Decision: 2019-0675 Case file: 11-002135-0485 PE(4) CRIMINAL JUDGMENT APPEALS COURT. Second Judicial Circuit of San José. Goicoechea, at nine ten a.m. on the twenty-sixth of April, two thousand nineteen.- APPEALS filed in these proceedings against Nombre01, of legal age, Costa Rican, holder of identity card number CED01 , born in San José on February 5, 1954, son of Nombre01, unmarried, a farmer, resident of Limón, Pococí, Isla Calero; for the offenses of ENCROACHMENT UPON A CONSERVATION AREA AND ANOTHER OFFENSE, to the detriment of NATURAL RESOURCES. Judge Hannia Soto Arroyo and Judges Roy Antonio Badilla Rojas and Aisen Herrera López participated in deciding the appeals. Attorney José Salazar Monge, public defender for the accused; Attorney Federico Quesada Soto, Criminal State Attorney; and Attorney Liz Lovemore Sánchez, representing the Public Prosecution Service, Office of the Deputy Prosecutor for Pococí and Guácimo, appeared before this Court.
WHEREAS:
I.By judgment number 161-2018, issued at fifteen hours and fifteen minutes on the second of April, two thousand eighteen, the Criminal Court of the Second Judicial Circuit of the Atlantic Zone, Pococí Seat, ruled: “THEREFORE (POR TANTO): In accordance with the provisions of Articles 8 subsection 2) of the American Convention on Human Rights; 14 of the International Covenant on Civil and Political Rights; Articles 39 and 41 of the Political Constitution; Articles 1, 12, 18 through 20, 21, 30, 31, and 71 of the Criminal Code; 1 through 15, 37 through 41, 75 through 80, 265, 324, 360 through 367 et seq. of the Code of Criminal Procedure; 1, 4, 7, 11, 18, 20, 30, 31, 45, 47, 50, 51, 59 through 63, 71, 74, and 110 of the Criminal Code; and 19, 58 subsections a) and b), and 61 of the Ley Forestal, Nombre01 is hereby found criminally responsible as the perpetrator of the offense of EXPLOITATION OF FOREST RESOURCES (APROVECHAMIENTO DE RECURSOS FORESTALES), and is therefore sentenced to THREE MONTHS’ IMPRISONMENT.
He is likewise sentenced to THREE MONTHS’ IMPRISONMENT for the offense of ENCROACHMENT UPON A CONSERVATION AREA (INVASION A UN AREA DE CONSERVACIÓN), with both offenses in a real concurrence of offenses (concurso material) and to the detriment of the ENVIRONMENT, and in that capacity he is sentenced to A TOTAL OF 6 MONTHS’ IMPRISONMENT, to be served at the place and in the manner prescribed by the applicable prison regulations, with credit for any pretrial detention (prisión preventiva) served. Pursuant to Articles 59 through 63 of the Criminal Code, the benefit of a suspended sentence (ejecución condicional de la pena) is granted for a period of THREE YEARS, during which he must not commit another intentional offense punishable by more than six months. The cessation of the occupancy of the Refugio de Vida Silvestre Corredor Fronterizo Costa Rica-Nicaragua is likewise ordered, and he is prohibited from again encroaching upon protected State lands.
Restoration to the prior condition (restablecimiento de las cosas a su estado anterior) is ordered, for which the accused is granted a period of SIX MONTHS from the date the judgment becomes final to remove his belongings, poultry, livestock, and any other domestic animal or animal used for agricultural or livestock production; he must vacate the encroached-upon land, demolish any structure erected there, and remove all nonbiodegradable rubble and waste. Otherwise, once that month has elapsed, SINAC Tortuguero is directed to proceed as ordered herein. The accused, Nombre01, is warned that any act of noncompliance with an order issued by a judicial authority may constitute the offense of disobedience of authority (desobediencia a la autoridad). The forfeiture (comiso) of the seized and confiscated property is ordered. The civil claim for damages (acción civil resarcitoria) is granted, and the accused is ordered, with the amount to be determined in subsequent proceedings (en abstracto), to pay for the environmental damage arising solely from the criminal activities proven against him herein.
With respect to the offense of LAND-USE CHANGE (CAMBIO DE USO DE SUELO), pursuant to the universal principle of in dubio pro reo, the defendant Nombre01 IS ACQUITTED of all punishment and liability. This judgment is rendered without a special award of costs, and the costs of the proceedings shall be borne by the State. Once this judgment becomes final, the corresponding notices shall be issued to the Instituto Nacional de Criminología, the Sentence Enforcement Court (Juzgado de Ejecución de la Pena), the Registro Judicial, and SINAC Tortuguero. NOTICE SHALL BE GIVEN.-” (sic.).
II.Attorney José Salazar Monge, public defender for the accused, and Attorney Federico Quesada Soto, Criminal State Attorney, filed appeals against the foregoing decision.
III.Following the corresponding deliberation in accordance with Article 465 of the Code of Criminal Procedure (as amended by Laws Nº 8837 and Nº 9021 and following the numbering specified in the Errata adopted by resolution of the Legislative Directorate published in La Gaceta Nº 51 of March 12, 2012, which is the numbering used in this text), the Court considered the issues raised in the appeal.
Criminal Judgment Appeals Judge Soto Arroyo authors the opinion; and,
CONSIDERING:
I.Attorneys José Salazar Monge, public defender for Nombre01, and Federico Quesada Soto, Criminal State Attorney, filed appeals against judgment N° 161-18, issued at 15:15 hours on April 2, 2018, by the Criminal Court of the Second Judicial Circuit of the Atlantic Zone, Pococí Seat. Pursuant to Articles 437, 438, 439, 458, 459, 460, and 462 of the Code of Criminal Procedure, the appeals satisfy the statutory requirements for consideration on the merits.
II.The judges whose signatures appear at the foot of this judgment proceed to decide this matter in accordance with the provisions adopted by the Consejo Superior at session 89-18 of October 11, 2018, Article XLVII, which approved the establishment of temporary sections within the Criminal Judgment Appeals Court of the Second Judicial Circuit of San José, pursuant to the authority conferred upon that Council by Article 81 of the Ley Orgánica del Poder Judicial (LOPJ) to remedy the situation of courts whose caseloads are not current; and under the “Plan de descongestionamiento del Tribunal de Apelación Penal Segundo Circuito Judicial de San José,” which forms part of an institutionally significant project directed by the Presidencia de la Corte and sponsored by the Consejo Superior to address the oldest matters pending before this Court, as objectively determined by the dates on which they were filed, through the application of Articles 44 and 81 of the LOPJ, Circular de Corte Plena 16-2015, and subsection 10.1 of the Plan de Vacaciones del Período 2017-2018.
It was decided that this remedial plan would operate between November 1 and December 15, 2018, in an effort to resolve the oldest matters—as reiterated above—consistent with the principle of prompt and effective justice (principio de justicia pronta y cumplida) under Article 41 of the Political Constitution and Article 4 of the Code of Criminal Procedure. Subsequently, through a resolution adopted by the Consejo Superior del Poder Judicial at extraordinary session N°110-18 held on December 19, 2018, continuation of the remedial plan from January 7 through March 31 of the current year was approved. It is important to emphasize that this plan does not affect the principle of the natural judge (principio de juez natural), because: i) the law expressly provides that “By reason of the volume of work and the required efficiency of the public administration of justice, the Court may appoint additional members of the courts, either temporarily or permanently” (Article 46 of the LOPJ); ii) the same statute further provides that, in multi-member courts (tribunales colegiados), members of the different sections may substitute for one another for justified reasons, such as providing the service more efficiently and reducing the backlog in accordance with the guidelines of an institutional plan (cf.
Article 33 of the LOPJ); iii) this is not a court or a group of judges specially appointed for a particular case, ad hoc or ex post facto, but rather the previously established court empowered under the Political Constitution and preexisting laws to hear these matters (cf. Article 35 of the Political Constitution; Article 10 of the Universal Declaration of Human Rights; Article 26 of the American Declaration of the Rights and Duties of Man; Article 14.1 of the International Covenant on Civil and Political Rights; Article 8.1 of the American Convention on Human Rights; Article 3 of the Criminal Code; and Articles 33, 46, and 93 of the LOPJ); and iv) in any event, appeals in which evidence was presented orally during the proceedings or in which an oral hearing (vista) was held at which the grounds were expanded must be decided by the same judges who received that evidence or conducted the oral hearing, pursuant to the final paragraph of Article 464 of the Code of Criminal Procedure.
III.Appeal filed by attorney José Salazar Monge, public defender for Nombre01. The sole ground of appeal alleges erroneous reasoning (fundamentación intelectiva) based on an incorrect analysis of the mistake of law (error de prohibición). Appellant states that the defendant was convicted of the offense of illegal exploitation of forest resources (aprovechamiento ilegal de recursos forestales) and the offense of encroachment upon a conservation area (invasión de área de conservación). In his view, the conviction for the second offense is contrary to law because the Trial Court states that the defendant claims to hold privately acquired title to the property. This is not apparent from the defendant’s testimony or the defense strategy, nor is it what the documents submitted to the proceedings by his defense counsel contain. He states that what occurred was a mistake of law because, as the defendant explained, when he first became acquainted with the land and was given the opportunity to acquire it, the site was a developing settlement (with a grocery store, school, and bar), and he completed the sale and purchase through a notary public, which, in his view, gave the transaction a formal character; he was not warned of any irregularity concerning the land or its acquisition, and the seller had possessed the land for 20 years.
Furthermore, the defendant has little formal education, and his home was frequently visited by personnel from MINAET, the Ministry of Public Security, and the Public Force because of its location, yet no authority told him that he was within a protected area. The defendant even stated that, because of a failed sale and purchase, his property had been the subject of litigation before the agrarian courts, in which the ruling was in his favor, and he likewise was not warned about the status of his property. On folios 257 and 258 of the judgment, the Court attempts to refute the existence of a mistake of law by stating that the agrarian judge informed him that the area was within the river protection area and within the two-kilometer border zone, but the judgment does not warn him that his continued presence at the site was unlawful. In addition, appellant states that the Court faults the defendant for excusing himself on the ground that other people lived at the site, that he never prepared a cadastral survey plan (plano catastrado) for the land or registered it, and that he still lives there—all matters that do not disprove the existence of a mistake of law.
The Court thereby disregarded the defendant’s testimony and the nature of the mistake, resulting in the prejudice of his conviction. Appellant requests that the judgment be vacated and the case remanded for new proceedings. The claim is denied. After a detailed analysis of the judgment, this Court of Appeal finds that the Trial Court did, in fact, substantiate its finding that the mistake of law alleged by the defense did not exist. First, it should be noted that a mistake of law occurs when the perpetrator believes that he is acting lawfully or does not even contemplate that his conduct might in some way be unlawful. For purposes of the judgment, this means that, if the existence of such a mistake is ruled out, the Court must be fully convinced that the defendant knew his conduct was unlawful and must expressly state that finding on the basis of compelling evidence. In the present case, the court below (A quo) determined as follows: “....
Nevertheless, the defendant’s counsel and the defendant himself argued that, although the defendant’s conduct was both typical conduct (conducta típica) and unlawful conduct (conducta antijurídica), it was not culpable because of a mistake of law. This argument is based on the defendant’s statement that he had acquired the property before an attorney and had initially even paid two million colones for it. At that time, other people were already living in the same place, and there were other people whom he considered neighbors, as well as grocery stores, bars, schools, etc., which led him to presume that he could exercise acts of possession (actos de posesión) without violating any particular rule. He also states that there was an agrarian proceeding in which a judge heard a claim filed by a third party who had purchased the property from him and who, because he was unable to pay the amount for which the parcel had been sold, had to return the property, which the defendant understood to mean that the court had ‘ruled in his favor.’ He adds that not only did these circumstances lead him to understand that the tract of land could be possessed without any problem, but he also received members of DIS, the Government, the Public Force, and MINAET, persons who, around the time news broke of the Nicaraguan incursion into Isla Calero, ate his provisions, slept under his roof, and never informed him that he was doing anything improper.
He states that his neighbors have a survey plan bearing even the MINAET seal and that this means an inspection must have been conducted at that location, yet they are still allowed to live there and occupy the land. On the basis of all these circumstances, he states that he mistakenly believed he could possess two hundred hectares in that area, live there, and maintain the site without committing an offense. This argument must be rejected. Even assuming that he acquired the land believing that his possession was entirely lawful because other people were present at the site and because he had purchased his possessory right (derecho de posesión) before a legal professional, the fact remains that the proven facts do not concern the manner in which he allegedly acquired that right—which, according to the private sale and purchase agreement appearing at folios 229 and 230, occurred in the year 2000—but rather the acts of possession carried out after the judge of the Agrarian Court informed him that the area in which the property at issue was located lay within the river protection area and within the two-kilometer border zone (See folio 43).
The fact that other people live there cannot be understood as giving rise to a presumption in his favor that he may lawfully occupy a protected area. Although it is true that the property was acquired before an attorney, and even assuming that, because of his limited education, Nombre01 considered that sufficient to establish the lawfulness of his possession, it is highly questionable that, since the year two thousand, he has shown no interest in registering that right in the Property Registry, obtaining the corresponding survey plan, or, particularly after the agrarian proceeding in which his possession was challenged, undertaking any procedure to obtain an endorsement (visado) from MINAET or the Municipalidad de Pococí, pursuing any registration procedure, or submitting any claim to the Administration generally in order to justify his occupation within a Wildlife Refuge (Refugio de Vida Silvestre) protected because of its environmental value.
Nevertheless, despite all this, Nombre01 continues to live at that location, meaning that, to this day, the offense of encroachment has continued permanently over time, although he is aware that it is a protected area and cannot claim ignorance of the law or of the consequences of his actions at that location from the year 2010 to the present... ” (f. 257 reverse-258, quoted verbatim). The arguments set forth by the Trial Court completely rule out the possibility that the defendant believed he was lawfully living on his property. Even accepting that the defendant has little formal education, as the Court itself notes, the circumstances listed in the judgment—such as the fact that there is virtually a village at the site, that the defendant acquired the land through a sale and purchase carried out by a notary, and that officials from MINAE, the Public Force, DIS, and other government entities visited his home on numerous occasions without questioning its location—do not support the existence of a mistake of law, because the defendant knew, as stated in the judgment and as he was informed in the decision of the Agrarian Court (folio 43 of the record), that the status of his property was unlawful, as is clearly stated in the following passage: “... in view of the evidence of logging and because the location is within the river protection area and within the two-kilometer border zone, it is ordered that certified copies of the relevant records (testimonio de piezas) be sent to the Public Prosecutor’s Office so that this matter may be investigated and it may be determined whether such conduct constituted a violation of the law....” Even considering the defendant’s limited education, the Agrarian Court’s decision establishes that his presence on the land at issue warranted examination in criminal proceedings precisely because of its unlawful status.
Finally, the court below states that it is “questionable that, since the year two thousand, he has shown no interest in registering (the defendant’s) right in the Property Registry, obtaining a cadastral survey plan, or, particularly after the agrarian proceeding in which his possession was challenged, undertaking any procedure to obtain an endorsement from MINAET or the Municipalidad de Pococí, pursuing any registration procedure, or submitting any claim to the Administration generally in order to justify his occupation within a Wildlife Refuge protected because of its environmental value...” (f.258). This assertion further strengthens the position of the court below because, despite the agrarian judgment, the defendant indeed avoided undertaking any governmental procedure concerning his property. Accordingly, this Court of Appeal finds that the judgment contains sufficient reasoning, as quoted above, to support the conviction for the offense of encroachment upon a conservation area, and the claim is therefore denied.
IV.Appeal filed by Federico Quesada Soto, Criminal Prosecutor. In the sole ground of his appeal, the appellant alleges an erroneous assessment of the circumstantial evidence (prueba indiciaria). With respect to the offenses of land-use change (cambio de uso del suelo) and destruction of the wetland (humedal), analyzed in the fourth recital of the judgment, the Court determined that the environmental damage could not be attributed to the accused because it could not be established that he alone occupied the property or how the perimeter of the cleared area was determined. He states that the defendant, Nombre01, said that he transferred possession of the property to Nombre02 from 2007 to 2009, as may be inferred from case N°09-128-507-AG, which establishes that Nombre02 cleared 25 hectares of forest. According to the Court, this means that a person other than the accused, at the same location identified by MINAE, felled trees and changed the use of the land.
The witnesses stated that there had been a pasture (potrero) in the area, but they could not define the area of that pasture with certainty. The judgment also states that the SINAC reports and maps do not indicate which area was cleared and which area had been pasture. In his view, this contradicts the content of the evidence, namely: a.) the agrarian proceeding shows that, beginning in 2009, the defendant exercised acts of possession over the land; b.) on 14 April 2010, the agrarian proceeding was conducted at the defendant’s residence; c.) the clearing of 25 hectares occurred between 2007 and 2009; d) since 2009, the defendant has not carried out any further activity in the cleared 25-hectare area; e.) by February 2018, when the accused testified, that area was already secondary forest; f.) the defendant only maintains scrubland (charral), which is the old pasture that existed in the area.
Thus, it is not plausible that anyone other than the accused cleared the charged 5.3 hectares, particularly because the SINAC inspection was conducted in 2011, when the 25 hectares were already undergoing regeneration, whereas the clearing of the 5,3 hectares had occurred 4 months earlier. Second, he states that the testimony of Nombre03, a SINAC official, indicated that he saw the cleared 5.3-hectare area from the air, where a palustrine forest (bosque Palustrino) had existed, with all the trees felled or cut, and that the land-use change occurred between February and March 2011 because there was fresh sawdust and fresh sap on the stumps, as well as undecomposed trunks with leaves on their branches, all adjacent to the cleared forest area, which is now a pasture established 5 or 7 years ago. For his part, the witness Nombre04 stated that the cleared area had been a palustrine forest, that there were felled trees on the ground in an area of 5.3 hectares, and that timber was visibly being hauled from the site.
It is evident that the 5.3-hectare area is not part of the 25 hectares previously cleared because it bordered mature forest and was determined to have been cleared between 2010-2011. As a third point, the appellant states that insufficient weight was given to the photographs in report ACTO-GASP-RNVSBC-PO-031-2011, which show the sawdust, sap, and clearing that the judgment found to be absent. Nor is the doubt expressed in the judgment concerning the manner in which the inspection of the area was conducted valid merely because the area was initially observed from the air; the judgment discounted the credibility of the testimony of Nombre04 and Nombre03 without further reasoning. Moreover, there are ground-level photographs of the area. In sum, the appellant states that the evidence presented establishes the following: “...a.) the defendant took possession of that property in 2000, clearing an area of scrubland—according to his statement during examination—even though in the agrarian proceeding he stated that he had cleared 6 ha of forest, and maintaining it as the old pasture area; b) after the agrarian proceeding, the defendant became aware that clearing was prohibited at that site and that it was located within the 2 km border zone; c) the defendant, at least since 2009, took (sic) possession of that State-owned land, exercising acts of that nature to the point that he lived at the site with his wife and son; d) the site is extremely remote, forested, and difficult to access by water; e) on the day of the inspection, in June 2011, the accused was conducting timber-harvesting activities (aprovechamiento forestal), using suitable equipment for that purpose—2 chainsaws that belonged to him—in a pasture area near the cleared forest; d) the cleared palustrine forest area expanded the old pasture area, and the defendant was the only person who benefited from it; e) it is impossible that the defendant did not notice clearing of such (sic) magnitude, since his house is near the affected site; f) the benefit from timber harvesting clearly accrued to the accused...” (quoted verbatim, f. 281-282).
The appellant requests that the judgment be vacated as to the acquittal and that the case be remanded for new proceedings. The claim has merit. Regarding the offense of Land-use Change, Article 61(c) of the Ley Forestal provides: “...A term of imprisonment of one month to three years shall be imposed on anyone who: (..) c) Carries out activities involving a change in land use contrary to the provisions of Art. 19 of this law. In the foregoing cases, the products shall be seized and placed at the disposal of the competent judicial authority...”. In the judgment, the accused was acquitted of this offense on the following grounds: “.....Based on that information, it must be asked: if the existing pasture area of which he was already aware was one hectare and the devastated area was five hectares, where were the twenty-five hectares that the plaintiff in the agrarian proceeding stated under oath that he had cleared in order to convert them into pasture?
It is also especially important to point out that, during the adversarial proceedings, that witness was very clear in stating that the leaves on the trees were dry but still attached to the trees; that some of the sawdust appeared fresh; that sap from species such as Sangrillo was still present; and that there were skid trails (trillos de arrastre) at the site along which some of the felled trees had been transported. However, such information is absent not only from the report he prepared, but there is not a single photograph from the inspection they conducted showing leaves attached to tree branches, skid trails, the color of the sap, the presence of sawdust, cut yolillos, or the color of the bark, which could substantiate the time frame he calculated for when the alleged devastation occurred. Moreover, the photographs incorporated into the report prepared by that witness show precisely the identified pasture area, to such an extent that, at folio 7, the building described as Nombre01’s house can be seen only a few meters away.
The same situation is reflected at folio 8, where, far from showing attached leaves, fresh sawdust, or devastation of the understory (sotobosque), a fallen trunk without attached leaves can be seen, surrounded by cattle and diverse vegetation. These elements, including the descriptions of the photographs themselves at folio 8, indicate that the sawn trees were located only 40 meters from the San Juan River, which makes it possible to establish that those photographs were taken in the pasture area that the witness stated had already been established. There is no doubt that this area was adversely altered, since countless stumps are plainly visible and constitute clear evidence of forest damage that occurred at some point. There is a high degree of probability that the defendant, Nombre01, contributed to making such deplorable modifications to the habitat protected there, since he was apprehended while harvesting several trees, as has already been established.
However, for his benefit, the investigation was not sufficiently complete to move from that probability to the required certainty and establish the recency of the alleged clearing. It could not be established how the inspection was conducted at the site shown in the aerial images—where a large number of trunks can be seen lying practically together on the ground—or whether the report refers specifically to the pasture area or to the forest area located by GPS. The investigation did not include a count of the fallen trees or of the stumps present at the forested site; rather, what is shown is a photograph of many stumps, apparently in the area adjoining the defendant’s residence, which was described as pasture. No plot measurements were taken to determine the area in which the sampling was conducted. Nor do the aerial photographs that supposedly correspond to the site possessed by Mr. Nombre01 show the location of his house, the San Juan River, the corral, the paddocks, the fence mentioned by the witness, or any other identifying feature of the location that would make it possible to determine how much of that land was recently devastated and how much had already been established as pasture.
This doubt was not resolved by the witness Nombre03...” (f. 262-263). After analyzing the case and the evidence, as well as the Court’s reasoning, this Chamber of Appeals finds that the Trial Court’s analysis did not assess all of the evidence, because it lacks an examination of the inspection and the report at folio 1, as well as of the entirety of the testimonial evidence. Both contain details of the case requiring analysis, such as the items found near the defendant’s house on the day of the inspection and the matters observed by the prosecution witnesses, including the felled trees, the condition of the trunks, and the dates on which these signs were reportedly observed, etc. All of these elements must be reviewed again in order to determine whether the defendant is responsible for the offenses with which he is charged. Accordingly, the ground of appeal is granted. The judgment is vacated with respect to the acquittal on the offense of Land-use Change, and the case is remanded for new proceedings.
POR TANTO:
The appeal filed by the public defense is denied. The appeal filed by the Procuraduría General de la República is granted. The judgment is vacated solely with respect to the acquittal on the offense of Land-use Change, and the case is remanded for new proceedings. The remainder of the judgment is undisturbed. Resolución: 2019-0675 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las nueve horas diez minutos, del veintiséis de abril de dos mil diecinueve.- RECURSOS DE APELACIÓN interpuestos en la presente causa seguida contra Nombre01, mayor, costarricense, cédula de identidad número CED01 , nacido en San José el 5 de febrero de1954, hijo de Nombre01, soltero, de oficio agricultor, vecino de Limón, Pococí, Isla Calero; por el delito de INVASIÓN A UNA ÁREA DE CONSERVACIÓN Y OTRO, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión de los recursos la jueza Hannia Soto Arroyo, los jueces Roy Antonio Badilla Rojas y Aisen Herrera López. Se apersonaron en esta sede el licenciado José Salazar Monge, defensor público del encartado; el licenciado Federico Quesada Soto, Procurador Penal y la licenciada Liz Lovemore Sánchez, en representación del Ministerio Público, Fiscalía Adjunta de Pococí y Guácimo.
RESULTANDO:
I.Que mediante sentencia número 161-2018, de las quince horas quince minutos, del dos de abril de dos mil dieciocho, el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Sede Pococí, resolvió: "POR TANTO: De conformidad con lo establecido en los artículos 8 inciso 2) de la Convención Americana de Derechos Humanos; 14 del Pacto de Derechos Civiles y Políticos; artículos 39 y 41 de la Constitución Política; artículos 1, 12, 18 a 20, 21, 30, 31, 71, del Código Penal; 1 al 15, 37 a 41, 75 a 80, 265, 324, 360 a 367 y siguientes del Código Procesal Penal 1, 4, 7, 11, 18, 20, 30, 31, 45, 47, 50, 51, 59 a 63, 71, 74, 110 del Código Penal, 19, 58 incisos a) y b) y 61 de la Ley Forestal, se declara a Nombre01 autor responsable de un delito de APROVECHAMIENTO DE RECURSOS FORESTALES, y en tal sentido se le impone la pena de TRES MESES DE PRISION. De igual forma se le condena a TRES MESES DE PRISION por un delito de INVASION A UN AREA DE CONSERVACIÓN, ambos delitos en concurso material y en perjuicio del MEDIO AMBIENTE, y en tal carácter se le impone UN TOTAL DE 6 MESES DE PRISION, que deberá descontar en el lugar y forma que determinen los respectivos reglamentos penitenciarios, previo abono de la prisión preventiva que hubiere cumplido.
En aplicación de los artículos 59 a 63 del Código Penal, se concede el beneficio de ejecución condicional de la pena por un período de TRES AÑOS, durante los cuales deberá de no cometer nuevo delito doloso con sanción superior a los seis meses. De igual forma, se ordena el cese de la ocupación en el Refugio de Vida Silvestre Corredor Fronterizo Costa Rica-Nicaragua y se le prohíbe invadir nuevamente terrenos protegidos del Estado. Se ordena el restablecimiento de las cosas a su estado anterior para lo cual se le da al imputado el plazo de SEIS MESES a partir de la firmeza del fallo para sacar sus pertenencias, aves de granja, ganado y cualquier otro animal doméstico o de explotación agropecuaria, debiendo desalojar el terreno invadido debiendo demoler cualquier estructura ahí constituida eliminando los escombros y desechos que no sean biodegradables. Caso contrario, una vez transcurrido ese mes se comisiona al SINAC Tortuguero para que proceda conforme lo aquí ordenado.
Se le hace la advertencia al imputado Nombre01, que cualquier acto de desacato de la orden emitida por una autoridad judicial podrá constituir el delito de desobediencia a la autoridad. Se ordena el comiso de los bienes secuestrados y decomisados . Se declara con lugar la acción civil resarcitoria, y se condena al imputado en abstracto al pago del daño ambiental únicamente derivado de las actividades delictivas que le fueron aquí acreditadas. Con respecto al delito de CAMBIO DE USO DE SUELO, en aplicación del principio universal in dubio pro reo, SE ABSUELVE de toda pena y responsabilidad al justiciable Nombre01. Se dicta esta sentencia sin especial condenatoria en costas, son los gastos del proceso a cargo del Estado. Una vez firme esta sentencia expídanse las comunicaciones respectivas ante el Instituto Nacional de Criminología, el Juzgado de Ejecución de la Pena, el Registro Judicial y el SINAC Tortuguero. NOTIFÍQUESE.-" (sic.).
II.Que contra el anterior pronunciamiento interpusieron recurso de apelación el licenciado José Salazar Monge, defensor público del encartado y el licenciado Federico Quesada Soto, Procurador Penal.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal (reformado por leyes Nº 8837 y Nº 9021 y siguiendo la numeración indicada en la Fe de Erratas adoptada mediante acuerdo del directorio legislativo publicado en La Gaceta Nº 51 del 12 de marzo de 2012, que es la que se usará en este texto), el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta la jueza de Apelación de Sentencia Penal Soto Arroyo; y,
CONSIDERANDO:
I.Los licenciados José Salazar Monge, defensor público de Nombre01 y Federico Quesada Soto, Procurador Penal, interponen recursos de apelación, contra la sentencia N° 161-18, de las 15:15 horas, del 2 de abril de 2018, dictada por el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, sede Pococí. De conformidad con los artículos 437, 438, 439, 458, 459, 460 y 462 del Código Procesal Penal, los recursos de apelación reúnen los requisitos de ley para su conocimiento por el fondo.
II.Se procede a resolver el presente asunto, por las personas juzgadoras que firman al pie de esta sentencia, de conformidad con lo dispuesto por el Consejo Superior en la sesión 89-18 del 11 de octubre de 2018, artículo XLVII, que aprobó la conformación de secciones emergentes en el Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José, conforme a las atribuciones que el artículo 81 de la Ley Orgánica del Poder Judicial (LOPJ) le da ese Consejo para remediar la situación de los despachos que no se encuentren al día; y mediante el "Plan de descongestionamiento del Tribunal de Apelación Penal Segundo Circuito Judicial de San José", que se circunscribe dentro de un proyecto de interés institucional, que dirige la Presidencia de la Corte, con el patrocinio del Consejo Superior, para dar atención a los asuntos de más antigüedad de este despacho (lo que se determina objetivamente conforme a la fecha en que ingresaron al mismo), mediante la aplicación de los artículos 44 y 81 de la LOPJ, la Circular de Corte Plena 16-2015 y el inciso 10.1 del Plan de Vacaciones del Período 2017-2018.
Se dispuso que este plan remedial se ha de desarrollar entre el 1 de noviembre y el 15 de diciembre de 2018, para procurar que se resuelvan los asuntos de más antigüedad –se reitera–, lo que se conforma al principio de justicia pronta y cumplida (artículos 41 de la Constitución Política y 4 del Código Procesal Penal). Posteriormente, mediante acuerdo tomado por el Consejo Superior del Poder Judicial, en sesión extraordinaria N°110-18 celebrada el 19 de diciembre del 2018 se aprobó la continuidad del plan remedial desde el siete de enero al treinta y uno de marzo del año en curso. Es importante subrayar que este plan no afecta el principio de juez natural, porque: i) la ley dispone expresamente que "En razón del volumen de trabajo y la obligada eficiencia del servicio público de la justicia, la Corte podrá nombrar más integrantes de los tribunales, en forma temporal o definitiva" (articulo 46 de la LOPJ); ii) porque el mismo texto legal dispone además que en los tribunales colegiados, los integrantes de sus diferentes secciones pueden sustituirse recíprocamente por motivo justificado (como lo es brindar el servicio con mayor eficiencia y reducir la mora conforme a los lineamientos de un plan institucional, cfr. artículo 33 de la LOPJ); iii) porque no se trata de un tribunal o de jueces designados especialmente para un caso concreto, ad-hoc o ex post facto, sino del tribunal establecido con anterioridad, de acuerdo a la Constitución Política y leyes preexistentes, para conocer de estos asuntos (cfr. artículos 35 de la Constitución Política; 10 de la Declaración Universal de Derechos Humanos; 26 de la Declaración Americana de los Derechos Humanos; 14.1 del Pacto Internacional de Derechos Civiles y Políticos; 8.1 de la Convención Americana sobre Derechos Humanos; 3 del Código Penal, 33, 46 y 93 de la LOPJ); y iv) porque, en todo caso, las apelaciones en cuyo trámite se evacuó prueba oralmente o medió una audiencia oral (vista) en la que se hayan ampliado fundamentos, han de ser resueltas por los mismos jueces que la hayan recibido o celebrado la audiencia oral, conforme a lo dispuesto en el párrafo final del artículo 464 del Código Procesal Penal.
III.Recurso de apelación presentado por el licenciado José Salazar Monge, defensor público de Nombre01. El único motivo de apelación acusa errónea fundamentación intelectiva por equivocado análisis del error de prohibición. Indica el recurrente que al acusado se le condenó por un delito de aprovechamiento ilegal de recursos forestales y un delito de invasión de área de conservación. Según su criterio, la condena por este segundo delito, no se ajusta a derecho, en tanto el Tribunal de Juicio señala que el acusado alega tener títulos de propiedad sobre el inmueble adquiridos de forma privada. Ello no se desprende de la declaración del acusado o a la estrategia de defensa, ni es lo que contienen los documentos aportados por su defensor al proceso. Indica que lo sucedido es un error de prohibición, pues como lo explicó el acusado, cuando él conoció el terreno y se le presenta la oportunidad de adquirirlo, el sitio era un caserío en desarrollo (con pulpería, escuela, bar), y la compraventa la realiza por medio de una notaria pública, lo que en su criterio, le dio formalidad al negocio y no se le advirtió de ninguna anomalía en el terreno o su adquisición y el vendedor tenía 20 años de poseer el terreno.
Además, el acusado es de baja escolaridad e incluso en su casa muchas veces recibió visitas del MINAET, Ministerio de Seguridad y Fuerza Pública dada la ubicación de ésta, y ninguna autoridad le señaló que estaba dentro de zona protegida. Incluso, señaló el acusado que por una compra venta fallida, su propiedad estuvo en litigio en los tribunales agrarios, proceso en el que se le dio la razón e igualmente no se le advirtió de la situación de su propiedad. A folio 257 y 258 del fallo, el Tribunal intenta desvirtuar la existencia del error de prohibición, señalando que el Juez agrario le señaló que la zona estaba dentro del área de protección del río y dentro de los dos kilómetros fronterizos, pero en la sentencia no se advierte de la ilegalidad de su permanencia en el sitio. Aunado a ello, señala el recurrente que el Tribunal le achaca al acusado excusarse en que en el sitio vivían otras personas y que nunca hizo un plano catastrado del terreno ni lo inscribió y que aún vive ahí, aspectos todos que no desacreditan la existencia de un error de prohibición, dejando de lado la declaración del acusado y la naturaleza del error, lo que trae como agravio la condena en su contra.
Solicita el recurrente se anule el fallo y se ordene el reenvío para una nueva sustanciación. Se declara sin lugar el alegato. Esta Cámara de Apelación, tras un análisis detallado del fallo, considera que, efectivamente, el Tribunal de Juicio sustentó la inexistencia del error de prohibición alegado por la defensa. En primer término, debe señalarse que el error de prohibición se da cuando el autor cree que actúa forma lícita o ni siquiera se plantea que su conducta puede ser ilícita en alguna forma. Esto implica, para fines de la sentencia, que en caso de descartarse su existencia, el Tribunal debe tener pleno convencimiento de que el acusado sabía de su actuar ilícito y así plasmarlo, con base en elementos probatorios de peso. En el caso concreto, el A quo determinó lo siguiente: ".... No obstante, la defensa técnica y material del encartado alegaron que la conducta del encartado si bien ha sido una conducta típica y antijurídica, que la misma no es culpable por la existencia de un error de prohibición.
Para justificar dicho argumento, se parte de la declaración del imputado, que refirió haber adquirido dicha propiedad frente a un abogado, incluso haber pagado por ella dos millones de colones en un primer momento. Que para ese entonces, ya habían otras personas viviendo en ese mismo lugar, así como otras personas que tenía como vecinos, pulperías, cantinas, escuelas etc, lo cual le permitió presumir que podía ejercer actos de posesión sin contravenir ninguna norma en particular. Incluso, señala que hubo un proceso agrario donde un juez se impuso de un reclamo interpuesto por un tercero que le compró dicha propiedad y que al no poder cancelarle la suma en que vendió dicho fundo, tuvo que devolver dicha propiedad, a lo que él estimó que le "habían dado la razón". Agrega que no solamente dichos aspectos le permitieron entender que podía poseerse sin ningún problema ese espacio de tierra, sino que además recibió a miembros de la DIS, del Gobierno, de la Fuerza Pública y del MINAET, personas que para la fecha en que se dio la noticia de la invasión Nicaragüense a Isla Calero, comieron de sus provisiones, durmieron en su techo y nunca le informaron que estuviera realizando una acción indebida.
Manifiesta que vecinos suyos tienen un plano que posee hasta el sello del MINAET y que eso implica que tuvieron que hacer inspección en dicho lugar y aún así les permiten vivir ahí y ocupar la tierra; por todos estos aspectos señala que él creyó erróneamente que podía poseer doscientas hectáreas en esa área, vivir y darle mantenimiento al lugar sin estar cometiendo un delito. Este argumento debe rechazarse, incluso, asumiendo que haya adquirido dicho terreno pensando que era completamente legal su posesión conforme a la existencia de otras personas en el sitio, por haber comprado su derecho de posesión ante una profesional en derecho, lo cierto del caso, es que los hechos que se tuvieron por demostrados no implica la forma en que supuestamente adquirió dicho derecho, siendo que eso ocurrió en el año 2000, conforme se desprende de la compra venta privada visible a folios 229 y 230, sino que por el contrario, se le está endilgado los actos de posesión que se han estado dando después de que el juez del Juzgado Agrario le hizo ver que la zona donde se encontraba ubicada la propiedad en cuestión se encontraba ubicada en el área de protección del río y dentro de los dos kilómetros fronterizos (Ver folio 43).
El hecho de que existan otras personas ahí viviendo, no puede entenderse como una presunción a su favor para poder ocupar legítimamente un área protegida. Si bien es cierto, al momento de adquirir el bien se hizo frente a un abogada y aún partiendo de que por su escasa escolaridad Nombre01 asumiera eso suficiente para justificar la legalidad de su posesión es, sumamente cuestionable que desde el año dos mil no se haya interesado en inscribir dicho derecho registralmente, obtener un plano conforme corresponde, más aún, después del proceso agrario en que se cuestionó su posesión, no haber realizado trámite alguno para obtener un visado del MINAET, de la Municipalidad de Pococí, algún trámite registral o reclamo a la Administración en general, para poder justificar su ocupación dentro de un Refugio de Vida Silvestre protegido por su valor para el medio ambiente. No obstante, a pesar de ello Nombre01 aún sigue viviendo en dicho lugar, lo cual implica que al día de hoy el delito de invasión se mantiene en el tiempo de forma permanente, a pesar de estar consciente de que es una zona protegida sin que se pueda alegar ignorancia de la ley o los alcances de sus acciones en dicho lugar del año 2010 a la fecha...
" (f. 257 reverso-258, la cita es literal). Los argumentos que establece el Tribunal de Juicio descartan por completo que el acusado considerara que se encontraba viviendo en su propiedad conforme a derecho. Partiendo de que el acusado es una persona de baja escolaridad, como lo señala el propio Tribunal, las situaciones que se enumeran en sentencia, tales como que en el sitio hay prácticamente un pueblo, que el acusado adquirió el terreno por medio de una compra venta realizada por una notaria y que en su casa de habitación en múltiples oportunidades llegaron personeros del MINAE, Fuerza Pública, DIS y otras entidades del gobierno que no cuestionaron la ubicación de su casa, no son elementos que sustenten existencia de un error de prohibición, ya que el imputado conocía, como se señala en sentencia y se le indicó en le fallo del Tribunal Agrario, (folio 43 de los autos), que la situcaión de su propiedad era ilegítima, pues claramente se indica lo siguiente: "... ante la evidencia de la tala y debido a que se está dentro del área de protección del río y dentro de los dos kilómetros fronterizos, se ordena el testimonio de piezas para ante el Ministerio Público, para que se investigue tal situación y se determine si existió infracción a la ley en tal actuar...".
Aún bajo la condición de baja escolaridad del acusado, el fallo del Tribunal Agrario determina que su ubicación dentro de las tierras en cuestión debe ser conocida en la vía penal justo por su ilegítima situación. Finalmente, el A quo indica que se le hace "cuestionable que desde el año dos mil no se haya interesado en inscribir (al imputado) dicho derecho registralmente, obtener un plano catastrado, más aún después del proceso agrario en que se cuestionó su posesión, no haber realizado trámite alguno para obtener un visado del MINAET, de la Municipalidad de Pococí, algún trámite registral o reclamo a la Administración en general, para poder justificar su ocupación dentro de un Refugio de Vida Silvestre protegido por su valor para el medio ambiente..." (f.258), aseveración que fortalece aún más la posición del A quo, pues efectivamente el acusado, pese al fallo agrario, evadió realizar cualquier trámite gubernamental sobre su propiedad.
Así, considera esta Cámara de Apelación que el fallo cuenta con la fundamentación intelectiva suficiente como ya se citaran en cuanto a la condenatoria por el delito de Invasión a un área de conservación, por lo que se declara sin lugar el alegato.
IV.Recurso de apelación presentado por el licenciado Federico Quesada Soto, Procurador Penal. En el único motivo de su recurso, acusa el recurrente la errónea valoración de la prueba indiciaria. En los delitos de cambio de uso de suelo y eliminación del humedal, analizados en el considerando cuarto de la sentencia, el Tribunal determinó que el daño ambiental no se le puede achacar al acusado, porque no se puede determinar que sólo él ocupara la propiedad y cómo se precisó el perímetro del área talada. Indica que el imputado Nombre01 dijo que le cedió la posesión del inmueble a Nombre02 del año 2007 al 2009, lo que se desprende de la causa N°09-128-507-AG, en la que consta que el señor Nombre02 taló 25 hectáreas de bosque, lo que para el Tribunal implica que una persona distinta al acusado, en la misma ubicación que acusa el Minae, taló árboles y cambió el uso del terreno, y los testigos señalaron que en la zona hubo un potrero, sin poder definir el área de dicho potrero con certeza, y también señala el fallo que en los informes y planos del SINAC no indica cuál es el área talada y el área que era potrero.
Según su criterio, ello contradice el contenido de los elementos probatorios, a saber: a.) del juicio agrario se desprende que el a partir del año 2009 el imputado ejercía los actos de posesión sobre el terreno; b.) que para el 14 de abril de 2010 el juicio agrario el juicio agrario se llevó a cabo en la casa de habitación del imputado; c.) la tala de 25 hectáreas se dio entre el año 2007 y 2009; d) desde el 2009 el imputado no ha intervenido más en el área de 25 hectáreas talada, e.) para febrero del año 2018, cuando declaró el acusado, dicha zona ya era un bosque secundario; f.) el imputado sólo le da mantenimiento a un charral que es el potrero viejo que había en la zona. Así, no es factible que otra persona que no sea el acusado haya talado las 5.3 hectáreas acusadas, máxime que la inspección del SINAC se realizó en el años 2011, ya las 25 hectáreas estaban en proceso de regeneración y la tala de las 5,3 hectáreas se había realizado hacía 4 meses.
Señala, en segundo término, que la prueba testimonial, en la persona del señor Nombre03, funcionario del SINAC, indicó que el vio el área de 5,3 hectáreas taladas, desde el aire donde existía un bosque Palustrino, con todos los árboles talados o cortados y el cambio de uso de suelo se dio entre febrero y marzo del 2011 ya que había aserrín fresco y savia fresca en los tocones, así como troncos sin descomponer con hojas en las ramas, todo ello adyacente al área de bosque talada, que ahora es un potrero de 5 o 7 años de constituído. Por su parte, el testigo Nombre04 indicó que la zona talada era un bosque Palustrino, que en el suelo había árboles talados , en un área de 5,3 hectáreas y que en el sitio se apreciaba que estaban jalando madera. Resulta evidente que la zona de 5,3 hectáreas no es parte de las 25 hectáreas taladas anteriormente, por que colindaba con bosque maduro y se determinó que se dio entre el años 2010-2011.
Como tercer aspecto, señala el recurrente que se le resta valor a las fotografías del informe ACTO-GASP-RNVSBC-PO-031-2011, en las que se observa el aserin, savia y tala que se echan de menos en el fallo. Tampoco resulta válida la duda que se establece en sentencia sobre la forma en que se dio la inspección de la zona que inicialmente se apreció por aire, restándole credibilidad sin mayor argumento, a las declaraciones de los testigos Nombre04 y Nombre03. Además, sí hay fotografías terrestres de la zona. En suma, señala el recurrente que de la prueba evacuada se deriva lo siguiente: "...a.) el imputado entró en posesión de dicho inmueble en el año 2000, eliminado un área de charral - según su declaración indagatoria-, aunque en el proceso agrario manifestó que había talado 6 ha de bosque, y manteniéndola como el área de potrero vieja; b) luego del proceso agrario, el imputado entró en conocimiento que en ese sitio no se podía talar y que estaba dentro de un terreno ubicado dentro de los 2 km fronterizos; c) el imputado al menos desde el 2009 entrar el (sic) posesión de esos terrenos del Estado, ejerciendo actos de tal naturaleza, al punto que vivía en el sitio con su esposa e hijo, d) se trata de un sitio sumamente alejado, con naturaleza boscosa y de difícil acceso acuático, e) el día de la inspección, en junio de 2011, el encartado estaba realizando labores de aprovechamiento forestal, con equipo idóneo para ello, 2 motosierras que eran de su propiedad, en un área de potrero cercana al bosque talado, d) el área de bosque palustrino talado, ampliaba el área de potrero viejo y el único beneficiado con ello era el imputado, e) no es posible que el imputado no se haya dado cuenta de una tala de tan (sic) magnitud toda vez que su casa está cerca del sitio de la afectación, f) el beneficio de un aprovechamiento forestal es evidentemente para el encartado..." ( la cita es literal, f. 281-282).
Solicita el recurrente se anule el fallo en cuanto a la absolutoria y se orden el reenvío para una nueva sustanciación. Es atendible el reclamo. En relación al delito de Cambio de uso de suelo, el artículo 61 inc.c.) de la Ley Forestal, señala: "...Se impondrá prisión de un mes a tres años a quien: (..) c) Realice actividades que impliquen cambio en el uso de la tierra, en contra de lo estipulado en el artículo 19 de esta ley. En los casos anteriores, los productos serán decomisados y puestos a la orden de la autoridad judicial competente...". En sentencia, se absuelve al acusado por este hecho, con base en lo siguiente: ".....Conforme con dicha información, cabe preguntarse sí el área de potrero existente que él ya conocía de previo era una hectárea y la zona devastada de cinco hectáreas, dónde se encontraban ubicadas las veinticinco hectáreas que el actor del proceso agrario señaló bajo fe de juramento haber talado para convertirla en potrero?.
También resulta de especial importancia, hacer ver que en el contradictorio, dicho testigo fue muy claro en señalar que las hojas de los árboles estaban secas pero adheridas aún al árbol, que el aserrín en algunos se percibía fresco, que la sabia de especies como el Sangrillo aún estaba presente, que en el sitio habían trillos de arrastre donde se habían trasladado algunos de los árboles talados. Sin embargo, tales datos se extrañan no sólo en el informe por él realizado, si no que no existe ni una sola fotografía de la inspección por ellos realizadadonde se observen las hojas adheridas a las ramas de los árboles, los trillos de arrastre, el color de la sabia, la presencia de aserrín, los yolillos cortados, el color de la corteza para poder respaldar el espacio temporal que fuera por él calculado en que se había dado la devastación aludida. Más aún, de las fotografías que fueron incorporadas al informe realizado por dicho deponente, lo que se observa es precisamente el área de potrero identificada, al punto que a folio 7, se observa a escasos metros la edificación descrita como la casa de Nombre01, misma situación reflejada a folio 8, donde lejos de evidenciar hojas adheridas, aserrín fresco, devastación del sotobosque, se observa un fuste caído pero sin hojas adheridas, con ganado circundante y vegetación diversa.
Estos elementos, incluso de las descripciones que se hacen a las mismas fotografías, a folio 8, los árboles aserrados fueron ubicados a escasos 40 metros de distancia del río San Juan, lo cual permite establecer que esas fotos fueron tomadas en el área de potrero que refirió el testigo ya se encontraba preestablecida. No hay duda, que esa área fue alterada de forma negativa, pues evidentemente se observan una infinidad de tocones que son clara evidencia de la afectación boscosa que en algún momento ocurrió, en donde cabe un alto grado de probabilidad de que el imputado Nombre01 contribuyó a realizar tales despreciables modificaciones del hábitat que ahí se protege, pues el mismo fue detenido mientras aprovechaba varios árboles conforme se tuvo ya por acreditado. Pero en su beneficio, de esa probabilidad a la certeza requerida, la investigación no fue lo suficientemente completa para poder acreditar esa novedad en la tala referida, no se pudo establecer cómo realizaron la inspección en el sitio que se evidencia en las tomas aéreas (en donde se observan una gran cantidad de fustes en el suelo prácticamente juntos), o si lo que refiere el informe es precisamente del área de potrero, o del área de bosque ubicada por medio de GPS.
De la investigación realizada no se hizo un conteo de árboles caídos, o de tocones presentes en el sitio boscoso, sino que lo que se evidencia es una fotografía de muchos tocones pero aparentemente en la zona aledaña a la vivienda del imputado, que fue descrita como un área de potrero. No se hicieron mediciones de parcelas para comprender en que área se hizo el muestreo. Ni en las fotografías aéreas que supuestamente corresponden al sitio donde hace posesión don Nombre01, se observa la ubicación de su casa, del río San Juan, del corral, de los apartos, de la cerca referida por el testigo, ni ningún otro dato identificativo del lugar, para poder asumir cuánta cantidad de ese terreno fue devastada recientemente y cuánta área ya se encontraba definida como potrero. Esta duda, no fue evacuada por el testigo Nombre03... " (f. 262-263). Analizado el caso y los elementos probatorios, así como la fundamentación intelectiva, esta Cámara de Apelación considera que el análisis del Tribunal de Juicio no valoró la totalidad de la prueba, pues se echa de menos un estudio de la inspección e informe de folio 1, así como de la totalidad de la prueba testimonial, siendo que en ambas hay detalles de la causa por analizar, tales como los elementos encontrados cerca de la casa del imputado el día de la inspección y los puntos que observaron los testigos de cargo, tales como los árboles talados, el estado de los troncos, así como las fechas que se indica se observaron estos indicios, etc. elementos todos que deben ser revisados nuevamente a efectos de determinar si el imputado es responsable de los delitos que se le acusan. En razón de lo anterior, se declara con lugar el alegato. Se anula el fallo con respecto a la absolutoria por el delito de Cambio de uso de suelo y se ordena el reenvío para una nueva sustanciación.
POR TANTO:
Se declara sin lugar el recurso de apelación presentado por la defensa pública. Se declara con lugar el recurso de apelación presentado por la Procuraduría General de la República. Se anula el fallo únicamente en cuanto a la absolutoria por el delito de Cambio de uso de suelo y se ordena el reenvío para una nueva sustanciación. Queda el resto del fallo incólume.
