Zeledón, quien deberá en función de su cargo otorgar eventualmente los permisos necesarios para el aserrío o traslado de la madera que produzcan los arboles (sic) que se ordena su corta o desrrame. Dicha notificaciones (sic) se realizará al medio aportado en autos por el MINAE. Se les hace saber a los intervinientes que esta resolución es impugnable, por lo que si alguna de las partes va a presentar recurso de apelación contra la misma, favor remitir además, el recurso de apelación por formato electrónico a la dirección [...] Ello por motivo de la inserción de la oralidad en materia agraria. Además si es el deseo de la parte que el Tribunal de alzada les confiera una audiencia oral, deberán de hacerlo saber en el mismo escrito de apelación.
En igual sentido se le recomienda a las partes señalar prioritariamente un correo electrónico donde recibir notificaciones, ello porque a través de este medio, se les puede enviar documentos grabados en audio o video (sentencia oral)", (ver escritorio virtual del Juzgado Agrario de Pérez Zeledón, documentos asociados, sentencia de primera instancia incorporada el 05/03/2020 14:20:57).
4. El licenciado Miguel Ángel Hernández Ureña, en su condición de defensor público de la parte actora, interpuso recurso de apelación con indicación expresa de las razones en que se apoya para refutar la tesis del juzgado de instancia, (ver escritorio virtual del Juzgado Agrario de Pérez Zeledón, escrito incorporado el 06/03/2020 10:56:26).
5. En la substanciación del proceso se han observado las prescripciones legales, y no hay errores u omisiones capaces de producir la nulidad del fallo.
Redacta la jueza Díaz Bolaños; y,
CONSIDERANDO:
I.Se comparte el conjunto de hechos probados por tener buen sustento en los autos, a excepción del marcado con el número tres. A éste se le modifica la redacción de la siguiente manera: 3) Los árboles detallados en el hechos primero y segundo se ubican dentro de la zona protectora de una quebrada sin nombre (informe del MINAE en cuadro 4 y video número dos en disco compacto en archivo).
II.Se apela la sentencia de las 14 horas 20 minutos del 05 de marzo de 2020 visible en imágenes 57 a 63 del expediente virtual del Juzgado Agrario de Pérez Zeledón. En tal decisión se acogió parcialmente el sumario de derribo; se autorizó la corta de dos árboles de la especie cedro amargo. En conjunto se dispuso los gastos son a cargo del peticionante; el aprovechamiento de la madera se concede a favor de la Junta de Educación del centro educativo más cercano; y, sin especial condenatoria en costas. El recurso es rubricado por el defensor público agrario Miguel Ángel Fernández Ureña en representación de [Nombre1] . El único motivo de impugnación es la disposición de otorgar el aprovechamiento de las especies forestales a la junta de educación del lugar. Afirma se debe otorgar al verdadero dueño de acuerdo con los artículos 505 y 506 del Código Civil. Invoca la sentencia de esta Cámara número 1098-F-2018. Manifiesta, generalmente los derribos son pedidos por personas de escasos recursos que tienen que negociar la corta con parte de la madera. Razona, para las escuelas, en esta época la madera no es de utilidad, les genera un conflicto pues disponen de otros materiales y técnicas de trabajo. Pide se revoque la sentencia únicamente en otorgar la madera a favor de promovente (cuadros 66 a 67).
III.En la especie se tiene por demostrado que las dos especies forestales representan un peligro dado que se ubican cerca de una de las dos viviendas ubicadas en la heredad. Al respecto el oficio SINAC-ACLA-P-SRPZ-1047-2019 datado 27 de setiembre de 2019, después de verificada una inspección en el campo el 25 de setiembre de ese mismo año explicó: “…se logra determinar que efectivamente existen dos árboles que atentan contra la vida humana, esto debido a la altura de los árboles con respecto a la distancia de los mismos con respecto a dos viviendas unifamiliares. Una de estas viviendas fue construida en área de protección de quebrada y por eso presenta riesgo” (cuadro 4). Abonado a lo anterior, en el segundo video del reconocimiento judicial efectuado el 24 de enero de 2020 se detalló la existencia de un cuerpo de agua. Es identificado como una quebrada o yurro, que forma una especie de laguna.
Ese cuerpo de agua, según lo adicionado en el audio tercero, están a una distancia de más o menos tres o cuatro metros. Empero como se indicó, en el informe del MINAE se determina que sendas especies forestales se ubican en la zona protectora, de la propiedad del gestionante del partido de San José número CED3. En aras de dilucidar el punto objeto de apelación es de relevancia citar lo analizado por esta Cámara concerniente al destino del aprovechamiento de la madera producto de los derribos de especies forestales: “...Al efecto, estima el Tribunal sí existen ideas contradictorias y confusas en la sentencia. Respecto a la legislación aplicable, efectivamente, no existe norma alguna que directamente justifique la decisión tomada y emitida por el juzgador. Tan es así que en la sentencia no se cita artículo alguno que lo justifique. Se cita en la resolución que rechaza la aclaración y adición el artículo 65 de la Ley Forestal 7575 porque es mencionado por el representante del Estado en el recurso de apelación en estudio, incoado ante la denegación de tales peticiones.
El Procurador indica, esa norma no es aplicable porque se refiere a procesos penales en los que se conozca de ilícitos, siendo una situación diferente a la planteada en este proceso. Al respecto debe señalarse, la norma en mención dispone literalmente: “ARTÍCULO 65.- Remate de productos decomisados. Las infracciones de esta ley se denunciarán ante la autoridad judicial competente y, si se decomisa madera u otros productos forestales, la referida autoridad, previo avalúo realizado por la Administración Forestal del Estado, los rematará en subasta pública, dentro de un plazo no mayor de un mes contado a partir de la fecha en que se interpuso la denuncia. Esos productos forestales no podrán subastarse por un valor menor al fijado por la Administración Forestal del Estado. Si transcurrido ese plazo, no se ha rematado la madera o los recursos forestales, cualquier persona podrá aprovecharlos, previo depósito, en el Tribunal, del valor asignado por la Administración Forestal.
El producto del remate se depositará en la cuenta de la autoridad judicial correspondiente, mientras se define el proceso respectivo. Si el indiciado resulta absuelto, se le entregará el dinero; en caso contrario, el cincuenta por ciento (50%) le corresponderá a la Administración Forestal del Estado y el otro cincuenta por ciento (50%), a las municipalidades del lugar donde se encuentre el fundo del cual se extrajo la materia prima o donde se ubique la industria o a la asociación de indígenas, si es una en reserva indígena, para destinarlo al desarrollo de proyectos forestales; todo sin perjuicio de las responsabilidades penales que se determinen para los infractores. Se autoriza al Ministerio del Ambiente y Energía para que, por medio de la Administración Forestal, done al Ministerio de Educación Pública la madera que llegue a su poder como resultado de un desastre natural o por ampliación de carreteras, siempre que los propietarios sean desconocidos.
También donará la decomisada, una vez firme la sentencia condenatoria, y que no haya sido adjudicada en remate ni solicitada por persona alguna con los requisitos de ley. El Ministerio de Educación Pública destinará esa madera a fabricar mobiliario o reparar infraestructura en escuelas y colegios públicos o utilizarla como materia prima en las asignaturas de ebanistería, torno, carpintería y otras que impartan escuelas y colegios estatales. (Así adicionados estos dos últimos párrafos por el artículo 1, inciso b), de la ley No. 7609 de 11 de junio de 1996).” De la lectura de la norma se desprende que efectivamente, no ofrece una solución específica para el caso concreto, ventilado en sede interdictal, pues está referido a madera decomisada producto de ilícitos. No obstante, ante la ausencia de normativa que de solución a este caso, tanto en la Ley de Jurisdicción Agraria como en los artículos 474 al 476 del Código Procesal Civil aplicado supletoriamente.
Ante esa situación, y existiendo una norma referida al destino y aprovechamiento de árboles, aunque esté referida a ilícitos, es aplicable analógicamente. Al respecto, el artículo 12 del Código Civil señala: “Procederá la aplicación analógica de las normas cuando éstas no contemplen un supuesto específico, pero regulen otro semejante en el que se aprecie identidad de razón, salvo cuando alguna norma prohíba esa aplicación.”; sin que exista norma alguna en la Ley de Jurisdicción Agraria que prohíba la aplicación analógica. El artículo 65 citado, en lo que a este caso interesa, en caso de que la madera se decomise, delega la valoración y subasta de la madera u otros productos forestales a la Administración Forestal del Estado, para lo cual le confiere un plazo no mayor de un mes. En este caso, la madera no está decomisada pues conforme a la información que consta en el expediente, está pendiente de tala.
En la sentencia no se dio un plazo para la corta de los cinco árboles de laurel, omisión que debe llenarse para que el fallo sea ejecutable y se administren los riesgos que la caída de los mismos podrían generar; sin embargo se indicó, una vez talados, el Ministerio debía proceder a valorarlos, labor que estima el Tribunal es consustancial a las funciones dadas por ley al mismo, al estar integrado por funcionarias y funcionarios expertos en la temática. La norma señala además, los bienes deben rematarse en subasta pública dentro del plazo de un mes, por el monto fijado por el Ministerio; y sólo en caso de que no se logre rematar la madera o los recursos forestales, cualquier persona podrá aprovecharlos, previo depósito, en el Tribunal, del valor asignado por la Administración Forestal. En este caso, como el producto forestal no deriva de un acto ilícito, sino de una medida preventiva, la posibilidad de aprovecharlos por cualquier persona cede ante la prioridad que debe darse a la parte demandante, pues los árboles están ubicados en una propiedad en posesión del señor [Nombre3] , de manera tal que es éste quien puede aprovecharlos tomando las medidas de prevención respectiva, en el entendido de que el valor de esos recursos forestales debe destinarse por parte de éste a la recuperación del área que resulte afectada con la eliminación de esos árboles, la cual necesariamente debe hacerse por parte del señor [Nombre3] en coordinación con las personas expertas que designe la Oficina Regional del Ministerio de Ambiente y Energía., pues al ser una zona de protección, deben sembrarse árboles endémicos o nativos de ésta, de manera tal que no debe dejarse abierta la posibilidad del demandante de sustituir los árboles de laurel que serán talados por cualquier otra especie, sino solo por aquellas que dispongan el Ministerio referido.
La norma plantea el supuesto, ajeno a este proceso, de que si la persona resulta absuelta del ilícito, se le entregará el dinero producto del avalúo, de lo contrario, el 50% del monto le corresponderá a la Administración Forestal del Estado y el otro 50% a la Municipalidad del lugar donde se encuentre el fundo para destinarlo al desarrollo de proyectos forestales; de igual forma, se autoriza al Ministerio del Ambiente y Energía para que, por medio de la Administración Forestal, done al Ministerio de Educación Pública la madera que llegue a su poder como resultado de un desastre natural o por ampliación de carreteras, siempre que las personas propietarias sean desconocidas. En este caso, no se está en presencia de productos forestales vinculados con un ilícito como para asumir distribuir el valor de éstos en un 50% a la Administración Forestal del Estado y el otro 50% a la Municipalidad. En relación con la participación de centros de enseñanza, la norma permite que el Ministerio del Ambiente y Energía done al Ministerio de Educación Pública la madera que llegue a su poder como resultado de un desastre natural o por ampliación de carreteras, siempre que los propietarios sean desconocidos; y permite la donación de madera decomisada, una vez firme la sentencia condenatoria, y que no haya sido adjudicada en remate ni solicitada por persona alguna con los requisitos de ley.
En este caso, no se está en presencia de un desastre natural, pues el objetivo del proceso es su prevención, ni de ampliación de carreteras; y aunque tales supuestos podrían asimilarse al caso en concreto, dista el supuesto señalado por la norma en el hecho de que supone, la persona propietaria del bien donde están los árboles sea desconocida. En este caso, el demandante aportó certificación registral en la que consta es el titular registral del fundo; y aunque en procesos interdictales no es posible referirse a aspectos vinculados con el derecho de propiedad conforme lo prevé el artículo 457 del Código Procesal Civil aplicado supletoriamente, el dato resulta de particular interés para determinar si los recursos forestales están dentro del terreno del demandante, descartando con ello que sea desconocida la persona dueña del fundo donde están los árboles. Ahora bien, debe agregarse, la asignación de recursos forestales al Ministerio de Educación Pública producto de ilícitos o en general, de cualquier proceso judicial, debe hacerse conforme a los fines dispuestos en la norma, es decir, para que la madera se destine a “fabricar mobiliario o reparar infraestructura en escuelas y colegios públicos”, y no simplemente pretender asignarle recursos económicos producto de los árboles sin un fin específico o sin un destino concreto, como bien lo advierte el representante estatal.
De lo transcrito, concluye el Tribunal, la sentencia no es clara; sin embargo, no podría considerarse está viciada de nulidad …. Por lo expuesto, con fundamento en los artículos 50 de la Constitución Política; 6 inciso g), 31, 49 y 65 de la Ley Forestal 7575; 12 del Código Civil; 474 al 476 del Código Procesal Civil; y 1, 6, 26, 54 y 79 de la Ley de Jurisdicción Agraria; deberá revocarse la sentencia en la parte en que dispone donar los productos forestales específicamente a la Escuela de Iroquois de Guácimo y exige al demandante pagar el valor de los productos forestales que establezca el Ministerio de Ambiente y Energía. En lo demás, objeto de apelación, deberá confirmarse la sentencia en lo atinente a la autorización que se da al señor [Nombre3] para que a partir de la firmeza de esta resolución, extraiga los cinco árboles de laurel objeto de la litis, en cuyo caso deberá tomar las medidas técnicas preventivas y precautorias que sean necesarias a fin de no causar daños a personas o bienes.
El Ministerio de Ambiente y Energía deberá tomar las medidas preventivas necesarias y controlar que el proceso de tala de los árboles de laurel se ejecute cumpliendo con las disposiciones de la Ley Forestal; y una vez realizada la corta, dicha Oficina procederá al avalúo de los productos forestales mencionados. El demandante podrá aprovechar la madera, sin necesidad de depósito alguno al encontrarse los árboles dentro de la finca inscrita a su nombre, en cuyo caso, el Ministerio de Ambiente y Energía debe otorgarle los permisos de transporte, procesamiento u otros que sean necesarios, para su aprovechamiento …“. En el caso en estudio, se determinó por el juez en el reconocimiento judicial y el informe del MINAE brindado al efecto, que los árboles se sitúan donde ya fue descrito. Y la actora de forma responsable ha acudido a solicitar los permisos respectivos de las especies forestales ubicados dentro de su terreno.
Acatando por su parte los procedimientos y trámites para el derribo que se aprobó técnicamente dado el peligro inminente. Se estima, esa especie es parte de su fundo acorde con lo dispuesto en el artículo 505 y 506 del Código Civil. En ese orden de ideas, la Sala Constitucional de la Corte Suprema de Justicia ha resuelto en el Voto 2007-10578 del 25 de julio del 2007 el contenido del derecho de propiedad de la siguiente forma: “El derecho de propiedad tiene un contenido esencial que la Sala ha definido como la facultad de disfrutar y usar el bien para provecho personal (propiedad privada) o para utilidad pública (propiedad pública). Por ello, so pretexto de imponer determinadas limitaciones de “interés social”, no puede la autoridad pública, sea el Legislador o el Ejecutivo, eliminar uno o varios de sus atributos esenciales. En tal situación, es decir, si las limitaciones impuestas a la propiedad vulneran el contenido esencial del derecho de propiedad, el propietario tiene derecho a ser indemnizado por ello.
En este sentido, la Sala ha señalado: “Es decir, pueden limitarse los atributos de la propiedad, en tanto el propietario reserve para sí la posibilidad de explotar normalmente el bien, excluida claro está, la parte o la función afectada por la limitación impuesta por el Estado. Fuera de estos parámetros, si el bienestar social exige sacrificios de uno o de algunos únicamente, debe ser indemnizado, lo mismo que ocurre cuando el sacrificio que se impone al propietario es de tal identidad, que lo hace perder en su totalidad el bien. Así, la limitación a la propiedad resiste el análisis constitucional, cuando la afectación a los atributos esenciales de la propiedad que son aquellos que permiten el uso natural de la cosa dentro de la realidad socio-económica actual, no hace desaparecer la naturaleza del bien o no haga imposible el uso de la cosa, porque el Estado imponga requisitos de autorización o de aprobación tan complejos que impliquen de hecho, la imposibilidad de usufructuar el bien”.
(sentencia N° 2345-96).” Debido a lo explicado, se determina que lo regulado en cuanto a otorgar el producto maderable a las Juntas de Educación es cuando proviene de una situación totalmente diferente a la generada por el derribo de un árbol porque implica peligro a la vida humana. Se suma al criterio anterior, lo indicado en el Código Civil tocante a lo que comprende el derecho de propiedad. Esta situación no varía porque las especies se ubiquen en zona protectora, pues las limitaciones existentes de carácter ambiental son sobre la explotación, pero de manera alguna se puede ampliar a la utilización de los árboles en los supuestos aquí analizados. Lo anterior es parte del derecho de uso, disfrute y aprovechamiento de su fundo y sus productos la facultad de encontrar uso comercial a ese recurso de la legislación civil indicada.
IV.De conformidad con los numerales 505 y 506 del Código Civil procederá revocar la pieza apelada únicamente en cuanto, el aprovechamiento de la madera resultante de los árboles y ramas que se corten, en caso de que sea aprovechable, se concede a favor de la Junta de Educación de la Escuela más cercana, la cual deberá informar en el plazo de TRES DÍAS y aportar la debida aceptación de la misma (artículos 65 de la Ley Forestal), quienes a su vez deben gestionar los permisos para la extracción, aserrío y traslado de la madera, y asumir los costos respectivos que generen esas labores. En su lugar se reconocerá a la parte actora el derecho de aprovechar la madera que se obtenga de los árboles que se autoriza derribar; mediando la debida obtención y cumplimiento de los permisos y requisitos legales para tal fin, así como el seguimiento de las medidas de seguridad necesarias en el proceso de derribo, transporte y comercialización.
POR TANTO:
En lo apelado, se revoca únicamente en cuanto: el aprovechamiento de la madera resultante de los árboles y ramas que se corten, en caso de que sea aprovechable, se concede a favor de la Junta de Educación de la Escuela más cercana, la cual deberá informar en el plazo de TRES DÍAS y aportar la debida aceptación de la misma (artículos 65 de la Ley Forestal), quienes a su vez deben gestionar los permisos para la extracción, aserrío y traslado de la madera, y asumir los costos respectivos que generen esas labores. En su lugar: se reconoce a la parte actora el derecho de aprovechar la madera que se obtenga de los árboles que se autoriza derribar; mediando la debida obtención y cumplimiento de los permisos y requisitos legales para tal fin, así como el seguimiento de las medidas de seguridad necesarias en el proceso de derribo, transporte y comercialización.
