FINDINGS

III.Through their counsel of record, attorney Maribel Castillo Masis, the plaintiff entities filed an appeal against the aforementioned ruling, stating as follows: SUBSTANTIVE GROUNDS FOR APPEAL: “Among the proven facts, number one is particularly noteworthy; it states that the property registered in the Cartago Registry District under registration [Placa1] number [Placa2] is not burdened by any right-of-way easement in favor of any property belonging to the co-plaintiff companies. Regarding this fact, it should be emphasized that the purpose of the interdict proceeding was to protect possession of the passage over a private road that crosses the parcels until reaching a public road. Because of the downward slope, it is easier for all the plaintiff agricultural companies to transport their agricultural products by that route, not only because of the slope but also because the road is in poor condition and because it leads to the town of San Rafael de Irazú, where most of the farm laborers who work on those lands live.
At no time, at least in this proceeding, was the existence or nonexistence of a registered easement at issue, because there is no evidence addressing that matter. Determining it would require an in-depth study to conclusively rule out the existence of an easement or the possibility that, due to the numerous subdivisions (segregaciones) of the properties, an easement may have been carried over but mistakenly not registered. This remains unknown to date, but an ordinary proceeding would have to be filed to allow the taking of relevant evidence to prove that circumstance. Accordingly, this ‘proven’ fact cannot be treated as such in this proceeding. Regarding proven fact number two, although the parcels do have an exit to the north, the court below did not consider that this is not the best exit, despite this having been confirmed during the judicial inspection (reconocimiento judicial). The judge did not consider that the agricultural products must be transported by heavily loaded trucks and that having to climb that slope over a rough, poorly maintained road that is muddy most of the time makes this activity—which is extremely important to the country because it concerns everyone’s food—very difficult, when in fact THEY HAD ALWAYS USED THAT ROAD, BUT IN THE DIRECTION OF [Dirección1] .
The trucks and agricultural machinery travel uphill unloaded, which is easier, and downhill loaded. Using the northern exit means traveling downhill unloaded and uphill with a load, which not only makes transportation more difficult but also causes greater wear on the vehicles. Regarding unproven fact number one, as shown by the evidence submitted, principally the testimony given on examination of Mr. [Nombre2] , they always had a key to the gate and traveled along that road for years. There was tacit authorization from the defendant and even from the owner of the neighboring property, who allows passage through that gate, which does not even belong to the plaintiff. There was acquiescence that became a possessory right (derecho de posesión), specifically a right of passage. The defendant should have demonstrated that it no longer wanted that road to continue being used by means of a written notice or communication through some provable method, instead of taking the law into its own hands in an arbitrary and inconsiderate manner by digging a ditch in bad faith for the sole purpose of preventing the plaintiffs from passing, without considering that all these agricultural producers, who had been using that road—again, to transport their agricultural products—would suddenly encounter a ditch preventing them from continuing and would have to turn back with loaded trucks.
These duly proven facts WERE NOT CONSIDERED BY THE JUDGE, and this proceeding was brought to enforce their rights and seek legal protection regarding what is actually occurring. The defendant should have given all the plaintiffs advance notice so that they could take the necessary precautions, rather than acting as it did. Although it owns the property and, as the judge concludes, may do whatever it wishes on its property, THAT IS NOT TRUE. Property owners cannot do whatever they wish; for example, we cannot cut down trees or appropriate water or mineral deposits, etc. In this specific case, IT MAY NOT INFRINGE THE RIGHTS OF OTHERS, because the right of property is not unlimited, especially where third parties have been allowed use and enjoyment, as occurred here through passage along that route. Although this type of easement cannot be acquired by prescription over time, immediate possession cannot be left unprotected in an INTERDICT PROCEEDING, because that is the purpose of such a proceeding; the legal issues will subsequently be litigated, as stated above, through other proceedings.
Strangely, although the judge transcribes the rulings issued by the Superior Agrarian Court in various decisions, he does not apply their content: “A possessory proceeding (interdicto) constitutes a claim intended to preserve a current and temporary factual situation until the right to possess or not possess a thing is decided in broader proceedings, such as declaratory proceedings (vía declarativa), independently of the right of ownership…” The Court and our legal system identify four important aspects that the Judge does not apply: 1—It concerns immovable property (bienes inmuebles). 2—Matters of ownership or permanent possession are not adjudicated. 3—Three months had not elapsed since the events began when the claim was filed. 4—Only proof of possession and proof of the disturbances are required. These decisions refer to the right of an owner and a possessor, of whatever kind, to defend their property or possession, not only by resorting to the competent authority, but even by using force against force, and that, to obtain the protection of the authorities, it is sufficient to prove the fact of possession, that is, current and temporary possession; and this is precisely what the claimant agricultural companies sought in these proceedings: protection of the possession that was being disturbed, without delving into whether the easement (servidumbre) was registered, because, as we know, that issue is reserved for declaratory proceedings.
It is therefore surprising that, as a central point among his established and unestablished facts (hechos probados y no probados), the Judge refers to whether a registered easement or authorization to use the road existed. What matters is that the road had been used for many years and that, from one day to the next, the claimant dug a trench across the entire road, of such depth that passage was impossible; this was the immediate circumstance giving rise to this possessory proceeding. Article 395 of our Civil Code clearly provides that the owner of a landlocked property (predio enclavado) situated among properties belonging to others, without access or without adequate access to a public road, is entitled to demand passage over neighboring properties for the productive use of their property, upon payment of the value of the necessary land and compensation for any other damage. According to this article, and with reference to the case law cited by the Judge, an exception is identified to the rule set forth in Article 462 of the Code of Civil Procedure in relation to Article 308 of the Civil Code, namely that “possessory protection (protección interdictal) is available in the case of landlocked properties because, under such conditions, passage must be maintained as it has been exercised, in order to prevent serious harm to those who use it, until otherwise decided in separate proceedings.” Nevertheless, despite the judicial inspection (reconocimiento judicial), which was conducted precisely during heavy downpours, the Judge did not find as established facts that the road was in poor condition and muddy, nor did he even take the slope into account.
Had he done so, as he should have, he would have concluded that although the properties of the claimant companies are not landlocked because they have an exit to the north, as the Judge duly verified, they may be classified as properties with a special characteristic: they are properties “without adequate access to [Dirección2],” and therefore THEY DESERVE PROTECTION THROUGH POSSESSORY PROCEEDINGS. Nor did the Judge find as an established fact that the claimants are agricultural and livestock producers and that this activity therefore constitutes AGRARIAN PRODUCTION (PRODUCCIÓN AGRARIA); according to the transcribed case law, the Agrarian Court, “in addition to the landlocked-property requirement, has required that the property be engaged in or maintain some type of agrarian production…” Even more important is what the court of first instance (a quo) itself emphasizes: “When the matter concerns an easement or right of way (derecho de paso), THE CLAIMANT HAS STANDING WHEN POSSESSION IS EXERCISED FOR AGRARIAN OR ECOLOGICAL PURPOSES ON THE CLAIMANT’S LAND… and the access route is used to carry out activities inherent to agrarian production or environmental conservation on that land, to enter the property or remove the goods produced therefrom” (capitalization ours).
Whether an agreement or evidence of a testamentary disposition exists in relation to easements such as the one at issue here is a matter that must be proven in declaratory proceedings. As is evident from the statement of facts, possessory proceedings were pursued in compliance with the four requirements mentioned above, which the Agrarian Court itself has established, particularly since “it was determined that all of them are farms devoted to the production of agricultural products and dairy farming. The agricultural crops include potatoes, carrots, broccoli, and cauliflower.” It is not true that the road to the north is in good condition. The inspection conducted in connection with the oral hearing (juicio verbal) took place during a different season, the dry season (August), unlike when the events occurred and the possessory proceeding was filed, which was during the height of the rainy season (December and the first months of the year).
During the dry season, any road is passable in four-wheel-drive vehicles. The defenses raised should not be upheld for the reasons stated above, principally because of the STANDING conferred by their status as agricultural producers defending their production against acts of bad faith, such as those reported, which consisted precisely of obstructing passage by digging trenches and closing the road. As I reiterate, such acts can never be inherent to the right of ownership when they cause harm to others who have, in some manner, been exercising a right—in this case, a right of passage. All of this prompted the filing of the possessory proceeding at a time of torrential rains and poor road conditions, when they urgently needed, by any means necessary, to transport their perishable produce, which the claimant prevented without prior notice or even giving them an opportunity to do so at least during that period.
All of this constitutes A PLAUSIBLE REASON FOR THE CLAIMANTS TO FILE THIS POSSESSORY PROCEEDING, and therefore they could never have been ordered to pay both categories of litigation costs (ambas costas del juicio), as the Judge unjustly ruled. For all the foregoing reasons, we request that the challenged decision be reversed, that the possessory proceeding be granted in all respects, and, in the alternative, that, for the reasons asserted, they be exempted from paying both categories of costs because they litigated in good faith in defense of their rights and to protect their crops, which constitutes a plausible reason to litigate.” (See the Virtual Desktop of the Cartago Agrarian Court, in the Filings Inbox, file dated 9/9/19 at 12:45:16 p.m.).-
IV.REGARDING THE CLAIM OF ERROR CONCERNING THE ALLEGED IMPROPRIETY OF DISCUSSING THE INSTRUMENT CONSTITUTING AN EASEMENT IN A POSSESSORY PROCEEDING: The appellant is incorrect. Regarding possessory proceedings (procesos interdictales), this Court has held: “The possessory-proceeding remedy in agrarian matters serves to protect agrarian possession (posesión agraria), which is reflected in the performance of agrarian acts of possession (actos posesorios agrarios) in the strict sense. From this specific action, what has been termed ‘agrarian possessory actions’ (acciones interdictales agrarias) has arisen within Agrarian Procedural Law (Derecho Procesal Agrario); through them, the aim is to protect present and immediate possession so that production activities are not affected and the productive purpose of agrarian property can be fulfilled. The purpose of a possessory claim (pretensión interdictal) is to maintain a present and immediate factual situation until the right to possess a thing is resolved in a broader proceeding, such as a declaratory proceeding, irrespective of ownership rights or a superior right of possession; in other words, possessory proceedings seek the prompt restoration of the factual situation, either by protecting a person whose possession has been disturbed or by restoring possession to a person who has been dispossessed.
The law even authorizes a possessor of any kind to repel force with force when possession is threatened; this is an exceptional remedy to which persons should resort only in highly exceptional circumstances (Article 457 of the Code of Civil Procedure (Código Procesal Civil)). The present case concerns an access route located on the defendant’s property leading to the plaintiff’s property. (Agrarian Court Voto 649-f-03 at 14.40 hours on September 26, 2003).-” Likewise, specifically regarding agrarian possessory proceedings protecting easements (servidumbres), legal scholarship has stated: “For a possessory proceeding concerning easements to be successfully brought, important distinctions must be noted in these respects, principally as regards standing to sue (legitimación activa), which differs not only depending on whether the possessory proceeding is civil, agrarian—or even agro-environmental—but also according to the characteristics of the easement involved—whether continuous and apparent, as with certain types of view easements; continuous and non-apparent, as with other types of view easements; or discontinuous, as with rights-of-way, whether apparent or not. a.- Standing to sue and special circumstances: With respect to continuous non-apparent and discontinuous easements, standing to sue must be described as ‘composite,’ because it comprises several distinct elements.
In a civil possessory proceeding concerning easements, standing to sue depends on the plaintiff proving not only that the plaintiff is a possessor, but also that the possession is of a dominant estate (fundo dominante), that is, an estate that enjoys the use of an easement. If the easement is discontinuous (as in the typical example of a right-of-way, whether agrarian or civil) or continuous and non-apparent (such as a view easement without external signs), the plaintiff must prove that the easement is recorded in the Registry—arts. 308, 379 C.Ci. and 462 CPC—or produce an instrument originating from that owner or from prior owners; in other words, documentary evidence of a legally prescribed kind (prueba tasada documental). If the easement is continuous and apparent, it will suffice to show the plaintiff’s use and the defendant’s acquiescence, that is, de facto possession of the dominant estate, primarily through judicial inspection, admissions, and witness testimony, without prejudice to other means of evidence.
In agrarian possessory proceedings, as analyzed in Chapter VI of this work, the substantive prerequisites of the claim consist of the matter to be proved (thema probandum): that the claimant is the present or immediate de facto possessor of an agrarian, forest, or agro-environmental estate that benefits from an easement whose exercise has been impaired or obstructed. As in other possessory proceedings, the type of possessory act will depend on the nature of the real property—agrarian, agroforestry, or ecological. The exceptions concerning proof of the instrument upon which the easements are based, set forth in Articles 462 CPC and 308 and 379 C.Ci. and noted above, apply in agrarian matters. The same applies to easements not included within those exceptions. In the specific case of a right-of-way easement (servidumbre de paso), whether or not the dominant estate is landlocked is irrelevant; what prevails is proof that the easement was constituted, whether by agreement or by testamentary disposition.
In this situation under Article 462 CPC, it is the right to possess—and not mere possession for purposes of a possessory proceeding (posesión ad interdictam)—that is adjudicated in relation to standing to sue. However, if we accept the theory that conservation easements (servidumbres ecológicas) may be recognized as such even without the existence of a dominant estate, then, in the case of acts of disturbance affecting this type of easement, because the collective or diffuse interest in a healthy and ecologically balanced environment is affected, any person, by the mere fact of being a person, would have standing to bring an agrarian possessory proceeding, including environmental NGOs in the area of the dispute. Nevertheless, it must also be considered that these conservation easements are generally non-apparent or discontinuous, and therefore the constitution of these easements over the defendant’s property must always be proved. b.- Standing to be sued (legitimación pasiva) and its application to particular circumstances: Standing to sue and standing to be sued are correlative because of the causal nexus connecting the parties through the act of disturbance.
At the same time, just as the type of easement involved warrants a particular means of evidence for purposes of standing to sue, the characteristics of the easement will also determine who may and may not be sued in particular circumstances, opening a range of possibilities that we shall attempt to address. If the easement is continuous and apparent and, because it is excluded from Articles 462 CPC and 308 and 379 C.Ci., it is sufficient merely to prove the plaintiff’s use with the defendant’s acquiescence, then standing to be sued in such cases will necessarily depend on reliably establishing that the defendant—regardless of whether the defendant is the owner of the servient estate (fundo sirviente) or any third party—was responsible for or caused the disturbance, closure, or obstruction of the use of that easement. Because no instrument is required, much less one recorded in the Registry, and because the easement is apparent, having external signs that must reliably reveal its existence, any third party can recognize that the third party’s action affects the use of the easement.
(...) A similar situation arises in cases in which the exceptions under Articles 462 CPC and 308 and 379 C.Ci. do apply: these are continuous non-apparent easements—the view easement without external signs and the agrarian apicultural right-of-way easement—and discontinuous easements, such as all other rights-of-way. Although those provisions make it mandatory to prove the legal act—no longer merely a factual act—by which they were duly constituted through an agreement or the testamentary disposition of the owner of the servient estate or its prior owners, it must be borne in mind that this requirement applies only to standing to sue, since all easements of this kind, whether appurtenant or real (servidumbres prediales o reales), are imposed for the benefit of and as burdens upon real property, and not upon or for the benefit of persons. However, as analyzed in Chapters VI, VII, and VIII, standing to be sued in possessory proceedings for protection of possession (interdictos de amparo de posesión) and restitution lies against any third party who disturbs or dispossesses the plaintiff in the plaintiff’s de facto possession.
Accordingly, standing to be sued lies not only against the owner of the servient estate but also against any third party who disturbs or deprives the plaintiff of the use of the easement. Of course, the resolution of all these hypothetical cases depends on the establishment of the third prerequisite of the possessory claim, which we briefly review below. c.- Time bar (caducidad): As with any other possessory proceeding, except one for demolition, the strict three-month time-bar period begins to run from the commencement of the disturbance, closure, or obstruction of the use of the easement.” [Nombre10] () and [Nombre11] (). Possessory Proceedings in Civil, Agrarian, Environmental, and Administrative Litigation Matters (Los Interdictos en Materia Civil, Agraria, Ambiental y Contenciosa), San José, Faro, 2017, pp. 415 to 420. The foregoing is consistent with this Court’s settled case law: “When an easement or right-of-way is at issue, standing to sue is established when possession is exercised for agrarian or ecological purposes on the plaintiff’s land—which would be the dominant estate if an easement were involved—and the access route is used to carry out activities inherent to agrarian production or environmental conservation there, to enter the property, or to remove goods produced therefrom.
In such cases, however, what is stated in the following recitals (considerandos) must also be taken into account.- VI- With respect to possessory protection of rights-of-way, the law is very clear: a) Article 462 of the Code of Civil Procedure provides that, when the complaint concerns continuous non-apparent or discontinuous easements, Article 308 of the Civil Code (Código Civil) shall apply. b) That article establishes that, for such easements, ‘the claim, in order to be entertained, must be based on an instrument originating from the owner of the servient estate or from those from whom the owner acquired it.’ c) In turn, Article 379 of the latter Code states that ‘Discontinuous easements of every kind and continuous non-apparent easements may be constituted only by agreement or by testamentary disposition.’ AGRARIAN COURT, Voto Nº 697 at 16:10 hrs. on November 8, 1996. In possessory proceedings of this kind, the reference in Article 462 of the Code of Civil Procedure to Articles 307 and 308 of the Civil Code necessarily entails an examination of whether or not the easement was constituted.
Therefore, reference to the constitution of an easement means the instrument (agreement or testamentary declaration) creating the easement, not the registration of an already constituted easement in the Registry. As the appellant herself states, there is no legally constituted easement; consequently, the statement by the court below (a quo) in the first fact found proven and in the sole fact not proven is correct. The possessory proceeding for protection of possession of an easement therefore does not lie, and the claim of error is rejected. Different rules govern a possessory proceeding for protection of possession of a landlocked estate (fundo enclavado), which is the subject of the next claim of error and will be decided below.-
V.REGARDING THE CLAIM OF ERROR CONCERNING THE AVAILABILITY OF A POSSESSORY-PROTECTION INJUNCTION FOR LANDLOCKED PROPERTY (INTERDICTO DE AMPARO DE POSESIÓN DE FUNDO ENCLAVADO), DUE TO THE LACK OF SUFFICIENT ACCESS TO [Dirección3]: The appellant is incorrect. Since no easement (servidumbre) has been established, it must be determined whether or not the plaintiff’s property is landlocked in order to grant possessory injunctive relief (tutela interdictal). This Court agrees with the a quo’s assessment of the evidence (valoración probatoria) concerning the judicial inspections (reconocimientos judiciales), in light of the free-assessment-of-evidence system (sistema de libre valoración de la prueba) enshrined in Article 54 of the Ley de Jurisdicción Agraria. Regarding the first inspection, the purpose of which was the interim measure (medida cautelar), conducted at nine thirty in the morning on 23 de marzo del 2017, the a quo noted from the outset that there are two access routes to the plaintiffs’ properties (images 206 to 207 of the electronic case file): The first of these (which is the route at issue in these proceedings and over which the plaintiffs seek to be granted passage) was described by the a quo as follows: “It is approximately fifteen minutes from Pacayas and is reached by entering through the property of Mr. [Nombre12], which connects directly to a public road.
A red iron gate with a padlock can be seen on that property, together with a large sign stating, ‘No Trespassing. Private Property.’” As for the second access route, on the basis of which the a quo denied the injunction, it was described on that occasion as follows: “The other access route is located approximately eight kilometers from this first access route, along the road from [Dirección4]. It enters through property belonging to third parties, Mr. [Nombre6] and Mr. [Nombre2], and crosses other properties belonging to the remaining plaintiffs until reaching the Hacienda Ukrania property, which adjoins the defendant’s property. However, that road is accessible only by four-wheel-drive vehicle, is sloped, and is approximately two kilometers long. On the day of the inspection, it had rained, and the route was muddy and boggy, so the vehicle used for the inspection slipped while traveling along it, even though it had four-wheel drive.” (images 206 to 207 of the electronic case file).
It should be noted that, on that occasion, the requested interim measure was granted precisely because of the poor condition of that other access route, and a form of “physical landlocking” (enclave material) was found because it had rained (images 211 to 218). It should also be noted that the ruling issued at that time was a provisional solution subject to possible changes in circumstances. However, during the second judicial inspection, conducted for the oral trial hearing (audiencia de juicio verbal) on 20 de agosto del 2018 (a year and a half after the first), the same a quo who issued the challenged judgment stated: “Result of the judicial inspection:
The appellant is correct. In light of Article 55 of the Ley de Jurisdicción Agraria, this Court finds that the plaintiffs had sufficient grounds to litigate and did so in good faith, since the outcome of the proceedings depended on the assessment of the judicial-inspection evidence. Actúa como abogada directora de las sociedades demandantes, la licenciada Maribel Castillo Masis, colegiada tres mil ciento cincuenta y dos; y como apoderado especial judicial de la entidad demandada, el letrado Esteban Troyol Dittel, carné siete mil doscientos ochenta y uno. Tramitado ante el Juzgado Agrario de Cartago.-
RESULTANDO
Redacta el juez Picado Vargas, y;
CONSIDERANDO
III.Las entidades actoras, por medio de su abogada directora la licenciada Maribel Castillo Masis, interpusieron recurso de apelación contra la referida resolución, manifestando lo siguiente: AGRAVIOS DE FONDO: “Dentro de los hechos probados se destaca el número uno, que indica que la finca del Partido de Cartago, con matrícula de [Placa1] número [Placa2] no soporta servidumbre de paso alguna a favor de ninguno de los inmuebles de las sociedades coactoras, en cuanto a este hecho cabe destacar que el objetivo del interdicto era amparar la posesión sobre el paso que se tiene en una calle privada que atraviesa los fundos hasta llegar a calle pública, que por la pendiente hacia abajo, resulta más fácil para todas las empresas agrícolas actoras, sacar los productos agrícolas por esa vía, no sólo por esa pendiente, sino también por cuanto el camino es un camino en mal estado y además, por ahí, llegan al pueblo San Rafael de Irazú, donde viven la mayoría de los peones agrícolas que trabajan en esas tierras y en ningún momento, al menos por esta vía, se discutiera si existe o no la servidumbre inscrita, porque, no hay prueba que así lo indique, ya que para ello, debía hacerse un estudio profundo con el fin de descartar efectivamente que no hay una servidumbre o que quizá, por las muchas segregaciones de las propiedades, podría arrastrar una servidumbre que por error no se haya inscrito, lo que a la fecha no se sabe pero para ello tendría que presentarse un juicio ordinario que permita evacuar prueba pertinente para demostrar esta situación, de tal forma que este hecho “probado” en esta vía, no puede considerarse de esa manera.
En cuanto al hecho probado número dos, si bien es cierto los fundos tienen salida por el norte, el señor juez a quo no consideró que esa salida no es la mejor, a pesar de haberse constatado en el reconocimiento judicial realizado, no consideró el señor juez que los productos agrícolas tienen que sacarse mediante camiones, que van muy cargados y tener que subir por esa pendiente, en un camino tosco y de mal estado, enlodado la mayoría de las veces, convierte la actividad, de suma importancia para el país, porque se refiere al alimento de todos, en una actividad muy difícil cuando en la realidad, SIEMPRE HABIAN UTILIZADO ESE CAMINO PERO CON DIRECCIÓN HACIA [Dirección1] , los camiones y maquinaria agrícola suben descargados, lo que es más fácil y bajan cargados, el utilizar la salida por el norte, significa bajar descargados y subir con una carga que no sólo dificulta el transporte sino que significa más desgaste para los vehículos.
En cuanto al hecho no probado uno, según se desprende de la prueba aportada, principalmente la declaración confesional del Sr. [Nombre2] , siempre tuvieron llave del portón, por años siempre pasaron por ese camino, hay una autorización tácita, por parte de la demandada e incluso del dueño de la finca vecina que permite la salida por ese portón, que no es ni siquiera de la actora, hubo una tolerancia que se convirtió en un derecho de posesión concretamente en el derecho de paso, quien debió haber demostrado que ya no quería que se siguiera usando ese camino a través de una nota escrita o una comunicación mediante algún medio que se pudiera probar, debió haber sido la demandada y no, hacer justicia por su propia mano de una manera arbitraria y desconsiderada, abriendo una zanja con el único propósito de que no pasaran los actores, de mala fe, sin tomar en cuenta, que todos estos productores agrícolas, que venían usando ese camino, repito, para sacar sus productos agrícolas, de pronto se topan con una zanja que no permite seguir su camino y tenerse que devolver con camiones cargados, estos hechos, debidamente demostrados NO HAN SIDO CONSIDERADOS POR EL SEÑOR JUEZ y se acude a esta vía, para hacer valer los derechos y buscar una protección legal, a lo que realmente está sucediendo.
La demandada, debió haber avisado con tiempo a todos los actores, para que tomaran las precauciones del caso, pero no hacerlo de la manera como lo hizo, a pesar de que es el dueño del fundo y como concluye el señor juez, puede hacer lo que quiera dentro de su propiedad, LO QUE NO ES CIERTO, los propietarios no podemos hacer lo que queramos, no podemos por ejemplo talar árboles, apoderarnos del agua, de yacimientos de minerales, etc., y en este caso concreto, NO PUEDE PERJUDICAR DERECHOS DE OTROS, porque el derecho de propiedad no es ilimitado sobretodo, cuando se ha permitido el uso y disfrute, a terceros, como en este caso, el paso por esa vía. Si bien es cierto, por la clase de servidumbre que nos ocupa, no prescribe con el tiempo, no puede dejarse de proteger, en un INTERDICTO la posesión inmediata, porque para eso es el interdicto, ya las cuestiones de derecho se discutirán, como se ha dicho líneas atrás, por otras vías.
Extrañamente el señor juez, a pesar de que transcribe lo resuelto por el Tribunal Superior Agrario, en distintas resoluciones, no aplica lo ahí contenido: “El interdicto constituye una pretensión que tiene por objeto mantener una situación de hecho actual y momentánea hasta tanto no se resuelva en una vía más amplia como la declarativa, el derecho de poseer o no una cosa, independientemente del derecho de la propiedad…” Cuatro aspectos importantes que señala el Tribunal y nuestro ordenamiento jurídico pero que el señor Juez no aplica: 1-Se refiere a bienes inmuebles. 2- No se discute asuntos de propiedad o de posesión definitiva. 3- No han pasado los tres meses desde que iniciaron los hechos acaecidos, al presentar la demanda. 4- Nada más se requiere la prueba de la posesión y la prueba de las perturbaciones. Estas resoluciones hacen mención al derecho que tiene el propietario y el poseedor, de cualquier clase que sea, de que pueden defender su propiedad o posesión, no solo recurriendo a la autoridad competente, sino aún empleando la fuerza contra la fuerza y para obtener la protección de la autoridad basta probar el hecho de poseer o sea la posesión actual y momentánea y esto es, precisamente lo que, las sociedades agrícolas actoras, buscaron en este proceso, la protección a esa posesión que estaba siendo perturbada, sin adentrarse a demostrar, si la servidumbre estaba inscrita o no, porque tal y como sabemos, eso queda para una vía declarativa, de tal forma, que es de extrañar, que el señor Juez se refiera como punto medular en sus hechos probados y no probados, la existencia o no de una servidumbre inscrita o una autorización para el uso del camino, lo que interesa es que el camino se ha estado usando por muchos años y de la noche a la mañana la actora abre una zanja que atraviesa de lado a lado el camino y con una profundidad tal, que no permite el paso y esto era lo inmediato, para que fuera motivo del presente interdicto.
Nuestro Código Civil, en su artículo 395 establece claramente que el propietario de un predio enclavado entre otros ajenos, sin salida o sin salida bastante a la vía pública, tiene derecho de exigir paso por los predios vecinos para la explotación del suyo, pagando el valor del terreno necesario y de todo otro perjuicio. Según este artículo y en referencia a la Jurisprudencia referida por el Sr. Juez, se indica una excepción a la normativa indicada del artículo 462 del Código Procesal Civil en relación con el artículo 308 del Código Civil y es que, “la protección interdictal procede cuando se trata de fundos enclavados, pues en tales condiciones el paso debe mantenerse como se ha ejercido, para evitar graves perjuicios a quienes se sirven de él, mientras no se decida lo contrario en otra vía.” Pero el señor Juez, a pesar del reconocimiento judicial realizado, que precisamente se hizo en plenos aguaceros, no tuvo como hecho probado, el mal estado del camino, que el mismo se encontraba enlodado y ni siquiera tomó en cuenta la pendiente, de haberlo hecho, como se debía, hubiera concluido que los fundos de las sociedades actoras , a pesar de que no son enclavados porque tienen salida al norte, como bien lo constató el señor juez, se pueden catalogar dentro de fundos con una característica especial, son fundos “sin salida bastante a la [Dirección2] ” y por lo tanto MERECEN LA TUTELA DE LA VIA INTERDICTAL.
Tampoco tuvo el señor juez, como hecho probado, que los actores son productores agrícolas y pecuarios y por lo tanto, esta actividad es PRODUCCIÓN AGRARIA y de acuerdo a la jurisprudencia transcrita, el Tribunal Agrario “aparte del requisito de enclave ha exigido que el fundo se encuentre o mantenga algún tipo de producción agraria…” Todavía resulta más importante y que el propio a quo lo resalta: “Cuando de lo que se trata es de una servidumbre o derecho de paso, LA LEGITIMACION ACTIVA SE CONFIGURA CUANDO LA POSESIÓN SE EJERCE AGRARIA O ECOLOGICAMENTE EN EL TERRENO DEL ACTOR… y la vía de acceso se utiliza para realizar en el mismo las actividades propias de la producción agraria o de conservación ambiental para ingresar al fundo o sacar los bienes producidos en él” (mayúscula nuestra). Si existe convenio o prueba de última voluntad, en referencia a las servidumbres como la que nos ocupa, es un aspecto que debe demostrarse en la vía declarativa y tal y como se desprende de la relación de hechos, se acude a la vía interdictal cumpliendo con los cuatro presupuestos antes mencionados, que el propio Tribunal Agrario ha establecido, máxime que “ se logró determinar que todas ellas son fincas dedicadas a la producción de productos agrícolas y a la ganadería de leche.
Dentro de los cultivos agrícolas se encuentran la papa, zanahoria, brócoli y coliflor.” No es cierto que el camino hacia el norte esté en buen estado, el reconocimiento realizado con ocasión del juicio verbal, se llevó a cabo en otra época, de verano (agosto), a diferencia, de la fecha en que ocurrieron los hechos y se interpuso el interdicto que era pleno invierno (diciembre y primeros meses del año), en verano cualquier camino es bueno, en vehículos de doble tracción. No deben acogerse las excepciones opuestas por los motivos antes señalados y principalmente la LEGITIMACIÓN que otorga el hecho de ser productores agrícolas que defienden su producción ante actos de mala fe, como los denunciados, que son precisamente impedir el paso, abriendo zanjas y cerramiento de camino, como repito no pueden ser jamás, inherentes al derecho de propiedad cuando causan perjuicio a otros, que de alguna forma han venido ejerciendo un derecho, como en este caso, de paso., todo esto, motivó la interposición del interdicto, en un momento de lluvias torrenciales, caminos malos, que necesitaban a como diera lugar, sacar la producción de productos perecederos, lo que fue impedido por la actora, sin un aviso previo, ni siquiera darles la oportunidad, de al menos por esas fechas, todo lo cual, constituye para las actoras una RAZON PLAUSIBLE PARA INTERPONER ESTE INTERDICTO, por lo que jamás, podían ser condenadas en el pago de ambas costas del juicio, como injustamente lo ha resuelto el señor Juez.
Por todo lo anterior, solicitamos se revoque la resolución recurrida, se acoja el interdicto en todos sus extremos y subsidiariamente, por los motivos alegados, eximirlos del pago de ambas costas por haber litigado de buena fe en defensa de sus derechos y en protección a sus cultivos, constituyendo esto una razón plausible para litigar.” (Ver Escritorio Virtual del Juzgado Agrario de Cartago, en Bandeja de Escritos, archivo del 9/9/19 de las 12:45:16 p.m.).-
IV.SOBRE EL AGRAVIO RELATIVO A LA ALEGADA IMPROCEDENCIA DE DISCUTIR SOBRE EL TITULO DE CONSTITUCION DE UNA SERVIDUMBRE EN UN INTERDICTO: No lleva razón la recurrente. Sobre los procesos interdictales, ha estimado este Tribunal : "La vía interdictal en materia agraria, sirve para proteger una posesión agraria que se traduce en la realización de actos posesorios agrarios propiamente dichos. De esta acción específica ha surgido dentro del Derecho Procesal Agrario , lo que ha denominado " acciones interdictales agrarias" mediante las cuales se busca proteger la posesión actual y momentánea, a efecto de que las actividades de producción no sean afectadas, y se pueda cumplir con el destino productivo de los bienes agrarios. La pretensión interdictal, tiene por objeto mantener una situación de hecho, actual y momentánea, hasta tanto no sea resuelta en una vía más amplia, como la declarativa, el derecho de poseer una cosa, independientemente del derecho de propiedad o el mejor derecho de posesión; en otros términos; los interdictos tienden al pronto restablecimiento del estado de hecho, ya sea amparar al que fuere inquietado en la posesión, o restableciendo en ella al que ha sufrido despojo; incluso la ley faculta al poseedor de cualquier clase que sea para repeler la fuerza con la fuerza, en caso de que se atente contra su posesión, el cual es un recurso excepcional, el cual las personas sólo deben acudir en situaciones muy calificadas (artículo 457 del Código Procesal Civil).
En el presente caso se trata de un acceso ubicado en la propiedad del demandado hacia el fundo de la actora. (Tribunal Agrario Voto 649-f-03 de las 14.40 horas del 26 de septiembre del 2003).- Asimismo, propiamente sobre los interdictos agrarios que tutelan las servidumbres, ha dicho la doctrina: "Para que el interdicto sobre servidumbres sea establecido con éxito, resulta necesario apuntar variaciones importantes en estos aspectos, principalmente en lo referente a la legitimación activa que difiere no sólo si trata de un interdicto civil o uno agrario –e incluso agroambiental- sino también en los caracteres de la servidumbre que se trate –sea continua y aparente -algunos supuestos de vista-, continua y no aparente -otros supuestos de servidumbre de vista- y discontinuas -como las de paso, sean aparentes o no-. a.- Legitimación activa y supuestos especiales: En esta figura, tratándose de servidumbres continuas no aparentes y discontinuas, se debe hablar de una legitimación activa “compuesta” pues se integra de varios elementos propios.
En caso del interdicto civil de servidumbres, la legitimación activa radica en que el actor logre acreditar no sólo su condición de poseedor, sino que lo es de un fundo dominante, es decir, sobre el cual tenga a su favor el uso de una servidumbre. Si la servidumbre es discontinua (como el ejemplo típico de la de paso, sean agrarias o civiles) o continua no aparente (como la de vista sin signos externos), deberá acreditar que la servidumbre está inscrita en el Registro -arts. 308, 379 C.Ci. y 462 CPC- ó el título proveniente de dicho titular o de los anteriores propietarios, es decir, prueba tasada documental. Si la servidumbre es continua y aparente, bastará con que demuestre el uso del actor y la paciencia del demandado, es decir, la posesión de hecho sobre el fundo dominante, mediante, básicamente, reconocimiento judicial, confesional y testimonial, sin menoscabo de otros medios de prueba.
En materia de interdicto agrario, tal y como se analizó en el Capítulo VI de esta obra, los presupuestos materiales de la pretensión radica en el thema probandum de demostrar la calidad de ser poseedor actual o momentáneo -de hecho-, de un fundo de naturaleza agrario, forestal o agrario-ambiental que tenga a su favor una servidumbre que se haya visto afectada u obstaculizada. El tipo de acto posesorio, al igual que en el resto de los interdictos, dependerá de la naturaleza del bien inmueble -agraria, agroforestal o ecológica-. Las salvedades de la demostración del título en que se funde las servidumbres contempladas en los artículos 462 CPC, 308 y 379 del C.Ci., señaladas anteriormente, son aplicables en materia agraria. De igual manera con las que no se incluyen en dichas excepciones. En el caso específico de una servidumbre de paso, resulta irrelevante el enclave o no del fundo dominante, sino que prima la demostración de la constitución de la servidumbre, sea por convenio o por última voluntad.
Es en este supuesto del 462 del CPC que se ventila el derecho de poseer y no la simple posesión ad interdictam en el caso de la legitimación activa. Sin embargo, si aceptamos la tesis de que las servidumbres ecológicas pueden ser admitidas como tales aún sin la existencia de fundo dominante, encontramos que tratándose de actos perturbatorios que afecten este tipo de servidumbres, al afectarse el interés colectivo o difuso al ambiente sano y ecológicamente equilibrado, cualquier persona por el hecho de serlo, tendría legitimación activa para demandar en la vía interdictal agraria, incluyéndose en esto a las ONGs de carácter ambiental de la zona de conflicto, pero también debe tomarse en cuenta que estas servidumbres ecológicas generalmente son no aparentes, o discontinuas, por lo que siempre deberá demostrarse la constitución de estas servidumbres en el inmueble del demandado. b.- Legitimación pasiva y su casuística: La legitimación activa y la pasiva son correlativas, por el nexo de causalidad que involucra a las partes a través del acto perturbatorio.
Pero a la vez, así como el tipo de servidumbre que se trate justifica determinado medio de prueba para la legitimación activa, los caracteres de la servidumbre van a determinar también quiénes pueden ser demandados y quiénes no en determinados supuestos, lo cual abre un abanico de posibilidades que trataremos de dar respuesta. Si se tratase de una servidumbre continua y aparente, que por ser excluida de los artículos 462 CPC y 308 y 379 del C.Ci, solo basta demostrar el uso del actor a paciencia del demandado, necesariamente, la legitimación pasiva en estos casos radicará en que se logre demostrar fehacientemente que el demandado –sin importar si es el titular del fundo sirviente o cualquier tercero- haya sido el (os) responsable (s) o causante (s) de la perturbación, cierre u obstaculización del uso de dicha servidumbre. Como no se exige un título, mucho menos inscrito en el Registro y la servidumbre es aparente, pues tiene signos externos que deben revelar fehacientemente su existencia, cualquier tercero puede percatarse que su acción afecta el uso de la servidumbre.
(...) De forma similar sucede en los casos en que sí se aplican las excepciones de los artículos 462 CPC y 308 y 379 del C.Ci: son los supuestos de las servidumbres continuas no aparentes –la servidumbre de vista sin signos externos y la servidumbre agraria de paso apícola- y las discontinuas –como todo el resto de servidumbres de paso-. Aunque dichas normas establecen la obligatoriedad de acreditar el acto –ya no hablamos de hecho- jurídico que se encuentran debidamente constituidas por convenio o última disposición del propietario del fundo sirviente o sus anteriores dueños, debemos tomar en cuenta que dicho requisito es únicamente para la legitimación activa, pues todo este tipo de servidumbres prediales o reales, se imponen a favor y en contra de bienes inmuebles y no sobre o a favor de personas. Pero, tal como se analizó en los Capítulos VI, VII y VIII, la legitimación pasiva en los interdictos de amparo de posesión y restitución radica en cualquier tercero que perturbare o despojare al actor en su posesión de hecho.
Por ello, la legitimación pasiva radica no sólo en la figura del titular del fundo sirviente, sino a cualquier tercero que perturbe o despoje el uso de la servidumbre al actor. Por supuesto que la solución a todos estos casos hipotéticos dependen de la configuración del tercer presupuesto de la demanda interdictal, el cual revisamos a continuación en forma breve. c.- Caducidad: Al igual que cualquier otro interdicto, salvo el de derribo, el término fatal de caducidad empieza a correr tres meses a partir del inicio de la perturbación, cierre u obstaculización del uso de la servidumbre." [Nombre10] () y [Nombre11] (). Los Interdictos en Materia Civil, Agraria, Ambiental y Contenciosa, San José, Faro, 2017, p.p. 415 a 420. Lo anterior concuerda con lo establecido en forma reiterada por la jurisprudencia de este Tribunal: "Cuando de lo que se trata es de una servidumbre o derecho de paso, la legitimación activa se configura cuando la posesión se ejerce agraria o ecológicamente en el terreno del actor (que sería el fundo dominante, si se tratara de servidumbre) y la vía de acceso se utiliza para realizar en el mismo las actividades propias de la producción agraria o de conservación ambiental, para ingresar al fundo o sacar los bienes producidos en él.
Sin embargo, en esos casos debe tomarse en cuenta, además, lo que se expone en los siguientes considerandos.- VI- Tratándose de la protección interdictal de servidumbres de paso la ley es muy clara: a) el artículo 462 del Código Procesal Civil dispone que cuando la demanda versa sobre servidumbres continuas no aparentes, o sobre discontinuas, se aplicará lo dicho en el artículo 308 del Código Civil. b) Ese artículo establece que tratándose de esas servidumbres "el reclamo, para ser atendido, debe fundarse en título que provenga del propietario del fundo sirviente o de aquellos de quien éste lo hubo". c) Por su parte el numeral 379 del último código citado señala que "Las servidumbres discontinuas de toda clase y las continuas no aparentes, sólo pueden constituirse por convenio o por última voluntad." TRIBUNAL AGRARIO, Voto Nº 697 de las 16:10 hrs. del 8 de noviembre de 1996. Tratándose de este tipo de interdictos, la referencia del artículo 462 del Código Procesal Civil a los numerales 307 y 308 del Código Civil implica que necesariamente se analice sobre la constitución o no de la servidumbre.
Por ende, al hablar de constitución de servidumbre, se refiere al título (convenio o declaración de última voluntad) en que se crea la servidumbre, no la inscripción registral de la servidumbre ya constituida. Como la misma recurrente lo indica, no hay una servidumbre legalmente constituida, por lo que la aseveración del a quo en el primer hecho probado como en el único hecho no demostrado es correcta; por lo que no procede el interdicto de amparo de posesión sobre servidumbre, por lo que se rechaza el agravio. Diferentes supuestos rigen sobre el interdicto de amparo de posesión de fundo enclavado, el cual es el objeto del siguiente agravio, el cual se resolverá a continuación.-
V.SOBRE EL AGRAVIO DE LA PROCEDENCIA DEL INTERDICTO DE AMPARO DE POSESIÓN DE FUNDO ENCLAVADO, POR NO TENER SUFICIENTE SALIDA A [Dirección3] : No lleva razón la recurrente. Al no existir una servidumbre constituida, debe analizarse si la finca del actor se encuentra o no enclavada, para acceder a la tutela interdictal. Este Tribunal comparte la valoración probatoria realizada por el a quo en cuanto a la prueba de reconocimientos judiciales, a la luz del sistema de libre valoración de la prueba consagrada en el artículo 54 de la Ley de Jurisdicción Agraria. Del primer reconocimiento, cuyo objeto fue la medida cautelar, realizado a las nueve horas treinta minutos del 23 de marzo del 2017, desde el inicio el a quo referenció que para llegar a las fincas de los actores existen dos accesos (imágenes 206 a 207 del expediente electrónico): El primero de ellos (que es la vía que es objeto de este proceso y por el cual los actores pretenden se les otorgue el paso) el a quo lo describió así: “queda a unos quince minutos de Pacayas, y los es entrando por la finca del señor [Nombre12] , que es la que conecta en forma directa con calle pública.
En esa finca se observa un portón de hierro de color rojo, con candado y un rótulo grande que indica "Prohibido el Paso. Propiedad Privada". En cuanto al segundo acceso, por el cual el a quo rechaza el interdicto, se describió en esa ocasión así: “El otro acceso se hace a unos ocho kilómetros aproximadamente de distancia de este primer acceso, por calle de [Dirección4]. Se ingresa por la finca de terceros, los señores [Nombre6] y [Nombre2] , y pasa por otras propiedades pertenecientes al resto de los actores, hasta llegar a la finca de Hacienda Ukrania, la cual colinda con el demandado. Sin embargo dicho camino solo es accesible con vehículo de doble tracción, tiene forma de pendiente y un largo de aproximadamente dos kilómetros. Se pudo observar, este día de la inspección, que llovió, el paso embarrialado y fangoso, por lo que el vehículo en el que se hizo la inspección resbalaba al transitar, aún y cuando era de doble tracción.” (imágenes 206 a 207 del expediente electrónico.
Cabe indicar que en esa ocasión, la medida cautelar solicitada fue otorgada precisamente por la mala condición de ese otro acceso, determinándose una forma de “enclave material” porque había llovido (imágenes 211 a 218). Cabe indicar que lo resuelto en ese momento era una solución provisional y sujeta a posibles cambios de circunstancias. Empero, en el segundo reconocimiento judicial, para audiencia de juicio verbal, realizado el 20 de agosto del 2018 (año y medio después del primero) el propio a quo que dicta la sentencia impugnada consignó: “Resultado del reconocimiento judicial:
Lleva razón la recurrente. Este Tribunal, a la luz del artículo 55 de la Ley de Jurisdicción Agraria, considera que las actoras tenían suficientes motivos para litigar y han litigado de buena fe, ya que el resultado del proceso dependió de la valoración probatoria del reconocimiento judicial, por lo que se revoca parcialmente la sentencia apelada, únicamente en cuanto a que condenó en costas a la parte actora. En su lugar, se exime del pago de las costas.-
POR TANTO
Se revoca parcialmente la sentencia apelada, únicamente en cuanto a que condenó en costas a la parte actora. En su lugar, se exime del pago de las costas.
