The proceeding is being heard before the Agrarian Court of the First Judicial Circuit of Zona Sur, Pérez Zeledón.- Drafted by Judge Alpízar Rodríguez; and, WHEREAS (CONSIDERANDO):

I.The established facts (hechos probados) are approved because they are consistent with the evidence in the record at this stage of the proceeding and are relevant to deciding the measure, with the following additions. The following is added to 1): it is agricultural and pasture land located at [Dirección1] , . According to the Property Registry, it is bounded to the north, south, and east by [Nombre12] and to the west by [Nombre13] . Add to the evidentiary materials: the relief sought in the complaint. As to 2): Proceeding 12-000115-1129AG is an ordinary proceeding in which the persons who are defendants in this matter were the plaintiffs, and the plaintiffs herein were the defendants. It concluded by a settlement agreement (acuerdo conciliatorio) approved in final judgment 48 of 11 de marzo de 2015. Insofar as relevant, they agreed:

  • 1)The property shall be offered at three judicial auctions (subastas) to determine the prospective buyer.
  • 2)The opening bid for the first auction shall be doscientos millones de colones, for the second ciento cincuenta millones de colones, and for the third (the amount cannot be read because the stamp on the copy overlaps that information).
  • 3)Persons participating in the auctions must deposit veinticinco por ciento of the amount established for each one. If the property is awarded, they must deposit the balance within ocho días hábiles from the auction date.
  • 4)If the balance (for which the auction was awarded) is not paid within the established period, the successful bidder shall forfeit the deposit, and that amount shall be divided into ocho partes iguales and disbursed to the co-owners (copropietarios) representing un octavo of the ownership interest in the property. In the case of [Nombre1] (interest 009), [Nombre1] (interest 010), and [Nombre2] (interest 011), those three shall specify by written court filing how the share corresponding to each shall be disbursed, it being understood that, collectively, those three hold un octavo of the ownership interest in the property.
  • 5)If the auction is approved, the purchase price deposited in the Court’s account shall be disbursed under the same conditions set forth in the preceding paragraph.
  • 6)If no bids are submitted at the third auction or the auctions have been declared void (insubsistentes), a period of tres meses shall be granted for any interested person to deposit into the Court’s account an amount not less than the price set for the third auction, in which case the property shall be awarded to that person.
  • 7)If no amount whatsoever is offered for the property at issue in this litigation, the case shall be concluded, and the parties shall resort to whatever procedures they deem appropriate for the administration of jointly owned property (cosa en común) and the termination of co-ownership (copropiedad).
  • 8)Until the auction and judicial sale process is resolved, possession and administration of the land shall continue as before. Regarding occupancy of the house, the defendants shall continue using it until the property is awarded.
  • 9)The defendants are authorized to dispose of the water tank, furniture, firewood, the structure located between the dwelling and the corral, where the kitchen is located, as well as two washbasins, which stand on an earthen floor, and also the storehouse attached to that structure.
  • 10)The parties waive any claim concerning the administration of the jointly owned property from the date on which they acquired their respective interests through the present date.
  • 11)Any improvement made to the real property shall become part of the property by accession (accesión), without any right accruing to the person who makes it.
  • 12)The parties undertake to remain respectful and not to become agitated or insult or assault one another.
  • 13)Except as provided in this agreement, the judicial auction (almoneda judicial) shall be conducted in accordance with the procedure established by the Ley de Cobro Judicial.
  • 14)The principal ordinary proceeding underlying the agreement was concluded. The following is added to established fact 3): In junio de dos mil quince, in addition to the crops referred to, the land also contained a dwelling with an external room used as a wood-fired kitchen; and a corral that, according to the plaintiffs and defendant [Nombre5], was being used by tenant (arrendatario) [Nombre14] . There is a stream and a spring (naciente). Cuarenta y dos head of cattle were also grazing there, and it was reported that they belonged to that gentleman, who leased the property. 4) The present ordinary complaint has been recorded since dos de junio del dos mil quince in the Property Registry entries for the cited property, against each ownership interest held by the parties to the proceeding (images 115 to 134 in the associated documents folder: file 23/07/2018 14:43:26). 5) In an order dated 5 de junio del 2015, issued in proceeding 12-000115-1129AG, a date was set for the auction of the property, to be held on dos de agosto del dos mil dieciocho, subject to the notice of pendency (anotación de demanda) recorded in this matter (image 135 in the associated documents folder: file 23/07/2018 14:43:26).

II.For purposes of deciding the precautionary measure and the appeal filed, at this stage of the proceeding, the following is deemed unproven: 1/. The outcome of the auction cited in the last established fact or whether it could be held.

III.This Court hears the appeal filed by the plaintiffs against order-judgment (auto-sentencia) 119 15 junio 2015, which denied their requested precautionary measure seeking to have them placed and maintained in possession of the land in dispute and to order the defendants to refrain from disturbing their possession or dispossessing them until this proceeding is resolved. On its own motion, the court authorized the plaintiffs to provide appropriate care and maintenance to the corn and bean crops through the harvest stage and their subsequent collection, in the area at the front of the property in litigation. All defendants were ordered, with notice that failure to comply could result in criminal proceedings for the offense of disobedience of authority, to allow the plaintiffs to enter the specified section of land to perform maintenance, harvesting, and removal (sic) of produce from the existing corn and bean plantings.

The defendants must refrain from damaging those crops or carrying out works or acts that interfere with the normal exercise of the agricultural activity being conducted. The plaintiffs must strictly limit their conduct to entering the cultivated section of the land and the area agreed upon in approved settlement judgment (sentencia homologa) number 48 del 2015; they may not move through other areas of the property or occupy new or different areas. As a prohibitory injunction (medida inhibitoria), they are expressly warned that they must not expand the cultivated areas or introduce crops in addition to those already existing; nor may they replant, plant trees, undertake construction of any kind, stockpile construction materials, impair the property, or change its designated use. The defendants are subject to the restriction that they must prevent the banks of the spring and the river along one of the boundaries from being left unprotected; they must not engage in tree felling or timber extraction, vegetation burning, or activities that cause land-use change (cambio de uso de suelo), or, in general, actions that could alter the physical and agroecological condition of the property in dispute.

All of the foregoing is ordered with notice that, in the event of noncompliance, the authorization granted shall be terminated and criminal proceedings shall be brought for the offense of disobedience of authority, without prejudice to any other criminal offenses that may also arise, for which the offender may be prosecuted. The plaintiffs allege that: 1) Without any legal basis, relying solely on a settlement agreement that is being challenged in the complaint, the measure was denied. 2) Acting ultra petita, and without any basis or reason to direct the plaintiffs to limit their conduct to entering the cultivated section of land and the area agreed upon in approved settlement judgment (sic) 48-2015, the court ordered that they could not move through other areas of the property or occupy new areas. They were further warned that they must not expand cultivated areas, introduce crops in addition to those already existing, replant, plant trees, undertake construction of any kind, stockpile construction materials, impair the property, or change its designated use.

They consider this erroneous because the entire property, not merely the cultivated areas, is in dispute, in addition to the fact that the judgment approving the settlement is being challenged on grounds of nullity. They request that the appealed ruling be reversed solely insofar as it denies the requested precautionary measures, that those measures be granted, and that the restrictions on the plaintiffs’ activities and access to certain areas of the property be reversed or annulled, because the relief sought clearly concerns the entire property (pleadings folder: file 30/05/2018 14:06:54, image 20).

IV.Given the content of the grounds for appeal (agravios), it is important to recall that Article 242 of the Code of Civil Procedure (Código Procesal Civil), applied supplementarily pursuant to sections 6, 26, and 79 of the Agrarian Jurisdiction Act (Ley de Jurisdicción Agraria), in conjunction with Article 41 of the Political Constitution (Constitución Política), provides that, in addition to specific or statutorily prescribed precautionary proceedings (procedimientos cautelares), appropriate precautionary measures (medidas precautorias) may be imposed when there is a well-founded fear that one party, before judgment is entered, may cause serious and difficult-to-repair harm to the other party’s rights. Accordingly, those who administer justice are empowered to authorize or prohibit the performance of certain acts, order property to be placed in custody, or require the posting of security (caución).

In this regard, the Constitutional Chamber (Sala Constitucional), in voto 3929 del 18 de julio de 1995, stated: “...Protective or precautionary measures (medidas asegurativas o cautelares), according to the most authoritative legal scholarship, arise in proceedings as a necessity for ensuring effective judicial protection and may therefore be conceptualized as ‘a set of procedural powers vested in the judge—whether exercising judicial or administrative adjudicatory authority—to rule before the final decision, for the specific purpose of preserving the factual conditions essential for issuing and enforcing the final act.’ Legal scholarship understands instrumentality and provisionality to be two fundamental characteristics of precautionary measures and considers that their principal defining elements require them to be: a) lawful and legally possible; b) provisional, since they expire upon issuance of the final act; c) supported by reasons, meaning that they must have a genuine factual basis relating to the particular case; d) modifiable, in the sense that they may be expanded or reduced to adapt them to new needs; e) ancillary, since they are justified within a principal proceeding; f) preventive in nature, because their purpose is to avert harm to the interests and rights represented in the principal proceeding; g) protective in effect, insofar as they seek to maintain a factual or legal situation during the course of the proceeding, preventing circumstances that could impair the effectiveness of the judgment or final act; and h) uniform in nature and not identical in character to the substantive right being protected, so that they constitute effective preventive measures rather than anticipatory acts of enforcement” (see voto 1322-F-11 de este Tribunal del 24 de noviembre del 2011).

In agrarian matters, regarding the purposes of atypical precautionary measures (medidas cautelares atípicas), in addition to the foregoing, it has been emphasized that care must also be taken to ensure that the continuity of production and the protection of natural resources are not endangered. The measures are adopted preventively, to safeguard the interests of the community and to prevent the results of proceedings from being rendered ineffectual. They may be ordered sua sponte (de oficio) or at the request of a party. They are provisional and may therefore be modified or lifted during the course of the proceeding or upon its conclusion. The requirements that must be met for their issuance may be summarized as follows: a) residuality (residualidad), meaning that no other avenue exists for provisional protection; b) likelihood of success on the merits (apariencia de buen derecho), meaning that the relief requested as a measure and the relief sought in the complaint must likely be capable of protection under our legal system and must not be unlawful; and c) risk arising from delay (peligro de demora), meaning that the measures must be granted when necessary to prevent irreparable harm or serious injury to either party before the matter is decided.

Their purpose is to avoid, to the extent possible, alterations in the parties’ initial balance that may result from the duration of the proceeding. Hence the instrumental nature of these measures, which do not exist independently but only in connection with the principal proceeding (voto 769 del 13 de noviembre de 1998 de este Tribunal). In assessing those requirements in light of the ruling appealed by [Nombre4], it must be borne in mind that the claims in this complaint, insofar as relevant, seek a declaration of adverse possession (usucapión) over half a hectare of land located at [Dirección2] de Cartago and an order that it be recorded in the Public Registry (Registro Público). The claims are based on Articles 92 and 101 of the Land and Settlement Act (Ley de Tierras y Colonización), among other provisions.

V.To decide the matter under appeal, it is necessary to review the substantive claims in the complaint and clearly identify the precautionary relief requested by the plaintiff. Because the presentation is confusing and repetitive, the claims may be summarized as follows: a) that adverse possession be declared with respect to the property at San [Nombre3] [Dirección3]; b) that the defendants’ alleged rights to recover their ownership be declared expired; c) that the aforementioned property be registered in the plaintiffs’ names; d) that the defendants be ordered to refrain from interfering with the plaintiffs’ possession, with notice that criminal proceedings may be brought against them for the offense of disobedience of authority; e) that they be ordered to pay for improvements (the plaintiffs cite a corral, house, pastures, roads, protection of natural resources, and land preparation); f) that all donations of the properties associated with that registry entry be annulled, specifically the donation filed in volume 2011, entry CED12, made by [Nombre15], and the following transfers: 2011-00276266-01, held in co-ownership as follows (sic): sub-registration CED13 in the name of [Nombre3] ; sub-registration CED14 filed in volume 2012-00018188-01 in the name of [Nombre4] ; sub-registration CED15 filed in volume 2011-00276266-01 in the name of [Nombre7] ; sub-registration CED16 filed in volume; 2012-00171342,-01 in the name of [Nombre4] , sub-registration CED17 filed in volume 2011-00276266-01 in the name of [Nombre16] ; sub-registration CED18 filed in volume 2011-00276266-01 in the name of [Nombre8] ; sub-registration CED19 filed in volume 2011-00276266-01 in the name of [Nombre6] , sub-registration CED20 filed in volume 2011-00356331-01 in the name of [Nombre1] , sub-registration CED21 filed in volume 2011-00356331-01, in the name of [Nombre1] , sub-registration CED22 filed in volume 2011-0035-6331, in the name of [Nombre2] ; g) that title to the aforementioned property be restored to the plaintiffs in equal shares and registered in their names; h) that they be placed in full formal and physical possession of the aforementioned property; i) that ordinary proceeding 12-000115-1129AG, consent judgment 48 de 11 de marzo de 2015, the scheduling of the judicial sale, and all actions taken in that proceeding be declared null and void; j) that they be maintained as the lawful holders of the possessory right to that property; k) that all enforcement and dispossession or judicial-sale proceedings be stayed until their good-faith possession is established; l) that the administrative decisions intended to dispossess them of the property within mortgage proceeding (sic) 12-000115-1129AG be declared null and void; and m) that the defendants be ordered to pay damages (loss of use of the parcel, distress and helplessness resulting from efforts to resolve this dispute, and indexation of the amounts from the filing of the complaint until actual payment).

In the complaint, the plaintiff requests the following because agricultural activities (sugarcane, pasture, corn, beans, vegetables, and livestock) and natural resources on the land are under threat: a) that the defendants be ordered to refrain from acts of interference and threats of dispossession related to eviction from the property until the proceeding is resolved; b) that notice of the existence of this other proceeding be provided in ordinary proceeding 12-000115-1129AG; c) that a notice of lis pendens (anotación de la demanda) be entered alongside the registry entry for the aforementioned property (this was ordered in the order serving process dated 25 de mayo de 2015 and appears in registry certifications issued after that decision, showing that the notice was entered as of 2 junio 2015 under filing references 800-00266294-01-0001-01); d) that the judicial sale scheduled in the aforementioned case file be stayed; e) that she be maintained in possession of the disputed land until the crop-production cycle ends.

If that relief is not granted, that the defendants be ordered to refrain from altering or destroying the crops and from introducing improvements or accession (accesión). f) that she be appointed judicial custodian (depositaria judicial) to care for the crops and environmental resources until a final judgment is entered in this proceeding.

VI.Before analyzing the precautionary measure under appeal, it is necessary, given the content of the claims, to make the following observations so that the Trial Court may review the proceedings and make the appropriate corrections in order to prevent future nullities (Articles 590 of the Labor Code (Código de Trabajo) and 26, 60 of the Ley de Jurisdicción Agraria):

  • 1)Before continuing to process the case, it must be determined whether the set of claims may be joined in this proceeding; if they may not, the appropriate corrective order must be issued pursuant to sections 36 and 37 of the aforementioned Act and 123,124 of the Código Procesal Civil, applied supplementarily. If they may be joined but are mutually exclusive, the plaintiff must be ordered to specify which claims are principal and which are alternative. In this case, several claims are in that situation; therefore, for the sake of orderly procedure and due process, the situation must be corrected, a task incumbent upon the court of first instance. In that regard, it is emphasized that the aforementioned sections 36 and 37 permit the joinder of claims (acumulación de pretensiones) when they must be processed jointly and decided in a single judgment, so as not to divide the cause of action or to avoid contradictory judgments.

They refer to Articles 41, 123, and 124 of the Código Procesal Civil in all relevant respects; those provisions emphasize that joinder of claims is appropriate when there is a connection between at least two of their elements, or between only one if that element is the cause, when the claims are not mutually exclusive, the procedure for resolving them is the same, and the adjudicator has jurisdiction over all of them. Even mutually exclusive claims may be joined as principal and alternative claims. When severance (desacumulación) is ordered, sua sponte or at a party’s request, the court must expressly identify in its decision which claims may not be joined, so that the plaintiff may choose which to maintain and which to exclude within the period prescribed by law. If the plaintiff does so correctly, the Trial Court must issue a decision deeming that requirement satisfied and, as a matter of due process, identify the claims that will thereafter be subject to litigation.

If the party does not comply with the order or does so incorrectly by maintaining claims that may not be joined, the court must proceed as stipulated in the aforementioned section 124, ordering the claims warranted by the circumstances to be processed.

  • 2)The second matter that must be corrected—and for which the issue of the claims and their joinder must first be resolved—is to verify that all persons who must be parties to the proceeding have been joined as such. This is because several requests seek the nullification of acts and the cancellation of registry entries. If the titleholders or persons who participated in those acts do not appear as plaintiffs or defendants, the absent persons must be joined as necessary defendants (litis consorcio pasivo necesario). Such is the case of [Nombre15] , who is identified as having participated in a donation that the plaintiffs seek to have annulled. It is clarified that joinder of that person must be ordered only after determining whether the related claims may be joined in this proceeding. Therefore, this Court cannot order the immediate correction of that matter.

Despite those issues, this Court, in the interest of procedural economy (economía procesal) and given the nature of the appealed judicial act, may hear and decide the matter without having to wait for them to be cured. However, after the acts ordered to be cured have been completed, the decision concerning the measure under review must be reviewed sua sponte by the Court, in order to assess whether, once the issue of joinder of claims (acumulación de pretensiones) has been resolved, the measure should remain in effect as ordered. It is also clarified that the appealed ruling was issued prematurely, because the defendant parties were granted a three-day hearing concerning the nonstandard interim measures (medidas atípicas) in the order for service issued on 25 mayo del 2015. The appealed ruling was issued on 15 junio 2015. As of that date, co-defendants [Nombre3] and [Nombre9] had not yet been served, as stated in the ruling of 1 julio 2015.

The former was not served until the following 9 julio, and the latter did not enter an appearance in the proceedings until 30 de mayo de 2018. However, none of the defendant parties objected to that situation or filed an appeal against the decision; therefore, the defect is deemed cured and does not warrant any declaration of procedural nullity (nulidad procesal) in that regard (sections 194 to 197 of the Código Procesal Civil, applied supplementarily).

VII.The first ground of appeal is without merit. In ruling on the nonstandard interim measures, the trial judge considered what existed on the land when the judicial inspection (reconocimiento judicial) was conducted, the fact that it had been leased to a third party, and the subject matter in dispute. She therefore denied the measure seeking the “reinstatement of the plaintiffs.” Furthermore, her decision was based on the terms agreed upon in the court-approved settlement (conciliación homologada) in the 2012 ordinary proceeding, particularly clause eight, which governs possession and administration of the land, as well as on other agreements; she therefore concluded that this diminished the prima facie case (apariencia de buen derecho) supporting the claimants’ requests for interim relief. Regarding the denial of the stay of the auction, she explained that this had also been agreed upon in that settlement.

She stated other reasons with which this Court disagrees, namely, that the effects of judgment-enforcement proceedings (proceso de ejecución de sentencia) cannot be stayed through an ordinary proceeding, because in exceptional circumstances certain measures may have that effect. Nor does this Court agree that the only grounds for interrupting and staying proceedings are those set forth in sections 201 and 202 of the Código Procesal Civil. The trial judge was correct, however, in finding that the existence of court-approved judgment 48-2015 and its legal effects cannot be disregarded when assessing the prima facie case. Accordingly, the appellant’s assertion that the matter was decided without legal grounds and that the court below could not rely on the settlement agreement because it is being challenged in this action is without merit. That agreement is effective because its court approval became final, and the request for a declaration of nullity (nulidad) sought in this matter does not render it ineffective.

The claimants’ arguments concerning its validity may be examined in the judgment on the merits. Until then, however, the court-approved agreement remains effective. This action may logically affect it, but the filing of the action neither eliminates its existence nor renders it ineffective. Therefore, the denial of the nonstandard interim measures requested in the complaint is duly supported, and the plaintiff offers no compelling or sustainable grounds for altering that decision. Indeed, regarding the effects of this matter on enforcement of the agreement reached in the 2012 ordinary proceeding, this Court emphasizes that the 2015 complaint is recorded in the registry entries for the disputed property; therefore, notice to third parties is already effective, and the record does not show that the property was auctioned before that notation was entered. Anyone who acquires it is therefore already aware of this matter and its potential legal implications should the complaint be granted.

Possession of the real property was also addressed in that settlement; thus, the trial judge was correct in finding that it is improper, through an interim measure (medida cautelar) and on the basis of the issues disputed in this matter, to vary or modify what the parties agreed in that regard.

VIII.Regarding the second ground of appeal, the appellant is partially correct that the measures imposed sua sponte must conform to what was agreed and, accordingly, must not be more burdensome for the plaintiffs than for the defendants. However, the interim orders imposed by the trial judge on the plaintiffs cannot be characterized as ultra petita, because interim measures may be imposed sua sponte (articles 26 Ley de Jurisdicción Agraria, 5 Ley Orgánica del Poder Judicial and 98, 242 of the Código Procesal Civil). As explained, it is appropriate to analyze the scope of the interim orders issued to the claimants in light of the aforementioned settlement agreement and the issues disputed in the proceedings, while taking into account that the exercise of a fundamental right—private property—is at stake. The first interim order issued sua sponte restricts the plaintiffs’ access to the cultivated section of the land and to the area agreed upon in court-approved judgment 48-2015, clarifying that they may not enter other areas or occupy new ones.

Clause 8 of the court-approved agreement provided: “While the auction and judicial-sale proceedings are being resolved, possession and administration of the land shall continue as they have until now. With respect to occupancy of the house, the defendants shall continue using it until the property is awarded.” The record neither establishes nor makes clear what is meant by “possession and administration of the land shall continue as they have until now”; however, the remainder of the clause indicates that the plaintiffs in this action would continue to have use of the dwelling house, provided that the property was not awarded to another person. But that agreement was not the only one addressing possession of the property. The following provisions also did so: 7) In the event that no sum whatsoever is offered for the real property at issue in this litigation, the case shall be terminated and the parties shall resort to such procedures as they deem appropriate for the administration of jointly owned property and the termination of co-ownership (copropiedad). 9) The defendants are authorized to dispose of the water tank, furniture, firewood, the structure located between the dwelling house and the corral, where the kitchen is located, as well as two washbasins in the structure, which has an earthen floor, and the granary adjoining that structure. 11) Any improvement made to the real property shall become part of the property through accession (accesión), without any right accruing to the person who made it.

In addition to those agreements, it must be borne in mind that in 2015, when the judicial inspection was conducted, the property was leased to a third party, and the record does not show that this situation has changed or that a third party has been awarded the property at auction. Accordingly, this Court finds that the order must be adjusted so as not to infringe the plaintiffs’ constitutional rights, because they are currently co-owners of the property, and also in light of the agreement reached in the 2012 proceedings. In that regard, the plaintiffs must neither be prevented from entering the property nor have their movement restricted to a particular sector, because, as co-owners, they may enter it in the exercise of the incidents of ownership, provided that they neither abuse their rights nor damage existing property, particularly property belonging to third parties, such as the aforementioned tenant, and provided that they do not infringe any rights in rem over another’s property (derechos reales en bien ajeno) that the co-owners may have created (articles 45 Constitución Política and 264 to 266, 269, 270 Código Civil).

As agreed, they may use the structures and property referred to in clauses eight and nine of the settlement agreement and may enter the land in the manner indicated. The second interim order prohibits them from introducing new crops, replanting, undertaking construction, stockpiling construction materials, impairing the property, or changing its designated use. This order must also be qualified in the same manner as the preceding one, because the evidence established that the property was leased to a third party, at least in 2015, and there is no evidence regarding the duration or term of that agreement, nor regarding how or by whom the property was operated or administered—apart from the house, which the plaintiffs were acknowledged to occupy—before this complaint was filed. The answers state only that the property is used for livestock, has temporary crops and no forest, has been maintained by the defendants since 2012, and that the plaintiff and her daughters have lived in the house (pleadings folder: file 10/07/2018 15:13:14).

Because the property is co-owned, and given the disputes among the co-owners and the purpose and content of the aforementioned settlement agreement, it is reasonable for the restrictions against substantially altering the nature of the land to be imposed on all co-owners, not solely on the plaintiff. Because the system governing use or administration of the disputed co-owned property before the aforementioned agreement is unclear, except with respect to use of the house and the other property cited in clauses 8 and 9, all parties’ use of the property must be restricted accordingly, without imposing specific prohibitions solely on some of the co-owners. Furthermore, clause 11 provided that “any improvement made to the real property shall become part of the property through accession, without any right accruing to the person who made it.” Accordingly, the second order under review must be modified as follows: While these proceedings remain pending, unless a supervening circumstance alters the condition of the disputed real property or the parties’ co-ownership relationship with respect to it, the plaintiffs are authorized to use what exists on the property in the manner agreed in clauses eight and nine of the agreement, without thereby being permitted to destroy anything existing there or abuse the exercise of their rights as co-owners.

Nevertheless, to maintain procedural balance and given the purpose of the aforementioned agreement, within the scope of the agreed use, until these proceedings conclude and while the parties remain co-owners of the land, they may neither change the current nature of the land (pasture areas with the aforementioned structures) nor damage or adversely affect property and environmental resources, under the same terms imposed on the defendant party. In view of the modifications indicated, it is clarified that, because it was not appealed, the order requiring the defendant parties to permit and not obstruct the plaintiffs’ access to the cultivated areas remains in effect; this access also extends to the remainder of the property, subject to the conditions indicated. This Court also emphasizes that, because no appeal was filed concerning them, it modifies only those aspects of the sua sponte interim orders imposed on the defendant parties that relate to or are affected by the changes indicated in response to the plaintiffs’ appeal.

VII.In accordance with the foregoing, with respect to the matters appealed, the appealed interlocutory judgment (auto-sentencia) is partially reversed solely insofar as it provides: a) “The defendants [Nombre3], [Nombre4], [Nombre4], [Nombre6], [Nombre5], [Nombre7], [Nombre17], [Nombre18], known as [Nombre9], are ordered to allow the plaintiffs to enter the aforementioned section of land so that they may perform maintenance work and harvest and remove produce from the existing corn and bean crops, with the warning that, in the event of noncompliance, criminal proceedings may be brought against them for the offense of Disobedience of Authority.” b) The plaintiffs must strictly limit their conduct to entering the cultivated section of land and the area agreed upon in approved settlement judgment (sentencia homologa) number 48-2015; they may not move within the property to other areas or occupy new or different areas.

As a prohibitory measure (medida inhibitoria), they are expressly warned that they must not expand the planted areas or introduce crops other than those already existing, nor construct anything of any kind or stockpile construction materials, nor cause deterioration to the property or change its designated use; they may perform replanting work, but are not authorized to plant trees, construct anything of any kind or stockpile construction materials, nor cause deterioration to the property or change its designated use. Instead, the following is ordered while this proceeding remains pending or while co-ownership (copropiedad) of the property in dispute continues: a) The defendants [Nombre3], [Nombre4], [Nombre4], [Nombre6], [Nombre5], [Nombre7], [Nombre17], [Nombre18], known as [Nombre9], must allow the plaintiffs to enter the entire property in dispute (located at [Dirección4], registered under number CED23, as undivided interests), particularly the areas where the bean and corn crops were located, for their maintenance and harvesting.

They must refrain from obstructing the plaintiffs’ entry onto and movement throughout the property, with the warning that, in the event of noncompliance, criminal proceedings may be brought against them for the offense of Disobedience of Authority. b) Within the scope of the use agreed upon in the court-approved settlement (conciliación homologada) under judgment 48-2015, issued in ordinary proceeding (ordinario) 12-000115-1129 AG, the plaintiffs are prohibited from changing the current nature of the land (pasture areas with the aforementioned structures) or damaging or affecting environmental assets and resources, in the same manner and subject to the same warnings imposed upon the defendants. In all other respects not modified herein, the precautionary relief ordered by the Court on its own motion remains in effect, subject to the warnings stated in the appealed ruling. Solely for criminal-law purposes, the Court shall commission the appropriate authority to serve this ruling upon all parties, given that the aforementioned modifications are material and the warnings carry potential criminal consequences.

For procedural purposes, this ruling shall be served through the means designated by the parties for receiving notices in this matter. To avoid future procedural nullities, the trial court shall take note of the matters stated in the sixth recital (considerando sexto) concerning review of the claims and whether they may be joined, as well as the required joinder of necessary defendants (litis consorcio pasivo necesario), if applicable, once the foregoing issue has been resolved.

THEREFORE (POR TANTO) As to the matters appealed, precautionary interlocutory judgment (autosentencia cautelar) 119 of 15 de junio de 2018 is partially reversed solely insofar as it provides: a) “The defendants [Nombre3], [Nombre4], [Nombre4], [Nombre6], [Nombre5], [Nombre7], [Nombre17], [Nombre18], known as [Nombre9], are ordered to allow the plaintiffs to enter the aforementioned section of land so that they may perform maintenance work and harvest and remove produce from the existing corn and bean crops, with the warning that, in the event of noncompliance, criminal proceedings may be brought against them for the offense of Disobedience of Authority.” b) The plaintiffs must strictly limit their conduct to entering the cultivated section of land and the area agreed upon in approved settlement judgment number 48-2015; they may not move within the property to other areas or occupy new or different areas.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las once horas y dieciséis minutos del veintisiete de setiembre de dos mil dieciocho.- MEDIDA CAUTELAR EN PROCESO ORDINARIO interpuesto por [Nombre1] , casada, de oficios domésticos, vecina de San Isidro del General, cédula CED1 ; [Nombre1] , soltera, de profesión desconocida, vecina de Buenos Aires de Puntarenas, cédula CED2 ; [Nombre2] , viuda, de oficios domésticos, vecina de Pejibaye de Pérez Zeledón, cédula CED3 ; contra:

El proceso es tramitado ante el Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón.- Redacta la Jueza Alpízar Rodríguez, y;

CONSIDERANDO:

I.Se aprueban los hechos probados por estar conforme con la prueba que consta en autos en esta fase del proceso y ser de interés para resolver la medida, con las siguientes adiciones. Al

  • 1)se agrega: es terreno de agricultura y potrero, ubicado en [Dirección1] , . Colinda registralmente al norte, sur y este con [Nombre12] y oeste: [Nombre13] . Adicionar a los elementos probatorios: pretensiones de escrito de demanda. Al 2): El proceso 12-000115-1129AG es un ordinario, en el cual las personas demandadas en este asunto eran las accionantes y las actoras las demandadas. Se terminó por acuerdo conciliatorio homologado en sentencia firme 48 de 11 de marzo de 2015. En lo que interesa acordaron:
  • 1)La finca se rematará en tres subastas para determinar el posible comprador.
  • 2)La base del primer remate será doscientos millones de colones, la del segundo ciento cincuenta millones de colones y la del tercero (no se lee la cantidad porque el sello de la copia se sobrepone a ese dato).
  • 3)Las personas participantes en los remates deberán depositar el veinticinco por ciento de la suma establecida para cada uno. De adjudicarse el bien, deberán depositar la diferencia en ocho días hábiles, a partir de la fecha del remate.
  • 4)Si no se completase la diferencia (por la cual se adjudicó el remate) en el tiempo establecido, perderá lo depositado y ese monto se dividirá en ocho partes iguales, que se girarán a las personas copropietarios que representen un octavo del dominio de la propiedad. En el caso de [Nombre1] (derecho 009), [Nombre1] (derecho 010) y [Nombre2] (derecho 011), estas tres últimas definirán por medio de escrito judicial la forma en que se girará la proporción correspondiente a cada una, entendiéndose que a estas tres últimas les corresponde en conjunto un octavo del dominio de la propiedad.
  • 5)En caso de aprobarse el remate, el monto del precio depositado en la cuenta del Despacho se girará en las mismas condiciones del punto anterior.
  • 6)Si en el tercer remate no se presentan posturas o los remates han sido declarados insubsistentes, se otorgará un plazo de tres meses para que cualquiera persona interesada deposite en la cuenta del Despacho un monto no inferior al precio del tercer remate, y en tal supuesto se le adjudicará la finca.
  • 7)En el eventual supuesto que no se ofrezca suma alguna por el inmueble de este litigio, la causa se dará por finalizada y las partes recurrirán a los procedimientos que consideren convenientes para la administración de cosa en común y la resolución de la copropiedad.
  • 8)Mientras el proceso de remate y venta judicial se define, la tenencia y la administración de la tierra seguirá manteniéndose como hasta ahora. Con relación a la habitación de la casa las demandadas continuarán haciendo uso de la misma hasta la adjudicación de la propiedad.
  • 9)Las demandadas quedan facultadas para disponer del tanque de agua, los muebles, la leña, la edificación que se encuentra entre la casa de habitación y el corral, donde se encuentra la cocina, así como dos pilas, que es de piso de tierra y también la troja anexa a esta edificación.
  • 10)Las partes renuncian a cualquier reclamo con relación a la administración de la cosa en común, desde la fecha en que adquirieron su derecho hasta el día de hoy.
  • 11)Cualquier mejora que se realice en el inmueble será accedida por la finca (accesión) sin derecho alguno por parte de quien la realice.
  • 12)Las partes se comprometen a mantener respeto, a no alterarse, ofenderse o agredirse mutuamente.
  • 13)La almoneda judicial se practicará, en lo no establecido en este convenio, conforme al procedimiento de la Ley de Cobro Judicial.
  • 14)Se dio por terminado el ordinario principal base del acuerdo. Al hecho probado
  • 3)se agrega: En el terreno existía también, en junio de dos mil quince, además de los cultivos referidos, una casa de habitación con un aposento externo para cocina de leña; un corral que estaba siendo utilizado, según la parte actora y la demandada [Nombre5] por el arrendatario [Nombre14] . Existe una quebrada y una naciente. Se encontraban pastando también cuarenta y dos reses, que se informó pertenecían a dicho señor, pues arrendaba la finca.
  • 4)La presente demanda ordinaria aparece anotada desde el dos de junio del dos mil quince, en los asientos registrales de la finca citada, en cada derecho de las partes del proceso (imágenes 115 a 134 en carpeta de documentos asociados: archivo 23/07/2018 14:43:26).
  • 5)En resolución del 5 de junio del 2015, emitida en el proceso 12-000115-1129AG, se señala fecha para remate de la finca, a celebrase el dos de agosto del dos mil dieciocho, soportando la anotación de demanda del presente asunto (imagen 135 en carpeta de documentos asociados: archivo 23/07/2018 14:43:26).

II.Para efectos de resolver la medida cautelar y la apelación interpuesta, en esta fase del proceso, se tiene por indemostrado lo siguiente: 1/. El resultado del remate citado en el último hecho probado o si se pudo llevar a cabo.

III.Conoce este Tribunal del recurso de apelación planteado por la parte actora contra el auto-sentencia 119 15 junio 2015, que rechazó la medida cautelar solicitada por ella referida a que se les pusiese y mantuviesen en posesión del terreno en litigio y se les advirtiese a las personas demandados se abstuviese de perturbarles y desposeerles hasta que se resuelva este proceso. De oficio, se autorizó a las actoras el dar asistencia y mantenimiento adecuado a los cultivos de maíz y frijol hasta su etapa de cosecha y su posterior recolección, localizados en el sector del frente de la finca en litis. Se ordenó a todos los demandados, con el apercibimiento de que en caso de incumplimiento se le podrá seguir causa por el delito de desobediencia a la Autoridad, permitir el ingreso de las actoras a la sección de terreno referida, a fin de que realicen las labores de mantenimiento, recolección y sacado (sic) de frutos de los sembradíos de maíz y frijol existentes.

Deberán los accionados abstenerse de causar daños a los cultivos mencionados o ejecutar obras o actos que afecten el ejercicio normal de la actividad agraria desarrollada. Las actoras deberá adecuar su conducta estrictamente al ingreso a la sección de terreno cultivada y el área acordada en el sentencia homologa número 48 del 2015, no podrán desplazarse dentro de la finca a zonas distintas, ni ocupar nuevas y distintas áreas. Como medida inhibitoria, expresamente se les advierte que no deberán ampliar las áreas de siembra ni introducir más cultivos que los existentes, tampoco podrán realizar labores de resiembra, ni sembrar árboles, realizar construcciones de ningún tipo o acopiar materiales de construcción, lo mismo que a realizar desmejoras al inmueble o un cambio de destino. A los accionados, se le impone como restricción que deberá evitar la desprotección de las márgenes de la naciente y orillas del río de una de las colindancias, no deberán realizar talas o extracción de madera, quemas de vegetación o actividades que produzcan el cambio de uso de suelo y en general, acciones que puedan alterar la situación física y agroecológica del fundo en conflicto.

Todo lo anterior, bajo el apercibimiento de que en caso de incumplimiento, se cesará la autorización concedida y se le seguirá causa por el delito de desobediencia a la Autoridad, sin perjuicio de otras figuras delictivas que también pudieran presentarse, pudiendo ser procesado por dicha causa. Alega que: 1) Sin ninguna razón jurídica, basándose únicamente en un acuerdo conciliatorio que está siendo cuestionado en la demanda, se rechaza la medida. 2) Actuando ultrapetita, sin fundamento o razón para prevenir a las actoras adecuar su conducta al ingreso de la sección de terreno cultiva y el área acordada en la sentencia homologa (sic) 48-2015, se ordena que no podrán desplazarse a zonas distintas dentro de la finca, ni ocupar nuevas áreas. Además, se les advierte no deben ampliar áreas de siembra ni introducir más cultivos que los existentes, realizar resiembra, sembrar árboles, realizar construcciones de ningún tipo, acopio de materiales de construcción, desmejoras al inmueble o cambio de destino.

Consideran eso es equivocado, dado que lo que está en litigio es la totalidad de la finca y no las áreas cultivadas, aparte de que la sentencia de homologación está siendo cuestionada por vicios de nulidad. Pide se revoque la resolución recurrida, únicamente en cuanto deniega las medidas cuatelares solicitadas, se acojan tales y se revoque o anule lo que limita a las actoras a realizar y visitar ciertas áreas de la finca, por ser las pretensiones clareas sobre que se reclama toda la finca (carpeta de escritos: archivo 30/05/2018 14:06:54, imagen 20).

IV.Dado el contenido de los agravios, es importante recordar que el artículo 242 del Código Procesal Civil, aplicado supletoriamente con base en los numerales 6, 26 y 79 de la Ley de Jurisdicción Agraria, en concordancia con el 41 de la Constitución Política, disponen que, además de los procedimientos cautelares específicos o tipificados, se pueden imponer medidas precautorias adecuadas, cuando exista fundado temor de que una parte, antes de la sentencia, pueda causar al derecho de la otra parte una lesión grave y de difícil reparación. Ante ello, se faculta a quienes administran justicia, para autorizar o prohibir la práctica de determinados actos, ordenar el depósito de bienes o imponer el otorgamiento de una caución. Al respecto, la Sala Constitucional, en voto 3929 del 18 de julio de 1995, señaló: "...Las medidas asegurativas o cautelares, según la más calificada doctrina, surgen en el proceso como una necesidad que permita garantizar una tutela jurisdiccional efectiva y por ello se pueden conceptualizar como "un conjunto de potestades procesales del juez -sea justicia jurisdiccional o administrativa- para resolver antes del fallo, con el específico fin de conservar las condiciones reales indispensables para la emisión y ejecución del acto final".

La doctrina entiende que la instrumentalidad y la provisionalidad son dos características fundamentales de las medidas cautelares y que sus principales elementos configurativos, exigen que deban ser : a) lícitas y jurídicamente posibles; b) provisionales, puesto que se extinguen con el dictado del acto final; c) fundamentadas, es decir, tener un sustento fáctico real con relación al caso particular; d) modificables, en el sentido que son susceptibles de aumentarse o disminuirse para adaptarlas a nuevas necesidades; e) accesorias, puesto que se justifican dentro de un proceso principal; f) de naturaleza preventiva, ya que tienen como objeto evitar inconveniencias a los intereses y derechos representados en el proceso principal; g) de efectos asegurativos, al pretender mantener un estado de hecho o de derecho durante el desarrollo del proceso, previniendo situaciones que puedan perjudicar la efectividad de la sentencia o acto final; h) ser homogéneas y no responder a características de identidad respecto del derecho sustantivo tutelado, con el fin de que sean medidas preventivas efectivas y no actos anticipados de ejecución" (ver voto 1322-F-11 de este Tribunal del 24 de noviembre del 2011).

En materia agraria, sobre los fines de las medidas cautelares atípicas, además de lo explicado, se ha resaltado que debe también velarse porque no se ponga en peligro la continuidad de la producción y la protección de los recursos naturales. Las medidas se toman con carácter preventivo, en garantía de los intereses de la colectividad y para no hacer nugatorios los resultados de los procesos. Pueden ser decretadas de oficio o a instancia de parte. Son provisionales, por lo que pueden variar o quedar sin efecto durante el transcurso del proceso o al finalizar éste. Los presupuestos que se deben de cumplir para dictarlas se resumen en: a) La residualidad (que no exista otra vía para su tutela provisional); b) La apariencia de buen derecho, en el sentido que lo solicitado como medida y lo pretendido en la demanda tenga probabilidad de ser tutelable en nuestro ordenamiento jurídico, que no sea ilegal; c) El peligro de demora, que significa que deben acogerse cuando sea necesario para evitar daños irreparables o alguna lesión grave a alguna de las partes antes de que se falle el asunto.

Su fin es evitar dentro de lo límites de lo posible, aquellas alteraciones en el equilibrio inicial de las partes que puedan derivar de la duración del proceso. De ahí el carácter instrumental de esta medida, que no existen por sí solas sino en función del proceso principal (voto 769 del 13 de noviembre de 1998 de este Tribunal). Para valorar esos presupuestos a la [Nombre4] de lo apelado, debe tenerse presente que las pretensiones de esta demanda, en lo que interesa es se declare la usucapión sobre media hectárea de terreno de la [Dirección2] de Cartago y se ordene su inscripción en el Registro Público. Se fundamenta en los artículos 92 y 101 de la Ley de Tierras y Colonización, entre otros.

V.Para resolver lo que es objeto de apelación es necesario revisar las pretensiones de fondo de la demanda y tener claro qué se pidió como medida cautelar por la parte actora. Se resumen como sigue dado lo confuso y reiterado de su exposición: a) se declare usucapión respecto de la finca de San [Nombre3] [Dirección3]; b) se declaren caducos los supuestos derechos de los demandados tendientes a reinvindicar su dominio; c) se inscriba a nombre de las personas actoras la finca citada; d) se prevenga a los demandados abstenerse de perturbar su posesión, con apercibimiento de seguírseles causa por el delito de desobediencia a la autoridad; e) se les condene al pago de mejoras (citan corral, casa, repastos, caminos, protección recursos naturales, preparación del terreno); f) se anulen todas las donaciones de las fincas referidas a ese asiento registral, especifican la presentada al tomo 2011, asiento CED12, hecha por [Nombre15] y los siguientes traspasos: 2011-00276266-01 en copropiedad de la siguiente forma (sic): submatrícula CED13 a nombre de [Nombre3] ; submatrícula CED14 presentada al tomo 2012-00018188-01 a nombre de [Nombre4] ; submatrícula CED15 presentada al tomo 2011-00276266-01 a nombre [Nombre7] ; submatrícula CED16 presentada al tomo; 2012-00171342,-01 a nombre de [Nombre4] , submatrícula CED17 presentada al tomo 2011-00276266-01 a nombre de [Nombre16] ; submatrícula CED18 presentada al tomo 2011-00276266-01 a nombre de [Nombre8] ; sub-matrícula CED19 presentada al tomo 2011-00276266-01 a nombre de [Nombre6] , submatrícula CED20 presentada al tomo 2011-00356331-01 a nombre de [Nombre1] , submatrícula CED21 presentada al tomo 2011-00356331-01, a nombre de [Nombre1] , submatrícula CED22 presentada al tomo 2011-0035-6331, a nombre de [Nombre2] ; g) se regrese la titularidad de la finca referida a las actoras por partes iguales y se inscriba a su nombre; h) se les ponga en perfecta posesión formal y material de la finca citada; i) se declare nulo el proceso ordinario 12-000115-1129AG y la sentencia homologatoria 48 de 11 de marzo de 2015, el señalamiento a remate y lo actuado en ese proceso; j) se les mantenga como legítimas titulares del derecho de posesión sobre ese inmueble; k) se suspenda toda ejecución y proceso de despojo o remate hasta que se demuestre su posesión de buena fe; l) se declaren nulas las resoluciones administrativas tendientes a despojarles de la posesión del inmueble dentro del hipotecario (sic) 12-000115-1129AG; m) se condene a los demandados al pago de daños y perjuicios (no disfrute de la parcela, preocupación e impotencia por resolver este conflicto e indexación por los montos desde la presentación de la demanda hasta su efectivo pago).

En la demanda, la actora pide, dado que en el terreno existen actividades agrícolas (caña, repasto, maíz, frijos, hortalizas, ganado) y recursos naturales que se ven amenazadas: a) se prevenga a los demandados abstenerse de realizar actos perturbatorios y amenazas de despojo relacionadas con el lanzamiento de la finca, hasta que se resuelva el proceso; b) se informe en el ordinario 12-000115-1129AG sobre la existencia de este otro proceso; c) se anote la demanda al margen del asiento registral de la finca referida (ello fue ordenado en el auto de traslado del 25 de mayo de 2015 y consta en certificaciones registrales posteriores a esa resolución, que se anotó desde el 2 junio 2015 con las citas 800-00266294-01-0001-01); d) se suspenda el remate señalado en el expediente citado; e) se le mantenga en posesión del terreno en litigio hasta que finalice el ciclo de producción de los cultivos.

De no concederse eso, se prevenga a los demandados abstenerse de alterarlos o destruirlos y de introducir mejoras o accesión. f) se le nombre depositaria judicial para que cuide los cultivos y recursos ambientales hasta tanto exista sentencia firme en este proceso.

VI.Antes de analizar la medida cautelar apelada, es necesario, dado el contenido de las pretensiones, hacer las siguientes observaciones, para que el Juzgado revise procedimientos y haga las correcciones pertinentes, con el fin de evitar futuras nulidades (artículos 590 del Código de Trabajo y 26, 60 de la Ley de Jurisdicción Agraria):

  • 1)Deberá revisarse antes de continuar con la tramitación del proceso es si el elenco de pretensiones es acumulable en este proceso; si no lo son prevenir lo que corresponda conforme lo disponen los numerales 36 y 37 de la Ley citada y 123,124 Código Procesal Civil, aplicado supletoriamente. Si lo son pero son excluyentes, deberá prevenírsele que indique cuáles son las pretensiones principales y cuáles las subsidiarias. En el caso, varias pretensiones están en esa situación, por lo que por orden y debido proceso, debe subsanarse esa situación, tarea que le corresponde hacerla al tribunal de primera instancia. Al respecto se resalta que los numerales 36 y 37 citados permiten la acumulación de pretensiones cuando deban ser tramitadas conjuntamente y resueltas en una sola sentencia, a fin de que no se rompa la continencia de la causa o para evitar se produzcan fallos contradictorios. Remiten a lo dispuesto en los artículos 41, 123, 124 del Código Procesal Civil en todo aquello que fuese pertinente, resaltándose en tales que la acumulación de pretensiones es procedente cuando exista conexidad al menos en dos de sus elementos o sólo en uno si es la causa, no se excluyan entre sí, el procedimiento para resolverlas sea común y la persona juzgadora sea competente para conocer todas.

Inclusive, en caso de ser excluyentes, pueden acumularse como principales y subsidiarias. Cuando la desacumulación se ordena, de oficio o a petición de parte, el tribunal debe indicar expresamente en la resolución qué pretensiones no son acumulables entre sí, para que la parte actora pueda elegir cuáles mantiene y cuáles excluye en el plazo conferido por ley. Si lo hace correctamente, el Juzgado debe emitir una resolución en la que se tenga por cumplido ese trámite e indicar, por debido proceso, las pretensiones que en adelante serán objeto de debate. Si la parte no cumple lo prevenido o lo hace en forma incorrecta, manteniendo pretensiones no acumulables entre sí, el tribunal debe proceder como lo estipula el numeral 124 citado, ordenando tramitar las que corresponda de acuerdo con las circunstancias.

  • 2)El segundo aspecto que debe ser subsanado y para lo cual primero debe corregirse el tema de las pretensiones y su acumulación, es revisar que todas las partes que deben estar en el proceso figuren como tales. Esto por cuanto en varias petitorias se piden nulidades de actos e inscripciones de asientos registrales. Si las personas titulares o que participaron en esos actos no figuran como actoras o demandadas, debe integrarse la litis consorcio pasivo necesario con las faltantes. Tal es el caso de [Nombre15] , quien se cita participó en un acto de donación que se pide sea anulado. Se aclara la integración de la litis contra esa persona debe ordenarse una vez que se determine si las pretensiones relacionadas con tal son acumulables o no en este proceso. Por ello este Tribunal no puede ordenar la corrección de ese aspecto de una vez.

Pese a esos aspectos, esta Sede, por economía procesal y por la naturaleza del acto judicial apelado, puede conocer y resolver sin necesidad de esperar que sean subsanados. Sin embargo, lo que se decida en la medida analizada deberá posterior a esos actos que se ordena subsanar, ser revisado de oficio por el Juzgado, para efectos de sopesar si luego de resuelto el tema de la acumulación de pretensiones, la medida debe mantenerse en la forma como se dispuso. También se aclara que la resolución recurrida se resolvió en forma anticipada, dado que de las medidas atípicas se dio audiencia por tres días a las partes demandadas en el auto de traslado emitido el 25 mayo del 2015. La resolución recurrida fue dictada el 15 junio 2015. Para esa fecha faltaba aún de notificar a los codemandados [Nombre3] y [Nombre9] , conforme se expone en resolución del 1 julio 2015. El primero fue notificado hasta el 9 julio siguiente y el segundo se apersonó al proceso hasta el 30 de mayo de 2018. Sin embargo, ninguna de las partes demandadas objetó dicha situación ni presentó apelación contra lo resuelto, por lo que se entiende que el vicio queda subsanado y no amerita declarar ninguna nulidad procesal al respecto (numerales 194 a 197 del Código Procesal Civil, aplicados supletoriamente).

VII.El primer agravio no es de recibo. La jueza de instancia, al resolver las medidas atípicas, consideró lo que existía en el terreno cuando se hizo el reconocimiento judicial, que estaba alquilado a una tercera persona y lo que era objeto de debate. Por ello rechazó la medida de "reinstalación de las actoras". Pero además, se fundamenta en lo acordado en la conciliación homologada en el ordinario del 2012, especialmente en la cláusula octava, en la cual se dispone lo relativo a la tenencia y administración de la tierra y en otros acuerdos, por lo que considera eso resta apariencia de buen derecho a las peticiones cautelares de las accionantes. En cuanto al rechazo de la suspensión del remate, explica, eso también fue acordado en esa conciliación. Expresa otras razones que no comparte este Tribunal, referidas a que no se pueden enervar los efectos de un proceso de ejecución de sentencia a través de un ordinario, pues en situaciones excepcionales, algunas medidas pueden tener ese efecto.

Así como tampoco que las únicas causales de interrupción y suspensión de un proceso son las contenidas en los numerales 201 y 202 Código Procesal Civil. Pero en lo que si lleva razón la jueza de instancia es en considerar que para valorar la apariencia de buen derecho no puede dejarse de lado la existencia de la sentencia homologatorio 48-2015 y sus efectos jurídicos. Por ello, el alegato de la apelante de que se resolvió sin razón jurídica y que no podía basarse la A quo en el acuerdo conciliatorio, por estar siendo cuestionado en esta demanda, no es de recibo. Ese acuerdo tiene eficacia por haber sido homologado en firme y la solicitud de nulidad que se pretende en este asunto no lo vuelve ineficaz. Será en sentencia de fondo que se podrán analizar los argumentos de las accionantes referidos a su validez. Pero mientras ello no sea así, el acuerdo homologado surte efectos. Lógicamente la presente demanda puede incidir en ello, pero su interposición no elimina su existencia ni lo hace ineficaz.

Por ende, el rechazo de las medidas atípicas solicitadas en la demanda está debidamente fundamentado y no expresa la actora razones de peso ni acogibles para variar lo resuelto al respecto. Incluso, en relación con los efectos de este asunto en la ejecución de lo acordado en el ordinario del 2012, resalta este Tribunal que la demanda del 2015 está anotada en los asientos registrales de la finca en litigio, por lo que la publicidad frente a terceras personas ya surte efectos, sin que conste el remate del bien haya sucedido antes de esa anotación. Si alguna persona lo adquiere, ya conoce sobre la existencia de este asunto y las eventuales implicaciones jurídicas, en caso de que la demanda sea acogida. Lo relacionado con la tenencia del inmueble también fue un tema acordado en esa conciliación, por lo que lleva razón la jueza de instancia en cuanto a que no es procedente que a través de una medida cautelar y en función de lo debatido en el presente asunto, se varíe o modifique lo dispuesto al respecto por las partes.

VIII.En cuanto al segundo agravio, lleva parcialmente razón la apelante en cuanto a que las medidas impuestas de oficio deben ajustarse a lo acordado y no ser más gravosas para las actoras respecto de los demandados, en función de ello. Pero no puede calificarse de ultrapetita las ordenes cautelares que haya impuesto la jueza de primera instancia a cargo de las actoras, por cuanto las medidas cautelares se pueden imponer de oficio (artículos 26 Ley de Jurisdicción Agraria, 5 Ley Orgánica del Poder Judicial y 98, 242 del Código Procesal Civil). Lo que procede, conforme lo explicado, es analizar los alcances de las órdenes cautelares dadas a las accionantes, en función del acuerdo conciliatorio referido, lo debatido en el proceso y tomando en cuenta que está de por medio el ejercicio de un derecho fundamental, como lo es la propiedad privada. La primer orden cautelar de oficio limita el ingreso de las actoras a la sección de terreno cultivada y al área acordada en la sentencia homologada 48-2015, aclarando no podrán desplazarse a zonas distintas ni ocupar nuevas áreas.

En la cláusula 8 del acuerdo homologado se dispuso: "Mientras el proceso de remate y venta judicial se define, la tenencia y la administración de la tierra seguirá manteniéndose como hasta ahora. Con relación a la habitación de la casa las demandadas continuarán haciendo uso de la misma hasta la adjudicación de la propiedad". No consta ni queda claro que se debe entender por "tenencia y la administración de la tierra seguirá manteniéndose como hasta ahora", pero del resto de la cláusula se desprende que el uso de la casa de habitación continuaría a favor de las aquí actoras, siempre que no se adjudicase el bien a otra persona. Pero no solo ese acuerdo se refería a la tenencia del bien. También los siguientes: 7) En el eventual supuesto que no se ofrezca suma alguna por el inmueble de este litigio, la causa se dará por finalizada y las partes recurrirán a los procedimientos que consideren convenientes para la administración de cosa en común y la resolución de la copropiedad. 9) Las demandadas quedan facultadas para disponer del tanque de agua, los muebles, la leña, la edificación que se encuentra entre la casa de habitación y el corral, donde se encuentra la cocina, así como dos pilas, que es de piso de tierra y también la troja anexa a esta edificación. 11) Cualquier mejora que se realice en el inmueble será accedida por la finca (accesión) sin derecho alguno por parte de quien la realice.

Además de esos acuerdos, debe tenerse presente que en el 2015, cuando se realizó el reconocimiento judicial, la finca estaba arrendada a una tercera persona, sin que conste que esa situación haya variado, así como tampoco que una tercera persona se haya adjudicado el bien en remate. Por ende, considera este Tribunal que la orden debe ser ajustada, para no infringir derechos constitucionales de las actoras, pues son actualmente copropietarias del bien y también en función de lo acordado en el proceso del 2012. En ese sentido, no se le debe obstaculizar el ingreso a la finca a las actoras ni limitar su desplazamiento a un sector determinado, pues ellas como copropietarias pueden en el ejercicio de los atributos del dominio acceder a la misma, siempre que no abusen de su derecho ni causen perjuicio a los bienes existentes, más si son de terceras personas, como por ejemplo el arrendatario referido, ni tampoco infrinjan eventuales derechos reales en bien ajeno que las personas copropietarias pudieran establecer (artículos 45 Constitución Política y 264 a 266, 269, 270 Código Civil).

Conforme a lo acordado pueden hacer uso de las edificaciones y bienes referidas en la cláusulas octava y novena del acuerdo conciliatorio y acceder al terreno en la forma indica. La segunda orden cautelar les prohíbe introducir nuevos cultivos, resembrar o realizar construcciones, acopio de materiales de construcción y desmejoras o cambios de destino. También debe dimensionarse en igual sentido que la anterior, porque lo que se probó es que la finca estaba en arriendo a favor de una tercera persona, al menos en 2015 y no existe prueba de la duración o plazo de ese contrato, así como tampoco de cómo o quien es el que explotaba o administraba la finca (salvo la casa que se aceptó ocupaban las actoras) antes de plantearse esta demanda, pues en la contestaciones lo que se dice es que la finca es ganadera, con cultivos temporales, sin bosque, que el mantenimiento lo han dado los demandados desde el 2012 y que en la casa ha vivido la actora y sus hijas (carpeta de escritos: archivo 10/07/2018 15:13:14).

Al ser un bien en copropiedad y dado los conflictos que existen entre las personas copropietarias y el fin y contenido del acuerdo conciliatorio referido, lo razonable es que las limitaciones de variar sustancialmente la naturaleza del terreno sean impuestas a todas las personas copropietarias y no solo a la actora. Dado que no queda claro cuál era el régimen de uso o administración de la copropiedad del bien en litigio, antes del acuerdo referido, salvo en cuanto al uso de la casa y los otros bienes citados en las cláusulas 8 y 9, debe limitarse a todas las partes el uso del bien en función de ello, sin hacer prohibiciones específicas a solo unas de las copropietarias. Además, en la cláusula 11 se acordó que "cualquier mejora que se realice en el inmueble será accedida por la finca (accesión) sin derecho alguno por parte de quien la realice". Por ello, la segunda orden analizada debe ser modificada como sigue: Se autoriza a las actoras, mientras dura este proceso, salvo que alguna situación sobreviniente modifique el estado del bien inmueble en litigio o la relación de copropiedad de las partes respecto de tal, utilizar lo que existe en el bien de la manera acordada en las cláusulas octava y novena del acuerdo, sin que por ello puedan destruir lo existente ni tampoco abusar del ejercicio de sus atributos como copropietarias.

Sin embargo, por equilibrio procesal y dado el fin del acuerdo referido, dentro del uso acordado, mientras finaliza este proceso y mientras se mantenga la copropiedad del terreno entre las partes, no podrán cambiar la naturaleza actual del terreno (áreas de pasto con las construcciones referidas) ni dañar o afectar los bienes y recursos ambientales, en la misma forma impuesta a la parte demandada. Se aclara, dadas las modificaciones indicadas, que se mantiene, al no ser objeto de apelación, la orden impuesta a las partes demandadas para que permitan y no obstaculicen el ingreso de las actoras a las áreas cultivadas, pero también al resto de la finca, en las condiciones indicadas. También se resalta que este Tribunal, por no haber sido apelado, solo modifica los aspectos de las órdenes cautelares de oficio impuestas a las personas demandadas, que se relacionasen o se viesen afectadas por los cambios indicados en función de la apelación de las actoras.

VII.De conformidad con lo expuesto, en lo que fue objeto de apelación, se revocar parcialmente el auto-sentencia recurrido únicamente en cuanto dispone: a) "Se ordena a los demandados [Nombre3], [Nombre4], [Nombre4], [Nombre6], [Nombre5], [Nombre7], [Nombre17] , [Nombre18] conocido como [Nombre9] , con el apercibimiento de que en caso de incumplimiento se le podrá seguir causa por el delito de Desobediencia a la Autoridad, permitir el ingreso de las actoras a la sección de terreno referida, a fin de que realice las labores de mantenimiento, recolección y sacado de frutos de los sembradíos de maíz y frijol ya existentes". b) Las actoras deberá adecuar su conducta estrictamente al ingreso a la sección de terreno cultivada y el área acordada en el sentencia homologa número 48-2015, no podrá desplazarse dentro de la finca a zonas distintas, ni ocupar nuevas y distintas áreas. Como medida inhibitoria, expresamente se le advierte que no deberá ampliar las áreas de siembra ni introducir más cultivos que los existentes, tampoco realizar construcciones de ningún tipo o acopiar materiales de construcción, lo mismo que a realizar desmejoras al inmueble o un cambio de destino podrá realizar labores de resiembra, ni se encuentra autorizado a sembrar árboles,realizar construcciones de ningún tipo o acopiar materiales de construcción, lo mismo que a realizar desmejoras al inmueble o un cambio de destino.

En su lugar se ordena, mientras se resuelve este proceso o se mantenga la copropiedad del bien en litigio: a) Deberán los demandados [Nombre3], [Nombre4], [Nombre4], [Nombre6], [Nombre5], [Nombre7], [Nombre17] , [Nombre18] conocido como [Nombre9] , permitir el ingreso de las actoras a toda la finca en litigio (ubicada en en [Dirección4] , , inscrita registralmente con el número CED23 , en derechos), especialmente a las áreas que tenían los cultivos de frijol y maíz, para su mantenimiento y cosecha. Deberán abstenerse de obstaculizar su ingreso y desplazamiento por la finca, con el apercibimiento de que en caso de incumplimiento se les podrá seguir causa por el delito de desobediencia a la Autoridad. b) Dentro del uso acordado en la conciliación homologada en sentencia 48-2015 emitida en el ordinario 12-000115-1129 AG, se prohíbe a las actoras cambiar la naturaleza actual del terreno (áreas de pasto con las construcciones referidas), dañar o afectar los bienes y recursos ambientales, en la misma forma y con iguales prevenciones impuestas a las partes demandada.

En lo demás no modificado, se mantiene lo resuelto de oficio cautelarmente, con las prevenciones indicadas en la resolución recurrida. Solo para los efectos penales, proceda el Juzgado a comisionar a la autoridad respectiva, para que se notifique esta resolución a todas las partes, dado que las variaciones referidas son relevantes y las advertencias se hacen con apercibimientos de orden penal. Para efectos procesales, esta resolución se notificará en los medios señalados por las partes para recibir las notificaciones de este asunto. Tome nota el Juzgado de instancia, con el fin de evitar futuras nulidades procesales, de lo indicado en el considerando sexto, en relación con la revisión de las pretensiones y su acumulabilidad y lo referido a la integración de la litis consorcio pasivo necesario, de ser pertinente, una vez resuelto el tema anterior.

POR TANTO

En lo apelado, se revoca parcialmente el autosentencia cautelar 119 de 15 de junio de 2018. únicamente en cuanto dispone: a) "Se ordena a los demandados [Nombre3], [Nombre4], [Nombre4], [Nombre6], [Nombre5], [Nombre7], [Nombre17] , [Nombre18] conocido como [Nombre9] , con el apercibimiento de que en caso de incumplimiento se le podrá seguir causa por el delito de Desobediencia a la Autoridad, permitir el ingreso de las actoras a la sección de terreno referida, a fin de que realice las labores de mantenimiento, recolección y sacado de frutos de los sembradíos de maíz y frijol ya existentes". b) Las actoras deberá adecuar su conducta estrictamente al ingreso a la sección de terreno cultivada y el área acordada en el sentencia homologa número 48-2015, no podrá desplazarse dentro de la finca a zonas distintas, ni ocupar nuevas y distintas áreas. Como medida inhibitoria, expresamente se le advierte que no deberá ampliar las áreas de siembra ni introducir más cultivos que los existentes, tampoco realizar construcciones de ningún tipo o acopiar materiales de construcción, lo mismo que a realizar desmejoras al inmueble o un cambio de destino podrá realizar labores de resiembra, ni se encuentra autorizado a sembrar árboles,realizar construcciones de ningún tipo o acopiar materiales de construcción, lo mismo que a realizar desmejoras al inmueble o un cambio de destino.
