Appeal filed in the present case against [Nombre1], of legal age, born on diecisiete de diciembre de mil novecientos ochenta y uno, holder of identity card number CED1 – – , and [Nombre2], of legal age, born on veintiuno de julio de mil novecientos sesenta y cuatro, holder of identity card number CED2 – – , for the offense of Violation of the Ley Forestal in the form of illegal harvesting (aprovechamiento ilegal), to the detriment of Los Recursos Naturales. Judges Jaime Robleto Gutiérrez and Marco Mairena Navarro and Judge Xiomara Gutiérrez Cruz participated in deciding the appeal. Attorney Roberto Madrigal Zamora appeared in the appeal in his capacity as public defender for the accused [Nombre2]; Attorneys Tatiana Villegas Ceciliano, representative of the Ministerio Público, and Natalia Tencio Montenegro, in her capacity as public defender for the defendant [Nombre1]; and Attorney Zaray Chavarría Prado and Attorney Carlos Lizano Rodríguez, Criminal State Counsel.

Findings:

1. By judgment 209-TFPZ-2019, issued at dieciocho horas veinte minutos del primero de marzo de dos mil diecinueve, the Tribunal de Flagrancia del Primer Circuito Judicial de la Zona Sur, sede Pérez Zeledón, ruled: "POR TANTO: In accordance with the foregoing, Articles 39 and 41 of the Constitución Política, 8 and 9 of the Convención Americana sobre Derechos Humanos, Articles 1, 11, 18, 20, and 30 of the Código Penal, 3 and 58 subsection B) of the Ley Forestal, Articles 1 through 6, 9, 12, 13, 16, 38, 111, 113, 119, 142, 200, 236, 265 through 267, 303, 360 through 366, 429, and 432 of the Código Procesal Penal, and 1045 of the Código Civil, [Nombre1] and [Nombre2] are acquitted of all punishment and liability for the offense of VIOLATION OF THE LEY FORESTAL IN THE FORM OF ILLEGAL HARVESTING, to the detriment of LOS RECURSOS NATURALES. The civil action for damages (acción civil resarcitoria) is granted, and the civil defendants [Nombre1] and [Nombre2] are ordered to pay, in an amount to be determined, for the environmental damage caused and the interest accrued until its actual payment; accordingly, they must resort to the appropriate proceeding. The timber shall be delivered to the Administración Forestal de Estado, and the seized saw shall be returned to [Nombre3]. The Portable Sawmill shall be returned to whoever proves to be its lawful owner; for this purpose, a period of three months is granted to appear before the court and request its return. Once that period has elapsed, pursuant to Article 1 of the Ley de Bienes Caídos en Comiso, it shall be placed at the disposal of the State. The criminal judgment is entered without an award of costs; the expenses of the proceedings shall be borne by the State. The civil defendants are ordered to pay the costs of the civil action for damages, the amount of which shall be determined separately; they must resort to the appropriate proceeding for its enforcement. Once the judgment becomes final, the case shall be closed immediately. BECAUSE THE JUDGMENT WAS DELIVERED ORALLY, THE PARTIES ARE HEREBY DEEMED NOTIFIED AT THIS PROCEEDING, AND THE AUDIO AND VIDEO RECORDING OF THE JUDGMENT IS MADE AVAILABLE TO THEM. 2. Attorney Roberto Madrigal Zamora and Attorneys Tatiana Villegas Ceciliano and Tatiana Tencio Montenegro filed appeals against the foregoing ruling.

3. After the corresponding deliberation was conducted in accordance with Article 466 of the Código Procesal Penal, as amended by Ley 8837 published on nueve de diciembre de dos mil once (Creation of an Appeal from the Judgment), the Court considered the issues raised in the appeal.

4. The pertinent legal requirements were observed throughout the proceedings.

Whereas:

I.Ms. Tatiana Villegas Ceciliano, Assistant Prosecutor for Flagrante Delicto in Pérez Zeledón, pursuant to Articles 39 and 41 of the Political Constitution; 142 and 459 of the Code of Criminal Procedure; sections 3 and 61(a) of the Ley Forestal; and 437,438, 439, 458, 459,485 and 460 of the Code of Criminal Procedure, files an appeal (recurso de Apelación) against judgment N° 209-TFPZ-2019, issued by the Flagrante Delicto Court of the First Circuit of the Southern Zone, Pérez Zeledón seat, at 18:20 hours on 1° de marzo de 2019, whereby [Nombre2] and [Nombre4] were acquitted of all punishment and criminal liability for the offense of Violation of the Ley Forestal in the Form of Illegal Harvesting (Aprovechamiento Ilegal), to the detriment of Natural Resources. However, the civil action for damages (acción civil resarcitoria) was granted, and the civil defendants [Nombre2] and [Nombre4] were ordered to pay, in an amount to be determined, for the environmental damage caused, plus interest until full payment.

The timber was ordered delivered to the State Forestry Administration, and the seized saw was ordered returned to [Nombre3]. The Portable Sawmill was ordered returned to whoever proves to be its lawful owner; for that purpose, a period of three months was granted to appear before the Court and request its return, after which, pursuant to Article 1 of the Forfeited Property Act, it shall be placed at the disposal of the State. The judgment was rendered without an award of costs in the criminal proceedings, and the expenses of the proceedings shall be borne by the State. The civil defendants were ordered to pay the costs of the civil action for damages, in an amount to be determined, and the appropriate proceedings must be pursued for enforcement. Her challenge is directed against the criminal acquittal of [Nombre2] and [Nombre4] for the offense of Violation of the Ley Forestal in the Form of Illegal Harvesting, to the detriment of Natural Resources.

As her sole ground, she alleges erroneous application of the principle of congruence between the indictment and the judgment (principio de correlación entre acusación y sentencia). The oral judgment contains serious errors because it mistakenly states that the Public Prosecution Service made significant omissions in drafting the indictment (acusación), supposedly omitting objective elements of the criminal offense, which, in the appellant’s view, is untrue. According to the judge, the acquittal was possible because the prosecution’s indictment did not state that the Guanacaste tree had fallen when it was harvested by the defendants, nor did the charging instrument (requisitoria fiscal) state that the site where the forest harvesting (aprovechamiento forestal) occurred was land belonging to the Natural Heritage of the State (Patrimonio Natural del Estado). Furthermore, the challenged judgment states that the nature of the harvesting was not described; that is, it did not specify the benefit, advantage, utility, or gain obtained.

Consequently, the trial judge went so far as to state that the alleged facts did not constitute a criminal offense. Nevertheless, the judge’s statement is contrary to the procedural record and the audio recordings of these criminal proceedings. It is surprising that the judge stated in her judgment that the indictment did not establish that the Guanacaste tree had fallen, because, beginning with the Initial Hearing, as reflected in the audio recording, when requesting that the Court assume jurisdiction, the Public Prosecution Service read the charging document and clearly stated that the tree that was the object of the defendants’ unlawful conduct had fallen. Moreover, when the indictment was presented, it was explained to the defendants and the Court that the conduct charged against the defendants consisted precisely of harvesting a fallen Guanacaste tree, a circumstance recorded in the audio and video of the initial hearing held on 15 de enero del año 2019.

Likewise, when the oral and public trial began, the Public Prosecution Service delivered its opening statement and once again presented the previously admitted indictment, again explaining that condition of the Guanacaste tree that is the subject of these proceedings. All of this can be corroborated by reviewing the audio recordings of the oral and public trial. For that reason, it is untrue that the prosecution’s indictment contains serious omissions in the charges that would have precluded the issuance of a conviction, as the Court’s judge stated. Instead, it appears that she failed to pay due attention, because her judgment erroneously asserted that this circumstance was not stated in the Prosecution’s Indictment and, therefore, based on the principle of congruence between the indictment and the judgment, the judicial authority erroneously justified an acquittal. In another vein, the weakness of the judicial analysis in the judgment is apparent: merely listening to the indictment is enough to recognize that the Public Prosecution Service charged both defendants with the violation of the Ley Forestal established in Article 61(a), and not, as the judge erroneously stated in her judgment, with the violation established in Article 58(b).

We are, of course, aware that charges concern facts rather than legal classifications (calificaciones jurídicas), but it is important to highlight this inconsistency because, beginning with the initial hearing, the criminal offense with which the defendants were charged was established as that under Article 61(a) of the aforementioned Law. Although the legal classification is established provisionally during the proceedings and the Trial Court must establish in its judgment the legal classification it deems appropriate, that classification must be based on a legal analysis pursuant to Article 142 of the Code of Criminal Procedure, in which the judge thoroughly explains the reasons for departing from the position of the prosecution and that of the initial-hearing judge, who also admitted the legal classification assigned by the Public Prosecution Service. In this case, however, the trial judge instead appears confused about the criminal offense being charged, which is particularly relevant because it is unclear whether she determined the facts based on the criminal offense charged by the Public Prosecution Service and found the charging allegations insufficient, or whether she confused it with another offense and found elements lacking for a criminal offense that had not been charged.

The lack of clarity on this point does not guarantee any party the right to a fair and duly reasoned judgment. Furthermore, in the erroneous reasoning that the trial judge continued to deliver orally, she stated that the indictment did not specify that the tree was within the Natural Heritage of the State: “...in this case, based on what was initially established and what was indicated in the evidence, it concerned Article 58 of the Ley Forestal, subsection 8), which was the provision considered by the Court because it was always stated that this tree was located within State property. It was a place where, some time ago ... after tropical storm [Nombre5], it was swept along, leaving that Guanacaste tree at the site... At trial, it was stated that this tree was cut and dragged to a private Teak plantation adjoining the Natural Heritage of the State, and that was precisely where the tree was sawn, or at least, in this Judge’s view, it was not a matter of testing the tree; the photographs were clear because of the number of pieces of timber that had already been cut, 34 pieces, and the sawing was already being carried out...” In her judgment, the trial judge herself stated that the harvesting did NOT occur on land belonging to the Natural Heritage of the State.

It was precisely for this reason that the Public Prosecution Service did not charge the violation established in Article 58(b) of the Ley Forestal, and this is why the indictment obviously did not state that the defendants’ harvesting occurred on State land. The prosecution’s indictment did establish that the illegal harvesting of the fallen Guanacaste tree occurred in Buenos Aires de Puntarenas, specifically on the property located at geographic coordinates CED3 and CED4. The trial judge herself found that harvesting proven, as she even rejected the account provided by defendant [Nombre2], who asserted that he was merely “testing” the timber. Finally, another of the statutory elements (elementos normativos) that the Court found absent from the prosecution’s indictment was that it did not identify the benefit, advantage, utility, or gain obtained by the defendants or those whom they represented.

On this point, the Court stated: “that must also be included in the charging document, or at least that is how it was presented..., it was not even investigated by SINAC officials, and in this case, if harvesting did occur, it should have been included in the charging document because it involved using a fallen tree, explaining what benefit would result from that cutting or, in this case, as was stated, that it was for the benefit of the Escuela de Ocochobi...” [sic]. At trial, the statements of the defendants and the witness called by the defense established the purposes for which the sawn timber was to be used. Indeed, the trial judge herself acknowledged this in the judgment by stating that the timber was to be used by the Escuela de Ocochobi. The Public Prosecution Service cannot be required to specify precisely in the indictment what that benefit or advantage was. The Prosecutor’s Office will not be able to make that specific determination in every indictment.

In this case, the mere fact that the defendants had sawn 34 pieces of timber in itself represents the possibility of obtaining the benefit, advantage, utility, or gain established in Article 3 of the Ley Forestal, which expressly provides: “...that generates or may generate any benefit, advantage, utility, or gain for the person who carries it out or for the person whom he or she represents...” In this particular case, for example, it was not until the trial, through the statements of the defendants and the witness called by the Defense, that the specific benefit to be obtained through the harvesting was established, namely, for the Escuela de Ocochobi. Nevertheless, it is contrary to the rules of logic and experience for a person to process timber and obtain 34 pieces of Guanacaste, only to leave them at the site without putting them to any use. On this point, ruling 21-2016 of 15:00 hours, issued by the Criminal Judgment Appeals Court of the II Judicial Circuit of Guanacaste, Santa Cruz, states: “...the court below (a quo) indicated that harvesting was proven when the mahogany tree’s timber was sawn, planed, and stored, and that it was not proven that the accused felled the tree while it was standing on the bank of the stream.

The discussion concerning the accused’s spinal condition, which prevented him from felling a tree, is therefore immaterial, because the harvesting of the timber was proven through the acts carried out by the accused after the mahogany tree had been felled. Nor is the claim that the accused was not the person who was ‘cobaliaba’ the timber from the mahogany tree well-founded. In that regard, the judgment stated that the two MINAET officers were clear in identifying the accused as the person who was sawing and planing the logs…. Finally, the concept of ‘harvesting’ was challenged on the ground that what the accused did was ‘cobaliar,’ meaning to cut and saw the logs and plane them into symmetrical boards, and then store them in order to decide later what to do with them.

This conduct by the accused—sawing and planing the wood, cutting it into uniform boards suitable for use in any construction, and storing them for later use—is a clear indication of the purpose of harvesting (aprovechamiento), since that purpose is achieved when the material can “generate some profit, benefit, advantage, usefulness, or gain... It is not logical to take mahogany logs, cut planks from them, align those planks until each has standard dimensions and they become well-fashioned boards, and then think that they are not intended for harvesting but merely to be placed in the corridor. Indeed, upon analyzing the documentary evidence (...) they all had the same length, the same width, and the same thickness, ready to be used in construction or sold.” (Folio 83). The conclusion reached in the judgment is consistent with the rules of sound judicial reasoning (sana crítica), because ultimately the form that the accused gave the logs, turning them into well-formed boards, served the purpose of their later use, in accordance with the principles of logic and experience...” To the same effect, decisions 175-10 of 9:30 hours on 30 de julio del 2010, and 57-12 of 10:15 hours on 10 de febrero del 2012.

Furthermore, regarding this issue, the Tribunal de Apelación de la Sentencia Penal de Cartago, in decision 2015-443 of 16:39 hours on 27 de julio del 2015, has already been very clear in holding: “...the defendants [Nombre6]... and [Nombre7]..., acting by common agreement, proceeded, without a permit from the Administración Forestal del Estado, to harvest a tree of the Espavel species...” (underlining and boldface not in the original). In fact, the accused are charged with the harvesting required by the definition of the offense (tipo penal), thus satisfying the requirement of a complete charging instrument, since it includes the normative element that the judge appears to find missing, especially because, as stated in the cited decision, Article 3(a) of Ley N° 7575 contains the legal definition of harvesting, which in turn presupposes that the forest product entails some profit, benefit, advantage, usefulness, or gain for the person carrying out the prohibited act.

That is, given the complex nature of the verb and because this is a blank criminal provision (norma penal en blanco), contrary to the trial judge’s conclusion in acquitting on the ground that the conduct did not fall within the statutory offense (atipicidad), the normative element was properly alleged; once the evidence had been presented, it was specifically established that the wood extracted from the fallen tree was to be used to finish a corral, as [Nombre8] testified; in other words, that was the intended purpose and usefulness of the resource. Consequently, because the conduct does fall within the statutory offense, the appeal filed by the Prosecutor must be granted...” To the same effect, judgment 2615-153 of the Tribunal de Apelación de la Sentencia Penal de Cartago, Second Section, at thirteen hours forty-five minutes on trece de marzo de dos mil quince, is cited: “For the Ministerio Público, the ruling of the Tribunal de Apelación de Cartago is clear and applies to the specific case before us because, although this matter does not concern Article 58 of Ley Forestal but rather Article 61 of that same law, both criminal offenses provide that the prohibited conduct is the harvesting of forest resources, differing only as to the place where the conduct occurs and, of course, the penalty.

At trial, it was established how the wood was to be used; indeed, the trial judge herself so found in her judgment. Consequently, the conduct carried out by both defendants, as set forth in the charging instrument, does fall within the statutory offense.” In the appellant Prosecutor’s view, the formal defect that gave rise to the acquittal does not exist and, moreover, the trial judge’s reasoning is replete with errors warranting the invalidation of the judgment and of the trial that preceded it. She therefore requests that a new trial on remand (juicio de reenvío) be ordered, with the proceedings conducted anew in their entirety. Given the manner in which the appeals are resolved, the challenge filed by the representative of the Ministerio Público is addressed first and is denied: The trial judge acquitted [Nombre2] and [Nombre4] of the criminal charge of Violation of Ley Forestal in the Form of Illegal Harvesting, to the detriment of Los Recursos Naturales.

In the oral ruling, she stated that because there was a discrepancy between the charging instrument and the judgment that could be issued, the conduct necessarily failed to fall within the statutory offense. The two grounds on which the trial judge found a violation of the principle of congruence between the charge and the judgment (principio de correlación entre acusación y sentencia) were: (a) the Prosecution did not state in the charge that the Guanacaste tree was already fallen when it was harvested; and (b) the judge also acquitted because she found that, in bringing the charge, the Ministerio Público did not state what the harvesting of the forest product consisted of. At the procedural level, the principal difference between proceedings conducted under the flagrante delicto procedure (flagrancia) and ordinary proceedings (proceso ordinario) is that the former have no preparatory or intermediate stage, which in principle makes them more expeditious; under no circumstances, however, should this be understood—much less permitted—to mean that such proceedings may entail the infringement of the parties’ procedural safeguards, particularly those of the weaker party, namely the defendant.

Accordingly, the prosecution’s charging instrument must satisfy the same requirements applicable in ordinary proceedings, as set forth in Article 303 of the Código Procesal Penal, and must contain a precise and detailed description of the punishable act attributed to the accused. This presupposes clarity in the factual allegations and, although the instrument must include a legal classification (calificación jurídica), that classification must be understood as provisional and approximate in relation to the alleged facts and, in any event, is not binding on the adjudicating court. In this case, the Ministerio Público’s charge essentially alleged: “On 14/08/18, at approximately 12:00 hours, the defendants [Nombre1] and [Nombre2], acting jointly and with full control over the act, proceeded, without a permit from the Administración Forestal del Estado, to illegally harvest a tree of the Guanacaste species in Ocochobi de Buenos Aires de Puntarenas, specifically at geographic coordinates CED5 and CED6.

SINAC officers caught defendant [Nombre2] in flagrante delicto while he was operating the sawmill, and defendant [Nombre1] while he was taking the sawn pieces and stockpiling them. In total, the defendants harvested 3 062 cubic meters of Guanacaste, which were seized by SINAC officers, along with two logs equivalent to 1 763 cubic meters; the wood had a total value of two million seven hundred twenty-three thousand one hundred eighty-five colones.” [sic]. The foregoing describes the harvesting of a Guanacaste tree. The conduct described in the charging instrument occurred on private property, which in itself violates no provision because the charge does not state that the tree came from an area protected by the State, a fact that cannot and must not be presumed and must be clearly and unequivocally stated in the formal allegation of facts. The coordinates listed above do not, in themselves, explain the location to which they refer.

The charge therefore fails to provide the requisite factual particulars. Moreover, it was not expressly alleged that the Guanacaste tree species found cut down on private property by MINAE officers fell outside the exception established in Article 28 of Ley Forestal, which provides: “Ley Forestal. ARTICLE 28.—Exception from the felling-permit requirement (permiso de corta). Forest plantations, including agroforestry systems and individually planted trees and their products, shall not require a permit for felling, transportation, processing, or export. However, where, prior to the entry into force of this law, a forestry contract was entered into with the State for the receipt of Certificados de Abono Forestal or an income-tax deduction, felling must be carried out in accordance with the provisions of the management plan (plan de manejo) approved by the Administración Forestal del Estado.” Thus, the prosecution’s charging instrument states only that no permit had been obtained from the Administración Forestal del Estado to harvest the tree in question.

It concerned a single Guanacaste tree, without stating whether it was covered by any statutory exception, such as that established in Decreto N° 38863-MINAE, Article 26 of which provides: “Article 26.—Procedure for felling trees in forest plantations (CO-PF), agroforestry systems (CO-SAF), and individually planted trees. Pursuant to Article 28 of Ley Forestal 7575, and in accordance with Article 3°, subsection f), of that same law and its amendments, forest plantations established with private resources—that is, those that are not subject to a forestry contract with the State for the receipt of Certificados de Abono Forestal or an income-tax deduction—as well as agroforestry systems, including individually planted trees, and naturally regenerated trees, a category that includes windbreaks, individually planted trees, and planted blocks of less than one hectare, do not require a felling permit; however, for their products to be transported, their origin must be demonstrated through certificates of origin (certificados de origen).

Likewise, their harvesting must comply with Articles 33 and 34 of Ley Forestal 7575.” In other words, the charging instrument does not state where the Guanacaste tree came from; it therefore cannot be legally established that it was removed from an area protected by the State or from public-domain property (propiedad demanial). Moreover, the charge does not state that the seized cut wood from that tree did not fall within any of the exceptions established by the legal system under which the corresponding felling permit issued by the authorities was unnecessary. Consequently, irrespective of the personal conviction that may arise from the cumulative circumstantial evidence (indicios) in this case, the manner in which the prosecution formulated the charge does not permit a finding that the alleged conduct satisfies the objective statutory elements of the offense (elementos de tipicidad objetiva), which the Ministerio Público attempts to cure through this appeal with a respectable argument concerning the context and the application of the law, but which does not remedy the serious defect in the charging instrument.

Accordingly, the a quo ruled in accordance with law as to the criminal acquittal, and the civil claims challenged by defense counsel will be resolved in the corresponding recitals (considerandos). The appeal filed by the representative of the Ministerio Público is denied.

II.Attorney Roberto Madrigal Zamora, who filed the appeal (recurso de apelación) on behalf of [Nombre2] and who, in his capacity as a public defender, was granted, at the time, a reinstatement of the time limit (reposición de plazo) of fifteen business days for filing the appeal by the Tribunal de Juicio de Pérez Zeledón, through Voto 341-TFPZ-2019, at 18:00 hours on 26 de marzo de 2019, because this defendant could no longer afford the fees of private counsel, based on Articles 39 and 41 of the Constitución Política; 11 of the Declaración Universal de los Derechos del Hombre; 14. 5 of the Pacto Internacional de Derechos Civiles y Políticos; 8.2 h) of the Convención Americana sobre Derechos Humanos; and 1, 40, 142, 143, 363 subsection b), and 368 of the Código Procesal Penal. He files an appeal against judgment N° 209-TFPZ-2019, issued by the Tribunal de Flagrancia del Primer Circuito de la Zona Sur, Pérez Zeledón seat, at 18:20 hours on 1° de marzo de 2019, a ruling by which [Nombre2] and [Nombre4] were acquitted of all punishment and criminal liability for the offense of Violation of the Ley Forestal in the Form of Illegal Harvesting, to the detriment of Los Recursos Naturales.

However, the civil claim for damages (acción civil resarcitoria) was granted, and the civil defendants [Nombre2] and [Nombre4] were ordered to pay an amount to be determined (condenados en abstracto) for the environmental damage caused, plus interest until full payment. Delivery of the timber to the Administración Forestal de Estado is ordered, as is the return to [Nombre3] of the seized saw. The return of the Aserradero Portátil to whoever proves to be its lawful owner is ordered; for that purpose, a period of three months is granted to appear before the court and request its return. Once that period has elapsed, pursuant to Article 1 of the Ley de Bienes Caídos en Comiso, it shall be placed at the disposal of the State. The ruling is issued without an award of costs (condenatoria en costas) in the criminal portion; the costs of the proceedings shall be borne by the State. The civil defendants are ordered to pay the costs of the civil claim for damages, which are to be determined; they must resort to the appropriate proceeding for enforcement.

As the first ground, the Defense alleges a violation of the principle that the civil claim for damages is ancillary (principio de accesoriedad). The appellant states that his client, [Nombre2], was acquitted because his conduct did not constitute a criminal offense (atipicidad penal); in his view, the ancillary nature of the criminal action, provided for in section 40 of the Código Penal, presupposes at least the existence of a criminal wrong (injusto penal). The grounds on which the civil claim is based are independent of the definition of the criminal matter to be proved (thema probandum), and therefore the civil claimant (actor civil) may not go beyond the factual allegations of the Fiscalía. Likewise, the description of facts set forth in the civil claim for damages may not replace the description provided by the prosecuting authority. He requests that the judgment and the trial on which it is based be declared ineffective, and that a new trial also be ordered.

The claimant is incorrect in this argument: It should be clarified that a civil judgment may be entered in criminal proceedings even in the event of an acquittal, provided that a causal nexus (nexo causal) justifying it is established; at least, that is the position of the majority doctrine. Under section 40 of the Código Procesal Penal, the ancillary nature of the civil claim for damages refers to the opportunity to exercise it and not to the success of the asserted claim itself. Accordingly, contrary to what is alleged under this ground, the failure of the criminal claim does not entail the dismissal of the civil claim for damages, as the appellant contends.

III.Lack of analytical reasoning and illegitimate analytical reasoning. The claimant states that he does not disagree with [Nombre2]’s criminal acquittal, but that, with respect to the judgment on the civil claim for damages, the judge merely provided a descriptive statement of reasons and attempted to string together certain ideas without analyzing the incriminating evidence against him or the defendant’s own testimony. The judge sought to indicate that the absence of a statutory offense arose from the lack of congruence between the accusation and the judgment (correlación entre acusatoria y sentencia), but instead called into question the testimony of [Nombre9], such that no basis remains for why the damage must be repaired. The failure to analyze defendant [Nombre2]’s testimony leaves him defenseless, since he stated that he believed everything concerning the timber was in order and that he had been hired to go and cut some timber.

That omission in the ruling constitutes an absolute defect (vicio absoluto) because it concerns the nature of the criminal and civil liability arising from his conduct. He requests that the judgment and the trial on which it is based be declared ineffective and that a new trial also be ordered. The alleged defect is upheld for the following reasons: Noncontractual civil liability (responsabilidad civil extracontractual) arising from a harmful act requires, when asserted through a civil claim for damages in criminal proceedings, at a minimum that a criminal wrong arise under Beling’s tripartite theory (statutory definition of the offense [tipicidad] + unlawfulness [antijuridicidad]), so that the harmful result may be linked to the person to whom the legally relevant act is attributed, thereby establishing a causal nexus that permits the imposition of enforceable noncontractual civil liability.

It is relevant to recall the opinion of Daniel [Nombre10] Vallespinos in this regard, when he states that: “the necessary factual connection that must exist between human action and the harmful result produced is called the causal relationship. The causal relationship materially and directly links the breach of an obligation or the Aquilian wrongful act with the damage and, secondarily and indirectly, links the damage with the attribution factor…”. ([Nombre10], Ramón Daniel and Vallespinos, Carlos Gustavo, 1999). Instituciones de Derecho Privado- Obligaciones. Buenos Aires, Editorial Hammurabi, Volume 3, page 94). Although the concept is broader than the criminal-law concept, it encompasses the entirety of what the causal nexus means. In the case under review, because the conduct does not even reach the stage of constituting a statutory offense, it is not possible to link that conduct—which could be harmful—to the person to whom it is attributed; therefore, it is possible to establish the causal nexus necessary for the civil judgment.

Consequently, the reasons provided by the court below (a quo) in the judgment lack legal reasoning and are limited to a merely descriptive analysis, which is insufficient and, at the same time, contradicts the decision on the criminal aspect, because the court found that the defendants’ conduct did not constitute an offense. This causes significant conceptual confusion that must be examined in the retrial on remand (juicio de reenvío). The claim is therefore upheld, and the judgment is partially vacated, solely as to the civil aspects of the challenged judgment. The case is remanded for consideration of those portions of the ruling.

IV.Attorney Nathalia Tencio Montenegro, Public Defender for [Nombre1], based on Articles 1, 2, 6, 142, 143, 363, 458, 459, 460, and 461 of the Código Procesal Penal, files an appeal against judgment N° 209-TFPZ-2019, issued by the Tribunal de Flagrancia del Primer Circuito de la Zona Sur, Pérez Zeledón seat, at 18:20 hours on 1° de marzo de 2019, a ruling by which [Nombre2] and [Nombre4] were acquitted of all punishment and criminal liability for the offense of Violation of the Ley Forestal in the Form of Illegal Harvesting, to the detriment of Los Recursos Naturales. However, the civil claim for damages was granted, and the civil defendants [Nombre2] and [Nombre4] were ordered to pay an amount to be determined for the environmental damage caused, plus interest until full payment. Lack of reasoning and assessment of the evidence (falta de fundamentación y valoración de la prueba): Although the judge acquitted her client criminally, she neither weighed nor took into account that her client, [Nombre1], asserted the existence of a mistake of fact (error de tipo), consisting of the defendants’ mistaken belief that the legal permits for harvesting the tree in question had been obtained and that, because of the particular circumstances of the facts and of the defendant, that mistake was unavoidable; consequently, neither the cognitive nor volitional elements of the commission of the offense were present.

Nevertheless, the judge did not give even passing consideration to the arguments of counsel and the defendant personally and failed to assess these circumstances, which ultimately would likewise have resulted in an acquittal, but on entirely different grounds from those stated. In the appellant’s view, the prejudice arising from the judge’s action may be summarized as follows: “For the foregoing reasons, this representation considers that the unjustified rejection of my client’s testimony and of defense counsel’s theory of the case constitutes a violation of the duty to provide reasons for the ruling, the right to personally conduct a defense, and due process, resulting in a civil judgment against an innocent person of limited financial means, through the unjustified rejection of our theory of the case, who might ultimately have to pay millions from his limited assets.” She requests that the appeal be granted and that the court proceed in accordance with Articles 466 and 467 of the Código Procesal Penal.

The allegation must be considered upon remand if deemed necessary: On this occasion, the appellant points to the civil implications that a direct mistake of law (error de prohibición directo) could have for the civil consequences of the punishable act. Nevertheless, her claim likewise cannot be considered because, in view of the ruling in Considerando III of this decision, its effects extend to her client, such that all civil aspects of this case will be considered in a new trial, including matters relating to the source of the seized property held in the custody of the Tribunal de juicio.

V.Erroneous legal grounds for granting the civil action for damages (acción civil resarcitoria). The claim alleges that no assessment of the environmental damage (daño ambiental) was conducted. The judgment merely states that such environmental damage is valued at the same amount established by MINAE in the report entered into evidence at trial, dated 17 de agosto del 2018, which assigns the sawn timber a value of DOS MILLONES SETECIENTOS VEINTITRÉS MIL CIENTO OCHENTA Y CINCO COLONES. The appellant states verbatim: “The trial judge clearly erred in granting the civil action for damages on those terms, since an analysis of the judgment makes it senseless that a person could be acquitted of committing an offense because of errors in the formulation or attribution of the charges, yet, under the same circumstances of being unable to determine the damage, collection thereof could nevertheless be sought.

Although the indictment filed by the Public Prosecutor’s Office and the civil action for damages, which in this case is delegated to the Procuraduría General de la República, pursue different objectives, they share one aspect: once filed, each defines the matters that will be heard in adversarial proceedings and alleged against the accused party in this case, as well as the evidence supporting their claims; and here the State submitted no evidence establishing the environmental damage for which the accused was ordered to pay. Accordingly, the trial judge violates several principles, which are listed and analyzed below: First, by making such statements, she violates the principle of impartiality by attempting to remedy the civil action for damages, granting it, holding them liable for environmental damage in the abstract, and ordering that new expert reports be prepared to determine the environmental damage for which the State must be compensated.

It was the responsibility of the representative of the Procuraduría General de la República to arrange for this to be done, since she is the party interested in determining the alleged harm caused to the environment so that it may be quantified and, once that has been done, compensation may eventually be demanded from the accused. Nevertheless, in this situation, the trial judge assumes the position of the representative pursuing the civil action, attempting to establish the causal link (nexo causal) between the act committed by the accused and the damage they caused. Second, the judge violates the principle of objectivity that she is legally required to apply by admitting and granting the civil action for damages while knowing that it does not satisfy the requirements necessary to determine reliably and through technical criteria the harm for which my client is expected to pay and compensate the State.

It is surprising to defense counsel that the accused was held liable on the civil claims when the unlawful conduct that caused the damage has not been precisely established. This is particularly so because, in matters of civil liability (responsabilidad civil), the essential elements are the establishment of the conduct that caused the damage and the causal link between them. In that regard, it is unclear what conduct caused the damage, and therefore the causal link cannot be determined. Finally, the damage cannot be established with certainty, much less quantified, because there is no evidence from which the environmental damage may be proven.” Defense counsel requests that the appeal (recurso de apelación) be granted, that the challenged judgment be declared ineffective, and that a remand trial (juicio de reenvío) be ordered for new proceedings before a differently constituted panel of the same Court.

This ground for relief succeeds for reasons other than those alleged: For the reasons repeatedly stated above, the civil claims will be reassessed at the remand trial. Nevertheless, it must be noted that the environmental damage was not alleged in the indictment, but only in the second factual allegation of the civil action for damages, which states, in pertinent part: “Second: It is clear that the unlawful conduct perpetrated by the accused [Nombre1] and [Nombre2] caused environmental damage, which is estimated at two million seven hundred twenty-three thousand one hundred eighty-five colones (2.723.185), representing the economic value of the forest product, because by illegally harvesting the tree without the respective State permits, they harmed the natural resources and their recovery, such as the opportunity cost of the growth of species that lived in that tree even if it had fallen, since it immediately becomes an ecosystem until it disappears from the world after having provided food or shelter to countless species and, of course, after having fertilized the soil where it decomposed; this was prevented by the harvesting, thereby causing destructive exploitation and eliminating its biological wealth, flora, fauna, and ecosystems.” It is evident that the alleged civil damage does not appear in the criminal indictment; therefore, the remand Court must decide whether this claim may proceed against the civil defendants. This ground of the appeal filed by attorney Nathalia Tencio Montenegro, Public Defender for [Nombre1], is granted.

POR TANTO

The appeal filed by attorney Tatiana Villegas Ceciliano, Assistant Prosecutor for Flagrancy Matters of Pérez Zeledón, is denied; the criminal acquittal in favor of the accused remains undisturbed. The first ground is denied and the second ground of the appeal filed by attorney Roberto Madrigal Zamora on behalf of [Nombre2] is granted. Both grounds of appeal filed by attorney Nathalia Tencio Montenegro, Public Defender for [Nombre1], are granted. Accordingly, the challenged judgment is partially vacated solely as to its civil claims; the remainder of the judgment remains undisturbed, including the criminal acquittal in favor of both accused persons. The remand Court shall decide on the return of the seized property. Let notice be given.

A las nueve horas treinta y cinco minutos del veintisiete de marzo de dos mil veinte.

Recurso de apelación interpuesto en la presente causa seguida contra [Nombre1] , mayor, nacido el diecisiete de diciembre de mil novecientos ochenta y uno, con cédula de identidad número CED1 – – , y [Nombre2] , mayor, nacido el veintiuno de julio de mil novecientos sesenta y cuatro, con cédula de identidad número CED2 – – , por el delito de Infracción a la Ley Forestal en la modalidad de aprovechamiento ilegal, en perjuicio de Los Recursos Naturales. Intervienen en la decisión del recurso los jueces Jaime Robleto Gutiérrez y Marco Mairena Navarro y la jueza Xiomara Gutiérrez Cruz. Se apersonaron en apelación el licenciado Roberto Madrigal Zamora, en su condición de defensor público del imputado [Nombre2] , las licenciadas Tatiana Villegas Ceciliano, representante del Ministerio Público, Natalia Tencio Montenegro, en calidad de defensora pública del encartado [Nombre1] y la licenciada Zaray Chavarría Prado y el licenciado Carlos Lizano Rodríguez, Procuradores Penales.

Resultando:

1. Que mediante sentencia 209-TFPZ-2019 de las dieciocho horas veinte minutos del primero de marzo de dos mil diecinueve, el Tribunal de Flagrancia del Primer Circuito Judicial de la Zona Sur, sede Pérez Zeledón, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política, 8 y 9 de la Convención Americana sobre Derechos Humanos, artículos 1, 11, 18, 20, 30 del Código Penal, 3, 58 inciso B) de la Ley Forestal, artículos 1 a 6, 9, 12, 13, 16, 38, 111, 113, 119, 142, 200, 236, 265 al 267, 303, 360 a 366 y 429, 432 del Código Procesal Penal, 1045 del Código Civil, se declara a [Nombre1] y a [Nombre2] , absueltos de toda pena y responsabilidad en de un delito de INFRACCIÓN A LA LEY FORESTAL EN LA MODALIDAD DE APROVECHAMIENTO ILEGAL, en perjuicio de LOS RECURSOS NATURALES. Se declara con lugar la acción civil resarcitoria y se condena por el daño ambiental causado y los intereses que genere hasta su efectivo paso en abstracto a los demandados civiles [Nombre1] y [Nombre2] , por lo que deberán recurrir a la vía correspondiente. Se ordena la entrega de la madera a favor de la Administración Forestal de Estado, se ordena la devolución de la sierra decomisada a [Nombre3] . Se ordena la devolución del Aserradero Portátil a quién demuestre ser su legitimo dueño, para ello se le concede el plazo de tres meses para que se presente ante el tribunal a solicitar la devolución, una vez transcurrido ese plazo de conformidad con lo que establece el artículo 1 de la Ley de Bienes Caídos en Comiso pasará a la orden del estado. Se dicta el fallo sin condenatoria en costas en la parte penal, los gastos del proceso correrán a cargo de estado. Se condena a los demandados civiles a pago de las costas de la acción civil resarcitoria la cual se fija en abstracto, deberán recurrir a la vía correspondiente para su ejecución. Una vez firme la sentencia se ordena el archivo inmediato de la causa. POR HABERSE DICTADO EN FORMA ORAL, QUEDAN EN LAS PARTES NOTIFICADAS EN ESTE ACTO, SE DEJA A DISPOSICIÓN DE LAS MISMAS LA GRABACIÓN EN AUDIO Y VIDEO DE LA SENTENCIA. Marjorie Navarro Castro, Jueza. 2. Que contra el anterior pronunciamiento, el licenciado Roberto Madrigal Zamora y las licenciadas Tatiana Villegas Ceciliano y Tatiana Tencio Montenegro interpusieron los recursos de apelación.

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.

4. Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez Robleto Gutiérrez, y;

Considerando:

I.La licenciada Tatiana Villegas Ceciliano, Fiscal Auxiliar de Flagrancia de Pérez Zeledón, con fundamento en los artículos 39 y 41 de la Constitución Política; 142 y 459 del Código Procesal Penal; numerales 3 y 61 inciso a) de la Ley Forestal; 437,438, 439, 458, 459,485 y 460 del Código Procesal interpone recurso de Apelación contra la sentencia N° 209-TFPZ-2019, dictada por el Tribunal de Flagrancia del Primer Circuito de la Zona Sur, sede Pérez Zeledón, a las 18:20 horas del 1° de marzo de 2019, fallo mediante el cual se absolvió de toda pena y responsabilidad penal a [Nombre2] y a [Nombre4] , del delito de Infracción a la Ley Forestal en la Modalidad de Aprovechamiento Ilegal en perjuicio de Los Recursos Naturales. Pero, se declaró con lugar la acción civil resarcitoria, y se les condenó en abstracto a los demandados civiles [Nombre2] y a [Nombre4] , por el daño ambiental causado más los intereses hasta su efectivo pago.

Se ordena la entrega de la madera a favor de la Administración Forestal de Estado, se ordena la devolución de la sierra decomisada a [Nombre3] . Se ordena la devolución del Aserradero Portátil a quién demuestre ser su legítimo dueño, para ello se le concede el plazo de tres meses para que se presente ante el tribunal a solicitar la devolución, una vez transcurrido ese plazo de conformidad con lo que establece el artículo 1 de la Ley de Bienes Caídos en Comiso pasará a la orden del Estado. Se dicta el fallo sin condenatoria en costas en la parte penal, los gastos del proceso correrán a cargo de estado. Se condena a los demandados civiles a pago de las costas de la acción civil resarcitoria la cual se fija en abstracto, deberán recurrir a la vía correspondiente para su ejecución. Su reclamo se dirige contra la absolutoria penal en favor de [Nombre2] y a [Nombre4] por el delito de Infracción a la Ley Forestal en la Modalidad de Aprovechamiento Ilegal en perjuicio de Los Recursos Naturales.

Como único motivo aduce errónea aplicación del principio de correlación entre acusación y sentencia. El fallo oral presenta errores graves, por cuanto, de manera equivocada, se indica en el mismo, que el Ministerio Público incurrió en omisiones importantes al construir la acusación, supuestamente se echan de menos elementos objetivos del tipo penal, lo que en criterio de la recurrente no es cierto. Lo que, según la jueza permitió el dictado absolutorio, es que la acusación fiscal no describe que el árbol de Guanacaste estuviese caído al momento de ser aprovechado por los imputados, así como que no se indica en la requisitoria fiscal, que el sitio en el que se realizó el aprovechamiento forestal, fuese en terreno Patrimonio Natural del Estado. Además, señala la sentencia impugnada que no se describió en qué consistió el aprovechamiento, es decir, no se indicó, cuál fue el beneficio, la ventaja, la utilidad o la ganancia obtenida.

Por eso, la persona juzgadora, llegó al extremo de decir que los hechos son atípicos. Pese a ello, lo indicado por la juzgadora, resulta contrario a la realidad procesal, así como a los registros de audio del presente proceso penal, pues que es sorprendente que la jueza indique en su sentencia que la acusación no establecía que el árbol de Guanacaste estuviera caído, pues desde la Audiencia Inicial, tal y como consta en el registro de audio, al momento de solicitar la competencia, el Ministerio Público hizo lectura de la pieza acusatoria indicando claramente que el árbol objeto de la acción ilícita de los acusados estaba caído. Por si fuese poco, cuando se formuló la acusación se le explicó a los imputados y al Tribunal que la conducta acusada a los imputados era precisamente aprovechar un árbol caído de Guanacaste, situación que consta en el audio y video de la audiencia inicial celebrada en fecha 15 de enero del año 2019.

Asimismo, cuando inició la celebración del debate oral y público, el Ministerio Público realizó su alegato de apertura, expuso una vez más la acusación que había sido admitida previamente, en donde se expuso nuevamente dicha condición del árbol de Guanacaste objeto del presente proceso. Todo lo cual puede ser corroborado mediante la observación de los registros de audio del debate oral y público. Por esa razón, no es cierto que la acusación fiscal cuente con omisiones graves en la imputación que hubieran impedido el dictado de una sentencia condenatoria, como lo señala la juez del Tribunal, más bien parece que la misma no prestó la atención debida, pues en su sentencia de manera errónea afirmó que esta situación no constaba en la Acusación Fiscal y por ende en aplicación del principio de correlación entre acusación y sentencia se justifica erradamente por la autoridad judicial un fallo absolutorio.

En otro orden de ideas, véase el débil análisis judicial en el fallo, que basta con escuchar la acusación para darse cuenta que el Ministerio Público acusó a ambos imputados de la infracción a la Ley Forestal, prevista por el artículo 61 a), y no como erróneamente lo indicó la jueza en su sentencia por la infracción contemplada en el artículo 58 inciso b). Evidentemente, conocemos que lo que se acusan son hechos y no son calificaciones jurídicas, pero es importante hacer ver esta inconsistencia, toda vez que, desde la audiencia inicial se estableció el tipo penal que se les imputaba a los acusados era el artículo 61 a) de la citada Ley. Si bien es cierto la calificación legal se establece de manera provisional durante el proceso, y es el Tribunal de juicio quien debe mediante una sentencia establecer la calificación legal que estime adecuada, lo cierto del caso es que dicha calificación debe obedecer a un análisis legal y jurídico al tenor del artículo 142 del Código Procesal Penal, en donde el juzgador razone ampliamente los motivos que tuvo para separarse del criterio de la representación fiscal y del juez de la audiencia inicial quien también admitió la calificación legal dada por el Ministerio Público.

Pero en el caso que nos ocupa más bien pareciera que la juzgadora entra en una confusión en cuanto al tipo penal que se está acusando, lo cual si cobra especial relevancia, puesto que no está tan claro si la determinación de los hechos la realizó con base en el tipo penal acusado por el Ministerio Público y estimó insuficientes los elementos de imputación, o bien si se equivocó de figura y echó de menos elementos de un tipo penal que no estaba siendo acusado. La falta de claridad en este aspecto, no le garantiza a ninguna de las partes el derecho a una sentencia justa y debidamente fundada. Por otra parte, de acuerdo con la fundamentación que erróneamente continúa realizando la juzgadora de forma oral, establece que la acusación no indicó que el árbol estuviera dentro del Patrimonio Natural del Estado, "... en este caso en lo que inicialmente estableció y de lo que se indicó en los elementos de prueba, se trataba del artículo 58 de la Ley Forestal inciso 8), que ese fue el que tomó en consideración el Tribunal porque siempre se habló que este árbol se encontraba dentro de la propiedad del Estado.

Era un lugar donde hace tiempo ... luego de la tormenta tropical [Nombre5] hizo un arrastre quedándose ese árbol de Guanacaste en el sitio... En el debate se indicó que ese árbol se cortó y se arrastró hasta una finca privada de Teca que colinda con el Patrimonio Natural del Estado que ahí fue donde precisamente se procedió a realizar el aserrío del árbol, o por lo menos, a criterio de esta Juzgadora, no se trataba de probar el árbol, las fotografías era evidentes porque la cantidad de piezas de madera que ya se habían cortado, 34 piezas, ya se estaba haciendo el aserrío..." La propia juzgadora en su sentencia indica que el aprovechamiento NO se realizó en terrenos del Patrimonio Natural del Estado, precisamente por esta razón el Ministerio Público no acusó la infracción prevista por el artículo 58 inciso b) de la Ley Forestal, y es ésta la razón por la cual evidentemente en la acusación no se estableció que el aprovechamiento realizado por los imputados se realizara en terrenos del Estado.

La acusación fiscal sí estableció que el aprovechamiento ilegal del árbol caído de la especie de Guanacaste se realizó en la localidad de Buenos Aires de Puntarenas, propiamente en la finca ubicada en las coordenadas geográficas CED3 y CED4 . La misma juzgadora tuvo por acreditado ese aprovechamiento, pues incluso desvirtuó la versión del imputado [Nombre2] , quien afirmó que únicamente estaba "probando" la madera. Finalmente, otro de los elementos normativos que echa de menos el Tribunal en la acusación fiscal, es que en ésta no se establece cuál fue el provecho, beneficio, ventaja, utilidad o ganancia para los imputados o quienes éstos representaban. En este punto, establece el Tribunal: "eso también se debe de incluir en la pieza acusatoria o por lo menos lo hizo ver de esa manera..., ni siquiera se investigó por funcionarios del SINAC y en este caso sí había un aprovechamiento debió incluirse dentro de la pieza acusatoria al tratarse de utilizar un árbol caído, exponerse cuál iba a ser el beneficio de esa corta o en este caso que se decía que era en beneficio de la Escuela de Ocochobi...". [sic].

En el debate, quedó demostrado con las declaraciones de los imputados y del testigo que ofreció la defensa, para qué fines se iba a utilizar esa madera aserrada, incluso así lo reconoce la propia juzgadora en la sentencia, al indicar que esa madera se iba a utilizar por la Escuela de Ocochobi. No es posible que exija al Ministerio Público establecer de manera puntual en la acusación, cuál es ese provecho, beneficio o ventaja. No en todos los casos, podrá la Fiscalía determinar de manera concreta en la acusación. En este caso el sólo hecho de que los imputados hayan aserrado 34 piezas de madera, ya de por sí representa la posibilidad que se obtenga ese provecho, beneficio, ventaja, utilidad o ganancia, establecida por el artículo 3 de la Ley Forestal, pues incluso éste es claro al establecer ..."que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa...".

Ahora bien, en el caso concreto, por ejemplo, fue hasta en el Debate, con la declaración de los imputados y del testigo que ofreció la Defensa, que se estableció, de manera concreta, el beneficio que se obtendría con el aprovechamiento, sea para la Escuela de Ocochobi. Sin embargo, resulta contrario a las reglas de la lógica, de la experiencia, que una persona procese madera, obtenga 34 piezas de Guanacaste, pero las deje en el sitio sin darles ningún uso. Sobre éste punto, el voto 21-2016 de las 15:00 horas, del Tribunal de Apelación de Sentencia Penal del II Circuito judicial de Guanacaste, Santa Cruz, establece: "...el a quo indicó que se demostró el aprovechamiento cuando se aserró, cepilló y almacenó la madera del árbol de caoba y que no se probó que el endilgado talara el árbol cuando este estaba en pie a la orilla de la quebrada, por lo que la discusión sobre el padecimiento en la columna del imputado que lo imposibilitaba para talar un árbol es estéril, pues el aprovechamiento de la madera se probó mediante los actos posteriores a la tala del árbol de caoba, realizados por el imputado.

Tampoco es procedente el reclamo de que el encartado no era quien "cobaliaba" la madera proveniente del árbol de caoba. En ese sentido, el fallo expresó que los dos oficiales del MINAET fueron claros en su relato al identificar al encartado como la persona que aserraba y cepillaba las trozas de madera…. Ahora bien, como último agravio, se cuestionó el concepto de "aprovechamiento", pues se indicó que lo que realizó el imputado fue "cobaliar", es decir, cortar, aserrar las trozas y cepillarlas para lograr tablas simétricas y almacenarlas para decidir qué hacer con ellas con posterioridad. Esta conducta del acusado, de aserrar y cepillar la madera, cortarla en tablas uniformes aptas para ser utilizadas en cualquier construcción y almacenarlas para ser usadas con posterioridad, es un indicador claro del objetivo de aprovechamiento, pues se logra ese propósito cuando e/ material puede "generar algún provecho, beneficio, ventaja, utilidad o ganancia...

No es lógico tomar trozas de madera de caoba, sacar tablones, alinear esos tablones hasta darle una medida estándar a cada uno y que queden tablas bien diseñadas y pensar que no son para el aprovechamiento, sino simplemente para acomodarlas en el corredor. Incluso al analizar la prueba documental (...) todas tenían el mismo largo, e/ mismo ancho y el mismo grueso, listas para ser utilizadas en construcción o vendidas." (Folio 83). La conclusión a la que llega la sentencia, es congruente con las reglas de la sana critica, pues finalmente la forma que el encartado dio a las trosas, en tablas bien estructuradas, cumplían con el objetivo de ser utilizadas posteriormente, de acuerdo a los principios de la lógica y la experiencia..." En igual sentido votos 175-10 de las 9:30 horas del 30 de julio del 2010, y 57-12 de las 10:15 horas del 10 de febrero del 2012. Además, sobre este aspecto ya el Tribunal de Apelación de la Sentencia Penal de Cartago, mediante resolución 2015-443 de las 16:39 horas del 27 de julio del 2015, ha sido muy claro al establecer: "...los imputados [Nombre6]. . . y [Nombre7]. . ., actuando de común acuerdo procedieron sin contar con el permiso de la Administración Forestal del Estado a aprovechar un árbol de la especie Espavel..." (el sublineado y negrilla no es del original).

En realidad, se imputa a los encartados el aprovechamiento requerido por el tipo penal por lo que se cumple con el requisito de una acusación completa. ya que incluye el elemento normativo que la jueza parece echar de menos, máxime que como se indicó en la resolución citada el artículo 3 inciso a) de la Ley N° 7575 contiene la definición legal de aprovechamiento, que a su vez presupone que el producto forestal conlleva un provecho, beneficio. ventaja. utilidad o ganancia para la persona que realiza la acción prohibida. Es decir, por la naturaleza compleja del verbo y siendo una norma penal en blanco contrario a lo que estimó la juzgadora por absolver por atipicidad, el elemento normativo sí fue debidamente acusado, siendo que, una vez evacuada la prueba pudo establecerse de manera específica que Ia madera extraída del árbol caído se iba a utilizar para terminar un corral, ello lo declaró [Nombre8] . es decir, esa era la finalidad del recurso y su utilidad.

En consecuencia, dado que la conducta no es atípica, debe acogerse el recurso interpuesto por el Fiscal..." en igual sentido, se cita la sentencia 2615-153 del Tribunal de Apelación de la Sentencia Penal de Cartago. sección segunda, de las trece horas cuarenta y cinco minutos del trece de marzo de dos mil quince:” Para el Ministerio Público lo resuelto por el Tribunal de Apelación de Cartago es claro y se aplica para el caso concreto que nos ocupa. porque si bien no se trata del artículo 58 de la Ley Forestal, sino más bien del 61 del mismo cuerpo legal, ambos tipos penales establecen que la conducta prohibida es realizar el aprovechamiento de recursos forestales, variando únicamente el lugar donde se realiza y por supuesto la pena. En el debate si se logró acreditar cómo iba a utilizarse la madera, incluso la misma Juzgadora así lo estableció en su sentencia, por lo que en consecuencia la conducta realizada por ambos imputados. plasmada en la acusación, no es atípica.” Para la Fiscal impugnante no existe el vicio formal que dio lugar a la absolutoria y, además, el razonamiento de la juzgadora está lleno de errores que justifican la ineficacia de la sentencia y el debate que la precedió.

Solicita se ordene por ello, un juicio de reenvío para una nueva sustanciación en su totalidad. Por la forma en que se dirimen los recursos, se resuelve primero la impugnación interpuesta por la representante del Ministerio Público y se declara sin lugar: La persona juzgadora absolvió en lo penal a los encartados [Nombre2] y a [Nombre4] por el delito de Infracción a la Ley Forestal en la Modalidad de Aprovechamiento Ilegal en perjuicio de Los Recursos Naturales, para ello declaró oralmente en el fallo que, en razón de que existía un quebranto entre la pieza acusatoria y la sentencia que podía dictar, necesariamente, el resultado era la atipicidad de la conducta. Los dos basamentos en que la juzgadora estima que se violenta el principio de correlación entre acusación y sentencia son: a) que no se describe por parte de la Fiscalía en la acusación, que el árbol de Guanacaste estaba caído al momento de ser aprovechado; y b) la jueza absolvió también porque estimó que el Ministerio Público no indicó al acusar, en qué consistía el aprovechamiento del producto forestal.

A nivel procesal, la diferencia principal entre un proceso tramitado por flagrancia y uno por el proceso ordinario, es que el primero no tiene una etapa preparatoria e intermedia, lo que lo hace más expedito en principio, pero en ningún caso ello debe entenderse, y mucho menos permitirse, que sea un procedimiento que conlleve la vulneración de garantías para las partes, especialmente para la más débil, que es el imputado. De tal manera que la acusación fiscal debe reunir los mismos requisitos que son necesarios en un proceso ordinario y que se indican en el artículo 303 del Código Procesal Penal, debiendo contener una descripción precisa y circunstanciada del hecho punible que se atribuya al acusado, lo que presupone claridad en la narración fáctica, y que, si bien, debe incluir una calificación jurídica, esta debe entenderse como provisional y aproximada a los hechos acusados, y en todo caso, no es vinculante para el Tribunal decisor.

En el caso concreto, la acusación del Ministerio Público consistió básicamente en que: “El día 14/08/18, aproximadamente a las 12:00 horas, los imputados [Nombre1] y [Nombre2] actuando de manera conjunta y con pleno dominio del hecho, procedieron sin contar con el permiso de la Administración Forestal del Estado, a aprovechar ilegalmente un árbol de la especie Guanacaste, en Ocochobi de Buenos Aires de Puntarenas, propiamente en las coordenadas geográficas CED5 y CED6 . Funcionarios del SINAC sorprendieron en flagrante delito al imputado [Nombre2] , cuando éste operaba el aserradero y al imputado [Nombre1] cuando tomaba las piezas aserradas y las acopiaba. En total los imputados realizaron el aprovechamiento de 3 062 metros cúbicos de Guanacaste, los cuales fueron decomisados por los funcionarios del SINAC, al igual que dos trozas equivalentes a 1 763 metros cúbicos, madera que en total tiene un valor de dos millones setecientos veintitrés mil ciento ochenta y cinco colones.” [sic], de lo anterior se extrae un aprovechamiento de un árbol de guanacaste, esa acción descrita en la pieza acusatoria se dio en una propiedad privada, lo que en sí misma no es violatoria de ninguna norma porque no se indica en la acusación el vegetal procediera de un área protegida por el Estado, lo que no puede, ni debe presumirse, y debe constar en la imputación formal de hechos de manera clara e indubitable, por lo que las coordenadas que se indican supra no explican en sí mismas a cual locación se refieren.

Incumpliendo con ello circunstanciar la acusación, sumado a lo anterior, tampoco se acusó expresamente que la especie del árbol de guanacaste que se encontró cortado en propiedad privada por los funcionarios del MINAE no estuviera dentro de la excepción prevista en el numeral de artículo 28 de la Ley Forestal, que reza: “Ley Forestal. ARTICULO 28.- Excepción de permiso de corta Las plantaciones forestales, incluidos los sistemas agroforestales y los árboles plantados individualmente y sus productos, no requerirá permiso de corta, transporte, industrialización ni exportación. Sin embargo, en los casos en que antes de la vigencia de esta ley exista un contrato forestal, firmado con el Estado para recibir Certificados de Abono Forestal o deducción del impuesto sobre la renta, la corta deberá realizarse conforme a lo establecido en el plan de manejo aprobado por la Administración Forestal del Estado.” De tal forma, que, en la pieza fiscal, solo se menciona que no se contaba con el permiso de la Administración Forestal del Estado para aprovechar el árbol de marras.

Un solo árbol de guanacaste, sin describir si está excepcionado por alguna excepción legal como la contemplada por el Decreto N° 38863-MINAE, en cuyo artículo 26, se lee: “Artículo 26.-Del trámite de corta de árboles en plantaciones forestales (CO-PF), sistemas agroforestales (CO-SAF) y árboles plantados individualmente. Conforme a lo establecido en el artículo 28 de la Ley Forestal 7575, y en concordancia con el artículo 3°, inciso f) de esa misma ley y sus reformas, las plantaciones forestales efectuadas con recursos propios, o sea; que no poseen un contrato forestal con el Estado para recibir Certificados de Abono Forestal o deducción de impuesto sobre la renta; también los sistemas agroforestales, incluidos los árboles plantados individualmente, y los árboles regenerados naturalmente, considerando dentro de esta categoría los rompevientos, los árboles plantados individualmente y en bloques plantados inferiores a una hectárea, no requieren permiso de corta, sin embargo; para el transporte de sus productos deberá demostrarse su procedencia a través de certificados de origen.

Así mismo, para su aprovechamiento se deberá respetar lo establecido en los artículos 33 y 34 de la Ley Forestal 7575.” Es decir, la pieza acusatoria, no indica de dónde procede el árbol de Guanacaste, por lo que no pude establecer legalmente que fue extraído de una zona protegida por el Estado o de una propiedad demanial; sumado a ello, tampoco se describe en la acusación que la madera cortada proveniente de ese árbol que fue incautada no estaba dentro de algunas de las excepciones previstas por el ordenamiento que hacían que no fuese necesario contar con el permiso de corta respectivo otorgado por las autoridades. En consecuencia, e independientemente de la íntima convicción que puedan generar la suma de los indicios de esta causa, la manera en que fue formulada la acusación fiscal no permite arribar a la descripción de una conducta típica por omisiones de los elementos de tipicidad objetiva que el Ministerio Público, mediante este recurso de apelación, trata de paliar, con una argumentación respetable del contexto y de la aplicación normativa, pero que no consigue sanear el grave vicio contenido en la pieza acusatoria.

En consecuencia, la a quo resolvió conforme a derecho en cuanto a la absolutoria penal y los extremos civiles cuestionados por los defensores se resolverán en los respectivos considerandos. Se declara sin lugar el recurso interpuesto por la representación del Ministerio Público.

II.El licenciado Roberto Madrigal Zamora, quien interpuso el recurso de apelación en favor de [Nombre2] , y que, en su carácter de defensor público, en su momento, el Tribunal de Juicio de Pérez Zeledón, mediante el Voto 341-TFPZ-2019, de las 18:00 horas del 26 de marzo de 2019, le otorgó una reposición de plazo de quince días hábiles para la interposición del recurso de apelación, en razón de que este encartado no pudo seguir pagando los honorarios de un abogado particular, cona base en los artículos 39 y 41 de la Constitución Política; 11 de la Declaración Universal de los Derechos del Hombre; 14. 5 del Pacto Internacional de Derechos Civiles y Políticos; 8.2 h) de la Convención Americana sobre Derechos Humanos; 1, 40, 142, 143, 363 inciso b), 368, del Código Procesal Penal. Interpone recurso de apelación contra la sentencia N° 209-TFPZ-2019, dictada por el Tribunal de Flagrancia del Primer Circuito de la Zona Sur, sede Pérez Zeledón, a las 18:20 horas del 1° de marzo de 2019, fallo mediante el cual se absolvió de toda pena y responsabilidad penal a [Nombre2] y a [Nombre4] , del delito de Infracción a la Ley Forestal en la Modalidad de Aprovechamiento Ilegal en perjuicio de Los Recursos Naturales.

Pero, se declaró con lugar la acción civil resarcitoria, y se les condenó en abstracto a los demandados civiles [Nombre2] y a [Nombre4] , por el daño ambiental causado más los intereses hasta su efectivo pago. Se ordena la entrega de la madera a favor de la Administración Forestal de Estado, se ordena la devolución de la sierra decomisada a [Nombre3] . Se ordena la devolución del Aserradero Portátil a quién demuestre ser su legítimo dueño, para ello se le concede el plazo de tres meses para que se presente ante el tribunal a solicitar la devolución, una vez transcurrido ese plazo de conformidad con lo que establece el artículo 1 de la Ley de Bienes Caídos en Comiso pasará a la orden del Estado. Se dicta el fallo sin condenatoria en costas en la parte penal, los gastos del proceso correrán a cargo de estado. Se condena a los demandados civiles a pago de las costas de la acción civil resarcitoria la cual se fija en abstracto, deberán recurrir a la vía correspondiente para su ejecución.

Como primer motivo, la Defensa alega violación al principio de accesoriedad de la acción civil resarcitoria. El recurrente afirma que su representado [Nombre2] fue absuelto por atipicidad penal de su conducta, en su criterio, la accesoriedad de la acción penal, prevista en el numeral 40 del Código Penal, presupone al menos la existencia del injusto penal. Los motivos en que se basa la acción civil son independientes a la delimitación del thema probandum penal, por lo que el actor civil no puede ir más allá del supuesto fáctico de la Fiscalía. Y, la descripción de hechos que se haga en la acción civil resarcitoria, no puede sustituir la que haga el órgano fiscal. Solicita la ineficacia de la sentencia, y el debate en que se fundamenta, ordenando, además, la realización de un nuevo juicio. Por este argumento, no lleva razón el reclamante: Cabe aclarar que es posible la condenatoria civil en un proceso penal aún en caso de absolutoria siempre y cuando se establezca un nexo causal que lo justifique, al menos esa es la posición de la doctrina mayoritaria.

De conformidad con el numeral 40 del Código Procesal Penal, el carácter accesorio de la acción civil resarcitoria alude a la oportunidad del ejercicio de esta y no al éxito en sí de la pretensión esgrimida. Por lo que, contrario a lo que se alega en este motivo, el fracaso de la pretensión penal, no implica la declaratoria sin lugar de la acción civil resarcitoria como lo hacer ver el impugnante.

III.Ausencia de fundamentación analítica y motivación analítica ilegítima. El reclamante expresa que no existe disconformidad por la absolutoria penal con relación a [Nombre2] , pero en cuanto a la condenatoria por la acción civil resarcitoria, la jueza hizo una fundamentación descriptiva, e intentó hilvanar algunas ideas, sin analizar la prueba de cargo en su contra, ni la declaración que rindió el propio imputado. La persona juzgadora se esforzó en indicar que la atipicidad provenía de la falta de correlación entre acusatoria y sentencia, pero, más bien puso en entredicho la declaración de la deponente [Nombre9] , de tal manera, que no queda sustentado el por qué el daño debe ser reparado. La omisión del análisis de lo que declaró el imputado [Nombre2] lo deja en indefensión, dado que, éste manifestó que él pensó que todo lo relacionado con la madera estaba bien y que él fue contratado para ir a cortar una madera, esa omisión del fallo causa un vicio absoluto porque alude a la naturaleza de la responsabilidad penal y civil de su conducta.

Solicita la ineficacia de la sentencia, y el debate en que se fundamenta, ordenando, además, la realización de un nuevo juicio. El vicio alegado se declara con lugar por lo que se expone: La responsabilidad civil extracontractual procedente de un hecho dañoso, requiere, cuando se plantea dentro de una acción civil resarcitoria en el proceso penal, como mínimo que nazca el injusto penal según el planteamiento de la teoría tripartita de Beling (Tipicidad +antijuridicidad), para poder relacionar así el resultado dañino al sujeto a quien se le atribuye la acción jurídicamente relevante, estableciendo de esa manera un nexo causal que permite establecer la responsabilidad civil extracontractual exigible. Es relevante recordar la opinión de Daniel [Nombre10] Vallespinos al respecto, cuando señala que: “la necesaria conexión fáctica que debe existir entre la acción humana y el resultado dañoso producido se denomina relación de causalidad.

La relación de causalidad vincula materialmente, de manera directa, al incumplimiento obligacional o al acto ilícito aquiliano con el daño y, en forma sucedánea e indirecta, a éste con el factor de atribución…”. ([Nombre10], Ramón Daniel y Vallespinos, Carlos Gustavo, 1999). Instituciones de Derecho Privado- Obligaciones. Buenos Aires, Editorial Hammurabi, Tomo 3, página 94). Si bien el concepto es más amplio que el penal, abarca la totalidad de lo que significa el nexo causal. En la causa bajo estudio, al no llegar la acción siquiera al estadio de la tipicidad, no resulta posible vincular ese proceder (que podría ser dañoso) con el sujeto que se le atribuye, por lo que es posible establece el nexo causal necesario para la condena civil, de tal manera que las razones brindadas por la a quo en la sentencia carecen de motivación jurídica y se limitan a un estudio meramente descriptivo, el cual resulta insuficiente y a la vez, viene a ser contradictorio con lo decidido en el extremo penal, dado que estableció que la conducta de los encartados era atípica, lo que causa una confusión conceptual significativa que debe ser sometida a estudio en el juicio de reenvío.

Por ello, se declara con lugar la queja y se anula parcialmente la sentencia, únicamente en cuanto a los extremos civiles de la sentencia impugnada. Se ordena el reenvío de la causa para conocer esos puntos del fallo.

IV.La licenciada Nathalia Tencio Montenegro, Defensora Pública de [Nombre1] , con base en los artículos, 1, 2, 6, 142, 143, 363, 458, 459, 460, 461, del Código Procesal Penal, interpone recurso de Apelación contra la sentencia N° 209-TFPZ-2019, dictada por el Tribunal de Flagrancia del Primer Circuito de la Zona Sur, sede Pérez Zeledón, a las 18:20 horas del 1° de marzo de 2019, fallo mediante el cual se absolvió de toda pena y responsabilidad penal a [Nombre2] y a [Nombre4] , del delito de Infracción a la Ley Forestal en la Modalidad de Aprovechamiento Ilegal en perjuicio de Los Recursos Naturales. Pero, se declaró con lugar la acción civil resarcitoria, y se les condenó en abstracto a los demandados civiles [Nombre2] y a [Nombre4] , por el daño ambiental causado más los intereses hasta su efectivo pago. Se ordena la entrega de la madera a favor de la Administración Forestal de Estado, se ordena la devolución de la sierra decomisada a [Nombre3] .

Se ordena la devolución del Aserradero Portátil a quién demuestre ser su legítimo dueño, para ello se le concede el plazo de tres meses para que se presente ante el tribunal a solicitar la devolución, una vez transcurrido ese plazo de conformidad con lo que establece el artículo 1 de la Ley de Bienes Caídos en Comiso pasará a la orden del Estado. Se dicta el fallo sin condenatoria en costas en la parte penal, los gastos del proceso correrán a cargo de estado. Se condena a los demandados civiles a pago de las costas de la acción civil resarcitoria la cual se fija en abstracto, deberán recurrir a la vía correspondiente para su ejecución. Falta de fundamentación y valoración de la prueba: Si bien es cierto, la persona juzgadora absolvió penalmente a su representado, no ponderó, ni tomó en cuenta que su representado [Nombre1] indicó la existencia de un error de tipo en cuanto a la falsa creencia que tenían los imputados de que se contaba con los permisos legales para el aprovechamiento del árbol en cuestión y que por las condiciones particulares de los hechos y del imputado, dicho error era invencible, de modo que no se configuran los elementos cognitivos ni volitivos de la comisión del delito.

Sin embargo, la juzgadora no consideró ni por asomo lo manifestado por la defensa técnica y material y dejó sin valorar estas circunstancias que a la postre hubieran resultado en una sentencia de igual forma absolutoria, pero en unos términos completamente diferentes a los expuestos. En criterio de quien impugna, el agravio de este procede de la jueza, se resume así: “Es por lo anterior que esta representación considera que el descarte injustificado de la declaración de mi representado y de la teoría del caso de la defensa técnica implica una violación al deber de fundamentar el fallo, al derecho de defensa material, y el debido proceso, que dio como resultado una condena en vía civil, en descarte injustificado de nuestra teoría del caso, contra una persona inocente, de escasos recursos económicos, que eventualmente tendría que cancelar montos millonarios con su poco patrimonio.” Solicita que, se proceda a declarar con lugar el recurso; y que se disponga conforme lo establecido en los artículos 466 y 467 del Código Procesal Penal.

Lo alegado debe ser conocido en el reenvío de la causa si se estima necesario: En esta ocasión, la recurrente apunta a las implicaciones civiles que podría tener un error de prohibición directo en las consecuencias civiles del hecho punible, pero de igual manera, no es posible conocer su reclamo, porque, dado lo resuelto en el Considerando III de esta resolución, se extienden los efectos su representado, de tal forma que en un nuevo juicio se conocerán todos los extremos civiles de esta causa. Inclusive lo relativo a la procedencia de los bienes incautados que tiene el Tribunal de juicio en custodia.

V.Errónea fundamentación jurídica en cuanto a declarar con lugar la acción civil resarcitoria. El reclamo consiste en que se alega que no se realizó ninguna valoración del daño ambiental. Siendo que únicamente se limita a indicar que dicho daño ambiental se valora en la misma suma que se estableció por parte del MINAE en el informe incorporado a debate, de fecha 17 de agosto del 2018, donde se le asigna un valor a la madera aserrada de DOS MILLONES SETECIENTOS VEINTITRÉS MIL CIENTO OCHENTA Y CINCO COLONES. La reclamante alega textualmente: “Yerra la juzgadora de manera categórica al declarar con lugar la acción civil resarcitoria bajo esos términos, ya que realizando un análisis en relación a lo que se resolvió en sentencia, carece de sentido que una persona pueda ser absuelta de la comisión de un delito por existir errores en la formulación o imputación dentro de la pieza acusatoria y que bajo los mismos supuestos de no lograr determinar el daño que se les pretenda cobrar el mismo.

Si bien es cierto, la acusación que formula el Ministerio Público y la Acción Civil Resarcitoria que es delegada en este caso a la Procuraduría General de la República, persiguen fines distintos entre sí tienen un aspecto en común, y es que cada una de ellas, una vez formulada, definen los aspectos que en el contradictorio se conocerán y se reprocharan en este caso a la parte imputada, así como la prueba que sustente sus pretensiones y en este caso El Estado no aportó prueba que establezca un daño ambiental por el que se condena al imputado. Siendo esto así, la juzgadora transgrede varios principios lo cuales se proceden a enumerar y a analizar a continuación: En primer lugar, al emitir ese tipo de manifestaciones quebranta el principio de imparcialidad al tratar de corregir la acción civil resarcitoria, declarándola con lugar y condenarlos por el daño ambiental en abstracto y enviando a que se rindan nuevos peritajes para poder determinar el daño ambiental por el cual debe ser resarcido el Estado.

Esta situación le correspondía diligenciada a la representante de la Procuraduría General de la República, ya que ésta es la parte interesada en poder determinar esta supuesta afectación que se le causó al medio ambiente para poder cuantificarla y eventualmente luego de esto poder exigir el resarcimiento por parte de los imputados, sin embargo, ante esta situación la juzgadora toma la posición de la representante de la acción civil tratando de establecer el nexo causal entre la acción cometida por los imputados y el daño producidos por éstos. En segundo lugar, la jueza infringe el principio de objetividad que, por imperativo legal le corresponde aplicar, al admitir y declarar con lugar la acción civil resarcitoria, teniendo conocimiento que la misma no reúne los requisitos para poder determinar de una manera fehaciente y mediante criterios técnicos la afectación por la cual se le pretende hacer pagar y retribuir al Estado por parte de mi representado.

Resulta sorpresivo para la defensa técnica, que se condene a la persona imputada en los extremos civiles por cuanto no se ha tenido por acreditado de forma precisa, cual fue la conducta ilícita generadora del daño. Lo anterior, máxime que en materia de responsabilidad civil lo esencial es el establecimiento de la conducta generadora del daño y el nexo causal entre ellos. En ese sentido, no queda clara cuál es la conducta generadora del daño, y por ende el nexo causal no es determinable. Por último, el daño no se puede establecer con certeza, ni mucho menos se puede cuantificar puesto que no existen elementos de convicción que permitan acreditar el daño ambiental.” La defensora solicita se declare con lugar el recurso de apelación, se declare la ineficacia del fallo recurrido y se ordene la realización de un juicio de reenvío para una nueva sustanciación ante otra integración del mismo Tribunal.

La pretensión del motivo, prospera por razones distintas a las alegadas: Por lo que ya se ha expuesto reiteradamente, los extremos civiles serán objeto de una nueva ponderación en el juicio de reenvío. Pese a ello, debe asentarse que el daño ambiental no se endilgó en la pieza acusatoria, sino solamente en el hecho segundo de la acción civil resarcitoria, que en lo conducente indica: “Segundo: Es claro que el actuar ilícito perpetrado por los acusados [Nombre1] y [Nombre2] produjo un daño ambiental, el cual se estima en la suma de dos millones setecientos veintitrés mil ciento ochenta y cinco colones (2.723.185), como el valor económico del producto forestal, ya que con el aprovechamiento ilegal del árbol sin contar con los respectivos permisos del Estado, deterioraron los recursos naturales y su recuperación, tales como el cesto de oportunidad de crecimiento de especie que hablaban en ese árbol aunque estuviese caído, ya que se convierte Inmediatamente en un ecosistema, hasta que desaparece del mundo por haber alimentado o dado casa a un sinnúmero de especies, y por supuesto, después de haber fertilizado la tierra donde se deshiciera, lo cual Impidieron al aprovechando generando una explotación destructiva e hicieron desaparecer su riqueza biológica, flora, fauna y ecosistemas.” Es notorio que este daño civil acusado, no aparece imputado en la acusación penal, así que será el Tribunal de reenvío quien habrá de decidir si este extremo procede o no en contra de los demandados civiles. Con lugar este extremo del recurso de apelación de la licenciada Nathalia Tencio Montenegro, Defensora Pública de [Nombre1] .

POR TANTO

Se declara sin lugar el recurso de apelación interpuesto por la licenciada Tatiana Villegas Ceciliano, Fiscal Auxiliar de Flagrancia de Pérez Zeledón, la absolutoria penal en favor de los encartados se mantiene incólume. Se declara sin lugar el primer motivo y con lugar el segundo motivo del recurso de apelación del licenciado Roberto Madrigal Zamora, quien interpuso el recurso de apelación en favor de [Nombre2] . Se declaran con lugar los dos motivos de apelación interpuestos por la licenciada Nathalia Tencio Montenegro, Defensora Pública de [Nombre1] . En consecuencia, se anula parcialmente la sentencia impugnada, únicamente en cuanto a los extremos civiles de la misma, el resto del fallo permanece incólume, incluida la absolutoria penal en favor de ambos encartados. El Tribunal de reenvío decidirá acerca de la devolución de los bienes incautados. Notifíquese.
