BACKGROUND (RESULTANDO):
1. The plaintiff filed this ordinary action, valued at diez millones de colones—See image 11—requesting that the judgment declare the following: “1. That the company I represent be declared the sole and exclusive owner of the property registered in the Alajuela Registry District, under Mechanized Real Property Folio Number 223712-000, with cadastral survey plan number A-0703382-1987. 2. That all attributes of ownership over the property be restored to me and that the defendants be evicted from the area enclosed by wooden posts and living posts and seven strands of barbed wire installed by the defendants, where we were dispossessed of all possession and enjoyment of the protection area surrounding the spring (naciente), measuring approximately media hectárea de terreno. Ancillary claims: 3. That the defendants be ordered jointly and severally to pay all procedural costs and attorney’s fees (costas procesales y personales) arising from this action. 4.
That the defendants be ordered jointly and severally to pay SEIS MILLONES DE COLONES NETOS as non-pecuniary damages (daño moral), due to the continuous abuses, disturbances, and encroachments upon my property, the unlawful dispossession of an area of my property (the fencing of the spring protection area, measuring approximately media hectárea), and the severe deterioration of the health and mental and emotional condition of myself, my son [Nombre4], and my daughters [Nombre5] and [Nombre6], resulting from this entire situation. NON-PECUNIARY DAMAGES: a) Acts disturbing the property at issue (fundo en litis) and Mrs. [Nombre6], for more than diez años. The defendant, having been duly served, answered the action brought against it and asserted the defenses (excepciones) of absence of a legal right, lack of standing, lack of a present interest, and failure to exhaust administrative remedies. Judge Ana Milena Castro Elizondo of the Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, through judgment Nº 129-S-2016 at quince horas cuarenta y cuatro minutos on doce de agosto del dos mil dieciséis, ruled: “THEREFORE (POR TANTO): Confession questions 1, 3, and 4, as well as question 2 concerning the party examination (declaración de parte) of defendant [Nombre3], are deemed answered in the negative. The defenses of lack of active standing and lack of passive standing concerning Veintiséis de Enero (SIC) del Cincuenta (SIC) y Dos (SIC) P y J Sociedad (SIC) Anónima and Asociación del Acueducto (SIC) y Alcantarillado Sanitario del Río Celeste de Guatuso Alajuela, respectively, are denied. The defenses of lack of active standing concerning plaintiff [Nombre1] (), lack of passive standing concerning co-defendant [Nombre3], and absence of a legal right, asserted by Asociación del Acueducto y Alcantarillado Sanitario de Río Celeste de Guatuso de Alajuela, are granted.

Attorney Ricardo Salazar Hidalgo, acting as special judicial attorney-in-fact for the plaintiff, filed an appeal (recurso de apelación), expressly stating the grounds on which he relied to challenge the trial court’s position (Escritorio Virtual del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, filings, at quince horas cero minutos con once segundos on veinticuatro de agosto del dos mil dieciséis, Add Filing - APPEAL/Add document - 24 Aug 2016 03:00PM).
5. The statutory requirements were observed in the conduct of the proceeding, and there are no errors or omissions capable of rendering the judgment void.
Drafted by Judge Díaz Bolaños; and, CONSIDERING (CONSIDERANDO):
II.The second unproven event is affirmed because no evidence supporting the matters stated therein was submitted into the record. No ruling is made concerning the first because it is not the subject of the appeal.
III.The judgment issued at 15:44 on August 12, 2016, is appealed. In its essential respects, that judgment dismissed the complaint and ruled without a special award of costs (virtual case file of the Juzgado Agrario de San Carlos, PDF format, images 295 to 313). The appeal is signed by [Nombre7], in his capacity as special judicial attorney-in-fact for the plaintiff, for the following reasons: 1. He alleges an improper assessment of the substantive legislation. He refers to Article 41 of the Constitución Política, sections 58, 69, and 60 of the Ley de Jurisdicción Agraria, and sections 554, 559, and 560 of the Código Procesal Civil. He mentions recitals IX and X because he believes they analyze all land within a 200-meter perimeter of drinking-water collection sites or intake points as being in the public domain or constituting public-domain assets (bienes demaniales). Consequently, he asserts that Article 31(a) of the Ley de Aguas was erroneously interpreted.
He adds that the parcel (predio) containing the water exploited by the ASADA is privately owned and registered with the Registro Nacional. He transcribes section 7 without identifying the body of law. He argues that the Ley de Aguas dates from 1942 and the Ley de Tierras y Colonización from 1961, that both are special laws, and that the later law therefore modifies or repeals the earlier one. He explains that sections 33 and 34 of the 1996 Ley Forestal apply to privately owned estates (fundos de dominio privado). He copies a portion of opinion number C-042-99, dated February 19, 1999, issued by the Procuraduría General de la República, and an excerpt from judgment number 4205-96, issued by the Sala Constitucional de la Corte Suprema de Justicia at 14:33 on August 20, 1996. With respect to protection areas (áreas de protección), he analyzes Article 33 of the Ley Forestal and states that owners may exercise their ownership rights subject to the limitation in Article 34 thereof concerning the cutting or removal of trees.
He notes that there is extensive legislation requiring the prevention of contamination of water sources and imposing penalties on violators. Nevertheless, he reasons that it does not authorize ASADAS to enter and leave private property without the owners’ permission or to erect structures such as dense barbed-wire fences to prevent anyone from entering the surrounding area, because private property differs from public-domain assets. He states that, in this matter, upon issuance of a health order (orden sanitaria) by the Ministerio de Salud, the proper course would have been to notify his clients, who are the persons dispossessed of the area, of the existence of that document. They could then have adopted preventive measures and would not have authorized the ASADA to undertake compliance with the preventive requirements. He maintains that his clients could have faced judicial and administrative proceedings for violations of various laws.
In his view, the ASADA should not have acted overbearingly, as though they were not the owners of the property, by installing a wire fence. He transcribes Articles 59, 64, and 67 of the Ley Orgánica del Ambiente; sections 73, 263, 275, 277, 278, 273, and 285 of the Ley General de Salud; and Articles 6, 44, 69, 94, and 102 of the Ley de Uso Manejo y Conservación de Suelos. He reviews criminal-law information because he believes that, when legal requirements are disregarded, the State has punitive authority and there may be civil liability for losses and damages. He cites Articles 132, 162, and 259 of the Código Penal. In the administrative sphere, he states that there are penalties such as moral sanctions, warnings for violations, monetary penalties, and rescission of favorable administrative acts. He copies section 99 of the Ley Orgánica del Ambiente; section 155(10) of the Reglamento de Uso, Manejo y Conservación de Suelos; and sections 340, 341, 355, 356, 363, and 364 of the Ley General de Salud, since that law establishes measures including the revocation of permits.
Regarding the Ley de Aguas, he transcribes Article 167, as well as section 101 of the Ley Orgánica del Ambiente. He emphasizes that the legislation provides a broad range of options for preventing, penalizing, and remedying contaminating acts that harm water-producing sources, and that their protection and future preservation are therefore a matter of will. He explains that ASADAS are private entities performing public functions and governed by public law (Derecho Público), and that no legal provision authorizes their officials to enter or build on private land without permission, much less to take 3000 square meters of a parcel from its owners. He indicates that the health order issued by the Ministerio de Salud requires the owners to prevent contamination of the water sources, failing which they are subject to a penalty. As grounds for appeal, he asserts that section 31 of the Ley de Aguas was erroneously applied because it applies only to vacant land (terrenos baldíos), and that the ruling against his clients, through acceptance of the defense of lack of legal entitlement (excepción de falta de derecho), legalizes the dispossession of land carried out by the ASADA de Río Celeste de Guatuso.
He adds to his argument that, pursuant to Article 7(c) of the Ley de Informaciones Posesorias, sections 33 and 34 of the Ley Forestal must be applied to privately owned land and that, under extensive constitutional case law, owners may not be deprived of their private estates; otherwise, the disputed area must be expropriated, which has not occurred. 2. He believes that the evidence was improperly assessed. Based on the body of evidence, he maintains that his client, [Nombre6], personally purchased the parcel 23 years ago. He recounts that a small water-collection tank had already been built at that time. In 2011, she transferred it to a company in which she serves as president and general attorney-in-fact with unlimited powers. He states that the first tank is not the problem. The “error of interpretation” concerns the ASADA’s construction in 2011 of a second, larger tank and its enclosure of a 3000-square-meter perimeter.
Those works were carried out without the plaintiff company’s permission; he characterizes that situation as misappropriation and dispossession, states that the property is not a public-domain asset but private property, and asserts that the defendant has no legal basis for remaining on the property at issue. He discusses report HN-ARS-G-SMC-184-2013 of May 23, 2013, issued by the Ministerio de Salud, which concerns deficiencies in the collection system, one of which was the lack of a protective fence. He transcribes a portion of that document. In his view, the complaint provides no evidence of a health order from that Ministry directing that action be taken, or that the appellant was informed so that permission could be obtained to erect the fence. What it presents, he alleges, is a report of an on-site visual inspection (inspección ocular). No order to install a fence is submitted; fencing is merely recommended.
Nor, in his view, is there evidence that the ASADA has lawful rights to the aqueduct through Acueductos y Alcantarillados; the defendant submits only its registration with the Registro Nacional, which is insufficient evidence. He concludes that, even if the ASADA is acting lawfully, it has an obligation to maintain and repair drinking-water systems and prevent their contamination, but must do so in accordance with the law and with respect for private property (images 316 to 331).
IV.In light of the grounds for appeal, this Court considers it important to revisit the relief sought in this matter. The claims are defined in images 97 to 98. As to the principal relief, the first request is for a declaration that the plaintiff company is the sole and exclusive owner of property number CED9 in the province of Alajuela. The second request states verbatim: “2. That all attributes of ownership over the property be restored to me and that the defendants be evicted with respect to the area enclosed by wooden posts and living fence posts (postes vivos), and seven strands of barbed wire installed by the defendants, where we were dispossessed of all possession and enjoyment of the protection area surrounding the spring (naciente), which measures approximately half a hectare of land….” For that reason, it is emphasized that the claim for recovery of ownership (reivindicación) is limited exclusively to the area surrounding the spring’s protection area.
It is clarified that, if the principal claims fail, no ruling may be issued on the ancillary claims, which seek the ancillary payment of damages. This area was identified during the judicial inspection (reconocimiento judicial) (in the third audio file added to the virtual case file of the lower court, from minute 01:17 to 08:48) as being located within the property, near its center and on elevated ground. The adjudicator estimated that it encompasses approximately 2500 to 3000 square meters. The disputed sector is fully enclosed by wooden posts and six strands of wire around the entire circumference, which includes or encompasses collection tanks used by the defendant ASADA. The containers are described as being constructed of cement, with ceramic material on top, and as independent of one another. A considerable amount of piping was observed carrying the collected water toward the northern portion of the estate.
The first tank comprises approximately 10 square meters of construction. The second, smaller and adjacent tank comprises 5 square meters. The record states that there is a forest protection area (área de protección forestal) with substantial forest cover (cobertura boscosa), encompassing approximately 2500 to 3000 square meters. The forest is native to the area. Pursuant to Article 54 of the Ley de Jurisdicción and the principle of party disposition (principio dispositivo), the dispute concerning the protective action invoked must be limited to that area.
V.The first claim against the judgment under appeal challenges the assessment of the evidence because, in the appellants’ view, this is a registered property (finca inscrita), and the ASADA—hereinafter referring to the defendant, Asociación del Acueducto y Alcantarillado Sanitario de Río Celeste de Guatuso—has no right to perform work without the owner’s permission. Regarding the sanitary order (orden sanitaria), they contend that no evidence of an order of that nature was submitted, nor were the owners informed of that deficiency so that permission could be obtained to build the dividing barrier. What was submitted was an ocular inspection (inspección ocular). Nor were any documents provided to demonstrate that the ASADA is operating lawfully before Acueductos y Alcantarillados. Based on what was observed during the judicial inspection (reconocimiento judicial) mentioned in the preceding section, and because this is not a disputed issue (see the fifth allegation of fact in the complaint and the response, images 94 and 172, respectively), the dispute concerns the fenced area.
At its center is a spring (naciente) and collection tanks (tanques de captación) used to supply that water to a population. Regarding the allegedly improper assessment of the evidence, this Court finds the argument to be without merit. The sanitary order is contained in the record. In images 179 to 182, it is identified by number S-018-2013 del 28 de mayo de 2014, issued by the Dirección de Rectoría de la Salud Huétar Norte, Área Rectora de Salud Guatuso. That document bears the signature of environmental engineering professional Sharon Moncada Corrales, as does the notice served on Carlos Vargas Jiménez, who represented the ASADA. That evidence relied for its justification on report HN-ARS-G-SMC-184-2013, for the purpose of “protecting human health and the environment.” Among other matters, a period not exceeding 66 business days was granted to carry out a series of works. Among the measures ordered at the springs was the following: “Install a protective fence preventing people or animals from accessing the site.” The administrative act (acto administrativo) has been duly entered into the record.
The ASADA was therefore obligated to comply with its provisions. As emphasized in the text of the document under review, its ultimate purpose is the protection of health. Two matters must be borne in mind. First, the supply of drinking water (agua potable) is a right to which everyone must have access. The Sala Constitucional de la Corte Suprema de Justicia has addressed this issue as follows: “… III.- Fundamental right to drinking water. This Court has recognized in its case law that the rights to health and life are fundamental human rights that depend—to a great extent—on access to drinking water, and that the competent bodies have the unavoidable responsibility to ensure that society as a whole does not see them diminished...” (Voto Nº18633 de las 10 horas 50 minutos del 21 de diciembre de 2007). This leads to the second matter: powers in the area of health belong to the Ministerio de Salud as the governing authority.
This is stated in section two of that body of law, which provides: “It is an essential function of the State to safeguard the health of the population. The Executive Branch, through the Ministerio de Salubridad Pública, hereinafter referred to in abbreviated form in this law as the ‘Ministerio,’ is responsible for defining national health policy and for regulating, planning, and coordinating all public and private health-related activities, as well as carrying out those activities assigned to it by law.” For these reasons, the right to health prevails over the property right for which the plaintiff seeks protection. Although both are constitutionally grounded, the general interest predominates. Accordingly, the order issued by this country’s governing health authority cannot be challenged in this proceeding. Furthermore, the sanitary order was issued to “ASADA Río Celeste,” which was required to comply with it.
Whether communication with the commercial entity holding title to the property was required is an issue beyond the scope of this proceeding because, as stated, this is a protective action for recovery of possession (acción protectora de reivindicación) concerning the area where a spring and collection tanks are located, and authority over such controls rests with whomever the administrative body charges with them. Compliance with the sanitary order is mandatory because the regulations so require where water for human consumption is concerned. Section 268 ibid. provides that every drinking-water supply, without exception, is subject to the Ministerio’s oversight regarding the quality of the water supplied to the population and to ensure that the system’s constituent elements, operation, and state of maintenance guarantee an adequate and safe supply; the Ministerio may intervene if the health of the inhabitants is endangered.
As for the grounds of appeal concerning whether the ASADA is operating lawfully, that matter is likewise outside the scope of the dispute because, as repeatedly stated, compliance with the provisions of the Ministerio de Salud cannot be questioned in this dispute, and the protection of a right superior to the right to private property prevails. Nevertheless, the testimony of [Nombre8], in audio file number five, added to the trial court’s virtual desktop, minutes 0:32 to 16:35, is relevant; the witness stated that they worked for the ASADA. The witness recounted participating with the Ministerio de Salud in connection with a complaint and having to accompany its personnel. The witness stated that several visits were made to [Nombre6] because they had a court order prohibiting them from entering the property. The witness explained that several people associated with the ASADA visited her to request written permission, but she refused to grant it.
During another visit by [Nombre9], she did give verbal permission to paint and install some fencing, but they were not permitted to build anything. A review of the remaining testimony shows that none of it provides specific information regarding the inspection and enforcement of the sanitary order. A dispute over the installation of the fence clearly exists; however, under the regulations cited, compliance with that measure was mandatory because public health prevails. As for the documentary evidence, the record also contains, at images 15 to 24, a copy of the criminal complaint processed under expediente EXPN1, which provides no information warranting modification of the conclusions stated herein.
VI.The other claim concerns the erroneous application of section 31 of the Ley de Aguas because, according to the theory advanced on appeal, it applies only to vacant lands (terrenos baldíos), which belong to the State and cannot be acquired by adverse possession (usucapir). The appellants believe that the defendant ASADA’s dispossession of the land was thereby legitimized in some manner. They contend that, because this is privately owned land, Articles 33 and 34 of the Ley Forestal must apply. This position is untenable because those provisions concern protection zones (zonas de protección). However, when sources suitable for supplying water for human consumption are involved, the applicable special provision is section 31 of the Ley de Aguas. As stated, it is undisputed that the area sought to be recovered is limited to a portion of the property measuring approximately 2500 or 3000 square meters, where a fence surrounds the spring and the collection tanks used to supply water to the surrounding communities.
Thus, although the spring is indisputably located on private property registered with the Registro Nacional, the title to which has not been challenged, the description provided during the judicial inspection and the statements of witnesses [Nombre8] (fifth audio, minute 0:32 to 16:35) and [Nombre4] (fifth audio, minute 35:30 to 59:10) were consistent in indicating that the fence is located in that area; they also made evident the lack of communication between the ASADA and the property owner. Nor is the judgment deemed to grant the defendant association any right, because this is an area surrounding a spring where the cited provisions of the Ley de Aguas prevail. Rights of exploitation (derechos de explotación) fall within the authority of bodies specifically empowered by the legal system. In this case, because the only matter in dispute is limited to the area containing the spring and the tanks surrounded by the fence, and because the testimony indicates that the dispute between the parties is much broader, this Court is barred from resolving matters beyond those presented by the parties or from analyzing facts included only in the ancillary claim for damages (pretensión accesoria de daños).
In this case, the three prerequisites for the admissibility (presupuestos de procedibilidad) of the protective action are satisfied; nevertheless, its dismissal is due to the absence of a legal right, given the characteristics of the area to which the complaint was confined, pursuant to the rules of section 31 of the Ley de Aguas, as reasoned by this Court supra. Accordingly, as to the matters appealed, the judgment shall be affirmed.
THEREFORE (POR TANTO):
As to the matters appealed, the judgment rendered at fifteen hours forty-four minutes on doce de agosto de dos mil dieciséis is affirmed for the reasons stated by this Court.

VOTO N° 000739-F-2018 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas y veintiuno minutos del nueve de agosto de dos mil dieciocho.
PROCESO ORDINARIO establecido por VEINTISÉIS DE ENERO DEL CINCUENTA Y DOS P Y J SOCIEDAD ANÓNIMA, cédula de persona jurídica número CED1 - - , representada por su presidenta con facultades de apoderada generalísima sin límite de suma [Nombre1] , mayor, soltera, ama de casa, vecina de Alajuela, cédula de identidad número CED2 - - ; contra ASOCIACIÓN DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE RÍO CELESTE DE GUATUSO, ALAJUELA, cédula de persona jurídica número CED3 - - , representada por su presidente con facultades de apoderado generalísimo sin límite de suma [Nombre2] , mayor, divorciado una vez, agricultor, vecino de Guatuso, cédula de identidad número CED4 - - , y a [Nombre3] , mayor, casado una vez, chofer, vecino de Guatuso, cédula de identidad número CED5 - - . Actúan como apoderados especiales judiciales; de la parte actora, el licenciado Ricardo Salazar Hidalgo, mayor, divorciado en primeras nupcias, abogado, vecino de Alajuela, cédula de identidad número CED6 - - , colegiado número dos uno uno cero cero; y de la parte demandada, el letrado William Gerardo Rodríguez Acuña, mayor, casado una vez, abogado y notario, vecino de Guatuso, cédula de identidad número CED7 - - , carné número CED8 . Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos.
RESULTANDO:
1. La parte actora interpone la presente demanda ordinaria estimada en la suma de diez millones de colones -Ver imagen 11-, solicitando que se declare en sentencia lo siguiente: "1. Que se declare que la sociedad que yo represento es la única dueña y exclusiva propietaria de la finca inscrita al Partido de Alajuela, al Folio Real Mecanizado Número 223712-000, con plano catastrado número A-0703382-1987. 2. Que se me reivindique en todos los atributos del dominio sobre el bien y se desaloje e (SIC) los demandados en cuanto al área cercada con postes de madera y postes vivos y siete hilos de alambre de púas colocada por los demandados, en donde nos despojaron de toda posesión y disfrute sobre el área de protección de la naciente que mide aproximadamente media hectárea de terreno. Accesorias: 3. Que se condene a los demandados en forma solidaria, al pago de la totalidad de las costas procesales y personales de esta acción. 4.
Que se condene a los demandados en forma solidaria, al pago de SEIS MILLONES DE COLONES NETOS por concepto de daño moral, esto debido a los continuos abusos, perturbaciones, usurpaciones a mi fundo, y al despojo ilegal de un área de mi propiedad (cierre con cerca del área de protección de la naciente con una medida aproximada de media hectárea) y el fuerte deterioro de salud, y estados mentales y emocionales de mi persona, mi hijo [Nombre4] , y mis hijas [Nombre5] y [Nombre6] , producto de toda esta problemática. DAÑO MORAL: a) Actos perturbatorios al fundo en litis y a la persona de la señora [Nombre6] , desde hace más de diez años. Don [Nombre3] y los funcionarios de la ASADA entran y salen de la propiedad con Folio Real 2-223712-000, sin ninguna comunicación previa, y mucho menos con el permiso de Doña [Nombre6] o algún otro miembro de su familia, causándole enojo, angustia, frustración, estrés, depresión y un sentimiento de estado de indefensión a la señora [Nombre4] . b) Ampliación de la construcción del tanque de captación hace 4 años y construcción hace aproximadamente 2 años de un segundo tanque de captación de agua, esto sin ninguna comunicación o permiso previo de la señora [Nombre6] o algún miembro de su familia, causándole enojo, angustia, frustración, estrés, depresión y un sentimiento de estado de indefensión a la señora [Nombre4] . c) Actos de usurpación a la propiedad en litis, esto desde hace aproximadamente siete meses por la construcción de una cerca de alambre a siete hilos de alambre de púas en la mayoría de los tramos, esto alrededor del área de protección de la naciente, causándole enojo, angustia, frustración, estrés, depresión y un sentimiento de estado de indefensión a la señora [Nombre4] . d) Denuncia infundada al Ministerio Público contra la señora [Nombre6] por los presuntos delitos de "Daños" y "Usurpación de Bienes de Dominio Publico", en donde el Ministerio Público decide solicitar sobreseimiento definitivo de la causa penal y archivar el expediente, causándole enojo, angustia, frustración, estrés, depresión y un sentimiento de estado de indefensión a la señora [Nombre4] .

Gestos de transporte de la señora [Nombre6] para acudir a indagatoria de la Fiscalía, acudir a citas médicas y a farmacias.¢50,000,°°. Daño Moral Subjetivo:...¢5,500.000,°°. Aflicciones tales como preocupación, tristeza, aflicción, dolor, estrés, depresión y sentimiento de estado de indefensión.", (Ver Escritorio Virtual del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, escritos, de las once horas treinta y uno minutos con treinta segundos del veintiséis de diciembre del dos mil trece, Escrito Eelectronico/dic 26 2013 11:31AM/DEMANDA PARTE 6 (ESCRITO INICIAL); daño moral; escritos, de las trece horas treinta y siete minutos con doce segundos del diecisiete de enero del dos mil catorce, Escrito Eelectronico/ene 17 2014 1:37PM/CUMPLIMIENTO DE PREVENCIÓN).
2. La parte demandada, debidamente notificada, contestó la acción incoada en su contra, e interpuso las excepciones de falta de derecho, falta de legitimación y falta de interés actual, falta de agotamiento de la vía administrativa. Este último fue rechazada mediante la Auto-Sentencia N° 167-AS-2014, de las catorce horas cincuenta y tres minutos del dieciséis de octubre del dos mil catorce-Ver Escritorio Virtual del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, documentos asociados, de las catorce horas cincuenta y tres minutos con cuarenta segundos del dieciséis de octubre del dos mil catorce, 08. Resolución fondo excepciones/EV=16/10/2014 14:55 167-as-2014 FALTA DE AGOTAMIENTO VÍA ADMINISTRATIVA-), y excepción de incompetencia en razón de la materia (Esté último fue rechazada mediante el Voto N° 440-C-14, de las nueve horas quince minutos del veintiocho de mayo del dos mil catorce -Ver Escritorio Virtual del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, documentos asociados, de las nueve horas quince minutos con cinco segundos del veintiocho de mayo del dos mil catorce, Sentencia de Segunda Instancia (plantilla)/EV=28/05/2014 09:20 (Escritorio Virtual del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, escritos, de las trece horas cincuenta y un minutos con cero segundos del diecinueve de marzo del dos mil catorce, Escrito Eelectronico/mar 19 2014 1:51PM/ESCRITO PARTE 1 (CONTESTACION DE DEMANDA, PODER ESPECIAL JUDICIAL)).
3. La jueza Ana Milena Castro Elizondo, del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, mediante la sentencia Nº 129-S-2016 de las quince horas cuarenta y cuatro minutos del doce de agosto del dos mil dieciséis, resolvió: “POR TANTO: Se tienen por contestadas negativamente las preguntas de confesional 1, 3 y 4, así como la 2 respecto a declaración de parte efectuada al demandado [Nombre3] . Se rechazan las excepciones de falta de legitimación activa y falta de legitimación pasiva respecto a Veintiséis de Enero (SIC) del Cincuenta (SIC) y Dos (SIC) P y J Sociedad (SIC) Anónima y Asociación del Acueducto (SIC) y Alcantarillado Sanitario del Río Celeste de Guatuso Alajuela, respectivamente. Se acogen las excepciones de falta de legitimación activa respecto a la actora [Nombre1] () , falta de legitimación pasiva respecto al co-demandado [Nombre3] , y falta de derecho, interpuesta por la Asociación del Acueducto y Alcantarillado Sanitario de Río Celeste de Guatuso de Alajuela.
Se declara SIN LUGAR la demanda interpuesta por Amariles (SIC) [Nombre4] y Veintiséis de enero del cincuenta y dos P y J Sociedad Anónima contra [Nombre3] y Asociación del Acueducto y Alcantarillado Sanitario de Río Celeste de Guatuso de Alajuela. Se resuelve sin especial condenatoria en costas", (Escritorio del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, documentos asociados, de las quince horas cuarenta y cuatro minutos con tres segundos del doce de agosto del dos mil dieciséis, Sentencia primera instancia (plantilla) (actualiza fase conclusiva)/129-S-2016/EV=12/08/2016 15:47).
4. El licenciado Ricardo Salazar Hidalgo, en su condición de apoderado especial judicial de la parte actora, interpuso recurso de apelación con indicación expresa de las razones en que se apoyó para refutar la tesis del juzgado de instancia, (Escritorio Virtual del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, escritos, de las quince horas cero minutos con once segundos del veinticuatro de agosto del dos mil dieciséis, Incorporar Escrito - RECURSO DE APELACION/Agregar documento - 24 Aug 2016 03:00PM ).
5. En la substanciación del proceso se han observado las prescripciones legales, y no hay errores u omisiones capaces de producir la nulidad del fallo.
Redacta la jueza Díaz Bolaños; y,
CONSIDERANDO:
II.Se avala el segundo evento indemostrado por cuanto no se trajeron pruebas a los autos de lo ahí indicado. Se omite pronunciamiento sobre el primero por no ser objeto de apelación.
III.Se recurre la sentencia de las 15 horas 44 minutos del 12 de agosto de 2016 mediante la cual, en lo medular, declaró sin lugar la demanda y se resolvió sin especial condenatoria en costas (escritorio virtual del Juzgado Agrario de San Carlos, en modo PDF, imágenes 295 a 313). La apelación es rubricada por [Nombre7] , en su condición de apoderado especial judicial de la parte actora por las siguientes razones: 1. Acusa una indebida valoración de la legislación sustantiva. Refiere al artículo 41 de la Constitución Política, numerales 58, 69 y 60 de la Ley de Jurisdicción Agraria y 554, 559 y 560 del Código Procesal Civil. Hace mención a los considerandos IX y X, porque estima se analiza que todos los terrenos en un perímetro de 200 metros de los sitios de captación o tomas surtidoras de agua potable son de dominio público o bienes demaniales. En consecuencia, manifiesta hay una errada interpretación del artículo 31 inciso a) de la Ley de Aguas.
Agrega, el predio donde se encuentran las aguas explotadas por la ASADA es en uno privado, inscrito en el Registro Nacional. Trascribe el canon 7 sin precisar el cuerpo legal. Alega, la Ley de Aguas es de 1942 y la Ley de Tierras y Colonización de 1961, ambas son especiales, por lo que ley nueva modifica o deroga a la anterior. En el caso de los fundos de dominio privado, explica se aplica los numerares 33 y 34 de la Ley Forestal de 1996. Copia un segmento del dictamen de la Procuraduría General de la República número C-042-99 del 19 de febrero de 1999; un extracto de la sentencia de la Sala Constitucional de la Corte Suprema de Justicia número 4205-96 de las 14 horas 33 minutos del 20 de agosto de 1996. Analiza, en cuanto a áreas de protección el artículo 33 de la Ley Forestal, los propietarios ejercerán su dominio con la salvedad del 34 ibid. en cuanto a la corta o eliminación de árboles.
Revela, existe abundante legislación que obligan a prevenir la contaminación de las fuentes de agua e imponen castigos a quienes las infrinjan. Empero razona, no faculta a las ASADAS entren y salgan sin permisos de los dueños en propiedad privada y tampoco que edifiquen como cercas tupidas con alambres de púas para que no entre nadie alrededor, porque son diferentes a los bienes demaniales. En este asunto manifiesta, ante una emisión de una orden sanitaria del Ministerio de Salud, lo procedente era informar a sus representados, quienes son las personas despojadas del área, sobre la existencia tal documento. De esa manera hubiesen tomado las medidas preventivas y no les hubiera otorgado permiso a la ASADA para asumir el cumplimiento de la prevención. Considera, a sus representados se les hubiera podido procesar judicial y administrativamente por infracciones a diversas leyes. A su entender, la ASADA no tenía que actuar de forma prepotente como si ellos no fueran los dueños de la finca, colocando una cerca de alambre.
Trascribe los artículo 59, 64, 67 de la Ley Orgánica del Ambiente; numerales 73, 263, 275, 277, 278, 273, 285 de la Ley General de Salud; de la Ley de Uso Manejo y Conservación de Suelos, artículo 6, 44, 69, 94, 102. Reseña información de orden penal porque estima cuando los requerimientos legales son desatendidos el Estado tiene la potestad punitiva y la eventual responsabilidad civil por los daños y perjuicios. Cita los artículos 132, 162 y 259 del Código Penal. En el campo administrativo afirma hay sanciones como sanciones morales, advertencias por infracción, pecuniarias y resarcitorios de actos administrativos favorables. Copia el numeral 99 de la Ley Orgánica del Ambiente, el canon 155 inciso 10 del Reglamento de Uso, Manejo y Conservación de Suelos; la Ley General de Salud pues se establecen medidas entre estas la cancelación de permisos, numerales 340, 341, 355, 356, 363, 364. En cuanto a la Ley de Aguas trascribe los artículos 167, el numeral 101 de la Ley Orgánica del Ambiente.
Enfatiza la legislación cuenta con una amplia gama de posibilidades en cuanto a la prevención, sanción y restauración por actos contaminantes en perjuicios de fuentes productoras de agua, por lo que su protección y aseguramiento futuro es un problema de voluntad. Expone, las ASADAS son entes privados con funciones públicas que se rigen por el Derecho Público, y no hay norma legal para autorizar a los funcionarios de esos entes a entrar o a construir sin autorización en terrenos privados, y tampoco restar 3000 metros cuadrados de predio a sus dueños. Indica, la orden sanitaria del Ministerio de Salud obliga a los dueños a prevenir la contaminación de las fuentes de agua, sino tienen una sanción. Agravia, erróneamente aplicado el ordinal 31 de la Ley de Aguas porque solo aplica en terrenos baldíos y se resuelve contra sus representados al aceptar la excepción de falta de derecho, legalizando un despojo de terreno realizado por la ASADA de Río Celeste de Guatuso.
Suma a su argumento, por aplicación del artículo 7 inciso c) de la Ley de Informaciones Posesorias sobre tierras de propiedad privada se debe utilizar los numerales 33 y 34 de la Ley forestal y por abundante jurisprudencia constitucional donde no se puede privar a los dueños de sus fundos privados, de lo contrario se le debe expropiar el área en litis, lo que no ha ocurrido. 2. Estima hay una indebida valoración de la prueba. Considera del conjunto de probanzas su representada [Nombre6] compró en forma personal el predio hace 23 años. Para ese momento, relata se había construido un pequeño tanque de captación de agua. En el 2011 le traspasó a una sociedad donde ella figura como presidenta y apoderada generalísima. Afirma, el primer tanque no es el problema. El “error de interpretación” esta en la construcción por parte de la ASADA de un segundo tanque, más grande así como el cierre perimetral de 3000 metros cuadrados, en el 2011.
Esas obras se hicieron sin permiso de la sociedad actora, y señala en esa situación una apropiación indebida, el despojo, no es bien demanial, es propiedad privada, y la demandada no tiene asidero legal para permanecer en la finca en litis. Reseña el informe HN-ARS-G-SMC-184-2013 del 23 de mayo de 2013 emitido por el Ministerio de Salud, el cual versa sobre deficiencias del sistema de captación, y una de estas era la carencia de cerca de protección. Trascribe un segmento del citado documento. A su entender la demanda no presenta prueba de orden sanitaria del Ministerio en referencia donde se ordene acciones, o que le hayan informado a la apelante para obtener permiso para erguir la cerca. Lo que presenta acusa, es un informe de visita de inspección ocular. No se presenta una orden de cerrar con cerca, solo se recomienda. Tampoco a su criterio, hay prueba de la legalidad de la ASADA al derecho al acueducto con Acueductos y Alcantarillados, solo presentan la inscripción en el Registro Nacional pero no es prueba suficiente.
Concluye, aun en el evento de estar a derecho la ASADA es obligación mantener, reparar y prevenir contaminaciones en los sistemas de agua potable, pero al amparo de la legalidad, respetando la propiedad privada (imágenes 316 a 331).
IV.En virtud de lo agraviado estima esta Sede importante retomar lo pedido en este asunto. En imágenes 97 a 98 se encuentra deslindada la pretensión. En cuanto a la principal, la primera se solicita se declare la sociedad actora es única dueña y exclusiva propietaria de la finca del partido de Alajuela número CED9. El segundo requerimiento a la letra señala: “2. Que se me reivindique en todos los atributos del dominio sobre el bien y se desaloje e (sic) los demandados en cuanto al área cercada con postes de madera y postes vivos y siete hilos de alambre de púas colocada por los demandados, en donde nos despojaron de toda posesión y disfrute sobre el área de protección de la naciente que mide aproximadamente media hectárea de terreno…”. Por tal razón, se subraya, la reivindicación únicamente se limita a la zona alrededor de la zona de protección de la naciente. Se aclara al perecer las pretensiones principales, no se puede emitir pronunciamiento sobre las accesorias, las cuales contemplan el pago accesorio de daños.
Esta zona es identificada en el reconocimiento judicial (en tercer audio agregado al escritorio virtual del juzgado de origen del minuto 01:17 a 08:48), ubicada en el interior de la finca, cercano al centro de la propiedad y elevado. Aproximadamente estimó la persona juzgadora corresponde de 2500 a 3000 metros cuadrados. El sector en contienda se encuentra delimitado, con postes de madera, seis hilos de alambres, en la totalidad de la circunferencia que comprende o abarca tanques de captación utilizado por la ASADA demandada. Los contenedores se describen construidos en cemento; en la parte superior con cerámica, los cuales son independientes entre sí. Se observó bastante tubería que mantiene la captación del agua hacía el rumbo norte de la heredad. El primer tanque es de aproximadamente 10 metros cuadrados de construcción. El segundo, más pequeño y contiguo es de 5 metros cuadrados. Relata hay un área de protección forestal con bastante cobertura de aproximadamente 2500 a 3000 metros cuadrados. La foresta es propia de la zona. De conformidad con el artículo 54 de la Ley de Jurisdicción y el principio dispositivo, el debate de la acción protectora invocada debe limitarse a esa zona.
V.El primer reclamo contra la pieza apelada combate la valoración a la prueba, porque a su entender se trata de una finca inscrita, y la ASADA, que en lo sucesivo se hará referencia a la demandada la Asociación del Acueducto y Alcantarillado Sanitario de Río Celeste de Guatuso, carece de derecho para hacer labores sin permiso de la propietaria. Relativo a la orden sanitaria, consideran no se presentó prueba de orden de tal naturaleza, ni se les informó a los dueños esa deficiencia para obtener permiso para la edificación de la divisoria. Lo presentado es una visita de inspección ocular. Tampoco se aportó documentos para demostrar la ASADA está a derecho ante Acueductos y Alcantarillados. De acuerdo a lo observado en el reconocimiento judicial mencionado en el acápite anterior, y dado no es un tema controvertido (ver hecho quinto de la demanda y contestación imágenes 94 y 172 respectivamente), el conflicto se ajusta a la zona cercada.
En el centro de tal se ubica una naciente y tanques de captación para suministrar de ese fluido a una población. Relativo a la prueba indebidamente valorada, considera esta instancia carece de sustento el alegato. Consta en autos la orden sanitaria. En imágenes 179 a 182 se encuentra identificada con el número S-018-2013 del 28 de mayo de 2014, emitida por la Dirección de Rectoría de la Salud Huétar Norte, Área Rectora de Salud Guatuso. Tal documento es rubricado por la profesional en ingeniería ambiental Sharon Moncada Corrales, así como la notificación a quien ejercía la representación de la ASADA, Carlos Vargas Jiménez. En esa probanza se tomó como justificación el informe HN-ARS-G-SMC-184-2013, en aras de “proteger la salud de las personas y del ambiente”. Entre otros aspectos, se concedió el plazo no mayor a 66 días hábiles para realizar una serie de obras. Entre las decretadas en las nacientes se señaló: “Colocar cerca de protección que impida el acceso de personas o animales al sitio”.
El acto administrativo se encuentra debidamente agregado en autos. Por tal razón la ASADA tenía la obligación de cumplir con lo preceptuado. Como se resaltó del texto del documento en análisis, el fin último es la protección de la salud. Debe tenerse presente dos aspectos. El primero radica en que el suministro de agua potable es un derecho al que todas las personas deben tener acceso. Este tema ha sido abordado por la Sala Constitucional de la Corte Suprema de Justicia de la siguiente manera: “… III.- Derecho fundamental al agua potable. Este Tribunal ha reconocido en su jurisprudencia que el derecho a la salud y a la vida son derechos fundamentales del ser humano que dependen -en gran parte- del acceso al agua potable, y que los órganos competentes tienen la responsabilidad, ineludible, de velar para que la sociedad como un todo no los vea mermados..." (Voto Nº18633 de las 10 horas 50 minutos del 21 de diciembre de 2007).
De ahí, se arriba al segundo, en cuanto a las competencias en materia de salud, corresponden al Ministerio de Salud como ente rector. Así lo señala el canon segundo de ese cuerpo legal, el cual establece: “Es función esencial del Estado velar por la salud de la población. Corresponde al Poder Ejecutivo por medio del Ministerio de Salubridad Pública, al cual se referirá abreviadamente la presente ley como "Ministerio", la definición de la política nacional de salud, la normación, planificación y coordinación de todas las actividades públicas y privadas relativas a salud, así como la ejecución de aquellas actividades que le competen conforme a la ley”. Por tales motivos, más allá del derecho de propiedad que pretende sea tutelado la parte actora, prevalece el derecho a la salud. Aunque sendos tienen raigambre constitucional, predomina el interés general. De ahí, no es dable combatir en esta Sede lo ordenado por el ente rector de la salud en este país.
Por otra parte, la orden sanitaria fue expedida a la “ASADA Río Celeste” quien debía cumplir con lo ordenado. Si correspondía o no mediar comunicación con la mercantil titular del predio es un debate ajeno en este proceso, pues como se indicó, se trata de una acción protectora de reivindicación de la zona donde se ubica una naciente y tanques de captación, la competencia para ese tipo de controles corresponde a quien el ente administrativo se lo imponga. La orden sanitaria es de acatamiento obligatorio, pues tratándose de agua para consumo humano, la regulación así lo impone. El ordinal 268 ibid. establece todo abasto de agua potable, sin excepción, queda sujeto al control del Ministerio en cuanto a la calidad del agua que se suministre a la población y para velar porque los elementos constitutivos del sistema, su funcionamiento y estado de conservación garanticen el suministro adecuado y seguro, pudiendo ser intervenido por el Ministerio si hubiera peligro para la salud de los habitantes.
Concerniente a los agravios vinculados si la ASADA se encuentra funcionando a derecho, también es un tema ajeno al debate, pues se ha reiterado el cumplimiento de lo preceptuado por el Ministerio de Salud es incuestionable en este conflicto y prevalece la tutela de un derecho superior al derecho a la propiedad privada. No obstante, lo indicado, es relevante la declaración [Nombre8] , en archivo de audio número cinco, adicionado al escritorio virtual del juzgado de origen, minutos 0:32 a 16:35, quien indicó laborar para la ASADA. Relató que participó con el Ministerio de Salud, por una denuncia y los tuvo que acompañar. Relató que se hicieron varias visitas a [Nombre6] , porque tenían una orden judicial para no ingresar al predio. Explicó fue visitada por varias personas relacionadas con la ASADA para pedirle por escrito permiso, pero no lo quiso dar. En otra visita de [Nombre9] si dio permiso verbal, para pintar y hacer unas cercas, lo que no podían hacer era construir nada.
Revisadas las demás declaraciones ninguna aporta datos específicos a lo acontecido con la inspección y ejecución de la orden sanitaria. Es evidente, la existencia de un conflicto por la colocación de la cerca, pero sustentados en la normativa reseñada la misma era de acatamiento obligatorio por prevalecer la salud pública. En cuanto a la documental, resta en autos una copia de la denuncia penal tramitada bajo el expediente EXPN1 en imágenes 15 a 24 sin que permitan aportar datos para modificar lo aquí expresado.
VI.El otro reclamo es atinente a la errónea aplicación del cardinal 31 de la Ley de Aguas porque, según la teoría recursiva, solo se aplica a terrenos baldíos los cuales son del Estado y no se pueden usucapir. Estima se legalizó de algún modo el despojo del terreno por parte de la ASADA demandada. Considera por tratarse de una zona privada se debe aplicar los artículos 33 y 34 de la Ley Forestal. Esta tesis es insostenible porque tales regulaciones hacen mención a las zonas de protección. Empero, cuando se trata de fuentes aptas para abastecer consumo humano la norma especial aplicable es el 31 de la Ley de Aguas. Como se ha indicado, no es un hecho controvertido que la zona a reivindicar se circunscribe a una porción de la finca de aproximadamente 2500 o 3000 metros cuadrados donde se ubica una cerca que rodea la naciente y tanques de captación empleados para suministrar agua a las poblaciones circundantes.
Por esa razón, aunque es innegable la naciente se ubica en una propiedad privada, inscrita ante el Registro Nacional, cuyo título no ha sido cuestionado, por la descripción dada en el reconocimiento judicial y lo expresado por los declarantes [Nombre8] (audio quinto de minuto 0:32 a 16:35); y [Nombre4] (audio quinto de minuto 35:30 a 59:10) fueron contestes en indicar que la cerca se ubica en esa zona, además quedando en evidencia la falta de comunicación entre la ASADA y la propietaria del bien. Tampoco se considera la sentencia le conceda derecho alguno a la asociación demandada, pues se trata de una zona circundante a una naciente, donde prevalece la normativa referida de la ley de aguas. Los derechos de explotación son competencia de órganos específicamente dotados por el ordenamiento jurídica. En este caso, dado que lo único debatido se limita a la zona donde se ubica la naciente y los tanques rodeados por la cerca, pues de la testimonial se infiere el conflicto entre las partes es mucho más amplio, pero esta Sede esta imposibilitada para resolver aspectos ajenos a lo propuesto por las partes o bien analizar hechos que solo se incluyen en la pretensión accesoria de daños.
En la especie se configuran los tres presupuestos de procedibilidad de la acción protectora, sin embargo, el rechazo obedece a la falta de derecho por las cualidades de la zona a la cual se circunscribió la demanda, según las reglas del ordinal 31 de la Ley de Aguas, según razonó esta instancia supra, por lo cual procederá, en lo apelado, confirmar la sentencia.
POR TANTO:
En lo apelado, se confirma la sentencia de las quince horas cuarenta y cuatro minutos del doce de agosto de dos mil dieciséis por las razones dadas en esta instancia.
