SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At eighteen hours and zero minutes on May twenty-two, two thousand eighteen.- ORDINARY PROCEEDING brought by [Nombre1], of legal age, divorced, homemaker, resident of Los Chiles, identity card CED1 - -; against [Nombre2], of legal age, widowed, merchant, identity card CED2, resident of Pavón de Los Chiles; and [Nombre3], of legal age, divorced, day laborer, identity card CED3, resident of Los Chiles, Alajuela. The PROCURADURÍA GENERAL DE LA REPÚBLICA (PGR), represented by Silvia Quesada Casares, of legal age, attorney, resident of San José, identity card CED4, participates in the proceeding as an interested party. Ignacio Rodríguez Sancho acts in the proceeding as agrarian public defender for the plaintiff, and Dania Josefina Valverde Núñez, Bar Association member number two thousand six hundred thirty-five, acts as special judicial attorney-in-fact (apoderada especial judicial) for defendant [Nombre2]. This proceeding is being heard before the Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos.- B A C K G R O U N D:

  1. 1The plaintiff filed an ordinary action, valued at the sum of twelve million colones, seeking a judgment declaring: “1.- That the undersigned is the sole lawful possessor with rights over the area of land claimed and described in the first factual allegation of this action, from possession of which I was disturbed and dispossessed, with the intention of appropriation by co-defendant [Nombre2]. 2.- That co-defendant [Nombre2] is an unlawful possessor of the land claimed in this action, of which he unlawfully dispossessed me, and that they are fully aware that the undersigned was the sole lawful possessor of the land, because I so informed the co-defendants when I observed them on the land. 3.- That it be declared that the undersigned has a superior right of possession over the land as against the co-defendants and that I am the sole lawful possessor of the land described in the first factual allegation of this action. 4.- That, consequently, the private documents consisting of the Option to Sell between [Nombre3], designated as seller, and [Nombre2], designated as buyer, dated July 5, 2013, and Public Deed 152 from the protocol of notary public Elizabeth Corella González, executed at 10:00 hours on October three, two thousand thirteen, must be annulled because they are unlawful. 5.- That both documents whose annulment is sought were executed contrary to law, because the land transacted through those documents is located within the so-called [Dirección1] Fronterizo [Dirección2] in [Dirección3], which renders it inalienable.- 6.- That the defendant must therefore be ordered to vacate immediately and restore to me the area of land of which he is dispossessing me, as described in the first factual allegation of this action, and must henceforth refrain from disturbing the possession exercised by the undersigned over the disputed area, with notice that criminal proceedings for the offense of disobedience to authority will be brought against him if he fails to comply. 7.- That the undersigned be placed in actual possession of the land, through the Juzgado Contravencional de Los Chiles or the Fuerza Pública command in Los Chiles, when the eviction is carried out. 8.- That the co-defendants be ordered to pay court costs and attorney’s fees if they oppose this action” (pleadings folder, file 17/08/16 1:19:06 p.m., images 1 through 8).-
  2. 2By order of August 22, 2016, the complaint was served, and the Procuraduría General de la República was recognized as an interested party.-
  3. 3Defendant [Nombre2] opposed the complaint and raised the defenses of lack of subject-matter jurisdiction (already decided), lack of a legal right, lack of standing to sue and be sued, lack of procedural capacity of the plaintiff and the defendant, and statute of limitations (the latter two rejected in interlocutory judgment 141-AS-2016). By order of September 26, 2016, [Nombre3] was declared in default, but he subsequently appeared in the proceeding and participated in the oral trial (pleadings folder: file 21/09/16 10:34:11 a.m.).-
  4. 4Judge Ana Milena Castro Elizondo of the Juzgado Agrario del Segundo Circuito Judicial de Alajuela ruled as follows in judgment 155-S-2017 of November 16, 2017: “THEREFORE: The defenses of lack of a legal right and lack of standing to sue and be sued raised by defendant [Nombre2] are rejected. The complaint filed by [Nombre1] against [Nombre2] and [Nombre3] is partially GRANTED, and relief not expressly granted is denied. For the purpose of resolving the dispute between private parties and without prejudice to the rights of the State: 1. As against co-defendants [Nombre2] and [Nombre3], [Nombre1] is recognized as the possessor of the disputed land, namely: agricultural and wetland property located in El Achiotal de Los Chiles, [Dirección4] Los Chiles, Province of Alajuela; the property measures approximately ten thousand seventy-two square meters and is bounded on the north by llanos Nacionales, on the south by [Dirección5], on the west by [Dirección6] Miranda, and on the east by [Dirección7]. 2.- The private documents consisting of the Option to Sell between [Nombre3], designated as seller, and [Nombre2], designated as buyer, dated July 5, 2013, and Public Deed 152 from the protocol of notary public Elizabeth Corella González, executed at 10:00 hours on October three, two thousand thirteen, are declared null and void. 3.- Defendant [Nombre2] is ordered to vacate the land at issue and restore it to the plaintiff, and to refrain from disturbing her possession of that disputed area, with notice that criminal proceedings for the offense of disobedience to authority will be brought against him if he fails to comply.Said co-defendant is granted a period of FIFTEEN DAYS to vacate the property voluntarily, failing which the property shall be forcibly vacated. No special award of costs is made” (associated documents folder, file 16/11/17 8:04:03 a.m.).-
  5. 5[Nombre2] and the PGR filed appeals expressly stating the grounds on which they rely to challenge the trial court’s position. A special judicial power of attorney in favor of [Nombre4] was submitted to the Tribunal (pleadings folder, files 20/11/17 2:20:11 p.m. and 21/11/17 7:01:31 a.m.).-
  6. 6The statutory requirements have been observed in the conduct of the proceeding, and there are NO errors or omissions capable of rendering the judgment null and void.-

Opinion drafted by Judge Alpízar Rodríguez;

CONSIDERING

I.Regarding the documents submitted by the appealing defendant as evidence to assist the court in reaching its decision (prueba para mejor proveer). In the appeal, the appellant offers what he asserts are three pages of a report from the IDA case file, which states that the possessor was [Nombre3], who sold the property to him, rather than the plaintiff. Given the content of the appeal, there are no valid grounds for admitting that evidence, as it is unnecessary to clarify the facts (Articles 52 of the Ley de Jurisdicción Agraria and 502 of the Código de Trabajo, applied on a supplementary basis pursuant to Transitorio I of Ley 9443. See in this regard decision 728 of October 4, 2007, of the Sala Primera). Moreover, the appellant does not explain why he failed to offer that documentary evidence in a timely manner when answering the complaint, given that the documents allegedly form part of an administrative case file.

Subsequently, in a brief filed before this Tribunal on December 4, 2017, he offers, to assist the court in reaching its decision, a copy of a criminal case file and requests that information be sought from SINAC and from the person in charge of the Plan de Manejo de Censo y Población del Achiotal, which he states he “understands is in a Decree awaiting signature and implementation (sic), showing that [the appellant] is the person accredited as holder of that parcel and that this is what will be forwarded for processing before Inder.” He does not clarify what is to be requested from SINAC; in any event, if the requested items are documents, the party should and could have submitted them because he does not establish that any legal impediment prevented him from obtaining them. As to the documents from the criminal proceeding to which he refers, they concern facts that cannot affect or alter the cause of action and subject matter of this litigation, and therefore there are no grounds for admitting them.

It should also be noted that they were not offered in a timely manner before the trial court, even though there was no impediment to doing so, as shown by the dates of those documents and of the challenged judgment.

II.The Tribunal adopts the findings of fact because they are supported by the evidence in the record, subject to the following modifications and additions. The following shall be added to the third finding: The Refugio nacional de vida silvestre Corredor Fronterizo Norte, created by Decreto Ejecutivo 22962 of February 15, 1994, encompasses the border corridor consisting of the lands extending along the border with Nicaragua from Punta [Dirección8] on the Caribbean Sea to Bahía Salinas on the Pacific Ocean, with a width of two thousand meters. Said corridor is also designated as public-domain property (bien demanial) pursuant to the Ley de Tierras y Colonización, which continues the designation dating from the late nineteenth century. The following shall be added to the fourth finding: The crops grown were for subsistence (cassava, corn, beans, taro, and soursop, coconut, and other fruit trees). The tenth finding shall read: The trial court’s possessory injunction judgment (sentencia interdictal) was reversed because the action had lapsed. The following is added as evidence supporting the sixth finding: divorce judgment 346-2014 of the Juzgado de Familia de San Carlos, dated May 27, 2014, paragraph five of the operative provisions (por tanto).

III.The following facts are deemed unproven: 1/. That the activities conducted by the plaintiff in the disputed area, both before and after her divorce from Mr. [Nombre3], affected the ecosystem balance of the wetland located in the northern portion of the area. 2/. That either the plaintiff or the defendants had authorization from the State (the corresponding SINAC Conservation Area or the former Instituto de Desarrollo Agrario), before entering the land, to exercise their tenure (tenencia) or remain there.

IV.This Tribunal considers the appeals filed by defendant [Nombre2] and the PGR against judgment 155 of November 16, 2017, which partially granted the complaint and, for the purpose of “resolving the dispute between private parties and without prejudice to the rights of the State,” declared plaintiff [Nombre1], as against co-defendants [Nombre2] and [Nombre3], to be the possessor of the disputed land; annulled the private Option to Sell documents between [Nombre3] and [Nombre2], dated July 5, 2013, and Public Deed 152 from the protocol of notary Elizabeth Corella González, dated October 3, 2013; ordered defendant [Nombre2] to vacate the disputed land and restore it to the plaintiff; and ordered him to refrain from disturbing her possession (associated documents folder, file 16/11/17 8:04:03 a.m.).- In a brief filed before this Tribunal on December 4, 2017, the appellant attempts to expand upon and explain the arguments in the appeal and offers documentary evidence to assist the court in reaching its decision, which was not admitted.

Nor can the additional arguments he seeks to present in that brief be considered, because they were untimely. In agrarian matters, there is no period for supplementing grounds of error; all grounds must be raised in the appeal filed within the period granted for appealing (Articles 59 and 60 of the Ley de Jurisdicción Agraria) (decision 927 of August 31, 2011). The PGR’s appeal will be analyzed first, followed by that of co-defendant [Nombre2].

V. APPEAL BY THE PGR

It sets forth the following grounds for appeal: 1) Violation of the principles of due process, procedural equality, congruence, and compliance with the essential elements of the judgment. Violation of procedural rules under articles 22 subsection ch) of the Ley de Jurisdicción Agraria, 98 subsection 2), and 155 paragraph 1) and subsection 3.e) of the Código Procesal Civil. It explains that judgment 155-2017 found as proven fact that the property in dispute is public-domain property (bien demanial), because it is located within the Refugio de Vida Silvestre Corredor Fronterizo Norte, where, it states, there is a wetland (humedal) in the northern sector. It emphasizes that the sixth recital stated that, because it is public-domain property, any agreements entered into by private parties regarding that area are null and void, and that any activity conducted by the plaintiff or the defendant without State authorization does not confer any legitimate right upon them.

For that reason, it states, the sales documents executed between [Nombre3] and [Nombre2] were annulled. Nevertheless, it objects, the complaint was partially granted, [Nombre1] was declared the “possessor of the land,” and restitution to her of the disputed “agricultural” and “wetland” land was ordered, “without prejudice to the rights of the State.” It disagrees with that determination. It states that it was recognized as an interested party in the ruling of 22 de agosto de 2016 and that, beginning with its appearance submission of 1 de septiembre de este año, it argued that the claim seeking to have the plaintiff declared the possessor of the disputed land was inadmissible because the property was part of the public domain. This was based on Ley 30 de 22 de junio de 1888; article 510-5) of the Código Fiscal, amended by leyes 11 de 22 de octubre de 1926 149 16 de agosto 29; article 10 of Ley 13 de 10 de enero de 1939; article 7-f) and i) of the Ley de Tierras y Colonización; Decreto 22962 concerning the Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte, which constitutes Patrimonio Natural del Estado under Ley Forestal 7575, articles 13, 14 and 15, which maintained the provisions of leyes forestales 4465 and 7554.

It therefore states that it raised the defense of lack of legal right (excepción de falta de derecho). It explains that the property was part of the public domain, a point reiterated in the brief of 16 de diciembre de 2016, when technical report number SINAC-ACAHN-FGH-1110-2016 of Área de Conservación Arenal Huetar Norte was submitted; that report supports proven fact 3) of the appealed judgment and was accepted in recitals II, III and IV. It adds that, in the conclusions of 20 de enero de 2017, it stated that neither the plaintiff nor the defendants had authorization from SINAC to lawfully occupy land within the aforementioned national refuge, as required by article 18 of the Ley Forestal. Because they hold neither administrative rights in rem (derechos reales administrativos) nor valid possession as owners, the defense of lack of legal right should be granted. Those arguments, it states, were disregarded in the second recital of the challenged judgment, because only the position of the plaintiff and of the codefendant who entered an appearance was summarized.

The judgment therefore violates the aforementioned principles, because the proceeding was decided as though the State had not been a party, without analyzing the substantive issues raised by the PGR (articles 22-h) of the Ley de Jurisdicción Agraria, 98-2) and 155 of the Código Procesal Civil). Regarding incongruence (incongruencia), it emphasizes that the incidental and substantive issues raised by all parties must be analyzed in order to ensure due process. In support, it cites rulings 127-2008, 126-2009, 947-2009 and 215-2016 of Sala Primera. It also emphasizes ruling 225-2016 of this body, which annulled a judgment that disregarded the State’s position as an interested party concerning claims affecting its natural heritage, and it transcribes paragraphs from that ruling. It therefore considers that the dispute was decided without regard to the State’s objections concerning the impossibility of recognizing any rights of the parties over its natural heritage.

The phrase “without prejudice to the rights of the State” is unexplained. Although the State was a party to the proceeding, the plaintiff was nevertheless declared the possessor of the land to be registered, located entirely within the Refuge at [Dirección9]. 2) Violation of substantive rules through failure to apply them. It reiterates that the same provisions cited in the preceding ground for appeal were violated and adds that article 32-f of the Ley Orgánica del Ambiente was not applied; that provision includes wetlands among protected wilderness areas (áreas silvestres protegidas) administered by MINAE, as part of the Patrimonio Natural del Estado and subject to the attributes established in articles 13, 14 and 15 of the Ley Forestal (articles 32, 38 and 40 of Ley 7554 and 39-i) of the Ley Forestal; rulings of Sala Constitucional 5399-93, [Telf1], 9158-1998, [Telf2], [Telf3], [Telf4], 16975-2008 and 14288-2009).

It emphasizes that it maintained this position in its briefs of 1 de septiembre de 2016, 16 de diciembre de ese año and 20 de enero de 2017. As was proven, it states, the parties to the proceeding do not have the authorization required by article 18 of the Ley Forestal to lawfully occupy land within the aforementioned refuge. Declaring the plaintiff the possessor of the land and ordering restitution in her favor is contrary to law. It requests that the judgment be reversed and that the defense of lack of legal right be granted (folder of submissions: file 21/11/2017 07:01:31).

VI. REGARDING THE PUBLIC-DOMAIN STATUS OF [Dirección10]

In view of the PGR’s position, which in summary denies that any form of protection may be afforded to possession exercised by private persons in that area when they lack State authorization to occupy it, it is important to address briefly two issues that provide context for the socio-legal reality of that area and explain why its appeal is not well-founded in light of the specific case under review. The first concerns the public-domain status of the Faja Fronteriza Norte (hereinafter FFN), and the second concerns land tenure (tenencia) and governance (gobernanza) in that area, because the problems and deficiencies in its administration by the State, dating back many decades, have fostered both its lawful and unlawful occupation, which undeniably gives rise to disputes among private persons for which the legal system must provide an appropriate solution. The FFN is public-domain property by virtue of a dual dedication to public use (doble afectación).

It has that status pursuant to the Ley de Tierras y Colonización de 14 de octubre de 1961 (in force insofar as it was not repealed or amended by Ley 9036 de 11 de mayo de 2012, which Transforma el Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (INDER)). That legislation maintained the dedication dating from the end of the nineteenth century, as the Procuraduría emphasizes in its arguments, which is based on considerations of sovereignty and national security. Moreover, pursuant to Decreto 22962 de 15 de febrero de 1994, it was also designated as Patrimonio Natural del Estado when it was declared a wildlife refuge (refugio de vida silvestre) named “Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte” (articles 13, 14 and 15 Ley Forestal 7575). That Corredor is administered by Ministerio de Ambiente y Energía (MINAE), specifically through Sistema Nacional de Áreas de Conservación (SINAC), except for the Peñas Blancas sector, which is administered by the current Instituto de Desarrollo Rural, pursuant to Ley 7774 de 21 de mayo de 1998, which “segrega Terrenos del Refugio de Vida Silvestre de la Frontera Norte,” and Dictamen C-223-2015 de 19 de agosto de 2015 of the PGR.

Public-domain property is subject to a special legal regime and is dedicated to purposes of public benefit; it is administered by a public legal entity. Such property is not subject to acquisitive prescription, is inalienable, cannot be attached, and cannot be appropriated; it is usually not registered, because the principle of exemption from initial registration (principio de inmatriculación) applies to it (articles 121-4 Constitución Política, 154 Ley General de la Administración Pública, and 261 to 263 Código Civil. Rulings of Sala Primera 189 de 3 marzo 2011; Sala Constitucional 18483 de 19 diciembre 2007). “Its ultimate objective is the full attainment of the common good. This is the principal reason justifying the existence of a restriction, at least in principle, on the free disposition of this category of property. The special regime governing it, however, does not apply equally to all public property; the greater, lesser, or nonexistent degree of coverage will depend on the type of property involved.

For that reason, public-law doctrine speaks of various types of property belonging to the State” (Sala Constitucional 3821 de 24 de abril de 2002). As the Procuraduría states, and as this Court agrees, privately held rights in rem (derechos reales de naturaleza privada), with their basic characteristics and attributes—attachment, enforceability against third parties, publicity, exclusion, pursuit, priority, and others—cannot be acquired over public-domain property. However, depending on its nature and the purpose of its dedication, it may be subject to common use (uso común) (e.g., beaches, public streets, and others) or exclusive private use (uso privativo). With respect to the latter, administrative rights in rem may be held and protected in favor of private persons when they use and occupy such property with State authorization granted through permits or concessions. Under the Procuraduría’s position, for private persons to obtain protection for acts or work performed on public-domain property not subject to common use, they must necessarily hold an administrative right in rem; otherwise, because they lack State authorization, their actions cannot confer any legitimate right upon them.

This Court cannot endorse that latter assertion in such absolute terms, because situations exist, such as those examined in this proceeding, that must be resolved objectively and in light of the circumstances of the specific case. Accordingly, that assertion is legally valid as against the State. But when the dispute arises between private persons, even if the occupation is unlawful or unauthorized, the legal system must provide an appropriate, effective, and reasonable response that prevents violence, abuse of rights (abuso del derecho), and the “law of the strongest.” Furthermore, with respect to the administration of the FFN, in resolving legal disputes between private persons concerning its occupation or tenure, the history and reality of the area and the existence of unauthorized uses that have continued for decades—facts that are public knowledge—cannot be overlooked; this is a situation that the Costa Rican State has tolerated for various reasons, as acknowledged in the legal instruments cited below. Accordingly, brief reference will be made to the concepts of tenure and governance in land use and to the State’s duties in that regard.

VII. ON LAND TENURE AND GOVERNANCE OF THE FFN

“Land tenure (tenencia de la tierra) is the relationship, whether legally or customarily defined, among people, as individuals or groups, with respect to land (for convenience, ‘land’ is used here to include other natural resources, such as water and trees). Land tenure is an institution, that is, a set of rules devised by societies to regulate behavior. Land-tenure rules define how land ownership rights may be allocated within society. They define how access is granted to the rights to use, control, and transfer land, as well as the corresponding responsibilities and limitations. In other words, land-tenure systems determine who may use which resources, for how long, and under what circumstances. Land tenure is an important part of social, political, and economic structures. It is multidimensional in nature, as it brings into play social, technical, economic, institutional, legal, and political aspects that are often overlooked but must be taken into account.

Land-tenure relationships may be well defined and enforceable before an official court of law or through customary structures within a community. In other cases, they may be relatively less well defined, with ambiguities that lend themselves to abuse” (FAO, Land Tenure and Rural Development. Land Tenure Studies Series Nº3, 2003, p. 9). Land governance (gobernanza de la tierra) is a broader concept that complements the foregoing. “…It includes the rules, processes, and organizations through which decisions concerning the use and control of land are made, how those decisions are implemented and enforced, and how competing interests in land are managed. The concept encompasses statutory, customary, and religious institutions. It also includes State structures such as agencies dealing with land-related matters, courts, and ministries responsible for land, as well as non-statutory actors such as traditional bodies and informal organizations.

The concept of governance covers both the legal and regulatory framework for land and traditional and informal practices that enjoy social legitimacy. Land governance is primarily concerned with power and the political economy of land. Society’s power structure is reflected in land-tenure rules; at the same time, the quality of governance may affect the distribution of power in society. Tenure is the relationship among people with respect to land and its resources. These rules define how access is granted to the rights to use, control, and transfer land, as well as the resulting responsibilities and restrictions… Weak land governance is the cause of many tenure-related problems” ([Nombre5], et al. Toward Improved Land Governance, in Land Tenure Working Paper, FAO, Nº 11, 2009, pp. 1 and 2, 9).

VI.The Food and Agriculture Organization of the United Nations (FAO, by its acronym in English) issued in 2012 the “Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries and Forests in the Context of National Food Security.” They explain that “the eradication of hunger and poverty and the sustainable use of the environment depend largely on how people, communities, and other groups gain access to land, fisheries, and forests. The livelihoods of many people, particularly poor rural populations, are based on secure and equitable access to and control over these resources. They are a source of food and shelter, the foundation of social, cultural, and religious practices, and a central factor in economic growth… Tenure systems determine who may use which resources, for how long, and under what conditions. These systems may be grounded in written policies and laws, but also in unwritten customs and practices.

Tenure systems are subject to increasing pressures due to the need to ensure food security for a growing global population, under circumstances in which the availability of land, fishery resources, and forests is being reduced by environmental degradation and climate change. Insecure tenure rights (derechos de tenencia) result in increased vulnerability, hunger, and poverty, and may lead to conflict and environmental degradation when competing users struggle to secure control over these resources… Tenure governance (gobernanza de la tenencia) is a crucial factor in determining whether and how people, communities, and other groups are able to acquire the rights and related duties that allow them to use and control land, fisheries, and forests. Many tenure-related problems arise as a result of weak governance, and attempts to address tenure problems are affected by the quality of governance.

Weak governance has adverse effects on social stability, the sustainable use of the environment, investment, and economic growth. People may be condemned to lives of hunger and poverty if they lose their tenure rights over their homes, land, fisheries, forests, and livelihoods because of corruption in tenure practices or because enforcement agencies fail to protect their rights. People may even lose their lives when poor tenure governance leads to violent conflict. Responsible governance of tenure (gobernanza responsable de la tenencia), by contrast, promotes sustainable social and economic development that can help eradicate poverty and food insecurity and encourages responsible investment.”

VIII.Those Guidelines explain and address matters relevant to understanding and resolving conflicts such as the one examined in this case because, although the FFN is a public-domain asset (bien demanial), it has historically been occupied and used, informally or without authorization, for agricultural and livestock activities (actividades agropecuarias) throughout much of its area, given the nature of the land and the policies for administering that zone that the State established in the past. In section 3A of the “Guiding Principles of Responsible Governance of Tenure,” entitled “General Principles,” points 3.1, paragraphs 4 and 5, and 25.4 emphasize that States must “provide access to justice to address violations of legitimate tenure rights. They should provide everyone, through recourse to judicial authorities or other instruments, with an effective and accessible means of resolving disputes over tenure rights, and enforce decisions within short timeframes and at affordable costs.

States should provide prompt and fair redress when tenure rights are expropriated (expropiados) for reasons of public utility (utilidad pública).” They must also “prevent tenure-related disputes, violent conflicts, and corruption. They should take active measures to prevent tenure disputes from arising and escalating into violent conflicts. They should seek to prevent corruption in all its forms, at all levels, and in all settings.” Point 4.9 of the “Tenure Rights and Responsibilities,” reiterated and expanded upon in point 21 on the “Resolution of Disputes over Tenure Rights,” states: “4.9 States should provide access, through impartial and competent judicial and administrative bodies, to timely, affordable, and effective means of resolving disputes over tenure rights, including alternative dispute-resolution mechanisms (medios alternativos para dichas soluciones), and should provide effective procedural remedies (recursos procesales) for this purpose, which may include a right of appeal, as appropriate.

Procedural remedies should be implemented promptly and may include restitution (restitución), indemnification (indemnización), compensation (compensación), and redress (reparación). States should endeavor to ensure that vulnerable and marginalized persons have access to such means, in accordance with paragraphs 6.6 and 21.6. States should ensure that anyone whose human rights are violated in the context of tenure has access to such dispute-resolution mechanisms and procedural remedies.” The section entitled “Legal Recognition and Allocation of Tenure Rights and Duties,” which addresses the governance of tenure of land, fisheries, and forests in relation to the legal recognition of the tenure rights of Indigenous peoples and other communities with customary tenure systems, as well as informal tenure rights, and the initial allocation of tenure rights over land, fisheries, and forests that are owned or controlled by the public sector, recommends that States establish safeguards (salvaguardas).

Particularly noteworthy among these is safeguard 7.6, which states: “Where legal recognition of tenure rights is not possible, States should prevent forced evictions (desalojos forzosos) that contravene their existing obligations under national and international law, in accordance with the principles of these Guidelines.” Section 10, concerning “Informal Tenure,” emphasizes: “10.1 Where informal tenure of land, fisheries, and forests exists, States should recognize it in a manner that respects existing formal rights under national legislation, acknowledges the reality of the situation, and promotes social, economic, and environmental well-being… 10.6 Where legal recognition of informal tenure is not possible, States should prevent forced evictions that contravene their existing obligations under national and international law, in accordance with the relevant provisions of Section 16.” Although referring to the right of ownership (derecho de propiedad), the FAO distinguishes between formal and informal status according to whether something is expressly recognized by the State and may be protected through legal means.

Informal status is that which lacks official recognition and protection. In some cases, informal rights are illegal, meaning that they constitute a violation of the law; with respect to illegal tenure (tenencia ilegal), it is acknowledged that in many cases it results from shortcomings in the legislative system. “Extralegal” situations may also arise, meaning situations that are neither contrary to the law nor recognized by it (FAO at http://www.fao.org/docrep/005/y4307s/y4307s05.htm). Finally, it should be emphasized that security of land tenure (seguridad de la tenencia de la tierra) is the certainty that a person’s rights will be recognized by others and protected against specific challenges.

IX.In Costa Rica, Decreto Ejecutivo 35959 of 07 abril 2010 “Declares the resolution of the land-tenure (tenencia de la tierra) problems in rural territories occupied by peasants and rural workers to be in the public interest.” And Decreto 35849 of 8 de febrero de 2010 declares the “Interinstitutional Commission for the Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte and Other Territories of Costa Rica’s Northern Zone” to be of “Public Interest.” Its preamble acknowledges the longstanding land-tenure problem in that area, stating: “I. That the legal insecurity affecting the inhabitants and residents located within the territories comprising the Costa Rican Refugio Nacional de Vida Silvestre Corredor Fronterizo is a priority for the State, because it is the State’s duty to safeguard the conservation of renewable natural resources, particularly those that contribute to the well-being and improved social, economic, political, and ecological development of the region’s inhabitants…

III.-That many of the inhabitants and residents living in those areas not only reside on those lands, but that the lands themselves, by virtue of their nature and location, have contributed and currently contribute to supporting thousands of families through rural tourism as a means of subsistence. IV.- That it is the duty of the State, through institutions such as the Ministerio de Ambiente Energía y Telecomunicaciones, to resolve the land-tenure problems of the inhabitants and residents within the territories located in the Refugio Nacional de Vida Silvestre Corredor Fronterizo. V.-That various legal interpretations jeopardize the existence and continued presence of Costa Rican farmers and rural workers, fostering the displacement and cultural extinction of those communities; therefore, an assessment study must urgently be promoted to determine the environmental, social, and economic significance of the Refugio Nacional de Vida Silvestre Corredor Fronterizo, the result of which should demonstrate the need and grounds for a legislative proposal to remove that territory’s protected status (desafectación).” In the same vein, Decreto 33407 of 4 de octubre de 2006 had acknowledged: “I.- That the cantons of Los Chiles, Upala, and Guatuso in the Región Norte Norte, as localities bordering Nicaragua and providing access from other northern Central American countries, are characterized by a complex socioeconomic situation involving public safety and land tenure, which requires special attention from the Central Government and its institutions in order to address those problems comprehensively…

V.- That these cantons constitute the areas of greatest poverty in that region and are characterized by poor health indicators, limited access to adequate housing, high unemployment rates, scarce educational opportunities, a difficult migration and public-safety situation due to their proximity to the country’s northern border, and inadequate basic services essential to life, all of which prevent greater human development among their inhabitants. VI.- That the principal gap hindering the human development of these three border cantons has been the absence of an entity with a full understanding of the true extent of these problems, making it difficult to coordinate actions aimed at bringing together the different actors in society.”

X.In accordance with the explanation provided regarding the recommendations and obligations established by the cited Guidelines on land tenure (tenencia de la tierra) and land governance (gobernanza de la tierra), not only for the State but also for civil society, in order to resolve conflicts such as the one presented in this case, the historical problem of land tenure in the FFN must be borne in mind. In this regard, our legal system establishes that the courts must provide a timely, reasonable, and reasoned response to every dispute brought before them, even those for which no express or specifically defined rule exists. This is established in Article 41 of the Constitution and Article 5 of the Ley Orgánica del Poder Judicial Nº 8 de 29 de noviembre de 1937, which state: “41.- By resorting to the law, everyone shall obtain redress for injuries or damage suffered to their person, property, or moral interests.

Justice must be administered promptly, fully, without denial, and in strict accordance with the law.” “5.-… The courts may not decline to exercise their authority or to decide matters within their jurisdiction on the grounds that no applicable rule exists, and they shall do so in accordance with the written and unwritten rules of the legal system, following the hierarchical order of their sources.” This is emphasized because the PGR, by requesting in its appeal that the claim be dismissed and deeming it improper to decide the matter “without prejudice to the rights of the State,” on the grounds that the plaintiff is engaged in the unauthorized occupation of a sector of the FFN, proposes an option that does not actually resolve the dispute between private parties and disregards the reality of informal or unlawful tenure in that area. It should be noted that, in this case, the plaintiff acknowledges in her complaint that she holds a public-domain asset (bien demanial), but claims that she was improperly dispossessed by another private person who is legally in no better position than she is.

Allowing abusive or even violent conduct between private parties to occupy public-domain assets over which the State has likewise failed to recover possession in a timely manner (it should be noted that, in this matter, the PGR did not file an intervention asserting an exclusive principal claim (intervención principal excluyente) and participated only as a statutory third party), even where informal or even unlawful tenure of a public-domain asset is involved, would encourage or endorse still more of the lack of governance already existing in the FFN and cause private persons to use improper means, force, or violence to occupy such land. This is not permitted by our Constitución Política or by international treaties, as provided in Article 8.1 of the Convención Americana sobre Derechos Humanos (Pacto de San José) (“Every person has the right to a hearing, with due guarantees and within a reasonable time, by a competent, independent, and impartial judge or tribunal previously established by law, in the substantiation of any criminal accusation made against that person, or for the determination of that person’s rights and obligations of a civil, labor, tax, or any other nature”) and Article XVIII of the Declaración Americana de los Derechos y Deberes del Hombre: “Every person may resort to the courts to enforce their rights.

Likewise, every person must have access to a simple and prompt procedure through which the courts will protect them against acts of authority that, to their detriment, violate any of the fundamental rights constitutionally enshrined.” Likewise, Article 263 of the Código Civil provides: “The manner of using and benefiting from public property shall be governed by the respective administrative regulations; however, disputes arising between private parties concerning the superior right or priority to use and benefit from public property shall be decided by the courts” (emphasis not in the original). The cited provisions not only empower but also require the courts to provide a reasonable and proportionate solution, supported by the protections afforded by the legal system, in order to prevent unjust or abusive situations arising from disputes between private persons over land tenure in the FFN.

In this regard, it must also be borne in mind that, as concluded in the FAO documents analyzed above, “when land governance is weak, the powerful can dominate disputes over scarce land resources,” which is contrary to the principles of sustainable development and the purposes of a social State governed by the rule of law (Estado social de Derecho). Accordingly, the recognition of the de facto possession or tenure (posesión o tenencia de hecho) set forth in the operative part (por tanto) of the challenged judgment, in favor of the plaintiff and without prejudice to the rights of the State, is an appropriate solution consistent with what the Costa Rican legal system permits in order to prevent violence and abuse in that area, provided that the State does not exercise its authority to recover land subject to informal possession. This is on the understanding that such tenure was exercised peacefully and publicly and without detriment to natural resources.

It is also subject to the condition that the defendant’s conduct, which is alleged to have constituted dispossession (despojo), was not supported by a “superior right or legal position” as against the plaintiff, as would be the case, for example, if the defendant held an administrative property right (derecho real administrativo). In other words, what the Procuraduría seeks through the position advanced in the appeal is to leave the land in the possession of a private person who, without legitimate cause, dispossessed another person of tenure that she had exercised peacefully and publicly for more than ten years, as was found proven; moreover, the former would thereby improperly and without cause enjoy what the latter had established on the land (crops, structures, etc.), given that the former entered pursuant to an agreement with the plaintiff’s former husband, with whom she had experienced domestic violence.

Denying the plaintiff the right to seek restoration of her de facto tenure or possession, given that the State also failed to show that it had taken any legal action to recover possession of that land so that it would not remain in private hands (it should also be noted that it did not file an intervention asserting an exclusive principal claim in this proceeding), would result in the asset remaining in the defendant’s possession, even though he likewise holds no administrative property right and is in no better legal position than the plaintiff. Furthermore, as the cited Article 263 of the Código Civil indicates, disputes between private parties concerning priority in the use of public-domain assets must be resolved. That provision applies to cases such as this one, even though the plaintiff’s informal possession is involved—which is not necessarily unlawful—given the historical context of land tenure and governance in the FFN.

Accordingly, the arguments set forth in the PGR’s first ground of appeal, alleging that the challenged judgment violates the principles of due process (debido proceso), procedural equality (igualdad procesal), congruence (congruencia), and compliance with the essential elements of a judgment, are unfounded. In Considerando sixth, the trial judge explains that this is a public-domain asset and states why the plaintiff’s claim of a superior possessory right (mejor derecho de posesión) must be analyzed in light of the characteristics of that type of asset. The operative part therefore does not grant the plaintiff a right of possession, but merely protects the de facto possession or bare tenure (mera tenencia) that she exercised publicly and peacefully for more than ten years. Such possession may be recognized in ordinary proceedings (proceso ordinario) such as these because de facto possession is protected by the legal system, even in cases involving bad faith.

Although the preferred procedural avenue for such protection is summary possessory proceedings (vía sumaria interdictal), there is no legal impediment to granting, in ordinary proceedings, protection to tenure exercised over a public-domain asset under the provisions permitting recovery of de facto possession exercised over real property when unlawful dispossession by another private person has occurred (Articles 282, 305, 307, 309, 313, 317, and 325 of the Código Civil). In this regard, the provisions of the cited Articles 305, 313, 317, 318, and 319 should be emphasized: “305- Owners and possessors, regardless of their status, may defend their ownership or possession by repelling force with force or by resorting to the competent authority.” “313.- The authority’s protection of a possessor whose possession is disturbed or interfered with shall have no effect whatsoever on questions of ownership or superior right to possess.” “317.- A possessor, regardless of status, is also entitled to recover possession of which the possessor has been improperly deprived and, once restored to possession, shall be deemed, for purposes of acquisitive prescription (prescripción), never to have been dispossessed.

Possession may not be taken violently, even by the person legally entitled to it; while the current possessor objects, possession must be claimed through judicial proceedings.” “318.- To be restored to the enjoyment of a right, it is sufficient for the possessor to prove possession and that the possessor was unlawfully deprived thereof” (underlining not in the originals). Those provisions permit the defense of de facto possession or bare tenure and apply to circumstances such as those alleged and proven by the plaintiff, whose dispute is not with the State but with another private person who seeks to dispossess her of the tenure she exercised over the disputed asset for more than ten years. It should be noted that, although the plaintiff uses the phrase “sole and lawful possessor with rights” in her first claim for relief, in the same complaint (allegation one and request five) she acknowledges that the land lies within [Dirección11]“[Dirección12] ”.

Accordingly, it is evident from a comprehensive analysis of the complaint that at no time did the plaintiff assert any right against the State; rather, she sought only to defend herself against an unjust and abusive situation involving another private person who dispossessed her of the tenure she had exercised over the disputed area for more than 10 years. At the same time, the trial judge protects the State’s rights over that sector as a public-domain asset by ruling “without detriment to the rights of the State.” The matter is thus not adjudicated with the force of res judicata (cosa juzgada) in relation to or to the detriment of the State, while a legally appropriate solution is provided for a dispute between private persons concerning the use of that public-domain asset, as explained in the preceding considerandos. The argument that neither party had SINAC authorization to validly occupy land within the cited national refuge and therefore held neither administrative property rights nor valid possession as owners is correct and was duly explained in the challenged judgment.

But this does not mean that, because of that situation, the defense of lack of legal entitlement (excepción de falta derecho) must be sustained and the claim denied. As extensively explained both in the challenged judgment and in the preceding considerandos, the decision concerns the current or temporary tenure or possession of the disputed property as between private persons. That asset is currently being used or occupied by one of them, even though it is a public-domain asset, and the State, as owner, has not sought to recover the attribute of possession over that sector, or at least no such effort was proven in the proceeding. That situation merits and requires protection in order to prevent further lack of governance in the FFN and to combat violence or abuse between private persons. Nor is it true that the challenged judgment failed or neglected to address the PGR’s argument concerning the public-domain nature of that area, or that the matter was decided as though the PGR were not a party.

In recitals (considerandos) V (which was not numbered), VI, and VII, that issue is analyzed, and therefore, without ruling infra petita, given what may be inferred as a whole from the complaint itself, the trial judge explains that she cannot recognize the claimant as the lawful possessor of the property at issue on the terms requested by her. However, to resolve the dispute without prejudice to the rights of the State, she grants the complaint so that the claimant may recover possession of the property of which she was improperly dispossessed, but without granting her any property right (derecho real). As to the argument raised in the second ground of appeal concerning the existence of a wetland (humedal) on the property at issue, this likewise provides no basis for altering the decision. This was acknowledged in the established facts (hechos probados) of the challenged judgment, and the decision does not entail granting the claimant any property right over that area or harming the ecological balance of that ecosystem.

Nor was it shown that the claimant’s activities during her more than 10 years of possession affected that wetland or contravened section 32 of the Ley Orgánica del Ambiente. In light of the foregoing, the PGR’s appeal cannot be upheld. Nevertheless, in view of its arguments, it is appropriate to clarify that the protection granted to the claimant extends only to mere holding or de facto possession (posesión de hecho). Consequently, as permitted by section 592 of the Código de Trabajo, the operative portion (parte dispositiva) of the challenged judgment shall be clarified so that points 1 and 3 read “de facto possession.”

XI. APPEAL BY CO-DEFENDANT [Nombre2] QUIROZ

He sets forth the following grounds of appeal (agravios), which are summarized to facilitate their analysis, although it should be emphasized that, in some phrases, the ideas are incomplete or incomprehensible: A) He complains that the evidence was not properly weighed in the challenged judgment. He states that the judgment is neither clear nor objective in its analysis of the evidence and in discounting the credibility of his witnesses, who are the only objective witnesses and are not relatives. He believes that the confession evidence (prueba confesional) of co-defendant [Nombre3] was used against him and to determine that the latter’s interests had always been the care of his wife’s parcel. He says that the sale and the payment he made are not analyzed, pursuant to which he possessed the land until a few months ago, when criminal proceedings were initiated. He asserts that both the plaintiff and her witnesses invaded the property, “remaining on it (sic) contrary to the status the property had,” and that his belongings were destroyed and removed, contrary to the judicial authority’s order, and that they took the property by force.

He maintains that his rights are being denied even though he resorted to the law and prevailed in possessory injunction proceedings (interdictos), and also proved the purchase and possession. B) He acknowledges that, although Achiotal is within public-domain property (bienes demaniales), it is also true, he says, that these are lands that SINAC will transfer to INDER. He asserts that, as the possessor, he is the person appearing on the final list, according to lists he has been unable to have certified. The current momentary possession was proven in the prior proceedings, “submitted as evidence and his own miso (sic) when proceeding with the evidence.” He offers three pages of a report that he says are from the IDA case file, stating that the possessor was [Nombre3], who sold the property to him, rather than his wife, who is the plaintiff. But now they are colluding to his detriment, thereby receiving both the land and the money through the judgment, which is improper and was wrongly decided.

He clarifies that he only recently became aware of these documents through the criminal proceedings being conducted for unlawful occupation (usurpación) against the plaintiff and the witnesses who seized the property. C) He states that the domestic-violence case copies show that the plaintiff and the other defendant were separated. He therefore characterizes as audacious and unfounded the trial judge’s assertion that the property was being cared for on the plaintiff’s behalf. Furthermore, the person registered with IDA was the other defendant, who sold it to him. Their divorce in 2014 is not a factor that should influence these proceedings. It was never treated as marital property (bien ganancial). He asserts that this demonstrates the intent to dispossess him of his ownership and harm him; this cannot be accepted. If the other defendant was registered as the beneficiary possessor and was the person who sold it to him, that defendant’s personal life cannot be invoked against his public and notorious possession, which was declared in other proceedings and exercised at the property.

He states that the plaintiff may have planted, cultivated, and other (sic), when she lived with her husband before 2007, but that does not give her possession. Having established that [Nombre3] was the person in possession, based on the IDA registry, the sale document and the witnesses, as well as the price paid and his current momentary possession since the 2013 sale, this is sufficient for a ruling in his favor (sic), as it should be. D) He reiterates that, where a sale made by the person registered as the holder with IDA allowed him to possess the property, no evidence based on presumption can lend credence to the contrary. The arguments outlined by the judge should be applied to him, not to the plaintiff. It cannot in any way be asserted that he possesses the property by mere tolerance (mera tolerancia), because that is untrue. He complains that the adjudicator failed to apply “the standards of logic and common sense.” E) He objects that it makes no sense to deem points nine and ten proven facts, because ultimately what prevails is that he, not the plaintiff, was the possessor.

  • F)He states that the entire town of Achiotal is in the same circumstances, within the zone of influence of Área de conservación arenal Huerta Norte, but that within it there is a decision levantada (sic) by SINAC-INDER regarding the possessors. He asks that this be requested (sic), because he currently appears on the list and his possession must therefore be declared, and the representatives of the State should have stated as much. He clarifies that he is not asking for the property’s public-domain status to be disregarded, but rather for possession of that public-domain property to be declared, because there is a special regulation governing use of the area and he has been included under it by virtue of the transfer from the possessor, who was not the plaintiff. He asserts that this is a scheme to defraud him of his rights. G) He requests that, for purposes of the disturbance of possession (perturbación), consideration be given to the fact that the plaintiff invaded the property a couple of months ago and remains there, for which reason criminal proceedings were filed.

He requests that the judgment be reversed and reiterates his offer, as evidence to assist the court in reaching a decision (para mejor resolver), of the three pages submitted (filings folder: file 20/11/2017 02:20:11).

XII.Given that several of appellant [Nombre2]’s grounds of appeal challenge the manner in which the trial judge assessed the evidence, it must be borne in mind that section 54 of the Ley de la Jurisdicción Agraria establishes the system of free evaluation of evidence (libre valoración probatoria). This requires the court to examine and select the sources of evidence obtained in order to determine their effectiveness in resolving the dispute submitted for its consideration, through perception, representation or reconstruction, and deductive or inductive reasoning. The court must state the principles of equity or law on which it bases its judgment. “The system of free evaluation of evidence surpasses both the traditional system of legally prescribed evidence (prueba legal) and that of reasoned judgment (sana crítica), which govern civil proceedings. The manner in which agrarian proceedings have been conceived allows the judge to assess broadly the facts alleged by the parties.

That system is not arbitrary; on the contrary, under the free evaluation of evidence, the assessment must be reasoned and critical and must be based on logic, experience, and psychology. In the reasoning of the judgment, the judge must set forth the grounds for the conviction that lead the judge to rule in the terms stated. Unlike the statutory-weight system (tarifa legal), in which evidence is assessed subject to pre-established legal rules, and even the admissibility of evidence must be specified in advance by the Legal System, under the system of free assessment the judge is free to admit evidence according to the judge’s own judgment” (decisions 398 of 6 de junio del 2001 of Sala Primera. To the same effect, decisions 206 of 26 de marzo de 1999, 46 del 26 de abril de 1995; 66 del 6 de febrero de 2009 and 364 de 28 de mayo del 2009 of Tribunal Agrario, and 3657 del 7 de mayo de 2003 of Sala Constitucional).

XIII.Ground of appeal A is without merit. The appellant claims that the evidence was not properly weighed and that his witnesses, who are the only objective and unrelated witnesses, were given insufficient credence. However, contrary to his assertion, the challenged judgment precisely and objectively explains, in the third and fourth recitals, the reasons why the testimony of [Nombre6], [Nombre7], and [Nombre8] was deemed credible and useful, a conclusion with which this Court agrees, because their statements contain neither exaggerated assertions nor inaccuracies and are not contradictory either among themselves or with the remaining evidentiary record; this was not the case with the testimony of [Nombre9]. This witness confirms the sale of the land by [Nombre3] to [Nombre2] and recounts events that occurred after Mr. [Nombre2] entered the property. The portion of his account that is not credible is his denial that the plaintiff had previously held the property and his denial that agricultural work had been performed.

His account is plainly accommodating and intended to favor Mr. [Nombre2], because he attempts to emphasize what the latter did or improved but denies facts concerning what occurred before the latter was on the property. [Nombre10], for her part, did not know the plaintiff and is Mr. [Nombre2]’s daughter. Although she ultimately admits that she has an interest in the property because her father offered it to her as a place to live, her account provides little information useful for resolving the dispute, since it refers essentially to the transaction involving the sale of the land in dispute by Mr. [Nombre3] to [Nombre2], the resulting problems between them, and what they have done since her father entered the property. The witnesses offered by the plaintiff credibly confirmed how she entered the property; who exercised possession (tenencia) over it and how, particularly after the marital problems with her former husband; and what they knew from the time the problems concerning the property arose with the other co-defendant.

As to the fact that some of them were related to the plaintiff, that circumstance alone does not diminish their credibility, because, in the context and conditions in which human relationships currently develop, it is generally the parties’ relatives and close friends who know or may come to know in greater detail the acts and situations in which the parties are involved (see, in this regard, decisions of the Second Chamber 2001 de 2 de febrero de 2001, 182 de 14 de junio de 1996, 49 de 9 de febrero de 1996, and 177 de 30 de junio de 1999). A family relationship or close friendship merely means that such testimony must be analyzed cautiously, which the challenged judgment shows was done, in accordance with the explanations provided in the cited recitals. With respect to the testimony elicited through examination (confesional) and the party statement (declaración de parte) of co-defendant [Nombre3], the appellant claims that it was used against him to determine that his interests had always been limited to caring for his wife’s parcel, without analyzing the sale or the payment he made, by virtue of which he possessed the property for several months before the plaintiff and her witnesses “invaded” the property.

That evidence is cited as a source for established facts six, seven, and eight, but not as the sole evidence. In his statement, insofar as relevant here, co-defendant [Nombre3] states that the plaintiff acquired the land in dispute; he clarifies that a committee granted it to her, but that they were married when this occurred. He admitted that he planted and tended the property with her while they were a couple and that he sold it without her consent when he was desperate and they were having problems, because [Nombre1] removed him (sic) from where he lived and also wanted to remove him from the land in dispute, which left him in a state of crisis. The other co-defendant repeatedly insisted that he sell it to him, even though he explained that the person with whom he needed to speak was the plaintiff and that it was land within the border zone; nevertheless, the other co-defendant agreed to assume responsibility for the problem even though the land did not belong to him.

He clarifies that he sold only the improvements because he knew the property was within the border strip. He states that he also had problems with the co-defendant because the latter did not pay him everything agreed upon, and for that reason he told him that he would not deliver the parcel until he paid him, but the latter then caused damage through other people, and he left for another place out of fear (audio folder in associated documents: archivo14/12/2016 08:17:29). Given its content, the assessment of that evidence as support for the aforementioned established facts is correct, because, as stated in the fifth fact, Mr. [Nombre3] and the plaintiff worked on the property together while they were a couple; after the marital problems, however, the cited co-defendant remained on the property with her permission, not exclusively. Moreover, as explained in the appealed judgment, the sale referenced by the appellant is absolutely null and void and therefore cannot have legal effects with respect to third parties (articles 627, 631 of the Código Civil).

If the appellant delivered any money to Mr. [Nombre3] pursuant to that act, he may seek reimbursement of that amount through the appropriate proceeding. What is inadmissible is his position that this act should be given legal effect to justify the eviction that interfered with the plaintiff’s possession of the property. In view of the manner in which the matter was resolved, based on the evidence analyzed, the appellant has not been denied any right either; in any event, it is clarified that he would have no real property right (derecho real) over the land because it is public-domain property (bien demanial), even though he purchased it from Mr. [Nombre3] through a void sale. Finally, the fact that he “won” (sic) an injunction proceeding (proceso interdictal) not only confers no right upon him because of the summary nature of that proceeding, in which no rights of any kind are adjudicated or granted, as established in provision 457 of the Código Procesal Civil, applied supplementally.

Furthermore, it is not true that the injunction proceeding in which he participated against the plaintiff was decided in his favor, because it was dismissed as time-barred, as ordered in decision 245-F-2016 of this Court.

XIII.Nor is the confusing argument presented in ground of appeal B) valid: namely, that although “Achiotal” is part of the public domain, he asserts that these are lands transferred by SINAC to INDER and that, because he is listed in a report that he has been unable to have certified, he is the person recorded as the possessor. The sixth recital of this judgment explains the public-domain nature of the area where the land at issue is located and identifies the entity responsible for its administration. As for the appellant’s appearance on a list, without explaining the purpose for which it was prepared or by whom, this is not evidence of any possession, much less does it confer upon him any right concerning the land in dispute. His claim that he proved current momentary possession in prior proceedings, without specifying which ones—therefore leading to the conclusion that he means injunction proceeding 13-000307-298AG—is likewise untrue.

At first instance, the established facts in the injunction judgment of 28 de marzo 2014 deemed the plaintiff to be the current or momentary possessor. Decision 245-F-2016 of this Court reversed that judgment, but on procedural grounds, by declaring the action time-barred. Also without merit is the argument that Mr. [Nombre3] and the plaintiff have agreed to harm him by keeping both the land and the money, which he characterizes as improper and incorrectly decided. As explained to him, the trial judgment declares the sale in which he participated absolutely null and void; consequently, he cannot seek to obtain benefits of any kind through it. As for the money he alleges he delivered, he may pursue reimbursement from the person who received it through the appropriate proceeding. Nor is his argument that the plaintiff and the other co-defendant conspired against him credible, because there is no evidence whatsoever confirming that assertion.

On the contrary, the evidence shows that the marriage ended in divorce and that domestic-violence complaints were even filed, reflecting a difficult relationship between the parties. The evidence offered for further consideration (prueba para mejor resolver) was not admitted.

XIV.The allegation made in argument C) is unfounded. The finding that Mr. [Nombre3] remained on the property on behalf of the plaintiff after the separation is neither audacious nor baseless, because the possession he exercised over that property was never exclusive, either during their relationship or afterward. That conclusion follows from the testimonial evidence, testimony elicited through examination, and documentary evidence, analyzed as a whole and according to criteria of logic and reasonableness. The statement in the sixth established fact of the challenged judgment—that before their divorce, Mr. [Nombre3] performed work jointly with the plaintiff and subsequently continued living on the property with her consent or permission, as they had agreed upon divorcing, but not exclusively—was confirmed by witnesses [Nombre1] and [Nombre6]. It should also be borne in mind that co-defendant [Nombre3] and the plaintiff had conflicts that resulted in domestic-violence complaints, which is why she explains in her filings that she went to live elsewhere.

Witnesses [Nombre8] and [Nombre7] further explained, with respect to the land in dispute, that after the divorce they agreed that Mr. [Nombre3] would remain there with the plaintiff’s permission, but not exclusively. This may be explained by the fact that they had a daughter together who was five years old in 2005, as recounted in the judgment of 16 de mayo de 2005 issued in expediente 05-110052-323VD by the Juzgado Contravencional de Los Chiles, which is confirmed in divorce judgment 354 de 27 de mayo de 2014 issued by the Juzgado de Familia de San Carlos. Another fact confirming the plaintiff’s statement, which the appellant accepts, is that when Mr. [Nombre3] stayed on the property, he did not do so in a dwelling but in an uninhabitable storage building whose only sound feature was its zinc roof (second fact in the answer). With respect to his statement that the land at issue is not marital property (bien ganancial), this is true, but it was not a fact relied upon in the challenged judgment to resolve the dispute.

Indeed, the divorce judgment expressly does not characterize it in that manner and merely clarifies that they exercise possession in that area. Nor is his assertion understandable that, on the basis of this allegation, there is evidence of “an intention to deprive him of his ownership and harm him,” and that Mr. [Nombre3]’s life cannot be asserted against his open and notorious possession if the latter was the person registered as possessor. His argument that the crops planted by the plaintiff before 2007, when she lived with her former husband, do not grant her possession of the property—because [Nombre3] was the person in possession, as shown by the IDA record, the sale document, the witnesses, the price paid, and current momentary possession since the sale in 2013, which he considers sufficient for the claim to be decided in his favor—is an erroneous and unfounded conclusion in light of the evidence and the foregoing analysis.

In this regard, it is emphasized that, in the cited judgment 354-2014 issued by the Juzgado de Familia de San Carlos in divorce expediente 13-000706-924FA (point 5 of the operative provisions (por tanto)), the plaintiff and Mr. [Nombre3] referred to the land at issue and its status given the existence of injunction proceeding 13-000308-298 AG, and agreed that if the claim were granted, possession of the parcel would belong to both of them in equal shares. By doing so, Mr. [Nombre3] acknowledged that possession of the land was not exclusively his, demonstrating that the plaintiff’s claim was supported by the manner in which both had actually possessed the property before those proceedings and refuting the appellant-defendant’s position that Mr. [Nombre3] was the sole possessor of that area.

XV.In the claim identified as [Nombre11], he reiterates that legal effect should be given to the sale that enabled him to possess the property, since it was executed by the titleholder registered with the IDA. Apart from the fact that this was not proven, it has already been explained that the sale is void and produces no legal effects. Regarding his assertion that the trial judge’s conclusion should apply to him and not to the plaintiff, the appellant is mistaken, because her claim was proven; indeed, it was established conclusively, not merely through circumstantial evidence. As for his contention that it makes no sense to include the ninth and tenth proven facts in the challenged judgment because, ultimately, what prevails is that he, rather than the plaintiff, was the possessor (ground of appeal E), this is a respectable but incorrect assessment. Those facts concern the outcome of the judgments issued in the summary possessory proceeding (proceso interdictal) 13-000307-298AG, information that is important as precedent for this proceeding.

XVI.In his penultimate ground of appeal (F), he states that the entire community of Achiotal is in the same circumstances, within the area of influence of the Área de Conservación Arenal Huerta Norte, but that within it there is a decision drawn up (sic) by SINAC-INDER with the possessors, which he asks the Court to obtain because he currently appears on the list and this permits his possession to be declared, a matter that the State’s representatives should have mentioned. He clarifies that he is not asking for the public-domain status (demanialidad) to be disregarded, but rather for possession of that public-domain property (bien demanial) to be declared in his favor, because there is a special regulation governing the use of the area and he has been included under it by virtue of the transfer from the possessor, who was not the plaintiff, the entire matter being a scheme to defraud him of his rights.

His argument is unfounded and, moreover, was not proven. The fact that an entire community is in the same situation does not mean that he is therefore entitled to receive the benefit he seeks. The fact that a list may exist—whose origin and purposes are unclear, as is the date on which it was prepared—does not, as already explained, confer any type of right upon him and is not useful evidence for proving de facto occupancy or possession (tenencia o posesión de hecho) of public-domain property.

XVII.Finally, he asks the Court to consider, for purposes of the disturbance of possession (perturbación), that the plaintiff invaded the property a couple of months ago and remains there, for which reason criminal complaints were filed (ground of appeal G). Even if those events did in fact occur, they do not alter the decision, because they would constitute events that cannot change the cause of action or subject matter of this litigation; furthermore, that situation would not negate the fact that the appellant defendant dispossessed the plaintiff of the occupancy she exercised, based on a cause that lacked validity, namely, the void sale of public-domain property. Accordingly, none of defendant [Nombre2]’s arguments provide grounds for altering the decision.

XVIII. In accordance with the foregoing, as to the matters appealed, the challenged judgment must be affirmed

POR TANTO

As to the matters appealed, the challenged judgment is affirmed. VOTO N° 423-F-2018 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciocho horas y cero minutos del veintidós de mayo de dos mil dieciocho.- PROCESO ORDINARIO establecido por [Nombre1] , mayor, divorciada, de oficios domésticos, vecina de Los Chiles, cédula CED1 - - ; contra [Nombre2] , mayor, viudo, comerciante, cédula CED2 , vecino de Pavón de Los Chiles; y [Nombre3] , mayor, divorciado, jornalero, cédula CED3 , vecino de Los Chiles, Alajuela. Interviene en el proceso como parte interesada la PROCURADURÍA GENERAL DE LA REPÚBLICA (PGR), representada por Silvia Quesada Casares, mayor, abogada, vecina de San José, cédula CED4 . Actúa en el proceso como defensor público agrario de la parte actora, Ignacio Rodríguez Sancho, y como apoderada especial judicial del demandado [Nombre2], Dania Josefina Valverde Núñez, colegiada dos mil seiscientos treinta y cinco. Este proceso es tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos.- R E S U L T A N D O:

  1. 1La parte actora planteó demanda ordinaria, estimada en la suma de doce millones de colones para que en sentencia se declare: " 1.- Que la suscrita soy la única y legítima poseedora con derechos del área del terreno que se reclama y se escribe en el hecho primero de esta acción, sobre el cual fui perturbada y despojada de la posesión, con intenciones de apropiamiento por parte del coaccionado [Nombre2] . 2.- Que el coaccionado [Nombre2] es poseedor ilegítimo del terreno que se reclama con esta acción, sobre el cual me despojo ilegítimamente y que tienen pleno conocimiento de que la única poseedora legal del terreno era la suscrita, porque así se lo hice saber a los coaccionados cuando los observé dentro del terreno. 3.- Que se declare que la suscrita tengo mejor derecho de posesión sobre el terreno, en relación con los codemandados y que soy la única y legítima poseedora del terreno que describe en hecho primero de esta acción. 4.- Que consecuentemente, los documentos privados de Opción de Venta, entre [Nombre3] , denominado vendedor y [Nombre2] , denominado comprador, de fecha 5 de julio del 2013 y la Escritura Pública 152 del protocolo de la notaria pública Elizabeth Corella González, a las 10:00 horas del tres de octubre del dos mil trece se deben anular, dado que son ilegales. 5.- Que ambos documentos que se solicita anular fueron hechos contrarios al derecho, pues el terreno que se negoció en esos documentos se localiza dentro del llamado [Dirección1] Fronterizo [Dirección2] en [Dirección3] lo que lo convierte en inalienable.- 6.- Se deberá por consiguiente ordenar al accionado que desaloje inmediatamente y me restituya el área de terreno que me está despojando, la cual se describe en el hecho primero de esta acción y que debe de abstenerse en lo sucesivo de perturbar la posesión que ejerce la suscrita sobre esa área de la litis, bajo apercibimiento de seguírsele causa penal por el delito de desobediencia a la Autoridad si desobedece. 7.- Que se ordene por medio del Juzgado Contravencional de Los Chiles o la Fuerza Pública del comando de Los Chiles, poner en efectiva posesión del terreno a la suscrita, al momento que se lleve a cabo el desalojo. 8.- Que se le condene al coaccionados al pago de las costas procesales y personales en caso de oposición a la presente acción" (carpeta descritos, archivo 17/08/16 1:19:06 p.m., imágenes de la 1 a 8).-
  2. 2En resolución de 22 de agosto de 2016 se da el traslado de la demanda y se tuvo como parte interesada a la Procuraduría General de la República.-
  3. 3El demandado [Nombre2] se opuso a la demanda e interpuso las excepciones de incompetencia de la jurisdicción (ya resuelta), falta de derecho, falta de legitimación activa y pasiva, falta de personalidad procesal del actor y de la demandada y prescripción (estas dos últimas rechazadas en auto-sentencia 141-AS-2016). En resolución de 26 de setiembre de 2016 se declaró rebelde a [Nombre3] , pero tal se apersonó al proceso y participó en el juicio verbal (carpeta de escritos: archivo 21/09/16 10:34:11 a.m.).-
  4. 4La Jueza Ana Milena Castro Elizondo, del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, en sentencia 155-S-2017 de 16 de noviembre de 2017, resolvió: “POR TANTO: Se rechazan las de falta de derecho, falta de legitimación activa y pasiva interpuestas por el demandado [Nombre2] . Se declara parcialmente CON LUGAR la demanda interpuesta [Nombre1] contra [Nombre2] y [Nombre3] , denegándose en lo expresamente no concedido. Con el fin de resolver el conflicto entre particulares y sin detrimento de los derechos del Estado, 1. Respecto a los co-demandados [Nombre2] y [Nombre3] , se reconoce a [Nombre1] como poseedora del terreno, en litis, a saber: terreno de agricultura y de humedal, sito en El Achiotal de Los Chiles, [Dirección4] Los Chiles de la Provincia de Alajuela, finca mide aproximadamente diez mil setenta y dos metros cuadrados linda al norte llanos Nacionales, al sur [Dirección5] , al oeste [Dirección6] Miranda y al este [Dirección7] . 2.- Se declaran nulos los documentos privados de Opción de Venta, entre [Nombre3] , denominado vendedor y [Nombre2] , denominado comprador, de fecha 5 de julio del 2013 y la Escritura Pública 152 del protocolo de la notaria pública Elizabeth Corella González, a las 10:00 horas del tres de octubre del dos mil trece. 3- Se le ordena al demandado [Nombre2] , el desalojo del terreno objeto de litigio y la restitución del mismo a la actora, así como abstenerse de perturbar la posesión que ejerce sobre esa área de la litis, bajo apercibimiento de seguírsele causa penal por el delito de desobediencia a la Autoridad si desobedece.Se le otorga a dicho co-demandado un plazo de QUINCE DÍAS, para proceder a desocupar el inmueble de forma voluntaria, caso contrario se procederá al desalojo forzoso del inmueble. Se resuelve sin especial condenatoria en costas" (carpeta de documentos asociados, archivo 16/11/17 8:04:03 a.m.).-
  5. 5El actor [Nombre2] y la PGR interponen recurso de apelación con indicación expresa de las razones en que se apoyan para refutar la tesis del juzgado de instancia. Aportó ante el Tribunal poder especial judicial a favor de [Nombre4] (carpeta de escritos, archivos 20/11/17 2:20:11 p.m. y 21/11/17 7:01:31 a.m.).-
  6. 6En la substanciación del proceso se han observado las prescripciones legales y NO existen errores u omisiones capaces de producir la nulidad del fallo.-

Redacta la jueza Alpízar Rodríguez;

CONSIDERANDO

I.Sobre los documentos aportados como prueba para mejor proveer por la parte demandada apelante. Ofrece en la apelación lo que afirma son tres hojas de un informe que dice son del expediente del IDA, donde se indica que el poseedor era [Nombre3] , quien le vendió, no la actora. Dado el contenido del recurso, no existen razones válidas para admitir esa prueba, al ser innecesaria para el esclarecimiento de los hechos (artículos 52 de la Ley de Jurisdicción Agraria y 502 del Código de Trabajo, aplicado supletoriamente, según Transitorio I de la Ley 9443. Ver al respecto el voto 728 de 4 de octubre de 2007 de la Sala Primera). Además, no justifica el apelante por qué no ofreció dicha documental oportunamente, cuando contestó la demanda, si eran documentos que afirma constan en un expediente administrativo. Posteriormente, en memorial presentado ante esta Sede, el 4 de diciembre de 2017, ofrece para mejor resolver copia de un expediente penal y pide se solicite al SINAC, a la encargada del Plan de Manejo de Censo y Población del Achiotal, lo cual asegura que "entiende está en Decreto para ser firmado y ejecutado (sic) donde consta que es [el apelante] el acreditado en esa parcela como titular y es lo que pasará para el trámite ante el Inder.

No aclara qué es lo que se debe solicitar al SINAC, pero en todo caso, si son documentos la parte debió y pudo haberlos aportado, pues no justifica que tenga algún impedimento de orden legal para obtenerlos. En cuanto a los documentos del proceso penal que refiere, tratan sobre hechos que no pueden influir ni variar la causa y objeto de este litigio, por lo que no existe razón para admitirles. Nótese además, tampoco fueron ofrecidos oportunamente en primera instancia, sin que existiese impedimento para ello, según las fechas de esos documentos y la de la sentencia impugnada.

II.El Tribunal comparte los hechos probados, por tener sustento en la prueba aportada en autos, con las siguientes modificaciones y adiciones. Al hecho tercero adiciónese: El Refugio nacional de vida silvestre Corredor Fronterizo Norte, creado mediante Decreto Ejecutivo 22962 de 15 de febrero de 1994, comprende el corredor fronterizo conformado por los terrenos comprendidos a lo largo de la frontera con Nicaragua desde Punta [Dirección8] en el Mar Caribe hasta Bahía Salinas en el Océano Pacífico, con un ancho de dos mil metros. Dicho corredor está además afectado como bien demanial por lo dispuesto en la Ley de Tierras y Colonización, que da continuidad a la afectación que data de finales del siglo XIX. Al hecho cuarto: Los cultivos realizados fueron de subsistencia (yuca, maíz, frijoles, tiquizque y árboles frutales de guanábana, coco y otros). Al hecho décimo: Se revocó la sentencia interdictal de primera instancia por estar caduca la demanda.Se agrega como elemento probatorio del hecho sexto: sentencia de divorcio 346-2014 del Juzgado de Familia de San Carlos del 27 de mayo del 2014, punto quinto del por tanto.

III.Se tiene como hechos indemostrados los siguientes: 1/. Las actividades realizadas por la actora en el sector en litigio, tanto antes de divorciarse del señor [Nombre3] como luego de ello, hayan afectado el equilibrio ecosistémico del humedal ubicado en el sector norte del área. 2/. La actora ni los demandados hayan contado con autorización del Estado (Área de conservación respectiva del SINAC o el antes Instituto de Desarrollo Agrario), previo a su ingreso al terreno, para ejercer su tenencia o para mantenerse en él.

IV.Conoce este Tribunal los recursos de apelación interpuestos por la parte demandada [Nombre2] y la PGR contra la sentencia 155 de 16 de noviembre de 2017, en la cual se declaró parcialmente con lugar la demanda, por lo que se declaró a la actora [Nombre1] , con el fin de “resolver el conflicto entre particulares y sin detrimento de los derechos del Estado”, respecto de los co-demandados [Nombre2] y [Nombre3] , poseedora del terreno en litigio; se anularon los documentos privados de opción de venta entre [Nombre3] y [Nombre2] , de fecha 5 de julio del 2013 y la Escritura Pública 152 del protocolo de la notaria Elizabeth Corella González de 3 de octubre de 2013; se ordenó al demandado [Nombre2] desalojar el terreno objeto de litigio y restituirlo a la actora, así como abstenerse de perturbar su posesión (carpeta de documentos asociados, archivo 16/11/17 8:04:03 a.m.).- En memorial presentado ante esta Sede, el 4 de diciembre de 2017, el apelante intenta ampliar y explicar argumentos del recurso de apelación y ofrece prueba documental para mejor resolver, la cual no fue admitida.

Tampoco resulta atendible los argumentos adicionales que pretende presentar en ese memorial, por extemporáneos. En materia agraria no existe plazo para ampliar agravios; todos deben interponerse en el recurso que se presente en el plazo conferido para apelar (artículos 59 y 60 de la Ley de Jurisdicción Agraria) (voto 927 de 31 de agosto de 2011). Se analizará primero lo que concierne al recurso de la PGR y luego el del codemandado [Nombre2].

V. RECURSO DE LA PGR

Expone los siguientes agravios: 1) Infracción a los principios del debido proceso, igualdad procesal, congruencia y cumplimiento de los elementos esenciales del fallo. Violación de normas procesales de acuerdo con los artículos 22 inciso ch) de la Ley de Jurisdicción Agraria, 98 inciso 2) y 155 párrafo 1) e inciso 3.e) del código procesal civil. Explica, la sentencia 155-2017 tiene como hecho probado que el inmueble litigio es demanial, por ubicarse dentro del Refugio de Vida Silvestre Corredor Fronterizo Norte, en el cual indica existe un humedal en el sector norte. Resalta, en el considerando sexto se indicó que por ser un bien demanial, los convenios que hayan realizado los particulares respecto a esa zona son nulos, y cualquier actividad realizada por la actora o el demandado, sin autorización del Estado, no le genera derecho legítimo alguno. Por ello, dice se anularon los documentos de venta suscritos entre [Nombre3] y [Nombre2] .

No obstante, reclama, se acoge parcialmente la demanda y se declara a [Nombre1] “poseedora del terreno” y se ordena restituirle el terreno litigio de “agricultura” y “humedal”, “sin detrimento los derechos del Estado”. Eso no se comparte. Indica se le tuvo como parte interesada en resolución del 22 de agosto de 2016, y desde su escrito apasionamiento del 1 de septiembre de este año, se indicó no era de recibo la pretensión de declarar al actora poseedora del terreno litigio por tratarse de un viento del dominio público. Ello con base en la Ley 30 de 22 de junio de 1888; artículo 510-5) del Código Fiscal, reformado por leyes 11 de 22 de octubre de 1926 149 16 de agosto 29; artículo 10 de Ley 13 de 10 de enero de 1939: articuló 7-f) e i) de la Ley de tierras y colonización; Decreto 22962 del Refugio nacional de vida silvestre Corredor fronterizo Norte, el cual constituye Patrimonio natural del Estado, según la Ley Forestal 7575, artículos 13,14 y 15, que mantuvo lo dispuesto en las leyes forestales 4465 y 7554.

Por eso indica la invocan a excepción de falta derecho. El que se trataba de un bien del dominio público, expresa, fue reiterado memorial del 16 de diciembre de 2016, cuando se aportó al informe técnico del Área de conservación Arenal Huetar Norte, número SINAC- ACAHN-FGH-1110-2016, que sustenta el hecho probado 3) de la sentencia recurrida y se acoge en el considerando II, III y IV. Agrega, en las conclusiones del 20 de enero de 2017, señalaron que la actora ni los demandados tenían autorización del SINAC, para ocupar válidamente un terreno dentro del citado refugio nacional, conforme al artículo 18 de la Ley Forestal. Como no ostentan derechos reales administrativos ni posesión válida a título de dueños, deba acogerse la excepción de falta derecho. Esos argumentos, dice fueron agobiados en el considerando segundo de la sentencia impugnada, porque sólo se resumió la postura de la parte ascendente y del codemandado apersonado.

Por ello, la sentencia infringe los principios citados, dado que se resolvió el proceso como si el Estado no hubiese sido parte, sin analizar las cuestiones de fondo planteadas por la PGR (artículos 22-h) de la Ley de Jurisdicción Agraria, 98-2) y 155 del Código Procesal Civil). En cuanto a la incongruencia, resalta implica que se deben analizar las incidencias y cuestión de fondo planteada por todas las partes, para garantizar el debido proceso. Cito su apoyo los votos de la Sala Primera 127-2008,126-2009, 947-2009, 215-2016. Resalta también el voto 225-2016 de este órgano, él anuló una sentencia que desatendió la posición del Estado como parte interesada, en relación con las pretensiones que afectan su patrimonio natural y transcribe párrafos de ese fallo. Por ello considera que se resolvió litigio sin consideración de las objeciones del Estado relativas a la imposibilidad de reconocer derecho a las partes sobre su patrimonio natural.

La frase “sin detrimento los derechos del Estado”, no encuentra explicación. Siendo el Estado parte del proceso, aun así se declaró a la actora poseedora del terreno inscribir localizados en su totalidad dentro del Refugio en la [Dirección9] . 2) Quebranto de normas sustantivas por falta aplicación. Reiteradas se infringen las mismas normas y cada en el agravio anterior y agrega que se desaplicó el artículo 32-f de la Ley orgánica del ambiente, que incluye a los humedales como áreas silvestres protegidas, bajo administración del MINAE, al ser parte patrimonio natural del Estado con los atributos de los artículos 13,14 y 15 de la Ley Forestal (artículos 32.38 y 40 de la Ley 7554 y 39-i) de la Ley Forestal; votos de la Sala Constitucional 5399-93, [Telf1], 9158-1998, [Telf2], [Telf3], [Telf4], 16975-2008, 14288-2009). Resalta esa posición la mantuvo en sus memoriales de 1 de septiembre de 2016, 16 de diciembre de ese año y 20 de enero de 2017.

Conforme se probó, dice las partes del proceso no ostentan la autorización exigida por el artículo 18 de la Ley Forestal para ocupar válidamente terrenos del refugio citado. Es contraria al derecho, declarar que la actora después hora del terreno y ordenar a su favor la restitución. Pide se revoque la sentencia y sacó a la excepción de falta derecho (carpeta de escritos: archivo 21/11/2017 07:01:31).

VI. SOBRE LA DEMANIALIDAD DE LA [Dirección10]

Dada la posición de la PGR, que en resumen niega se pueda dar ningún tipo de tutela a la posesión ejercida por personas privadas en tal zona, cuando no cuenten con autorización estatal para ocuparla, es importante referirse brevemente dos temas, que contextualizan la realidad socio-jurídica de esa zona y explican por qué no es procedente su apelación en función del caso concreto analizado. El primero trata sobre la demanialidad de la Faja Fronteriza Norte (en adelante FFN) y el segundo sobre la tenencia y gobernanza de esa zona, porque los problemas y deficiencias de su administración estatal, que datan de hace muchas décadas, han propiciado su ocupación legal e ilegal y esto innegablemente genera conflictos entre personas privadas, a las que el ordenamiento jurídico debe dar una solución idónea. La FFN es un bien demanial por doble afectación. Lo es por disposición de la Ley de Tierras y Colonización de 14 de octubre de 1961 (vigente en lo no derogado o reformado por Ley 9036 de 11 de mayo de 2012, que Transforma el Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (Inder).

Dicha normativa mantuvo la afectación que data desde finales del siglo XIX, como lo resalta la Procuraduría en sus alegatos, que se basa en razones de soberanía y seguridad nacional. Y a partir del Decreto 22962 de 15 de febrero de 1994, se afecta también como Patrimonio Natural del Estado, al ser declarada refugio de vida silvestre, denominado “Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte” (artículos 13, 14 y 15 Ley Forestal 7575). Dicho Corredor es administrado por el Ministerio de Ambiente y Energía (Minae), específicamente por el Sistema Nacional de Áreas de Conservación (Sinac), salvo el sector de Peñas Blancas, cuya administración corresponde al ahora Instituto de Desarrollo Rural, según Ley 7774 de 21 de mayo de 1998, que “segrega Terrenos del Refugio de Vida Silvestre de la Frontera Norte” y el Dictamen C-223-2015 de 19 de agosto de 2015 de la PGR. Los bienes demaniales están sometidos a un régimen especial y están destinados a fines de utilidad pública; son administrados por una persona jurídica pública.

Son imprescriptibles, inalienables, inembargable e inapropiables; usualmente no están registrados, pues prima para ellos el principio de inmatriculación (artículos 121-4 Constitución Política, 154 Ley General de la Administración Pública, 261 a 263 Código Civil. Votos de la Sala Primera 189 de 3 marzo 2011; Sala Constitucional 18483 de 19 diciembre 2007). “Su objetivo final es alcanzar, plenamente, el bien común. Es ésta la principal razón para justificar la existencia de un impedimento, por lo menos en principio, para la libre disposición de esta categoría de bienes. El régimen especial que los cobija, sin embargo, no alcanza por igual a todos los bienes públicos; la mayor, menor o inexistente cobertura dependerá del tipo de bien de que se trate. Es por ello que la doctrina del Derecho público habla de diversos tipos de bienes que pertenecen al Estado” (Sala Constitucional 3821 de 24 de abril de 2002).

Sobre bienes demaniales, como lo señala la Procuraduría, con lo cual concuerda este Tribunal, no se pueden adquirir derechos reales de naturaleza privada, con sus características y atributos básicos (inherencia, oponibilidad, publicidad, exclusión, persecución, prioridad y otros). Pero de acuerdo con su naturaleza y el fin de la afectación, puede darse un uso común (v.g en playas, calles públicas y otros) o un uso privativo. En función del último, podrían ostentarse y tutelarse, a favor de las personas privadas, derechos reales de naturaleza administrativa cuando los utilicen y ocupen con la autorización estatal (otorgada a través de permisos o concesiones). De acuerdo con la tesis de la Procuraduría, las personas privadas, para obtener tutela por actos o labores realizadas en bienes de dominio de dominio público que no sean de uso común, necesariamente deben ostentar un derecho real administrativo; si no es así, por no tener autorización del Estado, lo que hagan no les puede generar derecho legítimo alguno.

Esta última afirmación, tan absoluta, este Tribunal no la puede avalar por existir situaciones, como las que se analizan en este proceso, que deben ser resueltas objetivamente y atendiendo a las circunstancias del caso concreto. Por ello, esa afirmación frente al Estado es admisible jurídicamente. Pero cuando el conflicto surge entre personas privadas, aunque la ocupación sea ilegal o no autorizada, el ordenamiento jurídico debe dar una respuesta acertada, efectiva y razonable, que evite la violencia, el abuso del derecho y la “ley del más fuerte”. Además, en lo que concierne a la administración de la FFN, no puede dejar de tenerse presente, para resolver los conflictos jurídicos entre personas privadas por su ocupación o tenencia, la historia y realidad de la zona y la existencia de usos no autorizados que se han dado por décadas, lo cual es de conocimiento público; situación que el Estado costarricense ha tolerado por diversos motivos, como se reconoce en los instrumentos legales que se citarán posteriormente. Por ello, brevemente se hará referencia a los conceptos de tenencia y gobernanza en el uso de la tierra y a los deberes estatales al respecto.

VII. SOBRE LA TENENCIA Y GOBERNANZA DE LA FFN

“Tenencia de la tierra es la relación, definido en forma jurídica o consuetudinaria, entre personas, en cuanto individuos o grupos, con respecto a la tierra (por razones de comodidad, “tierra” se utiliza aquí para englobar otros recursos naturales, como el agua y los árboles). La tenencia de la tierra es una institución, es decir, un conjunto de normas inventadas por las sociedades para regular el comportamiento. La regla sobre la tenencia definen de qué manera pueden asignarse dentro de la sociedad de los derechos de propiedad de la tierra. Definen cómo se otorga el acceso a los derechos de utilizar, controlar y transferir la tierra, así como las pertinentes responsabilidades y limitaciones. En otras palabras, los sistemas de tenencia de la tierra determinan quién puede utilizar qué recursos, durante cuánto tiempo y bajo qué circunstancias. La tenencia de la tierra es una parte importante las estructuras sociales, políticas y económicas.

Es de carácter multidimensional, ya que hace entrar en juego aspectos sociales, técnicos, económicos, institucionales, jurídicos y políticos que muchas veces son pasados por alto pero que deben tenerse en cuenta. Las relaciones de tenencia de la tierra pueden estar bien definidas y ser exigibles ante un tribunal judicial oficial o mediante estructuras consuetudinarias dentro de una comunidad. En otros casos, pueden estar relativamente más definidas, con ambigüedades que se prestan a abusos” (FAO, tenencia de la tierra y desarrollo rural. Serie Estudios sobre la tenencia de la tierra Nº3, 2003, pág 9). La gobernanza de la tierra es un concepto más amplio, que complementa el anterior. “…Incluye las normas, procesos y organizaciones mediante las cuales se adoptan las decisiones relativas al uso y el control de la tierra, la forma en que se ejecutan e imponen las decisiones, y la manera en que se gestionan intereses contrapuestos relativos a la tierra.

El concepto abarca instituciones estatutarias, consuetudinarias y religiosas. Asimismo, incluye estructuras del Estado como, por ejemplo, organismos que se ocupan de cuestiones relativas a la tierra, tribunales y ministerios responsables de la tierra, así como agentes no estatutarios, como órganos tradicionales y organismos no oficiales. El concepto de gobernanza cubre tanto el marco jurídico y normativo para la tierra como las prácticas tradicionales e informales que cuentan con legitimidad social. La gobernanza de la tierra trata principalmente del poder y la economía política de la tierra. La estructura de poder de la sociedad se refleja en las normas de tenencia de la tierra; al mismo tiempo, la calidad de la gobernanza puede afectar a la distribución del poder en la sociedad. La tenencia es la relación entre personas respecto a la tierra y sus recursos. Estas normas definen la forma en la que se concede el acceso a los derechos para usar, controlar y transferir la tierra, así como las responsabilidades y restricciones derivadas…

Una gobernanza débil de la tierra es la causa de muchos problemas relacionados con la tenencia” ([Nombre5] , y otros. Hacia una mejor gobernanza de la tierra, en Documento de trabajo sobre la tenencia de la tierra, FAO, Nº 11, 2009, pág 1 y 2, 9).

VI.La Organización de las Naciones Unidas para la Alimentación (FAO por sus siglas en inglés), emitió en el 2012 las “Directrices voluntarias sobre la Gobernanza responsable de la tenencia de la tierra, la pesca y los bosques en el contexto de la seguridad alimentaria nacional”. En tales se explica que “la erradicación del hambre y la pobreza y el uso sostenible del medio ambiente dependen en gran medida de la forma en que las personas, las comunidades y otros grupos consiguen acceder a la tierra, la pesca y los bosques. Los medios de vida de muchos, particularmente las poblaciones rurales pobres, se basan en un acceso seguro y equitativo a estos recursos y en su control. Son la fuente de alimento y refugio, la base de las prácticas sociales, culturales y religiosas, y un factor central en el crecimiento económico… Los sistemas de tenencia determinan quiénes pueden usar qué recursos, por cuánto tiempo y en qué condiciones.

Estos sistemas pueden cimentarse en políticas y leyes escritas, pero igualmente en costumbres y prácticas no escritas. Los sistemas de tenencia están expuestos a tensiones crecientes ante la exigencia de garantizar la seguridad alimentaria para una población mundial en aumento, en circunstancias en que la disponibilidad de tierras, de recursos pesqueros y de bosques se ve reducida por la degradación ambiental y el cambio climático. Unos derechos de tenencia inseguros se traducen en un aumento de la vulnerabilidad, el hambre y la pobreza, y pueden conducir a conflictos y a la degradación ambiental cuando los usuarios en competencia luchan por asegurarse el control de estos recursos… La gobernanza de la tenencia es un elemento crucial para determinar si las personas, comunidades y otros grupos consiguen adquirir aquellos derechos y deberes conexos que les permiten utilizar y controlar la tierra, la pesca y los bosques y con arreglo a qué modalidades los consiguen.

Muchos problemas relacionados con la tenencia surgen a consecuencia de una débil gobernanza; y los intentos de abordar los problemas de tenencia se ven afectados por la calidad de la gobernanza. Una gobernanza débil tiene efectos adversos en la estabilidad social, la utilización sostenible del medio ambiente, las inversiones y el crecimiento económico. Las personas pueden verse condenadas a vivir una vida de hambre y pobreza si pierden sus derechos de tenencia sobre sus hogares, la tierra, la pesca y los bosques y sus medios de vida, debido a la corrupción en las prácticas de tenencia, o al hecho de que los organismos de ejecución no protegen sus derechos. Las personas pueden incluso perder la vida cuando una gobernanza deficiente de la tenencia conduce a conflictos violentos. La gobernanza responsable de la tenencia, por el contrario, promueve el desarrollo social y económico sostenible que puede ayudar a erradicar la pobreza y la inseguridad alimentaria y alienta la inversión responsable”.

VIII.En esas Directrices se explican y contemplan aspectos relevantes para entender y resolver conflictos como el analizado en este caso, pues aunque la FFN sea un bien demanial, históricamente ha sido ocupado y usado, de manera informal o no autorizada para el desarrollo de actividades agropecuarias en gran parte de su extensión, dada la naturaleza de la tierra y las políticas de administración de esa zona que en el pasado estableció el Estado. En el aparte 3A de los “Principios rectores de la gobernanza responsable de la tenencia”, denominado “Principios generales”, se destaca en el punto 3.1 párrafos 4 y 5 y también en el punto 25.4, que los Estados deben “proporcionar acceso a la justicia para hacer frente a las violaciones de los derechos legítimos de tenencia. Deberían proporcionar a todos, mediante el recurso a las autoridades judiciales o a otros instrumentos, una vía eficaz y accesible para la resolución de los conflictos sobre los derechos de tenencia, y poner en ejecución las resoluciones en plazos breves y a costos asequibles.

Los Estados deberían proporcionar una reparación rápida y justa cuando los derechos de tenencia se expropien por motivos de utilidad pública. Y “prevenir las disputas relacionadas con la tenencia, los conflictos violentos y la corrupción. Deberían tomar medidas activas para evitar que surjan disputas por la tenencia y deriven en conflictos violentos. Deberían tratar de impedir la corrupción en todas sus formas, en todos los niveles y en todos los ámbitos”. Como punto 4.9 de los “Derechos y responsabilidades relacionados con la tenencia”, reiterado y ampliado en el punto 21 sobre “Solución de controversias sobre derechos de tenencia” se indica: “4.9 Los Estados deberían proporcionar acceso, por conducto de órganos judiciales y administrativos imparciales y competentes, a medios que permitan dar solución oportuna, asequible y eficaz a las controversias sobre los derechos de tenencia, incluidos los medios alternativos para dichas soluciones, y deberían proporcionar recursos procesales eficaces para ello, entre los que podrá encontrarse un derecho de apelación, según proceda.

Los recursos procesales deberían aplicarse con prontitud y podrán incluir la restitución, la indemnización, la compensación y la reparación. Los Estados deberían esforzarse para garantizar que las personas vulnerables y marginadas tienen acceso a tales medios, en consonancia con los párrafos 6.6 y 21.6. Los Estados deberían asegurar que cualquier persona cuyos derechos humanos se violen en el contexto de la tenencia tenga acceso a tales medios de resolución de las controversias y recursos procesales”. En el apartado denominado “Reconocimiento jurídico y asignación de derechos y deberes de tenencia”, que aborda la gobernanza de la tenencia de la tierra, la pesca y los bosques en relación con el reconocimiento jurídico de los derechos de tenencia de los pueblos indígenas y otras comunidades con sistemas consuetudinarios de tenencia, además de los derechos de tenencia informales; y la asignación inicial de derechos de tenencia sobre la tierra, las pesquerías y los bosques que son propiedad o se encuentran bajo control del sector público, se recomienda que los Estados establezcan salvaguardas.

Entre ellas cabe destacar las numerada 7.6, que dice: “Cuando no sea posible un reconocimiento legal de los derechos de tenencia, los Estados deberían impedir los desalojos forzosos que contravengan a sus obligaciones existentes en el marco del derecho nacional e internacional, de conformidad con los principios de las presentes Directrices”. En el apartado 10, referido a “Tenencia informal” se destaca: “10.1 Cuando exista la tenencia informal de tierras, pesquerías y bosques, los Estados deberían reconocerla de tal manera que dicha tenencia respete los derechos formales vigentes con arreglo a la legislación nacional y de forma que se reconozca la realidad de la situación y se fomente el bienestar social, económico y medioambiental… 10.6 Cuando no sea posible un reconocimiento legal de la tenencia informal, los Estados deberían impedir los desalojos forzosos que contravengan a sus obligaciones existentes en el marco del derecho nacional e internacional, de conformidad con las disposiciones pertinentes de la Sección 16.

Aunque haciendo referencia al derecho de propiedad, la FAO diferencia lo formal e informal en función de si algo es reconocido expresamente por el Estado y puede ser protegido a través de medios legales Lo informal será lo que carece de reconocimiento y protección oficial. En algunos casos, los derechos informales son ilegales, es decir, representan una infracción a la ley y tratándose de tenencia ilegal, se reconoce en que en muchos casos se producen por deficiencias del sistema legislativo. También pueden presentarse situaciones “extralegales”, es decir, no contra la ley pero tampoco reconocidas por ella (FAO en http://www.fao.org/docrep/005/y4307s/y4307s05.htm). Finalmente, debe destacarse que la seguridad de la tenencia de la tierra es la certeza de que los derechos de una persona serán reconocidos por los demás y recibirán protección frente a impugnaciones específicas.

IX.En Costa Rica, el Decreto Ejecutivo 35959 de 07 abril 2010 “Declara de interés público la solución de la problemática de tenencia de la tierra en territorios rurales ocupados por campesinos y trabajadores rurales”. Y el Decreto 35849 de 8 de febrero de 2010 declara de “Interés Público la Comisión Interinstitucional de la Zona del Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte y demás Territorios de la Zona Norte de Costa Rica”. En su preámbulo reconoce el problema de tenencia de la tierra de esa zona, que es de muy vieja data, al considerar: “I. Que el problema de la inseguridad jurídica de los habitantes y pobladores que se ubican dentro de los territorios que conforman la Zona del Refugio Nacional de Vida Silvestre Corredor Fronterizo costarricense, resulta ser una prioridad para el Estado, ya que es función del mismo velar por la conservación de los recursos naturales renovables, especialmente aquellos que colaboran en el bienestar y mejor desarrollo social, económico, político y ecológico de los pobladores de la región…

III.-Que muchos de los habitantes y pobladores que viven en dichas zonas, no sólo habitan en dichos terrenos, sino que los mismos, por su naturaleza y ubicación han contribuido y contribuyen actualmente, a llevar el sustento a miles de familias a través del turismo rural como medio de subsistencia. IV.- Que es deber del Estado a través de las instituciones como el Ministerio de Ambiente Energía y Telecomunicaciones, resolver la problemática de tenencia de la tierra de los habitantes y pobladores que están dentro de los territorios que se ubican dentro de la Zona del Refugio Nacional de Vida Silvestre Corredor Fronterizo. V.-Que diversas interpretaciones legales ponen en peligro la existencia y permanencia, de los agricultores y trabajadores rurales costarricenses, promoviendo el desarraigo y extinción cultural de dichos poblados, por lo que se debe promover con urgencia un estudio de evaluación que determine la relevancia de carácter ambiental, social y económica de la Zona del Refugio Nacional de Vida Silvestre Corredor Fronterizo, cuyo resultado refleje la necesidad y fundamento para una propuesta de desafectación vía ley de dicho territorio”.

En ese mismo sentido, el Decreto 33407 de 4 de octubre de 2006, había reconocido: “I.- Que los cantones de Los Chiles, Upala, Guatuso de la Región Norte Norte, en tanto localidades fronterizas con Nicaragua y de acceso desde otros países del norte centroamericano, se caracterizan por una compleja realidad socioeconómica, de seguridad ciudadana y tenencia de la tierra, que obligan una atención especial por parte del Gobierno Central y sus instituciones para abordar dicha problemática en una forma integral… V.- Que estos cantones, constituyen las zonas de mayor pobreza de dicha Región, caracterizadas por los bajos índices de salud, poco acceso a vivienda digna, alta tasas de desempleo, escasas oportunidades de educación, conflictiva situación migratoria y de seguridad ciudadana en virtud de su cercanía a la zona fronteriza del norte del país, así como servicios básicos vitales para la vida deficitarios, que imposibilitan un mejor desarrollo humano de sus habitantes.

VI.- Que el principal vacío para el desarrollo humano de estos tres cantones fronterizos, ha sido la ausencia de un ente que conozca en su verdadera dimensión tal problemática, por lo que se hace difícil coordinar las acciones tendientes a integrar los diferentes actores de la sociedad”.

X.Conforme a lo explicado sobre las recomendaciones y obligaciones que las Directrices citadas establecen sobre tenencia y gobernanza de la tierra, no sólo para el Estado, sino también para el sector civil, para resolver conflictos como el presentado en este caso, debe tenerse presente el histórico problema de la tenencia de la tierra en la FFN. Al respecto, nuestro ordenamiento jurídico establece que los tribunales deben dar una respuesta –oportuna, razonable y fundamentada- a todos los conflictos que se les presenten, aun a aquellos para los cuales no exista norma expresa o tipificada. Así lo disponen los numerales 41 constitucional y 5 de la Ley Orgánica del Poder Judicial Nº 8 de 29 de noviembre de 1937, que expresan: “41.- Ocurriendo a las leyes, todos han de encontrar reparación para las injurias o daños que hayan recibido en su persona, propiedad o intereses morales. Debe hacérseles justicia pronta, cumplida, sin denegación y en estricta conformidad con las leyes”.

“5.-… Los tribunales no podrán excusarse de ejercer su autoridad o de fallar en los asuntos de su competencia por falta de norma que aplicar y deberán hacerlo de conformidad con las normas escritas y no escritas del ordenamiento, según la escala jerárquica de sus fuentes”. Esto se resalta porque la PGR, al solicitar en su recurso se declare sin lugar la demanda y considerar improcedente que se resuelva “sin perjuicio de los derechos del Estado”, por ejercer la accionante una ocupación no autorizada de un sector de la FFN, propone una opción que no soluciona en realidad el conflicto entre privados y que desconoce la realidad de la tenencia informal o ilegal de tal zona. Nótese en este caso la actora en su demanda reconoce que ejerce la tenencia de un bien demanial pero reclama que ha sido desalojada indebidamente por otra persona privada, que legalmente no está en una mejor situación que ella.

Permitir que entre privados se puedan dar situaciones abusivas o incluso violentas para ocupar bienes demaniales sobre los cuales el Estado tampoco ha ejercido oportunamente la recuperación de la posesión (nótese en este asunto la PGR no ejerció la intervención principal excluyente y participó solo como tercero legal), aun cuando esté de por medio la tenencia informal o hasta ilegal de un bien demanial, sería propiciar o avalar más ingobernanza de la que ya existe en la FFN y generar que las personas privadas utilicen medios indebidos o la fuerza o violencia para ocupar esos terrenos. Ello no lo permite nuestra Constitución Política ni los tratados internacionales, tal y como se dispone en los numerales 8.1 de la Convención Americana sobre Derechos Humanos (Pacto de San José) (“Toda persona tiene derecho a ser oída, con las debidas garantías y dentro de un plazo razonable, por un juez o tribunal competente, independiente e imparcial, establecido con anterioridad por la ley, en la sustanciación de cualquier acusación penal formulada contra ella, o para la determinación de sus derechos y obligaciones de orden civil, laboral, fiscal o de cualquier otro carácter”) y artículo XVIII de la Declaración Americana de los Derechos y Deberes del Hombre “Toda persona puede ocurrir a los tribunales para hacer valer sus derechos.

Asimismo debe disponer de un procedimiento sencillo y breve por el cual la justicia lo ampare contra actos de la autoridad que violen, en perjuicio suyo, alguno de los derechos fundamentales consagrados constitucionalmente”). Asimismo, el numeral 263 del Código Civil dispone: “El modo de usar y de aprovecharse de las cosas públicas se rige por los respectivos reglamentos administrativos; pero las cuestiones que surjan entre particulares, sobre mejor derecho o preferencia al uso y aprovechamiento de las cosas públicas, serán resueltas por los tribunales” (lo destacado no es del original). La normativa citada no sólo faculta sino que obligan a los tribunales a dar una solución razonable y proporcional, amparada en lo que el ordenamiento jurídico tutela, para evitar situaciones injustas o abusivas originadas en conflictos entre personas privadas por la tenencia de la tierra en la FFN. Téngase presente al respecto, además, que como se concluye en los documentos de la FAO antes analizados “cuando la gobernanza de la tierra es débil, los poderosos pueden dominar las disputas por los recursos de tierra escasos”, lo cual va en contra de los principios del desarrollo sostenible y los fines de un Estado social de Derecho.

Por ende, el reconocimiento de la posesión o tenencia de hecho que se expresa en el por tanto de la sentencia impugnada, a favor de la actora y sin perjuicio de los derechos del Estado, es una solución idónea y conforme a lo que el ordenamiento jurídico costarricense posibilita para evitar situaciones de violencia y abuso en esa zona, siempre que el Estado no ejerza sus facultades de recuperación de los terrenos en los cuales existe una posesión informal. Esto en el entendido que esa tenencia se haya realizado en forma pacífica y pública y sin detrimento los recursos naturales. Así como, que la actuación de la parte demandada, contra la cual se reclama realizó un despojo, no ostente un “mejor derecho o situación legal” frente a la parte actora, como lo sería por ejemplo contar con un derecho real administrativo a su favor. En otras palabras, lo que pretende la Procuraduría con la posesión planteada en la apelación, es que se mantenga en la posesión del terreno a una persona privada que sin causa legítima despojo a otra de una tenencia que venía ejerciendo de forma pacífica y pública, por más de diez años, según se tuvo por probado, aparte de que con ello la primera estaría disfrutando indebidamente y sin causa de lo que la otra ha realizado en el terreno (cultivos, construcciones, etc.), dado que ingresó gracias a un acuerdo con el ex-esposo de la actora, con quien está tuvo situaciones de violencia doméstica.

Negar a la actora reclamar la restitución de la tenencia o posesión de hecho y dado que el Estado tampoco demostró haber realizado ninguna acción legal para recuperar la posesión de ese terreno de manera que no quede en manos de personas privadas (nótese tampoco interpuso en este proceso la acción de intervención principal excluyente), tendría como resultado que se mantuvieran la tenencia del bien en manos del demandado, quien tampoco ostenta un derecho real administrativo ni está en mejor situación legal que la demandante. Por otro lado, como lo indica la citada norma 263 del Código Civil, debe darse una solución a los conflictos entre particulares relacionados con la preferencia en el uso de los bienes demaniales. Esa norma resulta aplicable a casos como el presente, aunque esté de por medio una posesión informal de la parte actora, no necesariamente ilegal, dado el contexto histórico de la tenencia y gobernanza de la tierra en la FFN.

Por ello, resulta improcedente lo expuesto en el agravio primero de la PGR, referido a que la sentencia impugnada infringe los principios del debido proceso, igualdad procesal, congruencia y cumplimiento de los elementos esenciales del fallo. La juzgadora de instancia en el considerando sexto explica es un bien demanial y el motivo por el cual el reclamo de mejor derecho de posesión de la actora, debe ser analizado en función de las características de ese tipo de bien. Por ello el por tanto no concede un derecho de posesión a la actora, sino que tutela simplemente la posesión de hecho o mera tenencia que ella ha ejercido por más de diez años, en forma pública y pacífica. Ello es posible de reconocer en un proceso ordinario como el presente, pues la posesión de hecho es tutelada por el ordenamiento jurídico, aún en situaciones de mala fe. Si bien la vía de preferencia para ello es la sumaria interdictal, no existe impedimento legal para que un ordinario no se le otorgue tutela a la tenencia que se ejerce sobre un bien demanial, bajo la normativa que permite recuperar la posesión de hecho que se ejerce sobre un inmueble cuando ha ocurrido un despojo ilegítimo realizado por otra persona privada (artículos 282, 305, 307, 309, 313, 317, 325 del Código Civil).

Al respecto, vale resaltar lo dispuestos por los numeral 305 y 313, 317, 318, 319 citados: “305- El propietario y el poseedor, de cualquiera clase que sean, pueden defender su propiedad o posesión repeliendo la fuerza con la fuerza o recurriendo a la autoridad competente”.-“313.- La protección de la autoridad al poseedor que se viere inquietado o molestado en su posesión, no afecta en nada a las cuestiones sobre propiedad o sobre mejor derecho de poseer”. “317.- El poseedor, de cualquiera clase que sea, tiene también derecho para reclamar la posesión de que ha sido indebidamente privado, y una vez repuesto en ella se considera, para los objetos de prescribir, como si no hubiera sido desposeído. No podrá tomarse la posesión de una manera violenta, ni por aquel a quien legalmente corresponde; mientras el actual poseedor se oponga, debe reclamarse judicialmente”. “318.- Para ser restituido en el goce de un derecho, basta que el poseedor pruebe el hecho de la posesión y de haber sido privado de ella ilegalmente” (lo subrayado no es de los originales).

Esas normas permiten la defensa de la posesión de hecho o mera tenencia y son de aplicación a situaciones como la planteada y demostrada por la parte actora, que no tiene conflicto con el Estado sino con otra persona privada, que quiere despojarla de la tenencia que ella ha ejercido por más de diez años sobre el bien en litigio. Nótese la parte demandante, aunque utiliza la frase “única y legítima poseedora con derechos” en su primera pretensión, en el mismo escrito de demanda (hecho uno y petitoria cinco) reconoce que el terreno está dentro del [Dirección11]“[Dirección12] ”. Por ende, resulta evidente, del análisis integral de la demanda, que en ningún momento la actora pretendió ningún derecho frente al Estado, sino sólo defenderse de una situación injusta y abusiva frente a otra persona privada que la despojo de la tenencia que ha ejercido por más de 10 años sobre el área en disputa. La jueza de instancia a la vez tutela los derechos del Estado sobre ese sector como bien demanial, al resolver “sin detrimento los derechos del Estado”.

De esa manera no se resuelve con autoridad de cosa juzgada en relación ni en perjuicio del Estado y además se brinda una solución legalmente pertinente a un conflicto entre personas privadas en relación con el uso de ese bien demanial, conforme se explicó en los considerandos anteriores. El argumento de que ninguna de las partes tenía autorización del SINAC para ocupar válidamente un terreno dentro del citado refugio nacional y por ende no ostentan derechos reales administrativos ni posesión válida a título de dueños, es cierto y así fue debidamente explicado en la sentencia impugnada. Pero ello no significa que en función de esa situación deba acogerse la excepción de falta derecho y denegarse la demanda. De acuerdo con lo ampliamente explicado tanto la sentencia impugnada, como en los considerandos anteriores, lo que se resuelve tiene que ver con la tenencia o posesión actual o momentánea del inmueble en litigio en relación con personas privadas.

Ese bien siendo utilizado u ocupado actualmente por una de ellas, aunque sea un bien demanial, sin que el Estado haya procurado, como propietario, recuperar el atributo de posesión sobre ese sector o al menos eso no quedó demostrado en el proceso. Esa situación merece y debe ser tutelada para evitar mayor ingobernanza en la FFN y combatir situaciones de violencia o abuso entre personas privadas. Tampoco es cierto que en el fallo recurrido se haya desatendido ni obviado referirse a lo argumentado por la PGR sobre el carácter demanial de esa zona ni que se haya resuelto como si tal no fuese parte. En los considerandos V (que no se numeró), VI y VII se analiza ese tema y por ello, sin incurrir en infra petita, dado lo que en forma integral se deriva de la propia demanda, la jueza de instancia explica que no puede reconocer a la accionante como legítima poseedora del bien en litigio en los términos solicitados por ella, pero con el fin de solucionar el conflicto, sin detrimento los derechos del Estado, acoge la demanda para que recupere la tenencia del bien del cual fue despojada indebidamente, pero sin otorgarle ningún derecho real.

En cuanto a lo argumentado en el segundo agravio respecto de la existencia de un humedal en el bien en litigio, tampoco es motivo para variar lo resuelto. Ello fue reconocido en los hechos probados de la sentencia impugnada y lo resuelto no implica que se le esté otorgando algún derecho real a la actora sobre esa zona ni tampoco se perjudique el equilibrio de ese ecosistema. No se demostró tampoco que con lo realizado por la accionante en los más de 10 años de tenencia, se haya afectado dicho humedal ni lo dispuesto en el numeral 32 de la Ley Orgánica del Ambiente. Conforme lo explicado, el recurso de la PGR no es de recibo. Sin embargo, en función de sus argumentos, es pertinente aclarar que la tutela concedida a la actora es solo por la mera tenencia o posesión de hecho. Por consiguiente, conforme lo permite el numeral 592 del Código de Trabajo, se aclarará la parte dispositiva de la sentencia impugnada, para que se lea en los puntos 1 y 3 “posesión de hecho”.

XI. RECURSO DEL CODEMANDADO [Nombre2] QUIROZ

Expone los siguientes agravios, que se resumen para facilitar su análisis, pero se resalta que en algunas frases las ideas son incompletas o incomprensibles: A) Reclama en la sentencia impugnada no se ponderó las pruebas debidamente. Indica no es clara y objetiva al analizar la prueba y restarle crédito a sus testigos, que son los únicos objetivos y no parientes. Considera se usó en su contra la confesional del codemandado [Nombre3] y para determinar que sus intereses siempre fueron el cuidado de la parcela de su esposa. Dice no se analiza la venta y el pago que el efectuó, por el cual poseyó el terreno hasta hace unos meses que se cursaron demandas penales. Afirma tanto la actora como sus testigos invadieron el inmueble, “permaneciendo en el (sic) contrario al estatus que tenía la finca” y sus bienes fueron destruidos y sustraídos, en contra del ordenado por la autoridad judicial y tomando por la fuerza el bien.

Sostiene le niegan sus derechos, pese a que acudió a la ley y gano interdictos, así como demostró la compra y posesión. B) Acepta que si bien el Achiotal está dentro de bienes demaniales, dice que también es cierto que son terrenos que el SINAC trasladará al INDER. Asegura que como poseedor, en listados que no ha logrado se certifiquen, es quien figura en la lista final. Comprobada la posesión momentánea actual, en los procesos anteriores, “aportados como prueba y el suyo miso (sic) cuando se va con la prueba”. Ofrece tres hojas de un informe que dice son del expediente del IDA, donde se indica que el poseedor era [Nombre3] , quien le vendió, no su esposa la que es actora. Pero ahora, se ponen de acuerdo en su perjuicio, con lo cual reciben con la sentencia el terreno y el dinero, lo cual es impropio y mal resuelto. Aclara tuvo conocimiento de sus documentos en forma reciente, por los procesos penales que se cursa por usurpación contra la actora y los testigos que se apoderaron del bien.

  • C)Indica consta que la actora y el otro demandado estaban separados, en las copias de violencia doméstica. Por ello califica de osada y sin fundamento la afirmación de la A quo de que se cuidaba en nombre de la actora. Además, quien estaba registrado ante el IDA, era el otro demandado, quien le vendió. El que se divorciaran desde el 2014 no es un elemento que deba influir en ese proceso. Nunca se tuvo como bien ganancial. Asegura es así como se manifiesta, la intención de sustraer su dominio y perjudicarle; ello no puede ser de recibo. Si el otro demandado era registrado como beneficiario poseedor y fue quien le vendió, su vida no puede ser opuesta ante mi posesión pública y notoria y declarada en otros procesos, efectiva en el lugar. Indica, que la actora puede haber sembrado, cultivado y otros (sic), cuando vivió antes del 2007 con su esposo, pero ella no le da la posesión. Comprobado que era [Nombre3] quien poseía, por el registro del IDA, el documento de venta y los testigos, y el precio pagado, y la posesión momentánea actual desde la venta en el 2013, es suficiente para que se declare a su favor (sic), como debe ser.
  • D)Reitera, si una venta que le permitió poseer el inmueble, hecha por el titular registrado en el IDA, ninguna probanza, por presunción puede dar crédito a lo contrario. Los argumentos que esboza la señora jueza deben ser aplicados a él y no a la actora. De modo alguno puede asegurarse que posee por mera tolerancia, lo cual no es cierto. Reclama ahí la juzgadora no aplicó “criterio de lógica y sentido común”. E) Refuta no tiene sentido tener como hecho probado el punto noveno y el décimo, pues al final lo que prevalece es el poseedor era él y no la actora. F) Señala que todo el pueblo de Achiotal está en la misma circunstancia, dentro de la zona de influencia del Área de conservación arenal Huerta Norte, pero hay dentro de ella una decisión levantada (sic) por el SINAC-INDER con los poseedores. Pide solicitar ello (sic), porque aparece actualmente en la lista y así debe declararse su posesión y debieron indicarlo los representantes del Estado.

Aclara no pide que se obvie la demanialidad, sino que se declare la posesión de ese bien demanial, porque existe una regulación especial del uso de la zona y él ha estado incluido en ello en virtud del traslado del poseedor, que no era la actora. Afirma ello es un ardid para defraudar sus derechos. G) Pide se considere para efectos de la perturbación que la actora invadió la finca hace un par de meses y permanece en ella, por lo que se interpusieron demandas penales. Solicita se revoque la sentencia y reitera ofrece para mejor resolver las tres hojas aportadas (carpeta de escritos: archivo 20/11/2017 02:20:11).

XII.Dado que varios agravios del apelante [Nombre2] objetan la forma como se apreció la prueba por la jueza de instancia, debe tenerse presente que el numeral 54 de la Ley de la Jurisdicción Agraria establece el sistema de la libre valoración probatoria. Ello exige al tribunal estudiar y seleccionar las fuentes de prueba obtenidas, a fin de establecer su eficacia para resolver el conflicto sometido a su conocimiento, a través de la percepción, la representación o reconstrucción y el razonamiento deductivo o inductivo. El tribunal debe expresar los principios de equidad o de derecho sobre los cuales basa su criterio. "El sistema de la libre valoración de la prueba supera el clásico sistema de la prueba legal así como el de la sana crítica, que rigen en el proceso civil. La forma como ha sido concebido el proceso agrario le permite al juez valorar ampliamente los hechos alegados por las partes.

Dicho sistema no es arbitrario, por el contrario en la libre valoración de la prueba la misma deber ser razonada, crítica, basarse en la lógica, la experiencia y la sicología. En la motivación del fallo el juez debe exponer los motivos de convicción que lo llevan a resolver en los términos que lo hace. A diferencia del sistema de tarifa legal, en el cual las pruebas se aprecian con sujeción a reglas legales previas, e incluso la admisibilidad de pruebas debe estar previamente señalado por el Ordenamiento Jurídico, en el sistema de libre apreciación el juez tiene libertad para admitir pruebas conforme a su criterio” (votos 398 de 6 de junio del 2001 de la Sala Primera. En igual sentido votos 206 de 26 de marzo de 1999, 46 del 26 de abril de 1995; 66 del 6 de febrero de 2009 y 364 de 28 de mayo del 2009 del Tribunal Agrario y 3657 del 7 de mayo de 2003 de la Sala Constitucional).

XIII.El agravio A no es de recibo. Reclama el apelante no se ponderó las pruebas debidamente y se le restó crédito a sus testigos, que son los únicos objetivos y no parientes. Pero, contrario su dicho, en la sentencia impugnada se explica en forma precisa y objetiva, lo cual comparte este Tribunal, en los considerandos tercero y cuarto, las razones por las cuales se apreció como creíble y útil las declaraciones de [Nombre6] , [Nombre7] y [Nombre8] , que no contienen aseveraciones exageradas ni imprecisiones ni son contradictorias entre sí ni con el resto del material probatorio; ello no sucedió así con la de [Nombre9] . Este testigo, confirma lo de la venta del terreno que hizo [Nombre3] a [Nombre2] y relata hechos sobre lo sucedido luego de que ingresó el señor [Nombre2]. En lo que no es creíble su relato es en negar que antes de tal lo haya tenido la actora y en negar que se hicieran labores de agricultura.

Su relato se evidencia complaciente a favorecer al señor [Nombre2], pues trata de resaltar lo que tal hizo o mejoró pero niega hechos en relación con lo sucedido antes de que tal estuviese en el terreno. [Nombre10] por su parte, no conocía a la actora y es hija del señor [Nombre2] y aunque al final acepta tiene interés en el terreno porque su papá se lo ofreció para vivir, su relato aporta pocos datos de utilidad para resolver el conflicto, dado que se refiere básicamente al negocio de la venta del terreno en litigio, que hizo el señor [Nombre3] a [Nombre2], los problemas entre ellos por eso y lo que han hecho luego de que su papá ingresó al terreno. Las personas testigas ofrecidas por la demandante confirmaron en forma creíble cómo ella ingresó al terreno; quién y como se ejercía la tenencia sobre tal, especialmente luego de los problemas conyugales con su ex-esposo; y narran lo que conocen a partir de que se presentaron los problemas por el inmueble con el otro codemandado.

En cuanto a que algunas de ellas fuesen familiares de la actora, esa situación por sí sola, no les resta credibilidad, dado que en el contexto y condiciones en que se desarrollan las relaciones humanas actualmente, por lo general, son los parientes y amistades cercanas de las partes quienes conocen o pueden llegar a conocer con mayor detalle los actos y situaciones en que tales participan (ver al respecto votos de la Sala Segunda 2001 de 2 de febrero de 2001, 182 de 14 de junio de 1996, 49 de 9 de febrero de 1996, y 177 de 30 de junio de 1999). La relación de parentesco o amistad cercana lo que implica es que debe hacerse un análisis cauteloso de tales declaraciones, lo cual consta se hizo en la sentencia impugnada, conforme las explicaciones brindadas en los considerandos citados. En cuanto a la confesional y declaración de parte del codemandado [Nombre3] , el apelante reclama se usó en su contra para determinar que sus intereses siempre fueron el cuidado de la parcela de su esposa, sin analizarse la venta y el pago que el efectuó, por el cual poseyó el terreno por unos meses, antes de que la actora y sus testigos “invadieran” el inmueble.

Dicho elemento probatorio se cita como fuente en los hechos probados sexto, séptimo y octavo, pero no como único elemento. En su declaración, en lo que interesa resaltar, el codemandado [Nombre3] refiere que el terreno en litigio lo adquirió la actora; aclara a ello se lo entregó un comité pero que estaban casados cuando eso sucedió. Aceptó él sembraba y cuidaba con ella cuando eran pareja y que lo vendió sin su consentimiento, cuando estaba desesperado y tuvieron problemas, porque [Nombre1] lo sacó (sic) de donde vivía y también lo quería sacar del terreno en litigio y eso lo dejó a él en una crisis. Y el otro codemandado le insistía mucho en que se lo vendiera, pese a que le explicó que con quien tenía que hablar era con la actora y que era un terreno fronterizo, pero él aceptó hacerse cargo del problema aunque el terreno no fuese de él. Aclara solo vendió las mejoras porque sabía que estaba dentro de la franja fronteriza.

Refiere que tuvo problemas también con el codemandado porque no le pagó todo lo convenido y por eso le dijo que no le entregaba la parcela hasta que le parcela, pero luego le hizo daños por medio de otras personas y por temor él se fue a otro lugar (carpeta de audio en documentos asociados: archivo14/12/2016 08:17:29). La valoración de esa prueba como fundamento de los hechos probados referidos, es correcta, dado su contenido, pues como se indica en el hecho quinto, el señor [Nombre3] y la actora, hicieron trabajos en el terreno en conjunto, mientras fueron pareja, pero luego de los problemas conyugales, el codemandado citado se mantuvo en el terreno por tolerancia de ella, no en forma exclusiva. Además, tal y como se explicó en la sentencia apelada, la venta a que hace referencia el recurrente es absolutamente nula y por ende no puede surtir efectos legales respecto de terceras personas (artículos 627, 631 del Código Civil).

Si el recurrente entregó algún dinero al señor [Nombre3] , en función de ese acto, puede a través de la vía pertinente reclamarlo la devolución de la suma. Lo que no es admisible es su posición de darle valor a ese acto para justificar el desalojo que afectó la tenencia que ejercía la actora sobre el inmueble. Por la forma como se resolvió, con sustento la prueba analizada, tampoco se le ha negado derecho alguno al apelante, que en todo caso se aclara no tendría tampoco derecho real sobre el terreno por ser un bien demanial, aunque lo haya comprado, a través de una venta nula, al señor [Nombre3] . Finalmente el que hubiese “ganado” (sic) un proceso interdictal, no sólo no le confiere derecho alguno por la naturaleza de ese sumario en el cual no se discute ni otorgan derechos de ningún tipo, según lo establecido en el numeral 457 del Código Procesal Civil, aplicado supletoriamente. Pero además no es cierto que se haya declarado a su favor el proceso interdictal en el cual participó frente a la actora pues tal fue denegado por caducidad, según se dispuso en el voto 245-F-2016 de este Tribunal.

XIII.Tampoco es procedente lo argumentado en forma confusa el agravio B) sobre que si bien el “Achiotal” está dentro de bienes demaniales, que asegura son terrenos que el SINAC trasladó al INDER y que por estar él enlistado en un informe que no ha logrado se certifiquen, es quien figura como poseedor. En el sexto considerando de esta sentencia se explica la naturaleza demanial de la zona donde se ubica el terreno objeto de litigio y a quién corresponde su administración. En cuanto a que el apelante aparezca en un listado, que no explica con qué fin se hizo y por quién, ello no es prueba de tenencia alguna, ni mucho menos le confiere algún derecho en relación con el terreno en litigio. Con respecto a qué probó la posesión momentánea actual, en los procesos anteriores, sin especificar cuáles, por lo que se concluye se trata del interdicto 13-000307-298AG, tampoco es cierto. En primera instancia, en los hechos probados de la sentencia interdictal de 28 de marzo 2014, se consideró poseedora actual o momentánea a la actora.

El voto 245-F-2016, de este Tribunal, revocó esa sentencia pero por razones de forma, al declararla caduca. Tampoco es de recibo el argumento de que el señor [Nombre3] y la actora estén de acuerdo para perjudicarlo pues se quedan con el terreno y el dinero, lo cual es impropio y está mal resuelto. Como se le explicó, la sentencia de instancia declara la venta en la que participó absolutamente nula, por ende no puede pretender obtener beneficios de ningún tipo a través de ella. Y con respecto al dinero que alega entregó, puede acudir a la vía pertinente a reclamar su devolución a la persona que lo recibió. No es creíble tampoco su argumento de que la actora y el otro codemandado tenga un complot en su contra, dado que no existe prueba alguna que confirme esa aseveración. Por el contrario, lo que existen son elementos que demuestran que el matrimonio terminó en divorcio e incluso hubo denuncias por violencia doméstica, que reflejan una relación difícil entre las partes. La prueba ofrecida para mejor resolver no fue admitida.

XIV.Lo alegado en el argumento C) resulta improcedente. Lo tenido por probado con respecto a que el señor [Nombre3] se mantenía en el terreno a nombre de la actora luego de la separación, no es osado ni infundado, pues nunca la tenencia que ejerció en ese terreno fue en forma exclusiva, ni durante la relación de pareja ni luego de eso. Esa conclusión se deriva de lo que se desprende de la prueba testimonial, confesional y documental analizar en forma integral y con criterios de lógica y razonabilidad. Lo expuesto en el hecho probado sexto de la sentencia impugnada, con respecto a que antes de divorciarse ese señor realizaba los trabajos en forma conjunta con la actora y luego continuó habitando el inmueble con anuencia o tolerancia de ella, pues así fue acordado al divorciarse, pero no en forma exclusiva, fue confirmado por los testigos [Nombre1] y [Nombre6]. Tómese en cuenta además que el codemandado [Nombre3] y la actora tuvieron conflictos que generaron denuncias por violencia doméstica y por eso ella explica en sus gestiones que fue a vivir a otro lugar.

Los testigos [Nombre8] y [Nombre7] explicaron además, en relación con el terreno en litigio, que ellos acordaron luego del divorcio que el señor [Nombre3] permaneciese en tal por tolerancia de la actora, no con exclusividad, lo cual se puede explicar porque tenían una hija en común, que tenía cinco años de edad en el 2005 según se narra en la sentencia de 16 de mayo de 2005, emitida en el expediente 05-110052-323VD del Juzgado Contravencional de Los Chiles, lo que se confirma en la sentencia de divorcio 354 de 27 de mayo de 2014 emitida por el Juzgado de Familia de San Carlos. Otro dato que confirma el dicho de la actora y que el apelante acepta, es que dicho señor, cuando se quedaba en el terreno, no lo hacía en una casa de habitación, sino en una bodega inhabitable, que solo tenía bien el techo de zinc (hecho segundo de la contestación). Con respecto a su referencia de no ser el terreno objeto de litigio un bien ganancial, ello es cierto, pero no es un dato que haya sido utilizado en la sentencia impugnada para resolver el conflicto, incluso en la sentencia de divorcio expresamente no lo califican de esa manera y aclaran tan solo que ellos ejercen tenencia en esa zona.

No se entiende tampoco su afirmación de que con base en este alegato se manifiesta “la intención de sustraer su dominio y perjudicarle” y que la vida del señor [Nombre3] no le puede ser opuesta a su posesión pública y notoria, si tal era quien aparecía registrado como poseedor. Su argumento de que los cultivos realizados por la actora antes del 2007, cuando vivió con su ex esposo, no le otorgan la tenencia del bien -pues era [Nombre3] quien poseía, por el registro del IDA, el documento de venta, los testigos, el precio pagado, y la posesión momentánea actual desde la venta en el 2013, lo cual considera suficiente para que se declare a su favor la demanda-, es una conclusión errada e infundada, conforme a la prueba y lo analizado. Se resalta al respecto que en la citada sentencia 354-2014 emitida por el Juzgado de Familia de San Carlos en el expediente de divorcio 13-000706-924FA (punto 5 del por tanto), la actora y el señor [Nombre3] hicieron referencia al terreno objeto en litigio y a la situación en que se encontraba dada la existencia del interdicto 13-000308-298 AG y aceptaron que en caso de que la demanda fuese acogida, la posesión de la parcela le quedaría a los dos por partes iguales.

Con ello el señor [Nombre3] reconoció que la tenencia de ese terreno no era suya exclusivamente, lo que demuestra que lo reclamado por la actora tenía fundamento en la forma como ambos había poseído de hecho el bien antes de esos procesos y desvirtúa la posición del demandado apelante de ser el señor [Nombre3] el único poseedor de ese sector.

XV.En el reclamo identificado como [Nombre11], reitera se le debe dar valor a la venta que le permitió poseer el inmueble, pues la hizo el titular registrado en el IDA. Aparte que ello no fue demostrado, ya se explicó que se trata de una venta nula que no surte efectos legales. Con respecto a que lo concluido por la jueza de instancia debe serle aplicable a él y no la actora, no lleva razón el apelante pues lo reclamado por ella se probó; por el contrario, se demostró fehacientemente, no con indicios. En cuanto a que no tiene sentido incluir los hechos probados noveno y décimo de la sentencia impugnada pues al final lo que prevalece es que el poseedor era él y no la actora (agravio E), es una apreciación respetable pero no correcta. Tales hechos se refieren al resultado de las sentencias dictadas en el proceso interdictal 13-000307-298AG, datos que son importantes conocer como precedentes de este proceso.

XVI.En su penúltimo agravio (F) señala que todo el pueblo de Achiotal está en la misma circunstancia, dentro de la zona de influencia del Área de Conservación Arenal Huerta Norte, pero hay dentro de ella una decisión levantada (sic) por el SINAC-INDER con los poseedores, lo cual pide se solicite porque aparece actualmente en la lista y ello permite declarar su posesión, lo cual debieron indicar los representantes del Estado. Aclara no pide se obvie la demanialidad, sino que se declare a su favor la posesión de ese bien demanial, porque existe una regulación especial del uso de la zona y él ha estado incluido en ello en virtud del traslado del poseedor, que no era la actora, siendo todo un ardid para defraudar sus derechos. Su argumentación es infundada y además no fue demostrada. El que todo un pueblo esté en la misma situación no implica que por ello pueda recibir el beneficio que solicita. El que eventualmente apareciera un listado, del cual no se tiene claro cuál es su origen y fines, ni tampoco cuando se realizó, ya se explicó no le confiere ningún tipo de derecho y no es prueba útil para demostrar tenencia o posesión de hecho sobre un bien demanial.

XVII.Finalmente pide se considere, para efectos de la perturbación, que la actora invadió la finca hace un par de meses y permanece en ella, por lo que se interpusieron demandas penales (agravio G). Aunque esos hechos efectivamente hayan sucedido, no cambia lo resuelto pues se trataría de sucesos que no pueden variar la causa ni objeto de este litigio y además esa situación no enervaría que el demandado apelante despojo a la actora de la tenencia que ella ejercía, con fundamento en una causa que no tenía validez, como lo es la venta nula de un bien demanial. Por ende ninguno de los argumentos del demandado [Nombre2] resultan de recibo para variar lo resuelto.

XVIII. De conformidad con lo expuesto, en lo apelado, procede confirmar la sentencia recurrida

POR TANTO

En lo apelado, se confirma la sentencia recurrida. Se aclara que en los puntos uno y tres del por tanto se trata de “posesión de hecho o mera tenencia”.
