RESPONDENT: MUNICIPALIDAD DE ESCAZÚ N° 403 -2019 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SECCIÓN TERCERA. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, Dirección200 . , at nine thirty-five on treinta y uno de julio del año dos mil diecinueve.- This Court hears, as the non-hierarchical reviewing authority (jerarca impropio), the appeal (recurso de apelación) filed by INMOBILIARIA MELY S.A., corporate identification number CED83375, represented by Nombre106307, holder of identity card CED83376, against decision DAME-189-16 issued at 10:25 on 2 de noviembre del 2016 and signed by the ALCALDE MUNICIPAL DE ESCAZÚ.- Drafted by Judge Chaves Torres; and,

WHEREAS:

I.Background. For purposes of rendering a decision, the following is deemed duly established:

  • 1)On 9 de julio del 2015, the Unidad de Gestión Hídrica del Sistema Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), through official letter N°UGH-237-15, responded to the inquiry submitted by Nombre106308 concerning the delineation of the protection perimeter (perímetro de protección) of two springs (nacientes) located in San Antonio de Escazú; and determined that the “...site where the construction of 7 single-family dwellings (one on each property) is proposed is located in an area of medium intrinsic vulnerability to aquifer contamination (...) 4. The properties under review, identified by cadastral plans SJ-1155669-2007, SJ-1156354-2007, SJ-1156352-2007, SJ-1156353-2007, SJ-1155671-2007, SJ-1162473-2007 and SJ-1169425-2007, are all located within the protection zone (zona de protección) having a radius of 100 m established in article 33 of the Ley Forestal; nevertheless, the development of the specified lots is not expected to pose a risk of contamination to springs NAC-3709 and NAC-3710, in terms of either the quantity or quality of the springs’ water, because they are located outside the springs’ effective protection perimeter or the underground flow tube (tubo de flujo subterráneo) that feeds them, as indicated in figure 6 of the hydrogeological study (estudio hidrogeológico) submitted...”. (See image 36).
  • 2)On 27 de setiembre del 2016, the Proceso de Contraloría Ambiental del Municipio de Escazú, in response to a request by the appellant for a study concerning the impact on springs, rivers, streams, wells, or their corresponding protection areas (áreas de protección), determined through official letter CA-0644-2016 that, on the property described in cadastral plan SJ-1156353-07 and owned by Inmobiliaria Mely S.A., the following must be observed: “...the protection area of the Río Agres and of the springs, as prescribed by the Ley Forestal, the Ley de Aguas, and related case law, as well as obtaining the corresponding setback (retiro) from INVU. Those setback areas must be marked off on the land with plastic tape, stakes, or rope and must retain vegetation cover (cobertura vegetal), meaning that they must be reforested and kept free of all waste. NOTE: With regard to the springs, you are reminded that article 33 of the Ley Forestal has not been repealed; therefore, the protection area of 100 must be observed, as indicated in official letter N°UGH-237-15 SENARA, point 4. It is further clarified that flow-tube studies do not provide an exemption from that requirement...”; this determination was made in consideration of the position expressed by the Dirección de Aguas del MINAE in official letter AT-3218-2015. (See image 26).
  • 3)On 10 de octubre del 2016, the Ayuntamiento de Escazú received a formal appeal against act CA-00644-2016, requesting that “...any precautionary measure (medida cautelar) encumbering the property in relation to the 100-meter radius around the specified springs be lifted, because there is no forest here, which is what ley 7575 regulates, and that is not our case because we are in an urban area and the statutory prerequisites for being subject to a forestry regime (régimen forestal), as provided by ley 7575, have not been met. 2. That, because the unequivocal scientific Hydrogeological Study endorsed by SENARA must prevail, the radius or flow tube shall be applied in accordance with art. 33 of ley 7575, given that it is the ENTITY with jurisdiction over the subject matter and authority to regulate the boundaries. 3. That the protection zone of the Río Agres be maintained in all respects exactly as established by law. 4. That, if the municipal position regarding the need to establish a protection zone is maintained, the protection zone under article 149 of the ley de aguas be established, as it is the least detrimental to private interests...”. (See images 7 to 25).
  • 4)On 2 de noviembre del 2016, the Alcalde de Escazú, through decision DAME-189-16, decided to deny the appeal, reasoning, in summary, that the appellant’s property is affected by the spring specified in official letter CA-0644-2016 and that MINAE, as follows from Ley N°276, rather than SENARA as asserted by the appellant, is the governing authority for water resources. The decision adds that SENARA is obligated to “...provide technical advice to private parties and institutions through technical studies conducted by a specialized office; however, this does not mean that the so-called technical studies of spring tubes or flows included in the case file have the effect of reducing or releasing the areas that the law designates as a ‘reserved domain’ (reserva de dominio) in favor of the nation, or of reducing the areas in which the law prohibits tree cutting and whose purpose is precisely to safeguard the quality and quantity of the water resource. Accordingly, official letter CA-0644-2016 issued by the Contraloría Ambiental is consistent with the spirit of the provision, and such restriction notices protect that vital resource...”. In support thereof, it relies on articles 3 and 7 of Ley 6877 (SENARA’s functions), article 31 of the Ley de Aguas (concerning the public domain), article 50 of the Constitution, articles 33, 34 and 58 of Ley 7575, article 90 of the Ley de Conservación de la Vida Silvestre, and the principle of non-regression in environmental matters (principio de no regresión en materia ambiental) developed by the Sala Constitucional. For that purpose, it quotes decision 2014-012887 as follows: “...A protected area may be reduced only by law, if technical and scientific studies rule out environmental harm, and if the eliminated area is compensated for with another area of equal size. This follows from what this Chamber has held on prior occasions in decisions numbers 2012-13367 and 2009-1056...”. It adds that a technical study of a spring’s flow tubes has the capacity to identify the direction of the flows feeding the aquifer and makes it possible to determine, with greater technical precision, the area that must be protected more rigorously to guarantee the quality and quantity of the water resource; at the same time, it also makes it possible to identify the area surrounding the spring where less stringent protective measures may technically be applied while still guaranteeing due protection of the water resource. Nevertheless, consistently with the foregoing, it follows from the facts underlying the appeal that the proposed project would be a single-family dwelling within the 100 meters established by the Ley Forestal; therefore, within that area, section 34 of the Ley Forestal establishes a prohibition against carrying out any activity intended to cut down trees, which affects the water resource that enjoys constitutional protection (...) Consequently, the appellant’s first, second, third, fourth, ninth, eleventh, and twelfth arguments in the legal analysis appearing in part at folio 3 of the case file are without merit insofar as it asserts that the applicable provision is article 149 of Ley de Aguas N°276, because, as explained, the application of article 33 of the Ley Forestal protects permanent springs (...) and therefore the provision must not be interpreted solely according to its text, as the appellant would suggest, but rather in light of the context it is intended to regulate...”. (See images 208 to 225).
  • 5)On 11 de noviembre del 2016, the representative of Inmobiliaria Mely S.A. filed with the Municipalidad de Escazú a motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio) against the decision described in the preceding fact; accordingly, once the reconsideration challenge (impugnación horizontal) was denied, the matter was referred to this Court for adjudication of the corresponding appeal. (See images 227 and 253).-

II.Grounds for appeal (motivos de agravio). In summary, the appellant argues that it can find no legal justification or reasoning that categorically supports applying a forestry regime to an urban area. It adds that the land falls outside the scope of ley N°7575 because that law was enacted to protect natural forests and its property is not subject to a forestry restriction (limitación forestal). It states that its land is not a public-domain reserve under article 31 of the ley de aguas because it is not a forest area and contains no drinking-water intakes. It adds that there are no scientific studies showing that the land is of public interest for the protection of wildlife species under article 2 of Ley N°7575 so as to materially preclude the construction of dwellings. It states that article 149 of the Ley de Aguas must be applied to protect springs located outside the forest or the Régimen Forestal. It further asserts that the administrative case file (expediente administrativo) contains scientific evidence that the work to be carried out on its land will neither diminish the springs’ flow nor contaminate them in any manner.

III.On the appeal. Based on a detailed analysis of the arguments presented by the representative of the appellant company and of the challenged decision, this Chamber considers that the subject matter of the challenge centers on the appellant’s disagreement with the application of the restrictions established in the Ley Forestal to its property, described in cadastral plan Placa18829, due to the existence of two permanent water springs, whose existence was established by the Dirección de Aguas in official letter AT-32-2015 and is not in dispute. Accordingly, and pursuant to section 181 of the Ley General de la Administración, this Court, acting as a non-hierarchical reviewer of legality (contralor no jerárquico de legalidad), will address each of the grounds raised in the appeal. Within this jurisdictional framework, and in light of the lack of precision shown by both parties, it is important to address the legal regime governing the protection of springs, which provides for different scenarios that share the establishment of an area surrounding them to which the corresponding legal protection applies.

The legal “system” provides for several scenarios governing the protection of areas adjacent to water springs. These different regimes are intended to prevent human activities from degrading the areas adjoining water springs; some have as their principal purpose the protection of water resources and the potability or purity of water, while others protect various natural resources, including water. To proceed in an order reflecting the degree of impact on property rights, the analysis must begin with the legal regime having the greatest repercussions on those rights, namely that contained in sections 31 and 32 of Ley de Aguas N° 276 del 27 de agosto de 1942, which provides:

“Article 31.- The following are declared reserved domains in favor of the Nation:

  • a)Lands surrounding drinking-water catchment sites or supply intakes, within a perimeter having a radius of no less than two hundred meters; b) The forest zone that protects or must protect all lands where potable water infiltration occurs, as well as those encompassing watersheds and reservoir banks, supply sources, or the permanent course of such waters.

Article 32.- When, in an area larger than that indicated above, there is a risk of contamination of either surface water or groundwater, the Executive Branch, through the Potable Water Section referred to in the following article, shall order such measures in that area as it deems appropriate to prevent the risk of contamination.” As may readily be inferred from the provisions transcribed above, the legislature chose to remove from private ownership all areas within a 200-meter radius of springs (nacientes) that have “potable-water supply intakes (tomas surtidoras de agua potable)” and are supplying a population, with the principal object of protecting water resources. Regarding this particular encumbrance (afectación) on lands surrounding springs that meet those characteristics, this Court, in Decision N°229-2018 of May 31, 2018, had the opportunity to analyze its requirements and consequences—expropriation or liability of the Administration—and held “...that the declaration of ownership referred to must be understood as artificial public domain (dominio público artificial), insofar as such property consists of ‘assets declared public by the legislature but whose creation or existence depends on a human act (the construction of a street or public park, for example),’ as stated by the Sala Constitucional in the precedent transcribed above.

In this regard, for this situation to arise, the potable-water collection infrastructure or supply intake must be installed; only at that point could the issue of whether the property—or at least the portion affected by that provision—is public-domain property (demanialidad) be analyzed....” For this reason, the provisions of Article 31 of the Ley de Aguas are indeed inapplicable to the property of Inmobiliaria Mely S.A., because an essential element is absent: a potable-water supply intake at the spring, a fact that is not in dispute. Furthermore, there are protection areas (áreas de protección) around springs that constitute limitations alone, which constitutional case law recognizes as legitimate and generally applicable to the right of private property; they serve an overriding public interest through reasonable, useful, and appropriate criteria and, accordingly, have been held not to require prior compensation (Articles 45, paragraph 2, and 50 of the Constitution; constitutional judgments 3173-93, 4205-96 and 7137-2007; opinions C-42-99 and C-148-2012).

They form part of the protection afforded by the legal system to natural resources essential to life; in other words, they result from balancing several fundamental rights. Within this framework, Chapter IX of the same Ley de Aguas N°276, entitled “Measures concerning the conservation of trees to prevent the reduction of water,” provides general protection for water resources originating from springs. Unlike the preceding regime, however, ownership is not removed from the private domain (dominio privado), as follows:

“Article 148.- Owners of lands crossed by rivers or streams, or of lands on which springs exist and where the forests that sheltered their banks or surrounding areas have been destroyed, are required to plant trees along the banks of those rivers, streams, or springs, no more than five meters from such waters, throughout the entire stretch and course located within the respective property.

Article 149.- It is prohibited, in both national and privately owned forests, to destroy trees located within sixty meters of springs originating in hills or within fifty meters of those originating on level ground.

Article 150.- It is prohibited, in both national forests and privately owned lands, to destroy trees located within five meters of rivers or streams flowing through such properties.” The appellant argues that Article 148, transcribed above, should be applied to her, but she refers to the fifty-meter setback (retiro) contained in Article 149. This Court therefore understands her argument to refer to the latter provision. It should be emphasized that this provision unquestionably concerns protective measures designed by the legislature primarily to safeguard water flowing from springs, the term being understood as “1. adj. That flows or springs forth. Flowing water, spring source. 2. m. Source of waters.” (online consultation of the Diccionario de la lengua española, tricentennial edition updated to 2008, https://dle.rae.es/?id=O7aXamT). In other words, the provision considers the forests and trees located within 60 or 50 linear meters of springs necessary for protecting water resources and therefore establishes a limitation on private property to prevent encroachment upon that area (a systematic interpretation of Articles 148, 149 and 150). Failure to comply results, among other consequences, in the fine established in Article 165 of the same body of law, by reference from Article 151, which provides as follows:

“Article 151.- A violation of the preceding articles requires the offender to replace the trees destroyed and subjects the offender to the penalty established in Article 165 of the following chapter. In addition, the violation shall constitute sufficient grounds to proceed with the expropriation of the strips of land having the widths specified in the preceding article, on either or both sides of the river’s or stream’s course, throughout its entire length.” In sum, such protection was established for all springs (nacientes), regardless of their characteristics (with or without a drinking-water intake), or the frequency of flow from the water-resource source (intermittent or permanent) (in this regard, reference may be made to Voto 9221-2019 issued by the Sala Constitucional at 11:41 hours on 22 de mayo del 2019), insofar as springs (manantiales) that emerge naturally from the ground are public-domain waters (aguas del dominio público), based on a systematic interpretation of subsection IV of Article 1 and Article 3 of the oft-cited Ley de Aguas de 1942.

In this regard, there are consistent precedents issued by both the Sala Primera de la Corte Suprema de Justicia, in vote 858-F-S1-2012, at 9:20 hours on 20 de julio de 2012, and the Sala Constitucional, in vote number 2010-8315 at 8:45 hours on 7 de mayo de 2010, in which the sixty-meter protection radius was applied to intermittent springs. To that effect, the Sala Primera held in the aforementioned vote: “III.- Section 149 of the Ley de Aguas is contained in Chapter Nine of that law, entitled ‘Measures Concerning the Conservation of Trees to Prevent the Depletion of Waters,’ which, as its name indicates, seeks through the provisions contained therein to ensure that state authorities oversee ‘(…) strict compliance with the legal provisions concerning the conservation of trees, especially those along riverbanks and those located at water sources’ (section 145 ibidem), in order to prevent the depletion of waters.

In this regard, the referenced section provides: ‘The destruction, in both national and privately owned forests, of trees located less than sixty meters from springs originating in hills, or less than fifty meters from those originating on flat land, is prohibited.’ As can be seen, the provision does not distinguish between permanent and intermittent springs, and therefore no such distinction may be made when applying it. This is a typical public-interest restriction (limitación de interés público) (Article 45 of the Constitución Política), which, like others established in various statutory instruments within the legal system, has developed the concept of limitations on private property in pursuit of genuine and effective protection of the constitutional guarantee (Article 50 of our Constitución Política) of a healthy and ecologically balanced environment. Nor does the provision distinguish between public-domain waters and private-domain waters (aguas de dominio privado).

The provision refers only to waters, that is, to the water resource in general, and therefore the citation of Articles 1 through 4 of Law no. 276 is not relevant to this case. Accordingly, this Chamber does not consider that the Court violated the section alleged to have been erroneously interpreted and applied when it found that intermittent springs are indeed legally protected.” From the foregoing follows the legal recognition afforded by national case law to the protection of intermittent water outcrops (afloramientos hídricos) under section 149 of the Ley de Aguas, as opposed to permanent springs, which, in addition to that safeguard, are subject to an even stricter protective regime under Ley Forestal N°7575. Regarding this difference in the treatment of springs according to their frequency, the Sala Constitucional, in Voto N°09221-2019 at 11:41 hours on 22 de mayo del 2019, clarifies the following: “...Thus, it is clear that considering water an essential resource and a fundamental right necessarily entails protecting its sources and catchment areas (áreas de captación), which include underground and surface aquifers, as well as springs, wells, and other areas where the water resource is located and made available.

This protection entails establishing what are known as protection areas or perimeters (áreas o perímetros de protección), such as that specified precisely in subsection a) of Article 33 of the Ley Forestal, which, as noted, establishes a 100-meter protection radius for permanent springs. This protection area may vary—and ordinary legislation does in fact so provide—if the spring is not permanent but is instead intermittent or non-permanent. This does not mean that such springs receive no protection whatsoever, but rather that the radii of their protection areas may vary as determined by the regulations and the responsible technical bodies. In other words, the regulations and case law recognize the importance of and need to protect springs, hence the definition of the radii of their protection areas, whose extent varies depending on the type of spring involved, precisely because the applicable protection-area radius will depend on the type of spring.

This does not, per se, create any unconstitutional situation because, as correctly stated in the precedent cited, the particular conditions of each type of spring—aquifer, well, and others—define the specific conditions of protection, such that protection areas are specifically defined according to the type of spring, water table, or well involved. In this regard, determining whether a spring is permanent or non-permanent falls within the authority of the Administration’s technical bodies and, in accordance with their respective areas of jurisdiction, would be a matter for the Dirección de Aguas del Ministerio del Ambiente y Energía, in close coordination with other related bodies such as the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento and the Instituto Costarricense de Acueductos y Alcantarillados. This determination must likewise be observed even by municipalities when preparing the corresponding regulatory plans (planes reguladores) and when granting or denying the respective land-use permits (permisos de uso de suelo)...” In the present case, there is no dispute that the springs located on the appellant company’s property are permanent.

The appellant’s representative is therefore incorrect in arguing that only the setback (retiro) under section 149 of the Ley de Aguas should apply; rather, their protection extends further, as the Municipality stated in the challenged act (acto impugnado).

IV.In this connection, and with respect to permanent springs, it must be acknowledged that Ley Forestal N°7575 does indeed establish a special protection regime for forest resources, which unquestionably extends to water resources emerging as springs. This can readily be inferred from Article 1 of that law, which establishes as its principal objective the “...conservation, protection, and administration of natural forests and the production, harvesting, industrialization, and promotion of the country’s forest resources intended for that purpose, in accordance with the principle of the proper and sustainable use of renewable natural resources...” In other words, that statutory instrument is governed by a conservation principle concerning forest resources, which, in light of the rules of experience, entails the direct or indirect protection of water resources as an essential input for forests and trees.

There is therefore mutual legal protection of both natural resources—given their actual interdependence—because, as noted above, the Ley de Aguas directly protects trees and forests to prevent the depletion of waters, while the Ley Forestal protects the spring and its surrounding recharge area (área de recarga) in order to fulfill the purpose of preserving forest resources. It is in this context that section 33 of the Ley Forestal, which declares the existence of a protection area around permanent springs and their recharge areas, must be understood and interpreted. More specifically:

“ARTICLE 33.- Protection areas. The following are declared protection areas: a) Areas bordering permanent springs, defined within a radius of one hundred meters measured horizontally. b) A strip of fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both sides along the banks of rivers, ravines, or streams if the terrain is flat, and fifty horizontal meters if the terrain is steep. c) An area of fifty meters measured horizontally along the shores of natural lakes and reservoirs and of artificial lakes or reservoirs constructed by the State and its institutions. Privately owned artificial lakes and reservoirs are excluded. d) Recharge areas and the aquifers of springs, whose boundaries shall be determined by the competent bodies established in the regulations to this law.” It should be noted that the preceding article unequivocally declares a protection area with a radius of one hundred meters, measured from the location of the permanent spring.

This is the first difference from the protection established in section 149 of the Ley de Aguas, namely, the distance and the manner in which that reserved area (área reservada) must be measured. This entails applying the special provision over the general provision; the two are therefore mutually exclusive, and the former applies. A different situation arises with the protection established in the Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones, which refers to permanent springs, but whose protected area is subsumed within the one-hundred-meter radius established by the Ley Forestal in the oft-cited Article 33. More specifically, that regulation provides:

“...III.3.7.6 If a permanent watercourse originates within an area to be developed, the springhead (ojo de agua) shall be protected within a minimum radius of 50 meters, an area in which no works may be constructed except those intended for the use of the water. This area may be included within the percentage to be transferred to the Municipality for public use, in which case it shall be designated as a park...” For its part, regarding the restrictions applicable to that area, section 34 of the Ley Forestal establishes a prohibition very similar to that contained in the Ley de Aguas, as follows:

“ARTICLE 34.- Prohibition on felling in protected areas. The cutting or removal of trees within the protection areas described in the preceding article is prohibited, except for projects declared by the Poder Ejecutivo to be of national interest (conveniencia nacional). Any boundary alignments (alineamientos) that must be processed in connection with these areas shall be performed by the Instituto Nacional de Vivienda y Urbanismo.” It should also be emphasized that this section 34 grants the Instituto Nacional de Vivienda y Urbanismo jurisdiction to establish the setback line (alineamiento) for such protection areas (áreas de protección); therefore, the Municipality would act improperly by conducting measurements or determining locations before the administrative procedures for building permits (licencias constructivas) or when issuing land-use certificates (certificados de uso de suelo), since jurisdiction has been assigned by law to another public entity.

Accordingly, the administrative jurisdictions conferred by law upon both institutions must be respected; at most, inter-agency coordination (coordinación intersubjetiva) could be established. This would entail having the INVU issue the final administrative act (acto final) concerning the encumbrance of the protection area upon the property owned by the appellant company, thereby allowing it to be challenged during the administrative stage or directly before the administrative-law court, without first having to exhaust administrative remedies. Once that setback-line determination has been issued as a prerequisite, the Municipality has no alternative but to grant the application pursuant to section 146 of the Ley General de la Administración Pública and the mandate of Ley N°8220. A very similar situation arises with the setback line issued by the MOPT for property fronting a national road before a municipal permit is granted.

The Ayuntamiento de Escazú is fully aware of this circumstance; indeed, in the act initiating the sequence of appeals—OFICIO CA-0644-2016—the Contraloría Ambiental advises the appellant that it must process “...the corresponding setback before the INVU...”. Along these lines, by ruling solely that the appeal was denied in the challenged decision—DAME 189-16—the Alcalde unquestionably confirmed an interlocutory act without independent effect (acto de trámite sin efecto propio) upon the appellant’s legal rights. In this regard, it must be recalled that this Chamber hears an appeal within the context of an administrative proceeding (procedimiento administrativo) which, although regulated in certain specific respects by the Código Municipal, is also subject to the provisions of the Ley General de la Administración Pública, hereinafter “LGAP” (and, supplementarily, the Código Procesal Contencioso Administrativo), regarding matters that the legislature has not expressly regulated in the Código Municipal, which constitutes the lex specialis in this field.

With respect to challenging decisions issued by the Alcalde Municipal, the Código Municipal does not specify whether every formal administrative action may be challenged on appeal. In this regard, as concerns so-called interlocutory acts without independent effect, the Código Municipal does provide that agreements of the Concejo Municipal may not be challenged; nevertheless, the absence of an express provision on this issue in that code should not be understood as authorizing litigants to challenge each and every procedural action issued by either the Alcalde or subordinate bodies. Accordingly, the Código Municipal, which is silent on the matter under review, must necessarily be supplemented by the Ley General de la Administración Pública. Consistent with jurisprudential and scholarly developments in this field, that applicable statute also restricts separate challenges to “interlocutory acts” (actos de trámite) or “preparatory acts” (actos preparatorios) when they have no independent effect.

It must be clarified here that such acts, regardless of the municipal body issuing them, are not immune from judicial review or hierarchical review at the administrative level (where available); rather, the legislature established that they may be challenged only when the “final” or “definitive” administrative action, for whose preparation they form part of the procedural course, is challenged, unless otherwise provided by law. Regarding the aforementioned bar against challenges, the Ley General de la Administración Pública clearly provides: “Article 342.—The parties may appeal decisions that are merely procedural, incidental, or final, under the terms of this law, on grounds of legality or expediency.” “Article 163.—(...) 2. Defects inherent in preparatory acts shall be challenged together with the act, unless those preparatory acts are themselves acts having independent effect.” Having established that interlocutory acts cannot be challenged before this instance by virtue of the express wording of the provisions just transcribed, it is appropriate to note that although Article 342 permits challenges on grounds of expediency, this provision refers to vertical challenges before natural hierarchical superiors.

With respect to this Chamber, however, because it is a nonhierarchical legality-review body, the express terms of Article 181 of the same LGAP preclude the submission of arguments based on expediency. In this specific case, the Chamber unquestionably finds that the act giving rise to the chain of appeals—namely, the official communication from the Contraloría Ambiental—is merely an interlocutory act, as it simply informs the appellant company of the existence of the springs (nacientes) recognized by the competent body, namely MINAE, and that it must therefore request the setback-line determination from the INVU. Only after satisfying that requirement may the appellant company return to the Municipality to complete the process for obtaining the building permit. Its separate challenge is therefore improper because it is premature (Voto N°4072-95 del 21 de julio de 1995 dictado por la Sala Constitucional), which renders the appeal inadmissible.

V.Without prejudice to the foregoing, given the importance of the subject matter of the appeal, this Tribunal considers it appropriate to continue clarifying the arguments presented by the appellant’s representative. In this regard, there is extensive case law from the Sala Constitucional and numerous opinions from the Procuraduría concerning the application to urban properties of the restrictions established by the Ley Forestal (see, in this regard, judgments 2019-04901, 2011-001745, 2014-012913, 2004-1923, and opinion C-318-2017 del 19 de diciembre del 2017). In the specific case of the Cantón de Escazú, its Plan Regulador, published in la Gaceta N°23 del 3 de febrero del 2005, creates a “Water-Source and Riverbank Protection Zone (Zona de Protección de Fuentes de Agua y Riberas, ZPFAR),” which incorporates the protection area for permanent springs established by the Ley Forestal as part of the land-use restrictions throughout the canton, without exception, and classifies “all types of construction works” as a nonconforming use (uso no conforme). Consequently, the appellant company’s argument that this protection area is supposedly inapplicable because the property is located in an urban area is clearly incorrect in the case of the Cantón de Escazú. The relevant provisions are transcribed below:

16.3. Water-Source and Riverbank Protection Zone (Zona de Protección de Fuentes de Agua y Riberas, ZPFAR).

16.3.1. Definition.

Pursuant to Ley 7575, Article 33, subsections a, b, and d, and the Ley Forestal in Articles 33 and 34, for the purpose of regulating construction and preserving and improving the condition of Escazú’s water resources, the following are defined as protection zones for water sources and riverbanks: a. Areas surrounding permanent springs, defined by a radius of one hundred meters measured horizontally. (...)

16.3.2. Conforming uses (usos conformes).

a. Conservation of water resources.

b. Reforestation.

16.3.3. Conditional uses (usos condicionales).

a. Infrastructure for the utilization of water resources.

b. Basic infrastructure for safety within the area, such as trails, lighting, and other facilities.

In urban areas, work on river-channel walls may be authorized, subject to prior approval by the Oficina de Desarrollo Urbano and the Contraloría Ambiental de la Municipalidad of the hydrological study for the channel to be modified and its design.

16.3.4. Nonconforming uses.

a. All types of construction works not specified under conforming and conditional uses.

b. Billboards.” (Emphasis not in the original) This land-use planning provision (norma urbanística) is consistent with the concept of a protection area described in the Ley Forestal, which is broader in scope than the prohibitions established in the Ley de Aguas; indeed, it even establishes a criminal offense under which liability may be sought against anyone who violates this prohibition, as follows:

“ARTICLE 58.—Penalties. A term of imprisonment of three months to three years shall be imposed upon anyone who: a) Encroaches upon a conservation or protection area, regardless of its management category, or upon other forest areas or lands subject to the forestry regime (régimen forestal), regardless of the area occupied and irrespective of whether the lands are privately owned by the State or other public administrative bodies or are privately owned. The perpetrators of or participants in the act shall not be entitled to any compensation for any construction or works they may have carried out on the encroached-upon lands.” In this Court’s view, the transcribed article supplements the limitations imposed on owners in section 33 of Ley N°7575 (as recognized by the Constitutional Chamber in Voto N°74-2010 del 6 de enero del 2010), since it includes the verb “to encroach” (invadir), a concept that has been interpreted broadly in the case law of the highest Criminal Cassation Courts. By way of example, the following three excerpts are transcribed:

  • 1)“...For those acts, the court below convicted the accused of the offenses of Violation of the Ley Forestal, in the form of encroachment upon a river protection area (área de protección), Disobedience to Authority, and Usurpation of Public-Domain Property, in material concurrence (concurso material), to the detriment of Natural Resources and Public Authority, sentencing him to a total of two years and six months’ imprisonment and granting him the benefit of a suspended sentence (condena de ejecución condicional) for a period of three years (front of folio 136). Regarding the foregoing legal classification, it states that the accused committed the three offenses at different times: ‘first, the offense of disobedience to authority was committed on 29 de abril del 2011, when a public official notified him of a precautionary measure (medida cautelar) ordering suspension of the construction of the dwelling and the accused disregarded the issued order; subsequently, encroachment upon the protected area corresponding to the property located along the bank of the río limoncito, which belongs to the State, was established; and, finally, he himself usurped and possessed the property without the respective permits to do so, making use of the property in question.’ (back of folio 132 and front of folio 133). It further states that there is a causal relationship between the action carried out by the accused and the resulting outcome, since he violated the rules and guidelines and impaired the legally protected interests (bienes jurídicos) established by the legislature through the commission of the offenses established in the judgment (...) The legally protected interest safeguarded by this criminal provision is the ‘environment’; more specifically, and as relevant to the dispute concerning the factual framework established in the judgment, it protects water resources (recurso hídrico), since reference to encroachment upon a protection area—whether private or state-owned and regardless of the area occupied—means the protection areas of rivers, gullies, streams, etc., as defined in the referenced section 33.b) of the Ley Forestal. Indirectly, the cited provision also protects State property insofar as it is, in fact, under State protection. Under the formulation of the offense (tipo penal) under consideration, the verb ‘to encroach’ is not legally defined in the Ley Forestal or its regulations, and its meaning must therefore be sought in other sources. The case law of this Chamber has so indicated, stating that, ‘According to the Dictionary of the Real Academia Española, invadir is understood as “1. To burst into or enter by force; 2. trans. To occupy a place abnormally or irregularly. The waters invaded the highway; 3. trans. Said of a thing: To enter and spread through a particular place or medium....” Thus, the conduct penalized by subsection a) of article 58 of the Ley Forestal is occupying or entering a conservation or protection area, regardless of whether the land is state-owned or private, and even includes making “improvements” to the site (for which the encroacher will not be reimbursed), as stipulated by the same provision. In other words, encroachment entails acts of occupation of the site, which take the form of settling there and exercising control over it.’ (Criminal Cassation Chamber, resolution Nº 2016-01131, at 15:40 hours, del 25 de octubre del 2016). In light of the foregoing, the act of encroachment may consist either of bursting into or forcibly entering a site, or of occupying it abnormally or irregularly. This is logically consistent with the civil consequences of the criminal conduct prescribed by that subsection, which bars any claim for compensation due to the loss or demolition of any structure or work built at the site, although the latter provision might actually be considered superfluous, given that the State has no obligation to recognize the ‘improvements’ made by a person who illegally encroached upon the protection area, with the resulting harm to the ecosystem...” (Criminal Cassation Chamber, Voto N°263-2018 del 30 de abril del 2018).
  • 2)“...The punishable conduct is the exploitation of forest resources (aprovechamiento del recurso forestal). Such exploitation consists of the ‘Act of cutting or removing standing timber trees, or using fallen trees....that generates or may generate some advantage, benefit, gain, utility, or profit...’ (article 3. a) of the Ley Forestal). It has been understood that an economic advantage is not required, in view of the various possibilities contemplated: ‘As stated above, offenses involving forest exploitation do not necessarily require an intent to profit, understood as the intention to obtain or the actual receipt of some type of benefit that can be expressed in economic terms. To the contrary, the definition of timber exploitation (aprovechamiento maderable) in article 3, subsection a) of the LF broadens the circumstances in which the offense may be established, requiring only that the perpetrator, or the entity represented by that person, obtain some advantage, benefit, gain, utility, or profit. These elements do not necessarily entail the sale of the timber or an economic aspect generally. Many other advantages may result from exploitation; for example, the advantage of removing an obstruction that blocked the scenery or view, clearing the land for subsequent planting or construction, or reducing forest density so that the land will not qualify as forest and a clear-cutting permit (permiso de tala rasa) may thereby be obtained, among others’ (González Montero, José Pablo. Manual de Delitos Ambientales, Escuela Judicial, 2007, page 267) (Tribunal de Casación Penal de San Cruz, Voto N°175-2010 del 30 de julio del 2010).
  • 3)“...It should be noted that the concept of ‘encroachment’ contemplated in section 58 subsection a- of the Ley Forestal has been addressed in the case law of this Court. In this regard, it has been held that the criminal conduct established by section 58.a- of the Ley Forestal consists of encroaching upon a conservation or protection area, but the term does not mean dispossessing another person or entering another person’s property. Because conservation areas impose a general limitation on every owner of real property through which the rivers of Costa Rica flow, encroaching upon the protection area means carrying out any unauthorized act within it, which may be done by anyone, whether the owner or a third party. In this regard, the TRIBUNAL DE CASACIÓN PENAL stated in Voto No. 751 de las diez horas cuarenta y cinco minutos del diecinueve de setiembre de dos: ‘V.- The fifth ground invokes §§ 30 and 31 of the C.p. and 33 and 58 of the Ley forestal. The appellant argues that the facts established in the judgment on the merits do not constitute an offense (atípicos). The prohibited act under § 58.a of the Ley forestal is encroachment, which the accused did not commit because he merely replaced grass and brush with lilies on his own property, in his possession; he did not encroach upon another person’s real property. On that basis, he requests reversal of the challenged judgment and entry of a judgment of acquittal. The claim is denied. It is true that the criminal conduct established by § 58.c of the Ley Forestal consists of encroaching upon a conservation or protection area, but the term does not mean dispossessing another person or entering another person’s property. Because conservation areas impose a general limitation on every owner of real property through which the rivers of Costa Rica flow, for the purpose of preserving the natural environment, health, ecology, and what little may be saved to maintain the balance of planet Earth, such restriction upon ownership is a legal regime requiring the portion of the real property under State protection to remain intact, from which follows the possibility of carrying out there only those acts permitted by that regime. Thus, encroaching upon the protection area means carrying out any unauthorized act within it, which may be done by anyone, whether the owner or a third party. The appellant is therefore incorrect in asserting that because his client held title to the real property, a portion of which was restricted as a protection area, he could not have encroached because the object of the conduct did not belong to another. To the contrary, the accused Nombre106309 committed the act, and any other person may also commit it. For the foregoing reasons, the claim is denied....’ Under the factual framework established in the judgment—and insofar as relevant to the resolution of these two substantive grounds—it was found that: ‘B- From the month of diciembre del año dos mil to the present, the accused has used the real property as an “open-air” garbage dump by allowing and encouraging unidentified persons to deposit waste on the property, including cardboard, rubble, metals, vehicle parts, washing machines, wood, scrap metal, tires, household appliances, weeds, and other discarded objects.’ Thus, the accused is regarded not only as the person who permitted the conduct of third parties, but also as having encouraged the dumping of waste in the protected area. Therefore, the ground is rejected...” (Tribunal de Casación Penal de San José, Voto N°904-2004 del 2 de setiembre del 2004). Considering the judgments partially transcribed above, this Chamber concludes that the legally protected interest under articles 33 and 58 of the Ley Forestal is the environment, understood by the Criminal Courts as encompassing the ecosystems and the water and forest resources surrounding the spring (naciente). For this reason, the case law has interpreted encroachment upon protected areas as capable of being committed merely by removing vegetation cover (cobertura vegetal) or altering such land; in other words, a conservation-based principle of property ownership prevails, imposing a clear limitation on the owner of the real property. For this reason, the impact study concerning the spring or flow tubes conducted by SENARA, to which the appellant’s representative refers, is not sufficient, since the interest protected by the Ley Forestal through its “protection areas” is not primarily the water resource or its contamination, as might be inferred from the limitations of the Ley de aguas. Rather, Ley N°7575 establishes a much broader safeguard, as is apparent from its opening articles and the interpretation provided by the case law, which this Chamber considers consistent with the public interest protected by the provision, pursuant to article 10 of the Ley General de la Administración Pública. Nevertheless, in view of SENARA’s favorable technical opinion concerning the building that the appellant company intends to construct within the protection area of the springs, the Ministry of Environment and Energy, as the governing body and in the exercise of its State Forestry Administration functions under sections 5 and 19 of Ley N°7575, is responsible for determining the impact on forest resources and the environment before authorizing a change in the land use (uso del suelo) surrounding the spring. In other words, SENARA and MINAET are responsible for conducting a rigorous technical assessment, using modern instruments and techniques, to comprehensively evaluate the effects of the construction project on the natural resources protected under article 33 of the Ley Forestal, because that provision significantly places the fundamental right to property in tension with the conservation of environmental resources essential to life.

VI.Conclusion. As duly explained in recital IV (considerando IV) of this decision, the proper course is deemed to be to declare inadmissible the appeal (recurso de apelación) filed by the representative of Inmobiliaria Mely S.A. against decision DAME-189-16 issued by the Mayor of the Municipalidad de Escazú; given the manner in which this matter is decided, no declaration of exhaustion of administrative remedies (agotamiento de la vía administrativa) is granted.—

VII.Copy of the case file and return of documents. Because the proceedings before this tribunal were conducted electronically, the parties may obtain a complete copy containing both the administrative case file (expediente administrativo) transmitted by the Corporación Municipal and all documents comprising this appeal proceeding (alzada), for which purpose they must provide an electronic storage device (USB flash drive or compact disc). Furthermore, if any physical or electronic documentation (plans, photographs, reports, etc.) was submitted and remains in the custody of the Court, the person who submitted it may retrieve it within 30 business days, pursuant to Article 12 of the «Regulations on Electronic Case Files before the Poder Judicial» («Reglamento sobre Expediente Electrónico ante el Poder Judicial»), approved by the Corte Plena at session no. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial no. 19 of January 26, 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session no. 43-12 held on May 3, 2012, Article LXXXI.

POR TANTO

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, Dirección200 . , a las nueve horas treinta y cinco minutos del treinta y uno de julio del año dos mil diecinueve.- Conoce este Tribunal, como jerarca impropio del recurso de apelación interpuesto por la empresa INMOBILIARIA MELY S.A., con cédula jurídica CED83375, representada por Nombre106307 portador de la cédula de identidad CED83376, contra la resolución DAME-189-16 de las 10:25 horas del día 2 de noviembre del 2016, suscrita por el ALCALDE MUNICIPAL DE ESCAZÚ.- Redacta el juez Chaves Torres; y,

CONSIDERANDO:

I.Antecedentes. Para decidir, se tiene como debidamente acreditado lo siguiente:

  • 1)Que el 9 de julio del 2015, la Unidad de Gestión Hídrica del Sistema Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), con su oficio N°UGH-237-15 atiende la consulta del señor Nombre106308 sobre la delimitación del perímetro de protección de dos nacientes ubicada en San Antonio de Escazú; y dispuso que el "...sitio donde se pretenden desarrollar la construcción de 7 viviendas unifamiliares (una por cada propiedad) se encuentra en una zona de vulnerabilidad intrínseca media a la contaminación de acuíferos (...) 4. Las propiedades consultantes con planos catastrados SJ-1155669-2007, SJ-1156354-2007, SJ-1156352-2007, SJ-1156353-2007, SJ-1155671-2007, SJ-1162473-2007 y SJ-1169425-2007, todas se ubican dentro de la zona de protección de 100 m de radio establecida en el artículo 33 de la Ley Forestal, no obstante, no se prevé que exista riesgo de contaminación de las nacientes NAC-3709 y NAC-3710 por el desarrollo de los lotes indicados, tanto a la cantidad como calidad del agua de las nacientes, dado que se ubican fuera del perímetro de protección efectiva de las nacientes o tubo de flujo subterráneo que alimenta las mismas, tal y como se indica en la figura 6 del estudio hidrogeológico aportado...".(Ver imagen 36).
  • 2)Que el 27 de setiembre del 2016, el Proceso de Contraloría Ambiental del Municipio de Escazú, ante un requerimiento de la parte apelante para que se realizara el estudio por afectación de nacientes, ríos, quebradas, pozos o sus correspondientes áreas de protección, mediante el oficio CA-0644-2016 resolvió que en la finca descrita en el plano catastrado SJ-1156353-07 propiedad de la empresa Inmobiliaria Mely S.A., se deben respetar "...el área de protección del río Agres y de las nacientes según lo estipula la Ley Forestal, la Ley de Aguas y jurisprudencia relacionada, así como tramitar ante el INVU el retiro correspondiente. Dichas áreas de retiro deben ser delimitadas en el terreno con cinta plástica, estacas o cuerda, así como permanecer con cobertura vegetal es decir reforestadas y sin ningún tipo de residuo. NOTA: Se les recuerda respecto a las nacientes que: artículo 33 de la Ley Forestal no ha sido derogado por lo que deben respetar el área de protección de 100 condición que se indica en el oficio N°UGH-237-15 SENARA en el punto 4; a su vez se le aclara que los estudios de tubos de flujo no eximen tal condición...", lo anterior al considerar lo expuesto por la Dirección de Aguas del MINAE en el oficio AT-3218-2015. (Ver imagen 26).
  • 3)Que el 10 de octubre del 2016, se recibe en el Ayuntamiento de Escazú formal recurso de apelación contra el acto CA-00644-2016, mediante el cual se solicita "...se levante cualquier medida cautelar que pese sobre el fundo, respecto a la afectación del radio de 100 metros de las nacientes indicadas ya que no estamos en presencia de bosque alguno lo cual es regulado por esta ley 7575 y no es nuestro caso porque estamos en zona urbana y no se cumplen los presupuestos de ley para estar sometido y a un régimen forestal como lo indica la ley 7575. 2. Que prevalezca, por ser el Estudio Hidrogeológico científico unívoco, que esta avalado por el SENARA el radio o tubo de flujos de acuerdo con el art. 33 de la ley 7575, dado que es el ENTE competente en la materia para regular los limites. 3. Que se mantenga en todos sus extremos la zona de protección del Río Agres tal cual, se establece por ley. 4. Que, de mantener criterio municipal sobre la necesidad de establecer una zona de protección se establezca la zona de protección del artículo 149 de la ley de aguas, por ser la menos dañosa para los intereses particulares...". (Ver imagen 7 a 25).
  • 4)Que el 2 de noviembre del 2016, el Alcalde de Escazú mediante su resolución DAME-189-16 decide rechazar el recurso de apelación, al considerar en resumen que la propiedad del recurrente se encuentra afectada por la naciente indicada en el oficio CA-0644-2016, y que el ente rector en materia del recurso hídrico es el MINAE según se desprende de la Ley N°276, y no el SENARA como lo afirma el apelante; agrega que dicho ente (SENARA) se encuentra en la obligación de "...asesorar técnicamente a particulares e Instituciones mediante estudios técnicos realizados por una oficina especializada, ello, no es óbice para que la existencia de los denominados estudios técnicos de tubos o de flujos de nacientes aportados dentro del expediente, tengan la virtud de disminuir ni liberar las áreas que la ley denomina "reserva de dominio" en favor de la nación, ni disminuir las áreas en las que la ley prohíbe la tala de árboles y cuyo propósito es precisamente salvaguardar la calidad y cantidad del recurso hídrico, de tal suerte que el oficio CA-0644-2016 emitido por la Contraloría Ambiental se ajusta al espíritu de la norma y tales advertencias de restricción están tutelando dicho recurso vital..."; para ello se apoya en los artículos 3 y 7 de la Ley 6877 (funciones del SENARA), el 31 de la Ley de Aguas (sobre el dominio público), 50 Constitucional, 33, 34 y 58 de la Ley 7575, 90 de la Ley de Conservación de la Vida Silvestre, y el principio de no regresión en materia ambiental desarrollado por la Sala Constitucional, para ello transcribe la resolución 2014-012887 en lo siguiente: "...Un área protegida solo se puede reducir si se hace mediante ley, si hay estudio técnicos y científicos que descarten el daño ambiental y si se da una compensación del área suprimida con otra de igual tamaño. Así se desprende de lo que esta Sala ha resuelto en anteriores oportunidades en los votos números 2012-13367 y 2009-1056...". Agrega que el estudio técnico de tubos de flujo de una naciente, tiene la virtud de identificar la dirección que llevan los flujos que alimentan el acuífero y permite determinar con mayor precisión técnica, el área que debe protegerse con mayor rigurosidad para garantizar la calidad y cantidad del recurso hídrico, y a la vez también permite identificar el área aledaña a la naciente donde técnicamente es posible aplicar medidas de protección menos rigurosas, pero que también garantizan la debida protección del recurso hídrico. No obstante, ello y siendo consecuente con lo indicado supra según se desprende de los hechos del recurso que el proyecto a construir sería una vivienda unifamiliar dentro de los 100 metros establecidos por la Ley Forestal, por lo que dentro de dicha área el ordinal 34 de la Ley Forestal establece la prohibición de realizar cualquier actividad tendiente a talar árboles lo que afecta el recurso hídrico que tiene protección constitucional (...) En consecuencia, no lleva razón el recurrente en sus argumentos primero, segundo tercero y cuarto y noveno, once y doce del análisis jurídico que rola a parte del folio 3 del expediente, al indicar que la normativa a aplicar es el artículo 149 de la Ley de Aguas N°276, toda vez que como se explicó la aplicación del artículo 33 de la Ley Forestal protege las nacientes permanentes (...) de tal suerte que no debe la norma ser interpretada solamente por la letra como lo pretende hacer ver el recurrente, sino por el contexto que pretende regular...". (Ver imagen 208 a 225).
  • 5)Que el 11 de noviembre del 2016, la representación de Inmobiliaria Mely S.A., presenta en la Municipalidad de Escazú recurso de revocatoria con apelación en subsidio contra la resolución descrita en el hecho anterior; por lo que una vez rechazada la impugnación horizontal se eleva para ante este Tribunal para ser atendida la apelación correspondiente. (Ver imagen 227 y 253).-

II.Motivos de agravio. En resumen, alega que no encuentra una justificación o argumentación jurídica que rebata categóricamente la aplicación de un régimen forestal a zona urbana, agrega que el terreno se ubica fuera del alcance de la ley N°7575, ya que fue creada para proteger los bosques naturales, y que su propiedad no se encuentra con limitación forestal. Señala que no es cierto que su terreno de acuerdo con el artículo 31 de la ley de aguas es reserva de dominio público, porque no es zona forestal y no hay tomas de agua potable. Agrega que no existen estudios científicos que demuestren que los terrenos revisten un interés público para la protección de especies silvestres, de acuerdo con el artículo 2 de la Ley N°7575, que imposibiliten materialmente la construcción de viviendas. Señala que debe aplicarse la Ley de Aguas en su artículo 149, para proteger las nacientes que están fuera del ámbito del bosque o Régimen Forestal. Que existen en el expediente administrativo prueba científica de que las obras a realizar en su terreno, no causan a las nacientes menos cabo en el caudal ni las contaminarán de ninguna forma.

III.Sobre el recurso. De un análisis pormenorizado de los argumentos expuestos por la representación de la sociedad apelante y la resolución impugnada, considera esta Cámara que el objeto de la impugnación gravita en la inconformidad de la parte recurrente con la aplicación de las limitaciones dispuestas en la Ley Forestal, a su propiedad descrita en plano catastrado Placa18829, en razón de la existencia de dos nacientes de agua de tipo permanentes, que fueron acreditadas por la Dirección de Aguas en su oficio AT-32-2015, y sobre lo cual no existe controversia. En dicha línea y siguiendo lo ordenado por el cardinal 181 de la Ley General de la Administración éste Tribunal como contralor no jerárquico de legalidad, estará atendiendo cada uno de los agravios expuestos en el recurso de apelación. En este marco de competencia, y por la imprecisión mostrada por ambas partes, es importante referirse al régimen de protección de las nacientes, el cual prevé distintos supuestos, los cuales tienen en común, el establecimiento de un área alrededor de éstas sobre la cual recae la respectiva tutela.

El "ordenamiento" jurídico dispone varios supuestos sobre el régimen de protección de las áreas adyacentes a las nacientes de agua. Estos distintos regímenes son un intento de evitar que actividades humanas tiendan a degradar las áreas contiguas a las nacientes de agua, algunos tienen por finalidad principal la protección del recurso hídrico, la potabilidad o pureza del agua, y otros protegen varios recursos naturales, entre ellos el agua. A fin de seguir un orden en razón de la afectación al derecho de propiedad, se debe iniciar con el régimen jurídico de mayores repercusiones sobre aquel derecho, como lo es el contenido en el ordinal 31 y 32 de la Ley de Aguas N° 276 del 27 de agosto de 1942, que establece:

"Artículo 31.- Se declaran como reserva de dominio a favor de la Nación:

  • a)Las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio; b) La zona forestal que protege o debe proteger el conjunto de terrenos en que se produce la infiltración de aguas potables, así como el de los que dan asiento a cuencas hidrográficas y márgenes de depósito, fuentes surtidoras o curso permanente de las mismas aguas.

Artículo 32.- Cuando en una área mayor de la anteriormente señalada exista peligro de contaminación ya sea en las aguas superficiales o en las subterráneas, el Poder Ejecutivo, por medio de la Sección de Aguas Potables a que alude el artículo siguiente, dispondrá en el área dicha las medidas que juzgue oportunas para evitar el peligro de contaminación." Como bien se puede desprender de los ordinales transcritos, el legislador optó por abstraer del dominio privado todas las áreas que se encuentren en el radio de 200 metros de las nacientes que cuenten con "tomas surtidoras de agua potable" y estén abasteciendo una población; siendo su principal objeto de protección el recurso hídrico. En relación a esta particular afectación de los terrenos circundantes a las nacientes que cumplen con dichas características, éste Tribunal en la resolución N°229-2018 del 31 de mayo del 2018, tuvo la oportunidad de analizar sus requisitos y consecuencias (expropiación o responsabilidad de la Administración), disponiendo "...que la declaratoria de dominio que se alude, debe ser entendida como dominio público artificial, en tanto son "bienes declarados públicos por el legislador pero cuya creación o existencia depende de un hecho humano (construcción de una calle o un parque público, por ejemplo)", tal y como lo afirma la Sala Constitucional en el antecedente transcrito.

En este sentido, para encontrarnos en este supuesto, debe realizarse la instalación de la infraestructura de captación o toma surtidora de agua potable, siendo hasta ese momento en que podría analizarse el tema de la demanialidad del bien -o al menos de la parte afectada por dicha norma-...". Por esta razón, efectivamente a la propiedad de la empresa Inmobiliaria Mely S.A., no le resulta aplicable lo dispuesto en el ordinal 31 de la Ley de Aguas, en el tanto falta como elemento esencial, la toma surtidora de agua potable en la naciente, hecho que no se encuentra en discusión. Por otra parte, se encuentran áreas de protección alrededor de las nacientes que se constituyen únicamente como limitaciones, entendidas estas como legítimas por la jurisprudencia Constitucional, y que tienen un carácter general al derecho de propiedad privada, las cuales satisfacen un interés público prevaleciente, a través de criterios razonables, útiles y oportunos, y por ende se ha dicho que no requieren indemnización previa (artículos 45 párrafo 2° y 50 Constitucionales; sentencias constitucionales 3173-93, 4205-96 y 7137-2007; dictámenes C-42-99 y C-148-2012).

Son parte de la protección dispuesta por el ordenamiento jurídico a los recursos naturales esenciales para la vida, es decir, son la consecuencia de confrontar varios derechos fundamentales. En este marco, encontramos en el capítulo IX de la misma Ley de Aguas N°276 denominado "Medidas referentes a la conservación de árboles para evitar la disminución de las aguas", una protección general al recurso hídrico proveniente de las nacientes, pero a diferencia del régimen anterior no se abstrae la propiedad del dominio privado, en este sentido:

"Artículo 148.- Los propietarios de terrenos atravesados por ríos, arroyos, o aquellos en los cuales existan manantiales, en cuyas vegas o contornos hayan sido destruídos los bosques que les servían de abrigo, están obligados a sembrar árboles en las márgenes de los mismos ríos, arroyos o manantiales, a una distancia no mayor de cinco metros de las expresadas aguas, en todo el trayecto y su curso, comprendido en la respectiva propiedad.

Artículo 149.- Se prohíbe destruir, tanto en los bosques nacionales como en los de particulares, los árboles situados a menos de sesenta metros de los manantiales que nazcan en los cerros, o a menos de cincuenta metros de los que nazcan en terrenos planos.

Artículo 150.- Se prohíbe destruir, tanto en los bosques nacionales como en los terrenos particulares, los árboles situados a menos de cinco metros de los ríos o arroyos que discurran por sus predios." Alega la apelante que se le aplique del ordinal 148 anteriormente transcrito, pero hace referencia al retiro de cincuenta metros contenido en el artículo 149, por consiguiente comprende este Tribunal que se refiere a este último; sobre el cual cabe resaltar que dicha norma refiere indubitablemente a medidas de protección diseñadas por el legislador con la finalidad principal de salvaguardar el agua que brota de los manantiales, entendido este concepto como "1. adj.Que mana o brota. Agua, fuente manantial.2. m. Nacimiento de las aguas." (consulta en línea al diccionario de la lengua española, edición del tricentenario actualizado al 2008, https://dle.rae.es/?id=O7aXamT). Es decir, considera la norma que los bosques y arboles ubicados a 60 o 50 metros lineales de las nacientes son necesarios para proteger el recurso hídrico, y por consiguiente establece una limitación a la propiedad privada para que dicha área sea invadida (interpretación sistemática de dichas normas 148, 149 y 150), y que su incumplimiento tiene entre otras consecuencias la multa dispuesta en el ordinal 165 del mismo cuerpo normativo por remisión del 151 que establece lo siguiente:

"Artículo 151.- La infracción a lo dispuesto en los artículos anteriores obliga al infractor a reponer los árboles destruidos y lo sujeta a la pena que se determina en el artículo 165 del capítulo siguiente. Además, la infracción será causa suficiente para que pueda procederse a la expropiación de las fajas de terreno en los anchos expresados en el artículo anterior, o a uno y otro lado del curso del río o arroyo, en toda su extensión." En suma, dicha protección se dispuso para todas las nacientes indistintamente de sus características (con o sin toma de agua potable), o su frecuencia en la fuente del recurso hídrico (intermitentes o permanentes) (al respecto se puede consultar el Voto 9221-2019 dictado por la Sala Constitucional a las 11:41 horas del 22 de mayo del 2019), en el tanto los manantiales que broten naturalmente de la tierra son aguas del dominio público por interpretación sistemática del inciso IV del artículo 1 y el artículo 3 de la tantas veces citada Ley de Aguas de 1942.

Al respecto existen antecedentes uniformes, emitidos tanto por la Sala Primera de la Corte Suprema de Justicia, en voto 858-F-S1-2012, de las 9:20 horas del 20 de julio de 2012, como de la Sala Constitucional, en el voto número 2010-8315 de las 8:45 horas del 7 de mayo de 2010, en donde se aplicó el radio de sesenta metros de protección a las nacientes intermitentes. Al efecto, dispuso la Sala Primera en el voto indicado que:"III.- El numeral 149 de la Ley de Aguas se encuentra dentro del Capítulo Noveno de dicha ley, denominado “Medidas Referentes a la Conservación de Árboles para Evitar la Disminución de las Aguas”, que como su nombre lo dice, procura con los preceptos contenidos en él, que las autoridades estatales velen por “(…) el estricto cumplimiento de las disposiciones legales referentes a la conservación de los árboles, especialmente los de las orillas de los ríos y los que se encuentren en los nacimientos de aguas” (canon 145 ibídem), con el fin de evitar la disminución de las aguas.

En ese sentido, el numeral referido reza: “Se prohíbe destruir, tanto en los bosques nacionales como en los de particulares, los árboles situados a menos de sesenta metros de los manantiales que nazcan en los cerros, o menos de cincuenta metros de los que nazcan en terrenos planos”. Como se observa, la norma no distingue entre manantiales permanentes e intermitentes, por lo que no cabría hacer tal diferenciación a la hora de aplicarla. Se trata de una típica limitación de interés público (artículo 45 de la Constitución Política), que al igual que otras previstas en diversos cuerpos normativos del ordenamiento jurídico, ha evolucionado el concepto de límites a la propiedad privada, en aras de una tutela real y efectiva de la garantía constitucional (artículo 50 de nuestra Constitución Política) de un ambiente sano y ecológicamente equilibrado. Tampoco distingue el precepto entre aguas de dominio público y de dominio privado.

La norma alude a aguas solamente, sea, al recurso hídrico en general, por lo que la cita de los artículos 1 a 4 de la Ley no. 276 no resulta pertinente al caso. De ahí, que no estima esta Sala que el Tribunal hubiese quebrantado el canon cuya errónea interpretación y aplicación se acusa, al establecer que sí existe amparo legal para las nacientes intermitentes.". De lo anterior se extrae, el reconocimiento jurídico efectuado por la jurisprudencia nacional, para proteger con el 149 de la Ley de Aguas los afloramientos hídricos intermitentes, en contraposición con las nacientes permanentes, que además de dicha medida de salvaguarda cuenta con un régimen proteccionista aún más riguroso en la Ley Forestal N°7575. Sobre esta diferencia en el trato de las nacientes según su frecuencia, la Sala Constitucional en el Voto N°09221-2019 de las 11:41 horas del 22 de mayo del 2019, aclara lo siguiente: "...De tal manera, es claro que la consideración del agua como recurso esencial y derecho fundamental, conlleva la necesaria protección de sus fuentes y de las áreas de captación, donde se consideran desde los mantos acuíferos subterráneos y superficiales, así como las nacientes, pozos y demás áreas desde las que se ubica y dispone del recurso hídrico.

Esta protección implica el establecimiento de las denominadas áreas o perímetros de protección, como la señalada, precisamente, en el inciso a) del artículo 33 de la Ley Forestal, la cual, según se ha reseñado, refiere un radio de protección de 100 metros respecto de las nacientes permanentes, área de protección que puede variar, y de hecho así se establece en la legislación ordinaria, si la naciente dista de ser permanente, y, por el contrario, es una naciente de carácter intermitente o no permanente, respecto de las cuales no es que no exista protección alguna, sino que los radios de las áreas de protección pueden ser variables según así se considere por la normativa y las instancias técnicas responsables. Dicho de otro modo, la normativa y la jurisprudencia reconocen la importancia y la necesidad de brindar protección a las nacientes, y de ahí la definición de los radios de las áreas de protección de las mismas, cuya extensión varía dependiendo del tipo de naciente de que se trate, justamente, porque partiendo del tipo de naciente, así será el radio del área de protección correspondiente, sin que ello sea, per se, una situación que genere inconstitucionalidad alguna, pues como bien se indica en el precedente de cita, las propias condiciones de cada tipo de naciente –acuífero, pozo y demás- son las que definen las condiciones particulares de protección, de modo que haya áreas de protección especialmente definidas de acuerdo al tipo de naciente, manto o pozo de que se trate.

En este sentido, la verificación de si una naciente es de carácter permanente o no permanente, es una determinación que compete a las instancias técnicas de la administración, que de conformidad con sus respectivos ámbitos de competencia, sería un asunto propio de la Dirección de Aguas del Ministerio del Ambiente y Energía, en estricta coordinación con otras instancias relacionadas, como el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, y el propio Instituto Costarricense de Acueductos y Alcantarillados, definición que igualmente debe ser observada incluso por las municipalidades al momento de la elaboración de los correspondientes planes reguladores y los respectivos otorgamientos de los permisos de uso de suelo o sus denegatorias...". En el caso concreto, no existe discusión que las nacientes ubicadas en la propiedad de la empresa apelante son de carácter permanente, por lo que no lleva razón la representación recurrente en su argumento de aplicar solamente el retiro del 149 de la Ley de Aguas, sino que su protección va más allá, tal y como lo informó la Municipalidad en el acto impugnado.

IV.En este orden, y sobre las nacientes permanentes, se debe reconocer que efectivamente la Ley Forestal N°7575 establece un régimen de protección especial para el recurso forestal, que sin lugar a dudas alcanza hasta el recurso hídrico que aflora en condición de manantiales, esto se extrae con facilidad del artículo 1 de la misma ley, ya que establece como objetivo principal la "...conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables...", es decir en dicho cuerpo normativo le rige un principio conservacionista de los recursos forestales, que a la luz de las reglas de la experiencia conlleva la protección directa o indirecta del recurso hídrico como insumo vital de los bosques y árboles.

Existiendo, entonces una protección jurídica mutua de ambos recursos naturales -dada su interdependencia real-, ya que como se observó anteriormente la Ley de Aguas protege directamente los árboles y bosques para evitar la disminución de las aguas y ahora en la Ley Forestal se protege la naciente y su área de recarga que le rodea para poder cumplir con el fin de preservar el recurso forestal. En este contexto, debe ser entendido e interpretado el ordinal 33 de la Ley Forestal que declara la existencia de un área de protección alrededor de las nacientes permanentes y sus áreas de recarga, a mayor abundamiento:

"ARTICULO 33.- Áreas de protección. Se declaran áreas de protección las siguientes:a) Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal. b) Una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado. c) Una zona de cincuenta metros medida horizontalmente en las riberas de los lagos y embalses naturales y en los lagos o embalses artificiales construidos por el Estado y sus instituciones. Se exceptúan los lagos y embalses artificiales privados. d) Las áreas de recarga y los acuíferos de los manantiales, cuyos límites serán determinados por los órganos competentes establecidos en el reglamento de esta ley." Véase, que el artículo anterior declara sin lugar a dudas un área de protección de cien metros de radio, partiendo de la ubicación de la naciente permanente, esta es una primera diferencia con la protección dispuesta en el 149 de la Ley de Aguas, es decir la distancia y la forma como se debe medir dicha área reservada, con lo cual se trata de la aplicación de la norma especial sobre la general, por lo que se excluyen entre sí y resulta aplicable la primera.

Distinta situación ocurre con la protección dispuesta en el Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones, que se refiere a las nacientes permanentes pero el área protegida queda subsumida en los cien metros de radio de la Ley Forestal en el tan citado artículo 33, a mayor abundamiento dicho reglamento dispone:

"...III.3.7.6 En caso que una corriente de agua permanente nazca en un área a urbanizar, el ojo de agua deberá protegerse en un radio de 50 metros como mínimo, zona en que no se podrá construir ninguna obra, salvo las de aprovechamiento del agua. Esta área podrá entregarse dentro del porcentaje a ceder al Municipio para uso público y en este caso deberá destinarse a parque..." Por su parte, y sobre las limitaciones a dicha área, el ordinal 34 de la Ley forestal establece una muy similar prohibición a la ley de aguas, véase::

"ARTICULO 34.- Prohibición para talar en áreas protegidas Se prohíbe la corta o eliminación de árboles en las áreas de protección descritas en el artículo anterior, excepto en proyectos declarados por el Poder Ejecutivo como de conveniencia nacional. Los alineamientos que deban tramitarse en relación con estas áreas, serán realizados por el Instituto Nacional de Vivienda y Urbanismo." También cabe resaltar, que este ordinal 34 le otorga la competencia al Instituto Nacional de Vivienda y Urbanismo para establecer el alineamiento de dichas áreas de protección, con lo cual mal haría el Ayuntamiento en hacer mediciones o ubicaciones de forma previa a los procedimientos administrativos de licencias constructivas o en la emisión de certificados de uso de suelo, cuando la competencia está dada por ley a otro ente público. Por lo que debe imperar un respeto de las competencias administrativas dadas por ley a ambas instituciones, siendo que a lo sumo podría establecerse una coordinación intersubjetiva, esto conllevaría que la emisión del acto final sobre la afectación del área de protección al inmueble propiedad de la sociedad recurrente, fuese emitido por el INVU, lo cual posibilita su impugnación en fase administrativa o directamente ante el juez contencioso administrativo, sin necesidad de agotar previamente la vía.

Una vez emitido dicho acto de alineamiento, como requisito previo, no le queda más remedio a la Municipalidad que otorgar lo solicitado con base en lo dispuesto en el ordinal 146 de la Ley General de la Administración Pública y lo ordenado en la Ley N°8220, algo muy similar acontece con el alineamiento que otorga el MOPT frente a calle nacional de previo a la licencia municipal. Toda esta circunstancia es del conocimiento del Ayuntamiento de Escazú, véase que en el acto que da inicio la escalerilla recursiva -OFICIO CA-0644-2016- la Contraloría Ambiental advierte a la parte apelante que debe tramitar "...ante el INVU el retiro correspondiente...". En esta línea, el señor Alcalde en la resolución apelada -DAME 189-16-, al resolver únicamente que declara sin lugar el recurso de apelación, sin duda alguna está confirmando un acto de trámite sin ningún efecto en la esfera jurídica de la parte apelante.

Sobre ello, se debe recordar que esta Cámara conoce de un recurso de apelación, enmarcado en el contexto de un procedimiento administrativo, que amén de estar regulado en algunos puntos específicos por el Código Municipal, le son también aplicables las disposiciones de la Ley General de la Administración Pública, en adelante “LGAP” (y supletoriamente el Código Procesal Contencioso Administrativo), respecto de temas que no hayan sido expresamente regulados por el legislador en el Código Municipal, que en esta materia se constituye en lex specialis. En lo que hace a la impugnación de resoluciones emanadas del Alcalde Municipal, el Código Municipal es omiso en precisar si cualquier conducta administrativa formal puede ser recurrible en vía de apelación. En esta dirección y en lo que respecta a los denominados actos de trámite sin efecto propio, el Código Municipal sí regula su inimpugnabilidad respecto de los acuerdos del Concejo Municipal, no obstante, la falta de norma expresa sobre este tema en el citado código, no debe ser entendida como una habilitación del justiciable para impugnar todas y cada una de las actuaciones procedimentales emitidas tanto por el Alcalde como por sus órganos subordinados.

En esta dirección, es claro que el Código Municipal, omiso en el tema bajo estudio, necesariamente debe ser complementado con la Ley General de la Administración Pública, texto legal aplicable a la materia que, siendo conteste con los desarrollos jurisprudenciales y doctrinales en la materia, también restringe la impugnabilidad autónoma de los “actos de trámite” o “actos preparatorios”, en aquellos casos en que estos no tengan un efecto propio. Aquí es menester precisar que tales actos, independientemente del órgano municipal que los emite, no son actos inmunes a la revisión jurisdiccional o al control jerárquico en sede administrativa (cuando este exista), sino que el legislador estableció que ellos únicamente pueden impugnarse al momento de atacarse la conducta administrativa “final” o “definitiva”, a la cual sirven como parte del cauce procesal de preparación, lo anterior claro está salvo disposición legal en contrario.

Sobre la apuntada inimpugnabilidad, la Ley General de la Administración Pública indica claramente: “Artículo 342.-Las partes podrán recurrir contra resoluciones de mero trámite, o incidentales o finales, en los términos de esta ley, por motivos de legalidad o de oportunidad”. “Artículo 163.- (...) 2. Los vicios propios de los actos preparatorios se impugnarán conjuntamente con el acto, salvo que aquellos sean, a su vez, actos con efecto propio”. Precisada la imposibilidad de impugnar actos de trámite en esta instancia en razón del texto expreso de las normas recién transcritas, se considera oportuno indicar que si bien el artículo 342 permite la impugnación por razones de oportunidad, se aclara que esta disposición refiere a las impugnaciones verticales ante jerarcas naturales, no obstante, en lo que hace a esta Cámara, por tratarse de un contralor no jerárquico de legalidad, por disposición expresa del artículo 181 de la misma LGAP, no es posible la presentación de alegatos de oportunidad.

En el caso concreto, observa esta Cámara, indudablemente, que el acto que origina la cadena recursiva, a saber el oficio de la Contraloría Ambiental, es un acto de mero trámite, al ser simplemente el acto que advierte a la empresa recurrente sobre la existencia de las nacientes reconocidas por el órgano competente, sea el MINAE; y que ante ello debe pedir el alineamiento en el INVU, y es solo después de haber cumplido con dicho requisito que la sociedad apelante puede volver a la Municipalidad a cumplir con el trámite para la obtención de la licencia constructiva, razón por la cual su impugnación autónoma es improcedente en el tanto resulta prematura (Voto N°4072-95 del 21 de julio de 1995 dictado por la Sala Constitucional), situación que implica la inadmisibilidad del recurso de apelación presentado.

V.Sin perjuicio de lo anterior, dada la importancia en el objeto de apelación, este Tribunal considera oportuno continuar aclarando los argumentos expuestos por la representación recurrente. En este sentido, y sobre la aplicación de las limitaciones dispuestas en la Ley Forestal a los predios urbanos existe basta jurisprudencia de la Sala Constitucional y pronunciamientos de Procuraduría (al respecto ver sentencias 2019-04901, 2011-001745, 2014-012913, 2004-1923, y dictamen C-318-2017 del 19 de diciembre del 2017). Ahora bien, en el caso concreto del Cantón de Escazú, su Plan Regulador publicado en la Gaceta N°23 del 3 de febrero del 2005, crea una "Zona de Protección de Fuentes de Agua y Riberas (ZPFAR)", que incorpora el área de protección de las nacientes permanentes creadas en la Ley Forestal como parte de las limitaciones para el uso de suelo en todo el cantón sin excepción alguna, y establece como uso no conforme "toda clase de obras de construcción", por consiguiente el argumento expuesto por la empresa apelante relacionado con una supuesta inaplicabilidad de dicha área de protección, al encontrarse en zona urbana es claramente incorrecto en el caso del Cantón de Escazú. Al respecto se transcriben en lo que interesa las normas referidas:

16.3. Zona de Protección de Fuentes de Agua y Riberas (ZPFAR).

16.3.1. Definición.

Según la Ley 7575, artículo 33, incisos a, b y d, y la Ley Forestal en sus artículos 33 y 34, para regular la construcción, y con el .n de preservar y mejorar las condiciones del recurso hídrico de Escazú, se define como zonas de protección de las fuentes de agua y riberas, las siguientes: a. Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal. (...)

16.3.2. Usos conformes.

a. Conservación del recurso hídrico.

b. Reforestación.

16.3.3. Usos condicionales.

a. Infraestructura para el aprovechamiento del recurso hídrico.

b. Infraestructura básica para la seguridad en el área tales como senderos, iluminación y otros.

En área urbana se podrá autorizar el tratamiento de las paredes del cauce de los ríos, con la aprobación previa (por parte de la Oficina de Desarrollo Urbano y la Contraloría Ambiental de la Municipalidad) del estudio hidrológico del cauce por intervenir y de su diseño.

16.3.4. Usos no conformes.

a. Toda clase de obras de construcción no especificadas en los usos conformes y condicionales.

b. Vallas publicitarias." (Lo resaltado no es parte del original) Dicha norma urbanística, se encuentra en armonía con el concepto de área de protección descrito en la Ley Forestal que tiene un mayor alcance a las prohibiciones establecidas en la Ley de Aguas; pues se establece inclusive un tipo penal que faculta solicitar dicha responsabilidad a quien incumpla esta prohibición, a saber:

"ARTICULO 58.- Penas. Se impondrá prisión de tres meses a tres años a quien: a) Invada un área de conservación o protección, cualquiera que sea su categoría de manejo, u otras áreas de bosques o terrenos sometidos al régimen forestal, cualquiera que sea el área ocupada; independientemente de que se trate de terrenos privados del Estado u otros organismos de la Administración Pública o de terrenos de dominio particular. Los autores o partícipes del acto no tendrán derecho a indemnización alguna por cualquier construcción u obra que hayan realizado en los terrenos invadidos." En criterio de este Tribunal, el artículo transcrito complementa las limitaciones dispuestas para el propietario en el ordinal 33 de la Ley N°7575 (así reconocido por la Sala Constitucional en el Voto N°74-2010 del 6 de enero del 2010), toda vez que incluye el verbo "invadir", y éste concepto ha sido objeto de interpretación amplia por la jurisprudencia de los altos Tribunales de Casación Penal, a manera de ejemplo se transcriben los siguientes tres extractos:1) "...Por esos hechos, el Tribunal a quo condenó al enjuiciado por los delitos de Infracción a la Ley Forestal en la modalidad de invasión en un área de protección de un río, Desobediencia a la Autoridad y Usurpación de Bienes de Dominio Público, en concurso material, en perjuicio de los Recursos Naturales y la Autoridad Pública, imponiéndole un total de dos años y seis meses de prisión, concediéndole al sentenciado el beneficio de condena de ejecución condicional por el plazo de tres años (folio 136 frente).

Sobre la calificación legal anterior, señala que el imputado comete los tres ilícitos en momentos diferentes: “primeramente se comete el delito de desobediencia a la autoridad en fecha 29 de abril del 2011, cuando un funcionario público le notifica de una medida cautelar de suspender la construcción de la vivienda y el imputado hace caso omiso a la orden emanada, posteriormente se establece la invasión al área protegida correspondiente al predio que se encuentra al margen del río limoncito, propiedad que pertenece al Estado, y por último el mismo usurpa y posee la propiedad sin los permisos respectivos para hacerlo, haciendo uso de la propiedad en mención.” (folios 132 vuelto y 133 frente). Señala además, que se da una relación de causalidad entre la acción ejecutada por el justiciable y el resultado producido, ya que el mismo infringe las normas y lineamientos, así como la afectación a los bienes jurídicos establecidos por parte del legislador, con el acometimiento de los ilícitos acreditados en el fallo(...) Esta norma penal tutela como bien jurídico el “ambiente”; más concretamente y en lo que atañe a la discusión vinculada con el marco fáctico acreditado en sentencia, protege el recurso hídrico, toda vez que cuando se habla de invasión a un área de protección -sea privada o estatal y cualquiera que sea el área ocupada-, se alude a las áreas de protección de los ríos, quebradas, arroyos, etc, que aparecen definidas en el numeral 33.b) referenciado de la Ley Forestal.

De modo indirecto, la norma citada tutela también los bienes del Estado, en cuanto efectivamente están bajo su protección. Conforme la construcción del tipo penal en estudio, el verbo “invadir” no aparece definido legalmente en la Ley Forestal ni en su reglamento, motivo por el cual su carácter debe buscarse en otras fuentes. Así lo ha indicado la jurisprudencia de esta Sala, al señalar que, “Según el Diccionario de la Real Academia Española, invadir se entiende como “1. Irrumpir, entrar por la fuerza; 2. tr. Ocupar anormal o irregularmente un lugar. Las aguas invadieron la autopista; 3. tr. Dicho de una cosa: Entrar y propagarse en un lugar o medio determinados…”. Sea entonces, que la acción que sanciona el inc. a) del artículo 58 de la Ley Forestal, es el ocupar, irrumpir en un área de conservación o protección, independientemente de que se trate de terrenos estatales o privados, contemplando incluso el hacer “mejoras” al lugar (las que no se le retribuirán al invasor), como lo estipula la misma norma.

Es decir, invadir implica actos de ocupación del sitio, que se traducen en establecerse en el lugar y disponer del mismo.” (Sala de Casación Penal, resolución Nº 2016-01131, de las 15:40 horas, del 25 de octubre del 2016). Conforme lo anterior, se comprende que el acto de invadir puede consistir tanto en irrumpir o entrar a la fuerza en un sitio; o bien, ocuparlo de manera anormal o irregular, circunstancia que lógicamente resulta congruente con las consecuencias civiles de la conducta delictiva que preceptúa dicho inciso, de negar cualquier reclamo indemnizatorio por la pérdida o derribo de la construcción u obra que se haya realizado en el lugar, aunque esto último en realidad podría pensarse que está de más, si se considera que no existe obligación alguna por parte del Estado, de reconocer las “mejoras” efectuadas, a quien de manera ilegal invadió el área de protección, con la consecuente afectación al ecosistema..." (Sala de Casación Penal, Voto N°263-2018 del 30 de abril del 2018). 2)"...La conducta sancionada es el aprovechamiento del recurso forestal.

Este aprovechamiento consiste en la "Acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos....que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia..." (artículo 3. a) de la Ley Forestal). Se ha entendido que no se requiere ventaja económica, en vista de las varias posibilidades que se contemplan: "Como se dijo antes, en los tipos penales de aprovechamiento forestal, no debe existir necesariamente el ánimo de lucro, entendido como la intención o la obtención actual de algún tipo de beneficio que sea traducible en términos económicos, sino que, por el contrario, la definición de aprovechamiento maderable en el artículo 3, inciso a) de la LF, amplía la posibilidad de que se configure el delito, con solo que el sujeto activo, o su representada, obtengan algún provecho, beneficio, ventaja, utilidad o ganancia. Estos elementos no necesariamente implican la comercialización de la madera o el aspecto económico en general.

Pueden existir otras muchas ventajas, como resultado de un aprovechamiento; por ejemplo, la ventaja de la eliminación de un estorbo que tapaba el paisaje o la vista, la limpieza del terreno para una posterior plantación o construcción, la disminución de la densidad boscosa para lograr que el terreno no califique como bosque, para obtener así el permiso de tala rasa, entre otros" (González Montero, José Pablo. Manual de Delitos Ambientales, Escuela Judicial, 2007, página 267) (Tribunal de Casación Penal de San Cruz, Voto N°175-2010 del 30 de julio del 2010). 3)"...Debe indicarse que el concepto de “invasión” que contempla el numeral 58 inciso a- de la Ley Forestal, ha ocupada la jurisprudencia de este Tribunal. En este sentido se ha dicho que la acción delictiva establecida por el numeral 58.a- de la Ley Forestal consiste en invadir un área de conservación o de protección, pero el contenido del término no es el despojo o ingreso al dominio de otro.

Como las áreas de conservación suponen una limitación genérica a todo propietario de inmuebles por los que corren los ríos de Costa Rica, invadir el área de protección se traduce en realizar sobre ella cualquier acto no permitido, lo que puede hacer cualquiera ya sea propietario o un tercero. En este sentido ha dicho el TRIBUNAL DE CASACIÓN PENAL, Voto No. 751 de las diez horas cuarenta y cinco minutos del diecinueve de setiembre de dos:“V.- El quinto motivo invoca los §§ 30 y 31 del C.p., 33 y 58 del la Ley forestal. Señala el recurrente que los hechos acreditados en la sentencia de mérito son atípicos. La acción típica del § 58.a de la Ley forestal es invadir, lo que no hizo el imputado pues solamente sustituyó zacate y monte por lirios de su propiedad, en su posesión; no invadió el inmueble de otro. De acuerdo a lo anterior solicita la revocatoria de la sentencia impugnada y el dictado de una sentencia absolutoria.

Se declara sin lugar el reclamo. Es cierto que la acción delictiva establecida por el § 58.c de la Ley Forestal consiste en invadir un área de conservación o de protección, pero el contenido del término no es el despojo o ingreso al dominio de otro. Como las áreas de conservación suponen una limitación genérica, a todo propietario de inmuebles por los que corren los ríos de Costa Rica, con la finalidad de preservar el ambiente natural, la salud, la ecología y lo poco que pueda salvarse para el equilibrio del planeta Tierra, tal restricción al dominio es un régimen que obliga a mantener intacta la porción del inmueble bajo la tutela estatal, de donde deriva la posibilidad de realizar en aquella únicamente los actos permitidos por ese régimen. De este modo, invadir el área de protección se traduce en realizar sobre ella cualquier acto no permitido, lo que puede hacer cualquiera ya sea propietario o un tercero.

Por ello no lleva razón el recurrente cuando afirma que su patrocinado, por ser titular del derecho de propiedad del inmueble, limitado en una parte que es área de protección, no pudo invadir porque el objeto de la acción no es ajeno; antes por el contrario, cometió el hecho el imputado Nombre106309 y lo puede cometer cualquiera otra persona. Por lo expuesto se declara sin lugar el reclamo….”. Según el marco fáctico fijado en sentencia –y en lo que interesa para la resolución de estos dos motivos de fondo –se tuvo por cierto que: “B- Que desde el mes de diciembre del año dos mil y hasta la fecha, el imputado ha hecho del inmueble un botadero de basura “ a cielo abierto “, al permitir y promover que personas no determinadas depositen en el inmueble desechos de basura como son cartones, escombros, metales, partes de vehículos, lavadoras, madera, chatarra, llantas, electrodomésticos, maleza y otros objetos residuales”, de modo que no solamente se tiene al imputado como el sujeto que permite la conducta de terceros, sino en la acción de promover el lanzamiento de los desechos en la zona protegida.

Por lo tanto, se rechaza el motivo..." (Tribunal de Casación Penal de San José, Voto N°904-2004 del 2 de setiembre del 2004). Considerando las sentencias parcialmente transcritas, esta Cámara concluye que el bien jurídico tutelado en los artículos 33 y 58 de la Ley Forestal es el ambiente, entendido éste por los Tribunales Penales como el conjunto de los ecosistemas, el recurso hídrico y forestal alrededor de la naciente; por esta razón ha interpretado la jurisprudencia que la invasión en las áreas protegidas puede llevarse a cabo con la sola eliminación de la cobertura vegetal o alteración de dicho terreno, es decir prevalece un principio conservacionista de la propiedad, generando una clara limitación al propietario del inmueble. Y por esta razón no es suficiente el estudio de impacto a la naciente o tubos de flujo efectuado por el SENARA y al que hace alusión la representación apelante, en el tanto el bien jurídico protegido en la Ley Forestal con las "áreas de protección" no es principalmente el recurso hídrico o su contaminación como podría pensarse de las limitaciones de la Ley de aguas, sino que la Ley N°7575 establece una salvaguarda mucho más amplia, según se desprende de sus primeros artículos y la interpretación efectuada por la jurisprudencia, que en criterio de esta Cámara se encuentra acorde con el interés público protegido en la norma, de conformidad con el artículo 10 de la Ley General de la Administración Pública.

Sin embargo, considerando la existencia del criterio técnico positivo del SENARA sobre la edificación que pretende levantar la empresa apelante en el área de protección de las nacientes, le corresponde al Ministerio de Ambiente y Energía como órgano rector y en sus funciones de Administración Forestal del Estado a la luz de los ordinales 5 y 19 de la Ley N°7575, verificar la afectación al recurso forestal y al ambiente, de previo autorizar una modificación en el uso del suelo circundante a la naciente; es decir les compete al SENARA y al MINAET efectuar un ejercicio técnico serio, utilizando los instrumentos y técnicas modernas, para valorar de forma integral las repercusiones del proyecto constructivo a los recursos naturales protegidos en el artículo 33 de la Ley Forestal, ya que dicha norma confronta de manera importante el derecho fundamental a la propiedad con la conservación de los recursos ambientales esenciales para la vida.

VI.Corolario. Como bien se ha expuesto en el considerando IV de la presente resolución, se estima que lo procedente es declarar la inadmisibilidad del recurso de apelación intentado por la representación de la empresa Inmobiliaria Mely S.A., contra la resolución DAME-189-16 dictada por el Alcalde Municipal de Escazú, por la forma como se resuelve se omite otorgar el agotamiento de la vía administrativa.-.

VII.De la copia del expediente y devolución de documentos. Al haberse sustanciado esta sede en forma electrónica, queda a disposición de las partes obtener una copia integral que contiene tanto el expediente administrativo remitido por la Corporación Municipal así como la totalidad de las piezas que conforman la presente alzada, para lo cual deberá aportar el dispositivo electrónico de almacenamiento (llave maya o disco compacto). Asimismo, en caso que hubiere ingresado documentación física o electrónica (planos, fotografías, informes, etc) que permanezca aún en custodia el Despacho, podrá retirarla quien la aportó en un plazo de 30 días hábiles, de conformidad con lo dispuesto en el artículo 12 del «Reglamento sobre Expediente Electrónico ante el Poder Judicial», aprobado por la Corte Plena en sesión n.° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial n.° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión n.° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO

Se rechaza por inadmisible el recurso de apelación intentado.- Francisco José Chaves Torres Jorge Leiva Poveda Marco Antonio Hernández Vargas PROCESO: APELACIÓN EN JERARQUÍA RECURRENTE: INMOBILIARIA MELY S.A.
