THE STATE No. 1387-2019 ADMINISTRATIVE AND CIVIL COURT OF THE TREASURY, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at nueve horas y cuarenta minutos on seis de agosto de dos mil diecinueve.- PRECAUTIONARY MEASURE proceeding instituted by Nombre15234 against THE STATE. The pendente lite precautionary measure (medida cautelar lite pendente) is hereby decided.

WHEREAS:

I. RELEVANT PROCEDURAL MATTERS

Given that this precautionary-measures case file contains multiple filings, the procedural events relevant to this decision are limited to the following: 1.- By means of a filing dated 12 de abril de 2019, a prima facie precautionary-measure application (solicitud de medida cautelar prima facie) was submitted together with an ordinary proceeding (proceso de conocimiento) [see images 2 to 10 of the precautionary-measures case file]. 2.- By means of the decision issued at dieciséis horas y cincuenta y ocho minutos on doce de abril de dos mil diecinueve, the extremely urgent provisional precautionary measure (medida cautelar provisionalísima) was denied, and the defendant was granted a period in which to respond regarding the measure, with notice being served on 6 de junio. [See image 38 of the precautionary-measures case file]. 3.- By a filing dated 20 de mayo, the State’s representative opposed the matter submitted for response (audiencia) [Images 38 to 175 of the judicial precautionary-measures case file, respectively]. 4.- The mandatory procedural requirements have been observed in the proceedings, and no grounds that could result in nullity and/or denial of the right to a defense (indefensión) have been identified.

II. PURPOSE OF THE PRECAUTIONARY-MEASURE APPLICATION

As indicated in item 1 of the preceding whereas clause (considerando), the requests for precautionary relief (pretensiones cautelares) were narrowed to those contained in the initial filing; accordingly, the moving party requests the following: “That the permits granted by MAG to burn sugarcane fields north of the city of Puntarenas for Ingenio el Palmar and the surrounding areas be suspended immediately. That the State (MAG) be provisionally ordered not to authorize, at its discretion, any further burning of sugarcane fields north of the city of Puntarenas at Ingenio el Palmar and in the surrounding areas unless the previously omitted action has first been completed, consisting of an environmental impact study (estudio de impacto ambiental) by MINAET, a technical opinion (criterio técnico) from SINAC, and a binding permit from Ministerio de Salud, ensuring the health of the people of Puntarenas, the right to a healthy and ecologically balanced environment, and the conservation of the mangroves in the Zona Marítima Terrestre north of the Puntarenas estuary” [image 5 of the precautionary-measures case file].

III. ARGUMENTS OF THE PARTIES

In summary, the moving party, Nombre15234, bases his theory of the case on what, in his view, constitutes environmental harm caused by the authorization of burns by Ministerio de Agricultura y Ganadería which—he claims—take place from late December through late March each year on the property at Ingenio el Palmar and in the surrounding areas north of the city of Puntarenas. These burns are conducted without health or environmental controls, causing smoke and soot debris to cover the entire city; specifically, on 8 de marzo de 2019, the situation was so extreme that it caused breathing difficulties, even resulting in some people requiring medical care for respiratory problems, for which photographic evidence was submitted (facts 1, 5 and 6 of the complaint). The defendant, THE STATE, through its representative, opposes the measure, alleging that the relief sought lacks specificity because it does not precisely identify the location of the events.

It further alleges that the action lacks seriousness because the incident reported on 8 de marzo de 2019 resulted from acts of vandalism and not from the execution of an authorized controlled burn (quema controlada) by the defendant Ministry (attaching technical reports from the Coordinator of Controlled Agricultural Burns for Región de Desarrollo Pacífico Central and report A.E.A.E./001 from the Head of the Esparza agricultural extension area, dated 1 y 2 de abril del año en curso, appearing in images 44 to 175 of the precautionary-measures case file). It also argues that neither the application nor the validity of decree 35368-MAG-S-MINAE can generally be suspended with respect to permits granted, nor can requirements be imposed without technical criteria supporting them. Likewise, it alleges that delay would not cause serious damages and losses (daños y perjuicios graves), because no evidence has been submitted beyond the assertion that pollution occurred in Puntarenas; insufficient indicia (indicios) have been provided to establish the allegations, and the measure’s instrumental relationship (instrumentalidad) to the protection of the applicant’s interests has not been shown.

The applicant has not established that the harm resulted from a permit that had been granted, and it is reiterated that it resulted from acts of vandalism. The defendant concludes by arguing that the balancing of interests (ponderación de intereses) cannot favor the applicant because the suspension would not eliminate the burns, much less those resulting from acts of vandalism, and the regulation is necessary to control the activity.

IV. REQUIREMENTS FOR GRANTING AN INTERIM MEASURE

As developed in the case law of the Constitutional Chamber of the Supreme Court of Justice, interim relief (justicia cautelar) responds to the need to guarantee the constitutional principle of prompt and effective justice by preserving the factual conditions indispensable for issuing and enforcing the judgment (Voto Nº 7190-1994, de las 15:24 horas del 6 de diciembre, Voto Nº 6224-2005, de las 15:16 horas del 25 de mayo del 2005). Briefly, it should be noted that the legal nature of interim measures (medidas cautelares) is justified as a second-order procedural instrument—or an instrument of the procedural instrument—intended to mitigate the negative effects of the normal, and sometimes pathological, duration of judicial proceedings—vacatio or distantia temporis—thereby giving effect to the fundamental right to prompt and effective justice established in Article 41 of the Political Constitution of the Republic of Costa Rica, since prompt justice cannot be delayed and effective justice must be carried out.

It has rightly been stated that this does not involve prejudging the matter, but rather protecting urgent situations that, without proper judicial protection, would result in direct harm to the parties to the proceedings. In this same regard, Article 19 of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo) establishes that the purpose of ordering an interim measure is to provisionally protect and safeguard the subject matter of the proceedings and the effectiveness of the judgment. Legal scholarship has stated that the purpose of interim relief is not to declare a fact or liability, establish a legal relationship, enforce an order and satisfy an undisputed right, or resolve a dispute, but rather to prevent harm that the litigation may cause or that may arise from an abnormal situation (Gallegos Fedriani, Nombre41. Interim Measures against the Public Administration. 2 ed.

Buenos Aires, Argentina: Ábaco, 2006). Pursuant to Article 21 of the Administrative Litigation Procedure Code, when determining whether an application for an interim measure should be granted, the judge must verify that the claim in the merits proceedings (proceso de conocimiento) is not frivolous or manifestly lacking in seriousness. This constitutes a preliminary assessment of the merits to determine whether the case presents what legal scholarship and case law have called a likelihood of success on the merits (apariencia de buen derecho), or fumus boni iuris. Furthermore, Article 21 of the Code provides that an interim measure is appropriate when the implementation or continuation of the conduct under review causes serious actual or potential damage or loss, a situation defined in legal scholarship as danger in delay (peligro en la demora), or periculum in mora; that is, when the pathological delay inherent in judicial proceedings creates a present, real, and objective danger that the applicant will suffer serious harm (Jinesta Lobo, Ernesto.

Manual of Administrative Litigation Proceedings. 1 ed. San José, Costa Rica, Editorial Jurídica Continental, 2008). Lastly, Article 22 CPCA establishes the judge’s obligation, in light of the principle of proportionality, to balance the interests at stake (ponderación de los intereses en juego)—that is, the private party’s circumstances, on the one hand, and the public interest and the interests of third parties that may be affected by the adoption of the interim measure, on the other. Only when all three elements are present—namely, likelihood of success on the merits, danger in delay, and a determination, based on the balancing of interests, that the harm suffered by the private party warrants protection over the other interests at stake—may the court grant the requested interim measure. In similar terms, the Administrative Litigation and Civil Treasury Court (Sixth Section), in decision number 301-2012-VI, de las diez horas con cuarenta y cinco minutos del veintiuno de diciembre del dos mil doce, had occasion to address the matter and held as follows: “[...] The reparability of the protected interest is not satisfied in every case by monetary compensation.

Accordingly, as a consequence of this approach, the Administrative Litigation Procedure Code (hereinafter CPCA) expressly abandons an interim-relief system centered on the administrative act (acto administrativo), which, although one of the formal manifestations of the public will, is not the only one. On the contrary, given the broad scope of the subject matter of the proceedings, interim relief must extend beyond a mere stay order, as a subtype of negative-content preservative measures, to encompass affirmative innovative measures (medidas innovativas), whether prohibitory, mandatory, or substitutive, while always assessing, in each case, the scope of the judge’s powers regarding review of administrative discretion (administrative discretionary authority) (ordinales 20 y 128 del CPCA). From this perspective, these are measures that serve the principal merits proceedings, hence their provisional and instrumental nature.

As to the former, any ruling concerning interim relief remains in effect subject to the outcome of the merits proceedings. It should be emphasized that the measure may also be terminated or modified at any time if the circumstances that initially justified it change, or a measure previously denied may be adopted, as provided in Article 29 of the applicable Code. As to the latter aspect—instrumentality—the interim measure has a pronounced ancillary relationship to the final judgment because, ultimately, it serves as an instrument for preserving the subject matter of the proceedings under the terms already described. Added to the foregoing is the nature of summary review (sumaria cognitio), which is inherent in these measures because, as provisional forms of relief directed toward the stated purposes, they must be decided promptly in order to fulfill their function. It should be noted that these measures arise, in every case, upon a party’s application; accordingly, they are governed by the party-presentation principle (principio dispositivo).

However, this applies only to the analysis of whether their adoption is necessary, because once they have been requested, the judge may order those deemed necessary and appropriate to provisionally protect and safeguard the subject matter of the proceedings and the effectiveness of the judgment (artículo 19.1 ejusdem). The adoption of these measures is, however, contingent upon the convergence of a series of requirements and conditions that must be satisfied in each case. This is indeed required by Article 21 in conjunction with Article 22 of that Code. The following requirements arise from the foregoing provisions: danger in delay (periculum in mora), likelihood of success on the merits (fumus boni iuris), and the balancing of the interests at stake [...]. In summary, the judge must consider the criteria governing the adoption of this type of measure, including suitability—that is, whether the measure is appropriate for achieving the intended purposes; necessity, which entails assessing the remedies that will best fulfill its purpose; and proportionality, through the balancing of the interests at stake.—

V.PRELIMINARY ASSESSMENT OF THE RULES ON STANDING IN THIS SPECIFIC CASE (ANALYSIS OF THE ACTION’S LIKELIHOOD OF SUCCESS ON THE MERITS): One of the central issues to be considered in connection with the present measure is the applicant’s standing (legitimación activa) to bring this action, which may be characterized as one seeking environmental protection (tutela ambiental). In this regard, it is clear that this derives from the constitutional rule enshrined in Article 50, supplemented by Article 41 of the Constitution, which confers what legal scholarship refers to as protection of a diffuse interest in environmental protection (tutela de un interés difuso de protección ambiental). Pursuant to both provisions, this action is given practical effect under Article 49 of the Constitution, which permits matters concerning the protection of this legally protected interest (bien jurídico) to be heard in administrative litigation proceedings.

Such protection is also found in international law and has been extensively developed. Thus, the precautionary principle in environmental matters (principio precautorio en materia ambiental) is one of the governing tenets of Environmental Law and is embodied in the United Nations Conference on Environment and Development, or Rio Declaration, which states verbatim: “Principle 15.—In order to protect the environment, States shall broadly apply the precautionary approach according to their capabilities. Where there is a danger of serious and irreversible damage, the lack of absolute scientific certainty shall not be used as a reason for postponing the adoption of cost-effective measures to prevent environmental degradation.” In addition, within the domestic legal system, Article 11 of the Biodiversity Law (Ley de Biodiversidad) sets forth the following principles as interpretive parameters: 1.—Preventive approach (Criterio preventivo): It is recognized that anticipating, preventing, and addressing the causes of biodiversity loss or threats to biodiversity is of vital importance. 2.—Precautionary approach, or in dubio pro natura (Criterios precautorio o indubio pro natura): Where there is a danger or threat of serious or imminent harm to the elements of biodiversity and the associated knowledge, the absence of scientific certainty shall not be used as a reason for postponing the adoption of effective protective measures.

We also find the principles governing the State’s duty to protect environmental rights (principios de tutela del derecho ambiental), derived from Article 50 of the Political Constitution, which imposes on the State the obligation to exercise a protective and governing role in environmental matters. In this regard, the Constitutional Chamber has stated that the State must safeguard and protect the right against any risk or need, and must oppose, prohibit, and prevent any activity that infringes upon that right. The principle of environmental quality (Principio de la calidad ambiental) constitutes a fundamental measure of quality of life, linked to the conditions under which each individual may live and to the use made of the environment for personal development. The Constitutional Chamber has held that the right to a healthy and ecologically balanced environment entails a corresponding duty to protect and preserve the environment through the rational exercise and beneficial enjoyment of the right itself.

All of the foregoing permits an analysis under Article 10, leading to the conclusion that the applicant falls within the circumstances set forth in subsection 1), subparagraphs c) and d), for purposes of that Article. Nevertheless, the applicant also has standing because the applicant is deemed a direct, individual victim of the damage and loss for which compensation is sought in the principal proceedings; thus, pursuant to subsection 1), subparagraph a), of that Article, the applicant has standing on two grounds.

VI.LEGAL LIMITATION ON THE RELIEF SOUGHT (ANALYSIS OF LIKELIHOOD OF SUCCESS ON THE MERITS AND THE INSTRUMENTAL NATURE OF THE MEASURE): Irrespective of the analysis of standing (legitimación), the application for interim relief (requerimiento cautelar) itself must satisfy an analysis of likelihood of success on the merits (apariencia de buen derecho) and instrumental nature (instrumentalidad), bearing in mind, as explained above, the limitations of summary review (summa cognitio) inherent in this type of judicial proceeding. Thus, prima facie, there is a conflict between the request to add requirements to the regulatory provision (the second paragraph of the application for interim relief) and the provisions of ley 8220 and its regulations. Specifically, the creation of requirements or the non-application of the principles contained in section 4 of the “Ley de Protección al ciudadano del exceso de requisitos y trámites administrativos” is not discretionary for the Administration—or, by extension, for this jurisdiction when acting in its stead—which provides: “Every procedure or requirement, regardless of its regulatory source, must satisfy the following conditions before it may be required of a person subject to the Administration: a) It must be established in a law, executive decree, or regulation. b) It must be published in the official gazette La Gaceta together with the procedure to be followed, instructions, manuals, forms, and other corresponding documents, and must be displayed in a visible location within the institution.

In addition, a notice referring to that publication must be published in a newspaper of national circulation.” Furthermore, the regulations implementing the aforementioned provision (decreto 37045-MP-MEIC) require, through a review of procedural simplification, reasonableness, and justification of the requirement, that any addition, modification, or amendment to any regulation or body of rules governing a procedure that citizens must complete undergo an evaluation process known as “Prior Review” (“Control Previo”) (see sections 12 to 13bis and 56 to 60bis of those regulations). It is therefore improper to impose procedural requirements through interim protection (tutela cautelar), namely, health approval and environmental impact studies (estudios de impacto ambiental), which the rule does not currently require; moreover, doing so would entail creating rules for a finite group of persons, thereby violating section 33 of the Constitución Política by treating them differently from all other persons throughout the country who apply for and process permits under the aforementioned rules.

For this reason, the requested relief does not satisfy the likelihood-of-success analysis insofar as it seeks to create additional requirements. Nevertheless, with respect to the suspension of permits already granted, and not only for the reasons set forth in the consideration below regarding the territorial boundaries within which the measure would apply, the manner in which the action was brought does not permit an analysis of its impact on third parties—who would be affected by the relief sought—thereby rendering the application for interim relief indeterminate, as neither the respondents to whom the suspension would apply nor the causal relationship between the claim brought in the principal proceeding (damages) and those third parties is clear. Consequently, at least in interim proceedings, it is impossible to assess whether the applicant has shown a likelihood of success on the merits.

In this regard, we emphasize the requirement that every interim measure (medida cautelar) be instrumental to the claim on the merits. Having reviewed the relief sought in the complaint, we find that no claim is specifically directed against a private party (permit holder), nor does the complaint establish whether the implementation of a particular permit affects the applicant (causation analysis). Accordingly, no demonstrated causal relationship exists between the request to suspend permits already granted—which, as stated supra, have not been individually identified—and the claim on the merits in the proceeding; the measure must therefore likewise be denied.

VII.ANALYSIS OF THE FACTUAL FRAMEWORK FOR RULING ON THIS INTERIM MEASURE (SPATIOTEMPORAL SCOPE OF THE INTERIM ANALYSIS AND SPECIFIC DEFINITION OF THE RELIEF SOUGHT): Although interim protection is strongly characterized by informality, this in no way authorizes or grants the adjudicator the prerogative to interpret or reformulate the application for interim relief. Rather, that burden rests on the applicant, who must delimit and clearly and concisely define the protective relief sought. On another occasion, the Court of Appeals, in its oral ruling 413-2018-II (minute 13:00 a 13:40 of the audio recording of that ruling, specifically the note submitted by Judge Palacios García), emphasized that one of the fundamental elements of an interim measure is the need to determine spatially the location where the measure will take effect. Thus, a specific definition of the relief sought constitutes one of the fundamental requirements for the measure to be operational, particularly so that compliance may ultimately be reviewed in response to an allegation of noncompliance and assessed by the enforcement judge.

In this regard, this Court agrees with the State’s contention that the measure, as framed, does not permit the location to be properly specified because it refers generically to the “northern Puntarenas” sector and to Ingenio El Palmar “and surrounding areas.” It is therefore impossible to determine the territorial scope of the measure, and the Court cannot sua sponte tailor its effects because there is no evidence—apart from the photographs submitted—that would permit the factual circumstances at issue to be georeferenced. It bears recalling, as will again be emphasized infra, that this is the applicant’s burden and is exclusively within its province for the proper assessment of the factual circumstances. In this respect, the testimonial evidence offered would contribute nothing because it is unsuitable for establishing this information; since the location has been presented in indeterminate terms, no ruling can be made.

This contrasts with the facts reported in the defendant’s response to the application for interim relief, which makes clear in report A.E.A.E/001 from the Agencia de Servicios Agropecuarios de Esparza that the facts alleged by the applicant concern an act of vandalism in an area near the mill that ultimately affected approximately 35 hectares of land belonging to Agrícola El Palmar, causing the company substantial harm. The company reported the incident and attempted to control it, which proved very difficult given the weather conditions on the day of the incident (see images 44 a 52 of the interim-relief file). Accordingly, at least in this interim proceeding, there is no evidence causally linking the challenged conduct to the implementation of a permit that was granted, and this requirement for interim relief is therefore absent. For this reason, the measure must be denied.

VIII. ANALYSIS OF THE DANGER IN DELAY REGARDING THE INTERIM MEASURE SOUGHT

There is no showing of actual or potential serious harm resulting from the conduct alleged by the applicant. As the State’s representative argues, the alleged harm has not been demonstrated. Not every harm may support interim protection; only serious harm may do so. The applicant neither alleges nor demonstrates concrete, objective, identifiable, and verifiable serious harm, but merely argues that the situation causes it “damages that it should not have to bear,” without specifying, identifying, or defining the impact that such loss has on its legal sphere, and without submitting supporting evidence for consideration. It should be recalled that evidence in the principal proceeding differs from evidence offered in the interim proceeding because the latter, unlike the former, must necessarily be directed toward supporting or substantiating the application for interim relief, even if only indirectly, and must permit a formal analysis of danger in delay (peligro en la demora).

The application for interim relief is entirely devoid of such evidence, as the applicant has failed to prove what those alleged damages are or would be. This is the essential criterion to be assessed regarding danger in delay, based on the evidence and the court’s probability analysis. Even where the alleged harm is potential rather than actual, analysis of the potential for serious harm requires the establishment, at least through argument, of a causal chain enabling the court handling the matter to verify the connection between the administrative action sought to be suspended and the harm that action might cause. The lack of evidence and argument in this regard is the plaintiff’s exclusive responsibility, a standard repeatedly affirmed by this Court, supported by the rulings of the Court of Cassation (including numbers 5-F-TC-2008 and 18-F-TC-2008, del 6 de febrero y del 28 de marzo), and reiterated by the Tribunal de Apelaciones de lo Contencioso Administrativo, Sección Segunda, in Voto 30-2012 de las catorce horas con veinte minutos del veintidós de octubre de dos mil doce, which has held that the party alleging the possibility of harm bears the burden of proving it and that a mere allegation is insufficient for these purposes.

Because no evidence of serious harm has been submitted and the Court does not find even the potential for such harm to occur, the danger-in-delay requirement cannot be deemed established in this matter. The measure must therefore be denied.

IX. SUMMA COGNITIO LIMITATION ON REVIEW

ANCILLARY AND INSTRUMENTAL NATURE OF THE INTERIM MEASURE IN RELATION TO THE PROCEEDING ON THE MERITS: As may be seen from the complaint, the issue to be decided (thema decidendum)—whether the regulations currently in force are valid in light of environmental protection and whether the applicant has suffered harm—lies beyond the proper scope of the analysis of this interim measure, given the summary review contemplated for this procedural action and, above all, the instrumental nature that the decision made here must have in relation to the principal proceeding. As such, these are matters going to the merits and are therefore excluded from the effects of this interim action. In this regard, as the Tribunal de Apelaciones de lo Contencioso Administrativo stated in the aforementioned ruling 413-2018-II, where the principal proceeding is—in principle—an administrative judicial action challenging an omission (conducta omisiva), its purpose, by its nature, is to impose affirmative obligations—to give or to do—if the irregularity or unlawfulness of the challenged omission is confirmed.

It must therefore be borne in mind that the application for interim relief cannot be viewed—even remotely—as an advance ruling on the merits of the principal matter in dispute, because doing so would completely distort the nature of the proceeding and turn it into an advance issuance of the judgment in the case, which is plainly improper. Nevertheless, this Court clearly must balance the interests involved. As stated in the preceding section, there is no danger in delay, no proper identification of potentially affected persons, and no defined geographic area to be subjected to interim protection. Moreover, the relief sought would entail violating ley 8220 and its regulations in relation to section 33 of the Constitution. It must therefore be determined that the protection of the public interest represented by the State, as well as the interests of any affected third parties, prevails over the applicant’s interests. For this reason, the measure must be denied.

THEREFORE

As the requirements established by the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo) for granting the requested interim relief (medida cautelar) have not been met, the application for interim relief filed by Nombre15234 against THE STATE is hereby DENIED. Notice shall be served.

EL ESTADO Nº1387-2019 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las nueve horas y cuarenta minutos del seis de agosto de dos mil diecinueve.- Proceso MEDIDA CAUTELAR establecido por Nombre15234 contra EL ESTADO. Se resuelve medida cautelar lite pendente.

CONSIDERANDO:

I. ASPECTOS DE TRÁMITE RELEVANTES

Dado que el presente legajo de medidas cautelares cuenta con múltiples gestiones, se circunscriben los eventos procesales relevantes para esta resolución las siguientes: 1.- Que por medio de escrito de fecha 12 de abril de 2019 se presenta solicitud de medida cautelar prima facie junto con proceso de conocimiento [véase imágenes 2 a 10 del legajo cautelar]. 2.- Que por medio de resolución de las dieciséis horas y cincuenta y ocho minutos del doce de abril de dos mil diecinueve, se rechaza la medida cautelar provisionalísima y se otorga plazo a la demandada para que se pronuncie respecto de la medida y notificándose en fecha 6 de junio. [véase imagen 38 del legajo cautelar]. 3.- Que por escrito de fecha 20 de mayo la representación Estatal contesta de forma negativa la audiencia otorgada [Imagen 38 a 175 del legajo judicial de medida cautelar respectivamente]. 4.- En los procedimientos se han observado las prescripciones de rigor, y no se observan causales que puedan producir nulidad y/o indefensión.

II. OBJETO DE LA SOLICITUD DE MEDIDA CAUTELAR

Conforme se indicó en el punto 1 del considerando anterior, las pretensiones cautelares fueron reducidas a las contenidas en el escrito de interposición, así la parte promovente solicita lo siguiente: "Se Ordene de inmediato la suspensión de los permisos que otorga el MAG para realizar las quemas de los cañales al norte de la ciudad de Puntarenas para el Ingenio el Palmar y sus alrededores. Que se ordene provisionalmente al Estado (MAG) no autorizar discrecionalmente más quemas de los cañales al norte de la ciudad de Puntarenas en el Ingenio el Palmar y sus alrededores, sino se cuenta de previo con la conducta omitida de un estudio de impacto ambiental del MINAET, criterio técnico del SINAC y un permiso del Ministerio de Salud vinculantes, que garanticen la salud de los Puntarenenses, el derecho a un ambiente sano y equilibrado, y la conservación de los manglares de la Zona Marítima Terrestre del norte del estero de Puntarenas” [imagen 5 del legajo cautelar].

III. ARGUMENTOS DE LAS PARTES

Por parte del promovente Nombre15234 en síntesis, gira su teoría del caso en lo que a su parecer es un daño ambiental provocado por la autorización de quemas por parte del Ministerio de Agricultura y Ganadería que – según afirma – se dan desde finales de diciembre hasta finales de marzo de cada año en la finca en el Ingenio el Palmar y sus alrededores al norte la ciudad de Puntarenas, los cuales se realizan sin control sanitario ni ambiental, provocando que el humo y basura de hollín cubra toda la ciudad y que concretamente el 8 de marzo de 2019 la situación fue extrema al punto de provocar dificultad para respirar, generando incluso que algunas personas requiriesen atención médica por problemas respiratorios aportando prueba fotográfica al efecto (hechos 1, 5 y 6 de la demanda). Por parte del accionado ESTADO, su representante se opone a la medida alegando una falta de concreción de lo peticionado al no determinar de forma concreta el lugar de los hechos; alega adicionalmente una falta de seriedad en la acción dado que lo acusado del 8 de marzo de 2019 respondió a actos vandálicos y no a la ejecución de una quema controlada autorizada por el demandado Ministerio (adjunta informes técnicos del coordinador de Quemas Agrícolas Controladas de la Región de Desarrollo Pacífico Central, e informe A.E.A.E./001 del Jefe del área de extensión agrícola de Esparza de fecha 1 y 2 de abril del año en curso visibles a imágenes 44 a 175 del legajo cautelar), además de que no es posible suspender, en general, la aplicación y la vigencia del decreto 35368-MAG-S-MINAE respecto de los permisos otorgados, ni tampoco exigir requisitos sin criterios técnicos que lo justifiquen; de igual forma alega que no existen daños y perjuicios graves en la demora, ya que no se aportan pruebas más allá de la referencia de que se produjo una contaminación en Puntarenas, no aportándose indicios suficientes que permita demostrar lo alegado, ni tampoco se observa la instrumentalidad de la medida para tutelar los intereses del petente, no acredita que la afectación fuera producto de un permiso otorgado, y reiterándose que fue producto de actos vandálicos; culminando su alegación en que no puede haber una ponderación de intereses a favor del solicitante por cuanto la suspensión no provocaría la eliminación de las quemas, y mucho menos las de actos vandálicos y se requiere la norma a efectos de controlar la actividad.

IV. LOS PRESUPUESTOS PARA EL OTORGAMIENTO DE UNA MEDIDA CAUTELAR

Tal y como ha sido desarrollado por la jurisprudencia de la Sala Constitucional de la Corte Suprema de Justicia, la justicia cautelar responde a la necesidad de garantizar el principio constitucional de una justicia pronta y cumplida, al conservar las condiciones reales indispensables para la emisión y ejecución de la sentencia (Voto Nº 7190-1994, de las 15:24 horas del 6 de diciembre, Voto Nº 6224-2005, de las 15:16 horas del 25 de mayo del 2005). Brevemente, conviene indicar que la naturaleza jurídica de las medidas cautelares está justificada como un instrumento procesal de segundo grado -u instrumento del instrumento procesal- que busca paliar los efectos negativos de la normal y a veces patológica duración de los procesos jurisdiccionales –vacatio u distancia temporis-, haciendo valedero el derecho fundamental a una justicia pronta y cumplida dispuesta en el numeral 41 de la Constitución Política de la República de Costa Rica, pues por pronta no puede ser tardada y por cumplida debe ser realizada; con acierto se ha dicho que no se trata de un adelanto de criterio sino de una tutela de situaciones apremiantes que sin el debido respaldo jurisdiccional se convertirían en daños directos para las partes procesales intervinientes.

En este mismo sentido, el artículo 19 del Código Procesal Contencioso Administrativo, establece que el fin de la fijación de una medida cautelar es proteger y garantizar, provisionalmente el objeto del proceso y la efectividad de la sentencia. La doctrina ha indicado que la justicia cautelar no tiene como fin declarar un hecho o una responsabilidad, ni la de constituir una relación jurídica, ni ejecutar un mandato y satisfacer el derecho que se tiene sin ser discutido, ni dirimir un litigio, sino prevenir los daños que el litigio pueda acarrear o que puedan derivarse de una situación anormal (Gallegos Fedriani, Nombre41. Las medidas cautelares contra la Administración Pública. 2 ed. Buenos Aires, Argentina: Ábaco, 2006). De conformidad con el artículo 21 del Código Procesal Contencioso Administrativo, el juez, a la hora de determinar la procedencia de una solicitud de medida cautelar, debe verificar que la pretensión del proceso de conocimiento no sea temeraria o, en forma palmaria, carente de seriedad, lo que constituye una valoración preliminar del fondo para determinar si existe en el caso en cuestión lo que la doctrina y la jurisprudencia han llamado apariencia de buen derecho o fumus boni iuris.

Por otro lado, el mismo numeral 21 del Código establece la procedencia de la medida cautelar cuando la ejecución o permanencia de la conducta sometida a proceso produzca graves daños o perjuicios, actuales o potenciales, situación que ha sido definida en la doctrina como el peligro en la demora o periculum en mora, es decir, que en virtud de la demora patológica del proceso judicial, concurra un peligro actual, real y objetivo de que se genere a la parte promovente un daño grave (Jinesta Lobo, Ernesto. Manual del Proceso Contencioso-Administrativo. 1 ed. San José, Costa Rica, Editorial Jurídica Continental, 2008). Por último, el artículo 22 CPCA establece la obligación del juzgador de realizar, a la luz del principio de proporcionalidad, una ponderación de los intereses en juego, es decir, entre la circunstancia del particular, por un lado y el interés público y los intereses de terceros que puedan verse afectados con la adopción de la medida cautelar, por el otro.

Sólo en la concurrencia de los tres elementos, es decir, de la apariencia de buen derecho, del peligro en la demora y que del análisis de la ponderación de intereses se considere que el daño sufrido por el particular debe tutelarse por encima de los demás intereses en juego, puede proceder el despacho a conceder la medida cautelar solicitada. En términos similares, el Tribunal de lo Contencioso Administrativo y Civil de Hacienda (Sección Sexta), en voto numero 301-2012-VI, de las diez horas con cuarenta y cinco minutos del veintiuno de diciembre del dos mil doce, tuvo la oportunidad de referirse al tema, y en tal sentido estableció: "[...] La reparabilidad del bien no se satisface, en todos los casos, por un reintegro monetario. De ahí que como derivado de esta corriente, el Código Procesal Contencioso Administrativo (en adelante CPCA) abandona de modo expreso un sistema cautelar que tiene como epicentro el acto administrativo, que si bien es una de las manifestaciones formales de la voluntad pública, no es la única.

Por el contrario, al considerar el marco amplio del objeto del proceso, la justicia cautelar debe trascender la mera orden suspensiva como sub-especie de las conservativas de contenido negativo, para introducir medidas innovativas, de contenido positivo, sean estas inhibitorias, ordenatorias o sustitutivas, pero siempre valorando, en cada caso, los alcances de los poderes del juez en torno al control de la discrecionalidad administrativa (ordinales 20 y 128 del CPCA). Desde ese plano, se trata de acciones que se encuentran al servicio del proceso principal de fondo, de ahí sus características de provisionalidad e instrumentalidad. En el primer caso, en tanto lo acordado respecto de la cautelar mantendrá una vigencia condicionada a lo que se resuelva en el proceso de fondo. Cabe resaltar que también puede ser cesada o modificada en cualquier momento, ante la variabilidad de las condiciones que originariamente le dieron cabida, o bien, adoptar la que de previo hubiere sido rechazada, tal y como lo estatuye el numeral 29 del Código de rito.

En el segundo aspecto (instrumentalidad), la medida cautelar guarda una marcada relación de accesoriedad con la sentencia final, pues en definitiva, sirve de instrumento para mantener la vigencia del objeto del proceso en los términos ya señalados. A lo anterior se añade el carácter de sumaria cognitio, que es propio de estas medidas, pues siendo formas provisionales que propenden a las finalidades señaladas, deben ser resueltas de forma breve para poder cumplir su función. Cabe indicar que estas medidas surgen, en todos los casos a instancia de parte; por tanto, están impregnadas por el principio dispositivo. Sin embargo, esto es así solo respecto del análisis de la necesidad de adoptarlas, pues bien el juzgador, una vez pedidas, puede ordenar las que considere necesarias y adecuadas para proteger y garantizar provisionalmente el objeto del proceso y la efectividad de la sentencia (artículo 19.1 ejusdem).

Ahora bien, la adopción de estas medidas se encuentra condicionada a la convergencia de una serie de requisitos y condiciones que han de ser satisfechos en cada caso. Así en efecto lo impone el numeral 21 en relación al 22 de ese Código. De las anteriores normas surgen los siguientes presupuestos: peligro en la demora (periculum in mora), apariencia de buen derecho (fumus boni iuris) y el equilibrio o ponderación de los intereses en juego[...]. En síntesis , el juzgador debe tomar en cuenta los criterios que rigen la adopción de este tipo de medidas, entre ellos, la adecuación, sea, la idoneidad de la medida para satisfacer los fines buscados; necesidad, lo que presupone la valoración de los remedios que permitan de mejor manera cumplir con su finalidad y proporcionalidad, ponderando los intereses en juego.-

V.APRECIACIÓN PRELIMINAR DEL RÉGIMEN DE LEGITIMACIÓN EN EL CASO EN CONCRETO (ANÁLISIS DE APARIENCIA DE BUEN DERECHO DE LA ACCIÓN): Uno de los aspectos medulares a considerar dentro de la presente medida es la legitimación activa que tiene el promovente para esta acción que es calificable de tutela ambiental. Al respecto, tenemos claro que es un desprendimiento de la norma constitucional amparada en el numeral 50 y que se complementa con el numeral 41 de la Carta Magna, la cual otorga lo que en doctrina se conoce como tutela de un interés difuso de protección ambiental. Esta acción conforme ambos preceptos se ve llevado a la práctica conforme el 49 de la Constitución al permitir que en sede de lo contencioso – administrativo se conozcan asuntos que giran en torno a la protección de tal bien jurídico y que tiene presencia incluso en normativa de carácter internacional y que posee un amplio desarrollo, así, encontramos al principio precautorio en materia ambiental como uno de los cánones rectores del Derecho Ambiental, y que se encuentra recogido en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo o Declaración de Río, que literalmente indica “Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades.

Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente”. Además, en el ordenamiento jurídico interno la Ley de Biodiversidad, en el artículo 11 recoge como parámetros hermenéuticos los siguientes principios: 1.-Criterio preventivo: Se reconoce que es de vital importancia anticipar, prevenir y atacar las causas de la pérdida de biodiversidad o sus amenazas. 2.-Criterios precautorio o indubio pro natura: Cuando exista peligro o amenaza de daños graves o inminentes a los elementos de la biodiversidad y al conocimiento asociado con estos, la ausencia de certeza científica no deberá utilizarse como razón para postergar la adopción de medidas eficaces de protección. Además, encontramos los principios de tutela del derecho ambiental a cargo del Estado que se extrae del artículo 50 de la Constitución Política, del que deriva la obligación del Estado de ejercer una función tutelar y rectora en materia ambiental y del cual, la Sala Constitucional ha señalado que el Estado debe asegurar y proteger el derecho contra algún riesgo o necesidad, defender, prohibir e impedir toda actividad que atente contra el derecho.

Principio de la calidad ambiental, que constituye un parámetro fundamental de la calidad de vida, vinculado con la condición de esta que cada individuo pueda llevar; y al uso que se haga del ambiente para el propio desarrollo, donde la Sala Constitucional ha estimado que el derecho a un ambiente sano y ecológicamente equilibrado, implica el correlativo deber de proteger y preservar el medio, mediante el ejercicio racional y el disfrute útil del derecho mismo. Todo lo anterior permite realizar un análisis conforme el numeral 10 concluyendo que el promovente se encuentra enmarcado dentro de los supuestos del inciso 1) sub incisos c) y d) a efectos de dicho numeral, empero, cuenta de igual forma con legitimación al considerarse como afectado directo y particular de daños y perjuicios que pretende reclamar en el proceso principal, con lo que le otorga conforme el inciso 1) sub inciso a) de dicho artículo, una doble legitimación.

VI. LIMITACIÓN LEGAL DE LO REQUERIDO (ANÁLISIS DE APARIENCIA DE BUEN DERECHO DE LA ACCIÓN E INSTRUMENTALIDAD DE LA MEDIDA)

Independientemente del análisis de legitimación, ante el requerimiento cautelar propiamente, éste debe superar un análisis de apariencia de buen derecho y de instrumentalidad, teniendo presente como se expuso líneas atrás de las limitaciones de summa cognitio que este tipo de proceso judicial contempla. Así, prima facie, tenemos conflicto entre el requerimiento de agregar requisitos a la disposición reglamentaria (párrafo segundo de la pretensión cautelar) y lo dispuesto por la ley 8220 y su reglamento. Concretamente, no es discrecional para la administración (y por reflejo de esta jurisdicción en sustitución de ésta) la creación de requisitos o la desaplicación de los principios contenidos en el numeral 4° de la “Ley de Protección al ciudadano del exceso de requisitos y trámites administrativos” que expresa: “Todo trámite o requisito, con independencia de su fuente normativa, para que pueda exigirse al administrado deberá: a) Constar en una ley, un decreto ejecutivo o un reglamento. b) Estar publicado en el diario oficial La Gaceta junto con el procedimiento a seguir, los instructivos, manuales, formularios y demás documentos correspondientes y estar ubicado en un lugar visible dentro de la institución.

Asimismo, en un diario de circulación nacional deberá publicarse un aviso referido a dicha publicación”; adicionalmente, el reglamento a la citada norma (decreto 37045-MP-MEIC) constriñe a través de un requisito de revisión de simplificación de trámites, razonabilidad y justificación del requisito, que toda adición, modificación o reforma a algún reglamento o cuerpo normativo que regule un trámite que el ciudadano debe realizar, pase por un proceso de evaluación denominado “Control Previo” (véase numerales 12 a 13bis y 56 a 60bis del citado reglamento), resultando así improcedente que por medio de la tutela cautelar, se impongan requisitos de trámite, a saber, el visto bueno de salud y estudios de impacto ambiental que actualmente la norma no exige; sin mencionar que ello implicaría crear normas para un grupo finito de personas, generando así una violación al numeral 33 de la Constitución Política al dar un tratamiento diferenciado respecto de las demás personas que, a lo largo del país, utilizan y tramitan permisos al amparo del a citada normativa.

Es por esta razón que lo pretendido no supera el análisis de apariencia de buen derecho, en lo que respecta a crear más requisitos. No obstante, en lo que se refiere a la suspensión de permisos ya otorgados, no solamente por las razones expuestas en el considerando infra respecto de la delimitación territorial en la que la medida se aplicaría, el planteamiento de la acción presentada no permite analizar el impacto que tendría sobre terceros (quienes se verían afectados con lo pretendido), por lo que se genera una indeterminación del requerimiento cautelar, no teniendo claro los sujetos pasivos a los cuales se les estaría aplicando la suspensión, así como la causalidad entre el reclamo presentado en el proceso principal (daños y perjuicios) y tales terceros, haciendo imposible por ende que, al menos en vía cautelar, se logre valorar una apariencia de buen derecho a favor del promovente. En este sentido, reforzamos el requisito de instrumentalidad que toda medida cautelar debe tener respecto de la pretensión de fondo, la cual, una vez revisada las pretensiones de la demanda, encontramos que no existe una dirigida en específico contra un sujeto privado (permisiario), ni tampoco logra identificar si la ejecución de un permiso en concreto afecta al promovente (análisis de causalidad), por lo que no existiría una causalidad demostrada entre el requerimiento de suspensión de permisos ya otorgados (que como se dijo supra no se logran individualizar) y la pretensión de fondo del proceso, por lo que la medida debe de igual forma de ser rechazada.

VII.ANÁLISIS DEL CUADRO FÁCTICO PARA LA RESOLUCIÓN DE ESTA MEDIDA CAUTELAR (UBICACIÓN ESPACIO - TEMPORAL DE ANÁLISIS CAUTELAR Y CONCRECIÓN DE LO SOLICITADO): Si bien es cierto, la tutela cautelar tiene fuertes rasgos de informalismo, ello en ninguna forma habilita o genera una prerrogativa al juzgador para realizar una interpretación o adecuación de la pretensión cautelar, sino que tal carga recae sobre la parte promovente al delimitar, definir clara y de forma concisa la acción de cautela que pretende sea otorgada. En otra oportunidad, el Tribunal de Apelaciones en su resolución oral 413-2018-II (minuto 13:00 a 13:40 del audio de dicha resolución, concreto a la nota presentada por el Juez Palacios García) recalcó que uno de los elementos fundamentales de la medida cautelar, es la necesidad de determinar espacialmente el lugar donde la medida vaya a tener efecto, así la concreción de lo solicitado se yergue como uno de los requisitos fundamentales para la operatividad de la medida cautelar, sobre todo, para su eventual fiscalización ante una alegación de incumplimiento y que el juez de ejecución pueda valorar.

Al respecto, este Juzgador concuerda con la alegación Estatal de que la medida, tal y como ha sido planteada, no permite una correcta circunstanciación de lugar al referirse de manera genérica al sector “norte de Puntarenas”, refiriéndose al Ingenio El Palmar “y alrededores”. En este sentido, no es posible realizar una determinación territorial del ámbito de aplicación del a medida, haciendo imposible a que, de oficio, se adecúe los efectos de la medida en tanto no se cuentan con elementos probatorios (más allá de las fotografías aportadas) que permitan geo referenciar el cuadro fáctico bajo discusión, es de recordarse, como se insistirá infra, que esto es carga de la promovente y resorte suyo exclusivo para la correcta apreciación de la especie fáctica. En este sentido, la prueba testimonial ofrecida en nada vendría a aportar por cuanto resulta inidónea para la obtención de este dato que, al presentarse de manera indeterminada, recae en imposible de pronunciarse, hecho que se enfrenta al hecho informado con la contestación de la medida cautelar por parte de la demanda, la cual deja claro en su informe A.E.A.E/001 de la Agencia de Servicios Agropecuarios de Esparza que los hechos alegados por la promovente se refieren a un acto vandálico en una zona cercana al ingenio y que terminó afectando la finca de la empresa Agrícola El Palmar en aproximadamente 35 hectáreas, generando con ello un gran daño a la empresa, la cual denunció los hechos e intentó controlar el evento lo cual resultó muy difícil dada las condiciones climáticas que se presentaron el día del evento (véase imágenes 44 a 52 del legajo cautelar) por lo que, al menos en este proceso cautelar, no existen elementos que vinculen causalmente la conducta reclamada con la ejecución de un permiso otorgado, estando con ello ausente este requisito cautelar. Por esta razón la medida debe ser rechazada.

VIII. SOBRE EL ANÁLISIS DEL PELIGRO EN LA DEMORA DE LA MEDIDA CAUTELAR PROMOVIDA

Se echa de menos la demostración de un actual o potencial daño grave con motivo de la conducta acusada por el promovente, nótese que, tal y como lo alega la representación estatal, no existe una demostración de los daños alegados. No todo daño es plausible de tutela cautelar, únicamente el daño grave. La parte promovente no invoca, ni demuestra, un daño grave concreto objetivo, individualizable, verificable, sino que se limita a argumentar que la situación le genera “daños y perjuicios que no debe soportar”, pero no especifica, individualiza o concreta el impacto que tal pérdida genera en su esfera jurídica, ni tampoco aporta soporte probatorio para ser valorado. Recuérdese que existe una diferencia entre la prueba del proceso principal y la prueba ofrecida en el proceso cautelar en tanto esta última, a diferencia de la primera, debe dirigirse de manera ineludible a darle soporte o fundamento a la pretensión cautelar, aunque sea de manera indirecta y que permita un formal análisis del peligro en la demora, cosa que es totalmente ayuno el escrito de medida cautelar, pues la parte promovente no logra acreditar probatoriamente en qué consisten u consistirían esos alegados daños, siendo el presupuesto fundamental a valorar en cuanto al peligro en la demora a partir de los elementos probatorios y un análisis de probabilidades que hace el juez, aun y tratándose de daños potenciales y no actuales, el análisis de la potencialidad del daño grave requiere que se establezca una cadena causal, al menos de forma argumentativa, que permita al juez tramitador verificar el vínculo entre la actuación administrativa que se pretende suspender y el daño que dicha actividad pueda causar.

La falta de prueba y de argumentación en este sentido son responsabilidad exclusiva de la parte actora, criterio ampliamente reiterado por este Tribunal, respaldado por las resoluciones del Tribunal de Casación (entre otras, las números 5-F-TC-2008 y 18-F-TC-2008, del 6 de febrero y del 28 de marzo), y reiterado por el Tribunal de Apelaciones de lo Contencioso Administrativo, Sección Segunda, en el Voto 30-2012 de las catorce horas con veinte minutos del veintidós de octubre de dos mil doce, que ha indicado que es carga probatoria de quien alega la posibilidad del daño su demostración, no bastando a estos efectos su mera alegación. Siendo que no se aportan pruebas sobre el daño grave y que el despacho no verifica que exista siquiera potencialidad de su ocurrencia, no puede tenerse por acreditado el presupuesto de peligro en la demora en este asunto. Por ello, es que la medida debe ser rechazada.

IX. LIMITANTE DE CONOCIMIENTO SUMMA COGNITIO

ACCESORIEDAD E INSTRUMENTALIDAD DE LA MEDIDA CAUTELAR RESPECTO DEL PROCESO DE FONDO: Como puede observarse de la demanda, el thema decidendum sobre la validez o no frente a la tutela ambiental del reglamento actualmente vigente, así como la existencia o no de daños al promovente, son elementos que escapan del límite que el análisis de esta medida cautelar debe tener, dado el conocimiento sumario que se supone esta acción procesal debe considerar y sobre todo, respecto a la naturaleza instrumental que lo que aquí se decide debe tener respecto del proceso principal y como tales, son temas propios de fondo, y excluidos, por tanto, de los efectos de la presente acción cautelar. En este orden de ideas, tal y como lo ha indicado el Tribunal de Apelaciones de lo Contencioso Administrativo en la ya mencionada resolución 413-2018-II, cuando el proceso principal se trata – en principio –de una acción contenciosa administrativa para atacar una conducta omisiva, ésta por su naturaleza, tiene la finalidad de la imposición de obligaciones activas (dar o hacer) en caso de confirmarse la irregularidad o antijuridicidad de la conducta omisiva atacada.

En este sentido, debe tenerse presente que la pretensión cautelar no puede verse – ni de asomo – como un adelantamiento del pronunciamiento de fondo del tema de discusión principal, ya que esto desnaturalizaría completamente la instancia que se convertiría en un adelantamiento de la sentencia del proceso, lo cual resulta a todas luces improcedente. Empero, es claro que este juzgador debe realizar una ponderación de intereses, en tanto si bien como se indicó en acápite anterior no existe el peligro en la demora y no existe una correcta identificación de posibles afectados ni una zona geográfica definida a ser sometida a la tutela cautelar, así como el hecho de que lo pretendido implicaría violentar lo dispuesto en la ley 8220, su reglamento en relación con el 33 constitucional, lleva entonces a determinar la prevalencia de la tutela del interés público representado por el Estado, así como de los eventuales terceros afectados, por encima de los del promovente. Por tal razón la medida debe ser rechazada.

POR TANTO

Al no cumplirse con los requisitos dispuestos por el Código Procesal Contencioso Administrativo para el otorgamiento de la medida cautelar solicitada, se declara SIN LUGAR la medida cautelar interpuesta gestionada por Nombre15234 contra EL ESTADO. Notifíquese.
