VOTO N° 522-F-2018 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At sixteen hours and fifteen minutes on the fourteenth of June, two thousand eighteen.- POSSESSORY ACTION FOR PROTECTION OF POSSESSION AND RESTITUTION (INTERDICTO DE AMPARO DE POSESIÓN Y RESTITUCIÓN) filed by ABUELOS LOS OLIVOS SOCIEDAD ANÓNIMA, corporate identification number CED1 - - , represented by [Nombre1], of legal age, married, merchant, resident of Puriscal, identity card number CED2 - - , in his capacity as general attorney-in-fact with unlimited authority; against [Nombre2], of legal age, divorced, farmer, resident of Candelarita de Puriscal, identity card number CED3 - - . CONSIDERING:
I.We do not agree with the first, second, and fourth facts found to have been proven, because the cited evidentiary support does not appear in the record. Only the third fact is adopted, as it reflects the notation acknowledging receipt of the complaint. Accordingly, this Court finds the following to have been proven:
5).- The disputed area constitutes a portion, approximately one hectare of land, of the real property recorded under registration number [Placa1] in the San José Registry District, registered in the name of 3101537621 Sociedad Anónima. The land as a whole consists of mountainous terrain and pastureland, with irregular topography comprising hillside areas and areas suitable for crops, and it contains three dwellings in fair condition. (undisputed fact; see also the judicial inspection (reconocimiento judicial) in video and audio, survey plan, registry certification, and photographs in Documentos Asociados 24/05/2013 08:38:54).- 6) For more than 36 years, the disputed area had been used by the defendant, [Nombre2], to cultivate pasture, rice, and cassava and to raise pigs; it was enclosed by fences made of living fence posts and others made of bamboo, and contained several small pigsties constructed of old wood and earthen floors. (see judicial inspection in video and audio, and testimony from [Nombre3], [Nombre4], and [Nombre5] in the audio recordings).-
II.The sole fact found not to have been proven is adopted, as no evidence exists in that regard.- This Court also adds the following facts of that nature:
III.The plaintiff timely appeals the trial court judgment number 201500158, issued at eight hours and eight minutes on the twenty-eighth of August, two thousand fifteen, principally arguing that the appealed judgment is affected by defects rendering it absolutely null and void. In this regard, it states, on the one hand, that on 08 de setiembre del 2014 the defendant submitted a document providing evidence for the court’s further consideration (prueba para mejor resolver), but that, according to the plaintiff, it was never notified of that document, nor did the court below (a quo) issue any assessment of that evidence. It adds that there was a clear omission giving rise to nullity. On the other hand, it maintains that it is even more serious that the record does not show that the parties were granted the six-day period for closing arguments (alegato de conclusiones) to address the weight of the evidence, as provided in Article 53 of the Ley de Jurisdicción Agraria.
It further complains that the judgment was issued after a delay of eleven months and nineteen days, which, it contends, constitutes noncompliance with the applicable rules. It also disputes the existence of an erroneous analysis by the trial judge regarding the expiration that was declared. It alleges that this was the only issue analyzed by the court below, but that the analysis was erroneous because, it argues, it is impossible for the expiration period to have elapsed between 08 de mayo del 2013 and 23 de mayo del 2013; rather, it states that only fifteen days had elapsed.-
IV.Regarding the claims that the appealed judgment is null and void, this Court finds that the grounds of error asserted by the appellant do not warrant relief. First, it must be considered that although the Ley de Jurisdicción Agraria, a special statute having priority of application in agrarian matters, applies in this field, Article 79 thereof provides, insofar as relevant, that: “When the judge must hear any matter that would ordinarily fall within the jurisdiction of the ordinary courts and that has not been expressly regulated by this law, the proceedings shall be governed by the procedure established for each case in the respective code....” Accordingly, it has repeatedly been held that this law regulates the ordinary proceeding par excellence, together with the essential principles applicable to other proceedings and, in particular, to summary proceedings (procesos sumarios), whose procedures must conform to the provisions of the codes applied on a supplementary basis.
Thus, in cases such as the present one, the procedure established in Article 432 et seq. of the Código Procesal Civil must be applied because this is a Possessory Action for Protection of Possession and Restitution, as must Article 457 thereof, also pursuant to Article 26 of the aforementioned law, because the primary purpose of these proceedings is to resolve the dispute through a more streamlined and expeditious procedure than an ordinary proceeding, while harmonizing it with the procedural principles that are regulated by the Ley de Jurisdicción Agraria.- It must be recalled that the stages forming part of an ordinary proceeding are clearly differentiated, but this is not so in possessory actions because they are summary proceedings.- In this regard, this Court does not agree with the first objection raised by the appellant, since an argument regarding the weight of the evidence (alegato de buena prueba) or a closing-argument stage is improper in possessory actions because no such stage exists in these proceedings; consequently, it provides no basis whatsoever for nullity.
V.On the other hand, the argument concerning evidence for better adjudication (prueba para mejor resolver) likewise cannot be deemed grounds for nullity of the appealed judgment.- In this regard, this Court has repeatedly held that, pursuant to Article 52 of the Ley de Jurisdicción Agraria, judges have discretion to admit evidence submitted for better adjudication.- Procedural law determines the stages established for offering ordinary evidence, duly incorporated into the proceedings, and such evidence must be ruled upon and assessed. In this regard, it must be recalled that all evidence must be offered in the parties’ principal pleadings, such as the complaint, the answer, and the plaintiff’s response thereto or rebuttal evidence (contraprueba).- The First Chamber of the Supreme Court of Justice, in its numerous rulings, has stated: “... This Chamber has repeatedly held that evidence for better adjudication is an instrument intended for the adjudicatory body.
It is a decision or power of judges to request some evidentiary element or admit an offer by the parties in order to clarify the facts. Thus, provision 331 of the CPC establishes that, once the proceedings are ready for judgment, the judges may order the taking of any evidence or expand upon the evidence received, provided they consider it decisively influential upon the outcome. This presupposes that the parties have already performed the evidentiary work incumbent upon them in accordance with the burden of proof imposed by the legal system. For this reason, it has also been stated that this mechanism cannot be used to ‘correct the parties’ omissions, negligence, or oversights regarding their respective burden of proof, or to remedy deficiencies in defense techniques (…) although it permits the incorporation of evidence that was rejected during the proceedings or declared inadmissible, void, or impossible to take, the decision to gather it is indeed discretionary for the judicial body; therefore, it is subject to the judge’s discretionary assessment, and the judge may dispense with it without the need for an express ruling’ (see, among others, judgment n° 213-F-SI-2008 at 8 hours 20 minutes on 25 de marzo de 2008; to the same effect, decision n° 880 at 8 hours 25 minutes on 14 de diciembre de 2007).”.- Accordingly, the appellant’s objection is unfounded.
This Chamber considers that failure to rule on the evidence identified as evidence for better adjudication does not give rise to any nullity because, as noted, its admission and eventual assessment are matters within the judge’s discretion, and the failure to admit or assess it does not give rise to any nullity.- On the other hand, the fact that the judgment was issued outside the legally established time limit likewise does not constitute grounds for nullity.- The appellant complains that the judgment was issued eleven months and nineteen days late and therefore maintains that it is null. In this regard, this Court does not agree with the objection raised because the law does not prescribe statutory nullity (Article 26 of Ley de Jurisdicción Agraria) as a procedural sanction in such cases, since these are directory rather than mandatory time limits. It must be noted that declaring nullity on this ground would further delay the parties in obtaining a decision; accordingly, this ground is rejected.
VI- Finally, with respect to the last objection, concerning the a quo’s erroneous assessment of expiration (caducidad) in the appealed judgment, this Chamber does not agree with the grounds asserted. Regarding this type of proceeding, it has been stated that possessory-summary relief (vía interdictal) in agrarian matters serves to protect agrarian possession (posesión agraria), which takes the form of agrarian possessory acts (actos posesorios agrarios) in the strict sense, and that this type of action seeks to protect present and immediate agrarian possession so that agricultural production activities are not affected and the productive purpose of agrarian property may be fulfilled.- Under the law in force, three requirements must be met in possessory-summary proceedings (proceso interdictal) for the complaint to succeed. Those three requirements are: a) Active standing (Legitimación Activa); that is, the plaintiff must be a present and immediate possessor, although the plaintiff need not necessarily hold the right of possession as such, since this factual situation is sufficient even if it involves present and immediate possession not based on lawful possession. b) Passive standing (Legitimación Pasiva): this status is held by the defendant, who is the person disturbing and/or dispossessing the present and immediate possession exercised by the plaintiff, or who benefits from the alteration of a boundary. c) Expiration: this means that the possessory-summary complaint must be filed within three months from the time the disturbing acts occur.- With particular regard to this last requirement, it has repeatedly been stated: “First, pursuant to provision 458 of the Código Procesal Civil, applied on a supplementary basis, calculation of the expiration period begins when the disturbing acts commence, not on the date when the plaintiff becomes aware of them.
In this regard, national legal scholarship has stated: ‘The expiration requirement, in both agrarian and civil matters, has prompted debate concerning its calculation for purposes of determining whether the complaint should be granted. First, it must be clarified that the three-month expiration period in both fields is the period established in art. 458 CPC, which repealed the one-year period under Articles 279 and 307 of the C.Ci. In both fields, it has consistently been held that the expiration period runs from the time the disturbing acts begin, not from when they are completed or from when the plaintiff becomes aware of those acts (...) We therefore understand that the acts of disturbance must be clear, evident, outwardly manifested, patent, public, and that the period is calculated from their outward manifestation; that is, the “commencement of the events” refers to relevant public events and not to concealed or surreptitious actions that the disturbing party might carry out without the disturbed party’s knowledge or that could not be discovered through the diligence of an ordinary person (...) Likewise, in both fields it has been determined that if the defendant erroneously raises the preliminary defense of prescription when expiration is actually applicable, the defense must be construed as the latter, and therefore dismissal in limine is not appropriate in cases where the wrong defense is raised.
Consequently, the judge must first analyze whether the facts are proper subjects of the possessory-summary complaint and, if such correspondence does indeed exist, then proceed to examine expiration.’ [Nombre6] ([Nombre7]) et al. Los Interdictos en materia civil, agraria y ambiental, San José, Dupas, 2008, p.p.713-716.” (see, among others, voto N°28 at 16:17hrs on 25/01/2018 of the Tribunal Superior Agrario).- In this case, the plaintiff alleges that, fifteen days before the filing of the complaint on 23 de mayo del 2013, the defendant, without the plaintiff’s authorization, built a bamboo fence approximately one hundred meters long, affecting what the plaintiff claims may be one hectare of land, and that the defendant also brings his cattle onto the land, as a result of which the plaintiff alleged disturbance and dispossession of his possession.- In that regard, the plaintiff contends that the appealed judgment established that the first disturbing acts occurred on 08 de mayo del 2013 and that, when the complaint was filed on 23 de mayo del 2013, only fifteen days had evidently elapsed, according to the plaintiff.
In this regard, although it is clear that the a quo made such a reference, the judgment as a whole shows that this was due to a clerical error whereby that date was stated instead of 14 de julio del 2012, as had been explained in the judgment. It should be noted in this regard that the a quo conducted the analysis on the basis that the disturbing acts had occurred since that time. The argument is therefore rejected. Nevertheless, this Chamber finds that the expiration declared by the a quo must be reversed because the evidentiary basis cited by the a quo in the appealed judgment—namely, images 2 through 7 of the Virtual Folder and images 113 through 115 of the virtual folder, corresponding to the initial complaint in these proceedings and the party’s request to substitute the power of attorney—does not establish that the facts alleged as disturbing acts in this possessory-summary complaint are in fact the same as those addressed in the principal complaint in proceeding EXPN1.
It must be borne in mind that the record contains no evidence establishing this circumstance from which it could be determined with certainty that the acts alleged as disturbing occurred more than three months before the filing of this possessory-summary complaint. Nor does it establish that, in this particular case, the disturbing acts were challenged at some other time or had occurred previously, as provided in Article 458 of the Código Procesal Civil.
VII.In these proceedings, Mr. [Nombre1], as representative of Abuelos Los Olivos S.A, alleges that the defendant, [Nombre2], built a bamboo fence approximately one hundred meters long, which he claims disturbed and dispossessed him, because it encloses on one side a type of paddock (aparto) covering approximately one hectare; he further claims that the defendant has been spraying and pulling up the grass, has brought cattle onto his property without his consent, and has destroyed fences through which cattle escape from his property, forcing him, he says, to search for them in other distant locations. Facts four and five of the complaint; these allegations are denied by the defendant, who states that he has been performing that work on his own property.- In this regard, the evidence submitted in the case includes the testimony of witness [Nombre8], who states, insofar as relevant, that: [Nombre1] “...has had this property for four years.
Since then, he has instructed me to build fences and clear brush. He told me to clear it because the fences were in poor condition and he was going to put cattle there, because he had purchased this property. At that time, [Nombre2] came by and asked me what they were doing to that land, and I told him that [Nombre1] had already said that he had purchased it and was therefore going to take possession of the property. After that, we continued working; we continued clearing brush, cutting vegetation, and sowing seed. [Nombre2] became angry... Other things happened afterward... We came and found the fences cut. I cannot say that he did it. I did not see him, but the fence was definitely cut. We had to go and retrieve cattle as far away as [Dirección1]... On some occasions, fences here on this property had been knocked down, and we came to repair them. Then on that other one and over there, that is, on three [Nombre9]... is the person currently in possession of the properties.
We have been repairing fences on both sides. We have been working on both sides of the properties. We have been clearing brush and sowing seed over there, and repairing fences and everything... I cannot say exactly how long it has been since Mr. [Nombre2] stopped keeping pigs, because I am a driver and I come only when [Nombre1] may ask me for a favor.”.- Witness [Nombre3], for his part, states, insofar as relevant, that: “...I have known [Nombre2] for more than 36 years. I have not worked with him, but I have been at his pigsties and seen the pigs, cattle, and all that. And he was the one who repaired the fences and everything. He was the one who established the pasture. What I know is that [Nombre2] has had that property for more than 36 years... I entered this place once when I went to have my property in La Cangreja appraised, approximately six months ago. [Nombre1] already had possession, because [Nombre10] was already in prison and all that...
Mr. [Nombre2] has worked these properties the entire time. I do not remember the exact date, but he has indeed been the owner. I saw [Nombre2] when he still had pigs up there as well, less than a year ago. They say that all those pigsties were knocked down and burned too.”.- Witness [Nombre5] states: “...We were working the field. I was doing my own work. Mr. [Nombre2] told me to work there. [Nombre2] lent me the land. Then some fellow, a worker for [Nombre1], threw me out. He told me to leave. He had been sent by [Nombre1]. All my life I have seen this pasture maintained by Mr. [Nombre2]. After that, I have not entered again, but I pass by every Monday on my way to my property. What I have observed is that [Nombre1] now has a caretaker.”.- Witness [Nombre4], for his part, states: “...[Nombre2] and I had a little rice crop; we made a rice field there approximately two years ago. Over there toward that field, on the left side of the property.
We were forced to remove that rice crop because [Nombre1] sent his laborer to tell us to remove it, and that otherwise he would put the cattle in. So we harvested it, even though it was not ready, and left because we had no other choice. [Nombre2] was the person I worked with. He worked with me. We worked there for almost a year. It is approximately one hundred meters to the left. We were already working and had been working there before [Nombre1] arrived here. ...We planted rice, cassava, and plantains. We had two cajuelas of rice. During the same period, two years ago... Mr. [Nombre2] had pigs approximately four years ago. [Nombre1] ordered the fences cut so that they could be put in. That man had some fences and they were cut; some bamboo he had was also cut. [Nombre2] had probably put up the bamboo to plant something. It was all burned when the property was burned. I do not know what happened regarding the burning of the property; I was not here, but it was approximately three years ago.
Mr. [Nombre2] was the person who maintained the property. Mr. [Nombre2] has been here on the property at all times; it is only now that he is in prison that he is not here, but before that he was always here. Mr. [Nombre2] has been in prison for approximately one month... Here on [Nombre1]’s land, I have not planted anything since I planted that little rice crop.- That property was in dispute. I did that little job with Mr. [Nombre2], but separately from him, there on his land. After that rice crop, I did not plant anything else. We worked there growing chili peppers and planting cassava and plantains; we had rows of cassava extending from over there. At the same time as the rice, we planted all of that.”.- These testimonies affirmatively establish that the defendant, [Nombre2], had personally exercised possession of the land, particularly the disputed area, for years. Although the defendant gave a party examination (confesional), it provides no significant admission that may be considered.
This is pursuant to Article 338 of the Código Procesal Civil, applied on a supplementary basis. However, the representative of the plaintiff company, in response to the question..... admits: “I have had possession of this property, where that issue is in dispute, for approximately two years and some unspecified amount of time; it is the date on which the document says that I took possession. And I have had this one for a little longer, perhaps approximately four years (area not in dispute).-” This leads this Chamber to conclude that he was not in possession of the disputed land. In addition, the judicial inspection (reconocimiento judicial) shows the actual condition of the disputed area, which, in very general terms, reveals an area that appears to have been used for raising pigs and where there is a fence forming a type of paddock. Nevertheless, this Court observes that, based on the evidence in the record, the evidence does not clearly demonstrate that the acts alleged to constitute disturbance—specifically, the construction of a bamboo fence, the apparent dispossession of one hectare of land, the removal and cutting of fences, or spraying and grass-removal work—occurred as acts of disturbance within the three months preceding the filing of the complaint.
Accordingly, this Court does not agree that sufficient evidence exists to conclude that the limitation period (caducidad) has expired with respect to the acts of disturbance alleged in facts four and five of the original complaint. Therefore, no expiration of the limitation period may be declared.
VIII.In view of the foregoing, having confirmed that this matter is not time-barred, this Court must determine whether the requirements of active and passive standing (legitimación activa y pasiva) applicable to possessory injunction proceedings (acciones interdictales) have been satisfied. Active standing is established when the plaintiff demonstrates that, at the time of the disturbance, it exercised actual possession of the land or areas in dispute; passive standing is established by demonstrating that the defendant was responsible for the alleged acts of disturbance. Regarding active standing, this Court notes that the witnesses’ statements indicate, in essence, that it was instead the defendant, [Nombre2], who had been working the land by raising pigs and cultivating rice, cassava, and plantains. It is therefore impossible to establish that the plaintiff exercised actual possession at that specific time.
Although witness [Nombre8] states that Mr. [Nombre1] had possessed the land for some time, when this is assessed together with his own party examination, in which he states that he had possessed the disputed area for only two years, these elements are not corroborated by additional evidence sufficient to establish certainty, primarily because they are contradicted by the statements of Mr. [Nombre3], Mr. [Nombre5], and Mr. [Nombre4], who generally indicate that the disputed area had been worked by Mr. [Nombre2] for years. It must be considered that although the witnesses clarify that, at the time of their testimony, Mr. [Nombre1] was on the land, those witnesses demonstrate that, during the preceding dates and years, it was the defendant, [Nombre2], who exercised possession of the land.- In addition, this Chamber observes that the evidence fails to establish that the defendant was responsible for the alleged acts of disturbance.
This Court considers that although the defendant, [Nombre2], had exercised possession of the land by raising pigs, planting rice, cassava, and other crops, also using the land as pasture, and building fences, as discussed above, that alone is insufficient to establish the existence of acts of disturbance per se against the alleged possession asserted by the plaintiff. This is because the evidence in the record does not establish that the defendant was responsible for cutting or building fences to dispossess the plaintiff or that he drove out its cattle.- It is important to note that in matters involving possessory injunctions (interdictos), whether for protection of possession (amparo de posesión) or restitution (restitución), issues concerning ownership rights or definitive possession of the land must not be litigated, because the purpose is to safeguard and protect the actual possession being exercised on the disputed land at the relevant time.
Accordingly, Article 317 of the Código Procesal Civil, applied on a supplementary basis pursuant to Articles 6, 26, and 79 of the Ley de Jurisdicción Agraria, provides: “The burden of proof (carga de la prueba) lies with: 1) A person asserting a claim, regarding the allegations concerning the facts constituting that person’s right. 2) A person opposing a claim, regarding allegations of facts that preclude, modify, or extinguish the plaintiff’s right.”- Under this provision, if the complaint seeks a declaration that acts of disturbance occurred against possession allegedly held by the plaintiff, the plaintiff bears the burden of proving those matters. Nevertheless, in this case, the requirements necessary for this action to proceed have not been established. This Chamber therefore concludes that this possessory injunction must be denied because the plaintiff lacks both active and passive standing in its claim against the defendant.
IX- Pursuant to Articles 1 and 2 of the Ley de Jurisdicción Agraria and Articles 317 and 461 to 465 of the Código Procesal Civil, the ruling declaring that the limitation period for the possessory injunction complaint filed by the plaintiff had expired must be reversed. In its place, the defenses of expiration of the limitation period and prescription (prescripción), the latter construed as expiration of the limitation period, must be denied, and the defenses of lack of a legal right (falta de derecho) and the general defense of sin actione agit must be granted because the plaintiff lacks both active and passive standing in its claim against the defendant. Consequently, the complaint seeking a possessory injunction for protection of possession and restitution filed by Abuelos Los Olivos S.A against [Nombre2] is denied, and costs are assessed against the plaintiff as the unsuccessful party, pursuant to Article 55 of the Ley de Jurisdicción Agraria.
POR TANTO
The plea of nullity (nulidad) is denied. The appealed judgment is partially reversed insofar as it upheld the defenses (excepciones) of expiration (caducidad) and statute of limitations (prescripción), construed as a defense of expiration, and insofar as it omitted, as unnecessary, a ruling on the defenses of lack of legal right (falta de derecho), lack of standing to sue (falta de legitimación activa), and lack of standing to be sued (falta de legitimación pasiva). Instead: The defense of expiration and statute of limitations, the latter construed as expiration, is denied. The defenses of lack of legal right raised by the defendant are upheld.- In all other respects appealed, the challenged judgment is affirmed.

VOTO N° 522-F-2018 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas y quince minutos del catorce de junio de dos mil dieciocho.- PROCESO INTERDICTO DE AMPARO DE POSESIÓN Y RESTITUCIÓN interpuesto por ABUELOS LOS OLIVOS SOCIEDAD ANÓNIMA, cédula jurídica CED1 - - , representada por [Nombre1] , mayor, casado, comerciante, vecino de Puriscal, cédula de identidad número CED2 - - , en su carácter de apoderado generalísimo sin límite de suma; contra [Nombre2] , mayor, divorciado, agricultor, vecino de Candelarita de Puriscal, cédula de identidad número CED3 - - . Actúan en este proceso como apoderados especiales: de la sociedad demandante, el letrado John Brenes Ortiz, mayor, divorciado, abogado, vecino de Moravia, cédula de identidad número CED4 - - , colegiado cuatro mil cuarenta; y del demandado, el licenciado Fernando Monge Hernández, mayor, casado, abogado, vecino de Junquillo Arriba de Puriscal, cédula de identidad número CED5 - - , carné doce mil ochocientos treinta y cinco. El proceso se tramita ante el Juzgado Agrario del Segundo Circuito Judicial de San José.-
RESULTANDO:
Redacta la jueza Sánchez Blanco y;
CONSIDERANDO:
I.No se comparten los hechos primero, segundo y cuarto tenidos por demostrados, por cuanto el sustento probatorio referido no consta en autos. Únicamente se prohíja el hecho tercero por ser reflejo de la razón de recibido de la demanda. De esta naturaleza, esta instancia tiene por demostrado que:
5).- El área en litigio constituye una parte, sea en aproximación a una hectárea de terreno, del inmueble matrícula número [Placa1] del Partido de San José, inscrita a nombre de la sociedad 3101537621 Sociedad Anónima, terreno que es en su totalidad es de naturaleza montaña y repastos, con topografía irregular con sectores de ladera, sectores para cultivos y cuenta tres casas de habitación en regulares condiciones de conservación. (hecho no controvertido, ver además reconocimiento judicial en video y audio, plano, certificación registral y fotografías en documentos asociados 24/05/2013 08:38:54).- 6) El área objeto de litigio venía siendo dedicado por el señor demandado [Nombre2] por más de 36años para el cultivo de pastos, arroz, yuca, cría de cerdos, cercados con cercas de postes de pega y otras de bambú, y algunos pequeños chiqueros en madera vieja y tierra para cerdos. (ver reconocimiento judicial en video y audio, y testimoniales de [Nombre3] , [Nombre4] , y [Nombre5] en audios).-
II.Se prohíja el único hecho indemostrado por no existir prueba al respecto.- Se agrega en esta instancia además de esta naturaleza que:
III.Apela en tiempo la parte actora la sentencia de primer instancia número 201500158 de las ocho horas y ocho minutos del veintiocho de agosto del dos mil quince, reclamando en lo medular que la sentencia recurrida tiene vicios de nulidad absoluta. Al respecto, expone que por un lado, la parte demandada presentó en fecha 08 de setiembre del 2014 un documento en el que aportó prueba para mejor resolver, pero que según dice, jamás se le puso en conocimiento, y que tampoco se emitió por parte del a quo criterio en torno a esa prueba. Agrega que hubo una clara omisión que genera nulidad. Sostiene por otro lado, que aún más gravoso es que no consta en el expediente que se hubiera otorgado el alegato de conclusiones de seis días a las partes para alegar buena prueba, de acuerdo a lo que se refiere en el artículo 53 de la Ley de Jurisdicción Agraria. Reclama además que la sentencia fue dictada con una tardanza de once meses y diecinueve días, lo que según dice genera un incumplimiento de la normativa.
Refuta por otro lado que existe un análisis erróneo por parte del juzgador de primer instancia en cuanto a la caducidad decretada. Alega que es el único elemento analizado por el a quo, pero que el mismo se ha realizado de manera equivocada debido a que se contabiliza, según sostiene, que es imposible que entre el plazo del 08 de mayo del 2013 al 23 de mayo del 2013 haya transcurrido el plazo de caducidad, sino que dice hubo solo quince días.-
IV.En torno a los aspectos de nulidad en contra de la sentencia recurrida, observa este Tribunal que no son de reparo los motivos de agravio expuestos por el recurrente. En primer lugar es necesario considerar que si bien en materia agraria, existe la Ley de Jurisdicción Agraria, normativa especial de aplicación prioritaria en esta materia, se dispone en su artículo 79, en lo que interesa que: "Cuando el juez deba conocer de algún negocio, que ordinariamente sea de competencia de los tribunales comunes, y que no haya sido objeto de regulación expresa en esta ley, sujetará su tramitación al procedimiento que en cada caso establece el respectivo código...".Dado a ello, de manera reiterada se ha sostenido que se regula en esta ley, el procedimiento ordinario por excelencia, junto a los principios esenciales aplicables en los demás procesos, y en el particular los de naturaleza sumaria, debiendo estarse en relación a los procedimientos de estos, a lo dispuesto en los códigos de aplicación supletoria.
De tal suerte, para casos como el presente, debe darse la aplicación del procedimiento previsto en el artículo 432 y siguientes del Código Procesal Civil, por encontrarse frente a un Interdicto de Amparo de Posesión y Restitución; así como lo dispuesto en el artículo 457 ibídem, en aplicación también a lo dispuesto en el artículo 26 de la referida ley, pues el objetivo principal de estos procesos es la solución del conflicto por un procedimiento más ágil y expedito que un procedimiento ordinario, eso sí, armonizado con los principios procesales que sí encuentran regulación en la Ley de Jurisdicción Agraria.- Es necesario recordar, que existe claramente diferenciación de etapas que conforman parte del proceso ordinario pero no así de los procesos interdictales, por ser estos procesos sumarios.- En este sentido, no comparte este Tribunal el primero de los reproches apuntado por el recurrente, toda vez que es improcedente el alegato de buena fe o etapa de conclusiones en los procesos de interdicto, por cuanto esta etapa en estos procesos no existe; por lo que en nada genera motivo de nulidad.
V.Por otro lado, en relación al alegato referente a la prueba para mejor resolver tampoco puede considerarse motivo de nulidad de la sentencia recurrida.- Al respecto se ha sostenido de manera reiterada por este Tribunal, que de conformidad con el artículo 52 de la Ley de Jurisdicción Agraria le es facultativo a las personas juzgadoras admitir prueba presentada para mejor resolver.- El ordenamiento procesal determina cuales son los momentos previstos para ofrecer prueba ordinaria, oportunamente incorporada al proceso y sobre tal debe mediar pronunciamiento y valoración. Al respecto ha de recordarse, toda la prueba debe ser ofrecida en los actos de parte principales, tales como demanda, contestación y pronunciamiento de la actora sobre ésta o contraprueba.- La Sala Primera de la Corte Suprema de Justicia, en sus múltiples criterios ha indicado: "... Esta Sala ha sostenido en reiteradas ocasiones que la prueba para mejor proveer es un instrumento concebido para el órgano juzgador.
Constituye una decisión o facultad de los jueces solicitar algún elemento de convicción o admitir el ofrecimiento de las partes, a fin de obtener claridad sobre los hechos. Así, el precepto 331 del CPC dispone que listo el proceso para el dictado de la sentencia, los juzgadores podrán disponer la práctica de cualquier medio probatorio o ampliar los recibidos, siempre que lo consideren de influencia decisiva en el resultado. De esta manera, presupone que las partes ya desplegaron la labor demostrativa que les corresponde de acuerdo a la carga probatoria que impone el ordenamiento jurídico. Por este motivo, se ha manifestado también que el instituto no puede utilizarse para “corregir las omisiones, negligencias o descuidos de las partes en cuanto a la carga probatoria que les incumbe o bien subsanar deficiencias en las técnicas de defensa (…) si bien permite incorporar probanzas que fueron rechazadas en el proceso, declaradas inadmisibles, nulas o inevacuables, ciertamente, la decisión de recabarla es facultativa del órgano jurisdiccional, ergo, corresponde a una valoración discrecional del juzgador, quien puede prescindir de ella sin necesidad de resolución expresa” (ver entre otras sentencia n° 213-F-SI-2008 de las 8 horas 20 minutos del 25 de marzo de 2008; en el mismo sentido la resolución n° 880 de las 8 horas 25 minutos del 14 de diciembre de 2007).".- Dado a ello, el reproche hecho por el recurrente no tiene lugar.
Considera esta Cámara que no genera nulidad alguna el no pronunciarse respecto a la prueba referida como prueba para mejor resolver, debido a que conforme se observa, su admisión y eventual valoración resultan un aspecto discrecional del juzgador, que de no darse, no se genera nulidad alguna.- Por otro lado, tampoco es motivo de nulidad que la sentencia se dictara fuera del plazo legal establecido para los efectos.- Reclama el recurrente que la sentencia fue dictada con una tardanza de once meses y diecinueve días, por lo que sostiene hay nulidad de la misma. Al respecto, no comparte esta Sede el reproche reclamado, por cuanto la ley no prescribe nulidad legal (artículo 26 de Ley de Jurisdicción Agraria) para estos casos como sanción procesal, pues se trata de plazos ordenatorios no perentorios. Debe observarse que el declarar una nulidad por este motivo le repercutiría más a las partes para lograr la obtención del fallo, por lo cual se rechaza ese motivo.
VI- Finalmente, en relación al último de los reproches referentes a la errónea valoración de la caducidad hecha por el a quo en la sentencia recurrida, no comparte esta Cámara los motivos alegados. En torno a este tipo de procesos, se ha indicado que la vía interdictal en materia agraria, es para proteger una posesión agraria que se traduce en la realización de actos posesorios agrarios propiamente dichos, y que mediante este tipo de acciones se busca proteger la posesión agraria actual y momentánea, a efecto de que las actividades agrarias de producción no sean afectadas, y para que se pueda cumplir con el destino productivo de los bienes agrarios.- De acuerdo a la normativa vigente, en un proceso interdictal deben configurarse tres presupuestos para que prospere la demanda. Esos tres presupuestos lo son: a) La Legitimación Activa; es decir que el actor sea un poseedor actual y momentáneo, no necesariamente éste debe ostentar el derecho de posesión como tal, basta esa situación de hecho, aunque se trate de una posesión actual y momentánea no basada en una posesión legítima. b) La Legitimación Pasiva: tal condición la reúne la parte demandada, quien es la persona que perturba y/o despoja la posesión actual y momentánea ejercida por el actor, o bien es quien se beneficia con la alteración de límite. c) La caducidad: se traduce en que la demanda interdictal debe interponerse dentro de los tres meses siguientes contados a partir del momento en que se producen los actos perturbatorios.- Particularmente en cuanto este último, de manera reiterada se ha dicho que: "En primer lugar, el cómputo del término de caducidad inicia, de acuerdo con el numeral 458 del Código Procesal Civil, aplicado supletoriamente, desde el momento en que inician los actos perturbatorios, no desde que la fecha en que el actor toma conocimiento de ellos.
Al respecto ha indicado la doctrina nacional: "El presupuesto de caducidad, tanto en materia agraria como civil, ha generado discusiones sobre su cómputo, para los efectos de la estimación de la demanda. En primer lugar hay que aclarar que el término de caducidad de tres meses, en ambas materias, es el previsto en el art. 458 CPC, el que derogó, el plazo de un año de los artículo 279 y 307 del C.Ci. En ambas materias, el criterio es reiterado en cuanto a que el término de caducidad corre desde el momento en que comienzan los actos perturbatorios, no desde que éstos se consumen ni desde el momento en que el actor toma conocimiento de tales actos (...) Por eso entendemos que los actos de perturbación deben ser claros, evidentes, exteriorizados, patentes, públicos y el término se contaría a partir de la exteriorización de tales, es decir el “comienzo de los hechos” sería de los hechos públicos relevantes y no acciones ocultas o subrepticias que pudiera realizar el perturbante, sin conocimiento del perturbado o sin que en la diligencia de hombre normal pudieran ser conocidos (...) Asimismo, en ambas materias se ha determinado que si la parte demandada opone erróneamente la excepción previa de prescripción, cuando en realidad lo que cabe es la caducidad; se debe entender por ésta última, por lo que no cabe el rechazo ad limine en casos de errónea oposición.
En consecuencia, el Juez debe analizar primero si los hechos son objeto de la demanda interdictal, y si efectivamente existe esta correspondencia, entra entonces en el examen de la caducidad." [Nombre6] ([Nombre7]) y otro. Los Interdictos en materia civil, agraria y ambiental, San José, Dupas, 2008, p.p.713-716." (ver entre otros voto N°28 de las 16:17hrs del 25/01/2018 del Tribunal Superior Agrario).- En este caso, la parte actora recrimina que el demandado quince días a la interposición de la demanda del 23 de mayo del 2013, éste sin su autorización, construyó una cerca de bambú de aproximadamente cien metros generando una afectación de lo que dice puede ser una hectárea de terreno, y que además ingresa ganado suyo con lo que alegó sentirse perturbado y despojado en su posesión.- En ese sentido, acusa la parte que se estableció en la sentencia recurrida que los primeros actos perturbatorios se dan para el 08 de mayo del 2013 y que para cuando se establece la demanda el 23 de mayo del 2013 evidentemente sólo habían transcurrido quince días, según dice.
Al respecto, si bien es notorio que el a quo hace tal referencia, se observa de la redacción integral de la sentencia, que ello obedeció a un error material por el que indicó esa fecha y no el 14 de julio del 2012, como venía explicando en la sentencia. Véase al respecto, que el a quo hace análisis considerando que los actos perturbatorios se dan desde ese momento. Motivo por el cual se rechaza su alegato. No obstante, observa esta cámara que la caducidad declarada por el a quo debe ser revocada, toda vez que del sustento probatorio indicado por el a quo en la sentencia recurrida, sea las imágenes 2 a 7 de la Carpeta Virtual e imágenes 113 a 115 de la carpeta virtual, correspondientes a la demanda inicial de este proceso y solicitud de sustitución del poder realizado por la parte, no es posible desprender que en efecto, los hechos planteados en esta demanda interdictal como perturbatorios, sean los mismos que se tramitaran por la demanda principal del proceso EXPN1.
Tómese en cuenta que no existe ningún elemento probatorio en autos que acredite esta situación y de la cual se pueda desprender a ciencia cierta que los hechos acusados como perturbatorios hayan sido ocurridos con exactitud desde antes de los tres meses a la interposición de la demanda de este interdicto. Y que en el particular, los hechos perturbatorios hayan sido reclamados en algún otro momento, o que estos se hubieran dando con anterioridad, de acuerdo a lo previsto en el artículo 458 del Código Procesal Civil.
VII.En este proceso, acusa el señor [Nombre1] como representante de la sociedad Abuelos Los Olivos S.A, que el demandado, [Nombre2] , le construyó una cerca de bambú de aproximadamente cien metros, que dice le perturbó y despojó, debido a que rodea por un costado, una especie de aparto que puede abarcar aproximadamente una hectárea, y que dice le ha estado, fumigando y arrancando el pasto, y que además ha introducido ganado a su finca sin su consentimiento y destruido cercas por donde saca el ganado de su propiedad, el cual dice ha tenido que buscar en otros lugares lejanos. Hechos cuarto y quinto de la demanda; mismos que rechaza el demandado, al indicar que esos trabajos los ha estado haciendo en su propiedad.- En tal orden, se tiene de los elementos probatorios aportados al caso que, el testigo [Nombre8] , indica en su declaración, en lo que interesa que: [Nombre1]"... tiene esta finca desde hace cuatro años.
Desde ese tiempo me mandó a hacer cercas y a chapear. Él me mandó a limpiar porque las cercas estaban malas, que iba a echar ya ganado, porque él esta finca había comprado. En ese momento [Nombre2] pasó me dijo que qué le estaban haciendo a eso, y yo le dije que ya [Nombre1] había dicho que había comprado y que entonces se iba a posesionar ya de la finca. Después de eso seguimos trabajando ya, se siguió limpiando, chapeando, regando semilla. [Nombre2] salió bravo... Después si hubieron otras cosas... Vinimos y las cercas estaban cortadas. No puedo decir que él fue. Yo no lo ví, pero de que la cerca estaba cortada, estaba cortada. De que tuvimos que ir a recoger un ganado hasta el [Dirección1] , tuvimos que ir... Habían ocasiones que habían cercas botadas acá en esta finca y que vinimos a repararlas. Después en esa otra y allá, o sea en tres [Nombre9]... es quien está actualmente en posesión de las fincas.
Nosotros hemos estado arreglando cercas a ambos lados. Hemos estado trabajando a ambos lados de las fincas. Hemos estado chapeando, regando semilla en aquel lado, y arreglando cercas y todo... No puedo decir con exactitud hace cuanto ya no tiene cerdos don [Nombre2] porque yo soy chofer y en los momentos que talvez [Nombre1] me pide un favor es que vengo.".- Por su parte, el testigo [Nombre3] , dice en lo que interesa que: "...Yo a [Nombre2] lo conozco desde hace más de 36 años, yo con él no he trabajado pero sí he estado en las chancheras de él viendo los chanchos y el ganado y todo eso. Y las cercas es él quien las reparaba y todo eso. El pasto fue quien lo hizo. Yo lo que sé es que [Nombre2] tiene más de 36 años de tener esa finca... Entré a este lugar una vez que fui a hacerle un avaluó a la finca mía en La Cangreja, hace como seis meses de eso. Ya [Nombre1] tenía la posesión, porque [Nombre10] ya preso y todo eso...
Todo el tiempo don [Nombre2] ha estado haciendo estas fincas él. No tengo la fecha totalmente aclarada en la mente mía, pero sí el propietario ha sido él. A [Nombre2] lo vi cuando tenía chanchos allá arriba también, hace ni un año de eso. Que dicen que todos esos chiqueros se los botaron y se los quemaron también.".- El testigo [Nombre5] indica: "... Estábamos trabajando el llano. Yo estaba haciendo trabajos míos. Don [Nombre2] me dijo que le trabaja ahí. [Nombre2] me prestó el terreno. Entonces un carambas, un trabajador de [Nombre1], me echó afuera. Me dijo que saliera. Fue mandado por [Nombre1]. Yo toda la vida he visto este pasto hecho por don [Nombre2]. Después de eso yo no he vuelto a entrar pero paso todos los lunes a mi finca. Lo que yo he observado es que ahora [Nombre1] tiene un cuidador.".- El testigo [Nombre4] , refiere al por su parte:"...[Nombre2] y yo tuvimos un arrocito, hicimos un arrozal ahí como hace dos años.
Allá para aquel llano, al lado izquierdo de la finca. Ese arrozal nos obligaron a sacarlo, porque [Nombre1] mandó el peón a que le sacaramos eso, que si no echaba el ganado. Entonces nosotros lo que hicimos fue cortar aunque no estaba puesto y salir porque no quedaba de otra. [Nombre2] era con quien yo trabajaba. Él trabajó conmigo. Tuvimos como un año casi de estar trabajando ahí. Esta como a cien metros del lado izquierdo. Nosotros estábamos trabajando ya teníamos de trabajar, todavía [Nombre1] no había llegado aquí. .. Sombrábamos arroz, yuca, plátano. Teníamos dos cajuelas de arroz. En la misma época hace dos años... Don [Nombre2] tuvo cerdos tuvo hace unos cuatro años. [Nombre1] mandó a cortar las cercas para echarlos. Ese señor tenía unas cercas las cortaron, unos bambús que tenía también se los cortaron. El bambú lo había puesto [Nombre2] seguro para sembrar algo. Eso lo quemaron todo cuando quemaron la finca.
No sé que fue lo de la quema de la finca, no estaba aquí pero fue hace como tres años. Don [Nombre2] fue quien daba mantenimiento a la finca. Don [Nombre2] aquí, hasta ahora que está en la cárcel es que no está en la finca, pero antes de eso siempre ha estado aquí. Don [Nombre2] tiene como un mes de estar en la cárcel... Aquí donde [Nombre1] desde que sembré ese arrocito no he vuelto a sembrar.- Esa propiedad estaba en pleito. Yo hice ese trabajito con don [Nombre2] , pero con exclusión de él, ahí donde él. Después de ese arroz no sembré más. Ahí trabajamos para chile, en la siembra de yuca y plátano, que teníamos unas calles de yuca desde allá. Cuando el mismo arroz, sembramos todo eso.".- Tales testimonios desprenden en afirmación, que es el señor demandado [Nombre2] , quien en su persona, venía ejerciendo la posesión del terreno y particularmente del área en conflicto desde años atrás.
Por otro lado, pese a que hubo confesional del demandado, esta no aporta ningún aspecto que en confesión se pueda rescatar de importancia. De acuerdo a lo dispuesto en el artículo 338 del Código Procesal Civil, aplicado supletoriamente. Pero sí el señor representante de la sociedad actora quien, ante la pregunta..... confiesa: "De esta finca donde está en discusión el tema ese tengo la posesión hace aproximadamente desde dos años y algo no preciso, es la fecha en que dice el documento que yo entro en posesión. Y de esta si tengo un poco más, talvez unos cuatro años (área fuera de litigio).- Lo que hace ver a esta Cámara que no se encontraba en posesión del terreno en litigio. Adicionalmente, del reconocimiento judicial se logra apreciar la situación real del área en conflicto, donde de una manera muy general, refleja la existencia de un área que en apariencia fue dedicada para la crianza de cerdos, donde hay una cerca que genera una especie de aparto.
Sin embargo, observa este Tribunal que de acuerdo a la prueba en autos, éstas no evidencian de manera diáfana, que los hechos acusados como perturbatorios, sean propiamente, la construcción de una cerca de bambú, el aparente despojo de una hectárea de terreno y la remoción y corta de cercas o bien trabajos de fumigación y eliminación de pastos, se hubieran dado como actos perturbatorios con anterioridad a los tres meses desde la interposición a la demanda, razón por la cual, no comparte este Tribunal que existe elemento probatorio suficiente que permita considerar que ha operado la caducidad, en cuanto a los actos perturbatorios acusados en los hechos cuatro y cinco de la demanda inicial. Por tal motivo no puede declararse caducidad alguna.
VIII.Visto lo anterior, al corroborarse que este asunto no se encuentra caduco, debe esta Sede verificar si se cumplen los presupuestos de la legitimación activa y pasiva que deben estar presentes en las acciones interdictales. La legitimación en su modalidad activa se acredita al demostrar la parte actora que al momento de la perturbación se encontraba en posesión de hecho sobre los terrenos o áreas en litis y la legitimación pasiva, al demostrarse que es la persona demandada, el responsable de los actos perturbatorios reclamados. En torno a la legitimación activa, denota este Tribunal que las declaraciones de los testigos refieren en lo medular que ha sido por el contrario, el señor demandado [Nombre2] quien ha venido trabajando el terreno con cerdos, y cultivos de arroz, yuca y plátano, por lo que no es posible acreditar que fuera la parte actora quien se encontrara en posesión, real y momentánea para ese momento.
Si bien el testigo [Nombre8] dice que el señor [Nombre1] tiene tiempo de posesión del terreno, valorado esto con la misma confesional depuesta donde dice tener sólo dos años de posesión del área en litigio, tales elementos no son reforzados con prueba adicional que permita tener certeza de ello, principalmente porque se ven contrariadas con lo dicho por don [Nombre3] , don [Nombre5] y don [Nombre4] , quienes en términos generales reflejan que la posesión del área en conflicto venía siendo trabajada por don [Nombre2] desde años atrás. Debe tomarse en cuenta que si bien los testigos hacen la aclaración de que para la actualidad, refiriéndose al momento de su declaración, el señor [Nombre1] se encontraba en el terreno, tales señores evidencian que en las fechas y años anteriores era el demando [Nombre2] quien ejercía la posesión del terreno.- Adicionalmente, observa esta Cámara que es omisa la prueba en acreditar que fuera el demandado el responsable de los actos perturbatorios acusados.
Considera este Tribunal que si bien, es el demando [Nombre2] quien ha venido ejerciendo la posesión del terreno con la crianza de cerdos, la siembra de arroz, yuca y otros cultivos, dedicando el terreno también para repastos, haciendo cercas, de acuerdo a lo analizado, ello no es suficiente por sí solo para acreditar la existencia de actos perturbatorios per sé, ocasionados en contra de la supuesta posesión alegada por la parte demandada. Dado a que no se logra acreditar con la prueba en autos, que fuera el demandado, el responsable de cortar o construir cercas en despojo de la parte actora, o le hubiera sacado el ganado.- Ahora bien, es importante hacer notar, que en materia de interdictos, tanto de amparo de posesión como de restitución, no debe discutirse aspectos de derecho de propiedad o posesión definitiva del terreno, pues lo que se busca es la tutela y protección a la posesión real y momentánea que se viniera realizando en el terreno de conflicto.
Ante ello, el artículo 317 del Código Procesal Civil aplicado supletoriamente con base en los numerales 6, 26 y 79 de la Ley de Jurisdicción Agraria, dispone: "La carga de la prueba incumbe: 1) A quien formule una pretensión, respecto a las afirmaciones de los hechos constitutivos de su derecho. 2) A quien se oponga a una pretensión, en cuanto a las afirmaciones de hechos impeditivos, modificativos o extintivos del derecho del actor."- De acuerdo a esa norma, si con la demanda se pretende que se declare que existieron actos perturbatorios ante una posesión que dice tener la parte actora, esta tiene la carga de la prueba sobre esos extremos. No obstante, en el presente caso no se logra acreditar los presupuestos necesarios para la procedencia de esta acción, por lo que llega esta Cámara a la conclusión de que debe rechazarse este interdicto pero ante la falta de legitimación activa y pasiva de la parte actora frente al demandado en su reclamo.
IX- Con fundamento en el artículo 1 y 2 de la Ley de Jurisdicción Agraria, artículos 317, 461 a 465 del Código Procesal Civil, deberá revocarse lo resuelto en cuanto declaró la caducidad de la demanda interdictal incoada por la parte actora. En su lugar, deberán rechazarse la excepción de caducidad y prescripción entendida esta como caducidad, acogerse las excepciones de falta de derecho, y la genérica sin actione agit interpuestas por existir falta de legitimación activa y pasiva de la parte actora frente al demandado en su reclamo. En consecuencia se rechaza la demanda de interdicto de amparo de posesión y restitución interpuesta por Abuelos Los Olivos S.A en contra de [Nombre2] , condenándose a las costas a la parte actora por resultar vencida de acuerdo a lo dispuesto en el artículo 55 de la Ley de Jurisdicción Agraria.
POR TANTO
Se rechaza la nulidad invocada. Se revoca parcialmente la sentencia apelada en cuanto acogió las excepciones de caducidad y prescripción, entendidas estas como excepción de caducidad y en cuanto omitió pronunciamiento por innecesario de las excepciones de falta de derecho, falta de legitimación activa y pasiva. En su lugar: Se rechaza la excepción de caducidad y prescripción entendida esta como caducidad. Se acogen las excepciones de falta de derecho interpuestas por la parte demandada.- En lo demás apelado se confirma la sentencia recurrida.
