I.The Court adopts the proven facts, finding them supported by the record, subject to the following modifications. The following is added to the first: The award of damages was unliquidated. The complaint against [Nombre2] was denied in all respects. On appeal, judgment 752 of 21 de junio de 2012 affirmed the ruling, as did decision 1207 of 18 de setiembre de 2013 of the Sala Primera (folios 1347 to 1354). As to the second: The judgment creditor’s land is located in Puntarenas, [Dirección1], , measures doscientos catorce mil ochocientos sesenta y siete metros cuadrados and is bounded as follows: north, west, and south: public road; east: [Nombre3]. The following facts of the same nature are added: *
IV.Numeral 592 of the Código de Trabajo, applicable by express reference under article 60 of the Ley de Jurisdicción Agraria, requires that, when considering an appeal, this Tribunal first review the case file to determine whether there is any procedural defect (vicio procesal) affecting the proceeding or the challenged decision that must be remedied, where legally appropriate. Likewise, article 26 of the Ley de Jurisdicción Agraria provides, in relevant part: “Where appropriate, the courts may, on their own initiative, declare proceedings void and order procedural steps to be repeated in order to correct irregularities that could affect the validity of the proceeding.” Therefore, if any formality capable of causing an actual denial of the right to a defense (indefensión) is found to have been omitted, an attempt must be made to remedy the defect, and only in cases that truly warrant it may the proceedings or decisions be annulled to the extent necessary to restore the normal course of the litigation.
Under these provisions, this Tribunal has maintained that a declaration of procedural nullity (nulidad procesal) is proper only when it is absolutely essential in order to prevent a denial of the right to a defense or to restore the normal course of the proceeding due to a violation of essential procedural requirements (articles 194 a 198 of the Código Procesal Civil, applied on a supplementary basis).* The asserted grounds for nullity are unfounded because the appealed judgment neither lacks * reasoning nor is it inconsistent. They are, in fact, arguments on the merits concerning the manner in which the evidence was assessed and the substantive rules governing liability for damage were interpreted when environmental assets or resources are affected. If well founded, such arguments would warrant reversal, not annulment. They will therefore be considered as arguments on the merits and not as grounds for nullity.*
V.To decide the appeal from the enforcement judgment, it is necessary to be clear about what was disputed and decided in the proceeding now being enforced. In the complaint in the principal action, the plaintiff requested* a declaration that it owned property Puntarenas 23327-000, restitution of the disputed strip that it claimed was unlawfully occupied by defendants [Nombre2] and Corporación de Balsa, and an award of damages against them. It clarified that its property measured 214867 square meters, but that the disputed strip was an area of one manzana, or seven thousand square meters, located toward its center, across from the northern side of [Dirección2], and bordered to the east and north by a small stream that it called Quebrada Grande. It alleged, and proved, that this area of its property was erroneously included in survey plan (plano) P-966513-2001, corresponding to property P-77262-000 owned by the corporate defendant in the principal action.
The damages claimed against both defendants were itemized in allegation 21 of the principal complaint and in its prayers for relief (petitorias). According to the ordinary complaint, they were based on the clearing of forest and the disruption of the property’s conservation-oriented agrarian use through a polluting industry producing solid waste and noise, which it considered directly affected the understory (sotobosque) and Quebrada Grande; it added that this “cuts up and physically and financially diminishes the property...,” making it unattractive to investors and hindering continuation of its agrarian ecoculture. In the specific itemization of damages in the principal complaint, it stated that defendant [Nombre2] was personally liable and that the company was also liable because of the causal connection to the damage to the environment in general and to the property in particular. As material damage (daño material), it claimed the occupation of approximately 7000 square meters in the most valuable part of the property, which physically diminishes it and ruins (sic) survey plan P-746975-2001 because it overlaps with another, erroneous plan, P-966513-20001.
It asserted that, as a result, it could not use that area or the property as a whole because the former provided access to the remainder and also because the sawmill polluted Quebrada Grande and Río Térraba, into which it flows; the understory was damaged and the agrarian ecoculture was disturbed (sic), all of which harmed its assets. It assessed those damages at ¢20000000,00 (twenty million colones). It also sought non-pecuniary damages (daño moral), but that claim was denied in the final judgment in the principal action. It sought the same amount for consequential losses (perjuicios), on the basis that the physical and registry-related impairment of the property made it unattractive to investors and that it could not be sold or otherwise conveyed because it “had an intruder embedded right in the very center of the property.” In addition, it asserted that this prevented it from developing ecotourism and agro-environmental projects and that it could not adequately access the land (folios 53 a 57). *
VI.The final judgment in the main ordinary proceeding found that the disputed area, measuring 7041 square meters, formed part of the judgment creditor’s property and that it was erroneously depicted within survey plan P-966513-2001, recorded in the registry entry for the property of the judgment debtor company CED6, which was actually located elsewhere and did not include the disputed area. According to the proven facts (see proven fact g), at the time the main ordinary proceeding was filed, that area was occupied by [Nombre2] for sawmilling operations. At first instance, a finding subsequently corrected in the appellate judgment, it was held that the nature of that gentleman’s relationship with the company joined as a co-defendant in the main proceeding had not been established. In this regard, the first-instance judge explained: “...the problem that has arisen here is that the plan describing the defendant’s property, number CED7, has been erroneously located within property registration CED8, to which the plaintiff holds title and of which it is the owner.” In recital V (considerando V) of the first-instance judgment, the court ruled on damages (daños y perjuicios): “...the defendant company has indeed caused those damages to the plaintiff because the latter has been unable to enjoy the real property in its entirety and with the attributes inherent in the right of ownership, even though the defendant, according to its assertions, did not intend to cause damage... construction and earthworks (movimientos de tierra) have been carried out that the plaintiff probably would not have undertaken had it used the land and acquired it in its entirety and under different conditions..., in addition to the activity conducted by the plaintiff (sic) at the site, since it has an operating sawmill with the respective permits and licenses.” It dismissed the claim against [Nombre2] for lack of standing as a defendant (legitimación pasiva) and rejected the claim for damages against him because “it has likewise not been established that he engaged in such conduct with the authorization of the plaintiff (sic) or on its behalf.” It granted the claim against the judgment debtor company, ordering restitution of the disputed area and, with respect to damages, entered an unliquidated award (condena en abstracto), because the court of first instance (A quo) found that they had not been quantified, leaving their calculation and proof for the enforcement-of-judgment proceeding (ejecución de sentencia).
It rejected the claim for non-pecuniary damages (daño moral) (folios 1143 to 1166). It is also important to emphasize that, although this was not stated as a proven fact, the main first-instance judgment clarifies that the judgment debtor company had occupied the disputed area for several years before the plaintiff acquired its property, since August 1993 (folios 475 and Considerando III of the main appellate judgment). Consequently, when the judgment creditor acquired the land in May 2001, that area was already occupied by the judgment debtor company, and the judgment creditor was aware of that circumstance. Judgment 752 of the Tribunal Agrario, dated 21 junio 2012, affirmed the ruling but clarified, in recital V, that [Nombre2]’s relationship with Corporación and with the disputed land had indeed been established, because the record showed that he had been the tenant for several years before the main ordinary action was filed.*
In view of the matters appealed, it is important to emphasize the following points. In enforcement-of-judgment proceedings, regardless of their form, only that which was granted in the final judgment in the main proceeding or stipulated in a judgment approving an agreement (sentencia homologatoria) may be approved or ordered (Articles 162, 220, 314, 629, and 630 of Código Procesal Civil 7130, applicable on a supplementary basis because it was the law in force when the enforcement proceeding commenced).* Pursuant to the cited Article 162: “Final judgments rendered in ordinary or summary proceedings,* have the authority and effect of substantive res judicata (cosa juzgada material). Those rulings to which the law expressly grants* that effect shall also have such authority and effect.* The effects of substantive res judicata are limited to the operative portion* of the judgment and do not extend to its grounds, thereby making the existence or nonexistence of the legal relationship declared therein* indisputable in another proceeding....” Accordingly, the enforcing court may only comply with what was ordered in the operative portion of the judgment being enforced.
Furthermore, Article 158 of that same body of law provides: “Judges and courts may not vary or modify their* judgments, but they may clarify any ambiguous concept or cure any* omission concerning an issue contested in the litigation. Clarification or* supplementation of a judgment is permissible only with respect to its operative portion....” Under the principles of due process (debido proceso) and legality (legalidad), enforcement courts may not enforce matters or forms of relief not granted by a final judgment in the main proceeding. If a prevailing party requests relief that cannot be enforced in the enforcement proceeding, it must be summarily rejected at the outset to avoid unnecessary and improper proceedings that are also legally inadmissible and improper because the enforcement court lacks jurisdiction to conduct them. If it was not rejected by an interlocutory ruling, the inadmissible claim must be rejected in the judgment.
In this matter, several forms of relief requested in the enforcement petition are neither enforceable by final judgment nor otherwise enforceable because they were not granted as final awards in the main judgment being enforced; they should therefore have been summarily rejected. Specifically: a) the claim for fruits not received, which the party asserts consist of income not received from the “illegal” timber exploitation allegedly conducted by the judgment debtor. The final judgment in the main proceeding contains no award for fruits not received, nor was such relief requested in the main ordinary complaint. In this regard, damages must not be confused with a claim for fruits not received (Articles 287, 288, 321, 325, 327, and 329 of Código Civil, applied on a supplementary basis); b) the rent not received from the “illegal” timber-exploitation activity likewise constitutes a fruit; c) the collection of interest on the amounts claimed as damages.
Those three items therefore cannot be considered for purposes of this enforcement proceeding because they were not granted in the final award being enforced. In light of the foregoing, the third ground of appeal must be rejected because it claims that the rent received by the judgment debtor should have been awarded as civil fruits. Contrary to the appellant’s assertion, and in view of the terms of the final award, the rejection of that item in the appealed judgment does not violate Article 329 of Código Civil, for the reasons already explained by this Court. Compensation for fruits was not an issue litigated in the main proceeding, and therefore no award was entered in that regard. It is consequently unnecessary to analyze its objections concerning the manner in which the expert evidence (prueba pericial) of the mathematical actuary was assessed in relation to that issue.*
IX.With respect to the award of damages in the abstract (related to the enforcement claim under point “a” of Considerando VII, the only matter relevant to the appeal), the following must be emphasized. That form of award should be used only exceptionally, because it is permitted and appropriate* only in specific circumstances. For example: a) when the legal system provides for it by operation of law. In that case, only a general award is made in the principal proceeding, and the court hearing it may neither analyze nor determine the specific items that may be granted. The specification and proof of the items claimed, as well as their quantification and scope, are therefore left to the enforcement proceeding. This occurs in certain summary proceedings, such as possessory injunction proceedings (interdictos) (Article 460 of the Code of Civil Procedure, applied supplementarily and in force when this proceeding commenced); the amparo proceeding and habeas corpus (Articles* 26 and 51 of the Constitutional Jurisdiction Law); and civil actions for compensation granted in criminal proceedings (Article 432 of the Code of Criminal Procedure). b)* A second situation in which that type of award (in the abstract) is possible is more limited.
It arises when damages are claimed as the principal relief or as ancillary relief, but there is no evidence of their amount. In that case, an award is made in the abstract so that its amount or valuation may be determined in the judgment-enforcement proceeding. In this situation, the courts must indicate the specific items they grant, when those items have been duly proven and compensation for them has been justified. If possible, the amount awarded for each item must be determined at once. However, if this cannot be done for lack of evidence, the debate concerning* the determination of the amount or quantum of the damages—which have already been duly established, but not their occurrence or existence—must be left to the enforcement proceeding (whether conducted within the same case file as the principal proceeding or separately) (Articles 156 and 155(d) of the applicable Code of Civil Procedure, as indicated above).
On the matter under consideration, the First Chamber of the Supreme Court of Justice has stated: “The possibility of making an award in the abstract does not exempt the plaintiff from the duty to specify the nature of the damages claimed and to estimate them. This is because an award in the abstract applies only where insufficient information exists to determine the amount, quantum, or extent of the damages…” (Judgment 12 of January 31, 1996. See, to the same effect, Voto 734 of October 6, 2005). Therefore, as a matter of proper legal practice, the determination of whether damages claimed in principal proceedings—particularly ordinary proceedings—have occurred should not be left to the enforcement proceeding. In other words, in the principal proceeding, the adjudicator should determine whether the claimed damages are warranted and whether they exist, and then determine what is granted in that regard.
Nevertheless, courts sometimes mistakenly leave both the determination of their existence and their quantum to the enforcement proceeding, even though the parties have in fact quantified the damages in the principal proceeding. That practice is inappropriate because it undermines procedural expeditiousness and is inconsistent with the provisions cited above (see decisions 25 of January 16, 1997, and 237 of March 31, 1998, of the Higher Criminal Court of Cassation of the Second Judicial Circuit of San José). Nevertheless, when such a situation occurs—as in this specific case—the rights of both parties may not be infringed. Accordingly, although it is not legally correct, it has been accepted that, in the corresponding enforcement proceeding, the damages claimed may be specified and the prevailing party may proceed to prove their existence, legal relevance, and quantum or amount (Article 693 ibid.).
However, any claim formulated in the enforcement proceeding must adhere to what was pleaded and debated in the principal proceeding; that is, the enforcing party may not alter what it claimed as damages in the principal complaint. In other words, when the award in the abstract does not specify the particular items granted, because there is no specific final and therefore enforceable ruling, this does not exempt the beneficiary from the duty to prove them in the appropriate proceeding. Moreover, that award in the abstract does not, by itself, confer a right to receive compensation for specific damages, because it does not establish a specific and express obligation in that regard. Consequently, to enforce it, the enforcing party must prove in the enforcement proceeding the existence, scope, causal nexus (nexo causal), and quantum* of each item claimed. Merely alleging or asserting them is insufficient.
They must be established beyond question. “It is clear that, in proceedings in which damages caused by one person to another are sought, it is absolutely necessary to prove that they were in fact caused, since the existence of the damage or loss must be established, as must the defendant’s responsibility for it—that is, the causal nexus. The burden of proof (carga de la prueba) rests with the party bringing the action, as specifically established in the first subsection of Article 317 of the Code of Civil Procedure. This means that merely alleging them is insufficient; rather, they must be proven by suitable and reliable evidence before they may be awarded…” (First Chamber, Voto 774 of November 20, 2003).*
X.The First Chamber has also repeatedly addressed the distinction between monetary obligations (obligaciones de dinero) and value obligations (obligaciones de valor). “Under monetary obligations, a ‘quantum’ is owed (a fixed or invariable amount expressed in monetary units), whereas under value obligations a ‘quid’ is owed (an unalterable asset or benefit)...; the object of a value obligation is not a sum of money, but rather an abstract value corresponding to the creditor’s financial expectation or claim, and therefore the quantification of the claim is extrinsic to the obligational relationship. This does not preclude its being quantified and liquidated in cash” (Voto 292 of May 12, 2005). Thus, in the case of value obligations or debts, if the principal judgment did not convert them into monetary obligations or establish clear parameters for their calculation and determination, the prevailing party bears the burden of proving those items in the judgment-enforcement proceeding.
That is, the party must prove the value, price, or amount to be compensated and, on occasion, even the existence of what was awarded in the abstract (Articles 9, 317, 629, and 694 ibid.). To that end, the party must not only specify the claims granted generically (in this case, specific damages based on those claimed in the principal ordinary complaint, without being permitted to modify the relief sought therein in that regard), but must also describe, in physical and temporal terms, the characteristics and elements of the item awarded so as to permit its fair and lawful valuation, and must further submit suitable evidence supporting its assertions in that regard, if such evidence does not appear in the principal proceeding (see Voto 472 of this Court of July 18, 2001, on this issue). In such cases, the burden-of-proof rule applies, under which each party bears the burden of proving the facts forming the basis of the right or situation it seeks to have declared or recognized in its favor, regardless of its procedural position; if it fails to do so, it must bear* the risk arising from the lack of evidence, which results in a decision adverse to its interests (Article 317 ibid.).*
*XI.-* In this case, having clarified the matters not subject to enforcement (points “c, d and e” of Considerando VII), it must be determined, in light of the appeal, whether the allegations in the enforcement action concerning environmental damage (point a) correspond to the relief sought in the original complaint, as explained in the preceding considerando. The decision regarding the other matter (point “b,” relating to the claim for material damage arising from the increase in the land’s value) was not challenged in the appeal under review; accordingly, no analysis thereof may be conducted (Article 590 of the Labor Code). The matter relevant to the appeal, according to the enforcement action, concerns “the environmental damage sustained on the recovered land, specifically the impact caused to the forest, property, and water sources through its exploitation by cutting trees, clearing land, and constructing buildings, from the time the appellant acquired it until such activities ceased.” As of the filing of the enforcement action (November 2014), that damage was valued at ¢75000000.00 (seventy-five million colones)* (folio 1475).
In the principal ordinary action, when addressing this issue, the enforcing party had claimed damages for the harm caused to the environment through “the clearing of forest, the distortion of the property’s agricultural conservation purpose by a polluting solid-waste industry and noise, which it considered directly affected the understory and Quebrada Grande, and which ‘cuts through and physically and economically diminishes the property...,’ making it unattractive to investors and unsuitable for continuing its agricultural ecoculture.” In the specific itemization of damages in the principal complaint, it stated that the defendant [Nombre2] was personally liable and that the company was also liable based on the causal relationship to the damage caused to the environment in general and to the property in particular.” As of the filing of the complaint (June 2006), it estimated those damages at ¢20000000,00 (twenty million colones) (folios 57 to 58).* The relief sought on that issue in the enforcement action therefore corresponds to the allegations made in the ordinary action.
Since the ground for appeal concerns collective environmental damage (daño ambiental colectivo), it is important to briefly emphasize the following.* Environmental damage (daño ambiental) is the* “result of the intentional or unintentional alteration or destruction, arising from the negative impacts of any human activity or natural cause, that affects, disrupts, or destroys ecosystem components, reversibly or irreversibly altering their function and structure”* (art. 3-c of the Regulations to the Biodiversity Law). Environmental damage therefore exists when an action or activity causes an adverse alteration to the environment or any of its components. It may be biophysical or social. The former affects the surroundings and the inherent characteristics of the natural resource or environmental asset. The latter entails the loss of the benefits derived from them—that is, the goods and services they provide.* Although environmental damage may, in order to be compensated, manifest itself in or satisfy traditional parameters, it has also required special evolution, harmonization, or adaptation to cover circumstances not previously contemplated or for which, in certain cases, the classical conception of damage and legal liability—based primarily on the concepts of certain, present, and personal damage—is insufficient.* Environmental civil liability (responsabilidad civil ambiental) is intended to require anyone who causes environmental damage to carry out or pay for its full remediation (reparación integral).
Furthermore, it is important to bear in mind that any environmental liability regime must respect the characteristics and principles of Environmental Law, particularly the principles of prevention, precaution, and prior internalization of costs, the latter known as the polluter-pays principle. As with ordinary damage, environmental conflicts of interest may arise from a contractual relationship or may be noncontractual in nature; although the latter predominates, and in such cases the standard of attribution is usually objective (strict liability based on risk (responsabilidad por riesgo)). Legal scholarship also recognizes—in a proposition developed in Judgment 675-2007 of the First Chamber, cited in the appealed decision—that, as explained at the outset, environment-related damage may be of two types: a) damage to the environment (collective or pure damage (daños colectivos o puros)). For example, when a river is polluted, harm is caused to the river as an environmental asset and component of the environment. b) damage through the environment (individually sustained damage (daños individualmente soportados)), which may be economic or nonpecuniary and affects private property.* “Environmental damage affects society in general and not merely persons considered individually....
Relatedly, the concept of collectively sustained damage arises, understood as damage occurring when an interest of that nature is injured; such an interest is autonomous and may or may not coexist with individual interests, thereby revealing a collective reality. Nevertheless, conduct may sometimes cause not only injury to the environment as such but also direct harm to private individuals. In such cases, for purposes of remediation, it is necessary to distinguish environmental elements that benefit society as a whole from injuries to individuals. In the latter case, relief may be provided through compensation, taking into account both personal damage and loss. In the former case, by contrast, a diffuse interest (interés difuso) is involved—that is, one that is extended, dispersed, or widespread; it propagates or is diffused among the members of the group, whether or not that group is organized and cohesive.
This is supra-individual damage (daño supraindividual) that does not consist of the sum of specific injuries. Nor does it consist of harm to assets owned individually and privately, but rather of an actual and specific injury existing only from the perspective of the entire society that sustains it. Damage to the collective simultaneously and coincidentally affects the group. It is one and the same injury, which is now readily accepted as a concept having its own independent existence and affecting all members of the community equally, or certain groups indiscriminately and nonexclusively. The affected parties are no longer isolated persons, but categories or classes of subjects linked by some quality or characteristic that connects the group. In this context, if an obligation arises to compensate this type of harm, it does not comprise a sum of identifiable portions; rather, it is a general injury that can be perceived and experienced, in which the affected element is communal or collective and reaches individual subjects indivisibly through their inclusion in the group.
In view of the foregoing, a distinction must be drawn between damage to the environment and damage through the environment. The latter is based on traditional economic liability: personal and economic damage. The former, by contrast, refers to environmental damage per se. In conclusion, two categories may be identified: 1) Ecological or environmental damage in the strict sense. It affects flora and fauna, the landscape, air, water, and soil—in other words, the environment. It is the damage sustained by the ecosystem, inhibiting its natural functions. It does not attach to any individually owned asset. It is the harm or detriment sustained by elements of nature or the environment without affecting a person or legally protected property. It is damage to the environment, whether through its alteration or partial or total destruction, indirectly affecting the quality of life of the planet’s various living beings. 2) Environmental damage affecting particular persons.
This is damage that affects persons or individual property as a result of an environmental impact. This category is comparable to the traditional forms of damage already recognized by the Legal System. Although it receives judicial consideration as environmental damage, the rules for attributing liability and establishing compensation do not differ substantially from the classical rules of law. In such cases, the damage is to persons or property due to an alteration of the environment caused by human conduct. It is not direct damage to the environment, but damage to persons or property resulting from an alteration of the former” (emphasis added).*
XII.With regard to these two types of harm, a distinction must be drawn between standing (legitimación procesal) to claim them and the right to reparation. Standing concerns the grounds or interest required to bring a lawsuit or complaint; it is not the same as ownership of the substantive right asserted or disputed. Accordingly, the plaintiff or claimant may have standing to bring the action, but if the plaintiff fails to prove the facts underlying the claim, the action will be dismissed as unfounded. Likewise, this distinction makes it possible to understand that, although a person may be entitled to bring a claim for damages, the compensation sought may not necessarily be awarded to that person, as occurs in some cases of collective environmental harm (daño ambiental colectivo). In general terms, the right or principle of effective judicial protection (tutela judicial efectiva) is recognized in the American Convention on Human Rights (Pact of San José) (Articles 8.1 and 25) and in the Rio Declaration on Environment and Development (Principles 10 and 13).
In any event, it must be borne in mind that standing (which permits an action to be brought) must not be confused with the substantive right (derecho de fondo) sought, which must actually exist in order to obtain a favorable decision, and that harm caused to the community does not automatically imply the existence of personal harm or standing to claim it (Sala Primera, vote 834-2015). Who, then, has standing to seek reparation for environmental harm, and who is entitled to repair it or receive what is necessary to do so? With respect to collective environmental harm, Article 50 of the Costa Rican Constitution provides as follows regarding standing to seek relief: “Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek reparation for the harm caused. The State shall guarantee, defend, and preserve that right.” Likewise, Article 46 of that body of law provides that consumers and users have the right to protection of their health and environment.
As follows from those higher-ranking provisions, standing to seek the prevention, cessation, and reparation of environmental harm may not be restricted in our country. “…With regard to the Right to the Environment, standing belongs to every human being as such, because an infringement of that fundamental right is suffered both by the community and by the individual” (Sala Constitucional, vote [Telf2]). The same is provided in Articles 2 and 98 of the Ley Orgánica del Ambiente and Article 105 of the Ley de Biodiversidad. However, to reiterate, broad or open active standing (legitimación activa) to bring proceedings or file suit in defense of the environment (collective harm) does not mean that the substantive relief claimed may be granted merely because the proceedings were brought (for example, compensation for the harm caused). In Costa Rica, every person may seek reparation for environmental harm as such (pure or collective environmental harm), but with respect to harm concurrently suffered in the personal sphere, only those who have active standing under the specific procedural avenue used to bring the claim may do so; this depends on the type of action and the relief sought.
“Separate personal or multiple claims are not possible when the injured party is the community, because such interests are characterized by their indivisibility: the collective good cannot be divided among those who use it, nor can its enjoyment be divided. Consequently, different subjective rights cannot exist, because there is no direct link between an individual and that type of right. It either belongs to the group or to no one, because if someone appropriates it individually, it ceases to be jointly shared and becomes individual. This does not preclude, as stated, the possible coexistence of particular or multiple individual harms, because one characteristic of Environmental Law is that harm is always caused to the community, but sometimes has repercussions on individual property. Indeed, a person may bring an action in that person’s own name to seek personal compensation (particular environmental harm), as well as bring an action on behalf of a community to seek compensation that the person may not appropriate but may enjoy (environmental harm to the community), which is what truly constitutes reparation for environmental harm in its pure form” (Sala Primera, vote 675-2007).
In other words, the ability to bring a claim does not entail the right to receive the amount of any compensation awarded, unless an individual claim for compensation is also brought for individual and private harm arising from the environmental harm. Thus, notwithstanding the broad standing to claim environmental harm, compensation for collective harm cannot be awarded to the specific private or public persons who brought the claim. The party entitled to receive it is the State (represented by the PGR) or those expressly designated by law. Compensation for indirect impairment of private property or interests (individually sustained harm) may be claimed only by the person who suffered it and who, under the ordinary rules of liability, is entitled to compensation.*
XIII.-* It is evident that the harm claimed in this enforcement action (demanda de ejecución) is collective environmental harm, because compensation was sought for the environmental harm caused to the forest, the property, and the water sources by the tree-felling operations (which were not proven) and the activities conducted by the lumber sawmill installed in the disputed area. If warranted, and irrespective of the best means of restoring the environment with respect to the affected ecosystems, the enforcing party would have active standing to bring the claim, but could not seek compensation in a personal capacity for that impairment, as explained in the preceding recital (considerando). If that means of restoration were ordered, any award of compensation would be made in favor of the State because, as this is collective environmental harm, the State alone is entitled to receive it on behalf of society.
In this case, however, that claim is unfounded, and the judgment under appeal must therefore be affirmed in that respect. This is because, although the appellant has active standing to bring the claim, it is not directed against the person responsible for the underlying acts and facts. In other words, based on the facts found proven both in the principal ordinary proceeding and in this enforcement proceeding, there is no causal nexus (nexo causal) between the judgment debtor company and the acts and facts cited by the enforcing party in its complaint as the basis for the collective environmental harm. The person who conducted the lumber-sawing activity was [Nombre2] , in the capacity of lessee of the disputed area, beginning before the enforcing party filed its ordinary action. That person even remained there until possession was delivered in 2014. The fact that the judgment debtor was the party that leased the area to that person, within the context of the confusion that existed before 2006 (when it believed itself to be the owner of that area), makes it neither directly liable for any effects that the sawmill’s activities may have caused to the environment nor jointly and severally liable (responsabilidad solidaria), as the appellant sought to argue in the ordinary action.
This is because, as explained in the proven facts added by this Tribunal to the enforcement judgment, the only person individually responsible for and operating the sawmill was Mr. [Nombre5]. It was even proven that he held permits and authorizations to do so before the ordinary action was filed, although that would not have exempted him from liability had environmental liability been proven. After the principal action was filed, the continuation of that work was authorized through a precautionary measure (medida cautelar), as recorded in first-instance ruling 66 of 7 September 2007 and vote 358 of 30 May 2008 of this Tribunal (folios 155 and 299). However, the principal action was dismissed with respect to [Nombre2] , an issue that is decisive in rejecting the grounds of appeal concerning the collective environmental harm claimed. Consequently, no award of damages exists against that person, a situation accepted by the plaintiff when it did not appeal the ruling on that matter, as recorded in vote 752 of 21 June 2012 of this Tribunal.
With respect to the Balsa company, the existence of an award against it with the amount left undetermined (condena en abstracto) does not mean that it is actually obligated to compensate for the harm claimed, because that harm is not attributable to it; that is, it is not responsible for its origin. It therefore lacked passive standing (legitimación pasiva) in that respect because there was no causal nexus between the facts attributable to the company and the harm caused. In this regard,* “…in proceedings seeking damages that one person allegedly caused another, it is absolutely necessary to establish that such damages were in fact caused, because the existence of the damage or loss must be proven, as must the fact that the defendant is responsible for it; that is, the causal nexus* (vote 774 of 20 November 2003 of the Sala Primera). Although the attribution criteria change and the burdens of proof are relaxed in matters involving liability for environmental harm, the party claiming the harm is always required to prove the existence and severity of the harm, as well as the basic elements establishing the causal nexus between the acts alleged against the opposing party and the impairment suffered. If the latter is absent, even if the existence of the harm is proven, the claim must be dismissed because it was brought against the wrong person, as occurred in this case.*
XIV.Accordingly, the first and second grounds of appeal are without merit, for the reasons explained by this Court. Nor did the court below err in relying, as a basis for explaining the differences between collective environmental damage and individual environmental damage, on the reasoning set forth in judgment 675 of 21 de setiembre de 2009 of the Sala Primera, which was applicable to the case regardless of the fact that it was issued in an administrative litigation proceeding, since the environmental variable is cross-cutting; its rules and principles apply and must be respected in all fields, including—and all the more so—the agrarian field, given the relationship between it and environmental resources and assets, and the importance of ecosystem balance for sustainable development in the agrarian or rural sphere. What should be noted regarding the citation of that judgment is that the court below did not adequately explain the difference between standing to bring an action (legitimación para accionar) and the right to be compensated for collective damage, even though it reproduced its contents at great length in the third recital (considerando tercero) of the judgment under appeal, which was unnecessary and is not an appropriate legal technique.
However, as explained, the objections concerning the environmental damage claimed must be rejected, not because it is collective damage, but because its cause is not attributable to the judgment-debtor company, since the underlying acts were committed by a third party against whom there is no judgment requiring compensation. In that regard, the appellant’s contention that what she sought was compensation for individual damage personally suffered in her assets is also rejected, because that was not what was requested either in the ordinary action or in the enforcement action, in relation to the harm to the environment. Finally, her contention that the expert evidence obtained in the enforcement proceeding was incorrectly assessed is immaterial, because even if that had been the case—which need not be examined—the challenged outcome would not change, since the damage claimed is not attributable to the judgment-debtor company.*
XV.In accordance with the foregoing, the appealed enforcement judgment must be affirmed with respect to the matters challenged on appeal.* *

Se refiere al daño que ha ocasionado la demandada al bosque, fundo y* fuentes hídricas con la explotación de éste mediante la corta de árboles,* limpieza de terrenos y construcciones; b) Daño Material: cincuenta millones* de colones por el valor de mercado que ha perdido el terreno* por la explotación ilegal a manos de la demandada; c) Perjuicios: Setenta y cinco millones de colones por los montos dejados de percibir por los frutos de los cuales ilegalmente* se ha apropiado y ciento uno millones de colones por los montos* de alquiler del terreno que hubiera percibido la ejecutante en caso de* haberlo dado en arrendamiento desde el momento en que se adquirió el* terreno hasta la fecha; e) Costas procesales: tres* millones ciento noventa y nueve mil doscientos sesenta colones; f) Costas* Personales: cuarenta y tres millones doscientos* cincuenta mil colones (folios 1474 a 1480).-* * 2.- La sociedad ejecutada se opuso y alega que el inmueble no ha sufrido daños sino más bien mejoras* (folios 1672 a 1674).- * * 3.-* El juez* Juan Gutiérrez Villalobos, del Juzgado* Agrario del Segundo Circuito Judicial de la Zona Sur, en sentencia de ejecución 86 de 4 de mayo de 2018,* resolvió: “POR TANTO:* De conformidad con lo expuesto, artículos 2 inciso h), 155, 693 y* siguientes del Código Procesal Civil, se rechazan los montos reclamados* por daños y perjuicios de la presente ejecución y se rebajan y aprueban las* costas procesales en la suma de CIENTO NOVENTA Y NUEVE MIL* DOSCIENTOS SESENTA COLONES y las costas personales en la suma* de OCHO MILLONES DOSCIENTOS CINCUENTA MIL COLONES que* deberá cancelar la parte ejecutada a la parte actora ejecutante.

Por motivo* de la inserción de la oralidad en materia agraria, si es el deseo de la parte* que el Tribunal de alzada les confiera una audiencia oral, lo hagan saber* en el mismo escrito de apelación, o en su defecto señalar un correo* electrónico en donde se les pueda notificar" (carpeta de documentos asociados: archivo 4/5/18 14:10:11 p.m.).-* * 4.-* La sociedad ejecutante apela con indicación expresa de las razones en que se apoya para refutar la tesis del Juzgado (carpeta de bandeja de escritos: archivo 16/5/18 3:21:32 p.m.).-* * 5.-* En la substanciación del proceso se han respetado las disposiciones legales y no existen errores u omisiones capaces de producir nulidad procesal.* * Redacta la jueza ALPÍZAR RODRÍGUEZ, y; * CONSIDERANDO: *
I.El Tribunal comparte los hechos probados, por encontrar sustento en los autos, con las siguientes modificaciones. Al primero se adiciona: La condena en daños y perjuicios fue en abstracto. La demanda contra [Nombre2] se declaró sin lugar en todos sus extremos. En segunda instancia, en sentencia 752 de 21 de junio de 2012 se confirmó lo resuelto y de igual forma en voto 1207 de 18 de setiembre de 2013 de la Sala Primera (folios 1347 a 1354). Al segundo: El terreno de la ejecutante se ubica en Puntarenas, [Dirección1] , , mide doscientos catorce mil ochocientos sesenta y siete metros cuadrados y colinda: norte, oeste y sur: calle pública, este: [Nombre3] . De igual naturaleza se agregan: *
IV.El numeral 592 del Código de Trabajo, aplicable por remisión expresa del artículo 60 de la Ley de Jurisdicción Agraria, impone que al analizar una apelación, este Tribunal debe primero revisar el expediente, para determinar si existe algún vicio procesal que afecte el proceso o la resolución impugnada y deba ser subsanado, si es pertinente legalmente. Asimismo, el artículo 26 de la Ley de Jurisdicción Agraria, en lo que interesa dispone: "Cuando sea del caso, los tribunales podrán, por iniciativa propia, declarar nulidades y disponer la reposición de trámites, a fin de corregir irregularidades que pudieran afectar la validez del proceso". Por ende, si se encontrase que se ha omitido alguna formalidad, capaz de causar efectiva indefensión, debe intentarse subsanar el defecto y solo en casos que de verdad lo ameriten, decretar la nulidad de las actuaciones o resoluciones, hasta donde sea necesario para orientar el curso normal del juicio.
Al amparo de dichas regulaciones, esta Sede ha mantenido el criterio de que la declaratoria de nulidad procesal procede cuando sea absolutamente indispensable su pronunciamiento, para evitar indefensión o para orientar el curso normal del procedimiento, por violación a formas esenciales en el trámite (artículos 194 a 198 del Código Procesal Civil, aplicados supletoriamente).* Los motivos de nulidad invocados no son de recibo, dado que la sentencia apelada no adolece de falta de * fundamentación ni es incongruente. En realidad se trata de agravios de fondo, relacionados con la forma como se valoró la prueba y cómo se interpretaron las normas sustantivas de responsabilidad por daño, cuando se afectan bienes o recursos ambientales. Tales alegatos, de ser procedentes implicarían revocatoria, no nulidad. Se analizarán entonces como agravios de fondo y no como motivos de nulidad.*
V.Para resolver la apelación de la sentencia de ejecución, debe tenerse claro que fue lo debatido y resuelto en el proceso que se ejecuta. En la demanda del principal, la parte actora pedía* se declarase era dueña de la finca de Puntarenas 23327-000, la restitución de la franja en litigio que reclamaba ocupaban ilegalmente los demandados [Nombre2] y Corporación de Balsa y se les condenase a daños y perjuicios. Aclaró que su finca medía 214867 metros cuadrados pero la franja en litigio era un sector de una manzana o siete mil metros cuadrados, ubicado hacia el centro de tal, frente al costado norte de la [Dirección2] , bordeada por el este y norte por un pequeño riachuelo que denominó Quebrada Grande. Afirmaba, lo cual demostró, que ese sector de su finca fue incluido erróneamente en el plano P-966513-2001, que corresponde a la finca P-77262-000 de la sociedad demandada en el principal. Los daños y perjuicios que reclamaba frente a ambos demandados, los desglosó en el hecho 21 de la demanda principal y en sus petitorias.
Se basaban, según la demanda ordinaria, en la tala de bosque y desconfiguración de la vocación agraria conservacionista de la finca con una industria contaminante de desechos sólidos y ruido, que consideró afectaba directamente el sotobosque y la Quebrada Grande; agregó ello "troncha y desmejora física y patrimonialmente la finca...", haciéndola poco atractiva para inversionistas y para proseguir su ecocultura agraria. En el desglose específico de daños y perjuicios de la demanda principal expresó que el demandado [Nombre2] era responsable en forma personal y la sociedad también por la relación causal de los daños al medio ambiente en general y a la finca en particular. Como daño material reclamó la ocupación de aproximadamente 7000 metros cuadrados en la parte más valiosa de la finca, lo que la desmejora en su materialidad y hecha a perder (sic) el plano P-746975-2001, al estar traslapado por otro equívoco P-966513-20001.
Afirmó, por ello no puede hacer uso de ese sector ni de la finca en general, por ser lo primero el acceso al resto y además porque el aserrío contaminaba la Quebrada Grande y el Río Térraba donde aquella desemboca; se dañaba el sotobosque y se perturbaba la ecocultura agraria (sic), todo lo cual lesionaba su patrimonio. Estimó esos daños en ¢20000000,00 (veinte millones de colones). Pidió también daño moral, pero eso fue denegado en la sentencia firme principal. Por perjuicios pidió igual suma, basada en que al quedar desmejorada material y registralmente la finca, era poco atractiva para inversionistas y no se podría vender ni enajenar por "tener incrustado un intruso en el puro centro del inmueble". Además, afirmó, eso le impedía desarrollar proyectos de ecoturismo y agroambiental y tampoco podía ingresar adecuadamente al terreno (folios 53 a 57). *
VI.La sentencia firme del ordinario principal tuvo por cierto que el sector en litigio, que medía 7041 metros cuadrados, formaba parte de la finca de la ejecutante y que tal se graficaba erróneamente dentro del plano P-966513-2001, reportado en el asiento registral de la finca de la sociedad ejecutada CED6, la cual se ubicaba realmente en otro lugar y no comprendía esa zona en discusión. La misma, según los hechos probados (ver el hecho probado g), estaba ocupada a la fecha de plantearse el proceso ordinario principal por [Nombre2] , en labores de aserrío. En primera instancia, lo cual fue corregido en la sentencia de segunda instancia, se tuvo por no demostrada cuál era la relación de ese señor con la sociedad codemandada en el principal. Explicó al respecto el juez de primera instancia: "...el problema que se ha dado aquí es que el plano que describe la propiedad de la parte demandada el número CED7 ha sido erróneamente ubicado dentro de la propiedad matrícula CED8 cuya titularidad y dueña es la parte actora".
En el considerando V de la sentencia de primera instancia se resolvió sobre daños y perjuicios: "...efectivamente la sociedad demandada si ha sido causante de esos daños a la parte actora en virtud de que esta última no ha podido disfrutar del bien inmueble en su totalidad y con los atributos que el derecho de propiedad le concierne aún y cuando la parte demandada no haya tenido intención de causar daños según su dicho... se han efectuado construcciones y movimientos de tierra que la parte actora de haber utilizado el terreno y haberlo adquirido en su totalidad y en otras condiciones probablemente no las hubiese ejecutado..., además de la actividad que despliega la actora (sic) en el lugar pues tiene un aserradero en funcionamiento y con los permisos y patentes respectivas". Declaró la demanda sin lugar con respecto [Nombre2] por falta de legitimación pasiva y rechazó el reclamo de daños y perjuicios en su contra dado que "tampoco se le ha demostrado que el mismo ejecute tales conductas derivadas por autorización de la parte actora (sic) o a nombre de ésta".
La demanda contra la sociedad ejecutada la acogió, ordenando la restitución del sector en litigio y en cuanto a daños y perjuicios hizo condena en abstracto, dado que el A quo los tuvo por no cuantificados, dejando su liquidación y demostración para la ejecución de sentencia. Rechazó el cobro del daño moral (folios 1143 a 1166). Es importante también resaltar que aunque no se indicó como hecho probado, en la sentencia principal de primera instancia se aclara que la sociedad ejecutada permanecía en el sector en litigio varios años antes de haber adquirido su finca la actora, desde agosto de 1993 (folios 475 y considerando III de la sentencia principal de segunda instancia). Por consiguiente, para cuando la ejecutante adquiere el terreno en mayo de 2001, ya ese sector estaba siendo ocupado por la sociedad ejecutada y era de su conocimiento esa situación. La sentencia del Tribunal Agrario 752 de 21 junio 2012, confirmó lo resuelto, pero aclaró, en su considerando V, que si se había probado la relación de [Nombre2] con Corporación y con el terreno en litigio, dado que constaba que era el arrendatario desde hacía varios años antes de plantearse la demanda ordinaria principal.*
Dado lo apelado, es importante resaltar los siguientes aspectos. En procesos de ejecución de sentencia, sea cuál sea su modalidad, únicamente se puede aprobar u ordenar lo que haya sido concedido en la sentencia principal firme o estipulado en la sentencia homologatoria de un acuerdo (artículos 162, 220, 314, 629, 630 del Código Procesal Civil 7130, aplicable por ser la normativa vigente a la fecha de iniciarse el proceso de ejecución, aplicados supletoriamente).* De conformidad con el artículo 162 citado: "Las sentencias firmes dictadas en procesos ordinarios o abreviados,* producen la autoridad y la eficacia de la cosa juzgada material. También* producirán aquellas resoluciones a las cuales la ley les confiera* expresamente ese efecto.* Los efectos de la cosa juzgada material se limitan a lo resolutivo de* la sentencia y no a sus fundamentos, lo cual hace indiscutible, en otro* proceso, la existencia o la no existencia de la relación jurídica que ella* declara...".
Por ello, el tribunal que ejecuta únicamente puede limitarse a cumplir con lo ordenado en la parte dispositiva de la sentencia ejecutada. Por otro lado, el numeral 158 de ese mismo cuerpo legal establece: "Los jueces y los tribunales no podrán variar ni modificar sus* sentencias, pero sí aclarar cualquier concepto oscuro o suplir cualquier* omisión que contengan sobre punto discutido en el litigio. La aclaración o* adición de la sentencia sólo proceden respecto de la parte dispositiva...". Ahora bien, por los principios de debido proceso y legalidad, los tribunales de ejecución no pueden ejecutar aspectos o petitorias no concedidos en firme en sentencia principal. Si una parte vencedora, solicita una pretensión inejecutable en el proceso de ejecución, tal debe ser rechazada de plano, desde un inicio, para evitar realizar trámites innecesarios e indebidos, que además legalmente son improcedentes e indebidos (por carecer el tribunal de ejecución de competencia para llevarlos a cabo).
Si no se rechazó interlocutoriamente, debe rechazarse en sentencia el reclamo improcedente. En el presente asunto, varios de las petitorias de la demanda de ejecución no son ejecutoriables ni ejecutables, al no ser condenas firmas concedidas en la sentencia principal que se ejecuta, por lo cual debieron rechazarse de plano. En concreto los siguientes: a) reclamo por frutos dejados de percibir, que la parte afirma son lo no recibido por concepto de explotación de madera "ilegal", actividad que afirma hacía la ejecutada. En la sentencia firme principal no existe condena por frutos no percibidos ni ello fue tampoco objeto de petitoria en la demanda ordinaria principal. No debe en ese sentido, confundirse un daño o perjuicio con un reclamo por frutos no percibidos (artículos 287, 288, 321, 325, 327, 329 Código Civil, aplicados supletoriamente); b) igualmente se trata de un fruto lo reclamado por el alquiler no recibido por la explotación de la actividad maderera llevada a cabo "ilegalmente"; c) el cobro de intereses sobre las sumas reclamadas como daños y perjuicios.
Esos tres extremos no pueden ser considerandos entonces para efectos de la presente ejecución, al no ser concedidos en la condena firme ejecutada. En función de lo explicado, el tercer agravio debe ser rechazado, pues en él se reclama que debió concederse como fruto civil, lo dejado de percibir por el arriendo percibido por la parte ejecutada. Contrario a lo que la apelante afirma, y en función de lo que es condena firme, el rechazo de dicho extremo en la sentencia apelada no infringe el numeral 329 del Código Civil, por las razones ya explicadas por esta Sede. La indemnización de frutos no fue un extremo debatido en el proceso principal y por ende no existe condena al respecto. Por ello resulta innecesario analizar sus objeciones a la forma como se valoró la prueba pericial del actuario matemático en relación con ese tema.*
IX.En cuanto a la condena de daños y perjuicios en abstracto (relacionado con el reclamo en ejecución del punto "a" del considerando VII, único que interesa en función de lo apelado), debe resaltar lo siguiente. Ese formato de condena debe usarse solo excepcionalmente, porque es permitido y procedente* solo en supuestos específicos. Por ejemplo: a) cuando el ordenamiento lo dispone de pleno derecho. En tal caso, en el proceso principal solo se hace una condenatoria general, sin que se pueda analizar ni definir por el tribunal que lo tramita cuáles son los extremos concretos que pueden concederse. Queda entonces para el proceso de ejecución, tanto la especificación como la demostración de los extremos reclamados como su cuantificación y extensión. Ello sucede en algunos procesos sumarios, como los interdictos (artículo 460 del Código Procesal Civil, aplicado supletoriamente y vigente a la época en que inició este proceso); el recurso de amparo y el habeas corpus (artículos* 26 y 51 Ley de Jurisdicción Constitucional); y en las acciones civiles resarcitorias acogidas en sede penal (artículo 432 del Código Procesal Penal). b)* Una segunda situación en la cual es posible ese tipo de condena (en abstracto) es más limitada.
Se trata del supuesto en el cual se reclaman daños y perjuicios como petitoria principal o bien en forma accesoria, pero no existe prueba de su cuantía. En tal caso, se hace la condena en abstracto para que en el proceso de ejecución de sentencia se fije su importe o estimación. En este supuesto, a los tribunales les corresponde indicar cuáles extremos concretos concede, cuando han sido debidamente demostrados y justificada su indemnización. Si es posible, se debe determinar de una vez el monto que se otorga por cada uno. Pero si ello no se puede hacer por falta de prueba, debe dejarse para el proceso de ejecución (se tramite dentro del mismo expediente del principal o en forma separada), el debate sobre* la fijación del monto o quantum de los daños y perjuicios, que ya fueron debidamente acreditados, pero no su constatación o existencia (numerales 156 y 155 inciso d) del Código Procesal Civil aplicable según lo indicado).
Sobre el punto en examen la Sala Primera de la Corte Suprema de Justicia ha dicho: "La posibilidad de condenar en abstracto no exime al actor del deber de concretar en qué consisten los daños y perjuicios que se reclaman y realizar su estimación. Pues la condenatoria en abstracto se refiere tan sólo al caso de que no existan datos suficientes para fijar su importe, cuantía o extensión de los daños...” (sentencia 12 del 31 de enero de 1996. Ver en igual sentido voto 734 del 6 de octubre del 2005). Por ende, en una correcta técnica legal, no se debe dejar para el proceso de ejecución la constatación de daños y perjuicios que se hayan reclamado en los procesos principales, especialmente los ordinarios. En otras palabras, en el proceso principal la persona juzgadora debería determinar si los daños y perjuicios reclamados son procedentes y si existen, para determinar entonces qué se concede en cuanto a tales.
Sin embargo, en ocasiones, los tribunales en forma desacertada, pese a que las partes liquidan efectivamente daños y perjuicios en el principal, dejan tanto la constatación de su existencia como su quantum para el proceso de ejecución. Esa práctica no es apropiada, pues afecta la celeridad procesal y no se ajusta a lo regulado en los numerales antes citado (ver votos 25 del 16 de enero de 1997 y 237 del 31 de marzo de 1998, del Tribunal Superior de Casación Penal del Segundo Circuito Judicial de San José). Sin embargo, de darse tal situación -cómo sucede en el caso concreto- los derechos de ambas partes no pueden ser conculcados, por lo que pese a no ser lo correcto legalmente, se ha aceptado que en el proceso de ejecución correspondiente, se especifiquen los daños y perjuicios reclamados y se proceda a demostrar por la parte vencedora su existencia, relevancia jurídica y además su cuantía o monto (artículo 693 íbid).
Pero en esa formulación que se haga en el proceso de ejecución, se debe respetar lo planteado y debatido en el proceso principal, es decir, la parte ejecutante no puede cambiar lo que reclamó como daños y perjuicios en la demanda principal. En otras palabras, cuando la condena en abstracto no especifica cuáles son los extremos concretos concedidos, al no existir pronunciamiento concreto firme y por ende ejecutoriable, ello no exime al favorecido de su deber de demostrarlos en la vía correspondiente. Esa condena en abstracto además, no otorga por sí solo el derecho a recibir indemnizaciones por daños y perjuicios concretos, al no establecer una obligación específica y expresa al respecto. Por consiguiente, la parte ejecutante, para hacerla efectiva, debe demostrar en el proceso de ejecución tanto la existencia, alcances, nexo causal y cuantía* de cada extremo reclamado. No es suficiente alegarlos o protestarlos.
Deben acreditarse de manera incuestionable. “Es claro, que en los procesos en los cuales se cobran daños y perjuicios que una persona ocasionare a otra, es absolutamente necesario, se demuestre efectivamente que los mismos se han ocasionado, pues debe acreditarse la existencia del daño o del perjuicio, así como que la parte demandada es la responsable de éstos, sea, el nexo causal. La carga de la prueba, corresponde a la parte que promueve la acción, situación que establece en forma concreta el inciso primero del artículo 317 del Código Procesal Civil. Quiere decir, que no basta con alegarlos, sino que deben ser demostrados en forma idónea y fehaciente, para que puedan ser concedidos...” (Sala Primera, voto 774 de 20 de noviembre del 2003).*
X.La Sala Primera también se ha ocupado, en reiteradas ocasiones, de precisar la diferencia que existe entre las obligaciones de dinero y las obligaciones de valor. "En las obligaciones dinerarias se debe un "quantum" (cantidad fija o invariable de signo monetario), en tanto que en las de valor se debe un "quid" (un bien o una utilidad inmodificable)..., el objeto de la obligación de valor no es una suma de dinero, sino un valor abstracto correspondiente a una expectativa o pretensión patrimonial del acreedor, por lo que la cuantificación del crédito viene a ser extrínseca respecto a la relación obligatoria. Esto no obsta para que pueda ser cuantificable y liquidable en dinero efectivo" (voto 292 de 12 de mayo del 2005). Entonces, cuando se trate de obligaciones o deudas de valor, si en la sentencia principal no se convirtieron a dinerarias o no se fijaron los parámetros claros para su cálculo y determinación, tiene la parte vencedora, en cuanto a esos extremos, la carga de probarlos en el proceso de ejecución de sentencia.
Es decir, debe demostrar el valor, precio o cantidad a indemnizar, y en ocasiones incluso la existencia de lo concedido en abstracto (artículos 9, 317, 629, 694 íbid). Para ello, no solo debe especificar los créditos otorgados genéricamente (en este caso daños y perjuicios concretos, con base en lo reclamado en la demanda ordinaria principal y sin que pueda modificar lo pedido en tal al respecto), sino también describir física y temporalmente las características y elementos del extremo otorgado, que permita su valoración justa y legal, y además, aportar la prueba idónea que apoye sus afirmaciones al respecto, si no constan en el proceso principal (ver sobre el tema voto 472 de este Tribunal del 18 de julio del 2001). Y aplica en tales caso, la regla de la carga probatoria, que impone que a cada parte le corresponde la carga de probar los hechos que le sirven de presupuesto al derecho o situación que reclama sea declarado o reconocido a su favor, cualquiera que sea su posición procesal; si no lo hace, debe soportar* el riesgo de la falta de prueba, que se traduce en una decisión desfavorable a sus intereses (artículo 317 ibíd).*
* XI.-* En este caso, aclarado lo de los extremos no ejecutoriables (puntos "c, d y e" del considerando VII), debe revisarse en función de lo apelado, si lo expuesto en la demanda de ejecución respecto al extremo relacionado con daños al ambiente (punto a), responde a lo reclamado en la demanda original, según lo explicado en el considerando anterior. Lo decidido en cuanto al otro extremo (punto "b", referido al reclamo por daño material sufrido respecto a la plusvalía del terreno), no fue objeto de agravio en la apelación analizada, por lo que respecto a ello, no se puede realizar análisis alguno (artículo 590 Código de Trabajo). El extremo que interesa en función de lo apelado, según la demanda de ejecución, se refiere "al daño ambiental sufrido en el terreno reivindicado, propiamente el impacto ocasionado al bosque, fundo y fuentes hídricas con la explotación de este mediante la corta de árboles, limpieza de terrenos y construcciones, desde el momento en que lo adquirió la apelante y hasta su cese".
Valoró ese extremo, a la fecha de plantear la demanda de ejecución (noviembre de 2014) en ¢75000000.00 (setenta y cinco millones de colones)* (folio 1475). En la demanda ordinaria principal, al referirse a este tema, la parte ejecutante había reclamado como daños y perjuicios el daño causado al ambiente, por "la tala de bosque, la desconfiguración de la vocación agraria conservacionista de la finca con una industria contaminante de desechos sólidos y ruido, que consideró afecta directamente el sotobosque y la Quebrada Grande, que "troncha y desmejora física y patrimonialmente la finca..." haciéndola poco atractiva para inversionistas y para proseguir su ecocultura agraria. En el desglose específico de daños y perjuicios de la demanda principal expresó que el demandado [Nombre2] era responsable en forma personal y la sociedad también por la relación causal de los daños al ambiente en general y a la finca en particular".
Estimó esos daños a la fecha de plantearse la demanda (junio de 2006) en ¢20000000,00 (veinte millones de colones) (folios 57 a 58).* Lo reclamado en la demanda de ejecución sobre ese tema, responde entonces a lo expuesto en la demanda ordinaria. Al girar el agravio en torno a un daño ambiental colectivo, es importante resaltar brevemente lo siguiente.* El daño ambiental es el* “resultado de la alteración o destrucción, intencional o no, producto de impactos negativos, de alguna actividad humana o de origen natural, que afecta, interrumpe o destruye los componentes de los ecosistemas, alterando su función y estructura en forma reversible o irreversible”* (art. 3-c Reglamento Ley de Biodiversidad). Existe daño ambiental entonces cuando una acción o actividad produce una alteración desfavorable en el ambiente o en alguno de sus componentes. Puede ser biofísico o social. El primero recae en el entorno y afecta las características propias del recurso o bien ambiental.
El segundo implica la pérdida de los beneficios derivados de tales, es decir, de los bienes y servicios que se obtienen de ellos.* Si bien es cierto el daño ambiental, para ser resarcido, puede manifestarse o cumplir los parámetros tradicionales, también ha requerido una evolución, armonización o adaptación especial, para cubrir supuestos no previstos o para los cuales resulta, en ciertos supuestos, insuficiente la concepción clásica de daño y de responsabilidad jurídica, basados prioritariamente en conceptos de daño cierto, actual y personal.* La responsabilidad civil ambiental tiene por objeto obligar a quien cause un daño al ambiente a realizar o pagar por su reparación integral. Además, es importante tener presente que cualquier régimen de responsabilidad en materia ambiental debe respetar las características y principios del Derecho Ambiental, especialmente el preventivo, el precautorio y el de internalización previa de costos, conocido como quien contamina paga.
Al igual que pasa con el daño común, los conflictos de interés ambiental pueden derivarse de un vínculo contractual o ser de naturaleza extracontractual; aunque prima lo segundo y en tal supuesto el criterio de imputación es usualmente objetivo (responsabilidad por riesgo). También reconoce la doctrina, tesis desarrollada en la sentencia 675-2007 de la Sala Primera citada en el fallo recurrido, que los daños relacionados con el ambiente, como se explicó al inicio, pueden ser de dos tipos: a) Daños al ambiente (daños colectivos o puros). Por ejemplo, cuando se contamina un río, se causa un daño al río en cuanto bien ambiental y componente del ambiente. b) daños a través del ambiente (daños individualmente soportados), que son de orden patrimonial o moral y recaen sobre bienes privados.* “El daño ambiental afecta a la sociedad en general y no solo a las personas individualmente consideradas...
Vinculado a ello, surge la noción de daño sufrido colectivamente, entendido como aquel que nace cuando se lesiona un interés de esa índole, que tiene autonomía, y puede o no concurrir con los individuales, lo que revela una realidad grupal. No obstante, en ocasiones es posible que una conducta produzca, además de lesiones al ambiente como tal, detrimento de forma directa a particulares. En estos casos, de cara a la reparación, es necesario distinguir los elementos ambientales que benefician a toda la sociedad, de las lesiones a individuales. En este último, podrá darse a través de una indemnización, tomando en cuenta tanto el daño como el perjuicio personal. En el primer caso, por el contrario, se está ante un supuesto de interés difuso esto es, extendido, difundido, dilatado; se propaga o diluye entre los miembros del conjunto sea que este se encuentre o no organizado y compacto. Se trata de un daño supraindividual que no consiste en la suma de daños especiales.
Ni en un perjuicio de bienes propios y particulares de los individuos, sino en una lesión actual y concreta, sólo desde el punto de vista de la sociedad entera que los sufre. El daño al colectivo afecta simultánea y coincidentemente al grupo. Se trata de un mismo y único daño, que hoy en día se acepta sin dificultad, como una noción con entidad propia, que atañe por igual a todos los miembros de la comunidad, o a determinados grupos de manera indistinta y no exclusiva. Los destinatarios no son ya las personas, en forma aislada, sino categorías o clases de sujetos, vinculados por alguna calidad o característica que da conexión al conjunto. Dentro de esta temática, de surgir la obligación de resarcir este tipo de menoscabo, no se configura una suma de porciones identificables; por el contrario, es una lesión general, que resulta aprehensible y experimentable, en donde el elemento afectado es comunitario o grupal, que llega a los sujetos individuales indivisiblemente, por la inserción en el conjunto.
En vista de lo expuesto, se debe distinguir entre daños al ambiente y daños a través del ambiente. Este último se basa en la responsabilidad patrimonial tradicional: daños personales y económicos. El otro por el contrario, se refiere al daño ambiental per se. En conclusión, se pueden identificar dos categorías: 1) El ecológico o ambiental propiamente dicho. Afecta la flora y fauna, el paisaje, el aire, el agua, el suelo, es decir, el ambiente. Es el que sufre el ecosistema, inhibiéndolo en sus funciones naturales. No se ubica sobre ningún bien de pertenencia individual. Es el perjuicio o detrimento soportado por los elementos de la naturaleza o el ambiente, sin recaer en una persona o cosas jurídicamente tuteladas. Se trata de un daño al ambiente, ya sea mediante su alteración o destrucción parcial o total, afectando en forma mediata la calidad de vida de los diversos seres vivientes del planeta. 2) Los daños ambientales con efectos en personas particulares.
Son aquellos que por un impacto ambiental afectan a las personas o bienes individuales. Esta categoría resulta asimilable a las tradicionales hipótesis de daño, ya reconocidas por el Ordenamiento Jurídico. Si bien recibe la atención judicial como si se tratara de un daño ambiental, las reglas para atribuir responsabilidades y establecer su resarcimiento, no difieren sustancialmente de las clásicas del derecho. En estos casos, se trata de un daño a las personas o a las cosas por una alteración del medio a causa del obrar humano. No es un daño directo al ambiente, sino a las personas o a las cosas, por una alteración del primero” (énfasis agregados).*
XII.En relación con esos dos tipos de daños, debe distinguirse entre legitimación procesal para reclamarlos y derecho a la reparación. La legitimación se relaciona con la causa o interés para plantear un litigio o denuncia; no se identifica con la titularidad del derecho sustancial alegado o controvertido. Por ello, la parte actora o demandante puede estar legitimada para plantear la demanda, pero si no prueba los hechos base de su pretensión, la demanda se declarará infundada. De igual forma, esa distinción permite entender que aunque una persona esté facultada para plantear un reclamo por daños, la indemnización que solicite no necesariamente se le podrá otorgar, como sucede en algunos casos de daño ambiental colectivo. En términos generales, el derecho o principio de tutela judicial efectiva está reconocido en la Convención Americana de Derechos Humanos (Pacto de San José) (artículos 8.1 y 25) y en la Declaración de Río sobre Medio Ambiente y Desarrollo (principios 10 y 13).
Debe tenerse presente en todo caso, que no debe confundirse la legitimación procesal (que permite plantear una demanda), con el derecho de fondo (lo pretendido), que se debe tener en concreto para obtener una decisión favorable y que el daño causado a la colectividad no implica la existencia automática de un daño personal ni legitimación para reclamarlo (Sala Primera, voto 834-2015). Pero entonces ¿quién está legitimado para reclamar la reparación de un daño ambiental y quién para repararlo o recibir lo necesario para ello? Tratándose del daño ambiental colectivo, el artículo 50 constitucional costarricense, en cuanto a legitimación para reclamar dispone: “Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello, está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho”.
De igual forma, el numeral 46 de ese cuerpo legal dispone que las personas consumidoras y usuarias tienen derecho a la protección de su salud y ambiente. Como se desprende de dichas normas, de rango superior, en nuestro país no se puede restringir la legitimación para reclamar la prevención, cese y reparación de los daños ambientales. "…Tratándose del Derecho al Ambiente, la legitimación corresponde al ser humano como tal, pues la lesión a ese derecho fundamental la sufre tanto la comunidad como el individuo en particular" (Sala Constitucional, voto [Telf2]). De igual forma se disponen en los numerales 2 y 98 Ley Orgánica del Ambiente y 105 Ley de Biodiversidad. Pero, se reitera, la legitimación activa amplia o abierta para accionar o demandar en defensa del ambiente (daño colectivo), no implica que por haber accionado se le pueda conceder u otorgar la pretensión material alegada (por ejemplo, la indemnización por los daños ocasionados).
En Costa Rica, toda persona puede reclamar la reparación del daño propiamente ambiental (daño ambiental puro o colectivo), pero respecto de los daños que concomitante se hayan sufrido en la esfera personal, sólo lo pueden hacer aquellas que estén legitimadas activamente según la vía concreta que se utilice para plantear el reclamo, lo cual depende del tipo de demanda y de las pretensiones formuladas. “No cabe la posibilidad de reclamos personales, plurales y separados cuando el ofendido es la colectividad, ya que, es característica de dichos intereses su indivisibilidad, en razón de que el bien colectivo no es fraccionable entre quienes lo utilizan, tampoco es factible dividir su goce. Ello trae como consecuencia la imposibilidad de que existan distintos derechos subjetivos, por no existir un vínculo directo entre una persona y ese tipo de derecho. O es del grupo o no es de nadie, porque si alguien lo acapara para sí, deja de ser coparticipado para ser individual.
Lo que no quita, como se dijo, la posible coexistencia de daños particulares o plurindividuales, porque una de las características del Derecho Ambiental es que el daño se causa siempre a la colectividad, pero con repercusiones, en ocasiones, sobre bienes individuales. En efecto, la persona tiene posibilidad de accionar en su nombre para pedir una indemnización propia (daño ambiental particular), como de accionar en nombre de una colectividad para pedir una indemnización de la cual no se puede apropiar pero sí puede gozar (daño ambiental al colectivo), que es realmente la que constituye la reparación del daño ambiental en su estado puro” (Sala Primera, voto 675-2007). En otras palabras, el poder reclamar no conlleva que se pueda recibir el importe de una eventual indemnización, salvo que se plantee a la vez una acción indemnizatoria particular por un daño individual y privado, derivado del daño ambiental.
Así, pese a la amplitud en la legitimación para reclamar el daño ambiental, las indemnizaciones por daño colectivo no pueden ser otorgadas a favor de las personas privadas o públicas específicas que hayan planteado el reclamo. El titular para recibirlas es el Estado (representado por la PGR) o quienes la ley determine expresamente. La indemnización por afectación indirecta a bienes o intereses privados (daño individualmente soportado), puede reclamarla sólo quien lo ha sufrido y es tal, por las reglas comunes de responsabilidad, quien tiene derecho a la indemnización.*
XIII.-* Resulta evidente que lo reclamado en esta demanda de ejecución es un daño ambiental de tipo colectivo, dado que se pretendía una indemnización por el daño ambiental ocasionado al bosque, al fundo y a las fuentes hídricas dada la explotación de la corta de árboles (lo cual no fue probado) y la actividad desarrollada por el aserradero de madera que se instaló en el área en litigio. De ser procedente, e independientemente de la mejor forma de recomponer el ambiente en cuanto a los ecosistemas afectados, la parte ejecutante tendría legitimación activa para plantear el reclamo, pero no puede reclamar indemnización a título personal por esa afectación, conforme se explicó en el considerando anterior. De ordenarse tal vía de restauración, sería a favor del Estado que se otorgaría una condena indemnizatoria, pues al tratarse de un daño ambiental colectivo, es el único con derecho a recibirla, en representación de la sociedad.
Pero en este caso, ese reclamo resulta improcedente, por lo que la sentencia apelada en cuanto a ello, debe ser confirmada. Esto por cuanto, aunque la parte apelante cuente con legitimación activa para plantear el reclamo, no se dirige contra la persona responsable de los hechos base del mismo. En otras palabras, conforme a lo tenido por probado tanto en el ordinario principal como en este proceso de ejecución, no existe nexo causal entre la sociedad ejecutada y los actos y hechos que la ejecutante reclama como base del daño ambiental colectivo que cita en su demanda. La persona que desarrolló la actividad del aserrío de madera fue [Nombre2] , en su calidad de arrendatario del área en litigio, desde antes de que la ejecutante plantease su demanda ordinaria. Incluso se mantuvo en ella hasta la puesta en posesión en el 2014. El que la ejecutada fuese quien le arrendó, en el contexto de confusión que se tenía antes del 2006 (creyendo ser la propietaria de esa zona), no la hace ni responsable directa de los efectos que esa actividad del aserradero pudiesen generar en el ambiente, ni tampoco crea una responsabilidad solidaria, como lo pretendió sostener la apelante en la demanda ordinaria.
Esto por cuanto, conforme se explicó en los hechos probados agregados por este Tribunal a la sentencia de ejecución, el único responsable y operador a título personal del aserradero fue el señor [Nombre5]. Incluso se probó que contaba con permisos y autorizaciones para ello antes de plantearse la demanda ordinaria, aunque ello no le hubiese eximido de responsabilidad de probarse responsabilidad de tipo ambiental. Luego de planteada la demanda principal, a través de una medida cautelar, se autorizó se continuase con dicha labor, según consta en resolución de primera instancia 66 de 7 setiembre 2007 y voto 358 de 30 mayo 2008 de este Tribunal (folios 155 y 299). Pero la demanda principal fue declarada sin lugar en relación con [Nombre2] , aspecto que resulta medular para denegar los agravios en torno al daño ambiental colectivo reclamado. Por ende, en cuanto a tal persona, no existe condena en daños y perjuicios, situación con la cual se conformó la parte actora, al no plantear apelación sobre lo resuelto al respecto, conforme consta en el voto 752 de 21 de junio de 2012 de este Tribunal.
Y con respecto a la sociedad Balsa, el que exista una condena en abstracto en su contra, no significa que efectivamente tenga la obligación de indemnizar los daños reclamados, dado que no son imputables a ella, es decir, no es ella la responsable de su origen. No era por ende ella la legitimada pasiva al respecto, al no existir nexo causal entre los hechos imputables a la sociedad y los daños causados. Al respecto,* "...en los procesos en los cuales se cobran daños y perjuicios que una persona ocasionare a otra, es absolutamente necesario, se demuestre efectivamente que los mismos se han ocasionado, pues debe acreditarse la existencia del daño o del perjuicio, así como que la parte demandada es la responsable de éstos, sea, el nexo causal* (voto 774 del 20 de noviembre del 2003 de la Sala Primera). Si bien en materia de responsabilidad por daño ambiental cambian los criterios de imputación y se flexibilizan las cargas probatorias, la parte que reclama el daño siempre está obligada a demostrar la existencia y gravedad del daño, así como los elementos básicos para el nexo causal entre los hechos reclamados a la parte contraria y la afectación sufrida. De no existir lo segundo, aunque se pruebe la existencia del daño, el reclamo debe ser rechazado, por dirigirse contra persona incorrecta, lo cual sucedió en este caso.*
XIV.Por ende, los agravios primero y segundo no son de recibo, por las razones explicadas por este Tribunal. Tampoco erró el A quo en usar como base para explicar las diferencias entre el daño ambiental colectivo y el ambiental individual, el criterio expuesto en la sentencia 675 de 21 de setiembre de 2009 de la Sala Primera, que si era aplicable al caso, independientemente de que su emisión se diera en un proceso contencioso administrativa, pues la variable ambiental es transversal; sus reglas y principios son aplicables y deben ser respetadas en todas las materias, incluida y con mayor razón la agraria, dada la relación existente entre tal y los recursos y bienes ambientales y la importancia del equilibrio eco-sistémico para el desarrollo sostenible en el ámbito agrario o rural. Lo que se puede resaltar sobre la cita de esa sentencia, es que no explicó debidamente el A quo la diferencia entre legitimación para accionar y derecho a ser indemnizado por el daño colectivo, pese a que transcribió su contenido con gran amplitud en el considerando tercero del fallo apelado, lo cual era innecesario y no es una técnica jurídica apropiada.
Pero como se explicó, lo agraviado sobre el daño ambiental reclamado debe ser rechazado no por ser un daño colectivo, sino porque su causa no es imputable a la sociedad ejecutada, al ser realizados los hechos base del mismo por una tercera persona, contra la cual no existe condena alguna que la obligue al resarcimiento. En ese sentido, se rechaza también el alegato de la apelante de que lo que reclamaba era un daño individual para la reparación personal sufrida en su patrimonio, por cuando eso no fue lo requerido ni en la demanda ordinaria ni en la de ejecución, en relación con la afectación al ambiente. Finalmente, carece de interés su alegato de que se valoró erróneamente la prueba pericial practicada en el proceso de ejecución, pues aunque ello hubiese sido así, lo cual no se analiza por innecesario, no cambiaría el resultado impugnado, al no ser el daño reclamado imputable a la sociedad ejecutada.*
XV.De conformidad con lo expuesto, procede confirmar la sentencia de ejecución recurrida, en lo que fue objeto de apelación.* *
