Appeal filed in these proceedings against [Nombre1], of legal age, born on cuatro de febrero de mil novecientos sesenta y nueve, holder of identity card number CED1 - - , for the offense of usurpation of public-domain property and other offenses, to the detriment of El Ambiente. Judges Xiomara Gutiérrez Cruz and Karen Valverde Chaves and Judge Marco Mairena Navarro participated in deciding the appeal. Attorneys Adrián Fernández Rodríguez, acting as Special Judicial Attorney-in-Fact for Truchas Reales de Costa Rica S.A. and also authenticating the brief submitted by defendant [Nombre1], and Luis Diego Hernández Araya, representative of the Ministerio Público, as well as attorney Beatriz Sarmiento Chávez, in her capacity as Criminal State Attorney, entered appearances in the appeal.
Whereas:
1. By judgment 557-2018, issued at ten hours and fifteen minutes on veintiocho de setiembre de dos mil dieciocho, the Trial Court of the First Judicial Circuit of the Southern Zone, Pérez Zeledón seat, ruled: “POR TANTO: Pursuant to the foregoing and articles 39, 41 and 50 of the Constitución Política; 1, 11, 21, 30, 45, 59 to 63, 75, 226 subsection 1), and 227 of the Código Penal; article 100 of the Ley de Conservación de la Vida Silvestre and its Regulations; and sections 1, 3, 6, 8, 9,10, 37,38, 75,76, 111,113,116, 119,142, 175,178, 265 to 270, 303, and 341 to 368 of the Código Procesal Penal, Decreto Ejecutivo N. 39078 JP, the objection alleging defective procedural activity (actividad procesal defectuosa) filed by defense counsel concerning the entry of public officials onto the property located at [Dirección1] is DENIED. Defendant [Nombre1] is ACQUITTED of all punishment and liability for the offense of VIOLATION OF THE LEY DE VIDA SILVESTRE IN THE FORM OF POLLUTION OF PUBLIC-DOMAIN WATERS. Defendant [Nombre1] is found criminally responsible as the perpetrator of the offense of USURPATION OF PUBLIC-DOMAIN PROPERTY, IN IDEAL CONCURRENCE OF OFFENSES (concurso ideal) WITH THE OFFENSE OF USURPATION OF WATERS, AND IS SENTENCED TO ONE YEAR OF IMPRISONMENT, to be served in the corresponding correctional facility, with credit for time spent in pretrial detention. The Civil Claim for Damages (Acción Civil Resarcitoria) brought by the State, represented by the Procuraduría General de la República, against [Nombre1] AND TRUCHAS REALES DE COSTA RICA SOCIEDAD ANÓNIMA is GRANTED with respect to the claim arising from the offense of USURPATION OF WATERS WITHOUT HOLDING THE CORRESPONDING CONCESSION. 2. Attorneys Adrián Fernández Rodríguez and Luis Diego Hernández Araya, and defendant José Miguel Víquez Mora, filed appeals against the foregoing ruling.
3. After the corresponding deliberation was conducted in accordance with article 466 of the Código Procesal Penal, as amended by Ley 8837, published on nueve de diciembre de dos mil once (Creation of the Appeal against Judgment), the Court considered the issues raised in the appeal.
4. The relevant legal requirements have been observed throughout the proceedings.
Judge Gutiérrez Cruz writes the opinion; and
Considering:
I.Appeals filed: The Court of the First Judicial Circuit of the Southern Zone, Pérez Zeledón Seat, issued judgment number 557-2018 at ten hours and fifteen minutes on veintiocho de setiembre del dos mil dieciocho. The following filed appeals against that decision: 1) Defendant [Nombre1]. 2) Prosecutor Luis Diego Hernández Araya. 3) Attorney Adrián Fernández Rodríguez, in his capacity as special judicial attorney-in-fact for defendant Truchas Reales de Costa Rica S.A. These appeals were admitted by this Chamber through an order issued at eleven hours and fifty minutes on veintiséis de febrero del dos mil diecinueve.
II.Oral hearing. The oral hearing on the grounds for challenge (motivos de impugnación) was held on 26 de marzo del 2019, with the Criminal Judgment Appeals Court of Cartago composed of Judges Jaime Robleto Gutiérrez and Marco Mairena Navarro and Judge Xiomara Gutiérrez Cruz. Attorney Adrián Fernández Rodríguez, defendant [Nombre1], and prosecutor Alejandro Alpízar Arrones participated. Because no evidence or expansions of the grounds for appeal were received, the issuance of this decision by a panel composed partly of judges different from those who attended the oral hearing does not violate due process (debido proceso).
III.In the first ground of his appeal, the defendant (imputado) alleges an erroneous assessment of the evidence and disagreement with the determination of the proven facts (hechos probados). He objects that proven fact number four, in stating that on cuatro de mayo all the water flowing through the channel of Río Buenavista was captured without leaving any remaining flow (caudal remanente), is erroneous because the judicial inspection (reconocimiento judicial) and witness testimony demonstrated that the water enters through one channel and immediately exits through another, and therefore that river channel never dries up; moreover, this would be impossible because the project has no structure capable of retaining the water that flows continuously at the site 24 hours a day. Furthermore, unlike on other dates, no measurement was taken of the remaining flow that would establish that all the water was captured that day.
He objects that the erroneous finding of this proven fact prejudiced him because it served as the basis for concluding that harm to the ecosystem had occurred, on the basis of which civil liability was imposed upon him, even though that harm has not been established. He also claims that, in the sixth fact alleged in the indictment (acusación), he is accused of causing damage to the State by failing to pay the fee (canon) for the use of the water, which cannot be held against him because the witness José Miguel Zeledón himself, the highest administrative authority on water matters, testified that the defendant offered to pay the fee and that no response was given to his request; he was not told how much he was required to pay, including during the criminal proceedings, because the Procuraduría General de la República rejected payment of the alleged debt without any basis. Lastly, the Dirección de Aguas granted his principal a concession for 21 liters and processed her request for an increase in flow, without informing her that she was required to pay any amount for water used before that concession was granted.
He asserts that he was prejudiced by the imposition of civil liability for failure to pay the fee, even though that failure resulted from circumstances beyond his control, in light of all the foregoing. He requests that the appeal be granted and that the civil damages action (acción civil resarcitoria) be dismissed. In the second ground of his appeal, the defendant objects to the erroneous assessment of the evidence consisting of the statements of the defendant, [Nombre2], and [Nombre3], and administrative litigation case file (expediente contencioso administrativo) number 17-000153-1027-CA. In support of his claim, he transcribes several excerpts from the statements given at trial. He asserts that they show that several facts should be deemed proven: that the Dirección de Agua of MINAE knows that producers operate without any concession and that they have been given informational sessions so that they may begin the corresponding procedures, whereas the defendant has authorization from SETENA and has filed a concession application; that there were contradictory decisions concerning whether he could take water from Río Buenavista, because he was told that he could not do so while at the same time he was granted a concession and his request for an increase in flow was processed; and that the company Truchas Reales de Costa Rica S.A. engaged in discussions regarding continuation of the concession-granting process, which resulted in an agreement between the parties to withdraw a lawsuit filed in “the administrative court proceedings.” On the basis of these facts, he alleges the existence of a mistake of law (error de prohibición) that was not properly assessed by the trial court (Tribunal a quo), in violation of Article 35 of the Código Penal.
He requests that the appeal be granted, that a judgment of acquittal be entered in his favor, and that the civil damages action be dismissed. In the third ground, the defendant alleges an error in the legal reasoning used to convict him of the offense involving public-domain property [sic]. He states that the offense involving public-domain property was inapplicable because Article 20 of the Ley de Aguas permits the construction of works within a river channel, as acknowledged by the witness [Nombre4]. Furthermore, the Dirección de Aguas did not warn him that dams or walls could not be constructed to capture the water; on the contrary, the witness [Nombre5] told him that it was impossible to capture the water without building a dam or similar structure because of the different elevations between the river water and the land where it was to be used. He also claims that this article applies to persons who have no right of possession, an element absent in this case because the defendant has such a right under the Ley de Aguas, notwithstanding which the Court failed to explain why it declined to apply the aforementioned Article 20.
Consequently, he asserts that the alleged conduct does not constitute a criminal offense and that the conviction entered against him causes prejudice. He requests that the appeal be granted, that a judgment of acquittal be entered in his favor, and that the civil damages action be dismissed. The claims are considered jointly and denied. The defendant’s challenges are based on a subjective interpretation of the evidence that also departs from the provisions of Costa Rican law. The judgment under appeal, insofar as it established the defendant’s criminal liability for the offenses of Water Usurpation (Usurpación de aguas) and Usurpation of Public-Domain Property (Usurpación de Bienes de Dominio Público), was properly reasoned. The analysis of the documentary and testimonial evidence, which included the defense evidence, as well as the accused’s statement, established, in summary, that between 26 de abril del 2016 and 30 de mayo del 2017 he ordered the construction of a gabion dam that he used to divert water from the channel of Río Bellavista and use it for his trout-farming project; after circulating through the aquaculture tanks, the treated water returned to that channel several meters downstream.
All of this occurred without the corresponding concession, which was granted to him after these events, meaning that on those dates he had no right to possess that public-domain property. The testimony of [Nombre6], an official of the Dirección de Aguas, was essential because he visited the defendant’s project in marzo del año 2015 in response to the defendant’s concession application and personally served him with a document warning him that he could not use the water until the requested authorization had been granted. In addition, [Nombre7], an inspector from the same Dirección de Aguas, observed the defendant’s diversion of the river water, concerning which the trial court analyzed: “The witness [Nombre7], in his capacity as an inspector for the Dirección de Aguas of Minaet, was responsible for visiting the accused’s trout-farming project and was able to observe his use of the water without the corresponding concession, as well as the construction of a work in the river channel to divert the water.
Thus, on 04 de mayo del año 2016, official letter DA-UHTPSOZ-0030-2016, signed by [Nombre7] and addressed to Engineer [Nombre6], stated that an inspection had been conducted at the site on 26 de abril del año 2016, in the area of [Dirección3], in the presence of Mr. [Nombre8], an employee of the defendant herein. At the water intake on Río Buenavista, it was possible to observe the capture of the river’s entire flow, leaving no remaining flow except for some leaks at the intake, by means of a dam-type structure in the river channel, as shown in figure number 1, at coordinate point CED2 described in figure 2. Flow gauging (aforo) was performed at the intake structure to determine the captured flow, using a current meter and obtaining a flow of 676,7 liters per second.” The official [Nombre4] also provided highly relevant information, stating that, as of the date when the two previous officials reported the defendant’s actions, the concession had not been granted.
The testimony of these three witnesses was properly weighed by the Trial Judge in relation to the documentary evidence: “Thus, the statements of the witnesses [Nombre4], [Nombre6], and [Nombre7] are supplemented by the documentary evidence identified above: the certified copies of administrative file 16145-A of the Dirección de Aguas, official letter DA-1402-2016 of the Dirección de Aguas, official letter Da-UHTPSOZ-0275-2016 of the Dirección de Aguas, official letter DA-UI-ITPSOZ-0030-2016 of the Dirección de Agua, and certification N. C-0237-2016 of the Dirección de Aguas. These support the conclusion that the defendant herein undertook the administrative procedures before the Dirección de Aguas of the Ministerio de Ambiente y Energía; nevertheless, without having been granted the corresponding concession, he proceeded to use water from Río Buenavista, located in [Dirección3], for which purpose he constructed an intake structure in the river channel to divert the river water to the project known as Truchas Reales de Costa Rica, over which he held judicial and extrajudicial representation, according to the certification of legal capacity number CED3- of the Registro Nacional.” Even the defense evidence confirmed the prosecution’s theory, because [Nombre2], the defendant’s wife, confirmed that he knew he did not have a concession, that he read the contents of the documents sent to him, and that he was the person who ordered the construction of the gabion wall to divert the waters.
Likewise, the defendant’s statement was analyzed in the judgment, and the existence of any mistake that might exempt him from liability was rejected: “It should be emphasized that the defendant’s statement shows that he is an experienced trout farmer with 25 years of experience; indeed, in the years 2015, 2016 and 2017, he began exporting trout to the United States, shipping fish twice a week, and exporting to Europe once a week. The accused has considerable experience in trout farming. In its closing arguments, the defense asserts that, when using water from Río Bellavista, Mr. [Nombre1] acted under a mistake of fact (error de tipo), because he did not know that he was required to await the final decision of the Dirección de Aguas. However, this is not true: the defendant was personally notified in el año 2015 that he could not use water from Río Buenavista.” Other witnesses provided general information concerning the concession process and the powers conferred by concessions, including [Nombre5], [Nombre9], and [Nombre10].
Therefore, contrary to the appellant’s assertions, the judgment did properly analyze the evidence and established his liability beyond any doubt. Thus, with respect to the capture of all the water on cuatro de mayo, there is no deficiency, because the official Gómez Céspedes observed it. This does not mean that the river dried up because, as established, the water flowed continuously, entered the defendant’s project, and flowed out again. What was proven, therefore, was that all the water passing through the channel at a particular time was diverted, although it later returned to the channel after being used in the trout project. Moreover, the argument suggesting that because other persons who, according to the defendant, committed similar acts were not tried, he should have been acquitted cannot be entertained. Criminal liability is strictly personal, and each person must be afforded proceedings conducted in accordance with law, as occurred in this case; that is, the defendant was prosecuted in accordance with the applicable law, and the conviction entered against him is lawful, regardless of whether other persons were prosecuted for similar acts.
Likewise, whatever may have occurred in the administrative litigation proceedings neither exempts him from criminal liability nor has any bearing whatsoever on these proceedings, and therefore the arguments concerning this issue are immaterial.
It was determined that the defendant (imputado) was personally notified of the prohibition against beginning to use the water until the concession (concesión) had been granted and that, accordingly, he was fully aware of that restriction, which rules out any mistake on his part, even if other legal avenues existed for litigating other aspects of the dispute. Both matters were properly addressed in the judgment: “In fact, the filing of administrative litigation (contencioso administrativo) against the State, which the defendant later withdrew because the officials negotiated to grant the concession, is not relevant to the case, because while the concession application was pending in 2016 and 2017, the accused proceeded to draw water from the rio Buenavista without State permission; it must be recalled that this is a public-domain asset (bien demanial), which citizens may not use as they please…
In light of the foregoing, it may be concluded that Mr. [Nombre1] was fully aware that he could not divert water from the river to his trout-farming project. Defense counsel (defensa técnica) alleged a purported custom among trout farmers concerning the use of water for their operations; that custom cannot create a legal right, much less cause the accused to make a mistake. It must be emphasized that Mr. [Nombre1] is not a small producer; he is a trout exporter, as he stated in his preliminary examination (declaración indagatoria). Likewise, officials from the Dirección de Aguas personally notified him that he was required to refrain from taking water from the river and that he could incur liability for the offense of Water Usurpation (Usurpación de Aguas). Consider that, at trial, the defendant stated that the only way to take water from the river and channel it toward the project was through a diversion structure (obra canalizadora) in the river, which the witness [Nombre2] corroborated by stating that the defendant built the structure in the rio Bellavista for the purpose of diverting water toward the trout-farming project…
As both defense counsel and the defendant personally (defensa material) have argued, Mr. [Nombre1] has allegedly been subjected to unequal treatment because criminal proceedings were initiated against him while other persons engage in fish farming (piscicultura) without the corresponding permits. Nevertheless, the foregoing does not support finding any exculpatory circumstance (eximente) in the accused’s case. It should be considered that the accused did know that the required procedures had to be completed before the Dirección de Aguas, because on 29 de noviembre del año 2012, he submitted to SETENA the D1 environmental assessment form (formulario de evaluación ambiental D1) and the sworn declaration of environmental commitments (declaración jurada de compromisos ambientales) for the water concession on the río Buena Vista and the aquaculture project, as recorded in the administrative case file (expediente administrativo) submitted as documentary evidence (prueba documental), which contains resolution N145-2013-SETENA.
Therefore, the accused is not in the same position as other trout farmers, because his statement at trial and the documentary evidence make it clear that he did know that he was required to complete the corresponding procedures to obtain the water and, consequently, authorization for the in-stream works (obra en cauce)…” Furthermore, what the appellant fails to consider in his arguments is that he was convicted of ordering the construction of a gabion wall (muro de gaviones) and using the waters of the Río without a permit, before the administrative-litigation proceedings began and before the concession was granted to him; in other words, he is faulted precisely for having resorted to self-help measures (vías de hecho) before obtaining legal authorization to use the water. Accordingly, his reference to article 20 of the Ley de Aguas is irrelevant, because it is undisputed that once the concession has been obtained, the necessary works may be constructed to use the water; the offense in this case occurred because he constructed both the gabion wall and the diversion of the vital liquid before the corresponding authorization was granted. For all the foregoing reasons, these grounds are denied. The claims concerning the civil action for damages (acción civil resarcitoria) will be analyzed in the seventh recital (considerando sétimo).
IV.In the first ground of his appeal (motivo de su recurso), the prosecutor challenges the determination of the proven facts (hechos probados). He bases his claim on articles 142, 363 subsection c), and 459 of the Code of Criminal Procedure (Código Procesal Penal). He argues that the trial court omitted the determination of the fifth fact in the indictment (acusación), specifically that, since 18 de marzo del 2015, the defendant has occupied public-domain property (bien de dominio público) by maintaining a dam made of gabions and stones in the riverbed (cauce) of [Dirección4], and that, as of that date, he was not yet diverting water from that river. This relates to proven fact number three, which was established through the witness [Nombre6] and the reports contained in the evidentiary file (legajo de prueba). He states that, in his testimony, that witness clearly described the presence of the gabion dam within the riverbed and the absence of any water withdrawal (captación de agua) since 18 de marzo del 2015; consequently, the fifth proven fact was inaccurate in identifying 26 de abril del 2016 as the date on which the defendant began occupying the public-domain property.
This modification led the trial judge to find that the defendant’s conduct constituted ideal concurrence of offenses (concurso ideal); however, it is evident that there was a material concurrence of offenses (concurso material), because the acts occurred at different times: the water withdrawal began in the year 2016, whereas the unlawful occupation (usurpación) occurred beginning in the year 2015. This affected the imposition of a sentence lower than that sought by the Ministerio Público due to the application of the rules governing ideal concurrence. He requests that the judgment be vacated and the case remanded for new proceedings (reenvío para nueva sustanciación). The claim is denied. The principle of congruence between the indictment and the judgment (principio de correlación entre acusación y sentencia) is one of the pillars of due process (debido proceso) and the right of defense (derecho de defensa).
In this case, the prosecutor’s contention that the trial judge omitted from the established factual basis (plataforma fáctica demostrada) the allegation that the accused had occupied public-domain property since 18 de marzo del 2015 is entirely unsupported, because that theory was included neither in the prosecution’s charging allegation (imputación fiscal) nor in the private prosecution complaint (querella). The Ministerio Público therefore could not expect the judgment to add such a fact, even if it had emerged from the evidence. In decision número 2017-265 de las catorce horas dos minutos del veintiséis de mayo de dos mil diecisiete, the First Section of this Court of Appeal ruled: “Article 303 of the Code of Criminal Procedure provides in subsection b) that the indictment must contain a precise and detailed account of the alleged criminal act. This is an obligation that is not merely statutory but suprastatutory, since it is also a human right enshrined in articles 8.1 of the American Convention on Human Rights and article 14 of the Inter-American Covenant on Civil and Political Rights, which guarantee every person accused of an offense the right to be informed ‘...in detail, of the nature and cause of the charge against him’ and ‘to have adequate time and means for the preparation of his defense....’ In other words, the human-rights protection system establishes the right to be informed of the charges (derecho de intimación), which requires the attribution of the facts to be detailed, precise, and specific, rather than generic, abstract, and lacking in particulars, since the latter would prevent any effective defense by the accused.
From this perspective, in determining compliance with that fundamental right, which is a prerequisite for the general right of defense, it is essential to ascertain whether the allegation made enables the accused to understand the unlawful act attributed to him so that he can adequately prepare his defense. Clearly, the precision required by those provisions calls for a specific act, rather than generic acts that make it impossible to know which one is at issue, and the required particulars must be those necessary to provide the means to contest the allegation, including spatial circumstances (the location where an act occurs), circumstances concerning the manner of commission (how it was carried out: with violence, by deception, clandestinely, by taking advantage of some circumstance, etc.), and temporal circumstances.” It is therefore evident that facts not included in the indictment could not be deemed established.
With respect to that date—18 de marzo del 2015—the allegation was limited to stating that the official Vargas Salazar went to the accused’s property because a water-concession application (solicitud de concesión de aguas) existed and warned him that he could not take or use any quantity of water because he might commit an offense. Neither in that section nor in any other was it alleged or stated that, as of that date, the defendant had constructed a gabion dam without diverting water from the river—the wording “before 26 de abril del 2016” is insufficient for that purpose. The prosecutor is therefore incorrect in arguing that an error occurred because that proposition was not included among the established facts. On the contrary, had the trial judge proceeded in that manner, she would have taken the defendant by surprise and seriously violated his right of defense. Furthermore, the prosecution’s argument rests on the contention that the defendant acted first by constructing the dam and later diverted the waters, but the allegation was not framed in that manner either.
The fifth fact states that, before 26 de abril del 2016, “for the purpose of profiting from the trout-farming activity,” the defendant created eleven aquaculture tanks and, “for the purpose of obtaining water for the operation of his commercial activity,” ordered the construction of the dam, through which he succeeded in withdrawing the water and channeling it to his aquaculture project. In other words, the prosecution’s theory on which the trial was conducted was not that the defendant had first constructed the dam by 18 de marzo del 2015 without using it and had later devised and carried out the diversion of the waters, as asserted in the appellate brief (libelo impugnatorio); nor did the private prosecution complaint include such a factual proposition. On the contrary, the wording used by the accuser, as shown by the quoted phrases just transcribed, established a single purpose that gave meaning to the defendant’s conduct: using the waters for his aquaculture project.
To that end, he arranged for the construction of the dam, the preparation of the tanks, and the diversion of the river water, which is precisely what was deemed proven. When analyzed in light of the criminal offenses (tipos penales) applied by the trial judge, this supports the conclusion that both the established factual basis and the finding that the matter involved ideal concurrence comply with the provisions governing criminal proceedings. The judgment therefore does not contain the alleged error. Lastly, it should be added that the seventh fact in the indictment, corresponding to the fifth proven fact, specified the defendant’s occupation of a public-domain area through the constructed dam and, specifically, determined that this act occurred beginning on 26 de abril del 2016. This is consistent with the other established facts and confirms that the relief sought by the prosecutor under this ground of appeal cannot be granted.
V.In the second ground, the prosecutor challenges the determination of the sentence to be imposed. He bases his objection on articles 367 and 459 of the Code of Criminal Procedure and article 71 of the Criminal Code (Código Penal). He argues that, although significant environmental harm occurred, the trial judge chose to impose the minimum sentence. To support his objection, he quotes an excerpt from the judgment concerning the reasons for the sentence (fundamentación de la pena) and states that the trial judge’s reasoning is insufficient in light of the proven facts. Specifically, consideration of the fourth fact—according to which the defendant withdrew all the water from the river, leaving none for third parties or wildlife in the area—reveals the contradiction in the reasoning supporting the imposition of the minimum sentence. He adds that only the defendant’s personal circumstances were assessed, and not the seriousness of the act, which warranted the imposition of a greater sentence.
He requests that the challenged judgment be partially vacated as to the sentence and that the case be remanded for new proceedings. The claim is denied. Upon examining the arguments raised on appeal, this Chamber finds that the prosecutor is incorrect because his argument rests on the mistaken premise that the defendant received the minimum sentence prescribed for the established offenses. The statutory sentencing range, in the abstract, for the offense of Unlawful Appropriation of Waters (Usurpación de aguas) under the Criminal Code (article 226) is one month to two years’ imprisonment or ten to one hundred fine-days (días multa), while the penalty for the offense of Unlawful Occupation of Public-Domain Property (Usurpación de bienes de dominio público) (article 227) is six months to four years’ imprisonment or fifteen to one hundred fine-days. The trial judge determined that, because of the ideal concurrence, the sentence applicable to the second of those offenses—the more serious one—should be considered, and she decided to impose one year of imprisonment.
In other words, she declined to impose the less severe penalty, which would have been a fine, and chose a term exceeding the minimum sentence of six months’ imprisonment established in article 227 of the Criminal Code. The length of this sentence is properly justified, proportionate to the proven conduct, and consistent with the accused’s culpability, taking into account not only the factors favorable to him but also those increasing the blameworthiness of his conduct. Accordingly, the prosecutor’s contention that the harm caused was not properly assessed is likewise unpersuasive, because the Court did take it into account. The weighing of those factors favorable and unfavorable to the accused, together with the rehabilitative purpose (fin resocializador), resulted in the imposition of a term of imprisonment exceeding the minimum, accompanied by a conditionally suspended sentence (condena de ejecución condicional).
The prosecutor identifies no other factors that were omitted from consideration and that should have been weighed to impose a greater sentence. In this regard, the judgment stated: “...there is certainly significant environmental harm, which is mitigated to some extent because the defendant’s actions did not cause an impact involving contamination of the water of the Buenavista River. Mr. [Nombre1] is a hardworking person and a business owner who, as is apparent from his testimony at trial, has advanced in the fish-farming activity and is entrepreneurial. Nevertheless, he harmed the environment by deciding to take water from the riverbed without possessing the corresponding permits to perform work in the riverbed and, at the same time, to use the water in the trout-farming project. The Court finds that this sentence fulfills the purposes of general prevention and positive special prevention (prevención general y especial positiva) that guide sentencing, insofar as the defendant must receive rehabilitative treatment enabling him to conform his conduct to the rules of peaceful coexistence and preventing him from committing further offenses against others in the future....” For the foregoing reasons, this ground is denied.
VI.In the third ground of his appeal, the prosecutor challenges the assessment of the evidence (valoración de la prueba). He bases his claim on Articles 459 of the Código Procesal Penal and 100 of the Ley de Conservación de Vida Silvestre. He argues that it was not deemed proven that the defendant discharged pollutants (sustancias contaminantes) into [Dirección4] because there was no substantial difference between the quality of the water entering the trout-farming project and that of the water exiting through the discharge channel (canal de desfogue). However, this conclusion is inconsistent with the evidence, because the expert witness [Nombre11] explained what science considers to be pollution and wastewater (aguas residuales), and that, in the production process conducted by the accused, he did add foreign agents to the water, thereby changing its physical, chemical, and biological characteristics; consequently, the liquid he discharged through his final production channel was not river water but wastewater.
This makes it unnecessary to analyze the river’s characteristics before the accused drew the water, because by adding fish excrement and food residue, he altered the water’s natural condition and converted it into wastewater, which, according to the expert witness, is an agent capable of causing pollution and of modifying the physical, chemical, and biological conditions of the river into which it was discharged. The witness [Nombre1] also classified the water discharged by the accused’s aquaculture project as wastewater because it was the product of a trout-production process. Accordingly, the accused’s duly proven conduct of discharging that water into the river, where it constituted a pollutant, establishes the offense charged by the prosecution, and the reasoning employed by the trial judge to reach a different conclusion is contrary to scientific principles. Furthermore, the quality of the water in the receiving water body (cuerpo receptor) upstream from the trout project is irrelevant, because the statutory definition of the offense (tipo penal) does not require it.
What matters is establishing that what was discharged was a pollutant; nor is it necessary to establish numerical values for the pollutant’s concentration in order for the conduct to satisfy the statutory elements of the offense (tipicidad). He argues that the Public Prosecutor’s Office was prejudiced because the evidence was assessed incorrectly and scientific principles were not applied. He requests that the judgment be vacated with respect to the ruling on this offense and that the case be remanded for new proceedings. The challenge is denied. Upon examining the ground raised, this Chamber finds that the acquittal issued by the court below is consistent with the provisions of our legal system regarding the offense charged, although several clarifications are necessary because some of the trial judge’s arguments are incorrect. Nevertheless, the conclusion she reached regarding the fact that the conduct attributed to the defendant did not satisfy the statutory elements of the offense is correct, so the prosecuting authority suffered no prejudice and its claim should not be granted.
The acquittal was based essentially on the following arguments: “Testimony was received from four professionals, namely, the court-appointed expert Francisco Calvo González, a chemist; José Miguel Ramírez Corrales, a chemist who serves as head of the Laboratorio de Aguas de Acueductos y Alcantarillados; [Nombre12], a microbiologist and director of the laboratorio de aguas de la Universidad de Costa Rica; and [Nombre13], a veterinarian employed by BIOMAR. All the aforementioned professionals, each speaking from the perspective of their respective specialty, stated that no polluting effect occurred in the river after the water entered the accused’s trout-farming project. This means that, when the water was discharged into the river, it was not possible to identify any wastewater, which, according to the Reglamento de Vertido y Reuso de Aguas Residuales, must be understood as water that has been used and whose quality has been altered by the introduction of pollutants.
Article 100 of the Ley de Conservación de Vida Silvestre provides that a sentence of one to three years’ imprisonment shall be imposed on anyone who discharges any pollutant into rivers. In this particular case, it must be shown that, during the process of discharging water into the river, the accused discharged polluted water; under Article 3 of the Reglamento de Vertido y Reuso de Aguas Residuales, a pollutant must be understood as any substance whose incorporation into the water results in the deterioration of its physical, chemical, and biological quality. Article 3 of the Reglamento del Canon Ambiental por Vertidos N. 34431 states that a pollutant is any element whose incorporation into a body of water entails deterioration of the water’s physical, chemical, or biological quality. It is evident in the case at hand that the accused did not discharge polluted water into the [Dirección5] river, as established by the expert and documentary evidence received.
The Prosecution contends that the offense established in Article 100 of the Ley de Conservación de Vida Silvestre, pollution of public waters, is a conduct offense (delito de mera actividad) rather than a result offense (delito de resultado); therefore, merely discharging the water into the river, even if it does not cause pollution, is sufficient to establish the statutory offense. The conduct punishable under the statutory offense set forth in Article 100 of the Ley de Conservación de Vida Silvestre does not consist of discharging substances without authorization. It is not a conduct offense but a result offense, because the substances deposited in the river must be pollutants. As explained above, the accused did not have authorization to discharge water into the river, but the water deposited after the production process did not cause any pollution.”
Certainly, as the prosecutor states, and contrary to the finding in the judgment, the statutory offense described in Article 100 is a conduct offense rather than a result offense; therefore, it is established by discharging the substances referred to therein into the river, without any need to establish that the body of water was polluted. Nor is it relevant to determine whether pollution existed upstream. Furthermore, when that article refers to “any pollutant,” that expression does not encompass the other substances described in the statutory offense, because discharging any one of them is itself sufficient to establish the offense, which provides: “A sentence of one (1) to three (3) years’ imprisonment shall be imposed, provided that a more serious offense is not established, on anyone who discharges sewage, blackwater, sludge, waste, or any pollutant into springs, rivers, creeks, permanent or intermittent streams, lakes, lagoons, marshes, natural or artificial reservoirs, estuaries, peatlands, swamps, wetlands, or fresh, brackish, or salt waters, within their channels or their respective protected areas (áreas de protección).
(As amended by Article 1° of Law N° 8689 of 4 de diciembre de 2008).” However, the fact that it is unnecessary to determine that the body of water was actually polluted does not mean that consideration may be omitted as to whether the discharged substances are capable of causing pollution. Accordingly, interpreting this statutory offense requires consideration of Decretos Ejecutivos Nº 33601 Reglamento de Vertido y Reuso de Aguas Residuales and Nº 34431 Reglamento del Canon Ambiental por Vertidos in order to define what constitutes sewage (aguas servidas), blackwater (aguas negras), or pollutants that may not be discharged into rivers. The prosecutor emphasizes that, according to the testimony of [Nombre11] and [Nombre1], the water discharged by the accused’s aquaculture project was wastewater, a point that is not disputed because both witnesses did, in fact, so state. Moreover, according to the Diccionario de la Real Academia de la Lengua Española, the concepts of blackwater and sewage are synonymous with wastewater (RAE.

However, contrary to the prosecutor’s contention, under our legal system that water does not in itself constitute a pollutant, as analyzed in the challenged judgment, because the cited decrees permit wastewater to be discharged—as relevant to this case—into rivers, provided that it complies with the standards and parameters established therein. This is consistent with the harm principle (principio de lesividad), which requires that only conduct causing material harm to the legally protected interests (bienes jurídicos) of concern to the Costa Rican State be criminalized. Accordingly, if the pollution levels in that water are below the limits established in those regulations, the discharge does not fall within the criminal offense.
The current Reglamento de Vertido y Reuso de Aguas Residuales contains the following relevant provisions: “Article 1º—Scope of application. This Regulation shall be mandatory throughout the national territory with respect to the management of wastewater, regardless of its origin, that is discharged or reused. Article 2º—Objectives. The purpose of this Regulation is to protect public health and the environment through environmentally sound wastewater management… Article 4º—Obligation to treat wastewater. Every generating entity (ente generador) shall treat its wastewater so that it complies with the provisions of this Regulation, thereby preventing harm to the environment, health, or human well-being… Article 13.—Scope of this chapter. This chapter establishes the physicochemical and microbiological parameters that must be analyzed in wastewater discharged into a receiving water body or sanitary sewer system (alcantarillado sanitario)….
Article 17.—General characteristics of wastewater-discharge limits. The limits contained in this Chapter are permissible values and shall be mandatory for all generating entities. The Ministerio de Salud shall accept a range of variation established by the 95% confidence limits for the respective parameter.” (emphasis in original) To understand these provisions, it is necessary to consider the definitions contained in the regulation itself: “Pollutant: Any substance whose incorporation into water results in the deterioration of its physical, chemical, or biological quality. Wastewater: Water that has been used and whose quality has been altered by the introduction of pollutants. For purposes of this Regulation, two types are recognized: ordinary and special. Ordinary-type wastewater (agua residual de tipo ordinario): Wastewater generated by human domestic activities (use of toilets, showers, washbasins, sinks, laundering, etc.).
Special-type wastewater (agua residual de tipo especial): Wastewater of a type other than ordinary. Receiving water body: Any spring, recharge area (zona de recarga), river, creek, permanent or intermittent stream, lake, lagoon, marsh, natural or artificial reservoir, artificial channel, estuary, mangrove swamp, peatland, swamp, or fresh, brackish, or salt water into which wastewater is discharged. Effluent (efluente): A liquid flowing out of the confined space containing it. In wastewater management, it refers to the flow exiting the final treatment unit. Generating entity: A natural or legal person, public or private, responsible for the reuse of wastewater or its discharge into a receiving water body or sanitary sewer system.” (emphasis in original) It is therefore clear that the State itself determined that not every act of discharging substances is prohibited because, when certain parameters are met, the introduction of wastewater into bodies of water does not fall within the criminal offense.
Therefore, in this case, the Ministerio Público was required to prove that the waters discharged by the accused (imputado) into the river exceeded those permissible levels with respect to physicochemical and microbiological parameters, which was ruled out by the testimony received at trial and assessed by the a quo judge. The Reglamento del Canon Ambiental por Vertidos provides: “Article 15.—Discharge permit (permiso de vertidos). All natural or legal persons, whether public or private, that use bodies of water to introduce, transport, and dispose of discharges (vertidos) that may cause changes in the physical, chemical, and biological quality of the water shall require a discharge permit issued by MINAE in accordance with the provisions of these Regulations…All the aforementioned persons who discharge without a discharge permit shall be subject to the administrative, civil, and criminal proceedings and penalties established by applicable law, without being exempted from payment of the corresponding fee.” In these proceedings, it was proven that the accused carried out the discharge after subjecting the waters to a treatment process that brought them within the permitted parameters; consequently, this could have resulted in a ruling concerning civil remedies (extremos civiles), but this issue was not included in the complaint filed by the Procuraduría General de la República.
Proceedings could also have been brought through administrative channels, as appropriate, but that clearly did not fall within the jurisdiction of the Trial Court (Tribunal de Juicio). As to the criminal-law issue, neither Article 100 of the Ley de Conservación de la Vida Silvestre nor any other criminal provision (tipo penal) penalizes a person who engages in the conduct of discharging the substances described without the corresponding permit. Therefore, if those substances are within the levels permitted under the aforementioned Decreto Ejecutivo, the conduct does not constitute an offense from the standpoint of conglobate statutory classification (tipicidad conglobante), when the concepts of pollutant (sustancia contaminante) and wastewater (agua residual) are analyzed pursuant to that decree. From another perspective, the same arguments could support the conclusion that the conduct lacks formal unlawfulness (antijuricidad formal), because it is permitted under the legal system; in any event, this results in there being no unlawful act (ilícito) attributable to [Nombre1] . For the reasons stated, the claim is denied.
VII.In the sole ground of his appeal, Licenciado Pacheco Salazar alleges a violation of due process (debido proceso) in the determination of joint and several liability (responsabilidad solidaria). He bases his claim on Articles 122 to 126 of the Rules in Force on Civil Liability of the 1941 Criminal Code, Article 103 of the Criminal Code, and Article 1045 of the Civil Code. He argues that his client, Truchas Reales de Costa Rica S.A., was ordered to pay without any explanation as to why it must bear joint and several civil liability for the acts committed by the accused [Nombre1]. He states that the company submitted the application for a water concession (concesión de aguas) to MINAE and had environmental approval (viabilidad ambiental) from SETENA; moreover, the notices issued concerning water use (aprovechamiento de aguas) were addressed to the accused in his personal capacity and not to his client as a legal entity, and therefore the joint and several civil judgment adversely affects the assets of the other shareholders, who did not participate in the proceedings.
He adds that, for a civil judgment to be entered, there must be harm attributable to the party he represents and that, although the judgment identifies two forms of harm, neither is attributable to Truchas Reales de Costa Rica S.A. The first is the alleged nonpayment of the fee (canon) for using the water before the concession was granted; however, MINAE’s Dirección de Agua has never requested such payment from the company, even though the accused inquired about it, nor has the company refused to make it. If that Directorate has chosen not to collect the fee, requiring his client to pay it violates due process because payment could not be made in the absence of a specific amount and instructions as to where or how to pay it. The second is environmental harm (daño ambiental), or harm to the ecosystem, for which no evidence whatsoever exists; instead, a generic reference is made to Article 50 of the Constitución Política in order to disregard the due process protected under Articles 39 and 41 of that body of law.
He contends that a judgment for noncontractual civil liability (responsabilidad civil extracontractual) necessarily requires proof of harm and that, in this case, there is no evidence of any social or environmental harm or harm to third parties, since his client’s mere use of the water was not capable of causing such harm: the same quantity withdrawn was returned in the same or better condition than when received, and therefore neither the environment nor those downstream from the water intake were adversely affected. He claims that the violation of due process to the detriment of his client is evident because, if there is no evidence establishing the existence of harm, it is impossible to challenge the valuation made. He adds that, at the preliminary hearing and at trial, the accused offered to pay the amount assessed by the Procuraduría in order to bring the proceedings to an end, but the offer was not accepted; it is therefore contrary to logic, justice, and due process to require his client to make a payment to a party that has refused to quantify, collect, and receive it, such that his client was held liable for failing to do something impossible.
He considers his client to have been prejudiced by the order requiring Truchas Reales de Costa Rica S.A. to pay for nonexistent harm, without evidence or a statement of reasons, thereby affecting the assets of the company and of shareholders who are persons separate from the accused. He requests that the civil judgment be set aside and that the State be ordered to pay attorney fees and litigation costs. In the fourth ground, the accused alleges an erroneous application of the rules governing civil liability. He bases his claim on Articles 122 to 126 of the Rules in Force on Liability of the 1941 Criminal Code, Article 103 of the Criminal Code, and Article 1045 of the Civil Code. He argues that, in this case, there is no harm for which the accused may be charged, and therefore a civil judgment is unwarranted. The court below imposed liability for two alleged forms of harm: the nonpayment of the fee, which is illogical because the accused was never told how much he was required to pay, and alleged ecological or social harm for which there is no evidence, expert opinion, or biological report establishing that any harm to the ecosystem occurred.
The judgment did not explain which items of evidence supported the conclusion that harm existed. Furthermore, he was convicted of the offense of unlawful appropriation of water (usurpación de aguas) without taking into account that all the water withdrawn from the river was immediately discharged back into it; therefore, the criminal intent (dolo) to appropriate the water, as required by the criminal offense in question, was absent, since the project does not consume the water but uses it to increase the amount of dissolved oxygen in the ponds and to keep their temperature low, as shown by the testimony of [Nombre13], [Nombre5], and [Nombre1], the accused’s statement, and the judicial inspection (reconocimiento judicial) conducted by the trial judge. A criminal conviction does not necessarily entail civil liability, which cannot exist in the absence of harm. He requests that the appeal be granted and that the compensatory civil action (acción civil resarcitoria) be dismissed.
The claims are considered jointly and are granted. As this Court, sitting in different compositions, has recalled in numerous judgments, the statement of reasons for judicial decisions is a fundamental requirement for their legitimacy. Article 142 of the Code of Criminal Procedure establishes the obligation of judges to explain their decisions fully and adequately and to resolve every issue submitted for their consideration, so that the reasoning may be reviewed by the parties and understood by any person; this includes the compensatory civil action as an issue requiring adjudication. Having examined the arguments submitted by the accused in his capacity as civil defendant and by the representative of the company held jointly and severally liable, this Chamber finds that they must be granted because the civil judgment was not adequately reasoned. The section addressing this issue contains only a generic reference to certain matters, in thirty lines divided into two paragraphs, in which the trial judge failed to address all the prerequisites necessary to conclude that civil liability existed and instead merely recited the contents of certain evidence without assessing it, while repeatedly asserting that harm had occurred without sufficient justification.
The arguments included in the judgment were as follows: “CONCERNING THE COMPENSATORY CIVIL ACTION. The Compensatory Civil Action brought by the State, represented by the Procuraduría General de la República, against [Nombre1] AND TRUCHAS REALES DE COSTA RICA SOCIEDAD ANÓNIMA is GRANTED with respect to the claim arising from the offense of UNLAWFUL APPROPRIATION OF WATER WITHOUT THE CORRESPONDING CONCESSION. The civil defendants are ordered, jointly and severally, to pay the State, for ECONOMIC LOSS (DAÑO PATRIMONIAL), the sum of FIVE MILLION TWO HUNDRED FIFTY-ONE THOUSAND NINE HUNDRED EIGHTY-FIVE COLONES AND ZERO CENTIMOS, corresponding to the amount that the Dirección de Agua did not receive in water-use fees, according to report DA-UHTPSOZ-0560-2017. Under the methodology applied, consideration was given to the fact that the water was used unlawfully for a period of 250 days in 2016 and 285 days in 2017, since it was not until 13 October 2017 that a concession permit was granted for a flow rate of 21 liters per second.
The civil defendants are ordered, jointly and severally, to pay the State THE SUM OF THREE MILLION COLONES FOR SOCIAL HARM (DAÑO SOCIAL). It must be taken into consideration that, as a result of the accused’s conduct, harm was caused to the environment, consisting of taking most of the river’s flow and diverting it for profit to be used in his trout-farming project, before subsequently discharging it back into the river. Water is a public-domain asset; its conservation and sustainable use are matters of public interest pursuant to Article 50 of the Ley Orgánica del Ambiente. Article 51 of the Ley Orgánica del Ambiente establishes that, for the conservation and sustainable use of water, the ecosystems that regulate the water regime must be protected. The civil defendant and the company Truchas Reales de Costa Rica bear civil liability for the social harm caused to the environment because, without having a concession to use the water, he took possession of water from the Buenavista riverbed and proceeded to use it for personal profit, with disregard for the environment and the balance of the ecosystem.
The civil defendants’ attorney’s argument that no social harm exists because the river water was returned to the same river is unpersuasive. It is evident that diverting water from the riverbed causes harm to the ecosystem, which must remain balanced. It should be recalled that this is precisely why the Departamento de Agua conducts technical studies to determine the amount of water that may be granted under concession without adversely affecting the ecosystem.” (Emphasis in original.) Examination of what are known as the substantive prerequisites (presupuestos materiales) of a compensatory civil action is essential and includes the existence of the right, standing (legitimación)—both active and passive—and an interest. The judgment contains no analysis in this regard, even though one disputed issue concerning the defendant corporation is precisely whether it has passive standing (legitimación pasiva).
The judge decided that joint and several liability existed but did not explain why. She also stated on several occasions that economic loss and social harm existed, but she did not even adequately distinguish between them or include reasoning sufficient to clarify why it was determined that they existed and must be compensated jointly and severally by the defendants. The judgment did not explain why the failure to pay a fee constitutes economic loss or why harm independent of that loss existed, nor did it justify the amounts awarded. In addition, the analytical reasoning (fundamentación intelectiva) concerning the compensatory civil action must include an analysis of the evidence, specifying the weight assigned to each item of evidence and explaining how the proven civil facts and all matters related to the claim for compensation arise from it. The trial judge, however, merely mentioned official communication DA-UHTPSOZ-0560-2017 without indicating the weight assigned to it, explaining why it could support the civil judgment, establishing why the calculations contained in it were relevant and why the judgment could rely upon them, or explaining how it related to the other evidence.
It must be recalled that merely mentioning the evidence is not a substitute for a statement of reasons. Neither this section nor any other portion of the judgment contains substantiated reasons for the civil judgment. The judgment and the corresponding trial proceedings must therefore be partially vacated, solely with respect to all matters concerning the granting of the compensatory civil action against [Nombre1] and Truchas Reales de Costa Rica S.A., the resulting amounts awarded for economic loss and social harm, and the award of costs arising from that action. The matter is remanded so that the same court, sitting in a different composition, may decide this issue. The vacatur includes the fifth fact found proven in the private prosecution (querella), as well as the fifth and sixth facts of the compensatory civil action that were deemed proven; those facts must be litigated anew in the remand trial ordered herein.
POR TANTO
The sole ground of the appeal filed by Licenciado Adrián Fernández Rodríguez, in his capacity as special judicial attorney-in-fact for the defendant Truchas Reales de Costa Rica S.A., and the fourth ground of the appeal filed by the accused [Nombre1] are hereby granted; consequently, the appealed judgment and the preceding trial are partially annulled, solely with respect to the civil judgment against defendants [Nombre1] and Truchas Reales de Costa Rica S.A. The remaining grounds of the accused’s appeal, as well as the challenge filed by prosecutor Luis Diego Hernández Araya, are hereby denied. The case is remanded for new proceedings concerning the matters specified. In all other respects, the judgment remains undisturbed. NOTICE SHALL BE GIVEN.

Documento PJEDITOR *160000190611PE* Contra: [Nombre1] Delito: Usurpación de bienes de dominio público y otro Ofendido: El Ambiente Res: 2019-420 Tribunal de Apelación de Sentencia Penal de Cartago, Sección Segunda. A las catorce horas veintiocho minutos del seis de setiembre de dos mil diecinueve.
Recurso de apelación interpuesto en la presente causa seguida contra [Nombre1] , mayor, nacido el cuatro de febrero de mil novecientos sesenta y nueve, con cédula de identidad número CED1 - - , por el delito de Usurpación de bienes de dominio público y otros, en perjuicio de El Ambiente. Intervienen en la decisión del recurso las juezas Xiomara Gutiérrez Cruz y Karen Valverde Chaves y el juez Marco Mairena Navarro. Se apersonaron en apelación los licenciados Adrián Fernández Rodríguez, en calidad de Apoderado Especial Judicial de la empresa Truchas Reales de Costa Rica S.A. y además autenticando el escrito presentado por el imputado [Nombre1] , y Luis Diego Hernández Araya, representante del Ministerio Público, así como la licenciada Beatriz Sarmiento Chávez, en su condición de Procuradora Penal.
Resultando:
1. Que mediante sentencia 557-2018 de las diez horas quince minutos del veintiocho de setiembre de dos mil dieciocho, el Tribunal de Juicio del Primer Circuito Judicial de la Zona Sur, sede Pérez Zeledón, resolvió: "POR TANTO: De conformidad con lo antes expuesto y artículos 39, 41 y 50 de la Constitución Política; 1, 11, 21, 30, 45, 59 a 63, 75, 226 inciso 1), 227 del Código Penal; artículo 100 de la Ley de Conservación de la Vida Silvestre y su Reglamento y numerales 1, 3, 6, 8, 9,10, 37,38, 75,76, 111,113,116, 119,142, 175,178, 265 a 270, 303, 341 a 368 del Código Procesal Penal, Decreto Ejecutivo N. 39078 JP, se declara SIN LUGAR la protesta de actividad procesal defectuosa interpuesta por la defensa técnica del acusado referente al ingreso de los funcionarios públicos a la propiedad ubicada en la [Dirección1] . SE ABSUELVE de toda pena y responsabilidad al acusado [Nombre1] por un delito de INFRACCIÓN A LA LEY DE VIDA SILVESTRE EN SU MODALIDAD DE CONTAMINACIÓN DE AGUAS DE DOMINIO PUBLICO. Se declara al acusado [Nombre1] , autor responsable del delito de USURPACIÓN DE BIENES DE DOMINIO PÚBLICO EN CONCURSO IDEAL CON EL DELITO USURPACIÓN DE AGUAS, Y SE LE IMPONE LA PENA DE UN AÑO DE PRISIÓN, que deberá cumplir en el establecimiento carcelario respectivo, previo abono de la preventiva sufrida. Por reunir los requisitos para ello se otorga al acusado el Beneficio de Ejecución Condicional de la Pena, fijándose el período de prueba en el lapso de TRES AÑOS durante el cual deberá cumplir la siguiente condición no cometer un nuevo delito doloso sancionado con pena superior a los seis meses de prisión, en caso de que cometiera un delito con la pena indicada y dentro del período de prueba se le revocará el beneficio de ejecución condicional de la pena y deberá descontar la pena de prisión impuesta en el establecimiento carcelario correspondiente. Se declara CON LUGAR la Acción Civil Resarcitoria contra [Nombre1] Y TRUCHAS REALES DE COSTA RICA SOCIEDAD ANÓNIMA establecida por el Estado, representado por la Procuraduría General de la República, en cuanto al reclamo por el delito de USURPACIÓN DE AGUAS SIN TENER LA CONCESIÓN CORRESPONDIENTE. Se condena a los demandados civiles a pagar en forma solidaria al Estado, por DAÑO PATRIMONIAL la suma de CINCO MILLONES DOSCIENTOS CINCUENTA Y UN MIL NOVECIENTOS OCHENTA Y CINCO COLONES CON CERO CENTIMOS, POR DAÑO SOCIAL LA SUMA DE TRES MILLONES DE COLONES, PARA UN TOTAL DE OCHO MILLONES DOSCIENTOS CINCUENTA Y UN MIL NOVECIENTOS OCHENTA Y CINCO COLONES CON CERO CENTIMOS. Son las costas de la acción civil a cargo de los dos demandados civiles, en forma solidaria, siendo fijadas en la suma de UN MILLON SEISCIENTOS CINCUENTA MIL TRESCIENTOS NOVENTA Y SIETE COLONES CON CERO CENTIMOS. Se dejan sin efecto las medidas cautelares que se hubieren impuesto al acusado. Una vez firme esta sentencia se ordena su inscripción en el Registro Judicial, y expedir los respectivos testimonios de sentencia. 2. Que contra el anterior pronunciamiento, los licenciados Adrián Fernández Rodríguez y Luis Diego Hernández Araya, y el encartado José Miguel Víquez Mora interpusieron los recursos de apelación.
3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.
4. Que en los procedimientos se han observado las prescripciones legales pertinentes.
Redacta la Jueza Gutiérrez Cruz, y;
Considerando:
I.Recursos presentados: El Tribunal del I Circuito Judicial de la Zona Sur, Sede Pérez Zeledón, dictó la sentencia número 557-2018 a las diez horas quince minutos del veintiocho de setiembre del dos mil dieciocho. Contra dicho fallo presentaron recurso de apelación: 1) El imputado [Nombre1] . 2) El fiscal Luis Diego Hernández Araya. 3) El Licenciado Adrián Fernández Rodríguez, en su condición de apoderado especial judicial de la demandada Truchas Reales de Costa Rica S.A. Dichos recursos fueron admitidos por esta Cámara mediante auto de las once horas cincuenta minutos del veintiséis de febrero del dos mil diecinueve.
II.Audiencia oral. La audiencia oral para conocer los motivos de impugnación se celebró el 26 de marzo del 2019, integrándose el Tribunal de Apelación de Sentencia Penal de Cartago con los jueces Jaime Robleto Gutiérrez y Marco Mairena Navarro y la jueza Xiomara Gutiérrez Cruz. Participaron el Licenciado Adrián Fernández Rodríguez, el imputado [Nombre1] y el fiscal Alejandro Alpízar Arrones. Al no haberse recibido elementos de prueba ni ampliaciones de los motivos de apelación, no infringe el debido proceso que esta resolución se adopte con una integración parcialmente diferente a la que asistió a la audiencia oral.
III.En el primer motivo de su recurso, el imputado alega errónea apreciación de la prueba e inconformidad con la determinación de los hechos probados. Reprocha que el hecho probado número cuatro, al señalar que el día cuatro de mayo se captó la totalidad del agua que discurría por el cauce del Río Buenavista sin dejar líquido remanente, es erróneo porque se demostró mediante el reconocimiento judicial y las declaraciones de los testigos que el agua ingresa por un canal y sale por otro de forma inmediata, por lo que nunca se seca dicho cauce, lo que además sería imposible porque en el proyecto no se cuenta con estructura alguna que permitiera retener el agua que circula constantemente en el lugar las 24 horas del día. Adicionalmente, no se realizó, como en otras fechas, ninguna medición del caudal remanente que permita acreditar que ese día se captó la totalidad del agua. Reprocha que el establecimiento erróneo de ese hecho probado le causó agravio porque, a partir de este, se concluyó la existencia de un daño al ecosistema con base en el que se le condenó civilmente, a pesar de que dicho daño no está acreditado.
Reclama también que, en el hecho sexto de la acusación, se le atribuye la producción de un daño al Estado por no pagar el canon por concepto de utilización del agua, lo que no puede serle reprochado porque el propio testigo José Miguel Zeledón, máxima autoridad administrativa en materia de aguas, declaró que el imputado se ofreció a pagar el canon y que no se le dio respuesta a su gestión, no se le indicó cuánto debía pagar, tampoco durante el proceso penal, pues la Procuraduría General de la República, sin fundamento alguno, rechazó el pago del supuesto adeudo. Por último, a su representada la Dirección de Aguas le otorgó concesión por 21 litros y le tramitó aumento de caudal, sin indicarle que debía pagar algún rubro por el agua utilizada con anterioridad a dicho otorgamiento. Aduce que se le produjo agravio a condenarlo civilmente por la falta de pago del canon a pesar de que no se produjo por causas ajenas a su voluntad, según todo lo indicado.
Solicita se acoja el recurso y se declare sin lugar la acción civil resarcitoria. En el segundo motivo de su recurso, el imputado reprocha errónea valoración de la prueba consistente en las declaraciones del imputado, de [Nombre2] , de [Nombre3] y el expediente contencioso administrativo número 17-000153-1027-CA. Para fundamentar su reclamo, transcribe varios extractos de las declaraciones recibidas en juicio. Aduce que de estas se desprende que deberían tenerse como probados varios hechos: que la Dirección de Agua del MINAE conoce que operan productores sin concesión alguna a quienes se les han dado charlas para que inicien los trámites respectivos, mientras el imputado cuenta con permiso del SETENA y solicitud de concesión formulada, que hubo resoluciones contradictorias con respecto a la posibilidad de que él tomara el agua del Río Buenavista, pues se le dijo que no podía hacerlo y al mismo tiempo se le otorgó una concesión y se le tramitó un aumento de caudal y hubo un acercamiento de la empresa Truchas Reales de Costa Rica S.A. para la continuación del trámite de otorgamiento de la concesión, que implicó un acuerdo entre partes para el desistimiento de una demanda entablada en "el contencioso".
Con base en estos hechos alega la existencia de un error de prohibición que no fue debidamente valorado por el Tribunal a quo, con violación de lo establecido en el artículo 35 del Código Penal. Solicita se acoja el recurso y se dicte sentencia absolutoria en su favor y se declare sin lugar la acción civil resarcitoria. En el tercer motivo, el imputado reclama error en la fundamentación jurídica utilizada para condenarlo por el delito de dominio público [sic]. Señala que el delito de dominio público no procedía porque el artículo 20 de la Ley de Aguas permite la construcción de obras en el cauce, lo que fue admitido por el testigo [Nombre4] . Además, la Dirección de Aguas no le previno la imposibilidad de construir represas o muros para captar el agua, por el contrario, el testigo [Nombre5] le dijo que no era posible captar el agua sin hacer una represa o estructura similar debido a la existencia de diferentes niveles entre el agua del río y el terreno en el que va a ser utilizada.
También reclama que dicho artículo se aplica a quien no tenga derecho de poseer, elemento que está ausente en este caso porque el imputado cuenta con tal derecho según la Ley de Aguas, a pesar de lo cual el Tribunal no fundamentó por qué dejó de aplicar el citado artículo 20. En consecuencia, aduce que la conducta atribuida es atípica y que la condenatoria dictada constituye un agravio. Solicita se acoja el recurso y se dicte sentencia absolutoria en su favor y se declare sin lugar la acción civil resarcitoria. Los reclamos se conocen de manera conjunta y se declaran sin lugar. Los cuestionamientos del imputado obedecen a una interpretación subjetiva de la prueba que además se aleja de lo establecido por la normativa costarricense. La sentencia apelada, en lo atinente al establecimiento de la responsabilidad penal del imputado por los delitos de Usurpación de aguas y Usurpación de Bienes de Dominio Público, fue debidamente razonada.
Con el análisis de la prueba documental y testimonial, que incluyó la prueba de descargo, y también la declaración del acusado, se determinó en resumen, que entre el 26 de abril del 2016 y el 30 de mayo del 2017 este ordenó construir una presa de gaviones que utilizó para desviar el agua del cauce del Río Bellavista y utilizarla para su proyecto de cría de truchas, agua que luego de circular por los tanques de acuicultura, regresaba tratada a dicho cauce metros abajo, todo ello sin contar con la concesión respectiva, la cual le fue otorgada con posterioridad a estos hechos, por lo que para esas fechas, no contaba con derecho alguno de detentar ese bien de dominio público. Lo dicho por el testigo [Nombre6] , funcionario de la Dirección de Aguas, fue esencial, pues este visitó el proyecto del imputado en marzo del año 2015, ante la solicitud de concesión que este hiciera y le notificó personalmente un documento en el que se le advertía que no podía utilizar el agua hasta tanto se le otorgara el permiso solicitado.
Además, el inspector de la misma Dirección de Aguas, [Nombre7] , observó la desviación del agua del río ejecutada por el encartado, sobre lo que el a quo analizó “El testigo [Nombre7] , como inspector de la Dirección de Aguas del Minaet, le correspondió visitar el proyecto de cultivo de trucha del endilgado, pudiendo apreciar el aprovechamiento de agua por parte del mismo, sin contar con la concesión correspondiente, además de haber realizado una obra en el cauce del río para la desviación del agua. Así en fecha 04 de mayo del año 2016, mediante oficio DA-UHTPSOZ-0030-2016, suscrito por [Nombre7] dirigido al Ingeniero [Nombre6] , se indica que se realizó una inspección en el lugar en fecha 26 de abril del año 2016, en el sector de la [Dirección3] , contándose con la presencia del señor [Nombre8] es empleado del aquí imputado-estando en el río Buenavista en el lugar de la toma de agua, en que se pudo observar la captación del total del caudal del río, sin que quede caudal remanente, con excepción de algunas fugaz en la captación, ello mediante una obra tipo presa en el cauce del río, según se contempla en la figura número 1, en el punto de coordenadas CED2 descrito en la figura 2.
Se procedió al aforo en la obra de captación para determinar el caudal captado, utilizándose un correntómetro obteniendo un caudal de 676,7 litros por segundo.” También el funcionario [Nombre4] aportó información muy relevante, pues refirió que, para la fecha en que los dos funcionarios anteriores reportaron las acciones del imputado, la concesión no había sido otorgada. Lo dicho por estos tres testigos fue correctamente ponderado por la Juzgadora en relación con la prueba documental “Así pues, las declaraciones de los testigos [Nombre4] , [Nombre6] , [Nombre7] , se complementan con la prueba documental indicada líneas arriba, las copias certificadas del expediente administrativo 16145-A de la Dirección de Aguas, oficio DA-1402-2016 de la Dirección de Aguas, oficio Da-UHTPSOZ-0275-2016 de la Dirección de Aguas, oficio DA-UI-ITPSOZ-0030-2016 de la Dirección de Agua, certificación de la Dirección de Aguas N. C-0237-2016, para arribar a la conclusión de que el aquí imputado realizó los trámites administrativos ante la Dirección de Aguas del Ministerio de Ambiente y Energía, sin embargo, sin haberse otorgado la concesión correspondiente, procedió a utilizar el agua del río Buenavista ubicado en la [Dirección3] , para lo cual construyó una obra captación en el cauce del río, con la finalidad de desviar el agua del río, hacia el proyecto llamado Truchas Reales de Costa Rica, teniendo la representación judicial y extrajudicial, según certificación de la personería jurídica número de la sociedad número CED3- del Registro Nacional.” Incluso con la prueba de descargo se confirmó la hipótesis acusatoria, pues la señora [Nombre2] , esposa del imputado, confirmó que este conocía que no contaba con concesión y que leía el contenido de los documentos que le enviaban, además de que fue él quien dispuso la construcción del muro de gaviones para desviar las aguas.
De igual forma, la declaración del imputado fue analizada en la sentencia y se descartó la existencia de cualquier error que le eximiese de responsabilidad “Cabe remarcar que, de la declaración del imputado, se puede desprender es un criador de trucha experimentado, teniendo 25 años de experiencia, incluso en los años 2015, 2016 y 2017, inició la exportación de trucha a los Estados Unidos, enviando el pescado dos veces por semana, y exportando a Europa una vez por semana. El encartado tiene bastante experiencia en el cultivo de trucha, expone la defensa en sus conclusiones, que el señor [Nombre1] , al utilizar el agua del río Bellavista se encontraba bajo un error de tipo, pues desconocía que debía esperar la resolución final de la Dirección de Aguas, sin embargo, lo anterior no es cierto, al imputado se le notificó personalmente en el año 2015, que no podía utilizar el agua del río Buenavista.” Otros testigos aportaron información general sobre el trámite de las concesiones y qué facultades otorgan, entre ellos [Nombre5] , [Nombre9] y [Nombre10] .
Entonces, contrario a lo que aduce el recurrente, en la sentencia sí hubo un correcto análisis de la prueba mediante el que se estableció sin duda alguna su responsabilidad. Así, en cuanto a la captación de la totalidad del agua el día cuatro de mayo, no existe ninguna falencia, pues el funcionario Gómez Céspedes lo observó. Ello no significa que el río quedó seco, pues, conforme se acreditó, el agua discurría de forma continua, entraba al proyecto del imputado y volvía a salir, de modo que lo que se demostró fue que la totalidad del agua que pasaba en determinado momento por el cauce, fue desviada, aunque luego regresó a este, una vez que fue aprovechada en el proyecto de truchas. Por otra parte, el alegato del que se infiere que por el hecho de que no fueran juzgadas otras personas que, según el imputado, cometieron hechos parecidos, él que debió ser absuelto, no puede ser atendido, pues la responsabilidad penal es personalísima y contra cada quien debe efectuarse un proceso ajustado a derecho, lo que en este caso ocurrió, es decir, al imputado se le siguió un proceso conforme la normativa y la condenatoria dictada es legítima, con independencia de si otras personas fueron o no procesadas por hechos similares.
En el mismo sentido, no le exime de responsabilidad penal ni influye en modo alguno en este proceso, lo que haya ocurrido en la vía contencioso administrativa, por lo que los alegatos sobre este aspecto carecen de interés. Se determinó que el imputado fue notificado de forma personal de la prohibición de iniciar el uso del agua hasta que le fuera concedida la concesión y que, por ello, tenía pleno conocimiento de dicho impedimento, lo que descarta cualquier error de su parte aunque existieran otras vías legales para discutir otras aristas del conflicto. Ambos aspectos fueron abordados en forma atinada en la sentencia “En realidad, el que se haya presentado un contencioso administrativo contra el Estado, que luego desistió el imputado, porque negociaron los funcionarios para otorgar la concesión, no es de importancia para el caso, debido a que estando la solicitud de concesión en trámite en el año 2016 y 2017, el encartado procedió a abastecerse del agua del rio Buenavista sin permiso del Estado, debe recordarse que este es un bien demanial, del cual no pueden disponer al antojo los ciudadanos…
Si se toma en consideración lo expuesto, se puede concluir que el señor [Nombre1] , conocía perfectamente que no podía desviar el agua del río hacia su proyecto de trucha. La defensa técnica alegó una supuesta costumbre entre los trucheros, referente a la utilización del agua para su actividad, esta costumbre no puede crear derecho, ni mucho menos inducir a error al acusado, debe remarcarse que el señor [Nombre1] no es un pequeño productor, es un exportador de trucha, según lo refiere en su declaración indagatoria, en igual sentido, le fue notificado personalmente por medio de funcionarios de la Dirección de Aguas, que tenía la obligación de abstenerse de tomar el agua del río, pudiendo incurrir en el delito de Usurpación de Aguas. Considérese que el imputado en el juicio, refirió que la única forma de tomar el agua del río y canalizarla hacia el proyecto, era a través de una obra canalizadora en el río, lo que la testigo [Nombre2] corrobora al indicar que el imputado realizó la estructura en el rio Bellavista con la finalidad de desviar el agua hacia el proyecto de truchas…
Según ha expuesto, la defensa técnica y material, en el caso de don [Nombre1] , se le ha otorgado en trato desigual, al iniciarse una causa penal, estando otras personas dedicadas a la actividad de piscicultura sin contar con los permisos correspondientes, sin embargo, lo anterior no es óbice para considerar que exista alguna eximente en el caso del encartado, tómese en consideración que el acusado si conocía que había que realizar los trámites ante la Dirección de Aguas, pues el día 29 de noviembre del año 2012, presentó en SETENA, el formulario de evaluación ambiental D1 y la declaración jurada de compromisos ambientales de la concesión de agua sobre el río Buena Vista y el proyecto acuícola, lo cual se encuentra en el expediente administrativo ofrecido como prueba documental, en que consta la resolución N145-2013-SETENA. Por ello, el endilgado no se encuentra en las mismas condiciones de otros trucheros, pues de su declaración en el debate y con la prueba documental, es evidente que si conocía que debía realizar los trámites correspondientes para la obtención del agua y en consecuencia de la obra en cauce…” Además, lo que el recurrente omite considerar en sus alegatos es que se le ha condenado por disponer la construcción de un muro de gaviones y utilizar las aguas del Río sin contar con permiso, antes de que se iniciara el proceso contencioso-administrativo y antes de que se le otorgara la concesión, es decir, justamente se le reprocha haber acudido a las vías de hecho antes de que contar con autorización legal para hacer uso del agua.
Por ello, la mención que hace del artículo 20 de la Ley de Aguas no es relevante, pues no se cuestiona que, una vez que se cuenta con la concesión, se puede proceder con la construcción de las obras necesarias para aprovechar el agua, el delito en este caso se produjo porque tanto el muro de gaviones como el desvío del líquido vital los realizó antes de que se le otorgara la autorización respectiva. Por todo lo indicado, no se acogen estos motivos. Los reclamos referentes a la acción civil resarcitoria se analizarán en el considerando sétimo.
IV.En el primer motivo de su recurso, el fiscal alega inconformidad con la determinación de los hechos probados. Basa su reclamo en los artículos 142, 363 inciso c) y 459 del Código Procesal Penal. Alega que el tribunal omitió la determinación del hecho quinto de la acusación en cuanto a que el imputado detenta, desde el 18 de marzo del 2015, un bien de dominio público al mantener una presa con gaviones y piedras en el cauce del [Dirección4] y que, para esa fecha, él aún no estaba desviando agua del mismo río, lo cual se vincula al hecho probado número tres, que se acreditó por medio del testigo [Nombre6] y de los informes que consta en el legajo de prueba. Indica que dicho testigo en su declaración refirió con claridad la presencia de la presa de gaviones dentro del cauce y la inexistencia de captación de agua desde el 18 de marzo del 2015, por lo que el quinto hecho probado resultó inexacto al señalar como fecha en que el imputado empezó a detentar el bien de dominio público el 26 de abril del 2016.
Esta modificación produjo que la juzgadora considerara que la acción del imputado constituye un concurso ideal, sin embargo, es evidente que existe un concurso material porque las conductas se realizaron en distintos momentos temporales, ya que la captación de agua inició en el año 2016 mientras la usurpación se produjo desde el año 2015, lo que incidió en la imposición de una pena inferior a la pretendida por el Ministerio Público por la aplicación de las reglas del concurso ideal. Solicita se anule la sentencia y se ordene el reenvío para nueva sustanciación. El reclamo se declara sin lugar. El principio de correlación entre acusación y sentencia es uno de los pilares del debido proceso y del derecho de defensa. En este caso, lo que el fiscal reclama, en el sentido de que la juzgadora omitió incluir en la plataforma fáctica demostrada que el justiciable detentaba un bien de dominio público desde el 18 de marzo del 2015 no tiene asidero alguno, dado que esa hipótesis no se incluyó ni en la imputación fiscal ni en la querella, por lo cual el Ministerio Público no podía pretender que en la sentencia se agregara tal hecho, aunque hubiere derivado de la prueba.
Mediante voto número 2017-265 de las catorce horas dos minutos del veintiséis de mayo de dos mil diecisiete, la Sección Primera de este Tribunal de Apelación resolvió "El artículo 303 del Código Procesal Penal establece en el inciso b) que la acusación debe contener la relación precisa y circunstanciada del hecho punible que se atribuya. Se trata de una obligación que no solo es de tipo legal, sino supra legal, pues se trata de un derecho humano consagrado también por los artículos 8.1 de la Convención Americana sobre Derechos Humanos y por el artículo 14 del Pacto Interamericano de Derechos Civiles y Políticos, que garantizan a toda persona acusada de un delito el derecho a ser informada"...en forma detallada, de la naturaleza y causas de la acusación formulada contra ella" y a "disponer del tiempo y de los medios adecuados para la preparación de su defensa..." . En otras palabras, desde el sistema de protección de los derechos humanos, se establece el derecho de intimación que establece que la atribución de los hechos debe ser detallada, precisa y circunstanciada ;y no genérica, abstracta e incircunstanciada, pues eso impediría cualquier tipo de defensa efectiva de las personas acusadas.
Desde la anterior perspectiva, resulta fundamental para determinar el cumplimiento de dicho derecho fundamental, que es presupuesto del derecho general de defensa, si la imputación realizada le permite a la persona acusada conocer cuál es el hecho ilícito que se le atribuye, para así poder preparar adecuadamente su defensa. Evidentemente, dentro de la precisión que estipulan dichas normas, se debe hablar de un hecho concreto y no hechos genéricos que no permitan saber de cuál de ellos se habla y los requisitos de circunstanciación deben ser los necesarios para poder tener armas para combatir la atribución, como lo son las circunstancias espaciales (localidad donde ocurre un hecho), modales (de qué forma fue llevado a cabo: con violencia, con engaño, clandestinamente, aprovechándose de alguna circunstancia, etc) y temporales." Es evidente entonces que no se podían tener por acreditados hechos no incluidos en la acusación.
Con respecto a esa fecha -18 de marzo del 2015-, la imputación se limitó a describir que el funcionario Vargas Salazar se presentó al fundo del endilgado debido a la existencia de una solicitud de concesión de aguas y que le previno que no podía tomar ni usar cualquier cantidad de agua porque podría incurrir en delito. Ni en ese apartado ni en algún otro se describió o se atribuyó que para ese día el imputado hubiere construido alguna la presa de gaviones sin desviar agua del río -la fórmula que señala “antes del 26 de abril del 2016” no es suficiente para ello-, por lo que no lleva razón el fiscal cuando alega que se produjo un vicio por no incluirse tal supuesto en los hechos demostrados, dado que más bien, de haber procedido de tal forma, la juzgadora hubiese sorprendido al acusado y violentado gravemente su derecho de defensa. Por otra parte, el alegato de la fiscalía se funda en la pretensión de que se considere que el imputado actuó primero construyendo la citada presa y después desvió las aguas, pero tampoco la atribución se formuló de esa forma, pues el hecho quinto indica que antes del 26 de abril del 2016 “con el propósito de lucrar con la actividad de cultivo de truchas” el acusado creó once tanques para acuicultura y que “con la finalidad de obtener agua para el desarrollo de su actividad comercial” ordenó la construcción de la presa, con la que logró captar el agua y canalizarla para su proyecto acuícola.
Es decir, la proposición fiscal sobre la que se desarrolló el debate no se basó en que el imputado hubiese construido primero, para el 18 de marzo del 2015, la presa sin usarla y que tiempo después se idease y ejecutase el desvío de las aguas, como se plantea en el libelo impugnatorio y tampoco la querella incluía tal supuesto fáctico. Por el contrario, la redacción utilizada por quien acusó, como se evidencia a partir de las frases entrecomilladas recién transcritas, determinó la existencia de una sola finalidad que dio sentido a la acción del imputado, que fue la de utilizar las aguas para su proyecto acuícola, para lo que dispuso la construcción de la presa, la elaboración de los tanques y el desvío del agua del río, que fue justamente lo que se tuvo como probado, lo que, analizado a la luz de los tipos penales aplicados la juzgadora, permite concluir que tanto la plataforma fáctica demostrada como la consideración de que se trata de un concurso ideal, se encuentran ajustadas a las disposiciones que regulan el proceso penal, por lo que la sentencia carece del vicio que se reprocha.
Por último, debe añadirse que el hecho sétimo de la acusación que corresponde al hecho quinto probado, precisó la detentación por parte del imputado de un espacio de dominio público por medio de la presa construida, específicamente determinó la ocurrencia de ese hecho a partir del 26 de abril del 2016, lo que es consistente con los otros hechos demostrados y confirma la imposibilidad de acceder a lo que el fiscal pretende con este motivo de su recurso.
V.En el segundo motivo, el fiscal reclama inconformidad con la determinación de la pena a imponer. Basa su reproche en los artículos 367 y 459 del Código Procesal Penal y 71 del Código Penal. Alega que, a pesar de que se produjo un daño importante al ambiente, la juzgadora optó por la imposición de la pena mínima. Para fundamentar su inconformidad, transcribe un extracto de la sentencia relacionado con la fundamentación de la pena e indica que los argumentos de la juzgadora son insuficientes, tomando en cuenta los hechos probados. Específicamente al estudiar el hecho cuarto, según el cual en imputado captó la totalidad del agua del río sin dejar líquido para terceras personas o para la vida silvestre en la zona, se evidencia la contradicción existente al motivar la imposición de la pena mínima. Agrega que solamente se valoraron las condiciones personales del imputado, mas no la gravedad del hecho que ameritaba la imposición de una pena mayor.
Solicita se anule parcialmente la sentencia impugnada, en cuanto a la pena, y se ordene el reenvío para nueva sustanciación. El reclamo se declara sin lugar. Al estudiar los argumentos del recurso, esta Cámara considera que no lleva razón el fiscal pues parte de un presupuesto equivocado, cual es que al imputado se le impuso la pena mínima prevista para los delitos acreditados. La pena dispuesta, en abstracto, para el delito de Usurpación de aguas en el Código Penal (artículo 226) es de un mes a dos años de prisión o de diez a cien días multa, mientras la del delito de Usurpación de bienes de dominio público (artículo 227) es de seis meses a cuatro años de prisión o de quince a cien días multa. La juzgadora estableció que, por el concurso ideal, correspondía considerar la pena del segundo de esos ilícitos que es la más grave y decidió imponer un año de prisión. Es decir, descartó imponer la pena menos gravosa, que sería la de multa y se decantó por un extremo superior al mínimo de seis meses de prisión fijado en el artículo 227 del Código Penal.
El monto de esta pena se encuentra debidamente justificado y resulta proporcional a la conducta demostrada y ajustada a la culpabilidad del endilgado, tomando cuenta no solo los aspectos beneficiosos para este, sino también aquellos que aumentan el reproche de su conducta. Por ello, tampoco es atendible el alegato del fiscal en cuanto a que no se valoró adecuadamente el daño producido, pues el Tribunal sí lo tomó en cuenta y la ponderación de esos aspectos favorables y no favorables para el endilgado, unidos al fin resocializador, fueron los que determinaron la fijación de una pena de prisión superior a la mínima con el otorgamiento de la condena de ejecución condicional, sin que el fiscal apunte otros elementos que se hayan dejado de valorar y que ameritaran ser aquilatados para la imposición de una pena mayor. En tal sentido, en la sentencia se argumentó “…ciertamente existe un importante daño al ambiente, que en alguna medida se ve diezmado al no producirse por acción del encartado, un impacto en la contaminación del agua del río Buenavista.
El señor [Nombre1] , es una persona trabajadora, empresario, según se desprende de su declaración en el debate ha ido en ascenso en la actividad de piscicultura, es emprendedor, sin embargo, ha afectado el ambiente al decidir tomar agua del cauce del río sin contar con los permisos correspondientes para realizar la obra en el cauce y a la vez utilizar el agua en el proyecto de cultivo de trucha. Considera el tribunal que, dicha pena cumple con los cometidos de prevención general y especial positiva que orientan la pena, en el tanto se requiere por un lado que el encartado reciba un tratamiento rehabilitador que le permita adecuar su conducta a las normas de convivencia pacífica, y evitar que en el futuro cometa nuevos hechos delictivos contra sus congéneres…” Por lo expuesto, se declara sin lugar este motivo.
VI.En el tercer motivo de su recurso, el fiscal reprocha inconformidad con la valoración de la prueba. Basa su reclamo en los artículos 459 del Código Procesal Penal y 100 de la Ley de Conservación de Vida Silvestre. Alega que no se tuvo por acreditado que el justiciable arrojó sustancias contaminantes al [Dirección4] porque no hubo diferencia sustancial entre la calidad del agua que ingresó al proyecto de cultivo de trucha y la que salió por el canal de desfogue. Sin embargo, esta conclusión se aleja de lo que arrojó la prueba, pues el perito [Nombre11] explicó lo que para la ciencia se considera contaminación y aguas residuales y que, en el proceso productivo realizado por el imputado, sí adicionó agentes ajenos al agua con lo que cambió sus características físicas, químicas y biológicas, por lo que el líquido que lanzó a través de su último canal productivo no era agua de río sino aguas residuales.
Ello hace innecesario analizar las características propias del río de previo a que el imputado captara el agua, pues al adicionarle excretas de pez y restos de alimento modificación la condición natural del agua y la convirtió en agua residual, que, según el perito, es un agente capaz de contaminar que posee la capacidad de modificar las condiciones físicas, químicas y biológicas del río en el cual fueron vertidas. El testigo [Nombre1] también clasificó las aguas vertidas por el proyecto acuícola del imputado como aguas residuales por corresponder al producto de un proceso productivo de truchas. Por ello, la conducta del imputado, que fue debidamente demostrada, de arrojar esas aguas al río, las cuales constituyen un agente contaminante configura el delito acusado por la fiscalía y el razonamiento empleado por la juzgadora para llegar a una conclusión distinta es contrario a la ciencia. Además, no es relevante la calidad que tuviera el agua del cuerpo receptor aguas arriba del proyecto de truchas, pues el tipo penal no la exige.
Lo que interesa es establecer que lo arrojado corresponde a una sustancia contaminante, sin que tampoco se requiera el establecimiento de valores numéricos de concentración del contaminante para alcanzar la tipicidad de la conducta. Alega que se causó agravio al Ministerio Público hubo una incorrecta valoración de la prueba e inaplicación de las reglas de la ciencia. Solicita se anule la sentencia en cuanto a lo resuelto por este delito y se ordene el reenvío para nueva sustanciación. El reproche se declara sin lugar. Al estudiar el motivo formulado, esta Cámara considera que la absolutoria dictada por el tribunal a quo se encuentra ajustada a lo que establece nuestro ordenamiento jurídico con respecto al delito acusado, aunque es necesario hacer varias precisiones, pues algunos de los argumentos dados por la juzgadora son incorrectos, sin embargo, la conclusión a la que arribó, en cuanto a la atipicidad de la conducta que se atribuyó al justiciable, es acertada, de forma que no existe agravio alguno para el ente fiscal, por lo que no corresponde acoger su reclamo.
El fallo absolutorio se fundó, básicamente, en los siguientes argumentos “Se recibieron las declaraciones de cuatro profesionales a saber el perito judicial Francisco Calvo González, quien es químico de profesión, el señor José Miguel Ramírez Corrales, se desempeña como jefe del Laboratorio de Aguas de Acueductos y Alcantarillados, siendo químico de profesión, la señora [Nombre12] , microbióloga de profesión y directora del laboratorio de aguas de la Universidad de Costa Rica y el señor [Nombre13] , médico veterinario de la empresa BIOMAR. Todos los profesionales anteriores, desde cada una de sus especialidades, han señalado que no ha existido un efecto contaminante en el río luego del ingreso del agua, al proyecto de cultivo de trucha del imputado, lo que significa que al darse el vertido del agua al río no se ha podido determinar ningún tipo de agua residual, que según el Reglamento de Vertido y Reuso de Aguas Residuales, debe entenderse como el agua que ha recibido un uso y cuya calidad ha sido modificada por la incorporación de agentes contaminantes.
El artículo 100 de la ley de Conservación de Vida Silvestre señala que se impondrá la pena de uno a tres años de prisión, a quien arroje cualquier sustancia contaminante en ríos. En el caso concreto, debe demostrarse que, en ese proceso de vertido del agua al río, el encartado arrojo aguas contaminantes, que según el artículo 3 del Reglamento de Vertido y Reuso de Aguas Residuales, debe entenderse por agua contaminante, toda aquella sustancia cuya incorporación al agua conlleve al deterioro de su calidad física, química y biológica. El artículo 3 del Reglamento del Canon Ambiental por Vertidos N. 34431, se expone que es sustancia contaminante todo aquel elemento cuya incorporación a un cuerpo de agua implique un deterioro de la calidad física, química o biológica del agua. Es evidente, en el caso de marras, que el imputado no arrojó aguas contaminantes al rio [Dirección5], según ha quedado acreditado con la prueba pericial y documental recibida.
Para la Fiscalía, el delito previsto en el artículo 100 de la ley de Conservación de Vida Silvestre, contaminación de agua pública, es de mera actividad y no de resultado, por ello es suficiente con verter el agua al río, aunque no contamine, para que se configure el tipo penal. La conducta sancionaba en el tipo penal del artículo 100 de la Ley de Conservación de Vida Silvestre, no consiste en verter sustancias sin permiso, no es un delito de mera actividad, sino que es un delito de resultado pues las sustancias que se depositan en el río deben ser contaminantes, tal como se ha explicado supra, el imputado no tenía permiso para verter aguas al rio, pero las aguas que se depositaron luego del procedo de producción no implicaron contaminación alguna.” Ciertamente, como lo indica el fiscal y contrario a lo que se determinó en el fallo, el tipo penal descrito en el artículo 100 es de mera actividad y no de resultado, por lo que este se configuraría al arrojar las sustancias en él referidas al río, sin que sea necesario establecer que el cuerpo de agua fue contaminado; tampoco es relevante determinar si había o no contaminación aguas arriba.
Además, cuando dicho artículo se refiere a “cualquier sustancia contaminante”, no engloba esa expresión las otras sustancias descritas en el tipo, pues arrojar cualquiera de ellas ya implica la configuración del tipo penal, que dispone “Será sancionado con pena de prisión de uno (1) a tres (3) años, siempre que no se configure un delito de mayor gravedad, quien arroje aguas servidas, aguas negras, lodos, desechos o cualquier sustancia contaminante en manantiales, ríos, quebradas, arroyos permanentes o no permanentes, lagos, lagunas, marismas y embalses naturales o artificiales, esteros, turberas, pantanos, humedales, aguas dulces, salobres o saladas, en sus cauces o en sus respectivas áreas de protección. (Así reformado por el artículo 1° de la ley N° 8689 de 4 de diciembre de 2008)”. Sin embargo, el hecho de que no se exija determinar que el cuerpo de agua efectivamente se contaminó, no implica que se deba omitir considerar si las sustancias arrojadas son aptas o no para contaminar.
Por eso, la interpretación de este tipo penal requiere tomar en cuenta los Decretos Ejecutivos Nº 33601 Reglamento de Vertido y Reuso de Aguas Residuales y Nº 34431 Reglamento del Canon Ambiental por Vertidos para definir qué se consideran aguas servidas, aguas negras o sustancias contaminantes que no pueden verterse en los ríos. El fiscal enfatiza que, conforme lo dicho por los testigos [Nombre11] y [Nombre1] , las aguas vertidas proyecto acuícola del imputado son aguas residuales, aspecto sobre el que no existe controversia, pues, en efecto, ambos testigos así lo indicaron. Además, conforme el Diccionario de la Real Academia de la Lengua Española, los conceptos de aguas negras y de aguas servidas son sinónimos del concepto de aguas residuales (RAE. (2019) Diccionario de la Real Academia Española. Recuperado de https://dle.rae.es/?id=1BKpQj3). Sin embargo, contrario a lo que pretende el fiscal, dichas aguas no constituyen en sí mismas sustancias contaminantes según nuestro ordenamiento jurídico, conforme se analizó en el fallo recurrido, pues los decretos citados posibilitan que se arrojen aguas residuales, en lo que interesa en este caso, en los ríos, en tanto se conformen con las normas y parámetros en ellos establecidos, lo que es acorde con el principio de lesividad que exige que solo se tipifiquen las conductas que causen afectación relevante a los bienes jurídicos que interesan al Estado costarricense.
Conforme lo anterior, si los niveles de contaminación de las citadas aguas se encuentran por debajo de los límites fijados en esos reglamentos, el vertido no encuadra en la figura penal. El Reglamento de Vertido y Reuso de Aguas Residuales vigente contiene las siguientes disposiciones de interés “Artículo 1º-Ámbito de aplicación. El presente reglamento será de aplicación obligatoria en todo el territorio nacional en relación con el manejo de las aguas residuales, que independientemente de su origen sean vertidas o reusadas. Artículo 2º-Objetivos. El presente Reglamento tiene por objetivo la protección de la salud pública y del ambiente, a través de una gestión ambientalmente adecuada de las aguas residuales… Artículo 4º-Obligación de tratar las aguas residuales. Todo ente generador deberá dar tratamiento a sus aguas residuales para que cumplan con las disposiciones del presente Reglamento y se eviten así perjuicios al ambiente, a la salud, o al bienestar humano…Artículo 13.-Alcance del presente capítulo.
El presente capítulo establece los parámetros fisicoquímicos y microbiológicos que deberán ser analizados obligatoriamente en las aguas residuales que se viertan en un cuerpo receptor o alcantarillado sanitario…. Artículo 17.-Características generales de los límites para el vertido de aguas residuales. Los límites contenidos en el presente Capítulo son valores permisibles y serán de acatamiento obligatorio para todos los entes generadores. El Ministerio de Salud aceptará un intervalo de variación que será establecido por los límites de confianza al 95% del respectivo parámetro.” (el resaltado es original) Para comprender estas disposiciones es necesario tomar en cuenta las definiciones que el propio reglamento contiene “Agente contaminante: Toda aquella sustancia cuya incorporación al agua conlleve al deterioro de su calidad física, química o biológica. Agua Residual: Agua que ha recibido un uso y cuya calidad ha sido modificada por la incorporación de agentes contaminantes.
Para los efectos de este Reglamento, se reconocen dos tipos: ordinario y especial. Agua residual de tipo ordinario: Agua residual generada por las actividades domésticas del hombre (uso de inodoros, duchas, lavatorios, fregaderos, lavado de ropa, etc.) Agua residual de tipo especial: Agua residual de tipo diferente al ordinario. Cuerpo receptor: es todo aquel manantial, zonas de recarga, río, quebrada, arroyo permanente o no, lago, laguna, marisma, embalse natural o artificial, canal artificial, estuario, manglar, turbera, pantano, agua dulce, salobre o salada, donde se vierten aguas residuales. Efluente: Un líquido que fluye hacia afuera del espacio confinado que lo contiene. En el manejo de aguas residuales se refiere al caudal que sale de la última unidad de tratamiento. Ente generador: Persona física o jurídica, pública o privada, responsable del Reúso de aguas residuales o de su vertido en un cuerpo receptor o alcantarillado sanitario.” (el resaltado es original) Es claro entonces que el propio Estado consideró que no toda conducta de arrojar sustancias se encuentra prohibida, pues, bajo el cumplimiento de ciertos parámetros, la incorporación de las aguas residuales a los cuerpos de agua no encaja en la figura penal.
Por ello, el Ministerio Público debía, en este caso, demostrar que las aguas arrojadas por el imputado al río se encontraban fuera de esos niveles permisibles con respecto a los parámetros fisicoquímicos y microbiológicos, lo que se descartó con las declaraciones recibidas en juicio y valoradas por la jueza a quo. Ahora bien, el Reglamento del Canon Ambiental por Vertidos establece “Artículo 15.-Del permiso de vertidos. Todas las personas físicas o jurídicas, públicas o privadas, que utilicen los cuerpos de agua para introducir, transportar y eliminar vertidos que puedan provocar modificaciones en la calidad física, química y biológica del agua requerirán de un permiso de vertidos emitido por el MINAE de conformidad con lo establecido en este Reglamento…Todas las personas anteriores que viertan sin el permiso de vertidos, serán sujetas de los procedimientos y sanciones administrativas, civiles y penales establecidas en la legislación vigente, sin que eso las exima del pago del canon correspondiente.” En este proceso se demostró que el acusado procedió con el vertido luego de someter las aguas a un proceso de tratamiento que implicó que se hallaran dentro de los parámetros permitidos, por lo que podría haber dado lugar a un pronunciamiento con respecto a los extremos civiles, pero este aspecto no fue incluido en la demanda presentada por la Procuraduría General de la República.
También se podría proceder en la vía administrativa, conforme correspondiese, lo que, evidentemente, no era resorte del Tribunal de Juicio. En cuanto al aspecto penal, ni el artículo 100 de la Ley de Conservación de la Vida Silvestre, ni algún otro tipo penal, sanciona a quien realice esa conducta de arrojar las sustancias descritas sin contar con el permiso respectivo, por lo que si estas se hallan en los niveles permitidos a partir del Decreto Ejecutivo referido, la conducta es atípica desde el punto de vista de la tipicidad conglobante, al analizar los conceptos de sustancia contaminante y agua residual conforme ese decreto. Desde otra óptica, con los mismos argumentos podría señalarse que la conducta carece de antijuricidad formal, por encontrarse permitida en el ordenamiento jurídico, lo que, de todos modos, deriva en la inexistencia de algún ilícito que atribuir a [Nombre1] . Por las razones expuestas, se declara sin lugar el alegato.
VII.En el único motivo de su recurso, el Licenciado Pacheco Salazar reprocha violación al debido proceso en la determinación de la responsabilidad solidaria. Basa su reclamo en los artículos 122 a 126 de las Reglas Vigentes sobre Responsabilidad Civil del Código Penal de 1941, 103 del Código Penal y 1045 del Código Civil. Alega que, a su representada, Truchas Reales de Costa Rica S.A. se le condenó sin fundamentar por qué debe asumir responsabilidad civil solidaria por los actos realizados por el imputado [Nombre1] . Señala que la empresa hizo la solicitud de concesión de aguas al MINAE y contaba con viabilidad ambiental de SETENA, además, las prevenciones realizadas sobre el aprovechamiento de aguas se hicieron al imputado a título personal y no a su representada como persona jurídica, por lo que la condenatoria civil solidaria afecta el patrimonio de los demás accionistas que no han participado en el proceso.
Agrega que, para que exista condenatoria civil, debe de haber un daño atribuible a la parte que representa y aunque en la sentencia se detallan dos daños, ninguno de ellos es reprochable a Truchas Reales de Costa Rica S.A. El primero es el supuesto no pago del canon para la utilización del agua, antes de la concesión, sin embargo, la Dirección de Agua del MINAE nunca le ha solicitado a la empresa tal pago, aunque el imputado consultó al respecto, ni esta se ha negado a efectuarlo. Si dicha Dirección no ha querido hacer el cobro, es violatorio del debido proceso exigir a su representada el pago, pues este no se ha podido realizar a falta de fijación de un monto específico y de las indicaciones sobre dónde o cómo cancelarlo. El segundo es el daño ambiental o daño al ecosistema, sobre el que no existe prueba alguna y se hace una remisión genérica al artículo 50 de la Constitución Política para no aplicar el debido proceso tutelado en los artículos 39 y 41 de dicho cuerpo normativo.
Aduce que la condenatoria por responsabilidad civil extracontractual requiere necesariamente la acreditación del daño y, en este caso, no hay prueba de algún daño social o ambiental, ni a terceras personas, pues la sola utilización del agua por parte de su representada no es susceptible de generarlo, pues la misma cantidad que se tomaba, se devolvía en iguales o mejores condiciones que las recibidas, por lo que no existió afectación al ambiente ni a quienes estaban río abajo de la toma de agua. Reclama que la violación al debido proceso en perjuicio de su representada es evidente pues si no se cuenta con prueba para demostrar la existencia del daño, no es posible que se oponga a la cuantificación realizada. Agrega que el imputado ofreció en audiencia preliminar y en juicio cancelar el monto valorado por la Procuraduría para lograr la finalización del proceso, lo cual no se aceptó, por lo que es contrario a la lógica, justicia y debido proceso obligar a su representada a hacer un pago a favor de una parte que se ha negado a cuantificarlo, cobrarlo y recibirlo, de forma que se le condenó por no haber hecho algo imposible.
Considera que existe agravio al condenar a Truchas Reales de Costa Rica S.A. a pagar daños inexistentes, sin prueba y sin fundamentación, lo que afecta el patrimonio de la empresa y de los accionistas que son personas independientes del imputado. Solicita se deje sin efecto la condenatoria civil y se condene al Estado al pago de las costas personales y procesales. En el cuarto motivo, el imputado reprocha errónea aplicación de las reglas sobre responsabilidad civil. Basa su reclamo en los artículos 122 a 126 de las Reglas Vigentes de Responsabilidad del Código Penal de 1941, 103 del Código Penal y 1045 del Código Civil. Alega que en este caso no existe daño que se pueda cobrar al imputado, por lo que no procede la condenatoria civil. El a quo condenó por dos supuestos daños: el no pago del canon, que es ilógico porque nunca se dijo al imputado cuánto debía pagar y un supuesto daño ecológico o social del que no hay prueba, no existe ningún peritaje ni informe biológico que acredite la producción de algún perjuicio al ecosistema.
En la sentencia no se fundamentó cuáles elementos probatorios permitieron concluir la existencia del daño. Además, se le condenó por el delito de usurpación de aguas sin tomar en cuenta que toda el agua que se toma del río se vierte de inmediato en este, por lo que no existe el dolo de apropiarse del agua que exige el tipo penal en cuestión, ya que el proyecto no consume el líquido sino que lo utiliza para aumentar la cantidad de oxígeno disuelto en los estanques así como para mantener baja la temperatura en estos, lo que deriva de los testimonios de [Nombre13] , [Nombre5] y [Nombre1] , la declaración del imputado y el reconocimiento judicial realizado por la juzgadora. La condenatoria penal no implica necesariamente la civil, que no puede existir sin un daño. Solicita se acoja el recurso y se declare sin lugar la acción civil resarcitoria. Los reclamos se conocen conjuntamente y se declaran con lugar.
Como este Tribunal, con integraciones distintas, ha recordado en múltiples sentencias, la motivación de las resoluciones judiciales es un eje fundamental para considerar su legitimidad. El artículo 142 del Código Procesal Penal dispone la obligación de las personas juzgadoras de explicar amplia y adecuadamente sus decisiones y de resolver todos los temas sometidos a su conocimiento, de forma que esa motivación sea controlable por las partes y pueda ser conocida por cualquier persona, lo que incluye la acción civil resarcitoria como extremo objeto de decisión. Estudiados los alegatos que presentaron el imputado, en su condición de demandado civil, y el representante de la empresa condenada en forma solidaria, esta Cámara considera que deben declararse con lugar, pues en el fallo no se fundamentó debidamente la condenatoria civil, ya que el apartado en el que se aborda este extremo se hace solo una mención genérica de algunos aspectos, en treinta renglones distribuidos en dos párrafos, en los cuales la juzgadora omitió abordar todos los presupuestos necesarios para concluir la existencia de responsabilidad civil y más bien se limitó a enunciar el contenido de algunas pruebas, sin valorarlo, y a repetir que se produjo un daño, sin suficiente justificación.
Los argumentos incluidos en la sentencia fueron los siguientes “ACERCA DE LA ACCIÓN CIVIL RESARCITORIA Se declara CON LUGAR la Acción Civil Resarcitoria contra [Nombre1] Y TRUCHAS REALES DE COSTA RICA SOCIEDAD ANÓNIMA establecida por el Estado, representado por la Procuraduría General de la República, en cuanto al reclamo por el delito de USURPACIÓN DE AGUAS SIN TENER LA CONCESIÓN CORRESPONDIENTE. Se condena a los demandados civiles a pagar en forma solidaria al Estado, por DAÑO PATRIMONIAL la suma de CINCO MILLONES DOSCIENTOS CINCUENTA Y UN MIL NOVECIENTOS OCHENTA Y CINCO COLONES CON CERO CENTIMOS, según el monto dejado de percibir por la Dirección de Agua en materia de canon de aprovechamiento de agua, según informe DA-UHTPSOZ-0560-2017, de acuerdo con la metodología empleada se tomó en consideración que se utilizó el agua de manera ilegal por un período de 250 días en el año 2016 y 285 días en al año 2017, pues fue hasta el día 13 de octubre del año 2017, que se otorgó el permiso de concesión por un caudal de 21 litros por segundo.
Se condena a los demandados civiles a pagar en forma solidaria al Estado POR DAÑO SOCIAL LA SUMA DE TRES MILLONES DE COLONES, debe tomarse en consideración, que producto de la actuación del encartado, se causó un daño al ambiente, consistente en tomar la mayor parte del cauce del río y desviarlo con ánimo de lucro, para ser utilizado en su proyecto de cultivo de truchas, para posteriormente verterlo en el río. El agua es un bien de dominio público, su conservación y uso sostenible son de interés público, según lo previsto en el artículo 50 de la Ley Orgánica del Ambiente. El artículo 51 de la Ley Orgánica del Ambiente, establece para la conservación y uso sostenible del agua, deberá protegerse los ecosistemas que permiten regular el régimen hídrico. El demandado civil y la empresa Truchas Reales de Costa Rica, tienen responsabilidad civil por el daño social causado al medio ambiente, pues sin tener concesión de uso del agua, se apoderó del agua del cauce del río Buenavista y la procedió a utilizar para fines personales de lucro, con menosprecio para el medio ambiente y el equilibrio del ecosistema.
La tesis del abogado de los demandados civiles, de que no existe daño social, porque el agua del río se retornó nuevamente al mismo, no es de recibo, es evidente que al desviarse el agua del cauce del río, se produce un daño al ecosistema, que debe mantenerse equilibrado, recuérdese precisamente para eso existen los estudios técnicos del Departamento de Agua, que permiten determinar la cantidad de agua que se puede concesionar, para no afectar el ecosistema.” (El resaltado es original) El estudio de lo que se denominan presupuestos materiales de la acción civil resarcitoria es fundamental, lo que incluye la existencia del derecho, la legitimación -tanto activa como pasiva- y el interés. No existe, en la sentencia, ningún análisis al respecto, aunque un punto controvertido con respecto a la sociedad anónima demandada es justamente su legitimación pasiva. La jueza decidió que existe responsabilidad solidaria, pero no explicó por qué.
También afirmó, en diversas ocasiones, que existe daño patrimonial y social, pero ni siquiera hizo distinción suficiente entre ambos, ni incluyó razonamientos que permitan dilucidar los motivos por los que se determinó que estos existieron y que deben ser resarcidos solidariamente por los demandados. No se indicó por qué la falta de pago de un canon constituye daño patrimonial y por qué hay un daño independiente de este, tampoco se justificaron los montos otorgados. Además, la fundamentación intelectiva referente a la acción civil resarcitoria debe de incluir el análisis de los elementos de prueba, en el que se debe incorporar el valor dado a cada prueba y cómo surgen de estos los hechos civiles probados y todos los aspectos relacionados con la pretensión resarcitoria. Sin embargo, la juzgadora se limitó a mencionar el oficio DA-UHTPSOZ-0560-2017 sin indicar el valor que se le dio, sin establecer por qué este permite fundar la condenatoria civil, sin establecer por qué los cálculos realizados en él son pertinentes y por qué el fallo puede fundarse en ellos, ni cómo se relacionaba con las demás pruebas.
Debe recordarse que la simple mención de las pruebas no suple la fundamentación. Ni en este apartado ni en otros sectores del fallo se hallan las razones fundadas de la condenatoria civil, por lo cual corresponde anular parcialmente la sentencia y el debate respectivo, solo en cuanto a todo lo atinente a la declaratoria con lugar de la acción civil resarcitoria contra [Nombre1] y Truchas Reales de Costa Rica S.A. y los montos fijados, como consecuencia de ello, por daño patrimonial y daño social, así como la condenatoria en costas por dicha acción; se ordena el reenvío para que el mismo tribunal, con distinta integración, resuelva sobre este extremo. La anulación comprende el hecho quinto que se tuvo por acreditado en la querella, así como los hechos quinto y sexto de la acción civil resarcitoria que se consideraron demostrados, los que deberán ser nuevamente discutidos en el juicio de reenvío ordenado.
POR TANTO
Se declara con lugar el único motivo del recurso interpuesto por el Licenciado Adrián Fernández Rodríguez, en su condición de apoderado especial judicial de la demandada Truchas Reales de Costa Rica S.A. y el cuarto motivo del recurso del imputado [Nombre1] ; en consecuencia, se anulan parcialmente el fallo apelado y el juicio precedente, solo con respecto a la condenatoria civil de los demandados [Nombre1] y Truchas Reales de Costa Rica S.A. Se declaran sin lugar los demás motivos del recurso del imputado, así como la impugnación presentada por el fiscal Luis Diego Hernández Araya. Se ordena el reenvío para nueva sustanciación sobre los extremos señalados. En lo demás, el fallo permanece incólume. NOTIFÍQUESE.
