WHEREAS:

  1. 1The claimant instituted these proceedings so that, through this procedure, the property described as follows may be registered in the Public Property Registry: “...pastureland and woodland, located in Santa Elena at [Dirección1] , , in the Province of Puntarenas, measuring one hectare, two thousand one hundred thirteen square meters and fifty-one square decimeters; bounded on the NORTH by: Rodríguez Creek; SOUTH: [Nombre3] , [Nombre4] and a right-of-way with a frontage of seven linear meters. EAST: Servicios Camadu S.A. and WEST: [Nombre5] and [Nombre6] . Survey plan number P-1226429-2008 .(pages 15 to 19).
  2. 2The Office of the Attorney General of the Republic entered an appearance in the proceeding under the terms appearing on pages 29 to 31; the Agrarian Development Institute, in turn, did so on page 33.-
  3. 3Judge Sandra Trejos Jiménez of the Agrarian Court of Puntarenas, by judgment number 86-14, at fourteen hours thirty minutes on August twentieth, two thousand fourteen, ruled: “THEREFORE: Based on the foregoing and the statutory provisions cited, the legal requirements set forth in the Possessory Information Act N° 139 of July 14, 1941, and its amendments and additions, having been satisfied, I grant the claim asserted in these possessory information proceedings and, consequently, order the Public Real Property Registry to register the property that is the subject of these proceedings, free of liens, encumbrances, and co-owners, and without prejudice to third parties having a superior right, in the name of CORPORACION WILKIN S.A., domiciled in Santa Elena de Monteverde, Puntarenas, corporate identification number CED1, represented by its general attorney-in-fact without limitation as to amount, [Nombre1] , who has only one surname due to her United States nationality, of legal age, married twice, educator, holding passport number CED2 from her country, resident of Santa Elena de Monteverde, Puntarenas.The unregistered property, as to which the title applicant states that she lacks a title capable of registration in the Public Registry and which is located in Santa Elena, at [Dirección1] , , in the Province of Puntarenas, consists of demarcated pastureland and woodland and measures ONE HECTARE, TWO THOUSAND ONE HUNDRED THIRTEEN SQUARE METERS AND FIFTY-ONE SQUARE DECIMETERS; bounded on the North by: [Dirección2] ; South: [Nombre3] , [Nombre4] and a right-of-way with a frontage of seven linear meters; East: Servicios Camadu S.A.; and West: [Nombre5] and Rodríguez Creek; and is depicted in cadastral plan registered under N° P-1226429-2008 dated 28-03-2008. The title applicant has possessed the property for more than ten years, quietly, publicly, peacefully, and as owner, having acquired it through purchase from Mr. [Nombre4] . The notice publicizing these proceedings was published in Judicial Bulletin N° 117 dated June 17, 2011, and no third-party objection was filed.During the proceedings, testimony was received from [Nombre7] , [Nombre8] and [Nombre9] , all residents of Santa Elena, Puntarenas, who testified regarding the claimant’s exercise of possession over the property subject to registration, quietly, publicly, and peacefully for more than ten years. The claimant has exercised possession over this property while complying with the conforming land use for the activity conducted, in accordance with the approved methodology. The land subject to registration is located outside any protected wildlife area and does not include land owned or administered by the Agrarian Development Institute. The adjoining landowners were notified of the existence of the proceeding, and none filed an objection or opposition. The property subject to registration was appraised at eight million colones, and the proceedings at the same amount; the land is registered, lacks a title capable of registration with the Public Property Registry, is not subject to liens or encumbrances, has no co-owners, and the purpose of the proceedings was not to evade the consequences of probate proceedings.Pursuant to the provisions of article 19 of the Possessory Information Act, it is declared that this property is subject to the following reservations: First: If the parcels are landlocked or front on public roads less than 20 meters wide, they shall be subject to the reservations indicated in the General Public Roads Act. Second: To the reservations indicated in articles 72 and 73 of the Water Act, whenever public- or private-domain waters exist, as applicable. Third: To the prohibition against destroying forests or wooded areas containing plant or animal specimens which, in the judgment of the Ministry of Agriculture and Livestock, are undergoing extinction in the country; and Fourth: If the properties are declared suitable for forestry by the General Forestry Directorate within the month specified in article 5 of the Possessory Information Act, cutting trees on 25% of the area of this land is prohibited, except for those whose cutting that Directorate authorizes for forest renewal, after planting 5 or more trees of the same species for each tree authorized to be cut.The Public Registry is ordered to record that the property is subject to the reservations under article 4 of the General Public Roads Act. It shall also record that the area adjoining the watercourses is a protected area pursuant to article 33 subsection b) of Ley Forestal N° 7575, where the cutting or removal of trees is prohibited, and that the bed and waters of that watercourse are in the public domain (Water Act, articles 1 subsection IV and 3 subsection III). The surface water and groundwater existing on the property are in the State public domain and do not form part of the property. Given the nature of this type of proceeding, no special award of costs is entered. Once this judgment becomes final, the corresponding certified enforcement copy shall be issued...” (pages 142 to 147).
  4. 4Attorney Lydiana Rodríguez Paniagua, in her capacity as Deputy Attorney General, filed an appeal expressly stating the grounds on which she relies to challenge the trial court’s position (pages 156 to 162).
  5. 5The statutory requirements have been observed in the processing of the proceeding, and no errors or omissions capable of rendering the judgment null and void are evident.

Drafted by Judge [Nombre10] PANIAGUA; and,

CONSIDERING:

I.This Court adopts the statement of facts deemed proven in the judgment under appeal, as it faithfully reflects the contents of the record.-

II.Deputy Attorney General Lydiana Rodríguez Paniagua appeals the judgment rendered at fourteen hours thirty minutes on August twentieth, two thousand fourteen, arguing that the property sought to be registered consists of forestlands and forests within national reserves and is therefore subject to the public domain and has formed part of the State’s natural heritage since Ley Forestal 4465 of 1969, article 33, as amended by Ley Forestal 7174 of 1990, and that its public-domain status is maintained in Ley 7575 in articles 13 and 14.- She considers that the witness testimony does not establish ten years of possession sufficient for acquisitive prescription.- (see pages 156 to 162).-

III.The grounds for appeal asserted by the appellant are not accepted, for the following reasons: The soil study prepared by the National Institute for Agricultural Innovation and Technology Transfer (INTA) indicates that the property depicted in cadastral plan number P-1226429-2008 is land containing secondary forest and pasture. Although it is true that a majority of a differently constituted panel of this Court has held that the computation of the ten-year period of possession of forestland must precede its designation as public-domain property under Ley Forestal of 1969, that does not apply to this particular case. It should be noted that the property consists of secondary forest and improved pasture, which implies that the land was regenerated by its possessor; moreover, the judicial inspection shows that this resource has been cared for. The National Forestry Certification Commission of Costa Rica defines secondary forest as “... land with woody vegetation of a secondary successional nature that develops after the original vegetation has been removed by human activities or natural phenomena; with a minimum area of 0,5 ha and a density of no fewer than 500 trees per ha of all species, with dbh of no less than 5 cm” (CNCF 1999, National Forestry Certification Commission. 1999.

Based on this definition and the INTA technical study appearing on page 1, the original forest was converted into scrubland and subsequently became a secondary forest which, as stated, has been cared for by its possessor. Declaring this type of secondary forest to be public-domain property would discourage this kind of forest-regeneration activity, because possessors would prefer to keep their land as pasture so that it would remain within their estate and they would not risk having it declared State property. Silviculture and secondary-forest regeneration are activities necessary for capturing carbon from the atmosphere and, consequently, are environmental measures against global warming. As these activities benefit the environment, it would be inconsistent to punish possessors who engage in this kind of forest regeneration by denying them the right to obtain title to their property.

Nor is this property located within any protected zone; on the contrary, according to the document on page 1, it is located outside protected wildlife areas. Based on the foregoing, the witness testimony given in the record, which refers to ten years of possession, establishes a period sufficient for acquisitive prescription, because the requirement of exercising possession for ten years publicly, peacefully, continuously, and in good faith has been met. There is no need to address ten years of possession predating Ley Forestal, because the land was converted into secondary forest, an activity undertaken by the possessors that it would be contradictory to punish by refusing to recognize it as valid for purposes of acquisitive prescription.-

IV. For the foregoing reasons, the judgment under appeal must be affirmed insofar as it was challenged.-

VOTO N° 1204-F-14 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas y cuarenta y cuatro minutos del diecinueve de diciembre de dos mil catorce.- DILIGENCIAS DE INFORMACIÓN POSESORIA promovidas por CORPORACION WILKIN S.A.,domiciliada en Santa Elena de Monteverde de Puntarenas, con cédula jurídica número CED1, representada por su apoderada generalísima sin límite de suma [Nombre1] de un solo apellido en razón de su nacionalidad Estadounidense, quien es mayor, casada dos veces, educadora con pasaporte de su país número CED2, vecina de Santa Elena de Monteverde Puntarenas. Intervienen como partes la PROCURADURÍA GENERAL DE LA REPÚBLICA representada por Lydiana Rodríguez Paniagua, de calidades desconocidas en autos, en condición de procuradora adjunta; y el INSTITUTO DE DESARROLLO AGRARIO, cédula jurídica CED3 - - - , representado por Carmelina [Nombre2] Hidalgo, mayor, divorciada, abogada, vecina de Guachipelín, Escazú, cédula de identidad CED4 - - , en su condición de apoderada general judicial . Actúa como apoderado especial judicial el licenciado Javier González Loría, mayor, soltero, vecino de San Ramón de Alajuela, con cédula de identidad número CED5- . Tramitado ante el Juzgado Agrario de Puntarenas.-

RESULTANDO:

  1. 1El promovente formulo las presentes diligencias para que por medio de esta vía se proceda a inscribir en el Registro Público de la Propiedad la finca que se describe así: "...terreno de pastos, montaña, sita en Santa Elena en el [Dirección1] , , de la provincia de Puntarenas, con una medida de una hectárea dos mil ciento trece metros con cincuenta y un decímetros cuadrados; linda al NORTE: Quebrada Rodríguez; SUR: [Nombre3] , [Nombre4] y servidumbre de paso con un frente de siete metros lineales. ESTE: Servicios Camadu S.A. y OESTE: [Nombre5] y [Nombre6] . Plano número P-1226429-2008 .(folio 15 a 19).
  2. 2La Procuraduría General de la República se apersonó al proceso en los términos que corren de folio 29 a 31; a su vez el Instituto de Desarrollo Agrario lo hizo en el folio 33.-
  3. 3La jueza Sandra Trejos Jiménez, del Juzgado Agrario de Puntarenas, mediante sentencia número 86-14, de las catorce horas treinta minutos del veinte de agosto del dos mil catorce, resolvió: "POR TANTO: Con base en lo que ha sido expuesto y artículos de ley citados, estando cumplidos los requisitos legales señalados en la Ley de Informaciones Posesorias N° 139 de 14 de julio de 1941, sus reformas y adiciones, acojo la pretensión que se formula en las presentes diligencias de información posesoria, en consecuencia se ordena al Registro Público de la Propiedad Inmobiliario proceder a la inscripción de la finca motivo de éste trámite, libre de gravámenes, cargas reales y condueños y sin perjuicio de terceros de mejor derecho a nombre de CORPORACION WILKIN S.A. domiciliada en Santa Elena de Monteverde de Puntarenas, con cédula jurídica número CED1, representada por su apoderada generalísima sin límite de suma [Nombre1] , de un solo apellido en razón de su nacionalidad Estadounidense, quien es mayor, casada dos veces, educadora, con pasaporte de su país número CED2, vecina de Santa Elena de Monteverde, Puntarenas, la finca sin inscribir, de la cual la titulante afirma carece de título inscribible en el Registro Público y que se ubica en Santa Elena, en el [Dirección1] , , de la Provincia de Puntarenas, se trata de un terreno de pasto y montaña, demarcado, tiene una medida de UNA HECTAREA DOS MIL CIENTO TRECE METROS CON CINCUENTA Y UN DECÍMETROS CUADRADOS; lindante al Norte: [Dirección2] ; Sur: [Nombre3] , [Nombre4] y servidumbre de paso con un frente de siete metros lineales, Este: Servicios Camadu S.A. y al Oeste: [Nombre5] y quebrada Rodríguez, y se describe en el plano catastrado inscrito bajo el N° P-1226429-2008 de fecha 28-03-2008.La titulante posee el inmueble desde hace mas de diez años, en forma quieta, pública, pacífica y a título de dueño, quien adquirió por compra que le hiciera al señor [Nombre4] . El edicto relativo a la publicidad de éstas diligencias fue publicado en el boletín judicial N° 117 de fecha 17 de junio del año 2011, no hubo objeción de terceros. En el trámite se recibieron las declaraciones de [Nombre7] , [Nombre8] y [Nombre9] , vecinos todos de Santa Elena, Puntarenas, rindieron declaración sobre el ejercicio de la posesión decenal de la promovente sobre la finca objeto de inscripción, en forma quieta, pública, pacífica por más de diez años. Sobre éste inmueble el promovente ha ejercido posesión cumpliendo con el uso conforme del suelo para la actividad que realiza de acuerdo con la metodología aprobada. El terreno objeto de inscripción se ubica fuera de cualquier área silvestre protegida, no comprende terrenos propiedad del Instituto de Desarrollo Agrario o bajo su administración.Los colindantes del inmueble fueron notificados de la existencia de la diligencia, ninguno de ellos formuló objeción u oposición. El inmueble objeto de inscripción fue estimado en la suma de ocho millones de colones, he igual suma las diligencias, el terreno se encuentra inscrito, carece de título inscribible ante el Registro Público de la Propiedad, no soporta gravámenes, cargas reales, no tiene condueños y las diligencias no han tenido por fin evadir las consecuencias de un proceso sucesorio. De conformidad con lo que dispone el artículo 19 de la Ley de Informaciones Posesorias, se declara que este inmueble queda afectado a las siguientes reservas: Primero: Si los fundos son enclavados o tienen frentes a caminos públicos con ancho inferior a 20 metros, estarán afectos a las reservas que indica la Ley General de Caminos Públicos. Segundo: A las reservas que indica la Ley de Aguas en sus artículos 72 y 73, cuando existan aguas de dominio público o privado en su caso.Tercero: A la prohibición de destruir bosques o arboledas que contengan especímenes vegetales o animales, que estén en proceso de extinción en el país a juicio del Ministerio de Agricultura y Ganadería; y Cuarto: Si las fincas fueren declaradas de aptitud forestal por la Dirección General Forestal, dentro del mes que señala el artículo 5 de la Ley de Informaciones Posesorias, queda prohibido cortar árboles en un 25% de la cabida de este terreno, salvo, los que a esa Dirección autoriza para renovar bosque y previo cultivo de 5 o más árboles de la misma especie por cada árbol que se autorice cortar. Se ordena al Registro Público, se consigne que el inmueble se encuentra afecto a las reservas de los artículos 4 de la Ley General de Caminos Públicos. Además que el área contigua a las corrientes es área de protección según el artículo 33 inciso b) de la Ley Forestal N° 7575 y queda prohibida la corta o eliminación de árboles y el cauce y las aguas de esa corriente son de dominio público (Ley de Agua, artículos 1 inciso IV y 3 inciso III).Las aguas superficiales y subterráneas existentes en el inmueble son de dominio público estatal y no forman parte de la finca. Dada la naturaleza de este tipo de proceso, se resuelve sin especial condenatoria en costas. Una vez firme la presente expídase la ejecutoria correspondiente..." (folios 142 a 147).
  4. 4La licenciada Lydiana Rodríguez Paniagua, en su condición de procuradora adjunta, interpuso recurso de apelación con indicación expresa de las razones en que se fundamenta para refutar la tesis del juzgado de instancia, (folios 156 a 162).
  5. 5En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.

Redacta la jueza [Nombre10] PANIAGUA, y ;

CONSIDERANDO:

I.Este Tribunal prohija la relación de hechos tenidos por probados en el fallo recurrido al ser fiel reflejo de lo constante en autos.-

II.La Procuradora adjunta Licenciada Lydiana Rodríguez Paniagua, apela la sentencia de las catorce horas treinta minutos del veinte de agosto del dosmil catorce, argumentando el inmueble que se pretende inscribir son terrenos forestales y bosques de las reservas nacionales por lo que están afectos a dominio público, y son patrimonio natural del Estado desde la Ley Forestal 4465 de 1969, artículo 33 reformada por la Ley Forestal 7174 de 1990, y el carácter demanial se mantiene en la Ley 7575 en los artículos 13 y 14.- Considera las declaraciones de los testigos no demuestran la posesión decenal apta para usucapir.- (ver folios 156 a 162).-

III.No se comparten los agravios expuestos por la apelante por las siguientes razones: Del estudio de suelos elaborado por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria (INTA), se desprende que el inmueble descrito en el plano catastrado número P-1226429-2008 es terreno con bosque secundario y pastos. Si bien es cierto, por mayoría de otra integración de Tribunal se considera el conteo el plazo decenal de posesión de terrenos boscosos los es antes de la afectación de dominio público según Ley Forestal de 1969, ello no es de aplicación a este caso concreto, pues nótese se trata de un inmueble compuesto de bosque secundario y pastos mejorados, lo que implica ese terreno fue regenerado por parte de su poseedor además del reconocimiento judicial se desprende se ha cuidado ese recurso. La Comisión Nacional de Certificación Forestal de Costa Rica define el bosque secundario como "... aquella tierra con vegetación leñosa de carácter sucesional secundaria que se desarrolla una vez que la vegetación original fue eliminada por actividades humanas o fenómenos naturales; con una superficie mínima de 0,5 ha y una densidad no menor a 500 árboles por ha de todas las especies, con dap no menor a 5 cm" (CNCF 1999, Comisión Nacional de Certificación Forestal. 1999.

Partiendo de esta definición y del estudio técnico del INTA visible a folio 1, el bosque original fue convertido en charral, para luego dar lugar a un bosque secundario el cual como se dijo ha sido cuidado por su poseedor, declarar ese tipo de bosque secundario como bien demanial sería no incentivar ese tipo de actividad regeneradora de bosques, pues los poseedores preferirían mantener sus terrenos de naturaleza de potreros para tenerlos bajo su patrimonio y no correr el riesgo sean declarados estatales. La actividad silvícola y la regeneradora de bosques secundarios son actividades necesarias para la captación de carbono en la atmósfera y por ende medidas ambientales contra el calentamiento global, actividades beneficiosas para el medio ambiente por lo que sería incoherente castigar a los poseedores que tienen ese tipo de actividad regeneradora de bosques denegándoles la obtención de su título de propiedad.

Dicho inmueble tampoco está dentro de alguna zona protectora, por el contrario está ubicado fuera de áreas silvestres protegidas según documento de folio 1. Con base en lo anterior, las declaraciones testimoniales practicadas en autos, en las que se hace referencia a una posesión decenal, es tiempo apto para usucapir, pues se cumple con el requisito del ejercicio de una posesión decenal en forma pública, pacífica, continua, y de buena fe, sin que sea necesario referirnos a la posesión decenal anterior a la Ley Forestal, pues el terreno fue convertido a bosque secundario, actividad ejercida por los poseedores que sería un contrasentido castigar no teniendo esa actividad como válida para usucapir.-

IV. Por lo expuesto deberá confirmarse el fallo recurrido en lo que ha sido objeto de apelación.-

POR TANTO:
