WHEREAS:
I.The special litigation counsel for respondent Grupo Acón Sociedad Anónima appeals the ruling issued at diez horas cincuenta y dos minutos del diecinueve de setiembre del dos mil diecinueve, as regards the scope of the measure imposed on the plaintiffs requiring them to refrain from felling trees on the disputed land unless they have the corresponding permits, because he considers that this measure should be expanded to prohibit any act or omission tending to damage or destroy the forestry resource (recurso forestal) found at the site. This is because the bark could be stripped from the trees so that they dry out, thereby providing justification for felling them on the grounds that they pose a risk of falling; therefore, the exception to the prohibition on felling should be revoked, and there should be an absolute prohibition on felling or damaging the trees. (See appeal brief in file dated 23/09/2019 03:16:19).-
II.Among the obligations imposed on the parties to preserve the status quo and prevent alterations until this dispute is resolved, the challenged provisional measure affords special protection to the forestry resource by prohibiting the plaintiffs from felling trees on the disputed land unless they have the corresponding permits. The measure was granted with the protection of the forestry resource as its principal objective, and, consistent with this same approach to provisional protection, it is appropriate to modify the order issued to the plaintiffs so that they are prohibited not only from felling the forestry resource located on the property, but are also required to safeguard that resource by refraining from damaging its bark or otherwise deteriorating it so as to diminish its continued existence and subsequently exploit the resource. Neither party may do so, even with a forestry permit for its felling or exploitation, given the dispute over the property and because the forestry resource constitutes an immovable by destination (inmueble por destino), making it part of the dispute.
It should be noted that the purpose of the proceeding is to determine possession of the land (tenencia de la tierra); therefore, the nature of the property may not be changed by altering or modifying its contents, because the issue under consideration is who holds the right to it. The foregoing is ordered as an expansion of the provisional measures granted in the challenged ruling. These measures are provisional and may be modified if new circumstances so require.
III.In light of the foregoing, the challenged ruling shall be partially reversed solely insofar as it permits felling with the corresponding permits; instead, that possibility shall be eliminated and an absolute prohibition on felling shall be ordered. The measures imposed on the plaintiffs are expanded so that they are prohibited not only from felling the forestry resource located on the property, but are also required to safeguard that resource by refraining from damaging its bark or otherwise deteriorating it so as to diminish its continued existence. CONSIDERANDO:
I.El apoderado especial judicial de la accionada Grupo Acón Sociedad Anónima, apela la resolución de las diez horas cincuenta y dos minutos del diecinueve de setiembre del dos mil diecinueve, en cuanto al alcance de la medida que se dispuso a los actores para que éstos se abstuvieran de talar árboles dentro del terreno en litis, si no cuentan con los permisos correspondientes, pues considera esta medida debe ampliarse a la prohibición de toda acción u omisión tendiente al daño o destrucción del recurso forestal constatado en el sitio. Ello pues se puede dar la acción de desprender la corteza de los árboles para lograr que se sequen y así justificar la tala alegando peligro de caída, por lo que debe revocarse la condición liberatoria a la prohibición de talar, por lo que debe ser una prohibición absoluta de talar o dañar los árboles. (Ver escrito de apelación en archivo del 23/09/2019 03:16:19).-
II.La medida cautelar impugnada entre las obligaciones que se imponen a las partes para la conservación del estado de las cosas evitando modificaciones hasta tanto sea resuelto este conflicto, impone una especial medida de protección al recurso forestal, como lo es la prohibición a la parte actora de talar árboles dentro del terreno en litis si no cuentan con los permisos correspondientes.
