WHEREAS:

I. PROVEN FACTS

The following facts relevant to these proceedings are deemed duly established:

  • 1)In official letter No. DA-3928-2010 of 9 de noviembre del 2010, the Water Directorate of the former Ministerio de Ambiente, Energía y Telecomunicaciones stated that at Dirección12593, latitude 203418 and longitude 502393, there is a “public-domain spring (naciente), whose status cannot be determined until it is assessed during the dry season (marzo-abril), for which purpose a visit must be requested from this Directorate.”
  • 2)In official letter No. DA-0017-2011 of 3 de enero del 2011, the same government agency reported that at Dirección12594, latitude 204011 and longitude 499486, there is a “public-domain spring, whose status cannot be determined until it is assessed during the dry season (marzo-abril), for which purpose a visit must be requested from this Directorate.”
  • 3)On 17 de octubre del 2017, an application was submitted for a building permit (licencia constructiva) for a two-story dwelling on the property recorded under real-property folio registration Placa18780, between vertices 6 and 7 of cadastral plan (plano de catastro) Placa18781, located at Dirección2456 in Santiago de Puriscal.
  • 4)In decision DUC-US 915-2017 of 19 de octubre del 2017, the Construction Control Department ruled on the land use (uso de suelo) for the construction of a two-story dwelling on the aforementioned property, indicating that the property is subject to the restrictions set forth in Article 33 of the Ley Forestal because it is located seventy-two meters from a “permanent public-domain spring, according to opinion DA-0017-2011 of the Water Directorate of MINAE”; therefore, because it contravened subsection a) of that provision, which defines protected areas (áreas de protección) as “Areas bordering permanent springs, within a radius of one hundred meters measured horizontally,” it denied the building permit.
  • 5)In official letter No. DCC-238-2017 of that same date, the Construction Control Department again denied the building permit, reiterating the same technical basis contained in official letter DUC-US 915-2017.
  • 6)Dissatisfied, the company filed both ordinary administrative remedies (recursos ordinarios) against official letter DCC-238-2017.
  • 6)The Environmental Management Department conducted a new measurement based on the location of the property and the nearest spring at coordinates east 466045 north 1088815, and concluded in official letter OAM-068-2017 of 15 de noviembre del 2017 that “the measurement taken is 76 meters from the place where, according to the Water Directorate of MINAE, the outcrop classified as a spring emerges pursuant to opinions DA-3928-2010 and DA-0017-2011, to the nearest boundary of property number 593321 in relation to the spring; it is determined that the entire portion of the property on which construction is planned (according to Mr. Nombre106105) lies within the spring’s protected area (sic), pursuant to Ley Forestal 7575, Article 33, subsection a).”
  • 7)In decision DCC-257-2017 of 15 de noviembre del 2017, the motion for reconsideration (recurso de revocatoria) was denied.
  • 8)By decision No. 082-2017 issued at 09:00 hours on 05 de diciembre del 2017, the Mayor of Puriscal denied the appeal, leaving undisturbed the position expressed by the lower authority and safeguarding the protected area within the spring’s radius.
  • 9)The company’s representative filed both ordinary administrative remedies against that decision, and the motion for reconsideration was denied in decision No. 103-2017 issued at 11:00 hours on 19 de diciembre del 2017.

II.Grounds for Appeal. In summary, the company’s representative contends that the spring was not declared permanent by MINAE in either of the two official letters cited by the Administration and therefore must be deemed intermittent, since all local residents know that during the summer its flow dwindles entirely and, in some years, disappears completely. He argues that, before defining the protected radius, it must first be established whether the land is flat or rugged, whether it is in an urban or rural area, and where the water-flow conduit runs. Only then can it be determined whether construction could affect the water source, for which there is not a single item of technical evidence, since neither AyA nor Senara has issued any opinion to that effect, particularly considering that the spring is situated at a higher elevation. He further believes that the restriction in Article 33 of Ley 7575 prohibits only the cutting of trees, which is not planned, especially because the locality is paved and urbanized.

III.Merits. Article 50 of the Constitution establishes environmental protection in two dimensions, as a fundamental right and as a public function, under which the State must guarantee, defend, and preserve this right. The Municipalities form part of the organization of the Costa Rican State, since their nature as territorially decentralized entities also gives rise to responsibilities regarding environmental protection (in this regard, see judgment of the Constitutional Chamber number 2001-05737, issued at fourteen hours forty-one minutes on veintisiete de junio del dos mil uno). This means that the municipalities must protect all assets comprising the environment, ranging from all natural resources necessary for human existence to scenic beauty. This work includes, above all, oversight of every construction process, because urban growth tends to transform a portion of land into a settlement, which is a complex process of environmental alteration with substantial effects on natural and artificial ecosystems, since most works of this type compact the land and cover a significant part of the surface with an impermeable layer, potentially affecting aquifer reserves, increasing runoff, altering natural drainage, and increasing the flow of rivers and other watercourses, in addition to eliminating the original landscape.

Land-use planning (ordenamiento territorial) incorporates the sustainable use and development of renewable and nonrenewable resources located in the country’s various regions, as well as respect for the cultural, historical, and social characteristics of the human populations involved, with the aim of achieving a balance between human settlements and their environmental conditions. For this reason, everything concerning the approval of urban-planning regulations, as well as the granting of subdivision (fraccionamiento) and construction permits, has been entrusted to the Municipalities as the bodies responsible for administering local interests and services, pursuant to Article 169 of the Political Constitution (see also the Municipal Code, Article 13 subsection o), the Urban Planning Law, the Construction Law, and the Organic Law of the Environment). Articles 15 and 19 of the Urban Planning Law recognize each municipality’s authority to plan urban development within the boundaries of its territory in accordance with the regulations and regulatory plans (planes reguladores) it adopts for that purpose.

The granting of any building permit is conditional upon the project in question complying with the applicable urban-planning framework; this entails prior authorization or “permit” review, accompanied by oversight of the performance of the authorized activity to ensure that it is carried out in accordance with the license or permit granted and the environmental regulations governing the activity. This is why the construction process cannot be divorced from the environment in which it takes place, as the First Chamber of the Supreme Court of Justice explained in judgment N° 000507-F-04, stating:

“the concept of property fully and perfectly merges with the constitutional right to the environment, which the Constitution proclaims with equal force and rank in Article 50. It is therefore not difficult to infer that urban-planning regulation stands between property and the environment, since, after all, it is the gray, regulatory, and building-related side of the latter field. The environment and urban planning thus constitute areas of law that, through their restrictive role, delineate the precise boundaries of the right to property, that is, its essential content.” Specifically, public-order, urban-planning, and environmental regulations require compliance by private parties, since they form part of the content of the right to property insofar as they establish the authorized or lawful scope of its exercise by incorporating some of the limitations permitted by Article 45 of the Constitution, on the understanding that they neither dispossess anyone of private property nor deprive ownership of its primary attribute; therefore, they give rise neither to compensation nor to expropriation proceedings.

IV.With regard to the specific case, the municipality has indicated that the property owned by the appellant company is subject to the restrictions set forth in Articles 33 and 34 of the Ley Forestal because 100% of its surface area is encompassed by the protected radius of a spring. Indeed, the current Ley Forestal, number 7575 of 13 de febrero de 1996, establishes protected areas in Article 33:

“Article 33.- Protected areas. The following are declared protected areas:

  • a)Areas bordering permanent springs, defined within a radius of one hundred meters measured horizontally...” Article 34 of the Ley Forestal further provides:

“Article 34.- Prohibition on cutting trees in protected areas. The cutting or removal of trees in the protected areas described in the preceding article is prohibited, except in projects declared by the Executive Branch to be in the national interest. The boundary alignments (alineamientos) that must be processed in connection with these areas shall be established by the Instituto Nacional de Vivienda y Urbanismo.” The restriction contained in Article 33 of the Ley Forestal is generally applicable, since it arises from the need to preserve the one-hundred-meter radius surrounding every spring in order to conserve water sources originating underground, which depend on the physical factors of the land (soil texture and its components, namely roots, sand, silt, and clay), as well as its chemical and biotic factors; human alteration of these factors may contribute to soil degradation and the expansion of desert areas.

That restriction implicitly limits the exercise of other ownership rights (facultades dominicales) that could degrade the natural condition of springs, including, obviously, the restriction of the right to build on the land. Accordingly, those provisions take precedence over any regulation contained in local or national rules. The First Chamber of the Supreme Court of Justice, in judgment number 199 issued at 15:30 hours on 4 de febrero de 2010, applying reasoning that this Chamber fully endorses, stated:

“II…As the second ground, it considers that Articles 33 and 34 of the Ley Forestal were violated through erroneous interpretation; those provisions, it states, must be analyzed jointly. It also alleges their improper application, thereby violating section III.3.7.6 of the Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones…V.-…given the significance of the matter, it is important to address the protection regime governing springs (nacientes), which provides for different circumstances that share the establishment of an area around them subject to the corresponding legal protection. The legal system provides for two situations: placing that strip within the public domain (demanio público) (Articles 7 of the Ley de Tierras y Colonización and 31 of the Ley de Aguas), or retaining the property under private ownership but protected (Articles 33 and 34 of the Ley Forestal).

Regardless of the nature of the land in question (which is not disputed in these proceedings), even under the lesser degree of protection—that is, where it is a protected area (área protegida) on privately owned property—it cannot be overlooked that this legal classification entails a series of restrictions on property rights. In addition to the express restriction referred to in Article 34 of the aforementioned body of law, which consists of a prohibition on cutting down trees, the establishment of a protected area around the spring implicitly entails a restriction on the exercise of those ownership powers that may directly or indirectly affect a permanent spring. To hold otherwise could lead to the absurd result of allowing the construction of a building that destroys that natural resource, provided that no tree is felled—or, as in the present case, that no trees have been planted. In this regard, account must be taken of Article 10 of the Ley General de la Administración Pública, which establishes that an administrative rule must be interpreted in the manner that best ensures fulfillment of the public purpose pursued.

In environmental matters, in addition to the provisions of Article 50 of the Constitution, which were analyzed in Considerando III, it must be borne in mind that the State is compelled to safeguard the environment by promoting development that is healthy and ecologically balanced. This constitutional obligation has been developed in various statutory provisions, such as the Ley Orgánica del Ambiente and the Ley de Biodiversidad, among others. By virtue of the foregoing, although the challenged interim measure (medida cautelar) must be annulled, both the plaintiff and the Ministerio de Ambiente, Energía y Telecomunicaciones, as well as any other competent institution, are legally obligated to prevent any action that could adversely affect the spring.” The appellant reverses the meaning of the cited regulation by asserting that, in order to impose the restriction upon it, the Municipality must demonstrate that its construction neither causes pollution nor endangers the water source.

However, the rationale underlying this regulation is different, since it constitutes a legal presumption that the land is vulnerable, arising from an entirely preventive intent aimed at preserving the area surrounding a spring and preventing any human alteration of soil that has been declared protected. This is a mandatory rule of public policy (norma de orden público) that prevails over any individual interest.

V.The central issue in the present case concerns determining the nature of the spring, since the appellant objects to the application of the restrictions under the aforementioned Article 33 on the ground that there is no evidence establishing that this body of water is permanent. Conversely, the local authorities considered that official letters Nos. A-3928-2010 dated November 9, 2010, and DA-0017-2011 dated January 3, 2011, issued by the Dirección de Aguas, establish the existence of a permanent spring. However, both documents literally state that there is a “spring in the public domain, the nature of which cannot be determined until it is assessed during the dry season (March-April), for which purpose a visit must be requested from this Directorate”; it is therefore readily apparent that it is not yet known whether the spring is permanent or intermittent. In this regard, it should be noted that our legislation protects intermittent springs, not under Article 33 of the Ley Forestal, but under Article 149 of the Ley de Aguas, which provides:

“It is prohibited to destroy, in both national and privately owned forests, trees located within sixty meters of springs originating in hills, or within fifty meters of those originating on flat land.” In this regard, there is consistent precedent issued both by the First Chamber of the Supreme Court of Justice (Sala Primera de la Corte Suprema de Justicia), in judgment 858-F-S1-2012 at 9:20 a.m. on July 20, 2012, and by the Constitutional Chamber (Sala Constitucional), in judgment number 2010-8315 at 8:45 a.m. on May 7, 2010, recognizing a sixty-meter protection radius for intermittent springs pursuant to the aforementioned provision. To that effect, the Sala Primera held in the cited judgment:

“III.- Article 149 of the Ley de Aguas is found in Chapter Nine of that law, entitled ‘Measures Concerning the Conservation of Trees to Prevent the Depletion of Water,’ which, as its name indicates, seeks through the provisions contained therein to ensure that state authorities oversee ‘(…) strict compliance with the statutory provisions concerning the conservation of trees, especially those along riverbanks and those found at water sources’ (Article 145 ibidem), in order to prevent the depletion of water. In that regard, the aforementioned Article provides: ‘It is prohibited to destroy, in both national and privately owned forests, trees located within sixty meters of springs originating in hills, or within fifty meters of those originating on flat land.’ As can be seen, the rule does not distinguish between permanent and intermittent springs, and therefore no such distinction may be made when applying it.

This is a typical restriction in the public interest (Article 45 of the Political Constitution), which, like others established in various enactments within the legal system, has advanced the concept of limits on private property in pursuit of genuine and effective protection of the constitutional guarantee (Article 50 of our Political Constitution) of a healthy and ecologically balanced environment. Nor does the provision distinguish between waters in the public domain and waters in the private domain. The rule refers only to waters—that is, water resources in general—and therefore the citation of Articles 1 through 4 of Law no. 276 is not relevant to the case. Accordingly, this Chamber does not consider that the Court violated the provision alleged to have been erroneously interpreted and applied when it determined that intermittent springs do indeed receive legal protection.” It is clear from the foregoing that the radius surrounding intermittent springs, as part of the water resource (aquifers (mantos acuíferos)), is also protected by our environmental legal system; however, the distance established for that purpose is substantially shorter.

It is therefore essential that each spring be duly classified by the competent MINAE body in order to determine whether it is permanent or intermittent; in either case, its location must be established with certainty so that the extent of the radius encompassing its protected area may be defined. The municipalities are responsible for obtaining certainty in this regard so as to specify the construction-related restrictions applicable to surrounding land; they therefore have a duty to consult MINAE concerning the exact nature and location of each spring. This is the only means by which the surface area encompassed by a spring’s protection radius can be measured with technical certainty. It is clear that the local authorities misunderstood the scope and content of official letters DA-3928-2010 dated November 9, 2010, and DA-0017-2011 dated January 3, 2011, issued by the Dirección de Aguas, erroneously concluding that a permanent spring exists, although that conclusion cannot be drawn from those documents.

The grievance alleging the failure to determine this fact is indeed well-founded, revealing a significant legal and technical deficiency in the challenged act, because until there is absolute clarity regarding the nature of the spring and the length of its protection radius—whether one hundred linear meters if permanent, or sixty or fifty meters if intermittent, depending on whether it is located on a hill or on flat land—the maximum restriction provided for by the legal system cannot be imposed when means exist to remedy this lack of information. This matter must be clarified with certainty by the local government, with the Municipality submitting the required inquiry to MINAE’s Dirección de Aguas. It follows that the restriction cannot be imposed in the manner in which it was imposed, since doing so could directly, unlawfully, and unjustly infringe the appellant company’s property rights by preventing it from enjoying land that it might ultimately be entitled to use for construction purposes.

The aggrieved party’s claim is significant because the distance of 76 meters separating its property from the nearest spring could establish the inapplicability of the cited restriction if that spring were found to be intermittent. It should also be noted that the grievance seeking to have this Chamber interpret the spring as intermittent is legally untenable, because doing so would constitute unlawful interference with the authority of the administrative body specializing in that determination; that request must therefore be denied. These considerations necessarily lead to the conclusion that, because of the manner in which the local government ruled, Resolution No. 082-2017 of the Mayor of Puriscal, issued at 09:00 on December 5, 2017, is defective as to its grounds due to the lack of a technical basis and as to its content, contrary to Articles 16(1) and 136 of the Ley General de la Administración Pública.

This circumstance warrants declaring the challenged act absolutely null and void, which necessarily entails the nullity of land-use certificate (certificado de uso del suelo) DUC-US 915-2017 and official letter No. DCC-238-2017, both dated October 19, 2017, issued by the Departamento de Control Constructivo. For the reasons stated, the appeal is granted, and the record shall be returned to the local government so that it may reconsider the appellant’s application using the precise and reliable technical criteria available to it, in accordance with this decision.

VI.This Chamber cannot overlook that official letters Nos. DA-3928-2010 dated November 9, 2010, and DA-0017-2011 dated January 3, 2011, issued by the Dirección de Aguas, refer to two springs in different locations, as can readily be seen from their location coordinates. It was entirely improper for the municipal authorities to use both documents when referring to the spring near the aggrieved party’s property without specifying with absolute certainty which of the two springs is the subject of the present assessment. Accordingly, they must first identify the spring in question precisely and then consult the competent authority regarding its nature.

VII.Since these proceedings have been conducted electronically, the parties may obtain a complete copy containing both the administrative record (expediente administrativo) submitted by the Municipal Corporation and all the documents comprising this appeal proceeding, for which purpose they must provide an electronic storage device (USB flash drive or compact disc). Likewise, if physical or electronic documentation (plans, photographs, reports, etc.) has been submitted and remains in the custody of the Court, the person who submitted it may retrieve it within 30 business days, in accordance with Article 12 of the Regulations on Electronic Court Records before the Judiciary, approved by the Full Court at session n.° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Judicial Bulletin n.° 19 of 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary at session n.° 43-12 held on 3 de mayo del 2012, Article LXXXI.

POR TANTO

The appeal filed is granted and, consequently, decision 082-2017 of 09:00 hours on 05 de diciembre del 2017, issued by the Mayor of Puriscal, is annulled; by extension, official communications DUC-US 915-2017 and DCC-238-2017, both dated 19 de octubre del 2017 and issued by the Construction Control Department, are also annulled. The record is remanded to the respondent Municipality so that it may proceed in accordance with the foregoing findings.

SECCIÓN TERCERA, ANEXO A DEL II CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las trece horas treinta minutos del veintinueve de abril del dos mil diecinueve.- Recurso de apelación interpuesto por Alhema de Puriscal S.A., cédula jurídica No. CED13314, representada por su apoderado generalísimo sin límite de suma, el señor Nombre106105 , cédula de identidad No. CED77457, contra la resolución No. 082-2017 de las 09:00 horas del 05 de diciembre del 2017, dictada por el Alcalde de Puriscal.

Redacta la jueza Nombre12928 ,

CONSIDERANDO:

I. HECHOS PROBADOS

Se tienen como debidamente acreditados los siguientes hechos que resultan relevantes para este proceso:

  • 1)En oficio No. DA-3928-2010 del 9 de noviembre del 2010, la Dirección de Aguas del otrora Ministerio de Ambiente, Energía y Telecomunicaciones, se pronunció en el sentido que en Dirección12593 , latitud 203418 y longitud 502393, existe una "naciente de dominio público, sin determinarse el carácter de la misma hasta no valorarse en tiempo de estiaje (marzo-abril), para lo cual debe gestionarse dicha visita ante esta dirección".
  • 2)En oficio No. DA-0017-2011 del 3 de enero del 2011, la misma dependencia estatal informó que en Dirección12594 , latitud 204011 y longitud 499486, existe una "naciente de dominio público, sin determinarse el carácter de la misma hasta no valorarse en tiempo de estiaje (marzo-abril), para lo cual debe gestionarse dicha visita ante esta dirección".
  • 3)El 17 de octubre del 2017, fue presentada una solicitud de licencia constructiva para vivienda de dos pisos, en la finca con matrícula de folio real Placa18780, entre los vértices 6 y 7 del plano de catastro Placa18781, ubicada en Dirección2456 de Santiago de Puriscal.
  • 4)En resolución DUC-US 915-2017 del 19 de octubre del 2017, el Departamento de Control Constructivo resolvió el uso de suelo para construcción de una vivienda de dos pisos en la referida finca, indicando que la propiedad se encuentra afectada por las limitaciones del artículo 33 de la Ley Forestal, debido a que se encuentra a setenta y dos metros de una "naciente de dominio Permanente, según criterio DA-0017-2011 de la Dirección de Aguas del MINAE", por lo que al contravenir el inciso a) de dicho ordinal, que define como áreas de protección "Las áreas que bordeen nacientes permanentes, en un radio de cien metros medidos de modo horizontal", rechazó el permiso de construcción.
  • 5)En oficio No. DCC-238-2017 de esa misma fecha, el Departamento de Control Constructivo rechazó nuevamente la licencia constructiva, reiterando la misma base técnica contenida en el oficio DUC-US 915-2017.
  • 6)Inconforme, la sociedad interpuso sendos recursos ordinarios en contra del oficio DCC-238-2017.
  • 6)El Departamento de Gestión Ambiental hizo una nueva medición partiendo de la ubicación de la finca y la naciente más cercana en coordenadas este 466045 norte 1088815, y concluyó en el oficio OAM-068-2017 del 15 de noviembre del 2017, que "la medición realizada es de 76 metros del lugar en el que según la Dirección de Aguas del MINAE nace el afloramiento catalogado como naciente mediante criterios DA-3928-2010 y DA-0017-2011, al límite más cercano de la propiedad con número de finca 593321 respecto al naciente, se determina que todo el sector de la propiedad en el cual se planea realizar la construcción (según el señor Nombre106105) se ubica dentro del área de protección del (sic) naciente según la Ley Forestal 7575, artículo 33, inciso a)".
  • 7)En resolución DCC-257-2017 del 15 de noviembre del 2017, fue rechazado el recurso de revocatoria.
  • 8)El Alcalde de Puriscal, mediante resolución No. 082-2017 de las 09:00 horas del 05 de diciembre del 2017, declaró sin lugar el recurso de apelación, manteniendo incólume la posición externada por su inferior, asegurando el área protegida del radio de la naciente.
  • 9)Contra lo resuelto el representante de la sociedad interpuso sendos recursos ordinarios, resultando rechazada la revocatoria en resolución No. 103-2017 de las 11:00 horas del 19 de diciembre del 2017.

II.Agravios. A manera de resumen, reclama el representante de la sociedad que la naciente no ha sido declarada permanente por el MINAE en ninguno de los dos oficios indicados por la Administración, de modo que debe tenerse como intermitente pues es sabido por todos los vecinos que en época de verano merma totalmente su correntía y hay años que desaparece por completo. Alega que para definir el radio de protección debe acreditarse antes si el terreno es plano o quebrado, o si se trata de zona urbana y rural y por donde corre el tubo de flujos de agua. Solamente así puede determinarse si la construcción podría afectar la fuente de agua, de lo cual no existe una sola prueba técnica pues no existe criterio alguno del AyA o del Senara en tal sentido, sobre todo si se considera que la naciente se encuentra a un nivel mayor. Estima además que la limitación del numeral 33 de la Ley 7575 solamente prohíbe la corta de árboles, lo cual no está proyectado hacer, máxime que la localidad está asfaltada y urbanizada.

III.Sobre el fondo. En el artículo 50 constitucional se establece la tutela del medio ambiente en una doble vertiente, como derecho fundamental y como función pública, en el que el Estado debe garantizar, defender y preservar este derecho. Las Municipalidades constituyen parte de la organización del Estado costarricense, pues de su naturaleza de entes descentralizados en razón del territorio derivan responsabilidades también respecto de la tutela del ambiente (al respecto, ver la sentencia de la Sala Constitucional número 2001-05737, de las catorce horas cuarenta y un minutos del veintisiete de junio del dos mil uno). Ello implica que a cargo de las municipalidades debe protegerse todos aquellos bienes que convergen en el ambiente, ya sean todos los recursos naturales necesarios para la existencia humana, hasta las bellezas escénicas. Esta labor incluye, por excelencia, la vigilancia de todo proceso constructivo, pues el crecimiento urbano tiende a convertir en un poblado una porción de terreno, lo cual es un proceso complejo de alteración ambiental de gran efecto sobre los ecosistemas naturales y artificiales, ya que la mayoría de este tipo de obras compacta los terrenos y cubre una parte importante de la superficie de una capa impermeabilizante, con lo que se pueden llegar a afectar las reservas de acuíferos, se aumenta la escorrentía, se alteran los desagües naturales y se aumenta el caudal de los ríos y otros cursos del agua, además de eliminar el paisaje original.

El ordenamiento territorial incorpora el uso y desarrollo sostenible de los recursos renovables y no renovables ubicados en las distintas zonas del país, así como el respeto a las características culturales, históricas y sociales de las poblaciones humanas involucradas, aspirando a la obtención de un equilibrio entre los asentamientos humanos y sus condiciones ambientales. Es por ello que todo lo concerniente a la aprobación de la regulación urbanística, así como el otorgamiento de los permisos de fraccionamiento y construcción, se le ha conferido a las Municipalidades, como encargadas de la administración de los intereses y servicios locales, conforme lo dispone el artículo 169 de la Constitución Política (ver además, Código Municipal, artículo 13 inciso o), la Ley de Planificación Urbana, Ley de Construcciones y la Ley Orgánica del Ambiente). Los artículos 15 y 19 de la Ley de Planificación Urbana reconocen la competencia que dispone cada municipalidad para planificar el desarrollo urbano dentro de los límites de su territorio, conforme a los reglamentos y planes reguladores que al efecto dicten.

El otorgamiento de cualquier permiso de construcción está condicionado a que el proyecto en cuestión resulte conforme con la ordenación urbanística aplicable; lo cual supone un control previo de habilitación o "permiso", acompañado de la actividad de fiscalización en la ejecución de la actividad autorizada, a fin de que se realice conforme a la licencia o permiso concedido y a las regulaciones ambientales que rigen la actividad. A ello obedece que el proceso constructivo no pueda divorciarse del medio en que se desarrolla, y así lo ha desarrollado la Sala Primera de la Corte Suprema de Justicia en la sentencia N° 000507-F-04 en que indicó:

"la noción de propiedad se amalgama de manera plena y perfecta con el derecho constitucional del medio ambiente, que con igual intensidad y jerarquía, proclama el cuerpo constitucional en su precepto 50. Por ello, no es difícil inferir la regulación urbanística como intermedia entre propiedad y ambiente, pues al fin y al cabo, es el anverso gris, ordenatorio y edificativo de ésta última materia. Ambiente y urbanismo se constituyen así en áreas del Derecho que por su rol limitante, delimitan el contorno preciso del derecho de propiedad, es decir, su contenido esencial." Precisamente, las regulaciones de orden público, urbanísticas y ambientales imponen el sometimiento de los administrados, pues éstas integran el contenido del derecho de propiedad, en tanto establecen el ámbito autorizado o legítimo de su ejercicio, al contener algunas de las limitaciones autorizadas por el artículo 45 constitucional, bajo el entendido de que no se produce un despojo de la propiedad privada ni la privación del atributo primario del dominio, por ello, no dan cabida a indemnización alguna, ni a trámite expropiatorio.

IV.En lo que se refiere al caso concreto, la municipalidad ha indicado que la finca propiedad de la sociedad apelante, tiene las limitaciones de los artículos 33 y 34 de la Ley Forestal, a razón de estar cubierto el 100% de su superficie, por el radio de protección de una naciente. Ciertamente, la Ley Forestal vigente, número 7575 de 13 de febrero de 1996, establece la figura de las áreas de protección en su artículo 33:

“Artículo 33.- Áreas de protección. Se declaran áreas de protección las siguientes:

  • a)Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal...” Y el artículo 34 de la Ley Forestal agrega:

“Articulo 34.- Prohibición para talar en áreas protegidas. Se prohíbe la corta o eliminación de árboles en las áreas de protección descritas en el artículo anterior, excepto en proyectos declarados por el Poder Ejecutivo como de conveniencia nacional. Los alineamientos que deban tramitarse en relación con estas áreas, serán realizados por el Instituto Nacional de Vivienda y Urbanismo”.

La afectación contenida en el numeral 33 de la Ley Forestal es de alcance general, pues obedece a la necesaria conservación del radio de cien metros de toda naciente a razón de conservar las fuentes de agua que provienen del subsuelo, las cuales dependen de los factores físicos (textura del suelo y sus componentes, a saber, raíces, arena, limo y arcilla), químicos y bióticos del terreno, cuya alteración por parte del hombre, puede converger en la degradación de los suelos y el aumento de las zonas desérticas. Dicha limitación tiene implícita la restricción al ejercicio de aquellas otras facultades dominicales que puedan degradar el estado natural de las nacientes, lo cual incluye, como es obvio, la restricción al derecho a edificar sobre el terreno. Por ello, dichas normas se imponen por encima de cualquier regulación contenida en reglamentaciones locales o nacionales. La Sala Primera de la Corte Suprema de Justicia, en sentencia número 199 de las 15:30 horas del 4 de febrero de 2010, con criterios que este Cámara comparte en su totalidad, indicó:

“II…Como segundo motivo, considera vulnerado, por errónea interpretación, los ordinales 33 y 34 de la Ley Forestal, los cuales, refiere, deben ser analizados en forma conjunta, así como su aplicación indebida, por lo que se conculca el numeral III.3.7.6 del Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones…V.-…por la relevancia del tema, es importante referirse al régimen de protección de las nacientes, el cual prevé distintos supuestos, los cuales tienen en común, el establecimiento de un área alrededor de estas sobre la cual recae la respectiva tutela. El ordenamiento jurídico dispone dos supuestos; una afectación de esa franja al demanio público (ordinales 7 de la Ley de Tierras y Colonización y 31 de la Ley de Aguas), o bien, mantener el inmueble como propiedad privada pero protegida (artículos 33 y 34 de la Ley Forestal). Al margen de la naturaleza del terreno en cuestión (que no se encuentra en discusión en el presente proceso), aún en el supuesto de menor protección, es decir, tratándose de un área protegida en propiedad privada, no puede dejarse de lado que las consecuencias que de esta calificación legal se desprenden una serie de limitaciones a la propiedad.

Además de la explícita a que hace referencia el numeral 34 del cuerpo normativa citado, y que consiste en una prohibición para cortar árboles, lo cierto es que el establecimiento de un área de protección alrededor de la naciente lleva implícito una restricción al ejercicio de aquellas facultades de dominio que puedan afectar, directa o indirectamente, una naciente permanente. Afirmar lo contrario podría derivar en el contrasentido de que se permita levantar una edificación que destruya dicho recurso natural a condición de que no se tale ningún árbol, o como en el presente caso, que no hayan árboles sembrados. En este sentido, debe tenerse en cuenta lo dispuesto en el numeral 10 de la Ley General de la Administración Pública, el cual establece que la norma administrativa debe interpretarse de la manera que mejor garantice el fin público que se persigue. En materia ambiental, además de lo preceptuado en el ordinal 50 constitucional y que fue objeto de análisis en el considerando III, debe tenerse en cuenta que el Estado se encuentra compelido a velar por la protección del ambiente, procurando un desarrollo sano y ecológicamente equilibrado.

Esta obligación de rango constitucional ha sido desarrollada en diversas normas de rango legal, como por ejemplo la Ley Orgánica del Ambiente, la Ley de Biodiversidad, entre otras. En virtud de lo anterior, si bien la medida cautelar impugnada debe ser anulada, tanto la parte actora como el Ministerio de Ambiente, Energía y Telecomunicaciones, así como cualquier otra institución competente, se encuentran en la obligación legal de prevenir cualquier acción que pueda incidir en forma negativa sobre la naciente.” La parte apelante invierte el sentido de la regulación de cita, al considerar que para imponérsele la limitación, la Municipalidad debe demostrar que su construcción no es contaminante ni pone en riesgo la fuente de agua. Sin embargo, la lógica de esta normativa es otra, dado que se trata de una presunción legal de vulnerabilidad del terreno que deriva de una intención completamente preventiva, tendiendo a preservar el área que rodea una naciente y eludiendo cualquier alteración humana sobre el suelo cuya protección ha sido declarada. Ello es una norma de orden público que pesa por encima de cualquier interés individual.

V.Ahora bien, el eje de la presente causa reside en torno a la determinación de la naturaleza de la naciente, pues la parte apelante objeta la aplicación de las limitaciones del numeral 33 de cita, toda vez que no existe prueba que acredite que dicho cuerpo de agua es permanente. En sentido contrario, las autoridades locales consideraron que de los oficios Nos. A-3928-2010 del 9 de noviembre del 2010, y DA-0017-2011 del 3 de enero del 2011 de la Dirección de Aguas, se deriva que existe una naciente permanente. Sin embargo, ambos documentos disponen literalmente que existe una "naciente de dominio público, sin determinarse el carácter de la misma hasta no valorarse en tiempo de estiaje (marzo-abril), para lo cual debe gestionarse dicha visita ante esta dirección", de donde es fácil entender que aún no se sabe si la naciente es permanente o intermitente. Sobre este particular, ha de advertirse que nuestra legislación da protección de las nacientes intermitentes, no en el numeral 33 de la Ley Forestal, sino en el artículo 149 de la Ley de Aguas que dice:

“Se prohíbe destruir, tanto en los bosques nacionales como en los de particulares, los árboles situados a menos de sesenta metros de los manantiales que nazcan en los cerros, o a menos de cincuenta metros de los que nazcan en terrenos planos”.

En este sentido, existen antecedentes uniformes, emitidos tanto por la Sala Primera de la Corte Suprema de Justicia, en voto 858-F-S1-2012, de las 9:20 horas del 20 de julio de 2012, como de la Sala Constitucional, en el voto número 2010-8315 de las 8:45 horas del 7 de mayo de 2010, en donde se reconoció el radio de sesenta metros de protección de unas nacientes intermitentes, en aplicación del numeral de cita. Al efecto, dispuso la Sala Primera en el voto de cita:

"III.- El numeral 149 de la Ley de Aguas se encuentra dentro del Capítulo Noveno de dicha ley, denominado “Medidas Referentes a la Conservación de Árboles para Evitar la Disminución de las Aguas”, que como su nombre lo dice, procura con los preceptos contenidos en él, que las autoridades estatales velen por “(…) el estricto cumplimiento de las disposiciones legales referentes a la conservación de los árboles, especialmente los de las orillas de los ríos y los que se encuentren en los nacimientos de aguas” (canon 145 ibídem), con el fin de evitar la disminución de las aguas. En ese sentido, el numeral referido reza: “Se prohíbe destruir, tanto en los bosques nacionales como en los de particulares, los árboles situados a menos de sesenta metros de los manantiales que nazcan en los cerros, o menos de cincuenta metros de los que nazcan en terrenos planos”. Como se observa, la norma no distingue entre manantiales permanentes e intermitentes, por lo que no cabría hacer tal diferenciación a la hora de aplicarla.

Se trata de una típica limitación de interés público (artículo 45 de la Constitución Política), que al igual que otras previstas en diversos cuerpos normativos del ordenamiento jurídico, ha evolucionado el concepto de límites a la propiedad privada, en aras de una tutela real y efectiva de la garantía constitucional (artículo 50 de nuestra Constitución Política) de un ambiente sano y ecológicamente equilibrado. Tampoco distingue el precepto entre aguas de dominio público y de dominio privado. La norma alude a aguas solamente, sea, al recurso hídrico en general, por lo que la cita de los artículos 1 a 4 de la Ley no. 276 no resulta pertinente al caso. De ahí, que no estima esta Sala que el Tribunal hubiese quebrantado el canon cuya errónea interpretación y aplicación se acusa, al establecer que sí existe amparo legal para las nacientes intermitentes." De lo anterior, resulta claro que el radio de las nacientes intermitentes, como parte del recurso hídrico (mantos acuíferos), también es protegido por nuestro ordenamiento ambiental; empero, la distancia prevista al efecto es notoriamente menor.

Por ello es indispensable que cada naciente haya sido debidamente clasificada por el órgano del MINAE encargado al efecto, para determinar si es permanente o intermitente y, en último supuesto, se debe tener certeza de su localización, a efecto de definir la distancia del radio de cobertura de su área de protección. Es responsabilidad de las municipalidades obtener certeza respecto de ello para concretar las limitaciones de orden constructivo que recaen sobre los terrenos circundantes, por lo que pesa sobre ellas el deber de consultar al MINAE la naturaleza y localización exacta de cada naciente. Ese es el único medio por el cual se puede medir, con grado de certeza técnica, la superficie que abarca el radio de protección de una naciente. Es claro que las autoridades locales no comprendieron el alcance del contenido de los oficios DA-3928-2010 del 9 de noviembre del 2010 y DA-0017-2011 del 3 de enero del 2011 de la Dirección de Aguas, entendiendo erróneamente que existe una naciente permanente, lo cual no se desprende de esos documentos.

Ciertamente, el agravio que reclama la ausencia de determinación de este dato es de recibo, lo cual saca a relucir una deficiencia técnica jurídica importante del acto impugnado, puesto que hasta que no exista claridad absoluta de la naturaleza de la naciente y la longitud de su radio de protección, ya sea de cien metros lineales si es permanente, sesenta o cincuenta metros si es intermitente, dependiendo de la ubicación en un cerro o en un plano, no es posible imponer la máxima limitación prevista por el ordenamiento, si existen formas para solventar esta ausencia. Ello deberá ser aclarado con certeza por parte del gobierno local, haciendo la Municipalidad la consulta de rigor a la Dirección de Aguas del MINAE, lo que permite concluir que es imposible imponer la limitación de la forma en que se ha realizado, pues se podría estar generando una lesión directa, ilegítima e injusta sobre el derecho de propiedad de la sociedad apelante, impidiéndole el disfrute sobre un terreno que eventualmente sí podría aprovechar para efectos constructivos.

El reclamo del agraviado toma importancia en el tanto la distancia de 76 metros que separa su finca de la naciente más cercana, podría evidenciar la ausencia de la limitación de cita, si se verificare que esa naciente es intermitente. Ha de advertirse, por demás, que el agravio que pretende que esta Cámara interprete que la naciente es intermitente es jurídicamente imposible pues ello sería una intromisión antijurídica en las competencias de un órgano administrativo especializado al efecto, por lo que esa petición es de rechazo. Estas consideraciones son necesarias para concluir que, por la forma en que ha resuelto el gobierno local, existen vicios de motivo por falta de fundamento técnico y en el contenido en la resolución del Alcalde de Puriscal, No. 082-2017 de las 09:00 horas del 05 de diciembre del 2017, lo cual resulta contrario a lo dispuesto en los artículos 16 inciso 1) y 136 de la Ley General de la Administración Pública.

Dicha circunstancia amerita declarar la nulidad absoluta del acto recurrido, lo cual lleva de la mano la nulidad del certificado de uso del suelo DUC-US 915-2017 y del oficio No. DCC-238-2017, ambos del 19 de octubre del 2017 del Departamento de Control Constructivo. Por lo expuesto, se declara con lugar el recurso interpuesto, debiéndose devolver los autos al gobierno local, a efecto de que vuelva a atender la solicitud de la parte recurrente, con criterios técnicos exactos y certeros que tiene a su alcance, conforme lo indicado en esta resolución.

VI.No puede esta Cámara obviar que los oficios Nos. DA-3928-2010 del 9 de noviembre del 2010 y DA-0017-2011 del 3 de enero del 2011 de la Dirección de Aguas, se refieren a dos nacientes con ubicación diferente, según se puede leer con facilidad en las coordenadas de localización. Resulta totalmente incorrecto que las autoridades municipales hayan utilizado ambos documentos para referirse a la naciente cercana a la finca del agraviado, sin especificar con absoluto grado de certeza, sobre cuál de las dos nacientes se enfoca el presente estudio. Por ende, deberán primero identificar con exactitud la naciente de que se trata, para luego consultar su naturaleza.

VII.Al haberse sustanciado esta sede en forma electrónica, queda a disposición de las partes obtener una copia integral que contiene tanto el expediente administrativo remitido por la Corporación Municipal así como la totalidad de las piezas que conforman la presente alzada, para lo cual deberá aportar el dispositivo electrónico de almacenamiento (llave maya o disco compacto). Asimismo, en caso que hubiere ingresado documentación física o electrónica (planos, fotografías, informes, etc) que permanezca aún en custodia el Despacho, podrá retirarla quien la aportó en un plazo de 30 días hábiles, de conformidad con lo dispuesto en el artículo 12 del Reglamento sobre Expediente Electrónico ante el Poder Judicial, aprobado por la Corte Plena en sesión n.° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial n.° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión n.° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO

Se declara con lugar el recurso de apelación interpuesto y en consecuencia, se anula la resolución 082-2017 de las 09:00 horas del 05 de diciembre del 2017, dictada por el Alcalde de Puriscal y por conexidad, se anulan los oficios DUC-US 915-2017 y DCC-238-2017, ambos del 19 de octubre del 2017 del Departamento de Control Constructivo. Se devuelve el expediente a la Municipalidad recurrida, a fin de que proceda conforme a los considerandos previos.
