JUDGE [Nombre3] DRAFTS THE OPINION; and,
CONSIDERING:
III.The plaintiff appeals the decision issued by the Juzgado Agrario de Cartago, setting forth the following grounds for disagreement:
IV.The defendant filed a partial appeal (recurso de apelación parcial) against judgment number 2019000017, issued at diez horas treinta minutos on seis de mayo de dos mil diecinueve, solely insofar as it exempts the plaintiff from legal costs (costas) with respect to the defendant company Dulce Miel S.A. In this regard, it should be noted that the plaintiff misused a summary proceeding designed to protect factual situations, after he himself should have been reported, including criminally and before MINAE, as was demonstrated in the answer to the complaint. The plaintiff has lied and made false statements, without regard for the defendants’ reputation or for the interests of good-faith neighborly relations. Through this complaint, the plaintiff has sought to portray himself as a victim, when he is the one who has violated rules protecting property rights and natural resources. Exemption from costs is permitted on specific grounds, none of which is present here, since no good faith (buena fe) has been established.
On the contrary, the plaintiff has so little evidence for what he alleges that he brought into the proceeding a witness who has not visited the properties at issue for more than thirty years. Conversely, it was established that the defendant fulfills the social and ecological function of property (función social y ecológica de la propiedad) by enrolling its property adjoining that of the plaintiff in Environmental Services programs (programas de Servicios Ambientales). This summary possessory proceeding (interdicto) was filed as a means of intimidation and as part of a calculated strategy by the plaintiff to create the appearance of a superior right where he knows he has none, as well as to evade responsibility for other acts that should have been reported by the defendant’s representative before this proceeding, all of which was established by the documentary evidence in the case when the complaint was answered.
In light of the foregoing, I request that the challenged decision be reversed solely with respect to the plaintiff’s exemption from costs in favor of the defendant company, and that it be affirmed with respect to the award of costs against the plaintiff and in favor of Ms. [Nombre2] in her personal capacity, as well as in all other respects. This proceeding was clearly improper from the outset, and it must not be forgotten that exercising the right of action (derecho de acción) entails responsibility, as is true of every right, since the law does not protect abuse of rights (abuso del derecho) or their antisocial exercise (ejercicio antisocial) (see appeal, Bandeja de Escritos, added on 13/05/2019 at 10:30).
V.Pursuant to section 26 of the Agrarian Jurisdiction Law (Ley de Jurisdicción Agraria), the courts of this specialized jurisdiction are empowered, on their own initiative, to declare nullities (nulidades) and order proceedings to be repeated (reposición de trámites), in order to correct irregularities that could affect the validity of the proceedings and, likewise, where the law is silent, to apply labor legislation by analogy in the first instance. In that field, section 502 of the Labor Code (Código de Trabajo) provides: “Once the case record reaches the Superior Court on appeal, the Court shall first review the proceedings; if it finds that any formality capable of causing actual denial of a party’s right to defend itself has been omitted, it shall declare such proceedings or decisions null and void to the extent necessary to restore the normal course of the trial...” Since an appeal in cassation (recurso de Casación) in agrarian matters is not admissible on procedural grounds, except as stated regarding inconsistency (incongruencia), the Superior Court has even greater reason to oversee the proceedings and remedy any procedural defect or omission capable of denying a party’s right to defend itself or of disrupting the normal course of the proceedings.
In this case, the judgment contains elements that violate due process (debido proceso) and the right of defense (derecho de defensa), and it must therefore be declared null and void by this Court. Judgments must be clear, precise, and consistent. They must decide each and every issue in dispute (Article 54 of the Agrarian Jurisdiction Law and articles 153 and 155 of the Code of Civil Procedure (Código Procesal Civil)). In these proceedings, this Chamber finds that the appellant is correct, because the procedures and the right of defense were flagrantly violated, given that the legal system allows any person to apply to the Courts of Justice to resolve disputes, as provided in section 41 of the Political Constitution (Constitución Política): “By resorting to the laws, everyone shall obtain redress for injuries or damages suffered to their person, property, or moral interests. They must receive prompt and full justice, without denial and in strict accordance with the law.” In the case under review, the plaintiff resorts to the courts to resolve a dispute that has arisen with the adjoining landowner, in defense of what the claimant considers to be his property.
The substance of the right of defense and due process, as well as the Administration’s obligation to comply fully with those principles, follows from the relationship between articles 39 and 41 of the Political Constitution, for the benefit of persons subject to administrative authority (administrados), in relation to provisions issued by the Administration when they concern sanctions or may result in the elimination or restriction of individuals’ subjective rights (derechos subjetivos). The appellant is correct that the legal system permits him to bring a possessory action (acción interdictal), as regulated by both the former and current Code of Civil Procedure; in this Chamber’s view, the judge therefore avoids resolving the dispute for the reasons stated in the judgment. In substantive recital (considerando de fondo) VII, the judge ruled: “...VII.- ON THE MERITS OF THE MATTER AND THE DEFENSES RAISED: As stated in the third recital, the plaintiff alleges in his complaint that he devotes his property to conservation, carrying out protective activities so that Fonafifo will pay him incentives for environmental services.
He further alleges that, since purchasing the property four years ago, he has kept the same boundary clearings (carriles) cleared and well marked. The co-defendant company, for its part, also alleges that its property is devoted to conservation and enrolled in the payment for environmental services program (régimen de pago por servicios ambientales). During the judicial inspection (reconocimiento judicial), a boundary clearing was observed that is purportedly the actual boundary between the plaintiff’s property and the property of the co-defendant company Dulce Miel Sociedad Anónima. Simply by observing that boundary, it was impossible to determine how long that boundary clearing had existed; it could well have been opened a few months earlier, but it was impossible to venture that it had remained in that condition for years. The witness [Nombre4], a witness for the plaintiff, states that this boundary clearing has remained there for many years and that he cleared it when he was young; however, when questioned by the opposing party, he states that the last time he was at that location was approximately thirty years ago.
Accordingly, the undersigned judge does not find this witness’s testimony credible. It should be noted that the boundary clearing at issue, the one constructed by the plaintiff, is not visible from the road, meaning that only someone thoroughly familiar with its location could determine that a boundary clearing is located there. The plaintiff’s other witness, [Nombre6], for his part, gives somewhat confusing testimony, because he does not specifically refer to this boundary clearing but merely states that no new boundary clearings have been made on that property, without indicating the age of this one. He also acknowledges that, over the last two years, disputes have arisen regarding the location of boundary clearings in this southern sector of the plaintiff’s property. The co-defendant company, for its part, alleges that it marked its boundary clearings using GPS points, with the assistance of professionals in the field and MINAE officials.
Determining the age of the boundary clearing made by the plaintiff is extremely important because it is the only way to determine who had actual and immediate possession (posesión real y momentánea) of the disputed area (área en litis); once that circumstance is established, it will be possible to determine whether the co-defendants committed the alleged acts of disturbance (actos perturbatorios) by constructing the fence in question. Similarly, possession of land in a mountainous area can be proven only by marking that boundary, whether with boundary clearings, fences, boundary markers (mojones), or some other type of marking that clearly identifies it. For example, the construction of a boundary clearing would indicate to someone passing through the area that the clearing might logically be marking the boundary of a parcel of land; if it encloses land on all four sides, it is easy to infer that the clearing was made to mark that land clearly and thereby indicate that it is possessed or owned by someone.
Under the environmental regulations currently in force in the country, very few acts of possession (actos de posesión), other than marking a boundary clearing by whatever means, could be performed within a primary forest, where the aim is to protect and preserve forest resources. And this act of possession—the construction of a boundary clearing—is not intended to conserve the forest, but solely to mark the boundaries of a parcel of land and indicate to third parties that the land has a possessor or owner. In the case before us, the dispute presented to us, [Dirección1], concerning the plaintiff’s property, arises within an area of forest that appears to be primary forest and that is also enrolled in the payment for environmental services program, since we must not forget that both parties to the dispute allege that they receive payment for environmental services for their respective properties.
Thus, in this case, the boundary clearing constructed by the plaintiff as an act of possession was constructed to mark the boundary of his property—that is, to mark the boundary of the land he owns—and not to perform a possessory act (acto posesorio) intended to protect the natural forest resource. Consequently, the issue concerning the location of the boundary clearing—whether it is located where the plaintiff alleges or actually where the defendant indicates—is intended to resolve a matter of ownership. The foregoing is emphasized for the following reason. We must not forget that possessory proceedings (interdictos) are, by their nature, summary proceedings (proceso sumario); they are summary because such proceedings are intended to provide a rapid response to an extremely urgent problem that arises, as is the case with possessory actions. By their nature, possessory actions denote urgency and are filed because they require a rapid and urgent response from the adjudicating judicial body.
In agrarian matters, the urgency could arise from the need to harvest a coffee crop where the defendant prevents its harvest by closing access to the coffee plantation, or where a person claims to maintain a forested area as a forest reserve and a third party begins cutting trees in that forested area. In such cases, a possessory action would be more than appropriate, because assets at risk could disappear or be destroyed. In the case before us, there is no danger that the forest resource or any other asset will be destroyed; therefore, deciding where the disputed boundary clearing is located is not intended to protect the forest, but solely to define the boundaries of the plaintiff’s property. It must be considered that both the plaintiff and the defendant allege that the disputed area is enrolled in the payment for environmental services program with Fonafifo, meaning that the forest resource is not in any danger.
Furthermore, the need to establish the boundary clearings arises because Fonafifo requires, as a condition for payment for environmental services, that the boundary clearings of the property receiving those benefits be clearly marked. It is important to reiterate and emphasize that there is no urgency of any kind that would lead the undersigned judge to consider it necessary to grant the plaintiff possession of the disputed area as a matter of urgency; likewise, it would be immaterial if the defendant were to remain in possession of that area, because there is no legally protected interest (bien jurídico) requiring urgent protection through this possessory action. At bottom, the sole objective of the action filed is to decide a matter of ownership by determining which boundary clearing is supposedly the true one, in the sense that it marks the actual boundary between the plaintiff’s property and the defendant’s property.
Based on all the foregoing, the undersigned judge finds that, in this case, a possessory action is not the proper avenue for resolving the dispute brought by the plaintiff against the co-defendant Dulce Miel Sociedad Anónima, and the complaint filed against that co-defendant company must therefore be dismissed. Similarly, the complaint filed against [Nombre2] in her personal capacity—to be redundant—is dismissed not for the reasons stated above, but because the plaintiff failed to prove that [Nombre2] had ordered the placement of the fence at issue; accordingly, she lacked standing as a defendant (legitimación pasiva). It should be noted that, in her answer, she acknowledges that, while acting on behalf of Dulce Miel, she ordered the fence to be installed, but she never acknowledges having done so on her own initiative; rather, she always acted as the representative of Dulce Miel, which, moreover, owns the property where the boundary dispute arose.
Consequently, with respect to the complaint filed against Dulce Miel Sociedad Anónima, the defense of lack of a legal right (excepción de falta de derecho) is sustained; no ruling is issued on the remaining defenses because of the manner in which this dispute has been decided, and the complaint is dismissed in all respects and as to all relief requested. With regard to the damages (daños y perjuicios) claimed in the fourth prayer for relief, they are denied because possessory proceedings are intended to adjudicate matters of current and immediate possession, and recovery of damages is improper in such proceedings, an ordinary proceeding (vía ordinaria) being the appropriate avenue for that purpose. The complaint against Dulce Miel Sociedad Anónima is decided without a special award of costs (especial condenatoria en costas).
With respect to the complaint filed against [Nombre2], the defense of lack of passive standing (excepción de falta de legitimación pasiva) is sustained, and consequently, the complaint filed against her is dismissed in all respects. In the case of [Nombre2], the plaintiff is ordered to pay her both the legal costs and attorneys’ fees (ambas costas) of this action. Likewise, no ruling is made regarding the other defenses raised by [Nombre2], as doing so is unnecessary.” This Chamber finds that due process (debido proceso) and the right of defense (derecho de defensa) have been violated, because the argument stated in the judgment—that this is a matter for ordinary proceedings (vía ordinaria)—is untenable, as is the omission of a ruling on the prerequisites for the possessory action (acción interdictal), since a determination regarding current and immediate possession is being sought through possessory proceedings (vía interdictal).
Nor does this Chamber agree that possessory proceedings do not permit a ruling on the recovery of damages (daños y perjuicios), since that position is inconsistent with the provisions of subsection 106.5 of the Código Procesal Civil in force at the relevant time and Article 461 of the former Código Procesal Civil in force on the date these proceedings commenced. In this Chamber’s view, this requires the trial judge’s decision to be vacated, because this matter must be decided on the merits (por el fondo) in these proceedings as requested, and substantial omissions are evident which, if remedied at this level, would entail a ruling at a single instance (única instancia). The duty to administer justice must not be exercised to the detriment of the form—and also the substance—of judgments, which safeguard due process and the opportunity for legal representation (defensa técnica). In light of the foregoing, this Chamber finds that the relief sought must be adjudicated by determining whether the complaint should be sustained or dismissed and by analyzing, based on the evidence (probanzas), the prerequisites for the action at issue. Based on the foregoing, the judgment rendered is hereby vacated.
THEREFORE:
The judgment under appeal is annulled.

RESULTANDO:
REDACTA EL JUEZ [Nombre3] ; y,
CONSIDERANDO:
III.La parte actora interpone recurso de apelación contra la resolución dictada por el Juzgado Agrario de Cartago exponiendo los siguientes motivos de inconformidad:
IV.La parte demandada interpuso recurso de apelación parcial en contra de la sentencia numero 2019000017, dictada a las diez horas treinta minutos del seis de mayo de dos mil diecinueve, únicamente en el tanto esta exime de costas a la parte actora respecto de la sociedad demandada Dulce Miel S.A. Al respecto debe notarse que el actor abusó de un proceso sumario diseñado para tutelar situaciones de hecho. luego de haber sido el mismo quien debió ser denunciado incluso penalmente y ante el MINAE. como se demostró desde la contestación de demanda. EI actor ha mentido, ha dicho cosas falsas, sin respeto a la imagen de las demandadas ni de interés para la buena fe vecinal. Lo que el actor ha hecho con esta demanda es buscar colocarse en una situación de víctima cuando es el mismo quien ha irrespetado normativa que protege el derecho de propiedad y los recursos naturales. La exención en costas tiene causas especificas y no se esta ante ninguna de ellas, dado que no hay buena fe acreditada, por el contrario, tanta falta tiene de prueba de 10 que dice el actor que trae al proceso un testigo que no va a las fincas en Litis desde hace mas de treinta anos.
Por el contrario, se acreditó que la demandada cumple con la función social y ecológica de la propiedad al someter su fundo colindante con el del actor a programas de Servicios Ambientales.Este interdicto se presentó como una técnica de intimidación, y como parte de una estrategia calculada de la parte actora para aparentar mejor derecho donde sabe que no tiene, así como para evadir responsabilidad por otros actos que debieron ser denunciados por la representante de la demandada antes de este proceso, todo lo que se acreditó con la documental del caso desde que se contestó la demanda. Conforme a lo anterior solicito se revoque la resolución recurrida únicamente en lo que respecta a la exención de costas a cargo del actor y a favor de la sociedad demandada, debiendo confirmarse en lo que respecta a la condenatoria en costas a cargo del actor y a favor de la señora [Nombre2] a titulo personal y en todos los demás extremos, siendo este proceso claramente improcedente desde un inicio, no debiendo olvidarse que el ejercicio del derecho de acción conlleva una responsabilidad, tal como ocurre con todo derecho, siendo que la ley no ampara el abuso del derecho ni el ejercicio antisocial de este (ver recurso de apelación Bandeja de Escritos agregado el 13/05/2019 a las 10:30).
V.Conforme al ordinal 26 de la ley de Jurisdicción Agraria, los Tribunales en esta sede especializada están facultados por iniciativa propia para declarar nulidades y disponer la reposición de trámites, a fin de corregir irregularidades que pudieren afectar la validez del proceso e igualmente ante el silencio de la ley para aplicar por analogía en primer lugar la normativa de la legislación laboral. En esta disciplina el numeral 502 del Código de Trabajo dispone que: "Una vez que los autos lleguen en apelación, ante el Tribunal Superior éste revisará, en primer término, los procedimientos; si encontrare se ha omitido alguna formalidad capaz de causar efectiva indefensión a alguna de las partes, decretará la nulidad de actuaciones o de resoluciones que proceda hasta donde sea necesario para orientar el curso normal del juicio...". En virtud de que el recurso de Casación en materia agraria no es admisible por razones de forma, con excepción de lo dicho por incongruencia, el Tribunal Superior con mayor razón debe ser un contralor de los procedimientos y proceder a subsanar cualquier defecto u omisión procedimental capaz de causar indefensión a alguna de las partes o para orientar el curso normal de los procedimientos. .
En este caso el fallo contiene aspectos que hacen se violente el debido proceso y el derecho de defensa, lo cual hace la nulidad del mismo se deba declarar en esta sede. Las sentencias deben ser claras, precisas y congruentes. Deben resolver todos y cada uno de los puntos objeto del debate (Artículo 54 de la Ley de Jurisdicción Agraria y artículos 153 y 155 del Código Procesal Civil). En el presente proceso considera esta cámara lleva razón el apelante dado se violenta de manera grosera los procedimientos y el derecho de defensa por cuanto el ordenamiento jurídico le permite a cualquier persona acudir a los Tribunales de Justicia a resolver sus conflictos según lo dispone el ordinal 41 de la Constitución Política " Ocurriendo a las leyes, todos han de encontrar reparación para las injurias o daños que hayan recibido en su persona, propiedad o intereses morales. Debe hacérseles justicia pronta, cumplida, sin denegación y en estricta conformidad con las leyes.".
En el caso bajo examen el actor recurre a la vía jurisdiccional para que se le resuelva un conflicto que se ha generado para con su colindante en defensa de lo que el accionante considera de su propiedad. El contenido del derecho de defensa y el debido proceso, así como la obligación de la Administración de dar un cabal cumplimiento a tales principios, se derivan de la relación de los artículos 39 y 41 de la Constitución Política en beneficio de los administrados, frente a las disposiciones de la Administración, cuando éstas, se refieran a materia sancionadora o puedan desembocar en la supresión o restricción de derechos subjetivos de las personas. Lleva razón el recurrente en cuanto a que el ordenamiento jurídico le permite plantear una acción interdictal según lo regula el Código Procesal Civil anterior como el actual, por lo que a criterio de esta Cámara el juez rehuye resolver el conflicto según los argumentos que da en el fallo.
En el considerando de fondo identificado VII, el juez resuelve: "...VII.- SOBRE EL FONDO DEL ASUNTO Y EXCEPCIONES OPUESTAS: Tal y como se indicó en el considerando tercero, el actor en su demanda señala que su finca la dedica a la conservación, realizando actos de protección con el fin de que se le paguen incentivos por servicios ambientales por parte de Fonafifo. Y que desde que compró la finca, hace cuatro años, ha mantenido los mismos carriles limpios y bien demarcados. Por su parte la sociedad co - demandadas también alega tener la finca destinada a la conservación y sometida al régimen de pago por servicios ambientales. Al momento del reconocimiento judicial, se pudo constatar un carril que se supone es el lindero real entre el inmueble del actor y el inmueble de la sociedad codemandada Dulce Miel Sociedad Anónima. De la simple observación de dicho lindero, era imposible determinar la antiguedad de dicho carril, que bien podía tener unos meses de abierto pero imposible aventurar que tuviera años en tal estado.
El testigo [Nombre4] , testigo del actor, señala que ese carril se ha mantenido allí por muchos años, y que el lo limpió cuando era joven, sin embargo ante pregunta de la contraparte manifiesta que la última vez que estuvo en ese lugar fue hace unas treinta años; de manera que la declaración de este testigo no le merece fe al suscrito juzgador. Hay que indicar que el carril de marras, el construido por el actor, no es visible desde el camino, de manera que solo alguien que conoce muy bien la ubicación de dicho carril puede determinar que allí se encuentra un carril. Por su parte el otro testigo del actor, [Nombre6] , hace una declaración un poco confusa, pues no se refiere a este carril concretamente, sino que indica solamente, que en esa finca no se han hecho carriles nuevos, pero no indica la antigüedad de ese carril. Por otra parte reconoce que en los últimos dos años, han habido problemas por ubicación de los carriles en este sector sur de la finca del actor.
Por su parte, la sociedad codemandada alega que ellos han demarcado sus carriles con puntos GPS con la ayuda de profesionales en la materia y con funcionarios del Minae. La determinación de la antigüedad del carril hecho por el actor, es de suma importancia, pues es la única manera de poder determinar quién ha estado en posesión real y momentánea del área en litis, de manera que al determinarse tal situación podrá concluirse si las co demandadas cometieron los actos perturbatorios alegados con la construcción de la cerca dicha. En el mismo orden de ideas, demostrar la posesión de un terreno en un área de montaña, solo es posible demostrarlo demarcando dicho lindero, ya sea con carriles, cercas, mojones o algún tipo de marcas que permita su demarcación claramente. Por ejemplo, la construcción de un carril indicaría a una persona que pase por el lugar, que dicho carril podría estar demarcando, lógicamente, el lindero de un terreno, si ese carril encierra por cuatro lados un terreno es fácil deducir que dicho carril se realizó para demarcar claramente dicho terreno e indicar así que esta en posesión o es propiedad de alguna persona.
De conformidad con la normativa ambiental vigente en el país, muy pocos actos de posesión, además de la demarcación de un carril (por los medios que sea) se podrían hacer dentro de un bosque primario, donde lo que se busca es la protección del recurso forestal y su preservación. Y este acto de posesión, la construcción de un carril, no lleva como fin la conservación del bosque, sino únicamente demarcar los linderos de un terreno, para indicar a terceros que ese terreno tiene un poseedor o un propietario. En el caso que nos ocupa, el conflicto que se nos presenta, [Dirección1] , del inmueble del actor, el conflicto se presenta dentro de un área de bosque que en apariencia es primario y que además se encuentra sometido al pago por servicios ambientales, pues no debemos olvidar que ambas partes en conflicto alegan estar recibiendo el pago por servicios ambientales en sus respectivos inmuebles.
De manera que en este caso el carril construido, por el actor, como acto de posesión se construyó con el fin de demarcar el lindero de su finca, o sea para demarcar el lindero de su propiedad y no con el fin de realizar un acto posesorio tendiente a la protección del recurso natural bosque. De manera que el problema de la ubicación del carril, en cuanto a si se ubica donde alega el actor, o si realmente se ubica donde indica la parte demandada, lo que busca es resolver un asunto de propiedad. Y se recalca lo anterior por la siguiente razón. No debemos olvidar que la naturaleza de los interdictos, es ser un proceso sumario; y es sumario debido a que se supone que los procesos sumarios buscan dar respuesta rápida a un problema muy urgente que se suscite, tal es el caso de las acciones interdictales. Las acciones interdictales, en razón de su naturaleza, son acciones que denotan urgencia, y que son interpuestas porque requieren de una respuesta rápida y urgente del órgano judicial decisor.
En materia agraria la urgencia podría provenir de la urgencia de recolectar una cosecha de café y la parte demandada impide tal recolección, (cerrando los accesos a la plantación de café) también en el caso de que una persona alegue tener un área de bosque como reserva forestal y un tercero inicie una corta de árboles en esa área de bosque. En estos casos la acción interdictal sería más que procedente, púes hay bienes en peligro que podrían desaparecer o ser destruidos. En el caso que nos ocupa, no hay peligro de destrucción del recurso forestal, ni de ningún otro bien, de manera que decidir donde va la ubicación del carril en conflicto no procura la protección del bosque, únicamente procura que se defina los límites de la propiedad de la parte actora. Hay que tomar en cuenta que tanto la parte actora, como la parte demanda, alegan que el área en conflicto esta sometida al pago de servicios ambientales con Fonafifo, de manera que el recurso forestal no corre peligro alguno; por otra parte la necesidad de establecer los carriles obedece a que el Fonafifo establece como requisito para el pago de servicios ambientales, que los carriles del inmueble que tienen dicho beneficios estén claramente demarcados.
Es importante recalcar y enfatizar que no hay ningún tipo de urgencia para que él suscrito juzgador considere urgente dar en posesión el área en litis a la parte actora, de igual manera carecería de importancia si la parte demandada quedará en posesión del área en litis, pues no hay un bien jurídico urgente de tutelar mediante la presente acción interdictal, pues en el fondo lo único que se persigue con la acción interpuesta es que se defina un asunto de propiedad al definir cual carril es el supuestamente verdadero, en el sentido de que demarca el verdadero lindero entre el inmueble de la parte actora y el inmueble de la parte demandada. De conformidad con todo lo expuesto, considera el suscrito juzgador que una acción interdictal, en este caso, no es la vía correcta para resolver el conflicto que plantea la parte actora contra la codemandada Dulce Miel Sociedad Anónima, y por ello deberá declararse sin lugar la demanda planteada contra la sociedad codemandada.
En el mismo orden de ideas, la demanda planteada contra [Nombre2] , en su carácter personal (valga la redundancia) no se rechaza por la razones anteriormente apuntadas sino porque la parte actora no acreditó que [Nombre2] hubiera ordenado la colocación de la cerca en litis, de manera que no se configuró la legitimación pasiva en contra de su persona. Nótese que en la contestación ella reconoce que actuando en representación de Dulce Miel ordenó colocar dicha cerca, pero nunca reconoce haberlo hecho por iniciativa propia, sino que siempre lo hizo como representante de Dulce Miel, que por demás es la propietaria de la finca donde se suscita el conflicto de linderos. En consecuencia y con relación con la demanda planteada contra Dulce Miel Sociedad Anónima se acoge la excepción de falta de derecho, omitiéndose pronunciamiento con respecto a las restantes excepciones por la forma en que se resolvió este conflicto, y se declara sin lugar la demanda en todos sus extremos petitorios.
Con relación a los daños y perjuicios cobrados en la petitoria cuarta, los mismos se rechazan pues la vía interdictal es para conocer asuntos de posesión actual y momentánea, y el cobro de daños y perjuicios es improcedente en esta vía, siendo la vía ordinaria la vía idónea para ello. La demanda en contra de Dulce Miel Sociedad Anónima se falla sin especial condenatoria en costas. Con relación a la demanda planteada contra [Nombre2] se acoge la excepción de falta de legitimación pasiva, y por ende se declara sin lugar en todos sus extremos petitorios la demanda contra ella planteada. Se condena al actor, en el caso de [Nombre2] , a pagarle ambas costas de esta acción. De igual manera se omite pronunciamiento con respecto a las demás excepciones planteadas, por [Nombre2] , por ser innecesario.". Considera esta Cámara se violenta el debido proceso y el derecho de defensa, por cuanto no es atendible el argumento vertido en el fallo, de que se trata de un asunto de la vía ordinaria , y se omita pronunciamiento sobre los presupuestos de la acción interdictal, pues se está pidiendo se resuelva sobre la posesión actual y momentánea a través de la vía interdictaL.
Tampoco se comparte que en la vía interdictal no proceda pronunciarse sobre el cobro de daños y perjuicios, pues ello no es acorde a lo preceptuado en el ordinal 106.5 del Código Procesal Civil vigente a la fecha y el artículo 461 del anterior Código Procesal Civil vigente a la fecha de inicio de este proceso. Ello a criterio de esta Cámara hace se deba anular lo resuelto por el juzgador por cuanto debe de resolverse por el fondo este asunto en esta vía tal y como se ha peticionado, y se evidencian omisiones sustanciales que de subsanarsen en esta sede, implicaría un pronunciamiento en única instancia. La misión de administrar justicia no debe ir en detrimento de las formas -y también la sustancia- de las sentencias, que garantizan el debido proceso y la posibilidad de defensa técnica. En razón de lo anterior considera esta Cámara, debe procederse a resolver lo peticionado, indicando si se acoge o no la demanda, analizando los presupuestos de la acción que nos ocupa con base en las probanzas. Partiendo de lo señalado se procede a anular la sentencia dictada
POR TANTO:
Se anula la sentencia venida en alzada.
