Appeal filed in the present case number 16-001718-0396-PE, brought against [Nombre1], a Nicaraguan national, identity document number CED1, born on 5 de diciembre de 1970, son of [Nombre2], for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of NATURAL RESOURCES. Judges Gerardo Rubén Alfaro Vargas and José Manuel Cisneros Mojica and Judge Cynthia Dumani Stradtmann participated in deciding the appeal. Attorney Kattia Soto Hernández appeared before this Court on behalf of the Public Prosecutor’s Office.

RESULTS

The civil claim for damages (Acción Civil Resarcitoria) brought against [Nombre1] is dismissed. Any precautionary measure (medida cautelar) is ordered lifted, if one exists and if no other case prevents it. This matter is resolved without a special award of costs. The expenses of the proceedings shall be borne by the State. Issue the corresponding notices... Attorney Beatriz Herrera Di Pippa. Trial Judge” (sic).

  3. 3Following the corresponding deliberation in accordance with the Code of Criminal Procedure, the Court considered the issues raised in the appeal.

CONSIDERING

SOLE. The appellant alleges that the judgment contains erroneous reasoning due to the incorrect application of the principle of congruence between the accusation and the judgment (principio de correlación entre acusación y sentencia). She believes that the trial judge erred by finding that, because illegal logging (tala ilegal) in a protected area (área de protección) had not been charged, as was established at trial, the defendant could not be convicted. She based her argument on the fact that both prosecuting entities sought a conviction for the offense of land-use change (cambio de uso de suelo), but overlooked that facts, rather than legal classifications, are charged. She describes the facts charged by both the Public Prosecutor’s Office and the Office of the Attorney General of the Republic and then reviews sections 61(c) and 58(b) (both understood to be from the Ley Forestal). She then states that it was concluded at trial that the property where the events occurred is in the protected zone of [Dirección1] and that at least three trees were in fact harvested (aprovechamiento), notwithstanding which the court below refused to convict the accused for that act.

She argues that the trial court failed to establish proven facts and therefore did not recognize its error, because the harvesting of the trees in the protected zone formed part of the charge. The appeal is inadmissible. It is necessary to establish the facts that were charged, bearing in mind that both those set forth in the prosecutorial indictment (requerimiento fiscal) and those alleged in the private criminal complaint (querella) filed by the Office of the Attorney General of the Republic were admitted for trial. The charging document filed by the Public Prosecutor’s Office essentially alleged that, between abril and julio de 2016, the accused carried out clear-cutting (tala rasa), illegally cutting down trees on a property belonging to [Nombre3], located in Los Ángeles de Santa Cecilia de La Cruz, encompassing both forested and non-forested areas, for the purpose of changing the land use of that property, an activity for which he lacked permits from the State Forestry Administration (Administración Forestal del Estado).

The private criminal complaint refers to the same events; however, it stated that the land formed part of the Corredor Fronterizo and further established that the logging and forest harvesting (aprovechamiento forestal) were carried out without the corresponding permits. The Office of the Attorney General of the Republic classified the alleged acts as the illegal harvesting of forest products (aprovechamiento ilegal de productos forestales) on privately owned land and in forest, and land-use change, under sections 61(a) and (c), in relation to section 19 of the Ley Forestal; the prosecutorial entity, for its part, classified them as a violation of sections 58 and 61 of the Ley Forestal. The trial court acquitted the accused because it found that it had not been established with certainty that he was the person who carried out the clear-cutting to change the land use from forest to agricultural land.

However, a review of the trial court’s reasoning shows that it found it established that the accused had cut down at least three trees. In that regard, testimony was received from [Nombre4], who stated at trial that, when he arrived at the site, he found the accused “chopping up” the trees that had previously been felled with the saw. [Nombre5], for his part, stated that the accused had hired him to cut down some trees, which he did until [Nombre4] arrived at the site, an argument ensued, and the work stopped. This witness could not say how many trees they had felled, but stated that there were several. Nevertheless, after establishing that authorship of the land-use change could not be proven, the court below focused on stating that, even if some trees had been felled and harvested, it had not been proven that this activity occurred in a forest area (área de bosque); therefore, in its view, the accused could not be convicted of the illegal harvesting of forest products.

A deficiency in the examination and analysis of the evidence concerning the facts alleged by the Office of the Attorney General of the Republic is readily apparent. According to the private criminal complaint, the events occurred in [Dirección2], which is the two-kilometer strip extending from the border with Nicaragua. The trial judge failed to address that aspect. One of the witnesses, [Nombre6], stated that the logging site was within the two-kilometer protected border zone, an area in which no type of forest harvesting was permitted. The location of the property where the events occurred was also detailed in the report of the Sistema Nacional de Áreas de Conservación, Área de Conservación Guanacaste, at pages 1 through 5, a document admitted into evidence at trial by reading. As the appellant noted, section 58(b) of the Ley Forestal provides a penalty for anyone who: “Harvests forest resources on land belonging to the natural heritage of the State (patrimonio natural del Estado) and in protected areas for purposes other than those established in this law.” Accordingly, the challenged judgment is indeed defective insofar as it failed to explain why the conduct attributed to the accused—cutting down and harvesting trees in an area located within the border corridor with Nicaragua—does not constitute the offense established and punishable under section 58(b) of the Ley Forestal.

However—and herein lies the crux of the matter—the appellant lacks standing to challenge the judgment because the act that she claims was not adjudicated did not form part of the prosecutorial indictment but rather, as indicated above, of the private criminal complaint. In other words, the entity with standing to challenge the defect, namely the Office of the Attorney General of the Republic, accepted it. The prosecutorial representative never alleged that the events had occurred in the Corredor Fronterizo, but rather on a property containing both forested and non-forested areas, an issue concerning which the judgment found reasonable doubt and with which the prosecutorial representative expressed no disagreement. It is important to note that, although this is a judgment of acquittal against which the Public Prosecutor’s Office has the right to appeal, that right exists only insofar as the judgment causes it prejudice (agravio).

In this case, no prejudice exists because the ground for appeal is based on the failure to examine part of the private criminal complaint rather than the prosecution’s accusation. This is an issue in which the factual scope of neither instrument encompasses that of the other. Consequently, the appeal is denied.

POR TANTO

The appeal filed is denied. NOTIFY THE PARTIES.

Intervienen en la decisión del recurso los jueces Gerardo Rubén Alfaro Vargas, José Manuel Cisneros Mojica y la jueza Cynthia Dumani Stradtmann. Se apersonó en esta sede, la licenciada Kattia Soto Hernández, en representación del Ministerio Público.

RESULTANDO

  1. 1Mediante sentencia n.° 312-2019 de nueve horas diez minutos de treinta de mayo de dos mil diecinueve, el Tribunal de Juicio del Primer Circuito Judicial de Guanacaste, sede Liberia, resolvió: "POR TANTO: De conformidad con lo expuesto y artículos 39 y 41 de la Constitución Política; 1, 30 del Código Penal; 1, 360, 363, 364, 365 y 366 del Código Procesal Penal, en aplicación del principio In Dubio Pro Reo se absuelve de toda pena y responsabilidad a [Nombre1] DE UN DELITO DE INFRACCIÓN A LA LEY FORESTAL, cometido en perjuicio de LOS RECURSOS NATURALES. Se declara sin lugar la Acción Civil Resarcitoria incoada contra [Nombre1] . Se ordena el levantamiento de cualquier medida cautelar si existiere y si otra cusa no lo impide. Se resuelve este asunto sin especial condenatoria en costas. Son los gastos del proceso a cargo del Estado. Háganse las comunicaciones respectivas... Licda. Beatriz Herrera Di Pippa.   2. 2Contra el anterior pronunciamiento, la licenciada Kattia Soto Hernández, en representación del Ministerio Público, interpuso recurso de apelación.
  3. 3Verificada la deliberación respectiva de conformidad con lo dispuesto en el Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso.
  4. 4En los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el juez Alfaro Vargas ; y,

CONSIDERANDO

ÚNICO. La apelante reprocha errónea fundamentación de la sentencia por incorrecta aplicación del principio de correlación entre acusación y sentencia. Estima que la juzgadora incurrió en un yerro, al no considerar que por no haberse acusado una tala ilegal en área de protección, tal y como se comprobó en el debate, no se podía condenar al justiciable. Sustentó su argumento en que tanto los entes acusadores, requirieron un delito de cambio de uso de suelo, pero olvidó que se acusan hechos y no calificaciones jurídicas. Describe los hechos acusados tanto por la Fiscalía como por la Procuraduría General de la República y posteriormente reseña los numerales 61 inciso c y 58 inciso b (se entiende ambos de la Ley Forestal). Luego expone, que en del debate se concluyó que la finca donde ocurrieron los hechos es la zona protegida del [Dirección1] y que efectivamente hubo aprovechamiento de al menos tres árboles, a pesar de lo cual el a quo se negó a condenar al imputado por ese hecho.

Alega que el tribunal de sentencia omitió establecer hechos probados, por lo cual no se percató del error en que incurrió, porque el aprovechamiento de los árboles en zona protegida, fue parte de la imputación. El recurso es inadmisible. Es preciso establecer los hechos que fueron acusados, teniendo en cuenta que se admitieron para ser debatidos, los establecidos en el requerimiento fiscal y los querellados por la Procuraduría General de la República. En la pieza acusatoria del Ministerio Público, se imputó al justiciable básicamente, que entre abril y julio de 2016, realizó una tala raza, cortando ilegalmente árboles en una finca de [Nombre3] , sita en Los Ángeles de Santa Cecilia de La Cruz, la cual comprendió área de bosque y de no bosque, lo cual realizó para cambiar el uso del suelo de ese predio, actividad para la cual no contaba con los permisos de la Administración Forestal del Estado.

La querella, se refiere a los mismos hechos, sin embargo, señaló que el terreno era parte del Corredor Fronterizo, además estableció que la tala y el aprovechamiento forestal se ejecutaron sin los permisos correspondientes. Los hechos acusados fueron calificados por la Procuraduría General de la República como aprovechamiento ilegal de productos forestales en terrenos propiedad privada y bosque, cambio de uso de suelo, según los artículos 61 inciso a) y c) en relación con el numeral 19 de la Ley Forestal; por su parte la entidad fiscal, los calificó como infracción a los artículos 58 y 61 de la Ley Forestal. El tribunal de sentencia, absolvió al justiciable, porque consideró que no se demostró con certeza, que hubiera sido él, quien realizó la tala raza para lograr el cambio de uso de suelo de bosque a predio agrícola. Sin embargo de la lectura de la motivación del tribunal sentenciador, se tiene que tuvo por acreditado que el imputado taló al menos tres árboles.

En ese sentido se recibió la declaración de [Nombre4] , quien relató en juicio, que en el momento en que llegó al sitio encontró al imputado "picando" los árboles que antes habían talado con la sierra. Por su parte [Nombre5] , refirió que el imputado lo contrató para talar unos árboles, lo cual cumplió hasta que se apersonó al lugar [Nombre4] , se suscitó una discusión y paró la labor. Este testigo no pudo decir cuántos árboles habían talado, pero indicó que fueron varios. Sin embargo el a quo después de establecer la imposibilidad de acreditación de la autoría del cambio de uso de suelo, se centró en señalar que aunque se hubiera talado y aprovechado algunos árboles, no se comprobó que esa actividad fuera en área de bosque, por lo cual en su criterio no podía condenarse al imputado por el aprovechamiento ilegal de productos forestales. Salta a la vista, una falencia en el examen y análisis de la prueba en relación con los hechos acusados por la Procuraduría General de la República.

De acuerdo con la querella, los hechos ocurrieron en el [Dirección2] , que es el margen de dos kilómetros a partir de la línea de frontera con Nicaragua. La juzgadora omitió referirse a ese aspecto. Resulta que uno de los testigos, [Nombre6] , manifestó que el lugar de la tala estaba dentro de los dos kilómetros de protección de la frontera, espacio en el cual no era posible algún tipo de aprovechamiento forestal. La ubicación de la finca donde sucedieron los hechos, también se detalló en el informe del Sistema Nacional de Áreas de Conservación, Área de Conservación Guanacaste, de folios 1 a 5, documento incorporado por lectura al debate. Tal y como lo apuntó la recurrente, el numeral 58 inciso b) de la Ley Forestal, prevé una pena para quien: "Aproveche los recursos forestales en terrenos del patrimonio natural del Estado y en las áreas de protección para fines diferentes de los establecidos en esta ley".

De tal manera que el fallo impugnado, efectivamente padece un defecto en tanto no justificó por qué la conducta atribuida al encartado de talar y aprovechar árboles en un sector comprendido dentro del corredor fronterizo con Nicaragua no constituye el delito previsto y sancionado en el numeral 58 inciso b) de la Ley Forestal. Sin embargo y aquí el quid del asunto, la recurrente no tiene legitimidad para recurrir el fallo, porque el hecho que reclama como no resuelto no fue parte del requerimiento fiscal, sino, como se ha indicado líneas atrás de la querella. Se trata de un aspecto en que los ámbitos fácticos de ambos instrumentos no se contienen entre sí. En consecuencia se declara sin lugar el recurso interpuesto.
