BACKGROUND:
I.On February 27, 2019, the plaintiffs’ special counsel instituted plenary proceedings seeking a provisional measure (medida cautelar), requesting that the judgment annul “Health Order (Orden Sanitaria) number 114-2018,” alleging that the administrative act (acto administrativo) is absolutely null and void because it is contrary to the legal system, and that the defendants be ordered to pay attorneys’ fees and procedural costs (costas personales y procesales). (See Preliminary Hearing CD).
II.By order issued at 09:05 hours on March 14, 2019, the complaint and the request for a provisional measure were served on the representatives of FIDUCIARIA UNIBANC S.A. and the State. In a brief filed on May 02, 2019, the representative of FIDUCIARIA UNIBANC S.A. opposed the complaint and, in its defense, raised the affirmative defense of lack of legal entitlement (excepción de falta de derecho). The State’s representative, for her part, responded in a brief dated May 07, 2019, requesting that the affirmative defense of lack of legal entitlement be upheld and that the complaint be dismissed in its entirety. III.By Decision No. 553-2019 issued at 14:15 hours on March 26, 2019, the requested provisional measure was denied. (See image 58 of the digital version of the provisional-measure court record).
IV.The Preliminary Hearing provided for in section 90 of the Code of Administrative Procedure (Código Procesal Contencioso Administrativo) was held on February 26, 2020. At that hearing, it was reiterated that the relief sought in the judgment was a declaration that “Health Order No. 114-2018” was null and void; the disputed facts were analyzed; the documentary evidence was admitted; and, because there was no further evidence to be presented, the Case-Management Judge (Jueza de Trámite) declared the proceeding to involve purely legal issues (proceso de puro derecho), granting the parties a period of 3 business days to submit their closing arguments in writing. V.This matter was assigned to the Fourth Section on April 30, 2020, for issuance of the corresponding judgment, as recorded in the Court’s electronic system. (See the digital version of the court record).
VI.This judgment is issued following deliberation by the members of the Court, within the time permitted by the Court’s workload, and no grounds capable of invalidating the proceedings have been identified.

CONSIDERING:
At the preliminary hearing, the State’s representative offered, as evidence for better adjudication, official letter MS-DRRSCS-ARSAL-0191-2020, signed by the Director of the Área Rectora de la Salud and addressed to the State’s representative, together with documentation appearing at images 20 through 40 of the digital court record, consisting of various documents concerning activities at the settlement known as la chancera by various institutions. Pursuant to article 50 of the CPCA, the Case-Management Judge reserved the determination of the admissibility of that evidence until the judgment was issued. Regarding the admissibility of evidence for better adjudication, it must be noted that the settled case law of the Sala Primera de la Corte Suprema de Justicia holds that its rejection does not leave the parties without a defense. Among other judgments, the relevant portion of Voto N° 547-F-2002, issued at 16 hours on July 12, 2002, is transcribed below, in which that Chamber stated: “(…) IV.- Numerous precedents of this Chamber addressing evidence for better adjudication have stated that such evidence belongs to the judge, not to the parties.
Consequently, the decision to obtain it is discretionary for the adjudicative body, and it may be dispensed with without the need for any decision whatsoever. Therefore, no ruling need be made regarding it precisely because the evidentiary stage has concluded; during that stage, the parties must prove the facts establishing their rights, as required by the rules governing the burden of proof (carga de la prueba). Once that stage has closed, it is exclusively within the judge’s discretion to determine whether new evidence necessary for the proper resolution of the dispute should be added to the record. Among many others, the following decisions may be consulted: 59, issued at 15:20 hours on May 31, 1996; 23, issued at 14:20 hours on March 4, 1992; 34, issued at 10:45 hours on May 28, 1993; and 83, issued at 14:40 hours on December 22, 1993. (…)”. In this particular case, the evidence offered consists of documentation concerning the institutional assistance provided by various State institutions to the informal settlement (precario) known as “Chanchera,” located in Alajuelita.
In the Court’s judgment, however, that evidence is irrelevant because it has no bearing on the subject matter of this proceeding, namely, the alleged illegality of the provisions of the Health Order whose annulment is sought. It is therefore excluded.
Counsel for the plaintiffs instituted ordinary proceedings (proceso de conocimiento), seeking a judgment declaring “Health Order (Orden Sanitaria) No. 114-2018” null and void on the grounds that it is contrary to the legal system. Their representative stated that approximately 60 families live within the property registered in the Province of San José under No. [Valor 010], corresponding to cadastral plan (plano catastrado) number [Valor 013]. They named the property “Asentamiento Agrario Monte Alto,” in Concepción de Alajuelita, and stated that the plaintiffs are mostly persons of limited means living in extreme poverty, which is why their homes are humble and simple. They currently exercise and maintain possession (posesión) of that property peacefully, openly, uninterruptedly, in good faith, and as owners, and the property had remained unused and served no social function for more than 10 years.
Their initial work on the property consisted of repairing fences, clearing firebreaks, and planting cassava and square bananas for family subsistence. In 2018, the challenged Health Order was issued, notifying them that they were required to vacate because of the irregularities detected in the structures and that, if they failed to do so, the shacks located there would be destroyed. That Order was appealed, but the Ministerio de Salud denied the appeal by Resolution DR-CS-0135-2019. For its part, counsel for FIDUCIARIA UNIBANC Sociedad Anónima stated, insofar as relevant: That on February 6, 2013, its client acquired the property registered in the Province of San José under Real Property Folio (folio Real) No. [Valor 001], located in [...], Province of San José, with an area of 148.692 square meters and 20 square decimeters, for the purpose of developing an environmentally friendly housing project while protecting the springs (nacientes) located on the property, which was maintained, fenced, and provided with security.
During December 2017 and January and February 2018, more than 70 squatter families invaded the property; they have always acted in bad faith and did not occupy it openly, peacefully, as owners, or uninterruptedly. Since the invasion of the property occurred, the remedies permitted by the legal system have been pursued, including a request for administrative eviction (desalojo administrativo), a criminal complaint before the Fiscalía de Hatillo, and a complaint before the Municipalidad de Alajuelita, because the occupants built illegally, in clear violation of the Código de Construcciones, without water or electricity and, moreover, on slopes, causing serious environmental damage, not only through the earthworks (movimientos de tierra) they carried out but also by affecting the protection zone (zona de protección) of an existing spring on the property. Absolutely nothing has been planted at the site; the fences they constructed were intended to separate the lots, while the property’s fences were removed and probably used to separate their own lots.
The administrative act (acto administrativo)—the Health Order—issued by the Área Rectora de Salud de Alajuelita, whose purpose is to “ensure the health and well-being of the occupants,” complies with the principle of legality (principio de legalidad), because the conditions in which the families unlawfully occupying the property live are unsuitable for their development as persons, since they lack basic sanitary conditions such as potable water, sanitary sewerage, electrical service, and others; therefore, the Health Order was issued in strict compliance with the Ley General de Salud, in addition to the fact that they did not have construction permits issued by the Municipalidad de Alajuelita. The Ministerio de Salud clearly stated that dwellings must meet the minimum dimensions (art. 154 LGS); bedrooms must have an area of 3.0 m2 and 7.50 m2 (art. 155 LGS); and sewage, wastewater, and stormwater must be disposed of “properly and hygienically” to prevent soil contamination.
(art.285 LGS) The construction of dwellings without sanitary systems is prohibited (310 LGS.) None of the shacks complies with Article 313 of the Ley General de Salud, making it clear that those shacks pose a real danger to the health of their occupants. The houses farther down the slope are causing contamination and damage that may be irreparable to the soil and water resources. The shacks were built irregularly on property that does not belong to them, with the unlawful occupants’ full knowledge. The actions taken by the Ministerio de Salud were lawful and sought to protect a higher value, namely human life, which the conditions in these shacks endanger, to the current or potential detriment of the plaintiffs themselves. Finally, it stated that the plaintiffs have acted in bad faith and that the action they brought before this Court is part of the conduct its client has endured since the invasion; there can be no good faith when property is unlawfully occupied, nor any valid legal right when the occupants jeopardize their own health and that of the neighbors located below the property.
The plaintiffs’ claim should be dismissed because the actions of the Ministerio de Salud are and have been entirely lawful. These arguments were reiterated in the closing arguments appearing in images 13 through 16 of the digital case file. For its part, government counsel stated: That the claimants seek the annulment of “Health Order No. 114-2018” of December 17, 2018, issued by the Ministerio de Salud, Área Rectora de Alajuelita, because they consider that Order unlawful, alleging that the property had been unused and that they had possessed it for more than 10 years. They base their asserted right on the alleged purchase of the lots where the houses are located, arguments opposed by government counsel as lacking any legal basis, for the following reasons:
6306 and that, under those circumstances, the irregularities found in the aforementioned dwellings in the “La Chanchera” informal settlement (precario) constitute the technical justification for the eviction order issued, with Administrative Act No. 114-2018 being fully valid and effective. That in this matter, under no circumstances should judicial actions facilitate harm—which, of course, may prove irreparable—to interests of a higher order such as health, physical integrity, life, or the environment, much less when, as in this case, the buildings fail to comply with the standards and requirements imposed by the legal system, limitations that were conceived for such purposes. That although the lack of decent housing is indeed a social problem, the solution to such problems falls to the appropriate institutions; nevertheless, in the present case, setting aside said order would instead entail violating the regulations cited above and endangering people’s health, not only that of the inhabitants of said informal settlement but also that of those in the surrounding areas. That, this being the case, in accordance with the foregoing, the conduct of the Administration is consistent with the Legal System, and therefore the claim must be dismissed. This argument was reiterated in the written closing arguments appearing in images 5 through 12.
The following are deemed relevant to the outcome of this matter:
Counsel for the plaintiffs requested that the judgment declare the absolute nullity (nulidad absoluta) of “Health Order” (Orden Sanitaria) No. 114-2018, alleging that the content of that administrative act (acto administrativo) is contrary to the legal system (ordenamiento jurídico), purportedly because a right of possession (derecho de posesión) had been established over property registered in the San José registry district under No. [Valor 001], corresponding to cadastral plan (plano catastrado) No. [Valor 002], located in [...]. However, a request for the nullification of an administrative act is a technical claim, due to the characteristics of the administrative act and its constituent elements. It is therefore not a claim that may be made without a technical basis. Regarding the nullity of the administrative act, this Section of the Court has reiterated in its judgments, including No. 64-2016 de las nueve horas del doce de julio de dos mil dieciséis: “...Pursuant to Article 158 of the General Law of Public Administration (Ley General de la Administración Pública; hereinafter, LGAP), the absence or defect of any requirement of the administrative act that is expressly or implicitly required by the legal system constitutes a defect (vicio) in that act.
It then provides that an administrative act that is substantially inconsistent with the legal system shall be invalid, while specifying that insubstantial violations shall not invalidate the act. This means that two types of violations may arise in an administrative act: substantial and insubstantial. The former render the act invalid, which, depending on the seriousness of the violation committed, takes the form of relative or absolute nullity; insubstantial violations do not render the act invalid, but do give rise to disciplinary liability on the part of the responsible public servant. In this regard, the validity of an administrative act is established by the complete and proper fulfillment and presence of its constituent elements, both formal and substantive. The elements to which we refer are distinguished as formal and substantive under both national legal scholarship and the LGAP. The formal elements include the subject, procedure, and form, while the substantive or material elements consist of the grounds, content, and purpose.
The first formal element of the administrative act is the subject. This is the author of the act: the public official, administrative body, or administrative entity that issues an administrative act, who or which must, in turn, meet a series of requirements such as investiture (investidura), jurisdiction (competencia), and incumbency (titularidad). Investiture is the appointment or election of a person to a public office or position (in this regard, Articles 111 et seq. of the LGAP). It is the authority to act in Nombre62 and on behalf of the State and to attribute to the State the effects of that person’s conduct. Investiture may occur through election or appointment. It becomes effective upon taking office. Eduardo Ortiz defines jurisdiction ‘as the exact measure of the legally authorized means available to the State, in a specific case, to pursue a particular purpose.’ Jurisdiction means the set of powers and duties assigned to a particular administrative entity.
Jurisdiction is the body of authorities and powers attributed to a particular administrative body in relation to the others, since the basis of jurisdiction lies in the plurality of bodies comprising the Public Administration and the allocation of the various functions among them (Articles 59 and 129 LGAP). Finally, incumbency means that the public official must not only have jurisdiction but must also be the incumbent vested with that jurisdiction. An incumbent has been understood to mean a person who holds an office, profession, or position by right or by permanent appointment, with full qualifications and security of tenure, as opposed to a person called upon to occupy it provisionally.
The second formal element of the administrative act is procedure. The Public Administration has the power to issue administrative acts unilaterally, which may even nullify or revoke the subjective rights (derechos subjetivos) of private parties. This power of administrative self-enforcement (autotutela) has been limited by the legal system. That limitation consists of the Public Administration’s obligation to follow a procedure when issuing an administrative act. An administrative procedure (procedimiento administrativo) is a linked series of procedural acts directed toward an end. The fundamental purpose of an administrative procedure is to ascertain the actual truth concerning the grounds that will serve as the basis for the final administrative act. Procedure concerns the manner in which an act is produced (Articles 214, 216, 224, 225, 308, and 320 LGAP).
However, where such a procedure is intended to impose a penalty or, in some manner, an adverse measure (acto de gravamen), whether by imposing an obligation or causing the loss of a status or right, the act initiating that procedure must be duly communicated to the affected party. Such communication is accomplished in two ways: service of notice (notificación) or publication (publicación). Acts of general application are communicated by publication, while specific acts are communicated by service of notice—Article 240 Ley General de la Administración Pública—; however, when the place designated for service upon the interested party is unknown or incorrect due to that party’s own fault, the act must be communicated by publication, in which case communication shall be deemed effected five days after that publication (Article 242 LGAP). Service of notice is the means of directly and personally informing the affected party or recipient of the final act that the procedure has commenced, which constitutes a fundamental requirement of legal certainty (seguridad jurídica) and substantive due process (debido proceso sustancial). Service of notice is a legal duty of the Administration whose purpose is to ensure that the affected parties obtain true, actual, and complete knowledge of the commencement of an administrative procedure against them and of its consequences.
Undoubtedly, proper service of notice is another manifestation of the elements comprising due process, which the Constitutional Chamber (Sala Constitucional) has defined as follows: a) providing the affected party with notice of the charges, which entails communicating the alleged facts individually, specifically, and promptly; b) allowing unrestricted access to the administrative record (expediente administrativo); c) granting a reasonable period to prepare a defense; d) granting a hearing and allowing the party to submit any evidence deemed appropriate in support of the defense; e) stating the grounds for decisions that conclude the procedure; and f) recognizing the right to appeal the decision imposing the penalty” (Voto número 5469-95 de las dieciocho horas tres minutos del cuatro de octubre de mil novecientos noventa y cinco). It bears noting that, under Article 223 LGAP, only the omission of essential procedural formalities (formalidades sustanciales del procedimiento) shall result in the nullity of the proceedings, meaning a formality whose proper observance would have prevented or changed the final decision in significant respects, or whose omission caused a denial of the right to a defense (indefensión).
Procedural defects are therefore those caused by failure to observe the required procedural formalities, insofar as the omission or absence of such a formality prevents or changes the final decision or causes a denial of the right to a defense.
The third formal element of the administrative act is form, which is the manner in which the administrative act is externally expressed or manifested. Pursuant to Article 134 of the LGAP, an administrative act must be expressed in writing unless its nature or the circumstances require a different form (see 136 LGAP and 146 Constitución Política). From this formal element arises the Administration’s obligation to adequately justify its decisions by providing reasons (motivación) for its acts, insofar as providing reasons means the explanation, legal basis, or justification furnished by the Administration when issuing an administrative act. It has been stated that: ‘To state the reasons for an administrative act is to trace the decision contained therein back to a rule of law that authorizes that decision or from whose application it arises. Providing reasons for an act therefore requires, first, establishing the facts taken into consideration and bringing those facts within the scope of a legal rule; and, second, explaining how that legal rule requires the decision adopted in the operative portion of the act.’ (Eduardo García de Enterría and Tomás Ramón Fernández; “Curso de Derecho Administrativo”, Tomo I, Editorial Civitas, Madrid, 1997, p. 556).
The Sala Constitucional has stated: ‘The requirement to provide reasons for administrative acts must be understood as the grounds that public authorities must give for the content of the act they issue, taking into account the factual and legal grounds and the purpose sought by the decision. In settled case law, this court has held that providing reasons for administrative acts is a requirement of the constitutional principle of due process, as well as of the right of defense, and entails reference to facts and legal grounds so that the person subject to the Administration’s authority (administrado) knows the reasons why a penalty is to be imposed or why an application affecting that person’s interests or even subjective rights is denied.’ (Voto 7924-99).
As for the material or substantive elements of the administrative act, the grounds (motivo) (Article 133 LGAP) are the legal prerequisite, the triggering fact that gives rise to the administrative act. Thus, the grounds of the administrative act constitute the circumstance or triggering fact for issuing an administrative act; in other words, they constitute the rationale for the administrative act—what requires or permits its issuance. The grounds may consist of a legally significant act or fact contemplated by the legal rule. The content of the act, meanwhile, constitutes its legal effect or operative portion—what it commands, orders, or provides. It is the change that the act introduces into the legal realm. It is the portion of the act that provides for a penalty, authorization, permit, or concession (Article 132 LGAP).
The last substantive or material element is purpose (fin). The Public Administration has a single mission: satisfying the public interest (interés público). The public interest is satisfied in various ways, one of which is through the issuance of administrative acts that exercise the specific jurisdiction assigned to the administrative body or entity precisely so that it may act and satisfy the public interest inherent in the jurisdiction conferred upon it. In principle, every administrative act, as the concrete result of general jurisdiction, is understood to seek the satisfaction of the common interest. Accordingly, the purpose of the administrative act is said to be the satisfaction of the public interest, which constitutes the general purpose of every administrative act; in turn, its specific purpose is to satisfy the public interest entrusted to that jurisdiction (Article 131 LGAP).
Article 166 LGAP provides: ‘An act shall be absolutely null when one or more of its constituent elements are entirely absent, either factually or legally.’ It must be borne in mind, as Nombre111027 reminds us, that ‘the concept of an administrative act is undoubtedly a consequence of the Public Administration’s subjection to a legal regime,’ and that the ‘frequently invoked general principle of the legality of administrative action becomes, when each specific administrative act is examined, a matter of pure legal analysis, the use of which is therefore indispensable for rigorously determining which administrative acts are legally valid and which are not....’” Thus, pursuant to the Ley General de la Administración Pública, an administrative act (acto administrativo) shall be absolutely null and void (nulidad absoluta) when one or more of its essential elements are absent, namely, its grounds (motivo), content (contenido), or purpose (fin), a circumstance that must be determined in each specific case.
In the present matter, although annulment is sought on the allegation that “Health Order No. 114-2018” (Orden Sanitaria No. 114-2018) is contrary to the legal system (ordenamiento jurídico), counsel for the plaintiffs, in a filing lacking legal precision, fails to specify why that administrative act is considered contrary to the legal system; moreover, regardless of whether an act of the nature of the challenged act complies with the law, it bears no relation whatsoever to either ownership (titularidad) or possession (posesión) of real property (bien inmueble). Notwithstanding the foregoing, this Chamber shall now review the proceedings to determine whether they comply with the legal system.
The subject matter of these proceedings is the plaintiffs’ request that the judgment declare the “Sanitary Order (Orden Sanitaria) No. 114-2018” null and void, by which they were ordered to vacate the property within 10 business days, on the ground that it was contrary to the legal system, although they failed to specify, in legal terms, the nature of the alleged defect. Nevertheless, this Chamber will now review the legality of the actions taken on the basis of the facts deemed proven. Officials from the Área de Salud de Alajuelita conducted an on-site inspection (inspección ocular) on 17 de diciembre de 2018 at property No. [Valor 001] of the Partido de San José, corresponding to registered cadastral plan (plano catastrado) No. [Valor 002] and owned by Fiduciaria Unibanc S.A., corporate identification number: CED83090, and found that shacks had been built there. For such purposes, they drew up inspection record (acta) No. 234-2018, which stated that the dwelling was unsanitary and dilapidated, had inadequate arrangements for the disposal of wastewater, gray water, and sewage, lacked cross-ventilation, potable water, minimum dimensions for living spaces, and electricity; and, pursuant to articles 310, 312, 313, 314, 319, 320 and 3 21 of the Ley General de Salud, No. 5395-S, as amended, they declared it uninhabitable (inhabitable).
Based on that inspection and in order to safeguard the health and well-being of the occupants, and now pursuant to articles 50 of the Constitución Política; 1, 2, 4, 7, 310, 312, 313, 319, 320, 321, 338, 339, 340, 341, 355 356, 357 and 363 of the Ley General de Salud, Ley No. 5395 del 30 de Octubre de 1973, Reformada por leyes No. 5789 de 01 de Setiembre de 1975; 6430 de 15 de Mayo de 1980; 6726 de 10 de Marzo de 1982; 7093 de 22 de Abril de 1988 y 7600 de 2 de Mayo de 1966, and article 303 of the Ley General de la Administración Pública, No. 6227, “Orden Sanitaria” No. 114-2018 was issued and served, provisionally declaring the dwelling uninhabitable and ordering that it be vacated within 10 business days. Based on the contents of the record prepared by a public official, which the plaintiffs did not disprove in these proceedings, it is clear that the actions taken complied with the principle of legality (principio de legalidad), since the dwelling did not meet the minimum conditions required for habitation.
Accordingly, the authorities of the Área de Salud de Alajuelita acted in accordance with their legal obligation to protect public health, and for purposes of adopting the challenged administrative act (acto administrativo), the existence or absence of a preexisting right of possession (derecho de posesión) vested in those potentially affected by the measure was irrelevant. Thus, the Administration issued an administrative act that satisfied its constituent elements: specifically, there was a genuine factual basis (motivo real), consisting of the unsanitary and uninhabitable condition of the dwelling, thereby complying with the requirements of article 133 of the Ley General de la Administración Pública. The substance of the act (contenido del acto) (article 132 of the LGAP), namely, the eviction order (orden de desalojo), was consistent with and proportionate to its grounds, because under the provisions on which it was based, a dwelling declared to be in such a condition must be vacated.
Finally, its purpose (fin) (article 131 LGAP) was fulfilled, namely, the duty of officials of the Área de Salud de Alajuelita to protect public health. The substantive or objective elements (elementos materiales u objetivos) of the administrative act were therefore satisfied. In the Chamber’s view, the challenged act also satisfied the subjective or formal elements (elementos subjetivos o formales), namely, procedure, issuing authority, and form. Thus, the act was issued by the competent body and was also duly communicated so as not to cause a denial of the right of defense (indefensión). Although the plaintiffs filed administrative appeals (recursos administrativos), they did not establish that the dwelling met the conditions required for habitation, which was the factual basis of the act they challenge. The same is true in these proceedings, since the plaintiffs have not established that the dwelling they were ordered to vacate for health reasons met the conditions required for habitation.
As to the burden of proof (carga de la prueba), the plaintiffs must bear in mind that, under article 41.1 of the new Código Procesal Civil in relation to article 220 of the Código Procesal Contencioso Administrativo, each party is required to prove its assertions, which the plaintiffs did not do in this case. The relationship between these two articles gives rise to what is known as onus probandi (or burden of proof), a Latin expression for the legal principle identifying who is required to prove a particular fact before the courts. The basis of onus probandi lies in an old legal maxim stating that “what is normal is presumed; what is abnormal must be proven.” Por tanto, whoever alleges something that disrupts the normal state of affairs must prove it (“affirmanti incumbit probatio”: the burden of proof lies with the person making the assertion). Essentially, this maxim means that the burden or task of proving a proposition must fall upon the person who disrupts the normal state of affairs—that is, the person claiming to possess a new truth concerning a matter.
Therefore, because the plaintiffs failed to establish either that the dwelling met the conditions required for habitation or that they held any right over property No. [Valor 001] of the Partido de San José, corresponding to registered cadastral plan No. [Valor 002], the necessary consequence of the foregoing is that the complaint must be dismissed in its entirety, as is hereby ordered.
The representatives of FIDUCIARIA UNIBANC Sociedad Anónima and the ESTADO raised the defense of lack of legal right (excepción de falta de derecho). Regarding the defense raised, and returning to what our Sala Primera has held, reference must be made to the proof of the facts as a fundamental part of the analysis, because the findings made in that regard will determine whether the legal grounds for the relief sought exist. Current legislation provides that one of the defenses that may be raised in judicial proceedings is lack of legal right, and legal scholarship states the following concerning that defense: “...To speak of a lack of legal right is like speaking of the absence of a legal rule; it would therefore be more accurate to speak of an absence of substantive prerequisites or an absence of elements of the substantive claim—not the procedural claim, since we all possess the latter.
Despite this terminological imprecision, lack of legal right appears to refer to what Italian scholarship calls the conditions of the ‘action’ or requirements of the claim, which are understood to include the constituent requirements intended to convey that, without them, the right of action is not properly exercised and that they must consequently be regarded as the necessary and sufficient elements for specifically determining the inception of the right to seek relief. According to legal scholarship, there are three such requirements of a claim, which must be present for the claim seeking a favorable ruling to be upheld: (a) a specific legal fact, that is, a particular relationship between a fact and a legal rule; (b) standing (legitimación); and (c) procedural interest (interés procesal). Accordingly, lack of legal right would consist of the absence of the substantive prerequisites applicable to each specific case....” In accordance with the foregoing, and because no legally protectable right (derecho amparable) in favor of the plaintiffs has been established, the defense of lack of legal right must be sustained and the complaint dismissed in its entirety.
Pursuant to article 193 of the Código Procesal Contencioso Administrativo, procedural costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed upon the losing party by virtue of having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is rendered on the basis of evidence of which the opposing party was unaware. In this case, there are no grounds for departing from the general rule that costs are assessed against the losing party. Accordingly, both categories of costs in these proceedings are assessed against the plaintiffs and shall be quantified during the judgment-enforcement phase (fase de ejecución de sentencia) upon application by the defendants. The ESTADO is also awarded interest until payment is made in full, as it expressly requested.
POR TANTO:
The defense of lack of legal right is sustained, and the complaint brought by [Nombre62 002], residence identification card number [Valor 003], [Nombre 003], residence identification card number [Valor 004], [Nombre 004], residence identification card number [Valor 005], [Nombre 005], residence identification card number [Valor 006], [Nombre 006], residence identification card number [Valor 007], and [Nombre62 008], identity card number [Valor 008], and [Nombre 007], residence identification card number [Valor 009], against FIDUCIARIA UNIBANC S.A. and the ESTADO is therefore dismissed in its entirety. Both categories of costs are assessed against the plaintiffs and shall be quantified during the judgment-enforcement phase upon application by the defendants. RESULTANDO:
I.El día 27 de febrero de 2019, el apoderado especial de los actores planteó proceso de conocimiento con medida cautelar para que en sentencia se anule la "Orden Sanitaria número 114-2018 " alegando que el acto administrativo es absolutamente nulo, por ser contrario al ordenamiento jurídico y se condene a los demandados al pago de las costas personales y procesales. (Ver cd de Audiencia Preliminar).
II.Por auto de las 09:05 horas del 14 de marzo de 2019 se dio traslado de la demanda y de la medida cautelar a la representación de la sociedad FIDUCIARIA UNIBANC S. A. y al Estado. Por escrito presentado el día 02 de mayo de 2019, la representación de la sociedad FIDUCIARIA UNIBANC S. A.contestó negativamente la demanda y en su defensa opuso la excepción de falta de derecho. Por su parte la representación estatal lo hizo por escrito de fecha 07 de mayo de 2019, solicitando acoger la excepción de falta de derecho, y se rechazara la demanda en todos sus extremos. (Ver expediente judicial en su versión digital).
III.Por resolución No. 553-2019 de las 14:15 horas del 26 de marzo de 2019, se rechazó la medida cautelar solicitada. (Ver imagen 58 del expediente judicial en su versión digital de la medida cautelar) .
IV.Que la Audiencia Preliminar establecida en el ordinal 90 del Código Procesal Contencioso Administrativo fue celebrada el día 26 de febrero de 2020, en la que se reiteró que lo solicitado en sentencia es la declaratoria de nulidad de la "Orden Sanitaria No. 114-2018", se analizaron los hechos controvertidos, se admitió la prueba documental y por no haber mas prueba que evacuar, la Jueza de Trámite declaró el proceso como de puro derecho, otorgando a las partes el plazo de 3 hábiles días para que rindieran sus conclusiones por escrito. (Ver expediente judicial en su versión digital) .
V.El presente asunto fue turnado a la Sección Cuarta el día 30 de abril de 2020, para el dictado del fallo correspondiente, según consta en el sistema informático del Tribunal. (Ver expediente judicial en su versión digital).
VI.Se dicta esta sentencia, previa deliberación de los integrantes del Tribunal, dentro del plazo que permiten las labores propias de este Tribunal sin que se observen causales capaces de invalidar lo actuado.
Redacta el Juez Salas Leitón, con el voto afirmativo del juzgador Nombre111125 y el juzgador Nombre111126 .
CONSIDERANDO:
En la audiencia preliminar la representación estatal ofreció como prueba para mejor resolver el oficio MS-DRRSCS-ARSAL-0191-2020, suscrito por el Director del Área Rectora de la Salud y dirigida a la representante estatal, acompañada de documentación que rola de la imagen 20 a la 40 del expediente digital judicial y que consiste en documentación variada de la actividad del asentamiento la chancera, por parte de diversas instituciones y la jueza de Trámite conforme lo que señala el artículo 50 del CPCA, reservó la admisibilidad de la prueba para el dictado de la sentencia. En cuanto a la admisibilidad de la prueba para mejor resolver, se debe indicar que es criterio reiterado de la jurisprudencia de la Sala Primera de la Corte Suprema de Justicia, que su rechazo no produce la indefensión de las partes. Entre otras sentencias, se transcribe en lo que interesa el Voto N° 547-F-2002 de las 16 horas del 12 de julio de 2002, en el cual esa Sala indicó: “(…) IV.- Múltiples precedentes de esta Sala, refiriéndose a la prueba para mejor resolver, han señalado que esta es prueba del juez, y no de las partes.
En consecuencia, la decisión de recabarla es facultativa del órgano jurisdiccional, y puede prescindirse de ella sin necesidad de resolución alguna. Ergo, la omisión de pronunciamiento a su respecto, precisamente porque ha sido rebasada la etapa probatoria, en la cual deben las partes demostrar los hechos constitutivos de su derecho, según lo imponen las normas sobre la carga de la prueba y precluida aquella etapa, será facultad exclusiva del juzgador, determinar si deben allegarse a los autos nuevas probanzas necesarias para la correcta decisión del litigio. Pueden consultarse, entre muchas otras las siguientes resoluciones; 59 de las 15:20 horas del 31 de mayo de 1996, 23 de las 14:20 horas del 4 de marzo de 1992, 34 de las 10:45 horas del 28 de mayo de 1993 y 83 de las 14:40 horas del 22 de diciembre de 1993. (…)”. En el caso concreto, la prueba ofrecida consiste en documentación sobre la atención institucional que se le ha brindado al precario denominado la "Chanchera" ubicado en Alajuelita, por parte de diversas instituciones estatales, pero que en criterio del Tribunal, dicha prueba resulta irrelevante ya que no posee pertinencia, con el objeto del presente proceso, es decir la supuesta ilegalidad de lo dispuesto en la orden sanitaria que se pide anular, por lo que se inadmite.
La representación de los actores planteó proceso de conocimiento para que en sentencia se declare la nulidad de la " Orden Sanitaria No. 114-2018" por considerarla contraria al ordenamiento jurídico. Manifestó su representante que son aproximadamente 60 familias, que viven dentro del inmueble inscrito en el Partido de San José, No. [Valor 010] y que corresponde al plano catastrado número [Valor 013]. Finca que denominaron "Asentamiento Agrario Monte Alto" en Concepción de Alajuelita, e indicó que los actores son en su mayoría personas de escasos recursos y de pobreza extrema, razón por la cual sus casas son humildes y sencillas. Que la posesión que ejercen y mantienen en la actualidad sobre dicha propiedad es de forma pacífica, pública, sin interrupción, de buena fe y en calidad de dueños, siendo que ese inmueble permaneció por más de 10 años, sin uso y sin ninguna función social. Que sus trabajos iniciales dentro de la finca fue arreglar cercas, hacer rondas, sembrar yuca, guineo cuadrado para subsistencia familiar.
Que en el año 2018 se emitió la orden sanitaria que se impugna donde se les notificó que debían desalojar por las anomalías detectadas en las construcciones y en caso de no hacerlo se procedería a la destrucción de los ranchos que se encuentran Que esa orden se apeló pero que el Ministerio de Salud por resolución DR-CS-0135-2019 rechazó el recurso de apelación. Por su parte, la representación de la sociedad FIDUCIARIA UNIBANC Sociedad Anónima, manifestó en lo que interesa: Que su representada adquirió el día 6 de febrero del 2013 la finca del partido de San José, inscrita a folio Real No. [Valor 001], situada en el [...], Provincia de San José, con una cabida de 148.692 metros con 20 decímetros cuadrados, con el propósito de desarrollar un proyecto habitacional amigable con el ambiente, protegiendo las nacientes que en la propiedad existen, a la cual se le daba mantenimiento, estaba cercada y proveída de seguridad.
Que durante los meses de diciembre de 2017, y enero y febrero del 2018, más de 70 familias precaristas invadieron la finca, quienes han actuado siempre de mala fe, no la ocuparon de manera pública, ni pacífica, ni a título de dueños y menos ininterrumpidamente. Que desde que se dio la invasión a la propiedad, se han ejercido las acciones que el ordenamiento jurídico permite, como lo es la solicitud de desalojo administrativo, denuncia Penal ante la Fiscalía de Hatillo y denuncia ante la Municipalidad de Alajuelita, por cuanto los ocupantes construyeron en forma ilegal, con una clara transgresión al código de construcciones, sin agua, ni luz y además en pendientes, ocasionando un serio daño ambiental, no solo por los movimientos de tierra que han hecho, sino por la afectación a la zona de protección de una naciente existente en el inmueble. Que en el sitio no se ha sembrado absolutamente nada, las cercas que han hecho son para separar los lotes y las cercas de la propiedad fueron eliminadas y utilizadas, probablemente, en la separación de sus propios lotes.
Que el acto administrativo (orden sanitaria) del Área Rectora de Salud de Alajuelita, cuyo objetivo es "garantizar la salud y bienestar de los ocupantes", es apegado al principio de legalidad, ya que las condiciones en que viven las familias usurpadoras no son aptas para el desarrollo como personas, puesto que no cuentan con las condiciones higiénicas básicas, como agua potable, alcantarillado sanitario, servicio eléctrico y otras; por lo que la emisión de la orden sanitaria se hizo en estricto apego a la Ley General de Salud, aunado a que no contaron con los permisos de construcción dados por la Municipalidad de Alajuelita. Que el Ministerio de Salud, fue claro al indicar que las viviendas deben contar con las dimensiones mínimas (art. 154 LGS), los dormitorios deben contar con un área de 3.0 m2 y 7.50 m2 (art. 155 LGS); que las aguas negras, las servidas, y las pluviales deben ser eliminadas "adecuada y sanitariamente" con el fin de evitar la contaminación del suelo.
(art.285 LGS) Que es prohibida la construcción de viviendas sin sistemas sanitarios (310 LGS.) Que ningún rancho cumple con lo establecido en el artículo 313 de Ley General de Salud, de forma que fue claro que esos ranchos están ocasionando un peligro real para la salud de los que los habitan. Que las casas, ladera abajo, están generando contaminación y daño que puede ser irreparable para el suelo y el recurso hídrico. Que las construcciones de los ranchos se hicieron de forma irregular, en un inmueble que no les pertenece, con pleno conocimiento de los usurpadores. Que lo actuado por el Ministerio de Salud, fue ajustado a derecho y persiguiendo un valor más alto como lo es la vida humana, que en las condiciones de estos ranchos es contrario a la salud, en perjuicio actual o potencial para los actores mismos. Finalmente señaló que la actuación de los actores es de mala fe y que la acción que han emprendido en esta sede, es parte de las acciones de lo que su representada ha sufrido desde la invasión, y que no puede existir buena fe, cuando se usurpa una propiedad, ni un buen derecho, cuando se atenta contra la salud de ellos mismos y de los vecinos ubicados en la parte baja de la propiedad.
Que la pretensión de los actores debe ser rechazada, puesto que la actuación del Ministerio de Salud es y ha sido absolutamente legal. Alegatos que fueron reiterados en el alegato de conclusiones que rola de imagen 13 a la 16 del expediente digital. Por su parte la representación estatal señaló: Que quienes accionan pretenden la nulidad de la " Orden sanitaria No. 114-2018" del 17 de diciembre de 2018, emitida por el Ministerio de Salud, Área Rectora de Alajuelita, pues consideran que, dicha orden es ilegal, bajo el argumento de que dicho inmueble se encontraba sin uso y ellos han ejercido la posesión de la propiedad por más de 10 años. Que fundamentan su derecho en la supuesta compra de los lotes en que se ubican las casas, argumentos a los que se opone por carecer de fundamento legal, con base en:
De importancia para el resultado del presente asunto se tienen como tales:
La representación de los actores solicitó que en sentencia se declare la nulidad absoluta de la "Orden Sanitaria" No. 114-2018, bajo el alegato de que el contenido de dicho acto administrativo es contrario al ordenamiento jurídico, supuestamente por haberse constituido un derecho de posesión sobre la finca del partido de San José No. [Valor 001] , correspondiente al plano catastrado No. [Valor 002], ubicada en [...]. Ahora bien, la solicitud de nulidad de un acto administrativo es una pretensión de índole técnica, debido a las características del acto administrativo y sus elementos conformadores. De manera que no es una pretensión que se haga sin basamento técnico. Ahora, en cuanto a la nulidad del acto administrativo, esta Sección del Tribunal ha reiterado en sus sentencias, entre otras, la No. 64-2016 de las nueve horas del doce de julio de dos mil dieciséis: "...Conforme con el artículo 158 de la Ley General de la Administración Pública (en adelante LGAP) la falta o defecto de algún requisito del acto administrativo, expresa o implícitamente exigido por el ordenamiento jurídico constituirá un vicio de éste.
Manifestando a continuación, que será inválido el acto administrativo sustancialmente disconforme con el ordenamiento jurídico, precisando que las infracciones insustanciales no invalidarán el acto. Lo que significa que en un acto administrativo se pueden presentar dos tipos de infracciones: sustanciales e insustanciales, siendo las primeras de ellas las que determinan la invalidez del acto, que se manifiesta, dependiendo de la gravedad de la violación cometida, en nulidad relativa o absoluta y, las insustanciales que no producen la invalidez del acto, pero si responsabilidad disciplinaria del servidor agente. En tal sentido, la validez del acto administrativo se verifica con el cumplimiento y presencia en forma perfecta de los elementos que lo constituyen, tanto formales como sustanciales. Estos elementos a que hacemos referencia, la doctrina nacional, como la LGAP, los distingue entre formales y sustanciales.
Entre los elementos formales se encuentran el sujeto, procedimiento y la forma, y en los sustanciales o materiales se tiene el motivo, el contenido y el fin. El primer elemento formal del acto administrativo es el sujeto. Corresponde al autor del acto. Es el funcionario público, órgano o ente administrativo que dicta un acto administrativo, el cual debe a su vez contar con una serie de requisitos, tales como: investidura, competencia y titularidad. La investidura es el nombramiento o la elección de una persona en un cargo o empleo público (en tal sentido artículos 111 y siguientes de la LGAP). Es la potestad para actuar a Nombre62 y por cuenta del Estado y dirigir a éste el efecto de su conducta. Esta puede darse por elección o nombramiento. Se hace efectiva con la toma de posesión del cargo. Eduardo Ortiz define a la competencia "como la medida exacta de la cantidad de medios legalmente autorizados en favor del Estado, dentro de un caso concreto para perseguir un fin determinado".
La competencia significa la cantidad de poderes y deberes dispuestos en favor de un determinado ente administrativo. La competencia es el complejo de facultades y poderes atribuido a un determinado órgano administrativo con relación a los demás, pues el fundamento de la competencia radica en la pluralidad de órganos que integran la Administración Pública y la distribución de las distintas funciones entre ellas (artículos 59 y 129 LGAP). Finalmente la titularidad, implica que el funcionario público no sólo debe ser competente, sino además debe ser el titular de la competencia. Por titular se ha entendido aquel que ejerce un cargo, profesión u oficio, por derecho propio o nombramiento definitivo, con la plenitud de requisitos y estabilidad, a diferencia del llamado a ocuparlo provisionalmente. El segundo elemento formal del acto administrativo es el procedimiento. La Administración Pública cuenta con la facultad de emitir actos administrativos en forma unilateral, que incluso pueden llegar a anular o revocar derechos subjetivos de los particulares.
Este poder de auto tutela ha sido limitado por el ordenamiento jurídico. Ese límite lo constituye la obligación de la Administración Pública de seguir un procedimiento para emitir el acto administrativo. El procedimiento administrativo es una serie concatenada de actos procedimentales tendentes a un fin. El procedimiento administrativo tiene por objeto fundamental la averiguación de la verdad real del motivo que va a servir de base al acto administrativo final. El procedimiento se trata del modo de producción de un acto (artículos 214, 216, 224, 225, 308 y 320 LGAP). Ahora bien, en el caso que tal procedimiento tenga por objeto la imposición de una sanción, o de alguna manera un acto de gravamen, sea que imponga una obligación o la pérdida de una condición o derecho, se requiere que el acto de inicio de tal procedimiento sea debidamente comunicado al afectado. Esta comunicación se logra de dos maneras: notificación o publicación.
Se comunican por publicación los actos generales y por notificación los concretos –artículo 240 Ley General de la Administración Pública-, sin embargo, cuando se ignore o esté equivocado el lugar para notificaciones al interesado por culpa de éste, deberá comunicársele el acto por publicación, en cuyo caso la comunicación se tendrá por hecha cinco días después de ésta última (artículo 242 LGAP). La notificación es el modo de comunicar al afectado o destinatario del acto final, de manera directa y personal, el inicio del procedimiento, lo que constituye un requisito fundamental para la seguridad jurídica y el debido proceso sustancial. La notificación es un deber jurídico de la Administración, cuya finalidad es asegurar el verdadero, real e íntegro conocimiento por parte de los afectados del establecimiento de un procedimiento administrativo en su contra y de sus consecuencias. Indudablemente, la debida notificación constituye una manifestación más de los elementos que integran el debido proceso, los que ha definido la Sala Constitucional de la siguiente manera: a) hacer traslado de cargos al afectado, lo cual implica comunicar en forma individualizada, concreta y oportuna los hechos que se imputan; b) permitirle el acceso irrestricto al expediente administrativo, c) concederle un plazo razonable para la preparación de su defensa, d) concederle la audiencia y permitirle aportar toda prueba que considere oportuna para respaldar su defensa; e) fundamentar las resoluciones que pongan fin al procedimiento; f) reconocer su derecho a recurrir contra la resolución sancionatoria” (Voto número 5469-95 de las dieciocho horas tres minutos del cuatro de octubre de mil novecientos noventa y cinco).
Valga señalar que al tenor del artículo 223 LGAP, solo causará la nulidad de lo actuado, la omisión de formalidades sustanciales del procedimiento, entendiendo como tal, la formalidad cuya realización correcta hubiera impedido o cambiado la decisión final en aspectos importantes, o cuya omisión causare indefensión. Se tiene entonces, que los vicios del procedimiento son los causados al inobservarse la debida ritualidad de éste, en tanto con la omisión o ausencia de esa formalidad se impida o cambie la decisión final o que se cause indefensión. El tercer elemento formal del acto administrativo es la forma, que es la manera como se exterioriza o manifiesta el acto administrativo. De conformidad con el artículo 134 de la LGAP, el acto administrativo deberá expresarse por escrito, salvo que su naturaleza o las circunstancias exijan forma diversa (ver 136 LGAP y 146 Constitución Política). Deriva de este elemento formal, la obligación de la Administración de justificar adecuadamente sus decisiones, por medio de la motivación de sus actos, en tanto la motivación significa la explicación, fundamentación o justificación que la Administración brinda en el dictado de un acto administrativo.
Se ha dicho que “Motivar un acto administrativo es reconducir la decisión que en el mismo se contiene a una regla de derecho que autoriza tal decisión o de cuya aplicación surge. Por ello motivar un acto obliga a fijar, en primer término, los hechos de cuya consideración se parte y a incluir tales hechos en el supuesto de una norma jurídica; y, en segundo lugar, a razonar como tal norma jurídica impone la resolución que se adopta en la parte dispositiva del acto.” (Eduardo García de Enterría y Tomás Ramón Fernández; “Curso de Derecho Administrativo”, Tomo I, Editorial Civitas, Madrid, 1997, p. 556). La Sala Constitucional ha manifestado: "En cuanto a la motivación de los actos administrativos se debe entender como la fundamentación que deben dar las autoridades públicas del contenido del acto que emiten, tomando en cuenta los motivos de hecho y de derecho, y el fin que se pretende con la decisión.
En reiterada jurisprudencia, este tribunal ha manifestado que la motivación de los actos administrativos es una exigencia del principio constitucional del debido proceso así como del derecho de defensa e implica una referencia a hechos y fundamentos de derecho, de manera que el administrado conozca los motivos por los cuales ha de ser sancionado o por los cuales se le deniega una gestión que afecta sus intereses o incluso sus derechos subjetivos." (Voto 7924-99). Respecto de los elementos materiales o sustanciales del acto administrativo, tenemos que el motivo (artículo 133 LGAP) es el presupuesto jurídico, el hecho condicionante que da génesis al acto administrativo. De tal manera que el motivo del acto administrativo constituye el supuesto o el hecho condicionante de la emisión de un acto administrativo, en otros términos, constituye la razón de ser del acto administrativo, lo que obliga o permite su emisión.
Puede consistir en un acto o un hecho jurídico previsto por la norma jurídica. En tanto que el contenido del acto, constituye el efecto jurídico o la parte dispositiva del acto, lo que manda, ordena o dispone. Es el cambio que introduce en el mundo jurídico. Es la parte del acto que dispone una sanción, una autorización, permiso, concesión (artículo 132 LGAP). El último de los elementos sustanciales o materiales es el Fin. La Administración Pública tiene un cometido único, la satisfacción del interés público. Esa satisfacción del interés público se logra de diversas maneras, siendo una de ellas a través de la emisión de actos administrativos que actúan las competencias específicas asignadas al órgano u ente administrativo y que le han sido asignadas, precisamente para actuar y satisfacer el interés público incito en la competencia conferida. En principio se entiende que, todo acto administrativo, como resultado concreto de una competencia genérica, tiende a la satisfacción del interés común.
Por ello se afirma, que el fin del acto administrativo en consecuencia será la satisfacción del interés público, que constituye el fin general de todo acto administrativo y a su vez, el fin específico será la satisfacción del interés público que está a cargo de esa competencia (artículo 131 LGAP). Dispone el artículo 166 LGAP: “Habrá nulidad absoluta del acto cuando falten totalmente uno o varios de sus elementos constitutivos, real o jurídicamente.” Advirtiendo, como nos los recuerda Nombre111027 que "la noción de acto administrativo es indudablemente una consecuencia de la sumisión de la Administración Pública a un régimen de derecho" y que el "principio general, tantas veces aludido, de la legalidad de la actuación administrativa se resuelve, a la vista de cada concreto acto administrativo, en una cuestión de pura técnica jurídica, cuyo empleo se hace entonces indispensable para determinar con rigor qué actos administrativos son legalmente válidos y cuáles no...".
De esta forma de acuerdo a la Ley General de la Administración Pública, habrá nulidad absoluta del acto administrativo cuando falte uno o varios de los elementos del acto administrativo, sea, motivo, contenido o fin, circunstancia que habrá de determinarse en cada caso concreto. En el presente asunto si bien se pide anular bajo el alegato de que la "Orden Sanitaria No. 114-2018" es contraria al ordenamiento jurídico, sin embargo en un escrito carente de técnica jurídica omite la representación de los actores precisar porqué razón considera dicho acto administrativo contrario al ordenamiento, sin perjuicio de la el ajuste a derecho o no de un acto de la naturaleza del impugnado, ninguna relación tiene ni con la titularidad ni con la posesión de un bien inmueble. No obstante lo anterior, esta Cámara procederá de seguido a revisar lo actuado a efectos de determinar su correspondencia o no con el ordenamiento jurídico.
Como objeto del presente proceso tenemos que la representación de los actores solicitó que en sentencia se declare la nulidad de la "Orden Sanitaria No. 114-2018", por la cual se les previno desalojar el inmueble en el plazo de 10 días hábiles, por considerarla contraria al ordenamiento jurídico, mas sin precisar desde la técnica jurídica en que consiste el vicio acusado, no obstante esta Cámara se seguido procederá a revisar la legalidad de lo actuado con base en los hechos que se han tenido por acreditados. Tenemos que personeros del Área de Salud de Alajuelita realizaron el día 17 de diciembre de 2018, una inspección ocular en la finca del Partido de San José No. [Valor 001] , correspondiente al plano catastrado No. [Valor 002] y propiedad de la sociedad Fiduciaria Unibanc S.A.cédula jurídica: CED83090, y constataron la construcción de ranchos y para los efectos levantaron el acta acta No. 234-2018 en la que se indicó que la vivienda era insalubre y ruinosa, poseía una inadecuada disposición de aguas residuales, servidas y negras, no poseían ventilación cruzada, ausencia de agua potable, ausencia dimensiones mínimas en espacios habitacionales, ausencia de electricidad, y conforme a lo dispuesto en los artículos 310 , 312, 313 , 314 , 319, 320 y 3 21 de la Ley General de Salud, No. 5395-S y sus reformas, procedieron a declararlo inhabitable.
Con base en dicha Inspección y con el fin de salvaguardar la salud y el bienestar de los ocupantes, ahora con fundamento en los artículos 50 de la Constitución Política; 1, 2, 4, 7, 310, 312, 313, 319, 320, 321, 338, 339, 340, 341, 355 356, 357 y 363 de la Ley General de Salud, Ley No. 5395 del 30 de Octubre de 1973, Reformada por leyes No. 5789 de 01 de Setiembre de 1975; 6430 de 15 de Mayo de 1980; 6726 de 10 de Marzo de 1982; 7093 de 22 de Abril de 1988 y 7600 de 2 de Mayo de 1966 y el artículo 303 de la Ley General de la Administración Pública, No. 6227 se emitió y notificó la " Orden Sanitaria" No. 114-2018", declarando precautoriamente inhabitable la vivienda y se ordenó desalojarla en el plazo de 10 día hábiles. Conforme a lo consignado en el acta por parte de un funcionario público, y que no fue desacreditado en la presente causa por los actores, es claro que lo actuado se hizo conforme al principio de legalidad, toda vez que la vivienda no presentaba condiciones mínimas para ser habitable, de manera que la autoridades del Área de Salud de Alajuelita, actuaron conforme a lo que le exige el ordenamiento jurídico en su obligación de velar por la salud pública, resultando a los efectos de la adopción del acto administrativo impugnado, irrelevante la existencia o no de un derecho de posesión pre existente en cabeza de los posibles afectados con la medida.
Así, la Administración emitió un acto administrativo que cumplió con sus elementos conformadores, a saber, existió un motivo real constituido por el estando insalubre e inhabitable de la vivienda, cumpliéndose con lo que exige el artículo 133 de la Ley General de la Administración Pública. Luego el contenido del acto (artículo 132 de la LGAP), es decir la orden de desalojo fue conteste y proporcionada al motivo, ya que conforme a la normativa del fundamento, una habitación declarada en tales condiciones debe ser desalojada. Y finalmente se cumplió con el fin (artículo 131 LGAP), el cual es el deber de los personeros del Área de Salud de Alajuelita de velar por la Salud Pública. De esta forma se cumplió con los elementos materiales u objetivos del acto administrativo. Luego también el acto cuestionado, cumplió en criterio de la Cámara con los elementos subjetivos o formales, a saber, procedimiento, sujeto y forma.
Así el acto fue dictado por el órgano competente, fue además debidamente comunicado, a efectos de no generar indefensión. Luego, si bien los actores plantearon los recursos administrativos, lo cierto es que no acreditaron que la vivienda cumpliera con las condiciones requeridas para ser habitable, fundamento en el plano fáctico del acto que cuestionan. Situación que también se da en esta sede, toda vez que los actores no acreditan que la vivienda que se les pidió desalojar por razones sanitarias, cumpliera con las condiciones requeridas para ser habitable. Y es que en cuanto a la carga de la prueba, deben los actores tener presente que a la sombra de lo normados por el artículo 41.1 del nuevo Código Procesal Civil con relación al 220 del Código Procesal Contencioso Administrativo, es obligación de la parte probar su dicho, lo que en la especie no lo hizo. De la relación de ambos artículos se deriva lo que se conoce como el onus probandi (o carga de la prueba) expresión latina del principio jurídico que señala quién está obligado a probar un determinado hecho ante los tribunales.
El fundamento del onus probandi radica en un viejo aforismo de derecho que expresa que "lo normal se presume, lo anormal se prueba". Por tanto, quien invoca algo que rompe el estado de normalidad, debe probarlo ("affirmanti incumbit probatio": a quien afirma, incumbe la prueba). Básicamente, lo que se quiere decir con este aforismo es que la carga o el trabajo de probar un enunciado debe recaer en aquel que rompe el estado de normalidad (el que afirma poseer una nueva verdad sobre un tema). De forma que al no haber acreditado los actores las condiciones requeridas para habitar la vivienda, ni derecho alguno sobre la finca del Partido de San José No. [Valor 001], correspondiente al plano catastrado No. [Valor 002], corolario de lo expuesto es declarar improcedente la demanda en todos su extremos, como en efecto se hace.
La representación de la sociedad FIDUCIARIA UNIBANC Sociedad Anónima y del ESTADO opusieron en su defensa la excepción de falta de derecho. Sobre la excepción de falta de derecho opuesta; retomando lo dicho por nuestra Sala Primera, es menester remitirse a la demostración de los hechos, como parte fundamental de ello, porque de lo que en ese acápite se determina, se podrá desprender si existen o no las bases legales para lo pretendido. Establece la legislación vigente que una de las excepciones oponibles en los procesos judiciales es la falta de derecho y sobre esa excepción la doctrina nos indica: "...Hablar de falta de derecho es como hablar de falta de norma jurídica, por lo que lo correcto sería hablar entonces de falta de presupuestos materiales o falta de elementos en la pretensión material -no procesal pues ésta todos la poseemos, a pesar de la imprecisión terminológica falta de derecho parece entonces referirse a las denominadas por la doctrina italiana como condiciones de la "acción" o requisitos de la pretensión y que se sabe comprende los requisitos constitutivos, para hacer comprender que sin ellos el derecho de acción no se ejerce adecuadamente y que los mismos debe, por consiguiente, ser considerados como los extremos necesarios y suficientes para determinar en concreto, el nacimiento del derecho a la pretensión.
Tales requisitos de la pretensión, que deben concurrir, para que pueda considerarse estimatoria la misma, la cual busca la resolución favorable, son, según la doctrina, tres: (a) un cierto hecho específico jurídico, o sea, una cierta relación entre un hecho y una norma; (b) la legitimación, (c) el interés procesal. Entonces la falta de derecho estaría representada por la inexistencia de los presupuestos materiales para cada caso concreto...". De acuerdo a lo indicado supra y no habiéndose acreditado derecho amparable a favor de los actores, lo procedente es acoger la excepción de falta de derecho y rechazar la demanda en todos sus extremos.
De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o cuando la sentencia se dicte en virtud de pruebas que desconociera la parte contraria. En este caso, no se observan motivos que permitan excepcionar la máxima de condena al vencido. Por ello, se imponen ambas costas del proceso a cargo de los actores, las cuales se liquidarán en fase de ejecución de sentencia a instancia de los accionados. Se reconoce además a favor del Estado el reconocimiento de los intereses hasta su efectivo pago, por así haberlo solicitado expresamente.
POR TANTO:
Se acoge la excepción de falta de derecho y por ende se declara improcedente la demanda incoada por los señores [Nombre62 002], cédula de residencia de numero [Valor 003], [Nombre 003] , cédula de residencia de numero [Valor 004], [Nombre 004], cédula de residencia de numero [Valor 005], [Nombre 005], cédula de residencia de [Valor 006] , [Nombre 006], cédula de residencia [Valor 007], y [Nombre62 008], cédula de identidad número [Valor 008] y [Nombre 007], cédula de residencia número [Valor 009] contra FIDUCIARIA UNIBANC S.A. y el ESTADO. Son ambas costas a cargo de los actores las cuales se liquidarán en fase de ejecución de sentencia a instancia de los accionados. Se reconoce intereses sobre las costas, a favor del Estado hasta su efectivo pago, por así haberlo solicitado expresamente. NOTIFÍQUESE. José Iván Salas Leitón, Nombre111125 , Nombre111126 .
