CONSIDERING

I. PROVEN FACTS

This Court concurs with the findings concerning the proven facts, as they are well supported by the record, except for number five, because it is inconsistent with the evidence submitted in the case file.

II. UNPROVEN FACTS

For purposes of ruling at this level in a proceeding of this nature, this Court finds the following: 2.- It was not demonstrated that either the petitioners or their predecessor in title had exercised ecological possession (posesión ecológica) over the property for which title is sought, or that adequate protection had been afforded to the natural resources (The record contains no evidence establishing this).

III.The State’s representative filed an appeal against the decision issued by the Agrarian Court of the Second Judicial Circuit of the Southern Zone at nine hours and twenty-two minutes on veinte de marzo del dos mil catorce, arguing essentially as follows: Proven fact 5) stated: “That the petitioners submitted the land-use report (informe de uso del suelo), which indicates that compliant land use (uso conforme del suelo) has been observed,” which is false, and the judgment is inconsistent in subsequently holding: “compliance has not been achieved with respect to one percent” (fourth consideration). The record of the judicial inspection (reconocimiento judicial) stated: “on both sides of the stream there are two pasture areas.” The land-use capability map (mapa de capacidad de uso de las tierras) shows that all areas surrounding the stream (sectors A, B, and C) are pastureland. This makes it impossible to acquire ownership or possession rights because the natural resource was not protected on land located within Parque Nacional Piedras Blancas.

She argues that the land involved in these proceedings (according to survey plan No. P-407641-1997) is located entirely within Parque Nacional Piedras Blancas (Proven Fact 3). At folio 271, the petitioners’ representative stated that “there is only one adjoining landowner, namely the Costa Rican State, because the properties surrounding the land at issue were sold to and paid for by the State.” She states that the survey plan depicts an easement (servidumbre) 1163.12 meters long over land described as A, without it being apparent what that letter refers to; however, according to official communication No. SINAC-ACOSA-PNPB-AD-018-2013, which she submitted, those sectors are properties owned by the State. She adds that the record of the judicial inspection states that they entered through the stream adjoining [Nombre6] according to the survey plan, but that, according to the cited official communication, that sector is owned by the State.

She states that she did not receive a copy of the filing indicating that the easement shown on the survey plan had not been legally registered; nevertheless, she considers that this requirement cannot be deemed satisfied because the survey plan cited in the decision finding that the requirement had been satisfied is not the subject of these proceedings. She argues that rights-of-way (servidumbres de paso), because they are discontinuous, cannot be established by adverse possession (usucapión) (article 379 of the Código Civil). Furthermore, article 11 of the Ley de Creación de Servicio de Parques Nacionales No. 6084 provides: “Easements benefiting privately owned parcels may not be established on national park lands”; approving these proceedings and ordering registration of the property under those conditions would contravene Ley No. 6084 del 24 de agosto de 1977.

IV.The appellant’s grievances are well founded. To obtain title through possessory information proceedings, the legislature established a series of heightened requirements precisely to prevent the Natural Heritage of the State and protected areas, as well as their biodiversity, from being adversely affected. Accordingly, Article 7 of the Possessory Information Law requires proof, in addition to ten years of possession prior to the creation of the respective protected area, that the natural resources existing on the property have been conserved and protected. The record shows that the property for which title is sought is depicted in survey plan P-407641-97 and is located within Piedras Blancas National Park, created by Decreto No. 23153-MIRENEN of 19 de abril de 1994 (see cadastral plan at folio 1 and certification from the National System of Conservation Areas at folio 2); as of that date, a restriction was imposed on the exercise of productive activities, since the purpose of the protected zone is precisely to protect natural resources and biodiversity.

In this specific case, as the appellant correctly argues, the petitioners did not demonstrate that possession had been exercised in accordance with land use requirements and with the proper protection of natural resources, either before or after the creation of the Protected Zone, for the reasons set forth below. The initial filing indicates that the petitioner described the land as being devoted to the care of the forest, pasture, and the planting of fruit trees (see filing at folio 12). This is consistent with the testimony given by [Nombre7], [Nombre8], and [Nombre9], who stated that they had known the land for approximately 40 to 35 years and that the property had been devoted to pasture, livestock farming, care of the forest, and agricultural activities (see witness testimony at folios 286 to 288). Indeed, [Nombre7] stated: “The farm is devoted to livestock farming; most of it is forested” (see witness testimony at folio 286).

For his part, [Nombre9] testified that the farm is used for agriculture and for cattle kept there; see folios 287 and 288. It is therefore evident that the property has been used for various activities that are incompatible with the appropriate land use. This situation is corroborated by land-use-conformity study number 35830, issued on 17 de febrero del 2012, which indicated that 70 % of the property’s area has forest cover. In the remaining 30 %, the predominant cover consists of a mosaic of pasture and natural areas (pasture and riparian forest). The use conforms with the applicable requirements in 99 % of the area, except in sector C, where symptoms of erosion (terracettes) are present due to grazing on very steep slopes. The land is subject to Article 33 of Ley Forestal 7575 (see land-use-conformity certificate at folios 268 and 269). The foregoing was confirmed during the judicial inspection conducted on 23 de mayo del 2013, in which the court below stated: “...as indicated in the plan, the stream can be seen crossing the farm; this part is the flattest part (sic) of the farm, and on both sides of the stream there are two pasture areas....” It is important to emphasize that this proves that the stream area does not have the protection area established by law.

From the foregoing and the evidence in the record, it follows that neither the prior transferor nor the petitioners have exercised proper ecological possession of the property for which title is sought, which precludes approval of these possessory information proceedings. In this case, as previously stated, the petitioners were required to demonstrate, in addition to exercising ten years of possession prior to the property’s designation as a protected zone, that the possession exercised by both them and their predecessor in title conformed with the appropriate land use, in order to ensure proper protection of natural resources, particularly in cases in which the property is subject to a legal restriction. On this subject, this Court has stated: “... Possessory Information is a noncontentious judicial proceeding for formalizing a registrable title to a property right acquired through adverse possession, upon compliance with the corresponding statutory requirements.

Possession as owner must be demonstrated to have been quiet, public, peaceful, and uninterrupted (Articles 1 of the Possessory Information Law and 856 of the Civil Code). In addition to lacking a title registered or eligible for registration in the Public Registry, the applicant for title must expressly declare that the property has not previously been registered in the Public Registry. For reasons of public interest, and to prevent duplicate registration of the same property or to protect third parties with rights superior to those of the applicant for title, the Law requires notice to certain persons. It also established a procedure for objections within the Possessory Information proceeding if any interested party considers itself prejudiced by the granting of title (Article 8). The Possessory Information Law directs the Judge to treat the adjoining landowners as parties and therefore to provide them with personal notice from the outset of the proceedings, because the title could encompass part of the lands belonging to them....

Notice must also be given to co-owners or condominium owners. Likewise, to safeguard the interests of the State, the Office of the Attorney General of the Republic and the Agrarian Development Institute must be treated as parties in order to protect property subject to the public domain and state-owned Agrarian Property (Article 5). Finally, the Law requires that all interested parties who may have a legitimate interest in the proceeding be summoned through publication of a Notice in the Judicial Bulletin. (See section 5 of the Possessory Information Law).- Article 7 of the Possessory Information Law, as well as the Forestry Laws, have sought to protect forest resources from human activity by subjecting them to various forms of forest management. Although titling of such areas has been permitted, which, once declared conservation areas, become part of the Forest Heritage of the State, compliance with additional, more stringent requirements is required.

This leads us directly to the concept of ecological possession and to the principle of the ecological function of forest property. In repeated judgments, both the First Chamber of Cassation and the Higher Agrarian Court itself have established the principles that must govern the resolution of these types of agro-environmental situations. Our country has been a pioneer in developing the legal doctrines of agrarian possession and ecological possession. Case law itself has recognized and developed these doctrines, as well as the life cycle of agrarian possession and, more recently, ecological possession (within the broader principle of the ecological function of forest property). Case law has also sought to distinguish entrepreneurial ownership and possession, in which an activity directed toward forest cultivation is conducted, from ownership and possession in which merely extractive or purely conservation activities are carried out.

The latter cases involve forest ownership or possession (without an enterprise). It is precisely in these cases that Ley Forestal establishes an entire legal framework for the protection of forest resources, sometimes mandatorily subjecting the owner to the forestry regime and, in other cases, doing so voluntarily. Thus, in forest possession, de facto control is exercised over property having a forestry vocation or devoted for the most part to protecting forest resources, without any intention of exploiting them, or else devoted merely to the extraction of timber species through management plans intended to achieve the natural regeneration of the forest. In neither case would a biological plant or animal cycle be developed, nor would humans assume any risk. This is why the law does not protect—and, on the contrary, penalizes—possession through which the forest resources of protected areas are destroyed.

It also denies the possibility of acquiring possessory rights over lands in national reserves when harmful action against forest resources has been undertaken. Today, part of agrarian legal scholarship affirms the existence of Forestry Law, with the characteristics of an organic and complete system in which the doctrines of forest ownership and possession occupy an important place. In Costa Rica, forest ownership, as well as forest possession as a real right derived from it or conceived independently, began to take shape with the Fiscal Code of 1885, which establishes an entire chapter concerning forests whose regulations are aimed at their conservation. Subsequently, Ley de Terrenos Baldíos No. 13 of 6 de enero de 1939 incorporated those principles. Thereafter, Article 7 of the Land and Colonization Law expanded the national reserves for the protection of such resources. VII.- Special legislation concerning the protection of forest ownership and possession has had three stages in our country.

The first stage of forest ownership is framed by Ley No. 4465 of 35 de noviembre de 1969. The second began with better-conceived regulations enacted through Ley No. 7032 of 7 de abril de 1986, which was subsequently declared unconstitutional. The final stage began with the enactment of Ley Forestal No. 7174 of 28 de junio de 1990, recently amended by Ley No. 7575 of 13 de febrero de 1996 (published in supplement 21 of La Gaceta No. 72 on Tuesday, 16 de abril de 1996). These laws contain various forest-property regimes and limit private parties’ use and exploitation of resources. Ownership of land with forest cover cannot be acquired unless the protection of the forest resource is demonstrated. Its constitutional basis is found in the second paragraph of Article 45 of the Constitution. The legal doctrines of forest ownership and possession are protected through restrictions based on social interest.

Such ownership is not the same as civil or agrarian ownership; it is ownership for conservation, and therefore the acts of possession performed on the property must serve that purpose.- VIII. Forest possession has had its legal framework in the aforementioned Forestry Laws. It applies to a specific type of property: land covered by forests or having a forestry vocation. The owner or possessor of such property has an obligation to conserve forest resources and may not exploit them economically except under the restrictions or limitations imposed by law. For the legal resolution of disputes arising from the exercise of forest possession, that special legal framework and the principles of Forestry Law must be applied. Ley Forestal establishes, as an essential function and priority of the State, the duty to ensure the protection, conservation, use, industrialization, administration, and promotion of the country’s forest resources, in accordance with the principle of rational use of renewable natural resources.

(Article 1). All land having a forestry vocation and all forests in the country, whether state-owned or held under private ownership, are subject to the purposes of the law. The forestry regime is the body of provisions, including legal, economic, and technical provisions, established by the law, its regulations, and other rules governing the conservation, renewal, use, and development of the country’s forests and lands having a forestry vocation.

Accordingly, to acquire forest property by adverse possession (usucapión), the exercise of forest possession (posesión forestal) is required. Article 7 of the Ley de Informaciones posesorias, as amended by the Ley Forestal, provided, prior to its amendment: “Article 7. When the property referred to in the proceeding is located within an area declared to be a national park, biological reserve, forest reserve, or protected zone, the applicant for title must demonstrate that ten-year possession was exercised beginning at least ten years before the effective date of the respective law or decree creating the relevant wilderness area. Properties located outside those areas and containing forests may be titled only if the petitioner demonstrates having possessed them for ten years or more and having protected that natural resource, provided that the property must be duly demarcated by fences or cleared boundary lines.” In other words, actual control under forest possession applies to the natural resource consisting of “forests” or “lands suitable for forestry,” and acts of possession must be directed toward their protection and conservation.

Only if this is demonstrated may the land be acquired or registered in favor of those possessors. Otherwise, it would become part of the State’s natural heritage (Article 13 of the new Ley Forestal), would be exempt from attachment and inalienable, and its possession would not create any rights in favor of private parties (Article 14 of the new Ley Forestal)... X. Ley Forestal No. 7575 also retained the restrictions in the Ley de Informaciones Posesorias governing the titling of land located within protected areas. The current provision states in this regard: “Article 7.- When the property referred to in the proceeding is located within a protected wilderness area, regardless of its management category, the applicant for title must demonstrate ownership of the legal rights to ten-year possession, exercised beginning at least ten years before the effective date of the law or decree creating that wilderness area.” (Emphasis added).

In other words, the legislature intended those areas to have remained protected and conserved throughout this entire period, including before the creation of the Reserves and protected areas...” (Voto Nº 113 de las 14:50 horas del 20 de febrero de 1998).

V.Based on the authority cited above, it is evident that the two requirements set forth by law must be satisfied in order to acquire this type of land, namely, possession for ten years prior to the creation of the protected wilderness area (área silvestre protegida) and the exercise of ecological possession (posesión ecológica). Because the latter requirement was not proven in this case, the proper course is to reverse the challenged decision and, in its place, deny the present possessory information proceedings (diligencias de información posesoria) initiated by [Nombre1] , [Nombre2] , [Nombre10] and [Nombre4] . As for the appellant’s remaining grounds for appeal (agravios), no ruling is made on them in view of the manner in which this matter is decided.

THEREFORE (POR TANTO):

The challenged decision is reversed and, in its place, the present possessory information proceedings initiated by [Nombre1] , [Nombre2] , [Nombre10] and [Nombre4] are denied. As for the appellant’s remaining grounds for appeal, no ruling is made on them in view of the manner in which this matter is decided .

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las diecisiete horas y cuarenta minutos del diecinueve de diciembre de dos mil catorce.- INFORMACIÓN POSESORIA promovida por [Nombre1] , mayor, soltera, de oficios domésticos, vecina de Río Esquinas de Osa, Puntarenas, cédula de identidad número CED1 - - ; [Nombre2] , mayor, casado, guarda, vecino de Osa, cédula de identidad número CED2 - - ; [Nombre3] , mayor, soltero, agricultor, vecino de Osa, cédula de identidad número CED3 - y [Nombre4] , mayor, soltero, de profesión desconocida, vecino de Osa, cédula de identidad número CED4 - - . Intervienen en el proceso, la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Susana Fallas Cubero, mayor, abogada, vecina de San José, cédula de identidad número CED5 - - , en su condición de procuradora adjunta y el INSTITUTO DE DESARROLLO RURAL, cédula jurídica CED6 - - dos mil ciento cuarenta y tres - once, representado por [Nombre5] , mayor, divorciada una vez, abogada, vecina de Guachipelín de Escazú, cédula de identidad número CED7 - - . Actúa como apoderado especial judicial de los promoventes, el licenciado Alex Chavarría Castillo , mayor, casado, abogado, vecino de Palmar Norte, cédula de identidad número CED8 - - . Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, con sede en Corredores.-

RESULTANDO:

  1. 1Los promoventes interpusieron proceso de información posesoria con el fin que se inscriba a su nombre en el Registro Público de la Propiedad la finca que se describe así: "Terreno de montaña, tacotal, pastos,con una casa de habitación, diez hectáreas de tacotal, treinta hectáreas de pasto, treinta y nueve hectáreas de montaña, situada en Rio Esquinas, Del [Dirección1] , , de la provincia de Puntarenas, con una medida total de setenta y nueve hectáreas cuatro mil cuatrocientos setenta metros cuadrados, según el plano catastrado p 407641-1997 y que tiene los siguientes linderos; norte con Parque Nacional Piedras Blancas, sur; Parque Nacional Piedras Blancas; este y Oeste con Parque Nacional Piedras," (folios 12, 256, 562 y 329).-
  2. 2La Procuraduría General de la República se apersonó al proceso en los términos que corren de folio s 241 a 244; a su vez el Instituto de Desarrollo Rural lo hizo en el folio 247, sin manifestar ambos su oposición a las presentes diligencias. -
  3. 3La jueza Marisel Zamora Arias, del Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores, mediante sentencia número 27-2014 de las nueve horas veintidós minutos del veinte de Marzo del año dos mil catorce, resolvió: "POR TANTO: De conformidad con lo expuesto y habiendo cumplido con los requisitos que señala ala Ley de Informaciones Posesorias, se APRUEBAN las presentes diligencias de información posesoria y se ordena al registro Público de la Propiedad inscribir a nombre de los señores: [Nombre1] , [Nombre2] , [Nombre3] , Y [Nombre4] , el terreno que se describe de la siguiente forma:Terreno de montaña, tacotal, pastos,con una casa de habitación, diez hectáreas de tacotal, treinta hectáreas de pasto, treinta y nueve hectáreas de montaña, situada en Rio Esquinas, Del [Dirección2] , Golfito, de la provincia de Puntarenas, con una medida total de setenta y nueve hectáreas cuatro mil cuatrocientos setenta metros cuadrados, según el plano catastrado p 407641-1997 y que tiene los siguientes linderos; norte con Parque Nacional Piedras Blancas, sur; Parque Nacional Piedras Blancas; este y Oeste con Parque Nacional Piedras," (folios 325 al 329 y vuelto).-
  4. 4La licenciada Susana Fallas Cubero, en su condición de procuradora adjunta , formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia, (folios 346 al 350).-

5. En la substanciación del proceso se han observado las prescripciones legales, y no se nota la existencia de errores u omisiones en el fallo capaces de producir su nulidad. - Redacta la jueza Ruiz Ramírez, y;

CONSIDERANDO

I. HECHOS PROBADOS

Este Tribunal comparte lo dispuesto en relación con los hechos probados por tener buen sustento en los autos, salvo el número cinco, por no encontrarse conforme a las pruebas aportadas al expediente.

II. HECHOS NO PROBADOS

Para resolver en esta instancia, de esta naturaleza este Tribunal tiene el siguiente: 2.- No se demostró que las personas promoventes ni su anterior adquirente hubieran ejercido en el inmueble pretendido a titular una posesión ecológica ni se brindara la adecuada protección a los recursos naturales (No consta en autos pruebas que lo acrediten).

III.La representante del Estado interpuso recurso de apelación contra la resolución dictada por el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur a las nueve horas veintidós minutos del veinte de marzo del dos mil catorce, argumentado en lo medular: En el hecho probado 5), se indicó: " Que los promoventes aportaron el informe de uso del suelo, el cual indica que se ha cumplido con el uso conforme del suelo", lo cual es falso y la sentencia es incongruente al sostener después: " en uno por ciento no se ha cumplido (considerando cuarto). En el acta de la diligencia del reconocimiento judicial se indicó: " hacia ambos lados de la quebrada hay dos áreas de potreros". En el mapa de capacidad de uso de las tierras se ilustra como todas las áreas que rodean la quebrada (sectores A, B y C) son de pasto. Ello conlleva la imposibilidad de adquirir derechos de propiedad o de posesión por no haberse protegido el recurso natural en terrenos ubicados en el Parque Nacional Piedras Blancas.

Alega, el terreno objeto de estas diligencias (según plano No. P-407641-1997) está ubicado en su totalidad dentro del Parque Nacional Piedras Blancas (Hecho probado 3). El representante de los promoventes en folio 271 manifestó que " solo hay un colindante, el cual es el Estado Costarricense, ya que las fincas que rodean el terreno de marras fueron vendidas y pagadas por el Estado". Indica, en el plano se dibuja una servidumbre de 1163.12 metros de largo sobre un terreno descrito como A, sin que sea visible a qué corresponde dicha letra, pero según el oficio No. SINAC-ACOSA-PNPB-AD-018-2013 que aporto, esos sectores son fincas propiedad del Estado. Agrega,en el acta de reconocimiento judicial se consignó que ingresaron por la quebrada que colinda con [Nombre6] según el plano, pero según el oficio citado ese sector es propiedad del Estado. Manifiesta, no recibió copia del escrito en la cual se indicó que la servidumbre que aparece en el plano no ha sido inscrita legalmente, sin embargo, considera no cabe tener por cumplido ese requisito por cuanto el plano citado en la resolución en la cual se da por cumplido el requisito no es objeto de estas diligencias.

Alega, las servidumbres de paso, por ser discontinuas, no pueden constituirse por usucapión (artículo 379 del Código Civil) Además el artículo 11 de la Ley de Creación de Servicio de Parques Nacionales No. 6084 dispone: " No podrán constituirse servidumbres a favor de fundos particulares en terrenos de parques nacionales", que de aprobarse estas diligencias y ordenar la inscripción del inmueble en esas condiciones se está contraviniendo la Ley No. 6084 del 24 de agosto de 1977.

IV.Lleva razón la recurrente en sus agravios. Para poder titular mediante el trámite de información posesoria el legislador estableció una serie de requisitos mayores, justamente para evitar que el Patrimonio Natural del Estado y las áreas protegidas se vean afectadas, así como su biodiversidad. Por ello, la Ley de Informaciones Posesorias en su artículo 7 exige demostrar, aparte de la posesión decenal anterior a la creación de la respectiva área protegida; que se ha conservado y protegido los recursos naturales existentes en el inmueble. De los autos se desprende que la finca pretendida a titular se encuentra representada por el plano P-407641-97, la cual, está dentro del Parque Nacional Piedras Blancas creado mediante Decreto No. 23153-MIRENEN del 19 de abril de 1994 (ver plano catastrado en folio 1, certificación del Sistema Nacional de Áreas de Conservación a folio 2); fecha a partir de la cual se establecía una restricción en el ejercicio de las actividades productivas, pues el fin de la zona protectora es justamente proteger los recursos naturales y la biodiversidad.

En el caso concreto, como bien lo argumenta el recurrente, no demostró las personas promoventes el ejercicio de la posesión conforme con el uso del suelo y la adecuada protección de los recursos naturales antes ni después de la creación de la Zona Protectora, por las razones que se exponen a continuación. Del escrito inicial se desprende que el promovente describe que el terreno se encuentra dedicado al cuido de la montaña, pasto y siembra de árboles frutales (ver escrito a folio 12). Ello concuerda con las declaraciones testimoniales recibidas por parte de los señores [Nombre7] , [Nombre8] , y [Nombre9] , los cuales, indicaron que conocen el terreno hace aproximadamente 40 a 35 años y que dicho inmueble ha sido dedicado a pastos, ganadería, al cuido de la montaña y agriculturas (ver declaraciones testimoniales en folios 286 a 288) Incluso el señor [Nombre7] manifestó: "La finca esta dedicada a la ganadería, tiene montaña casi en su mayor parte" (ver declaración testimonial en folio 286).

Por su parte el señor [Nombre9] declaró que la finca la dedican a la agricultura y a un ganado que tienen ahí, ver folios 287 y 288. Ante ello, es evidente que el inmueble ha sido destinado a diversas actividades que resultan incompatibles con el uso del suelo. Dicha situación es corroborada con el estudio de uso conforme de suelos número 35830 emitido en fecha 17 de febrero del 2012; en el cual, se indicó el terreno presenta una cobertura boscosa en el 70 % de su área. En el restante 30 % la cobertura que predomina es un mosaico de pastos con zonas naturales (pastos y bosque ripario). El uso es conforme en el 99 % del área, exceptuando el sector C, donde se presentan síntomas de erosión (terracetas), debido a la actividad de repasto, en pendientes muy fuertes. Terreno afectado por el artículo 33 de la Ley Forestal 7575 (ver certificado de uso conforme de suelos en folios 268 y 269). Lo anterior, fue constatado con el reconocimiento judicial que se realizó en fecha 23 de mayo del 2013, en donde el a quo señaló: " ...se observa así como lo indica el plano que la quebrada atraviesa la finca, es ta parte es la parte (sic) más plana de la finca hacia ambos lados de la quebrada hay dos áreas de potreros...".

Es importante resaltar que con ello se acredita que el área de la quebrada no cuenta con el área de protección establecida por ley. De lo anterior y conforme a las pruebas que constan en autos, se desprende que tanto el anterior transmitente como las personas promoventes no han ejercido una adecuada posesión ecológica en el inmueble pretendido a titular, lo cual, impide la aprobación de las presentes diligencias de información posesoria. En este caso, como bien se indicó anteriormente, las personas promoventes tenían que haber demostrado, además del ejercicio de la posesión decenal anterior a la afectación del inmueble como zona protectora, que dicho ejercicio de la posesión ejercida tanto por ellas como por su anterior adquirente, había sido conforme con el uso del suelo, ello con el fin de garantizar la adecuada protección de los recursos naturales, en especial en los casos en los que se cuenta con una afectación legal.

Sobre el tema, este Tribunal ha expuesto: "... La Información Posesoria es un trámite de actividad judicial no contenciosa para la formalización de un título registrable sobre un derecho de propiedad que se ha llegado a adquirir por la usucapión, cumpliendo para ello con los requisitos legales correspondientes. Se exige demostrar la posesión a título de dueño, en forma quieta, pública, pacífica e ininterrumpida (artículos 1 Ley de Informaciones Posesorias y 856 del Código Civil). El titulante, aparte de carecer de título inscrito o inscribible en el Registro Público, debe manifestar expresamente que la finca no ha sido inscrita en el Registro Público anteriormente. Por razones de interés público, y para evitar una doble inscripción registral sobre un mismo bien, o bien, para tutelar a terceros de mejor derecho que el titulante, la Ley exige notificar a ciertos sujetos. También estableció un trámite de oposición dentro de la Información Posesoria, en caso de que alguno de los interesados se sienta perjudicado por la titulación (artículo 8).

La Ley de Informaciones Posesorias ordena al Juez tener como partes y por tanto notificarles personalmente desde el inicio de las diligencias, a los colindantes, ello por cuanto la titulación podría abarcar parte de las tierras que les pertenecen... se ordena notificar a los condueños o condóminos. Igualmente, en resguardo de los intereses del Estado, se ordena tener como parte a la Procuraduría General de la República y al Instituto de Desarrollo Agrario, para el resguardo de la propiedad sujeta al dominio público, y de la Propiedad Agraria estatal (artículo 5). Finalmente, la Ley manda a citar a todos los interesados, mediante la publica ción de un Edicto en el Boletín Judicial, que puedan tener un interés legítimo en el proceso.(Ver numeral 5 de la Ley de Informaciones Posesorias).- La Ley de Informaciones Posesorias, en su artículo 7, así como las Leyes Forestales han procurado proteger los recursos forestales de la acción humana, sometiéndolos a diversas formas de manejo forestal.

Aunque se ha permitido la titulación de dichas áreas, que ya declaradas como áreas de conservaci ón pasan a formar parte del Patrimonio Forestal del Estado, se exige el cumplimiento de otros requisitos más calificados. Eso nos conduce, directamente al concepto de posesión ecológica, y al criterio de la función ecológica de la propiedad forestal. En reiteradas sentencias, tanto de la Sala Primera de Casación, como del mismo Tribunal Superior Agrario, se han establecido los principios que deben regir para resolver éste tipo de situaciones agro-ambientales. Nuestro país ha sido pionero en la construcción de los institutos de la posesión agraria y la posesión ecológica. La misma jurisprudencia ha reconocido y desarrollado estos institutos, así como el ciclo de vida de la posesión agraria y, recientemente de la posesión ecológica (dentro del más amplio criterio de la función ecológica de la propiedad forestal).

La misma Jurisprudencia ha querido distinguir la propiedad y posesión empresarial donde se ejercita una actividad dirigida al cultivo del bosque, de aquella donde simplemente se realiza una actividad extractiva o bien, meramente conservativa. En estos últimos casos se estaría en presencia de una propiedad o posesión forestal (sin empresa). Precisamente es en estos casos donde la Ley Forestal viene a establecer todo un régimen jurídico para la protección de los recursos forestales, sometiendo algunas veces al propietario en forma obligatoria al régimen forestal y en otros casos en forma voluntaria. De esa forma, en la posesión forestal el poder de hecho se ejerce sobre un bien de vocación forestal o en su mayor parte destinado a proteger los recursos forestales, sin miras a su explotación o bien, dedicándolo a la simple extracción de especies maderables, a través de planes de manejo para lograr la regeneración natural del bosque.

En uno y otro caso no existiría el desarrollo de un ciclo biológico vegetal o animal, ni asumiría el hombre ningún riesgo. Es por eso que la ley no tutela, al contrario reprime, la posesión a través de la cual se destruyan los recursos forestales de áreas protegidas. Además niega la posibilidad de adquirir derechos de posesión sobre tierras de las reservas nacionales cuando se ha ejercido una acción dañina en contra de los recursos forestales. Hoy, parte de la doctrina agrarista afirma la existencia de un Derecho forestal, con particularidades de sistema orgánico y completo, donde ocupan un lugar importante los institutos de la propiedad y posesión forestal. En Costa Rica la propiedad forestal, y también la posesión forestal como derecho real derivado de aquella, o bien concebido en forma independiente, se comienza a perfilar desde el Código Fiscal de 1885, que establece todo un capítulo en cuanto a bosques cuyas regulaciones tienden a su conservación.

Posteriormente la Ley de Terrenos Baldíos No. 13 del 6 de enero de 1939 incorpora dichos principios. Luego la Ley de Tierras y Colonización en su artículo 7 amplía las reservas nacionales para la protección de tales recursos. VII.- La legislación especial en cuanto a la tutela de la propiedad y posesión forestales tiene tres etapas en nuestro país. La primera etapa de la propiedad forestal se enmarca con la Ley No. 4465 del 35 de noviembre de 1969. La segunda se abre a través de una normativa mejor concebida a través de la Ley No. 7032 del 7 de abril de 1986, la cual fue posteriormente declarada inconstitucional. La última opera con la promulgación de la Ley Forestal No. 7174 del 28 de junio de 1990, reformada recientemente, por Ley No. 7575 del 13 de febrero de 1996 (publicada en el alcance 21 de La Gaceta No. 72 del martes 16 de abril de 1996). En ellas, se contienen diversos regímenes de propiedad forestal, y limita el uso y aprovechamiento de los recursos por los particulares.

No es posible adquirir la titularidad sobre terrenos con cobertura boscosa si no se demuestra haber protegido el recurso forestal. Su fundamento constitucional se encuentra en el párrafo segundo del artículo 45 de la Constitución. A través de limitaciones de interés social se protege el instituto de la propiedad y la posesión forestal. Esta no es igual a la civil, ni a la agraria, se trata de una propiedad para conservar, y por tanto los actos posesorios que en ella se realicen deben tener esa finalidad.- VIII. La posesión forestal ha tenido su régimen jurídico en las Leyes Forestales mencionadas. Recae sobre un bien específico: los terrenos cubiertos de bosques o de aptitud forestal. El propietario o poseedor de tales bienes tiene la obligación de conservar los recursos forestales y no los puede aprovechar económicamente sino bajo las restricciones o limitaciones impuestas por la ley. Para la solución jurídica de conflictos que nazcan del ejercicio de la posesión forestal, se debe aplicar ese régimen jurídico especial y los principios del Derecho forestal.

La Ley Forestal establece como función esencial y prioridad del Estado, velar por la protección, la conservación, el aprovechamiento, la industrialización, la administración y el fomento de los recursos forestales del país, de acuerdo con el principio de uso racional de los recursos naturales renovables.(Artículo 1). Todos los terrenos de aptitud forestal y los bosques del país, ya sea estatales o que estén reducidos a dominio particular, quedan sometidos a los fines de la ley. El régimen forestal es el conjunto de disposiciones, entre otras, de carácter jurídico, económico y técnico, establecidas por la ley, su reglamento y demás normas, que regulen la conservación, la renovación, el aprovechamiento y el desarrollo de los bosques y terrenos de aptitud forestal del país. Por ello, para adquirir la propiedad forestal por usucapión, se requiere el ejercicio de la posesión forestal. El artículo 7 de la Ley de Informaciones posesorias, reformado por la Ley Forestal, establecía, antes de su reforma: "Artículo 7.

Cuando el inmueble a que se refiere la información esté comprendido dentro de una zona declarada parque nacional, reserva biológico, reserva forestal o zona protectora, el titulante tendrá que demostrar haber ejercido la posesión decenal con por lo menos diez años de antelación a la fecha de vigencia de la respectiva ley o decreto en que se creó la respectiva área silvestre. Las fincas que estén fuera de esas áreas y que tengan bosques, solo podrán ser tituladas si el promovente demuestra haberlas poseído por diez años o más y haber protegido dicho recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado con cercas o carriles." En otros términos, el poder de hecho en la posesión forestal recae sobre el recurso natural "bosques" o "terrenos de aptitud forestal", y los actos posesorios deben ir encaminados a su protección y conservación. Sólo si se demuestra eso podría adquirirse o inscribirse terrenos a favor de dichos poseedores.

De lo contrario, quedarían formando parte del patrimonio natural del estado (artículo 13 de la nueva Ley Forestal), con carácter inembargable e inalienable, y su posesión no causará ningún derecho a favor de los particulares (art ículo 14 de la nueva Ley Forestal)... X. La Ley Forestal No. 7575, también mantuvo las restricciones en la Ley de Informaciones Posesorias, para poder titular terrenos comprendidos en áreas protegidas. Al respecto dispone el actual numeral: "Artículo 7.- Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre." (La negrita es nuestra). Es decir, la intención del legislador es que esas áreas se hayan mantenido protegidas, conservadas durante todo este tipo, incluso antes de la creación de las Reservas y áreas protegidas..." (Voto Nº 113 de las 14:50 horas del 20 de febrero de 1998).

V.Con fundamento en la cita expuesta, se evidencia la necesidad de cumplir con los dos requisitos expuestos en la ley para poder adquirir este tipo de terrenos, siendo éstos la posesión decenal anterior a la creación del área silvestre protegida y el ejercicio de la posesión ecológica y al no haberse acreditado en el presente caso el último de los requisitos, lo procedente es revocar la resolución recurrida y en su lugar, improbar las presentes diligencias de información posesoria promovidas por la [Nombre1] , [Nombre2] , [Nombre10] y [Nombre4] . En cuanto a los demás agravios expuestos por el recurrente, se omite pronunciamiento sobre los mismos por la forma en la que se resuelve.

POR TANTO:

Se revoca la resolución recurrida y en su lugar, se imprueban las presentes diligencias de información posesoria promovidas por [Nombre1] , [Nombre2] , [Nombre10] y [Nombre4] . En cuanto a los demás agravios expuestos por el recurrente, se omite pronunciamiento sobre los mismos por la forma en la que se resuelve .
