The parties are duly notified by the oral delivery of the judgment (Arguments and Submissions duly recorded in [Nombre9] Audio Video and available to the parties).” (sic).* * * 2.- Attorney Marvin Villalobos Badía, representative of the Public Prosecutor’s Office, filed an appeal against the foregoing ruling.* * 3.- After the corresponding deliberation was conducted in accordance with the Code of Criminal Procedure, the Court considered the issues raised in the appeal.* * 4.- The applicable legal requirements have been observed in the proceedings.* Judge Cynthia* Dumani Stradtmann drafts the opinion; and, * WHEREAS* * I.- ADMISSIBILITY OF THE APPEAL.

The appeal was timely filed by Attorney Marvin Villalobos Badía, representative of the Public Prosecutor’s Office, at 07:20 on 11 de diciembre de 2020 (page 56), within the statutory time limit and in accordance with the requirements necessary for the challenge (impugnación) to permit proper consideration of the objections raised, with a view to a comprehensive review of the challenged judgment, as established by Article 8.2(h) of the American Convention on Human Rights and Articles 458, 459, 460, and 462 of the Code of Criminal Procedure. In this regard, this Chamber finds that the Liberia Flagrancy Court delivered judgment number 459-2019 orally and in full at 10:20 on 20 de noviembre de 2019; therefore, the period for filing an appeal expired on 11 de diciembre de 2019. Accordingly, the appeal is admissible.* * *

II.The prosecution’s appeal is based on a single ground. It alleges an incorrect interpretation of the statutory offense (tipo penal) and contradictory reasoning. It states that the judgment acquitted defendants [Nombre1], [Nombre4], and [Nombre7] on the basis of reasonable doubt of the offense of illegal transportation of timber. It asserts that the factual allegations are very straightforward, since the accused were charged with transporting logs of the cocobolo species without the pertinent permits or documentation. Nevertheless, the trial court had doubts regarding the defendants’ conduct. It argues that the offense of transportation of timber was incorrectly interpreted as requiring proof of whether the timber came from a plantation or a forest. It maintains that the origin of the timber must be established for an offense such as timber theft, but not for transportation. It adds that the Court gave no weight to the alert received late at night concerning individuals who were transporting timber without the pertinent documents.

It further states that the officer’s experience was improperly disregarded, as he recognized the timber as belonging to the cocobolo species despite not being a forestry expert. It contends that the duty to provide reasons (deber de motivación) was violated and requests that the judgment be declared invalid and that a new judgment be issued.- The ground is upheld. The accused were charged as follows: “On 27/03/2019, at approximately one forty in the morning, in Guanacaste, Bagaces, [Dirección1], defendants [Nombre4], [Nombre7], AND [Nombre1] acquired and transported 13 pieces of timber of the cocobolo species without the pertinent permits or documentation, aboard the vehicle bearing license plates [Placa2].” (Trial record of 20 de noviembre de 2019, page 52). The trial court found that the objective elements of the offense (elementos objetivos del tipo) established in Article 56, in relation to Articles 61 and 63 of the Ley Forestal, had not been satisfied (sequence 25:39 to 26:00).

The charge in the present case, however, concerns the transportation of logs of the cocobolo species without the pertinent permits. The court acquitted the accused on the basis of reasonable doubt, principally because it believed that the species of the logs had to be verified as Cocobolo, as did the specific place from which the timber originated; it therefore ordered the return not only of the truck involved but also of the 13 logs (08:42, sequence 27:05). The prosecution’s claim, in turn, specifically concerns the judgment’s insufficient reasoning resulting from an incorrect interpretation of the requirements of the statutory offense involved. In this regard, this Chamber finds the claim well founded. Without prejudging the matter, the provisions applicable to the present case, based on the facts described in the charging instrument (acusación), which correspond to the description of the offense of illegal transportation of timber, are Articles 56 and 63 of Ley Forestal number 7575.

In this regard, the first provides: “ARTICLE 56.- Transportation of timber.* Timber in log, squared, or sawn form originating from a forest or plantation may not be transported without the corresponding documentation.” This provision clearly states that all transportation of timber, regardless of where it comes from (forest or plantation) or its form (sawn, in logs, or squared), requires the corresponding documentation. The second provision establishes the penalty for failing to carry the corresponding documentation: “ARTICLE 63.- Imprisonment from one month to one year. A term of imprisonment from one month to one year shall be imposed on anyone who: a) Violates the provisions of Article 56 of this Law.” This documentation consists of the timber transport permit (guía de transporte de madera) and its certificate of origin (certificado de origen), which are governed by Articles 104 through 109 of the Regulations to the Ley Forestal, number 2923-A.

Likewise, Article 115 of those Regulations establishes all forms of timber considered to be forest products (productos forestales) and requiring a certificate of origin and transport permit. In addition to the foregoing, it should be noted that, although “cocobola” (cocobolo, as Officer Jorge Eduardo López called it)* is subject to additional restrictions established in Article 115 of the aforementioned Regulations, the general statutory offense of transportation of timber (Article 56 of the Ley Forestal) does not require identification of the type of timber in order for the offense to be established. In other words, in the present matter, the description in the charging instrument shows that the accused were charged with transporting timber without the corresponding permits, not with transporting timber obtained by theft from private or State property, as provided in Article 61, which the adjudicating judge confused with the offense at issue.

In pertinent part, that provision states:* “ARTICLE 61.- Imprisonment from one month to three years. A term of imprisonment from one month to three years shall be imposed on anyone who: (…) d) Removes forest products from private or State property or transports forest products obtained in the same manner.” It is also apparent that, in questioning the species of the logs, the court omitted important documentary evidence (prueba documental) from its analysis, since the visual-inspection record (acta de inspección ocular) (page 41) and the report of the Minae official (pages 42 and 43) establish that the logs were of the species “cocobolo (Dalbergia retusa).” Consequently, the appeal filed by the representative of the Public Prosecutor’s Office is granted; the judgment and the trial (debate) preceding it are vacated, and the case file is remanded for new proceedings before a differently constituted panel. *

Se ordena el cese de cualquier medida cautelar que se haya dictado en contra de [Nombre1] , [Nombre4] y [Nombre7] por esta causa. Se ordena la devolución del camión del placas [Placa1] y 13 trozas de madera aparente Cocobolo de folios 5 a 7 del expediente que fueron decomisados, a quién demuestre mediante documento idóneo ser la persona propietaria de estos bienes. Son las costas del proceso a cargo del Estado. Una vez firme la presente sentencia se ordena el archivo de la presente causa. Quedan las partes debidamente notificadas con el dictado oral de la sentencia, (Alegatos y Argumentos debidamente grabados en [Nombre9] de Audio Video a disposición de parte)."(sic).* * * 2.- Contra el anterior pronunciamiento, el licenciado Marvin Villalobos Badía, representante del Ministerio Público, interpuso recurso de apelación.* * 3.- Verificada la deliberación respectiva de conformidad con lo dispuesto en el Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso.* * 4.- En los procedimientos se han observado las prescripciones legales pertinentes.* Redacta la jueza Cynthia* Dumani Stradtmann ; y, * CONSIDERANDO* * I.- ADMISIBILIDAD DEL RECURSO.

El recurso de apelación fue presentado en tiempo por el licenciado Marvin Villalobos Badía, representante del Ministerio Público, a las 07:20 horas del 11 de diciembre de 2020 (folio 56), conforme al plazo de ley y de acuerdo con los presupuestos que se requieren para que la impugnación posibilite el adecuado conocimiento de las inconformidades planteadas, en orden al examen integral de la sentencia impugnada, tal y como lo establece el artículo 8.2 h de la Convención Americana de Derechos Humanos y los artículos 458, 459, 460 y 462 del Código Procesal Penal. En ese sentido, constata esta Cámara que el Tribunal de Flagrancia de Liberia, dictó la sentencia número 459-2019 de forma oral e integralmente a las 10:20 horas de 20 de noviembre de 2019, por lo que el plazo para recurrir venció el 11 de diciembre de 2019. En virtud de lo anterior el recurso es admisible.* * *

II.El recurso de la fiscalía se fundamenta en un solo motivo. Reclama incorrecta interpretación del tipo penal y fundamentación contradictoria. Señala que en el fallo se absolvió por duda a los imputados [Nombre1] , [Nombre4] y [Nombre7] por el delito de transporte ilegal de madera. Expresa que la relación de hechos es muy sencilla ya que se acusó que los justiciables transportaron trozas de madera de la especie cocobolo, sin contar con los permisos o la documentación pertinente. A pesar de ello el tribunal sentenciador tuvo dudas de la actuación de los imputados. Alega que se interpretó de forma errónea el delito de transporte de madera, previendo que el mismo debe demostrar si la madera viene de una plantación o bosque. Estima que el origen de la madera se tiene que acreditar para un delito como el del robo de madera, pero no para el transporte. Agrega que el Tribunal no dio importancia a la alerta recibida a altas horas de la noche sobre sujetos que estaban transportando madera sin contar con los documentos pertinentes.

Adiciona que se desvirtúa la experiencia del oficial, quien sin ser experto forestal, reconoció que la madera era de la especie cocobolo. Considera que se violaron los deberes de motivación; solicita se declare la ineficacia del fallo y se ordene la reposición del fallo.- Se acoge el motivo. A los encartados se les atribuyó que "El día 27/03/2019 alrededor de la una de la madrugada con 40 minutos en la localidad de Guanacaste, Bagaces, [Dirección1] , los imputados [Nombre4] , [Nombre7] Y [Nombre1] , adquirieron y transportaron 13 trozos de madera de la especie cocobolo sin contar con los permisos o documentación pertinente, abordo del vehículo placas [Placa2]". El tribunal sentenciador consideró que no se cumplieron con los elementos objetivos del tipo establecidos en el artículo 56 en relación a los numerales 61 y 63 de la Ley Forestal (secuencia 25:39 a 26:00).

Ahora bien, lo que se acusa en la presente causa es el transporte de trozas de madera de la especie cocobolo sin contar con los permisos pertinentes. El tribunal absuelve al encartado por duda, fundamentándose principalmente porque debía corroborarse que la especia de las trozas, era Cocobolo, y el lugar de donde provenía la madera concretamente, por lo que ordenó la devolución no solo del camión involucrado, sino también de las 13 trozas de madera (08:42 secuencia 27:05). Por su parte, el reclamo de la fiscalía se concreta en la falta de fundamentación del fallo por un errónea interpretación de los requisitos del tipo penal involucrado. En ese sentido, considera esta Cámara que la queja lleva razón. Sin que se prejuzgue, la normativa aplicable para el presente asunto, según los hechos descritos en la acusación y que corresponden a la descripción del delito de transporte ilegal de madera son los artículos 56 y 63 de la Ley Forestal número 7575.

Al respecto, el primero de ello señala: “ARTICULO 56.- Movilización de madera.* No se podrá movilizar madera en trozas, escuadrada ni aserrada proveniente de bosque ni de plantación, si no se cuenta con la documentación respectiva.” Este numeral describe claramente que todo transporte de madera, independientemente de donde vengan (bosque o plantación), o en cualquier forma (aserrada, en trozas o escuadradas) requiere para su transporte la documentación respectiva. El segundo guarismo establece la sanción por incumplir con la portación de la documentación respectiva : “ARTICULO 63.- Prisión de un mes a un año. Se impondrá prisión de un mes a un año a quien: a) Contravenga lo dispuesto en el artículo 56 de esta ley.” Esta documentación corresponde a la guía de transporte de madera y su certificado de origen que se encuentra regulado en los artículos 104 al 109 del Reglamento a la Ley forestal número 2923-A.

Asimismo, dicho reglamento establece en el numeral 115 todas las formas de la madera que se considera productos forestales y requieren de certificado de origen y guía de transporte. Ahora bien, adicional a lo anterior, se debe agregar que si bien, “la cocobola” (cocobolo como lo llamó el oficial Jorge Eduardo López)* tiene restricciones adicionales, las cuales están establecidas en el numeral 115 del reglamento referido, el tipo penal general de transporte de madera (el numeral 56 de La Ley Forestal), no requieren la identificación del tipo de madera para su configuración. Es decir, en el presente asunto, de la descripción de la acusación, se desprende que lo que se endilgó a los encartados fue el transporte de la madera sin los permisos respectivos y no el transporte de madera producto de la sustracción de la misma en propiedad privada o del Estado como lo indica el numeral 61, como lo confunde el juzgador, el cual en lo que interesa señala:* “ARTICULO 61.- Prisión de un mes a tres años.

Se impondrá prisión de un mes a tres años a quien: (…) d) Sustraiga productos forestales de una propiedad privada o del Estado o transporte productos forestales obtenidos en la misma forma.” Se observa también, que el tribunal omitió prueba documental importante en su análisis al cuestionar la especie de la trozas, pues del acta de inspección ocular (folio 41) y del informe del funcionario del Minae (42 y 43), se establece que las trozas eran de la especie “cocobolo (dalbergia retusa). Por consiguiente, de declara con lugar el recurso de apelación interpuesto por el representante del Ministerio Público se anula la sentencia y el debate que le precedió y se ordena el reenvío del expediente para una nueva sustanciación con integración distinta. *
