APPEAL AGAINST THE JUDGMENT filed in the present proceedings against HELIODORO PÉREZ BRENES, of legal age, Costa Rican, identity card 6-300-989; RONALD PÉREZ BRENES, of legal age, Costa Rican, identity card 2-599-673; and HELIODORO PÉREZ MADRIGAL, of legal age, Costa Rican, identity card 6-100-901, for the offense of FORESTRY VIOLATION to the detriment of NATURAL RESOURCES. Judges Adriana Escalante Moncada, Yadira Godínez Segura, and Annia Enríquez Chavarría participate in deciding the appeal. Attorney Álvaro Pérez Roda, public defender for the accused Heliodoro Pérez Brenes; Attorney Carlos Lizano Rodríguez, State Attorney; and Attorney Elizabeth Ugalde Cortes, representative of the Ministerio Público, appear in the appeal against the judgment.
BACKGROUND:
I.By judgment number 644-2017, issued at sixteen hours forty-five minutes on thirty-one August two thousand seventeen, the Tribunal de Juicio de San Carlos ruled: "THEREFORE: In accordance with the foregoing; Articles 39 and 41 of the Constitución Política; Article 11 of the Declaración Universal de los Derechos Humanos; Article 8, subsection 2, of the Convención Americana de Derechos Humanos; Articles 1, 11, and 18 of the Código Penal; Articles 1, 7, 9, 360 through 365, 366, and 367 of the Código Procesal Penal; and Articles 33 and 58 of Ley Forestal, this Court, on the basis of the universal principle IN DUBIO PRO REO, acquits RONALD RIGAN PEREZ BRENES AND HELIODORO PEREZ MADRIGAL of all punishment and liability for committing the offense of VIOLATION OF LEY FORESTAL that has been alleged against them to the detriment of NATURAL RESOURCES.- Both the private criminal complaint (querella) and the civil action for damages (acción civil resarcitoria) brought by the Procuraduría General de la República against the accused are denied, with no special award of costs in either action.
Furthermore, HELIODORO PEREZ BRENES is found criminally responsible as the perpetrator of the offense of VIOLATION OF LEY FORESTAL that has been alleged against him, committed to the detriment of NATURAL RESOURCES, and in that capacity he is sentenced to THREE MONTHS' IMPRISONMENT. As it is deemed appropriate, he is granted the BENEFIT OF A SUSPENDED SENTENCE for a probationary period of three years, with the understanding that during that period he must not be convicted of a new intentional offense carrying a prison sentence of more than six months; should that occur, the benefit granted herein shall be revoked, and he shall serve the imposed sentence in prison. The civil action brought by the PROCURADURIA GENERAL DE LA REPUBLICA, representing the interests of the State, against civil defendant HELIODORO PEREZ BRENES is granted, and he is ordered to pay ONE MILLION ONE HUNDRED ONE THOUSAND EIGHT HUNDRED NINETY-ONE COLONES NET for environmental damage, which he must deposit into the State's single account, with no special award of costs in the civil matter.
The criminal matter is resolved without a special award of costs, and the costs of the proceedings shall be borne by the State. Pursuant to Article 110 of the Código penal, the Sthil-brand chainsaw, serial number 364258977, is ordered definitively forfeited to the State. The full reading of the judgment is scheduled for sixteen hours on Thursday, seven September two thousand seventeen" (sic).
II.Attorney Álvaro Pérez Roda, public defender for the accused Heliodoro Pérez Brenes, filed an appeal against the foregoing judgment.0168834137171609
III.After the corresponding deliberation was conducted, in accordance with Article 465 of the Código Procesal Penal, the Tribunal de Apelación de Sentencia del III Circuito Judicial de Alajuela, San Ramón, proceeded to hear the appeal.
Appellate Judge Escalante Moncada drafts the decision; and,
CONSIDERING:
I.Attorney Álvaro Pérez Roda, public defender for the accused Heliodoro Pérez Brenes, filed an appeal against judgment number 644-2017, issued by the Tribunal de Juicio del Segundo Circuito Judicial de Alajuela, San Carlos seat, at 16:45 on 31 August 2017.
II.In the first ground of the appeal, the appellant alleges a violation of the rules of reasoned judgment (reglas de la sana crítica), a lack of legal reasoning (fundamentación jurídica), and a breach of the principle of correlation between the charges and the judgment (principio de correlación entre acusación y sentencia). He contends that the Trial Court of San Carlos erroneously analyzed the criminal offense (tipo penal) contemplated in Article 58(b) of the Ley Forestal. He further challenges the fact that the decision was based on a factual finding that violates the rules of reasoned judgment and the principle of congruence (principio de congruencia). He maintains that, according to the charges brought by the Ministerio Público and the Procuraduría General de la República, in its capacity as private prosecutor (querellante) and civil claimant (actor civil), his client and the other three defendants were accused of having cut down and sawn a manú tree within the protection zone (zona de protección) of the Río Samen.
He states that those factual allegations did not accuse Pérez Brenes of having harvested the tree in question. He explains that the concept of harvesting (aprovechamiento) is described in Article 3(a) of the Ley Forestal, which provides that timber harvesting (aprovechamiento maderable) means the cutting or removal of standing timber trees or the use of fallen trees, carried out on private land not included in Article 1 of that law, which generates or may generate some profit, benefit, advantage, utility, or gain for the person performing it or for the person whom that individual represents. He asserts that the trial did not establish that his client had cut the tree from its original location. He explains that the Fuerza Pública officer who testified in the adversarial proceedings stated that he saw the defendant sawing a section of the tree after it had already been cut down. He adds that the accused testified during the plenary phase (fase plenaria) and explained that he went to the site to help co-defendant Tobías Monestel—who was acquitted of these same acts, as were the other co-defendants—remove the wood in question, a matter which, he argues, was not analyzed in the judgment and was omitted from the summary of evidence.
He challenges the fact that, in the judgment, the trial judge modified the factual basis of the charges (plataforma acusada) and found it proven that the defendant harvested the forest product, and that she made this change to cure the defect contained in the charging instruments (requisitorias), an action that he contends infringed the right to a defense and due process. He adds that the charging allegation did not describe the potential profit, benefit, advantage, or utility that the bucking of the timber would have provided to the accused or any third party. Nor did it describe, with respect to criminal intent (dolo), whether the defendant sought any type of benefit through his conduct. He maintains that the trial judge stated that the defendant’s intent was to obtain the monetary benefit that he might derive from the felled timber, but that circumstance was not mentioned by the witnesses who testified during the plenary phase.
He challenges the imposition of a three-month prison sentence on his client even though the alleged conduct was not found proven. He requests that the defendant be acquitted of all punishment and liability. The claim is granted. Having examined the ruling, these appellate judges find that it contains insufficient and erroneous reasoning. To properly resolve the objections raised, it is necessary to transcribe the charges brought by the Ministerio Público and the Procuraduría General de la República. The prosecuting authority charged as follows: “1. On June 17, 2013, on a property located in San Miguel de Katira de Guatuso, owned by a person identified as Fernando Barrantes, the accused Heliodoro Pérez Brenes, Ronald Rigan Pérez Brenes, Tobías Monestel Jiménez, and Heliodoro Pérez Madrigal, without any permit from the Administración Forestal del Estado and knowing that such activity was not authorized, felled and processed a Manú tree located in the protection zone of the Río Samen (one meter from the stream’s flow). 2.
In order to carry out the felling and processing described in the preceding allegation, the accused Heliodoro Pérez Brenes, Ronald Rigan Pérez Brenes, and Heliodoro Pérez Madrigal adopted a clear division of roles; defendant Heliodoro Pérez Brenes used a Sthil-brand chainsaw, serial number 364258977, with which he cut down and sawed the tree in the manner and dimensions already described; meanwhile, the accused Ronald Rigan Pérez Brenes and Tobías Monestel Jiménez helped Heliodoro Pérez Brenes cut down and saw the tree by holding and positioning the logs that the latter was producing, and they also used chains to secure one of the finished logs so that it could be dragged and removed from the felling site using a wheeled tractor bearing license plates EE 13453, which at that time was driven by co-defendant Heliodoro Pérez Madrigal, who removed that log from the sawing area and took it to a place from which they later intended to remove it along with the other timber that he was processing jointly with the other defendants.
While the accused Heliodoro Pérez Brenes, Ronald Rigan Pérez Brenes, Tobías Monestel Jiménez, and Heliodoro Pérez Madrigal were carrying out the actions described in the preceding allegation, they were caught in the act by Fuerza Pública officers who had already been alerted to the commission of this criminal offense. At that moment, the accused Heliiodoro Pérez Brenes, aware that the felling he was carrying out was illegal and realizing that his conduct had been discovered, chose to turn off the chainsaw and ran off with it over his shoulder in an attempt to escape from the police; however, he too was arrested. 3. Concurrently with the preceding acts and as a direct consequence of the felling described, the accused Heliodoro Pérez Brenes, Ronald Rigar Pérez Brenes, Tobías Monestel Jiménez, and Heliodoro Pérez Madrigal caused environmental damage (daño ambiental) in the protection zone of the Río Samen, which was assessed at one million one hundred one thousand eight hundred ninety-one colones” (verbatim copy from pages 661 and 662 of the digital case file in pdf format).
For its part, the Procuraduría General de la República filed a private prosecution (querella) based on the following facts: “1. On June 17, 2013, on the property owned by Mr. Fernando Barrantes, located in San Miguel de Katira de Guatuso, the accused Heliodoro Pérez Brenes, Ronald Rigar Pérez Brenes, Tobías Monestel Jiménez, and Heliodoro Pérez Madrigal, without any permit from the Administración Forestal del Estado and knowing that their conduct was unlawful, felled and processed a Manú tree located in the protection zone of the Río Samen, specifically one meter from the flow of that river. 2. In order to carry out the felling and processing described in the preceding allegation, the accused Heliodoro Pérez Brenes, Ronald Rigar Pérez Brenes, Tobías Monestel Jiménez, and Heliodoro Pérez Madrigal adopted a clear division of roles; thus, the privately prosecuted defendant Pérez Brenes was responsible for cutting down and sawing the aforementioned Manú tree, using for that purpose a Sthil-brand chainsaw, serial number 364258977, while the accused Ronald Rigan Pérez Brenes and Tobías Monestel Jiménez were responsible for holding and positioning the logs produced by the saw operator and for securing the finished logs with chains so that they could be dragged and removed from the site by co-defendant Heliodoro Pérez Madrigal, who drove the wheeled tractor bearing license plates EE-13453, which they used to remove the logs from the sawing area. 3.
While the persons privately prosecuted herein were carrying out the actions described in the preceding allegations, they were caught in the act by Fuerza Pública officers who had been alerted to the commission of this criminal offense; at that moment, upon realizing that the police were present, the accused Heliodoro Pérez Brenes turned off the chainsaw and attempted to escape with it over his shoulder; however, he too was arrested.” (verbatim copy from pages 662 and 663 of the digital case file in pdf format). As may be seen from this criminal proceeding, four persons stood trial, including the accused Heliodoro Pérez Brenes, and they were charged with jointly carrying out, pursuant to a defined division of roles, the act of felling a tree located in a river protection area and sawing it into several sections. In the challenged judgment, the defendants Ronald Pérez Brenes and Heliodoro Pérez Madrigal were acquitted of all punishment and liability; the fourth accused, Tobías Monestel, had been acquitted in an earlier proceeding; and defendant Heliodoro Pérez Brenes was convicted of that offense.
Returning to the analysis of the criminal conduct described in the charging instruments, according to the dictionary of the Real Academia Española, to fell means to cut a tree at its base. In other words, the alleged act consisted of the defendant cutting down a standing tree planted in the protection zone and processing it by dividing it into various sections. In the judgment, the trial judge found the following facts proven: “1. On June 17, 2013, on the property owned by Mr. Fernando Barrantes, located in San Miguel de Katira de Guatuso, defendant and civil respondent (demandado civil) Heliodoro Pérez Brenes was arrested in the commission of the offense by Fuerza Pública officers when, using a Sthil-brand chainsaw, serial number 364258977, he harvested a Manú tree located in the protection zone of the Río Samen (one meter from the stream’s flow). 2. As a direct consequence of the felling described, the person under investigation, Pérez Brenes, caused environmental damage in the protection zone of the Río Samen, which was assessed at one million one hundred one thousand eight hundred ninety-one colones.” (verbatim copy from page 665 of the digital case file in pdf format).
A comparison of these three factual accounts readily reveals that the event found proven was indeed worded differently from the event charged by the Ministerio Público and the Procuraduría General. On this point, it must be noted that the Trial Court is not required to adhere to the wording used to frame a charging allegation and therefore has the authority to describe the proven event using an account different from that proposed by the prosecuting authority. Nevertheless, any changes made by the panel of judges when describing the proven occurrence are subject to an insurmountable limit defined by the objective and subjective elements of the criminal offense constituting the central core of the criminal allegation. In other words, both the charged event and the proven fact must correspond with respect to the core of the allegation. Based on this clarification, it is concluded that, although the trial judge replaced the verbs “to fell” or “to cut”—contained in the prosecutorial charge and the private prosecution—with the act of harvesting, the fact remains that, under Article 3 of the Ley Forestal, one way in which forest resources may be harvested is by cutting down trees.
Accordingly, that portion of the proven event corresponds to the unlawful act alleged against the defendant in the charges brought against him. The relevant difference, however, is that in her evidentiary reasoning (fundamentación intelectiva), the trial judge expanded and completed the proven event by stating that the forest resource was harvested for the purpose of obtaining an economic benefit through the sale of the timber. This additional circumstance appended to the original charge is indeed relevant for the following reasons.
In this regard, Article 58 of the Law under discussion describes several unlawful forms of conduct, including the following unlawful actions, which are relevant to the resolution of this case: “A prison sentence of three months to three years shall be imposed on anyone who: a) Invades a conservation or protected area (área de conservación o protección), regardless of its management category (categoría de manejo), or other forest areas or lands subject to the forest regime (régimen forestal), regardless of the area occupied and irrespective of whether they are privately owned lands of the State or other Public Administration bodies, or privately owned lands. The perpetrators of or participants in the act shall not be entitled to any compensation for any construction or works they may have carried out on the invaded lands. b) Exploits forest resources (aproveche los recursos forestales) on lands belonging to the State’s natural heritage (patrimonio natural del Estado) and in protected areas (áreas de protección) for purposes other than those established in this law.” In the case under consideration, the defendant was not charged with invading or occupying land located in a protected area, which is the conduct described in subsection a) of Article 58, but rather with cutting down and processing a tree located in the protected area.
One of the points challenged on appeal concerns the legal classification (calificación jurídica) assigned by the a quo to the facts found to have been proven, because, in the public defender’s view, the alleged conduct does not fall within the core conduct described in subsection b) of Article 58 of the Ley Forestal, and the proven factual account differs from the one charged. On this issue, the judgment shows that one fact is undisputed: the accused entered land—without it having been established that he did so through the use of force or violence—on which there is a river; consequently, all trees growing within a radius of fifteen meters, measured horizontally from the riverbank, are situated in a protected area pursuant to Article 33 of the Ley Forestal. Likewise, as expressly provided by Article 3 of the Ley Forestal, forest-resource exploitation (aprovechamiento de recursos forestales) “consists of the act of cutting down or removing standing timber trees, or using fallen trees, on private lands not included in Article 1 of this law, where such conduct generates or may generate some profit, benefit, advantage, utility, or gain for the person carrying it out or for the person whom that individual represents.” The statutory definition of the verb “to exploit,” which in this case is supplied by the Ley Forestal itself, supports the conclusion that cutting down trees in protected areas is not only an action prohibited under Article 34 of the Ley Forestal, but also punishable conduct under the criminal offense (tipo penal) established in Article 58 subsection b) of that special legislation.
As can be seen, under the statutory description contained in subsection b) of the provision under discussion, the gravamen of the offense refers to forest exploitation (aprovechamiento forestal) on certain lands, including those declared to be protected areas, as in the case examined here. Likewise, that provision states that the act of cutting down or removing trees must seek to obtain or generate a gain, profit, or benefit for the person carrying it out. It is here that the principal error is found, both in the factual description contained in the charging instruments and in the decision rendered. When analyzing a case similar to the present one, this Chamber of Appeals of Criminal Judgments, adopting the position previously expressed by the Tribunal de Apelación de Sentencia del Segundo Circuito Judicial de San José, stated—in relevant part—as follows: “As can be seen, the gravamen of the criminal offense under Article 58 subsection b) of the Ley Forestal refers to forest exploitation, but only on certain lands: lands belonging to the State’s natural heritage and protected areas.
These aspects constitute normative elements of the offense (elementos normativos del tipo) that necessarily form part of the central gravamen of the charge and must therefore be incorporated into the charging document and the facts found to have been proven in the judgment, but never by textually repeating those normative concepts within the statement of facts as a substitute for the factual circumstances that should describe them. As occurs with other offenses, when drafting the charge, the prosecutor describes the act or conduct within a particular temporal and spatial context and, depending on the basic requirements imposed by the charged offense, adds other relevant circumstances, such as results and a description of special personal circumstances, among others. Thus, where the offense of theft is charged, it is unacceptable to use a drafting technique that merely states that a particular item was taken from someone’s possession, because what must be described is how the act occurred; subsequently, if that factual hypothesis is proven, the adjudicator may assess and determine whether the proven allegations correspond to a criminal offense.
The offense attributed to defendant A. contains normative elements, and these require reference to other provisions set forth—in this case—in the Ley Forestal, which give meaning to those expressions; in other words, they are specific criminal-law concepts. (...) The objective elements of the offense (tipo objetivo) set forth in Article 58 subsection b) of the Ley Forestal punish the act of forest exploitation, and this requires a description of the charged conduct so that it may subsequently be determined whether, if proven, it constitutes an instance of exploitation. Again, reference must necessarily be made to the Ley Forestal, Article 3 of which establishes that, for purposes of that law, exploitation means: ‘The act of cutting down or removing standing timber trees, or using fallen trees, on private lands not included in Article 1 of this law, where such conduct generates or may generate some profit, benefit, advantage, utility, or gain for the person carrying it out or for the person whom that individual represents.’ In other words, establishing the offense of exploitation requires stating not only the conduct carried out—which may take several forms—but also the potential or actual result generated, described in positive terms for the perpetrator.
In short, by operation of law, this normative element refers to two different circumstances: 1) a series of actions (cutting down or removing standing trees, or using fallen trees); and 2) a particular advantage, gain, utility, or benefit accruing to the person who carries out the action or to a third party represented by that person. That advantage is not limited, it should be noted, to a purely economic benefit and may therefore take many different forms (landscaping, making it possible to construct works at the site, using the wood for artistic purposes, etc.). From that standpoint, in the sub examine, the prosecution’s charging instrument clearly establishes only the first component of the normative element of ‘exploitation,’ namely, that at least five trees were cut down without the corresponding permit (within a protected area, by three individuals of unknown identity and background who had been hired by defendant A.).
But forest exploitation does not consist solely of describing the action—in this case, cutting down trees; it also requires specifically identifying the utility that flows or accrues to the perpetrator or the person whom the perpetrator represents. In the case at hand, the charge describes that normative element only partially, because it never stated what profit, advantage, gain, or utility that activity generated for the accused, and that is an indispensable requirement of the objective elements of the offense, namely, of Article 58 subsection b), read in conjunction with Article 3 of the Ley Forestal.” (Tribunal de Apelación de Sentencia del Tercer Ciruito Judicial de Alajuela, sede San Ramón, judgment number 388-2016). Returning to the case under examination and applying the foregoing line of reasoning, the conduct charged by the prosecution and the private complainant clearly establishes only the first component of the normative element of the offense of forest exploitation: namely, that the accused cut down a manú tree located within a river’s protected area, which he did without obtaining permits from the forestry administration (administración forestal).
Those charges, however, did not describe what profit the accused obtained or could have obtained from that prohibited action, even though all of those matters form part of the objective statutory elements (tipicidad objetiva) of the charged offense and must be made known to the accused so that he may also exercise his right to a defense with respect to them. On this point, although both charges state that the accused processed that forest resource by cutting it into pieces, the charge remained incomplete. Consequently, even though it described the act of cutting down the forest resource and the environmental damage caused, that factual account lacked the remaining elements of the offense, because it did not state what profit, advantage, gain, or utility that activity generated or could have generated for the accused; this is an indispensable requirement of the objective elements of the offense established in Article 58 subsection b), read in conjunction with Article 3 of the Ley Forestal.
The position adopted by this Chamber of Appeals of Criminal Judgments in decision number 388-2016 was endorsed by the Sala Tercera de la Corte Suprema de Justicia, which, in ruling on the appeal in cassation (recurso de casación) filed against that decision, held—in relevant part—as follows: “For its part, at the second-instance level, the Tribunal de Apelación de Sentencia acquitted the accused because it found that the charge did not encompass the circumstances set forth in subsections a.) and b.) of Article 58 of the cited legislation (f.230 reverse). B.) Regarding the concepts of ‘invasion’ and ‘exploitation’ set forth in Article 58 subsections a.) and b.) of the Ley Forestal. To determine the scope of the cited subsections of Article 58 and, on that basis, analyze whether the facts described in the charge fall within those circumstances, the content of the provision must first be set out.
The scope of the concept of exploitation contained in Article 58 subsection b) is readily defined, because the Ley Forestal itself defines the concept in Article 3 subsection a): ‘Article 3: For purposes of this law, the following shall be understood as: a) Timber exploitation (aprovechamiento maderable): The act of cutting down or removing standing timber trees, or using fallen trees, on private lands not included in Article 1 of this law, where such conduct generates or may generate some profit, benefit, advantage, utility, or gain for the person carrying it out or for the person whom that individual represents....’ Reading this provision establishes that exploiting forest resources entails the perpetrator obtaining some benefit for himself or the person he represents as a consequence of the damage caused to living or fallen trees; in practice, such benefits are generally reflected in the sale or personal use of the wood, or in the use of the land after the trees have been felled.
The concept of ‘invading’ set forth in Article 58 subsection a), however, is not defined in the Ley Forestal, and other sources must therefore be consulted. According to the Diccionario de la Real Academia Española, to invade means ‘1. To break in, to enter by force; 2. transitive verb. To occupy a place abnormally or irregularly. The waters invaded the highway; 3. transitive verb. Said of a thing: To enter and spread through a particular place or medium....’ Thus, the action punished by subsection” a) under Article 58 of the Ley Forestal, consists of occupying or intruding into a conservation or protection area, regardless of whether the land is public or private, and even includes making “improvements” to the site (for which the intruder will not be compensated), as stipulated by that same provision. In other words, intrusion entails acts of occupation of the site, which amount to settling there and exercising control over it.
Under that subsection, this offense is committed by anyone who exploits forest resources (aproveche los recursos forestales) on land forming part of the State’s natural heritage and in protection areas; in this case, it is corroborated that the accused cut four trees less than 100 meters, measured in a straight line, from the spring to the location of the trees in question. Criminal intent (dolo) in the commission of this offense may be inferred because the person under investigation carried out his action knowing that the logging (tala) affected an area of 2500 square meters, which was located within the protection area. In this particular case, we see that the accused, knowing of the spring’s existence, cut the four trees without observing the distance stipulated in Article 33 of the Ley Forestal…” (f. 36). Thus, according to the prosecution’s charge, the accused, [Nombre 001], entered the property in question, pruned 36 trees, and cut four Guaba trees.
These facts (which are not described in any greater detail and are not expanded upon in any way in the grounds for the charge) do not describe the act of “intruding,” because the accused did not occupy the property in any manner, nor does cutting the trees imply that he entered it forcibly, as provided in Article 58 subsection a) of the Ley Forestal. Likewise, the prosecution’s charging request does not describe the offense of “exploitation” (aprovechamiento), established in Article 58 subsection b.) in conjunction with Article 3 subsection a.), both of the same statute, because the charge does not state what benefit or advantage the accused obtained from cutting the trees in question or as a result thereof. Contrary to the appellant’s contention, this Chamber concludes that the failure to describe elements in the charge prevents a determination of which criminal acts the accused committed, in accordance with the principles governing the charge and the correspondence between the charge and the judgment (principios de imputación y correlación entre acusación y sentencia).
The judgment of the Court of Appeals for Criminal Judgments (Tribunal de Apelación de Sentencia) under review on appeal is correct in this regard; it is therefore affirmed, and the appeal in cassation (recurso de casación) is denied.” (Third Chamber of the Supreme Court of Justice (Sala Tercera de la Corte Suprema de Justicia), decision number 2016-1131, issued at 15:40 hours on October 25, 2016). Based on these jurisprudential guidelines, it is concluded that, in the case under consideration, the charge (imputación) does not fully describe the conduct set forth in Article 58 subsection b) of the Ley Forestal and, consequently, the trial judge was legally unable to modify that factual framework in the manner in which it was modified in the judgment. Therefore, because that objective element of the criminal offense (circunstancia objetiva del tipo penal), which forms an essential part of the core of the charge, was absent from the original charge, the judge was prohibited from altering the initial charge in order to enter a judgment of conviction.
Accordingly, the claim is granted, and the defendant is acquitted of the offense of exploitation of forest resources (aprovechamiento de recursos forestales) provided for in Article 58 subsection b) of the Ley Forestal. Likewise, because it is directly linked to the conviction being vacated on appeal, the forfeiture order (orden de comiso) issued with respect to the Sthil chainsaw, serial number 364258977, is declared ineffective. Said property shall be returned to whoever, within three months from the date this judgment becomes final, proves ownership of that object. Once that period has expired without any claim having been made, the trial court shall proceed in accordance with the provisions contained in the Ley de distribución de bienes confiscados o caídos en comiso número 6106.
III.In the second ground of the appeal, the appellant alleges erroneous legal reasoning regarding the civil claims (extremos civiles). He states that the judgment deemed the existence of environmental damage (daño ambiental) to have been proven, in an amount far greater than could be established during the adversarial proceedings (contradictorio). He maintains that the witness Orlando Picado Ramírez, who prepared the ecological damage assessment (valoración del daño ecológico), stated that the environmental damage consisted of the loss of carbon sequestration and that the environmental harm resulting from that circumstance amounted to 12.178 colones. He further challenges the fact that the administrative expenses incurred by the state entity were estimated at 101.150.00 colones. He objects that the judgment included among the damages the value of the timber extracted from the manú tree, since that tree should never have been cut; however, he contends that the judgment did not establish that his client was the person who cut the tree while it was still standing.
He adds that the methodology used to calculate the economic value of the timber bears no relation whatsoever to the environmental damage for which compensation was sought through the civil action (acción civil), and therefore considers the award of 988.562,00 colones improper. He requests that the claim be granted and, in the interest of procedural economy (economía procesal), that the decision of the court below (a quo) be reversed and the civil action for damages (acción civil resarcitoria) be dismissed. The claim is granted. Upon examination, the grounds on which the civil action was granted are erroneous and insufficient. First, the judgment contains an inconsistency between the fact deemed proven and the court’s reasoning (fundamentación intelectiva). In this regard, throughout the decision, the judge repeatedly maintained that the proven criminal conduct consisted of the defendant cutting a tree that lay within the protection zone (zona de protección) and exploiting that forest resource for economic gain.
The distinction is subtle but relevant, because in her reasoning the judge did not clearly state or substantiate that the defendant was the person who cut or felled the standing tree located within the protection zone, and the latter was the original conduct alleged by the civil plaintiff as the direct cause of the environmental damage claimed, as shown by the civil action filed in these proceedings (see pages 491 to 500). Furthermore, the judge violated the rules of logical inference (reglas de la derivación) by finding that the timber had been exploited for economic gain, since that fact cannot be inferred from the statements of the witnesses who testified at trial or from the documentary evidence entered into the record. In this regard, according to the summary of evidence, Fuerza Pública officer Rodolfo Méndez Castro stated that on that day he arrived at the scene and saw Heliodoro Pérez Brenes cutting a section of a tree that lay on the ground, while other persons were attempting to remove other pieces of timber using chains and a tractor.
For their part, Ministerio de Ambiente y Energía officials Alejandro Alvarado and Orlando Picado described the inspection conducted on the day following the incident and the economic appraisal they performed on the forest product. The summary of evidence does not show that these witnesses referred to the type of gain or benefit that the defendant sought through his criminal conduct. Moreover, the judge’s analysis of the defendant’s theory of defense was cursory, as she merely stated that his account was not credible, without giving reasons grounded in the evidence introduced at trial or in arguments based on maxims of experience (máximas de la experiencia) or psychology. In this regard, during the plenary phase (fase plenaria), the defendant stated—in summary—that Tobías Monestel was the person who purchased the timber from a man in the area, and that they went to that location at Tobías’s request because they had machinery nearby and went to help him remove the pieces of the tree, but were unable to do so.
He further clarified that when they arrived there, the tree had already been cut and was lying on the ground (audiovisual record 160000260298PE-31082017023541, from minute 34 onward). In this regard, the police report entered into the record and prepared on the day of the incident shows that Fuerza Pública officers recorded that, among the persons who were in the protection zone carrying out activities to remove timber from that property, one was identified as Tobías Monestel Jiménez. Furthermore, the charges brought by both the Ministerio Público and the Procuraduría General described Tobías Monestel as one of the persons who had participated in the criminal activity. Nevertheless, although the defendant Heliodoro Pérez Brenes had explained why he was in that area and why he performed those actions, the judge rejected this theory of defense without further reasoning and, to discredit it, relied on a series of presumptions, such as that the defendant had rented the tractor used to remove the timber and that, under those circumstances, it was reasonable to maintain that he intended to obtain an economic benefit from that forest resource.
However, the judge’s error lies in the fact that this conclusion cannot be inferred from the evidence entered into the record, because the document signed by Janior Solís Chaves—the owner of that equipment—states that the equipment was rented to the defendant Pérez Brenes to perform work on a pineapple farm and that he did not know why it was in the area. Moreover, in her reasoning concerning the civil claims, the judge conflated two distinct concepts: one concerning the environmental damage caused by cutting the tree, which, as shown by the expert assessment (pericia) conducted by the Ministerio de Ambiente y Energía, was limited to the carbon loss caused by cutting the tree and was valued at 12.178,00 colones; and the other concerning the timber’s economic market value, which was set at 988.562,00 colones (see page 299 of the digital case file in pdf format). The judge’s error consisted of equating the value of the timber with environmental damage, even though the economic value of the forest resource was not included within the environmental damage described in that expert assessment.
Furthermore, the judge conducted an insufficient analysis of the provisions of the Ley Forestal in order to determine whether the civil plaintiff had any right to collect or recover the economic value of the seized timber. In this regard, forestry legislation contains a series of provisions concerning the procedure to be followed when forest resources are seized as a result of unlawful activity. In this respect, Article 65 of the Ley Forestal provides as follows: Auction of seized products. Violations of this law shall be reported to the competent judicial authority and, if timber or other forest products are seized, that authority, following an appraisal conducted by the State Forestry Administration (Administración Forestal del Estado), shall sell them at public auction within a period not exceeding one month from the date on which the complaint was filed. Those forest products may not be auctioned for less than the value established by the State Forestry Administration.
If, upon expiration of that period, the timber or forest resources have not been auctioned, any person may make use of them after depositing with the Court the value assigned by the Forestry Administration. The proceeds from the auction shall be deposited in the account of the corresponding judicial authority while the respective proceedings are resolved. If the accused is acquitted, the money shall be delivered to him; otherwise, fifty percent (50%) shall belong to the State Forestry Administration and the other fifty percent (50%) to the municipalities of the place where the property from which the raw material was extracted is located or where the industry is situated, or to the indigenous association if it is on an indigenous reserve, to be allocated to the development of forestry projects, all without prejudice to any criminal liability determined for the offenders. The Ministerio del Ambiente y Energía is authorized, through the Forestry Administration, to donate to the Ministerio de Educación Pública any timber that comes into its possession as a result of a natural disaster or road widening, provided that the owners are unknown.
It shall also donate seized timber once the conviction has become final, provided that the timber was neither awarded at auction nor requested by any person meeting the legal requirements. The Ministerio de Educación Pública shall use that timber to manufacture furniture, repair infrastructure in public primary and secondary schools, or as raw material in cabinetmaking, woodturning, carpentry, and other courses taught by state primary and secondary schools.” It readily follows from the foregoing provision that a statutory procedure has been established for handling seized forest products. It also specifies how the financial resources generated from the auction of the timber must be allocated. Likewise, it specifies that, in cases where the forest resource cannot be auctioned or where a third party interested in obtaining that property has not acquired it as provided in that rule, the seized timber shall be donated to the Ministerio de Educación Pública.
A review of the digital case file—in pdf format—does not show that the local Criminal Court in which this case was processed carried out the auction procedure regulated by law. Nor does the record indicate whether that forest resource was acquired by a third party or donated to the Ministerio de Educación Pública. This issue should have been examined by the trial judge because it directly affects whether the Procuraduría had any right to claim the value of the timber as property damage (daño material). Furthermore, it should be noted that the same provision states that, if the defendant is acquitted, he shall be entitled to claim 50% of the value of the auctioned forest product. Nevertheless, in this case, as stated above, the judge did not analyze the provision contained in Article 65 of the Ley Forestal, nor did she determine whether that procedure was carried out in this case or what disposition was made of that forest resource.
Accordingly, the claim must be granted. The judgment is vacated insofar as it concerns the civil claims, and the case record is ordered remanded to the court of origin so that, in a new trial, the civil claims brought by the Procuraduría General de la República may be adjudicated.
POR TANTO
The first ground of appeal (motivo de apelación) filed by the Defensa Pública is granted. The defendant, Heliodoro Pérez Brenes, is acquitted of criminal liability for the offense established in Article 58(b) of the Ley Forestal, with which he had been charged. The forfeiture order (orden de comiso) issued for the Sthil chainsaw, serial number 364258977, is declared void. That property shall be returned to whoever, within three months from the date this judgment becomes final, proves ownership of it. Once that period has elapsed without any claim having been made, the trial court shall proceed in accordance with the provisions of Ley de distribución de bienes confiscados o caídos en comiso number 6106. The second ground of appeal filed by the public defender is granted. The judgment is vacated with respect to the civil claims. The matter is remanded for new proceedings on that issue.

Intervienen en la decisión del recurso, las juezas Adriana Escalante Moncada, Yadira Godínez Segura y Annia Enríquez Chavarría. Se apersonan en apelación de sentencia, el licenciado Álvaro Pérez Roda, defensor público del encartado Heliodoro Pérez Brenes, el licenciado Carlos Lizano Rodríguez, Procurador de la República y la licenciada Elizabeth Ugalde Cortes, representante del Ministerio Público.
RESULTANDO:
I.Que mediante sentencia número 644-2017 de las dieciséis horas cuarenta y cinco minutos del treinta y uno de agosto del año dos mil diecisiete, el Tribunal de Juicio de San Carlos, resolvió: "POR TANTO: Conforme a lo expuesto, artículos 39 y 41 de la Constitución Política, 11 de la Declaración Universal de los Derechos Humanos, 8 inciso 2 de la Convención Americana de Derechos Humanos, 1, 11, 18, del Código Penal; 1, 7, 9, 360 a 365 366, 367 del Código Procesal Penal y artículos 33 y 58 de La Ley Forestal, este Tribunal resuelve con base en el principio universal IN DUBIO PRO REO absolver de toda pena y responsabilidad a RONALD RIGAN PEREZ BRENES, Y HELIODORO PEREZ MADRIGAL de haber cometido un delito de INFRACCION A LA LEY FORESTAL que se le ha venido atribuyendo en perjuicio de LOS RECURSOS NATURALES.- Se declara sin lugar tanto en QUERELLA como la ACCION CIVIL RESARCITORIA incoadas por parte de la Procuraduría General de la República contra dichos endilgados; sin especial condenatoria en costas en ninguna de las mismas.
Por otra parte se declara a HELIODORO PEREZ BRENES, autor responsable de un delito de INFRACCION A LA LEY FORESTAL que se le viene atribuyendo cometido en perjuicio de LOS RECURSOS NATURALES en tal carácter se le impone el tanto de TRESS MESES DE PRISION. Por considerarlo procedente se le otorga el BENEFICIO DE EJECUCION CONDICIONAL DE LA PENA por un periodo de prueba de tres años, en el entendido de que durante dicho lapso no deberá resultar condenado por nuevo delito doloso en que se le imponga una pena de prisión superior a seis meses, pues en dicho evento, le será revocado el beneficio aquí concedido y deberá descontar en prisión la pena impuesta. Se acoge la acción civil incoada por la PROCURADURIA GENERAL DE LA REPUBLICA en representación de los intereses del Estado contra el demandado civil HELIODORO PEREZ BRENES, y se condena a este al pago de UN MILLON CIENTO UN MIL OCHOCIENTOS NOVENTA Y UN COLONES NETOS por concepto de daño ambiental, que deberá depositar en la cuenta única del Estado, sin especial condenatoria en costas respecto a lo civil.
Se resuelve el asunto sin especial condena en costas en lo penal y son los gastos del proceso a cargo del Estado. De conformidad con el artículo 110 del Código penal, se ordena el comiso definitivo a favor del Estado de la motosierra marca Sthil serie 364258977. Para la lectura integral del fallo, se señalan las dieciséis horas del jueves siete de setiembre del año dos mil diecisiete" (sic).
II.Que contra el anterior pronunciamiento, el licenciado Álvaro Pérez Roda, defensor público del encartado Heliodoro Pérez Brenes, interpuso recurso de apelación de sentencia.0168834137171609
III.Que verificada la deliberación respectiva, de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal de Apelación de Sentencia del III Circuito Judicial de Alajuela, San Ramón, procedió a conocer del recurso.
Redacta la jueza de apelación de sentencia Escalante Moncada; y,
CONSIDERANDO:
I.El licenciado Álvaro Pérez Roda, defensor público del encartado Heliodoro Pérez Brenes, interpuso recurso de apelación de sentencia, contra el fallo número 644-2017, dictado por el Tribunal de Juicio del Segundo Circuito Judicial de Alajuela, sede San Carlos a las 16:45 del 31 de agosto de 2017.
II.En el primer motivo del recurso, el apelante invoca violación a las reglas de la sana crítica, falta de fundamentación jurídica y quebranto al principio de correlación entre acusación y sentencia. Estima que el Tribunal de Juicio de San Carlos, hizo un análisis errado del tipo penal contemplado en el artículo 58 inciso b) de la Ley Forestal. Además, fustiga que la decisión partió de una demostración fáctica, que violenta las reglas de la sana crítica y el principio de congruencia. Sostiene que según la acusación formulada por el Ministerio Público y la Procuraduría General de la República, en su condición de querellante y actor civil, tanto a su representado como a los otros tres encartados, se les atribuyó haber cortado y aserrado un árbol de la especie manú dentro de la zona de protección del Río Samen. Refiere que en dichas plataformas fácticas, no se acusó al endilgado Pérez Brenes, de haber aprovechado el árbol en cuestión.
Detalla que el concepto de aprovechamiento, está descrito en el artículo 3 inciso a) de la Ley Forestal la cual indica que el aprovechamiento maderable, es la acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluida en el artículo 1 de esta ley, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa. Afirma que durante el debate no se demostró que su patrocinado hubiese cortado el árbol de su ubicación original. Detalla que el oficial de la Fuerza Pública que declaró en el contradictorio, lo que especificó fue que observó al enjuiciado aserrar un trozo del árbol, cuando este ya había sido cortado. Añade que el acusado declaró en la fase plenaria y explicó que él se presentó al sitio para ayudar al coimputado Tobías Monestel -abuelto por estos mismos hechos, al igual que los otros coimputados- a remover la madera en cuestión, aspecto que fustiga no fue analizado en la sentencia y fue omitido en el sumario de prueba.
Ataca que la juzgadora, en la sentencia modificó la plataforma acusada y tuvo por demostrado que el encartado aprovechó el producto forestal y que esa variación la efectuó a fin de subsanar el defecto que contienen las requisitorias, actuación que estima lesiona el derecho de defensa y el debido proceso. Agrega que en la imputación, no se describió el eventual aprovechamiento, beneficio, ventaja o utilidad que las acciones de troceo habrían traído para el imputado o algún tercero. Además, tampoco se describió a nivel del dolo, si el encartado perseguía algún tipo de beneficio con su actuar. Sostiene que la juzgadora afirmó, que la intención del encartado era el provecho pecuniario que pudiere obtener de la madera talada, pero ese aspecto no fue indicado por los testigos que depusieron en la fase plenaria. Fustiga que a su representado se le impusiera una pena de tres meses de prisión, a pesar de que no se tuvo por demostrada la conducta acusada.
Solicita se absuelva al encartado de toda pena y responsabilidad. Con lugar el reclamo. Una vez examinado el fallo estiman estas juzgadoras de alzada, que el mismo contiene una argumentación insuficiente y equivocada. Para una adecuada resolución de los reproches efectuados, es necesario transcribir las imputaciones que hicieron el Ministerio Público y la Procuraduría General de la República. Por su parte el ente fiscal acusó lo siguiente: “1. El diecisiete de junio del año 2013, en una finca ubicada en San Miguel de Katira de Guatuso, propiedad de una persona identificada como Fernando Barrantes, los imputados Heliodoro Pérez Brenes, Ronald Rigan Pérez Brenes, Tobías Monestel Jiménez y Heliodoro Pérez Madrigal; sin contar con permiso alguno de la Administración Forestal del Estado y conociendo que esa actividad no se autorizaba, talaron y procesaron un árbol de la especie Manú que se encontraba en la zona de protección del Río Samen (a un metro de distancia del caudal de la quebrada). 2.
Para poder llevar a cabo la tala y procesamiento descrita en el hecho anterior, los imputados Heliodoro Pérez Brenes, Ronald Rigan Pérez Brenes y Heliodoro Pérez Madrigal, recurrieron a una clara distribución de funciones; el endilgado Heliodoro Pérez Brenes hizo uso de una motosierra marca Sthil, serie 364258977 con la cual cortó y aserró el árbol de la forma y dimensiones ya descritas; entre tanto los imputados Ronald Rigan Pérez Brenes y Tobías Monestel Jiménez, ayudaron a Heliodoro Pérez Brenes a crotar y aserrar el árbol, para lo cual sostuvieron y acomodaron las trozas que el último iba conformando, también se encargaron de amarrar con cadenas una de las trozas ya conformadas para que fueran arrastradas y sacadas del sitio de la tala mediante el uso de un tractor de llantas con placas de circulación EE 13453 que en ese momento fue conducido por el coimputado Heliodoro Pérez Madrigal, el cual sacó de la zona de aserrío esa troza llevándola hasta un sitio desde donde pretendían llevarse después con las demás madera que estaba procesando en conjunto con los otros endilgados.
Cuando los imputados Heliodoro Pérez Brenes, Ronald Rigan Pérez Brenes, Tobías Monestel Jiménez y Heliodoro Pérez Madrigal se encontraban realizando las acciones descritas en el hecho anterior, fueron sorprendidos de manera flagrante por oficiales de la fuerza pública que ya habían sido alertadas de la comisión de este injusto penal. Fue en este momento que el imputado Heliiodoro Pérez Brenes, consciente de la ilegalidad de la tala que estaba realizando, al verse descubierto en su actuar, optó por apagar la motosierra y con ella al hombro echó a correr tratando de escapar de la policía, sin embargo también fue detenido. 3. De manera concomitante con los hechos anteriores y como consecuencia directa de la tala descrita, los imputados Heliodoro Pérez Brenes, Ronald Rigar Pérez Brenes, Tobías Monestel Jiménez y Heliodoro Pérez Madrigal produjeron en la zona de protección del Río Samen un daño ambiental que fue estimado en la suma de un millón ciento un mil ochocientos noventa y un colones” (copia textual página 661 y 662 del expediente digital el formato pdf).
Por su parte la Procuraduría General de la República entabló querella con base en los siguientes hechos: “1. El 17 de junio del año 2013 en la finca propiedad del señor Fernando Barrantes ubicada en San Miguel de Katira de Guatuso, los imputados Heliodoro Pérez Brenes, Ronald Rigar Pérez Brenes, Tobías Monestel Jiménez y Heliodoro Pérez Madrigal, sin contar con permiso alguno de la Administración Forestal del Estado y conociendo la ilicitud de su actuación talaron y procesaron un árbol dela especie Manú que se encontraba en la zona de protección del Río Samen, concretamente a un metro de distancia del caudal del citado río. 2. Para poder llevar a cabo la tala y procesamiento descrita en el hecho anterior, los imputados imputados Heliodoro Pérez Brenes, Ronald Rigar Pérez Brenes, Tobías Monestel Jiménez y Heliodoro Pérez Madrigal recurrieron a una clara distribución de funciones; de forma que el querellado Pérez Brenes se encargó de la corta y aserrío del árbol de Manú citado, haciendo uso para ello de una motosierra marca Sthil, serie 364258977, entre tanto los imputados Ronald Rigan Pérez Brenes y Tobías Monestel Jiménez, se hacían cargo de sostener y acomodar las trozas que el sierrista iba conformando, además se encargaban de amarrar con cadenas las trozas ya listas para que fueran arrastradas y sacadas del sitio por el coencartado Heliodoro Pérez Madrigal, quien era el conductor del tractor de llantas placas de circulación EE-13453, con el cual sacaban de la zona del aserrío de las trozas. 3.
Cuando los aquí querellados se encontraban realizando acciones descritas en los hechos anteriores, fueron sorprendidos de manera flagrante por los oficiales de la Fuerza Pública que habían sido alertadas de la comisión de este injusto penal; y es en ese momento el imputado Heliodoro Pérez Brenes, al darse cuenta de la presencia policial apagó la motosierra y con ella al hombro trató de escapar, sin embargo también fue detenido”. (copia textual de página de páginas 662 y 663 del expediente digital en formato pdf). Como se observa en esta sumaria penal, figuraron como enjuiciados cuatro personas, entre ellas, el acusado Heliodoro Pérez Brenes, a quienes se les imputó realizar en forma conjunta y con una debida distribución de funciones, la acción de talar un árbol ubicado en el área de protección de un río y aserrarlo en varios segmentos. En la sentencia impugnada, se absolvió de toda pena y responsabilidad a los enjuiciados Ronald Pérez Brenes y Heliodoro Pérez Madrigal, el cuarto acusado Tobías Monestel, había sido absuelto, en un proceso anterior y se condenó por dicha delincuencia al encartado Heliodoro Pérez Brenes.
Volviendo al análisis de la conducta delictiva descrita en las acusaciones, se tiene que según el diccionario de la Real Academia Española, talar significa cortar por el pie un árbol. Es decir, la acción imputada consistió en que el enjuiciado cortó un árbol en pie, que se encontraba sembrado en la zona de protección y lo procesó al dividirlo en diversos fragmentos. Por su parte, en la sentencia, la juzgadora tuvo por demostrados los siguientes hechos: “1. El 17 de junio del año 2013 en la finca propiedad del señor Fernando Barrantes ubicada en San Miguel de Katira de Guatuso, el encartado y demandado civil Heliodoro Pérez Brenes fue detenido por oficiales de la Fuerza Pública en flagrante delito, cuando haciendo uso de una motosierra marca Sthil, serie 364258977, aprovechó un árbol de la especie Manú que se encontraba en la zona de protección del Río Samen (a un metro de distancia del caudal de la quebrada). 2.
Como consecuencia directa de la tala descrita, el indagado Pérez Brenes, produjo en la zona de protección del Río Samen un daño ambiental que fue estimado en la suma de un millón ciento un mil ochocientos noventa y un colones.” (copia textual de página 665 del expediente digital en formato pdf). La comparación de esos tres cuadros fácticos, permite develar fácilmente, que en efecto, el evento que se tuvo por demostrado es diverso en su redacción al que se acusó por parte del Ministerio Público y de la Procuraduría General. Sobre este punto, es necesario indicar que, el Tribunal de Juicio, no está compelido a respetar la redacción mediante la que se formula una imputación, por lo que posee la facultad de describir el evento probado, utilizando para ello, una narración diversa a la propuesta por el ente acusador. No obstante, las variaciones que realice el Colegio de Jueces, al momento de describir el suceso probado, tiene un límite infranqueable, y está dado por la configuración de los elementos objetivos y subjetivos del tipo penal que conforman el núcleo central de la imputación delictiva.
Es decir, tanto el evento acusado, como el hecho demostrado, deben de guardar relación en cuanto al núcleo de la imputación. A partir de esta precisión, se concluye que a pesar de que la juzgadora sustituyó los verbos de talar o cortar -contenidos en la imputación fiscal y en la querella, por la acción de aprovechar, lo cierto es que de conformidad con el artículo 3 de la Ley Forestal, una de las formas en que se puede dar el aprovechamiento de recursos forestales es mediante la corta de árboles. Por ello, esa parte del evento demostrado concuerda con el hecho ilícito imputado al encartado en las acusaciones formuladas en su contra. Pero la diferencia relevante, radica en que la juzgadora, en la fundamentación intelectiva amplió el evento demostrado y lo completó al indicar que la acción de aprovechamiento del recurso forestal se hizo con la finalidad de obtener un beneficio económico mediante la venta de la madera.
Esta otra circunstancia agregada a la imputación original sí resulta relevante, por las siguientes consideraciones. Al respecto el artículo 58 de la Ley en comentario describe varias conductas ilícitas, entre ellas, y las que interesan para la resolución de este caso, se encuentran las siguientes acciones ilícitas: “ Se impondrá prisión de tres meses a tres años a quien a) Invada un área de conservación o protección, cualquiera que sea su categoría de manejo, u otras áreas de bosques o terrenos sometidos al régimen forestal, cualquiera que sea el área ocupada; independientemente de que se trate de terrenos privados del Estado u otros organismos de la Administración Pública o de terrenos de dominio particular. Los autores o partícipes del acto no tendrán derecho a indemnización alguna por cualquier construcción u obra que hayan realizado en los terrenos invadidos. b) Aproveche los recursos forestales en terrenos del patrimonio natural del Estado y en las áreas de protección para fines diferentes de los establecidos en esta ley.” En el caso bajo estudio, no se acusó al enjuiciado de invadir o detentar un terreno ubicado en el área de protección, que es la conducta descrita en el inciso a) del artículo 58, sino de cortar y procesar un árbol que se encontraba en el área de protección.
Uno de los puntos objetados en el recurso, consiste en la calificación jurídica que le asignó el a quo al cuadro fáctico tenido por demostrado, ya que, a criterio de la defensa pública, la conducta acusada no calza en el núcleo de la acción descrita en el inciso b) del artículo 58 de la Ley Forestal y el cuadro fáctico demostrado difiere del acusado. Sobre este aspecto, del fallo se deduce que hay un hecho no controvertido y es el referido a que el encartado ingresó a un terreno -sin demostrarse que fue mediante el uso de la fuerza o la violencia-, en el cual existe un río y por ende todos los árboles que están sembrados dentro del radio de quince metros medidos horizontalmente a partir de la ribera del río, están situados en una zona de protección de conformidad con la disposición del artículo 33 de la Ley Forestal. De igual manera, según lo regula de forma expresa el artículo 3 de la Ley Forestal, el aprovechamiento de recursos forestales “consiste en la acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluida en el artículo 1 de esta ley, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa”.
La definición normativa del verbo aprovechar, que en este caso nos provee la propia ley forestal, permite concluir que la corta de árboles en las zonas de protección no sólo es una acción prohibida según la previsión contenida en el artículo 34 de la Ley Forestal, sino que es una conducta punible conforme el tipo penal establecido en el artículo 58 inciso b) de la citada normativa especial. Como se observa, según la descripción típica contenida en el inciso b) de la norma en comentario, el núcleo de imputación del tipo penal, hace referencia al aprovechamiento forestal, en determinados terrenos, entre ellos, los declarados como áreas de protección, que es el caso aquí examinado. De igual manera, la referida norma indica que la acción de cortar o eliminar árboles debe procurar o generar una ganancia, provecho o beneficio para quien la ejecuta. Es aquí donde se detecta el principal error, tanto en la descripción fáctica contenida en las acusaciones, como en la decisión adoptada.
Esta Cámara de Apelación de Sentencia, con ocasión del análisis de un caso similar al presente, y retomando la postura que al efecto había expresado el Tribunal de Apelación de Sentencia del Segundo Circuito Judicial de San José indicó -en lo conducente- lo siguiente: “Como se observa el núcleo de imputación del tipo penal del artículo 58 inciso b) de la Ley Forestal, hace referencia al aprovechamiento forestal pero de determinados terrenos: del patrimonio natural del Estado y en áreas de protección. Dichos aspectos constituyen elementos normativos del tipo que necesariamente forman parte del núcleo central de imputación y, que por ende, deben integrarse a la pieza acusatoria y a los hechos tenidos por demostrados en sentencia, pero nunca reiterando dentro de la relación de hechos de forma textual esos conceptos normativos, en sustitución de la especie fáctica que los debería describir. Como sucede con otros delitos, el fiscal al formular la acusación describe la acción o conducta dentro de un determinado segmento temporal-espacial y, según las exigencias básicas impuestas por el tipo penal imputado adicionará otras circunstancias pertinentes, por ejemplo, resultados, descripción de especiales condiciones personales, entre otros.
Entonces si se atribuye un delito de hurto, resulta inaceptable una técnica que se limite a indicar en la acusación que se dio un desaporamiento de un determinado bien, pues lo que debe hacerse es describir cómo se desarrolló el hecho, luego, si se comprueba esa hipótesis fáctica, el juzgador podrá valorar y determinar si esa enunciación demostrada se adecua a un tipo penal. El delito atribuido a la justiciable A. contiene elementos normativos, y éstos exigen la remisión a otras normas previstas -en este caso- en la Ley Forestal, que le dan contenido a esas expresiones; es decir, se trata de conceptos jurídico penales específicos. (...) El tipo objetivo previsto en el artículo 58 inciso b) de la Ley Forestal, sanciona la acción de aprovechamiento forestal y eso implica describir la conducta acusada para determinar luego, si demostrada, constituye un supuesto de aprovechamiento. De nuevo, es imprescindible una remisión a la Ley Forestal que en el artículo 3 establece que para efectos de esa ley, se considera aprovechamiento: "Acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluida en el artículo 1 de esta ley, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa." Es decir, la configuración del tipo penal de aprovechamiento requiere no solo indicar la conducta realizada (que pueden ser varias) sino también el eventual o efectivo resultado generado y que se describe en términos positivos para el agente.
En suma, este elemento normativo por disposición de ley, alude a dos diversas circunstancias: 1) una serie de acciones (corta, eliminación de árboles en pie o utilización de los caídos) y, 2) una determina ventaja, ganancia, utilidad o beneficio, a quien realiza la acción o a un tercero que representa; que por cierto, no se limita a un aspecto de contenido puramente económico y que por ende, se puede traducir en muy diversos supuestos (paisajisticos, posibilitar construcción de obras en el lugar, uso de la madera para fines artísticos, etc.). Desde ese punto de vista, en el sub examine, el requerimiento fiscal sólo establece con claridad el primer aspecto del elemento normativo "aprovechamiento", es decir, que sin el permiso correspondiente se dio la corta de al menos cinco árboles (dentro de un área de protección, que realizaron tres sujetos de calidades desconocidas contratados por la imputada A.).
Pero el aprovechamiento forestal no solo se integra con la descripción de la acción (en este caso la corta de árboles), requiere también puntualizar cuál es la situación de utilidad que dimana o emerge para el sujeto activo o para quien él represente. En autos, la acusación describe solo parcialmente ese elemento normativo, pues nunca se señaló cuál fue el provecho, ventaja, ganancia o utilidad que dicha actividad generó a la acusada y esa es una exigencia ineludible del tipo objetivo, sea de lo establecido en el artículo 58 inciso b) en relación con el artículo 3 de la Ley Forestal.” (Tribunal de Apelación de Sentencia del Tercer Ciruito Judicial de Alajuela, sede San Ramón, sentencia número 388-2016). Volviendo al caso bajo examen y aplicando la anterior línea de pensamiento, se tiene que el hecho acusado por el ente fiscal y por el querellante, sólo establece con claridad el primer aspecto del elemento normativo del delito de aprovechamiento forestal, es decir, que el imputado cortó un árbol de manú ubicado dentro de un área de protección de un río, lo cual realizó sin contar con los permisos de la administración forestal, pero en dichas imputaciones no se describió en qué consistió o pudo consistir, el provecho que el encartado obtuvo o pudo obtener con esa acción prohibida, aspectos todos que forman parte de la tipicidad objetiva del delito atribuido y que deben ser conocidos por el endilgado, con el fin de ejercer su derecho de defensa también sobre esos extremos.
Sobre este punto, si bien ambas imputaciones indican que el encartado procesó ese recurso forestal al cortarlo en pedazos, lo cierto es que la imputación efectuada quedó incompleta y por ello, aunque se describiera la acción de cortar el recurso forestal y el daño ambiental que provocó, a ese cuadro fáctico le faltaban los restantes elementos del tipo penal, ya que no se señaló cuál fue el provecho, ventaja, ganancia o utilidad que dicha actividad generó o pudo generar para en el acusado y esa es una exigencia ineludible del tipo objetivo establecido en el artículo 58 inciso b) en relación con el artículo 3 de la Ley Forestal. La postura sostenida por esta Cámara de Apelación de Sentencia en el voto número 388-2016, fue acogida por la Sala Tercera de la Corte Suprema de Justicia, la cual al conocer del recurso de casación interpuesto contra dicho voto resolvió -en lo que interesa- lo siguiente: “Por su parte, en segunda instancia, el Tribunal de Apelación de Sentencia, absolvió al acusado, por considerar que la acusación no contempla los supuestos de los incisos a.) y b.) del artículo 58 de la normativa citada (f.230 reverso).
Con la lectura de este numeral, se puede determinar que a l aprovechar los recursos forestales, implica entonces que el autor del hecho obtenga algún beneficio para sí o su representado, consecuencia de los daños que le provocó a los árboles vivos o caídos y que en la práctica, generalmente, se ven representados en la venta de madera o uso personal de la misma o uso de los suelos tras el derribo de los árboles. Ahora bien, el concepto de “invadir” que plantea el artículo 58 inc.a), no cuenta con una definición dentro de la Ley Forestal, por lo que debe accederse a otra s fuentes. Según el Diccionario de la Real Academia Española, invadir se entiende como “1. Irrumpir, entrar por la fuerza; 2. tr. Ocupar anormal o irregularmente un lugar. Las aguas invadieron la autopista; 3. tr. Dicho de una cosa: Entrar y propagarse en un lugar o medio determinados…”. Sea entonces, que la acción que sanciona el inc. a) del artículo 58 de la Ley Forestal, es el ocupar, irrumpir en un área de conservación o protección, independientemente de que se trate de terrenos estatales o privados, contemplando incluso el hacer “mejoras” al lugar (las que no se le retribuirán al invasor), como lo estipula la misma norma.
Es decir, invadir implica actos de ocupación del sitio, que se traducen en establecerse en el lugar y disponer del mismo. C.) Sobre los hechos acusados y la tipicidad. Tal como se indicara supra, los hechos acusados son los siguientes: “…Sin precisar la fecha exacta pero en el mes de febrero del año dos mil trece, el imputado [Nombre 001], se presentó a la finca ubicada en Cataratas Alfaro de San Ramón, hoja cartográfica Miramar, escala 1.50.000 en las coordenadas Lambter 229:350 y 481:131. Una vez en el sitio, y sin contar con el permiso de la Administración Forestal del Estado, podó las ramas de 36 árboles de la especie Guaba y cortó 04 árboles de la misma especie desde su tronco, a una altura de dos a cuatro metros de altura desde el nivel del suelo, también de la especia Guaba, los cuales se encontraban dentro de una zona de protección de una naciente de agua permanente…” (f. 35 reverso).
En la fundamentación del requerimiento fiscal, se indicó que “…En cuanto a la calificación jurídica expuesta en esta pieza, tenemos que la conducta acusada al prevenido encuadra dentro de lo previsto en el artículo 58 inciso b.) de la Ley Forestal. Conforme ese inciso, comete este delito quien aproveche los recursos forestales de un terreno del patrimonio natural del Estado y en las áreas de protección, que en este caso que corrobora que el acusado cortó cuatro árboles a menos de 100 metros medidos linealmente desde la naciente hasta donde se encontraban los árboles en cuestión. El dolo en la comisión de este delito se infiere, debido a que el indiciado llevó a cabo su acción, a sabiendas de que la tala realizada afectaba un área de 2500 metros cuadrados, los cuales se encontraban dentro del área de protección. En el particular vemos como el acusado conociendo acerca de la existencia de la naciente, llevó a cabo la tala de los cuatro árboles sin respetar la distancia que estipula el artículo 33 de la Ley Forestal…” (f. 36).
Según la acusación fiscal entonces, lo que se tiene es que el imputado, [Nombre 001], entró a la propiedad en cuestión, podó 36 árboles y cortó cuatro árboles de la especie Guaba. Estos hechos (que no cuentan con mayor descripción no se amplían de manera alguna en la fundamentación de la acusación), no describen la acción de “invadir”, pues no se ocupó la finca en forma alguna por parte del imputado ni la corta de los árboles implica que se haya entrado violentamente en la misma, tal como se determina en el artículo 58 inc. a) de la Ley Forestal. A su vez, tampoco el requerimiento fiscal describe la figura del “aprovechamiento”, establecido en el artículo 58 inc.b.) en relación con el artículo 3 inc. a.), ambos del mismo cuerpo legal, pues no refiere la acusación el beneficio o provecho que obtuvo el imputado de la corta de los árboles en cuestión o raíz de ella. Cont r ario a lo que plantea el recurrente, concluye esta Sala que la falta de descripción de elementos en la acusación, no permite determinar en cuál de las acciones delictivas incurrió el imputado, ello de conformidad con los principios de imputación y correlación entre acusación y sentencia.
Lleva razón en ello el criterio del Tribunal de Apelación de Sentencia que he venido en alzada, por lo que se confirma el mismo y se declara sin lugar el recurso de casación.” (Sala Tercera de la Corte Suprema de Justicia, resolución número 2016-1131 de las 15:40 horas del 25 de octubre de 2016). A partir de estos lineamientos jurisprudenciales, se concluye que, en el caso en estudio, la imputación efectuada no describe a cabalidad la conducta descrita en el artículo 58 inciso b) de la Ley Forestal y de ahí, la imposibilidad legal que tenía la juzgadora para modificar dicho cuadro fáctico, en la forma en que se hizo en el fallo. Por ello, al no estar presente esa circunstancia objetiva del tipo penal en la imputación original, la cual forma parte esencial del núcleo de la imputación, la jueza tenía vedado variar la imputación inicial, a fin de emitir una sentencia condenatoria. En consecuencia, se declara con lugar el reclamo y se absuelve al encartado del delito de aprovechamiento de recursos forestales, contemplado en el artículo 58 inciso b) de la Ley Forestal.
De igual manera, por estar directamente vinculado con la condenatoria que se está anulando en alzada, se declara ineficaz, la orden de comiso que se decretó sobre la motosierra marca Sthil serie 364258977. Se ordena la devolución de dicho bien, a quien, en el plazo de tres meses contados a partir de la firmeza de esta sentencia, demuestre ser el titular de ese objeto. Una vez fenecido el lapso anterior, sin que se realice reclamo alguno, la autoridad jurisdiccional de instancia procederá conforme con las disposiciones contenidas en la Ley de distribución de bienes confiscados o caídos en comiso número 6106.
III.En el segundo motivo del recurso, el apelante reclama errónea fundamentación jurídica de los extremos civiles. Indica que en la sentencia, se tuvo por demostrado la existencia de un daño ambiental, muy superior al que pudo constatarse durante el contradictorio. Sostiene que el testigo Orlando Picado Ramírez, quien elaboró la valoración del daño ecológico, indicó que el daño ambiental consiste en la pérdida de liberación de carbono y que el menoscabo ambiental por dicha circunstancia asciende al monto de 12.178 colones. Además, fustiga que por los gastos administrativos en los que incurrió la entidad estatal, dicha suma fue estimada en 101.150.00 colones. Fustiga que la sentencia, incluyera dentro de los daños, el costo de la madera extraída del árbol de manú, puesto que este nunca debió cortarse, sin embargo, estima que en la sentencia no se demostró que fuera su representado quien cortara dicho árbol, cuando éste se encontraba plantado.
Añade que la metodología utilizada para calcular el valor económico de la madera no tiene relación alguna con el daño ambiental que se pretendía resarcir por medio de la acción civil y por ello considera que era improcedente otorgar el monto de 988.562,00 colones. Solicita declarar con lugar el reclamo y por economía procesal revocar la decisión del a quo y declarar sin lugar la acción civil resarcitoria. Con lugar el reclamo. Examinados los argumentos por los que se declaró con lugar la acción civil, los mismos resultan equivocados e insuficientes. En primer término, se advierte que el fallo contiene una incongruencia entre el hecho tenido por demostrado y la fundamentación intelectiva que efectuó la juzgadora. Al respecto, a lo largo de la decisión adoptada, la jueza sostuvo, en reiteradas oportunidades, que la acción delictiva comprobada consistía en que el encartado cortó un árbol que yacía en la zona de protección y aprovechó ese recurso forestal con un fin económico.
La diferencia que se presenta es sutil, pero relevante, ya que juzgadora en la fundamentación intelectiva no expresó o fundamentó con claridad que el encartado fuera la persona que cortó o taló el árbol en pie que se encontraba en la zona de protección y esta última era la conducta original por la que el actor civil reclamó como causa directa del daño ambiental reclamado, según se desprende de la acción civil instaurada en este proceso (cfr. páginas 491 a la 500). Además, la juzgadora violentó las reglas de la derivación al establecer que el aprovechamiento de la madera era con un fin económico, ya que ese aspecto no se deriva de las declaraciones de los testigos que depusieron en el debate ni de la documental incorporada en autos. Al respecto el oficial de la Fuerza Pública Rodolfo Méndez Castro lo que detalló -según se deriva del sumario de prueba- fue que ese día, llegó al sitio del suceso y observó a Heliodoro Pérez Brenes, cortar un trozo de árbol que yacía en el suelo, además, otras personas estaban tratando de sacar otros fragmentos de madera, mediante cadenas y un tractor.
Por su parte los funcionarios del Ministerio de Ambiente y Energía, Alejandro Alvarado y Orlando Picado, dieron cuenta de la inspección que se realizó al día siguiente del suceso, y de la tasación económica que hicieron sobre el producto forestal. Del sumario de prueba, no se desprende que dichos testigos hayan hecho referencia a qué tipo de ganancia o provecho perseguía el encartado con su actuar delictivo. Por otra parte, el análisis que hizo la juzgadora de la tesis defensiva del enjuiciado, fue escaso, ya que se limitó a indicar que no era creíble dicha versión, sin dar razones que se sustentaran en los medios probatorios incorporados al debate o en argumentos basados en máximas de la experiencia o de la psicología. En este sentido, el justiciable durante la fase plenaria indicó -en síntesis- que Tobías Monestel, fue quien compró la madera a un señor de la zona, y que ellos llegaron a ese sector a petición de Tobías, porque tenían la maquinaria cerca y fueron a ayudarle a sacar los trozos del árbol, pero que no se pudo.
Además, aclaró que cuando llegaron a ese lugar, el árbol ya había sido cortado y se encontraba en el suelo (registro audiovisual 160000260298PE-31082017023541, a partir del minuto 34). Al respecto se tiene que, en el parte policial incorporado en autos, y confeccionado el día de los hechos, los oficiales de la Fuerza Pública habían dejado constancia de que entre las personas que se encontraban en la zona de protección, ejecutando acciones para sacar madera de ese predio, se identificó a uno de ellos como Tobías Monestel Jiménez. Además, de la imputación que efectuó tanto el Ministerio Público, como la Procuraduría General, se describió que Tobías Monestel, era una de las personas que había participado en la actividad delictiva. No obstante, a pesar de que el encartado Heliodoro Pérez Brenes, había dado una explicación del porqué se encontraba en dicho sector y el motivo por el que ejecutó esas acciones, esa tesis defensiva fue descartada sin mayor razonamiento por la juzgadora, y para restarle validez, se basó en una serie de presunciones, tales como que el encartado era quien había alquilado tanto el tractor para sacar dicha madera, y que por esa circunstancia era razonable sostener que iba a obtener un provecho económico con dicho recurso forestal.
Sin embargo, el error en que incurrió la juzgadora, radica en que dicha conclusión no se deriva de la prueba que fue incorporada en autos, ya que en el documento suscrito por Janior Solís Chaves, -dueño de dicho equipo- se indica que ese bien fue alquilado al encartado Pérez Brenes, para realizar trabajos en una finca piñera, y que desconocía por qué motivo estaba en la zona. Por otra parte, en la fundamentación de los extremos civiles, la jueza confundió dos conceptos diversos, uno referente al daño ambiental causado por la corta del árbol, el cual conforme se desprende de la pericia que efectúo el Ministerio de Ambiente y Energía, fue circunscrito a la pérdida de carbono que se ocasionó por la corta del árbol y fue valorado en la suma de 12.178,00 colones, y el otro relativo al valor económico que tiene la madera en el mercado, el cual fue fijado en la suma de 988.562,00 colones (cfr. página 299 del expediente digital en formato pdf-).
El error de la juzgadora consistió en equiparar el valor de la madera con el concepto de daño ambiental, cuando el valor económico del recurso forestal no fue comprendido dentro del daño ambiental que se describió en dicho peritaje. Además, la juzgadora efectuó un análisis insuficiente de la normativa contenida en la Ley Forestal, a fin de establecer si al actor civil le asiste algún derecho que le permita cobrar o recuperar el valor económico que tenía la madera que fue incautada. Al respecto, la normativa forestal tiene una serie de disposiciones relativas al procedimiento que se debe seguir cuando por la comisión de una actividad ilícita se decomisen recursos forestales. En este sentido el artículo 65 de la Ley Forestal indica lo siguiente: Remate de productos decomisados. Las infracciones de esta ley se denunciarán ante la autoridad judicial competente y, si se decomisa madera u otros productos forestales, la referida autoridad, previo avalúo realizado por la Administración Forestal del Estado, los rematará en subasta pública, dentro de un plazo no mayor de un mes contado a partir de la fecha en que se interpuso la denuncia.
Esos productos forestales no podrán subastarse por un valor menor al fijado por la Administración Forestal del Estado. Si transcurrido ese plazo, no se ha rematado la madera o los recursos forestales, cualquier persona podrá aprovecharlos, previo depósito, en el Tribunal, del valor asignado por la Administración Forestal. El producto el remate se depositará en la cuenta de la autoridad judicial correspondiente, mientras se define el proceso respectivo. Si el indiciado resulta absuelto, se le entregará el dinero; en caso contrario, el cincuenta por ciento (50%) le corresponderá a la Administración Forestal del Estado y el otro cincuenta por ciento (50%), a las municipalidades del lugar donde se encuentre el fundo del cual se extrajo la materia prima o donde se ubique la industria o a la asociación de indígenas, si es una en reserva indígena, para destinarlo al desarrollo de proyectos forestales; todo sin perjuicio de las responsabilidades penales que se determinen para los infractores.
Se autoriza al Ministerio del Ambiente y Energía para que, por medio de la Administración Forestal, done al Ministerio de Educación Pública la madera que llegue a su poder como resultado de un desastre natural o por ampliación de carreteras, siempre que los propietarios sean desconocidos. También donará la decomisada, una vez firme la sentencia condenatoria, y que no haya sido adjudicada en remate ni solicitada por persona alguna con los requisitos de ley. El Ministerio de Educación Pública destinará esa madera a fabricar mobiliario o reparar infraestructura en escuelas y colegios públicos o utilizarla como materia prima en las asignaturas de ebanistería, torno, carpintería y otras que impartan escuelas y colegios estatales”. De la anterior normativa se deriva con facilidad que a nivel legal se ha establecido un procedimiento que se debe seguir con los productos forestales que han sido decomisados.
Además, se detalla cuál es el destino que se le debe dar a los recursos económicos que se han generado con el remate de la madera. De igual manera, se especifica que en aquellos casos en que no fuere posible el remate del recurso forestal, o un tercero interesado en obtener dicho bien no lo haya adquirido, según la previsión contenida en dicha norma, la madera decomisada será donada al Ministerio de Educación Pública. De un estudio del expediente digital – en formato pdf- no se advierte que el Juzgado Penal de la localidad en la que se tramitó esta causa, hubiese llevado a cabo el procedimiento del remate regulado por Ley. Tampoco consta si dicho recurso forestal fue adquirido por un tercero, o si el mismo fue donado al Ministerio de Educación Pública. Este aspecto, debió ser analizado por la persona juzgadora de instancia, toda vez que incide directamente en lo concerniente a si la Procuraduría le asistía derecho alguno, para reclamar como daño material el valor de la madera.
Además, nótese que la misma norma dispone que en caso de que el enjuiciado fuera absuelto, tendrá derecho a reclamar el 50% del valor del producto forestal rematado. No obstante, en este caso, como se indicó líneas atrás la juzgadora no analizó la disposición contenida en el numeral 65 de la Ley Forestal, además, tampoco estableció si en este caso se efectuó dicho procedimiento o cuál fue el destino que se le dio a dicho recurso forestal. Por ello resulta procedente declarar con lugar el reclamo planteado. Se anula la sentencia en lo que corresponde a los extremos civiles, y se ordena remitir la sumaria ante el Tribunal de origen, para que en un nuevo debate se resuelven los reclamos civiles planteados por la Procuraduría General de la República.
POR TANTO
Se declara con lugar el primer motivo de apelación interpuesto por la Defensa Pública. Se absuelve de la responsabilidad penal por el delito previsto en el artículo 58 inciso b) de la Ley Forestal, que se le venía atribuyendo al encartado Heliodoro Pérez Brenes. Se declara ineficaz, la orden de comiso que se decretó sobre la motosierra marca Sthil serie 364258977. Se ordena la devolución de dicho bien, a quien, en el plazo de tres meses contados a partir de la firmeza de esta sentencia, demuestre ser el titular de ese objeto. Una vez fenecido el lapso anterior, sin que se realice reclamo alguno, la autoridad jurisdiccional de instancia procederá conforme con las disposiciones contenidas en la Ley de distribución de bienes confiscados o caídos en comiso número 6106. Se declara con lugar el segundo motivo de apelación interpuesto por el defensor público. Se anula la sentencia, en lo atinente a los extremos civiles. Se ordena el reenvío para una nueva sustanciación de ese extremo.
