Judges [Nombre3], José Manuel Cisneros Mojica, and [Nombre4] participated in deciding the appeal. Whereas:
1. No criminal costs are awarded. The civil claim for damages (acción civil resarcitoria) filed by the Office of the Attorney General of the Republic against civil defendant [Nombre6] is denied. The civil claimant is exempted from payment of costs because it litigated in good faith. The Municipality of Osa is ordered to demolish the structure located on the property registered in Puntarenas, Bahía Ballena sector, at boundary markers (mojones) [Dirección1], which is described in [Placa1] and registered in the name of [Nombre7]. 3. After the corresponding deliberation was conducted pursuant to Article 466 of the Code of Criminal Procedure, as amended by Ley 8837, published on nueve de diciembre de dos mil once (Creation of the Appeal from Judgment), the Court considered the issues raised in the appeal.

Considerations:
I.The oral hearing on the appeal was held at 10:00 hours on 29 de mayo de 2018, with the Criminal Judgment Appeals Court of Cartago composed of Judges [Nombre10], who presided, [Nombre4], and [Nombre3]. Also participating were counsel [Nombre5], as privately retained defense counsel (Defensor Particular) for defendant [Nombre1], who appeared; [Nombre11], representing the Public Prosecutor’s Office (Ministerio Público); and [Nombre12], representing the Office of the Attorney General of the Republic (Procuraduría General de la República).
II.The defendant [Nombre1] challenges judgment No. 09-2018, issued by the Criminal Court of the Second Judicial Circuit of the Southern Zone, Osa seat, on 19 de enero del 2018, whereby she was acquitted of all punishment and liability for the offenses of illegal logging, unlawful harvesting of forest products, and land-use change (cambio de uso de la tierra), to the detriment of Natural Resources; the demolition of her dwelling was likewise ordered. In her sole ground for appeal, she alleges deficient analytical reasoning.[Nombre2] The appellant states that, due to errors in the assessment of the evidence received at trial, the judge failed to consider that [Nombre7] acquired the property registered in Puntarenas under registration number [Placa2] in 2003, registering it in his name on 3 de abril of that year, as shown by the registry certifications submitted to the record. She states that the nature of that property has always been land containing cabins and scrubland (charral), which obviously permitted the construction of her dwelling; moreover, when the property was purchased, it had no annotations or restrictions indicating that the land was classified as forest.
Furthermore, it is a privately owned parcel measuring 5.799 square meters, not subject to environmental protection, except for the boundary lines or setbacks (alineamientos o retiros) that must be observed with respect to the banks of the streams located on the site. These requirements were fully complied with, as demonstrated by registered survey plan P-743355-2001, approved by INVU, which allowed the house to be constructed through completion. She emphasizes that, from the purchase of the property until completion of the dwelling, no state authority informed her that the land was subject to restrictions because it was classified as forest. Because of the foregoing, the trial judge decided to acquit her of all punishment and liability for the acts attributed to her, since it could not be established that she knew of any characteristic of the property that legally prevented her from constructing her dwelling.
This is even more evident from the fact that, when MINAET inspectors visited the property in question, inspected the house, and prepared their report, they did not at any time order any precautionary measure (medida cautelar) preventing construction from continuing. She states that, notwithstanding the foregoing and due to an erroneous interpretation of the law, the Trial Court ordered the house demolished, even though it had been built with all the required permits and, above all, without the registered owner having been joined to the proceeding. The appellant maintains that, from the time she gave her first statement, which occurred on 1º de octubre del 2010, she indicated that the property was not hers but her husband’s, a fact also noted in the reports submitted by the Sistema Nacional de Áreas de Conservación, but disregarded by the authorities of the Ministerio Público, who continued the proceeding against her.
In her view, this constitutes a serious violation of due process (debido proceso), through a clear disregard of the right of defense (derecho de defensa). She therefore requests that the challenged judgment be declared ineffective insofar as it orders the demolition of the dwelling constructed on the aforementioned property. The claim is granted. For the proper resolution of the appeal filed, it is important to note that, according to the registry certification submitted to the record, the property registered in Puntarenas under registration number [Placa3] has been owned by [Nombre7] since 3 de abril del 2003, is located in the district of Bahía Ballena de Osa, province of Puntarenas, and is described in registered survey plan P-0743355-2001. It was precisely on that property that this person constructed a 120-square-meter dwelling, which the challenged judgment ordered demolished. In this regard, the trial judge stated: [Nombre2]The Municipalidad de Osa is ordered to demolish the structure located on the property registered in Puntarenas, Bahía Ballena sector, at boundary markers 26-27-28, which is described in plan P-0743355-2001 and is registered to [Nombre7] , a fact established by the registry certification on pages 437 and 438, showing that the property corresponds to plan P-0743355-2001, which the defendant herself acknowledged as belonging to her husband [Nombre13] and herself.
There is therefore no confusion that this is the property on which the ten trees were cut and the dwelling was constructed. Now, based on Articles 103 of the Penal Code and 140 of the Code of Criminal Procedure, and Article 50 of the Political Constitution, although it has been shown that the registered owner of the property is [Nombre7] , the husband of [Nombre6] , Costa Rica recognizes the fundamental right to a healthy and ecologically balanced environment, and the protection of that right entails restrictions on the right to property, as well as on certain rights derived from or related to it. In this case, we are dealing with land under forest cover (cobertura de bosque), for which the prohibitions against changing land use without authorization from Minae are well known. Based on the foregoing, as was established at trial, the construction carried out within the property registered to [Nombre14] lacks any authorization and is therefore illegal; and because the consequence of its failure to comply with the law is demolition, it must be demolished.[Nombre2] (page 483).
However, that decision, which obviously affects [Nombre15]’s property rights, was adopted without his having been able to exercise his right of defense in the proceeding, since he was never formally notified not only of its existence, but also that he had the right to be heard, to present arguments in support of his property interests, and to produce or offer evidence relevant to those ends, for which purpose he could be represented and advised by attorneys. This omission unquestionably violated due process. Accordingly, the trial judge’s reasoning is unacceptable under any circumstances when she stated: [Nombre2]With respect to avoiding infringement of any right that Mr. [Nombre16] () (sic) may exercise as the registered owner of the property concerning the demolition, this judge considers that he need not be notified of this judgment because the construction is illegal and, consequently, he cannot benefit from that structure merely because it is located on his property; that is, there can be no assertion of rights or legitimate expectation of rights that could prevent the demolition of the indicated property, particularly since it is the dwelling in which the defendant currently resides…” (page 483).
The judge erred not only in stating that he need not be notified of this judgment, but also because he should have been treated as an interested party throughout the entire proceeding so that he could validly exercise the right to defend his property. A judicial decision was adopted that, unexpectedly and wholly arbitrarily, orders the State to destroy his dwelling. As the Sala Tercera has held: [Nombre2]in a State governed by the rule of law, before extinguishing the right to private property in any type of asset, a basic procedure must be followed that guarantees the owner the right to learn of the State’s intention, the opportunity to argue against it—the right of defense—and, where appropriate, to challenge the decision[Nombre2] (Voto 2007-00728 de las 11:15 horas del 20 de julio del 2007). In other words, the registered owner of the property should have been permitted to participate fully in the proceeding so that he could respond not only to the State’s punitive claim (pretensión punitiva estatal), but also to the real possibility that the demolition of his dwelling would be ordered, by summoning him as an interested party with standing to intervene in the case.
Failing to do so, as the court below decided,[Nombre2] disregards the essential content of the principles of due process, particularly the right of defense at trial and effective judicial protection (tutela judicial efectiva). The Sala Constitucional so established in its landmark decision 1739-92, de las 11:45 horas del 1 de julio de 1992: [Nombre2]The concept of due process comprehensively encompasses the progressive development of virtually all fundamental rights of a procedural or instrumental nature, understood as sets of guarantees protecting rights of enjoyment—whose exercise immediately satisfies human needs or interests—that is, the means intended to ensure their continued force and effectiveness.[Nombre2] Due process naturally imposes fundamental requirements on every proceeding or procedure, particularly those resulting in conviction, sanctioning proceedings generally, and even those culminating in the denial, restriction, or suppression of the rights or freedoms of private persons, or even of public entities insofar as they are third parties vis-à-vis the entity taking action.
However, because this is a consultation from the Sala Penal de la Corte framed within an appeal for review (recurso de revisión) in a criminal matter, the response from this point onward will be limited to identifying the conditions of due process in criminal matters. Our country has also experienced jurisprudential development of the constitutional provisions guaranteeing the procedural and substantive rights of persons subjected to proceedings, particularly criminal proceedings. Here, the central basis of the procedural guarantee has been Article 41 of the Constitution, interpreted as its primary source, together with Articles 35, 36, 39, and 42, regarded as its most specific manifestations in the field of criminal proceedings. The text of the first provides: “Article 41 [Nombre2] By resorting to the laws, everyone shall obtain redress for injuries or damages suffered to their person, property, or moral interests.
Justice must be administered to them promptly, fully, and in strict conformity with the laws.” From the final rule—“justice must be administered to them promptly, fully, and in strict conformity with the laws”—the Corte Suprema de Justicia, acting as a constitutional court, had already delineated the general and universal right to justice and to a fair proceeding.[Nombre2] Moreover, while Article 41 is the general provision, Article 39 is the specific provision for criminal matters, and from its proper interpretation—beyond a merely literal reading—a coherent system of rules, principles, values, and rights governing criminal procedure may be derived. The text—somewhat laconic, perhaps—provides: “Article 39. No one shall be made to suffer punishment except for an offense, quasi-offense, or infraction punishable under a preexisting law and pursuant to a final judgment issued by a competent authority, after the accused has been afforded an opportunity to exercise a defense and upon the necessary demonstration of guilt.[Nombre2] From this basic text, constitutional case law and secondary legislation have derived an entire system of procedural guarantees, especially in criminal matters—the subject of the present consultation—a system of guarantees that significantly expands upon, though certainly does not exhaust, the general principles of the cited Article 39.
International human rights instruments, the Penal Code and Code of Criminal Procedure, and other punitive laws develop the elements of this right with greater precision and detail, and the judgments of the Corte Suprema, when it exercised the functions of a constitutional court, confirm them, as was seen (sic) in the transcribed examples, because those judgments were required to compare the various statutory provisions challenged as unconstitutional against the text, principles, and values of Article 39 and of the Constitution generally.
V [Nombre2] Another constituent element of the right to due process (debido proceso) is its general applicability—numerus apertus—such that neither the text nor what the Chamber may state necessarily exhausts the possible catalog or typology of its elements […] D) THE RIGHTS TO A HEARING AND DEFENSE: In the terse language of our Constitution, the general right to defense (derecho general a la defensa), both in criminal matters and, generally, in any punitive matter or proceeding that may result in the elimination or restriction of individuals’ subjective rights (derechos subjetivos), is also enshrined in Article 39 of the Constitution and is further developed extensively in the Code of Criminal Procedure and in Article 8 of the American Convention on Human Rights, specifically paragraph 1 thereof for all proceedings and paragraphs 2 through 5 for criminal proceedings. The general right to defense entails other rights, particularly the right to a hearing (derecho de audiencia) and the principles of charging (imputación) and formal notice (intimación), as well as the right to proper reasoning or grounds (motivación o fundamentación debida) for every procedural ruling (resolución procesal). [Nombre2][Nombre2] Although it is true that the Constitutional Chamber itself, in that precedent, expressly stated that the specific considerations referred primarily to criminal proceedings and the accused, it is also true that it clearly established that the procedural principles of due process are common to the administration of justice in a democratic system and are therefore applicable to any proceeding, fundamentally those intended to restrict rights or powers or to affect legal situations (situaciones jurídicas) or legitimate interests (intereses legítimos).
The foregoing is of paramount importance to the proper disposition of the appeal (recurso), because [Nombre15], as the registered owner not only of the property on which the illegal logging was alleged to have occurred, but also of the dwelling whose demolition was ordered, did not participate fully in the trial proceedings brought against [Nombre17], even though, as in fact occurred, no judgment affecting his property interests could lawfully be issued without his participation. Under these circumstances, the ruling’s conclusion ordering the demolition of his dwelling is entirely unlawful, precisely because he was not summoned as the essential party that he was in these proceedings. This leads this Court of Appeal to declare ineffective the portion of the judgment under appeal (sentencia venida en alzada) that ordered the demolition of the dwelling built on the property registered in the Puntarenas Property Registry under record [Placa2], between boundary markers 26-27-28, as described in survey plan [Placa4].
A corresponding remand for retrial (juicio de reenvío) is not ordered because merely holding that procedural stage would not allow [Nombre15] to exercise his rights fully; accordingly, the possibility of ordering the demolition of that dwelling must be addressed by the Administration, in the appropriate forum and through the applicable administrative and judicial procedures.
THEREFORE
The appeal filed by [Nombre1] is granted. The judgment under appeal is declared ineffective insofar as it ordered the demolition of the dwelling built on the property registered in the Puntarenas Property Registry under registration number [Placa2], between boundary markers 26-27-28, as described in survey plan P-0743355-2001; the interested party may seek an order for the demolition of that dwelling before the appropriate administrative and judicial authorities and through the applicable administrative and judicial proceedings. Que mediante sentencia 09-2018 de las nueve horas treinta minutos del diecinueve de enero de dos mil dieciocho, el Tribunal de Juicio del Segundo Circuito Judicial de la Zona Sur, sede Osa, resolvió: [Nombre2]POR TANTO: De conformidad con lo expuesto y artículos 35, 37, 39 y 41 de la Constitución Política; 8 inciso 2 de la Convención Americana sobre Derechos Humanos; 11 de la Declaración Universal de Derechos Humanos; 14 del Pacto Internacional de Derechos Civiles y Políticos, 1, 11, 18, 20, 30, 31, 45, 50, 51 del Código Penal, artículos 3, 19, 61 inciso a) y c) de la Ley Forestal 7575, artículos 1, 2, 3, 6, 8, 75 al 77, 111 al 116, 142 y siguientes, 265, 267, 269, 324 y siguientes [Nombre2] 360, 361, 363, 364, 365, 366 del Código Procesal Penal; SE ABSUELVE DE TODA PENA Y RESPONSABILIDAD a [Nombre6] por los delitos de INFRACCIÓN A LA LEY FORESTAL EN LA MODALIDAD DE APROVECHAMIENTO ILEGAL DE PRODUCTOS FORESTALES Y CAMBIO EN EL USO DE LA TIERRA, cometido en perjuicio de LOS RECURSOS NATURALES.
Se resuelve sin condenatoria en costas en lo penal. Se declara sin lugar acción civil resarcitoria incoada por la Procuraduría General de la República en contra de la demandada civil [Nombre6] . Se exime del pago de las costas a la actora civil por haber litigado de buena fe. Se ordena la demolición por parte de la Municipalidad de Osa de la construcción ubicada en la propiedad del partido de Puntarenas, sector de Bahía Ballena, en los mojones [Dirección1], y que se encuentra descrita en el [Placa1] perteneciente registralmente a [Nombre7] . Firme el fallo, archívese y cancélese del libro de entradas. POR LECTURA NOTIFÍQUESE.
[Nombre8] . JUEZA.[Nombre2] (sic)
2. Que contra el anterior pronunciamiento, la encartada [Nombre1] interpuso el recurso de apelación.
3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.
4[Nombre2] Que en los procedimientos se han observado las prescripciones legales pertinentes.
Redacta el Juez [Nombre9] , y;
Considerando:
I.La audiencia oral para conocer del recurso de apelación se celebró a las 10:00 horas del 29 de mayo de 2018, integrándose el Tribunal de Apelación de Sentencia Penal de Cartago por los jueces [Nombre10] , quien presidió, [Nombre4] . y [Nombre3] . Intervinieron además los licenciados [Nombre5] en calidad de Defensor Particular de la imputada [Nombre1] , quien se apersonó; [Nombre11] en representación del Ministerio Público; y [Nombre12] en representación de la Procuraduría General de la República.
II.La encartada [Nombre1] impugna la sentencia nº09-2018, dictada por el Tribunal Penal del II Circuito Judicial de la Zona Sur, sede de Osa, el día 19 de enero del 2018, mediante la cual se le absolvió de toda pena y responsabilidad por los delitos de tala ilegal, aprovechamiento ilegal de productos forestales y cambio de uso de la tierra en perjuicio de Los Recursos Naturales; e igualmente se ordenó el derribo de su casa de habitación. En su único motivo de impugnación reclama una fundamentación analítica deficiente[Nombre2] Indica la impugnante que, debido a los errores en la apreciación de la prueba que se recibió en el juicio, la jueza dejó de considerar que [Nombre7] , adquirió la finca del partido de Puntarenas, matrícula [Placa2] desde el año 2003, inscribiéndola a su nombre el 3 de abril de ese año, tal y como consta en las certificaciones registrales aportadas a los autos. Manifiesta que la naturaleza de ese inmueble siempre ha sido terreno de cabañas y charral, lo cual, obviamente permitía la construcción de su casa de habitación; además, desde que se compró la finca la misma no tenía anotaciones o restricciones que implicara que el terreno fuese catalogado como bosque.
Se trata, además, de un terreno de 5.799 metros cuadrados, de carácter privado, sin estar afectado a protección ambiental, salvo los alineamientos o retiros que debe observarse con relación a las riberas de las quebradas que existen en el sitio, lo cual se cumplió cabalmente, tal y como se comprueba con el plano catastrado P-743355-2001, visado por el INVU, lo cual permitió la construcción de la casa hasta finalizarla. Enfatiza que, desde la compra del inmueble hasta la finalización de la construcción de la vivienda, ninguna autoridad estatal le comunicó que ese terreno estuviese afectado por tener una clasificación como bosque. Debido a lo anterior, la juzgadora decidió absolverla de toda pena y responsabilidad por los hechos que se le atribuyeron, ya que no se pudo comprobar que ella tuviese el conocimiento de alguna característica del inmueble que le impidiera, jurídicamente, la construcción de su casa la habitación.
Lo anterior se evidencia aún más, cuando los inspectores del MINAET visitaron el inmueble en mención, efectuaron una inspección de la casa y levantaron su informe, pero en ningún momento ordenaron alguna medida cautelar que impidiera la continuación de la construcción. Refiere que, a pesar de lo anterior, y debido a una errónea interpretación de la ley, el Tribunal de Juicio ordenó la demolición de la casa, a pesar de haber sido construida con todos los permisos exigidos para ello, y, sobre todo, sin haber sido llamado al proceso su propietario registral. Sostiene la recurrente que desde que rindió su primera declaración, lo cual sucedió el 1º de octubre del 2010, indicó que esa propiedad no era suya, sino de su esposo, aspecto que se hacía ver también en los informes remitidos por el Sistema Nacional de Áreas de Conservación, lo cual fue soslayado por las autoridades del Ministerio Público quienes siguieron el proceso en su contra.
Ello implica, de acuerdo a su criterio una grave infracción al debido proceso, por un claro irrespeto al derecho de defensa. Por lo anterior solicita se disponga la ineficacia del fallo impugnado en cuanto ordena demoler la casa de habitación construida en el inmueble mencionado. El reclamo se declara con lugar. Para la adecuada solución del recurso de apelación planteado, es importante mencionar que, de acuerdo a la certificación registral aportada a los autos, la finca del partido de Puntarenas matrícula [Placa3], es propiedad de [Nombre7] desde el 3 de abril del 2003, ubicada en el distrito de Bahía Ballena de Osa, provincia de Puntarenas, la cual se encuentra descrita en el plano catastrado P-0743355-2001. Fue precisamente en ese inmueble en el que esta persona construyó una casa de habitación con una medida de 120 metros cuadrados, la cual, mediante la sentencia impugnada se ordenó demoler.
Al efecto indicó la jueza de juicio: [Nombre2]Se ordena la demolición por parte de la Municipalidad de Osa de la construcción ubicada en la propiedad del partido de Puntarenas, sector de Bahía Ballena, en los mojones 26-27-28, y que se encuentra descrita en el plano P-0743355-2001 perteneciente registralmente a [Nombre7] , dato que se acredita mediante la certificación registral de folios 437 y 438 que esa propiedad pertenece al plano P-0743355-2001, misma que reconoció la propia imputada como de su esposo [Nombre13] y su persona. Es por ello que no hay confusión de que sea la propiedad donde se realizó la corta de los diez árboles y la construcción de la vivienda. Ahora bien, basada en los artículos 103 del Código Penal y 140 del Código Procesal Penal, 50 de la Constitución Política, aunque se haya demostrado que registralmente el dueño de la propiedad es [Nombre7] esposo de [Nombre6] , en Costa Rica existe el derecho fundamental a un ambiente sano y ecológicamente equilibrado y en tutela a ese derecho existen restricciones al derecho de propiedad, así como a algunos de aquellos derechos derivados o relaciones con el mismo, en este caso hablamos de terrenos con cobertura de bosque, para el cual son conocidas las prohibiciones para el cambio en el uso de la tierra sin autorización del Minae.
Con base en lo anterior, tal como se logró acreditar en juicio, la construcción realizada dentro de la propiedad registral de [Nombre14] no tiene autorización alguna, por lo que es ilegal, y siendo que su consecuencia es el derribo, por no cumplir con esa legalidad[Nombre2] (folio 483). Sin embargo, tal decisión, que obviamente afecta el derecho de propiedad de [Nombre15] , se adoptó sin que haya podido ejercer su derecho de defensa dentro del proceso, pues nunca se le notificó formalmente, no sólo la existencia del mismo, sino además que tenía el derecho a ser oído, presentando argumentos a favor de sus intereses patrimoniales y producir u ofrecer prueba pertinente a esos fines, para lo cual podía hacerse representar y asesorar por abogados, omisión que indudablemente lesionó el debido proceso. Por ello no es aceptable, bajo ninguna circunstancia, la consideración de la juzgadora cuando afirmó que: [Nombre2]Con respecto a no violentar el derecho que pueda ejercer el señor [Nombre16] () (sic) por ser el propietario registral del inmueble para proceder con el derribo, considera ésta juzgadora que no debe notificársele esta sentencia, por cuanto la construcción es ilegal y por ende no puede aprovechar esa construcción por estar en su propiedad, es decir, no puede haber reivindicación de derechos o una expectativa de derechos legítimos, que pudiese evitar el derribo del inmueble señalado; y máxime que es la vivienda donde actualmente vive la imputada…” (folio 483).
Yerra la jueza en indicar que no debe notificársele este fallo, sino que también debió haberse tenido como parte interesada a lo largo de todo el proceso para que pudiese ejercer válidamente el derecho de defensa de su propiedad. Se adopta una decisión jurisdiccional que, de manera sorpresiva y totalmente arbitraria, ordena la destrucción por parte del Estado de su casa de habitación. Tal y como lo ha sostenido la Sala Tercera: [Nombre2]en un Estado de Derecho, para proceder a dejar sin efecto el derecho de propiedad privada en cualquier clase de bien que se trate, debe seguirse un camino básico que garantice a su propietario el derecho de enterarse de la intención estatal, la posibilidad de argumentar en contra –derecho de defensa- y eventualmente de impugnar la decisión[Nombre2] (Voto 2007-00728 de las 11:15 horas del 20 de julio del 2007). Es decir, debió permitirse que el propietario registral del inmueble participara en el proceso plenamente, con la finalidad de poder hacer frente, no solo a la pretensión punitiva estatal, sino, además, a la posibilidad real de que se ordenara el derribo de su vivienda, convocándolo como parte interesada y legitimada para intervenir en la causa.
No hacerlo, como decidió la jueza a-quo[Nombre2] es soslayar el contenido esencial de los principios del debido proceso, especialmente de defensa en juicio y tutela judicial efectiva. Así lo estableció la Sala Constitucional desde el voto icónico 1739-92, de las 11:45 horas del 1 de julio de 1992: [Nombre2]El concepto del debido proceso envuelve comprensivamente el desarrollo progresivo de prácticamente todos los derechos fundamentales de carácter procesal o instrumental, como conjuntos de garantías de los derechos de goce -cuyo disfrute satisface inmediatamente las necesidades o intereses del ser humano-, es decir, de los medios tendientes a asegurar su vigencia y eficacia [Nombre2] Desde luego que el debido proceso genera exigencias fundamentales respecto de todo proceso o procedimiento, especialmente en tratándose de los de condena, de los sancionadores en general, y aun de aquellos que desembocan en una denegación, restricción o supresión de derechos o libertades de personas privadas, o aún de las públicas en cuanto que terceros frente a la que actúa; sin embargo por tratarse de una consulta de la Sala Penal de la Corte y enmarcada en un recurso de revisión de ese carácter, a partir de aquí la respuesta se concretará a señalar las condiciones del debido proceso en materia penal.
En nuestro país también se ha producido un desarrollo jurisprudencial de las normas constitucionales que garantizan los derechos procesales y sustantivos de la persona sometida a un proceso, especialmente penal. Aquí el eje de la garantía procesal ha sido el artículo 41 de la Constitución, interpretado como su fuente primaria, junto con los artículos 35, 36, 39 y 42, considerados como su manifestación más concreta en el campo del proceso penal. Dice el texto del primero: "Artículo 41 [Nombre2] Ocurriendo a las leyes, todos han de encontrar reparación para las injurias o daños que hayan recibido en su persona, propiedad o intereses morales. Debe hacérseles justicia pronta, cumplida y en estricta conformidad con las leyes". De la última regla -"debe hacérseles justicia pronta, cumplida y en estricta conformidad con las leyes"-, ya la Corte Suprema de Justicia, actuando como tribunal constitucional, había jalonado el derecho general y universal a la justicia y a un proceso justo [Nombre2] Más: si el artículo 41 es la norma genérica, el 39 es la específica para la materia penal, de cuya correcta interpretación -por encima de la meramente literal- puede deducirse un sistema coherente de reglas, principios, valores y derechos que presiden el procedimiento penal.
El texto -un tanto lacónico si se quiere-dice: "Artículo 39. A nadie se hará sufrir pena sino por delito, cuasidelito o falta, sancionados por ley anterior y en virtud de sentencia firme dictada por autoridad competente, previa oportunidad concedida al indiciado para ejercitar su defensa y mediante la necesaria demostración de su culpabilidad [Nombre2] De este texto básico, la jurisprudencia constitucional y la legislación secundaria han deducido todo un sistema de garantías procesales, especialmente en la materia penal -que es la que nos ocupa con motivo de la presente consulta-, sistema de garantías que amplía significativamente, sin agotar por cierto, los principios generales del artículo 39 citado. Los instrumentos internacionales sobre derechos humanos, los Códigos Penal y de Procedimientos Penales, y las demás leyes punitivas, desarrollan con mayor precisión y detalle los elementos de este derecho y las sentencias de la Corte Suprema cuando ejercía las funciones de tribunal constitucional, lo confirman, como se vió (sic) de los ejemplos transcritos, pues debieron confrontar las diferentes normas legales impugnadas de inconstitucionales con el texto, principios y valores de artículo 39 y en general de toda la Constitución.
V [Nombre2] Otro elemento constitutivo del derecho al debido proceso es su generalidad, -numerus apertus-, de manera que, ni el texto ni lo que diga la Sala agota necesariamente las posibilidades de un catálogo o tipología de sus elementos […]D) LOS DERECHOS DE AUDIENCIA Y DEFENSA: En el lenguaje escueto de nuestra Constitución, el derecho general a la defensa, y tanto en lo penal como, en general, en toda materia sancionadora o que pueda desembocar en la supresión o restricción de derechos subjetivos de las personas, está también consagrado en el artículo 39 de la Constitución, y se desarrolla, además, extensamente en el Código Procesal Penal y en el artículo 8 de la Convención Americana sobre Derechos Humanos, este último en sus párrafos 1, para todo proceso, y 2 a 5 específicamente para el proceso penal. El derecho general de defensa implica otros, particularmente el de audiencia y los principios de imputación e intimación, así como el derecho a la motivación o fundamentación debida de toda resolución procesal [Nombre2][Nombre2] Si bien es cierto la propia Sala Constitucional, en dicho precedente, explicitó que las consideraciones puntuales se referían básicamente al proceso penal y al acusado, también lo es que estableció claramente que los principios procesales del debido proceso resultan comunes al ejercicio de la Administración de Justicia en un sistema democrático y, por ende, aplicables a cualquier proceso, fundamentalmente en aquellos en que se pretenda restringir derechos, facultades o afectar situaciones jurídicas o intereses legítimos.
Lo anterior es de absoluta importancia para la correcta solución del recurso, pues [Nombre15] , como propietario registral, no sólo del inmueble en el cual se acusó la tala ilegal, sino además de la vivienda que se ordenó derribar, participara de manera plena en el juicio proceso seguido en contra de [Nombre17] , pues evidentemente, tal y como aconteció, no podía dictarse una sentencia que afectara sus intereses patrimoniales. En tales condiciones, la conclusión del fallo, que dispuso el derribo de su vivienda, es absolutamente ilegítima, precisamente porque no se le convocó como la parte esencial que era en este proceso, lo cual conduce a este Tribunal de Apelación a declarar la ineficacia de la sentencia venida en alzada en cuanto dispuso el derribo de la casa de habitación construida en la finca del Partido de Puntarenas matrícula [Placa2], entre los mojones 26-27-28, descrita en el plano [Placa4].
No se ordena el correspondiente juicio de reenvío ya que la sola celebración de esa etapa procesal no permitiría a [Nombre15] el ejercicio pleno de sus derechos, de modo que la posibilidad de ordenarse la demolición de esa vivienda deberá ser discutida por la Administración, en la sede y por los procedimientos administrativos y jurisdiccionales que correspondan.
POR TANTO
Se declara con lugar el recurso de apelación interpuesto por [Nombre1] . Se declara la ineficacia de la sentencia venida en alzada en cuanto dispuso el derribo de la casa de habitación construida en la finca del Partido de Puntarenas matrícula [Placa2], entre los mojones 26-27-28, descrita en el plano P-0743355-2001, pudiendo la parte interesada plantear la posibilidad de ordenar la demolición de esa vivienda en la sede y por los procedimientos administrativos y jurisdiccionales que correspondan. NOTIFÍQUESE.
