SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At sixteen hours and twenty-three minutes on the eleventh of October, two thousand nineteen.- SUMMARY POSSESSORY PROCEEDING brought by [Nombre1], of legal age, married, farmer, resident of Guanacaste, identity card number CED1 - -; against SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN TEMPISQUE (SINAC), legal entity identification number CED2 - -, represented by attorney Grettel Vega Arce, of legal age, married, economist, resident of Heredia, identity card number CED3 - -; and INSTITUTO DE DESARROLLO RURAL (INDER), legal entity identification number CED4 - -, represented by attorney Karen Hernández Segura, of legal age, single, attorney-at-law, identity card number CED5 - -, bar membership number nineteen thousand six hundred twenty-three. Heard before the Juzgado Agrario del Segundo Circuito Judicial de Guanacaste, Santa Cruz.- Judge FISHER GONZÁLEZ authors the decision; and,

CONSIDERING

I.The Juzgado Agrario del Segundo Circuito Judicial de Guanacaste (Santa Cruz), by order issued at seven hours and fifty-nine minutes on the twenty-ninth of August of the year two thousand nineteen, admitted an appeal against Judgment No. 134-2019, issued at ten hours and thirty-one minutes on the tenth of June, two thousand nineteen, which granted an atypical interim measure (medida cautelar atípica) requested by the plaintiff, and likewise forwarded the case file for consideration of the objection based on lack of subject-matter jurisdiction (excepción de incompetencia en razón de la materia) raised by the defendant (images 78 and 79 of the electronic case file viewed as a single PDF document).

II.This Court shall rule on the objection based on lack of subject-matter jurisdiction. In this regard, the defendant, SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN TEMPISQUE (SINAC), states that the Agrarian Courts lack jurisdiction to hear this matter “because doing so would violate the provisions of Article 108 of the Ley de biodiversidad, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the administrative litigation courts. In the present case, the conditions for the exceptions are not met; consequently, because this matter concerns a judgment against SINAC that, according to the plaintiffs’ claims, would lift restrictions on the use of real property imposed by environmental protection law and the protection of diffuse interests (intereses difusos), this jurisdiction entirely lacks competence” (answer shown in image 55 of the cited case file).

Upon analysis of the present matter, the dispute concerns possession (posesión) of the property belonging to Partido de Guanacaste, registration number [Placa1], registered in the name of Estado-Ministerio de Ambiente Energía y Telecomunicaciones as part of the State Natural Heritage (Patrimonio Natural del Estado), Parque Nacional Diriá (aerial photograph in image 60 and registry certification in image 67). Furthermore, although disputes between private parties in public-domain areas (zonas de dominio público) have sometimes been resolved in this forum, depending on the claims asserted in a proceeding, the fact remains that this dispute is against the State, through its decentralized agency SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN TEMPISQUE (SINAC). Specifically, this is a claim against that State entity, brought through a summary possessory proceeding, concerning a notice served on the plaintiff directing him to vacate voluntarily the area he possesses within Parque Nacional Diriá, under warning that criminal proceedings would be brought for unlawful occupation of State property (usurpación de bienes del Estado) (document in image 7).

The defendant is therefore correct that, pursuant to Article 108 of the Ley de Biodiversidad, jurisdiction over this matter lies with the Administrative Litigation Jurisdiction (Jurisdicción Contencioso Administrativa), because it is a dispute against the State concerning public-domain property (bien de dominio público).

III.In view of the foregoing, and pursuant to Articles 1, 2, and 16 of the Ley de Jurisdicción Agraria, this specialized forum does not have jurisdiction to hear this matter. Accordingly, the objection based on lack of subject-matter jurisdiction is sustained, and the case shall be transferred to the Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José so that it may, if it deems appropriate, hear the appeal filed against the order granting the interim measure (medida cautelar). This is because this judicial body does not find that there is extreme urgency requiring a final ruling on the measure in this forum, given that it was granted to the plaintiff; consequently, there are no grounds justifying a ruling on the appeal when this Court lacks jurisdiction.

THEREFORE

The objection based on lack of subject-matter jurisdiction is sustained, and the present matter shall be transferred to the Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José so that it may hear the appeal filed, if it deems appropriate.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas y veintitrés minutos del once de octubre de dos mil diecinueve.- PROCESO INTERDICTAL interpuesto por [Nombre1] , mayor, casado, agricultor, vecino de Guanacaste, cédula de identidad número CED1 - - ; contra SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN TEMPISQUE (SINAC); cédula jurídica número CED2 - - , representado por la licenciada Grettel Vega Arce, mayor, casada, economista, vecina Heredia, cédula de identidad número CED3 - - ; y INSTITUTO DE DESARROLLO RURAL (INDER), cédula jurídica número CED4 - - , representado por la licenciada Karen Hernández Segura, mayor, soltera, abogada, cédula de identidad número CED5 - - , colegiada número diecinueve mil seiscientos veintitrés. Actúa como abogado director de la parte actora, el licenciado Jose Gómez Hernández, carné catorce mil doscientos setenta; y como apoderado especial judicial del Sistema Nacional de Áreas de Conservación, (SINAC) el licenciado Róger Francisco Gutiérrez Vindas, colegiado número diecinueve mil trescientos veintinueve. Tramitado ante el juzgado Agrario del Segundo Circuito Judicial de Guanacaste, Santa Cruz.- Redacta la Jueza FISHER GONZÁLEZ y;

CONSIDERANDO

I.El Juzgado Agrario del Segundo Circuito Judicial de Guanacaste (Santa Cruz), en resolución de las siete horas y cincuenta y nueve minutos del veintinueve de agosto del año dos mil diecinueve; dispuso admitir recurso de apelación contra la sentencia No. 134-2019 de las diez horas y treinta y uno minutos del diez de junio del dos mil diecinueve que acogió una medida cautelar atípica gestionada por la parte actora, y de igual modo remitió el expediente para que se conociera la excepción de incompetencia en razón de la materia interpuesta por la parte demandada (imágenes 78 y 79 del expediente electrónico visualizado como documento único de PDF).

II.Este Tribunal procederá a resolver la excepción interpuesta por razón de la materia. En este sentido, la parte demandada SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN TEMPISQUE (SINAC). Se indica que los Tribunlaes Agrarios, no resultan competentes para conocer de este asunto "porque estaría en violación de lo dispuesto en el artículo 108 de la Ley de biodiversidad y mientras no exista una jurisdicción ambiental toda controversia será competencia exclusiva de la jurisdicción contenciosa administrativa. En el presente caso no se cumple los supuestos de las excepciones y en consecuencia al tratarse de asuntos cuya sentencia en contra del SINAC recaería según las pretensiones de los actores en levantar limitaciones al uso de los inmuebles impuestas por la ley de protección al ambiente y a los intereses difusos esta jurisdicción resulta totalmente incompetente" (contestación en imagen 55 del citado expediente).

Analizado el presente asunto, el conflicto versa sobre la posesión de la finca perteneciente al Partido de Guanacaste, matrícula [Placa1], inscrita a nombre del Estado-Ministerio de Ambiente Energía y Telecomunicaciones, como parte del Patrimonio Natural del Estado, Parque Nacional Diriá (fotografía aérea en imagen 60, certificación registral en imagen 67). Asimismo, aunque en ocasiones, dependiendo de las pretensiones de un proceso, se han dilucidado en esta sede conflictos entre particulares en zonas de dominio público, lo cierto es que esta controversia es contra el Estado, en el órgano desconcentrado SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN TEMPISQUE (SINAC). Y se trata propiamente de un reclamo frente a esa entidad estatal, en la vía interdictal, por un aviso comunicado al actor, para que desocupe en forma voluntaria el sector que posee, ubicado dentro del citado Parque Nacional Diriá, bajo apercibimiento de acudir a la vía penal por usurpación de bienes del Estado (documento en imagen 7).

De esta forma lleva razón la parte demandada, que al tenor del artículo 108 de la Ley de Biodiversidad corresponde conocer a la Jurisdicción Contencioso Administrativa este asunto, pues se trata de una controversia frente al Estado por un bien de dominio público.

III.En virtud de lo anteriormente expuesto, y conforme a los artículos 1 y 2 y 16 de la Ley de Jurisdicción Agraria no corresponde a esta sede especializada conocer de este asunto, de ahí que se acoge la excepción de incompetencia en razón de la materia y se disponga remitirlo al Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, para que proceda a conocer el recurso de apelación interpuesto contra la resolución que acogió la medida cautelar, si a bien lo tiene. Lo anterior porque no se observa por parte de este órgano jurisdiccional que exista extrema urgencia en resolver en definitiva en esta sede la medida, dado que le fue acogida a la parte actora, por lo que no existen razones que justifiquen se proceda a resolver el recurso sino es competencia de este Tribunal.

POR TANTO

Se acoge la excepción de incompetencia en razón de la materia y se dispone remitir el presente asunto al Tribunal Contencioso Administrativo y Civil de Hacienda del Segundo Circuito Judicial de San José, para que conozca del recurso de apelación interpuesto si a bien lo tiene.
