EVICTION PROCEEDING (PROCESO DE DESAHUCIO) brought by GRUPO QUETZALCOATL SOCIEDAD ANÓNIMA, corporate identification number CED1 - - , represented by its president, who holds a general power of attorney with unlimited authority (apoderado generalísimo sin límite de suma), Mr. [Nombre1], of legal age, married, businessperson, resident of San Gerardo, Dota, Copey, San José, identity card number CED2 - - ; against [Nombre2], of legal age, married, merchant, resident of San Gerardo de Dota, identity card number CED3 - - . BACKGROUND:
1. The plaintiff filed an eviction proceeding, seeking a judgment declaring the following: “That this action be granted. That Grupo Quetzalcoalt S.A. be recognized as the sole and exclusive owner and possessor. That, for purposes of this eviction, it be deemed established that the property carries out productive agricultural activities characteristic of an agricultural enterprise (empresa agraria). That it be deemed established that the activity conducted by the defendant is restricting and interfering with the tourism project undertaken by my client on its property and that, consequently, those ponds must be removed and the trout must be taken away. That mere tolerance (mera tolerancia) in the use of one pond be deemed established, as justified by the blood relationship between the plaintiff and the defendant. That the defendant breached the terms concerning the duration and use or purpose of the pools.
That it be declared that the defendant unlawfully breached the agreement and, without the owner’s consent, unilaterally extended the period for using the pools. That the pools be removed completely because they jeopardize the safety of visitors and workers. That the defendant be ordered to remove the trout from the pools he currently uses. 2. The defendant opposed the complaint, raising the defenses (excepciones) of lack of a legal right, lack of capacity, lack of standing, and sine actione agit, as well as the defenses of failure to join a necessary plaintiff and failure to join a necessary defendant (litis consorcio activo necesario and litis consorcio pasivo necesario) (see the virtual case-management system of the Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, associated documents, part 1 of the scanned physical case file incorporated on 21/03/2018 at 13:22:56, images 53 to 57).
3. In interlocutory judgment (auto-sentencia) number 40-2017, issued at trece horas cincuenta y cinco minutos del cuatro de mayo del año dos mil diecisiete, the Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, ruled on the preliminary defenses (excepciones previas) of failure to join a necessary plaintiff, failure to join a necessary defendant, and lack of capacity (see the virtual case-management system of the Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, associated documents, part 4 of the scanned physical case file incorporated, images 28 to 30.
4. Judge William Roberto Arburola Castillo of the Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, ruled as follows in judgment number 2019000034, issued at catorce horas y seis minutos del veintinueve de abril del año dos mil diecinueve: “Based on the cited legal provisions, the arguments presented, and the transcribed case law, the defenses of sine actione agit and lack of both active and passive standing are denied, and the defense of lack of a legal right is granted. The eviction action brought by GRUPO QUETZALCOALT SOCIEDAD ANÓNIMA, represented by its president [Nombre1], against [Nombre2] IS DISMISSED in its entirety. The unsuccessful party is relieved from paying both categories of costs in the proceeding. The court, on its own motion, orders that certified copies of the relevant portions of the record be prepared and forwarded to the Prosecutor’s Office for investigation of the possible commission of an environmental offense,” (see the virtual case-management system of the Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, associated documents, trial-court judgment incorporated on 18/09/2018 11:47:31).
5. The plaintiff filed an appeal (recurso de apelación), expressly stating the grounds relied upon to rebut the trial court’s position (see the virtual case-management system of the Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, filing incorporated on 07/05/2019 02:52:01).
6. The statutory requirements were observed in the conduct of the proceeding, and there are no errors or omissions capable of rendering the judgment null and void.
Judge Díaz Bolaños drafts the opinion; and,
CONSIDERING:
I.The established facts are adopted because they are well supported by the record. The following facts of the same nature are also included: VII) The aquaculture activity described in established fact V began approximately 25 years ago under the father of [Nombre1] and [Nombre3], Mr. [Nombre4] (testimony of [Nombre5], [Nombre4], [Nombre6], and [Nombre7], in audio recordings added to the virtual case file in the associated-documents folder under each witness’s name, dated 03 de abril de 2019). VIII) Before the property was transferred into the plaintiff company’s name, on an unspecified date, the trout-farming activity and operation of the shelters were conducted by the siblings [Nombre1] and [Nombre3], who, over time, separately managed each activity (testimony of [Nombre4], [Nombre5], [Nombre6], and [Nombre7], in audio recordings added to the virtual case file in the associated-documents folder under each witness’s name, dated 03 de abril de 2019).
III.The judgment issued at 14 horas 06 minutos del 29 de abril de 2019, appearing in image 366 of the virtual case file of the Juzgado Agrario de Pérez Zeledón in PDF format, is appealed. That decision dismissed the eviction action based on mere tolerance, without a specific award of costs. It ordered the preparation of certified copies of relevant portions of the record for referral to the Fiscalía General de la República for investigation of a possible environmental offense. The appeal is signed by attorney Jazmín Hidalgo in her capacity as special litigation counsel for the plaintiff, Grupo Quetzalcóatl Sociedad Anónima, according to the filing appearing in frames 386 to 389. She challenges the improper assessment of the evidence, arguing that the evidence was not analyzed as a whole in conjunction with the defendant’s statements during the proceeding, particularly his answer to the complaint.
She contends that there is evidence showing that this matter concerns mere tolerance. The previous owner was [Nombre4], who disposed of his property by selling it to the plaintiff. She refers to the fifth recital of the appealed decision, insofar as it found that there was no conclusive evidence that her client had granted the defendant permission to perform certain acts on the land and that the only evidence of tolerance was [Nombre7]’s testimony. In counsel’s view, that person stated that the defendant began using the ponds for trout farming after requesting authorization, without providing financial compensation. The appeal states that this witness affirmed that there was no financial benefit of any kind because of the blood relationship between the plaintiff and the defendant. It further states that such permission was subject to a period consisting of one season, equivalent to approximately one calendar year according to the activity’s biological cycle, and that once this period elapsed, the plaintiff requested eviction.
She contends that the court below gave insufficient weight to that testimony. She also refers to the witness’s statements regarding the improvements and the complaint filed by that person. She criticizes the judgment for finding the defendant’s possession established based on the grandfather’s testimony, even though he benefits from the activity because the trout are sold at a restaurant he owns. She considers this irrefutable proof that the witness is partial and has a direct interest in the outcome of the proceeding. The testimony of [Nombre6], the defendant’s mother, was deemed credible despite consisting of hearsay statements (manifestaciones de referencia), since she unequivocally stated that she was recounting what the defendant himself had said. Regarding the area where the activity is conducted, the inspections confirm that the activity continues to expand. She states that this was one of the reasons for returning possession of the land to him, because he showed no concern for the environmental damage he might cause or for the interference with the property. She requests that the judgment be reversed, that the claims be granted, and that the defendant be ordered to vacate the premises immediately.
IV.At its core, the appeal (apelación) concerns the weight assigned to the testimonial evidence (probanza testimonial). It should be clarified that the 1989 Code of Civil Procedure applies in this case by virtue of Transitional Provision I of Ley 9242 and Transitional Provision II of Ley 9243, because the case file was initiated on 04 de julio de 2016, according to the stamp showing receipt of the complaint (demanda) in image 91. Regarding the weight assigned to the assertions made in the answer to the complaint (contestación de la demanda), pursuant to Article 341 of the 1989 Code of Civil Procedure applicable to this matter, assertions contained in pleadings (escritos) that refer to personal facts concerning a party shall be deemed that party’s confession (confesión). However, in agrarian matters, Article 54 of the Agrarian Jurisdiction Act (Ley de Jurisdicción Agraria) establishes the system for weighing evidence (valoración probatoria).
With respect to this system of assessment, the First Chamber of the Court (Sala Primera de la Corte), in judgment number 60-2011, issued at 9 hours 15 minutes on 27 de enero de 2011, stated: “Under Article 54 of the LJA, in agrarian matters, evidence must be assessed ‘conscientiously and without strict adherence to the rules of ordinary law, but, in all cases, when analyzing the result of the evidence gathered in the proceedings, the court must state the principles of equity or law on which it bases its determination.’ In turn, provision 61 ibid. establishes: ‘When assessing the evidence and deciding the case, the Cassation Chamber (Sala de Casación) shall be governed by Article 54 and, in general, by the principles underlying this law.’ Regarding this issue, this Chamber stated: ‘IV. In the case at bar (sub júdice), the dispute centers on one specific point: the assessment of the evidentiary record (material probatorio) as to which party breached the contract.
The manner in which judges must assess evidence has varied throughout the history of Procedural Law. In an initial stage, preceding the nineteenth-century codifications, a system of predetermined evidentiary weight (sistema tasado) was used to determine the probative force of each item. Thus, the law assigned a value to each item of evidence in advance, without allowing the adjudicator to decide independently which elements best informed the adjudicator’s conviction in resolving the particular case. Accordingly, specific means were required to prove each right, their number varying with each right, while discrimination among witnesses was established a priori based on gender, age, occupation, or social class. That system was superseded by the Spanish Civil Procedure Act of 1855, which served as the basis for the procedural codes of Latin America, including Costa Rica. That Spanish legislation adopted the model of assessing the evidentiary record under the rules of sound judicial assessment (sana crítica).
This is the intermediate approach between legally prescribed evidence (prueba legal) and unfettered conviction (libre convicción). On the basis of sound judicial assessment, judges may independently reach a conviction regarding the truth of the facts on which they base their decisions through their own assessment; however, that assessment is not entirely unrestricted but is subject to the rules of formal logical thought and, simultaneously, to human experience. On this point, legal scholarship, particularly Couture, has stated that a judge is not a reasoning machine but, essentially, a human being who becomes aware of and understands the surrounding world through sensory and intellectual processes. In addition to logic, sound judicial assessment entails the proper consideration of certain propositions derived from experience that every person uses in life. Therefore, the judicial authority is responsible for assessing the evidence through proper logical interconnection and also in light of the circumstances of its surroundings, as observed through experience.
The purpose of the foregoing is to ensure that the adjudicator cannot rely solely on discretion but must explain, based on logic and experience, the grounds for the resulting conviction. This will also allow the higher court, if the judgment is challenged, to review whether the criteria applied by the court below (a quo) complied with those rules of correct human understanding. A third system is known as unfettered conviction. Under this system, the adjudicator’s decision need not necessarily be based on the evidence submitted by the parties to the proceedings. The adjudicator could even rule contrary to the proven facts and rely solely on the judge’s private knowledge. It would be sufficient for the judge to assert a moral certainty that the events occurred in a particular manner, without being required to set out the logical development of the reasoning. The Costa Rican Code of Civil Procedure employs a hybrid of the rules of sound judicial assessment and predetermined evidentiary weight.
That conclusion follows from provision 330, as well as from various regulations that are remnants of the former system concerning the weight of such evidence as confessions, public instruments (instrumentos públicos), documents that prevail over witness testimony, and the impossibility of proving certain facts solely through such testimony. Article 54, second paragraph, of the Agrarian Jurisdiction Act, for its part, provides as follows: “When ruling on the merits of the case (fondo del negocio), the judge shall assess the evidence conscientiously and without strict adherence to the rules of ordinary law, but, in all cases, when analyzing the result of the evidence gathered in the proceedings, shall state the principles of equity or law on which the judge’s determination is based.” Although the similarity in terminology might initially suggest that this provision conforms to the system of unfettered conviction, it does not, because the rule itself directs the adjudicator to provide legal or equitable grounds justifying the assessment.
A ruling was likewise issued on the subject when the Constitutional Chamber (Sala Constitucional), in judgment no. 11932, issued at 15 hours 37 minutes on 21 de noviembre del 2001, explained that evidence may not be assessed at the mere discretion of the judicial authority. Rather, Article 54 requires the judicial authority to “...analyze the result of the evidence gathered in the proceedings and state the principles of equity or law on which its determination is based, thereby respecting the minimum requirements of the right of defense.” In the cited ruling, that Chamber refers to its judgment no. 4448, issued at 9 hours on 30 de agosto de 1996, in which it stated: “Thus, the conscientious assessment of evidence does not entail ruling arbitrarily, because every judge—as a public official—is subject to the principle of legality, which imposes the imperative that public action conform not only to the specific rules governing a particular subject but to the entire body of law; accordingly, a judge may not rule in disregard of constitutional principles and rights, since the judge is constrained by the rules of sound judicial assessment and the principles of reasonableness, which, when properly applied, bring judicial assessment into harmony with the Political Constitution.” It must therefore be concluded that Article 54 of the Agrarian Jurisdiction Act does not, in fact, permit adjudicators to follow a system of unfettered conviction.
Moreover, in view of the duties to provide reasons that it imposes and in light of its interpretation in constitutional case law, it subjects adjudicators to the rules of sound judicial assessment, insofar as they must employ reasoning that is logical and consistent with intersubjective human experience to justify their rulings. Given the absence of strict adherence to ordinary law, as the provision itself establishes, it must be understood that, unlike civil proceedings, there is no evidence with predetermined weight. Accordingly, when agrarian judges are alleged to have improperly assessed the evidence, what is actually being alleged is their failure, when explaining the basis of their conviction, to observe the rules of logic and experience that inform correct human understanding.’ (See judgment no. 712, issued at 15 hours 15 minutes on 26 de setiembre de 2005; the underlining does not appear in the original).
Based on these statutory premises and in accordance with the legal system, the arguments raised against the challenged judgment will now be analyzed.” Under the system for weighing evidence established in the cited Article 54, the evidence must be assessed as a whole and not in isolation. First, those assertions contained in the responsive pleading (libelo de respuesta) must be contrary to the asserting party’s interests and must then be weighed against the remaining evidence in order to reach the conviction necessary to grant the relief sought (pretensiones) in the complaint. In any event, a review of the complaint in images 125 to 129, as well as the party testimony (declaración de parte) of defendant [Nombre2], reveals no personal facts contrary to that party’s interests and favorable to the opposing party, as required by provision 338 of the Code of Civil Procedure applicable to this matter. The party testimony of [Nombre1] is in the same position.
V.The appellate brief argues that eviction (desahucio) is warranted on the ground of mere tolerance (mera tolerancia). It states that there is evidence concerning ownership of the occupied area and that tilapia farming was permitted there for one year. Mere tolerance is understood as “mere generosity,” that is, “a permissive act characteristic of the owner of the property, which may be rebutted only by proof, in this case by the defendant, that the defendant holds possession (posesión) of the property on a ground other than the plaintiff’s permission” (judgment 663 of 21 September 2004 and 761 of 8 October 2004 of the Agrarian Court. See also judgments numbers 234 of 20 April 1994 and 729 of 18 July 2011). Mere tolerance arises from facts or reasons of a nonlegal nature, such as friendship, charity, kinship, gratitude, neighborliness, or indulgence, among others. This ground is not established if possession is exercised for legal reasons, that is, if it originates from a transaction or contract establishing conditions for its exercise, such as a term, performance obligations, or other duties.
Nor is it established if entry occurred without authorization or for reasons unrelated to the person claiming to hold an ownership or possessory right over the land. Because mere tolerance constitutes mere generosity, whoever permits possession or occupancy of property may terminate that situation at any time (see on this issue judgments 3 of 14 January 1994 of the First Chamber and 112 of 16 February 2010, 144 of 16 March 2001, 682 of 24 October 1997, and 624 of 9 August 1995 of the Agrarian Court). Possession by mere tolerance creates no right in favor of the person exercising it. It remains subject to the holder of possession claiming it at any time and recovering it through a judicial ruling if it is not returned voluntarily (see judgments of the Agrarian Court, 724 of 7 October 1993 and 514 of 28 June 2007). Regarding the requirements for proceedings of this type, in addition to the formal requirements established in Article 448 of the Code of Civil Procedure (which include specifying the ground on which eviction is sought), this Court has explained: “…
Article 449 of the Code of Civil Procedure, applied supplementarily, provides that standing to bring an eviction action shall be held by anyone who demonstrates an ownership or possessory right over the property under any lawful title…. As for standing to be sued, it shall be held by the tenant, subtenant, assignee, occupants, and persons possessing the property at sufferance (precario) or by mere tolerance, as the cited provision states…” (judgments 663 of 21 September 2004, 299 of 23 March 2006, 761 of 8 October 2004, and 20 of 12 January 1995). The burden of proving title to the property and the ground invoked rests with the party bringing the action. However, if the defendant disagrees with or denies that ground, the defendant bears the burden of proving the basis on which possession of the property is claimed or, as applicable, the reason why that ground is not established. This is pursuant to the rules governing burdens of proof under Article 317 of the Code of Civil Procedure, applied supplementarily.
In this case, it has been established that the commercial company is the registered owner of the portion where the tilapia-farming ponds are located, a matter that is not disputed. Regarding standing to be sued, it is at this point that the reasons for occupying the property must be specifically analyzed. It must also be emphasized that the defendant’s possession must not arise from legal grounds, such as the existence of a transaction or contract giving rise to that occupancy, as explained above. An assessment of the testimony as a whole leads to the conclusion that the aquaculture activity in question was begun approximately 25 years ago by the father of [Nombre1] and [Nombre3], Mr. [Nombre4]. It has likewise been established that, before the property was transferred into the name of the plaintiff company, although the date was not specified, the trout-farming activity and operation of the lodges were conducted by the brothers [Nombre1] and [Nombre3].
At the time of the latter’s death, they separately managed each of the activities described. On this point, all the witnesses consistently referred to the origins of the trout-farming business. This Chamber notes that it does not consider [Nombre4]’s testimony biased, because his account is precise and consistent with those of the other witnesses, and it does not appear that he has an interest in the matter. Nor is the testimony concerning the indicated facts given by the defendant’s mother, [Nombre6], afforded less weight; it must be considered that all the witnesses are related by marriage or blood, but that circumstance is not a basis for automatically disregarding their statements. The witness [Nombre5] stated that he is the brother-in-law of the plaintiff’s attorney-in-fact and that the defendant is his nephew by marriage. He stated that he did not know who owned the trout ponds. He explained, however, that he lives across from that area and can see the sector from a large window.
He identified [Nombre2], the father, and a worker as performing work at that location. He stated that the defendant entered to feed or remove trout, but not [Nombre1]. He indicated that he did not know who owned the ponds used to raise those fish, but stated that he had observed [Nombre1], the father, and [Nombre2]’s father, reiterating that he saw all three in the disputed area. The witness [Nombre6] is [Nombre1]’s sister-in-law, [Nombre3]’s widow, and the mother of the defendant, [Nombre2]. She explained that the lakes or breeding ponds are currently managed by her son but were previously managed by her husband, [Nombre3]. She explained that their father worked there for a time and then, more than 25 years ago, transferred them to [Nombre3] and [Nombre1] so that they could work together. She stated that her husband died and [Nombre2] continued with the project, which had existed for more than 25 years.
Regarding the construction of those ponds, she stated that they had been built by Mr. [Nombre4] and [Nombre3], who were the ones who began the operation. After some time, Mr. [Nombre4] transferred it to [Nombre1] so that he could work with [Nombre3]. She stated that, over time, [Nombre1] managed the lodges and [Nombre3] managed the trout ponds. As relevant here, she said that after [Nombre3]’s death, his son [Nombre2] continued the activity. The witness [Nombre7] stated, as relevant here, that she is married to [Nombre1], the plaintiff’s representative, and is the aunt by marriage of the defendant, [Nombre2]. She related that the defendant entered the property some time after [Nombre3]’s death and stated that, before then, he did not have permission to enter the property. She said that [Nombre2] was granted the period of one trout harvest in which to operate and that he then had to leave.
She stated that the trout operation had existed for about 15 years because her children would have been about five years old when it began. The ponds were built by [Nombre1] and [Nombre3], and she did not know whether Mr. [Nombre4] had participated. Regarding the work performed by [Nombre1] and [Nombre3], she explained that they were brothers and shared the profits from the lodges and the lake. She specified that no payment was made in connection with [Nombre2]’s occupancy. For his part, [Nombre4] is the father of [Nombre1], the commercial company’s attorney-in-fact, and the grandfather of the defendant, [Nombre2]. He spontaneously, clearly, and precisely explained that the farm was large, but that work began on that small portion approximately 25 years ago and that he gave it to the two brothers. He later transferred the documents without considering what might happen. He said that before the late [Nombre3], [Nombre2]’s father, died, he transferred everything to [Nombre1] by deed.
He stated that he built one of the lakes; [Nombre3] began working in the trout operation, and later [Nombre3] and [Nombre1] built the small lodges; they built another lake, principally [Nombre3]. They worked there together. They divided the profits equally. They later separated their activities, with one operating the lodges and the other the lakes. When [Nombre3] died, [Nombre2] continued working. He described how the trout were marketed; he also stated that [Nombre3] and [Nombre2] did not rent because the former worked there as the owner, and no rent was paid. He said that [Nombre2] worked there because he had a right to do so. An assessment of the testimony as a whole clearly shows that the work performed by the co-defendant derives from an apparent contractual relationship between the late [Nombre3] and his brother [Nombre1], attorney-in-fact for the plaintiff company; consequently, it is not possible in these summary proceedings (vía sumaria) to determine whether the defendant’s occupancy is by mere tolerance or whether there is some legal relationship that defeats that tolerance.
As noted, one of the requirements for this ground to apply is that the defendant must rebut mere tolerance. In the case at bar (subjúdice), it is evident from the statements of all the witnesses that a contractual relationship existed between the brothers [Nombre1] and [Nombre3] for the operation of the trout ponds and lodges, without any intention at this stage to delve further into the details of that relationship. It is unknown, however, whether that relationship has been wound up, although the defendant may have continued that activity following the death of his father, [Nombre3]. For that reason, it has not been clearly established that the occupancy is by mere tolerance or that [Nombre2]’s actions can be separated from the work previously performed by his father. Accordingly, if the parties so wish, they may litigate their claims in accordance with law in broader proceedings, but the relief sought in the complaint cannot be granted through this procedure pursuant to Article 449 of the Code of Civil Procedure, as applied in this field. The appealed judgment shall therefore be affirmed for the reasons stated at this level of review.
POR TANTO:
As to the matters appealed, the judgment issued at fourteen hours and six minutes on the twenty-ninth of April of two thousand nineteen is affirmed.

VOTO N° 000668-F-2019 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las quince horas y treinta y ocho minutos del veintinueve de agosto de dos mil diecinueve.
PROCESO DE DESAHUCIO planteado por GRUPO QUETZALCOATL SOCIEDAD ANÓNIMA, cédula jurídica CED1 - - , representada por su presidente con facultades de apoderado generalísimo sin límite de suma el señor [Nombre1] , mayor, casado, empresario, vecino de San Gerardo, Dota, Copey, San José, cédula de identidad número CED2 - - ; contra [Nombre2] , mayor, casado, comerciante, vecino de San Gerardo de Dota, cédula de identidad número CED3 - - . Interviene como tercero interesado la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por su procuradora Yannia Salas Víquez, mayor, abogada, vecina de San José, cédula de identidad CED4 - - . Actúa como apoderada especial judicial de la sociedad actora la letrada Jazmín Hidalgo Quesada, cédula de identidad número CED5 - - , colegiada veintidós mil setecientos treinta y uno; y como abogado director de la parte demandada el licenciado José Roberto Quirós Brenes, colegiado diez mil ciento sesenta y dos. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón.
RESULTANDO:
1. La parte actora interpone proceso desahucio, para que en sentencia se declare lo siguiente: "Se declare con lugar la presente demanda. Que se tenga como propietario y poseedor único y exclusivo a Grupo Quetzalcoalt S.A. Que para los efectos del presente desahucio se tenga que la finca desarrolla actividades agrarias productivas propias de una empresa agraria. Que se tenga que la actividad desarrollada por el accionado está limitando e interfiriendo con el proyecto turístico que desarrolla mi representado en su propiedad y que por tanto dichas pozas deben eliminarse y las truchas deben ser desalojadas. Que se tenga por demostrada la mera tolerancia en el uso de una poza justificado ello por la relación de consanguinidad entre el accionante y el demandado. Que hubo incumplimiento por parte del accionado con respecto al tiempo y uso o destino de las piscinas. Que se declare que el accionado incumplió lo pactado de manera ilegítima y sin consentimiento del propietario amplió unilateralmente el plazo de uso de las piscinas.
Que se eliminen por completo las piscinas por comprometer la seguridad de los visitantes y los trabajadores. Se ordene al demandado el desalojo de las truchas de las piscinas que utiliza actualmente. Se condene al pago de ambas costas personales y procesales", (ver escritorio virtual del Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, documentos asociados, parte 1 expediente físico escaneado incorporado el 21/03/2018 a las 13:22:56, imagen 16).
2. El demandado contestó negativamente la demanda interponiendo las excepciones de falta de derecho, falta de capacidad, falta de legitimación y la sine actione agit, así como las excepciones de litis consorcio activo necesario y la de litis consorcio pasivo necesario (ver escritorio virtual del Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, documentos asociados, parte 1 expediente físico escaneado incorporado el 21/03/2018 a las 13:22:56, imagen 53 a 57).
3. El Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, en el auto-sentencia número 40-2017, de las trece horas cincuenta y cinco minutos del cuatro de mayo del año dos mil diecisiete, se resuelven las excepciones previas de litis consorcio activo necesario, litis consorcio pasivo necesario y falta de capacidad, (ver escritorio virtual del Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, documentos asociados, parte 4 expediente físico escaneado incorporado imágenes del 28 al 30.
4. El Juez William Roberto Arburola Castillo, del Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, en sentencia número 2019000034, de catorce horas y seis minutos del veintinueve de abril del año dos mil diecinueve resolvió: “De las citas legales indicadas, los argumentos expuestos y jurisprudencia trasnscrita se rechazan las excepciones de sine actione agit, falta de legitimación tanto activa como pasiva, se acoge la excepción de falta de derecho. SE DECLARA SIN LUGAR en todos sus extremos la demanda de desahucio interpuesta por GRUPO QUETZALCOALT SOCIEDAD ANÓNIMA, representada por su presidente [Nombre1] en contra de [Nombre2] . Se exime del pago de ambas costas del proceso a la parte vencida en pretensiones. Se ordena de oficio testimoniar piezas y remitirlas a la fiscalía para que se investigue la posible comisión de un delito contra el ambiente", (ver escritorio Virtual del Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, documentos asociados, sentencia de primera instancia incorporada el 18/09/2018 11:47:31).
5. La parte actora interpuso recurso de apelación con indicación expresa de las razones en que se apoyaron para refutar la tesis del juzgado de instancia, (ver escritorio Virtual del Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, escrito incorporado el 07/05/2019 02:52:01).
6. En la substanciación del proceso se han observado las prescripciones legales, y no hay errores u omisiones capaces de producir la nulidad del fallo.
Redacta la jueza Díaz Bolaños; y,
CONSIDERANDO:
I.Se comparte el conjunto de eventos demostrados por tener buen sustento en los autos. De igual linaje se incluye el siguiente: VII) La actividad acuicultura relatada en el evento probado V inició hace aproximadamente 25 años por el padre de [Nombre1] y [Nombre3] , el señor [Nombre4] (declaración testimonial de [Nombre5] , [Nombre4] , [Nombre6] , [Nombre7] en soporte de audio agregadas al expediente virtual en la carpeta de documentos asociados por cada uno de los nombres de las personas testigas del 03 de abril de 2019). VIII) Antes del traspaso de la propiedad a nombre de la empresa actora, sin precisar fecha, la actividad de cultivo de truchas y explotación de los ranchos era desarrollada por los hermanos [Nombre1] y [Nombre3] , quienes con el paso del tiempo administraban de manera separada cada una de las actividades (Declaración de [Nombre4] , [Nombre5] , [Nombre6] y [Nombre7] en soporte de audio agregadas al expediente virtual en la carpeta de documentos asociados por cada uno de los nombres de las personas testigas del 03 de abril de 2019).
III.Se apela la sentencia de las 14 horas 06 minutos del 29 de abril de 2019 visible en la imagen 366 del expediente virtual del Juzgado Agrario de Pérez Zeledón en modo PDF. En tal decisión se declaró sin lugar la demanda de desahucio por mera tolerancia, sin especial condenatoria en costas. Se ordenó el testimonio de piezas para ser remitidas a la Fiscalía General de la República para la investigación de un posible delito contra el ambiente. La impugnación es rubricada por la abogada Jazmín Hidalgo en su calidad de apoderada especial judicial de la actora Grupo Quetzalcóatl Sociedad Anónima según memorial en cuadros 386 a 389. Recrimina la indebida valoración de la prueba al no hacer un análisis integral de tales con el dicho del accionado durante el proceso, y especialmente con la contestación de la demanda. Sostiene existe probanza que este asunto responde a una mera tolerancia. El anterior propietario fue [Nombre4] quien dispuso de su propiedad vendiendo a la actora.
Remite al considerando quinto de la pieza apelada, en cuanto no existió prueba contundente respecto a que existiera permiso por parte de su representada hacia el demandado para ejercer ciertos actos sobre el terreno y que prueba de la tolerancia solo se tuvo la declaración de [Nombre7] . Esa persona a su entender expresó el demandado inició el uso de las pozas para el cultivo de trucha después de haber solicitado la autorización sin recibir retribución económica. Indica el recurso, esa deponente afirmó no había beneficio patrimonial de ningún tipo debido a la relación por consanguinidad entre el actor y el demandado. Que tal permiso estaba condicionado a un periodo de tiempo, consistente en una temporada equivalente a un año calendario aproximadamente, según el ciclo biológico de la actividad, así mismo que una vez transcurrido ese periodo el actor solicitó el desalojo. Sostiene el a quo le restó importancia a tal dicho.
También hace referencia a lo indicado por la testiga respecto a las mejoras y denuncia realizada por esa persona. Critica en la sentencia se tuvo por demostrada la posesión del accionado basado en el testimonio del abuelo quien se beneficia con la actividad ejercida porque las truchas se venden en un restaurante de su propiedad. Considera, es una prueba irrefutable que el testigo es complaciente y tiene interés directo en el resultado del proceso. Respecto a la deposición de [Nombre6] madre del demandado, le mereció credibilidad pese a tratarse de manifestaciones de referencia, pues es contundente en exteriorizar se trata de lo indicado por el propio accionado. En cuanto al área donde se desarrolla la actividad se constata a pesar de los reconocimientos realizados, se continua ampliando la actividad. Señala, esa fue una de las razones para que le devolviera en la materialidad del terreno porque no hizo reparo en el daño ambiental que pudo ocasionar, así como la perturbación a la propiedad. Pide se revoque la sentencia y se tenga con lugar las pretensiones en cuanto el accionado debe desalojar de inmediato el predio.
IV.En lo medular la apelación gira en torno al valor dado a la probanza testimonial. Se hace la aclaración que en la especie resulta de empleo el código del proceso civil de 1989 debido a los transitorios I de la Ley 9242 y II de la Ley 9243, porque el expediente inició el 04 de julio de 2016 según sello de recibido de la demanda en imagen 91. Tocante al valor dado a las afirmaciones soportadas en la contestación de la demanda de conformidad con el artículo 341 del Código Procesal Civil de 1989 de empleo en la materia las aserciones contenidas en los escritos que se refieren a hechos personales de la parte se tendrán como confesión de éstos. Empero, en materia agraria el artículo 54 de la Ley de Jurisdicción Agraria establece el sistema de valoración probatoria. Es importante señalar sobre este sistema de ponderación la Sala Primera de la Corte en sentencia número 60-2011 de las 9 horas 15 minutos del 27 de enero de 2011 indicó: "Conforme al numeral 54 de la LJA, en materia agraria, la prueba debe ser valorada “a conciencia y sin sujeción estricta a las normas del derecho común, pero, en todo caso, al analizar el resultado de la prueba recogida en el proceso, deberá expresar los principios de equidad o de derecho en que basa su criterio.” Por su parte el mandato 61 ibídem determina “La Sala de Casación, a la hora de apreciar la prueba y de resolver el negocio, se regirá por lo dispuesto en el artículo 54 y, en general, por los principios que informan esta ley.” En lo atinente a este tema, esta Sala indicó: “IV.
En el sub júdice la discusión gira en torno a un punto concreto: la apreciación del material probatorio, en cuanto a cuál de las partes incumplió el contrato. La forma cómo deben los jueces apreciar la prueba, ha variado a lo largo de la historia del Derecho Procesal. En una primera etapa, anterior a las codificaciones decimonónicas, se partía de un sistema tasado para discernir sobre la fuerza demostrativa de cada elemento. Así, la ley de antemano imponía valor a cada probanza, sin que el juzgador estuviera en la posibilidad de decidir, por sí mismo, cuáles elementos informaban mejor su convicción para resolver el caso concreto. De esa manera, se requerían medios específicos para demostrar cada derecho, variando su cantidad en torno a cada uno, así como estableciendo, a priori, discriminaciones sobre los declarantes en razón de su género, edad, oficio o clase social. Ese sistema fue superado en la Ley de Enjuiciamiento Civil española, de 1855, que sirvió de base a los códigos procesales de América Latina, incluyendo a Costa Rica.
En dicha legislación hispana se acogió el modelo de apreciar el material demostrativo a la luz de las reglas de la sana crítica. Se trata de la figura intermedia entre la prueba legal y la libre convicción. Con fundamento en la sana crítica, el juez puede llegar a un convencimiento por sí mismo sobre la certeza de los hechos sobre los cuales basa su decisión, a través de su propia valoración, pero, esta no es del todo libre, sino que está sujeta a las normas del pensamiento lógico formal y, de manera simultánea, a la experiencia humana. Sobre el punto ha expresado la doctrina, en especial, Couture, que el juez no es una máquina de razonar, sino, esencialmente, un ser humano que toma conocimiento del mundo que le rodea y le conoce a través de sus procesos sensibles e intelectuales. La sana crítica es, además de lógica, la correcta apreciación de ciertas proposiciones de experiencia de que toda persona se sirve en la vida.
Por lo tanto, la autoridad judicial estará encargada de apreciar las probanzas con una debida concatenación lógica y, además, bajo las circunstancias de su entorno, observadas mediante la experiencia. La finalidad de lo anterior es que el juzgador no podrá acogerse tan solo a su discrecionalidad, sino que deberá fundamentar, con base en la lógica y la experiencia, los motivos de su convicción. Esto, además, permitirá al superior, si se impugna el fallo, revisar si los criterios del a quo, se sujetaron a tales reglas del correcto entendimiento humano. Un tercer sistema es el denominado como de libre convicción. En este, lo que decida el juzgador no deberá estar sujeto, necesariamente, a la prueba aportada por las partes al proceso. Incluso, podría resolverse contra los hechos probados y tener asidero tan solo en el saber privado del juez. Bastará con que este afirme tener la certidumbre moral de que los hechos sucedieron de tal manera, sin que se le pueda exigir el desarrollo lógico de su razonamiento.
El Código Procesal Civil costarricense se enmarca en un híbrido entre las reglas de la sana crítica y la prueba tasada. Tal conclusión se extrae del precepto 330, así como de diversas regulaciones, resabios del sistema anterior, en torno al valor de los medios demostrativos como la confesión, los instrumentos públicos, los documentos que prevalecen sobre las declaraciones testimoniales y la imposibilidad de probar algunos hechos tan sólo con estas últimas. Por otra parte, la Ley de la Jurisdicción Agraria, en su artículo 54, párrafo segundo, dispone lo siguiente: “Al resolver sobre el fondo del negocio, el juez apreciará la prueba a conciencia y sin sujeción estricta a las normas del derecho común, pero, en todo caso, al analizar el resultado de la prueba recogida en el proceso, deberá expresar los principios de equidad o de derecho en que basa su criterio.”. Aunque, por similitud de terminología, en principio, podría interpretarse que se ajusta al sistema de libre convicción, en realidad no es así, pues la propia norma ordena al juzgador dar argumentos de derecho o de equidad para justificar su apreciación.
Asimismo, hubo pronunciamiento sobre el tema, cuando la Sala Constitucional, en su sentencia n.º 11932 de las 15 horas 37 minutos del 21 de noviembre del 2001, explicó que la prueba no puede valorarse al mero arbitrio de la autoridad judicial. Más bien, dicho numeral 54 la obliga a que “...analice el resultado de la prueba recogida en el proceso y exprese los principios de equidad o de derecho en que basa su criterio; respetando de tal modo los contenidos mínimos del derecho de defensa.” Dicha Sala, en el voto de cita, refiere a su sentencia n.º 4448 de las 9 horas del 30 de agosto de 1996, donde expresó: “De esta manera, la apreciación de la prueba en conciencia no implica resolver en forma arbitraria, por cuanto todo juez –como funcionario que es- se encuentra sujeto al principio de legalidad, el cual constituye un imperativo de adecuación de la acción pública, no sólo de las normas específicas sobre un objeto determinado, sino a todo el bloque de legalidad; por lo que no puede fallar con desprecio de los principios y derecho constitucionales, ya que está limitado por las reglas de la sana crítica y principios de razonabilidad, que debidamente aplicados conducen a la armonía de la apreciación jurisdiccional con la Constitución Política” Entonces, debe concluirse, en realidad, el ordinal 54 de la Ley de Jurisdicción Agraria no permite al juzgador acogerse a un sistema de libre convicción.
Aún más, a partir de los deberes de fundamentar que se imponen y, a la luz de lo interpretado en la jurisprudencia constitucional, lo está sujetando a las reglas de la sana crítica, en el tanto, debe procurar un razonamiento lógico y acorde a la experiencia humana intersubjetiva para justificar lo que dispone. Por falta de sujeción al derecho común, según regula el propio precepto, habrá de entenderse que, a diferencia de los procesos civiles, no habrá prueba tasada alguna. En ese tanto, cuando se acuse una indebida valoración probatoria, por parte de los jueces agrarios, en realidad se estará acusando la inobservancia a las reglas de la lógica y de la experiencia, que informan el correcto entendimiento humano, al momento de fundamentar su convicción.” (Véase sentencia no. 712, de las 15 horas 15 minutos del 26 de setiembre de 2005, lo subrayado no corresponde al original). Con base en estas premisas normativas y acorde al ordenamiento jurídico, se procederá a analizar lo referente a los cargos esgrimidos, en relación a la sentencia dictada recurrida".
Conforme al sistema de valoración de la prueba dispuesto en el artículo 54 citado se deberá realizar en conjunto y no de manera aislada. En primer orden esas aseveraciones contenidas en el libelo de respuesta han de ser contraria a sus intereses y luego contrastadas con las restantes probanzas en aras de llegar al convencimiento necesario para acceder a las pretensiones elencadas en la demanda. En todo caso revisado el pliego de demanda en imágenes 125 a 129 así como la declaración de parte del accionado [Nombre2] , no hay hechos personales contrarios a sus intereses y favorables al adversario de conformidad con el numeral 338 del Código Procesal Civil de empleo en esta materia. En esa misma situación se ubica la declaración de parte de [Nombre1] .
V.Se argumenta en el pliego recursivo sobre la procedencia del desahucio por la causal de mera tolerancia. Se indica hay probanza sobre la propiedad de la zona ocupada y que se le permitió el cultivo de tilapia por un año. La mera tolerancia se entiende como una “mera liberalidad”, es decir, “un acto permisivo propio de quien es dueño del inmueble, pudiendo rebatirse la misma sólo mediante la demostración, en este caso de la parte demandada, de que ostenta la posesión del fundo por una causal distinta de la permisibilidad de la actora” (voto 663 del 21 de setiembre del 2004 y 761 del 8 de octubre del 2004 del Tribunal Agrario. También sentencias números 234 del 20 de abril de 1994 y 729 del 18 de julio del 2011). La mera tolerancia tiene como causa hechos o motivos de carácter extrajurídico, como la amistad, la caridad, el parentesco, el agradecimiento, la buena vecindad, la condescendencia, entre otros.
No se configura esta causal si la posesión se ejerce por motivos jurídicos, es decir, si existe un negocio o contrato que la origine, a través del cual se establezcan condiciones para su ejercicio, como plazo, prestaciones, obligaciones por ejemplo. Tampoco si el ingreso es sin autorización o por causas ajenas a quien reclama ser el titular de un derecho de propiedad o de posesión sobre el terreno. En la mera tolerancia, al ser una mera liberalidad, quien permite la posesión o ocupación de un bien, puede ponerle fin a la situación en cualquier momento (ver sobre el tema votos 3 del 14 de enero de 1994 de la Sala Primera y 112 de 16 de febrero del 2010, 144 del 16 de marzo del 2001, 682 del 24 de octubre de 1997 y 624 del 9 de agosto de 1995 del Tribunal Agrario). La posesión por mera tolerancia no genera ningún derecho a favor de quien la ejerce. Está a expensas de que la persona titular de la posesión pueda reclamarla en cualquier momento y recuperarla a través de un fallo judicial, si no se le devuelve voluntariamente (ver votos del Tribunal Agrario, 724 del 7 de octubre de 1993 y 514 de 28 de junio del 2007).
Respecto de los presupuestos de este tipo de procesos, aparte de los formales establecidos en el artículo 448 del Código Procesal Civil (que incluyen especificar la causal por la cual se pide el desalojo), este Tribunal ha explicado: “… dispone el artículo 449 del Código Procesal Civil aplicado supletoriamente, la legitimación para el planteamiento de la demanda de desahucio la tendrá quien demuestre tener derecho de propiedad o de posesión sobre la finca por cualquier título legítimo…. Ahora bien, la legitimación pasiva la tendrá el arrendatario, el subarrendatario, el cesionario, los ocupantes y los poseedores del inmueble en precario o por pura tolerancia, según reza la citada norma…” (votos 663 del 21 de setiembre del 2004, 299 de 23 de marzo del 2006, 761 del 8 de octubre del 2004 y 20 del 12 de enero de 1995). La carga de la prueba de la titularidad sobre el inmueble y de la causal invocada corresponde a quien acciona.
Pero si la parte demandada no está de acuerdo o niega la causal, a ella le corresponde probar el motivo por el cual alega poseer el bien, o en su caso, la razón por la cual no se configura la causal. Lo anterior de conformidad con las reglas que rigen las cargas probatorias del canon 317 del Código Procesal Civil, aplicado supletoriamente. En este caso se tiene por demostrado la mercantil es la propietaria registral de la porción donde se ubican las piletas para el cultivo de tilapias aspecto que no es controvertido. Respecto a la legitimación pasiva, en este punto es donde se debe de analizar de manera puntual las razones por las cuales se está ocupando el predio. Por otra parte, es necesario subrayar, que la posesión ejercida por el demandado no debe responder a razones jurídicas, tales como la existencia de un negocio o contrato que origine esa ocupación, tal y como se explicó en líneas anteriores.
De la valoración en conjunto de la testimonial, se arriba a la conclusión, la actividad de acuicultura señalada inició hace aproximadamente 25 años por el padre de [Nombre1] y [Nombre3] , el señor [Nombre4] . De igual manera se comprueba, antes del traspaso de la propiedad a nombre de la empresa actora, pero sin precisar fecha, la actividad de cultivo de truchas y explotación de los ranchos era desarrollada por los hermanos [Nombre1] y [Nombre3] . Para el momento de la defunción del segundo administraban de manera separada cada una de las actividades reseñadas. En este punto, todos los declarantes son contestes en hacer referencia a la génesis del negocio de cultivo de truchas. Se advierte esta Cámara no considera complaciente la declaración de [Nombre4] pues su relato es preciso y coherente con las demás personas declarantes y no se desprenda tenga un interés en el asunto. Tampoco se le resta valor en los hechos indicados a la madre del demandado [Nombre6] y se debe considerar que todas las personas testigas les une vínculo familiar por afinidad o consanguinidad, sin que esa situación sea un factor para que automáticamente se descarten sus manifestaciones.
El declarante [Nombre5] dijo ser cuñado del apoderado de la actora y el demandado es sobrino por afinidad. Expuso desconocer quién es el dueño de los estanques de trucha. Sin embargo, explicó vive al frente de esa zona y desde un ventanal tiene visibilidad al sector. Identificó a [Nombre2], al papá y a un trabajador realizar labores en ese sitio. Menciona, el accionado ingresaba a alimentar o sacar truchas, pero no al [Nombre1] . Indicó desconocer de quién era propiedad las fosas para crianza del citado pez, pero reseñó haber observado a [Nombre1], al papá y al papá de [Nombre2], reiterando que observaba los tres en el sector en conflicto. La declarante [Nombre6] es la cuñada de [Nombre1] , la viuda de [Nombre3] y la mamá del accionado [Nombre2] . Explicó que en la actualidad los lagos o criaderos son administrados por su hijo, pero antes era por su esposo [Nombre3]. Explicó ahí trabajó un tiempo el papá de ellos y luego se los cedió a [Nombre3] y a [Nombre1] para que trabajaran en conjunto hace más de 25 años.
Expresó el esposo falleció y [Nombre2] continuó con el proyecto que ha estado por más de 25 años. Sobre la edificación de esas fosas, enunció fueron hechas por don [Nombre4] y [Nombre3] que fueron los que iniciaron. Luego de un tiempo don [Nombre4] se lo cedió a [Nombre1] para que trabajara con [Nombre3]. Reseñó con el paso del tiempo [Nombre1] administraba los ranchos y [Nombre3] los estanques con truchas. En lo de interés dijo después de la muerte de [Nombre3] se siguió con la actividad por parte de su hijo [Nombre2]. La testiga [Nombre7] indicó en lo de interés, estar casada con [Nombre1] el representante de la actora; es tía por afinidad del demandado [Nombre2]. Relató el demandado entró a la heredad tiempo después de la muerte de [Nombre3], e indicó antes de eso no tenía permiso para ingresar al predio. Mencionó a [Nombre2] se le concedió el plazo de una cosecha de truchas para explotar y que luego tenía que salir.
Aludió lo de las truchas tiene como 15 años de existir porque sus hijos tendrían como cinco años cuando inició. Las piletas las construyeron [Nombre1] y [Nombre3] y no sabe si don [Nombre4]. Respecto al trabajo de [Nombre1] y [Nombre3] explicó eran hermanos, ellos compartían las ganancias de los ranchos y el lago. Puntualizó en la ocupación de [Nombre2] no medio pago alguno. Por su parte [Nombre4] , es padre de [Nombre1] el apoderado de la mercantil y abuelo del demandado [Nombre2] . Explicó de manera espontánea, clara y precisa, la finca era grande, pero en ese pedacito se trabajó más o menos hace 25 años y se lo dio a los dos hermanos. Luego dio los papeles sin pensar lo que podía pasar. Dijo antes que el finado [Nombre3] muriera, el papá de [Nombre2], le traspasó todo por escritura a [Nombre1]. Expresó el hizo uno de los lagos; [Nombre3] empezó a trabajar en la trucha y luego [Nombre3] y [Nombre1] formaron los ranchitos; hicieron otro lago sobre todo [Nombre3].
Ahí trabajaron unidos. La ganancia se la repartían por partes iguales. Después se dividieron, uno trabajaba con los ranchos y el otro con los lagos. Cuando [Nombre3] falleció siguió trabajando [Nombre2]. Mencionó la forma de comercialización de la trucha; además que [Nombre3] o [Nombre2] no alquilaban porque el primero trabajaba ahí era porque era el dueño no se pagaba alquiler. Dijo [Nombre2] trabajaba ahí porque tenía derecho. De la ponderación en conjunto de las declaraciones, se desprende de manera diáfana el trabajo realizado por el codemandado se deriva de una aparente relación contractual entre el fallecido [Nombre3] y su hermano [Nombre1] apoderado de la sociedad actora, con lo cual no es posible en esta vía sumaria poder dilucidar si la ocupación del demandado es por mera tolerancia o si existe algún vínculo jurídico que enerve esa tolerancia. Se hizo ver, dentro de los presupuestos de procedencia de esta causal es que el demandado debe de desvirtuar la mera tolerancia.
En el subjúdice, es evidente lo indicado por todos los testigos, en cuanto existía entre los hermanos [Nombre1] y [Nombre3] una relación contractual para la explotación de las piletas de truchas y los ranchos, sin que se pretenda en esta instancia ahondar en más detalles de esa relación. Empero se ignora si ha sido liquidada, pero si subsiste una posible continuidad de esa actividad por parte del demandado en ocasión del fallecimiento de su padre [Nombre3] . Es por tal razón, no está comprobada de manera diáfana sea una mera tolerancia y que la actuación de [Nombre2] se pueda desvincular de la labor previamente realizada por su padre. De ahí, si las partes lo tienen a bien podrán en una vía más amplia debatir sus pretensiones conforme a derecho, pero por este procedimiento no es dable acceder a lo pedido en la demanda de conformidad con el canon 449 del Código Procesal Civil de empleo en la disciplina. Procederá dar confirmación a la sentencia apelada por las razones dadas en esta instancia.
POR TANTO:
En lo apelado se confirma la sentencia de las catorce horas seis minutos del veintinueve de abril de dos mil diecinueve.
