  1. 1The plaintiff files this ordinary action, valued at veinte millones ciento noventa mil colones, requesting that the judgment declare as follows: “a.- That on 3 de marzo de 2013, a fire occurred on the properties owned by the undersigned personally and by my principal, Inversiones [Nombre1] y Flores Sociedad Anónima, which were described in the third factual allegation of the complaint; the fire originated when the electrical lines collided due to the wind because they lacked line spacers, causing sparks from the lines to fall to the ground and start a fire that spread through the properties, burning an approximate area of 30 hectares of Transvala and Brachiaria Brizantha pasture, thereby burning all the grazing fields and causing a loss of veinte millones ciento noventa mil colones, which amount I request be paid as compensation to my principal and to the undersigned personally, in proportion to the areas indicated for the properties. b.- That the defendant’s negligence, carelessness, and recklessness in failing to take care to provide proper maintenance to the electrical lines located in front of the properties caused the fire in the pastures when the electrical lines collided, due to a lack of foresight in properly maintaining them. c.- That the defendant be ordered to pay the damages and lost profits (daños y perjuicios) caused, as well as interest at the Basic Deposit Rate of the National System (Tasa Básica Pasiva del Sistema Nacional), calculated from the time the events occurred, 03 de marzo de 2013, until actual payment. d.- That the defendant be ordered to pay both categories of costs (ambas costas) of this action.Damages and Lost Profits: Damages: The damage sustained by my principal and the undersigned on the properties consists of the fact that the property measuring [Dirección1] metros con 48 decímetros cuadrados, which was planted with Transvala grass, produced 400 bales per hectare; damage was sustained because the grass could not be cut to make bales, nor could those grazing fields be used to feed my cattle, resulting in damage of 400 bales per hectare, valued at ¢1.900,00 each, without counting the width, for estimated damage of ¢19.760.000,00. The second property, measuring 39.284 metros con 63 decímetros cuadrados, was planted with Brachiara Brizantha and was intended for use as pasture, with a capacity of 6 head per hectare per month; its yield supported the maintenance of 6 head per hectare over 3 months, and the loss or damage under this heading is estimated at ¢430.000,00. Lost Profits: The lost profits consist of the income that I, personally and in my capacity as legal representative of the plaintiff Inversiones [Nombre1] y Flores Sociedad Anónima, failed to receive from producing 400 bales per hectare on the property planted with [Dirección2] grass, and, on the second property, from the use I could have made of it to maintain 6 head of cattle per hectare for a period of 3 months; I estimate these lost profits at a total of veinte millones ciento noventa mil colones.” (folios 29 to 34).-
  2. 2The defendant, having been duly served, answered the complaint filed against it in a timely and proper manner, as shown at folios 43 to 44, and raised the defense of lack of legal entitlement (excepción de falta de derecho).-
  3. 3The Instituto de Desarrollo Rural entered an appearance under the terms set forth at folio 53 and states that it has no interest in being a party to this proceeding and therefore waives future notices.-
  4. 4Judge Walter Ávila Quirós of the Agrarian Court of the Second Judicial Circuit of Guanacaste, Santa Cruz, by judgment N° 210-2016, issued at catorce horas y treinta minutos del treinta de agosto de dos mil dieciséis, ruled: “THEREFORE (POR TANTO): In accordance with the cited facts and law, the complaint filed by [Nombre1], personally and as representative of INVERSIONES [Nombre1] Y FLORES SOCIEDAD ANÓNIMA, against COOPERATIVA DE ELECTRIFICIÓN RURAL DE GUANACASTE RESPONSABILIDAD LIMITADA, represented by [Nombre2], both of whom have the particulars appearing in the record, is granted. Accordingly, the following is declared:1) On 3 de marzo de 2013, a fire occurred on the properties owned by the undersigned personally and by my principal, Inversiones [Nombre1] y Flores Sociedad Anónima.2) The fire originated from the collision of the electrical lines due to the wind because there were insufficient line spacers to prevent contact, thereby producing sparks that, upon coming into contact with the grass on the property, started the fire that burned the Transvala and Brachiaria Brizantha pastures located on the plaintiff’s properties.3) The defendant’s negligence, carelessness, and recklessness in failing to take care to provide proper maintenance to the electrical lines located in front of the properties caused the fire in the pastures when the electrical lines collided, due to a lack of foresight in properly maintaining them.4) The defendant is ordered to pay damages and lost profits, with the amount to be determined in subsequent proceedings (en abstracto), including payment of statutory interest from the date this judgment becomes final.5) The defendant is ordered to pay the attorney fees and procedural costs (costas personales y procesales) of this action. The defense of lack of legal entitlement raised by the defendant is denied.” (folios 119 to 127).-

5. In the conduct of the proceeding, all legal requirements have been observed, and no errors or omissions capable of rendering the judgment null and void are apparent.- Drafted by Judge Castro García; and, CONSIDERING (CONSIDERANDO):

I.Proven facts (hechos probados). The list of facts deemed proven is adopted because it is consistent with the evidence contained in the record. The following fact is added: 6) Two days after the fire of 3 de marzo del 2013, the Cooperativa’s technicians appeared to inspect the wiring and, two days later, installed a third spacer at the location where the sparks had been generated. (testimony of [Nombre3], [Nombre4], and [Nombre5] on the compact disc forming part of this proceeding).

II.Unproven facts (hechos no probados). The following unproven fact is added at this appellate level: 1) It was not established that the wiring owned by the Cooperativa was in optimal condition on 3 de marzo del 2013 or before that date. There is no evidence in this regard.

III.The defendant Cooperative filed an appeal (recurso de apelación) (pages 130 to 133) against first-instance judgment number 210-2016 of 14:30 hours on 30 de agosto del 2016 (pages 119 to 127), which granted the claim brought against it and ordered payment of the damages caused by a fire resulting from improper maintenance of the electrical lines. It first expressed disagreement by stating that, from the statement of facts in the complaint, it was proven only that on 3 de marzo del 2013 a fire occurred on two properties owned by the claimant and caused damage. The cause of the fire was not determined, since the record contains only documents from the Cuerpo de Bomberos reporting the incident on the stated date, its location, and a description of the events, without identifying causes or responsible parties. Nor was an expert examination (pericia) ever requested for those purposes. It argues that the challenged decision stated that the condition of the electrical lines made plausible the theory that the cables collided, producing sparks that fell onto the grass and started the fire.

But this is merely a possibility, without any certainty whatsoever. That assumption is unsupported by expert or technical evidence, and the decision is defective for lack of reasoning because it does not explain why a mere possibility warrants a judgment finding the Cooperative civilly liable as alleged. 2- It argues that the witness testimony does not establish the cause of the fire on that day and proceeds to describe what each witness stated. Regarding the statements of [Nombre6], it notes that he indicated that the cause of the incident did not affect the electricity at the location, since he stated that, after it had begun, he continued watching television, and that service was supplied by the appellant. Otherwise, the electrical service would have been interrupted before the flames began, as explained by the expert witness (testigo experto) in the field, [Nombre7]. It states that all witnesses agree that the fire occurred at approximately noon and that the electrical service was operating normally, even after the flames began.

Regarding the statements of [Nombre8], it notes that he stated that the incident had begun and that the Bomberos arrived and managed to extinguish it, but that he was not present when it began and did not observe its causes. The judgment disregarded the fact that the witness had observed nothing on the day of the events and gave weight to his testimony concerning what occurred days later, using it to infer future events in clear violation of the rules of reasoned evaluation of evidence (reglas de la sana crítica). Regarding the testimony (deposición) of [Nombre4], it states that he learned of the event two or three days afterward and therefore could not determine what had occurred; he asserted that, at that time, he observed the electrical-line cables rubbing against each other, generating a spark that fell to the ground and burned it slightly. The appellant asserts that this witness clarified that everyone had thought the fire originated from pieces of glass and that they were therefore looking for them, until a wind event caused the cables to rub together and produce a spark.

This led him to conclude that this might have been the cause of the fire. In this regard, it states that this is an assumption about something that may or may not have occurred, but that was not observed when the events took place and was not shown to have occurred on the day of the fire. It contends that the most significant aspect of this testimony is that the witness learned of the events two or three days later, meaning that he was not an eyewitness, and characterizes his statement as false because, had sparks been produced, the electrical system would have shut down; this did not occur, according to the statements of witness [Nombre4] and the technical explanation given by witness [Nombre9]. It states that [Nombre4] made an incorrect assumption. It reiterates that the events did not occur as he concluded, because the electrical service was not interrupted. Here too, the judgment failed to consider that the witness was absent on the day of the event.

Regarding the statements of witness [Nombre10], it alleges the same errors because she was not at the site and her knowledge derives from what [Nombre4] told her. It also refers to the statements of [Nombre7], which have technical value and indicated that the cables were properly tensioned and maintained, and that the alleged cause could not have caused the fire; yet this testimony was disregarded in favor of assumptions and gossip. Third, it argues on appeal that the absence of spacers alone cannot establish, as alleged in the relief sought (pretensión), that the wind caused the fire by making the cables collide. It states that no one observed or testified that sparks were produced and fell to the ground, causing the incident. Nor was it established that the fire resulted from recklessness, carelessness, or negligence. There is no evidence in that regard. It alleges that, in two lines on page 126, the judge purported to substantiate his decision by stating that the causal link (relación causal) between the alleged conduct and the resulting damage had been proven, characterizing the defendant as negligent for having loose cables without sufficient spacers to prevent them from rubbing together.

It states that the court of first instance (a quo) deemed this proven based on observations made years later, although it was impossible to determine the condition of the cables when the events occurred, and attributed causation casually and through assumptions. It did so without the support of any expert examination or technical opinion. Fourth, it states that the evidence must be analyzed conscientiously, with reasons given for what should and should not be deemed proven based on the evidentiary record (acervo probatorio), rather than on assumptions and speculation. It therefore disagrees with the weight given to the testimony of [Nombre4] and [Nombre10] concerning the claim that the fire was caused by sparks resulting from the cables rubbing together, without analyzing the fact that the electrical current continued uninterrupted. Instead, the court chose to base its ruling on gossip and assumptions. It also requests exemption from costs because it acted and litigated in good faith.

IV.This proceeding concerns strict non-contractual liability (responsabilidad extracontractual objetiva) and created risk (riesgo creado). Article 1045 of the Código Civil provides: “Anyone who, through willful misconduct, fault, negligence, or recklessness, causes harm to another is obligated to repair it and compensate the resulting losses.” This constitutes non-contractual liability (responsabilidad extracontractual), since it provides that anyone who engages in conduct of that nature is liable for its consequences. In the judgment under appeal, the essential reasoning cited recital III, On the Merits (considerando III Sobre el Fondo), stating that the judicial inspection (reconocimiento judicial) revealed loose cables at the time of the inspection and determined that, facing the public road, two electrical cables could be seen, one of which was supported on wooden poles with three spacers and was found to be loose.

It was concluded that this reflected inadequate maintenance of the lines by the defendant Cooperative. The judgment reasoned that this supported the possibility of the theory that the fire was caused by contact between the cables, which generated sparks that fell to the ground, and that this was consistent with the report of the Cuerpo de Bomberos and the witness testimony. The challenged decision thus held that this evidence established the causal link between the conduct alleged against the defendant and the damage suffered by the claimants, because the cables were loose and lacked sufficient spacers to prevent them from rubbing together. The defendant’s conduct was therefore characterized as negligent, and it was held civilly liable for the financial losses suffered by the plaintiff. Based on an analysis of the case file, the evidence contained therein, and the subject matter of this dispute (litis), this Chamber finds that the judgment on appeal must be affirmed; the objection alleging insufficient reasoning regarding proof of the causal link claimed by the plaintiff is without merit.

V- First, the subject matter of these proceedings concerns objective non-contractual civil liability (responsabilidad civil extracontractual objetiva), as the complaint alleges that the fire on the claimant’s properties resulted from the condition of the electrical cables located between poles number [Dirección3] and [Dirección4], which lacked separators between them, causing the cables to collide and generate sparks when moved by the wind; those sparks fell to the ground and started the fire, which spread through the affected area of the land covered with pasture. Non-contractual liability (responsabilidad extracontractual) presupposes the absence of a prior contractual relationship and is imposed upon a person who has caused legally relevant harm to another through fault or through the pursuit of a hazardous activity (actividad riesgosa). Its general legal basis is the duty not to cause harm to others, established in Articles 1045 through 1048 of the Código Civil and in the various special regulations governing each activity that creates a risk.

In the sub judice case, which concerns pecuniary damage (daño patrimonial) allegedly suffered by the claimant as a result of the activity carried out by the defendant Cooperative—namely, supplying electricity services to communities through electrical power transmission lines—and which is characterized as hazardous, it is appropriate to cite decision number 541-F-11 of this Court. That decision addressed the matter under discussion, referring to burning and aerial spraying as lawful hazardous activities that, by their very nature, inherently give rise to financial liability (responsabilidad patrimonial) when damage occurs. The legal and doctrinal analysis of the issue, as well as the consequences of reversing the burden of proof (inversión de la carga probatoria), is important. That judgment reasoned as follows: I) Finally, “the general provisions contained in Articles 1045 et seq. of the Código Civil regarding non-contractual civil liability apply supplementarily to this matter” (see judgment of the Sala Primera N°112 at 15:50 on 11 October 1995).

In the criminal sphere, the current Código Penal imposes a fine of 3 to 30 days on anyone who violates provisions intended to prevent fires or stop their spread (subsection 1 of Article 407), and on anyone who violates the rules governing the burning of weeds, crop residue, or other products of the land (subsection 2). V. Modern legal scholarship, for its part, has supported the objectivization of liability by recognizing risk, in addition to negligence and intent, among the factors for imputing and legally attributing damage. It has even been proposed that other objective factors be included: guarantee, equity, abuse of rights, and exceeding the limits of normal tolerance among neighbors. Damage is therefore viewed not from the perspective of the perpetrator’s act but from that of the injured party, with the aim of ensuring compensation for all unjustly caused harm. From another perspective, fault has been separated from the unlawfulness of the act, with greater importance being assigned to the latter.

“Once the equivalence between the unlawfulness of the act and fault was severed, the conduct acquired an autonomous character detached from the subjective aspect of the agent’s intent, becoming merely a means, cause, or connecting criterion between a person deemed liable and a particular harmful event for which compensation is due.” (Franzoni (Massimo), La Actividad peligrosa, in Responsabilidad por daños en el tercer milenio, Abeledo Perrot, Buenos Aires,1997, p.120). This is known as risk theory (Teoría del riesgo), which does not displace fault but supplements it, and may be summarized as the duty of anyone who creates a risk to compensate a third party for the harm it causes. “Risk is a basis for imputation when, due to the occurrence of certain causes and the performance of particular activities classified as dangerous, damage occurs. Damage under these circumstances must be compensated, not because its agent acted intentionally or negligently, but because the legal system must protect the community from the performance of dangerous activities, such that whoever carries them out incurs liability if damage is caused by their performance…

Liability arising from risk does not depend on the agent’s intent or fault but originates in the mere occurrence of damage resulting from the dangerous activity. This consideration entails a special evidentiary regime under which, by the mere pursuit of the unsafe activity, the agent’s fault is presumed, relieving the victim of the burden of proving wrongful conduct. It is incumbent upon the agent to rebut the presumption…” ([Nombre11] , Hecho imputable dañoso in Del daño, Editora Jurídica, 1° Ed,Colombia,2001, p.260). According to other authors, “the causal relationship (relación causal) is an element of both an unlawful act and a breach of contract that links the damage directly to the unlawful act and indirectly to the element of subjective imputation or objective attribution. It is the unifying factor that causes the damage and fault—or, where applicable, risk—to be integrated into the single act that gives rise to the obligation to compensate” (see [Nombre12] (), El perfil de la responsabilidad civil al finalizar el siglo XX in Responsabilidad por daños en el tercer milenio,Abeledo Perrot, Buenos Aires, 1997, p.24 a 26).

VI. The carrying out of burns—regardless of their purpose—is unquestionably a hazardous activity. Accordingly, consistent with the cited scholarship, the Sala Primera de la Corte Suprema de Justicia has clearly stated: “VII.- Burns may give rise to civil and criminal liability for the person who carries them out. Civil liability is governed by the Ley de quemas y Cercas divisorias, which establishes the obligation of anyone who carries out burns to pay the damages and losses (daños y perjuicios) caused as a consequence of the fire (Article 5, paragraph 4). The owner, possessor, or lessee of land that was prepared for burning at the time of the fire is presumed to be the person responsible for the burn… VIII.- The Sala Constitucional, through Voto N°3459 at 14 hours 42minutes on 20 [Nombre1] 1993, established the repeal of Article 5°, fifth paragraph, of the Ley de Quemas y Cercas Divisorias with respect to criminal liability…

The same Sala Constitucional (Voto N°439-I-95 at 14:36 on 22 August 1995) clarified the aforementioned judgment N°3459-93 to the effect that Article 5°, paragraphs 5°and 6, of the Ley de Cercas Divisorias y Quemas is repealed solely with respect to the criminal matters it contains… IX.- The regulations governing burns and fires follow the standard of objective liability (responsabilidad objetiva). Fault is presumed on the part of the person who created the conditions for the damage by assuming the risk of harming third parties through the burn or fire. The resulting damages and losses are borne by that person. The injured party is exempt from proving fault. The burden of proving the absence of fault lies with the person who carried out the burn or started the fire. This is a rebuttable presumption (presunción iuris tantum). Force majeure (fuerza mayor), fault of the victim (culpa de la víctima), or the act of a third party (hecho de un tercero) would constitute grounds for exemption from liability.

X. A person assumes a risk when, foreseeing the eventuality or possibility of damage, that person accepts the effects of the contingency. Liability is based on creating the risk of damage. By commencing the activity through the use of that person’s property, the person increases, heightens, or multiplies the potential danger. Even where the conduct may be lawful, the person who assumed the risk must always compensate for the damage. There is even greater reason to impose liability if the act results from unlawful conduct. An injured party cannot be required to bear damage resulting from conduct that the injured party did not initiate, unless the injured party placed himself or herself in a position to suffer the damage. A person who carries out a burn or starts a fire, even with authorization from the appropriate authority, cannot be exempted from liability. ….. … VIII.- Objective non-contractual agrarian liability (Responsabilidad agraria objetiva extracontractual).

There is also case law concerning objective non-contractual liability arising from aerial spraying activities in agriculture: “VII. Liability arising from damage caused to nature, whether resulting from an agricultural activity or any other type of activity, has universally always been considered objective in nature. This general principle of law has been broadly recognized in the most recent amendments to the Constitución, which introduced the right to a healthy and ecologically balanced environment, and the legislature adopted it even before those amendments and broadly reiterated it afterward, so that it is found throughout the environmental sector of the legal system. This standard has always prevailed since the earliest legal documents because the victim cannot be required to prove the causal nexus (nexo de causalidad), as is the case with subjective liability, when the person causing the damage has assumed a risk, even in the context of a lawful activity, if its possible effects include causing harm to third parties.

The case law of this Sala has ruled repeatedly on the issue of agricultural and non-agricultural burns that have harmful effects on neighboring or third-party properties, and has established the liability of a person who, while burning his or her own waste or weeds on his or her own property, causes harm to another, even if that person took every appropriate precaution to prevent the spread of the fire (judgments N° 112 at 15 hours 50 minutes and 113 at 16 hours, both dated 11 October 1995, and N°26 at 14 hours on 28 February 1996). Naturally, this position is now invoked as a general principle of law for environmental protection, and it is correct to characterize it as such. It is enshrined in the Bible itself, from which it passed into legal texts of the most diverse kinds, as exemplified by the entire Spanish tradition that has been so influential in our legal systems. The basis of this position is very simple.

This is not the subjective liability (responsabilidad subjetiva) provided for in Article 1045 of the Código Civil, because under that theory the injured party must prove the causal nexus between the harmful agent’s act and the losses suffered. Under objective liability, the mere existence of the damage establishes that the harmful agent is liable as the cause of that damage and must therefore compensate for the damages and losses caused by the agent’s conduct. This does not result from an arbitrary act but from pure logic, because anyone who, even through lawful conduct, assumes a risk involving danger must answer for all damage that such danger may cause. There are many examples. If a person handles gunpowder or any type of flammable material, whether in a factory, as part of a commercial activity, or for personal amusement, and an accident occurs that affects any neighbor, the injured party is not the one required to prove the causal nexus between the conduct undertaken and the damage caused; instead, the legal system presumes the fault of the person who assumed the risk and danger.

To be exempted from liability, that person could prove only that he or she was not directly responsible for the damage caused. The burden of proof is thus reversed, and the grounds for exemption—which could be applied by analogy in the environmental sphere—would be those provided for in the Ley General de la Administración Pública, which also establishes the objective liability of the State: ‘force majeure,’ ‘fault of the victim,’ or ‘act of a third party’ (Article 190). VIII. The record clearly established the damage suffered by the portion of the Teca plantation adjacent to the property planted with rice, with only a road separating the two properties. The first element required to establish compensable damage (daño resarcible) is therefore present: the existence of actual, certain, and effective damage.

Likewise, the infringement of a legally relevant interest warranting protection was deemed to have been proven.” (First Chamber of Cassation, No. 398 at 4:00 p.m. on June 6, 2001).

VI- With the foregoing understood, and this Court agreeing with the cited portion of the judgment under appeal in finding that providing electric service is a hazardous activity (artículo 1048 párrafo 4 del Código Civil), due to the transmission of high-voltage electricity through electrical wiring for the purpose of supplying the public electricity service, it is also deemed proven that the fire on the plaintiff’s properties did in fact occur, as recorded in Incident Certificate number 12659-2013 (page 3) and in the document entered into the record containing the expert report of the Organismo de Investigación Judicial prepared in criminal proceeding EXPN1 (pages 8 to 11), as well as in the fifth allegation of the complaint and the response thereto (pages 31 and 43). Furthermore, because the fire began near the public road and spread into the properties, according to the statements of the witnesses .....

(part of the case file preserved in digital format), an assessment of this evidence leads to the conclusion that the complaint must be granted. As noted, in cases of this nature, the reversal of the burden of proof (inversión de la carga probatoria) places that burden on the entity alleged to have caused the damage to the affected party’s property, and that entity must prove that the claimed causal nexus (nexo causal) between the conduct and the harm does not exist. In this case, the record includes the incident report of the Cuerpo de Bomberos and the document from criminal case file number EXPN1, which contains investigations conducted by the Organismo de Investigación Judicial. These establish that the fire occurred on 3 de marzo del 2013 and burned scrubland and pastures in an area then estimated at approximately thirty hectares used for cattle. The record contains a letter dated 2 de mayo del 2013 from the plaintiff to the defendant Cooperativa, in which he explains that his properties were devastated by a fire caused by sparks emanating from the continuous electrical cables of two utility poles, numbers 189/695 and 50000/134.

He also itemized the resulting damage (page 7). In letter number CG035-2013 dated 3 de octubre del 2013, the defendant responded to [Nombre1] that its technical and legal advisers were investigating the matter (page 15). On 5 de setiembre del 2013 (page 16), the plaintiff sent a letter to the Cooperativa setting out in detail the situation he had experienced, an account of the damage, and the documents that, in his view, substantiated what had occurred. In response, Coopeguanacaste stated that, after an exhaustive review, it rejected the proposal submitted to it because the complaint was inconsistent with its investigations (page 24). The record also contains a letter dated 19 de noviembre del 2013 addressed to [Nombre1] and [Nombre1] and Inversiones [Nombre1] y Flores S.A., stating that administrative file CG-035-2013 had been opened and explaining that the denial of their claims for damages (daños y perjuicios) was based on an objective and exhaustive analysis of the incident, which concluded that there was no causal connection between what occurred and the activity conducted by the Cooperativa.

It therefore denied all liability (page 27). The complaint was filed, and the defendant responded by denying any objective or subjective liability (responsabilidad objetiva o subjetiva) (pages 43 to 44). At the judge’s request, photographs previously taken by the Organismo de Investigación Judicial were entered into evidence. Two photographs are shown (pages 69 and 77 to 78): the first, as stated in the document, shows the electrical lines running parallel to the property fence, and the second shows the burned ground. At the trial and judicial inspection (reconocimiento judicial), testimony was given by persons who stated that they had witnessed the fire. Although they were not present when it began, they described important details concerning the absence of anything that could have caused the cables to rub against one another, the temperature conditions, and the day and time. The judicial inspection recorded the matters cited in the judgment, which were not appealed, except insofar as the inspection was used to determine the condition of the wiring on the day of the fire, even though that judicial act took place on 19 de enero del 2016.

Regarding the condition of the wiring, the judge stated that he observed two electrical lines. One was mounted on wooden poles and consisted of insulated cable; it was approximately 9 meters and 10 centimeters from the fence and ran along the property boundary. He stated that this line had no spacers between the cable and the poles. That line connected to pole 2190 and had a transformer. The other electrical line was higher and had pole number 50000/123 within the property and near the fence. It was clarified that the distance between poles was approximately one hundred meters, and two spacers and the cables were observed. The distance between the spacers was ten meters, and one of the poles was observed to be bent and loose. He subsequently clarified that there were three spacers.

VII- In that regard, as stated in the judgment under appeal, the witnesses presented by the plaintiff were [Nombre13], [Nombre14], and [Nombre4], while those presented by the Cooperativa were Miguel [Nombre4] Gómez Corea and [Nombre15]. The witness [Nombre3], known as [Nombre8], stated, concerning the matters appealed, that he had been alerted to the fire on the day of the incident and that there had been strong winds in early March after noon. He knew that everything had burned because he went to the scene while it was in flames and people were watching the fire. Regarding its origin, he stated that after the incident they began looking for glass, and the OIJ personnel arrived at that time. Once everyone was inside, the cable sparked at the point where the cables were making contact, and it burned his leg. The OIJ representative, referring to a woman, called the Cooperativa to alert it about the cables, and its personnel arrived.

Using a ladder, they installed a spacer, the third one. This was the largest spacer currently visible. It was installed in the witnesses’ presence. He stated that by the time the Bomberos arrived, the area had already burned and that the fire was being driven by the wind. There were strong winds that day, and he observed sparks being emitted. Another fire had occurred at the same location in 2012. In response to opposing counsel’s questions, he stated that when the fire began, he was inside his house at [Dirección5]. After the fire, they searched for glass because, due to the heat, they assumed there might be some, but he had not observed the sparking. They began searching for glass two days after the fire, and it was then that they saw the sparks. The OIJ personnel arrived two days after the fire. This witness’s testimony establishes that sparks were indeed produced by the cables rubbing against one another and that a third cable spacer was installed at the location where the sparks were observed.

This is in addition to the presence of fire on 3 de marzo del 2013. The foregoing is consistent with the testimony of [Nombre4], who importantly stated that on the day the OIJ arrived in March 2013, he was sitting with Aldobrandy. The fire had occurred 2 or 3 days earlier, and they considered it important to look for glass. They entered the property and, while conducting that search, [Nombre1] arrived with other persons. Those persons were from the OIJ and took down their information. At that point, a gust of wind arose, the cables made contact, and sparks fell on them. The sparks were produced in the direction of the location where a spacer was subsequently installed. He clarified that he had not seen the fire itself, but assumed that the sparks had caused it. He stated that the search occurred at around noon. The fire was extensive and lasted several hours while the tree trunks gradually stopped burning.

Before the fire, the area was covered with grass that was used to make bales. While they were searching for glass and the OIJ personnel arrived to inspect and investigate the causes, the sparking occurred in their presence. They observed it and verbally stated that it was the cause. He identified the location of the sparking and stated that [Nombre8], [Nombre16], the OIJ personnel, and he were present when a strong gust was felt, the cables made contact with one another, and hot sparks broke off. One of them burned his leg. This occurred where there had been no spacer; a spacer was subsequently installed there by Coopeguanacaste’s own technical personnel, and they helped those technicians hold the ladder. He saw them install the spacer and leave, and did not see them write anything down. They stated that contact had indeed occurred at that location because the cables were burned. In response to opposing counsel, he stated that he told [Nombre17] he felt bad that [Nombre1] might think they had burned the property because they were neighbors.

It was only logical that the affected party might at least believe they could have caused it. They began searching in the area where there was no spacer because it was burned there and because they had been told that the fire had started there. He explained that he arrived where [Nombre17] was, they went in to search, and the vehicle carrying Mr. [Nombre1] and the OIJ personnel arrived afterward, and they got out. Approximately 15 minutes after the OIJ personnel left, the Cooperativa personnel arrived. This witness’s testimony is consistent with that of the preceding witness: although he arrived at the site after the fire had already begun, he was able to witness the sparking and the installation of the spacer. Likewise, [Nombre18] stated that he lives across from the affected property. He explained that in 2012 he was resting when he suddenly saw a fire and alerted [Nombre8] that the property was burning.

The owner’s children came to the scene, and another area burned. In 2013, while at home, he heard that the area was burning and called [Nombre8]. He had not observed anything at the outset. He explained that [Nombre4] arrived on Monday, they went to look for some indication of the cause of the fire, and he saw the OIJ vehicle arrive. While everyone was present, the cables struck one another and produced sparks. The Cooperativa personnel arrived and installed a spacer where the cables were making contact. He stated that the first fire occurred when no one was at the site, which surprised him. It was windy on the day of the second fire. They assisted the Cooperativa personnel, who installed a new spacer, and that portion of the area was burned. He clarified that he, [Nombre4], and [Nombre8] were searching for glass. His house is approximately [Dirección6] from the spacer, and before observing the sparks he had never made any complaint regarding the matter.

On the day of the fire, he was watching the news at home when a young man passed by and alerted him to the fire. This witness reiterated what occurred two days later when the cables rubbed against each other and burning sparks fell onto the plaintiff’s land. In addition, OIJ personnel came to the scene and called the Cooperativa, whose personnel arrived and installed another spacer. It should be noted that the aforementioned witnesses stated that a female OIJ official called the Cooperativa personnel so that they would respond to the sparking incident. In addition to these statements, testimony was given by [Nombre10], the substance of which is cited in the judgment under appeal and describes the production of sparks in the same manner as the preceding witnesses. This testimony establishes a matter of fundamental importance in proceedings of this nature: the existence of a fire hazard due to sparks generated by cables rubbing against one another, the temperature and wind conditions prevailing at the location, and the installation of an additional spacer by employees of the defendant company two days after the fire.

It is true that the witnesses did not observe the precise moment when the fire began on 3 de marzo del 2013, but they did observe what occurred after the fire had begun and personally witnessed the defendant’s employees installing a spacer because sparks were in fact being generated by the cables rubbing against one another.

VIII- The Cooperative offered the testimony of [Nombre7], an employee of Coopeguanacaste and an electrical technician. The lines were built in 2009, and nothing had ever happened; he believes that the events could not have been caused by them. He stated that branches are generally trimmed because they are the greatest problem and that the network is supervised. Regarding the incident, he only knows that it occurred. The old network still exists and carries high- and low-voltage electricity. The line of wooden utility poles is a secondary line and was installed for a group of houses. He explained that he has worked for the company for 39 years and in the Development Area since the eighties. He is unaware of any complaints concerning sparks caused by cables rubbing against each other. The wind shifts. In the pasture area, he has never received complaints in this regard. Of the cables, one has black insulation and another does not.

This is because some are telephone cables and fiber-optic cables belonging to cable companies unaffiliated with the Cooperative. All cables that transmit electricity have spacers to prevent them from rubbing against each other, and failure to install them causes problems. He says that this network has spacers. He believes that, given the installed equipment, the possibility of wind causing the cables to rub against each other is remote because they are separated by 20 centímetros and the voltage is low. He explained that most pasture fires are caused by cigarettes. He does not know whether the Fire Department investigated anything concerning the fire at issue. In response to the opposing party, he believes that the fire occurred in March, but he does not know the exact date and does not remember the wind conditions. Whenever a report is made, a crew is sent when the power supply is interrupted, and when the cables rub against each other, the power is disconnected.

He stated that he has not worked in maintenance and does not know whether Cooperative personnel came to the site, because he was not there that day. Regarding whether the spacer at the site was positioned vertically or horizontally, what matters is the insulation. On the date of the incident, the spacers should have been in place since their installation in 2009, pursuant to the line-construction manual, and an inspector verifies this. When asked whether the lines had been installed by marzo del 2003, he stated that they had. This testimony offered in defense (testimonio ofrecido en descargo) by the defendant does not refute the fact that, two days after the fire, the defendant’s technicians did in fact arrive and install an additional spacer because sparks were being generated. This Court (Instancia) concludes from that technical action by the Cooperative that the cables did in fact generate sparks when the wind caused them to rub against each other and that, given the windy conditions described by the witnesses and the temperatures typical of March in that area of the country, the risk of a fire from that cause was evident and real.

This Chamber finds it noteworthy that the defendant stated that it conducted technical investigations and opened an administrative file (expediente administrativo), which was not submitted, and that it likewise submitted no evidence concerning the actual condition of the wiring structure before 3 de marzo del 2013. The conditions described by the employee who testified merely set forth the technical standards that should have been met at the site to prevent incidents, but he had no personal knowledge of them because he was neither an inspector nor responsible for network maintenance. Nor does this rebut the statements of the cited witnesses that the Cooperative had to install an additional spacer at the location where the sparks occurred.

IX- The appellant states that, technically, when sparking begins, the electricity is cut off and that one of the witnesses stated that the electricity supply continued after the fire began. This has no evidentiary support other than the technical explanations of the preceding witness, who had no involvement either before or after the fire and who stated that, when the wiring has appropriate spacers, sparks caused by cables rubbing against each other are unlikely. It should be noted that the defendant bears the burden of proving that the alleged acts were not the causal nexus (nexo causal) between the conduct and the harm suffered, and it submitted no evidence capable of diminishing the weight of the witnesses’ testimony regarding the installation of an additional spacer and the existence of sparks before the third spacer was installed. Accordingly, the first through fourth grounds of appeal (agravios) concerning the failure to establish the cause of the fire and the erroneous assessment of the evidence (valoración probatoria) in the judgment under appeal, based on the evidence that the parties placed in the case record (autos), are without merit. The analysis provided is deemed correct. The judgment must therefore be affirmed in this respect.

X- The ground of appeal concerning costs (costas), insofar as the appellant seeks exemption from the payment ordered in the judgment under review, is rejected. In this case, the plaintiff’s complaint was granted, and under the objective loser-pays principle (vencimiento objetivo) and article 54 of the Ley de Jurisdicción Agraria, the losing party is responsible for paying the costs of the proceeding.

XI- Based on the reasons stated, the decisions cited, articles 1 and 2 of the Ley de Jurisdicción Agraria, and sections 1045 and 1048 of the Código Civil, the judgment under appeal is affirmed as to the matters appealed.

As to the matters appealed, judgment number doscientos diez- dos mil dieciséis, issued at catorce horas treinta minutos del treinta de agosto del dos mil dieciséis, is affirmed.

  1. 1La parte actora interpone la presente demanda ordinaria estimada en la suma de veinte millones ciento noventa mil colones, solicitando que se declare en sentencia lo siguiente: "a.- Que el día 3 de marzo de 2013, se produjo un incendio en las fincas propiedad del suscrito en lo personal, y de mi representada Inversiones [Nombre1] y Flores Sociedad Anónima, que se describieron en el hecho tercero de la demanda, el cual fue originado por haber colisionado las líneas eléctricas por la acción del viento al no contener separadores de líneas, esto hizo que las chispas que produjeron las líneas cayeran al suelo y produjeran un incendio que se propalo por las propiedades siniestrándose un área aproximada de 30 hectáreas de pasturas de Transvala y pastos de Brachiaria Brizantha, lo cual ocasionó que se quemaran todos los repastos, causado esa acción una pérdida de veinte millones ciento noventa mil colones, suma que solicito se indemnice a mi representada y al suscrito en lo personal en la proporción de las áreas que indican los inmuebles. b.- Que por negligencia, descuido e imprudencia de la demandada al no tener el cuidado de dar el debido mantenimiento a las líneas eléctricas que se encuentran frente a las propiedades, ocasionó que se produjera el incendio sobre las pasturas, al colisionar las líneas eléctricas, por falta de previsión en el mantenimiento correcto de éstas. c.- Que se condene a la demandada al pago de los daños y perjuicios ocasionados, así como los intereses que establece la Tasa Básica Pasiva del Sistema Nacional, calculados éstos desde el momento en que ocurrieron los hechos 03 de marzo de 2013, hasta su efectivo pago. d.- Que se condene a la demandada al pago de ambas costas de esta acción.Daños y Perjuicios: Daños: Los daños ocasionados que sufrió mi representada y el suscrito en las propiedades consisten en que la finca de [Dirección1] metros con 48 decímetros cuadrados que se encontraba cultivado de zacate Transvala, ésta producía 400 pacas por hectárea, siendo que se sufrió un daño al no poderse elaborar la corta de zacate para la elaboración de pacas, ni se pudo aprovechar esos repastos para la alimentación de mi ganado, produciéndose un daño de 400 pacas por hectárea, valoradas en ¢1.900,00 cada una, sin contar la anchura, lo que da un daño que se estima en ¢19.760.000,00. En la segunda finca que mide 39.284 metros con 63 decímetros cuadrados, ésta se encontraba sembrada de Brachiara Brizantha, y la tenía destinada para el aprovechamiento de las pasturas, teniendo capacidad de 6 cabezas por hectárea por mes, cuya utilidad soportaba el mantenimiento de 6 cabezas por hectárea en 3 mese, estimando la pérdida o los daños por este concepto en la suma de ¢430.000,00.Perjuicios: Los perjuicios consiste en la pérdida que en lo personal y a título de representante legal de la actora Inversiones [Nombre1] y Flores Sociedad Anónima, se dejó de percibir en el aprovechamiento de la hechura de 400 pacas por hectárea en la finca sembrada de pastos [Dirección2], y en la segunda finca en el aprovechamiento que pude haber hecho de mantener 6 cabezas de ganado por hectárea en un período de 3 meses, perjuicios que estimo en la suma total de veinte millones ciento noventa mil colones.", (folios 29 al 34).-
  2. 2El demandado, debidamente notificado, contestó en tiempo y forma la demanda incoada en su contra, visible a folio 43 al 44, e interpuso la excepción de falta de derecho.-
  3. 3El Instituto de Desarrollo Rural se apersonó en los términos visibles a folio 53, y manifiesta que no presenta interés en ser parte de este proceso, por ello renuncia a futuras notificaciones.-
  4. 4El juez Walter Ávila Quirós, del Juzgado Agrario del Segundo Circuito Judicial de Guanacaste, Santa Cruz, mediante la sentencia N° 210-2016, de las catorce horas y treinta minutos del treinta de agosto de dos mil dieciséis, resolvió: “POR TANTO: De conformidad con las citas de hecho y de derecho se declara con lugar la demanda establecida por [Nombre1] a título personal y como representante de INVERSIONES [Nombre1] Y FLORES SOCIEDAD ANÓNIMA, contra COOPERATIVA DE ELECTRIFICIÓN RURAL DE GUANACASTE RESPONSABILIDAD LIMITADA, representada por [Nombre2] , ambos de calidades que constan en autos. En su lugar se declara lo siguiente:1) El día 3 de marzo de 2013, se produjo un incendio en las fincas propiedad del suscrito en lo personal, y de mi representada Inversiones [Nombre1] y Flores Sociedad Anónima.2) El incendio tuvo origen en la colisión en las líneas eléctricas por la acción del viento al no contener separadores de líneas suficientes que impidiesen el contacto, con lo cual se produjeron chispas que al hacer contacto con el pasto que había en la finca se produjo el incendio que quemo las pasturas de Transvala y Brachiaria Brizantha que había en las propiedades de la parte accionante.3) Que por negligencia, descuido e imprudencia de la demandada al no tener el cuidado de dar el debido mantenimiento a las líneas eléctricas que se encuentran frente a las propiedades, ocasionó que se produjera el incendio sobre las pasturas, al colisionar las líneas eléctricas, por falta de previsión en el mantenimiento correcto de éstas.4) Se condene a la demandada al pago de los daños y perjuicios de forma abstracta se condene en abstracta, reconociendo el pago de intereses legales a partir de la firmeza de éste fallo.5) Se condene a la demandada al pago de costas personales y procesales de esta acción. Se rechaza la excepción de falta de derecho establecida por la parte demandada.", (folios 119 al 127).-

5. En la substanciación del proceso se han observado las prescripciones legales, sin que se note la existencia de errores u omisiones capaces de producir la nulidad de la sentencia.- Redacta la jueza Castro García;y,

CONSIDERANDO:

I.Hechos probados. Se comparte el elenco de hechos tenidos por probados al ser acordes con las probanzas constantes en autos. De esta naturaleza de agrega: 6) Dos días después del incendio del 3 de marzo del 2013, técnicos de la Cooperativa se apersonaron revisar el cableado, y colocaron en el sitio donde se generaron chispas, dos días después, un tercer separador. (testimonios de [Nombre3] , [Nombre4] , [Nombre5] en disco compacto parte de este proceso).

II.Hechos no probados. Como hecho no probado se agrega en esta Instancia: 1) No se acreditó el estadio óptimo del cableado propiedad por la Cooperativa para el día 3 de marzo del 2013 y antes de esa fecha. No hay prueba al respecto.

III.La Cooperativa demandada, interpuso recurso de apelación (folio 130 a 133) contra la sentencia de primera instancia número 210-2016 de las 14:30 horas del 30 de agosto del 2016 (folio 119 a 127) que declaró con lugar la demanda incoada en su contra y ordenó el pago de los daños y perjuicios ocasionados por incendio causado por el indebido mantenimiento de las líneas eléctricas. Mostrándose inconforme en primer orden al mencionar que de la relación de hechos de la demanda solamente se probó que el 3 de marzo del 2013 se produjo un incendio en dos fincas propiedad de la accionante que produjo daños. Sin que se determinase la causa del mismo, pues solamente consta documentos del Cuerpo de Bomberos que revela la incidencia en la fecha mencionada, su ubicación y descripción de los hechos, sin citas motivos o responsables. Y nunca fue solicitada pericia para esos fines. Aduce, en la resolución impugnada se señaló que la condición del tendido eléctrico hace probable la tesis del choque de los cables produzca chispas que al caer al pasto se origine el fuego.

Pero es una mera probabilidad sin certeza alguna. Suposición no sustentada en prueba pericial o técnica y se incurre en un vicio de falta de fundamentación al no explicar las razones por las que la mera probabilidad hacen fallar de forma estimatoria la responsabilidad civil que se le achaca. 2- Argumenta, las declaraciones de los testigos no acreditan la causa del incendio ese día y procede a señalar lo que cada uno de ellos citó. Respecto a lo indicado por [Nombre6] , es rescatable que indicó que la causa de siniestro no afectó la electricidad del lugar, pues mencionó que ya iniciado seguía observando televisión y ese servicio lo suministra la apelante. Caso contrario, antes del inicio de las llamas se hubiera suspendido el servicio eléctrico como lo expuso el testigo experto en la materia [Nombre7] . Menciona, todos coinciden en que la hora aproximada del fuego fue alrededor del mediodía y el servicio de electricidad funcionaba normal; aún después del inicio de las llamas.

Sobre lo indicado por [Nombre8] rescata que indicó haberse iniciado el siniestro y llegar los Bomberos que lograron apagarlo, pero que no se encontraba en el momento ni observó sus causas. Se ignoró que el testigo no hubiera observado nada el día de los hechos y le concede valor a su declaración respecto a lo ocurrido días después, donde deduce hechos futuros en una evidente infracción de las reglas de la sana crítica. Menciona sobre la deposición de [Nombre4] , citó conocer del evento dos o tres días posteriores por lo que no podría determinar lo acontecido y afirmó que en esos momentos observó que los cables del tendido eléctrico rozaron entre sí, generando una chispa que cayó al suelo y lo quemó levemente. Afirma el recurrente ese testigo aclaró que todos habían pensado que el origen del incendio se produjo por unos vidrios y por eso lo estaban buscando, hasta que ocurrió el suceso del viento que produjo el rozamiento del cableado y surgió la chispa.

Lo que le llevó a concluir pudo haber sido esa la causa del fuego. Indica al respecto, es una suposición de algo que pudo ser o no ser, pero que no fue observado al momento de los hechos y no se evidenció el día del incendio. Refuta, lo más valiosos de esta declaración es que el conocimiento de los hechos es de dos o tres días más tarde, por lo que no es un testigo presencial y califica de falso lo manifestado pues en caso de haberse dado la producción de chispas, el sistema eléctrico se suspende; lo cual no ocurrió acorde con lo mencionado por el testigo [Nombre4] y la explicación técnica del testigo [Nombre9]. Indica que el declarante [Nombre4] hace una suposición equivocada. Reitera, los hechos no ocurren como concluye, al no haberse suspendido el servicio eléctrico. Tampoco en este caso se consideró en la sentencia la ausencia del deponente el día del evento. En relación con lo mencionado por la testiga [Nombre10] , acusa los mismos errores al no haber estado en el sitio y lo que sabe se deriva de lo que le indicó [Nombre4].

Se refiere también a lo afirmado por [Nombre7] , la cual tiene valor técnico y señaló que los cables estaban bien tensados, se les brindaba mantenimiento y que la causa del incendio no pudo ser la causa que se demanda y se desaplica y se funda en suposiciones y chismes. En tercer orden apela, no es posible demostrar que el viento produjo el incendio por el choque del cableado acorde con lo solicitado en la pretensión, solo por la falta de los separadores. Indica, nadie observó ni declaró, se produjeran chispas que cayeran al suelo causando el siniestro. Tampoco se acreditó que el motivo del incendio fuera por imprudencia, descuido o negligencia. No hay prueba al respecto. Acusa, en dos lineas de folio 126 pretende el juez fundar su decisión, mencionando tuvo por probada la relación causal entre la conducta acusada y el daño generado, al calificar de negligente a la demandada por tener cables flojos y sin separadores suficientes que impidieran el roce.

Señala, el a quo tiene por probado lo anterior, por lo que observó años después, sin que se posible determinar el estado de los cable en el momento de los hechos y achacar la causa de forma ligera y mediante suposiciones. Sin pericia ni criterio técnico lo sustenta. En cuarto lugar, menciona la obligación de analizar la prueba a conciencia razonando lo que debe tenerse por demostrado y lo que no con base en el acervo probatorio y no con suposiciones y especulaciones. Por lo que se muestra disconforme con el valor dado a las declaraciones testimoniales de [Nombre4] y [Nombre10] de haberse producido el incendio por chispas producto del roce del cableado, sin analizar la continuación del fluido eléctrico. Sino que se decanta por sentar su fallo en chimes y suposiciones. Pide además se le exonere en costas al haber actuado y litigado de buena fe.

IV.El presente proceso versa sobre el tema de responsabilidad extracontractual objetiva y el riesgo creado. El artículo 1045 del Código Civil establece que “Todo aquel que por dolo, falta, negligencia o imprudencia, causa a otro un daño, está obligado a repararlo junto con los perjuicios.” Se trata de una responsabilidad extracontractual, al indicarse, quien realice una conducta de esa calidad, será responsable de sus resultados. En la sentencia apelada en lo medular, se citó en el considerando III Sobre el Fondo que de lo observado en el reconocimiento judicial en el que se detalló haber observado cables flojos en ese acto y determinó que frente a calle pública visualizó dos cables eléctricos donde uno de ellos se sujeta sobre postes de madera, con tres separadores y que ese cable se encontró flojo. Se concluyó que ello reflejaba un inadecuado mantenimiento de las líneas por parte de la Cooperativa accionada.

Lo que se razona en el fallo como la existencia de probabilidad de que la tesis referida a que la causa del incendio fue el contacto entre cables que generó chispas que cayeron al suelo, y que ello coincide con el informe del Cuerpo de Bomberos y lo declarado por los testigos. Declarando así la resolución recurrida, se acreditó de esos elementos de prueba, el nexo causal entre la conducta acusada a la demandada y los daños sufridos por los accionantes, al existir cableados flojos y sin suficientes separadores que impidiesen el roce entre ellos. Por lo que se calificó de una conducta negligente de la demandada y se le declaró responsable civil de los menoscabos patrimoniales sufridos por la parte actora. Del análisis de los autos, las pruebas constantes en autos y el objeto de esta litis, considera esta Cámara ha de confirmarse la sentencia venida en apelación; sin que sea de recibo el agravio de falta de fundamentación respecto a la acreditación del nexo causal que se reclama por la parte actora.

V- En primer término, el objeto del proceso versa sobre el tema de responsabilidad civil extracontractual objetiva, al aducirse en la demanda que el incendio sufrido en las fincas del accionante fue producto del estado en que se encontraban los cables eléctricos ubicada entre los postes número [Dirección3] y [Dirección4] al no contener los separadores entre sí, lo que dió lugar a la colisión entre tales y la generación de chispas cuando fueron movidos por el viento, que cayeron al suelo y se inició el incendio propagándose por el área afectada de los terrenos que estaban cubiertos de repastos. La responsabilidad extracontractual supone la ausencia de vínculo contractual anterior, y se hace recaer sobre el sujeto que ha provocado un daño jurídicamente relevante a otro, por culpa, o mediante el ejercicio de una actividad riesgosa. El fundamento jurídico general es deber de no causar daños a otras personas, que se encuentra en el Código Civil establecido en sus ordinales 1045 a 1048 y diversa normativa especial de cada una de las actividades que se desarrollen y que generen un riesgo.

En el subjúdice, donde se discute sobre la producción de un daño patrimonial a la parte actora que acusa es producto de la actividad desarrollada de la Cooperativa demandada, que consiste en dotar de los servicios de electricidad a las comunidades, mediante la conectividad por líneas de transmisión de energía eléctrica, calificándola de riesgosa, resulta atinente citar el voto número 541-F-11 este Tribunal. Mismo que resolvió sobre el tema en discusión, refiriéndose a la actividad de quemas y fumigación área como actividades riesgosas lícitas, que por su naturaleza son generadores de por sí de responsabilidad patrimonial en caso de la producción de daños. Importante el análisis legal y doctrinal del tema, así como las consecuencias de la inversión de la carga probatoria. En esa sentencia se razonó: I) Finalmente “las disposiciones generales contenidas en los numerales “1045 y siguientes del Código Civil, sobre responsabilidad civil extracontractual, son de aplicación supletoria para esta materia” (ver sentencia de la Sala Primera N°112 de las 15:50 horas del 11 de octubre de1995).

En el ámbito penal, el Código Penal vigente sanciona con 3 a 30 días multa quien contraviniere las disposiciones encaminadas a prevenir incendios o evitar su propagación (inciso 1° del Artículo 407) y a quien infringiere las reglas sobre quema de malezas, rastrojos u otros productos de la tierra (inciso 2°).V. La doctrina moderna por su parte, ha apoyado la objetivación de la responsabilidad, al comprender dentro de los factores de imputabilidad y atribución legal del daño, aparte de la culpa y el dolo, el riesgo. Incluso se ha propuesto incluir como otros factores objetivos: garantía, equidad, abuso del derecho y exceso de la normal tolerancia entre vecinos. Se ve el daño entonces no desde el hecho del autor sino desde la posición del perjudicado, para procurar que todo daño causado en forma injusta sea reparado. Desde otro punto de vista, se ha separado la culpa de la ilicitud del hecho, dándole un rol más importante a éste.

“Una vez rota la equiparación entre la ilicitud del hecho y la culpa, la conducta adquirió una fisonomía autónoma desligada del perfil subjetivo de la voluntad del agente, para constituirse en un simple medio, causa o criterio de conexión entre un sujeto tenido por responsable y un cierto evento dañoso a resarcir”. (Franzoni (Massimo), La Actividad peligrosa, en Responsabilidad por daños en el tercer milenio, Abeledo Perrot, Buenos Aires,1997, p.120). Se habla así de la Teoría del riesgo, la cual no desplaza la culpa sino que la complementa, y se resume como el deber de quien crea un riesgo de indemnizar el daño que provoque a un tercero. “El riesgo es causa de imputabilidad cuando debido a la realización de ciertas causas y determinadas actividades, calificadas como peligrosas, se produce un daño. El daño en estas circunstancias debe resarcirse, no porque su agente haya incurrido en dolo o culpa, sino porque el orden jurídico debe proteger a la comunidad por el desarrollo de actividades peligrosas, de forma que quien las realiza incurre en responsabilidad si se ocasiona un daño en virtud de tal realización…

La responsabilidad derivada del riesgo no depende del dolo o la culpa del agente sino que se origina en la mera ocurrencia del daño consecuente de la actividad peligrosa. Esta consideración trae consigo un régimen especial de la prueba, según la cual, por el solo ejercicio de la actividad insegura se presume la culpa del agente, exonerándose la víctima de la tarea de demostrar una conducta indebida. Al agente le corresponde desvirtuar la presunción…” ([Nombre11] , Hecho imputable dañoso en Del daño, Editora Jurídica, 1° Ed,Colombia,2001, p.260). Para otros autores, “la relación causal es un elemento del acto ilícito y del incumplimiento contractual que vincula el daño directamente con el hecho antijurídico, e indirectamente con el elemento de imputación subjetiva o atribución objetiva. Es el factor aglutinante que hace que el daño y la culpa, o en su caso el riesgo, se integren en la unidad del acto que es fuente de la obligación de indemnizar” (ver [Nombre12] (), El perfil de la responsabilidad civil al finalizar el siglo XX en Responsabilidad por daños en el tercer milenio,Abeledo Perrot, Buenos Aires, 1997, p.24 a 26).

VI. Precisamente, la realización de quemas –independientemente de su fin- es una actividad innegablemente riesgosa. Por ello, en concordancia con la doctrina citada, La Sala Primera de la Corte Suprema de Justicia ha claramente indicado: “VII.- Las quemas pueden acarrear, para quien las produce, responsabilidades de tipo civil y penal. La responsabilidad civil está regulada en la Ley de quemas y Cercas divisorias al establecer la obligación, de quien hiciere quemazones, de pagar los daños y perjuicios ocasionados como consecuencia del fuego (artículo 5 párrafo 4). Se presume autor de la quemazón al propietario, poseedor o arrendatario del terreno que en la época del fuego estaba preparado para ese objeto… VIII.- La Sala Constitucional, mediante Voto N°3459 de las de las 14 horas 42minutos del 20 de [Nombre1] de 1993, estableció la derogatoria del artículo 5°,párrafo quinto, de la Ley de Quemas y Cercas Divisorias sobre las responsabilidad penal…

La misma Sala Constitucional (Voto N°439-I-95 de las 14:36 horas del 22 de agosto de 1995) aclaró la mencionada sentencia N°3459-93 en el sentido de que el artículo 5°, párrafos 5°y 6,de la Ley de Cercas Divisorias y Quemas está derogado únicamente en cuanto a los aspectos penales que contiene… IX.- La normativa de quemas e incendios siguen el criterio de la responsabilidad objetiva. La culpa se presume en quien creó las condiciones del daño por haber asumido el riesgo de perjudicar a terceros con la quema o incendio. Los daños y perjuicios ocasionados son a su cargo. El damnificado está exento de probar la culpa. La carga de la prueba sobre la ausencia de culpa corresponde a quien quemó o incendió. Es una presunción iuris tantum. Sería eximente de responsabilidad la fuerza mayor, la culpa de la víctima o el hecho de un tercero. X. Asume el riesgo quien previendo la eventualidad o posibilidad del daño acepta los efectos de la contingencia.

La responsabilidad se funda en crear el riesgo para el daño. El sujeto al iniciar la actividad, por medio de sus cosas, aumenta, potencia o multiplica las posibilidades de peligrosidad. Aun cuando pueda tratarse de una conducta lícita, siempre debe indemnizar el daño quien asumió el riesgo. Hay mayor razón para imputar la responsabilidad si el hecho proviene de una conducta ilícita. No puede el damnificado asumir daños sobre conductas no impulsadas por él mismo, salvo si se puso en condiciones para sufrir el daño.Quien quema o incendia, aún con la autorización de la autoridad correspondiente, no puede ser eximido de responsabilidad. ….. … VIII.- Responsabilidad agraria objetiva extracontractual. También existe Jurisprudencia relacionada con la responsabilidad objetiva extractual, generadas del ejercicio de actividades de fumigación aérea en agricultura: "VII. La responsabilidad derivada de daños causados a la naturaleza, sea ésta proveniente de una actividad agraria o de cualquier otro tipo, universalmente siempre se ha considerado como una responsabilidad de carácter objetiva.

Este principio general de derecho ha sido admitido ampliamente en las últimas reformas a la Constitución donde se introdujo el derecho a un ambiente sano y ecológico equilibrado, y el legislador lo ha asumido aún antes de esas reformas, reiterándolo ampliamente despues, para encontrarse en todo el sector ambiental del ordenamiento jurídico. Desde los más remotos documentos jurídicos este criterio siempre ha imperado porque no puede obligarse a la víctima a probar el nexo de causalidad, como sí acontece para la responsabilidad subjetiva, si el agente dañoso ha asumido un riesgo, aún cuando sea bajo una dimensión de una actividad lícita, si dentro de sus posibles efectos se pueden incluir el causarle un mal a terceros. La jurisprudencia de esta Sala se ha pronunciado en repetidas ocasiones en el tema de quemas, agrarias o no, con efectos dañinos en fundos colindantes o ajenos, y ha establecido la responsabilidad de quien procediendo a quemar sus propios deshechos o malezas, en su misma finca, le ha causado un mal a otro, aún cuando hubiera tomado todas las previsiones del caso para evitar la propagación del fuego (sentencias N° 112 de las 15 horas 50 minutos y 113 de las 16 horas, ambas del 11 de octubre de 1995, y la N°26 de las 14 horas del 28 de febrero de 1996).

Naturalmente esta tesis hoy se reclama como un principio general del derecho para la protección del medio ambiente, y resulta correcto afirmarlo así. En la misma Biblia se encuentra consagrado, de donde pasó a textos jurídicos de la más diversa índole como es el caso de toda la tradición española tan influyente en nuestros ordenamientos jurídicos. El fundamento de esta tesis es muy simple. No se trata de la responsabilidad subjetiva prevista en el numeral 1045 del Código Civil, porque en tal hipótesis el damnificado debe probar el nexo causal entre la acción del agente dañino y los perjuicios sufridos. En la objetiva la simple existencia del daño reputa la responsabilidad en el agente dañino de haber sido el causante de ese daño, y por tal quien deberá indemnizar los daños y perjuicios causados con su conducta. Esto no deriva de un acto arbitrario sino de pura lógica, pues quien, incluso en una conducta lícita, asume un riesgo donde exista peligrosidad, debe responder por todo cuanto daño pueda causar esa peligrosidad.

Existen muchos ejemplos al respecto. Si una persona manipula pólvora, o cualquier tipo de material inflamable, sea en una fábrica, en una actividad comercial, o por su propia diversión, en caso de ocurrir un siniestro con efectos en cualquier vecino, no ha de ser el damnificado el llamado a probar el nexo de causalidad entre la conducta ejercida y el daño causado, más bien el ordenamiento jurídico parte de la culpabilidad de quien asumió el riesgo y la peligrosidad, y solo para eximirlo de la responsabilidad podría probar no ser el responsable directo del daño causado, así la carga de la prueba se invierte, y los eximentes, como por analogía podría aplicarse para el ámbito ambiental, serían los previstos en la Ley General de la Administración Pública donde también se prevé la responsabilidad objetiva del Estado, siendo ellos “fuerza mayor”, “culpa de la víctima” o “hecho de un tercero” (artículo 190).

VIII. En autos quedó claramente demostrado el daño sufrido por el sector de la plantación de Teca adyacente al fundo sembrado de arroz, existiendo únicamente una calle entre ambos fundos. Se constata entonces el primer elemento para la configuración del daño resarcible, es decir la existencia del daño real, cierto y efectivo. Asimismo se tuvo por demostrada la lesión a un interés jurídicamente relevante, merecedor de amparo.." ( Sala Primera de Casación, No. 398 de las 16 horas del 6 de junio del 2001).

VI- Entendido lo anterior y coincidiendo esta Sede con lo citado en la sentencia recurrida al estimar que el servicio de dotación del servicio eléctrico es una actividad riesgosa (artículo 1048 párrafo 4 del Código Civil); en virtud de la transmisión de energía de alta tensión por cableado eléctrico a fin de suministro del servicio público de electricidad. Además de tenerse por acreditado que el fuego en las fincas de la parte actora ocurrieron en la realidad; pues así lo consignó la Constancia de Incidente consecutivo 12659-2013 (folio 3) y el documento aportado a los autos del dictamen pericial del Organismo de Investigación Judicial levantado dentro del proceso penal EXPN1 (folios 8 a 11), hecho quinto de la demanda y contestación (folio 31 y 43). Y haber iniciado desde lugar cercano a la calle pública y propagarse al interior de los inmuebles, según lo manifestaron los testigos .....

( resguardada en formato digital parte del expediente) se concluye de la valoración de esos elementos probatorios que la demanda de ser acogida. Como se señaló ante casos de esta naturaleza la inversión de la carga probatoria se inclina en el ente que se acusa generó el daño en los bienes del afectado, y es él quién debe acreditar que no existe el nexo causal que se reclama entra la conducta y el menoscabo. En esta caso se cuenta con el reporte de incidente del Cuerpo de Bomberos y el documento del expediente penal número EXPN1, donde se vertieron investigaciones por parte del Organismo de Investigación Judicial. De tales se logra acreditar que el suceso de incendio ocurre el día 3 de marzo del 2013 en donde se produjo l quema de charral y potreros en un área que en ese momento se calculó en forma aproximada de treinta hectáreas para ganado. Existe oficio del 2 de mayo del 2013 del actor dirigido a la Cooperativa accionada en donde le detalla que sus fincas fueron arrasadas por el fuego provocado por las chispas que emanaban, de los cables eléctricos continuos de dos postes de luz número 189/695 y 50000/134.

Detallando los daños ocasionados (folio 7). En oficio del 3 de octubre del 2013 número CG035-2013 se contesta por la accionada a [Nombre1] que el caso se encuentra en investigación de sus asesores técnicos y legales (folio 15). El 5 de setiembre del 2013, (folio 16) el aquí actor remite un oficio a la Cooperativa exponiendo de forma amplia la situación sufrida y el recuento de los daños y los documentos que daban sustento a lo acontecido según su criterio. En respuesta, Coopeguanacaste le indica que luego de una exhaustiva revisión rechazan la propuesta que se le realizara en virtud de que la denuncia no es concurrente con sus investigaciones. ( folio 24). Además consta nota del 19 de noviembre del 2013 dirigida a [Nombre1] y [Nombre1] y Inversiones [Nombre1] y Flores S.A. en donde describe que se procedió a iniciar con expediente administrativo CG-035-2013 y se le cita que la negativa a sus pretensiones de reconocerle daños y perjuicios, se fundan en un análisis objetivo y exhaustivo de lo ocurrido que concluyeron que no existe daño causal entre lo ocurrido y la actividad desarrollada por la Cooperativa.

Por lo que niegan responsabilidad alguna (folio 27). La demanda es presentada y se contesta por la accionada en los términos de su rechazo de la responsabilidad objetiva o subjetiva alguna (folio 43 a 44). Fue incorporado, a solicitud del juez fotografias previamente tomadas por el Organismo de Investigación Judicial en donde se muestran dos fotos (folio 69 y 77 a 78) en donde se observa, la primera que indica el documento se denota el paso del tendido eléctrico paralelo a la cerca de la propiedad y en la segunda la muestra fotográfica del suelo quemado. En el juicio y reconocimiento judicial rinden su declaración personas que afirman haber presenciado el incendio, y si bien no estuvieron en el momento en que comenzó si detallaron aspectos importantes sobre el estado de la ausencia de elementos que permitían rozaran los cables, las condiciones del temperatura así como el día y la hora. En el reconocimiento judicial se consignó lo citado en la sentencia que no fue objeto de apelación, salvo que es utilizado para determinar el estado del cableado el día del incendio, aún y cuando ese acto judicial se realiza el 19 de enero del 2016.

Sobre el estado del cableado se detalló por el juez, observó dos líneas de tendido eléctrico, una sobre postes de madera y cable forrado, que están como a 9 metros 10 centímetros de la cerca y es colindante. Indicó, en tal no hay separadores entre cable y postes. Esa línea se conecta con el poste 2190 y tiene transformador. El otro tendido eléctrico de mayor altura, con postes, número 50000/123 dentro de la y cercano a la cerca. Se aclaró existe una distancia entre poste y poste unos cien metros, se observó dos separadores y los cables. La distancia entre separadores es de diez metros y observó uno de los postes doblado y flojo.En forma posterior aclara que son tres los separadores.

VII- En ese sentido, tal y como se señala en la sentencia recurrida concurren los testigos ofrecidos por la actora, [Nombre13] , [Nombre14] , [Nombre4] y por la Cooperativa Miguel [Nombre4] Gómez Corea y [Nombre15] . Testigo [Nombre3] conocido como [Nombre8], mencionó en lo que fue objeto de apelación, haber sido alertado del incendio el día de los hechos y había un fuerte viento a principio de marzo después de mediodia. Le consta que se quemó todo pues se apersonó cuando estaba en llamas y había gente observando la quema. Sobre el origen, indica después que pasó, se pusieron a buscar vidrios, y en ese momento llegaron los del OIJ. Ya todos dentro, chispeó el cable en el lugar donde pegaban y le quemó una pierna. La persona del OIJ, refieriendose a una mujer, llamó a la Cooperativa alertándoles de los cables, que arribaron. Con una escalera colocaron un separador, el tercero. Que correspondía al más grande que se observa actualmente.

Fue colocado en presencia de los testigos. Informa, al llegar los Bomberos ya estaba quemado y era el fuego movido según el viento. Ese día había un fuerte viento y logró observar que se emitían chispas. En el año 2012 se había producido otro incendio en el mismo sitio. A las preguntas de la contraparte, indicó que al momento de iniciarse el siniestro, estaba dentro de su casa a [Dirección5] . Después del incendio buscaron vidrios dado que debido al calor supusieron que podrían haber, pero no había observado el chispeo. A los dos días del incendio se ponen a buscar los vidrios y es en ese momento que ven las chispas. Los del OIJ llegaron a los dos días del siniestro. De este testigo se concluye que efectivamente se produjeron chispas por roce del cableado y que fue puesto un tercer separador de cables en el sitio donde se produjeron las chispas observadas. Aunado a la presencia de fuego el día 3 de marzo del 2013.

Lo anterior coincide con lo depuesto por [Nombre4] , que de importancia citó, el día que llegó el OIJ en marzo del 2013 estaba sentado con Aldobrandy. Antes de eso, 2 o 3 días había pasado el incendio, y consideraron importante revisar si habían vidrios, ingresaron al fundo y cuando estaban en esa búsqueda, apareció [Nombre1] con otras personas. Mismas que eran del OIJ y les tomaron sus datos, en eso se viene una ráfaga de viento y los cables hicieron contacto y a ellos les cayeron chispas. Las mismas se producen en dirección de un separador que colocaron. Aclara, no observó el momento del incendio, pero supuso que fue las chispas la causa. Mencionó, la hora de la búsqueda fue alrededor de mediodía. El incendio fue de gran magnitud y duró varias horas mientras se iba apagando los troncos. Antes del siniestro lo que había eran pastos y se hacían pacas. Cuando están buscando los vidrios y llegar los del OIJ a hacer una inspección a averiguar las causas, en su presencia se da el chispeo y lo observaron y manifestaron verbalmente que esa fue la causa.

Muestra el sitio del chispeo y afirma estaban [Nombre8], [Nombre16], los del OIJ y en se momento se percibió una fuerte ráfaga, los cables hacen contacto entre sí y se desprenden las chispas calientes. Una de las cuales le quemó a él la pierna. Eso ocurre donde no había separador, que se coloca y se pone por los mismos funcionarios técnicos de Coopeguanacaste y ellos ayudaron a sostener la escalera a esos técnicos. Observó colocan el separador, se retiraron y no vio que anotaran nada. Ellos indicaron que efectivamente en ese sitio se produjo un contacto, pues estaban quemados los cables A la contraparte, contesta que él le comenta a [Nombre17] que le da pena de que [Nombre1] piense que ellos quemaron la finca por ser vecinos. Pues lo lógico es que el afectado al menos piense que pudo haberse provocado. Empezaron a buscar en el lugar donde no había separador porque estaba ahí quemado, por que les indicó que ahí inició.

Explicó, el llegó donde [Nombre17], se metieron a buscar, posteriormente llegó el carro con don [Nombre1] y el OIJ, se bajaron. Unos 15 minutos después de que se fueron los del OIJ, arribaron los de la Cooperativa. Este testigo coincide con lo indicado por el anterior, que si bien llega al sitio del incendio cuando ya inició, si pudo presenciar la existencia del chispeo y la colocación del separador. En igual forma, [Nombre18] , señala, vive frente a la finca afectada. Describe, en el 2012 estaba descansando y de repente ve un fuego y alerta a [Nombre8] que se quemaba la finca. Se apersonaron los hijos del dueño y se quemó otra área. En el 2013 estando en su casa, escucha que se estaba quemando el lugar y llamó a [Nombre8]. El no había observado nada al inicio. Explicó, el lunes llegó [Nombre4], fueron a buscar algún indicio de causa del incendio y observó que llegó el carro del OIJ. Estando todos chocan los cables y se producen chispas.

Llegaron los de la Cooperativa y donde pegaban los cables se colocó el separador. Afirmó, el primer incendio se produce sin que hubiera nadie en el sitio y eso le sorprendió. El día del segundo incendió estaba ventoso. Ellos le colaboran a los funcionarios de la Cooperativa y colocan un nuevo separador y en esa zona la parte estaba quemada. Aclaró buscando vidrios estaban él, [Nombre4] y [Nombre8]. Su casa del separador está a unos [Dirección6] , antes de observar los de las chispas nunca reclamó al respecto. El día del siniestro estaba viendo noticias en su casa y en eso pasó un muchacho alertando sobre el incendio. Reitera este testigo sobre lo ocurrido dos días después del roce del cableado y las chispas quemantes que cayeron al suelo del terreno de la parte actora. Aunado a que se apersonan los del OIJ y se llama a la Cooperativa que llega a colocar un separador más. Cabe citar, los testigos mencionados indican que una de las funcionarias del OIJ fue la que llama a las personas de la Cooperativa para que atiendan el incidente de la producción de chispas.

Aunado a estas declaraciones, se rindió el testimonio de [Nombre10] , cuyo contenido esta citado en la sentencia recurrida y se indica refiere a la producción de las chispas en la forma ya descrita por los anteriores testigos. De estas testimoniales se logra concluir un aspecto de importancia medular en procesos de esta naturaleza y es la existencia del riesgo de incendio en virtud de las chispas generadas por el roce de cableado, las condiciones de tempertaura y vientos imperante en el lugar y la colocación de un separador más dos días despúes del incendio por parte de funcionarios de la empresa demandada. Resulta cierto que los testigos no presenciaron el momento exacto del inicio del siniestro del 3 de marzo del 2013, pero si observaron lo ocurrido ya iniciado el fuego y les consta la presencia de los funcionarios de la demandada colocando un separador en virtud de generarse en forma efectiva chispas por roce de cables.

VIII- La Cooperativa ofreció el testimonio de [Nombre7] , funcionario de Coopeguanacaste y es técnico eléctrico. Las líneas se construyen el 2009 y nunca había pasado nada y estima no pudo haber ocurrido los hechos por causa de las mismas. Indicó, generalmente se da mantenimiento de ramas por ser el mayor problema y existe supervisión de esa red. Sobre el hecho ocurrido solo sabe que sucedió. La red antigua que existe aún y tiene electricidad de alta y baja tensión. El tendido de postes de madera es secundaria y se instala para un grupo de casas. Explicó, tiene 39 años de laborar para la empresa y en el Area de Desarrollo desde los ochentas. No conoce de denuncias por chispas por roce de cables. El viento es cambiante. En la zona de potrero, nunca ha recibido reclamos al respecto. El cableado, uno tiene un forro negro y otro no. Pues unos son cables telefónicos y fibra de cableras ajenas a la Cooperativa.

Los que trasmiten la energía para evitar que roce, todos llevan separadores y si no se instalan causan problemas. En esta, dice, hay separadores. Estima que las posibilidades del viento y rozamiento, es difícil con el equipo instalado por la separación de 20 centímetros y el voltaje es bajo. Explica, las quemas en los potreros la mayoría son por cigarros. Desconoce si los Bomberos investigaron algo sobre el incendio en cuestión. A la contraparte, cree el incendio fue en marzo pero no sabe la fecha exacta, no recuerda las condiciones de viento. Siempre que se hace un reporte, se manda cuando se suspende el fluído y cuando hay roce se desconecta. El no ha trabajado en la parte de mantenimiento señaló y desconoce si llegó o no gente de la Cooperativa, pues él no estaba ese día. Sobre la condición del separador que estaba en el sitio de manera vertical u horizontal, lo importante es el aislamiento.

Para la fecha del siniestro deberían estar los separadores desde su instalación en el 2009, según el manual de construcciones de líneas y hay un inspector que verifica. A la fecha marzo del 2003 sobre si las lineas estaban instaladas, indicó que así fue. De este testimonio ofrecido en descargo por la demandada, no se logra desvirtuar que en forma efectiva dos días después del incendio llegaran los técnicos de la accionada y colocaran en virtud de la generación de chispas, un separador más. Para esta Instancia, ese actuación técnica de la Cooperativa hace llegar a la conclusión que efectivamente al roce del viento se generaban chispas y dadas la condiciones ventosas de las cuales refieren los testigos y la temperatura propia del mes de marzo de esa zona del país, el riesgo de incendio por esa causa es patente y real. LLama la atención a esta Cámara se hubiera indicado por parte de la accionada realizó las investigaciones técnicas y se levantó un expediente administrativo que no se aportó, así como tampoco prueba alguna del estado real de la estructura del cableado antes del 3 de marzo del 2013.

Las condiciones de las que se refiere el funcionario que rindió su testimonio, se dedican a citar los criterios técnicos que debieron haber existido en el sitio a fin de evitar incidentes, pero no le constaban pues no era inspector ni encargado del mantenimiento de redes. Tampoco se enerva la afirmación de los testigos citados en cuanto debió la Cooperativa colocar un separador más en el sitio donde se produjeron las chispas.

IX- La parte recurrente indica que técnicamente al iniciarse el chispeo, se produce un corte de electricidad y que uno de los testigos manifestó que luego de iniciado el incendio el suministro eléctrico continuó. Ello no encuentra ningún sustento probatorio, más que las explicaciones técnicas del testigo anterior, que estuvo desvinculado antes y después del evento del siniestro y que mencionó que con los separadores adecuados del cableado resutla poco probable que se den chispas por rozamiento de cables. Cabe reseñar es a la parte demandada a quien le compete probar que los actos acusados no son el nexo causal entre la conducta y el daño sufrido, y no se aporta alguna que logre restar mérito a lo declarado por los testigos sobre la colocación de un separador más y la existencia de las chispas antes de la instalación del tercer separador Por ello no son de recibo los agravios primero a cuarto, en cuanto la falta de acreditación de la causa generadora del incendio, así como la errónea valoración probatoria en la sentencia recurrida de los elementos de prueba que las partes hicieron llegar a los autos. Estimándose correcto el análisis vertido. Por lo que al respecto debe ser confirmada la sentencia.

X- Sobre el agravio de las costas, en cuanto se le exonere del pago ordenado en el fallo venido en alzada se rechaza. En este caso se acogió la demanda de la actora y en virtud del vencimiento objetivo y el artículo 54 de la Ley de Jurisdicción Agraria corresponde a la parte perdidosa el pago de las costas del proceso.

XI- Con fundamento en las razones expuestas, resoluciones citadas y artículos 1 y 2 de la Ley de Jurisdicción Agraria, numerales 1045 y 1048 del Código Civil, en lo apelado se confirma la sentencia venida en alzada.

POR TANTO

En lo apelado, se confirma la sentencia número doscientos diez- dos mil dieciséis de las catorce horas treinta minutos del treinta de agosto del dos mil dieciséis.
