No. 11 - 2018-II ADMINISTRATIVE AND CIVIL COURT OF THE TREASURY. SECOND SECTION. Second Judicial Circuit of San José. Goicoechea. At nine thirty a.m. on February twenty-seven, two thousand eighteen.- Adjudication proceeding (proceso de conocimiento) declared to involve purely legal issues (puro derecho), brought before this Court by Nombre81316, identification card CED60384- -, of legal age, divorced, “homemaker,” resident of Buenos Aires de Puntarenas; against the INSTITUTO DE DESARROLLO RURAL (INDER), formerly IDA and ITCO. Hereinafter, the Institute. Attorney Alvaro Enrique Alfaro Jiménez represents the plaintiff, and attorneys Nadia Vanesa Rodríguez Rodríguez and Francisco Antonio Villegas Rodríguez represent the defendant.
BACKGROUND
“That the complaint be granted in all respects.
That the appropriate official of INDER be ordered, ipso facto and ipso jure, to process the deed in my favor and record it in the Public Registry, or to authorize Lic. Álvaro E. Alfaro Jiménez, attorney and notary public, to complete the corresponding process, with the Institute being required to provide the relevant information.
That INDER be ordered to pay subjective emotional distress damages (daño moral subjetivo) of an ‘in re ipsa’ nature, as the party responsible for causing me, FOR MORE THAN 21 YEARS, serious and irreparable harm to my personal integrity, health, and psyche.
That INDER be ordered to pay compensation for the losses (perjuicios) caused.
That the defendant be ordered to pay both categories of litigation costs (ambas costas) in this proceeding and that attorney’s fees be set at twenty-five percent, Article four hundred ninety-five of the Código de Trabajo (sic).
That INDER be ordered to pay interest on the amounts awarded.

After the presiding Judge asked whether any adjustments or clarifications were needed, and following the intervention of counsel for the parties, the claims were adjusted and clarified as follows:

CONSIDERING
I.Proven facts and/or background (hechos y/o antecedentes probados). The following are relevant to the resolution of this case, in chronological order:
He points out that the cadastral plan (plano) is P-376827-97, as stipulated in agreement OSSI-460-2010, and not as indicated in the email of December 9, 2013. He also states that, should INDER have problems notarizing the instrument (protocolizar el acto), he requests that the information be provided to him so that he may prepare the deed (escritura), thereby ensuring that the woman has secure title to the property and that the conveyance (traspaso) is completed (image 139 in the PDF of the electronic case file). 12) 2015: On May 28, 2015, Nombre81316 grants a full general power of attorney (poder generalísimo) to her daughter, Nombre81316 (PDF images 145-146 of the judicial case file). By means of a filing dated May 15, received by the Executive Presidency of the IDA on May 29, 2015, Nombre81316 requests that the Executive President order the appropriate person to process the deed in her favor and record it in the Public Registry, or authorize Notary Public Alvaro Alfaro Jimenez to proceed with the corresponding process, with the Institute being required to provide the relevant information (fs. 80-83).
That same day, May 29, 2014, by means of official letter 0SSI-328- 2014, the Head of the San Isidro Territorial Office requested from the Natural Resources Manager of MINAE a series of certifications, including the one required for the titling (titulación) at issue (f. 79). In turn, by Official Letter A-PE-877-2015, dated June 22, 2015, the Executive President forwarded to the Director of the Brunca Region the letter signed by Ms. Nombre81316, “concerning a request for assistance in obtaining a deed, so that he may analyze the case, assist the interested party, and forward a copy of the actions taken to this Executive Presidency.” (f. 84 of the administrative case file). On July 29, 2015, the TITLING FORM (FICHA DE TITULACIÓN) and FIELD INSPECTION (INSPECCIÓN DE CAMPO) were completed again, this time by Alexis Mora Vega, a technician from the San Isidro Subregional Office, and the PARTY DECLARATION (DECLARACIÓN DE PARTE)—by Ms.
Nombre81316—and the TECHNICIAN’S RECOMMENDATION (RECOMENDACIÓN DEL TÉCNICO) were signed (folios 85-88 of the administrative case file; images 122 and 123 of the judicial case file). On August 6, 2015, by means of official letter SINAC-ACLA- P-SRBA-606-2015 from MINAE, MINAE forwarded to the IDA its information regarding the CLASSIFICATION OF THE PROPERTY OWNED BY INDER, CADASTRAL PLAN P-376827-1997. In that document, the Sistema Nacional de Áreas de Conservación states that it “...does not form part of the State Natural Heritage (Patrimonio Natural del Estado), nor is it located within a protected wildlife area (área silvestre protegida)” (f. 89 of the administrative case file). On August 17, 2015, Ms. Nombre81316 signed the ACCEPTANCE FORM FOR PAYMENT OF THE DEBT-BALANCE INSURANCE PREMIUM (BOLETA ACEPTACIÓN DE PAGO DE PRIMA PÓLIZA DE SALDOS DEUDORES) (90 of the administrative case file and image 124 of the judicial case file).
As of September 24, 2015, the property registered under Placa12974 remained recorded in the name of the IDA, along with the mortgage (hipoteca): Creditor, Banco Nacional de Costa Rica. Debtor, Nombre81317 (fs. 92-96 of the administrative case file). That same day, September 24, 2015, by means of official letter OSSI 832- 2015, a TECHNICAL REPORT FOR THE TITLING OF P-116-A-1, GROMACO SETTLEMENT, IN RESPONSE TO DRB-2069-20123 was issued. This time it was prepared by technician Alexis Mora Vega, who states that the error in the plan number entered in MINAE’s certification had been corrected. However, he adds that, because considerable time had elapsed and new procedures for processing property titles (títulos de propiedad) had been adopted, the technical report was updated so that it would comply with Ley 9036, its regulations, and applicable procedures. Among other matters, section 1.1, Parcel Price, states the present indexed value of the parcel: ¢694.075,49.
The report concludes that the awardee (adjudicataria) has satisfied all the requirements for the issuance of a property title. It further states that “...it is recommended that the beneficiary be credited for the years during which she has worked and resided on the parcel from the date it was allocated to her until the present, and that the restrictions be imposed for the remaining years....” The case file was then forwarded to the Regional Directorate for processing before the Deeds and Notarial Services Area (Area de Escriturización y Notariado) (fs. 98-103 of the administrative case file). On October 7, 2015, by means of official letter OSSI- 865-2015, the case file, together with the favorable recommendation of the San Isidro Subregional Office, was forwarded to the Agrarian Coordinator of the Brunca Region for titling. Among other matters, it states: “...it is recommended that the proposed Board of Directors’ resolution for the titling of this parcel provide that it be registered subject to the restrictions of Article 67 of Ley 2825 until November 03, 2023, because seven years have already elapsed since its allocation and it has not been titled due to legal problems not attributable to the awardee, Nombre81316....” It concludes: “According to the information contained in the case file, the awardee satisfies all the legal requirements imposed by current legislation.
Likewise, the parcel to be titled satisfies the established requirements.” (fs.104-108). On October 8, it was received by the Brunca Region Territorial Directorate (f. 104 ibidem). On November 2, 20015, it was reviewed and, by Official Letter DRB-1350-2015—issued that same day, 02/11/2015—the case file was forwarded to the Deeds and Notarial Services Area (fs. 107-107 of the administrative case file). However, on November 06, 2015, by means of official letter DECA-691-2015, the Deeds and Notarial Services Area returned the titling case file because “...The increase resulting from indexation is applied to the land cost, which is not appropriate in this case because the award in favor of Ms. Nombre81316 was approved in 2008. Therefore, the information in SIGA, the titling form, the technical report, and the Regional Director’s Recommendation must be corrected.” (f. 109 of the administrative case file).
Accordingly, on November 9, 2015, official letter DRB - I383 - 2015, ADDENDUM TO OFFICIAL LETTER DRB-1350-2015, was issued as a correction regarding the parcel’s value, which was then set at ¢5.027,38 so that the corresponding process could continue. It states: “In this case, indexation does not apply because the aforementioned parcel was awarded by a Board Resolution, Article 45, at session 039-2008, held on November 3, 2008, before the entry into force of the Regulations to Ley 9036 authorizing that calculation, which were published on April 29, 2015; consequently, that provision cannot be given retroactive effect.” On November 12, 2015, the case file was again received by the Deeds Area (fs. 112-113 of the administrative case file). By means of a filing dated December 15, 2005, submitted to the Executive Presidency on December 18, 2015, Lic. Alvaro E. Alfaro Jiménez, referring to the request submitted on May 29, 2005, asked to be informed of the current status of the proceeding and the exact date of its final resolution (image 125 of the electronic case file). 13) 2016: On May 2, 2016, the “TITLING CASE-FILE REVIEW MEMORANDUM” (“MINUTA DE CALIFICACIÓN DE EXPEDIENTES DE TITULACIÓN”) was prepared in the Deeds Department (fs. 114-119 of the administrative case file).
On May 4, 2016, by means of official letter DECA 191 - 2016, the case file for parcel 116 A 1 was once again returned for correction by the Brunca Regional Directorate. In essence, the following corrections were requested: Matters concerning the valuation and payment for improvements (mejoras). Whether there were any overlap and location problems because a privately prepared plan had been submitted. Correction of SIGA and the titling form to reflect that the parcel would be segregated (segregado) from property 6-71391-000, rather than stating that the parcel had already been separately registered. The mortgage notation appearing on property 6-71391-000 had to be removed. On May 10, 2016, the case file was again received by the aforementioned Directorate (fs. 120-121 of the administrative case file). By Official Letter DRB-474-2016 dated May 13, 2016, Ing. Jean Paul Laurent Lostalo, the Region’s Agrarian Coordinator, was asked to assist so that Lic. Margarita Elizondo could “...urgently conduct the corresponding investigation before the Court handling the collection proceeding (proceso cobratorio) to determine the status of the case—concerning the mortgage—because an amparo proceeding (recurso de amparo) was decided against the IDA, now INDER” (f. 122 of the administrative case file).
On August 3, 2016, Nombre81316 submitted a request to the Executive Presidency: She states that she had appeared on numerous occasions. Some objection had always been raised to prevent resolution of the matter. She considers that this borders on abuse, disrespect, and disregard, as she is an elderly woman who is alone and ill. In light of the lack of interest shown in resolving the matter, she requests that she be informed of the time and date for signing the deed. Otherwise, she states, they will resort to the courts (images 71-75 in the PDF of the electronic case file). On August 22, 2016, by means of OFFICIAL LETTER DRB-924-2016, the Regional Director informed the Executive Presidency about the titling procedure. He points out that: The case is being handled by the Subregional Office. By Official Letter DRB-796-2015, instructions were issued for the case to be handled as a priority. After the requirements—the land-use certification (certificación de uso de suelo) and SINAC certification—were completed, the case file was forwarded on November 9, 2015, to the Deeds Department with a favorable recommendation for processing.
On May 4, 2016, it was returned because of certain problems with the information. On May 13, 2016, it was forwarded again so that the identified deficiencies could be remedied. He further states that the case file had not been reviewed by Legal Counsel when it was sent because that procedure had not yet been implemented; the review was then the responsibility of a technician, who noted the existence of the mortgage lien (gravamen hipotecario). Instructions had already been issued to remove that obstacle, and the request for urgent correction had been reiterated so that processing could continue once the lien was discharged (images 76-77 of the electronic case file). By Official Letter PE-1093-2016, dated September 1, 2016, the Executive Presidency responded to Nombre81316’s request of August 3, 20016. She was informed of OFFICIAL LETTER DRB-924-2016, issued by the Regional Director, which, it states, demonstrates the efforts undertaken to bring the matter to a satisfactory conclusion.
It found no inaction, arbitrariness, abuse of authority, or incompetence. It concludes by stating that copies would be sent to the Subregional Office so that it could expedite the procedures (PDF images 68, 69, and 70 of the principal case file). On the same date—September 1, 2016—a certification was received stating that Nombre81317 was not indebted to Banco Nacional (f. 123 of the administrative case file). On September 8, 2016, by Official Letter OSSI-987-2016, a CLARIFICATION REGARDING THE APPRAISAL OF IMPROVEMENTS IN TITLING REPORT P-116-A-1 was issued. Following its supporting explanation, it concludes that an appraisal of improvements was not appropriate. The first page of the titling form was submitted to correct the information entered incorrectly in SIGA. It also states that the parcel’s value had been corrected and updated. It requests that the procedure continue (fs. 124-127).
On September 9, 2016, Nombre81316 submitted a request to the Executive Presidency: She requests a copy of the administrative case file and that administrative remedies be deemed exhausted (agotada la vía administrativa) (image 67 of the electronic case file). On September 13, 2016, by Official Letter PE-1170-2016, the Executive Presidency referred Ms. Nombre81316 to the Regional Directorate, where the case file was located, so that it could provide her with a copy (image 66 of the principal case file). On the same date—September 13, 2016—the aforementioned Official Letter PE-1093-2016 was sent to her (PDF images 68, 69, and 70 of the principal case file). On September 20, 2016, by official letter AJRBA 440 - 2016, an internal request was made for the urgent appointment of Notary Public Jorge Campos to execute the deed discharging the lien imposed on the property (folios 128 and 129 of the administrative case file).
At Ordinary Session 36, held on 10 de octubre del 2016, the Board of Directors of INDER authorized Notary Jorge Campos to execute the deed canceling the mortgage lien (gravamen hipotecario) on the property (p. 132 of the administrative record). By Official Letter DBR-1535 - 2016, the record was forwarded again to the Departamento de Escrituración y control Agrario (See folio 144). On 12 de octubre del 2016, Nombre81316 filed the claim at issue with the court (pp. 98-105 of the main record). In the initial ruling issued at 11:11 on 31 de octubre de 2016, the following was ordered, insofar as relevant: “... given that the claim filed seeks to challenge an omission by the Administration (conducta omisiva de la Administración); pursuant to Article 35 of the Código Procesal Contencioso Administrativo, and with the proceedings stayed, the Instituto de Desarrollo Rural is granted a period of FIFTEEN BUSINESS DAYS to perform the required action.
It is advised that, if it does so, the proceedings shall be deemed concluded without a special award of costs, unless their continuation is necessary to fully restore the legal position of the injured person. It is further advised that if, upon expiration of that period, the alleged omission continues in whole or in part, the proceedings shall continue without the need for a ruling so ordering....” (image 97). This ruling was served on INDER on 11 de noviembre del 2016 (folios 133 to 136 of the administrative record). By Official Letter DRB 1501 2016 dated 1 de diciembre de 2016, it was reported—internally—that the “deficiencies” had been corrected, and therefore the record could be forwarded to the Departamento de Escriturización for the titling process (trámite de titulación) (folio 139 of the administrative record). By Official Letter DBR-1535-2016, dated 7 de diciembre de 2016, the record was forwarded again to the Departamento de Escrituración y control Agrario.
It was requested that the restrictions on the parcel (limitaciones al predio) be established as of the allotment (asignacion), pursuant to the allotment resolution, Article 45, of Ordinary Session 039- 2008, held on 03 de noviembre de 2008 (p. 144 of the administrative record). On 9 de diciembre de 2016, by Official Letter AT-1038-2016, the Area de Topografía issued its report on the findings concerning plans P-942588-91 and P-376827-97 and property 71391 (image 64). 14) 2017: By Deed No. 123, executed before INDER Institutional Notary Jorge Danilo Campos Herrera at 12:30 on 8 de marzo del 2017, the Institute transferred the real property Dirección8739, - - to Nombre81316. The fifth clause, concerning the restrictions, stipulated: “Pursuant to Articles sixty-six and sixty-eight of Law twenty-eight twenty-five and Article sixty-six of Law ninety thirty-six, this contract has been effective since 3 de noviembre del dos mil ocho, pursuant to Article forty-five, Ordinary Session thirty-nine -dos mil ocho; accordingly, the restrictions on title (limitaciones al dominio) referred to in Article sixty-seven of Law two thousand eight hundred twenty-five commence on that date and not on the date of this contract. ...” (images 33, 34, and 35 of the electronic record).

ENCUMBRANCES OR RESTRICTIONS> YES ... INDER RESTRICTIONS (LAW 9036 ... COMMENCES ON 03 DE NOVIEMBRE DE 2008 ENDS ON 03 DE NOVIEMBREDE 2023.... (images 28 to 32 in the PDF of the electronic record). The parties so informed the court through briefs filed on 24 y 28 de marzo del 2017 (images 26, 27, and 36 of the electronic record).
II.Unproven facts and/or background. For purposes of the present action, the following are relevant: 1) That she acquired the property in January 1995 without having been informed or made aware that she was acquiring a parcel that had been an ITCO project (the case record). 2) She cannot read or write (the case record). 3) She has received threats intended to make her leave the property (the case record). 4) That a land-use permit (uso de suelo) was pending in 2002 (the case record). 5) That the Executive Presidency merely referred the matter elsewhere in 2015 (the case record). 6) That the Constitutional Chamber (Sala Constitucional) specifically ordered that the property be registered in her name (the case record). 7) Lack of a response to the formal request (excitativa) of August 3, 2016 (the case record). 8) INDER is awarding it to an Association (the case record). 9) Since 1995, she has appeared before the Institute to request recognition of her right (the case record). 10) The property was not awarded to her by the Institute; rather, she purchased it from third parties and did so in good faith (the case record).
III.Subject Matter of the Proceedings and the Court’s Reasoning: Following an analysis of the parties’ allegations and evidence during the proceedings—the complaint and the response thereto, to which we refer—it is clear that, because subsequently, specifically at 12:30 p.m. on March 8, 2017, INDER finally issued a decision and ordered execution of the deed, which was registered in the Public Registry in the plaintiff’s name—as admitted and shown in the record—Ms. Nombre81316’s original claim seeking an order requiring the Institute to process and register the deed in her favor in the Public Registry and/or to authorize her attorney to do so became moot. Therefore, by virtue of the plaintiff’s and the Judge’s reformulation—and establishment—of the claims, the subject matter of this dispute now consists of determining whether the Institute should be ordered to pay subjective moral damages (daño moral subjetivo), estimated at ¢30.000.000,oo, plus interest; whether the encumbrance (gravamen) imposed on the property in transfer deed 123, executed by Notary Danilo Campos Herrera on March 8, 2017, should be lifted; and, finally, whether the defendant should be ordered to pay legal costs (costas).
In response, the representative of Ms. Nombre81316 ARGUES, in essence, that: Based on the allegations in the complaint and the evidence submitted, the harm caused to the plaintiff is clear and compelling, as she acquired this property in good faith in 1995 and thereafter appeared before the Institute to seek recognition of her right. It is very clear that the property was not awarded to her by the Institute; rather, she purchased it from third parties, and she made the purchase in good faith. He asserts: This is important for the Court because it was a good-faith transaction and the situation arose between third parties, not with the Institute. Although they had to sue INDER, this was due to the negligence of the Institute’s authorities in deciding—and deciding—a matter that had been resolved in the plaintiff’s favor long before. He reads Article 45 of ordinary session 039- 2008, dated November 3, 2008, of the IDA Board of Directors, in which Nombre81316 was declared eligible for the land-allocation program under the parcel modality and was awarded parcel N° 116-A-1 of Asentamiento Gromaco; that decision was transcribed to the plaintiff by Official Letter 0SSI -460, dated September 24, 2010.
He then asserts: This means that if the award of this property—which the plaintiff had acquired from a third party—was approved as early as 2010 (sic), and she was unaware of the conditions inherent to it because she cannot read or write, it is inconceivable that, so long after filing the Recurso de Amparo in 2006, after it was decided in her favor, and after various efforts were made over time through several attorneys, the Institute had still failed to issue a decision. Today it remains the same institution and must “shoulder” responsibility for the actions of its predecessors. That is indisputable. It is clear that the plaintiff was born on January 7, 1941, and is 76 years old; the property was made subject to a 15-year restriction beginning on November 3, 2008, and ending on November 3, 2013. He asks: Why encumber that property as of November 3, 2008, if she had been pursuing the matter since acquiring it in 1995?
Why harm her in that way? He asserts that “it just does not make sense.” Although the Law has a very clear and commendable purpose—in his view—it is not applicable to the plaintiff in the case at hand because she did not purchase the property from INDER, she purchased it many years ago, and the various efforts undertaken over time demonstrated that the plaintiff was acting in good faith so that the procedure could be corrected and she could make proper use of that property. And not until 2017, when they executed the deed and imposed an encumbrance effective from 2008—that is, he says, it is counterproductive, because when she becomes entitled to dispose freely of the property she will be 82 years and 10 months old, and she is a very ill woman. She is not someone who comes here to the Court ... (sic); rather, she has attended despite health limitations over time and is very concerned that she may “pass away” and that the property may be left “adrift.” It is very important for the Court to take that into consideration.
He submits that the principle of free disposition of property applies. There is no reason why a woman who purchased a property in good faith in 1995 should have it encumbered so that she cannot dispose of it and must wait several more years to do so freely. In light of what they are asserting, it is very important that the complaint be granted in its entirety and that an award be entered for the moral damages, which have been excessive and abusive. This is established in the record. And all claims should be granted, including the lifting of that encumbrance. He asserts: Although the law so provides, “okay,” apply the law properly and take into account that this proceeding has been under way since 1995, when she purchased the property; it did not begin in 2017, when the deed was executed. He asks: Why was the deed executed? Because they had to resort to the Court to defend the plaintiff’s rights, given that her requests had fallen on deaf ears over time.
It is inconceivable that, after so much time and the involvement of 3 or 4 attorneys who participated in this matter in an effort to assist her, the deed was executed and the property transferred in the plaintiff’s favor only now—after they sought judicial intervention. Why did they wait so long? In his view, the Administration has no right to harm those subject to its authority in such a manner. Had such a situation not arisen, they certainly would not be here. Because the plaintiff had neither the intention nor the desire to appear before the courts to assert her rights. That is precisely why they seek payment of costs, as provided in a decision issued by the same Court, which gave INDER 15 days to complete its procedure; it did not do so and must therefore be ordered to pay costs. And all claims currently being asserted, which were approved through the review of the proceedings, should be granted.
He therefore appeals to the Court to grant the complaint and the claims of the plaintiff, who has been the only party harmed during the 23 years to date. In response, the representative of the Institute ARGUES, in summary, that: The decision issued at 11:11 a.m. on October 31, 2016, serving notice of this complaint, clearly states that the subject matter is that “the appropriate official at INDER be ordered ipso facto and ipso jure to process the deed in my favor and register it in the Public Registry,...” From that moment, it has been clear that the central and principal objective is to have INDER issue title to the property in favor of the plaintiff, who claims to hold the corresponding right. He reads the provisions of Article 197. 1) of the CPCA. In this case, based on both the complaint and the response thereto, it is accepted as true and clear that the principal claim to be satisfied here is the issuance of title in the plaintiff’s favor.
In this case, Dirección8740. This essential claim or objective—notwithstanding and with due respect for the statements of the plaintiff’s representative—has been satisfied and was completed in March 2017, as is clearly demonstrated in the record. She now possesses a deed executed in accordance with the formalities established by the Law for such purposes. Accordingly, he submits that there would be no further interest in concluding or continuing this hearing and that the consequences connected with or ancillary to this basis or principal claim ... would likewise provide no grounds for ordering the Institute to pay costs, for one thing. Within the same background circumstances, which, according to the documents submitted by the plaintiff, date back to 1995, the situations described from 1995 through 2008 involved relationships between the plaintiff and third parties. That is, she claims to have acquired possession (posesión) from those third parties.
The fact is that, even as part of the background to what may be called the administrative due process (debido proceso administrativo) followed in this matter, this was among the grounds justifying the original possessors being declared—so to speak—“non grata” to retain possession under the existing legal conditions, and that is indeed shown in the administrative record (expediente administrativo) and is also described in the account set forth in the complaint. It is therefore important that we not take into account those events from 1995 to 2008, at least insofar as the Institute is concerned, because they are unrelated to it with respect to the relief sought. He then provides the following chronology: On February 4, 1991, the original award and transfer were approved. On July 26, 2004, they were revoked. Until that time—he asserts—the relationship was between third parties, and the Institute had no involvement in that relationship.
On May 30, 2006, once the revocation proceeding had concluded, the proper course, before the Institute could dispose of the parcel, was for it to appraise and pay for the improvements (mejoras). Subsequently, on November 31, 2008, the plaintiff was declared eligible for the titling program and was awarded the parcel. On December 9, 2010, the Allocation Agreement (Contrato de Asignación) was signed. It became effective as of that date. From that moment—2010—the procedures and legal requirements then in force for titling began: On October 2, 2011 (sic), the Field Worksheet (Planilla de Campo) was prepared. The land classification (Clasificación del terreno) was then requested from MINAE, a body independent of the Institute. The response was received on May 4, 2012. However, there was an error in the survey-plan number. On May 8, 2013, the legally required evaluation of the probationary period (período de prueba) was conducted.
On November 1, 2013, the legally required inspection was conducted. On November 12, 2013, the titling form (ficha de titulación) was completed and the technical report was prepared. The file was forwarded to the Subregional Office. On November 13, 2013, it was forwarded to the Agricultural Coordinator for titling because the requirements had been met. However, on November 25, 2013, it was returned because of the error in the MINAE certification. This had to be corrected before the process could continue. On May 29, 2004, the MINAE certification was requested. On June 29, 2015, the titling and field-inspection form was completed again. The certification was not received from MINAE until August 6, 20015. One month later—September 24, 2015—the Technical Report for Titling was issued. Because new procedures existed, it became necessary to issue those requirements. On October 7, 2015, the file was forwarded to the Regional Coordinator for titling.
As to the remainder—he states—he relies on the record. He asserts: All actions historically identified were lawful and taken in accordance with the applicable regulations, and many of the delays, periods of inactivity, or waiting associated with those actions did not result from arbitrary conduct by the Institute or depend exclusively on it; rather, many were contingent upon or awaiting decisions by other agencies, such as SINAC and even Banco Nacional de Costa Rica. It is indeed very regrettable that—in the plaintiff’s bad faith, in his view—she unfairly alleges in paragraph 4 of her complaint that she has been threatened in order to force her off the land, etc. The Institute has never acted in that manner.
Therefore, it is important to make clear that there has not been, nor could there even be, any subjective non-pecuniary harm (daño moral subjetivo) in this matter. There are many very important references to dates, but, just as the record shows—as occurred with the submission of the plaintiff’s attorney’s special power of attorney—there is a substantial lack of evidence supporting the assertions made here, which he hopes the Court will duly assess. These assertions do not provide a certain and valid basis for the plaintiff’s arguments regarding her claims, which may therefore lack the legal weight or rigor required for them to be granted. He requests that the complaint be dismissed in its entirety and that the Institute be exempted from any award of costs, subjective non-pecuniary harm, and any other relief sought. Court’s assessment: Having analyzed the parties’ arguments and reviewed the evidence in the record, the Court determines—in accordance with the claims reformulated and relief requested at the Preliminary Hearing—that the Institute should be ordered to pay subjective non-pecuniary damages to Nombre81316, for the reasons set forth below, although not in the disproportionate amount of ¢30.000.000,oo, but rather in the reasonable amount of ¢1.000.000,oo.
Likewise, for the reasons set forth below, it is improper to lift the encumbrance (gravamen) imposed on the property in transfer deed 123 executed by Notary Danilo Campos Herrera on 8 de marzo del 2017; and, finally, the defendant should be ordered to pay costs. Consequently, its exemption from costs is improper. Let us examine the matter: Regarding the claim seeking an order requiring the Institute to pay subjective non-pecuniary damages to Nombre81316: In Considerando IV. of judgment 2006-14393, issued at 16:06 hours on 27 de setiembre del 2006 by the Sala Constitucional, which decided the amparo proceeding (recurso de amparo) in favor of Nombre81316, it was stated: “Article 41 of the Constitución Política enshrines the principle of prompt and effective justice, which, in the case of the Public Administration, translates into its obligation to process and decide the various matters submitted for its consideration within a reasonable period and, additionally, to notify the applicants of the corresponding action; otherwise, one of the fundamental rights enjoyed by every citizen would be violated.
In other words, as this Chamber has repeatedly held, to prevent the complainant’s right from being rendered ineffective, the decision must be made within a period that is reasonable and appropriate to the type of complaint filed. In the matter before us, this Chamber deems it established, based on the evidence submitted in this case file and the reports rendered under oath, that the protected party, by a written submission received by the Instituto de Desarrollo Agrario on veinticinco de enero de dos mil dos, filed an application to annul the allocation (adjudicación) made in favor of Nombre81317 and Nombre81318 and an application for allocation in her favor. Likewise, by means of a written submission filed with the Board of Directors of that Institute on veintisiete de abril de dos mil cinco, the protected party renewed her application. This Chamber considers that, although the respondent authority could not process the protected party’s application for allocation until the revocation proceeding (procedimiento de revocatoria) had concluded—which did not occur until tres de mayo de dos mil seis—after which the appraisal of improvements continued and was completed in julio de dos mil seis, the time elapsed between the filing of the appellant’s application in dos mil dos and the filing of this amparo proceeding is excessive, arbitrary, disproportionate, and therefore violative of the protected party’s fundamental rights.
This Chamber has repeatedly held that a lack of resources does not justify delays in processing applications filed by private parties before the Administration, and therefore the respondent authority’s argument cannot be accepted. Moreover, the fact that the protected party’s parcel is located in such a remote area means that the respondent authority had even greater reason to notify her, at the place designated for receiving notices, of the date of the visit, so as not to delay the proceeding further, as in fact occurred. Accordingly, the proper course is to grant this amparo proceeding for violation of the right to prompt and effective justice enshrined in Article 41 of the Constitución Política, as is hereby ordered.” There are specific statutory provisions governing the Institute’s authority to grant parcels and revoke allocations, the requirements beneficiaries must meet, their rights and obligations, and the procedures for applying those provisions.
Nevertheless, administrative procedures (procedimientos administrativos) governed by special sectoral laws—such as those established in the laws concerning INDER, formerly IDA, and ITCO—cannot disregard or exempt themselves, in their application, from the general principles of economy, simplicity, promptness, and efficiency, which are intended to prevent serious and unjustified delay and the suspension of proceedings, as provided in a framework statute on the subject, namely the Ley General de la Administración Pública, which states, for example, that: The administrative procedure shall serve to ensure the best possible fulfillment of the Administration’s purposes, with due regard for the private party’s individual rights and legitimate interests, in accordance with the legal system. Its most important purpose is to ascertain the substantive truth of the facts underlying the final decision.
The body shall conduct the proceeding with the intention of achieving the greatest possible promptness and efficiency, while respecting the legal system and the private party’s rights and interests. The Administration and the public servant shall be liable for any serious and unjustified delay. The administrative procedure must be concluded by a final decision within two months after its commencement or, as applicable, after the private party files the claim or petition, unless otherwise provided by this Law. Administrative action shall be conducted in accordance with standards of economy, simplicity, promptness, and efficiency. The senior authorities of each office or agency shall ensure that their subordinates fully comply with this rule, which shall also serve as an interpretive criterion in applying procedural rules. A complaint may be filed at any time regarding procedural defects, particularly those involving suspension of proceedings, violation of mandatory deadlines, or omission of steps that may be remedied before the final disposition of the matter.
Still less may substantive legal principles be disregarded, such as the following: The Administration shall be liable for all damage caused by its lawful or unlawful, normal or abnormal operation, except in cases of force majeure, fault of the injured party, or an act of a third party. In all cases, the alleged damage must be actual, quantifiable, and identifiable in relation to a person or group. Liability may arise for harm to purely non-pecuniary interests, as well as for emotional suffering and physical pain caused by death or injury, respectively. That said, notwithstanding her assertions, the plaintiff failed to prove: that she acquired the property in enero de 1995 without having been informed or becoming aware that she was acquiring a farm that had been an ITCO project. To the contrary, on 1 de octubre de 2013, Nombre81316 signed a SWORN STATEMENT—before witnesses—stating that she acquired the land beginning in enero de 1997 and that the existing improvements had been made by her and her son, Nombre81319.
That she is unable to read or write. That she received threats intended to make her leave the property. That the Sala Constitucional specifically ordered that the property be registered in her name. That the Executive Presidency merely referred the matter elsewhere in the year 2015. That there was no response to the formal request for action (excitativa) of 3 de agosto de 2016. That the Institute was allocating the parcel to an Association. That she appeared before the Institute beginning in 1995 to request recognition of her right. And that the property was not allocated to her by the Institute. Nevertheless, it is likewise untrue—as the defendant asserts—that the Institute’s relationship with the plaintiff began in and/or as of the year 2008, since the proven facts and background establish that, on 25 de enero del 2002, Nombre81316 filed an application to annul the allocation made in favor of Nombre81317 and Nombre81318 and an application for allocation in her favor.
Likewise, by means of a written submission filed with the Board of Directors of that Institute on 27 de abril de 2005, she renewed her application. It is true that the Institute could not process the application for allocation—and issuance of title (titulación)—filed by Ms. Nombre81316 until the revocation proceeding had concluded, which did not occur until 26 de julio de 2004, when the Institute issued the final decision revoking the allocation of the parcel and authorized notice to the Registro Público of the nullity of the title registered under property record Placa12973, the cancellation of the restrictions, and the reversion of the property to the IDA. This was especially so once the affected parties had been served by publication, without filing the corresponding appeals against that decision. This finally occurred on 30 de marzo de 2006, which is the date on which the reversion of the property was registered with the Registro Público (folio 94 of the administrative record).
Nevertheless, there is no explanation or justification for the fact that it was not until 3 de noviembre de 2008—TWO YEARS AND SEVEN MONTHS LATER—that the allocation of parcel N° 116-A-1 of Asentamiento Gromaco to her was ordered. This constitutes a negligent suspension of proceedings. STILL LESS is there any explanation or justification for the fact that it was not until 9 de diciembre de 2010—TWO YEARS AND ONE MONTH LATER—that the parties signed the “LAND ALLOCATION AGREEMENT.” This likewise constitutes a negligent suspension of proceedings. Indeed, that document expressly acknowledges that the agreement was signed on that date because of the IDA’s delay in executing it. As the adage states: “An admission by a party dispenses with the need for evidence.” It is true that this agreement marked the beginning of a two-year probationary period (período de prueba). It would therefore expire on 9 de diciembre del 2012.
This explains why the process of verifying compliance with the requirements for issuance of title resumed and was conducted in that year, 2012, and during the year 2013. Those requirements included: CERTIFICATION OF THE PROPERTY’S CLASSIFICATION BY SINAC, OF MINAE; the FIELD FORM FOR DETERMINING LAND-USE CAPABILITY; the APPROVAL OF THE CERTIFICATION OF CONFORMING USE, issued by INTA; PROBATIONARY-PERIOD ASSESSMENT; SWORN STATEMENT OF THE DATE OF ACQUISITION AND OWNERSHIP OF THE IMPROVEMENTS; PARCEL INSPECTION; TITLE-ISSUANCE FORM containing the PARTY’S STATEMENT and the TECHNICIAN’S RECOMMENDATION; and the TECHNICAL REPORT—including the recommendation—concerning the property for which title was to be issued. Nevertheless, there is no explanation or justification for the failure to take any action in the title-issuance file throughout the entire year 2014. This constitutes a negligent suspension of proceedings.
It may be accepted that the title-issuance procedure includes requirements that are not within the Institute’s purview or jurisdiction, e.g., certification of conforming land use by INTA or certification of the Property Classification by SINAC, for whose errors or delays the Institute is not necessarily responsible.
It may be accepted, in this regard, that the error concerning the survey plan number in the first MINAE certification delayed the proceeding to such an extent that a new certification of the Land Classification (Clasificación del terreno) had to be requested from SINAC and, as a consequence, requirements such as those already noted had to be repeated in subsequent years—2015 and early 2016—because considerable time had elapsed. This was expressly acknowledged in official letter OSSI 832- 2015, dated 24 de septiembre de 2015—REPORT FOR TITLING (INFORME PARA TITULACIÓN) P-116-A-1, ASENTAMIENTO GROMACO, IN RESPONSE TO DRB-2069-20123—in the sense that the error in the survey plan number stated in the MINAE certification had already been corrected. Nevertheless, it was added that, because considerable time had elapsed and new procedures were in place for processing property titles, the technical report would be updated so that it complied with Ley 9036, its regulations, and the applicable procedures.
However, there is no explanation or justification as to why the Institute did not identify that error in a timely manner, resulting in wasted resources and valuable time to the detriment of the plaintiff. This constitutes delay, sluggishness, and waiting due to negligence. It may also be accepted that, within the titling procedure (procedimiento de titulación), it became necessary to request certification from Banco Nacional de Costa Rica regarding an existing mortgage debt and, as a preliminary matter, to proceed with the discharge of the mortgage (cancelación hipotecaria). This caused delay during 2016. However, there is likewise no explanation or justification as to why the Institute did not identify that registry impediment (impedimento registral) in a timely manner, resulting in wasted public resources and valuable time to the detriment of the plaintiff. This is particularly so because two registry reports included in the case file (expediente), dated 12 de noviembre de 2013 and 24 de setiembre del 2015, had indicated since then that the property recorded under registration number Placa12974, registered in the name of IDA, was subject to a mortgage and identified the creditor and debtor.
Nor is there any explanation or justification as to why the Institute did not identify in a timely manner the error noted by the Deed Preparation Department (Departamento de Escriturización) in noviembre del 2015 concerning the indexing increase applied to the land cost, which had to be corrected. Nor is there any explanation or justification as to why the Institute did not identify in a timely manner the other deficiencies noted by the Deed Preparation Department in mayo del 2016, which had to be clarified or corrected, such as: matters concerning the valuation and payment for improvements; whether there were overlap and location issues because a privately prepared survey plan had been submitted; and correcting the SIGA system and the titling record to indicate that the parcel (predio) would be segregated from property Placa12976, rather than that the parcel had been separately identified, resulting in wasted public resources and valuable time to the detriment of the plaintiff.
There was also, as noted, the deficiency concerning the mortgage encumbering the property. That abnormal operation—such suspension during certain periods; the serious and unjustified delay during other periods of the proceeding; and, in general, that excessive and abusive delay, sluggishness, or waiting—the Court finds, caused negative emotions of distress and uncertainty, including anger, in Nombre81316, which she had no duty to endure and which provides legal grounds for ordering the Institute to pay subjective non-pecuniary damages (daño moral subjetivo) to her, though not in the disproportionate and unjustified amount of ¢30.000.000,oo sought, but rather in the reasonable and equitable amount, under the circumstances, of ¢1.000.000,oo, together with statutory interest on that amount until fully paid; not, however, from the filing of the complaint, but from the date this judgment becomes final, because this ruling is constitutive rather than declaratory in nature.
The claim seeking the removal and discharge of the encumbrance (gravamen) imposed on the property in transfer deed 123 executed by Notary Danilo Campos Herrera on 8 de marzo del 2017 is denied because it is legally unfounded. Let us examine this issue: Through Article 45 of ordinary session 039- 2008 of the IDA Board of Directors, held on 3 de noviembre de 2008, it was ordered: “To accept the recommendation contained in official letters ASF-622-08 and DRB-1542-2008, signed by the Family Selection Area of Dirección Región Brunca, and on that basis it is resolved: 1. To declare Nombre81316, identity card CED60385, eligible for the land-allocation program under the parcel modality because she obtained a score higher than that established in Article 10 of the Autonomous Regulations for the Selection and Allocation of Land Applicants (Reglamento Autónomo para la Selección y Adjudicación de Solicitantes de Tierras), (66 points), and presents no grounds for disqualification.
She is likewise awarded parcel N° 116-A-1 of Asentamiento Gromaco, with an area of 3 ha. 5.206.86 M2, according to registered cadastral survey plan P-376827-97, located in Dirección8738, Provincia de Puntarenas, acquired with the Institute’s own funds. 2. It is established that Dirección Región Brunca and Oficina Subregional San Isidro must ensure compliance with Articles 24, 31, 32 and 37 of the Autonomous Regulations for the Selection and Allocation of Land Applicants. 3. Pursuant to resolution No. 42 of Ordinary Session 027-2008 of 4 de agosto del 2008, it is stated that, in this case, IDA neither valued nor paid for improvements within this parcel.” Now, Nombre81316 signed a SWORN STATEMENT (DECLARACIÓN JURADA)—before witnesses—dated 1 de octubre de 2013, stating that she acquired the land beginning in enero de 1997 and that the existing improvements were made by her and her son Nombre81319, which rules out, on the one hand, that she acquired it in enero de 1995, as she alleged in the complaint.
Moreover, even accepting that she acquired it from third parties, there can be no doubt that it was an unlawful sale, to such an extent that this—together with abandonment—constituted grounds for revoking the original allocation to those third parties. Nor can it be denied that, as a consequence of the foregoing, the property was allocated to her by the Institute on 3 de noviembre de 2008, as we have just seen. Article 66 of Ley No 9036 of 11/05/2012, which Transforms the Instituto de Desarrollo Agrario (IDA) into the Instituto de Desarrollo Rural (INDER) and Creates the Secretaría Técnica de Desarrollo Rural, effective since 30 de noviembre del 2012, provides: “ARTICLE 66.—Restrictions: The allottee or allottees may not transfer title to their parcel, encumber it, lease it, or subdivide it without prior authorization from Inder, unless fifteen years have elapsed from the act allocating the land and all obligations owed to Inder have been paid.
During that same period, such parcels may not be subject to any type of judicial, provisional, or enforcement measures by third parties or creditors, unless such credits, debts, or obligations have been authorized by Inder. Any contract entered into without compliance with the foregoing provisions shall be absolutely null and void. Once the fifteen years have elapsed and ownership rights have vested, Inder shall have a right of first refusal to purchase, at the price established by the appraisal performed by the Dirección General de Tributación, to prevent any transfer of the land that could result in undue concentration or excessive subdivision of the property. The Registro Nacional shall record the restrictions referred to in this article.” (boldface and underlining supplied). Similarly, Article 67 of Ley No. 2825, Ley de Tierras y Colonización (ITCO INDER), dated 14 de octubre de 1961, which remains in force insofar as it does not conflict with the preceding Law, with its principles prevailing even in the event of doubt between the two, provides: “Article 67.—The beneficiary may not transfer title to the parcel, encumber it, lease it, or subdivide it without authorization from the Institute, unless fifteen years have elapsed since acquisition of the parcel and all obligations owed to that entity have been paid.
Nor may the beneficiary, without such authorization and during the same period, encumber the crops, seeds, animals, furnishings, implements, or equipment necessary for operating the parcel, unless all obligations owed to the Institute have been paid. Authorization to encumber the real property requires four concurring votes of the Board of Directors. Any contract entered into without compliance with the foregoing provisions shall be absolutely null and void. Once the fifteen years have elapsed and the ownership right has been acquired, any transfer of a parcel that, in the Institute’s judgment, could result in excessive concentration or subdivision of property shall entitle the Institute to acquire the parcel or parcels offered for sale at the price determined by the experts appointed by the parties or, in the event of disagreement, by a third expert. This third expert shall be appointed by the other two experts.
The Registro Público shall record the restrictions referred to in this article.” (boldface and underlining supplied. Source: Sistema Costarricense de Información Jurídica). This legally explains and justifies the following provision in the “LAND ALLOCATION AGREEMENT” (CONTRATO DE ASIGNACIÓN DE TIERRAS), signed by the parties on 9 de diciembre del 2010: “SECOND: The allocation of the property is subject to the restrictions and limitations stipulated in Articles sixty-six, sixty-seven, and sixty-eight of the law (sic) under the aforementioned Ley de Tierras, as well as the provisions of the aforementioned Regulations. (...) THIRTEENTH: Both parties clarify and establish that this agreement is signed on this date due to IDA’s delay in executing it, but that, for purposes of oversight and compliance with the requirements for the eventual issuance of title, ‘THE ALLOTTEE’ has occupied the property covered by this agreement since the allocation made by the Board of Directors.” It also explains and justifies why the REPORT FOR TITLING P-116-A-1, ASENTAMIENTO GROMACO, IN RESPONSE TO DRB-2069-20123, official letter OSSI 832-2015, dated 24 de septiembre de 2015, stated, among other things, that “...it is recommended that the beneficiary be credited with the years during which she has worked and resided on the parcel from its allocation to the present date and that the restrictions be imposed for the remaining years....” (boldface and underlining supplied).
It likewise explains and justifies why official letter OSSI- 865-2015, dated 7 de octubre de 2015, stated, among other things, that “...it is recommended that the proposed resolution of the Board of Directors concerning the titling of this parcel provide that it be registered subject to the restrictions of Article 67 of Ley 2825 until 03 de noviembre de 2023, because seven years have already elapsed since its allocation and it has not been titled due to legal issues not attributable to the allottee Nombre81316....” It further explains and justifies why the Agreement for the Transfer of the real property Asentamiento Gromaco, Dirección8741 - -, in favor of Nombre81316, titling deed No. 123, executed before INDER Institutional Notary Jorge Danilo Campos Herrera at 12:30 hours on 8 de marzo del 2017, provided: “Fifth, regarding the restrictions: ‘In accordance with Articles sixty-six and sixty-eight of Ley veintiocho veinticinco and Article sixty-six of Ley noventa treinta y seis, this agreement is effective as of three de noviembre del dos mil ocho, pursuant to Article forty-five, ordinary session thirty-nine -dos mil ocho; accordingly, the restrictions on title referred to in Article sixty-seven of Ley dos mil ochocientos veinticinco commence on that date and not on the date of this agreement. ...’” And consequently, the registration entry—dated 27 de marzo de 2017—with License Plate Registration No. 12975 and Survey Plan: P-0376827-1997, must provide public notice in the Registro Público of the following: “ENCUMBRANCES or RESTRICTIONS: YES ...
INDER LIMITATIONS Ley 9036 ... BEGINS 03 DE NOVIEMBRE DE 2008 ENDS 03 DE NOVIEMBRE DE 2023....” (boldface and underlining supplied). The remaining objections concerning the plaintiff’s age and her concern regarding the disposition of the property after her death are rejected as unfounded, since both Article 68 of Ley No. 9036, of 11 de mayo de 2012, and Article 69 of Ley No. 2825 of 14 de octubre de 1961 establish rules governing administrative succession (sucesión administrativa) to the individual allotment agreement (contrato de asignación individual), and succession in the event of the beneficiary’s death before the conditions specified in Article 67 of Ley No. 2825, Ley de Tierras y Colonización (ITCO INDER), of 14 de octubre de 1961, have been met. All of the foregoing is deemed sufficient to dismiss—and the Court accordingly shall reject—the claim at issue.
IV.Regarding costs. In accordance with section 193 of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo), litigation costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed on the unsuccessful party by virtue of having lost. In this case, that party is INDER, due to the order requiring it to pay subjective moral damages (daño moral subjetivo) caused to Nombre81316 by the unjustified delay in the titling proceeding (procedimiento de titulación). This is in no way due to its failure to execute or register the title deed (escritura de titulación). The exemption provided for extrajudicial satisfaction (satisfacción extraprocesal) under article 197 of the CPCA is not deemed applicable in this regard. This is particularly so because, procedurally, the expediente contains no ruling to that effect declaring the proceeding terminated.
Waiver of this award is feasible only when, in the Tribunal’s judgment, there was sufficient cause to litigate or when the judgment is rendered based on evidence whose existence was unknown to the opposing party. In this case, this collegiate body finds no reason to apply the exceptions established by the applicable rules and depart from the principle that costs are awarded against the unsuccessful party. Accordingly, both litigation costs and attorneys’ fees are imposed on the unsuccessful defendant, together with statutory interest thereon from the date they are assessed until they are paid in full.
V.Regarding the defenses (excepciones): The defense of lack of standing on the part of the plaintiff and defendant (falta de legitimación activa y pasiva) is dismissed as procedurally improper and unfounded, because, by virtue and as a consequence of their participation in the titling proceeding, both Nombre81316, as the award recipient (adjudicataria), and Instituto de Desarrollo Agrario (INDER), as the awarding entity (adjudicante), had, as they claim, a substantive legal relationship (relación jurídica material) with the claim asserted in the proceeding (pretensión procesal). The defense of lack of a legal right (falta de derecho) is upheld with respect to the relief not granted, because in that respect the complaint was unsupported by the legal system; and it is dismissed with respect to the relief granted, because in that respect the complaint was supported by the legal system. COROLLARY: In view of the foregoing—which is deemed sufficient—the remaining arguments, assertions, and evidence alleged and submitted by the parties are rejected as unnecessary and immaterial.
As a corollary to the foregoing: Instituto de Desarrollo Agrario (INDER) must be ordered to pay subjective moral damages to Nombre81316 in the amount of one million colones (¢1.000.000,oo), together with statutory interest from the date the judgment becomes final until payment in full, as well as both the litigation costs and attorneys’ fees of the proceeding in favor of the plaintiff.
POR TANTO
The defense of lack of standing on the part of the plaintiff and defendant is dismissed. The defense of lack of a legal right is upheld with respect to the relief denied and dismissed with respect to the relief granted. The complaint is granted in part, and any relief not granted shall be deemed denied. Instituto de Desarrollo Agrario (INDER) is ordered to pay subjective moral damages to Nombre81316 in the amount of one million colones (¢1.000.000,oo), together with statutory interest from the date the judgment becomes final until payment in full. The defendant is ordered to pay both the litigation costs and attorneys’ fees of the proceeding, together with statutory interest thereon from the date they are assessed until payment in full. No. 11 - 2018-II TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. SECCIÓN SEGUNDA. Segundo Circuito Judicial de San José. Goicoechea. A las nueve horas treinta minutos, del veintisiete de febrero del dos mil dieciocho.- Proceso de conocimiento declarado de puro derecho, seguido ante este Tribunal por Nombre81316 , cédula CED60384- - , mayor, divorciada, "ejecutiva del hogar", vecina de Buenos Aires de Puntarenas; en contra del INSTITUTO DE DESARROLLO RURAL (INDER), antes IDA e ITCO. En adelante el Instituto. El abogado Alvaro Enrique Alfaro Jiménez representa a la actora y los abogados Nadia Vanesa Rodríguez Rodríguez y Francisco Antonio Villegas Rodríguez, a la parte demandada.
RESULTANDO
"Se declare con lugar la demanda en todos sus extremos.
Se ordene a quien corresponda del INDER ipso facto e ipso jure, tramitar la escritura a mi favor e inscribirla en el Registro Público, o autorizar para que el Lic. Álvaro E. Alfaro Jiménez, abogado y notario, proceda con el trámite respectivo, debiendo el Instituto suministrar la información correspondiente.
Se condene al INDER al pago de daño moral subjetivo de naturaleza "in re ipsa", como responsable de causarme DURANTE MÁS DE 21 AÑOS un grave daño a mi integridad, a mi salud y a mi psiques, de imposible reparación.
Se condene al INDER al pago de los perjuicios causados.
Se condene al demandado al pago de ambas costas del presente proceso y se fijen los honorarios de abogado en el veinticinco por ciento, artículo cuatrocientos noventa y cinco del Código de Trabajo (sic).
Se condene al INDER a cancelar los intereses por los montos a que sean condenados.
desde la presentación de la demanda y hasta su efectivo" (páginas 6 y 7 del principal).
Tras la pregunta de la Jueza tramitadora, de si había ajustes o aclaraciones que hacer, y la intervención de los abogados de las partes, las pretensiones se ajustaron y aclararon, así:
Redacta el juez Rodríguez Villalobos; y,
CONSIDERANDO
I.Hechos y/o antecedentes probados. De trascendencia para la resolución del presente caso se tienen los siguientes, en orden cronológico:
II.Hechos y/o antecedentes no demostrados. De relevancia para efectos de la presente demanda se tienen, que: 1) haber adquirido la propiedad, en enero de 1995 y sin haber sido informada ni enterada de que estaba adquiriendo una finca que había sido un proyecto del ITCO (los autos). 2) No sabe leer ni escribir (los autos). 3) Ha recibido amenazas para que abandone la propiedad (los autos). 4) Existiera un uso de suelo pendiente, en el 2002 (los autos) 5) La Presidencia Ejecutiva se limitara a hacer simple traslado del asunto, en el año 2015 (los autos). 6) La Sala Constitucional ordenara, específicamente, que la propiedad fuera inscrita a su nombre (los autos). 7) Ausencia de respuesta a la excitativa del 3 de agosto de 2016 (los autos) 8) El INDER se la está adjudicando a una Asociación (los autos). 9) Desde 1995 se apersonó al Instituto a hacer la gestión para que le reconocieran su derecho (los autos). 10) La propiedad no le fue adjudicada por el Instituto sino que se la compró a terceros y la compra de buena fe (los autos).
III.Objeto del proceso y criterio del tribunaL: Tras el análisis de las alegaciones y probanzas de las partes, durante el proceso -escritos de demanda y su contestación, a las cuales remitimos-, es claro que en virtud de que posteriormente, específicamente a las 12:30 horas del 8 de marzo del 2017, el INDER por fin resuelve y ordena la escritura la cual se inscribe en el Registro Público a nombre de la actora -como se admite y consta en autos-, quedó sin sentido la pretensión original de la Señora Nombre81316 para que se ordenara al Instituto a tramitar e inscribir en el Registro Público la escritura a su favor y/o autorizar a su abogado para ello. De ahí que, en virtud de la reformulación - y fijación- de las pretensiones, por la parte actora y por la Jueza, e l objeto de esta contienda estriba ahora en determinar la procedencia o no de la condena al Instituto al pago de daño moral subjetivo estimado en ¢30.000.000,oo; más intereses; la procedencia o no para que se levante el gravamen impuesto a la propiedad en la escritura de traspaso 123 del Notario Danilo Campos Herrera, otorgada el 8 de marzo del 2017; y finalmente, la procedencia o no para que se condene en costas a la parte demandada.
Frente a lo cual el representante de la señora Nombre81316 , ARGUMENTA, en esencia, que: De acuerdo a los hechos de la demanda y a las pruebas aportadas es claro y contundente el daño que se le ha causado a la actora quien adquirió esta propiedad de buena fe en 1995 y desde entonces se apersonó al Instituto a hacer la gestión para que le reconocieran su derecho. Siendo muy claros de que la propiedad no le fue adjudicada por el Instituto sino que se la compró a terceros y la compra de buena fe. Aduce: Esto es importante para el tribunal en virtud de que es un hecho de buena fe y fue entre terceros que se dio la situación no con el Instituto. Si bien tuvieron que demandar al INDER esto obedeció a negligencia de las autoridades del Instituto de resolver y resolver un asunto que había sido adjudicado a favor de la actora desde mucho tiempo antes. Hace lectura del artículo 45 de la sesión ordinaria 039- 2008, del 3 de noviembre de 2008, de la Junta Directiva del IDA, en que se declaró elegible del programa de dotación de tierras en la modalidad de parcela a Nombre81316 , a la vez que se le adjudica la parcela N° 116-A-1 del Asentamiento Gromaco; acuerdo transcrito a la actora, por Oficio 0SSI -460, del 24 de setiembre de 2010.
Tras lo cual aduce: Eso quiere decir que si desde el 2010 (sic) se aprobó la adjudicación de esta propiedad - que fue adquirida a un tercero por la actora-, quien desconocía dado que no sabe leer ni escribir, desconocía de las condiciones inherentes a la misma, no es posible que en tanto tiempo después de haber planteado el Recurso de Amparo en el 2006 de haber sido declarado a su favor y de haberse hecho diversas gestiones a través del tiempo con diversos abogados, el Instituto no hubiese resuelto. Hoy sigue siendo la misma institución y tiene que "apechugar" con la responsabilidad de las actuaciones de los anteriores. Eso es definitivo. Es claro que la actora nació el 7 de enero de 1941, tiene 76 años; a la propiedad la gravan con una limitación por 15 años que inicia el 3 de noviembre de 2008 y finaliza el 3 de noviembre de 2013. Pregunta: Porqué gravar esa propiedad a partir del 3 de noviembre del 2008 si ella hizo las gestiones desde que la adquirió en 1995?
Porqué hacerle un daño de esa forma?. Aduce: "como que no cabe". Si bien la Ley tiene un objetivo muy claro y loable - estima- no es aplicable para la actora en el caso que nos ocupa, en virtud de que la propiedad no la compró al INDER y que la compró hace muchísimos años y se demostró por las gestiones diversas que se hicieron a través del tiempo de que la actora estaba actuando de buena fe a efectos de que le enderezaran el procedimiento y de que pudiera hacer uso de esa propiedad, como es debido. Y no hasta el año 2017 en que hacen la escritura y le ponen un gravamen a partir del 2008 - o sea - dice- es como contraproducente, cuando tenga derecho a disponer libremente del bien tendrá 82 años y 10 meses y es una señora muy enferma. No es una persona que viene a hacer aquí al Juzgado ... (sic) sino que ha venido con limitaciones de salud a través del tiempo y está muy preocupada de que vaya a "faltar" y esa propiedad vaya a quedar al "garete".
Eso es muy importante que lo valore el Tribunal. Estima, aplica el principio de libre disposición de los bienes. No hay razón para que una señora que compra de buena fe una propiedad en 1995, se la estén gravando para que no pueda disponer del bien, y tenga que esperar hasta dentro de varios años para disponer libremente. Sí es muy importante de acuerdo a lo que están planteando que se acoja en todos sus extremos la demanda y se condene al pago del daño moral que ha sido excesivo y abusivo. Está probado en autos. Y se acojan todas las pretensiones como es el hecho de que se le levante ese gravamen. Aduce: Si bien la ley así lo estipula "ok" apliquen la ley como corresponde y valoren que este trámite se está haciendo a partir de 1995, cuando compra la propiedad, no se está haciendo en el 2017, que fue el momento en que se hizo la escritura. Pregunta: Por qué se hizo la escritura? porque tuvieron que acudir al Tribunal en defensa de los derechos de la actora, en virtud de que había oídos sordos a través del tiempo.
No es posible que en tanto tiempo con 3 o 4 abogados que participaron en este asunto para tratar de ayudarla no es sino hasta ahora - en que intervinieron judicialmente-, de que se haga la escritura y de que se haga el traspaso a favor de la actora. Por qué esperaron tanto tiempo? Estima, la Administración no tiene el derecho de lesionar a sus administrados de semejante forma. Si no se hubiera dado una situación de estas, no estarían aquí, definitivamente. Por que la actora no tenía ninguna intención ni interés de venir a estrados a alegar sus derechos. Precisamente por eso alegan el pago de las costas que así está estipulado en una resolución que emitió el mismo Tribunal que le dio 15 días de plazo al INDER para que hiciera su trámite, no lo hizo, por lo tanto tiene que ser condenado al pago de las costas. Y aprobar todas las pretensiones que están siendo planteadas en este momento que fueron aprobadas a través de la revisión del proceso.
Por lo tanto apela al Tribunal de forma que se declare con lugar la demanda y las pretensiones, quien ha sido la única perjudicada desde hace 23 años a la fecha. Frente a lo cual el representante deL Instituto ARGUMENTA, en resumen, que: La resolución de las 11:11 Horas del 31 de octubre de 2016 que da traslado a la presente demanda de manera clara indica que el objeto es que " Se ordene a quien corresponda del INDER ipso facto e ipso jure, tramitar la escritura a mi favor e inscribirla en el Registro Público,...". Desde ese momento se tiene claro que el objetivo central, principal, es pretender que el INDER titule a favor de la actora la propiedad la cual indica tener el derecho. Hace lectura de lo que establece el artículo 197. 1) del CPCA. En este caso tanto lo indicado en el documento de demanda y su contestación se tiene por cierto y claro de que es la pretensión principal a satisfacer acá es titular a favor de la actora.
En este caso el Dirección8740 . Esta pretensión u objetivo medular - amén y respetando lo dicho por el representante de la actora -, fue satisfecha, está culminado desde marzo del año 2017 y esto queda claro y demostrado en autos. Al tener ya consigo una escritura bajo los ritos que la Ley establece para esos efectos. Entonces -estima-, de que no habría mayor interés en la conclusión o en la continuación con este debate y asimismo las consecuencias conexas o anexas a este fundamento o pretensión principal ... no habría pues entonces tampoco cabida para la condena al Instituto en lo que hace a las costas, por una parte. Dentro de los mismos antecedentes, que se indican, que datan, según lo documentado por la parte actora, desde 1995. De 1995 y hasta el año 2008 las situaciones que ahí se indican son unas relaciones entre la señora actora y terceros. Cual es el indicar que adquirió la posesión de parte de esos terceros.
Lo cierto es que incluso como parte de los antecedentes de lo que podemos llamar el debido proceso administrativo que se ha seguido en este asunto fue incluso una de las causales justificantes para que poseedores originarios fueran declarados - digamos- "non gratos" para poseer en las condiciones legales existentes y eso sí consta en el expediente administrativo y así también señalado en la historia que nos narran en la demanda. Lo cierto entonces es que es importante que no tomemos en cuenta esos acontecimientos de 1995 al 2008 por lo menos en lo que hace al Instituto porque le son ajenos, en cuanto a lo pretendido. Seguidamente procede a hacer una cronología: El 4 de febrero de 1991 se aprueba la adjudicación y traspaso original. El 26 de julio del 2004 se revoca.Hasta este momento -aduce- la relación era entre terceros y el Instituto no tenía ninguna ingerencia en esa relación. El 30 de mayo de 2006, una vez que terminó el procedimiento de revocación, era lo procedente que de previo a que el Instituto pudiese disponer de la parcela, procediera a valorar y cancelar las mejoras.
Posteriormente, el 31 de noviembre de 2008 se declara elegible a la actora del programa de titulación y se le adjudica la parcela. El 9 de diciembre de 2010 se firma el Contrato de Asignación. A partir de su fecha que queda vigente. Es a partir de este momento -2010- que se inician los trámites y requisitos legales vigentes para titulación: El 2 de octubre de 2011 (sic) se realiza la Planilla de Campo. Luego se pide la Clasificación del terreno al MINAE. Organo ajeno al Instituto.L a respuesta se recibe el 4 de mayo de 2012. Pero hubo un error en cuanto a la numeración del plano. El 8 de mayo de 2013 se hace la evaluación del período de prueba, de ley. El 1 de noviembre de 2013 se realiza la inspección, de ley. El 12 de noviembre de 2013 se llena la ficha de titulación y se confecciona el informe técnico. Se pasa el expediente a la Subregional. El 13 de noviembre del 2013 se pasa al Coordinador Agrario para la titulación, por cumplir los requisitos.
Sin embargo, el 25 de noviembre de 2013 se devuelve por el error en la certificación del MINAE. Se debe corregir para poder continuar. El 29 de mayo de 2004 se procede a requerir la certificación del MINAE. Para el 29 de junio de 2015, se vuelve a llenar la ficha de titulación e inspección de campo. Hasta el 6 de agosto de 20015 se recibe del MINAE la cerificación. Un mes después -24 de setiembre de 2015, se emite el Informe técnico para titular. Debido a que existen nuevos procedimientos se hace necesario emitir dichos requerimientos. El 7 de octubre de 2015 se remite el expediente al Coordinador de la Región para que proceda a la titulación. En cuanto al resto - afirma-, se atiene a los autos. Aduce: Todas las actuaciones que históricamente se tienen por señaladas fueron ajustadas a derecho y emitidas conforme a la normativa y muchas de esas actuaciones en cuanto a su retraso o letargo o espera no dependían de manera antojadiza o no en exclusiva del Instituto sino que muchas estuvieron a expensas o esperas de decisiones de otras dependencias como el el caso del SINAC, hasta del Banco Nacional de Costa Rica, inclusive.
Es muy triste sí - que de mala fe de la actora -según su apreciación, en su demanda- de una manera injusta en el hecho 4 indique que ha sufrido amenazas para hacer que salga del terreno, etc. El Instituto nunca ha actuado de esa manera. Por lo tanto incluso es importante dejar claro que no ha existido ni puede existir siquiera un daño moral subjetivo sobre esto, hay muchas acotaciones de fechas muy importantes pero al igual que así consta en autos -como sucedió con la acreditación de poder especial del abogado de la actora-, hay un faltante grande de elementos probatorios del dicho acá que en su momento espera que el Tribunal así lo valore. Que no dan un sustento cierto y válido a los argumentos de la actora en cuanto a sus pretensiones, lo que las podrá estar haciendo carecer del peso o rigor legal necesario para que sean de recibo. Pide se rechace en todos sus extremos la demanda y se exonere de la condenatoria en costas, del daño moral y cualquier otra pretensión que se haya indicado.
Criterio del tribunal: Habiendo analizados los argumentos de las partes y revisado el contenido probatorio de los autos, el Tribunal determina- acorde con lo replanteado y solicitado en la Audiencia Preliminar-, la procedencia de la condena al Instituto al pago de daño moral subjetivo a favor de Nombre81316 , por las razones que se dirán, más no en el monto - desproporcionado- de ¢30.000.000,oo, sino en la suma -razonable- de ¢1.000.000,oo. Asimismo, por las razones que se dirán, la improcedencia para que se levante el gravamen impuesto a la propiedad en la escritura de traspaso 123 del Notario Danilo Campos Herrera, otorgada el 8 de marzo del 2017; y finalmente, la procedencia de la condena en costas a la parte demandada. Y, por ende, la improcedencia de su exoneración en costas. Veamos: En cuanto a la pretensión de condena al Instituto al pago de daño moral subjetivo a favor de Nombre81316 : En el Considerando IV. de la sentencia 2006-14393, de las 16:06 horas del 27 de setiembre del 2006, de la Sala Constitucional, que resolvió el recurso de amparo, a favor de Nombre81316 , se señalo: "El artículo 41 de la Constitución Política consagra el principio de justicia pronta y cumplida, que en el caso de la Administración Pública se concreta en la obligación de ésta de tramitar y resolver los diversos asuntos puestos a su conocimiento dentro de un plazo razonable, y además, de notificar lo que corresponda a los gestionantes, pues caso contrario se transgrediría uno de los derechos fundamentales de los que goza todo ciudadano.
Dicho de otro modo, según criterio reiterado de esta Sala, a fin de no hacer nugatorio el derecho que le asiste al denunciante, la decisión debe tomarse dentro de un término razonable y adecuado al tipo de denuncia que se entable. En el caso que nos ocupa, esta Sala tiene por demostrado, de la prueba aportada a este expediente y de los informes rendidos bajo juramento, que la amparada, mediante escrito recibido en el Instituto de Desarrollo Agrario el veinticinco de enero de dos mil dos, presentó solicitud de nulidad de adjudicación a favor de Nombre81317 y Nombre81318 y solicitud de adjudicación a su favor. Asimismo, por medio de escrito presentado ante la Junta Directiva de ese instituto el veintisiete de abril de dos mil cinco, la amparada reiteró su solicitud. Estima esta Sala, que si bien la autoridad recurrida no podía tramitar la solicitud de adjudicación presentada por la amparada hasta que se finalizara el procedimiento de revocatoria, lo cual sucedió hasta el tres de mayo de dos mil seis, continuando posteriormente con la valoración de mejoras, que concluyó en julio de dos mil seis, el tiempo transcurrido entre la presentación de la gestión de la recurrente en el año dos mil dos y la interposición del presente recurso de amparo resulta excesivo, arbitrario, desproporcionado, y por ende, violatorio de los derechos fundamentales de la amparada.
Ya ha reiterado esta Sala que el argumento de falta de recursos no justifica el retraso en la tramitación de las gestiones presentadas por los administrados, de manera tal que no es de recibo el argumento de la autoridad recurrida. Por otra parte, el hecho de que la parcela de la amparada se encuentre en una zona tan alejada, significa que con más razón la autoridad recurrida debió notificarle al lugar señalado para recibir notificaciones el día de la visita, para de esa manera no dilatar más el proceso, como en efecto sucedió. En este sentido, lo procedente es declarar con lugar el presente recurso de amparo por violación al derecho de justicia pronta y cumplida consagrado en el artículo 41 de la Constitución Política, como en efecto se ordena.". Existen disposiciones legales específicas que regulan la facultad del Instituto de otorgar parcelas y de revocar las adjudicaciones, los requisitos que deben cumplir los beneficiarios y cuáles son sus derechos y obligaciones y, también, los procedimientos para aplicarlas.
Sin embargo, los procedimientos administrativos regulados por leyes sectoriales especiales- como los contemplados en las leyes del INDER, antes IDA, e ITCO, no pueden desconocer o exceptuar, en su aplicación, los principios generales - de economía, simplicidad, celeridad y eficiencia-, con el fin de evitar retardo grave e injustificado y la paralización, contemplados en una Ley marco, sobre el tema, como es la Ley General de la Administración Pública, en cuanto señala, por ejemplo que: El procedimiento administrativo servirá para asegurar el mejor cumplimiento posible de los fines de la Administración; con respeto para los derechos subjetivos e intereses legítimos del administrado, de acuerdo con el ordenamiento jurídico. Su objeto más importante es la verificación de la verdad real de los hechos que sirven de motivo al acto final. El órgano deberá conducir el procedimiento con la intención de lograr un máximo de celeridad y eficiencia, dentro del respeto al ordenamiento y a los derechos e intereses del administrado.
Serán responsables la Administración y el servidor por cualquier retardo grave e injustificado. El procedimiento administrativo deberá concluirse, por acto final, dentro de los dos meses posteriores a su iniciación o, en su caso, posteriores a la presentación de la demanda o petición del administrado, salvo disposición en contrario de esta Ley. La actuación administrativa se realizará con arreglo a normas de economía, simplicidad, celeridad y eficiencia. Las autoridades superiores de cada centro o dependencia velarán, respecto de sus subordinados, por el cabal cumplimiento de este precepto, que servirá también de criterio interpretativo en la aplicación de las normas de procedimiento. En todo momento podrá reclamarse en queja contra los defectos de tramitación y, en especial, los que supongan paralización, infracción de plazos preceptivamente señalados u omisión de trámites que puedan subsanarse antes de la resolución definitiva del asunto.
Menos que menos desconocer, principios normativos de fondo, tales como que: La Administración responderá por todos los daños que cause su funcionamiento legítimo o ilegítimo, normal o anormal, salvo fuerza mayor, culpa de la víctima o hecho de un tercero. En todo caso el daño alegado habrá de ser efectivo, evaluable e individualizable en relación con una persona o grupo. Cabrá responsabilidad por el daño de bienes puramente morales, lo mismo que por el padecimiento moral y el dolor físico causados por la muerte o por la lesión inferida, respectivamente. Ahora bien, pese a sus afirmaciones, la parte actora no demostró: haber adquirido la propiedad, en enero de 1995, sin haber sido informada ni enterada de que estaba adquiriendo una finca que había sido un proyecto del ITCO . Por el contrario, con fecha 1 de octubre de 2013 Nombre81316 firmó DECLARACIÓN JURADA - ante testigos-, de que fue a partir de enero de 1997 en que adquirió el terreno y las mejoras existentes fueron introducidas por ella y su hijo Nombre81319 .
Que no sepa leer ni escribir. Haya recibido amenazas para que abandone la propiedad. La Sala Constitucional ordenara, específicamente, que la propiedad fuera inscrita a su nombre. La Presidencia Ejecutiva se limitara a hacer simple traslado del asunto, en el año 2015. Ausencia de respuesta a la excitativa del 3 de agosto de 2016. El Instituto estuviera adjudicando la parcela a una Asociación. Desde 1995 se apersonó al Instituto a hacer la gestión para que le reconocieran su derecho. Y, la propiedad no le fue adjudicada por el Instituto. Sin embargo, tampoco es cierto - como se aduce por el demandado-, que la relación del Instituto con la actora se produjo en y/o desde el año 2008, ya que conforme a los hechos y antecedentes probados se tiene por demostrado que desde el 25 de enero del 2002, Nombre81316 , presentó solicitud de nulidad de la adjudicación a favor de Nombre81317 y Nombre81318 y solicitud de adjudicación a su favor.
Asimismo, por medio de escrito presentado ante la Junta Directiva de ese instituto el 27 de abril de 2005, reiteró su solicitud. Es cierto que el Instituto no podía tramitar la solicitud de adjudicación - y titulación- presentada por la señora Nombre81316 hasta que se finalizara el procedimiento de revocatoria, lo cual sucedió hasta el 26 de julio de 2004 en que el Instituto emitió la resolución final de revocatoria de la adjudicación de la parcela y se autorizo comunicar al Registro Público la nulidad del título inscrito con matrícula Placa12973, y la cancelación de las limitaciones y la reversión del inmueble a nombre del IDA. Y sobre todo, cuando fue notificada - por edictos- a los afectados, sin que interpusieran los recursos correspondientes contra esa resolución. Lo cual ocurrió -finalmente- el 30 de marzo de 2006, que es la fecha de inscripción - de la reversión de la finca- en el Registro Público (folio 94 del administrativo).
Sin embargo, no existe ninguna explicación ni justificación de que no fuera sino hasta el 3 de noviembre de 2008 - DOS AÑOS Y SIETE MESES DESPUÉS- en que se dispuso adjudicarle la parcela N° 116-A-1 del Asentamiento Gromaco. Lo cual constituye paralización, por negligencia. MENOS QUE MENOS, que no fuera sino hasta el 9 de diciembre de 2010 - DOS AÑOS Y UN MES DESPUÉS-, que se firmara entre las partes, el " CONTRATO DE ASIGNACIÓN DE TIERRAS". Lo cual constituye también, paralización, por negligencia. Al extremo que en ese documento se admite, expresamente, que ese contrato se firma en esa fecha, en razón de atraso por parte del IDA en la suscripción del mismo. Como reza el adagio: "A confesión de parte, relevo de pruebas.". Es cierto que a partir de ese contrato se iniciaba un período de prueba, de dos años. El cual vencería entonces, el 9 de diciembre del 2012. Lo cual explica que el procedimiento en cuanto al cumplimiento de los requisitos para la titulación se retomara, y realizara, en ese año del 2012 y durante el año 2013.
Requisitos tales como: CERTIFICACIÓN DE LA CLASIFICACIÓN DEL PREDIO POR PARTE DEL SINAC, DEL MINAE, la PLANILLA DE CAMPO PARA LA DETERMINACIÓN DE LA CAPACIDAD DE USO DE TIERRAS, y EL VISADO DE CERTIFICACIÓN DE USO CONFORME, del INTA, EVALUACIÓN DEL PERÍODO DE PRUEBA, DECLARACIÓN JURADA DE LA FECHA DE ADQUISICIÓN Y PROPIEDAD DE LAS MEJORAS, INSPECCIÓN DE LA PARCELA, FICHA DE TITULACIÓN con la DECLARACIÓN DE PARTE y la RECOMENDACIÓN DEL TÉCNICO, así como el INFORME TÉCNICO - con la recomendación-, sobre el predio a titular. Sin embargo, no existe ninguna explicación ni justificación de que no se realizara ninguna gestión, dentro del expediente de titulación, durante todo el año 2014. Lo cual constituye paralización, por negligencia. Cabe aceptar que dentro del procedimiento de titulación existen requisitos, que no son del resorte o competencia del Instituto, p.ej.: la certificación del uso de suelo conforme, por parte del INTA, o bien, la certificación de la Clasificación del Predio, por parte del SINAC, de cuyos errores o retardo, no es responsable el Instituto, necesariamente.
Cabe aceptar, en este sentido, que el error en cuanto al número de plano, de la primera certificación del MINAE, retrasó el procedimiento, al extremo que hubo que pedir una nueva certificación de la Clasificación del terreno, al SINAC, y repetir, como consecuencia, en los años siguientes - 2015 e inicios del 2016-, requisitos como los ya señalados, por haber pasado mucho tiempo. Así se reconoce, expresamente, mediante oficio OSSI 832- 2015, del 24 de septiembre de 2015 - INFORME PARA TITULACIÓN P-116-A-1, ASENTAMIENTO GROMACO, PARA DAR RESPUESTA A DRB-2069-20123 -, en el sentido de que ya se corrigió el error en el número de plano consignado en la certificación del MINAE. Pese a lo cual - se añade que-, al haber pasado mucho tiempo y por tener nuevos procedimientos para tramitar títulos de propiedad, se procede a actualizar el informe técnico con el fin de que cumpla con la legislación y los procedimientos de la Ley 9036 y sus reglamentos.
Sin embargo, no existe ninguna explicación ni justificación de que no fuera advertido, ese error, por parte del Instituto, a su debido tiempo, perdiéndose recursos y tiempo valioso, en perjuicio de la actora. Lo cual constituye retraso, letargo y espera, por negligencia. Cabe aceptar también que dentro del procedimiento de titulación se hizo necesario requerir constancia del Banco Nacional de Costa Rica, sobre una deuda hipotecaria existente y proceder, de previo, a su cancelación hipotecaria. Lo cual produjo retardo o dilación, durante el año 2016 Sin embargo, tampoco existe explicación ni justificación de que ese impedimento registral, no fuera advertido, por parte del Instituto, a su debido tiempo, perdiéndose recursos públicos, y tiempo valioso, en perjuicio de la actora. Máxime que hubo dos informes registrales, incorporados al expediente, con fechas 12 de noviembre de 2013, y 24 de setiembre del 2015 , que daban cuenta - desde entonces-, de que el inmueble matrícula Placa12974, registrado a nombre del IDA, presentaba hipoteca, con indicación del nombre de acreedor y del deudor.
Tampoco existe explicación ni justificación, de que no fuera advertido, a su debido tiempo, por parte del Instituto, el error señalado por el Departamento de Escriturización, en noviembre del 2015 , en cuanto al incremento por indexación aplicado en el costo por concepto de tierra, que debió ser corregido. Tampoco existe explicación ni justificación, de que no fueran advertidas, a su debido tiempo, por parte del Instituto, las otras falencias, señaladas, por el Departamento de Escriturización, en mayo del 2016, que debieron ser aclaradas o corregidas, tales como: Lo referente a la valoración y cancelación de mejoras. Si existen problemas de traslapes y ubicación, al haberse aportado un plano particular. Corregir en el sistema SIGA y en ficha de titulación que el predio será segregado de la finca Placa12976 y no que el predio está individualizado, perdiéndose recursos públicos, y tiempo valioso, en perjuicio de la actora.
Aparte, como señalamos, la falencia en cuanto a la hipoteca que pesaba sobre la finca. Ese funcionamiento anormal - esa paralización, en unos tramos; y retardo grave e injustificado en otros lapsos, del procedimiento; y, en general ese retraso, letargo o espera, excesivos y abusivos - entiende el Tribunal- generó emociones negativas de desazón e incertidumbre, sin excluir el enojo, en el ánimo de Nombre81316 , que no tenía el deber de soportar, que fundamenta, jurídicamente, que se condene al Instituto al pago de daño moral subjetivo a favor de dicha señora, más no en el monto - desproporcionado e injustificado- de ¢30.000.000,oo, como se pretende, sino en la suma -razonable y equitativa-, de acuerdo con las circunstancias, de ¢1.000.000,oo; así como los intereses legales sobre esa suma, hasta su efectivo pago; mas no desde la presentación de la demanda, sino a partir de la firmeza de esta sentencia, en razón del carácter constitutivo y no declarativo de este fallo.
La pretensión para que se - elimine -, y levante el gravamen impuesto a la propiedad en la escritura de traspaso 123 del Notario Danilo Campos Herrera, otorgada el 8 de marzo del 2017, se rechaza, por su improcedencia jurídica. Veamos: Mediante artículo 45 de la sesión ordinaria 039- 2008, de la Junta Directiva del IDA, del 3 de noviembre de 2008, se dispuso: " Acoger recomendación contenida en los oficios ASF-622-08 y DRB-1542-2008, suscritos por el Area de Selección de Familias Dirección Región Brunca y con fundamento en ellos se acuerda: 1. Declarar elegible del programa de dotación de tierras en la modalidad de parcela a Nombre81316 , cédula CED60385 -, en razón de obtener puntaje superior al que establece el Artículo 10 del Reglamento Autónomo para la Selección y Adjudicación de Solicitantes de Tierras, (66 puntos), y no presentar ninguna razón de descal¡ficación. A su vez, se le adjudica la parcela N° 116-A-1 del Asentamiento Gromaco, con una área de 3 ha. 5.206.86 M2, según plano catastrado P-376827-97, sito en el Dirección8738 , , Provincia de Puntarenas, adquirido con recursos propios. 2.
Queda establecido que la Dirección Región Brunca y la Oficina Subregional San Isidro, deben velar por el cumplimiento de los artículos 24, 31, 32 y 37 del Reglamento Autónomo para la Selección y Adjudicación de Solicitantes de Tierras. 3. En atención al acuerdo No. 42 de la Sesión Ordinaria 027-2008 del 4 de agosto del 2008, se indica que en este caso, el IDA no valoró ni canceló mejoras dentro de este predio". Ahora bien, Nombre81316 firmó DECLARACIÓN JURADA - ante testigos-, con fecha 1 de octubre de 2013, de que fue a partir de enero de 1997 que adquirió el terreno y que las mejoras existentes fueron introducidas por ella y su hijo Nombre81319, lo cual descarta, por un lado, que lo hubiera adquirido, en enero de 1995, como afirmó, en la demanda. Además, aún aceptando que lo adquirió de terceros, no cabe duda que se trató de una venta ilegal, al extremo que fue la causal - junto con el abandono-, para que se revocara la adjudicación original, a esos terceros.
Sin que se pueda negar, que fue como consecuencia de lo anterior, que la propiedad le fue adjudicada por el Instituto, el 3 de noviembre de 2008, como acabamos de ver. El artículo 66, de la Ley No 9036 del 11/05/2012, que Transforma el Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (INDER) y Crea Secretaría Técnica de Desarrollo Rural, vigente desde el 30 de noviembre del 2012, establece: "ARTÍCULO 66.- Limitaciones: El asignatario o los asignatarios no podrán traspasar el dominio de su predio, ni gravarlo, arrendarlo o subdividirlo sin autorización previa del Inder, excepto que hayan transcurrido quince años contados a partir del acto de asignación de la tierra y que todas las obligaciones con el Inder estén canceladas. Durante ese mismo plazo, dichos predios no podrán ser objeto de ningún tipo de medidas judiciales, preventivas o ejecutivas por parte de terceros o acreedores, salvo que dichos créditos, deudas u obligaciones hayan sido autorizados por el Inder.
Será absolutamente nulo cualquier contrato que se celebre sin que se cumplan las disposiciones anteriores. Transcurridos los quince años y consolidado el derecho de propiedad, el Inder tendrá el derecho de primera opción de compraventa, por el precio que establezca el avalúo realizado por la Dirección General de Tributación, para evitar cualquier enajenación de la tierra que pueda producir la concentración indebida o la subdivisión excesiva de la propiedad. El Registro Nacional tomará nota de las limitaciones a que se refiere este artículo." (negrita y subrayado suplidos). En similar sentido, el artículo 67 de la Ley No. 2825, Ley de Tierras y Colonización (ITCO INDER), del 14 de octubre de 1961, que se mantiene vigente en lo que no contravenga la Ley anterior, con prevalencia incluso de sus principios en caso de duda entre ambas, establece: "Artículo 67.- El beneficiario no podrá traspasar el dominio de su predio ni gravarlo, arrendarlo o subdividirlo sin autorización del Instituto, excepto que hayan transcurrido quince años desde la adquisición de la parcela y de que todas las obligaciones con dicho organismo estuvieren canceladas.
Tampoco podrá, sin esa autorización y durante el mismo término, gravar las cosechas, semillas, animales, enseres, útiles o equipos necesarios para la explotación de la parcela, a menos que todas sus obligaciones con el Instituto estuvieren canceladas. Para autorizar el gravamen del inmueble se requieren cuatro votos conformes de la Junta Directiva. Será absolutamente nulo cualquier contrato que se celebre sin que se cumplan las disposiciones anteriores. Transcurridos los quince años y adquirido el derecho de propiedad, cualquier enajenación de parcela que, a juicio del Instituto, pueda producir la concentración o subdivisión excesiva de la propiedad, dará derecho a éste para adquirir la o las parcelas que se ofrezcan en venta por el precio que fijen los peritos nombrados por las partes, o por un tercero, en caso de discordia. Este tercer perito será nombrado por los otros dos expertos. El Registro Público tomará nota de las limitaciones a que se refiere este artículo.".
(negrita y subrayado suplidos. Fuente: Sistema Costarricense de Información Jurídica). Lo cual explica y justifica, jurídicamente, que en el "CONTRATO DE ASIGNACIÓN DE TIERRAS", firmado por las partes, el 9 de diciembre del 2010, se estipulara: "SEGUNDA: Que la asignación del inmueble está sometida a las restricciones y limitaciones estipuladas en los artículos sesenta y seis, sesenta y siete y sesenta y ocho de la ley (sic) por la ley de Tierras antes citada, así como a las regulaciones del Reglamento antes indicado. (...) DÉCIMA TERCERA: Ambas partes aclaran y establecen que el presente contrato se firma en esta data en razón de atraso por parte del IDA en la suscripción del mismo, pero que para efectos de fiscalización y cumplimiento de requisitos para el eventual otorgamiento del título , "LA ASIGNATARIA" se encuentra en el inmueble objeto de este contrato desde la adjudicación hecha por parte de la Junta Directiva".
Asimismo, que el INFORME PARA TITULACIÓN P-116-A-1, ASENTAMIENTO GROMACO, PARA DAR RESPUESTA A DRB-2069-20123, Oficio OSSI 832-2015, del 24 de septiembre de 2015, entre otras cosas, se señalara "...se recomienda que se reconozca a la beneficiaria los años que lleva de trabajar y habitar el predio desde su asignación a la fecha y se le impongan las limitaciones por los años que resten...." (negrita y subrayado suplidos). Así también, que en el oficio OSSI- 865-2015, del 7 de octubre de 2015, entre otras cosas, se señalara "...se recomienda incluir en la propuesta de acuerdo de Junta Directiva, para la titulación de este predio, que se inscriba con las limitaciones del artículo 67 de la Ley 2825, hasta el 03 de noviembre de 2023, por cuanto han transcurrido ya siete años desde la asignación del mismo y no se ha titulado por problemas de tipo legal no atribuibles a la asignataria Nombre81316 ....".
Asimismo, que en el Contrato de Traspaso del bien inmueble Asentamiento Gromaco, Dirección8741 - - , a favor de Nombre81316 , escritura de titulación No. 123, otorgada ante el Notario Institucional del INDER, Jorge Danilo Campos Herrera, a las 12:30 horas del 8 de marzo del 2017, se estipulara: "Quinto sobre las limitaciones: "De conformidad con lo establecido en los artículos sesenta y seis, sesenta y ocho de la Ley veintiocho veinticinco y articulo sesenta y seis de la Ley noventa treinta y seis, este contrato tiene vigencia a partir del día tres de noviembre del dos mil ocho, según artículo cuarenta y cinco, sesión ordinaria treinta y nueve -dos mil ocho, por lo que las limitaciones al dominio a que hace referencia el artículo sesenta y siete de la Ley dos mil ochocientos veinticinco, inician a partir de esa fecha y no la fecha de este contrato. ...". Y por lo consiguiente, que en el asiento de inscripción - del 27 de marzo de 2017-, con Matrícula Placa12975, y Plano: P-0376827-1997, en el Registro Público se publicite: "GRAVÁMENES o AFECTACIONES: SI HAY ...
LIMITACIONES INDER LEY 9036 ... INICIA EL 03 DE NOVIEMBRE DE 2008 FINALIZA EL 03 DE NOVIEMBRE DE 2023...". (negrita y subrayados suplidos). Los reparos restantes en torno a la edad de la actora y su preocupación por el destino del inmueble, tras su fallecimiento, se rechazan, por improcedentes, toda vez que tanto el artículo 68 de la Ley No. 9036, del 11 de mayo de 2012, como el artículo 69 de la Ley No. 2825 del 14 de octubre de 1961, establecen reglas, sobre sucesión administrativa del contrato de asignación individual, y, sobe sucesión en caso de fallecimiento del beneficiario, antes de haberse producido las condiciones que señala el artículo 67, de la Ley No. 2825, Ley de Tierras y Colonización (ITCO INDER), del 14 de octubre de 1961. Todo lo cual se estima suficiente para desestimar, como en efecto se ha de rechazar, la pretensión, en cuestión.
IV.Sobre las costas. De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. Como resulta ser, en este caso, el INDER, por la condena al pago de daño moral subjetivo causado a Nombre81316 , por el retardo injustificado, en el procedimiento de titulación. En modo alguno por no haber otorgado ni registrado la escritura de titulación. Sin que se estime aplicable, en este sentido, la hipótesis de exoneración, por satisfacción extraprocesal, del artículo 197 del CPCA. Máxime que procesalmente no existe, en el expediente, resolución en ese sentido declarando terminado el proceso. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, no encuentra este órgano colegiado motivo para aplicar las excepciones que fija la normativa aplicable y quebrar el postulado de condena al vencido. Por ende, se imponen ambas costas al demandado vencido; así como los intereses legales, sobre las mismas, a partir de su determinación y hasta su efectivo pago.
V.Sobre las excepciones: La excepción de falta de legitimación activa y pasiva se rechaza, por improcedente, por infundada, toda vez que con ocasión y como consecuencia de su participación dentro del procedimiento de titulación, tanto Nombre81316 , como adjudicataria como el Instituto de Desarrollo Agrario (INDER) como adjudicante, tuvieron, como alegan tener, una relación jurídica material con la pretensión procesal. La excepción de falta de derecho se acoge, en lo no se concede, por cuanto la demanda no encontró respaldo a su respecto en el ordenamiento jurídico; y se rechaza, en lo que se otorga, por cuanto la demanda sí encontró respaldo, a su respecto, en el ordenamiento jurídico. COROLARIO: En razón de lo señalado - lo cual se estima suficiente-, se desechan, por inútiles, por inconducentes, los argumentos, afirmaciones y probanzas, restantes alegados y presentados por las partes. Corolario de lo expuesto: Se ha de condenar al Instituto de Desarrollo Agrario (INDER) al pago de daño moral subjetivo a favor de Nombre81316 , en la suma de un millón de colones (¢1.000.000,oo), y sus intereses legales, a partir de la firmeza de la sentencia y hasta su efectivo pago; así como al pago de ambas costas del proceso, a favor de la parte actora.
POR TANTO
Se rechaza la excepción de falta de legitimación activa y pasiva. Se acoge la excepción de falta de derecho, en lo que se deniega y se rechaza en lo que se concede. Se declara parcialmente con lugar la demanda, debiéndose entender denegada en lo que no se concede. Se condena al Instituto de Desarrollo Agrario (INDER) al pago de daño moral subjetivo a favor de Nombre81316 , en el monto de un millón de colones (¢1.000.000,oo) y sus intereses legales, a partir de la firmeza de la sentencia y hasta su efectivo pago. Se condena a la parte demandada al pago de ambas costas del proceso, así como los intereses legales, sobre las mismas, a partir de su determinación y hasta su efectivo pago.
