APPEAL OF THE JUDGMENT (RECURSO DE APELACIÓN DE SENTENCIA) filed in the present criminal proceeding against [Nombre1], a Costa Rican national, identification document number CED1, for the offense of VIOLATION OF LEY FORESTAL, to the detriment of NATURAL RESOURCES. Judges José [Nombre1] Rojas Chacón, Francisco Lemus Víquez, and Adriana Escalante Moncada participated in deciding the appeal. Appearing in the appeal are the representative of the Procuraduría General de la República, attorney Margot Avellán Ruiz, and attorney Segismudo Araya Zúñiga, in his capacity as private defense counsel (defensor particular) for the accused (imputado), [Nombre1].

PROCEDURAL BACKGROUND (RESULTANDO):

  1. 1By judgment number 274-2019, issued at eight hours and fifteen minutes on treinta de abril de dos mil diecinueve, the Tribunal de Juicio del Primer Circuito Judicial de Alajuela ruled: “POR TANTO: In accordance with the foregoing; Articles 39 and 41 of the Constitución Política; Article 8 of the Convención Americana de Derechos Humanos; Article 1 of the Código Penal; and Articles 1 through 15, 142, 360, 361, and 366 of the Código Procesal Penal, the objections (protestas) alleging lack of standing (falta de legitimación activa) and lack of a right of action (falta de acción), raised by defense counsel for the defendant (encartado) against the participation of the Procuraduría General de la República, are denied. Likewise, [Nombre1] IS ACQUITTED OF ALL PUNISHMENT AND LIABILITY for the offense of VIOLATION OF LEY FORESTAL with which he had been charged to the detriment of NATURAL RESOURCES.The costs of the proceedings shall be borne by the State.- The civil damages action (acción civil resarcitoria) brought by the civil plaintiff (actora civil), Procuraduría General de la República, against the accused and civil defendant (demandado civil), [Nombre1], is denied; this issue is resolved without a special award of costs. Regarding the DVD submitted as physical evidence (evidencia material), once the judgment becomes final (firmeza del fallo), it shall be sent to the regional administration archives in accordance with the guidelines established at session 6312 of the Consejo Superior. Notice shall be given by reading.- *. MIGUEL E. FERNÁNDEZ CALVO. PRESIDING JUDGE (JUEZ COORDINADOR).
  2. 2Attorney Margot Avellán Ruiz and attorney Segismudo Araya Zúñiga filed appeals of the judgment against the foregoing ruling.
  3. 3Upon completion of the corresponding deliberation, in accordance with Article 465 of the Código Procesal Penal, the Tribunal de Apelación de Sentencia del III Circuito Judicial de Alajuela, San Ramón, proceeded to hear the appeal.
  4. 4The applicable legal requirements have been observed throughout the proceedings.

Appellate Judge (Juez de Apelación de Sentencia) Rojas Chacón authors the decision; and, CONSIDERING (CONSIDERANDO):

I.As the sole ground of the appeal against the judgment (recurso de apelación de sentencia) filed by adhesion by private defense counsel for the accused [Nombre1], a violation of due process (debido proceso) and the principle of legality (principio de legalidad) is alleged. He maintains that, at trial, he objected to the participation of the Procuraduría General de la República in the plenary proceedings (plenario), because the defense considered that its private prosecution (querella) and civil action for damages (acción civil resarcitoria) had been filed out of time, since they were not submitted to the Ministerio Público within the 13-day period. Nevertheless, the Trial Court rejected on the merits the defenses of lack of a legal right (falta de derecho) and lack of standing (falta de legitimación activa) raised by the accused’s defense counsel. He considers the rulings of both the Criminal Court for the Intermediate Stage and the Trial Court to be incorrect and, therefore, contends that an absolute defect (vicio absoluto) occurred when the participation of the Procuraduría General de la República in these proceedings was improperly allowed, thereby granting the State an undue advantage.

He maintains that Articles 76, 77, 114, and 306 of the Código Procesal Penal, which are the only provisions governing the filing of the private prosecution and the civil action, do not provide for the possibility of filing those pleadings with the Criminal Court. He further maintains that the periods established in Article 306 of the Código Procesal Penal must be calculated from the filing of the private prosecution and civil action with the Ministerio Público, because any contrary interpretation would entail the repeal of said Article 306, since it would relieve the party of the obligation to submit the pleadings to the Ministerio Público and would also relieve the latter of the oversight it must exercise pursuant to Article 308 of the Código Procesal Penal, given that, when the private prosecution and civil action are filed with the Criminal Court, the legally required hearings are not granted.

He also alleges that this would relieve the Ministerio Público of ensuring that the accused gives a statement pursuant to Article 309 of the Código Procesal Penal, and would relieve the private prosecutor (querellante) of complying with the procedure established in Article 114 of the same body of law, under which the civil action must be filed with the Ministerio Público during the preparatory proceedings (procedimiento preparatorio), together with the private prosecution. The appellant considers that allowing the private prosecutor to file the private prosecution and civil action directly with the Criminal Court merely because the private prosecutor decided to do so on its own initiative, and accepting those pleadings on that basis, is contrary to Articles 76 and 77 of the Código Procesal Penal and would relieve the Ministerio Público of its responsibility to verify the private prosecutor’s proper constitution and standing, since the Judge for the Intermediate Stage merely admits the pleading and exercises no oversight whatsoever, thus allowing the private prosecutor, through this avenue, to manipulate the time limits and forums at will.

He states that, in the case under review, page 81 shows that, at 08:18 on 7 de junio de 2016, the Ministerio Público ordered that the Procuraduría be informed that it had a period of 3 business days to state whether it wished to enter an appearance as a private prosecutor and civil plaintiff (actora civil), a ruling that was in fact served by fax on 7 de junio de 2016. He states that, as reflected on page 83, and because the Procuraduría did not express its wish to enter an appearance as a private prosecutor, the case file (expediente) was forwarded to the Criminal Court, which, by a ruling issued at 10:34 on 8 de julio de 2016, scheduled a preliminary hearing (audiencia preliminar), notice of which was served on the Procuraduría at fax number 22225335. He notes that page 89 reflects that Licda. Beatriz Sarmiento Chaves informed the Criminal Court that, by a filing issued at 08:18 on 7 de junio, the Ministerio público had granted it the hearing provided for in Article 306 of the Código Procesal Penal and that, because the notice did not include a copy of the charging document (pieza acusatoria) or the evidence supporting it, that entity requested the corresponding copies, with the consequent suspension of the applicable time limits.

In the appellant’s view, in her filing on page 89, Licda. Beatriz accepted and acknowledged as valid the notice of the hearing under Article 306 of the Código Procesal Penal, merely requesting suspension of the applicable period. The appellant considers that, according to his interpretation of Article 24 of the Ley Orgánica de la Procuraduría General de la República, the latter was indeed served on 7 de junio de 2016 and that the period should have been calculated from the date on which it was granted the hearing under Article 306 of the Código Procesal Penal. He further considers that the issue in dispute is whether the period should be calculated from the time when the Procuraduría General de la República, exercising the authority provided for in Article 170 of the Código Procesal Penal, filed the criminal private prosecution (querella penal) and civil action for damages with the Criminal Court for the Intermediate Stage, namely, on 8 de febrero de 2017, since that was when it decided to bring the action by availing itself of the reinstatement of the time limit (reposición de plazo) provided for in said Article 170.

He maintains that, in this case, despite not having the copies, the Procuraduría, by virtue of its request appearing on pages 99 to 100, deemed itself served and filed its civil-action and private-prosecution pleadings, but filed them with the Criminal Court even though the law, without exception, required their submission to the Ministerio Público, as directed by the ruling on page 82. The appellant states that, several months later, the Criminal Court for the Intermediate Stage declared that defective procedural activity (actividad procesal defectuosa) had occurred, based on Article 309 of the Código Procesal Penal, so that the accused could be questioned concerning the private prosecution; however, by the time the case file was returned to the Ministerio Público, considerably more than the 13 days established in Article 306 of the Código Procesal Penal had elapsed, calculated from 8 de febrero de 2017, when, according to page 99 and the civil-action files, it filed those pleadings while invoking Article 170 of the Código Procesal Penal.

The appellant maintains that filing those pleadings with the Criminal Court did not in any way suspend the period for filing them with the Ministerio Público and, consequently, by the time they were filed with the latter, the statutory period had long since elapsed, making their filing untimely. He alleges that it is untrue that the State receives special treatment with respect to the forum in which it must file, because that benefit applies only to time limits; but in this case, upon invoking Article 170 of the Código Procesal Penal, the matter no longer concerned the running of time limits or the lack of notice of the hearing under Article 306 of the Código Procesal Penal. Instead, it filed both actions with the wrong authority, and no provision establishes that time limits are suspended when an application is filed before another forum, just as, for example, if an appeal against a judgment were filed with the Sala de Casación and the statutory period elapsed, it would have to be deemed untimely.

He requests that the private prosecution and civil action filed in these proceedings by the Procuraduría General de la República be declared untimely and that, consequently, the appeal against the judgment filed by the State’s legal representative in these proceedings be declared improperly admitted. The ground is denied: For purposes of resolving the claim raised by private defense counsel for the accused, this Chamber will recount the proceedings related to the Procuraduría General de la República’s entry into these proceedings as private prosecutor and civil plaintiff: i).- By an official letter dated 23 de marzo de 2015, the Ministerio Público informed the Procuraduría General de la República of the existence of the criminal proceedings and of an on-site inspection (inspección ocular) scheduled for 6 de mayo de 2015 (cf. page 18). That official letter was sent by fax on 27 de abril de 2015 (cf. page 19). ii).- By a filing received by the Fiscalía Adjunta de Alajuela on 29 de abril de 2015, State Attorney Margot Avellán Ruiz requested that the Ministerio Público, pursuant to Article 24 of that institution’s organic law, send her copies of the case file, ancillary files (legajos), and reports comprising these proceedings.

Those materials were to be sent to the central offices of the Procuraduría General de la República in San José. She also requested suspension of the periods running against that representation until the requested documents were duly received at the specified location (cf. page 21). On that same date, an official letter from the Procuradora General was received, entering the appearances of attorneys Margot Avellán Ruiz, Federico Quesada Soto, and Olman Rodríguez Brunett so that, acting jointly or separately, they could represent the State’s interests in those proceedings (cf. page 22). iii).- Subsequently, page 39 contains an official letter dated 28 de julio de 2015, in which prosecutor Ada Ruth Pérez Vásquez forwarded to State Attorney Margot Avellán Ruiz copies of the summary-proceeding documents (piezas de la sumaria) for the appropriate purposes. It is noteworthy that the only acknowledgment-of-receipt copy attached to that official letter is from the Fiscalía Adjunta itself, dated 29 de julio de 2015 at 13:48, bearing the handwritten notation “with copies of case file” (cf. page 39). iv).- The Ministerio Público filed an indictment (acusación) dated 3 de junio de 2016 (cf. pages 72 to 80).

Subsequently, by a ruling issued at 08:18 on 7 de junio de 2016, the Unidad de Capacitación y Supervisión del Ministerio Público notified the Procuraduría General de la República by fax and granted it a period of three days to state whether it intended to enter an appearance as a private prosecutor and civil plaintiff, advising it that both pleadings had to be filed within the ten days following the expiration of that period (cf. page 81). That ruling was served on the Procuraduría General de la República on 7 de junio de 2016 (cf. page 82). However, nowhere in the case file is there any record that the Fiscalía de Alajuela sent the Procuraduría copies of the indictment or the evidence supporting it. v).- Subsequently, the case file was sent to the Juzgado Penal de Alajuela on 5 de julio de 2016 (cf. reverse of page 82). By a ruling issued at 10:34 on 8 de julio de 2016, the Juzgado Penal de Alajuela scheduled the preliminary hearing for 09:00 on 25 de noviembre de 2016 (cf. page 83); that ruling was served on the Procuraduría General de la República on 15 de julio de 2016 (cf. reverse of page 87). vi).- By a filing addressed to the Juzgado Penal de Alajuela and submitted on 15 de noviembre de 2016, State Attorney Beatriz Sarmiento Chávez, acting in place of Margot Avellán, confirmed that, by a filing issued at 08:18 on 7 de junio de 2016, the Ministerio Público had indeed granted the Procuraduría General de la República the hearing under Article 306 of the Código Procesal Penal.

However, because that notice did not include a copy of the charging document or the evidence supporting it, the Procuraduría General de la República requested the corresponding copies in a filing submitted that same day, with the consequent suspension of the period for responding to that hearing until the requested materials were received. Nevertheless, as of that date, the Ministerio Público had still not sent those documents.

Prosecutor Sarmiento Chávez stated that, taking into account that a preliminary hearing had already been scheduled, and in order to avoid filing the corresponding objection based on defective procedural activity (actividad procesal defectuosa) and resetting the time limits, the request for copies of the indictment (acusación) and the supporting evidence was renewed before the Criminal Court, with a request that it be addressed as promptly as possible (cf. folio 89). vii).- By order issued at 15:04 hours on 23 de noviembre de 2017, the Alajuela Criminal Court rescheduled the preliminary hearing for 11:00 hours on 10 de febrero de 2017. In a filing submitted to the Alajuela Criminal Court on 8 de febrero de 2017, Prosecutor Margot Avellán lodged an objection based on defective procedural activity, arguing that, since 7 de junio de 2016, the Office of the Attorney General of the Republic had requested that the Public Prosecutor’s Office provide it with copies of the indictment and the supporting evidence, with the resulting suspension of the time limits, but that as of that date the prosecuting authority had not provided the requested copies.

The prosecutor stated that, because those copies had not been provided, the request for copies was again submitted to the Criminal Court on 15 de noviembre de 2016 in order to determine whether it had an interest in appearing as a private prosecutor (querellante) and civil plaintiff (actor civil), but that request was likewise not addressed. The prosecutor stated that, notwithstanding the foregoing and despite the failure to comply with the request, the Office of the Attorney General had learned of the charging instrument (pieza acusatoria) and its supporting evidence through other means, but had not had an opportunity to state whether or in what capacity it would participate in these proceedings. This violated the right of defense (derecho de defensa) and the normal course of the proceedings, particularly considering that the time limit remained suspended and that, consequently, the Office of the Attorney General retained the right to participate as private prosecutor and civil plaintiff in the case under review because—in her view—it had not formally been granted the hearing provided for in Article 306 of the Code of Criminal Procedure.

She therefore requested that the objection based on defective procedural activity be sustained and that, in the interest of procedural expediency, the attached private-prosecution complaint (querella) and civil action (acción civil) pleadings be deemed filed; those pleadings had been prepared on the basis of evidence obtained through its own means. She further requested that the defendant be served as appropriate (cf. folios 99 to 100). viii).- During the preliminary hearing held at 11:34 hours on 10 de febrero de 2017, the Office of the Attorney General of the Republic renewed its objection based on defective procedural activity. Both the Public Prosecutor’s Office and defense counsel for the defendant stated that the defect did in fact exist, since the case file contained no record that copies of the indictment and evidence had been sent to the Office of the Attorney General. The Criminal Judge presiding over the intermediate stage sustained the objection and ordered that the case be returned to the Alajuela Deputy Prosecutor’s Office so that the private-prosecution complaint and civil action could be duly processed with respect to the accused and his defense counsel (cf. folio 121). ix).- Notwithstanding the foregoing, by decision dated 28 de febrero de 2017, Prosecutor Johana Ramírez Chacón returned the case file to the Criminal Court, arguing that folio 39 contained an official letter addressed to the Office of the Attorney General of the Republic in which the Public Prosecutor’s Office transmitted copies of the summary proceedings (sumaria), and that, according to the receipt stamp of the person then responsible for the mail, that official letter was received on 29 de julio de 2015 at 13:48 hours, bearing the notation “with copies of the case file”; accordingly, the Public Prosecutor’s Office had not failed to send those copies.

On that basis, Prosecutor Ramírez Chacón returned the case file to the Alajuela Criminal Court so that the request to admit the indictment and commit the case for trial (apertura a juicio) could again be considered (cf. folio 144). The case file was again received by the Criminal Court on 2 de marzo de 2017 (cf. folio 144 verso). x).- In a filing submitted to the Criminal Court on 17 de febrero de 2017 and forwarded to the Alajuela Deputy Prosecutor’s Office on 27 de febrero of that same year, the public defender for the accused, [Nombre1], argued that the Office of the Attorney General of the Republic had raised an objection based on defective procedural activity on the ground that copies of the charging instrument had not been transmitted during the hearing granted to that institution; however, what had occurred in the case under review was that the prosecutor took advantage of the fact that, at the time of the preliminary hearing, the physical case file did not contain a certification or other evidence showing that copies of the charging instrument had in fact been sent.

The public defender stated that, according to the official letter at folio 39, the copies had indeed been sent, but the receipt stamp belonged to the Public Prosecutor’s Office itself, a circumstance that—in the defense’s view—the Office of the Attorney General of the Republic exploited to file its private-prosecution complaint and civil action out of time, thereby misleading the Criminal Court and the other parties. The public defender stated that the copies requested by the Office of the Attorney General had in fact been sent through internal mail 001226-FFA-2015, information that did not appear in the physical case file but of which the prosecutor was aware, since the record showed that they had been sent to Licda. Margot Avellán Ruiz. The Office of the Attorney General had therefore abusively exercised its procedural powers in order to file the private-prosecution complaint out of time.

As evidence, she attached a copy of page 1 from General Services, which showed that the copies had in fact been sent as of 29 de julio de 2015 (cf. folios 157 and 158). xi).- During the preliminary hearing held on 10 de noviembre de 2017, a new objection based on defective procedural activity was raised because the Public Prosecutor’s Office had not taken an investigatory statement (declaración indagatoria) from the defendant, [Nombre1], regarding the private-prosecution complaint filed by the State’s representative, nor had the defendant been served with the civil action for damages (acción civil resarcitoria). The Criminal Court sustained that objection and ordered that the case file be returned to the Deputy Prosecutor’s Office so that both procedural steps could be completed (cf. folio 188). The defendant, [Nombre1], did in fact provide a new investigatory statement on 27 de noviembre de 2017 (cf. folio 189), and the civil complaint against him was served upon him (cf. folio 190). xii).- During the preliminary hearing held on 23 de enero de 2018, privately retained defense counsel for the defendant opposed the participation of the Office of the Attorney General of the Republic as private prosecutor and civil plaintiff and also requested a final dismissal (sobreseimiento definitivo) in favor of his client.

The Criminal Court granted the latter request and, by order issued at 15:15 hours on that same date, entered a final dismissal in favor of [Nombre1]. The Office of the Attorney General of the Republic appealed that decision (cf. folios 223 to 224). xiii).- By decision No. 136-2018 issued at 14:00 hours on 9 de julio de 2018, the Alajuela Trial Court granted that appeal and declared the Criminal Court’s ruling ineffective (cf. folios 249 to 252). xiv).- Subsequently, during the new preliminary hearing held on 8 de noviembre de 2018, privately retained defense counsel for the defendant once again opposed the participation of the Office of the Attorney General of the Republic as a party, requesting that its private-prosecution complaint and civil action be declared untimely. Nevertheless, by order issued on that same date, the Criminal Court admitted the Public Prosecutor’s Office’s indictment, as well as the private-prosecution complaint and civil action filed by the Office of the Attorney General, and ordered that the present case proceed to trial (cf. folios 262 to 263).

Having analyzed all of the foregoing, it is concluded that the appellant’s argument is without merit. Indeed, his entire argument rests on several erroneous premises, including his failure to consider the content of both the second subsection of Article 24 of the Organic Law of the Office of the Attorney General of the Republic and Article 179 of the Code of Criminal Procedure. Indeed, as the record shows, the Office of the Attorney General of the Republic entered an appearance (apersonamiento) in these proceedings on 29 de abril de 2015. Under the first subsection of the aforementioned Article 24 of the Organic Law of the Office of the Attorney General, the courts are required to provide that Office with copies of all pleadings and documents filed in proceedings to which the State is a party or in which it has an interest. In the case under review, the Public Prosecutor’s Office had indeed sent copies of the case file to the Office of the Attorney General.

However, a fundamental point entirely overlooked by the appellant is that, as shown by the official letter at folio 39, what the Prosecutor’s Office sent to the Office of the Attorney General at that time was a copy of the proceedings contained in the record through 29 de julio de 2015. After that date, however, the prosecuting authority continued its investigation and gathered other evidence (e.g., the certifications from the Municipalidad de Alajuela concerning the defendant’s lack of construction permits, folios 55 to 57; property-registry reports for the property recorded under real-property folio CED2, folios 68 to 69; Environmental Damage Assessment Report, folio 60; Report AT-0613-2016; etc.), which plainly had not formed part of the packet of copies previously sent to the Office of the Attorney General of the Republic. More importantly, the Public Prosecutor’s Office did not file the indictment until junio de 2016, that is, almost one year after it had sent the sole packet of copies to the Office of the Attorney General.

This is where subsection b) of Article 24 of the Organic Law of the Office of the Attorney General of the Republic applies. Under that provision, the Administration of Justice is also required to: “[…] provide the Office of the Attorney General with copies of all rulings, records, and proceedings, whether evidentiary or of any other nature, conducted during the processing of judicial proceedings or matters. Those copies shall be stamped and signed by the Clerk of the Court” (underlining added). Because this was the Public Prosecutor’s Office’s final charging request (requerimiento final), through which it filed formal charges against [Nombre1], offered the evidence supporting that charge, and requested that the case be committed for trial, the second subsection of the aforementioned Article 24 required the Public Prosecutor’s Office to provide the Office of the Attorney General of the Republic with copies of both the charging instrument and its supporting evidence.

A meticulous review of the case file, however, shows that the prosecuting authority never complied with this procedure. Consequently, pursuant to subsection c) of Article 24 of the Organic Law of the Office of the Attorney General of the Republic, even if it had been notified of the 13-day and 5-day hearings provided for in Articles 306 and 316 of the Code of Criminal Procedure, neither time limit would run against the State’s representative until the Public Prosecutor’s Office fulfilled its obligation to provide copies of the indictment and evidence. The defense’s entire argument concerning the alleged untimeliness of the private-prosecution complaint and civil action for damages filed in this case therefore collapses completely, because in this particular case the thirteen-day period provided for in Article 306 of the Code of Criminal Procedure never began to run for the Office of the Attorney General. There is also another fundamental issue that the appellant likewise overlooked.

Indeed, under Article 179 of the Code of Criminal Procedure, defects must be cured (saneados), whenever possible, by repeating the act, correcting the error, or performing the omitted act, either ex officio (de oficio) or at the request of the interested party (a instancia del interesado). In the case sub examine, although the Office of the Attorney General of the Republic, by means of an official letter dated 15 de noviembre de 2016, advised the Alajuela Criminal Court that the Public Prosecutor’s Office had failed to fulfill its obligation to provide it with copies of the indictment (acusación) and the evidence, a new preliminary hearing (audiencia preliminar) was scheduled, whereupon the Office of the Attorney General did timely lodge an objection based on defective procedural activity (protesta por actividad procesal defectuosa), since, it should be recalled, no time limit was running against it.

In application of Article 179 of the Code of Criminal Procedure, precisely so that the defective procedural activity attributable to the Public Prosecutor’s Office could be cured, the Office of the Attorney General filed a private prosecution (querella) and a civil action for damages (acción civil resarcitoria) with the Alajuela Criminal Court so that the judicial authority would order completion of the procedures omitted by the prosecutorial body. In the opinion of this Court of Appeal, that objection was properly granted by the Alajuela Criminal Court through its ruling of 10 de febrero de 2017, which ordered that the case be remanded (reenvío) to the Public Prosecutor’s Office so that Mr. [Nombre1] could be served with both the private prosecution and the civil action for damages and a new statement could be taken from him. Thus, if in this case the Office of the Attorney General filed the private prosecution and civil action with the Alajuela Criminal Court, it was not because of an arbitrary decision, as the defense baselessly alleges, but rather as a consequence of the Public Prosecutor’s Office’s failure to comply with the obligation established in subsection b) of Article 24 of the Organic Law of the Office of the Attorney General of the Republic.

Nevertheless, the Alajuela Prosecutor’s Office again erred—an error later repeated by the defendant’s public defender—when prosecutor Johana Ramírez Chacón returned the case file, stating that copies of the summary proceedings (sumaria) had been timely sent to the Office of the Attorney General. The prosecutor’s assertion proved inaccurate because, although copies had at some point been sent to the Office of the Attorney General, they covered only the contents of the case file through 29 de julio de 2015. No copies of any evidence gathered thereafter or of the indictment itself were sent to the Office of the Attorney General, and therefore no time limits were running against it. Accordingly, the Alajueja Criminal Court was correct when, in its ruling of 10 de noviembre de 2017, it ordered the case file returned to the Deputy Prosecutor’s Office so that the procedures relating to the private prosecution and civil action could be completed (cf. folio 188).

As reflected in the record, the defendant [Nombre1] gave a new investigatory statement (declaración indagatoria) on 27 de noviembre de 2017 (cf. folio 189), and the civil complaint against him was served upon him (cf. folio 190), thereby safeguarding the accused private party’s right of defense (derecho de defensa), correcting the procedural errors, and completing the omitted procedures. The appellant is therefore wholly incorrect in asserting that the Office of the Attorney General of the Republic filed the private prosecution directly with the Criminal Court for purely arbitrary reasons. Nor is it true that, in this case, the Public Prosecutor’s Office evaded its obligation to serve the private prosecution and civil action for damages filed by the State’s representative upon both the defendant and defense counsel. More importantly, the appeal is also incorrect in asserting that the Public Prosecutor’s Office is responsible for reviewing the admission of the private prosecutor (parte querellante) and civil plaintiff (actora civil) as parties.

The Code of Criminal Procedure does indeed provide that, in principle, the private prosecution and civil action must be filed with the Public Prosecutor’s Office—which was not possible in the present case because the Prosecutor’s Office failed to send copies of the indictment and evidence to the Office of the Attorney General—but the Public Prosecutor’s Office does not determine and formalize the admission of the private prosecutor and civil plaintiff as parties to the proceedings. Rather, jurisdiction to do so lies with the Criminal Judge for the Intermediate Stage (Juez Penal de la Etapa Intermedia), pursuant to Articles 318 to 321 of the Code of Criminal Procedure. In the case sub examine, when the Alajuela Criminal Court issued the corresponding order committing the case to trial (auto de apertura a juicio) in noviembre de 2018, it admitted the Office of the Attorney General of the Republic as a party to the proceedings so that, on behalf of the State, it could pursue the private prosecution and civil action for damages. For all the foregoing reasons, because the alleged defects do not exist, this ground of appeal is denied.

II.As the first ground of the appeal against the judgment filed by the representative of the Office of the Attorney General of the Republic, she alleges insufficient reasoning and failure to observe the rules of sound judicial assessment (sana crítica) with respect to evidence of essential value. She states that the court below acquitted the accused because it considered that doubts existed regarding the presence of the spring (naciente) located on complainant Edwin Chavarría González’s property, and that it also discounted the credibility of the certification issued by the Water Directorate (which establishes not only the existence of the body of water, but also its permanent nature). She explains that the act attributed to private defendant (querellado) [Nombre1] consisted of his construction of a dwelling within the protection zone (zona de protección) of that body of water despite knowing of a spring located on a nearby property.

She maintains that the criminal intent (dolo) with which the private defendant acted was established through the testimony of the owner of the property where the spring was located, witness Edwin Chavarría González, who testified that when Mr. [Nombre1] came to his office to tell him that he was going to carry out earthworks (movimientos de tierra), the witness reminded him that there was a spring on his property and that he required the corresponding permits, to which [Nombre1], the person on trial, replied that there was no problem. She argues that, despite this unequivocal statement—which was not denied by the accused—Mr. Chavarría González’s testimony was discredited by the trial court without any basis, on the ground that a witness’s statement alone would not suffice and that the accused’s intent instead had to be proved by means of a technical document bringing the matter to his attention.

She further objects that the judge held that, because this conversation was not described in the private complaint (querella), the witness’s statement could not be considered as a basis for conviction. The appellant argues that the essential content of her complaint alleged the accused’s will and knowledge of the unlawfulness of his acts in encroaching upon the protection zone, a description that satisfies the requirements of Articles 76 and 303 of the Code of Criminal Procedure (Código Procesal Penal). She therefore considers that matters properly subject to debate at trial, such as proof of the accused’s intent, need not be included among the allegations of fact in the complaint because, under procedural law, the particular manner in which the accused learned of the existence of the spring need not appear in the statement of facts; accordingly, the judge’s requirement violated due process (debido proceso).

She also considers the court below’s reasoning to violate the principle of freedom of proof (libertad probatoria). She argues that no express provision establishes that proof of knowledge of the existence of bodies of water, and of the restrictions they impose pursuant to Section 33 of Ley Forestal, requires a notation in the land registry records of the affected properties or notice through a technical or official document informing the public of the existence of those bodies of water. She states that, in such cases, it is sufficient for the accused to have seen the water emerge in order for him to be deemed aware of it, and therefore the trial court’s reasoning improperly imposes a system of predetermined evidentiary weight (prueba tasada). She emphasizes that Mr. Chavarría González’s statement to the private defendant was never deemed false, nor is there any contrary testimony that would justify discounting its credibility.

She criticizes the Trial Court for reasoning that the complainant had no official status and lacked standing to convey that information to the accused, which the appellant considers unreasonable given that Mr. Chavarría González had the right to protect his property and, on that basis, was entitled to warn the accused that the proposed earthworks could harm his property and the spring. In the appellant’s view, the foregoing made everything that occurred in this case appear probable, namely, the encroachment upon the protection zone and the production of sediment that eroded and washed onto the property of the injured party, Chavarría González. She considers it immaterial that construction began in July and that the complaint was filed with MINAE in September, because there is no doubt that the work was carried out during those months, after he had warned the accused. Thus, in the appellant’s view, from that moment onward it was wholly irrelevant whether the spring was visible from the road, whether the restriction appeared in the land registry, or whether the precise distance between the spring and the construction was known, because the accused had been warned by the property owner.

From then on, he could no longer claim ignorance, and if any doubt existed regarding the spring’s existence, it was incumbent upon the accused to make the necessary inquiries with the authorities to determine whether the information given to him was true. Nevertheless, it was so evident that Mr. [Nombre1] was unwilling to comply with the law by respecting the protection area (área de protección) that he did not even apply to the Municipality of Alajuela for construction permits, yet proceeded with construction knowing that they were required, as shown at folio 55. The Trial Court’s conclusion therefore lacks both legal and factual support. She further objects that the trial court accepted the defense’s theory that another spring exists, for which a concession was granted to Mr. Chavarría under expediente No. 8052 of MINAE’s Water Directorate, and that it differs from the spring at issue because it has a collection tank and pipes, thereby causing confusion as to the identity and permanent nature of the body of water referenced in these proceedings.

The appellant considers that no such confusion exists because the testimony received at trial from Edwin Chavarría González and [Nombre3], an official of the Área de Conservación de la Cordillera Volcánica Central who conducted the on-site investigation of the former’s complaint, established the location of the spring without the confusion alleged by the defense and accepted by the Trial Court. This is supported by official communication SINAC-ACCVC-OA-1783-2014, at folios 1 and 2 of the case file, as well as by expert report (dictamen pericial) DCF 2015-999521-ING, which confirms that the construction was located within the spring’s protection area. She likewise states that, according to report AT-0613-2016, the spring at issue in this case—not another one—was observed by the Water Directorate, thereby confirming its location within the complainant’s property. She further maintains that, according to administrative expediente No. 8052-A, the concession granted to Valle de Agua S.A., represented by Chavarría González, has existed since 1998 for property [Dirección1], and it was not until 7 de marzo de 2012 that Mr.

Chavarría González applied for it in the name of that company and for property No. 2-382484-001. The concession was granted, but not for the original property; rather, it was granted for the subdivided parcel (segregación) recorded under real-property folio 383484-002, pursuant to decision (resolución) R-0184-2014 (folios 167 u 168 del expediente). She states that it follows from the foregoing that the concession granted to Mr. Chavarría González differs from the original concession, as corroborated by the plans at folios 5 and 149. She considers that this clarifies why several springs and concessions appear in the same case file: the first water-use concession (concesión de aprovechamiento de agua) was for property [Dirección2], whereas, for purposes of the complainant’s application, his concession is recorded in the same case file but pertains specifically to his property, namely the subdivided parcel recorded under real-property folio 382484-002, thereby eliminating any confusion.

She adds that, although the folios in this record do not expressly describe the spring as permanent, that characteristic is evident from the case file because the spring was concessioned for continuous use in predetermined quantities due to its permanent flow of water. She states that this was confirmed by witness [Nombre3] and that it is also indisputable that the Water Directorate ultimately classified the spring, through report AT-0613-2016, as a permanent spring in the public domain. She maintains that the case law of the Court of Appeal has established that, although it has been argued that the Water Directorate conducted no hydrological studies supporting its classification of the body of water, the opinion of that ministerial division is sufficient to establish the nature of the water flow, all of which contradicts the trial court’s reasoning. She requests that the judgment be vacated and the case remanded for a new trial.

For the reasons stated below, this ground is denied: Under Article 31 of our Criminal Code (Código Penal), a person acts with intent when that person wishes to bring about the defined offense, as well as when that person accepts it while foreseeing it at least as possible. Under traditional legal scholarship, intent consists of an intellectual or cognitive component and a volitional component. The former is said to consist of knowing what one is doing and knowing the elements that characterize that action as satisfying the statutory definition of the offense (típica). According to legal scholarship, this knowledge concerns the objective elements of the offense (tipo): perpetrator, action, result, causal relationship or objective attribution, material object, and so forth. Thus, for example, with respect to the subjective elements of homicide (tipo subjetivo del homicidio), intent requires knowledge that one is killing, that the action performed is capable of causing another person’s death, and that the victim is a person.

Legal scholarship also states that the knowledge required for intent must be actual, effective knowledge (knowledge actually possessed by the person when committing the act) or capable of being brought to mind (although the person possesses it and has it available, the person does not consider it when acting. Thus, for example, a person may know what they ate for lunch on a particular day, which constitutes effective knowledge, but brings it to mind only when thinking about it—that is, when retrieving it from memory and holding it in mind when acting). Accordingly, potential knowledge is insufficient for intent because the person must know what they are doing; it is not enough that the person should or could have known. The volitional element of intent, meanwhile, consists of the unconditional will to perform something satisfying the statutory definition of the offense that the perpetrator believes can be performed.

In addition to knowing the objective elements of the offense, the person must wish to carry it out—that is, the actor must decide to engage in the conduct defined as an offense. (Cf. [Nombre4], Eugenio Raúl et al. Manual de Derecho Penal. Parte General. Buenos Aires, Ediar, 2005, pp. 400 y 401). Legal scholarship also agrees that the actor’s knowledge of the elements of the criminal offense must encompass both its descriptive and normative elements. Knowledge of the former requires that they have been perceived by the person. Normative elements are understood through their meaning. Regarding the latter, Professor Castillo González has stated: A normative element is one that can be apprehended only through an evaluation […] For intent to exist in relation to a normative element, the person must know the meaning of the concept (“Bedeutungskenntnis”) (for example, the meaning of the concept “unlawful appropriation” of “property belonging wholly or partly to another,” in 208 Cod, Pen.). Normative or evaluative elements may be of two kinds.

So-called legal normative elements (elementos normativos jurídicos) are those whose meaning can be understood only by reference to a legal rule (norma jurídica) external to Criminal Law and establishing legal relationships among different parties. The legal relationships to which these elements of the statutory definition (elementos del tipo) refer become part of the definition of the wrongful act (tipo de injusto). The legal concepts to which legal normative elements refer include, for example, “marriage” (Arts. 176, 177, 118, Criminal Code), “adoption” (Art. 183 bis, 184 bis, Criminal Code), “minor” (Art. 184 Criminal Code), etc. But there are also normative elements involving general evaluative formulations, which require the person to make a general assessment (worldview). These include, for example, “dishonor” (Art. 143 Criminal Code), “dignity or decorum” […] Criminal intent (dolo) with respect to a normative element of the statutory definition presupposes that the perpetrator understood the assessment incorporated by the legislature into the concept at issue (substantive rule (norma material)) (an assessment parallel to that of a layperson).

For this purpose, the perpetrator need not understand the concept in its legal dimension; it is sufficient that the perpetrator envision the factual situation to which the legislature intended to extend the protection of the criminal rule. The foregoing likewise means, however, that it is not sufficient for the perpetrator to recognize the circumstances of the act in their factual and empirical substratum; the perpetrator must understand their social content and significance. For example, when an individual deflates a car’s tires, the individual knows that the car cannot be used. In this case, the perpetrator cannot claim an absence of criminal intent based on unfamiliarity with the concept of ‘damage,’ arguing that the perpetrator believed the offense of causing damage could be committed only when the effect of the act impaired the substance of the property, but not when the object of the act affects, as in the example, its social function” (CASTILLO GONZÁLEZ, Francisco.

Criminal Law. General Part. San José, Editorial Jurídica Continental, Volume I, 2008, pp. 586-587). Turning to the case under review, it should be noted that the criminal offense defined in subsection (a) of Article 58 of the Ley Forestal provides a penalty for anyone who: “Invades a conservation or protection area, regardless of its management category, or other forest areas or lands subject to the forestry regime, regardless of the area occupied and irrespective of whether they are privately owned lands belonging to the State or other Public Administration bodies, or privately owned lands […]”. As may be seen, this criminal offense contains a legal normative element: the conduct disfavored by the legislature (invasion) must affect a conservation or protection area. This necessarily refers us to subsection (a) of Article 33 of this same Ley Forestal, under which the following are deemed protection areas: “Areas bordering permanent springs (nacientes permanentes), defined within a radius of one hundred meters measured horizontally.” It follows that, for the subjective elements of this offense (tipicidad subjetiva) to be established, the cognitive component of criminal intent necessarily requires the individual to know not only that the conduct constitutes an invasion—that is, an irregular entry into and occupation of an area known to lie within a distance of one hundred meters from a spring—but also that the spring is permanent in nature.

Naturally, this requires the individual to possess sufficient information to foresee and accept, at least as a possibility, the occurrence of that result. After examining both the contents of the case file and the grounds for the challenged judgment, this Court of Appeal concludes that the lower court was correct in finding that the evidence introduced at trial does not establish, with the certainty required by Articles 39 and 41 of the Political Constitution and Article 9 of the Code of Criminal Procedure, that, when the accused [Nombre1] erected the structure at issue in this case, he knew not only that the location where he was performing earthworks (movimientos de tierra) was allegedly less than one hundred horizontal meters from a spring, but also that the latter had “permanent” characteristics. Indeed, the trial court’s first ground for acquitting the defendant [Nombre1] was that the evidence presented at trial did not establish with certainty that he knew that the structure he was erecting might be located less than 100 meters from a spring having those characteristics.

In this regard, the Trial Court explained as follows: “[...] the first problem we face—in this case—lies in the description of the offense provided by both the Public Prosecutor’s Office and the Attorney General’s Office, since we find a serious problem in the allegation of facts made by both prosecuting entities. Let us first examine the prosecution’s charging instrument, which, in numbered paragraph 1, describes the following conduct by the defendant: ‘…knowing that the property was subject to a registered encumbrance consisting of its proximity to a water spring, in relation to which construction or alteration of the land within a distance of less than 100 meters is prohibited…’. Among the evidence submitted and presented in the record by both the private prosecuting party—namely, the Office of the Attorney General of the Republic—and the Public Prosecutor’s Office, there is no evidence demonstrating that the defendant [Nombre1] acted with the criminal intent to disregard the existence of a registered encumbrance.

This is so because the documentary evidence presented in this case shows the existence of the property recorded in the Public Registry under Real Property Folio Registration Number 118354-000, as may be verified at folios 68 and 69, which mention only the existence of a transferred easement (servidumbre) under references 326-04671-01-902-001, an entry wholly unrelated to the alleged registry notation described in the prosecution’s charging instrument. This is because no literal certification of the property at issue was introduced at trial confirming the existence of that restriction recorded in the Public Registry, as alleged. The court has a duty to apply the principle of consistency between the charge and the judgment (principio de correlación entre acusación y sentencia); accordingly, it would be impossible for this judge to find that the intentional conduct attributed to the defendant by the Public Prosecutor’s Office was established without documentary or testimonial evidence proving the existence of the registry restriction mentioned in the charging instrument.

Therefore, the proper course in this case is to reject the Public Prosecutor’s version because there is no evidence to that effect concerning the intentional commission of the acts involving the registered restriction on construction. The Office of the Attorney General of the Republic, however, in the private criminal complaint (querella) at folio 101, chose to describe the intentional conduct comprising the offense in more general terms than did the prosecution’s charging instrument, stating the following in the second alleged fact of the private charging instrument: ‘…The accused [Nombre1], knowing that his acts were unlawful, proceeded to invade the protection area of a permanent spring by performing earthworks and constructing, making habitable, and occupying a structure intended as a dwelling…’. Given this factual description by the Attorney General’s Office, the first matter the court must examine is how the defendant knew that his acts were unlawful; that is, how he knew that the water spring—mentioned in this case—was located less than one hundred meters from the place where he carried out the construction.

In its closing arguments, the private complainant submits that the defendant acquired knowledge of the fact (an element comprising the criminal offense) from the words of the complainant, Mr. Chavarría González, who testified that when the defendant approached him and told him of his intention to build a house on the land belonging to him, Mr. Chavarría González allegedly warned him that he had to obtain all permits because there was a water spring nearby. If this statement by the witness were true, however, there would be a series of uncertainties preventing a finding that the defendant possessed the knowledge of the fact attributed to him. The Court asks: Why does the Court doubt, in view of the statement made by the witness Chavarría González, that the defendant knew of the fact? The answer is very simple: Mr. Chavarría González did not know the distance between the future construction—since he did not know exactly where on the victim’s property it would be built—and the location of the alleged water spring.

Furthermore, the Court questions Mr. Chavarría González’s capacity and authority to give any type of warning to the defendant. Moreover, it is important to note that, as several witnesses stated—particularly Judicial Investigation Agency officer Calvo Alvarado—and as shown in the photographs submitted by the parties, it is impossible, from the defendant’s property, to see the water spring and the stream located on the complainant’s property. In other words, we lack the certainty necessary to find that the defendant acted with the criminal intent required to commit the offense charged in both the public prosecution and the private complaint—that is, with full knowledge that he was carrying out construction that encroached upon the protection zone of a permanent water spring. We infer this not only because it is impossible to see that permanent water spring or the stream, but, even more significantly, because it is impossible to determine the distance between one point and the other unless the corresponding measurements are taken using specialized technological devices.

In the case under review, the measurements were taken using precision instruments employed by the witness [Nombre5], an official of the Forensic Sciences Laboratory of the Judiciary, thereby establishing the distance between the construction and the alleged water spring. In other words, official knowledge of the distance between the Ojo de Agua and the defendant’s construction was obtained only after construction had already been completed. With respect to this specific point, the Office of the Attorney General of the Republic has sought to establish the defendant’s criminal intent not only because the witness Chavarría González had already mentioned the existence of the water spring, but also by invoking the number of years the defendant had lived in that place, which, the State Attorney insists, allows us to conclude that the defendant knew of the spring’s existence. In matters of criminal attribution, however, we cannot make assumptions, nor can we engage in the logical reasoning that the Office of the Attorney General of the Republic seeks to impose, consisting of treating as a proven fact that the defendant knew what he was doing because he did not apply for the respective municipal permits to construct the dwelling at issue here.

Accepting this reasoning would be improper because it is a fallacious assertion, insofar as the Court cannot treat the failure to complete the construction procedures required by the Municipality of Alajuela as unequivocal circumstantial evidence directly linked to construction within the protection zone of the alleged water spring.

This is because the decision made by the accused (encartado) to undertake construction without permits may have more than one explanation, making this an ambiguous indication (indicio anfibológico) […] The witness Chavarría González, the complainant (denunciante) in the present case, is the person who stated, as previously mentioned, that the accused knew of the fact and of the unlawfulness of his conduct and that he acted willfully (de manera dolosa); however, his account directly conflicts with the evidence presented before the court, one item of which—of fundamental importance—concerns the date on which the criminal acts were committed. It should be recalled that the witness testified at trial that the accused began construction a few days after appearing at the complainant’s office; at that meeting, he told him that he was going to build at the site, and that this date coincided with the 2014 World Cup in Brazil, held from 12 de junio de 2014 al 13 de julio de 2014.

However, the complaint was filed in setiembre de 2014, that is, several months after the World Cup had ended. Consequently, there is also no certainty as to when the acts that caused damage to the spring (naciente) began; in other words, there is a discrepancy of as much as two months between the two dates. The witness [Nombre5] merely reported on the measurements taken with a GPS for the case file (expediente) at the scene, stating the distance between the points identified to him; however, this witness merely took point-to-point measurements as directed by the complainant. Mr. [Nombre6], meanwhile, mentioned as a relevant point the absolute impossibility of seeing the spring, much less the stream located on the complainant’s property, because of the amount of undergrowth, the presence of a fence, and the hillside on which that land is situated. Finally, the witness [Nombre7], the expert (perito) who assessed the environmental damage, could not recall any details of the expert report she had signed […]”.

The Public Prosecutor’s Office (Ministerio Público) did not file an appeal, and therefore this Chamber will focus on the claims raised by the Office of the Attorney General of the Republic (Procuraduría General de la República). The first point to be made is that, based on how it structured the accusation in its private prosecution (querella), it expressly alleged that Mr. [Nombre1] knew of the “unlawfulness of his acts”; that is, he knew that he was building within a radius of one hundred meters from a permanent spring—a protected zone (zona de protección). Based on the foregoing, this Court of Appeal finds that the appellant selectively presents and misrepresents the trial court’s reasoning. The principle of freedom of proof (principio de libertad probatoria), established in article 182 of the Code of Criminal Procedure (Código Procesal Penal), certainly permits facts and circumstances relevant to resolving a case to be demonstrated through any item of evidence validly admitted into the proceedings.

This does not mean, however, that the Trial Court (Tribunal de Juicio) is exempt from conducting a critical and rigorous examination of those same items of evidence to determine whether they provide reliable information capable of proving facts or circumstances relevant to its decision. In other words, it is not enough for the item of evidence to be valid in itself; it must also provide sufficient information for the Court to reach a finding of certainty. The problem in the case sub examine is that the only item of evidence through which the appellant seeks to prove Mr. [Nombre1]’s criminal intent (dolo) is the testimony of Mr. Chavarría González, but he did not provide the necessary, reliable information to establish with certainty that the private defendant (querellado) knew exactly where the spring was located, that it was permanent, and—more importantly—that he carried out the earthworks (movimientos de tierra) knowing that he was less than one hundred meters away.

As the court below (juzgador a quo) observed, the summary included in the judgment of Edwin Chavarría González’s statement shows that, regarding his conversation with the accused, he said: “[…] Mr. [Nombre1] visited me at my office and told me that he was going to carry out earthworks and wanted to let me know, because he has lived in the area longer than I have. The issue was that the land where the earthworks were to be carried out was on a slope; the problem was that a pipeline would be buried and a spring at the site would be damaged. But he told me that he was not going to carry out those works immediately. He told me not to worry about the construction permits, and I also warned him that the area was a protected zone. To my surprise, he came to the office on Wednesday or Thursday, and the following week I was informed that earthworks were underway. When I arrived at the site, the earthworks had already been carried out and the excavated soil had been placed on the public road, and the street pipeline was completely obstructed.

An 8-meter road separates my property from that of the accused. The earthworks completely blocked the culvert, causing the water to flow across my land and damage the spring, which is directly aligned with the construction […] The property is enclosed by a wire fence and a gate. The accused did know about that spring. The accused knew my property because I was the one who arrived in the area later. When I arrived in 1997, I had to build a pipeline so that the water would not affect the spring. The 2014 World Cup was ending, specifically in julio de ese año, when I learned of these events. I warned the accused that the construction could affect the spring. My property measures almost 11.000 meters. There is no other spring on my property. My property does not adjoin Mr. [Nombre1]’s property. I know there are other springs on properties near mine. I hold a concession (concesión) from MINAE for this spring, which must be renewed every 10 years; it was renewed in 2002 and renewed again in 2012.

After this work was performed, I did not speak with the accused again. The damage caused by this construction was erosion.” Upon examining the reasoning in the judgment, this Chamber found that, contrary to the assertion in the appeal, the trial judge accepted that this conversation between Chavarría González and [Nombre1] had indeed occurred, but held that a series of inaccuracies in the complainant’s account prevented a finding that the private defendant had definite knowledge of the spring’s location. Indeed, as the lower court noted, the information Mr. Chavarría González gave the accused was merely general: he told him about a spring but provided no further information concerning it. In other words, his testimony does not show that Mr. Chavarría González told the accused exactly where the spring was located. Likewise, the complainant did not know where on Mr. [Nombre1]’s land—which did not adjoin his own—the construction would take place, meaning that the private defendant could not have been informed that it was less than 100 meters from a spring.

It was only after the respective surveys of both properties were conducted by [Nombre3], an official of the Sistema Nacional de Áreas de Conservación, and opinion DCF: 2015-00521-ING was issued by the Sección de Ingeniería Forense—after Mr. [Nombre1] had constructed the structure—that it was determined that the building was located within a radius of 100 meters from the water source (brote de agua). Mr. Chavarría González’s testimony therefore never possessed the alleged conclusiveness that the appellant seeks to attribute to it. Moreover, an analysis of the trial court’s reasoning shows that the assertion in the appeal that the court below (Tribunal a quo) acquitted the accused supposedly because the statement of facts in the private prosecution did not describe the conversation between Chavarría González and [Nombre1] is untrue. Nor is it true that the lower court, applying rules of prescribed evidentiary weight (prueba tasada), required criminal intent to be proven through technical evidence (prueba técnica).

Essentially, the Trial Court’s argument is that the evidence did not show that [Nombre1] knew where the spring was located such that the earthworks could affect it, a conclusion that this Chamber considers consistent with the weight of the evidence. Likewise, a crucial issue in resolving this case is determining whether the private defendant had the ability, by his own means, to verify whether the spring mentioned by Mr. Chavarría González actually existed and how far it was from the place where he intended to erect the building. This is where the appellant’s own argument becomes particularly important: she maintains that no express rule provides that, to prove knowledge of the existence of and restrictions imposed by bodies of water protected under Ley Forestal No. 7575, particularly numeral 33 thereof, the affected properties must contain a notation in the property registry (anotación registral), or that a technical or official notification or document must be issued to make the existence of those bodies of water generally known.

She expressly states in her appeal that it is enough for the accused to have seen the water source for the interested party to be deemed aware of it. However, as extensively explained in the challenged judgment, regardless of whether the law requires the existence of this type of water source to be recorded through a registry notation, the problem with the accusation filed by the Ministerio Público is that it attributed criminal intent to Mr. [Nombre1] specifically on the basis of his knowledge of a registry notation whose existence was never proven. The prosecution’s theory of the case (hipótesis acusatoria) therefore necessarily had to be rejected. As for the private prosecution filed by the Procuraduría General de la República, and in light of the lower court’s arguments, this Court of Appeal reviewed the Record of Visual Inspection No.

1538-2017, prepared by officers of the Alajuela Regional Delegation of the Judicial Investigation Agency, which states the following: “This is an open crime scene, since it encompasses both the outside area on the north side of the victim’s residence and the adjoining public road bordering the property in that area and along its west side, followed by an extremely extensive area on a descending slope, located on the north side of the road running from east to west and vice versa. The area is enclosed by galvanized wire mesh and has a vehicle access gate diagonally across from the residence of the attesting witness, more than ten meters away. A large amount of extremely dense vegetation can be observed, as well as a small dirt road beginning at the gate and running northwest into the property, which, according to residents of the community, ends near the river. Nevertheless, because of the vegetation, no spring (naciente), river, stream, seep, or accumulation of water can be seen from outside the property, much less from the defendant’s property.

Nor is there any sign or notice, either inside or outside, indicating the existence of that spring or anything similar. It is therefore impossible to detect it merely by passing through the area or observing it from outside the private property, which, incidentally, is completely enclosed, preventing access by third parties […]” (folio 192). The foregoing was confirmed at trial by investigator Andrés Calvo Alvarado, who testified as follows: “Upon arriving at the site, there was a public road, with the residence of one of the defendants on one side. On the other side of the public road was a private area enclosed by galvanized wire mesh around its entire perimeter. It had abundant vegetation and a vehicle gate providing access to the interior of the private property. The property is on a descending slope. From outside, on the public road, no spring, river, or anything similar could be observed.

Neighbors said that there apparently was a spring, but we could not corroborate that, and it could not be seen from the public road. No signage indicating the existence of a spring could be observed.” This evidence directly refutes the appellant’s argument, as it shows that it was physically impossible to observe the water seep at issue in this case from outside Mr. Chavarría González’s private property, which was completely fenced and enclosed. This provides evidentiary support for the trial court’s conclusion that Mr. [Nombre1] had no way to verify, first, whether this spring existed and, second, the distance between that water seep and the structure he was building, an essential element for establishing the criminal intent (dolo) required under Article 58 of the Ley Forestal. The merely general references made to him by witness Chavarría González were not, standing alone, sufficient to supply all the information required to establish the subjective elements of the offense (tipicidad subjetiva), contrary to the appellant’s erroneous contention.

Lastly, the Trial Court is correct in holding that the fact that [Nombre1] had lived in that area for many years did not support the irrefutable conclusion that he “had to” know that there was a spring on Mr. Chavarría González’s property. It should be recalled that, as legal scholarship explains, the knowledge required for criminal intent must be actual or capable of being brought to mind, rather than knowledge that the perpetrator simply “should” have. Accordingly, the appellant’s argument that the defendant “should” have known of the existence of that spring because of the number of years he had lived there rests on a mere unprovable assumption. As the judgment explains, neither the permanent spring nor the creek could be seen from Mr. [Nombre1]’s property; moreover, it was impossible to determine the distance between one point and the other without taking the corresponding measurements using specialized technological devices (e.g., land-surveying instruments, GPS, etc.), and those studies were conducted after the alleged events.

Consequently, the lower court is correct that the evidence presented at trial did not establish that [Nombre1] acted with criminal intent—that is, knowing that he was erecting a building less than one hundred horizontal meters from a permanent spring. This absence of criminal intent is, by itself, sufficient to justify [Nombre1]’s acquittal. On the other hand, an analysis of the judgment’s remaining arguments shows that the appellant is correct that the Trial Court’s grounds for finding purported doubt regarding the identity of the spring at issue in this case, or its status as “permanent,” are incomplete and inconsistent. On both issues, the court relied almost exclusively on the certified copies of administrative file 8052 of the Water Directorate of the Ministry of Environment and Energy, while almost entirely disregarding the remainder of the evidence. In this Chamber’s view, regardless of the identification in that file of the spring for which a concession appears to have been granted to Valles de Agua S.A., the trial court should have jointly, coherently, and critically analyzed the information contained in Official Letter SINAC-ACCVC-0A-1783-204, the Visual Inspection Record in Official Letter PA-1820, the georeferenced location map of the scene, expert report DCF: 2015-000521-ING, Official Letter OA-1955-2015 concerning the Environmental Damage Assessment, and the testimony of Edwin Chavarría González and [Nombre3], not only with respect to the identity and location of the spring whose protection area was allegedly encroached upon by the private defendant (querellado), but also with respect to its nature.

The trial court should thus have explained why, even in light of the information contained in this documentary, expert, and testimonial evidence, both the identification of the water seep and its “permanent” status could still be questioned; no such reasoning appears in the judgment. Indeed, as one of its grounds for ruling out criminal intent, the Trial Court itself acknowledges that measurements were taken with precision instruments by expert [Nombre5], an employee of the Judicial Branch’s Forensic Sciences Laboratory, and that the distance between the structure and the alleged spring was determined, which is inconsistent with its doubts concerning that spring’s very existence and identity. Nevertheless, without prejudice to the foregoing considerations, which could affect Mr. [Nombre1]’s potential civil liability (a matter that will be addressed in the following recital (considerando)), it must likewise be recalled that all these technical studies were conducted after the defendant had erected his building.

They therefore could not be used to establish that, when Mr. [Nombre1] was undertaking the construction, he possessed that technical knowledge regarding the identity, location, and nature of the aforementioned spring. In other words, they could not constitute evidence that he acted with criminal intent. For all the foregoing reasons, the ground for appeal is denied.

III.As the second ground for appeal, the appellant alleges insufficient reasoning and failure to observe the rules of sound judicial assessment (sana crítica) with respect to evidence of essential value. The appellant reiterates the same arguments set forth in the preceding recital, alleging that, since not only the existence of the spring (naciente) and its permanent nature were established, but also that the accused built the house within the radius of the spring’s protection area (área de protección), facts attributable to Mr. [Nombre8] (causal nexus (nexo causal)), the proper course was to compensate the State for the environmental damage arising from this unlawful act, which is established by official letter No. OA-1955-2015, to which an Environmental Damage Assessment Report is attached, setting forth the magnitude and amount of the damage caused by the criminal conduct of Mr. [Nombre1] , which was assessed by MINAR at ₵ 1.177.884,oo.

The appellant requests that the judgment be reversed insofar as it dismissed the civil action for damages (acción civil resarcitoria) filed by the Procuraduría General de la República, and that the case be remanded for new proceedings. As the third ground for appeal, the appellant alleges a lack of reasoning by omission regarding the order to restore the affected spring protection area to its previous condition. The appellant complains that, despite an express request, the Trial Court neither ruled nor issued any order concerning the affected site and its restoration to its original condition through removal of the structure built by the accused so as to allow the site to regenerate; in support, the appellant reiterates the argument that the documentary and testimonial evidence establishes not only the existence and condition of the affected water source, but also the structure erected by the accused.

The appellant requests that the judgment be reversed and the case remanded for new proceedings. Because the claims are related, both grounds are addressed in the same recital and, for the reasons stated below, are upheld. In the challenged judgment, virtually the only argument advanced by the adjudicating body to dismiss the civil action for damages filed by the Procuraduría General de la República was that it had not been established that the accused, [Nombre1], acted with criminal intent (dolo). However, national case law has repeatedly held that if, for “purely criminal-law” reasons, the accused is acquitted (e.g., because the conduct does not satisfy the elements of an offense, is not unlawful, or is not culpable), civil liability may nevertheless remain, provided that the existence of damage is established and that there is a legal source other than criminal law that permits such liability.

In other words, the absence of a criminal wrong does not necessarily preclude granting the civil action for damages, provided that an event causing damage can be established for which liability may be attributed to the defendant under civil law, thereby giving rise to the obligation to compensate. On precisely this issue, the Sala Tercera de la Corte Suprema de Justicia held as follows: “The right to reparation for damage caused by an offense is not ancillary to the offense, but is independent and equally important, since it does not depend upon a finding of the person’s criminal liability; rather, it is entirely possible for civil liability to remain following a criminal acquittal, such as the one ordered here (Articles 40 and 368 CPP). An acquittal does not automatically imply, nor does it authorize the Court to omit, an analysis and ruling concerning civil liability, an issue repeatedly addressed in various decisions of this Chamber (cf. judgment number 101-F, of 11:00 hours of October 8, 1982; 241-F of 10:45 hours of October 2, 1986).

In this regard: ‘... this Chamber has already accepted that a civil action for damages may be granted even when no criminal wrong whatsoever is established. For example, judgment N° 565-F-94 of 16:15 hours of December 12, 1994, stated as follows: “Although in criminal proceedings civil liability is normally imposed upon a finding of at least unlawful conduct (that is, conduct satisfying the elements of an offense and being unlawful), under Article 103 of the Criminal Code (see decisions 496-F of 11:30 of October 23, 1992, and 52-F of 9:45 of January 29, 1993), nothing prevents such a civil judgment from also being imposed when liability may arise from another legal source giving rise to the obligation to compensate, a possibility expressly provided for by our legislation in Articles 11 and 398 of the Code of Criminal Procedure.” Accordingly, a judgment imposing civil liability may be entered even without a criminal wrong, provided that the requirement of another legal source, distinct from criminal law, permitting such liability is met.

The case under examination concerns an event in which the trial court rejected the proposition that the conduct of one of the alleged perpetrators satisfied the elements of an offense. This means that there is no criminal wrong. Consequently, the only remaining issue is to determine whether there is a liability regime applicable to this matter such that a civil judgment may be entered...’” (Sala Tercera de la Corte Suprema de Justicia, decision number 2000-00619, of 11:20 hours of June 9, 2000). More recently, this Chamber addressed the ancillary nature of the civil action, as well as the adjudicator’s obligation to rule on it and the criteria for attribution of liability: “The principle that a civil action is ancillary to a criminal action entails a formal, rather than substantive, dependence; that is, the latter must exist in order for the matter of restitution or civil reparation to be decided.

Once the oral and public trial has been held, the ancillary principle ceases to apply, because the parties have had an opportunity to discuss the facts alleged in the claim, present evidence, and formulate the legal arguments supporting their claims. Furthermore, it must be borne in mind that the resolution of the criminal issue does not always coincide with that of the civil issue. This is because, whereas the criminal action concerns whether or not there is conduct that satisfies the elements of an offense, is unlawful, and is culpable, in the civil action the relevant matter is to determine, on the court’s own motion, whether the substantive requirements are present, namely: a) The right: this entails establishing the existence of moral or pecuniary damage; a causal relationship between the event and the damage; and, finally, a criterion for attribution of civil liability: subjective liability (intent or fault (culpa): Art. 1045 of the Civil Code), or strict liability (responsabilidad objetiva) (created risk: Art. 1048.5 of the Civil Code; consumer protection regarding products or services: Art. 35 of Ley 7472; liability of the Administration: Arts. 190 et seq. of the Ley General de la Administración Pública, among others), or even establishing at the end of the trial that what occurred was a breach of contract, which must likewise be resolved by the trial judges in the judgment. b) Standing to sue and be sued, and c) A current interest.

Thus, in our jurisdiction it is not valid to maintain that because there was a criminal acquittal, the civil claim must meet the same fate, an issue that has been extensively addressed in the case law of the Sala Tercera de la Corte Suprema de Justicia and the Courts of Cassation (now Courts of Appeal for Criminal Judgments). The criteria for resolving criminal and civil disputes differ, and they coincide only to some extent when the civil action concerns the application of liability based on subjective attribution: intent and fault. […] The Trial Court is obligated to assess whether the aforementioned substantive civil requirements are present and to decide accordingly; it is not sufficient to state that the civil action depends upon the criminal action. Even if it were concluded that there was a breach of contract, the Court would likewise have a duty to rule as appropriate on the requested reparation.” (Decision 902-2012, of 14:05 hours, of May 10, 2012).

Reparation may be sought through a claim filed in the civil courts, which is one of the avenues the legal system makes available to citizens in choosing the forum for such cases. The foregoing follows from Article 103 of the Criminal Code in conjunction with Article 109 of the same statute, from which it follows that the civil rules governing liability apply to obligations of civil reparation. As is readily apparent, the ancillary nature provided for in Article 40 of the Code of Criminal Procedure refers solely and exclusively to the need for criminal proceedings to exist before a civil action may be initiated in that forum; at no time, however, does it establish that the right to reparation—or the obligation to provide reparation—depends upon prosecution of the offense. Civil liability is independent of the commission of an unlawful act, because the phrase “where appropriate,” contained in the third paragraph of Article 40 of the Code of Criminal Procedure, must necessarily be interpreted to mean that, notwithstanding the criminal acquittal, the court may rule on the civil action when other legal grounds, distinct from the offense, remain upon which the duty to compensate may be based.

That is, when the established facts are sufficient to demonstrate the existence of civil liability, without any requirement that the substantive rule giving rise to the obligation to compensate for the damage derive from Criminal Law, and without any need to establish criminal liability. The foregoing is the only interpretation that may be derived from the principles of Procedural Economy and Restrictive Interpretation (Article 2 CPP), in harmony with our constitutional legal order (Article 41), subject only to the requirement that the defendant be afforded an opportunity to present a defense. (Voto No. 2013-1842 of 17:03 hours of December 3, 2013). Based on the foregoing, the fact that Mr. [Nombre1] acted without the criminal intent required by Article 58 of the Ley Forestal, thereby exempting him from criminal liability, does not, by itself, rule out the possibility that his conduct may have caused quantifiable harm to the environment.

This issue should have been analyzed by the lower court, which entirely omitted any discussion of it. Likewise, although this section of the judgment additionally states that doubt remained concerning the identity of the spring, as noted in the preceding recital, that doubt is not sufficiently reasoned, because no critical analysis was made of the information contained in Official Letter SINAC-ACCVC-0A-1783-204, the Visual Inspection Record (Acta de Inspección Ocular) in Official Letter PA-1820, the georeferenced location map of the scene, opinion DCF: 2015-000521-ING, official letter OA-1955-2015 concerning the Environmental Damage Assessment, and the statements of Edwin Chavarría González and [Nombre3] . The correct identification of the spring at issue in this case and the determination of its condition are matters that could also affect any civil liability ultimately attributed to the defendant, [Nombre1] .

Likewise, it is apparent from the judgment that no ruling was issued regarding the provisions of Articles 103 of the Criminal Code, 122 and 123 of the Current Rules on Civil Liability of the Criminal Code, 140 and 466 of the Code of Criminal Procedure, 1, 33, and 58(a) of the Ley Forestal, and 99(h) of the Environmental Law, as to whether restoration of the property to its prior condition (restitución de las cosas al estado anterior) was appropriate—that is, whether it was appropriate to order the demolition of the structure built by the accused (imputado), [Nombre1]. In light of the foregoing, this Court of Appeal concludes that, with respect to these matters, the judgment fails to satisfy the duties to state reasons (deberes de fundamentación) established by Articles 142, 184, 361, and 363 of the Code of Criminal Procedure. This Chamber wishes to make it very clear that, through this ruling, it is in no way expressing an opinion regarding the credibility of the evidence offered by the parties and/or how the case under consideration should be decided, but solely finding that the judgment lacks an adequate statement of reasons regarding the civil claims (extremos civiles).

In light of all the foregoing, the second and third grounds of the appeal against the judgment (recurso de apelación de sentencia) filed by the representative of the Procuraduría General de la República are sustained. The challenged judgment is partially vacated, solely insofar as it dismisses the civil action for damages (acción civil resarcitoria) brought by the Procuraduría General de la República against the defendant, [Nombre1]. The case is remanded (reenvío) to the court of origin for a new trial, solely with respect to the civil claims and the request for demolition of the structure erected by the civil defendant (demandado civil), for which purpose due account shall be taken of the matters set forth in the second and third recitals (considerandos) of this decision. In all other respects, the challenged judgment remains undisturbed.

THEREFORE:

The appeal of the judgment filed by the private defense counsel for [Nombre1] is denied. The first ground of the appeal of the judgment filed by the representative of the Office of the Attorney General of the Republic (Procuraduría General de la República) is denied. The second and third grounds of her appeal are granted. The challenged judgment is partially vacated, solely insofar as it denied the civil damages action (acción civil resarcitoria) brought by the Office of the Attorney General of the Republic against the civil defendant [Nombre1]. The case is remanded to the court of origin for new trial proceedings solely with respect to the civil claims and the request for demolition of the structure erected by the civil defendant, for which purpose the matters set forth in the second and third recitals (considerandos) of this decision shall be taken into account. In all other respects, the challenged judgment remains undisturbed.

RECURSO DE APELACIÓN DE SENTENCIA interpuesto en la presente causa seguida contra [Nombre1] , costarricense, documento de identidad número CED1, por el delito de INFRACCIÓN A LA LEY FORESTAL en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso, los jueces José [Nombre1] Rojas Chacón, Francisco Lemus Víquez y Adriana Escalante Moncada. Se apersonan en apelación de sentencia, la representante de la Procuraduría General de la República, la licenciada Margot Avellán Ruiz y el licenciado Segismudo Araya Zúñiga, en condición de defensor particular del imputado [Nombre1] .

RESULTANDO:

  1. 1Que mediante sentencia número 274-2019 de las ocho horas quince minutos del treinta de abril de dos mil diecinueve, el Tribunal de Juicio del Primer Circuito Judicial de Alajuela, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política; 8 de la Convención Americana de Derechos Humanos; 1 del Código Penal; 1 a 15, 142, 360, 361 y 366 del Código Procesal Penal, se declara sin lugar las protestas por falta de legitimación activa y falta de acción interpuestas por parte de la defensa del encartado contra la intervención de la Procuraduría General de la República. De igual forma SE ABSUELVE DE PENA Y RESPONSABILIDAD a [Nombre1] por el delito de INFRACCIÓN DE LA LEY FORESTAL que en perjuicio de LOS RECURSOS NATURALES se le venía atribuyendo. Son las costas del proceso a cargo del Estado.- Se declara sin lugar la acción civil resarcitoria interpuesta por la actora civil Procuraduría General de la República contra el imputado y demandado civil [Nombre1] , se resuelve este extremo sin especial condenatoria en costas. Respecto del disco DVD aportado como evidencia material, a la firmeza del fallo, será remitido al archivo de la administración regional según lineamientos establecidos en la sesión 6312 del Consejo Superior. Notifíquese mediante lectura.- *. MIGUEL E. FERNÁNDEZ CALVO. JUEZ COORDINADOR.
  2. 2Que contra el anterior pronunciamiento, la licenciada Margot Avellán Ruiz y el licenciado Segismudo Araya Zúñiga, interpusieron recursos de apelación de sentencia.
  3. 3Que verificada la deliberación respectiva, de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal de Apelación de Sentencia del III Circuito Judicial de Alajuela, San Ramón, procedió a conocer del recurso.
  4. 4Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez de Apelación de Sentencia Rojas Chacón; y,

CONSIDERANDO:

I.Como único motivo del recurso de apelación de sentencia que el defensor particular del imputado [Nombre1] interpuso por adhesión, se reclama violación al debido proceso y al principio de legalidad. Sostiene que en debate se opuso a que la Procuraduría General de la República participara en el plenario, por considerar la defensa que interpuso su querella y acción civil resarcitoria en forma extemporánea, toda vez que no fueron presentadas dentro del plazo de 13 días al Ministerio Público. No obstante, el Tribunal de Juicio rechazó por el fondo las excepciones de falta de derecho y falta de legitimación activa, interpuestas por la defensa técnica del imputado. Considera que lo resuelto tanto por el Juzgado Penal de la Etapa Intermedia como por el Tribunal de Juicio es incorrecto, por lo que existe un vicio absoluto al haberse admitido incorrectamente la participación de la Procuraduría General de la República en este proceso, otorgándosele una ventaja indebida al Estado.

Sostiene que los artículos 76, 77, 114 y 306 del Código Procesal Penal, que son las únicas normas que regulan la interposición de la querella y la acción civil, no prevén la posibilidad de que dichas piezas puedan ser presentadas ante el Juzgado Penal. Asimismo, sostiene que los plazos previstos por el artículo 306 del Código Procesal Penal, se deben contabilizar a partir de la presentación de la querella y la acción civil ante el Ministerio Público, pues interpretar lo contrario implicaría una derogatoria del referido artículo 306, pues liberarían a la parte de presentar las piezas ante el Ministerio Público, como también liberaría a este último del control que debe ejercer conforme a lo dispuesto por el artículo 308 del Código Procesal Penal, toda vez que al presentarse la querella y la acción civil ante el Juzgado Penal, no confiera las audiencias de ley. Alega también que esto liberaría al Ministerio Público de controlar que el imputado rinda declaración conforme al artículo 309 del Código Procesal Penal, así como liberaría a la parte querellante de cumplir con el procedimiento previsto por el artículo 114 de este mismo cuerpo normativo, según el cual la acción civil debe plantearse ante el Ministerio Público durante el procedimiento preparatorio junto con la querella.

El apelante considera que admitir que el querellante pueda presentar la querella y la acción civil directamente ante el Juzgado Penal, solo porque así lo decidió por mutuo propio, y que por ella estas piezas deben aceptarse, va en contra de lo establecido por los artículos 76 y 77 del Código Procesal Penal, e implicaría liberar al Ministerio Público de la responsabilidad de ejercer el control de constitución y legitimación que tenga el querellante, toda vez que el Juez de la Etapa Intermedia solo admite esta pieza y no ejerce control alguno, permitiéndose al querellante, a través de dicho conducto, utilizar los plazos a su antojo y las instancias como le convengan. Señala que, en el caso de estudio, del folio 81 se desprende que el Ministerio Público, al ser las 08:18 horas del 7 de junio de 2016, ordenó comunicar a la Procuraduría que contaba con el plazo de 3 días hábiles para manifestar si deseaba constituirse en querellante y actora civil, resolución que efectivamente fue notificada vía fax el 7 de junio de 2016.

Señala que según consta a folio 83, y dado que la Procuraduría no manifestó su deseo de constituirse en querellante, el expediente fue remitido al Juzgado Penal, el cual, mediante resolución de las 10:34 horas del 8 de julio de 2016, señaló audiencia preliminar, misma que fue notificada a la Procuraduría a su número de fax 22225335. Indica que consta a folio 89 que la Licda. Beatriz Sarmiento Chaves manifestó al Juzgado Penal que en memorial de las 08:18 horas del 7 de junio, se le dio la audiencia del artículo 306 del Código Procesal Penal por parte del Ministerio público, y siendo que al traslado no se le adjuntaron copia de la pieza acusatoria, y las pruebas que la sustentaban, dicha entidad formuló la solicitud de copias respectivas con la consecuente suspensión de plazos. A criterio del apelante, la Licda. Beatriz en su memorial de folio 89 aceptó y reconoció como válida la notificación de la audiencia del artículo 306 del Código Procesal Penal, solo que reclama la suspensión de plazo.

Considera el recurrente que, de acuerdo a la interpretación que hace del artículo 24 de la Ley Orgánica de la Procuraduría General de la República, esta última si fue notificada el 7 de junio de 2016 y que el plazo debía computarse a partir de que la fecha en que se le otorgó la audiencia del artículo 306 del Código Procesal Penal, y considera que el tema de discusión es que debe contarse a partir del momento en que la Procuraduría General de la República, ejerciendo la facultad que prevé el numeral 170 del Código Procesal Penal, presentó querella penal y acción civil resarcitoria ante el Juzgado Penal de la Fase Intermedia, sea, en fecha 8 de febrero de 2017, toda vez que fue el momento en que decidió plantear la acción aprovechándose de la reposición de plazo previsto en la referida norma 170. Sostiene que, en este caso, la Procuraduría, en razón de no contar con las copias, pese a que por virtud de su petición de folio 99 a 100, se dio por notificada y presentó líbelos de acción civil y querella, solo que las presentó ante el Juzgado Penal, pese a que, por disposición legal, sin excepción alguna, se exigía que las entregara en el Ministerio Público, tal como lo previno la resolución de folio 82.

Indica el recurrente que, varios meses después, el Juzgado Penal de la Fase Intermedia declaró una actividad procesal defectuosa, con sustento en el artículo 309 del Código Procesal Penal, para que se indagara al imputado por la querella; sin embargo, para ese momento en que el expediente regresó al Ministerio Público, ya habían transcurrido sobradamente los 13 días que establece el artículo 306 del Código Procesal Penal, esto a partir del 8 de febrero de 2017, momento en que de acuerdo con los folios 99 y los legajos de la acción civil, presentó dichas piezas invocando el artículo 170 del Código Procesal Penal. Sostiene el recurrente que la presentación de esas piezas en el Juzgado Penal, en modo alguno suspendía el plazo para presentarlas ante el Ministerio Público, y por ello cuando se presentaron ante este último ya habían transcurrido sobradamente el plazo de ley, de manera que su interposición fue extemporánea.

Alega que no es cierto que el Estado tenga un trato especial en cuanto a la sede donde debe presentar, ya que dicho beneficio es solo con respecto a los plazos, pero en este vaso, al hacer uso del numeral 170 del Código Procesal Penal, ya no se trataba de un asunto de correrle plazos o falta de notificación de la audiencia del artículo 306 del Código Procesal Penal, sino que presentó ambas acciones ante un ente equivocado, sin que ninguna norma establezca que los plazos se suspenden si se presenta en otra instancia la gestión, de la misma forma que, por ejemplo, si un recurso de apelación de sentencia se presenta ante la Sala de Casación y transcurre el plazo de ley, entonces de le debe tener por extemporáneo. Solicita se declaran extemporáneas la querella y la acción civil que en la presente causa fueron interpuestas por la Procuraduría General de la República y, por ende, se declare mal admitido el recurso de apelación de sentencia interpuesto por el representante legal del Estado en la presente causa.

El motivo se declara sin lugar: Para efectos de resolver el reclamo planteado por la defensa particular del imputado, esta Cámara procederá a efectuar un recuento de las actuaciones relacionadas con la constitución de la Procuraduría General de la República como querellante y actora civil en la presente causa: i).- Mediante oficio de fecha 23 de marzo de 2015, el Ministerio Público comunicó a la Procuraduría General de la República de la existencia de la causa penal y de la realización de una inspección ocular programada para el 6 de mayo de 2015 (cf. folio 18). Dicho oficio fue remitido por vía fax el 27 de abril de 2015 (cf. folio 19). ii).- Mediante escrito recibido en la Fiscalía Adjunta de Alajuela el 29 de abril de 2015, la procuradora Margot Avellán Ruiz solicitó al Ministerio Público que, de conformidad con el artículo 24 de la ley orgánica de dicha institución, le remitiera copias del expediente, legajos e informes que conformaban la presente causa, mismas que debían ser remitidas a las oficinas centrales de la Procuraduría General de la República en San José, como también que se suspendieran los plazos que corrían contra esa representación, hasta tanto los documentos solicitados fuesen debidamente recibidos en el lugar indicado (cf. folio 21).

En esa misma fecha, se recibió el oficio de la Procuradora General, apersonando a los licenciados Margot Avellán Ruiz, Federico Quesada Soto y Olman Rodríguez Brunett, para que actuando conjunta o separadamente representaran los intereses del Estado en dicha causa (cf. folio 22). iii).- Posteriormente, a folio 39, se observa un oficio de fecha 28 de julio de 2015, donde la fiscal Ada Ruth Pérez Vásquez remite a la procuradora Margot Avellán Ruiz copias de las piezas de la sumaria, para lo que corresponda. Llama la atención que dicho oficio solo tiene copia de recibido de la misma Fiscalía Adjunta, de fecha 29 de julio de 2015, de las 13:48 horas, donde se consigna a mano “con copias de exp.” (cf. folio 39). iv).- El Ministerio Público formuló una acusación con fecha 3 de junio de 2016 (cf. folios 72 a 80). Luego, mediante resolución de las 08:18 horas del 7 de junio de 2016, la Unidad de Capacitación y Supervisión del Ministerio Público, por la vía de fax, otorgó audiencia a la Procuraduría General de la República por el término de tres días, para que informara si pretendía constituirse en querellante y actora civil, indicándole que debía presentar ambas piezas dentro de los diez días posteriores al vencimiento de dicho plazo (cf. folio 81).

Dicha resolución fue notificada a la Procuraduría General de la República el 7 de junio de 2016 (cf. folio 82). Sin embargo, no consta en ninguna parte del expediente que la Fiscalía de Alajuela remitiera a la Procuraduría copias de la acusación o de las pruebas que la respaldaban. v).- Posteriormente, el expediente fue enviado al Juzgado Penal de Alajuela el 5 de julio de 2016 (cf. folio 82 vto.). Mediante resolución de las 10:34 horas del 8 de julio de 2016, el Juzgado Penal de Alajuela señaló las 09:00 horas del 25 de noviembre de 2016 para la realización de la audiencia preliminar (cf. folio 83), resolución que fue notificada a la Procuraduría General de la República el 15 de julio de 2016 (cf. folio 87 vto.). vi).- Mediante escrito dirigido al Juzgado Penal de Alajuela y presentado en fecha 15 de noviembre de 2016, la procuradora Beatriz Sarmiento Chávez, en sustitución de Margot Avellán, confirmó que efectivamente por memorial de las 08:18 horas del 7 de junio de 2016, el Ministerio Público confirió a la Procuraduría General de la República la audiencia del artículo 306 del Código Procesal Penal, pero que en vista de que a ese traslado no se le adjuntó copia de la pieza acusatoria y de las pruebas que la sustentaban, por escrito de ese mismo día la Procuraduría General de la República formuló la solicitud de copias respectiva, con la consecuente suspensión del plazo para referirse a dicha audiencia, hasta tanto no ingresara lo requerido, pese a lo cual dichos documentos, a esa fecha, todavía no habían sido remitidos por el Ministerio Público.

Indicó la procuradora Sarmiento Chávez que, tomando en cuenta que ya existía señalamiento para audiencia preliminar, y a fin de evitar la interposición de la actividad procesal defectuosa correspondiente y retrotraer los plazos, se reiteró al Juzgado Penal la solicitud de copias de la acusación y de las pruebas que la sustentaban, la cual se solicitó fuese atendida a la mayor brevedad posible (cf. folio 89). vii).- El Juzgado Penal de Alajuela, por resolución de las 15:04 horas del 23 de noviembre de 2017, reprogramó la audiencia preliminar para las 11:00 horas del 10 de febrero de 2017. Mediante escrito presentado en el Juzgado Penal de Alajuela el 8 de febrero de 2017, la procuradora Margot Avellán interpone una protesta por actividad procesal defectuosa, argumentando que desde el 7 de junio de 2016, la Procuraduría General de la República había formulado una solicitud al Ministerio Público para que le remitiera copias de la acusación y de las pruebas que la sustentaban, con la consecuente suspensión de los plazos, sin que a esa fecha el órgano acusador hubiere remitido las copias solicitadas.

Indicó la procuradora que como dichas copias no fueron aportadas, nuevamente en fecha 15 de noviembre de 2016 se reiteró ante el Juzgado Penal la petición de copias a fin de establecer su eventual interés de constituirse en querellantes y actores civiles, solicitud que tampoco fue atendida. Señaló la procuradora que, no obstante lo anterior, y a pesar del incumplimiento de lo peticionado, la Procuraduría, por otros medios, entró en conocimiento de la pieza acusatoria y la prueba que la sustenta, pero no había tenido la oportunidad de manifestarse en cuanto al interés o condición en que participaría en este proceso, lo cual violentaba el derecho de defensa y el curso normal del procedimiento, máxime si se tomaba en cuenta que el plazo se encontraba suspendido y, por ende, se encontraba vigente la posibilidad de la Procuraduría de participar como querellante y actor civil en el caso de estudio, pues –a su criterio- formalmente no se le había conferido la audiencia del artículo 306 del Código Procesal Penal, por lo que solicitó acoger la actividad procesal defectuosa y, en aras de la celeridad procesal, se tuviera presentados los líbelos de querella y acción civil que se adjuntaban, mismos que fueron elaborados conforme a la prueba que obtuvieron por sus propios medios, y que se procediera a notificar al imputado para lo correspondiente (cf. folios 99 a 100). viii).- Durante la audiencia preliminar celebrada a las 11:34 horas del 10 de febrero de 2017, la Procuraduría General de la República reiteró la protesta por actividad procesal defectuosa.

Por su parte, tanto el Ministerio Público como la defensa del imputado señalaron que efectivamente existía el vicio, toda vez que no constaba en el expediente que se hubiere remitido a la Procuraduría las copias de la acusación y las pruebas. El Juez Penal de la Etapa intermedia acogió la protesta y ordenó devolver la causa a la Fiscalía Adjunta de Alajuela, para que diera el trámite correspondiente a la querella y acción civil hacia el acusado y su defensa técnica (cf. folio 121). ix).- No obstante lo anterior, mediante disposición de fecha 28 de febrero de 2017, la fiscal Johana Ramírez Chacón remitió de nuevo el expediente al Juzgado Penal, argumentando que a folio 39 constaba un oficio dirigido a la Procuraduría General de la República, en el cual el Ministerio Público remitía copias de las piezas de la sumaria y que de acuerdo al sello de recibido de la encargada del correo en ese momento, recibe dicho oficio el 29 de julio de 2015 a las 13:48 horas, haciendo la anotación “con copias del expediente”, por lo que entonces el Ministerio Público no omitió remitir las referidas copias.

Con fundamento en lo anterior, la fiscal Ramírez Chacón remitió de nuevo el expediente al Juzgado Penal de Alajuela, para que se conociera nuevamente la solicitud de acusación y apertura a juicio (cf. folio 144). El expediente fue nuevamente recibido en el Juzgado Penal el 2 de marzo de 2017 (cf. folio 144 vto.). x).- Mediante escrito presentado en fecha 17 de febrero de 2017 en el Juzgado Penal y remitido a la Fiscalía Adjunta de Alajuela el 27 de febrero ese ese mismo año, la defensora pública del encartado [Nombre1] argumentó que la Procuraduría General de la República interpuso una actividad procesal defectuosa aduciendo que no se remitieron copias de la pieza acusatoria en la audiencia conferida a dicha institución, pero lo que sucedió en el caso de estudio es que la procuradora aprovechó que en el expediente físico no existía para el momento de la audiencia preliminar una constancia u otra prueba que demostrara que sí se enviaron copias de la pieza acusatoria.

La defensora indicó que según el oficio de folio 39, las copias sí se enviaron, pero el sello de recibido era del mismo Ministerio Público, circunstancia que –a criterio de la defensa- fue aprovechada por la Procuraduría General de la República para presentar su querella y acción civil en forma extemporánea, induciendo a error al Juzgado Penal y demás partes. Señaló la defensora que las copias solicitadas por la Procuraduría sí fueron enviadas por correo interno 001226-FFA-2015, información que no constaba en el expediente físico, pero que la señora procuradora sí conocía, pues consta que se enviaron a la Licda. Margot Avellán Ruiz, por lo que la Procuraduría incurrió en un ejercicio abusivo de sus facultades procesales para presentar la querella en forma extemporánea. Adjuntó como prueba copia de la hoja 1 de Servicios Generales, en el que constaba que las copias efectivamente fueron remitidas desde el 29 de julio de 2015 (cf. folios 157 y 158). xi).- Durante la audiencia preliminar efectuada en fecha 10 de noviembre de 2017, se interpuso una nueva protesta por actividad procesal defectuosa, toda vez que en el Ministerio Público no se le recibió declaración indagatoria al imputado [Nombre1] , con motivo de la querella formulada por la representación del Estado, como tampoco se le dio a este último traslado de la acción civil resarcitoria.

Dicha protesta fue acogida por el Juzgado Penal, que dispuso la devolución del expediente a la Fiscalía Adjunta para el cumplimiento de ambos trámites (cf. folio 188). En efecto, el imputado [Nombre1] rindió nueva declaración indagatoria el 27 de noviembre de 2017 (cf. folio 189) y se le dio traslado de la demanda civil en su contra (cf. folio 190). xii).- Durante la audiencia preliminar celebrada el 23 de enero de 2018, el defensor particular del imputado se opuso a la constitución de la Procuraduría General de la República como querellante y actora civil, así como también solicitó un sobreseimiento definitivo a favor de su representado. Esta última solicitud fue acogida por el Juzgado Penal, que mediante resolución de las 15:15 horas de esa misma fecha, dictó sobreseimiento definitivo a favor del señor [Nombre1] , misma que fue apelada por la Procuraduría General de la República (cf. folios 223 a 224). xiii).- El Tribunal de Juicio de Alajuela, mediante resolución No. 136-2018 de las 14:00 horas del 9 de julio de 2018, declaró con lugar el referido recurso y declaró ineficaz lo resuelto por el Juzgado Penal (cf. folios 249 a 252). xiv).- Posteriormente, durante la nueva audiencia preliminar que se realizó en fecha 8 de noviembre de 2018, una vez más el defensor particular del imputado se opuso a la constitución de la Procuraduría General de la República como parte, solicitando que se declararan extemporáneas la querella y la acción civil que interpuso.

No obstante, el Juzgado Penal, mediante resolución de esa misma fecha, admitió tanto la acusación del Ministerio Público, como la querella y la acción civil presentadas por la Procuraduría, disponiendo la elevación a juicio de la presente causa (cf. folios 262 a 263). Pues bien, analizado todo lo anteriormente expuesto, se concluye que no lleva razón el apelante. De hecho, toda su argumentación se construye sobre varias premisas erróneas, como lo es desconocer tanto el contenido del inciso segundo del artículo 24 de la Ley Orgánica de la Procuraduría General de la República, como del artículo 179 del Código Procesal Penal. En efecto, tal como consta en autos, desde del 29 de abril de 2015 la Procuraduría General de la República se apersonó a este proceso. Pues bien, de acuerdo con el inciso primero del referido artículo 24 de la Ley Orgánica de la Procuraduría, los tribunales de justicia tienen la obligación de remitir a esta última, copias de todos los escritos y documentos que se presente en los juicios en que sea parte o tenga interés el Estado.

En el caso de estudio ciertamente el Ministerio Público había enviado copias del expediente a la Procuraduría. Sin embargo, un aspecto fundamental que el recurrente soslayó por completo es que, según consta en el oficio de folio 39, lo que la Fiscalía en aquel entonces remitió a la Procuraduría, fue copia de las actuaciones que constaban en autos hasta el día 29 de julio de 2015. Sin embargo, con posterioridad a esta fecha, el órgano fiscal continuó adelante con la investigación y recabó otros elementos de prueba (v. gr. las certificaciones de la Municipalidad de Alajuela respecto a la falta de permisos de construcción del imputado, folios 55 a 57, estudios registrales de la finca matrícula folio real CED2, folios 68 a 69, Informe de Valoración de Daño Ambiental, folio 60, Informe AT-0613-2016, etc.), que, evidentemente, no formaban parte del legajo de copias que tiempo atrás había enviado a la Procuraduría General de la República.

Y más importante aún, el Ministerio Público formuló acusación hasta el mes de junio de 2016, es decir, prácticamente un año después de que había enviado el único legajo de copias a la Procuraduría. Pues bien, es aquí donde aplica lo dispuesto por el inciso b) del artículo 24 de la Ley Orgánica de la Procuraduría General de la República, de acuerdo con el cual, también es obligación de la Administración de Justicia: “[…] suministrar, a la Procuraduría, copias de todas las resoluciones, actas y diligencias, ya sean probatorias o de cualquier otra naturaleza, que se practiquen durante la tramitación de los juicios o negocios. Esas copias irán selladas y firmadas por el Secretario del Despacho” (subrayado es agregado). Tratándose entonces del requerimiento final del Ministerio Público, a través del cual presentó cargos formales contra [Nombre1] , así como ofreció la prueba que sustentaba dicha imputación y se solicitaba la apertura a juicio de la causa, de conformidad con el inciso segundo del referido artículo 24, era obligación del Ministerio Público remitir a la Procuraduría General de la República copias tanto de la pieza acusatoria como del material probatorio que le daba sustento.

Sin embargo, del estudio minucioso del expediente, se desprende que el órgano fiscal nunca cumplió con este procedimiento. En consecuencia, de conformidad con lo dispuesto por el inciso c) del artículo 24 de la Ley Orgánica de la Procuraduría General de la República, aún y cuando le hubiesen sido notificadas las audiencias de 13 días y 5 días de los artículos 306 y 316 del Código Procesal Penal, no correría ninguno de estos términos en contra de la representación del Estado, sino hasta que el Ministerio Público cumpliera con su obligación de entregar las copias de la acusación y las pruebas. De ahí entonces que toda la argumentación de la defensa técnica, acerca de la supuesta extemporaneidad con que se presentaron en la presente causa la querella y la acción civil resarcitoria, se resquebraja por completo, toda vez que en este caso concreto el término de trece días previsto por el artículo 306 del Código Procesal Penal, nunca comenzó a correr para la Procuraduría.

Y hay otro tema fundamental que fue igualmente soslayado por el apelante. En efecto, según lo dispuesto por el artículo 179 del Código Procesal Penal, los defectos deberán ser saneados, siempre que sea posible, renovando el acto, rectificando el error o cumpliendo con el acto omitido, de oficio o a instancia del interesado. En el caso sub examine, pese a que la Procuraduría General de la República, mediante oficio de fecha 15 de noviembre de 2016, advirtió al Juzgado Penal de Alajuela que el Ministerio Público no había cumplido con la obligación de remitirle copias de la acusación y las pruebas, se hizo un nuevo señalamiento de audiencia preliminar, por lo que entonces la Procuraduría, esta vez sí, presentó oportunamente la protesta por actividad procesal defectuosa (recuérdese que no le corría término). Y en aplicación de lo dispuesto por el artículo 179 del Código Procesal Penal, justamente para que fuera posible sanear la actividad procesal defectuosa en que incurrió el Ministerio Público, la Procuraduría presentó ante el Juzgado Penal de Alajuela la querella y la acción civil resarcitoria, para la autoridad jurisdiccional ordenase el cumplimiento de los trámites omitidos por el órgano fiscal, protesta que –a criterio de este Tribunal de Apelación- fue correctamente acogida por el Juzgado Penal de Alajuela, esto mediante resolución del 10 de febrero de 2017, ordenando el reenvío de la causa al Ministerio Público para que procediera a darle traslado al señor [Nombre1] tanto de la querella como de la acción civil resarcitoria y recibirle nueva declaración.

De esta forma, si en este caso la Procuraduría presentó la querella y la acción civil ante el Juzgado Penal de Alajuela, no fue por una decisión antojadiza, como infundadamente alega la defensa, sino más bien como consecuencia del incumplimiento por parte del Ministerio Público de la obligación establecida por el inciso b) del artículo 24 de la Ley Orgánica de la Procuraduría General de la República. Sin embargo, nuevamente la Fiscalía de Alajuela incurrió en error –mismo que luego fue reiterado por la defensora pública del imputado- cuando la fiscal Johana Ramírez Chacón devolvió el expediente diciendo que oportunamente se habían remitido a la Procuraduría copias de las piezas de la sumaria. Esta afirmación de la fiscal resultó ser inexacta, toda vez que, si bien, en algún momento se enviaron copias a la Procuraduría, estas correspondían únicamente al contenido del expediente hasta el 29 de julio de 2015.

Con respecto a todas las pruebas que fueron recopiladas con posterioridad y de la misma pieza acusatoria, no se envió copia a la Procuraduría, por lo que a esta última no le corrían términos. De ahí entonces que le asistía razón al Juzgado Penal Alajueja, cuando en resolución del 10 de noviembre de 2017 dispuso la devolución del expediente a la Fiscalía Adjunta para el cumplimiento de los trámites correspondientes a la querella y acción civil (cf. folio 188). Y tal como consta en autos, el imputado [Nombre1] rindió nueva declaración indagatoria el 27 de noviembre de 2017 (cf. folio 189) y se le dio traslado de la demanda civil en su contra (cf. folio 190), resguardando así el derecho de defensa del querellado, rectificando los errores procesales y cumpliendo con los trámites omitidos. De ahí entonces que de ninguna manera le asiste razón al apelante cuando afirma que fue por una cuestión puramente antojadiza que la Procuraduría General de la República presentó la querella directamente ante el Juzgado Penal, como tampoco es cierto que en este caso el Ministerio Público eludió su obligación de dar traslado a la defensa técnica y material de la querella y la acción civil resarcitoria presentada por la representación del Estado.

Y más importante aún, tampoco es correcto lo que se afirma en el recurso respecto a que es el Ministerio Público quien ejerce el control de la constitución de la parte querellante y actora civil. Ciertamente el Código Procesal Penal establece que, en principio, la querellada y la acción civil deben ser presentadas ante el Ministerio Público (en el caso de estudio ello no fue posible debido al incumplimiento de la Fiscalía de enviar copias de la acusación y las pruebas a la Procuraduría), pero no es el Ministerio Público el que califica y formaliza la constitución del querellante y actor civil como parte del proceso, sino que el competente para ello es el Juez Penal de la Etapa Intermedia, de conformidad con lo dispuesto por los artículos 318 a 321 del Código Procesal Penal, resultando que en el caso sub examine, el Juzgado Penal de Alajuela, al dictar el respectivo auto de apertura a juicio de noviembre de 2018, admitió la constitución de la Procuraduría General de la República, como parte procesal, para que en representación del Estado ejerciera la querella y la acción civil resarcitoria. Por todo lo expuesto, al no existir los vicios protestados, se declara sin lugar el motivo.

II.Como primer motivo del recurso de apelación de sentencia interpuesto por la representante de la Procuraduría General de la República, se reclama insuficiente fundamentación, e inobservancia de las reglas de la sana crítica con respecto a medios probatorios de valor esencial. Señala que el Tribunal a quo absolvió al imputado por considerar que había dudas sobre la existencia de la naciente de agua ubicada en el fundo del denunciante Edwin Chavarría González, así como que restó credibilidad a la constancia emitida por la Dirección de Aguas (que no sólo constata la existencia del cuerpo de agua, sino además su condición de permanente). Refiere que el hecho atribuido al querellado [Nombre1] consistió en que éste, conociendo la existencia de una naciente ubicada en una propiedad cercana, construyó una vivienda dentro de la zona de protección de dicho cuerpo de agua. Sostiene que el dolo con que actuó el querellado se acreditó con el testimonio del dueño del fundo donde se encontraba la naciente, el testigo Edwin Chavarría González, quien declaró que cuando el señor [Nombre1] se presentó a su oficina para indicarle que iba a realizar movimientos de tierra, dicho testigo le recordó que había una naciente en su propiedad y que requería los permisos correspondientes, a lo que el justiciable [Nombre1] contestó que no había ningún problema.

Alega que, a pesar de esta contundente manifestación –que no fue negada por el imputado-, el testimonio del señor Chavarría González fue demeritado por el órgano de instancia, sin ningún sustento, con el argumento de que no bastaría el dicho de un testigo, sino que el dolo del encartado debía demostrarse a través de un documento técnico que así se lo evidenciara. Reclama que, además, el juzgador consideró que como esta conversación no aparecía descrita en la querella, esta manifestación del testigo no podía ser considerada para una condenatoria. Argumenta la apelante que su querella tenía como contenido básico la voluntad y el conocimiento de la ilicitud de los actos del imputado al violentar la zona de protección, descripción que cumple con los requisitos de los artículos 76 y 303 del Código Procesal Penal, por lo que estima no tiene cabida dentro de los hechos de las querella consideraciones propias que deben ser debatidas en juicio, como lo es la demostración del dolo del imputado, pues según la normativa procesal esta particularidad de cómo ingresó al conocimiento del imputado la existencia de la naciente, no tiene que estar en la relación de hechos, de manera que tal exigencia del juzgador resultaba violatoria del debido proceso.

Por otra parte, considera que el argumento del a quo también es violatorio del principio de libertad probatoria. Alega que no existe norma expresa que establezca que para demostrar el conocimiento de la existencia y limitaciones que imponen los cuerpos de agua, protegidos en el numeral 33 de la Ley Forestal, se requiere una anotación registral en las propiedades a las que afecta, o que deba emitirse una notificación en un documento técnico u oficial que haga del conocimiento general la existencia de los cuerpos de agua. Señala que, en estos casos, basta con que el imputado haya tenido a su vista el brote de agua para que se tenga al interesado como conocedor del mismo, de manera que el argumento del órgano de instancia impone groseramente la prueba tasada. Enfatiza que nunca se tuvo como falsa la manifestación que hizo el señor Chavarría González al querellado y tampoco existe declaración en contrario que justifique restarle credibilidad.

Fustiga que el Tribunal de Juicio argumentó que el denunciante no tenía carácter oficial y no contaba con legitimación para transferir esa información al encartado, cosa que el apelante considera irrazonable tomando en cuenta que al señor Chavarría González le asistía el derecho de proteger su propiedad y –en esa premisa- estaba legitimado de advertir al imputado que los eventuales movimientos de tierra podrían perjudicar su fundo y la naciente de agua. A criterio de quien recurre, lo anterior hacía ver como probable todo lo que ocurrió en este caso, a saber, la invasión a la zona de protección y la producción de sedimentos que erosionaron y escurrieron la propiedad del ofendido Chavarría González. Considera que no importa que la construcción inició en julio y la denuncia ante el MINAE se presentó en setiembre, pues no hay duda de que la obra fue llevada a cabo en esos meses, después de que él alertara al imputado, de manera que –según el criterio de quien recurre - desde ese momento, el hecho de que la naciente se observara o no desde la calle, constara o no la limitación desde el punto de vista registral, o no se tuviera exacta idea de la distancia de la naciente desde la construcción, no tenía relevancia alguna, ya que el imputado fue puesto sobre aviso por el dueño de la propiedad, de manera que a partir de ese momento el estado de desconocimiento desapareció y, si existía alguna duda sobre la existencia de la naciente, correspondía al imputado gestionar lo pertinente ante las autoridades para determinar la veracidad de lo que se le informó, pero era tan evidente que el señor [Nombre1] no estaba dispuesto a someterse a la ley, respetando el área de protección, que ni siquiera solicitó los permisos de construcción a la Municipalidad de Alajuela, pese a lo cual levantó la construcción a sabiendas de que los requería, como consta a folio 55, de manera que la conclusión del Tribunal no tiene sustento jurídico ni fáctico.

Por otra parte, reclama al órgano de instancia haber aceptado la tesis de la defensa, respecto a que existe otra naciente de agua, concesionada al señor Chavarría, bajo el expediente No. 8052 de la Dirección de Agua del MINAE, que es distinta a la que nos ocupa pues tiene tanque de captación y tuberías, lo que genera confusión con respecto a la identidad y calidad de permanente del cuerpo de agua al que se hace referencia en el presente proceso. Considera la recurrente que tal confusión no existe, toda vez que en juicio se recibieron los testimonios de Edwin Chavarría González y [Nombre3] , funcionario del Área de Conservación de la Cordillera Volcánica Central, que atendió la denuncia del primero en el campo, quienes establecieron la ubicación de la naciente sin esa confusión alegada por la defensa y compartida por el Tribunal de Juicio, lo cual encuentra respaldo en el oficio SINAC-ACCVC-OA-1783-2014, de folios 1 y 2 del expediente, así como en el dictamen pericial DCF 2015-999521-ING, que confirma que la construcción se encontraba dentro del área de protección de la naciente.

Asimismo, refiere que según el informe AT-0613-2016, la naciente objeto de esta causa –no otra- fue observada por la Dirección de Aguas, corroborándose su ubicación dentro del fundo del denunciante. Sostiene además que según el expediente administrativo No. 8052-A, la concesión otorgada a Valle de Agua S.A., representada por Chavarría González, existe desde 1998 para la finca [Dirección1] y no fue sino hasta el 7 de marzo de 2012 que fue solicitada por el señor Chavarría González a nombre de dicha sociedad y para la finca No. 2-382484-001, la cual es otorgada pero no para la finca original, sino para la segregación de folio real 383484-002, según resolución R-0184-2014 (folios 167 u 168 del expediente). Señala que lo anterior se desprende que la concesión otorgada al señor Chavarría González difiere de la original, lo cual se corrobora con los planos de folios 5 y 149. Considera que lo anterior esclarece el hecho de que existan varias nacientes y concesiones en un mismo expediente: la primera concesión de aprovechamiento de agua fue para la finca [Dirección2], siendo que, para efectos de la solicitud del denunciante, su concesión existe dentro del mismo expediente, pero para su finca propiamente, sea la segregación folio real 382484-002, quedando así descartada la confusión.

Agrega que, si bien de los folios de este legajo no se logra extraer la denominación de naciente permanente, se hace evidente esta condición al comprobar en el expediente que la naciente fue concesionada para ser disfrutada de forma continua y en cantidades preestablecidas por su permanente brote de agua. Señala que lo anterior fue confirmado por el testigo [Nombre3] , siendo además un hecho incuestionable que es la Dirección de Aguas la que finalmente dictamina esa naciente mediante informe AT-0613-2016, como una naciente de dominio público y carácter permanente. Sostiene que la jurisprudencia del Tribunal de Apelación ha establecido que, aunque se ha alegado que no existen estudios hidrológicos realizados por la Dirección de Aguas para tener por cierto su criterio en cuanto a la calificación del cuerpo de aguas, el criterio de esta dependencia ministerial es suficiente para tenerse por cierta la condición del brote de agua, todo lo cual contradice la argumentación del órgano sentenciador.

Solicita se anule el fallo y se ordene reenvío para nueva sustanciación de juicio. En lo que se dirá, el motivo se declara sin lugar: De acuerdo con el artículo 31 de nuestro Código Penal, obra con dolo quien quiere la realización del hecho tipificado, como también quien lo acepta previéndolo al menos como posible. Para la doctrina tradicional, el dolo está constituido por un componente intelectual o cognitivo y un componente volitivo. En cuanto al primero, se afirma que consiste en saber qué es lo que se hace y conocer los elementos que caracterizan esa acción como típica. Según detalla la doctrina, este conocimiento se refiere a los elementos objetivos del tipo: sujeto, acción, resultado, relación causal o imputación objetiva, objeto material, etc. Así, por ejemplo, en el tipo subjetivo del homicidio, el dolo requiere conocer el hecho de que se mata, que la acción realizada es adecuada para producir la muerte de otra persona y que la víctima es una persona.

Señala también la doctrina que ese conocimiento exigido por el dolo, debe ser un conocimiento efectivo actual (un conocimiento realmente poseído por el sujeto al momento de cometer el hecho) o actualizable (a pesar de poseerlo y tenerlo disponible, no lo considere al momento de actuar. Así, por ejemplo, una persona puede saber qué almorzó un día, lo que constituye un conocimiento efectivo, pero solo lo actualiza cuando piensa en ello, es decir, cuando lo rescata de su memoria y lo tiene presente al momento de actuar). Por lo anterior, para que exista dolo, no basta el conocimiento potencial, pues la persona debe saber lo que hace; no basta con que hubiera debido o podido saberlo. Por otra parte, el elemento volitivo del dolo consiste en la voluntad incondicionada de realizar algo (típico) que el autor cree que puede realizar, pues además de conocer los elementos objetivos del tipo, es necesario querer realizarlo, es decir, que el agente se decida a realizar la conducta tipificada.

(Cf. [Nombre4], Eugenio Raúl y otros. Manual de Derecho Penal. Parte General. Buenos Aires, Ediar, 2005, pp. 400 y 401). Ahora bien, coincide también la doctrina en que ese conocimiento que ha de tener el agente de los elementos del tipo penal, debe abarcar tanto los elementos descriptivos como normativos. El conocimiento de los primeros, requiere que hayan sido percibidos por el sujeto. Con respecto a los elementos normativos, estos se comprenden por su significación. Con respecto a estos últimos, el profesor Castillo González ha indicado que: Normativo es un elemento que solamente puede ser aprehendido por una valoración […] Para la existencia del dolo con relación a un elemento normativo se requiere que el sujeto conozca el significado del concepto (“Bedeutungskenntnis”) (por ejemplo, el significado del concepto “apoderamiento ilegítimo” de una” cosa total o parcialmente ajena”, en el 208 Cod, Pen.).

Los elementos normativos o valorativos pueden ser de dos clases. Los llamados elementos normativos jurídicos son aquellos cuya significación solamente puede entenderse con referencia a una norma jurídica, que es exterior al Derecho Penal, y que establece relaciones jurídicas entre diferentes sujetos. Las relaciones jurídicas a que se refieren estos elementos del tipo se convierten en parte del tipo de injusto. Estos conceptos jurídicos a que se refieren los elementos normativos jurídicos son, por ejemplo, “matrimonio” (Arts. 176, 177, 118, cód. pen.), “adopción” (Art. 183 bis, 184 bis, cód. pen.), “menor” (Art. 184 cód. pen.), etc. Pero también hay elementos normativos con fórmulas valorativas generales, que son aquellos que requieren del sujeto una valoración de carácter general (cosmovisión). Tales son, por ejemplo, “deshonra” (Art. 143 cód. pen.), “dignidad o decoro” […] El dolo respecto a un elemento normativo del tipo supone que el autor haya entendido la valoración que el legislador incorporó en el concepto de que se trate (norma material) (valoración paralela a la esfera de un laico).

Para ello, no es necesario que el autor conozca el concepto en su dimensión jurídica, sino que basta que se represente a qué situación fáctica quiso el legislador extender la protección de la norma penal. Pero igualmente significa lo anterior que no es suficiente que el autor reconozca las circunstancias del hecho en su sustrato fáctico-empírico, sino que debe entenderlas en su contenido y significación social. Por ejemplo, el agente sabe, cuando desinfla las llantas de un auto, que este no puede ser utilizado. En este caso el autor no puede alegar su falta de dolo por su desconocimiento del concepto “daños”, argumentando que él pensaba que el delito de daños solamente podía cometerse cuando el efecto de la acción incidía sobre la sustancia de la cosa, pero no cuando el objeto de la acción incide, como en el caso del ejemplo, en su función social” (CASTILLO GONZÁLEZ, Francisco. Derecho Penal.

Parte General. San José, Editorial Jurídica Continental, Tomo I, 2008, pp. 586-587). Pues bien, enfocándonos en el caso de estudio, ha de indicarse que el tipo penal previsto en el inciso a) del artículo 58 de la Ley Forestal establece una sanción para quien: “Invada un área de conservación o protección, cualquiera que sea su categoría de manejo, u otras áreas de bosques o terrenos sometidos al régimen forestal, cualquiera que sea el área ocupada; independientemente de que se trate de terrenos privados del Estado u otros organismos de la Administración Pública o de terrenos de dominio particular […]”. Como puede verse, este tipo penal contiene un elemento normativo jurídico, como lo es que la acción desvalorada por el legislador (invasión) debe recaer sobre un área de conservación o protección. Lo anterior nos remite necesariamente a lo dispuesto por el inciso a) del artículo 33 de esta misma Ley Forestal, según el cual se consideran áreas de protección: “Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal”.

De lo anterior deriva que, para la configuración de la tipicidad subjetiva de este delito, como parte del elemento cognitivo del dolo, el agente necesariamente debe tener conocimiento no solo de que su acción implica invadir, esto es, irrumpir y ocupar en forma irregular una zona que sabe se encuentra dentro del radio de cien metros de distancia de una naciente, sino que además esta última es de naturaleza permanente. Naturalmente, para ello el agente ha de contar con la información suficiente como para prever y aceptar, al menos como posible, la producción de tal resultado. Pues bien, una vez examinados tanto el contenido del expediente como los fundamentos del fallo impugnado, este Tribunal de Apelación concluye que lleva razón el órgano de instancia en que el material probatorio incorporado al plenario no permite acreditar, con la certeza requerida por los artículos 39 y 41 de la Constitución Política y 9 del Código Procesal Penal, que el acusado [Nombre1] , al momento en que levantó la edificación objeto de la presente causa, tenía conocimiento, no solo de que el lugar donde realizaba los movimientos de tierra presuntamente estaría ubicado a menos de cien metros horizontales de distancia de una naciente, sino que además esta última tendría características de “permanente”.

En efecto, el primer argumento del órgano sentenciador para absolver al justiciable [Nombre1] , es que la prueba evacuada en juicio no demostró con certeza que este último tuviese conocimiento de que la edificación que estaba levantando, posiblemente se encontraba a menos de 100 metros de distancia de una naciente con tales características. Al respecto, el Tribunal de Juicio explicó lo siguiente: “[...] el primer problema al que nos enfrentamos -en el presente caso- lo ubicamos en la descripción típica que realizan, tanto Ministerio Público como Procuraduría, pues encontramos un serio problema en la imputación que, los hechos realizan ambos entes acusados. Analicemos primeramente la acusación fiscal, la cual en el punto numerado 1 describe la siguiente acción típica en el encartado “…a sabiendas que dicha finca se encontraba con una afectación registral consistente en la acercaría de una naciente de agua sobre la cual se prohíbe construir o modificar terreno a una distancia menor de 100 metros…”, de la prueba vertida en autos y ofrecida, tanto por la parte acusadora privada entiéndase Procuraduría General de la República así como el Ministerio Público, no existe elemento alguno en el que se pueda demostrar que el dolo del encartado [Nombre1] consistía en desobedecer la existencia de una afectación registral, ello es así en tanto la prueba documental, evacuada en la presente causa, da cuenta de la existencia de la finca Inscrita en el Registro Público al Folio Real Matrícula Número 118354-000, como se puede verificar al folio 68 y 69, en el que únicamente se menciona la existencia de una servidumbre trasladada con las citas 326-04671-01-902-001, inscripción que no tiene relación alguna con la supuesta anotación registral que se describe en la acusación fiscal, ello es así en el tanto no se aportó al debate una certificación literal de la propiedad, aquí relacionada, en que se confirme la existencia de dicha reserva inscrita en el Registro Público, tal y cómo se acusó.

Es deber del tribunal aplicar el principio de correlación entre acusación y sentencia, por lo que sería imposible para este juzgador tener por acreditada la acción dolosa, que el Ministerio Público le atribuye al encartado, sin el sustento probatorio documental, ni testimonial, que acredite la existencia de la restricción registral mencionada en la acusación. Eso por ello que, lo procedente en este caso es descartar la versión del Ministerio Fiscal por no existir prueba en ese sentido, respecto de la comisión dolosa de los hechos referida a la restricción registral de construir. Ahora bien, la Procuraduría General de la República en la querella de folio 101 se decantó, en el momento de la descripción de la conducta dolosa del tipo penal, en realizarla de manera más genérica que la acusación fiscal, indicando en el hecho segundo de la pieza acusatoria privada lo siguiente: “…El imputado [Nombre1] con conocimiento de la ilicitud de sus actos, procedió a invadir el área de protección de una naciente permanente, esto al realizar movimientos de tierra y construir, habilitar y detentar una estructura destinada a vivienda…”; con dicha descripción fáctica realizada por la Procuraduría lo primero que tiene que analizar el tribunal es la determinación de cómo el encartado tenía conocimiento de la ilicitud de sus actos; es decir, cómo sabía que la naciente de agua -que se ha mencionado en la presente causa- se encontraba a una distancia inferior a los cien metros del lugar de donde el encartado realizó la construcción.

La parte querellante nos propone, en sus conclusiones, que el conocimiento del hecho (elemento integrante del tipo penal) del encartado lo obtuvo de las palabras del señor denunciante Chavarría González, quien en su declaración indicó que cuando el encartado se acercó a narrarle su intención de construir una casa en el terreno que le pertenece, éste supuestamente le advirtió que debía solicitar todos los permisos porque cerca había una naciente de agua. Ahora bien, si esta manifestación del testigo fuese cierta habría una serie de imprecisiones que impedirían tener por acreditado el conocimiento del hecho que se retribuye al imputado. Se pregunta el tribunal ¿porqué (sic) le surge duda al Tribunal respecto de la existencia del conocimiento del hecho del encartado con lo mencionado por el testigo Chavarría González?, la respuesta es muy sencilla, el señor Chavarría González desconocía la distancia existente entre la futura construcción -puesto que no sabía exactamente en qué parte de la propiedad del ofendido se realizaría, en relación con la ubicación de la supuesta naciente de agua.

Pero además, el Tribunal se cuestiona la capacidad y legitimación que tiene el señor Chavarría González para realizarle algún tipo de advertencia al encartado. A mayor abundamiento, es importante determinar que, tal y como lo mencionaron varios testigos, particularmente el oficial del Organismo Investigación Judicial Calvo Alvarado, así como se hace constar en las fotografías aportadas por las partes, es imposible -colocado desde la propiedad del señor encartado- observar la naciente de agua y la quebrada que se encuentra en la propiedad del denunciante, es decir, carecemos de la certeza necesaria respecto de que el encartado actuara con el dolo requerido para la comisión del delito acusado y querellado, es decir, con el conocimiento absoluto de que estaba realizando una construcción que invadía la zona de protección de una naciente de agua permanente; esto lo inferimos no solo porque es imposible observar la existencia de esa naciente de agua permanente ni de la quebrada, sino que, más aún, es imposible determinar la distancia -entre un punto y otro- sin que se realicen las medias correspondientes con los dispositivos tecnológicos especializados.

En el caso en estudio las medidas fueron realizadas con instrumentos de precisión utilizados por el testigo [Nombre5] , funcionario del Laboratorio de Ciencias Forenses del Poder Judicial, en el cual se logró determinar la distancia entre la construcción y la supuesta naciente de agua. Es decir, el conocimiento oficial que se tiene de la distancia existente entre el Ojo de Agua y la construcción del encartado, se obtiene cuando ya la construcción había finalizado. La Procuraduría General de la República, respeto de este punto en específico, ha querido demostrar el dolo el encartado no solo porque el testigo Chavarría González ya había mencionado la existencia de la naciente de agua, sino también apelando a la cantidad de años que tenía el encartado de habitar en ese lugar, lo que nos permite concluir -insiste la señora procuradora- que el encartado conocía la existencia de esa naciente de agua.

Sin embargo, en materia de imputación penal, no podemos suponer, así como tampoco podemos tampoco realizar un razonamiento lógico, como el que pretende imponer la Procuraduría General de la República, consistente en tener como hecho probado que el encartado conocía del hecho que realizaba puesto que no solicito los permisos municipales de respectivos para la construcción de la vivienda aquí relacionada. Acoger este razonamiento es improcedente, puesto que el mismo resulta ser una afirmación falaz, en el tanto no puede el Tribunal acreditar como un indicio unívoco que la falta de trámites de construcción, que debía realizar en la Municipalidad de Alajuela, tenga relación directa con la construcción dentro de la zona de protección de la supuesta naciente de agua. Esto se debe a que, la decisión que tuvo el encartado para realizar una construcción sin permisos puede tener más de una explicación, siendo este un indicio anfibológico […] El testigo Chavarría González, denunciante en la presente causa, es la persona que indica, cómo lo mencionáramos anteriormente, que el señor encartado tenía conocimiento del hecho y de la ilicitud de su actuar y que realizó dicha acción de manera dolosa, embargo su versión choca de frente con los elementos probatorios vertidos por el tribunal, uno de ellos -de medular importancia- referido a la fecha de la comisión de los hechos delictivos, recordemos que el testigo declaró en el debate que el encartado inició la construcción pocos día después de que se había presentado a la oficina del denunciante, siendo que en dicha reunión le indicó iba hacer una construcción en el lugar y que esta fecha es acorde a la fecha en que se llevó acabo el mundial de fútbol y Brasil 2014 cuyas fechas son del 12 de junio de 2014 al 13 de julio de 2014, sin embargo, la denuncia se interpone en el mes de setiembre de 2014, es decir, varios meses después de finalizado el mundial de futbol, con lo que tampoco se tiene certeza de cuando iniciaron los actos que generaron los daños en la naciente, es decir, existe una imprecisión de hasta dos meses entre ambas fechas.

El testigo [Nombre5] únicamente da cuenta de las medidas realizadas en el expediente en el lugar de los hechos mediante un GPS, donde informa de la distancia existente entre los puntos a los que le hicieron referencia, pero este testigo únicamente realiza las medidas de punto a punto que le fue indicado por la parte denunciante. En tanto el señor [Nombre6] , nos menciona como punto de interés la imposibilidad absoluta de observa la naciente de agua y mucho menos la quebrada que hay en la propiedad del denunciante, esto por la cantidad de maleza, la existencia de una malla y la ladera en la que se encuentra ese terreno. Finalmente la testigo [Nombre7] , perito que realizó la valoración del daño ambiental no logró recordar detalle alguno del peritaje firmado por ella […]”. El Ministerio Público no presentó recurso de apelación, de manera que esta Cámara se concentrará en los reclamos planteados por la representación de la Procuraduría General de la República.

Y lo primero que debe indicarse, es que de acuerdo con la forma en que estructuró la imputación en su querella, expresamente le atribuyó al señor [Nombre1] el conocimiento de la “ilicitud de sus actos”, esto es, el conocimiento de que estaba construyendo dentro de radio de cien metros de una naciente permanente (zona de protección). Partiendo de lo anterior, este Tribunal de Apelación encuentra que la recurrente sesga y tergiversa la argumentación del órgano sentenciador. Ciertamente el principio de libertad probatoria, previsto en el artículo 182 del Código Procesal Penal, admite que los hechos y circunstancias relevantes para la solución de un caso, puedan ser demostrados a través de cualquier elemento de prueba válidamente incorporada al proceso. Sin embargo, esto no significa que el Tribunal de Juicio esté exento de practicar, a esos mismos elementos probatorios, un examen crítico y riguroso, para determinar si de ellos puede obtenerse información de calidad que permita demostrar hechos o circunstancias relevantes para tomar su decisión.

Dicho de otra manera, no basta con que el elemento de prueba sea válido en sí mismo, sino que además debe aportar suficientes datos como para que el Tribunal pueda formarse un juicio de certeza. El problema que se presenta en el caso sub examine, es que el único elemento de prueba con que la recurrente pretendería demostrar el dolo del señor [Nombre1] , lo es el testimonio del señor Chavarría González, pero este no proporcionó la información necesaria y de calidad como para acreditar, con seguridad, que el querellado sabía dónde estaba ubicada exactamente la naciente, y que esta era permanente y –más importante aún- que realizó los movimientos de tierra conociendo que se encontraba a menos de cien metros de distancia. Tal como lo señala el juzgador a quo, revisada la síntesis que se plasma en sentencia de la declaración rendida por Edwin Chavarría González, con respecto a la conversación que sostuvo con el imputado, manifestó lo siguiente: “[…] El señor don [Nombre1] me visitó a mi oficina, y me dijo que iba a hacer un movimiento de tierra y que me quería avisar.

Porque el señor tiene más años de habitar en el lugar que yo. La problemática es que dónde se iba a hacer el movimiento de tierra el terreno es una pendiente, el problema es que se iba a aterrar una tubería que se iba a dañar una naciente que había en el lugar. Pero me dijo que no era de momento que iba a hacer esos movimientos. Me dijo que no me preocupara por los permisos de construcción, también le advertí que la zona de era de protección. La sorpresa es que él fue miércoles o jueves a la oficina y la semana siguiente me avisaron que había un movimiento de tierras. Cuando yo llegué al lugar ya se había hecho el movimiento de tierras y la habían puesto en la vía pública, y la tubería de la calle estaba totalmente invadida, lo que separa mi propiedad de la del encartado es una calle de 8 metros. Con el movimiento de tierra se tapó toda la alcantarilla, así se fue el agua por mi terreno y se dieron daños en la naciente que precisamente está en línea recta con la construcción […] La propiedad se encuentra delimitada con cerca de alambre y un portón.

El encartado si tenía conocimiento de esa naciente. El señor imputado conocía mi finca, porque yo fui el que llegó después a la zona en cuestión. Cuando yo llegué en el año 1997, tuve que construir una tubería para que las aguas no afectaran la naciente. Estaba terminando el mundial del 2014, propiamente en julio de ese año cuando me entero de estos hechos. Yo le advertí al encartado que con la construcción se podría afectar la naciente de agua. Mi propiedad mide casi 11.000 metros. Dentro de mi propiedad no hay otra naciente de agua. Mi propiedad no colinda con la propiedad de don [Nombre1]. Sé que hay otras nacientes de agua en propiedades cercanas a la mía. Tengo una concesión de parte del MINAE de esta naciente, se tiene que estar renovando cada 10 años; se renovó en el 2002 y se volvió a renovar en el 2012. Después de realizada esta labor ya no conversé más con el señor encartado. El daño que se causó con esta construcción fue erosión”.

Pues bien, al examinar la argumentación del fallo, esta Cámara encontró que, contrariamente a lo afirmado en el recurso, el juzgador partió de que esta conversación entre Chavarría González y [Nombre1] ciertamente existió, pero sostuvo que una serie de imprecisiones en lo dicho por el denunciante, impedían concluir que el querellado tuvo conocimiento cierto de la ubicación de la naciente. En efecto, tal como señala el órgano de instancia, las referencias que el señor Chavarría González brindó al encartado fueron meramente genéricas, esto es, le habló de una naciente, pero no le facilitó más información al respecto. Dicho de otro modo, de su testimonio no se desprende que el señor Chavarría González indicó al imputado exactamente dónde estaba la naciente, de la misma forma que el denunciante tampoco sabía en qué parte del terreno del señor [Nombre1] , que no era colindante al suyo, se iba a realizar la construcción, de manera que el querellado pudiere ser informado que estaba a menos de 100 metros de una naciente.

No fue sino hasta que se realizaron los respectivos estudios de ambas fincas por parte de [Nombre3] , funcionario del Sistema Nacional de Áreas de Conservación, así como el dictamen DCF: 2015-00521-ING de la Sección de Ingeniería Forense, con posterioridad a la construcción de la obra por parte del señor [Nombre1] , que se logró determinar que dicha edificación se encontraba dentro del radio de los 100 metros de distancia del brote de agua. De ahí entonces que la declaración del señor Chavarría González nunca tuvo la supuesta contundencia que la apelante pretende endosarle. Además, analizado el razonamiento del órgano sentenciador, se aprecia que no es cierto lo afirmado en el recurso de que el Tribunal a quo absolvió al imputado supuestamente porque en la relación de hechos de querella no aparecía descrita la conversación entre Chavarría González y [Nombre1] ; tampoco es cierto que el órgano de instancia, aplicando criterios de prueba tasada, exigía que el dolo se probara a través de prueba técnica.

Básicamente, el argumento del Tribunal de Juicio consiste en sostener que la prueba no demostró que [Nombre1] sabía en dónde se ubicaba la naciente de agua, de manera que los movimientos de tierra podrían afectarla, conclusión que a criterio de esta Cámara se ajusta al mérito de las pruebas. Asimismo, un aspecto transcendental para la solución de este caso, es determinar si el querellado, por sus propios medios, tuvo la posibilidad de verificar si realmente existía la naciente de la que le habló el señor Chavarría González, así como la distancia a la que se encontraba del lugar donde proyectaba levantar la edificación. Y aquí es donde cobra gran importancia la argumentación de la propia recurrente, quien sostiene que no hay norma expresa que establezca que para demostrar el conocimiento de la existencia y las limitaciones que imponen los cuerpos de aguas protegidos por la Ley Forestal No. 7575, especialmente en su numeral 33, se requiere que exista una anotación de tipo registral en las propiedades a las que afecta o que deba emitirse una notificación o documento técnico u oficial que haga del conocimiento general la existencia de dichos cuerpos de agua, señalando expresamente en su recurso que basta con que el imputado haya tenido a su vista el brote de agua para que se tenga al interesado como conocedor del mismo.

Pues bien, como ampliamente se explica en el fallo impugnado, independientemente de si la legislación prevé la necesidad de que la existencia de esta clase de brotes de agua se consigne vía anotación registral, en lo que respecta a la acusación formulada por el Ministerio Público, el problema radica en que ahí se atribuyó al señor [Nombre1] el dolo justamente a través del conocimiento de una anotación registral, cuya existencia nunca fue demostrada. De ahí entonces que la hipótesis acusatoria del órgano fiscal necesariamente debía ser rechazada. Y en lo que respecta a la querella formulada por la Procuraduría General de la República, atendiendo a los argumentos del órgano de instancia, este Tribunal de Apelación revisó el acta de Inspección Ocular No. 1538-2017, levantada por oficiales de la Delegación Regional de Organismo de Investigación Judicial de Alajuela, donde se consigna lo siguiente: “Trata de un sitio del suceso abierto, ya que abarca tanto la zona externa del costado norte de la vivienda de la ofendida, así como la vía pública que le prosigue y bordea la propiedad en dicho sector y también en su costado oeste, para posteriormente ubicar una zona sumamente extensa y en plano de sustentación descendente, tipo ladera, situada hacia el costado norte de la carretera que se direcciona de este a oeste y viceversa, la cual se protege mediante malla tipo galvanizada, contando con un portón de acceso vehicular diagonal a la casa dela testigo de actuación, esto a más de diez metros de distancia, en donde se observa una gran cantidad de vegetación sumamente tupida y una pequeña calle de tierra que nace del portón hacia el nor-oeste, la cual lleva hacia el interior de la propiedad, y culmina según vecinos de la comunidad cerca del río, no obstante por el tipo de vegetación desde la zona externa y con mayor razón desde la propiedad del imputado, no se logra apreciar ningún tipo de naciente, río, riachuelo, brote o acumulación de agua, tampoco a nivel interno o externo se observa algún tipo de rotulación o señalamiento que haga saber sobre la existencia de dicha naciente o algo similar, por lo cual es imposible detectarlo con solo pasar por el lugar u observar desde el exterior de la propiedad privada, que dicho sea de paso se encuentra completamente cerrada, impidiendo el acceso a terceros […]” (folio 192).

Lo anterior fue ratificado en juicio por el investigador Andrés Calvo Alvarado, quien depuso lo siguiente: “Al llegar al sitio era una vía pública, a uno de los costados estaba la vivienda de uno de los imputados, al otro lado de la vía pública había una zona privada, protegida con malla galvanizada en todo su perímetro. Contaba con gran vegetación, tenía un portón vehicular, donde tenía un ingreso hacia la parte interna de la propiedad privada, la misma es un tipo ladera descendiente, desde a parte externa, vía pública, no se logró observar ningún tipo de naciente, río o cuestión similar. Por parte de vecinos, se dijo que al parecer si había naciente pero no pudo ser corroborado por nuestra parte y desde la vía pública no se logró ver. No se logró observar rotulación sobre existencia de naciente”. Esta prueba refuta abiertamente la argumentación de la recurrente, pues demuestra que desde las afueras de la finca privada del señor Chavarría González, misma que se encontraba totalmente cercada y cerrada, resultaba materialmente imposible observar el brote de agua objeto de la presente causa, lo que da sustento probatorio a la conclusión del órgano sentenciador respecto a que el señor [Nombre1] no tenía forma de corroborar, en primer lugar, si esta naciente existía.

Y, en segundo lugar, tampoco tenía forma de determinar qué distancia habría en dicho brote de agua y la construcción que estaba levantando, elemento fundamental para la configuración del dolo requerido por el artículo 58 de la Ley Forestal, sin que la referencias -meramente genéricas- que le hizo el testigo Chavarría González, por sí solas bastasen para suplir toda esa información requerida para la configuración de la tipicidad subjetiva del delito, como erróneamente pretende quien recurre. Por último, se estima que lleva razón el Tribunal de Juicio cuando sostiene que del hecho que [Nombre1] tuviese muchos años de residir en ese sector, no se podría derivar como conclusión irrefutable que éste “tendría” que saber que en el fundo del señor Chavarría González había una naciente. Recuérdese que tal como señala la doctrina, el conocimiento requerido para el dolo es actual o actualizable, no un conocimiento que el agente simplemente “debería” tener.

En ese tanto, el argumento de la recurrente, según el cual dada la cantidad de años que tenía el imputado de vivir “debería” conocer la existencia de esa naciente, parte de una mera suposición indemostrable, pues como se explica en el fallo, desde la propiedad del señor [Nombre1] no era posible observar la existencia de la naciente de agua permanente ni de la quebrada, sino que además era imposible determinar la distancia entre un punto y otro, sin que se realizaran las respectivas medidas mediante la utilización de dispositivos tecnológico especializados (v. gr. aparatos de medición topográfica, GPS, etc.), estudios que se realizaron con posterioridad a los hechos acusados. En consecuencia, lleva razón el órgano de instancia en que la prueba llevada al plenario no permitía demostrar que [Nombre1] actuó con dolo, esto es, sabiendo que levantaba una edificación a menos de cien metros horizontales de distancia de una naciente permanente.

Y esta ausencia de dolo, por sí sola, justifica la absolutoria penal de [Nombre1] . Por otra parte, del análisis de los restantes argumentos del fallo, se desprende que sí lleva razón la recurrente en que los fundamentos del Tribunal de Juicio para justificar la supuesta duda respecto a la identidad de la naciente objeto de la presente causa, o su condición de “permanente”, son omisos e inconsistentes, toda vez que con respecto a ambos temas el juzgador se apoyó casi que exclusivamente en las copias certificadas del expediente administrativo 8052 de la Dirección de Agua del Ministerio de Ambiente y Energía, soslayando prácticamente en su totalidad el resto del material probatorio A criterio de esta Cámara, independientemente de la identificación que se hace en dicho expediente de la naciente que ahí aparece concesionada a Valles de Agua S.A., se estima que el órgano juzgador debió analizar de forma conjunta, armónica y crítica la información consignada en el Oficio SINAC-ACCVC-0A-1783-204, el Acta de Inspección Ocular Oficio PA-1820, el mapa de ubicación georeferencial del sitio del suceso, el dictamen DCF: 2015-000521-ING, el oficio OA-1955-2015 referente a la Valoración del Daño Ambiental y las declaraciones de Edwin Chavarría González y [Nombre3] , no sólo con respecto a la identidad y ubicación de la naciente cuya área de protección habría sido presuntamente invadida por parte del querellado, sino también con respecto a su naturaleza, de manera que el órgano sentenciador pudiera explicar por qué, aún con la información que consta en estas pruebas documentales, periciales y testimoniales, igualmente cabría cuestionarse tanto la identificación del brote de agua como su condición de “permanencia”, fundamentación que no existe en el fallo.

Incluso, el propio Tribunal, como uno de los argumentos para descartar el dolo- admite que se realizaron medidas con instrumentos de precisión por parte del perito [Nombre5] , funcionario del Laboratorio de Ciencias Forenses del Poder Judicial, en el cual se logró determinar la distancia entre la construcción y la supuesta naciente de agua, lo que no es congruente con sus cuestionamientos acerca de la existencia misma e identidad de dicha naciente. Ahora bien, sin perjuicio de las anteriores consideraciones, que sí podrían tener incidencia en una eventual responsabilidad civil del señor [Nombre1] (tema que será tratado en el considerando siguiente), igualmente cabe recordar que todos estos estudios técnicos se realizaron con posterioridad a que el imputado levantara su edificación, de manera que no podrían utilizarse para demostrar que, al momento en que el señor [Nombre1] estaba realizando la construcción, tuvo ese conocimiento técnico sobre la identidad, ubicación y naturaleza de la referida naciente de agua. Es decir, no podrían constituir pruebas de que actuó con dolo. Por todo lo expuesto, se declara sin lugar el motivo.

III.Como segundo motivo del recurso, se reclama insuficiente fundamentación e inobservancia de las reglas de la sana crítica con respecto a medios probatorios de valor esencial. El apelante reitera los mismos argumentos expuestos en el considerando anterior, alegando que, habiéndose comprobado no sólo la existencia de la naciente y su carácter permanente, así como que el encartado construyó la casa dentro del radio del área de protección de la naciente, hechos que son atribuibles al señor [Nombre8] (nexo causal), lo procedente era resarcir al Estado por el daño ambiental derivado de este ilícito, el cual se comprueba mediante el oficio No. OA-1955-2015, al que se le anexa Informe de Valoración de Daño Ambiental, en el cual se consigna la magnitud y cuantía del daño causado por el accionar delictivo del señor [Nombre1] , el cual fue ponderado por el MINAR en la suma de ₵ 1.177.884,oo. Solicita se revoque el fallo en cuanto declaró sin lugar la acción civil resarcitoria interpuesta por la Procuraduría General de la República y se ordene su reenvío para nueva sustanciación.

Como tercer motivo del recurso, se reclama falta de fundamentación por omisión en cuanto a la orden de restitución de las cosas al estado anterior para la zona de protección de la naciente afectada. Reclama que pese a que existió solicitud expresa del apelante, el Tribunal de Juicio no dispuso ni ordenó nada en relación al sitio afectado y su restauración al estado original, mediante la eliminación de la obre construida por el imputado para que permita la regeneración del mismo, para lo cual reitera su argumentación respecto a que la prueba documental y testimonial demuestra no sólo la existencia y condiciones del brote de agua afectado, sino también la construcción levantada por el imputado. Solicita se revoque el fallo y se ordene su reenvío para nueva sustanciación. Por contener reclamos conexos, ambos motivos se conocen en un mismo considerando, declarándolos, en lo que se dirá, con lugar.

En el fallo impugnado, prácticamente el único argumento esgrimido por el órgano sentenciador para declarar sin lugar la acción civil resarcitoria interpuesta por la Procuraduría General de la República, fue que no se logró demostrar que el imputado [Nombre1] actuó con dolo. Sin embargo, la jurisprudencia nacional ha sostenido, reiteradamente, que si por motivos “puramente penales” se absuelve al imputado (v. gr. porque la conducta no es típica, antijurídica o culpable), su responsabilidad civil podría subsistir siempre y cuando se demuestre la existencia de un daño y se cumpla la exigencia de que haya una fuente normativa distinta del ordenamiento penal que permita tal cosa. En otras palabras, la exclusión del injusto penal no necesariamente impide que pueda acogerse la acción civil resarcitoria, siempre que pueda demostrarse un hecho generador de daños cuya responsabilidad, desde el punto de vista de la legislación civil, pueda atribuirse al demandado, surgiendo así la obligación de resarcir.

Precisamente sobre este mismo tema, la Sala Tercera de la Corte Suprema de Justicia se pronunció argumentando que: “El derecho a la reparación del daño causado por el delito no es accesorio de aquel, sino que es independiente e igualmente importante, pues no depende de que se declare la responsabilidad penal del sujeto, sino que es perfectamente viable que ante una absolutoria penal, como la que aquí se decide, subsista la responsabilidad civil (artículos 40 y 368 CPP). La sentencia absolutoria no implica automáticamente, ni autoriza al Tribunal para omitir el análisis y pronunciamiento respecto de la responsabilidad civil, aspecto señalado reiteradamente en diversas resoluciones de esta Sala (cfr. fallo número 101-F, de 11:00 horas del 8 de octubre de 1982; 241-F de 10:45 horas del 2 de octubre de 1986). En el sentido anterior: “... esta Sala ya ha admitido como posible el que se declare con lugar una acción civil resarcitoria aún cuando ni siquiera se configure un injusto penal.

Por ejemplo, en la sentencia N° 565-F-94 de las 16:15 horas del 12 de diciembre de 1994, se dijo lo siguiente: "Si bien en sede penal normalmente la responsabilidad civil es impuesta por la constatación al menos de una conducta injusta (es decir, típica y antijurídica), en los términos del artículo 103 del Código Penal (así, las resoluciones 496-F de las 11:30 del 23 de octubre de 1992 y 52-F de las 9:45 del 29 de enero de 1993), nada se opone a que esa condena civil sea impuesta también cuando la responsabilidad pueda surgir de otra fuente normativa, de la cual derive la obligación de indemnizar, posibilidad que expresamente prevee nuestra legislación en los artículos 11 y 398 del Código de Procedimientos Penales." Así las cosas, es perfectamente viable el que sin un injusto penal, proceda la condena por responsabilidad civil, siempre que se cumpla con la exigencia de que haya otra fuente normativa distinta del ordenamiento penal que permita tal cosa.

En el caso en examen se está frente a un hecho en el que la conducta típica de uno de los presuntos autores ha sido descartada por el tribunal de mérito. Ello significa que no hay injusto penal. Por ende, sólo queda el dilucidar si hay un régimen de responsabilidad aplicable en este asunto, de forma tal que sea factible condenar civilmente...”. (Sala Tercera de la Corte Suprema de Justicia, resolución número 2000-00619, de 11:20 horas del 9 de junio de 2000). Más recientemente, esta Sala se ha pronunciado con respecto al carácter accesorio de la acción civil, así como también la obligación del Juzgador de pronunciarse sobre la misma y los criterios de imputación: “El principio de accesoriedad de la acción civil en relación con la acción penal implica una dependencia de carácter formal y no sustantiva, es decir, se requiere de la existencia de la segunda para que deba resolverse el problema de restitución o reparación civil.

Una vez que se ha celebrado el juicio oral y público el principio de accesoriedad desaparece, pues las partes han tenido oportunidad de discutir sobre los hechos de la demanda, presentar las pruebas y formular los argumentos jurídicos que sustentan sus pretensiones. Además, debe tomarse en cuenta que no siempre la solución del problema penal coincide con el civil. Esto es así porque mientras en la acción penal se discute si estamos o no ante de una acción, típica, antijurídica y culpable, en lo civil lo importante es determinar, de oficio, la presencia de los presupuestos materiales, a saber: a) El derecho: lo que implica demostrar la existencia de un daño, moral o patrimonial; una relación de causalidad entre el evento y el daño y, finalmente, un criterio de imputación civil: subjetivo (dolo o culpa: art. 1045 del Código Civil), o de responsabilidad objetiva (riesgo creado: art. 1048.5 del Código Civil; de protección al consumidor de productos o servicios: art. 35 de la Ley 7472; de responsabilidad de la Administración: arts. 190 y ss. de la Ley General de la Administración Pública, entre otros, o incluso que al final de juicio se demuestre que lo que se ha producido es un incumplimiento contractual, lo que también debe ser resuelto por los jueces de juicio en sentencia. b) La legitimación activa y pasiva y c) El interés actual.

De tal forma que en nuestro medio no es válido sostener que por haberse absuelto en lo penal, la misma suerte corre la demanda civil, tema que ha sido ampliamente tratado por la jurisprudencia de la Sala Tercera de la Corte Suprema de Justicia y por los Tribunales de Casación (hoy de Apelación de Sentencia Penal). Los criterios para resolver el conflicto penal y el civil son diversos y sólo hay alguna coincidencia cuando en la acción civil se discute la aplicación de una responsabilidad fundada en imputación subjetiva: dolo y culpa. […] Es obligación del Tribunal de Juicio entrar a valorar si están o no presentes los citados presupuestos civiles materiales, para decidir lo que corresponda, sin que sea suficiente afirmar que existe una dependencia de la acción civil de la penal. Incluso, en el caso que se llegara a estimar que hay un incumplimiento contractual, también es un deber del Tribunal resolver lo que corresponda sobre la reparación que se pide.” (Resolución 902-2012, de las 14:05 horas, del 10 mayo de 2012).

Es factible que se pretenda la reparación mediante demanda en la sede civil, lo cual es una de las posibilidades que otorga el ordenamiento jurídico a los ciudadanos, como escogencia de la vía en estos casos. Lo anterior se deriva del artículo 103 del Código Penal relacionado con el 109 del mismo texto normativo, pues de ellos se extrae que son las normas civiles de responsabilidad las que se aplican a las obligaciones de reparación civil. Como se aprecia con facilidad, esa accesoriedad dispuesta en el artículo 40 del Código Procesal Penal está referida única y exclusivamente a la necesidad de que exista un proceso penal para que la acción civil pueda incoarse en dicha sede, mas en ningún momento se establece una relación de dependencia del derecho a la reparación (ni de la obligación de reparar) respecto de la persecución del delito. La responsabilidad civil es independiente de la comisión de un ilícito, por cuanto la frase “cuando proceda”, contenida en el párrafo tercero del artículo 40 del Código Procesal Penal debe necesariamente interpretarse en el sentido de que, a pesar de la absolutoria penal, el tribunal puede pronunciarse sobre la acción civil cuando subsistan otros supuestos normativos distintos al delito en los cuales pueda sustentarse ese deber de indemnizar.

Es decir, cuando los hechos acreditados sean suficientes para demostrar la existencia de responsabilidad civil, sin necesidad de que la norma sustantiva que genera la obligación de indemnizar el daño proceda del Derecho Penal, y sin necesidad de que se demuestre la responsabilidad penal. La anterior interpretación es la única posible a derivar de los principios de Economía Procesal e Interpretación Restrictiva (artículo 2 CPP), en consonancia con nuestro ordenamiento constitucional (artículo 41), con el único requisito de que debe concederse al demandado oportunidad de defensa. (Voto No. 2013-1842 de las 17:03 horas del 3 de diciembre de 2013). Con fundamento en lo anterior, el hecho de que el señor [Nombre1] actuase sin el dolo requerido por el artículo 58 de la Ley Forestal y que esto lo exime de responsabilidad penal, por sí solo no descarta la posibilidad de que su conducta, eventualmente, hubiese causado un perjuicio al medio ambiente que fuere cuantificable, tema que debió ser objeto de análisis por parte del órgano de instancia, que omitió por completo referirse a este extremo.

Asimismo, aun cuando en este acápite de la sentencia se agrega que, adicionalmente, subsistía una duda respecto a la identidad de la naciente de agua, tal como se indicó en el considerando anterior, dicha duda no se encuentra suficientemente fundamentada, pues se echó de menos un análisis crítico de la información consignada en el Oficio SINAC-ACCVC-0A-1783-204, el Acta de Inspección Ocular Oficio PA-1820, el mapa de ubicación georeferencial del sitio del suceso, el dictamen DCF: 2015-000521-ING, el oficio OA-1955-2015 referente a la Valoración del Daño Ambiental y las declaraciones de Edwin Chavarría González y [Nombre3] . Y sucede que la correcta identificación de la naciente objeto de la presente causa y la determinación de su condición, son temas que también podrían tener incidencia en una eventual responsabilidad civil por parte del demandado [Nombre1] . Asimismo, se observa en sentencia que tampoco existió pronunciamiento alguno con respecto a lo establecido por los artículos 103 del Código Penal, 122 y 123 de las Reglas Vigentes de Responsabilidad Civil del Código Penal, 140 y 466 del Código Procesal Penal, 1, 33 y 58 inciso a) de la Ley Forestal y 99 inciso h) de la Ley del Ambiente, con respecto a si resultaba procedente la restitución de las cosas al estado anterior, esto es, si era procedente ordenar el derribo de la obra construida por el imputado [Nombre1] .

Por lo expuesto, este Tribunal de Apelación concluye que, en cuanto a estos extremos, el fallo incumple con los deberes de fundamentación que establecen los artículos 142, 184, 361 y 363 del Código Procesal Penal. Esta Cámara quiere dejar muy claro que, con lo resuelto, en modo alguno está emitiendo criterio con respecto a la credibilidad de las pruebas ofrecidas por las partes y/o la forma en que deba resolverse el caso de estudio, sino únicamente que la sentencia carece de una adecuada fundamentación respecto a los extremos civiles. Por todo lo expuesto, se declaran con lugar los motivos segundo y tercero del recurso de apelación de sentencia interpuesto por la representante de la Procuraduría General de la República. Se anula parcialmente el fallo impugnado, únicamente en cuanto declara sin lugar la acción civil resarcitoria interpuesta por la Procuraduría General de la República en contra del demandado [Nombre1] .

Se ordena el reenvío al Tribunal de origen para nueva sustanciación de juicio, únicamente con respecto a los extremos civiles y a la solicitud de derribo de la obra levantada por el demandado civil, para lo cual se deberá tomar nota de lo expuesto en los considerandos segundo y tercero de la presente resolución. En lo restante el fallo impugnado se mantiene incólume.

POR TANTO:

Se declara sin lugar el recurso de apelación de sentencia interpuesto por el defensor particular de [Nombre1] . Se declara sin lugar el primer motivo del recurso de apelación de sentencia interpuesto por la representante de la Procuraduría General de la República. Se declaran con lugar los motivos segundo y tercero de su recurso. Se anula parcialmente el fallo impugnado, únicamente en cuanto declaró sin lugar la acción civil resarcitoria interpuesta por la Procuraduría General de la República en contra del demandado civil [Nombre1] . Se ordena el reenvío al Tribunal de origen para nueva sustanciación de juicio, únicamente con respecto a los extremos civiles y a la solicitud de derribo de la obra levantada por el demandado civil, para lo cual se deberá tomar nota de lo expuesto en los considerandos segundo y tercero de la presente resolución. En lo restante, el fallo impugnado se mantiene incólume.
