Judge Díaz Bolaños drafts the decision; and,
WHEREAS:
I.The decision issued at 14 hours 59 minutes on 04 de julio de 2019, which denied the precautionary measure requested by the plaintiff, is appealed. This appears in the virtual case file of the Agrarian Court of San Carlos, in PDF format, images 136 to 142. The appeal is signed by attorney Ricardo González Mora, acting as special litigation counsel for plaintiff [Nombre1], the commercial company Doble a Noventa y Cinco Sociedad Anónima—hereinafter referred to as Doble A—[Nombre2], and [Nombre4]. He raises the following grounds of appeal: 1. It follows from the contract giving rise to the main proceeding that the parties signed a private de facto partnership agreement (acuerdo de sociedad de hecho), as well as an agreement to investigate possible environmental damage (daño ambiental) and restore the property, on 06 de enero de 2019. 2. Under those contracts, [Nombre3] and the persons represented by him, [Nombre1], [Nombre2], and [Nombre4], agreed to form a de facto partnership (sociedad de hecho) and to distribute the work and its profits.
He states that part of the obligations of the persons he represents was to contribute ¢40.000.000 together with the resources needed to recover recoverable waste (desechos valorizables) from the estate within no more than three months from the signing of that document. He argues that possession of the property is plainly an indispensable requirement for recovering that waste and generating the resources necessary to meet the essential financial obligations under the agreement. 3. He explains that codefendant [Nombre3] hired the commercial company Doble A to conduct studies and investigations into environmental damage and environmental impact (impacto ambiental) on the property at issue. It was also hired to manage the property until its restoration for agricultural, aquaculture, livestock, tourism, and mining purposes. He contends that managing the property plainly entails possessing it; therefore, since the aforementioned company would manage the property, such possession was thereby being agreed upon.
He asks the Court to note that the contract price and payment for its services would be covered through a percentage of the recoverable waste extracted from the estate, which, in his view, means that possession would be entrusted to the persons he represents. 4. He refers to the agreement to indicate that it was stipulated that the property’s operating and administrative expenses would be generated from production through the recovery of the waste, that both principal and interest on the mortgage would be paid, and that [Nombre3] would thereafter be reimbursed for his original investment in purchasing the property. He emphasizes that, from that moment onward, his principals exercised possession of the parcel and began carrying out the activities contemplated in the contract. The aforementioned [Nombre3] never directly exercised possession or performed the activities contemplated in the agreements. 5.
During performance of the contract, the aforementioned codefendant changed his position and specifically stated that he was unwilling to allow the appellants to continue in possession. This change in attitude prompted the application for the precautionary measure. 6. He states that the persons he represents have possessed the property since January of the current year. He explains that they have cared for the parcel, cleared vegetation, repaired fences and roads, and provided protection to prevent encroachments and stop persons from carrying out illegal or unauthorized activities. He notes that the precautionary measure seeks to keep them in possession of the land so that they may continue performing the activities contemplated in the contracts. If it is denied, he believes they will be unable to fulfill the obligations undertaken in the agreements and will lose all rights derived therefrom. 7.
The contracts were submitted into the record to prove the administration and management of the property and the restoration work being performed on the parcel by the aforementioned company. For that reason, he emphasizes, exercising possession is necessary. 8. He refers to the environmental impact study (estudio de impacto ambiental), the report on the current human-health situation, the progress report on identified conditions, the biodiversity law, and the operational and financial reports. All this evidence demonstrates performance of the work for which Doble A was hired, because it concerns conditions specific to the property, which, he reiterates, has been in the possession of his principals. 9. To protect the possession exercised by that group, they have requested that the aforementioned [Nombre3] be ordered to refrain from acts intended to disturb or dispossess them of the possession they hold, subject to criminal-law warnings.
This is because the contracts executed by the parties are valid and are being performed. He reiterates that the persons he represents have fulfilled the obligations arising from the agreement and still have time to fulfill the remainder; he asks that the agreement be honored. 10. A disagreement arose between the parties, and the persons he represents are now being prevented from continuing in possession and performing the agreement. 11. He points out that if the persons he represents are dispossessed of the property and deprived of their occupancy (tenencia), they will be unable to continue performing the contract or to honor their obligations. He speculates that [Nombre3] intends to remove them from the property so as to prevent performance before the deadline expires, retain the property, and benefit from the payments made by the persons he represents toward the mortgage encumbering it. 12.
As a ground of appeal, he argues that the lower court focuses solely on livestock activity, disregarding the parties’ intent when they signed the contracts, which was to restore protected areas and environmental conditions such as rivers and wetlands through the extraction and removal of waste contaminating the property. He argues that the agreements have a plainly environmental purpose involving the restoration of the aforementioned ecosystems. He insists that this concerns not only livestock activity or the existence of an organized production cycle, but also an environmental matter of public interest in an area affected by the unlawful activities of third parties who have seriously damaged that environment and its ecosystems. He recounts the challenged decision’s findings regarding the absence of production. He questions whether the claim is appropriate for environmental matters, environmental restoration, decontamination of rivers and wetlands, and restoration of a protected area.
Yet it is denied based on a highly restrictive view of the subject matter of the proceeding. 13. He characterizes the analysis in the appealed decision as only a partial examination of the requirements for the requested atypical precautionary measure (medida cautelar atípica). The requirement of residuality (residualidad) is accepted, but the appearance of a valid legal claim (apariencia de buen derecho) is found to be absent. Nevertheless, in the same decision, within only a few lines, the signing of the contract is deemed established; he clarifies that there are two agreements, including the management of the estate to adapt it for agricultural, aquaculture, livestock, tourism, or mining activities, and that, under the contract, such management is precisely what Doble A must perform. He maintains that this establishes the appearance of a valid legal claim concerning the request to remain in possession of the property.
Moreover, he states that [Nombre3] has expressed his intention to dispossess them and reiterates that, if this occurs, they will be unable to perform the contract. He argues that there is a risk arising from delay (peligro en la demora) if the agreed work is not performed and that they must meet their financial obligations to avoid losing their rights. He requests that the appealed decision be reversed and that the requested precautionary relief be granted in its place (frames 178 to 185).
II.In this matter, an ordinary civil action (demanda ordinaria) was filed seeking the following: “That, in accordance with what was expressly agreed in the PRIVATE DE FACTO PARTNERSHIP AGREEMENT (CONTRATO PRIVADO DE ACUERDO DE SOCIEDAD DE HECHO) and also in the CONTRACT FOR THE INVESTIGATION OF POSSIBLE ENVIRONMENTAL DAMAGE AND RESTORATION OF THE PROPERTY (CONTRATO PARA INVESTIGACIÓN DE POSIBLE DAÑO AMBIENTAL Y RESTAURACIÓN DE FINCA), both dated 6 de enero del año dos mil diecinueve, the conditions stipulated by the parties in those contracts having been met, it shall be declared that the real property located in the Province of Alajuela, Canton of San Carlos, [Dirección1], recorded under real-property folio registration number [Placa1], subregistrations [Placa2], [Placa3] and [Placa4], is owned by the company DOLBE A NOVENTA Y CINCO S.A, legal-entity identification number CED8- -, and consequently shall be registered in the name of that company.
In the event of opposition, the opposing party shall be ordered to pay both categories of litigation costs (costas del proceso)” (emphasis in the original text in image 20). In the alternative, the following was requested: “That, in accordance with what was expressly agreed in the PRIVATE DE FACTO PARTNERSHIP AGREEMENT and also in the CONTRACT FOR THE INVESTIGATION OF POSSIBLE ENVIRONMENTAL DAMAGE AND RESTORATION OF THE PROPERTY, both dated 6 de enero del año dos mil diecinueve, the conditions stipulated by the parties in those contracts having been met, it shall be declared that the real property located in the Province of Alajuela, Canton of San Carlos, [Dirección1], recorded under real-property folio registration number CED9, subregistrations [Placa5] and [Placa4], shall be registered in the name of a corporation in which the partners of the de facto partnership (sociedad de hecho)—that is, the plaintiffs in these proceedings—shall hold equal ownership interests, and consequently the property shall be registered either in the name of that company or personally in the names of the partners.
In the event of opposition, the opposing party shall be ordered to pay both categories of litigation costs” (frames 20 to 21). In their statement of facts, the plaintiffs state that they entered into a contract with the defendant for the purpose of establishing a de facto partnership and agreeing upon the allocation of work and the profits from that work. For those purposes, the defendant [Nombre3] purchased the property at issue (finca objeto de litis) with his own funds for ¢80.000.000. Upon completion of the sale, ¢40.000.000 was paid, and the balance was to be paid by the plaintiffs within three months; a mortgage (hipoteca) was provided as security. The defendant also retained the company Doble A to conduct studies and an investigation into environmental damage and environmental impact (impacto ambiental), as well as to manage the property. Payment under that agreement was to be made from a percentage of the proceeds from extracting recoverable waste (desechos valorizables) obtained from that property, with the remainder being distributed among the parties.
In addition, a portion of the funds would be used to reimburse the defendant for his original investment in purchasing the property. Once that amount had been paid to the defendant, the property would be transferred to Doble A or to a corporation in which the partners of the de facto partnership would hold equal ownership interests. The plaintiffs allege that they made the payment on siete de abril de 2019. The investment amounts were to be reimbursed to the defendant within the following four months; therefore, they allege that, when the action was filed, they still had time to perform (see complaint in images 15 to 29). The de facto partnership agreement, which was executed on 06 de enero de 2019, is legible in frames 62 to 64. The complaint was answered as shown in images 144 to 155. The defendant denied the claims, alleging that the facts were only partially true in certain instances, specifically those numbered first, second, third, fourth, and fifth.
Broadly speaking, he alleges that the contract lacks the required formalities, that the signatures were not authenticated by a notary public, and that, even if the contracts had any validity, the plaintiffs had breached them in every respect and failed to honor all their commitments. The response to the second alleged fact states: “…despite having possessed the property since the beginning of the contract, the plaintiffs herein failed to fulfill any (sic) of their obligations, in an evident breach of contract (incumplimiento contractual).” Moreover, the contract for specified work (contrato de obra determinada) included in frames 172 to 174 was entered into by the commercial company Doble A and [Nombre5]. As relevant here, they agreed to provide surveillance of the property [Dirección2] in the Alajuela district to prevent encroachment by third parties, to remove from bodies of water any objects obstructing the channel, and to sort waste for transportation to a collection center. The counterclaim (contrademanda) sought the following: “1) that the breaches identified and analyzed herein be deemed established;
III.The complaint includes a request for an atypical interim measure (medida cautelar atípica), among others, ordering defendant [Nombre3] to refrain from taking actions tending to disturb or dispossess the plaintiffs of their possession of the property at issue, subject to the applicable criminal-law warnings (table 23). In answering the complaint, the defendant opposes the request. He alleges that the plaintiffs hold possession “on a precarious basis,” although it was initially held in good faith under the contract, which, in his view, was not fulfilled in any respect, thereby resulting in the dissolution by operation of law of the alleged de facto partnership (sociedad de hecho). He refers to a document showing that the mortgage was not discharged but rather assigned. He also addressed “the offer of countersecurity (contracautela).” In this section, he stated that the interim measure should be denied because it lacked a legal and factual basis and because of the assignment of the mortgage loan, which he characterizes as null and unlawful.
He requests that the interim measure be denied because it serves no purpose. If granted, it would legally sanction the precarious occupancy, which is currently in bad faith. During the judicial inspection (reconocimiento judicial), at which the parties were present, the proceeding was recorded in an audio file added to the virtual case file. It was established that the property is partly depicted in plan A-79911-1992, which appears in image 68. The judicial officer stated that it comprises approximately 23 hectares, excluding the area located north of the referenced cadastral plan (plano catastrado). The officer reported entering the estate through a [Dirección3] leading toward Concho, taking a turn onto a rustic road, partly unpaved, until reaching the property in Crucitas de Cutris. The property consists partly of rolling terrain and pastureland (potrero) (minute 04:57), covering approximately 18 hectares.
It includes some secondary scrubland (charral), with grasses and regrowth from reforestation involving the species [Nombre6]. At minute 05:29, the officer stated that there appeared to be livestock activity. The officer clarified that there were approximately 20 cows and one bull; however, they belonged to a third party unrelated to the litigation and entered that parcel because part of the dividing fence was absent. There is a house (minute 06:03) located toward the rear, built of wood, with a metal roof and wooden floor, rustic in style and without internal partitions; it lacks potable water and electricity. It contains household belongings and appears to be inhabited. Beginning at minute 06:30, the officer explained that the property is partly enclosed by wire fencing and that most of its boundaries are not clearly defined. It has an internal dirt road providing access to the dwelling, approximately 600 meters long, described as rolling and sloped.
At the front of the property (minute 07:00), where the estate is accessed, there is a green booth constructed of metal and zinc sheeting, without a roof. It is a small structure measuring approximately 3 square meters. There is a metal gate with an unlocked padlock through which entry was made. At minute 07:46, the officer reported that, in front of that public access, there was a three-strand wire fence on round posts, in fair condition. Weeds and reforestation regrowth can be seen in the pastureland. The grass is rotana, and there is no improved pasture within the property. The existence of a trail beginning at the front of the property, apparently used by pedestrians traveling north to south, was confirmed. Beginning at minute 08:53, the existence of three wetlands (humedales) was reported. All were in the same condition, with grass cover and soil sediment along the banks. The first was reported as measuring 2000 square meters; the second, approximately 4000; and the last, one hectare.
It was also reported that, near the aforementioned house, there is a terrace containing accumulated refuse consisting of plastic and aluminum cans. At minute 10:05, it was reported that bodies of water were observed along the route and that most had a protection zone (zona de protección), with trees of different species. Toward the southern portion of the estate, at the rear in relation to [Dirección4] street, a stream and a small watercourse (yurro) form. At that location, earthworks (movimientos de tierra) were described that appeared to be associated with open-pit mining (minería a cielo abierto) over an area of approximately three hectares. This area extends close to the bodies of water for a distance of 600 or 700 linear meters. Along that path, sedimentation, tunnel excavations, accumulations of plastic waste, and buckets made of the same material were observed. At minute 12:32, it was clarified that there appeared to be open-pit mining activity within the property boundaries, although it was not being carried out at that time because no one was present performing it.
The testimony of [Nombre5] was also admitted, and the statement begins at minute 17:42. This person stated that he worked on the property primarily as a watchman and secondarily collecting waste. He was hired by co-plaintiff [Nombre1] as of 22 de abril de este año for a term of 5 months. He explained that he also worked for Doble A, whose representative is [Nombre1]. At minute 21:27, he stated that his employment had been reported to the Fuerza Pública at the Comando de Crucitas. He said that he and his wife lived in the house, but clarified that she did not work for the aforementioned persons. He described the scope of his employment and certain delays in his payments. Regarding the work performed on the property, he stated that he removed refuse from the streambed and placed it near the house in accordance with the instructions received. He acknowledged that he was required to pay the Caja Costarricense del Seguro Social as a self-employed worker.
He knew that [Nombre3] was the registered owner. He did not receive instructions to prevent him from entering if he arrived. He reported having removed waste from the stream and kept watch to prevent anyone from entering and taking over the property. It is a watchman service. He explained that the problem was that other persons entered unlawfully. He clarified that he had once been prevented from entering the property with his vehicle. He had only collected refuse and had not performed any brush clearing (chapias). He concluded by stating that the livestock belonged to [Nombre7], the neighbor, and not to his employers; the cattle entered through the fences along the adjoining boundary.
Several matters are apparent from the foregoing. First, the area is one whose particular environmental characteristics arising from the unlawful extraction of minerals are a notorious fact (hecho notorio). During the judicial inspection, evidence of that activity was found, including plastic waste and buckets, as well as excavations extending over three hectares and along the bed of a stream for approximately 600 or 700 meters. This Chamber considers that, although no livestock activity is being conducted, under Article 50 of the Political Constitution, protecting and conserving the environment is an obligation of all citizens. In an area such as that described during the judicial inspection, the protection and care of resources are essential. The activity undertaken by the plaintiffs—since it is undisputed that they exercise possession, as shown by the account of the facts and the answer to the complaint described above—regardless of what is stated in the contracts, makes the monitoring and cleaning of environmentally vulnerable areas, such as watercourses, an urgent necessity.
This is an estate suitable for agricultural use (aptitud agraria) which, because of the circumstances affecting the region where it is located with respect to unlawful open-pit mining, deserves full attention for its potential restoration pursuant to the cited constitutional provision. For that reason, the Court finds a danger in delay (peligro en la demora), because it is necessary to continue monitoring the property and removing refuse, which, as explained, serves an interest higher than the right of possession, the right of ownership, or the right to conduct business. Furthermore, section 489 of the applicable labor procedural law states that the purpose of interim relief (cautelares) is provisionally to protect and safeguard the subject matter of the proceeding and the effectiveness of the judgment. Along the same lines, the final portion of Article 490 ibid. provides that atypical measures may be ordered to safeguard a potential future right.
Considering that there is a prima facie case (apariencia de buen derecho), since it is acknowledged that the plaintiffs exercise possession as explained, the requested measure does not establish any right whatsoever through the assessment of likelihood (juicio de verisimilitud) undertaken when ruling on the interim measure. Rather, it is intended to maintain the status quo during the proceedings unless the material circumstances change. In that event, the parties may request modification of this interim measure. The appealed ruling shall therefore be reversed and the interim measure partially granted in its place, under the terms set forth below. The parties are advised that, pursuant to decision number 7190 of 15 horas 24 minutos del 6 de diciembre de 1994 of the Sala Constitucional de la Corte Suprema de Justicia, judicial bodies may impose measures sua sponte (de oficio). This shall be done in the present case because of the particular circumstances of the property’s geographical location and the condition described during the judicial inspection, a rule applicable erga omnes.
Possession, in harmony with sustainable development and with the self-regeneration capacity of the ecosystems existing on the property, shall continue to be exercised by [Nombre1], who must take all necessary measures to prevent any deterioration whatsoever of the property and its existing resources. It is clarified that possession cannot be awarded to all the co-plaintiffs, because it is an obligation that [Nombre1] must continue to perform as explained, in order to define any potential liabilities arising from possession, given the reported condition of the property. He is further advised that, whenever any natural resource is affected, he is obligated to file a complaint with the appropriate Fiscalía. He is also required to submit a report on the physical condition of the property, stating the number of trees present and the condition of the wetlands located on the property; if he considers it necessary, the report may be accompanied by a qualified professional opinion.
He shall have two months from the date this decision becomes final to comply with the foregoing. He shall be advised that any activity sought to be conducted, other than monitoring and collecting plastic refuse, aluminum cans, and ordinary waste, must be reported to the court in advance in order to obtain authorization, accompanied by a technical opinion appropriate to the nature of the activity. The other parties must be ordered to refrain from disturbing the possession being exercised, with the warning that they may be prosecuted for the offense of disobedience to authority. For these purposes, the court of origin shall personally serve the other parties involved: [Nombre2], of legal age, single, small-scale artisanal miner, identity card CED10 - - ; [Nombre4], of legal age, attorney, resident of San José, identity card CED3 - - ; the representative of DOBLE A NOVENTA Y CINCO SOCIEDAD ANÓNIMA; and [Nombre3], of legal age, married once, businessperson, identity card CED11- - .
The record contains the administrative interim measure issued by the Sistema de Áreas de Conservación, Área de Conservación Arena Huétar Norte, Subregión San Carlos, Los Chiles (image 170), issued at 11 horas del 06 de febrero de 2019, ordering the cessation on the property of activities involving land-use change (cambio de uso del suelo) or tree cutting without authorization from the Administración Forestal del Estado. According to the document, the construction of a road through forest, the cutting of trees, shrubs, and other vegetation, and resulting harm to the forest and water resources were detected.
The measure ordered herein does not in any way affect, restrict, or modify the decision of the Administrative Authority, and, as a supplementary measure, the party is ordered to remain vigilant in ensuring compliance with what was ordered therein.
THEREFORE:
The decision issued at fourteen hours fifty-nine minutes on July four, two thousand nineteen is reversed. Instead, the precautionary measure (medida cautelar) requested by the plaintiff is partially granted as follows: 1. Possession, in harmony with sustainable development and the self-regeneration capacity of the ecosystems existing on the property at issue, shall continue to be exercised by [Nombre1], who shall take all measures necessary to prevent any deterioration whatsoever of the property and the existing resources. 2. [Nombre1] is required, whenever any natural element of the property is affected, to promptly file a complaint with the appropriate Prosecutor’s Office. 3. [Nombre1] is required to submit a report on the physical condition of the property, stating the number of existing trees and their condition, as well as the condition of the wetlands located on the property; if deemed necessary, the report may be accompanied by a qualified professional opinion.
A period of two months from the date this decision becomes final is granted for compliance with the foregoing. 4. Any activity to be undertaken, other than surveillance and the collection of plastic refuse, aluminum cans, and ordinary waste, must be reported in advance to the Court in order to obtain the corresponding authorization, accompanied by a technical opinion appropriate to the nature of the activity. [Nombre1] is advised that failure to comply with any of the conditions imposed herein constitutes grounds for revoking this precautionary measure, subject to due process. 5. The other parties are ordered to refrain from disturbing the possession being exercised, under warning that they may be prosecuted for the offense of disobedience of authority. In view of the administrative precautionary measure issued by the Sistema de Áreas de Conservación, Área de Conservación Arena Huétar Norte, Subregión San Carlos, Los Chiles, at 11 hours on February 06, 2019, which ordered the suspension on the property of activities involving land-use change (cambio de uso del suelo) or tree cutting without authorization from the State Forestry Administration (Administración Forestal del Estado), it is stated that the order herein does not in any way affect, restrict, or modify the decision of the Administrative Authority. In addition to the foregoing, [Nombre1] is ordered to remain vigilant regarding compliance with that decision and to faithfully comply with the orders of that entity.

VOTO N° 000756-F-2019 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las quince horas y treinta y cinco minutos del veinticuatro de setiembre de dos mil diecinueve.
MEDIDA CAUTELAR promovida dentro del PROCESO ORDINARIO incoado por [Nombre1] , mayor, viudo, comerciante, vecino de Purral, cédula de identidad CED1 - - ; [Nombre2] , mayor, soltero, coligallero, cédula de identidad CED2 - - ; RODOLFO SEGNINI SABAT, mayor, abogado, vecino de San José, cédula de identidad CED3 - - ; DOBLE A NOVENTA Y CINCO SOCIEDAD ANÓNIMA, cédula de persona jurídica número CED4 - - , representados por su apoderado generalísimo sin límite de suma Ricardo González Mora, mayor, abogado, vecino de San José, cédula de identidad CED5 - - ; contra [Nombre3] , mayor, casado una vez, empresario, cédula de identidad CED6 - - . Actúa como apoderado especial judicial de la parte actora, el licenciado Ricardo González Mora, cédula de identidad CED7 - - , colegiado tres mil cuatrocientos cuarenta y nueve; de la parte demandada, el letrado Alonso Gallardo Solís, colegiado dieciocho mil setenta y siete. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos.
Redacta la jueza Díaz Bolaños; y,
CONSIDERANDO:
I.Se recurre la decisión de las 14 horas 59 minutos del 04 de julio de 2019 mediante la cual se rechazó la medida cautelar pedida por la parte actora. Tal consta en el expediente virtual del Juzgado Agrario de San Carlos, en modo PDF, imágenes 136 a 142. La impugnación es rubricada por el abogado Ricardo González Mora, en calidad de apoderado especial judicial del actor [Nombre1] , la mercantil Doble a Noventa y Cinco Sociedad Anónima -en lo sucesivo llama Doble A, [Nombre2] y [Nombre4] . Agravia lo siguiente: 1. Se desprende del contrato que origina el proceso principal, las partes firmaron un contrato privado de acuerdo de sociedad de hecho, así como un convenio para investigación de posible daño ambiental y restauración de finca el 06 de enero de 2019. 2. En tales contratos [Nombre3] y sus representados [Nombre1] , [Nombre2] y [Nombre4] , convinieron en una sociedad de hecho, distribución de labores y de utilidades de trabajo.
Expone, parte de las obligaciones de las personas a quienes representa, era aportar la suma de ¢40.000.000 con los recursos para generar la recuperación de desechos valorizables de la heredad en un máximo de tres meses contados a partir de la firma de ese documento. Alega, es evidente la posesión del inmueble es requisito indispensable para recuperar esos desechos valorizables y generar los recursos necesarios para cumplir con prestaciones económicas esenciales del pacto. 3. Explica, el codemandado [Nombre3] contrató a la mercantil Doble A para realizar labores de estudio e investigación de daño e impacto ambiental en la finca en litis. También el manejo de ésta hasta la restauración para fines agrícolas, piscícolas, ganaderas, turísticos y mineros. Muestra, es evidente el manejo de la finca conlleva su posesión, de manera la citada sociedad manejaría el inmueble, se estaba acordando esa tenencia.
Pide se note, el precio de la contratación y el pago de sus servicios se cubrirían por medio de un porcentaje de extracción de desechos valorizables obtenidos de la heredad, lo cual, a su entender, supone que la posesión estaría a cargo de sus representados. 4. Remite al convenio para indicar se pactó los gastos de operación y administrativos de la finca se generan con la producción por medio de la recuperación de los desechos, a cancelar la hipoteca tanto capital como intereses y posteriormente devolver a [Nombre3] la inversión original de la compra de la finca. Subraya, a partir de ese momento sus mandantes ejercieron la posesión del predio e iniciaron la ejecución de actividades previstas en el contrato. El referido [Nombre3] nunca ejerció posesión de forma directa o actividades previstas en los convenios. 5. El referido codemandado cambió durante la ejecución del contrato y en forma concreta ha manifestado no está dispuesto permitir a quienes recurren continuar la posesión.
El cambio de actitud generó la solicitud de medida cautelar gestionada. 6. Dice, sus representados son los que han estado en posesión del inmueble desde el mes de enero del año en curso. Describe, han cuidado el predio, realizado chapias, reparado cercas, caminos, protección para evitar invasiones y personas a realizar actividades ilegales o sin permisos. Señala, la medida cautelar pretende mantenerlos en posesión del terreno para seguir realizando las actividades previstas en los contratos. Si se deniega, estima no podrán cumplir con las obligaciones adquiridas en los convenios y perderán todos los derechos derivados de tal. 7. A los autos se han aportado los contratos con la finalidad de comprobar la administración y manejo del bien; las labores de restauración del predio que hace la referida sociedad. Por esa razón, enfatiza, es necesario ejercer la posesión. 8. Hace referencia al estudio de impacto ambiental, informe de situación actual en salud humana, avance de situaciones encontradas, ley de biodiversidad, informes de operaciones y financiero.
Todas esas probanzas demuestran el cumplimiento de las labores por las cuales se contrato a la sociedad Doble A, porque son situaciones particulares de la propiedad, la cual reitera ha estado en posesión de sus mandantes. 9. Con la finalidad de proteger la posesión por ese grupo ejercida han solicitado se prevenga al citado [Nombre3] abstenerse de realizar actos tendientes a perturbar o despojar la posesión ostentada con las advertencias penales. Lo anterior porque los contratos suscritos entre las partes son válidos y están en ejecución. Reitera sus representados han cumplido con las obligaciones derivadas del convenio y tienen plazo para cumplir con lo restante; pide se respete la convención. 10. El desacuerdo se da entre las partes y ahora se les impide a sus representados continuar con la posesión y ejecución del convenio. 11. Hace ver, en caso sus representados sean despojados de la posesión y tenencia del inmueble, no pueden continuar con la ejecución del contrato, tampoco honrar las obligaciones.
Elucubra, la actitud de [Nombre3] es sacarlos de la finca para que antes de cumplir el plazo impida la ejecución y dejarse la propiedad y aprovechar los pagos realizados por sus representados en cuanto a la hipoteca que pesaba sobre tal. 12. Agravia, el juzgado solo se enfoca en la actividad pecuaria dejando de lado la intención de las partes al firmar los contratos, que radicaba en la recuperación de zonas protegidas, restauración de las condiciones ambientales como ríos y humedales, a partir de la extracción y retiro de desechos que están contaminando el inmueble. Analiza, los convenios tienen una vocación claramente ambiental, de recuperación de los ecosistemas citados. Insiste no es solo la actividad pecuaria o la existencia de un ciclo productivo organizado, sino un tema e interés público ambiental en una zona afectada por la actividad irregular de terceras personas que han dañado gravemente ese ambiente y ecosistemas.
Reseña la decisión impugnada en cuanto a la ausencia de producción. Se cuestiona la pretensión es dable para temas ambientales, recuperación del ambiente, descontaminación de ríos y humedales, restauración de zona protegida. Empero se deniega bajo una consideración muy limitada de lo que es el objeto del proceso. 13. Califica el análisis de lo apelado como parcial de los requisitos de la medida cautelar atípica gestionada. Se acepta el presupuesto de la residualidad, pero ausencia de apariencia de buen derecho. Sin embargo, en la misma resolución en pocas líneas se tiene por cierto la firma del contrato, aclara que son dos convenciones, incluye el manejo de la heredad para su adaptación a las actividades agrícolas, piscicultura, ganaderas, turísticas o mineras y precisamente ese manejo lo debe realizar según el contrato con la sociedad Doble A y ahí estima esta la apariencia de buen derecho en cuanto a la solicitud de mantener la posesión del bien.
Por otra parte, dice, [Nombre3] ha manifestado su intención de despojo y reitera así no pueden cumplir el contrato. Muestra la existencia de peligro en la demora si no se hacen los trabajos convenidos y deben solventar sus obligaciones económicas para no perder sus derechos. Pide, revocar lo apelado y en su lugar conceder la pretensión cautelar solicitada (cuadros 178 a 185).
II.En este asunto se interpone una demanda ordinaria para requerir: “Que de conformidad con lo expresamente convenido en el CONTRATO PRIVADO DE ACUERDO DE SOCIEDAD DE HECHO y también en el CONTRATO PARA INVESTIGACIÓN DE POSIBLE DAÑO AMBIENTAL Y RESTAURACIÓN DE FINCA, ambos de fecha 6 de enero del año dos mil diecinueve, habiéndose cumplido los presupuestos previstos por las partes en tales contratos, deberá declararse que el inmueble ubicado en la Provincia de Alajuela, Cantón San Carlos, [Dirección1] , inscrito bajo el número de matrícula de folio real número [Placa1], submatrículas [Placa2], [Placa3] y [Placa4], es propiedad de la empresa DOLBE A NOVENTA Y CINCO S.A, cédula de persona jurídica CED8- - y en consecuencia debe ser inscrita registralmente a nombre de dicha empresa. En caso de oposición, deberá condenarse a la parte contraria al pago de ambas costas del proceso” (lo destacado es del texto original en imagen 20).
De manera subsidiaria se pidió: “Que de conformidad con lo expresamente convenido en el CONTRATO PRIVADO DE ACUERDO DE SOCIEDAD DE HECHO y también en el CONTRATO PARA INVESTIGACIÓN DE POSIBLE DAÑO AMBIENTAL Y RESTAURACIÓN DE FINCA, ambos de fecha 6 de enero del año dos mil diecinueve, habiéndose cumplido los presupuestos previstos por las partes en tales contratos, deberá declararse que el inmueble ubicado en la Provincia de Alajuela, Cantón San Carlos, [Dirección1] , inscrito bajo el número de matrícula de folio real número CED9, submatrículas [Placa5], y [Placa4], deberá inscribirse registralmente a nombre de una sociedad en donde tendrán participación por partes iguales los socios de la sociedad de hecho, o sea los actores de este proceso y en consecuencia la finca debe ser registralmente ya sea a nombre de dicha empresa o bien a nombre de los socios en nombre personal. En caso de oposición, deberá condenarse a la parte contraria al pago de ambas costas del proceso” (cuadros 20 a 21).
En el relato de los hechos, las personas actoras relatan suscribieron contrato con el demandado en aras de acordar una sociedad de hecho, de distribución de labores y de utilidad del trabajo. Para esos efectos el demandado [Nombre3] adquirió con recursos propios la finca objeto de litis por un precio de ¢80.000.000. Al realizar la compraventa se cancelaron ¢40.000.000 y el saldo sería honrado por los actores en un plazo de tres meses; en garantía quedó una hipoteca. Por otra parte, el demandado contrató a la empresa Doble A para que realizara estudios e investigación de daño e impacto ambiental, además del manejo de tal predio. El pago de esa convención sería cancelado con un porcentaje de la extracción de los desechos valorizables obtenidos de esa heredad, distribuyéndose entre las partes el remanente. Además, se destinarían parte de los fondos para pagar al demandado su inversión original en la compra de la finca.
Una vez cancelado el rubro al demandado se traspasaría a la sociedad Doble A, o bien de una sociedad donde tendrían participación por partes iguales lo socios de hecho. Aducen, los accionantes cumplieron con el pago el siete de abril de 2019. La devolución de las sumas de inversión al demandado se realizaría en los próximos cuatro meses, por lo que, al momento de interponer la demanda, aducen tienen plazo para cumplir (ver demanda en imágenes 15 a 29). El contrato de sociedad de hecho se encuentra legible en cuadros 62 a 64 el cual fue suscrito el 06 de enero de 2019. Por otra parte, se respondió a la demanda según consta en imágenes 144 a 155. La acción fue contestada de manera negativa, aduciendo que los hechos son parcialmente ciertos en algunos casos, propiamente en los marcados primero, segundo, tercero, cuarto y quinto. A grosso modo aduce el contrato carece de formalidad, no están autenticadas las firmas por notario público, y de tener alguna validez éstos han sido incumplidos en todos los aspectos y compromisos por parte de los actores.
En el hecho segundo se indica: “…los aquí actores a pesar de estar en posesión de la finca desde el inicio del contrato, no cumplieron con ninguno (sic) de sus obligaciones en un evidente incumplimiento contractual”. Por otra parte, del contrato de obra determinada agregado en cuadro 172 a 174, es pactado por la mercantil Doble A y [Nombre5] . En lo de interés acordaron la vigilancia de la finca [Dirección2] del partido de Alajuela para evitar la invasión de terceras personas, realizar la obra de sacar de los cuerpos de agua todo objeto que interrumpa el cauce, clasificación de desechos para ser llevados a un centro de acopio. En la contrademanda se pidió lo siguiente: “1) se tengan por acreditados los incumplimientos aquí indicados y analizados,
III.En la demanda se incluye el pedido de una medida cautelar atípica, entre otras, para que se advierta al demandado [Nombre3] abstenerse de realizar actos que tiendan a perturbar o despojar la posesión ostentada por los actores sobre la finca en litis, con las advertencias penales del caso (cuadro 23). El accionado se opone al responder la demanda. Aduce, la posesión la tienen los actores “en precario”, aunque inicialmente fue de buena fe con sustento en el contrato, a su entender no fue cumplido en ninguno de sus puntos y esto da paso a la disolución de la supuesta sociedad de hecho de pleno derecho. Hace referencia a un documento donde consta la hipoteca no fue cancelada sino cedida. Además, indicó “sobre el ofrecimiento de la contracautela”. En este segmento afirmó rechazar la medida cautelar por carecer de fundamento legal y fáctico, así como por la cesión del crédito hipotecario el cual califica de nulo e ilegal.
Solicita se rechace la medida cautelar porque no tiene razón de ser. Si se concede se consiente legalmente la ocupación precaria que en la actualidad es de mala fe. En el reconocimiento judicial verificado, estuvieron las partes presentes, se soportó en un archivo de audio agregado al escritorio virtual. Se constató se trata de una finca en parte representada en el plano A-79911-1992, el cual está agregado en imagen 68. Indicó la persona juzgadora se trata de aproximadamente 23 hectáreas excluyendo la ubicación hacia el norte del referido plano catastrado. Relató, ingresó a la heredad mediante una [Dirección3] que va hacia el Concho; tomando un desvío por un camino rústico en parte de tierra hasta llegar a la propiedad en Crucitas de Cutris. La propiedad esta compuesta por un terreno ondulado en parte y potrero (minuto 04:57) de aproximadamente 18 hectáreas. Tiene charral en parte con pastos y rebrote de reforestación de la especie [Nombre6].
En minuto 05:29 refirió se aparente la actividad ganadera. Aclara hay aproximadamente 20 vacas y un toro, empero, son de una tercera persona ajena a la litis, las cuales se pasan a ese predio debido a la inexistencia en parte de cerca divisoria. Hay una casa (minuto 06:03) ubicada al fondo; construida en madera, techo de metal, piso de madera, tipo rústica, sin divisiones internas; carece de agua potable o luz. Tiene enseres de hogar aparentando estar habitada. A partir del minuto 06:30 explica, la propiedad en parte se encuentra delimitada con cerca de alambres en su mayor parte no están bien definidos los linderos. Cuenta con un camino interno de tierra que da acceso a la casa de habitación con una longitud aproximada de 600 metros, el cual es calificado como de ondulado con una pendiente. En la parte del frente de la propiedad (minuto 07:00) por donde se accede a la heredad, hay una caseta construida en metal, zinc, sin techo, con color verde.
Es una pequeña edificación de aproximadamente 3 metros cuadrados. Hay un portón de metal con candado abierto por donde se ingresó. En minuto 07:46 relató, al frente de ese acceso público se ve una cerca de tres hilos de alambre sobre poste redondo en regular estado. En el potrero se observa maleza con rebrotes de reforestación. El pasto es rotana, y no hay pasto mejorado dentro de la propiedad. Se constata la existencia de un trillo que inicia en la parte del frente en apariencia para el tránsito de personas con rumbo norte sur. A partir del minuto 08:53 se relata la existencia de tres humedales. Todos en la misma condición, con cobertura de pasto y sedimento de tierra en la orilla. El primero se reporta con una dimensión de 2000 metros cuadrados; el segundo un área aproximada de 4000; y, el último con una extensión de una hectárea. Por otra parte, se narra cerca a la casa reseñada hay una terraza donde hay desechos de basura que consiste en plástico y latas de aluminio, los cuales se observan apilados.
En minuto 10:05 se relata, a lo largo del recorrido se observan cuerpos de agua, en su mayoría tienen zona de protección, con árboles de diferentes especies. Se indican por el rumbo sur de la heredad al fondo respecto de la calle [Dirección4], se forman una quebrada y un yurro. En ese punto de describen movimientos de tierra aparentando una actividad minera a cielo abierto en un área aproximada de tres hectáreas. El cual se extiende de manera cercana a los cuerpos de agua nen una longitud de 600 o 700 metros lineales. En esa vereda se denota la existencia de sedimentación con excavaciones de túneles, acumulación de desechos plásticos y valdes de ese mismo material. En minuto 12:32 se aclara en dentro de los límites de la propiedad hay en apariencia actividad minera a cielo abierto, pero en ese momento no se ejecuta pues no hay persona alguna haciéndolo. Por otra parte, se admitió la testimonial de [Nombre5] , cuya declaración está a partir del minuto 17:42.
Tal persona indicó laborar en el predio de manera sustancial a la vigilancia y secundariamente a la recolección de desechos. Fue contratado por el coactor [Nombre1] desde el 22 de abril de este año por el plazo de 5 meses. Explicó que también labora para Doble A donde [Nombre1] es el representante. En minuto 21:27 indicó que su trabajo fue reportado a la Fuerza Pública al Comando de Crucitas. Dice en la casa habita él y la esposa, pero aclaró ella no trabaja para las referidas personas. Relató los alcances de la contratación y algunos retrasos en sus pagos. Tocante a las labores desarrolladas en el predio, indicó saca la basura del cauce de la quebrada y la coloca cerca de la casa según las instrucciones recibidas. Admitió él debe pagar la Caja Costarricense del Seguro Social como trabajador independiente. Sabe que [Nombre3] es el propietario registral. No recibió instrucciones que si él llegaba no lo dejaran entrar.
Relata ha hecho extracción de desechos de la quebrada y vigilancia para que nadie llegue a invadir la finca. Es un servicio de vigilancia. Dilucida el problema es que otras personas ingresan de manera ilegal. Aclara tuvo un impedimento para ingresar con su vehículo al inmueble. Solo ha realizado recolección de basura, no así chapias. Concluye afirmando el ganado es de [Nombre7] el vecino y no de los patrones; los vacunos ingresan por las cercas de la colindancia. De lo anterior se denotan varios aspectos. Lo primero, se trata de una zona que es un hecho notorio tiene unas características ambientales particulares por la extracción ilegal de minerales. En el reconocimiento judicial se detectaron hallazgos de esa actividad, como desechos plásticos y valdes, así como excavaciones en una extensión de tres hectáreas y a lo largo del cause de una quebrada de aproximadamente 600 o 700 metros. Es consideración de esta Cámara, que si bien no se realiza actividad ganadera, de conformidad con el canon 50 de la Constitución Política es una obligación de toda la ciudadanía la protección y conservación del ambiente.
En una zona como la descrita en el reconocimiento judicial, es menester la tutela y cuido de los recursos. La actividad que desarrollan los actores, porque no es un hecho controvertido que la posesión es ejercida por ellos según se denota del relato de los hechos y contestación de la demanda arriba reseñada, al margen de lo indicado en los contratos, es inminente la vigilancia y limpieza de zonas en vulnerabilidad ambiental como son los causes del líquido vital. Se trata de una heredad de aptitud agraria, que por las vicisitudes de la región donde se ubica en cuanto a la explotación minera a cielo abierto de manera ilegal, merece toda la atención para su eventual recuperación según el precepto constitucional indicado. Por tal razón, se considera, hay peligro en la demora dado es necesario dar continuidad a la vigilancia y limpieza de basura, que como se expuso atiende a un interés superior que al propio derecho de posesión, de propiedad o del ejercicio de la empresa.
Sumado a lo anterior, el ordinal 489 de la ley procesal laboral de aplicación, indica la finalidad de las cautelares, es proteger y garantizar, provisionalmente el objeto del proceso y la efectividad de la sentencia. En esa misma línea, el artículo 490 ibid parte final, reseña sobre las medidas atípicas, se pueden fijar para garantizar el eventual futuro derecho. La medida solicitada, considerando hay apariencia de buen derecho, pues se reconoce que la posesión es ejercida por los actores conforme se explicó, no constituye derecho alguno en este juicio de verisimilitud ejecutado al fundamentar la medida cautelar. Sino se trata de mantener el estado de las cosas, tal y como se encuentran, durante la tramitación del proceso, salvo que las condiciones materiales cambien. Entonces las partes podrán pedir una modificación de esta cautelar. Por tal razón procederá revocar la resolución apelada, y en su lugar acoger de manera parcial la medida cautelar en los términos en que se expondrá.
Se aclara a las partes, de conformidad con el voto número 7190 de las 15 horas 24 minutos del 6 de diciembre de 1994 de la Sala Constitucional de la Corte Suprema de Justicia los órganos judiciales pueden imponer medidas de oficio, lo cual se hará en este caso dada las condiciones particulares de la ubicación geográfica del predio y el estado relatado en el reconocimiento judicial, criterio de aplicación erga omnes. En cuanto la posesión, en armonía con el desarrollo sostenible y con la capacidad de autogeneración de los ecosistemas existentes en el inmueble, seguirá siendo ejercida por [Nombre1] quien deberá tomar todas las medidas necesarias para evitar que de cualquier manera se desmejore el bien y los recursos existentes. Se aclara no es dable conceder esa posesión a todos los coactores pues es una obligación que deberá seguir ejerciendo según se explicó, en aras de delimitar eventuales responsabilidades derivadas de la posesión, dadas las condiciones relatadas de la propiedad.
Por otro lado, se le advierte que tiene la obligación en cualquier momento que se vea afectado algún elemento natural gestionar denuncia en la Fiscalía correspondiente. Por otra parte, se le impone la obligación de rendir un informe del estado material de la finca donde se indique el número de árboles que hay la condición de los humedales ubicados en la propiedad y si lo estima necesario puede acompañarse de un criterio profesional calificado. Para cumplir con lo anterior se le concederá el plazo de dos meses contados a partir de la firmeza de esta decisión. Se le advertirá, que cualquier actividad que se desee realizar, salvo la de vigilancia y recolección de basura de plástico, latas de aluminio y desechos comunes, debe comunicarlo previamente al juzgado para obtener permiso acompañado por criterio técnico según sea la naturaleza de la actividad. Se deberá advertir a las demás partes, abstenerse de perturbar la posesión ejercida bajo el apercibimiento de ser eventualmente procesados por el delito de desobediencia a la autoridad.
Para tales efectos procederá la oficina de origen notificar personalmente a las demás partes involucradas [Nombre2] , mayor, soltero, coligallero, cédula de identidad CED10 - - ; [Nombre4] , mayor, abogado, vecino de San José, cédula de identidad CED3 - - ; a quien representa a DOBLE A NOVENTA Y CINCO SOCIEDAD ANÓNIMA y a [Nombre3] , mayor, casado una vez, empresario, cédula de identidad CED11- - . Consta en autos la medida cautelar administrativa emitida por el Sistema de Áreas de Conservación, Área de Conservación Arena Huétar Norte, Subregión San Carlos, Los Chiles (imagen 170), emitida a las 11 horas del 06 de febrero de 2019 la cual ordena paralizar en la finca actividades que implican cambio de uso del suelo o corta de árboles sin la autorización de la Administración Forestal del Estado. Pues según el documento se detectó la construcción de un camino en bosque, corta de árboles, arbustos y resto de vegetación con afectación al bosque y al recurso agua. La medida aquí ordenada no afecta, restringe o modifica de manera alguna lo decidido por la Autoridad Administrativa y como complemento se ordena a la parte que sea vigilante de lo ahí ordenado.
POR TANTO:
Se revoca la decisión de las catorce horas cincuenta y nueve minutos del cuatro de julio de dos mil diecinueve. En su lugar se acoge parcialmente la medida cautelar requerida por la actora de la siguiente manera: 1. La posesión, en armonía con el desarrollo sostenible y con la capacidad de autogeneración de los ecosistemas existentes en el inmueble en litis, seguirá siendo ejercida por [Nombre1] quien deberá tomar todas las medidas necesarias para evitar que de cualquier manera se desmejore el bien y los recursos existentes. 2. Se le impone la obligación que en cualquier momento que se vea afectado algún elemento natural del predio, gestionar de manera oportuna denuncia ante la Fiscalía correspondiente. 3. Se le impone la obligación de rendir un informe del estado material de la finca donde se indique el número de árboles existentes y su condición, así como la indicación de la condición de los humedales ubicados en la propiedad; si lo estima necesario puede acompañarse de un criterio profesional calificado.
Para cumplir con lo anterior se le concede el plazo de dos meses contados a partir de la firmeza de esta decisión. 4. Cualquier actividad que se desee realizar, salvo la de vigilancia y recolección de basura de plástico, latas de aluminio y desechos comunes, debe comunicarlo previamente al Juzgado para obtener permiso correspondiente, acompañado por un criterio técnico según sea la naturaleza de la actividad. Se le advierte a [Nombre1] que el incumplimiento de cualquiera de las condiciones aquí impuestas es causal para revocar esta medida cautelar, respetando el debido proceso. 5. Se advierte a las demás partes, abstenerse de perturbar la posesión ejercida bajo el apercibimiento de ser eventualmente procesados por el delito de desobediencia a la autoridad. Para tales efectos procederá la oficina de origen notificar personalmente a las demás partes involucradas: [Nombre2] , mayor, soltero, coligallero, cédula de identidad CED10 - - ; RODOLFO SEGNINI SABAT, mayor, abogado, vecino de San José, cédula de identidad CED12 - - novecientos diecinueve; a quien representa a DOBLE A NOVENTA Y CINCO SOCIEDAD ANÓNIMA y a [Nombre3] , mayor, casado una vez, empresario, cédula de identidad CED11- - . 6.
En virtud de la medida cautelar administrativa emitida por el Sistema de Áreas de Conservación, Área de Conservación Arena Huétar Norte, Subregión San Carlos, Los Chiles, emitida a las 11 horas del 06 de febrero de 2019 la cual ordenó paralizar en la finca actividades que implican cambio de uso del suelo o corta de árboles sin la autorización de la Administración Forestal del Estado se indica lo aquí ordenado no afecta, restringe o modifica de manera alguna lo decidido por la Autoridad Administrativa. Como complemento de lo anterior se ordena a [Nombre1] que sea vigilante de lo ahí ordenado y cumpla fielmente lo ordenado por ese ente.
