RESULTANDO
CONSIDERING
I.Proven facts. The following facts are relevant to the resolution of these proceedings:
Placa26212, in which the freezing of a portion of the project was ordered as an interim measure (medida cautelar), within which area subsidiary property 65 is located, sold to the plaintiff herein, Nombre138409. Thereafter, taking into account that the plaintiff Nombre138409 could not build on the property registered in the National Registry in the Province of San José, real property folio registration No. Placa26203, they agreed on the actions to be taken depending on the decision issued by the Administrative Environmental Tribunal (Tribunal Ambiental Administrativo) (folio 453 of the evidentiary file submitted by the plaintiff in expediente No. 12-00256-1027-CA).
Until the Municipalidad and the Ministerio de Energía, Ambiente y Telecomunicaciones have promulgated the respective regulations, only remodeling or maintenance work on previously constructed areas shall be permitted. Communicate this ruling to the Poder Ejecutivo. Publish a summary of this ruling in the Diario Oficial La Gaceta and publish it in full in the Boletín Judicial. Give notice. / Magistrado Castillo Víquez dissents solely with respect to the modulation of the effects (dimensionamiento) of this judgment. (…)”. This decision was published in Boletín Judicial No. 13 of 19 de enero del 2011 (judgment 2010-21258 of the Sala Constitucional, query conducted in the Sistema Costarricense de Información Jurídica). 32) In Considerando VIII of the aforementioned judgment No. 2010-21258, the Tribunal Constitucional modulated the effects of the judgment as follows: “(…) VIII.- Modulation of the effects of the judgment.
Drafted by Magistrada Calzada Miranda. Pursuant to Article 91 of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), a declaration of unconstitutionality (declaración de inconstitucionalidad) shall have declaratory and retroactive effect as of the effective date of the act or provision, without prejudice to rights acquired in good faith (derechos adquiridos de buena fe). A constitutional annulment judgment (sentencia constitucional de anulación) may calibrate and modulate its retroactive effect as to place, time, or subject matter and shall establish the rules necessary to prevent serious disruption to social security, justice, or peace. In the case before us, this Sala must take into account that the challenge to the Reglamento de Zonificación, according to the publication in La Gaceta No. 173 of 10 de septiembre de 2001, was filed approximately eight years after it took effect.
Notice that the action had been filed and admitted was published on 17 de agosto de 2009. In the judgment of this Sala, although the challenged provisions of the Reglamento de Planificación Urbana issued by the Municipalidad de Mora have remained in force, this has occurred particularly within the sector of the Zona Protectora Cerros de Escazú that predates it. In this regard, the creation of the aforementioned Zona Protectora by Decreto 6112-A dates from 23 de junio de 1976, and its expansion by Decreto No. 14672 of 20 de junio de 1983 took effect earlier than the regulatory plans (planes reguladores); therefore, it cannot be assumed that those national provisions were unknown to the Municipalidad, the residents of the Cantón, and the other protected areas that encompass the entirety of the Cantón de Mora. Accordingly, the Sala considers that the judgment must be accompanied by a special modulation so as to cover only fully completed structures, or structures begun pursuant to the respective building permits (licencias de construcción) before the first notice of 17 de agosto de 2009.
In the judgment of the Sala, two specific circumstances must be taken into account: first, where an interested party who had satisfied all necessary requirements actually began construction before publication of the aforementioned notice, because that party acted in reliance on the urban-planning regulations (normativa urbana) issued by the Municipalidad. Second, if homes in those locations require remodeling that does not entail any additional construction area, or require maintenance, this must be recognized as rights acquired in good faith, subject to the condition that the same previously constructed area be retained. All of the foregoing is without prejudice to the promulgation by the Municipalidad de Mora of new urban-planning provisions that guarantee human development in balance with the environment, in compliance with the provisions of the Ley de Planificación Urbana, without modifying the land regime (régimen de suelos) of the respective Zonas Protectoras, and with the corresponding technical environmental-impact studies (estudios técnicos de impacto ambiental).
Likewise, in the areas falling under the jurisdiction of the Ministerio de Ambiente, Energía y Telecomunicaciones, once it completes the respective management plan (Plan de Manejo) for the relevant Zonas Protectoras that similarly affect the Cantón de Mora and others, the Ministerio cannot remain aloof from the pressure that these zones receive from adjacent communities. Finally, it is clear that, upon the declaration of unconstitutionality of the challenged provisions, the corresponding provisions of the 1993 Reglamento de Zonificación concerning the Zona Agrícola (Article 11) and the provisions concerning the Resto de Distrito (ZRD) (Article 13) do not automatically take effect, but will do so only upon publication, since the record contains only the summary published in La Gaceta, as stated supra in this judgment. In the absence of such regulations, the urban-planning framework (ordenamiento urbano) of the Cantón de Mora must be supplemented by the corresponding regulations issued by the Instituto Nacional de Vivienda y Urbanismo. (…)” (aforementioned judgment 2010-21258, query in the Sistema Costarricense de Información Jurídica).
II.Facts not proven (hechos no probados). As relevant to these proceedings, and because there is no evidence supporting them, the following are deemed unproven:
III.Subject matter of the proceedings (objeto de los procesos). In essence, all the claimants bring this action to determine whether the framework of liability (marco de responsabilidad) that they attribute to the co-defendants is applicable, arising from what they consider to be damages and losses (daños y perjuicios) sustained in their capacity as owners of their respective properties located in the project known as Condominio Horizontal Residencial Hacienda Los Bambúes, developed by Urbanizadora La Laguna S.A. Specifically, the following principal claims (pretensiones principales) are asserted:
IV.General aspects related to the nature and scope of regulatory plans (planes reguladores), the consideration of the environmental variable (variable ambiental) in urban planning (planificación urbana), and its impact on individuals’ property rights (derecho de propiedad). Given the specific claims raised by each of the plaintiffs herein, the Court deems it necessary to address these matters, which this Court already considered in Judgment No. 0037-2017-VI, issued at 14:00 on March 22, 2017, resolving a similar claim brought by the owner of a property located precisely in Condominio Hacienda Los Bambú in the canton of Mora. As relevant here, that judgment stated: “(…) Under the provisions of Article 169 of the Constitución Política, exclusive authority over the planning, control, and implementation of local urban development rests with the municipalities, which exercise it through so-called regulatory plans, by means of which, within their territorial jurisdiction, they determine—among other matters—the zoning of land use (uso del suelo).
In this regard, the cited provision states: ‘The administration of local interests and services in each canton shall be entrusted to the Municipal Government, composed of a deliberative body consisting of popularly elected municipal councilors and an executive officer to be designated by law.’ This derives from the autonomy granted to them over their territories by the original constituent authority, a principle reiterated in the opening paragraph of Article 170, which states: ‘Municipal corporations are autonomous.’ The powers and functions of these administrative units are developed in the Código Municipal and the Ley de Planificación Urbana, insofar as concerns the activity under review. Under this understanding, Article 3 of the Código Municipal provides: ‘The territorial jurisdiction of the municipality is the respective canton, whose principal city is the seat of the municipal government./ The government and administration of cantonal interests and services shall be entrusted to the municipal government.’ From this standpoint, the issuance of local regulatory plans falls to the municipalities, following the procedure established by law.
Thus, Article 15 of the Ley de Planificación Urbana, No. 4240 of November 15, 1968, provides: ‘Pursuant to Article 169 of the Constitución Política, the competence and authority of municipal governments to plan and control urban development within the boundaries of their territorial jurisdiction are hereby recognized. Accordingly, each of them shall take the appropriate measures to implement a regulatory plan and the related urban development regulations in the areas where they are to apply, without prejudice to extending all or some of their effects to other sectors where compelling reasons warrant the establishment of a particular system of control.’ From this standpoint, Article 1 of the Ley de Planificación Urbana defines a regulatory plan as the local planning instrument that sets forth, in a collection of plans, maps, regulations, and any other document, graphic material, or supplement, the development policy and plans for population distribution, land uses, thoroughfares, public services, community facilities, and the construction, conservation, and rehabilitation of urban areas.
As to their nature, the Sala Constitucional has characterized them as follows: ‘These are broad planning mechanisms through which local governments decide on the best use to be made of land, as well as on the design of public services, local thoroughfares, housing, and urban renewal, among other matters. In this respect, these plans constitute municipal policy mechanisms that make it possible to plan the type of development desired for each canton, with due regard for the rights and interests of its inhabitants and the constitutional values governing all public action (see, to that effect, Judgment No. 5097-93, issued at ten twenty-four on October fifteenth, nineteen ninety-three, and Judgment No. 2006-10971, issued at eighteen oh-three on July twenty-sixth, two thousand six).’ (Decision 2008-6304, issued at twelve twenty-six on April eighteenth, two thousand eight). Through these plans, the urban planning and land-use regulation power (potestad de planificación y ordenación urbanística), conferred as an original competence upon local entities, is given concrete effect.
To that extent, Urban Planning is defined by Article 1 of the Ley de Planificación Urbana as ‘the continuous and comprehensive process of analyzing and formulating urban development plans and regulations, intended to promote the safety, health, comfort, and well-being of the community.’ Urban planning must therefore be regarded as a specific application of the exercise of the powers that public authority confers upon the State, as part of the actions intended to define national political and economic policy. Ultimately, the essential purpose of this type of exercise of power is that, through appropriate planning, various uses of land be combined so that its organization provides better service and utility for individuals and the urban community, balancing the development of population centers and surrounding rural areas, different urban communities, the regions, and the country as a whole.
It should be noted that regulatory plans and their respective regulations are normative in nature and, consequently, bind both the owners of land located within the area of application and the municipality that enacts them. They are normative instruments imposing urban-planning restrictions (limitaciones de orden urbanístico), pursuant to the authority granted by Ley No. 4240. Accordingly, once the local planning instrument has been adopted, its provisions apply to all buildings intended to be constructed, remodeled, or expanded after it enters into force, except in certain exceptional cases. It is therefore an urban land-use regulation instrument and a concrete exercise of the planning power vested in Local Corporations, establishing the rules governing development rights (edificabilidad) in a given area and thereby directly affecting the availability of the right to build (ius edificandi) inherent in real property, thus incorporating restrictions on property rights, effects that require and justify compliance with various statutory prerequisites and an issuance procedure.
Regarding its legal nature, see, among others, Decisions Nos. 416-2010, 2304-2010, 073-2011, 126-2011, and 141-2012, all issued by Section III of this Tribunal Contencioso Administrativo, as well as Decision No. 2006-13330 of the Sala Constitucional. / VI.- Requirements and procedure for issuing a Regulatory Plan. Based on the foregoing, the legal nature of the Regulatory Plan, its purpose, the competence of local entities to issue it, and its legal scope in limiting the full enjoyment of the various incidents of ownership (atributos del dominio) are clear. Nevertheless, the issuance of these regulatory plans is far from an unrestricted power and, as a typical administrative function involving the exercise of sovereign powers (potestades de imperio)—in this case, regulatory powers that therefore impose relative limitations on private rights—it must be, and indeed is, subject to the principle of legality (principio de legalidad).
This entails the applicability of limits imposed by the legal system itself, not only through the definition of frameworks for action and procedure but also, and perhaps most importantly, through limits deriving from the body of law and from the very rights whose exercise it seeks to condition or, at least, channel. The planning function lies at the very essence of State power in its purposive dimension, since it ultimately seeks to establish the foundations upon which urban-development actions must rest, so that regulating the use of urban property permits better use and optimization of resources, thereby improving individuals’ quality of life in harmony with the prevailing social and economic model. Even so, it is clear that this function is subject to boundaries or constraints. Planning may be neither arbitrary nor capricious; it must be the means to an end, the vehicle carrying urban factors toward the goal of a better city that integrates the various surrounding variables in appropriate harmony.
For this reason, viewed through the lens of the principle of legality, the issuance of regulatory plans is subject to the specific procedure established by the Ley de Planificación Urbana. That statute also establishes the basic content of these normative acts (actos normativos). In this regard, see Articles 15 through 20 of the aforementioned legislation. Specifically, Article 16 of the Ley de Planificación Urbana provides that, in accordance with the objectives defined by the various State governmental and administrative bodies themselves, a local regulatory plan shall include, among other nonexclusive elements: a) the development policy, setting forth the principles and rules upon which it is based and the objectives arising from the needs and growth of the area to be planned; b) the population study, including projections of future demographic growth, its distribution, and recommended density standards; c) land use showing the status and distribution of land with respect to housing, commerce, industry, education, recreation, public purposes, and any other relevant use; d) the transportation study, generally identifying the location of principal public roads and transportation routes and terminals; e) community services, indicating the location and size of the areas required for schools, secondary schools, parks, playing fields, health units, hospitals, libraries, museums, public markets, and any other similar facilities; f) public services, with a general analysis and location of the principal systems and facilities for water mains, fire hydrants, sanitary and storm sewers, and waste collection and disposal, as well as any other service of comparable importance; and g) housing and urban renewal, setting forth housing needs and objectives and identifying the areas to be subjected to conservation, rehabilitation, and remodeling.
The issuance of a regulatory plan is, however, subject to compliance with substantive requirements established by the legal system as conditions for the validity of the action. In this regard, Article 17 of the aforementioned Law provides that, before implementing a regulatory plan or any part thereof, the respective municipality seeking to do so must proceed as follows: ‘1) Convene a public hearing (audiencia pública) through the Diario Oficial and any additional publicity required, indicating the place, date, and time for consideration of the proposal and of any oral or written comments that residents or interested parties may wish to submit.
Notice shall be given no less than fifteen business days in advance;
The contrary view—that, because of the deficiency noted, the Plan cannot under any circumstances take effect—would defy all logic, given that a publication exists which, in principle, seeks to give effect to an act that has satisfied the applicable requirements. In this regard, section 43 of the Código Municipal provides that, in the absence of express mention of a different date, regulatory provisions take effect upon publication. That provision, which is special in nature in municipal matters, validly applies here because these proceedings concern urban-planning matters arising from powers vested in local governments—ultimately, matters associated with the jurisdictional framework of municipal councils—and are therefore also governed by the provisions of the legal system specific to that field. / VIII.- On consideration of the environmental variable in urban planning. Within the procedural framework of a Regulatory Plan, as well as the issuance of any regulations establishing rules for its implementation (including the Reglamento de Zonificación), analysis and protection of the environment are unquestionably required as a consequence of the general obligation imposed by constitutional provision 50.
Urban-planning matters must include environmental matters within their framework of analysis, assessment, and protection, to such an extent that all urban development must take that variable into account, as required by environmental-protection legislation. This is a field of human activity whose impact on the environment is directly evident. The autonomy constitutionally granted to municipalities for territorial planning and land-use planning does not exempt them from environmental regulations. Accordingly, in principle, every Regulatory Plan must, before being approved and implemented, include consideration of the environmental variable, with the proper participation of the authorities competent in that field. The importance of this variable more than justifies its assessment in projects of this kind, as a consequence of the doctrine arising from provision 50 of the Constitution, to which rights local governments are subject, without this entailing an infringement of their autonomy.
This constitutional provision requires the State, in the broad sense (including other public institutions and local governments), to intervene actively in protecting the environment, an area whose development is governed by statute, in order to promote economic and social development in full compatibility with a healthy and ecologically balanced environment. Legislation in this area is extensive and includes the Ley Orgánica del Ambiente No. 7554 del 04 de octubre de 1995, Ley Forestal No. 7575 del 13 de febrero de 1996, Ley de Conservación de Vida Silvestre No. 7317, Ley de Uso, Manejo y Conservación de Suelos No. 7779 del 30 de abril de 1998, Ley de Biodiversidad No. 7788 del 30 de abril de 1998, Ley de Aguas No. 276 del 27 de agosto de 1942, and Ley de Planificación Urbana No. 4240 del 15 de noviembre de 1968. Of particular relevance is the content of Article 17 of the Ley Orgánica del Ambiente, which provides: “Article 17.-Environmental Impact Assessment.
Human activities that alter or destroy elements of the environment or generate waste or toxic or hazardous materials shall require an environmental impact assessment (evaluación de impacto ambiental) by the Secretaría Técnica Nacional Ambiental created by this law. Prior approval by that body shall be an indispensable requirement for commencing the activities, works, and projects. Statutes and regulations shall specify which activities, works, or projects require an environmental impact assessment.” Likewise, the Reglamento General Sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), -Decreto Ejecutivo No. 31849-MINAE-S-MOPT-MAG-MEIC de 24 de mayo del 2004, publicado en La Gaceta No. 125 de 28 de junio del 2004-, provides in section 67: “Article 67.- Integration of the environmental variable into Regulatory Plans. Regulatory Plans established under the Ley de Planificación Urbana and the Ley de la Zona Marítima Terrestre, or any other official land-use planning plans or programs, as a means of planning the development of human activities that may affect the environment, must satisfy the requirement of integrating the environmental-impact variable, which shall be subject to an environmental-viability review by SETENA before approval by the respective authorities.
Through its EIA Manual, SETENA shall establish the terms of reference, instruments, and procedures for integrating that environmental variable into Regulatory Plans or land-use planning plans or programs, applicable both to those currently being prepared or to be prepared in the future and to those already approved that do not yet have environmental viability.” The manual referred to in this last provision was issued through Decreto número 32967-MINAE, publicado el 4 de mayo del 2006. Along these lines, the Sala Constitucional has stated emphatically: “Determination of the environmental viability of urban regulations or Regulatory Plans by a specialized technical body contributes to the effectiveness of Article 50 of the Constitución Política and to better protection of every person’s right to a healthy and ecologically balanced environment. Urban planning is one of the most important and consequential tools available to Municipal Governments in fulfilling their objectives and serving local interests.
It is the regulatory expression of the canton’s will and of the planning and design of its collective and individual development, without being detached from the national context or from the territorial and environmental unity to which it belongs. The manner in which the development of human activities is planned has a significant environmental impact, which may be negative or positive depending on the uses and activities authorized. Thus, incorporating environmental variables and subjecting Regulatory Plans to an environmental assessment process are mandatory requirements arising from Article 50 of the Constitution” (Judgment number 2007-13293 de las diez horas cuarenta minutos del catorce de septiembre del dos mil siete.) Accordingly, it bears repeating that consideration of the environmental impact of urban-planning plans, as well as of the regulatory instruments for their implementation, cannot omit this variable under any circumstances; otherwise, the result would be unlawful conduct giving rise to civil, criminal, and administrative liability for failure to discharge this duty.
The omission of this requirement and its effects in terms of the invalidity of urban-planning instruments have been analyzed by the Sala Constitucional, among others, in decisions 2005-14293 and 2001-5737. / IX.- On the effect (impact) of urban planning on individuals’ property rights. From the foregoing, it follows that the urban-planning power (whether national, regional, or local) is a legitimate power that seeks to reconcile the right to property with the public interest in the planned establishment, supported by proper technical justification, of permitted and prohibited land uses. From this perspective, it directly affects the right to real property, specifically the so-called right to build and dispose of the property (ius edificandi), and the purpose or use intended for the parcel (commercial, industrial, agricultural, conservation, etc.), because although the owner retains title, the actual exercise of the right to build and/or use is conditioned in advance by the rules established by the Regulatory Plan, the Reglamento de Zonificación, subdivision rules (normas de fraccionamiento), and the conditions imposed by the building regulations and the Reglamento de Renovación Urbana.
Strictly speaking, this is a right whose exercise depends on whether the use proposed by the owner is compatible (conforming) with the content of those planning rules. Thus, in the urban-planning context, land may, pursuant to those regulatory instruments, be classified as developed, developable, or non-developable. Zoning may even result in the land-use certificate stating that the proposed use is conforming, nonconforming, or approved subject to reservations. From this perspective, amendments to these planning instruments may have the effect of making it impossible to use the land in accordance with the original purpose for which it was acquired. Nevertheless, it is clear that these planning rules impose limitations on the exercise of ownership rights, which must be reasonable and proportionate; limitations that completely eliminate the availability or permissible-use regime of property cannot be deemed lawful.
There is therefore an inseparable relationship between real property and Urban-Planning Law, insofar as the latter limits, directs, and conditions the effective content of the former. The right to property, protected by provision 45 of the Constitution, was initially understood as an absolute, exclusive, and perpetual right. However, analysis of this right has evolved toward recognition of its relative nature, insofar as it is subject to the possibility of limitations imposed in the public interest. In judgment No. 4205-96 de las 14:33 horas del 20 de agosto de 1996, the Sala Constitucional stated the following regarding the content of this right: “V. THE SOCIAL FUNCTION OF PROPERTY AND ITS RELATIONSHIP TO LIMITATIONS ON THE RIGHT TO PROPERTY—SECOND PARAGRAPH OF ARTICLE 45 OF THE CONSTITUCIÓN POLÍTICA. A conception of the right to private property in absolute and virtually unlimited terms became the fundamental basis upon which the Western system was established, with the complete inviolability of the right to property enshrined as the core of the legal system, because it entailed complete dominion over the property in an absolute, general, independent, full, universal, unlimited, and exclusive manner.
However, this concept has evolved to the point of advocating the protection of property based on social harmony and on a social understanding of land ownership. The legal foundation on which the protection of property rests is thus modified: from being an exclusive individual right, it becomes an obligation in favor of harmonious coexistence in society. The idea of the “social function” of property arose, under which every individual has the obligation to fulfill certain communal duties directly related to the position that individual occupies and the interests of the social group that the individual represents. The substance of this “property-as-function” consists in the owner having the power to use the asset subject to ownership (dominio) to satisfy the owner’s own needs, while also having the duty to place it at the service of social needs when such conduct is indispensable. This new concept broadens the legislature’s authority to determine the substance of the right to property, which is achieved through the limits and obligations grounded in the social interest that it may establish, thereby putting an end to the exclusive, sacred, and inviolable character of that right.
(...) VI. Article 45 of the Political Constitution enshrines the right to property in our constitutional legal system. The first paragraph describes it as “inviolable” and establishes the State’s obligation to compensate the owner in advance when it must take the property for reasons of “legally established public interest.” The second paragraph provides for the possibility of imposing limitations in the social interest (limitaciones de interés social) on property through a law adopted by a qualified vote (votación calificada)—a vote of two-thirds of the entire membership of the Legislative Assembly. It is clear from the foregoing that the State’s obligation to pay compensation is constitutionally prescribed solely and exclusively in cases of expropriation (expropiación) and does not apply to limitations in the social interest established by a law adopted by qualified vote (...).” From this perspective, although property constitutes a constitutionally based right, its substance is developed through statutory sources.
Along these lines, section 264 of the Civil Code defines the substance of ownership or property as comprising the rights of possession, usufruct, transformation, conveyance, defense, exclusion, recovery, and compensation. As noted, that substance is not unrestricted, since it is subject to limitations imposed by law in consideration of the private interests of other owners as well as the public interest of the community. From this perspective, Article 45 of the Constitution itself establishes the ways in which that right to property may legitimately be qualified. The provision states verbatim: “Property is inviolable; no one may be deprived of their property except for legally established public interest and upon prior compensation in accordance with the law. In the event of war or internal unrest, compensation need not be paid in advance. Nevertheless, the corresponding payment shall be made no later than two years after the state of emergency has ended./ For reasons of public necessity, the Legislative Assembly may, by a vote of two-thirds of its entire membership, impose limitations in the social interest on property.” As relevant to the urban-planning framework, the second paragraph of the aforementioned provision governs administrative limitations (limitaciones administrativas), a category that includes urban-planning rules (reglas urbanísticas).
These limitations are based on the existence of a general public benefit or necessity grounded in the rules of social coexistence and neighbor relations, environmental protection, and building or urban-planning provisions, among others. Thus, unlike expropriation, which applies to the property of a particular person identified in the declaration of public interest and in the designation of the specific property to be acquired through this compulsory mechanism, administrative limitations apply to any person or rights holder who falls within the factual circumstances contemplated by the rule imposing the limitation. Moreover, limitations must be imposed by a law enacted by a qualified majority, whereas no such majority requirement applies to the legislative procedure for expropriation. A limitation imposed without enabling legislation, or under a statutory source enacted without that legislative approval majority, would lack a valid legal basis.
Furthermore, as an initial proposition, limitations do not extinguish the right to property; they merely restrict the owner’s performance or exercise of some of the attributes of ownership, or reduce the scope of their exercise, without eliminating them entirely. Given that distinction, because expropriation entails the complete loss of the attributes of the right to property as a whole, the Political Constitution itself requires prior compensation, subject to the exceptions provided for in that provision and in the Expropriations Law (Ley de Expropiaciones). By contrast, because an administrative limitation does not extinguish the right to property, as an initial proposition no monetary compensation is contemplated. / X.- Regarding the scope and restrictions of those limitations on property, the Constitutional Court stated, insofar as relevant, in the aforementioned ruling: “VIII. Notwithstanding what was stated in the preceding recitals (considerandos), it should be noted that the natural boundary of the legitimate limitations that may be imposed on private property lies in the degree to which the property is affected; that is, when the restriction on the right to property becomes a true expropriation, with the resulting obligation to pay compensation because the right to property is completely eliminated, or when it does not affect the community as a whole.
The Full Court so stated with respect to limitations imposed on property when they cross that boundary, at its special session of dieciséis de junio de mil novecientos ochenta y tres: ‘[...] that is, “limitations,” as Article 45 calls them, but not dispossession of private property or deprivation of a primary attribute of ownership, because preventing enjoyment of the property is equivalent, at least in this case, to a form of expropriation without the requirement of prior compensation mandated by the Constitution’; and as this Court held in the cited judgments number 5097-93 and 2345-96, where it stated: ‘IV.) In the Chamber’s view, the reasonable limits that the State may impose on private property, according to its nature, are constitutionally permissible insofar as they do not deprive it of its substance. When that occurs, it ceases to be a reasonable limitation and becomes a deprivation of the right itself.’ (Judgment number 5097-93); ‘That is, the attributes of property may be limited insofar as the owner retains the possibility of making ordinary use of the property, excluding, of course, the portion or function affected by the limitation imposed by the State.
Outside these parameters, if social welfare requires a sacrifice solely from one person or from a few persons, compensation must be paid, just as when the sacrifice imposed on the owner is of such a nature that it causes the owner to lose the property in its entirety. Thus, a limitation on property withstands constitutional scrutiny when its effect on the essential attributes of property—those that permit the natural use of the thing within current socioeconomic conditions—does not eliminate the nature of the property or make use of the thing impossible because the State imposes authorization or approval requirements so complex that they effectively make it impossible to enjoy the property.’ (judgment number 2345-96).” In this regard, it should be recalled that zoning plans (planes reguladores), by virtue of their substance and their enhanced enactment regime, may legitimately impose limitations in the social interest on property.
Along these lines, see also votes numbers 5305-93, 6706-93, 4205-96 and 2006-13330, all issued by the Constitutional Chamber. It follows from the foregoing that urban-planning limitations (limitaciones urbanísticas) are entirely valid; however, insofar as the imposition of one of these limitations renders the property, or its substance, functionally unusable in practice—that is, makes it impossible to utilize or use the property for the purposes permitted by urban-planning rules—those limitations become means of de facto expropriation (expropiación de hecho). In general, when any other form of burden or limitation on the full exercise of ownership is used that makes it impossible to exercise bare ownership (nuda propiedad), a right to compensation arises in favor of the affected owner. Along these lines, section 13 of the Ley de Expropiaciones states: “The provisions of this Law shall apply to the establishment of easements (servidumbres) and to every type of burden on property and rights.
When the type of burden substantially restricts the availability of the property or right, processing it as a burden shall be improper, and full expropriation shall be carried out.” Similarly, section 17 of the Ley de Expropiaciones governs the so-called dysfunctional remainder (remanente disfuncional), which arises when, in cases of partial expropriation, the owner cannot use the remainder of the real property for permitted activities. In both cases, when the practical effect is a substantial limitation on the availability of the property, the proper course is to order the total expropriation of that property. This is because, in such circumstances, the measure would not be a burden on property of the kind inherent in the administrative-limitations regime, but rather a true de facto expropriation, insofar as the possibility of disposing of the property is completely eliminated. The foregoing must be analyzed on a case-by-case basis, for which it is essential to consider the permitted land use (uso del suelo) of each property to be expropriated, as well as the minimum lot sizes for subdivision (fraccionamiento) or construction and the permitted or prohibited uses.
For example, if the unexpropriated remainder or the strip of land not subject to the administrative limitation has an area smaller than that required by the zoning plan for exercising the right of transformation or construction (ius edificandi), in cases involving land suitable for urban development, the substantive legal effect is the elimination of the ability to use the property, giving rise in such cases to the obligation to expropriate the entire parcel. The same occurs when, on land suitable for urban development, the zoning plan permits no form of transformation, because in such cases the owner faces a situation in which it is effectively impossible to make productive use of the real property, even though the owner remains subject to the urban obligations imposed through administrative limitations, e.g., construction and maintenance of sidewalks and preservation and security of the property, among many others, as well as tax charges relating to the property, including the real property tax and various municipal fees, without being able to benefit from the use and disposition of the property.
It should also be noted that environmental limitations (limitaciones de orden ambiental) exist, such as those imposed by the Ley Forestal, which allows the State to designate protected areas through an Executive Decree. It bears reiterating that one of the characteristics of restrictions and easements is that the owner does not entirely lose that status and may continue using the property within the bounds of what is permitted and required; that is, they do not entail the absolute loss of the property’s availability.
Therefore, when, as a result of an administrative restriction, the owner is entirely unable to use the property or put it to any use, this would essentially amount to transferring the property wholly to public use, which, it bears repeating, would result in a de facto expropriation. Hence, in each case, it must be determined whether the property becomes dysfunctional or whether bare ownership (nuda propiedad) is substantially impaired, in which case, to safeguard the right to property, an expropriation order (orden expropiatoria) is required so as not to subject the owner to unjustified dispossession (desposesión). (…)”. This Court reaffirms the foregoing standard and, in accordance with the guidelines established therein, proceeds to examine the various claims raised by the petitioners.
V.Regarding the specific case. Before analyzing the admissibility of the relief sought by the plaintiffs, it is essential to note as background that in 2001 the Municipalidad de Mora initiated proceedings to amend the Zoning Regulations (Reglamento de Zonificación), for the purpose of changing the land use (uso del suelo) in areas forming part of the ZPCE; that amendment ultimately received the approval of the INVU and entered into force. Pursuant to that amendment, Article 4.3 of the Zoning Regulations at issue created the Low-Density Residential Zone with Restrictions (Zona Residencial de Baja Densidad con Restricciones, Z.R.B.D.R), establishing the permitted uses, nonconforming uses (usos no conformes), and requirements for that zone as follows: “Article 4.3. Low-density residential zone with restrictions (Z.R.B.D.R): This zone comprises land located to the east and west of the Ciudad Colón urban district, in which, before any project may be developed, studies and analyses must be conducted establishing that future buildings will not experience problems due to landslides, subsidence, or soil erosion. 1.
Permitted uses: Single-family and multifamily housing in residential developments and condominiums, small-scale commerce, and community public services. Any agricultural, livestock, forestry, or related activity. 2. Nonconforming uses: All uses not included among the permitted uses. 3. Requirements: 3.1. Hydrological and geological studies demonstrating that there are no problems involving landslides, subsidence, or soil erosion. 3.2. Minimum lot area: 1.000 square meters. 3.3. Minimum lot frontage: 20.00 meters. 3.4. Setbacks (retiros): Front: 5.00 meters; side: 3.00 meters on each side or 5.00 meters on only one side. Rear: 3.00 meters. For buildings of 2 or more stories, the relevant provisions of the Construction Regulations (Reglamento de Construcciones) shall apply. 3.5. Maximum height: 2 stories for single-family housing. 6 stories for multifamily housing; buildings of 4 stories or more must obtain approval from Aviación Civil. 3.6.
Maximum lot coverage (cobertura máxima): 30% for single-family housing. 15% for multifamily housing. 3.7. Permitted density: 30 inhabitants per hectare, 6 dwellings per hectare.” Subsection 3 of Article 10 of those Regulations was also amended as follows: “Article 10.—Agricultural Zone (Z.A.): This zone comprises land generally located on the periphery that retains an agricultural use, which is intended to be protected while also serving as a buffer limiting urban development. 1. Permitted uses. In addition to the facilities necessary for agricultural activity, only housing for the owner or farmworkers shall be permitted, provided that minimum services are available. An exception is made for the Zones of Brasil, Rodeo, Jaris, San Bosco, Los Altos de San Rafael, and Barrio La Trinidad, since these sectors have a high proportion of housing intermingled with agricultural activity and must be allowed natural population growth; housing is therefore permitted subject to the same requirements already established for the residential zone.
Natural population growth shall occur along the periphery of public roads, with access by easements (servidumbres) or new public roads no longer than 150 meters in the case of a public road and no longer than 60 meters in the case of an easement, provided that they comply with the Construction Regulations and that lot sizes are determined by infiltration tests. 2. Requirements. 2.1. Minimum area: 1 hectare. 2.2. Minimum frontage: 20,00 meters. 2-3. Maximum coverage: 10% of the farm area, including structures related to agricultural use. (*)3. Requirements: For the zones of Brasil, Rodeo, Jaris, San Bosco, Los Altos de San Rafael, and Barrio La Trinidad, in accordance with the provisions of point one of this Article, residential development shall be permitted subject to the following requirements: 1. Maximum density of 250 inhabitants per hectare. 2. Maximum height of 6 stories. 3. Maximum coverage of 30%. 4.
Conforming and nonconforming uses as established for the Residential Zone. 5. All land in this zone must be supported by studies analyzing soil stability, erosion, landslides, and contamination of rivers and streams, as well as water sources.” While those regulatory provisions were in force, specifically between 22 de junio del 2006 and 20 de julio del 2007, the petitioners Nombre138412, Nombre138409, Nombre138410, and Nombre138411 entered into private share-assignment agreements (contratos privados de cesión de acciones) with the persons who were then the attorneys-in-fact of Desarrollos Urbanísticos Bloque SGRAH DOS BBB S.A, Desarrollos Urbanísticos Segmento TJFK SEIS FFF S.A., Desarrollos Urbanísticos Bloque SGRAH VEINTIUNO TTT S.A., and Desarrollos Urbanísticos Bloque SGRAH QUINCE ÑÑÑ S.A., under which the latter, for the price agreed therein, assigned to the former—the plaintiffs herein—all the shares of the respective companies (proven facts 8, 11, 14, and 17).
Those agreements established that the aforementioned companies, in the order indicated ut supra, owned the properties recorded in the Registro Nacional, Partido de San José, Sección de Propiedad Horizontal, under Real Folio registration numbers Placa26200, , and Placa26208, corresponding to units 53, 65, 48, and 61 of Condominio Hacienda Los Bambúes. The properties were thus acquired by the petitioners identified above, and all are described as condominium-unit properties, with their respective numbers, consisting of land suitable for construction, intended for residential use, on which buildings may have a maximum height of two stories. Moreover, the cadastral plans (planos catastrados) for each property indicate, in the detailed area schedule, the maximum coverage permitted in the zone, as well as the height (2 stories), the proposed maximum coverage area, the maximum construction area, and the floor-area ratio (índice de construcción) of 0.6.
(proven facts 9, 10, 12, 13, 15, 16, 18, and 19). Subsequently, on 19 de junio de 2009, the Mayor of the Municipalidad de Mora filed an action for unconstitutionality (acción de inconstitucionalidad) against the comprehensive amendment made to the Zoning Regulations of the Regulatory Plan (Plan Regulador) of the canton of Mora, solely in relation to the Zona Protectora Cerros de Escazú (ZPCE). The action was processed under expediente No. 09-009306-0007-CO, and by judgment No. 2010-021258 at 14 hours on 22 de diciembre del 2010, the Sala Constitucional ruled on that action for unconstitutionality. The operative portion (parte dispositiva) of that judgment states: “The action is hereby GRANTED. Accordingly, Articles 4.3 and 10 of the Zoning Regulations of the Plan Regulador de Mora, published in La Gaceta No. 173 of 10 de septiembre de 2001, are annulled as unconstitutional. Article 13 of the 1993 Zoning Regulations is not unconstitutional provided that, following its publication in the Diario La Gaceta, it is not applied to Áreas Silvestres Protegidas.
This judgment shall have declaratory and retroactive effect as of the effective date of the annulled provision, without prejudice to rights acquired in good faith (derechos adquiridos de buena fe). However, pursuant to Article 91 of the Ley de la Jurisdicción Constitucional, the effects are qualified such that the declaration of unconstitutionality shall not affect fully completed buildings or owners holding the corresponding building permits issued by the Municipalidad, except for those on which construction has not yet begun as of the date the notice is published. Until the Municipalidad and the Ministerio de Energía, Ambiente y Telecomunicaciones have enacted the corresponding regulations, only remodeling or maintenance work on previously constructed areas shall be allowed. This ruling shall be communicated to the Poder Ejecutivo. A summary of this ruling shall be published in the Diario Oficial La Gaceta, and the full text shall be published in the Boletín Judicial.
Notice shall be given. / Magistrado Castillo Víquez dissents solely with respect to the qualification of the effects of this judgment.” This judgment was published in Boletín Judicial No. 13 of 19 de enero del 2011. Against this background, we proceed to rule on the principal claims asserted by the plaintiffs.
VI.The first claim asserted by all the plaintiffs seeks a declaration that the defendants are liable for rendering unusable and impossible to develop the lots acquired while the 2001 amendment to the Zoning Regulations (Reglamento de Zonificación) of the Regulatory Plan (Plan Regulador) of the Canton of Mora was in force, because those properties have an area smaller than that permitted under the Zoning Regulations currently in force. In this regard, the first point we must make is that, based on the account of facts deemed proven, it is clear that, on the date when the plaintiffs Nombre138412 , Nombre138409 , Nombre138410 and Nombre138411 acquired, through the assignment of shares (cesión de acciones), the companies owning the properties registered in the National Registry, San José District, Condominium Property Section (Sección de Propiedad Horizontal), under Real Property Folio registration numbers Placa26200, , and Placa26208, which corresponded respectively to units 53, 65, 48 and 61 of Condominio Hacienda Los Bambúes, the Zoning Regulations amended in 2001 were in force.
Those Regulations established conditions governing the development of the properties under which, according to that instrument (and as reflected in the cadastral plans referred to in the proven facts), the maximum site coverage permitted in that zone was 30%, with a height of 2 stories and specific proposed maximum site coverage and buildable areas for each property. As we reiterate, this information is taken from the cadastral plans referred to in proven facts 9, 10, 12, 13, 15, 16, 18 and 19. Those original conditions, it bears emphasizing, were fully supported by the Zoning Regulations, which at that time constituted a planning instrument that had not adequately assessed the environmental impact and, as a result, was later annulled by the Constitutional Chamber. Now, in this Court’s view, the regulatory conditions governing building development in effect on the date ownership of the aforementioned properties was acquired expressly afforded a possibility—an expectation, not a right—of use and development for construction purposes, considering that it has been deemed proven that each property is specifically a unit in a condominium project that was duly registered, as shown by the cadastral plans identified in the proven facts.
The fact that the property in question forms part of a condominium ownership regime (propiedad horizontal) supports, in principle, the inference that the property was acquired on the premise of an expectation of use consistent with the project and design that, as a matter of common knowledge, ordinarily applies to projects of this type. The fact remains that, when the property was acquired, while the zoning instrument was in force and had been issued and applied by the competent authorities (since it had undergone processing by the Municipalidad de Mora and received the approval of INVU), the plaintiff cannot be charged with any duty or objective ability to know that, due to environmental conditions, the zoning regulations that enabled the change in the land-use regime (régimen de uso de suelo) governing those lands forming part of the ZPCE, and that permitted the construction of single-family homes under a condominium regime, subject to specific development and buildability parameters, were unlawful.
In our view, the properties were acquired in reliance on the paramount principle of legitimate expectations (confianza legítima), arising from the fact that the stated development and buildability conditions were expressly recognized in regulations issued by the competent administrative authorities themselves. In principle, that characterization is not defeated by the subsequent annulment of the 2001 amendment to the Zoning Regulations, ordered in 2007 by the Constitutional Chamber. Admittedly, within the scope of the Constitutional Court’s analysis in the cited ruling No. 2010-21258, a determining factor was the violation of environmental regulations requiring protection of the ecosystem specific to the ZPCE. Those regulations had been in force since that area was first created by Executive Decree Number 6112-A dated 23 de junio de 1976, for the purpose of protecting forest resources in that area and seeking to ensure that land suitable for forestry always remains under forest cover (cobertura de bosque).
However, the designation affecting those lands, established in 1976 and expanded in 1983 through the issuance of the aforementioned Executive Decree No. 14672, does not alter the fact that, when the properties discussed here were acquired with the single-family housing project, the applicable development conditions, including their land-use regime, conformed to and were consistent with an administrative regulation then in force. Because that regulation had been issued by the local urban-planning authority, it gave rise to the presumption that those characteristics were lawful and valid, creating for the acquiring private party a presumption of legality (presunción de legitimidad) regarding those circumstances, based on the regulatory support they had at that time. Indeed, it should be emphasized that the Constitutional Chamber itself, specifically in recital VIII of the referenced ruling, prescribed a limitation of the effects (dimensionamiento) of the declaration of unconstitutionality, justifying its position in part on that reliance by stating: “...
In the Chamber’s view, two specific conditions must be taken into account, the first being where an interested party who had fulfilled all necessary requirements had actually begun construction before publication of the aforementioned notice, since that party acted in reliance on the urban-planning regulations issued by the Municipality...” Acting in reliance on regulations then in force places the holder within that framework of legitimate expectations. Nevertheless, that limitation of effects also clearly stated that “(…) In accordance with article 91 of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), a declaration of unconstitutionality shall have declaratory and retroactive effect as of the effective date of the act or regulation, without prejudice to rights acquired in good faith (derechos adquiridos de buena fe). A constitutional judgment of annulment may calibrate and limit its retroactive effect as to place, time, or subject matter, and shall establish the rules necessary to prevent serious disruption of social security, justice, or peace.
In the case before us, this Chamber must take into account that the challenge to the Zoning Regulations, according to the publication in La Gaceta No. 173 dated 10 de septiembre de 2001, occurred approximately eight years after they entered into force. Notice that the action had been filed and admitted was published on 17 de agosto de 2009. In this Chamber’s view, although the challenged provisions of the Urban Planning Regulations (Reglamento de Planificación Urbana) issued by the Municipalidad de Mora have remained in force and effect, this occurred particularly within the sector of the Zona Protectora Cerros de Escazú that predates them. In this regard, the creation of the aforementioned Protected Zone by Decreto 6112-A is dated 23 de junio de 1976, and its expansion by Decreto No. 14672 dated 20 de junio de 1983 entered into force earlier than the regulatory plans; consequently, it cannot be concluded that those national provisions were unknown to the Municipality or to residents of the Canton and of other protected areas affecting the Canton of Mora in its entirety.
Therefore, the Chamber finds that the judgment must be accompanied by a special limitation of effects covering only fully completed buildings, or buildings begun under the corresponding building permits (licencias de construcción) before the first notice dated 17 de agosto de 2009. In the Chamber’s view, two specific conditions must be taken into account, the first being where an interested party who had fulfilled all necessary requirements had actually begun construction before publication of the aforementioned notice, since that party acted in reliance on the urban-planning regulations issued by the Municipality. The second is that, if the homes in those locations require remodeling that does not entail additional construction area or maintenance, such work must be recognized as rights acquired in good faith, subject to the condition that the same previously constructed area be preserved.
All of the foregoing is without prejudice to the Municipalidad de Mora adopting new urban-planning provisions that ensure human development in balance with the environment, in compliance with the provisions of the Urban Planning Law (Ley de Planificación Urbana), without modifying the land regime of the respective Protected Zones, and with the corresponding technical environmental impact studies. Likewise, within the areas falling under the authority of the Ministerio de Ambiente, Energía y Telecomunicaciones, once it completes the respective Management Plan (Plan de Manejo) for the protected zones that similarly affect the Canton of Mora and others, the Ministry cannot disregard the pressure placed on those zones by neighboring communities. Finally, it is clear that declaring the challenged regulations unconstitutional does not cause the respective provisions of the 1993 Zoning Regulations concerning the Agricultural Zone (Zona Agrícola) (article 11) and the Remaining District Zone (Resto de Distrito, ZRD) provisions (article 13) to enter into force automatically; rather, they shall do so only once published, because, as stated supra in this judgment, the record contains only the notice in La Gaceta.
In view of this regulatory gap, the urban-planning framework of the Canton of Mora must be supplemented by the corresponding regulations issued by the Instituto Nacional de Vivienda y Urbanismo. (…)” It follows from the Constitutional Chamber’s statements that the legal situations protected by the aforementioned limitation of effects concern specific circumstances involving fully completed buildings, or buildings that had been commenced under the corresponding building permits before the first notice of the constitutional challenge was published on 17 de agosto de 2009. Pursuant to the Constitutional Court’s ruling, properties falling within those factual circumstances—and only those circumstances—would not be affected by the elimination of the zoning instrument, insofar as the actions taken with respect to them complied with the regulations then in force. The Constitutional Chamber further specified that, in those circumstances, if the homes required remodeling, such work could be undertaken provided that it did not entail additional construction area or maintenance, on the understanding that this arises or follows from rights acquired in good faith, subject to the condition that the same previously constructed area be preserved.
The Constitutional Chamber also stated that the Municipalidad de Mora could adopt new urban-planning provisions, provided that it complied with the guidelines and regulations governing balance with the environment that had been disregarded in the 2001 amendment and formed the basis for the annulment ordered in those proceedings. It further stipulated that the Ministerio de Ambiente y Energía was required to issue the corresponding Management Plan for the sector concerned. It follows from the foregoing that the cited limitation of effects covered only those who had already built or had commenced construction under the corresponding permit as of 17 de agosto del 2009; it cannot be understood as applying to persons who, despite having acquired ownership rights (derecho de dominio) over properties whose land-use and construction regime was based on the annulled Zoning Regulations, had not, by that date, commenced lawful construction work under a building permit issued by the local authority.
In such cases, the holders of ownership rights (derecho de dominio) over the properties located within the area affected by the annulled zoning (zonificación) could not claim a vested right (derecho adquirido) to exercise their right to build (ius edificandi) in accordance with the parameters of that land-use plan (programación de uso de suelo), since it was a provision contrary to Constitutional Law (Derecho de la Constitución) because it was harmful to the environment and, therefore, subject to the exceptions noted by the Constitutional Chamber (Sala Constitucional) itself, could not be enforced in favor of the owners, insofar as doing so would entail a form of continued effect (ultra actividad) of a provision repealed on grounds of constitutional illegitimacy. The plaintiff relies in support of its position on the dissenting opinion (voto salvado) contained in the same ruling, which warns of the potentially harmful effects on those who acquired property while the annulled provision was in force but had not exercised their building rights.
However, we consider that argument unpersuasive because it constitutes a minority opinion that was not endorsed by the majority of the Constitutional Court (Tribunal Constitucional). Accordingly, in the context of the aforementioned judgment, this Court could not apply the rules governing the modulation of effects (dimensionamiento de efectos) to situations that were not expressly considered in that specific portion of the judicial decision; thus, that position does not preclude the implications and qualifications of such modulation.
VII.Now then, as stated above, the plaintiffs claim that the lots acquired while the 2001 amendment to the Zoning Regulations (Reglamento de Zonificación) of the Regulatory Plan (Plan Regulador) for the Canton of Mora was in force have allegedly been rendered unusable and incapable of development, because they are now properties with an area smaller than that permitted under the current Zoning Regulations, thereby extinguishing their building right (derecho de edificación), contrary to the purposes and designated use initially established by the Zoning Regulations in force when they acquired the properties between 2006 and 2007. The alleged loss of use, inability to develop, and extinguishment of their building right are based on the following. In their complaints, they argue that they made an investment to purchase the land in Condominio Hacienda Los Bambúes and that the property they acquired now lacks the legal characteristics required by the current Zoning Regulations because it does not have the minimum area of 10.000 square meters, while the current minimum percentage or coverage results in the land being unusable for the purposes for which it was acquired, namely, the construction of a house with certain socioeconomic characteristics that could not be developed on 10% of the land, thus making the damage certain and actual.
They add that they acted under urban-planning regulations that were presumed valid and effective, with the reasonable expectation of acquiring land that could be developed and used for residential, rather than agricultural, purposes, and that now, because it is a protected area (área protegida) (although no such declaration had been made by the entity responsible for its protection and administration), it may not be used for those purposes. They allege causal acts or events consisting of formal actions and inaction, embodied in the amendment to the Zoning Regulations of the Canton of Mora, the approval of the project by the Urban Planning Directorate without the required technical studies, and the State’s failure to act, because if it had timely protected the Cerros de Escazú protected area—particularly knowing that private parties were already constructing buildings within a protected area—it should, by virtue of its authority to administer protected areas, have put a stop to the activity or warned of the environmental impact, which would have led the plaintiffs herein not to exercise their decision to purchase; this was aggravated by the fact that those regulations remained in force for approximately nine years.
Subsequently, in their closing arguments, they add that the decision of the Constitutional Chamber eliminated the possibility of using the acquired land for housing, requiring the land use (uso del suelo) for those properties to be changed to lots with maximum coverage of 10% and a minimum area of one hectare; their properties do not meet that requirement and are therefore incapable of development, because they could not be developed for housing in accordance with the purpose for which they were acquired and instead became land whose permitted uses are limited to agricultural activity, with only housing for the owner and workers being allowed. However, after careful analysis, the Court finds this claim inadmissible for the following reasons. At the outset, two matters must be clarified. First, as established by the evidence, the ZPCE was declared as such in 1976 through the issuance of Executive Decree No. 6112-A, that is, before the plaintiffs acquired the properties referred to in this judgment; accordingly, the Court understands that they purchased them with knowledge of the existence of that protection zone.
Second, we must reiterate that although the Constitutional Court judgment to which we have referred annulled the Zoning Regulations under which the plaintiffs acquired the properties in Condominio Hacienda Los Bambúes, that judicial decision limited the effects of the declaration of unconstitutionality (declaratoria de inconstitucionalidad) by protecting the individual legal situations (situaciones jurídicas subjetivas) of those owners who, as of the date of publication of the first notice concerning the filing of the relevant action (17 de agosto de 2009), had already exercised their building right or who, as of that date, had obtained a municipal building permit (licencia edilicia) and had begun the respective construction. Furthermore, that judicial decision established that no absolute restriction was being imposed on the use of land located within the ZPCE, insofar as it stated with complete clarity that the Municipalidad de Mora could establish new land-use regimes, provided they were compatible with environmental-protection regulations, and made such development subject to the regulations that SINAC was required to issue through the corresponding General Management Plan (Plan General de Manejo), which had been lacking since the protection zone was created on 23 de junio de 1976 (through Decree No. Placa26213).
Thus, aside from the fact that this argument was not raised until closing arguments, it is not true that the decision of the Constitutional Chamber eliminated the possibility of using the land acquired by the plaintiffs herein, as alleged. In that regard, under Resolution No. 9 adopted at ordinary session number 11 -2015 held on 23 de noviembre de 2015, the Consejo Nacional de Áreas de Conservación approved the ZPCE General Management Plan, which was published in Gaceta No. 37 of 23 de febrero de 2016 (administrative records submitted by SINAC) and establishes the conditions governing the use of land in the ZPCE across four zones, namely zones of minimal, low, medium, and high intervention. It should be noted that all these zones permit, naturally under differing conditions, the construction of privately owned infrastructure, including single-family or multifamily homes and even housing developments or condominiums, the latter being permitted in the medium- and high-intervention zones.
Accordingly, we find that the Constitutional Chamber’s invalidation of the planning instrument does not in itself automatically render the right of ownership (derecho de propiedad) unusable or extinguished, nor does it create a framework of civil liability for the administrative authorities whose acts or omissions allowed the annulled regulations to remain in force. Rather, it is necessary to determine in each case whether, as a result of what occurred, the land falls within the limitation of effects established by the Constitutional Chamber, whether it was rendered unusable, or whether it is subject to restrictions that prevent the exercise of building rights. It is indisputable that the burden of proving these factors—that is, the loss or emptying of the right of ownership or the right to build (ius edificandi)—rests with the plaintiffs pursuant to Articles 317 of the Code of Civil Procedure (Código Procesal Civil) in force when these proceedings were filed, 41.1 of the Code of Civil Procedure in force when this judgment was issued, and 58 and 82 of the CPCA.
In the case before us, the plaintiff companies Desarrollos Urbanísticos Segmento TJFK SEIS FFF S.A., Desarrollos Urbanísticos Bloque SGRAH VEINTIUNO TTT S.A., and Desarrollos Urbanísticos Bloque SGRAH QUINCE ÑÑÑ S.A., represented by fellow plaintiffs Nombre138409 , Nombre138410 and Nombre138411 , did not prove in these proceedings that they had applied to the Municipalidad de Mora for a building permit and commenced construction before 17 de agosto del 2009. Still less did they prove that, before 17 de agosto del 2009, fully completed structures existed on their properties located in Condominio Hacienda Bambú. In view of the foregoing, their legal situation in this case consists solely of having acquired property in that condominium, which fell outside the limitation of the effects of the declaration of unconstitutionality established by the Constitutional Chamber, as explained above. They therefore cannot allege the violation of individual rights (derechos subjetivos) or vested legal situations (situaciones jurídicas consolidadas) relating to the ius edificandi.
In any event, it should be noted that these plaintiffs have also failed to establish the architectural design of the house they intended to build or, at minimum, the design offered to them by the developer and on the basis of which they planned to exercise their building rights. In our view, that issue was essential to determining the alleged impact on their properties caused by the change in the urban-planning regulations, specifically following the annulment of the Zoning Regulations issued in 2001 and the publication of the ZPCE General Management Plan. Nor was any technical evidence offered that would establish with certainty the intervention zone in which the cited plaintiffs’ properties are currently located following publication of the ZPCE General Management Plan. This technical requirement is fundamental because it provides indispensable information for comparing the occupancy conditions set forth in the Zoning Regulations in force when the shares in the plaintiff entity were assigned (2007) against those established in the current Management Plan, and for determining with certainty whether the conditions and permitted use of each property changed—for example, whether the construction of single-family homes, multifamily homes, housing developments, or condominiums was permitted; the maximum height of the homes; the maximum site-coverage and construction areas; and the permissible occupancy ratio.
All these matters are essential to determining whether the plaintiffs’ properties can be used or developed for construction purposes or whether, on the contrary, the properties were rendered unusable and the building right extinguished with respect to them. However, because the plaintiffs failed to discharge their evidentiary burden (carga probatoria) in this regard, they must bear the corresponding adverse procedural consequences in this case, namely, that it has not been proven that their properties were rendered unusable as a result of the promulgation of the General Management Plan, that they cannot be developed, or that construction on them is impossible. This is because, we reiterate, the invalidation of the former Zoning Regulations, exclusively as they pertained to the ZPCE area, did not necessarily make it impossible to use or build on the plaintiff companies’ properties, particularly since each has an area exceeding one thousand square meters.
Under the aforementioned Management Plan, those properties could generally be developed and be the subject of the exercise of building rights, which must now comply with the urban-planning ordinances issued after the Constitutional Chamber annulled the former Zoning Regulations and ordered the issuance of a Management Plan for that zone that would include consideration and analysis of the environmental variable (variable ambiental). In view of the foregoing, and because the alleged loss of use, inability to develop, or extinguishment of the building right with respect to the specified properties has not been proven, the relief sought must be denied, as it hereby is.
VIII.The claim seeking to have the defendants declared liable for rendering unusable and impossible to develop the lots acquired while the 2001 amendment to the Zoning Regulations (Reglamento de Zonificación) of the Regulatory Plan (Plan Regulador) for the Canton of Mora was in force must also be rejected with respect to the plaintiff corporation Desarrollos Urbanísticos Bloque SGRAH DOS BBB S.A., represented by fellow plaintiff Nombre138412. This is because it has been established that these plaintiffs did apply for a building permit (licencia constructiva) for a residence in Condominio Hacienda Los Bambúes and commenced the respective procedures before 17 de agosto del 2009. It was even established that the residence was built and that the aforementioned corporation paid the Solidarity Tax on Luxury Homes (Impuesto Solidario a las Viviendas de Lujo) corresponding to tax periods 2010 and 2011 (images 308 and 309 of the digital court file scanned into a single PDF file).
Accordingly, the Court has no doubt that the property in question could indeed be used, developed, and built upon, with no curtailment of their property right (derecho de propiedad) or ius edificandi being alleged or apparent. Moreover, because it was established that the plaintiff applied for the building permit and commenced construction work before 17 de agosto del 2009, its legal position was protected by the qualification of effects (dimensionamiento) established by the Sala Constitucional with respect to possible improvements.
IX.The following claims seek to hold the defendants financially liable (responsabilidad patrimonial) because, in the plaintiffs’ view, there was abnormal operation (funcionamiento anormal) and unlawful omission (conducta omisiva e ilícita) that caused them a series of damages. Given the matter under discussion, we deem it necessary to state that, pursuant to Article 190 of the Ley General de la Administración Pública (hereinafter, LGAP), the Administration shall be liable whenever its normal or abnormal, lawful or unlawful operation causes harm that the victim has no duty to bear, whether pecuniary or non-pecuniary, irrespective of the victim’s subjective legal position and the entitlement or authority held, provided, of course, that the essential requirement of a causal nexus (nexo causal) is met. On this issue, see the extensive analysis in decision no. 584, issued at 10 hours 40 minutes on 11 de agosto del 2005 by the Sala Primera de la Corte Suprema de Justicia.
From this standpoint, the legislation establishes unlawful or lawful conduct, as well as normal or abnormal operation, as grounds for attribution (criterios de imputación). Nevertheless, under those grounds for attribution, it must be established that the injury is a consequence of such acts or omissions in order to establish the causal nexus permitting liability to be attributed to the center of public authority. In addition, in cases of abnormality and unlawfulness, the adjudicator must examine the operation of public authorities to determine whether conduct has in fact occurred that departs from legality or conflicts with the principles of administrative efficiency. In such cases, it is essential to clearly establish the existence of those grounds; otherwise, each case must be treated and analyzed differently according to the type of operation to which the harm is attributed. The victim’s fault, the act of a third party, and force majeure constitute defenses to such liability.
It should be emphasized that this duty to compensate is also based on the underlying concept of unlawfulness (antijuridicidad de base), meaning the absence of a duty to bear the injury. Put more simply, whenever an injury has been suffered as a consequence of governmental conduct, whether by act or omission, which the victim is not obligated to bear, the duty to compensate arises from the principle of full reparation for harm (reparación integral del daño) derived from Article 41 of the Constitución Política. Accordingly, the scope of protection afforded by this liability system includes harm that may be caused by normal operation or lawful conduct because, in such cases, although the conduct of the public authorities is, in principle, consistent with the law or with the rules of efficiency governing it, compensation must be paid if it produces a harmful effect that the person has no duty to bear.
Of course, in such circumstances the harm must be special (affecting a small proportion of persons) or abnormal (that is, exceptionally severe and exceeding normal thresholds of tolerance), thereby giving rise to compensation for the harm, but not for lost profits (lucro cesante), pursuant to the rules established in Articles 194 and 195 of the LGAP. Nevertheless, it should be noted that not all harm is compensable, but only harm that the Legal System (Ordenamiento Jurídico) regards as fundamentally unlawful and that is actual, assessable, and individualized. Indeed, only an injury that, when assessed against the Legal System as a whole, may be deemed fundamentally unlawful is compensable; otherwise, as stated by the Sala Primera de la Corte Suprema de Justicia, compensation would be awarded for harmful conduct in response to a loss that the Legal System does not condemn but instead tolerates and accepts as normal and justified.
This would lead to the State’s imminent financial collapse, given that, in the national context, it is directly or indirectly involved in a large number of areas of activity. Put more simply, underlying unlawfulness exists whenever a legal mandate establishes an obligation to remedy an unlawful injury that the victim should not have to bear, irrespective of the attribution standard. The broad protective scope of the Administration’s strict-liability system (sistema de responsabilidad objetiva de la Administración) does not dispense with the duty to establish that the harm resulted from governmental conduct. In turn, the factual framework from which the injury to non-pecuniary interests (bienes extrapatrimoniales) may be inferred must be demonstrated. Merely alleging the existence of suffering or injury is insufficient; at a minimum, the facts that theoretically caused such harm must be established, because a person claiming to hold a right must prove the facts giving rise to it.
This is not a reversal of the burden of proof (carga probatoria) in a field founded on full reparation for harm and whose pillars are harm and created risk (riesgo creado), but rather the minimum substantiation of the grounds for attribution and the facts giving rise to the harm, as basic prerequisites for attributing liability and, consequently, for the emergence of the obligation to provide redress. This also follows from the provisions of Article 196 of the LGAP, which states: “In every case, the alleged harm must be actual, assessable, and individualized in relation to a person or group.” Whether the harm is actual in a specific case depends directly on demonstrating causation, allowing the harmful outcome to be linked to an act or omission by a Public Administration. This is also established in Article 58 of the aforementioned Code, insofar as it imposes upon the plaintiff the duty to state the causes of the alleged injury, what it consists of, and a reasonable estimate thereof.
Although that requirement is set forth in the cited provision where the claim for redress is ancillary, there is all the more reason for it to be satisfied where compensation is the central object of the claim, because in such cases establishing those prerequisites is the minimum basis for granting the relief sought.
X.The plaintiffs’ second claim seeks to have the State held liable for failing to supervise, control, and protect the Zona de Protección Cerros de Escazú, thereby allowing a change in zoning and in permitted uses to single-family and multifamily housing, which led to the purchase of land with areas greater than 1.000 square meters and less than 10.000 square meters and, consequently, caused the plaintiffs to purchase land within that range that would subsequently become impossible to develop and use. Consistent with the foregoing in Recitals (Considerandos) VI, VII, and VIII, which established that the first claim seeking a finding of liability for the impossibility of developing or using the plaintiffs’ land was unfounded, this claim must likewise be denied. It should be noted that, in substance, this request seeks to have this Court declare the co-defendants liable because of alleged failures of oversight that led the plaintiffs to purchase land that would later become unusable and impossible to develop.
However, as explained in the aforementioned Recitals, contrary to what the plaintiffs assert in support of that request, it was not established that their properties are subject to an urban-planning or environmental restriction of such a nature as to render them unusable or impossible to develop, or to prevent them from exercising the right to build (derecho de construcción); indeed, in the case of the plaintiff corporation Desarrollos Urbanísticos Bloque SGRAH DOS BBB S.A., the property was used because the residence was built. We reiterate that, in general, the General Management Plan (Plan General de Manejo) issued by SINAC permits those properties to be developed for single-family and multifamily residential use and, in some cases, even for residential developments and condominiums; the plaintiffs have failed to establish that those degrees of restriction substantially prevent them from developing or using the property.
In other words, the rules applicable to the ZPCE permit construction subject to specific rules different from those in force when they acquired the properties, but in no way deny or eliminate the possibility of using and developing the properties. Accordingly, this second claim must also be rejected because the actual existence of the harm for which redress is sought could not be established. The evidence introduced in the proceedings and the analysis of the documents in the record do not support a finding that the acquired properties may ultimately be rendered unusable or legally or materially incapable of being developed through construction. The Management Plan (Plan de Manejo) permits and recognizes that possibility, while imposing restrictions different from those applicable to the land when the amendment to the Reglamento de Zonificación of the Canton of Mora was issued in 2001. Under those circumstances, there can be no finding of a restriction on building activities (actos edilicios).
Moreover, it bears repeating that, except for the plaintiff corporation Desarrollos Urbanísticos Bloque SGRAH DOS BBB S.A. and its attorney-in-fact (apoderada), Nombre138412, the plaintiffs also failed to establish in these judicial proceedings the construction design of the project they intended to undertake or that they had in any way applied for permission to build on the properties they owned; consequently, there would likewise be no concrete infringement of the right alleged to have been violated. Ultimately, the Court finds that the plaintiffs have not submitted the evidence necessary to conclude that they cannot use or exercise their building rights (derecho de edificación) on the properties they own, in accordance with the particular conditions of Condominio Horizontal Residencial Hacienda Los Bambúes, developed by Urbanizadora La Laguna S.A. In addition to the absence of a building permit, the plaintiff offers no evidence providing any details regarding the construction plans that it claims to have or to have had, such that any expectation in this regard could be deemed impaired.
From that standpoint, and because they do not fall within the scope of the qualification of effects established by the Sala Constitucional in Voto No. 2010-21258 cited above, matters of this kind cannot be regarded as constituting actual harm, and the relief sought must be denied.
XI.The third claim seeks a declaration that the defendants are liable for the loss or diminution in the market value of the land acquired by the plaintiffs. According to the arguments set forth in the complaints, it is claimed, in essence, that the economic loss resulted from formal actions and inaction, specifically the amendment of the Reglamento de Zonificación del Cantón de Mora, the project’s approval by the Dirección de Urbanismo without the required technical studies, and the State’s failure to act. The plaintiffs contend that, had the State timely protected the Cerros de Escazú protected area—particularly given its knowledge that private parties were already constructing buildings in a protected area—it should, by virtue of its authority to administer protected areas, have halted the activity or warned of its environmental impact. This would have led the plaintiffs herein not to exercise their decision to purchase, a situation aggravated by the fact that those regulations remained in force for approximately nine years.
In this regard, we must reiterate that, as stated above (ut supra), in accordance with the provisions of canon 196 of the LGAP, 41.1. of the Código Procesal Civil, and 58 subsection e) of the CPCA, it is not sufficient to argue that damage probably exists; rather, a person claiming damage must prove its actual existence and the causes that produced it. This means that the plaintiffs must duly and convincingly establish those matters as an indispensable prerequisite for granting the compensation sought for the loss in market value of the real properties—and the other damages claimed in the fourth claim—referred to in this judgment. On this point, the Court finds serious evidentiary deficiencies that prevent it from determining, with the degree of certainty required in such cases, the alleged loss in market value of the properties at issue. First, we must emphasize that, in these proceedings, the plaintiffs did not establish the architectural design of the residence they intended to build or, at a minimum, the residence offered to them by the Urbanizadora, nor did they establish the intervention zone (zona de intervención) in which their properties are currently located.
We reiterate that these elements were essential not only to determine the potential frustration or elimination of their right to build, but also because they could have served as evidence of whether those properties had, in fact, lost market value. Although the building conditions (condiciones de edificabilidad) applicable to the plaintiffs’ properties may have changed after the Plan General de Manejo de la ZPCE was issued, that change in conditions alone does not, through automatic deduction, support a presumption or inference that the economic damage alleged by the plaintiffs in the claim under review exists. Contrary to their assertion, we find that this does not constitute actual damage in itself, because the introduction of new building conditions, which unquestionably affect the property’s development and use regime, does not per se cause the alleged loss in value. To establish a loss in the market value of the land at issue, an appraisal and field analysis would be required to determine whether, comparing the historical time of acquisition with the present, each individual condominium property (finca filial) suffered an actual and substantial diminution in value.
The only evidence submitted by the plaintiffs in this regard consists of the Informes de Estimación de Afectaciones prepared by Proyectos en Desarrollo S.A. (PRODESA), contained in the evidentiary file submitted for expediente No. 12-002956-1027-CA and in images 250 to 257 of the scanned digital court file contained in a single PDF file. The Court, however, does not find this evidence credible for the following reasons. At the outset, the report prepared for each plaintiff company states: “(…) At your request and that of the landowner, we have undertaken a study to estimate the economic value of the damage or adverse impact resulting from the ruling of the Sala Constitucional, which restricts the Municipalidad de Mora with respect to future construction permits in Condominio Horizontal Hacienda Los Bambúes, located in Calle Cedral, Distrito Colón, cantón de Mora, Provincia de San José. (…)” As can be seen, the report proceeds from the premise that the damage or economic adverse impact arose from the ruling of the Sala Constitucional.
However, according to the theory of the case (teoría del caso) presented in the complaint, the pecuniary liability (responsabilidad patrimonial) being claimed arises from the acts and omissions of the co-defendants, with abnormal operation and unlawful conduct alleged as the grounds for attribution of liability (parámetro de imputación). It was not until the written closing arguments that the plaintiffs introduced the novel argument that the damage arose as a result of the judgment of the Sala Constitucional referred to herein. This argument is undoubtedly not only unexpected but also untimely, because it was raised after the issues in dispute (litis) had already been joined and the defendants had exercised their right of defense. Accordingly, this new argument cannot be considered by this Court because, we reiterate, doing so would leave the co-defendants in these proceedings without an adequate defense.
It should be noted that accepting this new alleged cause of the claimed pecuniary liability would introduce the issue of liability of the State acting in its judicial capacity (responsabilidad del Estado-Juzgador), which was not alleged—except by the plaintiffs in their closing arguments—and did not form part of the conduct at issue in the proceedings as established during the preliminary hearing. In light of the foregoing, there is an evident discrepancy between the cause of the damage identified in the technical report and the cause debated by the parties in these proceedings, an issue that, in our opinion, is sufficient by itself to deprive the evidence in question of credibility. There are also other significant reasons that, in our opinion, undermine the credibility of that documentary evidence. The report states: “(…) A study was conducted in the area near Hacienda Los Bambúes to determine the current market value of other similar properties.
Data were also obtained from somewhat similar projects located in Escazú and Santa Ana. This was done to obtain an estimated value of the property under review under normal market conditions. (…)” Nevertheless, neither that study nor the data from the other similar projects used for comparison were submitted. Such worksheets are indispensable in documentary reports of this kind to ensure proper adversarial review (debido contradictorio) and to assess the information contained therein. At this stage, the Court does not know which area, projects, or similar properties the brokerage firm considered when determining the purported market value of each property, a deficiency that prevents us from assessing this evidence. The attachments accompanying each report generally include—depending on the plaintiff company—the property appraisal, registry certifications and cadastral survey plan (plano catastrado) for the property, a copy of the deed of incorporation and the shares of each plaintiff company, a copy of the private share-assignment agreement, a copy of the reciprocal agreement to purchase and sell the lot, a copy of the purchase application, copies of payment receipts issued to Urbanizadora La Laguna, and payment and price tables, among other documents.
In some instances, copies of the building permit and tax-payment records are also attached. As can be seen, none of these attachments discloses the specific parameters considered in establishing the market value under normal conditions and the value assigned as of the present. Furthermore, the report states: “(…) At present, the restrictions affecting this property prevent the owner from developing it as originally planned. (…)” However, we do not know—because the report never states—what those restrictions are or how each owner planned to develop the property, which demonstrates why the original building design should have been submitted, as indicated above. Finally, the report also fails to identify the current conditions that allegedly reduce the commercial value of each property to 10% of its current market value. All these deficiencies undermine the credibility of the report and prevent this Court from assigning it evidentiary weight.
It should be added that some of these deficiencies could have been remedied through testimony from the professional who prepared the reports or through expert evidence (prueba pericial) addressing these questions and determining whether the availability and building regime established by the Plan General de Manejo de la ZPCE affected the real-estate market price of the properties owned by the plaintiff companies in the Condominio Residencial Los Bambúes project, as compared with the conditions and market value of those properties in 2007, also taking into account, for example, the potential for construction use applicable at both points in time. The plaintiffs, however, did not offer this type of technical evidence and, during the preliminary hearing, their special litigation counsel withdrew the testimonial and expert evidence initially offered. We reiterate that, under the legal system, the plaintiffs bear the procedural burden (carga procesal) of proving the facts they allege.
This burden rests with the parties, not the judge, particularly where the claims asserted are pecuniary in nature and, therefore, subject to the parties’ disposition. The plaintiffs have not proven the loss in market value that they claim their properties or structures suffered and must bear the adverse consequences of their failure to do so. The plaintiffs overlook that when civil compensation is sought—in this case for alleged changes in real-estate market value caused by administrative actions—it must be proven that the loss actually occurred. The mere allegation that damage exists is insufficient for this Court to presume its existence. Nor do new building rules that allow a lower percentage of development than that established by the Reglamento de Zonificación create a right to compensation without prior proof of economic damage of the kind alleged. Given that the party making the claim must obtain and submit its own evidence to prove the damage and its causes—the facts on which its request is based—and that the plaintiffs neither offered nor submitted any evidence enabling this collegiate body to determine that the claimed damage exists, this Court cannot speculate as to whether it is actual or exists. Accordingly, there is no alternative but to dismiss the third claim under review.
XII.For the same reasons set forth in the preceding Whereas clause (Considerando), we must reject the fourth claim submitted by the plaintiffs for payment of the alleged damages relating to the loss of market value of the acquired properties, as well as the loss of market value of the structures on those properties that have buildings, allegedly resulting from the restrictions on property rights. Under this same heading, compensation is also sought, as damages, for the loss represented by bank interest paid on financing for the purchase and insurance premiums paid since the purchase, condominium maintenance fees paid since the purchase and arising from the inability to use the land, the loss represented by taxes paid since the purchase and taxes paid on real property and luxury homes, and the professional fees paid for the purchase. All these items must be rejected. We reiterate that, in light of section 196 of the LGAP, compensable damage (daño indemnizable) must be certain, which requires proof by the party claiming it, as follows from section 58(e) of the CPCA, an issue already duly explained above.
Consequently, damages not proven by the party claiming them must necessarily be rejected. With respect to these specific items, the plaintiff provides no evidence whatsoever from which the existence of such damages could be determined. Notwithstanding the foregoing, we find that these claims would not be admissible on the merits either. Regarding maintenance fees and the payment of insurance premiums and professional fees for the acquisition, it bears noting that the principal claim seeks payment for loss of market value, which presupposes that the property in question remains under the plaintiff’s ownership; accordingly, there is no logical basis for claiming payment of expenses inherent in ownership of the property when, in this case, that ownership is retained. As to taxes, the same reasoning applies, in addition to the fact that not all the companies have proven that they pay them. Payment is also sought for losses consisting of interest forgone due to advance payment of the purchase price and statutory interest on the opportunity cost of the investment.
With respect to this matter, the plaintiffs do not explain with the requisite detail the grounds supporting that request, much less provide allegations from which its nature may be inferred. That omission requires its rejection without further consideration, since a mere demand for compensation is insufficient and must be accompanied by the requisite justifications and evidence. Therefore, these items must be rejected, as is hereby ordered.
XIII.The fifth claim seeks an order requiring the defendants to pay statutory interest on the amounts claimed as damages and losses (daños y perjuicios), as well as compensation for the emotional distress (daño moral) caused by the frustrated hope of purchasing and acquiring a residential lot. Regarding the second item, we must note that the parties did not specify whether they were claiming subjective or objective emotional distress (daño moral subjetivo u objetivo), or whether this item was claimed on behalf of the companies, their attorneys-in-fact, or both. This is important because subjective emotional suffering, since it arises within the internal psycho-emotional sphere, can occur only in natural persons, not in legal entities, which are legal fictions created by law to constitute entities with their own assets and independent legal personality. Admittedly, a legal entity is created by and belongs to natural persons, but the law itself distinguishes between the corporate entity and its partners or shareholders for purposes of attributing rights and obligations.
Because this action was filed by legal entities and their attorneys-in-fact, it must be stated that the former cannot suffer internal emotional injuries of the kind intended to be protected through the aforementioned subjective emotional distress; accordingly, this item must be summarily rejected as to them. Furthermore, because no evidence of objective emotional distress was submitted, we must also reject this item with respect to the plaintiff companies. As to the attorneys-in-fact of the plaintiff companies, who also appear here in their personal capacities, we find that the claimed emotional distress must likewise be rejected. This Chamber has repeatedly held that, although section 196 of the LGAP permits compensation for non-pecuniary damages (daños extrapatrimoniales), including subjective emotional distress, regardless of whether proof thereof is deemed in re ipsa (because it may be inferred from the rules of human experience), the party alleging it must establish the factual circumstances on which that type of suffering is purportedly based.
In the case of the individual plaintiffs, the fact remains that, because the claims for declaratory relief and compensation were rejected, no conduct serving as a basis for attributing the claimed damage was established, nor was it shown that any expectation concerning the properties had been frustrated. Consequently, without any need for further discussion, the alleged subjective emotional suffering must be rejected. Objective emotional distress must also be rejected because no evidence was submitted from which its existence could be established. We must also reject the request that they be paid statutory interest on the amounts claimed as damages and losses. This follows from its ancillary nature and because, ultimately, no monetary judgment has been entered in favor of the plaintiffs.
XIV.Finally, the defendants are requested to be ordered to pay the amounts determined upon liquidation, together with the corresponding indexation (indexación). This item is plainly ancillary to the damages claimed; therefore, given the rejection of those principal items, the same outcome and treatment must apply to such statutory interest as financial losses (art. 706 Código Civil).
XV.Regarding the alternative claim (pretensión subsidiaria). The plaintiffs submit an alternative claim requesting: “In view of the loss of value of the lots acquired by the plaintiffs in Condominio Hacienda Los Bambúes, and the plaintiffs’ inability to use those properties for the purpose for which they were acquired, that the compulsory expropriation (expropiación forzosa) of those properties by the State be ordered pursuant to articulo 37 de la Ley Orgánica del Ambiente.” The material relief sought through the alternative claim is for this Court to direct or order the expropriation of the plaintiff’s property. To that end, the plaintiffs assert that the grounds are the loss of value and the inability to use it for the purposes for which it was acquired. As already analyzed in connection with the principal claims, it has not been established in this case that the land owned by the plaintiff lost market value as a result of the issuance of the General Management Plan (Plan General de Manejo) to which we have referred.
Nor has it been established that the plaintiffs could not exercise their building rights on their properties, or that they applied for any construction permit to build within that strip. Likewise, no details have been submitted in this case regarding any construction plans the claimant may have had that would support the conclusion that it cannot build what, in principle, it intended or planned to construct when it acquired the property. In this Court’s view, those claims are based on conjecture and assumptions that have not been proven and, as such, cannot constitute an objective basis for remedial or other legal consequences. From that standpoint, the requested expropriation would have to be based on the unavailability of the property or the substantial loss of functionality of that condominium unit, in accordance with sections 13 and 17 of the Ley de Expropiaciones, No. 7495, comprehensively amended by Ley No. 9286. However, such circumstances do not exist in this case, and the alternative claim must therefore be rejected.
XVI.Regarding the defenses raised. In both actions, INVU, SINAC, and the Municipalidad de Mora raised the defenses of lack of standing (falta de legitimación), in both its forms, lack of a present interest (falta de interés actual), and failure to state a valid legal right (falta de derecho), while the State raised only the latter. The defense of lack of active standing (falta de legitimación activa) must be rejected because the action was brought by the holders of the legal interest for which protection is sought. The action is based on section 10(1)(a) of the CPCA. The same must be stated regarding the alleged lack of passive standing (falta de legitimación pasiva). The action is directed against the Public Administrations to which the causes of the claimed damage have been attributed; therefore, their connection to the subject matter of the proceedings arises from section 12(1) and (2) of the CPCA.
Lack of a present interest must be rejected because the current and continuing nature of the subject matter in dispute is evident. However, for the reasons stated in this judgment, the defense of failure to state a valid legal right raised by all defendants must be sustained because none of the claimed damages and losses were proven. The allegations, rather than defenses, of fault of the victim (culpa de la víctima) and act of a third party (hecho de tercero) need not be addressed because the defense of failure to state a valid legal right has been sustained.
XVII.Regarding costs (costas). Pursuant to section 193 of the CPCA, litigation costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed upon the unsuccessful party by virtue of having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there was sufficient cause to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, this Court finds no basis for waiving the award of costs, insofar as the claims for compensation were dismissed due to the absence of evidence establishing the alleged injuries. Therefore, costs must be imposed upon the unsuccessful plaintiffs. In the case of the State and SINAC, the respective interest accruing on the costs from the date the decision fixing their amount becomes final until full payment must also be paid, at the statutory rate established by article 1163 del Código Civil. These amounts shall be determined during enforcement of the judgment (ejecución de sentencia).
POR TANTO
The defenses of lack of active and passive standing, as well as lack of a present interest, raised by the Instituto Nacional de Vivienda y Urbanismo, the Municipalidad de Mora, and the Sistema Nacional de Áreas de Conservación are rejected. The defense of failure to state a valid legal right raised by both the aforementioned defendant agency and entities and the State is sustained. Consequently, the actions are dismissed in all respects. Both categories of costs shall be borne by the unsuccessful plaintiffs. With respect to the State and the Sistema Nacional de Áreas de Conservación, the costs must be paid together with the respective interest accruing from the date the decision fixing their amount becomes final until full payment. These amounts shall be determined during enforcement of the judgment.

RESULTANDO
CONSIDERANDO
I.Hechos probados. De relevancia para la resolución del presente proceso se tienen los siguientes:
II.Hechos no probados. En lo que interesa a este proceso y por no haber prueba que los sustente, se tiene por indemostrado lo siguiente:
III.Objeto de los procesos. En lo medular, todos los accionantes formulan esta acción para que se determine la procedencia o no del marco de responsabilidad que imputan a las partes codemandadas, como derivación de lo que consideran son daños y perjuicios generados en su condición de propietarios, a los diferentes inmuebles de su propiedad que se ubican en el proyecto denominado Condominio Horizontal Residencial Hacienda Los Bambúes, desarrollado por Urbanizadora La Laguna S.A. Específicamente, se formulan las siguientes pretensiones principales:
IV.Aspectos generales relacionados con la naturaleza y alcance de los planes reguladores, la ponderación de la variable ambiental en la planificación urbana y el impacto de ésta en el derecho de propiedad de las personas. Dados los reclamos concretos que plantea cada uno de los aquí demandantes, el Tribunal estima necesario referirse a estos temas, los cuales ya han sido abordados por este Tribunal en la sentencia No. 0037-2017-VI dictada a las 14 horas del 22 de marzo del 2017 y en la cual se resolvió un reclamo similar planteado por un propietario de un inmueble ubicado, precisamente, en el Condominio Hacienda Los Bambú en el cantón de Mora. En lo que interesa, en esa sentencia se indicó “(…) Al socaire de los dispuesto por el numeral 169 de la Constitución Política, la competencia exclusiva de planificación, control y ejecución del desarrollo urbano local corresponde a las municipalidades, lo cual realizan a través de los denominados planes reguladores, mediante los que, dentro de su ámbito territorial de jurisdicción, disponen -entre otros elementos- cual será la zonificación del uso del suelo.
En este sentido indica la citada norma: “La administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal, formado de un cuerpo deliberante, integrado por regidores municipales de elección popular, y de un funcionario ejecutivo que designará la ley.” Lo anterior obedece a la autonomía que sobre sus territorios le ha otorgado el constituyente originario, postulado que se reitera en el canon 170 párrafo inicial que indica: “Las corporaciones municipales son autónomas”. Las potestades y funciones de estas unidades administrativas se desarrollan en el Código Municipal y en la Ley de Planificación Urbana, en lo que concierne a la actividad objeto de nuestro examen. Bajo esta inteligencia, el canon 3 del Código Municipal indica: “La jurisdicción territorial de la municipalidad es el cantón respectivo, cuya cabecera es la sede del gobierno municipal./ El gobierno y la administración de los intereses y servicios cantonales estarán a cargo del gobierno municipal.” Desde este plano, la emisión de planes reguladores locales, compete a los Municipios, mediante el procedimiento establecido por ley.
Así, la Ley de Planificación Urbana, No. 4240 de 15 de noviembre de 1968, dispone en su artículo 15: “Conforme al precepto del artículo 169 de la Constitución Política, reconócese la competencia y autoridad de los gobiernos municipales para planificar y controlar el desarrollo urbano, dentro de los límites de su territorio jurisdiccional. Consecuentemente, cada uno de ellos dispondrá lo que proceda para implantar un plan regulador, y los reglamentos de desarrollo urbano conexos, en las áreas donde deba regir, sin perjuicio de extender todos o algunos de sus efectos a otros sectores, en que priven razones calificadas para establecer un determinando régimen contralor.” Desde ese plano, el numeral primero de la Ley de Planificación Urbana conceptualiza al plan regulador como el instrumento de planificación local que define en un conjunto de planos, mapas, reglamentos y cualquier otro documento, gráfico o suplemento, la política de desarrollo y los planes para distribución de la población, usos de la tierra, vías de circulación, servicios públicos, facilidades comunales, y construcción, conservación y rehabilitación de áreas urbanas.
En cuanto a su naturaleza, la Sala Constitucional los ha considerado de la siguiente manera: “Éstos se tratan de mecanismos amplios de planificación por medio de los cuales, los gobiernos locales deciden acerca del mejor uso que debe ser dado a la tierra, así como al diseño de los servicios públicos, vías locales de comunicación, vivienda y renovación urbana, entre otros. En tal sentido, estos planes constituyen mecanismos de política municipal que permiten planificar el tipo de desarrollo que se desea para cada cantón, en atención de los derechos e intereses de sus habitantes y de los valores de rango constitucional que informan toda actuación pública (ver en ese sentido sentencia número 5097-93, de las diez horas veinticuatro minutos del quince de octubre de mil novecientos noventa y tres y sentencia número 2006-10971 de las dieciocho horas tres minutos del veintiséis de julio del dos mil seis).” (Resolución 2008-6304 de las doce horas y veintiséis minutos del dieciocho de abril del dos mil ocho).
Mediante estos planes, se concreta la potestad de planificación y ordenación urbanística que viene conferida como competencia primigenia a los entes locales. En ese tanto, la Planificación Urbana es definida por el numeral primero de la Ley de Planificación Urbana como “el proceso continuo e integral de análisis y formulación de planes y reglamentos sobre desarrollo urbano, tendiente a procurar la seguridad, salud, comodidad y bienestar de la comunidad.” De este modo, el planeamiento urbanístico debe ser considerado como una aplicación concreta del ejercicio de las potestades que el poder público confiere al Estado, como parte de las acciones tendientes a definir la acción político-económica nacional. A fin de cuentas, lo esencial de este tipo de manifestaciones de poder, es que, mediante un planeamiento adecuado, se produzca en la utilidad del suelo, una serie de combinaciones de destinos varios, de manera tal que su ordenamiento revista un mejor servicio y rendimiento para el hombre y la comunidad urbana, equilibrando el desarrollo de los núcleos de población y de las áreas rurales circundantes, de las distintas comunidades urbanas, de las regiones y en general del país.
Es menester señalar que los planes reguladores y sus respectivos reglamentos tienen naturaleza normativa, y por consiguiente, obligan tanto a los propietarios de terrenos ubicados en la zona de aplicación, como a la misma municipalidad que los dicta. Son instrumentos normativos que imponen limitaciones de orden urbanístico, como derivación de la habilitación prevista por la Ley No. 4240. De esa manera, una vez adoptado el instrumento de planificación local, las disposiciones allí contempladas resultan aplicables a todas las edificaciones que se pretendan construir, remodelar o ampliar con posterioridad a su entrada en vigencia, salvo algunos casos excepcionales. Así, trata de un instrumento de ordenación urbana y concreción de la potestad planificadora que es atinente a las Corporaciones Locales, y que fija las reglas para la edificabilidad en una determinada área y que por tal, incide de manera directa en la disponibilidad del ius edificandi que es propio de la propiedad inmueble, incorporando por ende limitaciones a la propiedad, efectos que exige y justifica la satisfacción de varios presupuestos legales y procedimiento de emisión.
Sobre su naturaleza jurídica puede verse, entre otras, las resoluciones números 416-2010, 2304-2010, 073-2011, 126-2011 y 141-2012, todas de la Sección III de este Tribunal Contencioso Administrativo, así como el voto No. 2006-13330 de la Sala Constitucional. / VI.- Exigencias y procedimiento para emitir un Plan Regulador. A partir de lo anteriormente expuesto, resulta clara la naturaleza jurídica del Plan Regulador, su finalidad y la competencia de los entes locales para su emisión, así como su alcance jurídico para limitar el pleno goce de los diversos atributos del dominio. No obstante, la emisión de estos planes reguladores, es una competencia que dista de ser irrestricta, y como típica función administrativa en ejercicio de potestades de imperio, en la especie, de corte ordenatorio y por tal, delimitador relativo de derechos de los particulares, debe estar sujeta, como de hecho lo está, a la legalidad.
Ello supone la aplicabilidad de límites que el mismo ordenamiento le impone, no solo a nivel de definición de marcos de acción y procedimiento, sino además, y tal vez, lo más relevante, a límites que derivan del plexo normativo y de los propios derechos cuyo ejercicio pretende condicionar, o al menos, encausar. La actividad planificadora radica en la esencia misma del poder del Estado en su vertiente teleológica, pues en el fondo, pretende sentar las bases sobre las cuales deben apoyarse las acciones de desarrollo urbano, a fin de que mediante la ordenación del uso de la propiedad urbana, se permita una mejor utilización y la optimización de los recursos, para incrementar la calidad de vida del particular, en armonía con el modelo social y económico imperante. Aún esto, es claro que está sujeta a bordes o barreras. La planificación no puede ser arbitraria ni antojadiza, debe ser el medio para llegar a un fin, el vehículo transportador de los factores urbanos hacia el destino de una mejor ciudad que integre las distintas variables que gravitan a su alrededor bajo una armonía adecuada.
Es por esto, que bajo el prisma del principio de legalidad, la emisión de planes reguladores está sujeta al procedimiento específico previsto por la Ley de la Planificación Urbana. Además, dicho cuerpo legal establece el contenido básico de estos actos normativos. Sobre el particular véanse los artículos 15 al 20 de la legislación mencionada. En concreto, el artículo 16 de la Ley de Planificación Urbana estipula que de acuerdo con los objetivos que definan los propios y diversos organismos de gobierno y administración del Estado, el plan regulador local contendrá, entre otros elementos, sin limitarse a ellos: a) la política de desarrollo, con enunciación de los principios y normas en que se fundamenta y los objetivos que plantean las necesidades y el crecimiento del área a planificar, b) el estudio de la población, que incluirá proyecciones hacia el futuro crecimiento demográfico, su distribución y normas recomendables sobre densidad; c) el uso de la tierra que muestre la situación y distribución de terrenos respecto a vivienda, comercio, industria, educación, recreación, fines públicos y cualquier otro destino pertinente; d) El estudio de la circulación, por medio del cual se señale, en forma general, la localización de las vías públicas principales y de las rutas y terminales del transporte; e) Los servicios comunales, para indicar ubicación y tamaño de las áreas requeridas para escuelas, colegios, parques, campos de juego, unidades sanitarias, hospitales, bibliotecas, museos, mercados públicos y cualquier otro similar, f) los servicios públicos, con análisis y ubicación en forma general de los sistemas e instalaciones principales de cañerías, hidrantes, alcantarillados sanitarios y pluviales, recolección y disposición de basuras, así como cualquier otro de importancia análoga y g) la vivienda y renovación urbana con exposición de las necesidades y objetivos en vivienda, y referencia a las áreas que deben ser sometidas a conservación, rehabilitación y remodelación.
Ahora bien, la emisión de un plan regulador está sujeta al cumplimiento de exigencias sustanciales, que dispone el ordenamiento jurídico, como criterio condicionante de la validez de la conducta. En este plano, el mandato 17 de la Ley de previa cita estatuye que, de previo a implantar un plan regulador o alguna de sus partes, deberá la respectiva municipalidad que lo intenta proceder de la siguiente manera: “1) Convocar a una audiencia pública por medio del Diario Oficial y la divulgación adicional necesaria con la indicación de local, fecha y hora para conocer el proyecto y de las observaciones verbales o escritas que tengan a bien formular los vecinos o interesados. El señalamiento deberá hacerse con antelación no menor de quince días hábiles;
V.Sobre el caso concreto. De previo a analizar la procedencia de lo pedido por los actores, es indispensable tener como antecedente que en el año 2001 la Municipalidad de Mora inició un procedimiento para la modificación del Reglamento de Zonificación, a efectos de variar el uso del suelo en áreas que forman parte de la ZPCE, modificación que en definitiva contó con la aprobación del INVU y fue puesta en vigencia. Conforme a la referida modificación, en el artículo 4.3 del Reglamento de Zonificación en cuestión, se creó la Zona Residencial de Baja Densidad con Restricciones (Z.R.B.D.R), estableciéndose para dicha zona los usos permitidos, los usos no conformes y los requisitos, de la siguiente manera: “Articulo 4.3. Zona residencial de baja densidad con restricciones (Z.R.B.D.R): Esta zona corresponde a terrenos ubicados al Este y Oeste del cuadrante de Ciudad Colón, en la cual para desarrollar cualquier proyecto será necesario realizar estudios y análisis que establezcan que las futuras edificaciones no tendrán problemas debido a deslizamientos, hundimientos, ó erosión de los suelos. 1.
Usos permitidos: Vivienda unifamiliar y multifamiliar, en urbanizaciones y condominio, comercio menor y servicios públicos comunales. Toda actividad agrícola, pecuaria v forestal o relacionada con estas. 2. Usos no conformes: Todos los no incluidos en usos permitidos. 3. Requisitos: 3.1. Estudios Hidrología y Geológicos que demuestran que no existen problemas de deslizamientos, hundimientos o erosión de los suelos. 3.2. Área lote mínimo: 1.000 metros cuadrados . 3.3. Frente mínimo de lote: 20.00 metros . 3.4. Retiros: Frontal 5.00 metros , Laterales 3.00 metros a cada lado ó 5.00 metros a un solo lado. Posterior 3.00 metros. En edificación de 2 ó más pisos se aplicará lo indicado al respecto en el Reglamento de Construcciones. 3.5. Altura máxima: 2 pisos en vivienda unifamiliar. 6 pisos en vivienda multifamiliar de 4 pisos en adelante se deberá contar con el visto bueno de Aviación Civil. 3.6.
Cobertura máxima: 30% en vivienda unifamiliar. 15% en vivienda multifamiliar. 3.7. Densidad permitida: 30 habitantes por hectárea 6 viviendas por hectárea.”. También se reformó el inciso 3 del artículo 10 de ese referido Reglamento en el siguiente sentido: “Articulo 10. —Zona Agrícola (Z.A.): Esta zona corresponde a terrenos ubicados generalmente en la periferia, que conservan un uso agrícola, el cual se pretende proteger y a la vez darle un colchón de amortiguamiento al desarrollo urbanos, como límite. 1. Usos permitidos. Además de las instalaciones necesarias para la actividad agrícola, se permite únicamente la vivienda del propietario o de los peones de la finca, siempre que existan los servicios mínimos. Para las Zonas de Brasil, Rodeo, Jaris, San Bosco, Los Altos de San Rafael, y Barrio La Trinidad, se hace la excepción dentro de estos sectores ya que existe un alto índice de vivienda mezcladas con la actividad agrícola y que debe darse lugar a un crecimiento vegetativo, por lo tanto se establece que la vivienda se permite y con los mismos requisitos de la zona residencial ya definidos.
El crecimiento vegetativo se hace en la periferia de las calles públicas y con accesos a servidumbres o calles públicas nuevas no mayores a 150 metros de largo en el caso de calle pública y no mayor de 60 metros en el caso de servidumbre, cumplan con el Reglamento de Construcción y los tamaños de lote dependerán de las pruebas de infiltración. 2. Requisitos. 2.1. Area mínima: 1 hectárea. 2.2. Frente mínimo: 20,00 metros, 2-3. Cobertura máxima- 10% del área de la finca, incluyendo las construcciones afines al uso agrícola. (*)3. Requisitos: Para las zonas de Brasil, Rodeo, Jaris, San Bosco, Los Altos de San Rafael y Barrio La Trinidad, de conformidad con lo establecido en el punto primero del presente artículo, se permite el desarrollo residencial con los siguientes requisitos: 1. Densidad máxima de 250 habitantes por hectárea. 2. Altura máxima de 6 pisos. 3. Cobertura máxima del 30%. 4. Los usos conformes y no conformes como se establecen en la Zona Residencial. 5.
Todos los terrenos de esta zona deberán presentar estudios en que se analicen la estabilidad de suelos, erosiones, deslizamientos y contaminación de ríos y quebradas, así como fuentes de agua.”. Durante la vigencia de esa normativa reglamentaria, específicamente entre el 22 de junio del 2006 y el 20 de julio del 2007, los accionantes Nombre138412 , Nombre138409 , Nombre138410 y Nombre138411 suscribieron contratos privados de cesión de acciones con quienes en ese momento eran los apoderados de las sociedades Desarrollos Urbanísticos Bloque SGRAH DOS BBB S.A, Desarrollos Urbanísticos Segmento TJFK SEIS FFF S.A., Desarrollos Urbanísticos Bloque SGRAH VEINTIUNO TTT S.A. y Desarrollos Urbanísticos Bloque SGRAH QUINCE ÑÑÑ S.A., mediante los cual los segundos, por el precio ahí convenido, cedían a los primeros (aquí actores) la totalidad de las acciones de las sociedades referidas, respectivamente (hechos probados 8, 11, 14 y 17).
En los referidos contratos se estableció que las referidas sociedades (en el orden indicado ut supra) eran propietarias de las fincas inscritas en el Registro Nacional, Partido de San José, Sección de Propiedad Horizontal, matrículas de Folio Real número Placa26200, , y Placa26208, que correspondían a las filiales número 53, 65, 48 y 61 del Condominio Hacienda Los Bambúes. De esta forma, las referidas fincas fueron adquiridas por los accionantes indicados y todas ellas se describen con una naturaleza de finca filial (con el número respectivo), terrenos aptos para construir, que se destinarán a uso habitacional, que podrá tener una altura máxima de dos pisos. Por otra parte, los planos catastrados de cada inmueble, indican en el detalle del cuadro de áreas, la cobertura máxima permitida en la zona, así como la altura (2 pisos), el área máxima de cobertura propuesta, el área máxima de construcción y el índice de construcción 0.6.
(hechos probados 9, 10, 12, 13, 15, 16, 18 y 19). Luego, el 19 de junio de 2009, el Alcalde de la Municipalidad de Mora, presentó acción de inconstitucionalidad contra la reforma integral efectuada al Reglamento de Zonificación del Plan Regulador del cantón de Mora, únicamente en relación con la Zona Protectora Cerros de Escazú (ZPCE) que se tramitó bajo el expediente No. 09-009306-0007-CO y mediante la sentencia No. 2010-021258 de las 14 horas del 22 de diciembre del 2010, la Sala Constitucional resolvió la acción de inconstitucionalidad referida. La parte dispositiva de ese fallo indica: "Se declara CON LUGAR la acción. En consecuencia se anulan por inconstitucionales los artículos 4.3 y 10 del Reglamento de Zonificación del Plan Regulador de Mora, publicado en La Gaceta No. 173 del 10 de septiembre de 2001. En cuanto al artículo 13 del Reglamento de Zonificación de 1993, no resulta inconstitucional si después de su publicación en el Diario La Gaceta no se aplica a Áreas Silvestres Protegidas.
Esta sentencia tiene efectos declarativos y retroactivos a la fecha de vigencia de la norma anulada, sin perjuicio de derechos adquiridos de buena fe. Sin embargo, de conformidad con lo dispuesto por el artículo 91 de la Ley de la Jurisdicción Constitucional, se dimensionan los efectos en el sentido de que la inconstitucionalidad declarada no afecta las construcciones plenamente terminadas o los propietarios que cuenten con las respectivas licencias de construcción otorgadas por la Municipalidad, salvo aquellas que aún no han iniciado a la fecha de publicación del aviso. Hasta tanto la Municipalidad y el Ministerio de Energía, Ambiente y Telecomunicaciones no hayan promulgado la respectiva normativa, únicamente se deben admitir trabajos de remodelación o mantenimiento sobre las áreas previamente construidas. Comuníquese este pronunciamiento al Poder Ejecutivo. Reséñese este pronunciamiento en el Diario Oficial La Gaceta y publíquese íntegramente en el Boletín Judicial.
Notifíquese. / El Magistrado Castillo Víquez salva el voto únicamente en cuanto al dimensionamiento de esta sentencia." Este fallo fue publicitado en el Boletín Judicial No. 13 del 19 de enero del 2011. Con estos antecedentes, ingresamos a resolver las pretensiones principales formuladas por los actores.
VI.La primera pretensión que formulan todos los accionantes se dirige a que se declare a los demandados responsables de la inutilización e imposibilidad de explotación de los lotes que fueron adquiridos durante la vigencia de la modificación efectuada al Reglamento de Zonificación del Plan Regulador del Cantón de Mora del año 2001, por ser inmuebles con un área inferior a la permitida según el Reglamento de Zonificación vigente. En ese sentido, lo primero que debemos señalar es que del recuento de hechos que se ha tenido por acreditado, es claro que a la fecha en que los accionantes Nombre138412 , Nombre138409 , Nombre138410 y Nombre138411 adquirieron, por cesión de acciones, las sociedades propietarias de los inmuebles inscritas en el Registro Nacional, Partido de San José, Sección de Propiedad Horizontal, matrículas de Folio Real número Placa26200, , y Placa26208, que correspondían a las filiales número 53, 65, 48 y 61 del Condominio Hacienda Los Bambúes, respectivamente; se encontraba vigente el Reglamento de Zonificación reformado en el 2001, que presentaba condiciones de disposición del inmueble en virtud de las cuales, acorde a lo indicado en ese instrumento (y lo reflejado en los plano catastrado a que se hace referencia en los hechos probados) la cobertura máxima permitida en esa zona era de 30%, con una altura de 2 pisos, con áreas máximas de cobertura y de edificabilidad propuesta específicas para cada inmueble, información que como reiteramos, se extrae de los planos catastrados a los que se hace referencia en los hechos probados 9, 10, 12, 13, 15, 16, 18 y 19.
Esas condiciones originarias, se insiste, encontraban pleno respaldo en el Reglamento de Zonificación, que a esa data era un instrumento de planificación que no había ponderado de manera adecuada el impacto al ambiente, producto de lo cual, luego fue anulado por la Sala Constitucional. Ahora bien, en criterio de este Tribunal, las condiciones normativas de disponibilidad edilicia establecidas a la fecha de adquisición del dominio sobre los referidos inmuebles concedían expresamente una posibilidad (expectativa y no un derecho) de uso y destino constructivo, si se considera que se ha tenido por acreditado que ese bien es precisamente una filial de un proyecto de Condominio que se encontraba debidamente registrado, lo que se desprende de los planos catastrado señalados en los hechos probados. El hecho de que la propiedad en cuestión forme parte de un esquema de propiedad horizontal permite, en principio, colegir que el bien se adquiere bajo la premisa de una expectativa de uso acorde a un proyecto y diseño que por regla de conocimiento común, opera en este tipo de proyectos.
Lo cierto del caso es que al momento de adquirir el inmueble, estando el instrumento de zonificación vigente y siendo expedido y aplicado por las autoridades competentes (pues contó con el trámite de la Municipalidad de Mora y la venia del INVU), no puede imputarse a la actora una suerte de deber o posibilidad objetiva de conocer que por condiciones ambientales, las normas de zonificación que posibilitaron el cambio en el régimen de uso de esos terrenos que forma parte de la ZPCE y que daban paso a la construcción de viviendas unifamiliares en régimen de condominio, con pautas de disponibilidad y edificabilidad específicas, eran ilegítimas. En nuestro criterio, las fincas se adquirieron al amparo de una máxima de confianza legítima, derivación de que las condiciones señaladas en cuanto a disponibilidad y edificabilidad, venían reconocidas expresamente en normas emitidas por las propias autoridades administrativas competentes.
Tal calificación no decae, en principio, por la circunstancia sobrevenida de anulación de la reforma del Reglamento de Zonificación del 2001, emitida en el 2007 por la Sala Constitucional. Ciertamente, dentro del ámbito de análisis realizado por el Tribunal Constitucional en el fallo No. 2010-21258 citado, un aspecto determinante fue la infracción a las normas de carácter ambiental que exigían la tutela del ecosistema propio de la ZPCE, mismas que imperaban desde la creación misma de esa área mediante Decreto Ejecutivo Número 6112-A de fecha 23 de junio de 1976, con la finalidad de proteger recursos forestales en dicha área, procurando que terrenos con vocación forestal permanezcan siempre con cobertura de bosque. Sin embargo, esa afectación de terrenos realizada desde 1976 y ampliada en 1983 mediante la emisión del Decreto Ejecutivo No. 14672 indicado, no deja de lado que al momento de adquirir los inmuebles aquí referidos con el proyecto de vivienda unifamiliar, las condiciones de disponibilidad, dentro de ellas, su régimen de uso de suelo, se encontraran ajustadas y conformes a una norma administrativa vigente (a esa fecha) y que por haber sido emitida por la autoridad rectora urbanística en el marco local, hacía presumir que esas particularidades eran legales y válidas, generando en el administrado adquirente una presunción de legitimidad de esas circunstancias por el respaldo normativo que encontraban a ese momento.
Incluso, es de destacar que la misma Sala Constitucional en el fallo de referencia, específicamente en el considerando VIII, fijó un dimensionamiento para los efectos de la declaratoria de inconstitucionalidad, justificando parte de su postura en dicha situación de confianza al señalar: "... A juicio de la Sala, habrán de tenerse en cuenta dos condiciones específicas, la primera cuando aquel interesado que ha cumplido con todos los requisitos necesarios inició efectivamente su edificación antes de la publicación del aludido aviso, pues actuó amparado a la normativa urbana emitida por la Municipalidad..." Esa actuación al amparo de normas vigentes coloca al titular en dicho marco de confianza legítima. No obstante, ese dimensionamiento también señaló claramente que “(…) De conformidad con el artículo 91 de la Ley de la Jurisdicción Constitucional, la declaración de inconstitucionalidad tendrá efecto declarativo y retroactivo a la fecha de vigencia del acto o de la norma, todo sin perjuicio de derechos adquiridos de buena fe.
La sentencia constitucional de anulación podrá graduar y dimensionar en el espacio, el tiempo o la materia, su efecto retroactivo, y dictará las reglas necesarias para evitar que esto produzca graves dislocaciones de la seguridad, la justicia o la paz sociales. En el caso que nos ocupa, esta Sala debe tomar en cuenta que la impugnación del Reglamento de Zonificación, según la publicación a La Gaceta No. 173 del 10 de septiembre de 2001, se realizó aproximadamente ocho años después de su puesta en vigencia. El aviso de la interposición y curso de la demanda se publicó el 17 de agosto de 2009. A juicio de esta Sala, aún cuando las disposiciones impugnadas del Reglamento de Planificación Urbana expedidos por la Municipalidad de Mora han tenido vigor y permanencia, ello ha ocurrido especialmente dentro del sector de la Zona Protectora Cerros de Escazú que le antecede. En este sentido, la creación de la Zona Protectora mencionada por Decreto 6112-A es del 23 de junio de 1976 y su ampliación por Decreto No. 14672 del 20 de junio de 1983, entraron en vigencia con mayor antelación que los planes reguladores, por lo que no se podría estimar que aquellas disposiciones nacionales fueran ignoradas por la Municipalidad y por los vecinos del Cantón y otras áreas protectoras que afectan en su totalidad al Cantón de Mora.
Por lo anterior, la Sala estima que la sentencia debe ir acompañada de un dimensionamiento especial con el fin de cubrir únicamente las construcciones plenamente terminadas, o a las iniciadas y que cuenten con las respectivas licencias de construcción e iniciadas antes del primer aviso del 17 de agosto de 2009. A juicio de la Sala, habrán de tenerse en cuenta dos condiciones específicas, la primera cuando aquel interesado que ha cumplido con todos los requisitos necesarios inició efectivamente su edificación antes de la publicación del aludido aviso, pues actuó amparado a la normativa urbana emitida por la Municipalidad. La segunda si las viviendas en dichos lugares requieren remodelaciones que no impliquen más área de construcción o mantenimiento, ello debe admitirse como derechos adquiridos de buena fe, bajo la condición de conservar la misma área previamente construida. Todo lo anterior, sin perjuicio de que la Municipalidad de Mora promulgue nuevas disposiciones urbanas que garanticen el desarrollo humano en equilibrio con el medio ambiente, cumpliendo con las disposiciones de la Ley de Planificación Urbana, sin modificar el régimen de suelos de las respectivas Zonas Protectoras, así como los respectivos estudios técnicos de impacto ambiental.
De igual manera, en las áreas que le competen al Ministerio de Ambiente, Energía y Telecomunicaciones, cuando cumpla con el respectivo Plan de Manejo de las respectivas zonas protectoras que afecten de igual manera al Cantón de Mora y otros, de lo cual no podría abstraerse el Ministerio ante la presión que estas zonas reciben de las comunidades adyacentes. Finalmente, es claro que al declarar la inconstitucionalidad de las normas impugnadas, las disposiciones respectivas del Reglamento de Zonificación de 1993, en cuanto a la Zona Agrícola (artículo 11) y las disposiciones del Resto de Distrito (ZRD) (artículo 13), no entran en vigor automáticamente, sino hasta que las mismas sean publicadas, dado que únicamente consta la reseña en La Gaceta, según se indicó supra en esta sentencia. Ante esta ausencia normativa, deberá integrarse el ordenamiento urbano del Cantón de Mora con la respectiva normativa dictada por el Instituto Nacional de Vivienda y Urbanismo.
(…)". De lo señalado por la Sala Constitucional, se desprende que las situaciones jurídicas tuteladas con el dimensionamiento señalado refieren a supuestos concretos atinentes a las construcciones plenamente terminadas, o a las iniciadas y que contaran con las respectivas licencias de construcción antes del primer aviso de la acción de inconstitucionalidad publicada el 17 de agosto de 2009. Conforme a lo dispuesto por el Tribunal Constitucional, los inmuebles que se encontraran en ese supuesto de hecho (y solamente en ese) no se verían afectados por la supresión del instrumento de zonificación, en la medida en que sus actuaciones se ajustaron a las normas vigentes en esa oportunidad. Por otro lado, la Sala Constitucional precisó que en esa situación, si dichas viviendas requirieran remodelaciones, podrían realizarlas, siempre que no implicara más área de construcción o mantenimiento, entendiendo que ello deriva o se desprende de los derechos adquiridos de buena fe, bajo la condición de conservar la misma área previamente construida.
También, la Sala Constitucional expresó que la Municipalidad de Mora podía promulgar nuevas disposiciones urbanas, respetando las pautas y normas de equilibrio con el medio ambiente, que fueron desatendidas en la reforma del 2001 y fueron la base de la anulación dictada en esa sede. Asimismo, estipuló que el Ministerio de Ambiente y Energía debía emitir el respectivo plan de manejo del sector involucrado. De lo dicho se desprende que el citado dimensionamiento solamente abarcó a quienes ya había construido o hubieran iniciado las construcciones con la licencia respectiva al 17 de agosto del 2009, sin que pueda entenderse aplicable a las personas que aún habiendo adquirido su derecho de dominio sobre las fincas cuyo régimen de uso de suelo y construcción se sustentaba en el Reglamento de Zonificación anulado, a esa fecha aludida, no habían iniciado obras constructivas legítimas, derivadas de una licencia edilicia otorgada por el ente local.
En tales casos, los titulares del derecho de dominio de los inmuebles localizados dentro de la zona afectada por la zonificación anulada, no podían alegar un derecho adquirido a concretar su ius edificandi acorde a los parámetros de esa programación de uso de suelo, pues se trata de una norma que contrasta con el Derecho de la Constitución, por ser lesivo al ambiente y que por ende, con las salvedades apuntadas por la misma Sala Constitucional, no es viable de generar una oponibilidad a favor de los propietarios, en la medida que ello implicaría una suerte de ultra actividad de norma derogada por ilegitimidad constitucional. La parte actora argumenta a su favor el voto salvado que consta en la misma resolución y que advierte sobre los posibles impactos perniciosos para quienes adquirieron en el ciclo de vigencia de la norma anulada, pero no habían concretado su derecho de edificación. Sin embargo, estimamos que ese argumento no resulta de recibo porque constituye una opinión de minoría que no avaló la mayoría del Tribunal Constitucional.
Por ende, en el contexto del fallo aludido, no podría este Tribunal aplicar las reglas del dimensionamiento a situaciones que no fueron expresamente consideradas en ese punto concreto de la decisión judicial, de suerte que tal postura no es óbice para las implicaciones y precisiones de tal dimensionamiento de efectos.
VII.Ahora bien, como indicamos ut supra, los accionantes reclaman la supuesta inutilización e imposibilidad de explotación de los lotes que fueron adquiridos durante la vigencia de la modificación efectuada al Reglamento de Zonificación del Plan Regulador del Cantón de Mora del año 2001, porque ahora son inmuebles con un área inferior a la permitida según el Reglamento de Zonificación vigente, lo que lleva a suprimir su derecho de edificación, acorde a las intenciones y vocación inicialmente establecidas por el Reglamento de Zonificación vigente al momento de adquirir los bienes entre los años 2006 y 2007. La supuesta inutilización, imposibilidad de explotación y supresión de su derecho a edificar se fundamenta en lo siguiente. En las demandas, argumentan que hicieron una inversión para la compra de los terrenos en el Condominio Hacienda Los Bambúes y ahora la propiedad que adquirieron no cuenta con las características legales exigidas por el Reglamento de Zonificación vigente porque no tiene el área mínima de 10.000 metros cuadrados y el porcentaje mínimo o cobertura en la actualidad, conlleva a una inutilización del terreno para los fines para los cuales fueron adquiridos, es decir la construcción de una casa con ciertas condiciones socioeconómicas que no podrían desarrollarse en el 10% del terreno, lo que hace que el daño sea cierto y efectivo.
Acota que actuaron al amparo de normas urbanísticas que se presumían válidas y eficaces, con la esperanza razonable de adquirir un terreno explotable y utilizable para vivienda residencial, no agrícola y que, ahora, al tratarse de un área protegida (de lo cual no había declaración, por parte del ente competente para su protección y administración), no podrá ser utilizada para tales fines. Acusa causas o hechos generadores materializados en actuaciones formales e inactividad, concretadas en la modificación al Reglamento de Zonificación del Cantón de Mora, aprobación del proyecto por parte de la Dirección de Urbanismo sin los estudios técnicos, y la actuación omisiva por parte del Estado, ya que si hubiese resguardado a tiempo el área protegida de los Cerros de Escazú, máxime con conocimiento de que particulares ya se encontraban construyendo edificaciones en un área protegida, de alguna manera por su competencia de administración de áreas protegidas, debió poner un alto en el camino o advertir sobre la afectación al medio ambiente, lo cual hubiese conllevado a que los aquí demandantes no ejercieran su decisión de compra, lo cual se agrava por el hecho de que esa normativa tuvo una vigencia aproximada a los nueve años.
Luego, durante sus conclusiones agregan que la resolución de la Sala Constitucional dejó sin efecto la posibilidad de utilización para vivienda de los terrenos adquiridos obligando a pasar el uso del suelo para dichos terrenos a lotes con una cobertura máxima de 10% y un área mínima de una hectárea, con lo cual sus terrenos no cumplen esa condición y resultan inexplotables ya que no podrían ser desarrollados para vivienda según el fin para el cual fueron adquiridos y pasando a ser terrenos con usos permitidos destinados a la actividad agrícola, permitiéndose solo la vivienda del propietario y trabajadores. Sin embargo, luego de un cuidadoso análisis, el Tribunal estima que esta pretensión resulta improcedente por las siguientes razones. De inicio, es necesario precisar dos aspectos. El primero de ellos es que, según se tuvo por acreditado, la ZPCE fue declarada como tal desde 1976, con la emisión del Decreto Ejecutivo No. 6112-A, es decir, desde antes de que los accionantes adquirieran los inmuebles a los que se ha hecho referencia en este fallo; de modo que, entiende el Tribunal, adquirieron conociendo de la existencia de la referida zona de protección.
Por otra parte, debemos reiterar que si bien el fallo del Tribunal Constitucional al que hemos hecho referencia anuló el Reglamento de Zonificación al amparo del cual los accionante adquirieron los inmuebles en el Condominio Hacienda Los Bambúes; lo cierto es esa decisión jurisdiccional dimensionó los efectos de la declaratoria de inconstitucionalidad protegiendo las situaciones jurídicas subjetivas de aquellos propietarios que a la fecha de publicación del primer aviso de la formulación de la acción referida (17 de agosto de 2009) ya habían ejercido el derecho de edificación o bien, quienes a esa data, habían obtenido la licencia edilicia y habían iniciado la construcción respectiva. Además, esa decisión jurisdiccional estableció que no se imponía una restricción absoluta de uso de los terrenos ubicados dentro de la ZPCE, en la medida en que indicó con toda claridad que la Municipalidad de Mora podía establecer nuevos regímenes de uso siempre que fuesen compatibles con las normas de protección ambiental, supeditando ese desarrollo a las regulaciones que debía emitir el SINAC mediante el respectivo Plan General de Manejo, echado de menos desde la creación misma de la zona de protección en 23 de junio de 1976 (con el Decreto No. Placa26213).
De esta forma, amén de que es un argumento esbozado hasta las conclusiones, no es cierto que la resolución de la Sala Constitucional dejara sin efecto la posibilidad de utilización de los terrenos adquiridos por los aquí demandantes, como se ha afirmado. En esa línea, tenemos que en el acuerdo No. 9 de la sesión ordinaria número 11 -2015 celebrada el 23 de noviembre de 2015, el Consejo Nacional de Áreas de Conservación aprobó el Plan General de Manejo ZPCE, que fue publicado en Gaceta No. 37 del 23 de febrero de 2016 (expedientes administrativos aportados por el SINAC) y en el cual se establecen las condiciones de uso de los terrenos de la ZPCE, en cuatro zonas, a saber, de mínima, baja, mediana y alta de intervención. Cabe mencionar que en todas esas zonas se permite, claro está, bajo distintas condiciones, la construcción de infraestructura de propiedad privada, lo que incluye viviendas unifamiliares o multifamiliares e incluso, urbanizaciones o condominios, estos últimos en las zonas de mediana y alta intervención.
Así las cosas, somos del criterio de que la supresión del instrumento de planificación por parte de la Sala Constitucional en sí mismo no lleva, de manera automática, a una inutilización o supresión del derecho de propiedad ni a un marco de responsabilidad civil de las instancias administrativas que con acción u omisión permitieron la vigencia de ese reglamento anulado, sino que es necesario ponderar en cada caso si a raíz de lo acontecido, esos terrenos se encuentran dentro del dimensionamiento efectuado por la Sala Constitucional, si fueron inutilizados o bien, si son objeto de limitaciones que impidan el ejercicio del derecho constructivo. Ahora, resulta indudable que la demostración de estos factores (es decir, la inutilización o vaciamiento del derecho de propiedad o el ius edificandi) es una carga que incumbe a los accionantes, en virtud de lo dispuesto en los artículos 317 del Código Procesal Civil vigente al momento de la interposición de estos procesos, 41.1 del Código Procesal Civil vigente al momento del dictado de esta sentencia, 58 y 82 del CPCA.
Pues bien, en el caso que nos ocupa, tenemos que las sociedades demandantes Desarrollos Urbanísticos Segmento TJFK SEIS FFF S.A., Desarrollos Urbanísticos Bloque SGRAH VEINTIUNO TTT S.A. y Desarrollos Urbanísticos Bloque SGRAH QUINCE ÑÑÑ S.A., representadas por los también actores Nombre138409 , Nombre138410 y Nombre138411 , no demostraron en este proceso que hubieran solicitado licencia constructiva ante la Municipalidad de Mora e iniciado construcciones, con anterioridad al 17 de agosto del 2009. Menos aún que con anterioridad al 17 de agosto del 2009 contaran con construcciones plenamente terminadas en los inmuebles de su propiedad ubicadas en el Condominio Hacienda Bambú. En virtud de lo expuesto, la situación jurídica con la que cuentan, en este caso es únicamente la adquisición de un inmueble en el referido condominio, la cual quedó fuera del dimensionamiento de los efectos de la declaratoria de inconstitucionalidad efectuado por la Sala Constitucional, según explicamos ut supra.
Por ello, no es posible que aleguen la violación a derechos subjetivos o situaciones jurídicas consolidadas relacionadas con el ius edificandi. En todo caso, cabe señalar que los actores indicados tampoco han demostrado cuál fue el diseño arquitectónico de la vivienda que pensaban construir o, al menos, el que les ofreció la Urbanizadora y sobre el cual planeaban ejercer su derecho constructivo. En nuestro criterio, ese aspecto era fundamental a efectos de establecer la supuesta afectación que sufrieron en sus inmuebles con el cambio en la normativa urbanística, específicamente a partir de la anulación del Reglamento de Zonificación emitido en el año 2001 y de la publicación del Plan General de Manejo de la ZPCE. Tampoco se ofreció ningún elemento técnico que permita establecer con certeza la zona de intervención en la que actualmente se ubican los inmuebles de los actores citados, con posterioridad de la publicación del Plan General de Manejo de la ZPCE.
Ese requerimiento técnico es fundamental porque constituye un insumo indispensable para poder cotejar las condiciones de ocupación plasmadas en el Reglamento de Zonificación vigente al momento en que se dio la cesión de acciones de la entidad accionante (2007), versus las que plasma el Plan de Manejo vigente y concluir certeramente si variaron las condiciones y el uso permitido para cada uno de los inmuebles, por ejemplo si se permitía la construcción de viviendas unifamiliares, multifamiliares, urbanizaciones o condominios, la altura máxima de las viviendas, el área máxima de cobertura y el de construcción, el índice de permisibilidad de ocupación Todos esos aspectos son indispensables para poder establecer si las propiedades de los aquí actores pueden ser utilizadas o explotadas en términos constructivos o si por el contrario, los inmuebles quedaron inutilizables y se suprimió el derecho de edificar en aquellos.
Sin embargo, al no haber atendido los actores sus cargas probatorias en ese sentido, deberán asumir las consecuencias procesales negativas que correspondan en este caso, que no se tenga probado que los inmuebles de su propiedad quedaron inutilizables con ocasión de la promulgación del Plan General de Manejo, que éstos no puedan ser explotados o sea imposible edificar en ellos. Lo anterior porque, insistimos, la supresión del anterior Reglamento de Zonificación, en lo que se refiere exclusivamente al área de la ZPCE, no llevó necesariamente a la imposibilidad de uso o edificación de la propiedad de las sociedades demandantes, máxime cuando la cabida en todos ellos es superior a los mil metros cuadrados. Al tenor del referido Plan de Manejo, en general, esas fincas podrían ser explotadas y ser objeto de ejercicio del derecho de edificación, el cual debe ajustarse, ahora, a dichas ordenanzas urbanísticas que fueron emitidas luego de que la Sala Constitucional anulara el anterior Reglamento de Zonificación y ordenara la emisión de una Plan de Manejo en esa zona, que incluyera la ponderación y análisis de la variable ambiental.
En virtud de lo expuesto y al no demostrarse la supuesta inutilización, imposibilidad de explotación o supresión del derecho a edificar en las fincas indicadas, lo pretendido debe rechazarse como en efecto se hace.
VIII.La pretensión dirigida a que se declare a los demandados responsables de la inutilización e imposibilidad de explotación de los lotes que fueron adquiridos durante la vigencia de la modificación efectuada al Reglamento de Zonificación del Plan Regulador del Cantón de Mora del año 2001, debe ser rechazada también respecto de la sociedad demandante Desarrollos Urbanísticos Bloque SGRAH DOS BBB S.A., representada por la también actora Nombre138412 . Lo anterior porque se ha tenido por acreditado que estos accionantes sí solicitaron licencia constructiva para una vivienda en el Condominio Hacienda Los Bambúes e iniciaron los trámites respectivos antes del 17 de agosto del 2009. Incluso, se acreditó que la vivienda fue construída y que la referida sociedad canceló el Impuesto Solidario a las Viviendas de Lujo correspondiente a los períodos fiscales 2010 y 2011 (imágenes 308 y 309 del expediente judicial digital escaneado en un único archivo PDF).
Así las cosas, no hay duda para el Tribunal de que el inmueble en cuestión sí pudo ser utilizado, explotado y edificado, sin que se alegue ni se observe ninguna supresión a su derecho de propiedad o al ius edificandi. Incluso, dado que se acreditó que la actora solicitó la licencia constructiva e inició obras antes del 17 de agosto del 2009, su situación jurídica quedó, protegida por el dimensionamiento efectuado por la Sala Constitucional respecto de eventuales mejoras.
IX.Las siguientes pretensiones se dirigen a reclamar la responsabilidad patrimonial de los demandados por que, en criterio de los demandantes, existió funcionamiento anormal, conducta omisiva e ilícita que le generó una serie de daños. Por el tema que se debate, estimamos necesario señalar que de conformidad con el artículo 190 de la Ley General de la Administración Pública (en adelante LGAP), habrá responsabilidad de la Administración siempre que su funcionamiento normal o anormal, legítimo o ilegítimo, cause un daño que la víctima no tenga el deber de soportar, ya sea patrimonial o extrapatrimonial, con independencia de su situación jurídica subjetiva y la titularidad o condición de poder que ostente, cumpliendo claro está, con el presupuesto imprescindible del nexo causal. Sobre el tema, véase el extenso desarrollo realizado en la resolución no. 584 de las 10 horas 40 minutos del 11 de agosto del 2005 de la Sala Primera de la Corte Suprema de Justicia.
Desde este plano, la legislación impone como criterios de imputación la conducta ilícita o lícita, así como el funcionamiento normal o anormal. Con todo, ante esos criterios de imputabilidad, ha de acreditarse que la lesión es consecuencia de esas acciones u omisiones, a efectos de establecer el nexo causal que permita la atribución de responsabilidad al centro de autoridad pública. Aunado a ello, en los casos de anormalidad e ilicitud, el juzgador ha de abordar un examen del funcionamiento público, a fin de establecer si efectivamente, se ha presentado un proceder que se aleja de la legalidad o bien, se contrapone a los conceptos de eficiencia administrativa. En tales casos, resulta determinante inferir con claridad la existencia de esos criterios, pues de otro modo, el tratamiento y análisis de cada caso debe ser diferente, atendiendo al tipo de funcionamiento al que se atribuye el detrimento.
Surgen como causas eximentes de tal responsabilidad la culpa de la víctima, el hecho de un tercero y la fuerza mayor. Cabe destacar que este deber indemnizatorio se fundamenta, además, en el concepto de antijuridicidad de base, traducible en la inexistencia del deber de soportar la lesión. Más simple, siempre que se haya sufrido una lesión como consecuencia de una conducta pública, sea esta activa u omisiva, que la víctima no tiene la obligación de soportar, surge el deber indemnizatorio como derivación de máxima de reparación integral del daño que se desprende del numeral 41 de la Constitución Política. De ahí que dentro del espectro de cobertura de este sistema de responsabilidad, se encuentren comprendidos los daños que puedan ocasionarse de un funcionamiento normal o bien de una conducta lícita, pues en tales casos, pese a que en tesis de principio, el proceder público se ajusta a legalidad o bien a las reglas de eficiencia que lo orientan, si se produce un efecto lesivo que la persona no tiene el deber de soportar, ha de ser indemnizado.
Desde luego que en esas hipótesis el daño ha de ser especial (infringido a una pequeña proporción de afectados) o anormal (sea, de un alcance excepcionalmente intenso, por encima de los márgenes normales de tolerancia), dando pie a la reparabilidad del daño, no así del lucro cesante, según las reglas dispuestas por los artículos 194 y 195 de la LGAP. Con todo, cabe indicar que no todo daño es indemnizable, sino solo aquel que el Ordenamiento Jurídico considere antijurídico en su base y que sea efectivo, evaluable e individualizable. En efecto, sólo es indemnizable la lesión que confrontada con la globalidad del Ordenamiento, pueda reputarse como antijurídica en su base; lo contrario llevaría, a decir de la Sala Primera de la Corte Suprema de Justicia, a afirmar la compensación por acción dañosa frente a un menoscabo que el Ordenamiento no reprocha y que, por el contrario, tolera y consciente como normal y justificado, lo que llevaría a una inminente quiebra del Estado, que en el contexto nacional, se encuentra vinculado directa o indirectamente con un gran número de áreas de acción.
Dicho en términos más simples, existe antijuricidad de base siempre que un mandato legal establezca la obligación de reparar una lesión contraria a derecho que la víctima no deba soportar, al margen del parámetro de imputación. La amplitud del marco de tutela del sistema de responsabilidad objetiva de la Administración no es óbice del deber de acreditar que el daño es consecuencia de un proceder público. A su vez, debe demostrarse el marco fáctico a partir del cual, es viable desprender la lesión a los bienes extrapatrimoniales. No basta alegar la existencia de padecimientos o lesiones, debe demostrarse al menos, los hechos que en teoría, han originado tal detrimento porque quien alega tener un derecho, de probar los hechos constitutivos de aquel. No se trata de una inversión de la carga probatoria en una materia que se sustenta en la reparación integral del daño y tiene como pilares el daño y el riesgo creado, sino de la comprobación mínima de los criterios de imputación y hechos que dan origen al daño, como presupuestos elementales de la atribución de responsabilidad y con ello del surgimiento de la obligación reparadora.
Lo anterior deriva además de lo preceptuado por el canon 196 de la LGAP, en cuanto señala: “En todo caso el daño alegado habrá de ser efectivo, evaluable e individualizable en relación con una persona o grupo.” La efectividad del daño en un caso concreto pende, de manera directa, de la demostración del nexo de causalidad, que permita vincular el resultado lesivo con una acción u omisión de una Administración Pública. Así además se establece en el ordinal 58 del Código de previa cita, en cuanto impone el deber del accionante de señalar las causas de la lesión reclamada, en qué consiste, y su estimación prudencial. Si bien tal exigencia se encuentra prevista en la norma indicada cuando el pedimento reparador sea accesorio, con mucho mayor razón ha de satisfacerse cuando el marco medular de la pretensión sea una indemnización, pues en esos casos, el establecimiento de esos presupuestos, es la base mínima para acceder a lo peticionado.
X.Pues bien, la segunda pretensión que formulan los actores es para que se declare responsable al Estado por falta de fiscalización, control y protección de la Zona de Protección Cerros de Escazú, permitiendo el cambio de zonificación y cambio de los usos permitidos a vivienda unifamiliar y multifamiliar lo que generó la compra de terrenos con áreas dentro de un rango superior a 1.000 metros cuadrados e inferiores a 10.000 metros cuadrados, y con ello ocasionó que los demandantes hicieran la compra de terrenos dentro de ese rango, que posteriormente serían inexplotables e inutilizables. A tono con lo recién indicado en los Considerando VI, VII y VIII, en los que se estableció la improcedencia de la pretensión primera que buscaba una condena de responsabilidad por la imposibilidad de explotación o utilización del terreno propiedad de los demandantes, esta pretensión resulta también inatendible.
Nótese que en el fondo, ese ruego busca que este Tribunal declare una responsabilidad de los coaccionados a raíz de supuestas omisiones de fiscalización que le llevaron a la compra de terrenos que luego serían inutilizables e inexplotables. Pero, como se explicó en los Considerandos referidos, a diferencia de lo que aseveran los actores en el sustento de ese pedimento, no se demostró que las fincas de su titularidad cuenten con una limitación urbanística o ambiental de tal condición que las convierta en inutilizables, inexplotables o les imposibilite el ejercicio del derecho de construcción, siendo incluso que en el caso de la sociedad demandante Desarrollos Urbanísticos Bloque SGRAH DOS BBB S.A., el inmueble sí fue utilizado porque la vivienda fue construida. Insistimos en que, en general, el Plan General de Manejo emitido por el SINAC, permite la explotación de esos inmuebles para uso de vivienda unipersonal, multipersonal e incluso, en algunos casos, para urbanizaciones y condominios; sin que los actores logren acreditar que esos niveles de afectación le impiden sustancialmente explotar o utilizar el inmueble.
Sea, las normas aplicables a la ZPCE posibilitan la construcción sujeta a reglas específicas distintas a las vigentes cuando ellos adquirieron los inmuebles, pero en modo alguno niegan o suprimen la posibilidad de uso y explotación de los inmuebles, ante lo cual, esa pretensión segunda debe, también, ser rechazada por no haberse podido establecer la existencia efectiva del daño cuya reparación se solicita. De la prueba traída al proceso y el análisis de las piezas que rolan en autos, no se puede concluir sobre una eventual inutilización o imposibilidad legal o material de aprovechar constructivamente las fincas adquiridas. El Plan de Manejo admite y reconoce esa posibilidad, imponiendo limitaciones diversas a las que pesaban sobre el terreno cuando fue emitida la reforma al Reglamento de Zonificación del cantón de Mora en el año 2001. En esas condiciones, no puede decirse de una restricción a actos edilicios.
Por otra parte, conviene reiterar que, con excepción de la sociedad demandante Desarrollos Urbanísticos Bloque SGRAH DOS BBB S.A. y su apoderada Nombre138412 , los actores tampoco demostraron en esta causa judicial cuál era el diseño constructivo del proyecto que planeaban materializar ni que hayan gestionado, en modo alguno, licencia para construir dentro de los inmuebles de su titularidad; por ende, tampoco habría afectación concreta al derecho que se alega como infringido. En definitiva, el Tribunal estima que los actores no han aportado los elementos demostrativos necesarios que permitan concluir que no pueden utilizar o disponer de su derecho de edificación en los inmuebles que son titulares, conforme a las condiciones propias del Condominio Horizontal Residencial Hacienda Los Bambúes, desarrollada por Urbanizadora La Laguna S.A. Aunado a la inexistencia de licencia constructiva, la actora no ofrece prueba que aporte algún detalle sobre las intenciones de edificación que dice tener o haber tenido, como para poder tener por lesionada alguna expectativa en este sentido.
Desde esa arista de examen, y siendo que no se ubican dentro del ámbito del dimensionamiento dado por la Sala Constitucional en el voto No. 2010-21258 citado, este tipo de aspectos no pueden tenerse como propios de un daño efectivo y lo pedido debe ser rechazado.
XI.La tercera pretensión que se formula es para que se declare responsable a los demandados de la pérdida o disminución del valor de mercado de los terrenos por ellos adquiridos. Conforme a los argumentos formulados en las demandas, en lo fundamental, se reclama el deterioro económico, dicen, se produjo por actuaciones formales e inactividad, concretadas en la modificación al Reglamento de Zonificación del Cantón de Mora, aprobación del proyecto por parte de la Dirección de Urbanismo sin los estudios técnicos, y la actuación omisiva por parte del Estado, ya que si hubiese resguardado a tiempo el área protegida de los Cerros de Escazú, máxime con conocimiento de que particulares ya se encontraban construyendo edificaciones en un área protegida, de alguna manera por su competencia de administración de áreas protegidas, debió poner un alto en el camino o advertir sobre la afectación al medio ambiente, lo cual hubiese conllevado a que los aquí demandantes no ejercieran su decisión de compra, lo cual se agrava por el hecho de que esa normativa tuvo una vigencia aproximada a los nueve años.
Al respecto, debemos insistir en que, conforme lo señalado ut supra, a tono con lo preceptuado por el canon 196 de la LGAP, 41.1. del Código Procesal Civil, 58 inciso e) del CPCA, no basta argumentar sobre la probable existencia de daños, sino que quien reclama un daño debe acreditar su existencia efectiva y la de las causas que lo han producido. Ello implica que atañe a los accionantes acreditar con la solvencia debida, dichos aspectos, como presupuesto impostergable para la procedencia de la indemnización que pretende, la pérdida del valor de mercado de los inmuebles (y los demás daños que se reclaman en la pretensión cuarta) a los que se ha hecho referencia en este fallo. Y en este punto, el Tribunal observa serias deficiencias probatorias que impiden establecer, con la contundencia requerida en estos casos, la supuesta pérdida del valor de mercado de las fincas en cuestión que se alega.
Como primer aspecto, debemos insistir en que en este proceso los accionantes no acreditaron cuál fue el diseño arquitectónico de la vivienda que pensaban construir o, al menos, la que le ofreció la Urbanizadora, ni la zona de intervención en la que actualmente se ubican sus inmuebles. Reiteramos que estos elementos resultaban fundamentales no solo para establecer la eventual inutilización o supresión de su derecho a edificar, sino que también hubieran servido de indicios para establecer si, eventualmente, esos inmuebles han perdido valor en el mercado. Y es que, aún y cuando las condiciones de edificabilidad de los inmuebles propiedad de los actores pudieran haber variado una vez que fue emitido el Plan General de Manejo de la ZPCE; lo cierto es esa sola mutación de condiciones no hace presuponer o inferir, por automatismo deductivo, la existencia del daño económico que expresan los accionantes en la pretensión bajo análisis.
A diferencia de lo que ellos indican, estimamos que no se trata de un daño efectivo en sí mismo, pues la introducción de nuevas condiciones de edificabilidad, que a no dudarlo, inciden en el régimen de explotación y uso del bien inmueble, no genera perse, la pérdida de valor que se aduce. Para sostener la pérdida de valor en el mercado inmobiliario del terreno de marras, sería necesaria la tasación y el análisis de campo que permitiera establecer que atendiendo al momento histórico de adquisición versus la actualidad, cada finca filial tuvo una disminución efectiva y sustancial de su valor. Ahora bien, la única prueba aportada por los accionantes en ese sentido son los Informes de Estimación de Afectaciones, elaborados por la firma Proyectos en Desarrollo S.A. (PRODESA) visibles en el legajo de prueba aportado para el expediente No. 12-002956-1027-CA, así como en las imágenes 250 a 257 del expediente judicial digital escaneado en un único archivo PDF.
Sin embargo, al Tribunal no le merece credibilidad esa probanza por las siguientes razones. De inicio, el informe rendido para cada una las sociedades demandantes señala que “(…) A su solicitud y la del propietario del terreno, hemos procedido a realizar un estudio que nos permitiera estimar el valor del daño o afectación, en términos económicos, producido a raíz de la resolución de la Sala Constitucional, que limita a la Municipalidad de Mora respecto a futuros permisos de construcción en el Condominio Horizontal Hacienda Los Bambúes, ubicado en Calle Cedral, Distrito Colón, cantón de Mora, en la Provincia de San José. (…)”. Como se observa, el informe parte de la premisa de que el daño o afectación económica se produce a partir de la resolución de la Sala Constitucional. Sin embargo, conforme a la teoría del caso introducida en la demanda, la responsabilidad patrimonial que se reclama lo es en virtud de actuaciones y omisiones de los codemandados, alegando como parámetro de imputación el funcionamiento anormal y la conducta ilícita.
No es sino hasta las conclusiones escritas, que la parte actora introduce la argumentación novedosa de que el daño se produce con ocasión de la sentencia de la Sala Constitucional a la que aquí se ha hecho referencia. Sin duda, se trata de un argumento que no solo es sorpresivo sino que además, es extemporáneo, pues se expone cuando ya la litis estaba trabada y las partes demandadas habían ejercido su derecho de defensa. Por ello, ese nuevo argumento no puede considerado por este Tribunal porque insistimos, supondría dejar en indefensión a los coaccionados en esta litis. Nótese que admitir ese nueva causa generadora de la responsabilidad patrimonial que se reclama, supondría introducir el tema de la responsabilidad del Estado-Juzgador, la cual no ha sido alegada (sino hasta las conclusiones por la parte actora) ni ha formado parte de la conducta objeto del proceso establecida durante la audiencia preliminar.
En virtud de lo expuesto, resulta evidente la divergencia que existe entre la causa generadora del daño que establece el informe técnico y la que ha sido debatida por las partes en esta litis, aspecto que por si solo, en nuestro criterio, hace que la probanza en cuestión pierda credibilidad. Pero también existen otros motivos relevantes que, en nuestro criterio, restan credibilidad a la prueba documental referida. El informe señala que “(…) Se llevó a cabo un estudio en la zona cercana a la Hacienda Los Bambúes para determinar el valor actual de mercado de otras propiedades similares. Igualmente, se obtuvieron datos en proyectos un tanto similares, ubicado en Escazú y Santa Ana. Esto, con el fin de obtener un valor estimado de la propiedad en estudio, en condiciones normales de mercado. (…)”; sin embargo, no se aportó el referido estudio ni los datos de los otros proyectos similares que sirvieron de punto de comparación.
Esas hojas de trabajo son indispensables en este tipo de informes documentales a efectos del debido contradictorio y para valorar la información ahí contenida. A esta altura, el Tribunal desconoce cuál zona, proyectos o propiedades similares fueron las que tomó en cuenta la empresa corredora para establecer el supuesto valor de mercado de cada inmueble, insuficiencia que nos impide valorar esa probanza. Los anexos que se adjuntan a cada informe son, en general (y dependiendo de cada sociedad demandante), la tasación del inmueble, certificaciones registrales y plano catastrado de la propiedad, copia de la escritura de constitución y de las acciones de cada sociedad accionante, copia del contrato privado de cesión de acciones, copia del contrato de promesa recíproca de compra venta de lote, copia de la solicitud de compra, copias de recibos de pago a la Urbanizadora La Laguna y tablas de pagos y precios, entre otros.
En algunos supuestos, se adjuntan también las copias de la licencia constructiva y de pago de impuestos. Como se observa, ninguno de esos anexos permite conocer cuáles fueron los parámetros específicos que fueron ponderados para establecer el valor de mercado en condiciones normales y el que se fijó para la actualidad. Por otra parte, el informe menciona que “(…) En la actualidad, las limitaciones que recaen sobre esta finca no le permiten al propietario desarrollarla como originalmente lo planeó.(…)”; pero no sabemos (porque el informe nunca lo señala) cuáles son esas limitaciones ni como planeaba cada propietario desarrollar el inmueble, lo que evidencia la necesidad de que se hubiera aportado el diseño constructivo original, según indicamos ut supra. Finalmente, tampoco indica el informe cuáles son las condiciones actuales que reducen el valor comercial de cada inmueble a un 10% del valor actual de mercado.
Todas esas deficiencias, restan credibilidad al informe rendido e impiden que este Tribunal pueda otorgarle valor probatorio. Cabe agregar que algunas de esas falencias pudieron ser corregidas con la declaración del profesional que rindió los informes o con una prueba pericial que se refiera a estas interrogantes y estableciera si existía incidencia en el precio en mercado inmobiliario que se haya producido respecto de la fincas de las sociedades accionantes en el proyecto Condominio Residencial Los Bambúes, producto del régimen de disponibilidad y edificabilidad fijados por el Plan General de Manejo de la ZPCE, respecto de las condiciones y valor de mercado que ostentaba esa propiedad en el año 2007, considerando, además, por ejemplo, la potencialidad de uso constructivo que en ambos momentos históricos regía. Sin embargo, los demandantes no ofrecieron ese tipo de probanzas técnicas y más bien durante la audiencia preliminar, su apoderado especial judicial desistió de las pruebas testimoniales y periciales inicialmente ofrecidas.
Insistimos en que, conforme al ordenamiento jurídico, la parte actora tiene la carga procesal de probar los hechos que alega. Se trata de una carga que incumbe a las partes y no al juez, máxime cuando lo que se formulan son pretensiones de naturaleza patrimonial y en ese caso, disponibles. Los demandantes no han probado la pérdida del valor de mercado que, afirman, sufrieron sus inmuebles o construcciones, debiendo asumir las consecuencias negativas de su desatención. Olvidan los actores que cuando se pretende la reparación civil, en este caso, por supuestas variaciones de valor en el mercado inmobiliario originadas por actuaciones administrativas, debe acreditarse que ese detrimento realmente se haya producido. No basta la simple alegación de existencia de daño para que este Tribunal pueda suponer su existencia. Tampoco las circunstancias de nuevas reglas de edificabilidad, que suponen un porcentaje de aprovechamiento menor al que fijaba el Reglamento de Zonificación, generan un derecho de indemnización sin acreditar de previo la existencia de un daño económico como el alegado.
Partiendo de que es la parte proponente quien debe procurar sus propias pruebas para la acreditación del daño, su causas (hechos en que sustenta su pedimento) y que los demandantes no ofrecieron ni aportaron prueba alguna que permita a este cuerpo colegiado determinar la existencia del daño que reclama, no podría este Tribunal conjeturar sobre su efectividad o existencia, por lo cual, no queda más opción que disponer el rechazo de la pretensión tercera bajo examen.
XII.Por las mismas razones expuestas en el Considerando previo, debemos rechazar la pretensión cuarta que formulan los actores para el pago de los supuestos daños referidos a la pérdida del valor de mercado de los terrenos adquiridos así como la pérdida del valor de mercado por las construcciones que se origina para las propiedades que tienen construcciones con las supuestas restricciones a la propiedad. En este mismo acápite, se pide también, que se indemnice, a título de daños, la pérdida de los intereses bancarios pagados por financiamiento para compra y pólizas de seguro pagadas desde la compra, las cuotas de mantenimiento del condominio pagadas desde la compra y que se origina por la imposibilidad de uso del terreno; la pérdida por el pago de impuestos pagados desde la compra e impuestos pagados por bienes inmuebles y casas de lujo, los honorarios profesionales pagados para la compra. Todas estas partidas han de ser rechazadas.
Insistimos que a la luz del ordinal 196 de la LGAP, el daño indemnizable ha de ser cierto, lo que supone su acreditación por parte de quien lo reclama, según se desprende del canon 58 inciso e) del CPCA, tema ya debidamente explicado arriba. En consecuencia, los daños no comprobados por quien los reclama, lleva, sin más remedio, a su rechazo. Respecto de esas partidas en concreto, la accionante no aporta elemento alguno que permita determinar la existencia de esos daños. Pese a ello, estimamos que por el fondo tampoco daría cabida a la admisión de esos reclamos. En cuanto a las cuotas de mantenimiento, pago de pólizas y de honorarios profesionales de la adquisición, vale indicar que la pretensión principal planteada radica en el pago de la pérdida de valor comercial, lo que supone que la finca en cuestión permanece dentro del dominio de la actora, razón por la cual no se ve sentido lógico alguno en reclamar el pago de extremos que son propios de la titularidad del bien que, en este caso, se conserva.
En cuanto a los impuestos, ese mismo criterio de impone, aunado a que no todas las sociedades han acreditado que los pagan. Se pide también, el pago de los perjuicios en los intereses perdidos por adelanto del precio y los intereses legales sobre el costo de oportunidad de la inversión. Sobre este aspecto, los demandantes no explica con el detalle de rigor las razones que den respaldo a ese ruego, ni mucho menos las alegaciones que permitan inferir en qué consiste. Esa inadvertencia lleva a su rechazo sin mayor consideración, pues no basta el simple requerimiento indemnizatorio sino debe complementarse con las justificaciones y probanzas de rigor. Por ende, estas partidas deben ser rechazadas, como en efecto se dispone.
XIII.La quinta pretensión es para que se condene a los demandantes al pago de los intereses legales por las sumas de daños y perjuicios y al daño moral ocasionado por la esperanza de compra y adquisición del lote para vivienda que se vio truncada. En relación con el segundo rubro, debemos señalar que las partes no precisaron si lo que se reclamaba era daño moral subjetivo u objetivo y si ese extremo se reclamaba para las sociedades, sus apoderados o ambos. Lo anterior es importante porque el padecimiento moral subjetivo, por generarse en el marco interno de la esfera psico-emocional, solo es posible en las personas físicas, no así en las jurídicas, que constituyen ficciones creadas por el Derecho para constituirse como entes con patrimonios y personalidad autónoma. Ciertamente está creada y pertenece a personas físicas, pero el mismo Derecho crea una distinción en términos de imputación de derechos y obligaciones entre el ente societario y sus socios o accionistas.
Como la presente demanda fue presentada por entidades jurídicas y sus apoderados, es necesario indicar que las primeras no pueden padecer lesiones internas emocionales que pretenden ser tuteladas con el aludido daño moral subjetivo, razón por la cual respecto de ellas este extremo debe ser rechazado de plano. Ahora bien, como no se aporta prueba respecto del daño moral objetivo, también debemos rechazar este extremo en relación con las sociedades demandantes. Respecto de los apoderados de las sociedades actoras y que aquí actúan también en su condición personal, estimamos que el daño moral que se reclama debe, también, ser rechazado. Esta sección ha señalado de manera reiterada que si bien el ordinal 196 de la LGAP permite la indemnización de daños extrapatrimoniales, dentro de ellos, el moral subjetivo, con independencia de que su acreditación sea considerada in re ipsa (pues se puede desprender de las reglas de experiencia humana), es menester de quien lo alega, acreditar las circunstancias de hecho en las que en teoría, se sustenta ese tipo de padecimiento.
Pues bien, tratándose de las personas físicas accionantes, lo cierto es que al haber sido rechazadas las pretensiones declarativas e indemnizatorias, no se acreditó ninguna conducta que sirve de parámetro de imputación del daño reclamado ni se demuestra que se haya visto truncado alguna expectativa en relación con los inumebles. En consecuencia, sin necesidad de mayor abordaje del asunto, debe disponerse el rechazo del padecimiento moral subjetivo alegado. También debe rechazarse el daño moral objetivo porque no se aportó ningún elemento demostrativo que permita constatar su existencia. También debemos rechazar el pedimento dirigido a que se les paguen de los intereses legales por las sumas de daños y perjuicios. Lo anterior dada su accesoriedad y porque, en definitiva, no se ha declarado ninguna condena patrimonial a favor de los actores.
XIV.Finalmente, se pide que se condene a los demandados al pago de las sumas que se liquiden con su respectiva indexación. Se trata de una partida que guarda una evidente relación de accesoriedad con los daños reclamados, de suerte que ante el rechazo de esas partidas principales, la misma suerte y tratamiento ha de aplicarse a esos intereses legales como perjuicios financieros (art. 706 Código Civil).
XV.Sobre la pretensión subsidiaria. Los demandantes formulan una pretensión subsidiaria dirigida a que “Que en virtud de la pérdida de valor de los lotes adquiridos por los demandantes en el Condominio Hacienda Los Bambúes adquiridos por los demandantes, y la imposibilidad de utilización para el fin que fueron adquiridos dichos inmuebles por parte de los demandantes, se ordene le expropiación forzosa a cargo del Estado de esos inmuebles, conforme al articulo 37 de la Ley Orgánica del Ambiente." La pretensión subsidiaria busca como efecto material que este Tribunal disponga u ordena la expropiación de la finca de su propiedad. Para tales efectos, señala que la causa es la pérdida del valor y la imposibilidad de uso para los fines para los cuales fue adquirida. Al tenor de lo ya analizado en lo relativo a las pretensiones principales, no se ha logrado acreditar en la especie que el terreno titularidad de la demandante, perdiera valor en mercado como derivación de la emisión del Plan General de Manejo al que hemos hecho referencia.
Tampoco se ha podido establecer que en los inmuebles de los accionantes no se pudiera ejercer su derecho de edificación o que hayan solicitado permiso de construcción alguno para la edificabilidad en esa franja. Tampoco se aporta en esta causa detalle alguno de diseños constructivos que tuviera la reclamante como para poder concluir que no puede construir lo que en principio, al momento de adquirir el inmueble, tenía por intención o finalidad levantar. A juicio de este Tribunal, esas reclamaciones se sustentan en conjeturas y suposiciones que no logran ser demostradas, y en esos términos, no pueden ser base objetiva de consecuencias jurídicas reparatorias o de otra índole. Desde esa óptica, la expropiación que se reclama debería sustentarse en la indisponibilidad del bien o en la disfuncionalidiad sustancial de esa filial, acorde a lo que se desprende de los ordinales 13 y 17 de la Ley de Expropiaciones, No. 7495, reformada integralmente por la Ley No. 9286. Pero, tales circunstancias no se producen en este caso, por lo que debe disponerse el rechazo de esa pretensión subsidiaria.
XVI.Sobre las defensas opuestas. El INVU, el SINAC y la Municipalidad de Mora opusieron, en ambas demandas, las excepciones de falta de legitimación en su doble modalidad, falta de interés actual y falta de derecho; mientras que el Estado solo opuso esta última. La defensa de falta de legitimación activa debe ser rechazada pues la demanda se formula por los titulares de la situación jurídica cuya tutela se pretende. La acción se sustenta en el ordinal 10 inciso 1) supuesto a) del CPCA. Lo mismo ha de indicarse respecto de la legitimación pasiva acusada. La demanda se direcciona contra las Administraciones Públicas a las cuales se ha imputado las causas del daño reclamado, por lo que, el vínculo con el objeto del proceso se deriva del ordinal 12 incisos 1 y 2 del CPCA. La falta de interés actual debe rechazarse siendo notoria la actualidad y vigencia del objeto debatido. Pero, por lo expuesto en este fallo, debe acogerse la defensa de falta de derecho que opusieron todos los demandados al no haber demostrado la existencia de ninguno de los daños y perjuicios reclamados. Las alegaciones (que no defensas) de culpa de la víctima y hecho de tercero resultan de innecesario abordaje por haberse acogido la defensa de falta de derecho.
XVII.Sobre las costas. De conformidad con el numeral 193 del CPCA, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, es criterio de este Tribunal, no se observa criterio alguno que permita aplicar la dispensa en la condenatoria en costas, en la medida en que las pretensiones indemnizatorias formuladas fueron desestimadas por la ausencia de elementos de convicción que permitieran la acreditación de las lesiones reclamadas. Ergo, deben ser impuestas a la parte promovente vencida. En el caso del Estado y el SINAC, sobre las costas, deberán cancelarse los respectivos intereses que se generen a partir de la firmeza de la resolución que fije su cuantía y hasta su efectivo pago, al tipo legal que establece el artículo 1163 del Código Civil. Estos extremos se liquidarán en ejecución de sentencia.
POR TANTO
Se rechazan las defensas de falta de legitimación activa y pasiva, así como la de falta de interés actual opuestas por el Instituto Nacional de Vivienda y Urbanismo, la Municipalidad de Mora y el Sistema Nacional de Áreas de Conservación. Se acoge la excepción de falta de derecho que formulan tanto el órgano y entes demandados indicados como el Estado. En consecuencia, se declaran sin lugar las demandas formuladas en todos sus extremos. Son ambas costas a cargo de los actores vencidos. Respecto del Estado y el Sistema Nacional de Áreas de Conservación, las costas deberán cancelarse junto con los respectivos intereses que se generen a partir de la firmeza de la resolución que fije su cuantía y hasta su efectivo pago. Estos extremos se liquidarán en ejecución de sentencia.
