SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At sixteen hours and thirty-nine minutes on the thirteenth of March, two thousand nineteen.- TREE-FELLING POSSESSORY INJUNCTION (INTERDICTO DE DERRIBO) filed by FAMILIA [Nombre1] DE [Nombre2] NOMBRE SOCIEDAD ANÓNIMA against UNKNOWN. The PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by [Nombre3], of legal age, divorced, an attorney, resident of San José, holder of identity card number CED1 - -, participates in the proceeding. Attorney Oscar Cerdas Fonseca acts in this proceeding as agrarian public defender for the plaintiff. Heard before the Juzgado Agrario del Segundo Circuito Judicial de Guanacaste, Santa Cruz.- BACKGROUND:

  1. 1The plaintiff filed a tree-felling possessory proceeding (proceso interdictal de derribo), valued at fifty million colones, seeking a judgment declaring: “1. That this possessory action be granted in all respects. 2. That the felling of the two [Nombre4] trees and the Espavel tree at issue in this matter be ordered. 3. That I be authorized to market or use the timber resulting from the cutting of those trees as I deem appropriate.” (See Escritorio Virtual del Juzgado Agrario de Santa Cruz, under Bandeja de Escritos, file dated 15/11/18 at 07:55:01).-
  2. 2Notice of this proceeding was served upon the Procuraduría General de la República, which entered an appearance therein (see Escritorio Virtual del Juzgado Agrario de Santa Cruz, under Bandeja de Escritos, file dated 11/01/19 at 04:21:04).-
  3. 3Judge Ericka Rojas Chavarría of the Juzgado Agrario de Santa Cruz, by judgment issued at fourteen hours and thirty minutes on the twenty-fourth of January, two thousand nineteen, ruled: “THEREFORE (POR TANTO): This tree-felling possessory action filed by [Nombre5], representing the company Familia Castillo Villegas de [Nombre2] Nombre S.A., is GRANTED. The plaintiff is authorized to cut the Espavel tree located at coordinate CED2, whose roots are within the stream and whose direction of fall is toward the stream’s gallery forest (bosque de galería), which is opposite the nearest house; however, the tree is observed to be shedding branches that are very large, some of which extend into the garden area of that house; [Nombre4] tree #1, located 1.0 m from the streambed, within the protection area (área de protección), at coordinates [Dirección1], and 2 meters from the Espavel tree. This tree’s direction of fall is toward the protection area.There is no house near this tree; and [Nombre4] tree #2, located 14 meters from the streambed, within the protection area, has damage at the base of its trunk and poses no risk of falling on any infrastructure; however, the tree is located in an area used for rest and by persons working on and visiting the property. The felling expenses shall be borne by the requesting party, which must also take all necessary safety and technical measures to prevent harm to third parties and avoid unnecessary damage to the environment and natural resources, which may be affected only to the extent strictly necessary. Where appropriate, it must notify third parties who could be affected by a falling branch and obtain any necessary permits (for example, to enter other land), on the basis of the judicial authorization granted herein. The use of the resulting timber (aprovechamiento de la madera), if usable, is granted to the Junta de Educación de la Escuela de [Nombre2] Nombre de Nicoya, the school in the locality where the applicant resides (Article 65 of the Ley Forestal and Article 12 of the Código Procesal Civil); likewise, the plaintiff must obtain the permits for extracting, sawing, and transporting the timber and bear the corresponding costs generated by such work.The Ministerio de Ambiente Energía y Telecomunicaciones shall be responsible for ensuring that only the trees identified herein are cut. The party is urged, once the felling has been carried out, to endeavor to preserve the protection area and even reforest it with species native to the area, which must be maintained through pruning to prevent them from reaching a height that would again endanger human life. This matter is decided without a special award of costs. Once this judgment becomes final, it shall be served upon La Oficina Regional del MINAET en Nicoya, which, in the performance of its duties, shall issue any permits that may be necessary for sawing the timber produced by the trees ordered to be cut.   4. 4The plaintiff company filed an appeal (recurso de apelación), expressly stating the grounds on which it relied to refute the trial court’s position (see Escritorio Virtual del Juzgado Agrario de Santa Cruz, under Bandeja de Escritos, file dated 29/01/19 at 07:43:34).-
  5. 5The statutory requirements have been observed in the conduct of the proceeding, and there are no apparent errors or omissions capable of rendering the judgment void.-

CONSIDERING:

I-Proven facts. The fourth proven fact is upheld because it is supported by evidence contained in the record, but it is amended insofar as it states that the trees authorized to be felled are located in the protection area of the river situated within property registered under [Placa1] CED3. The following are added as evidence: survey plan G-979927-2005 and the judicial inspection (reconocimiento judicial) shown in images 24 through 27. The second fact is upheld because it is supported by evidence contained in the record, and the following is added: trees located on property registered under [Placa2] of Guanacaste, owned and possessed by Familia Castillo Villegas de [Nombre2] Nombre S.A. The following evidence is added to that fact: initial pleading/judicial inspection in images 25 through 26 of the case file in PDF format/MINAE technical report in images 30 through 39 of the case file in PDF format). The first and fifth facts are not adopted because they do not constitute facts, but rather procedural acts or circumstances of the participating parties.

II- The plaintiff files an appeal (images 57 through 59 of the case file in PDF format) against the interlocutory possessory judgment (auto sentencia interdictal) issued at 14:30 hours on January 24, 2019 (images 50 through 56 in PDF format), which granted the tree-felling possessory injunction, challenging the designated disposition of the timber resulting from the felling of the two [Nombre4] trees and one Espavel tree. The plaintiff states that the trees are located on private property and that depriving it of their use violates Articles 505 and 506 of the Código Civil regarding the attributes encompassed by the right of ownership, which it states extends to the surface, plantings, and structures. It argues that the trees’ location within the river protection zone (zona de protección de río) means that the property is subject to environmental restrictions, but does not mean that they are not part of its real property or that the appellant cannot use the resource resulting from the cutting to defray its costs.

III- The judgment under appeal states that the felling was authorized because the trees posed an imminent risk to human health and life in the event of a fall, according to the MINAET report. That same report determined that the three trees are located within a river protection area. Regarding their use, the appealed judgment provided: “Regarding the commercial use of the timber (aprovechamiento maderable) from the trees authorized to be cut, the parties are advised that this authorization empowers them only to carry out the cutting of the trees. The use of the resulting timber, if usable, is granted to the Junta de Educación de la Escuela de [Nombre2] Nombre de Nicoya, the school in the locality where the applicant resides (Article 65 of the Ley Forestal and Article 12 of the Código Procesal Civil); likewise, the plaintiff must obtain the permits for extracting, sawing, and transporting the timber and bear the corresponding costs generated by such work.

The Ministerio de Ambiente Energía y Telecomunicaciones shall be responsible for ensuring that only the trees identified herein are cut. The party is urged, once the felling has been carried out, to endeavor to preserve the protection area and even reforest it with species native to the area, which must be maintained through pruning to prevent them from reaching a height that would again endanger human life.” As stated, the sole issue on appeal is the disposition of the timber resulting from the cutting.

IV- Having reviewed the record, it is apparent that, in challenging the ruling, the defendant questions the issue of the timber, arguing essentially that the protection area (área de protección) on which the forest species (especies forestales) stand is located within his registered property and that he therefore has the right to use the timber obtained from the trees that have been authorized for felling. In the view of this Chamber, the appellant is correct and is entitled to the relief he claims, since the trees are within his property and he requested such relief as part of the claim in his initial pleading. Regarding the disposition of the timber harvesting (aprovechamiento de la madera) resulting from the felling of forest species, it has ruled: “... In this regard, the Court finds that the judgment does contain contradictory and confusing statements. As to the applicable legislation, there is indeed no provision that directly supports the decision made and issued by the judge.

This is demonstrated by the fact that the judgment cites no article whatsoever in support of it. The decision denying clarification and supplementation cites Article 65 of Ley Forestal 7575 because it is mentioned by the State’s representative in the appeal under consideration, filed following the denial of those requests. The Attorney General states that this provision is inapplicable because it refers to criminal proceedings involving unlawful acts, which is a situation different from that raised in these proceedings. In this regard, it should be noted that the provision in question states verbatim: “ARTICLE 65.- Auction of seized products. Violations of this law shall be reported to the competent judicial authority and, if timber or other forest products are seized, that authority, following an appraisal conducted by the State Forestry Administration, shall sell them at public auction within a period not exceeding one month from the date on which the complaint was filed.

Those forest products may not be auctioned for less than the value established by the State Forestry Administration. If, after that period has elapsed, the timber or forest resources have not been auctioned, any person may use them after depositing with the Court the value assigned by the Forestry Administration. The proceeds of the auction shall be deposited in the account of the corresponding judicial authority pending resolution of the relevant proceedings. If the accused is acquitted, the money shall be delivered to the accused; otherwise, fifty percent (50%) shall be allocated to the State Forestry Administration and the other fifty percent (50%) to the municipalities of the place where the property from which the raw material was extracted is located or where the industry is situated, or to the indigenous association if it is located within an indigenous reserve, to be used for the development of forestry projects, without prejudice to any criminal liability determined with respect to the offenders.

The Ministry of Environment and Energy is authorized, through the Forestry Administration, to donate to the Ministry of Public Education any timber that comes into its possession as a result of a natural disaster or road widening, provided that the owners are unknown. It shall also donate seized timber once the conviction becomes final, where that timber has neither been awarded at auction nor requested by any person who meets the statutory requirements. The Ministry of Public Education shall use that timber to manufacture furniture or repair infrastructure in public primary and secondary schools, or as raw material in cabinetmaking, woodturning, carpentry, and other courses taught by state primary and secondary schools. (These final two paragraphs were added by Article 1, subsection b), of Law No. 7609 of 11 de junio de 1996).” A reading of the provision shows that it does not, in fact, provide a specific solution for the particular case being heard in possessory injunction proceedings (sede interdictal), because it concerns timber seized in connection with unlawful acts.

Nevertheless, in the absence of rules providing a solution for this case, both in the Agrarian Jurisdiction Law and in Articles 474 through 476 of the Code of Civil Procedure, which applies supplementarily. In that situation, since there is a provision concerning the disposition and use of trees, even though it relates to unlawful acts, it applies by analogy. In this regard, Article 12 of the Civil Code states: “Provisions may be applied by analogy when they do not address a specific situation but govern another similar situation in which the same rationale is present, unless a provision prohibits such application.”; and no provision of the Agrarian Jurisdiction Law prohibits application by analogy. Article 65 cited above, insofar as relevant to this case, delegates the appraisal and auction of timber or other forest products to the State Forestry Administration when the timber is seized, granting it a period not exceeding one month for that purpose.

In this case, the timber has not been seized because, according to the information in the record, it has yet to be felled. The judgment did not establish a deadline for cutting the five laurel trees, an omission that must be remedied so that the ruling may be enforced and the risks that their falling could create may be managed; however, it stated that, once they had been felled, the Ministry was to appraise them, a task that the Court considers inherent in the functions assigned to the Ministry by law, since it is staffed by officials with expertise in the subject matter. The provision further states that the property must be sold at public auction within one month for the amount established by the Ministry; and only if the timber or forest resources cannot be auctioned may any person use them after depositing with the Court the value assigned by the Forestry Administration. In this case, because the forest product does not arise from an unlawful act but from a preventive measure, the possibility of its use by any person gives way to the priority that must be afforded to the plaintiff, since the trees are located on property in the possession of Mr. [Nombre6], and he is therefore the person who may use them while taking the appropriate preventive measures, on the understanding that he must apply the value of those forest resources to restoring the area affected by the removal of those trees.

Such restoration must necessarily be undertaken by Mr. [Nombre6] in coordination with the experts designated by the Regional Office of the Ministry of Environment and Energy, because, as this is a protection area, endemic or native trees must be planted there. The plaintiff must therefore not be left free to replace the laurel trees to be felled with any other species, but only with those specified by the Ministry. The provision contemplates a situation unrelated to these proceedings, under which, if the person is acquitted of the unlawful act, the proceeds of the appraisal are delivered to that person; otherwise, 50% of the amount is allocated to the State Forestry Administration and the other 50% to the municipality of the place where the property is located, to be used for the development of forestry projects. Similarly, the Ministry of Environment and Energy is authorized, through the Forestry Administration, to donate to the Ministry of Public Education any timber that comes into its possession as a result of a natural disaster or road widening, provided that the property owners are unknown.

In this case, the forest products are not associated with an unlawful act such that their value should be distributed 50% to the State Forestry Administration and the other 50% to the municipality. Regarding the participation of educational institutions, the provision allows the Ministry of Environment and Energy to donate to the Ministry of Public Education any timber that comes into its possession as a result of a natural disaster or road widening, provided that the owners are unknown; it also allows the donation of seized timber once the conviction becomes final, where that timber has neither been awarded at auction nor requested by any person who meets the statutory requirements. This case does not involve a natural disaster, since the purpose of the proceedings is to prevent one, nor does it involve road widening; and although such circumstances could be treated as analogous to the particular case, the situation described in the provision differs in that it presupposes that the owner of the property on which the trees stand is unknown.

In this case, the plaintiff submitted a land-registry certificate showing that he is the registered owner of the property; and although possessory injunction proceedings may not address matters relating to ownership rights, as provided in Article 457 of the Code of Civil Procedure, which applies supplementarily, that information is particularly relevant in determining whether the forest resources are located within the plaintiff’s land, thereby ruling out the possibility that the owner of the property on which the trees stand is unknown. It must further be added that the allocation to the Ministry of Public Education of forest resources arising from unlawful acts or, generally, from any judicial proceeding must comply with the purposes established in the provision—that is, the timber must be used to “manufacture furniture or repair infrastructure in public primary and secondary schools”—and may not merely be intended to provide it with financial resources derived from the trees without a specific purpose or designated use, as the State’s representative correctly observes.

Based on the foregoing quotation, the Court concludes that the judgment is unclear; nevertheless, it cannot be deemed invalid .... For the reasons stated, pursuant to Articles 50 of the Political Constitution; 6 subsection g), 31, 49, and 65 of Ley Forestal 7575; 12 of the Civil Code; 474 through 476 of the Code of Civil Procedure; and 1, 6, 26, 54, and 79 of the Agrarian Jurisdiction Law, the judgment must be reversed insofar as it orders the forest products to be donated specifically to Escuela de Iroquois de Guácimo and requires the plaintiff to pay the value of the forest products as determined by the Ministry of Environment and Energy. In all other respects raised on appeal, the judgment must be affirmed as regards the authorization granted to Mr. [Nombre6] to remove the five laurel trees at issue in the dispute once this decision becomes final, in which case he must take all necessary technical, preventive, and precautionary measures to avoid causing harm to persons or property.

The Ministry of Environment and Energy must take the necessary preventive measures and ensure that the process of felling the laurel trees is carried out in compliance with the provisions of Ley Forestal; and once the cutting has been completed, that Office shall proceed to appraise the aforementioned forest products. The plaintiff may use the timber without making any deposit, because the trees are located within the property registered in his name, in which case the Ministry of Environment and Energy must grant him the transportation, processing, or other permits necessary for such use. ....”. In the case under consideration, the judge determined, based on the judicial inspection and the report provided by MINAE for that purpose, that the trees are located within the protection areas of the river that flows through that property. Accordingly, there is no legal basis for the decision in the appealed ruling ordering that the timber obtained from felling the three trees be donated to the Board of Education of the local school, because that timber did not result from the commission of any unlawful act. The protection area, as a legal concept, is defined in Article 33 of Ley Forestal, and its purpose is the conservation and protection of bodies of water.

These form part of the real properties (inmuebles) containing them, but their use and enjoyment are subject to environmental limitations, such as the prohibition against building, cultivating, or carrying out acts that endanger bodies of water. The plaintiff in these proceedings stated in his complaint that he was the person who planted the trees he now seeks to fell for reasons of safety to persons and surrounding infrastructure, and this Court finds no legal provision authorizing any institution or entity to take possession and ownership of the timber resulting from the felling under the circumstances of this matter. As the appellant states, those trees are part of his estate (fundo), in accordance with Articles 505 and 506 of the Código Civil. In that regard, the Sala Constitucional de la Corte Suprema de Justicia ruled in Voto 2007-10578 of July 25, 2007 regarding the substance of the right to property as follows: “The right to property has an essential content that the Sala has defined as the authority to enjoy and use the property for personal benefit (private property) or public benefit (public property).

Therefore, under the pretext of imposing certain limitations in the ‘social interest,’ a public authority, whether the Legislature or the Executive, may not eliminate one or more of its essential attributes. In such a situation—that is, if the limitations imposed on property violate the essential content of the right to property—the owner is entitled to compensation. In this regard, the Sala has stated: ‘That is, the attributes of property may be limited, provided that the owner retains the possibility of normally exploiting the property, excluding, of course, the portion or function affected by the limitation imposed by the State. Outside these parameters, if social welfare requires sacrifices solely from one person or a few persons, compensation must be paid, just as when the sacrifice imposed on the owner is of such a nature that it causes the owner to lose the property in its entirety.

Thus, a limitation on property withstands constitutional scrutiny when its effect on the essential attributes of property—those that permit the natural use of the thing within current socioeconomic conditions—does not cause the nature of the property to disappear or make use of the thing impossible because the State imposes authorization or approval requirements so complex that they effectively render it impossible to enjoy the property’s fruits.’ (Judgment N° 2345-96).” Accordingly, this Chamber finds that, as part of the right to use, enjoy, and exploit his estate and its products, he is entitled to use the timber from the trees to be felled on his registered property. To rule otherwise, absent conduct punishable as an administrative or criminal offense, would amount to confiscating private property without legal basis. The appealed portion of the interim judgment order (auto sentencia cautelar) must therefore be reversed.

V- For the reasons set forth, pursuant to Articles 1, 2, and 26 of the Agrarian Jurisdiction Law, Article 108 of the Code of Civil Procedure, applicable by virtue of Transitory Provision I of Ley 9343, Articles I and II of Ley 9342, Article 33 of the Ley Forestal, and Article 65 of its Regulations, with respect to the matters appealed, the interdict judgment (sentencia interdictal) rendered at 14:30 on 24 de enero del 2019 is partially reversed insofar as it held that the harvesting of the resulting timber (aprovechamiento de la madera), should it be usable, was awarded to the Board of Education of the School of [Nombre2] Nombre de Nicoya, the school in the locality where the applicant resides. In its place, Familia Castillo Villegas de [Nombre2] Nombre S.A. is recognized as entitled to harvest the timber obtained from the trees authorized to be felled, subject to duly obtaining and complying with the legal permits and requirements for that purpose.

With respect to the matters appealed, the interdict judgment rendered at catorce horas treinta minutos on veinticuatro de enero del dos mil diecinueve is partially reversed insofar as it held that the harvesting of the resulting timber, should it be usable, was awarded to the Board of Education of the School of [Nombre2] Nombre de Nicoya, the school in the locality where the applicant resides. In its place, Familia Castillo Villegas de [Nombre2] Nombre S.A. is recognized as entitled to harvest the timber obtained from the trees authorized to be felled, subject to duly obtaining and complying with the legal permits and requirements for that purpose.

VOTO N° 128-F-19 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas y treinta y nueve minutos del trece de marzo de dos mil diecinueve.- INTERDICTO DE DERRIBO interpuesto por FAMILIA [Nombre1] DE [Nombre2] NOMBRE SOCIEDAD ANÓNIMA; contra IGNORADO. Interviene en el proceso, la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por [Nombre3] , mayor, divorciada, abogada, vecina de San José, cédula de identidad número CED1 - - . Actúa en este proceso como defensor público agrario de la parte actora el licenciado Oscar Cerdas Fonseca. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Guanacaste, Santa Cruz.-

RESULTANDO:

  1. 1La parte actora planteó proceso Interdictal de Derribo, estimado en cincuenta millones de colones, para que en sentencia se declare: "1. Que se declare con lugar la presente demanda interdictal en todos sus extremos. 2. Se ordene el derribo de los dos arboles de [Nombre4], y el árbol de Espavel objeto de este asunto. 3. Se me autorice para comercializar ó aprovechar la madera que resulte de la corta de dichos árboles a mi conveniencia," (Ver Escritorio Virtual del Juzgado Agrario de Santa Cruz, en Bandeja de Escritos, archivo del 15/11/18 de las 07:55:01).-
  2. 2Se le otorgó traslado a la Procuraduría General de la República del presente proceso, quien se apersonó al mismo, (Ver Escritorio Virtual del Juzgado Agrario de Santa Cruz, en Bandeja de Escritos, archivo del 11/01/19 de las 04:21:04).-
  3. 3La jueza Ericka Rojas Chavarría, del Juzgado Agrario de Santa Cruz , mediante sentencia de las catorce horas y treinta minutos del veinticuatro de enero del año dos mil diecinueve, resolvió: "POR TANTO: " Se ACOGE la presente demanda interdictal de derribo interpuesta por [Nombre5] , en representación de la compañía Familia Castillo Villegas de [Nombre2] Nombre S.A.. Se autoriza al actor proceder a cortar el árbol de Espavel, ubicado bajo la coordenada CED2 y con raices (sic) dentro de la quebrada, presenta dirección de caída hacia el bosque de galería de la quebrada y el cual es el lado opuesto a la casa más cercana, sin embargo se observa, que el árbol está desprendiendo ramas, las cuales son muy grandes y algunas llegan hasta el área de jardin (sic) de dicha casa; el árbol de [Nombre4] #1 ubicado a 1.0 m del cauce de la quebrada, dentro del área de protección, y bajo las coordenadas [Dirección1] y a 2 metros de distancia del árbol de Espavel.Este árbol presenta dirección de caída, hacía el área de protección. No hay casa cerca de este árbol y el árbol de [Nombre4] #2 ubicado a 14 metros del cauce de la quebrada, dentro del área de protección, presenta daño en la base de su fuste, no genera riesgo de caída sobre ninguna infraestructura, sin embargo, el árbol se ubica en un área de descanso y de tránsito de personas que laboran dentro de la propiedad y visitantes. Los gastos de derribo corren a cargo de la parte gestionante, quien debe además tomar todas las medidas de seguridad y técnicas, para evitar daños a terceros, así como evitar daños innecesarios al ambiente y los recursos naturales, que deben verse afectados sólo en lo estrictamente necesario. Si es del caso, debe dar aviso a terceros que puedan verse afectados con la caída de alguna rama, y requerir los permisos que fueran necesarios, (por ejemplo, para ingresar a otros terrenos), con fundamento en la autorización judicial que se le concede.El aprovechamiento de la madera resultante del mismo, en caso de que sea aprovechable, se concede a favor de la Junta de Educación de la Escuela de [Nombre2] Nombre de Nicoya, escuela de la localidad donde reside el solicitante (artículos 65 de la Ley Forestal y 12 del Código Procesal Civil), asimismo el actor deberá a su vez gestionar los permisos para la extracción, aserrío y traslado de la madera, y asumir los costos respectivos que generen esas labores. Estará a cargo del Ministerio de Ambiente Energía y Telecomunicaciones lo relativo al control de que se corte únicamente los árboles que aquí se indican. Se le insta a la parte a que una vez realizada la tala, deberá de procurar conservar el área de protección, e incluso reforestarla con especies de la zona, especies que deberá darles un mantenimiento de poda para evitar que se alcance una altura que nuevamente ponga en riesgo la vida misma de las personas.Se resuelve este asunto sin especial condenatoria en costas. Una vez firme esta sentencia, se ordena le sea notificada a La Oficina Regional del MINAET en Nicoya, quien deberá en función de su cargo, otorgar eventualmente los permisos necesarios para el aserrío de la madera que produzca los árboles que se ordena su corta. Se les hace saber a los intervinientes que esta resolución es impugnable,” (Ver Escritorio Virtual del Juzgado Agrario de Santa Cruz, en Documentos Asociados, archivo del 24/01/19 de las 14:30:26).-
  4. 4La compañía actora, interpuso recurso de apelación con indicación expresa de las razones en que se apoyaron para refutar la tesis del juzgado de instancia, (Ver Escritorio Virtual del Juzgado Agrario de Santa Cruz, en Bandeja de Escritos, archivo del 29/01/19 de las 07:43:34).-
  5. 5En la substanciación del proceso se han observado las prescripciones legales, y no se nota la existencia de errores u omisiones capaces de producir la nulidad del fallo.-

Redacta la jueza Castro García; y,

CONSIDERANDO.

I-Hechos probados. Se avala el hecho probado cuarto por estar sustentado en elementos probatorios que constan en autos, pero se modifica en cuanto se cita que los árboles que se autoriza derribar se sitúan en el área de protección de río ubicado dentro de la finca matrícula de [Placa1] CED3. Agregándose como elementos probatorios el plano G-979927-2005, reconocimiento judicial en imagen 24 a 27. Se avala el segundo hecho por estar sustentado en elementos probatorios que constan en autos y se agrega: árboles situados en la finca matrícula [Placa2] de Guanacaste a nombre de Familia Castillo Villegas de [Nombre2] Nombre S.A. y en su posesión. Se agregan a ese hecho los elementos de prueba: escrito inicial/reconocimiento judicial en imagen 25 a imagen 26 exoediente modo pdf/informe técnico MINAE en imagen 30 a imagen 39 expediente modo pdf). No se prohíjan los hechos primero y quinto por no constituir hechos sino actuaciones o condiciones procesales de las partes intervinientes.

II- El actor interpone recurso de apelación (imagen 57 a imagen 59 expediente modo pdf) contra el auto sentencia interdictal de las 14:30 horas del 24 de enero del 2019 (imagen 50 a imagen 56 modo pdf) que acogió el interdicto de derribo de árboles, esgrimiendo como reproche el destino definido del producto de madera resultante del derribo de los dos árboles de [Nombre4] y un árbol de Espavel. Señala, se sitúan tales en propiedad privada y privarle de su aprovechamiento lesiona los artículos 505 y 506 del Código Civil, en cuanto los aspectos que contiene el derecho de propiedad, que estipula se extiende sobre la superficie, plantación y obras. Aduce, el hecho de que se encuentren los árboles en la zona de protección de río conlleva a entender que la finca contiene limitaciones de índole ambiental, pero no significa que no sea parte de su inmueble y que el recurrente pueda aprovechar el recurso resultante de la corta para sufragar los gastos de la misma.

III- Se menciona en el fallo venido en alzada que se autorizó ese derribo por presentar un inminente riesgo a la salud y vida humana en caso de eventual caída según informe del MINAET. Ese mismo informe determinó que los tres árboles se sitúan en área de protección de río. La sentencia apelada dispuso en cuanto al aprovechamiento: “En cuanto al aprovechamiento maderable de los árboles que se autorizan cortar, se aclara a las partes que esta autorización únicamente le faculta para realizar la corta de árboles. El aprovechamiento de la madera resultante del mismo, en caso de que sea aprovechable, se concede a favor de la Junta de Educación de la Escuela de [Nombre2] Nombre de Nicoya, escuela de la localidad donde reside el solicitante (artículos 65 de la Ley Forestal y 12 del Código Procesal Civil), asimismo el actor deberá a su vez gestionar los permisos para la extracción, aserrío y traslado de la madera, y asumir los costos respectivos que generen esas labores.

Estará a cargo del Ministerio de Ambiente Energía y Telecomunicaciones lo relativo al control de que se corte únicamente los árboles que aquí se indican. Se le insta a la parte a que una vez realizada la tala, deberá de procurar conservar el área de protección, e incluso reforestarla con especies de la zona, especies que deberá darles un mantenimiento de poda para evitar que se alcance una altura que nuevamente ponga en riesgo la vida misma de las personas.” Único tema objeto de apelación, como se citó, es el destino del aprovechamiento de la madera resultante de la corta.

IV- Estudiados los autos, se denota que el demandado al recurrir cuestiona el tema de la naturaleza, indica en lo medular que el área de protección sobre la cual se asientan las especies forestales se ubican en su finca inscrita y por ello tiene el derecho de aprovechar la madera resultante de los árboles que se han autorizado a derribar. Para esta Cámara lleva razón el recurrente y tiene el derecho que reclama, al estar los árboles dentro de su fundo y haberlo así solicitado como parte de la pretensión de su escrito inicial. Sobre el destino de la aprovechamiento de la madera producto de los derribos de especies forestales, ha resuelto: “ .. Al efecto, estima el Tribunal sí existen ideas contradictorias y confusas en la sentencia. Respecto a la legislación aplicable, efectivamente, no existe norma alguna que directamente justifique la decisión tomada y emitida por el juzgador. Tan es así que en la sentencia no se cita artículo alguno que lo justifique.

Se cita en la resolución que rechaza la aclaración y adición el artículo 65 de la Ley Forestal 7575 porque es mencionado por el representante del Estado en el recurso de apelación en estudio, incoado ante la denegación de tales peticiones. El Procurador indica, esa norma no es aplicable porque se refiere a procesos penales en los que se conozca de ilícitos, siendo una situación diferente a la planteada en este proceso. Al respecto debe señalarse, la norma en mención dispone literalmente: “ARTÍCULO 65.- Remate de productos decomisados. Las infracciones de esta ley se denunciarán ante la autoridad judicial competente y, si se decomisa madera u otros productos forestales, la referida autoridad, previo avalúo realizado por la Administración Forestal del Estado, los rematará en subasta pública, dentro de un plazo no mayor de un mes contado a partir de la fecha en que se interpuso la denuncia.

Esos productos forestales no podrán subastarse por un valor menor al fijado por la Administración Forestal del Estado. Si transcurrido ese plazo, no se ha rematado la madera o los recursos forestales, cualquier persona podrá aprovecharlos, previo depósito, en el Tribunal, del valor asignado por la Administración Forestal. El producto del remate se depositará en la cuenta de la autoridad judicial correspondiente, mientras se define el proceso respectivo. Si el indiciado resulta absuelto, se le entregará el dinero; en caso contrario, el cincuenta por ciento (50%) le corresponderá a la Administración Forestal del Estado y el otro cincuenta por ciento (50%), a las municipalidades del lugar donde se encuentre el fundo del cual se extrajo la materia prima o donde se ubique la industria o a la asociación de indígenas, si es una en reserva indígena, para destinarlo al desarrollo de proyectos forestales; todo sin perjuicio de las responsabilidades penales que se determinen para los infractores.

Se autoriza al Ministerio del Ambiente y Energía para que, por medio de la Administración Forestal, done al Ministerio de Educación Pública la madera que llegue a su poder como resultado de un desastre natural o por ampliación de carreteras, siempre que los propietarios sean desconocidos. También donará la decomisada, una vez firme la sentencia condenatoria, y que no haya sido adjudicada en remate ni solicitada por persona alguna con los requisitos de ley. El Ministerio de Educación Pública destinará esa madera a fabricar mobiliario o reparar infraestructura en escuelas y colegios públicos o utilizarla como materia prima en las asignaturas de ebanistería, torno, carpintería y otras que impartan escuelas y colegios estatales. (Así adicionados estos dos últimos párrafos por el artículo 1, inciso b), de la ley No. 7609 de 11 de junio de 1996).” De la lectura de la norma se desprende que efectivamente, no ofrece una solución específica para el caso concreto, ventilado en sede interdictal, pues está referido a madera decomisada producto de ilícitos.

No obstante, ante la ausencia de normativa que de solución a este caso, tanto en la Ley de Jurisdicción Agraria como en los artículos 474 al 476 del Código Procesal Civil aplicado supletoriamente. Ante esa situación, y existiendo una norma referida al destino y aprovechamiento de árboles, aunque esté referida a ilícitos, es aplicable analógicamente. Al respecto, el artículo 12 del Código Civil señala: “Procederá la aplicación analógica de las normas cuando éstas no contemplen un supuesto específico, pero regulen otro semejante en el que se aprecie identidad de razón, salvo cuando alguna norma prohíba esa aplicación.”; sin que exista norma alguna en la Ley de Jurisdicción Agraria que prohíba la aplicación analógica. El artículo 65 citado, en lo que a este caso interesa, en caso de que la madera se decomise, delega la valoración y subasta de la madera u otros productos forestales a la Administración Forestal del Estado, para lo cual le confiere un plazo no mayor de un mes.

En este caso, la madera no está decomisada pues conforme a la información que consta en el expediente, está pendiente de tala. En la sentencia no se dio un plazo para la corta de los cinco árboles de laurel, omisión que debe llenarse para que el fallo sea ejecutable y se administren los riesgos que la caída de los mismos podrían generar; sin embargo se indicó, una vez talados, el Ministerio debía proceder a valorarlos, labor que estima el Tribunal es consustancial a las funciones dadas por ley al mismo, al estar integrado por funcionarias y funcionarios expertos en la temática. La norma señala además, los bienes deben rematarse en subasta pública dentro del plazo de un mes, por el monto fijado por el Ministerio; y sólo en caso de que no se logre rematar la madera o los recursos forestales, cualquier persona podrá aprovecharlos, previo depósito, en el Tribunal, del valor asignado por la Administración Forestal.

En este caso, como el producto forestal no deriva de un acto ilícito, sino de una medida preventiva, la posibilidad de aprovecharlos por cualquier persona cede ante la prioridad que debe darse a la parte demandante, pues los árboles están ubicados en una propiedad en posesión del señor [Nombre6] , de manera tal que es éste quien puede aprovecharlos tomando las medidas de prevención respectiva, en el entendido de que el valor de esos recursos forestales debe destinarse por parte de éste a la recuperación del área que resulte afectada con la eliminación de esos árboles, la cual necesariamente debe hacerse por parte del señor [Nombre6] en coordinación con las personas expertas que designe la Oficina Regional del Ministerio de Ambiente y Energía., pues al ser una zona de protección, deben sembrarse árboles endémicos o nativos de ésta, de manera tal que no debe dejarse abierta la posibilidad del demandante de sustituir los árboles de laurel que serán talados por cualquier otra especie, sino solo por aquellas que dispongan el Ministerio referido.

La norma plantea el supuesto, ajeno a este proceso, de que si la persona resulta absuelta del ilícito, se le entregará el dinero producto del avalúo, de lo contrario, el 50% del monto le corresponderá a la Administración Forestal del Estado y el otro 50% a la Municipalidad del lugar donde se encuentre el fundo para destinarlo al desarrollo de proyectos forestales; de igual forma, se autoriza al Ministerio del Ambiente y Energía para que, por medio de la Administración Forestal, done al Ministerio de Educación Pública la madera que llegue a su poder como resultado de un desastre natural o por ampliación de carreteras, siempre que las personas propietarias sean desconocidas. En este caso, no se está en presencia de productos forestales vinculados con un ilícito como para asumir distribuir el valor de éstos en un 50% a la Administración Forestal del Estado y el otro 50% a la Municipalidad. En relación con la participación de centros de enseñanza, la norma permite que el Ministerio del Ambiente y Energía done al Ministerio de Educación Pública la madera que llegue a su poder como resultado de un desastre natural o por ampliación de carreteras, siempre que los propietarios sean desconocidos; y permite la donación de madera decomisada, una vez firme la sentencia condenatoria, y que no haya sido adjudicada en remate ni solicitada por persona alguna con los requisitos de ley.

En este caso, no se está en presencia de un desastre natural, pues el objetivo del proceso es su prevención, ni de ampliación de carreteras; y aunque tales supuestos podrían asimilarse al caso en concreto, dista el supuesto señalado por la norma en el hecho de que supone, la persona propietaria del bien donde están los árboles sea desconocida. En este caso, el demandante aportó certificación registral en la que consta es el titular registral del fundo; y aunque en procesos interdictales no es posible referirse a aspectos vinculados con el derecho de propiedad conforme lo prevé el artículo 457 del Código Procesal Civil aplicado supletoriamente, el dato resulta de particular interés para determinar si los recursos forestales están dentro del terreno del demandante, descartando con ello que sea desconocida la persona dueña del fundo donde están los árboles. Ahora bien, debe agregarse, la asignación de recursos forestales al Ministerio de Educación Pública producto de ilícitos o en general, de cualquier proceso judicial, debe hacerse conforme a los fines dispuestos en la norma, es decir, para que la madera se destine a “fabricar mobiliario o reparar infraestructura en escuelas y colegios públicos”, y no simplemente pretender asignarle recursos económicos producto de los árboles sin un fin específico o sin un destino concreto, como bien lo advierte el representante estatal.

De lo transcrito, concluye el Tribunal, la sentencia no es clara; sin embargo, no podría considerarse está viciada de nulidad …. Por lo expuesto, con fundamento en los artículos 50 de la Constitución Política; 6 inciso g), 31, 49 y 65 de la Ley Forestal 7575; 12 del Código Civil; 474 al 476 del Código Procesal Civil; y 1, 6, 26, 54 y 79 de la Ley de Jurisdicción Agraria; deberá revocarse la sentencia en la parte en que dispone donar los productos forestales específicamente a la Escuela de Iroquois de Guácimo y exige al demandante pagar el valor de los productos forestales que establezca el Ministerio de Ambiente y Energía. En lo demás, objeto de apelación, deberá confirmarse la sentencia en lo atinente a la autorización que se da al señor [Nombre6] para que a partir de la firmeza de esta resolución, extraiga los cinco árboles de laurel objeto de la litis, en cuyo caso deberá tomar las medidas técnicas preventivas y precautorias que sean necesarias a fin de no causar daños a personas o bienes.

El Ministerio de Ambiente y Energía deberá tomar las medidas preventivas necesarias y controlar que el proceso de tala de los árboles de laurel se ejecute cumpliendo con las disposiciones de la Ley Forestal; y una vez realizada la corta, dicha Oficina procederá al avalúo de los productos forestales mencionados. El demandante podrá aprovechar la madera, sin necesidad de depósito alguno al encontrarse los árboles dentro de la finca inscrita a su nombre, en cuyo caso, el Ministerio de Ambiente y Energía debe otorgarle los permisos de transporte, procesamiento u otros que sean necesarios, para su aprovechamiento. …. “. En el caso en estudio, se determinó por el juez en el reconocimiento judicial y el informe del MINAE brindado al efecto, que los árboles se sitúan en las áreas de protección del río que discurre por esa propiedad, por lo que no encuentra fundamento legal la decisión de la pieza apelada de disponer que la madera producto del derribo de los tres árboles deban ser destinados a donación para la Junta de Educación de la escuela del lugar, al no ser esta madera resultante de la comisión en acto ilícito alguno.

El área de protección como figura legal se define en el artículo 33 de la Ley Forestal y su fin es de conservación y protección de los cuerpos de agua. Tales forman parte de los inmuebles que la contienen pero su uso y disfrute contiene limitaciones de índole ambiental, tales como la prohibición de construir, cultivar o desarrollar actos que pongan en peligro los cuerpos de agua. Citó el actor de este proceso en su demanda, él fue quién cultivó los árboles que solicita hoy derribar por motivos de seguridad para las personas e infraestructura alrededor, y no encuentra norma legal este Tribunal que autorice a alguna institución o ente a tomar posesión y propiedad de la madera que resulte del derribo bajo las circunstancias de este asunto. Como lo refiere el recurrente, esos árboles son parte de su fundo acorde con lo dispuesto en el artículo 505 y 506 del Código Civil. En ese orden de ideas, la Sala Constitucional de la Corte Suprema de Justicia ha resuelto en el Voto 2007-10578 del 25 de julio del 2007 el contenido del derecho de propiedad de la siguiente forma: “El derecho de propiedad tiene un contenido esencial que la Sala ha definido como la facultad de disfrutar y usar el bien para provecho personal (propiedad privada) o para utilidad pública (propiedad pública).

Por ello, so pretexto de imponer determinadas limitaciones de “interés social”, no puede la autoridad pública, sea el Legislador o el Ejecutivo, eliminar uno o varios de sus atributos esenciales. En tal situación, es decir, si las limitaciones impuestas a la propiedad vulneran el contenido esencial del derecho de propiedad, el propietario tiene derecho a ser indemnizado por ello. En este sentido, la Sala ha señalado: “Es decir, pueden limitarse los atributos de la propiedad, en tanto el propietario reserve para sí la posibilidad de explotar normalmente el bien, excluida claro está, la parte o la función afectada por la limitación impuesta por el Estado. Fuera de estos parámetros, si el bienestar social exige sacrificios de uno o de algunos únicamente, debe ser indemnizado, lo mismo que ocurre cuando el sacrificio que se impone al propietario es de tal identidad, que lo hace perder en su totalidad el bien.

Así, la limitación a la propiedad resiste el análisis constitucional, cuando la afectación a los atributos esenciales de la propiedad que son aquellos que permiten el uso natural de la cosa dentro de la realidad socio-económica actual, no hace desaparecer la naturaleza del bien o no haga imposible el uso de la cosa, porque el Estado imponga requisitos de autorización o de aprobación tan complejos que impliquen de hecho, la imposibilidad de usufructuar el bien”. (sentencia N° 2345-96).” De tal forma, estima esta Cámara el derecho de aprovechar la madera de los árboles que se derribarán ubicados en su propiedad inscrita le asiste como parte del derecho de uso, disfrute y aprovechamiento de su fundo y sus productos. Resolver lo contrario sin que hubiera mediado una conducta que hubiere sido sancionada por falta administrativa o penal, conlleva a confiscar sin fundamento legal propiedad privada. Por lo que procede revocar en lo apelado el auto sentencia cautelar.

V- Por las razones expuestas, con fundamento en los artículos 1, 2 y 26 de la Ley de Jurisdicción Agraria, 108 del Código Procesal Civil aplicable en virtud del Transitorio I de Ley 9343, I y II de Ley 9342, 33 de la Ley Forestal y 65 de su Reglamento, en lo apelado, se revoca parcialmente la sentencia interdictal de las 14:30 horas del 24 de enero del 2019 en cuanto resolvió que el aprovechamiento de la madera resultante del mismo, en caso de que sea aprovechable, se concede a favor de la Junta de Educación de la Escuela de [Nombre2] Nombre de Nicoya, escuela de la localidad donde reside el solicitante. En su lugar, se reconoce a la sociedad Familia Castillo Villegas de [Nombre2] Nombre S.A. para aprovechar la madera que se obtenga de los árboles que se autoriza derribar; mediando la debida obtención y cumplimiento de los permisos y requisitos legales para tal fin.

POR TANTO

En lo apelado, se revoca parcialmente la sentencia interdictal de las catorce horas treinta minutos del veinticuatro de enero del dos mil diecinueve en cuanto resolvió que el aprovechamiento de la madera resultante del mismo, en caso de que sea aprovechable, se concedía a favor de la Junta de Educación de la Escuela de [Nombre2] Nombre de Nicoya, escuela de la localidad donde reside el solicitante. En su lugar, se reconoce a la sociedad Familia Castillo Villegas de [Nombre2] Nombre S.A. para aprovechar la madera que se obtenga de los árboles que se autoriza derribar; mediando la debida obtención y cumplimiento de los permisos y requisitos legales para tal fin.
