Proceeded before the Agrarian Court of the Second Judicial Circuit of San José.- FINDINGS OF FACT (RESULTANDO):

  1. 1The plaintiff instituted a summary possessory proceeding, requesting that the judgment declare: “1.- That I immediately be restored to possession of the real property that was taken from me. 2.- That my possession be maintained without any disturbance, with all legal attributes and safeguards. 3.- That the defendants be ordered to pay damages. 4.- That the defendants be ordered to pay the procedural costs and attorney’s fees of this proceeding. 5.- That the Subregional Directorate of the Ministry of Environment, Energy and Telecommunications in Puriscal, or alternatively the Tribunal Administrativo Ambiental, be instructed to conduct an on-site inspection (inspección in situ) of the environmental damage, in which case they must proceed as required by law. 6.- That the corresponding Order warn the trespassers that, should they fail to comply with the measures ordered, proceedings shall be instituted against them ex officio before the Ministerio Público for the offense of Disobedience to Authority (Desobediencia a la Autoridad)” (See Escritorio Virtual del Juzgado Agrario de San José, in Bandeja de Escritos, file dated 26/4/13 at 10:37:10 a.m.).-

The request that the Subregional Directorate of the Ministry of Environment, Energy and Telecommunications in Puriscal, or alternatively the Tribunal Administrativo Ambiental, be instructed to conduct an on-site inspection of the environmental damage and, in that event, proceed as required by law, is denied, since this is the responsibility of the plaintiff, who must undertake the corresponding administrative procedures.   4. 4Attorney María Fernanda Corrales Solís, in her capacity as agrarian public defender for the defendants, filed an appeal (recurso de apelación), expressly stating the grounds relied upon to challenge the trial court’s position (See Escritorio Virtual del Juzgado Agrario de San José, at [Dirección1], file dated 11/9/19 at 3:37:39 p.m.).-
  5. 5The statutory requirements have been observed in the conduct of the proceeding, and no errors or omissions capable of rendering the judgment null and void are apparent.-

Drafted by Judge Picado Vargas; and, CONSIDERATIONS (CONSIDERANDO)

I. The list of facts found to have been proven is adopted because it is consistent with the evidentiary record.-

II.Attorney María Fernanda Corrales Solís, in her capacity as agrarian public defender (defensora pública agraria) for the defendants, filed an appeal (recurso de apelación) together with a concurrent plea of nullity (nulidad concomitante), alleging only procedural errors, as follows: GROUNDS FOR NULLITY: 1.- The judgment is absolutely null and void because it violates the plaintiffs’ right of defense and due process, as it contravenes the legal system by failing to consider in its analysis the regulations related to Indigenous law. She cites ILO Convention 169 and states that the judgment is null and void for lack of reasoning because it is silent in that regard. She indicates that Indigenous reserves are inalienable and that the possessory proceeding (interdicto) cannot be analyzed solely under the mere requirements of “Western” agrarian regulations, but rather in accordance with the criteria of Indigenous tradition, since Indigenous property is collective and the body responsible for ordering and governing the property regime is the General Assembly of the Indigenous Territory. 2.- She alleges that the administrative remedies (vía administrativa) before the defendant Association itself should have been exhausted (See Virtual Desktop of the Agrarian Court of San José, at [Dirección1], file dated 11/9/19 at 3:37:39 p.m.).-

III.The appellant is incorrect regarding her first ground for nullity. Note that the argument repeatedly refers to a key word: property. A possessory proceeding is the summary proceeding (vía sumaria) in which current and immediate possession is examined, and any discussion or decision concerning property rights is prohibited pursuant to Article 457 of the Code of Civil Procedure, applied supplementarily in this matter predating October 8, 2018. The application of Indigenous regulations concerning property rights, whose absence the appellant criticizes, is appropriate for declaratory proceedings (proceso declarativo), since a possessory proceeding seeks social peace in the face of problems involving possession of land; accordingly, there is no lack of reasoning. Regarding possessory-injunction protection (tutela interdictal) in disputes involving Indigenous persons, this Court has held: “This Court has indeed recognized, in specific cases, the characteristics of Indigenous agrarian property rights and Indigenous agrarian possession rights (see, among many others, judgment 304-2006, at 8:00 a.m. on March 29, 2006).

But the protection established by the Indigenous Law itself does not mean that agrarian possession should not be protected as a mere fact of possession (independently of the right of property or possession, which non-Indigenous persons certainly cannot hold within ancestral territories). This is precisely because the agrarian possessory action (acción interdictal agraria) was created to prevent people from taking justice into their own hands, manu militari, by force or violence, since if everyone acted in that manner, chaos and situations of social and family violence would result. The dispute must be resolved by a third party (heterocomposición) through ordinary judicial channels, rather than by self-help resolution (autocomposición) through acts of force. Possessory proceedings are useful for providing legal certainty and maintaining social peace. Their protection is provisional while definitive property or possession rights are litigated in a broader proceeding, such as a declaratory proceeding.

Standing to bring the action (legitimación activa) is based simply and exclusively on mere current and immediate possession as a matter of fact. Its protection does not depend on any particular subjective status (it does not matter whether possession is in good or bad faith, whether it is lawful or unlawful, or whether the possessor is Indigenous or not), because the objective is to maintain social peace and prevent people from taking justice into their own hands. In that regard, the nineteenth-century legislature provided: ‘A possessor, of whatever class, is entitled to recover possession of which he has been improperly deprived, and once restored to it, shall be deemed, for purposes of prescription, not to have been dispossessed. Possession may not be taken violently, not even by the person legally entitled to it; while the current possessor objects, it must be claimed judicially’ (Article 317 of the Civil Code), and the following provision states: ‘To be restored to the enjoyment of a right, it is sufficient for the possessor to prove the fact of possession and that he was unlawfully deprived of it.’ All of the foregoing is consistent with Article 41 of the Political Constitution, which provides that, by resorting to the law, all persons shall obtain redress for their constitutional and treaty-based rights, but not by resorting to force, manu militari, or violence.

Regarding the possibility of resorting to an agrarian possessory action for possessory protection (protección posesoria), this Court has stated the following: ‘III.- The appellant’s arguments are correct. The settlement agreement (acuerdo conciliatorio) reached by the parties on October 31, 2012, is absolutely null and void because it is contrary to the Indigenous Law, which establishes that the administration of those territories corresponds to the Indigenous Reserves and that, furthermore, those lands have the characteristics of collective property. Consequently, in a possessory proceeding, in which the mere fact of possession is at issue, it is not feasible to dispose of definitive possession or property rights between private individuals, much less if they are not Indigenous, since that would be wholly contrary to Articles 1, 2, 4 5 of the Indigenous Law. What may properly be litigated is possession as a matter of fact, in order to maintain social peace and legal certainty.

In settlement agreements such as the one at issue here, the judge must consider not only the interests of the private parties, but also the existence of any collective rights or interests that could be affected and that receive special protection under special agrarian legislation; otherwise, rules of public interest would effectively be repealed through a private agreement (publicization (publicización)), which is wholly contrary to the Legal System.’ (Agrarian Court, judgment 1262-F-15, of December 4, 2015). In another ruling, this Court stated: ‘II.- Although national Indigenous regulations, as well as Convention 169 concerning Indigenous and Tribal Peoples in Independent Countries, ratified by Costa Rica, establish in Article 9 the principle of respect for the methods traditionally used by Indigenous peoples to resolve disputes arising among their members, that provision does not apply to this specific case.

The local government of each community has the authority to settle disputes arising among Indigenous persons from that same community. The dispute submitted through this possessory proceeding does not fall within that statutory circumstance because this action was filed by a non-Indigenous person. This may be preliminarily inferred from the personal details set out by the plaintiff himself in the complaint, in addition to the defendant’s statements in the answer appearing at folio 12, which indicate that Mr. [Nombre53] lacks standing to lease land within the Indigenous Reserve because only Indigenous persons are entitled to rights as possessors. In his answer, the defendant himself refers to the plaintiff’s non-Indigenous status, which the plaintiff did not dispute when responding at the respective hearing. Based on this circumstance, the cited Indigenous rule requiring the decision to be issued by the Indigenous local government represented by the Asociación Indígena Kekòldi would not apply to this possessory proceeding.

That Association intervenes to resolve disputes arising among Indigenous members of that community, but not litigation involving non-Indigenous persons, as in this case. Article 457 of the Code of Civil Procedure, applied supplementarily to agrarian matters by reference from Article 26 of the Agrarian Jurisdiction Law, provides: “Possessory proceedings shall be available only with respect to immovable property and shall in no way affect matters of ownership or definitive possession, concerning which no discussion whatsoever shall be permitted.” Note that this provision clearly establishes that the judgment in this possessory proceeding would in no way affect Indigenous property and possession rights, since it protects only current and immediate possession, whether lawful or not. Accordingly, the Indigenous government’s decision-making authority over the Indigenous territory would not be infringed, because the possessory judgment would produce only formal res judicata (cosa juzgada formal), not substantive res judicata (cosa juzgada material).’ (Voto 716-C-06 of July 12, 2016).” AGRARIAN COURT, Voto No. 1131-F-18 at 14:13 hours on December 19, 2018.

Consequently, the appealed judgment does not affect the Indigenous regulations invoked by the appellant, who confuses the mere fact of possession with the right of definitive possession and with the right of property; therefore, the nullity argument is unfounded. The first argument is rejected.-

IV.The second argument is likewise unfounded because, since the possessory proceeding concerns possession as a matter of fact and the Association itself is a defendant, there is no requirement to exhaust administrative remedies in this case; indeed, doing so could aggravate the factual situation presented, particularly because the possessory proceeding does not produce substantive res judicata or definitively resolve matters concerning property rights. The second ground for nullity is rejected, and the judgment under appeal is affirmed as to the matters appealed.-

Actúa como abogado director la misma parte actora en su calidad personal autenticando para sí mismo, el licenciado Guido Humberto Rojas Sánchez, carné diecisiete mil quinientos diecisiete; y como defensora pública agraria de los demandados la letrada [Nombre50] . Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de San José.-

RESULTANDO:

  1. 1La parte actora planteo proceso Interdictal para que en sentencia se declare: " 1.- Inmediatamente se me reponga la posesión del inmueble que me fue arrebatada. 2.- Se mantenga la posesión sin perturbación alguna con todos los atributos y garantías legales. 3.- Se condene a los demandados al pago de los daños y perjuicios. 4.- Se condene a los demandados al pago de las costas procesales y personales de este proceso. 5.- Se instruya a la Dirección Sub regional del Ministerio de Ambiente, Energía y Telecomunicaciones en Puriscal, o en su defecto, al Tribunal Administrativo Ambiental para que procedan a realizar inspección in situ de los daños ambientales, en cuyo caso, deben proceder conforme a derecho corresponda. 6.- En el Auto respectivo, advertir a los invasores que en caso de incumplimiento de las medidas acordadas, serán instruido de oficio ante el Ministerio Público por el delito de Desobediencia a la Autoridad" (Ver Escritorio Virtual del Juzgado Agrario de San José, en Bandeja de Escritos, archivo del 26/4/13 de las 10:37:10 a.m.).-
  2. 2Debidamente notificados los demandados, contestan en forma negativa la presente acción, e interpone las excepciones de falta de legitimación activa, legitimación pasiva, falta de identidad del bien, falta de interés actual y falta de derecho y caducidad. Mediante resolución de las catorce horas nueve minutos del treinta de octubre del dos mil trece, fueron declarados rebeldes [Nombre19] , [Nombre44] , [Nombre5] , [Nombre43] , [Nombre41] , [Nombre39] , [Nombre29] , [Nombre30] , [Nombre51] y [Nombre45] , (Ver Escritorio Virtual del Juzgado Agrario de San José, en [Dirección1] , archivo del 9/10/13 de las 12:56:23 p.m.).-
  3. 3La jueza Andrea Ruiz Ramírez, del Juzgado Agrario del Segundo Circuito Judicial de San José, mediante sentencia número 2019000142 de las siete horas y dos minutos del seis de setiembre de dos mil diecinueve, resolvió: "POR TANTO: SE DECLARA PARCIALMENTE CON LUGAR la presente demanda interdictal de AMPARO DE POSESIÓN Y RESTITUCIÓN planteado por [Nombre1] contra LA JUNTA DIRECTIVA DE LA ASOCIACIÓN DE DESARROLLO INTEGRAL DE LA RESERVA INDÍGENA DE QUITIRRISÍ DE MORA, representada por su Presidente con facultades de Apoderado General, [Nombre52] ; [Nombre2] ; [Nombre3] ; [Nombre4] ; [Nombre5] ; [Nombre6] ; LENIN BORBÓN SILES; FRANKLIN SILES SÁNCHEZ; JOSÉ ÁNGEL PÉREZ SERRANO; YORLENI MENA HERNÁNDEZ; MANUEL SERRANO MENA; FRESSY SÁNCHEZ SÁNCHEZ; MIGUEL PÉREZ SÁNCHEZ; AURORA HERNÁNDEZ PARRA; MAYELA UREÑA UREÑA; CARLOS MENA MENA; ROSA VÁSQUEZ MATA; OMARLEN VÁSQUEZ MENA; EMILCE VÁSQUEZ MENA; NIDIA VÁSQUEZ MENA, SILIAN VÁSQUEZ MENA, IVÁN VÁSQUEZ MENA, ANA ROBLES HERNÁNDEZ, ANGIE VÁSQUEZ MENA; ALEXIS MENA PARRA, IVANIA MARÍA MENA VÁSQUEZ, MANUEL VÁSQUEZ MENA; MARIA ELENA MENA MENA; ZORAIDAD SERRANO MENA; MARCO TULIO MARTÍNEZ MENA; MÓNICA MARTÍNEZ MENA; CARLOS ALEJANDRO VÁSQUEZ VÁSQUEZ; RAFAEL ÁNGEL MARÍN PÉREZ; BERNY MENA PÉREZ, ADRIAN JESÚS SANDI MARÍN; JUAN SERRANO MENA, ROSALINA SERRANO SÁNCHEZ, HEIDA HERNÁNDEZ PARRA ; RAFAEL VÁSQUEZ ROMÁN; LUIS MONGE MENA; CARLOS JAVIER ROBLES HERNÁNDEZ, JHONATAN SÁNCHEZ PÉREZ; WARNER SÁNCHEZ SÁNCHEZ; GAUDI PÉREZ SÁNCHEZ; EVELIN ORTIZ SÁENZ; WARNER QUIEL ORTIZ; DAMARIS PÉREZ SÁNCHEZ; ROMILIO SÁNCHEZ SERRANO ; GONZALO PÉREZ SERRANO; MARÍA AGRIPINA SILES SÁNCHEZ, [Nombre16] , y en consecuencia se acogen las pretensiones del actor y ordena:1) Firme esta sentencia se ordena reponer al actor en posesión del inmueble en litigio.2) Se ordena mantener al actor en posesión del inmueble que ha sido despojado sin perturbación alguna.3) Se condena a los demandados al pago de los daños y perjuicios ocasionados al actor, los cuales deberá ejecutar a través del proceso de ejecución de sentencia.4) Ambas costas son a cargo de la parte demandada; las personales se fijan en un diez por ciento sobre la estimación de la demanda, al litigado los demandados bajo el patrocinio de la defensa pública agraria.5) Se advierte a los demandados que en caso de incumplimiento de la presente sentencia serán remitidos al Ministerio Público para que sean procesados por el delito de Desobediencia a la Autoridad. En cuanto a que se instruya a la Dirección Sub regional del Ministerio de Ambiente, Energía y Telecomunicaciones en Puriscal, o en su defecto, al Tribunal Administrativo Ambiental para que procedan a realizar inspección in situ de los daños ambientales, en cuyo caso, deben proceder conforme a derecho corresponda, el mismo se rechaza, pues eso es función de la parte actora a quien corresponde hacer las gestiones administrativas que corresponda. Se rechazan las excepciones de falta de derecho, falta de interés, falta de legitimación activa, falta de legitimación pasiva y caducidad,” (Ver Escritorio Virtual del Juzgado Agrario de San José, en Documentos Asociados, archivo del 6/9/19 de las 7:02:15 a.m.).-
  4. 4La licenciada María Fernanda Corrales Solís, en su condición de defensora pública agraria de los demandados, interpuso recurso de apelación con indicación expresa de las razones en que se apoyaron para refutar la tesis del juzgado de instancia, (Ver Escritorio Virtual del Juzgado Agrario de San José, en [Dirección1] , archivo del 11/9/19 de las 3:37:39 p.m).-
  5. 5En la substanciación del proceso se han observado las prescripciones legales, y no se nota la existencia de errores y omisiones capaces de producir la nulidad del fallo.-

Redacta el juez Picado Vargas, y;

CONSIDERANDO

I. Se prohíja el elenco de hechos tenidos por demostrados por ser acordes al acervo probatorio.-

II.La licenciada María Fernanda Corrales Solís, en su condición de defensora pública agraria de los demandados, interpuso recurso de apelación con nulidad concomitando, argumentando solo agravios de forma en el siguiente sentido: MOTIVOS DE NULIDAD: 1.- La sentencia es absolutamente nula por cuanto viola el derecho de defensa de los actores y el debido proceso pues vulnera el ordenamiento jurídico porque no toma en cuenta para su análisis la normativa relacionada con el derecho indígena. Cita el Convenio 169 de la OIT y dice que la sentencia es nula por falta de fundamentación pues es omisa en ese sentido. Indica que las reservas indígenas son inalienables y que el interdicto no puede analizarse solos con los meros presupuestos de la normativa agraria "occidental" sino con los criterios de la tradición indígena ya que la propiedad indígena es colectiva y el órgano para ordenar y regir el régimen de la propiedad es la Asamblea General del Territorio Indígena. 2.-Alega que debió agotarse la vía administrativa ante la propia Asociación demandada (Ver Escritorio Virtual del Juzgado Agrario de San José, en [Dirección1] , archivo del 11/9/19 de las 3:37:39 p.m).-

III.Sobre su primer motivo de nulidad no lleva razón la recurrente. Nótese que el agravio habla continuamente de una palabra clave: propiedad. El interdicto es la vía sumaria donde se analiza la posesión actual y momentánea y está vetado discutir o decidir sobre el derecho de propiedad conforme al artículo 457 del Código Procesal Civil, aplicado supletoriamente en este asunto anterior al 8 de octubre del 2018. La aplicación que de la normativa indígena en cuanto al derecho de propiedad que echa de menos la recurrente es propia para un proceso declarativo, ya que el interdicto busca la paz social ante problemas en la posesión de la tierra, por lo que no existe falta de fundamentación. En materia de tutela interdictal en conflictos de personas indígenas ha establecido este Tribunal: "Ciertamente este Tribunal ha reconocido en casos concretos las características de los derechos de propiedad agraria indígena y los derechos de posesión agraria indígena (ver, entre muchas, la sentencia 304-2006, de las 8 horas del 29 de marzo del 2006).

Pero esa protección que establece la misma Ley Indígena, no significa que no deba ampararse la posesión agraria como mero hecho posesorio (independientemente del derecho de propiedad o de posesión, que ciertamente no pueden ostentar los no indígenas dentro de los territorios ancestrales). Porque justamente la acción interdictal agraria fue creada para evitar la justicia por mano propia, manu militari, a la fuerza, con violencia, pues si todas las personas actuaran de esa manera, se produciría un caos, situaciones de violencia social y familiar. Se impone la heterocomposición del conflicto, por las vías jurisdiccionales ordinarias, y no la autocomposición, por las vías de hecho. Los interdictos, son útiles para brindar seguridad jurídica y mantener la paz social. Su protección es provisional, mientras se discute en una vía más amplia, como puede ser la vía declarativa, los derechos de propiedad o de posesión definitivos.

La legitimación activa se basa, simplemente, en la mera posesión de hecho, actual y momentánea, únicamente. No depende de una particular condición subjetiva para su tutela (no importa si la posesión es de buena o de mala fe, si es legítima o ilegítima, si es en condición de indígena o no), porque lo que se busca es el mantenimiento de la paz social, y evitar que las personas se hagan justicia por su propia mano. En ese sentido, el legislador decimonónico dispuso: "El poseedor, de cualquier lase que sea, tiene derecho para reclamar la posesiónde que ha sido indebidamente privado, y una vez respuesto en ella, se considera para los efectos de prescribir,como si no hubiera sido desposeído. No podrá tomarse la posesión de una manera violenta, ni por aquel a quien legalmente corresponde; mientras el actual poseedor se oponga, debe reclamarse judicialmente" (artículo 317 Código Civil) y la norma siguiente indica: "Para ser restituido en el goce de un derecho, basta que el poseedor pruebe el hecho de la posesión y de haber sido privado de ella ilegalmente".

Todo lo anterior concuerda con lo dispuesto en el artículo 41 de la Constitución Política que establece que recurriendo a las Leyes todos encontrarán reparo de sus derechos constitucionales y convencionales, pero no recurriendo a la fuerza, manu militari, o a la violencia. En relación con la posibilidad de acudir a la acción interdictal agraria para la protección posesoria, este Tribunal ha indicado lo siguiente: "III.- Lleva razón el recurrente en sus agravios. El acuerdo conciliatorio a que llegaron las partes el día 31 de octubre del 2012, es absolutamente nulo, por ser contrario a lo dispuesto en la Ley Indígena, que establece que la administración de dichos territorios corresponde a las Reservas Indígenas y que, además, dichos terrenos tienen como características se propiedades colectivas. De ahí que no es factible a través de un proceso interdictal, en donde se discute el mero hecho de la posesión, disponer de derechos definitivos de posesión o propiedad, entre particulares, mucho menos si éstos no son indígenas, pues ello vendría en total contradicción con lo dispuesto en los artículos 1, 2, 4 5 de la Ley Indígena.

Lo que sí resulta factible es que se discuta la posesión de hecho, para mantener la paz social y la seguridad jurídica. En los acuerdos conciliatorios, como el que nos ocupa, el juez no debe solamente fijarse en el interés de los particulares, sino también la existencia de eventuales derechos o intereses colectivos que puedan verse afectados, y que tienen una tutela especial en la legislación especial agraria, pues de lo contrario, a través de un acuerdo privado se estarían derogando normas de interés público (publicización), lo que es totalmente contrario al Ordenamiento Jurídico." (Tribunal agrario, sentencia 1262-F-15, del 4 de diciembre del 2015) En otro voto, este Tribunal señaló: "II.- Si bien es cierto, la normativa indígena nacional, así como el Convenio 169 sobre Pueblos Indígenas y Tribales en Países Independientes, ratificado por Costa Rica, establece en su artículo 9 el principio sobre el respeto a los métodos a que los pueblos indígenas recurren tradicionalmente para la resolución de los conflictos surgidos entre sus miembros, tal disposición no es de aplicación a este caso concreto.

El gobierno local de cada comunidad tiene potestades para dirimir los conflictos que se susciten entre indígenas de su misma comunidad. El conflicto sometido en esta vía interdictal, no encaja dentro de ese supuesto normativo, porque este proceso ha sido interpuesto por un no indígena. Así se puede concluir indiciariamente por las calidades expuestas en el escrito de demanda por el mismo actor, además de lo manifestado por el demandado en la contestación a folio 12, en la que se indica que don [Nombre53] no está legitimado para arrendar tierras dentro de la Reserva Indígena, porque sólo a indígenas está reservado el derecho como posesionarias. El mismo demandado en su escrito de contestación, se refiere a la condición de no indígena del actor, lo cual no ha sido controvertido por éste al contestar la respectiva audiencia. Partiendo de esta circunstancia, no le sería de aplicación a este interdicto la norma indígena citada en cuanto a que su resolución sea emitida por el gobierno local indígena representado por la Asociación Indígena Kekòldi.

La intervención de esta Asociación lo es para la resolución de conflictos surgidos entre indígenas miembros de esa comunidad, no así para litigios entre no indígenas, tal y como ocurre en este caso. El artículo 457 del Código Procesal Civil aplicado supletoriamente a la materia agraria por remisión del artículo 26 de la Ley de Jurisdicción Agraria, establece: “Los interdictos sólo procederán respecto de bienes inmuebles y de ninguna manera afectarán las cuestiones de propiedad o de posesión definitiva, sobre las cuales no se admitirá discusión alguna”. Nótese esta norma es clara en establecer la sentencia de este interdicto en nada afectaría el derecho de propiedad y posesión indígena, pues solo se tutela la posesión actual y momentánea sea ésta ilegítima o no. De allí, no se estaría transgrediendo el poder de decisión del gobierno indígena en cuanto su disposición sobre el territorio indígena, pues la sentencia interdictal no produciría cosa juzgada material sino formal." (Voto 716-C-06 del 12 de julio del 2016)." TRIBUNAL AGRARIO, Voto No. 1131-F-18 de las14:13 horas del 19 de diciembre del 2018.

En consecuencia, la sentencia apelada no afecta la normativa indígena que invoca la recurrente, quien confunde el mero hecho de la posesión con el derecho de posesión definitiva y con el derecho de propiedad; por lo que el agravio de nulidad no tiene recibo. Se rechaza el primer agravio.-

IV.El segundo agravio tampoco es procedente, ya que al versar el interdicto sobre la posesión de hecho, y ser la propia asociación parte demandada, no cabe agotar la vía administrativa en este caso; por lo que más bien podría agravarse la situación de hecho presentada; máxime que el interdicto no produce cosa juzgada material ni resuelve en definitiva lo que al derecho de propiedad se refiere. Se rechaza el segundo motivo de nulidad y en lo apelado se confirma la sentencia venida en alzada.-

POR TANTO
