2 2 NUE 07-001253-0163-CA (06-001333-0163-CA consolidated with the former) No. 108 - 2016-II TRIBUNAL CONTENCIOSO ADMINISTRATIVO. SECCIÓN SEGUNDA. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at catorce horas con veinte minutos on veintiuno de diciembre de dos mil dieciséis. - Appeal in proceedings concerning atypical interim measures (medidas cautelares atípicas) brought by THE STATE within the following consolidated proceedings: ordinary administrative litigation proceedings brought by Nombre81093 and Nombre81093 against THE STATE, expediente 06-1333-0163-CA, and ordinary injuriousness proceedings (proceso de lesividad) brought by THE STATE against Nombre81093 and Nombre81093, expediente 07-001253-0163-CA.
BACKGROUND
"THEREFORE: In accordance with Considerando I of this decision, and given that two interim measures have been requested in these consolidated proceedings, one in proceso 07-001253-0163-CA and the other in the present consolidated proceso 06-001333-0163-CA, it is determined that each shall be decided separately, this decision being limited to the measure originally filed in proceso 06-001333-0163-CA. The State’s request is granted and, consequently, a proportionate atypical interim measure is ordered that bears a relationship to the principal claim and effectively and efficiently guarantees enforcement of the judgment—should the State’s claim prevail. Accordingly, the following is ordered: The removal of animals and persons from the land in dispute and an order to refrain from carrying out thereon, either directly or through other persons, drainage work, brush clearing, or the removal of, damage to, or destruction of plants, forest cover, shrubs, or palms of any kind (any type of trees, shrubs, or palms); any land-use change; and any construction, as well as the cutting of trees or extraction of timber from other areas of the disputed land.

CONSIDERING
I.The list of facts deemed proven contained in the lower-court decisions is approved, as it faithfully reflects the contents of the record.
I.The decision violates the law, the rule of law, and the basic principles of social coexistence and economic development to which every individual is entitled, because it constitutes a denial and suppression of constitutional, civil, and commercial rights that the Judge declines to apply for the sake of protecting nature and the environment, to the detriment of the individual and by undermining those rights. Everything is prohibited in this country, such as cutting down a tree, fishing, and exploiting natural mineral deposits, and as such the country does not generate, or is not permitted to generate, wealth. How can a country sustain itself socially and economically in the absence of a source of wealth? Only through international borrowing, which would lead us into chaos, compounded by poor state administration. This is not about plundering natural resources, but about sustainable development.
II.The law does not authorize the suppression of the subjective, statutory, and constitutional rights recognized in the judgment, because the protection afforded by this Jurisdiction is intended to safeguard the governed person (administrado) against the exercise of the State’s sovereign powers, abuse or misuse of power, or de facto actions affecting the subjective rights of private parties. It does not operate in the opposite direction, because it would be unlawful and arbitrary to introduce an issue—the environment—in opposition to the individual and to give it supra-statutory force in order to suppress rights without legal authorization.
III.They transcribe Article 8 of the L.O.P.J. and Articles 33 and 45 of the Constitution. Since the issue concerns the environment and the designation of private lands, Article 36 of the Ley de Biodiversidad similarly provides, consistently with those articles, that regardless of the type of designation—national park, refuge, forest reserve, or any other—when the designated lands are held and possessed by private parties, they shall not become part of the state regime.-
Such protection is reflected in Articles 261 and 317 of the Código Civil—concerning rights of possession and ownership, defense, exclusion, use, enjoyment, restitution, and compensation, and the right to claim possession—and in Article 155 of the LGAP, concerning ex officio revocation (revocación oficiosa) of an act conferring subjective rights.
The Constitution and the law protect the legitimate subjective rights of Nombre81093 and Nombre81093, Nombre81093; hence the legal basis for the principal claim in their complaint and the legal inconsistency of the injuriousness action (Lesividad). They therefore do not understand how the law can say one thing while the interlocutory decision declines to apply it and says something else, contra legem, to the detriment of their rights, concluding that, for the sake of nature, it does not matter that their rights of ownership, possession, use, enjoyment, exclusion, and defense are suppressed, leaving them in poverty and destitution. That appears to be state policy, but it is not the rule of law. This violates the principles of legal certainty and security.-
WHAT IS AND WHAT OUGHT TO BE, concerning the creation of national parks or protected areas: nature versus human beings. Counsel states that he watched a National Geographic documentary about the last pristine rainforest in Congo and Gabon, which presented, on the one hand, preservation and, on the other, the need of human beings suffering from hunger, malnutrition, extreme poverty, death, and a lack of public services on that continent to obtain food from wildlife. The person responsible for the documentary persuaded the President of Gabon, and 12 national parks were created.- If the policy of the State and certain environmentalists in our small country is to do the same, prior compensation (indemnización previa) is required. Instead, private properties are first designated and left as enclaves, and only later does anyone know whether the State will pay, particularly when the matter is decided, as now, under "INDUBIO PRO NATURA," when it should be "INDUBIO PRO SER HUMANO." It is enough to invoke that principle coined by environmentalists, and people are DISPOSSESSED of their property, affecting their vital and emotional existence when they are farmers rather than members of a liberal profession, as well as their economic stability.- These individuals form a belt of poverty in the city, in a country that does not generate wealth, particularly when it is full of protected areas that impede sustainable development in harmony with nature.- In the case of Nombre81093 and Nombre81093, as good-faith purchasers of property located as an enclave within a national park, they did not invade it.
Rather, one day Fundación Neotrópica claimed to own certain lands, drew a line, transferred them to the State, and Parque Nacional Tortuguero was thereby expanded. This is now compounded by the judicial decision, which invokes "in dubio pro natura" and dispossesses them of their land despite their holding full title and possession, without "indemnización previa." Either legal certainty and security exist, or there is no RULE OF LAW, but only the subjective interpretation of whichever judge happens to be presiding. No state of necessity (estado de necesidad) exists, much less any basis for declining to apply the law. The decision is unlawful, contrary to law, and declines to apply the fundamental subjective rights of Nombre81093 and Nombre81093.
Regarding the likelihood of success on the merits (apariencia de buen derecho) and the injuriousness action decided here, they consider it to be a denial for denial’s sake of their subjective right, to which they obtained access and entitlement through "rectification." The State’s position and defense, and now that of the Judge based on the manner in which she rules, is that by annulling the rectification of the survey plan, Nombre81093 and Nombre81093 are left in limbo. In other words, merely because of that fact, even though they possess the property and civil and agrarian legislation protects their possession, state officials may enter their farm, destroy houses and fences, release livestock to wander, burn farming implements, and destroy the property of these humble farmers, in addition to the legal dispossession, "in dubio pro natura," which is set against the individuals and their property.- The declaration of injuriousness (lesividad)—they contend—is based on reasons of expediency or convenience, and by legal mandate and under any other argument, such as nullity for nullity’s own sake, it must entail damages, which are absent from the declaration, in addition to other grounds of illegality that render that ruling unlawful and absolutely null and void.
In any event, Article 301 of the Código Civil provides that the survey (mensura) of a parcel of land, whether or not contested, is not by itself sufficient to prove possession of that same land. For this reason, they do not understand the resolve and haste in declaring injuriousness in an attempt to dispossess them and now, with the support of a judicial decision, subject them to a state of poverty—not because the law so authorizes, but because a judicial decision so declares, contrary to the interests of human beings and their property, while claiming to protect nature—hence the dispossession that leaves them emotionally and financially ruined.- B) Regarding Decision No 1335-2013, they state, in summary, the following:
These are two identical decisions that abuse their statutory powers. The court is acting by operation of law (Ministerio de Ley) by prima facie SUPPRESSING AND ELIMINATING SUBJECTIVE RIGHTS (DERECHOS SUBJETIVOS) ARISING FROM A PROPERTY TITLE that is lawful, valid, effective, and enforceable against third parties, as well as a RIGHT OF POSSESSION (DERECHO DE POSESIÓN), in accordance with civil and agrarian legislation, encompassing use, benefit, enjoyment, and transformation. It curtails the constitutional rights of farmers to prior compensation and the RIGHT TO WORK. It deprives them of their primary activity and subjects them to a STATE OF POVERTY because of their sin of having their farm enclosed within a forest reserve. Fundación Neotrópica assembled and donated property that it did not own, and now the State, by virtue of that transfer and through its officials, seeks to discredit the good faith and agricultural and silvicultural activities they carry out, as well as their legitimate right of registered ownership.
Because this is not an expropriation, the judges lack statutory authority to SUPPRESS subjective rights and disregard the registered RIGHT TO PROPERTY; in this case, the Judge A Quo may not REFUSE TO APPLY THE LAW.- The judge knows the law, but in the name of “in dubio pro natura,” their subjective rights are impaired and suppressed, and they are subjected to poverty. Environmental preservation prevails over the social and economic development of the individual and the community. This is in a country that does not generate wealth and where the sale of “knickknacks” (handicrafts and other products) is promoted.
Powers such as Brasil and other developing countries exploit petroleum, natural gas, gold, and other minerals and fisheries, or develop wind and river energy, unlike Costa Rica, where, for example, a group of indigenous people has brought electrical and natural-resource development to a standstill and where the State is apparently powerless before these small groups, as though we were in Venezuela or México, whose economies are sustained by petroleum. Regrettably, they are deprived of their resources and means of subsistence in the name of conservation, but they are given neither options nor solutions: “those affected are left to fend for themselves.” Where is the responsibility of the State and of those who make decisions that affect—or do not affect—the ordinary citizen, who is powerless before the State’s sovereign authority (poder de imperio)?
Regarding the impairment of the property rights of Nombre81093 and Nombre81093, the law applies erga omnes, without exceptions or supplementary applications or interpretations such as the one sought in this matter. In this regard, Article 474 of the Código Civil provides that: “A registration shall not be canceled except by an enforceable judicial order or pursuant to a public instrument or authentic document in which the person in whose favor the registration was made, or that person’s successors in interest or lawful representatives, expresses consent to the cancellation.”- Nombre81093 and Nombre81093 are good-faith purchasers—relying on the public notice, certainty, and security afforded by the Registry—from the previous owner, who registered the property through a possessory title proceeding (Información Posesoria), in good faith and publicly, in which, as required by law, the State’s representative and the IDA, now INDER, were afforded a hearing and entered an appearance, and a judicial inspection (reconocimiento judicial) was conducted at the Site.- Ley de Informaciones Posesorias itself—Articles 16 and 17—provides that, after 3 years have elapsed, the matter must be decided in declaratory proceedings (vía declarativa), subject to the ten-year limitation period (prescripción decenal).
The ownership rights of Nombre81093 and Nombre81093 have vested, because both the 3-year and 10-year periods have already elapsed. According to the attached registry certification, the purchase was registered on 14 de mayo del 2001. The aforementioned limitation period and that established in Article 868 of the Código Civil have been more than satisfied. The only thing that exists is the State’s intent (animus) to impair their legitimate, absolute, and unconditional property right, causing their dispossession contra lege. Accordingly, there is no legal basis for the Judge’s ruling.
They request that the decision be reversed and that the application for interim relief (medida cautelar) be denied in all respects, preserving their constitutional and statutory rights until the final decision is rendered.
It has been reiterated on many occasions that every interim measure (medida cautelar) has a series of structural characteristics and requirements for its admissibility. The so-called periculum in mora must be concurrently present (the claimant’s reasonable and objectively well-founded fear that the substantive legal position asserted may be seriously harmed or gravely and irreparably impaired during the time required for issuance of the judgment on the merits. Article 91.2 of the Ley Reguladora de la Jurisdicción Contenciosa Administrativa). There is also the fumus boni iuris, or appearance of a valid legal claim, translated into a hypothetical assessment of the plausibility of the substantive legal position and the corresponding likelihood that the principal claim will succeed in the final judgment. And, of course, the competing interests must also be weighed. The appellant’s argument appears attractive in terms of his clients’ interests, but it does not persuade this Court.
One cannot speak of “property” in the abstract, but rather of specific “properties.” On the one hand, there is the individual constitutional right and guarantee that property is inviolable; no one may be deprived of it except for a legally established public interest, upon prior compensation in accordance with the law; as well as the rights of possession, use, enjoyment, benefit, transformation, defense, exclusion, restitution, and compensation encompassed by ownership or absolute title to privately owned real property. Notwithstanding its status as private property, however, it is subject to certain encumbrances, obligations, restrictions, or limitations imposed by law for the benefit of neighboring properties or for reasons of public benefit and/or on grounds of public utility, governed by special statutes and regulations (Article 45 of the Constitution and Articles 264, 383, and 384 of the Civil Code).
This applies, for example, to urban planning, land registry matters, water, and construction. In this regard, the Legislature has the power to impose limitations on property in the social interest. There are also public things—real property that everyone may use because it has been dedicated to public use, and property permanently designated by law for any service of general benefit. Such property is subject to an administrative legal regime—for example, regarding how those public things or assets may be used and enjoyed. There is also the constitutional social right and guarantee of every person to a healthy and ecologically balanced environment, which the State shall guarantee, defend, and preserve (Articles 45 and 50 of the Constitution). Environmental law and/or the right to the environment therefore permeates both public property and activities and private property and activities. Accordingly, there are different forms of property, just as real properties—both public and private—differ in their nature, cover, appurtenances, location, size, use, function, suitability, legal designation, or intended purpose—whether natural or legal—and so forth; all are therefore subject to certain encumbrances, obligations, restrictions, or limitations for reasons of public benefit and/or on grounds of public utility, arising from and as a consequence, for example, of Environmental Law, which derives, of course, from the social right to a healthy and ecologically balanced environment and its corresponding public guarantee, defense, and preservation.
It is therefore no coincidence that there are various statutes—and their corresponding implementing regulations—such as, for example, the Ley de Creación del Servicio de Parques Nacionales, No. 6084, de 24 de agosto de 1977, the Ley de conservación de la vida silvestre, No. 7317, de 30 de octubre de 1992, the Ley Orgánica del Ambiente, No. 7554, de 4 de octubre de 1995, the Ley Forestal, No. 7575, de 13 de febrero de 1996, and the Ley de Biodiversidad No. 7788 del 30 de abril de 1998. Nor should the international conventions approved and ratified by Costa Rica, which have supra-statutory force, or the constitutional case-law doctrine—with erga omnes effect—of the Sala Constitucional on this subject be overlooked. Indeed, through the last-mentioned statute, express legal recognition was given to the precautionary principle (principio precautorio), or in dubio pro natura (Principle 15 of the 1992 Rio Declaration (U.N.)), cited by the A Quo Judge, by establishing it in subsection 2) of Article 11 of that statute as one of the various criteria for its application.
Ergo, contrary to the appellant’s contention, this is not simply a matter of declining to apply, eliminating, denying, or stripping away, in his case, the normative content of Articles 33 and 45 of the Constitution and Articles 261 and 317 of the nineteenth-century Civil Code, much less doing so in a final, definitive, and permanent manner. It is simply a matter of two judicial rulings—interlocutory rulings, as acknowledged—that are instrumental and ancillary within the two consolidated proceedings and that decide the respective applications for interim measures. Before judgment and in order to ensure its effectiveness should the State’s claim succeed, those rulings provisionally, temporarily, proportionately, and on stated grounds order the removal of animals and persons from the disputed land and prohibit the carrying out thereon, directly or through other persons, of drainage work, brush clearing (chapeas), or the removal, damage, or destruction of plants, forest cover (cobertura forestal), shrubs, or palms (any type of trees, shrubs, or palms); any land-use change (cambio de uso de suelo); construction; tree cutting; or timber extraction from other areas of the disputed land.
They also order that no forest harvesting (aprovechamiento forestal) be approved, that implementation of any pending management plans (planes de manejo)—should any exist—be suspended, and that no construction permits be granted in the disputed area, until the judgment on the merits is issued or until otherwise ordered during these proceedings. They do not decide the merits, as the appellants appear to understand; those issues must be resolved by judgment. This constitutes a reasonable exercise of the authority conferred on the Judge by Article 242 of the CPC to determine appropriate protective measures (medidas precautorias)—for example, prohibiting specified acts—to prevent harm when there is a well-founded fear that, before judgment, one party may cause serious and difficult-to-remedy injury to the other party’s rights. On the one hand, the Judge weighed the subjective right claimed by both Nombre81093 and Nombre81093 as the legal basis for the principal relief sought in their complaint, as well as the apparent legal soundness of the State’s proceeding for a declaration of injuriousness (proceso de lesividad).
This does not entail a final determination on the merits as to whether the latter action is well-founded, but merely a provisional and instrumental assessment of probability concerning the temporary propriety of the protective measures ordered. The dispute concerns real property or a portion of real property that both Nombre81093 and Nombre81093 claim as their own and that the State, by contrast, claims as its own, as land dedicated to the public domain. This must be decided in the judgment on the merits. In short, the Judge merely weighed or balanced the private interests of Nombre81093 and Nombre81093, Nombre81093, against the public interest, which is not necessarily always that of the Administration, but rather the expression of the coinciding individual interests of the governed, as defined by the Ley General de la Administración Pública. In this case, those interests are none other than the coinciding interests of Costa Rican voters in sustainable development, meaning the social and economic development of individuals and the community in harmony with nature, by virtue of the right to a healthy and ecologically balanced environment.
In this case and under our system of delegated representation, those interests are expressed through the provisions adopted with equal concurrence—at least by a majority—by legislators in the constitutional and statutory provisions cited above. This entails, among other things, establishing and declaring national parks, biological reserves, wildlife refuges, forest reserves, and protective zones, as well as guaranteeing, defending, and preserving them environmentally for as long as the aforementioned administrative legal regime remains in force. That regime is an expression of the legislative authority and majority will delegated by the electorate to the Asamblea Legislativa through suffrage. It is a different matter that the individual interests of Nombre81093 and Nombre81093, Nombre81093, or those of their attorney, dissent in these proceedings from that worldview and from that legally codified public interest.
As he acknowledges, that is his position; it is respected but not shared. The claims in the proceeding for a declaration of injuriousness seek annulment of registered cadastral plats (planos catastrados) and land-registry entries (inscripciones registrales). Ergo, contrary to his argument, this is not a declaration of injuriousness based on reasons of expediency or convenience. Nor does it involve unilateral revocation by the Administration on its own initiative in administrative proceedings. Accordingly, the compensation mechanism presupposed by that legal device likewise does not apply. The issue of compensation depends on the outcome of the consolidated proceedings—the ordinary proceeding and the proceeding for a declaration of injuriousness. It therefore cannot be decided in advance in the ancillary proceedings concerning interim measures, much less finally and definitively. Moreover, and without prejudice to the foregoing, it should be noted that the possibility of requiring a counter-security (contracautela) was not even raised for consideration.
Accordingly, the allegation of a violation through nonapplication of the third paragraph of Article 37 of the Ley Orgánica del Ambiente—not Article 36 of the Ley de Biodiversidad—is rejected. That paragraph provides: “...Private properties affected as provided in this Article because they are located within national parks, biological reserves, wildlife refuges, forest reserves, and protective zones shall become part of state-protected areas only once they have been paid for or lawfully expropriated, except where they are voluntarily placed under the Régimen Forestal. In the case of forest reserves, protective zones, and wildlife refuges, if payment or expropriation has not occurred, and until it occurs, the areas shall be subject to an environmental land-use plan (plan de ordenamiento ambiental) that includes an environmental impact assessment (evaluación de impacto ambiental) and, subsequently, to the plan for the management, recovery, and restoration of resources.” (Emphasis added.
The preceding paragraph was amended by Article 72, subsection c), of the Ley Forestal, N° 7575 del 13 de febrero de 1996, which was in turn amended by Article 114 of the Ley de Biodiversidad, N° 7788 de 30 de abril de 1998). Since this is a matter—a procedural claim for compensation—to be decided on the merits by judgment, the appellant generally fails to clarify whether the protective measures ordered are appropriate, and does not rebut the urgency or necessity asserted by the State concerning the possible adverse and supervening consequences that could arise if the requested interim relief is not granted.
The remaining arguments, namely, in summary: That they are not squatters, but rather good-faith purchasers (adquirentes de buena fe) of a property located within the National Park; that one day Fundación Neotrópica claimed ownership of certain lands, drew a boundary line, transferred them to the State, and thus expanded Parque Nacional Tortuguero; that the Foundation assembled and donated property that did not belong to it and that now, because of that transfer, government officials seek to discredit their good faith, the agricultural and forestry activities they carry out, and their registered property right (derecho de propiedad registral); they complain that officials may enter their farm, destroy houses and fences, remove livestock and leave it to wander, burn farming implements, and destroy their livelihood as small-scale farmers; that they are now being dispossessed of their land without prior compensation, despite holding title and possession; that the declaration of harmfulness (lesividad) is a denial for denial’s sake of the right to which they obtained access, as well as of their right arising from the “correction” (rectificación); that it is not true that annulling the survey-plan correction would leave them in legal limbo; and that they are good-faith purchasers—protected by the public notice afforded by the Property Registry (publicidad registral)—from the previous owner, who registered the property through possessory information proceedings (Información Posesoria), in good faith and publicly, with notice to public bodies and entities and an on-site inspection, and that their ownership has become final because the limitation periods (plazos de prescripción) have already expired, are dismissed as inadmissible in these precautionary-measure proceedings (procesos de medidas cautelares), since they concern the merits (fondo) of the main proceeding or proceedings, to be determined in the judgment.
THEREFORE
For the reasons stated, the appealed decisions are affirmed.

Goicoechea, a las catorce horas con veinte minutos del veintiuno de diciembre de dos mil dieciséis. - Apelación en incidentes de medida cautelar atípica promovidos por EL ESTADO dentro de los siguientes procesos acumulados: ordinario contencioso administrativo de Nombre81093 y Nombre81093 , contra el ESTADO, expediente 06-1333-0163-CA, y ordinario de lesividad del ESTADO, contra Nombre81093 y Nombre81093 , expediente 07-001253-0163-CA.
RESULTANDO
"POR TANTO: De conformidad con lo indicado en el considerando I de esta resolución, siendo que en el presente proceso acumulado existen dos medidas cautelares gestionadas, una del proceso 07-001253-0163-CA y la otra del presente acumulado 06-001333-0163-CA, se determina resolver cada una por separado, limitándose la presente a la medida interpuesta originalmente dentro del proceso 06-001333-0163-CA. Se acoge la solicitud del Estado, y en consecuencia se otorga una medida cautelar atípica proporcional, que guarde relación con la pretensión principal y que garantice en forma efectiva y eficaz lo resuelto en sentencia -de prosperar la pretensión del Estado-, por lo que se ordena: El desalojo de animales y personas del terreno en litigio y la abstención de efectuar en él, (directamente o por medio de otras personas) drenajes, chapeas, eliminación, daño o destrucción de plantas, cobertura forestal, arbustiva o palmácea (cualquier tipo de árboles, arbustos o palmas); cambio de uso de suelo; y construcciones, así como corta de árboles o extracción de madera de otras áreas del terreno en disputa. Lo anterior hasta el dictado de la sentencia principal o hasta tanto no se disponga otra cosa en el transcurso de este proceso. Se resuelve sin especial condena en costas. Notifíquese. Oriana Dávila Hilarión. Jueza.-(fs. 198 208 del legajo del incidente).
"POR TANTO: De conformidad con lo indicado en el considerando I de esta resolución, siendo que en el presente asunto acumulado existen dos medidas cautelares gestionadas, una del presente proceso 07-001253-0163-CA y la otra del proceso 06-001333-0163-CA, se determina resolver cada una por separado, limitándose la presente a la medida interpuesta originalmente dentro del proceso 07-001253-0163-CA. Se acoge la solicitud del Estado, y en consecuencia se otorga la siguiente medida cautelar: Se ordena remitir mandamientos dirigidos al Ministerio de Ambiente y Energía; Área de Conservación Tortuguero, para que no se apruebe ningún aprovechamiento forestal, se suspenda la ejecución de planes de manejo que estén en trámite –en caso de existir alguno-; y a la Municipalidad de Pococí, para que no se otorguen permisos de construcción en el área en disputa. En cuanto a la solicitud de que no se cancele monto alguno por concepto servicios ambientales, se rechaza la gestión. Lo anterior hasta el dictado de la sentencia principal o hasta tanto no se disponga otra cosa en el transcurso de este proceso. Entiéndase denegado lo no expresamente concedido. Se resuelve sin especial condena en costas. Notifíquese. Oriana Dávila Hilarión. Jueza.- (fs. 210-214 del legajo del incidente).

CONSIDERANDO
I.Se aprueba la lista de hechos tenidos por demostrados que contienen los fallos de instancia por corresponder fielmente de lo que consta en autos.
I.La resolución viola la ley, el Estado de Derecho, los principios básicos de coexistencia social y desarrollo económico a que todo individuo tiene derecho ya que se trata de una negación y supresión de derechos constitucionales, civiles y comerciales, que la Jueza desaplica, en aras de tutelar la naturaleza, medio ambiente, en perjuicio del sujeto, al socavar esos derechos. En el país está prohibido todo, como cortar un árbol, pescar, explotar los yacimientos minerales naturales, y como tal no genera o no le permite generar riqueza, ¿como se sostiene un país social y económicamente ante la ausencia de una fuente generadora de riqueza? solo con el endeudamiento internacional, que nos llevaría al caos, aunado a una mala gestión estatal. No se trata de depredar sino de un desarrollo sostenible.
II.La ley no autoriza la supresión de derechos subjetivos, legales y constitucionales, acordados en la sentencia, pues el amparo ante esta Jurisdicción, es de tutela del administrado, en contra del ejercicio de las potestades de impero del Estado, el exceso o desviación de poder o actuaciones de hecho que afecten derechos subjetivos de los particulares. No a la inversa, pues seria ilegal y arbitraria, traer un tema - medio ambiente- en contraposición a la persona, dándole validez supra-legal, para suprimir derechos no autorizados por ley.
III.Transcribe los artículos 8 de la L.O.P.J. y los artículos 33 y 45 constitucionales. Como el tema es ambiente y la afectación de tierras a particulares, en igual sentido y en concordancia esos artículos, la ley de Biodiversidad, articulo 36, establece que con independencia del tipo de afectación (parque nacional, refugio, reserva forestal o cualquier otro), cuando las tierras afectadas, estén en manos y poseidas por particulares, no entraran a formar parte del régimen estatal.-
Dicha tutela se refleja en los artículos 261 y 317 del Código Civil -sobre derechos de posesión y propiedad, defensa, exclusión, uso, goce, disfrute, restitución e indemnización; y, para reclamar la posesión. Y en el articulo 155 de la LGAP, sobre revocación oficiosa de un acto declarativo de derechos subjetivos.
La Constitución y la ley ampara el derecho legitimo y subjetivo de Nombre81093 y Nombre81093, Nombre81093 , de ahí el sustento jurídico de la principal pretensión de su demanda y la inconsistencia legal de la Lesividad. Por lo que no entienden cuando la ley dice una cosa, y la resolución la desaplica interlocutoriamente, y dice otra cosa, contra lege, en perjuicio de sus derechos al concluir que en aras de la naturaleza, no importa se les suprima sus derechos de propiedad, posesión, uso, goce, disfrute, exclusión y defensa, quedando en pobreza y miseria, lo que parece ser política de Estado, pero no de derecho. Violando principios de seguridad y certeza jurídIca.-
SER Y DEBER SER, a propósito de la creación de Parques nacionales o zonas protegidas, naturaleza versus ser humano. Dice haber visto un documental de National Geographic, sobre la última selva prístina en el Congo y Gabón, donde se planteaban, por un lado, la preservación, y por el otro, la necesidad del ser humano de alimentarse con la fauna en ese continente, con hambre, desnutrición, pobreza extrema, muerte, sin servicios públicos. La encargada del documental convenció al Presidente de Gabón y se crearon 12 parques nacionales.‑ Si la política estatal y de algunos ambientalistas, en nuestro pequeño país, es hacer lo mismo, se requiere indemnización previa. Pero, primero se afecta y deja enclavado fincas de particulares, y después quien sabe si el Estado va a cancelar, máxime cuando se resuelve, como ahora, "INDUBIO PRO NATURA", debiendo ser "INDUBIO PRO SER HUMANO". Basta rezar dicho principio acuñado por ambientalistas y se DESPOJA, a las personas, de sus bienes, afectando su ser vital y emocional cuando se es agricultor, no un profesional liberal, y su estabilidad económica.- Estos sujetos forman cinturón de miseria, en la ciudad, en un país, que no genera riqueza, máxime cuando esta lleno de zonas protegidas e impiden un desarrollo sostenible en armonía con la naturaleza.- En el caso de Nombre81093 y Nombre81093, como adquirentes de buena fe, de una propiedad enclavada en un Parque Nacional, no fue que la invadieron.
Sino que un día la Fundación Neotrópica dijo ser dueña de determinadas tierras, trazó una Linea, las traspaso al Estado y así se amplió el Parque Nacional Tortuguero, aunado ahora a la resolución judicial, que dice "in dubio pro natura", y los despoja de su tierra, con un titulo de propiedad y posesión plena, sin "indemnización previa". Hay certeza y seguridad jurídica, o no es ESTADO DE DERECHO, sino la interpretación subjetiva del juzgador de turno. No existe un estado de necesidad y menos procede desaplicar la ley. La resolución es ilegal, contraria a derecho, y desaplica derechos subjetivos fundamentales de Nombre81093 y Nombre81093.
A propósito de la apariencia de buen derecho, y la lesividad que aquí se resuelve- estiman-, es una negación por la negación misma, de su derecho subjetivo, al cual tuvieron acceso, y derecho por "rectificación". La tesis y defensa del Estado y ahora la de la Jueza por la forma en que resuelve, es que anulando la rectificación del plano Nombre81093 y Nombre81093 quedan en el limbo. Sea que, por ese simple hecho, aunque la posean, y la legislación civil y agraria, tutele su posesión, funcionarios estatales pueden ingresar a su finca, a destruir casas, cercas, sacar ganado para que deambule, quemar aperos, y destruir su patrimonio de agricultores sencillos, mas el despojo legal, "in dubio pro natura", que se opone a las personas y su patrimonio.‑ La lesividad -estiman-, es por razones de oportunidad o conveniencia, y por mandato legal y en cualquier otro argumento, como nulidad por la nulidad misma, debe llevar aparejado los daños y perjuicios, lo cual está ausente en la declaratoria, aparte otras razones de ilegalidad que torna ilegal y absolutamente nulo dicho pronunciamiento.
De todas formas, el artículo 301 del Código Civil, dispone que la mensura de un terreno, sea o no protestada, no basta por sí sola para probar la posesión del mismo terreno. Por eso, no entienden, la entereza, y ligereza en la lesividad, para pretender despojar y ahora con apoyo de una resolución judicial, se les someta a un estado de pobreza, no porque la ley así lo autoriza, sino porque una decisión judicial así lo declara en contra de los intereses del ser humano y su patrimonio diciendo que tutela la naturaleza, de ahí el despojo para dejarlo en la quiebra, emocional y patrimonial.- B) Respecto de la resolución No 1335-2013, señalan, en resumen, lo siguiente:
Se trata de dos resoluciones idénticas que abusan de sus potestades legales. El órgano jurisdiccional está actuando por Ministerio de Ley, al SUPRIMIR Y ELIMINAR, prima facie DERECHOS SUBJETIVOS, DE UN TITULO DE PROPIEDAD, justo, valido, eficaz y oponible a terceros, y un derecho de POSESIÓN, acorde con la legislación civil y agraria, de uso, goce, disfrute y transformación. Cercena los derechos constitucionales, de indemnización previa, y DERECHO AL TRABAJO, a agricultores. Los despoja de su actividad primordial, y somete en un ESTADO DE POBREZA, por su pecado de quedar su finca enclavada en una reserva forestal. Debido a que la Fundación Neotrópica reunió y donó lo que no es de su propiedad y que ahora el Estado, por ese traspaso y a través de sus funcionarios, pretenden deslegitimar la buena fe y actividad Agrícola y silvicultural que ejercen así como su derecho legitimo de propiedad registral.
Como no es una expropiación, los juzgadores carecen de potestad legal para SUPRIMIR derechos subjetivos, e irrespetar el DERECHO DE PROPIEDAD, inscrito, que en este caso, la Jueza A Quo no puede DESAPLICAR LA LEY.‑ El juez conoce el derecho, pero en aras "in dubio pro natura", se afecta y suprimen sus derechos subjetivos, y somete a pobreza. Prevalece la preservación ambiental y no el desarrollo social y económico del individuo y la colectividad. En un país que no genera riqueza, y se promueve la venta de "cachivaches" (productos artesanales y otros).
Potencias como Brasil y otros países en desarrollo, explotan petróleo, gas natural, oro, y otros minerales, pesquería, o desarrollan energía, eólica, ríos, y no como Costa Rica en que p. ej: un grupo de indígenas tiene paralizado el desarrollo eléctrico y natural, donde el Estado, en apariencia se ve impedido, ante estos pequeños grupos, como si estuviéramos en Venezuela o México, donde la economía se sostiene por el petróleo. Lamentablemente, se les quita los recursos, medios de subsistencia, en aras de la conservación pero no se les da opciones ni soluciones, " allá los afectados que se las entiendan". ¿Dónde está la responsabilidad estatal, y de quienes toman decisiones que afectan o no al ciudadano común y débil ante el poder de imperio?
Respecto de la afectación al derecho de Propiedad de Nombre81093 y Nombre81093 la ley es aplicable erga omnes, sin excepciones, ni aplicaciones o interpretaciones supletorias, como la que se pretende aplicar en este asunto. En este sentido sentido el artículo 474 del Código Civil, dispone que " No se cancelará una inscripción sino por providencia ejecutoria o en virtud de escritura o documento auténtico, en el cual expresen su consentimiento para la cancelación, la persona a cuyo favor se hubiere hecho la inscripción o sus causahabientes o representantes legítimos".‑ Nombre81093 y Nombre81093 son adquirentes de buena fe - al amparo de la publicidad, certeza y seguridad del Registro -, de su anterior propietaria, que inscribió la finca por Información Posesoria, de buena fe y públicamente, donde por ley se concedió audiencia y apersono la representación del Estado, y el IDA hoy INDER, y realizó un reconocimiento judicial en el Sitio.-.
La propia Ley de Informaciones Posesorias - artículos 16 y 17-, establecen que pasados 3 años se ha de decidir en vía declarativa, bajo la prescripción decenal. La propiedad de Nombre81093 y Nombre81093 está consolidada, porque ya transcurrieron los 3 años y los 10 años. Conforme a certificación registral adjunta, la compra se inscribió el 14 de mayo del 2001. La citada prescripción y la del articulo 868 del Código Civil, están de sobre cumplidos. Solo existe el animus estatal de afectar su derecho de Propiedad, legitimo puro y simple, provocando su despojo contra lege. Luego, no existe razón legal para resolver como lo hizo la Jueza.
Solicitan se revoque la resolución y declare sin lugar en todos sus extremos la medida cautelar, manteniendo sus derechos constitucionales y legales hasta su resolución final.
Se ha reiterado en no pocas oportunidades, que toda medida cautelar, presenta una serie de características estructurales y de presupuestos para su procedencia. Deben concurrir, concomitantemente el denominado periculum in mora (temor razonable y objetivamente fundado de la parte accionante de que la situación jurídica sustancial aducida resulte seriamente dañada o perjudicada de forma grave e irreparable durante el transcurso del tiempo necesario para el dictado de la sentencia principal. Artículo 91.2 de la Ley Reguladora de la Jurisdicción Contenciosa Administrativa). Por otra parte está el fumus boni iuris o apariencia de buen derecho, es decir, traducido en un juicio hipotético de verosimilitud acerca de la situación jurídica sustancial y su correspondiente éxito de la pretensión principal en la sentencia definitiva. Y también, desde luego, la ponderación de los intereses en pugna. El discurso del apelante luce atractivo, para los intereses de sus clientes, pero no convence a este Tribunal.
No se puede hablar de "la" propiedad, en abstracto, sino de "las" propiedades, en concreto. Por un lado tenemos, el derecho y garantía individual constitucional, de que la propiedad es inviolable; a nadie puede privarse de la misma si no es por interés público legalmente comprobado, previa indemnización conforme a la ley; así como los derechos de posesión, uso, goce, disfrute, transformación, defensa, exclusión, restitución e indemnización, que comprende el dominio o propiedad absoluta sobre una cosa inmueble privada. La cual, no obstante su carácter de propiedad privada, está sujeta a ciertas cargas, obligaciones, restricciones o limitaciones que la Ley le impone en favor de los predios vecinos o, por motivos de pública utilidad y/o por causa de utilidad pública, regidas por leyes y reglamentos especiales (artículo 45 constitucional, 264, 383 y 384 del C.Civ.). Por ejemplo en materia de planificación urbana, catastro, aguas y construcción.
En este sentido tenemos, la potestad legislativa de imponer a la propiedad limitaciones de interés social. También tenemos las cosas públicas - bienes inmuebles de que todos pueden aprovecharse por estar entregados al uso público, y los que por ley están destinados de un modo permanente a cualquier servicio de utilidad general. Sujetas a un régimen jurídico administrativo -p. ej. sobre el modo de usar y de aprovecharse de esas cosas o bienes públicos. También tenemos el derecho y garantía social constitucional, de toda persona a un ambiente sano y ecológicamente equilibrado, el cual garantizará, defenderá y preservara el Estado (artículos 45 y 50 constitucionales). Derecho ambiental y/o al ambiente que perméa, en consecuencia, tanto los bienes y actividades públicas como los bienes y actividades privadas. En virtud de lo cual tenemos diferentes propiedades, como diversos son los bienes inmuebles -públicos, pero también privados -, por su distinta naturaleza, cobertura, adherencia, ubicación, tamaño, uso, función, vocación, afectación o destino - natural o legal-, etc, sujetos, todos ellos, por lo mismo, a ciertas cargas, obligaciones, restricciones o limitaciones, por motivos de pública utilidad y/o por causa de utilidad pública, con ocasión y como consecuencia, por ejemplo, del Derecho Ambiental, derivado, desde luego, del derecho social a un ambiente sano y ecológicamente equilibrado, y su correspondiente garantía, defensa y preservación, públicas.
No por causalidad tenemos, entonces, diversas leyes - y sus reglamentos ejecutivos correspondientes-, como son, por ejemplo la Ley de Creación del Servicio de Parques Nacionales, No. 6084, de 24 de agosto de 1977, la Ley de conservación de la vida silvestre, No. 7317, de 30 de octubre de 1992, la Ley Orgánica del Ambiente, No. 7554, de 4 de octubre de 1995, la Ley Forestal, No. 7575, de 13 de febrero de 1996, y Ley de Biodiversidad No. 7788 del 30 de abril de 1998 . Sin dejar de lado las convenciones internacionales aprobadas y ratificadas, por Costa Rica, con valor supra legal; y la doctrina jurisprudencial - con efectos erga omnes-, de la Sala Constitucional, sobre el tema. Tanto así que mediante la última ley mencionada se le dio cobertura - positiva-, al principio precautorio o indubio pro natura (principio 15 de la Declaración de Río de 1992 (O.N.U. ), reseñado por la Jueza A Quo, al establecerse, en el inciso 2) del artículo 11, de esa Ley, como uno de los distintos criterios, para su aplicación.
Ergo, no se trata -como aduce el apelante, de una desaplicación, supresión, negación o despojo, sin más, en su caso, del contenido normativo de los artículos 33 y 45 constitucionales, y 261 y 317 del Código Civil, decimonónico, menos que menos final, definitiva y permanente, sino, sencillamente, de dos resoluciones judiciales -interlocutorias como se admite-, instrumentales y accesorias, dentro de los dos procesos acumulados, que deciden, sendos incidentes de medidas cautelares, determinando, de forma motivada, con carácter provisional, temporal y proporcional, antes de la sentencia, para garantizar su eficacia, -de prosperar la pretensión del Estado-, el desalojo de animales y personas del terreno en litigio y la abstención de efectuar en él (directamente o por medio de otras personas) drenajes, chapeas, eliminación, daño o destrucción de plantas, cobertura forestal, arbustiva o palmácea (cualquier tipo de árboles, arbustos o palmas); cambio de uso de suelo; construcciones, corta de árboles o extracción de madera de otras áreas del terreno en disputa; y, que no se apruebe ningún aprovechamiento forestal, se suspenda la ejecución de planes de manejo que estén en trámite –en caso de existir alguno-; y no se otorguen permisos de construcción en el área en disputa; hasta el dictado de la sentencia principal o hasta tanto no se disponga otra cosa en el transcurso de este proceso; y no las cuestiones de fondo, como parecen entender los apelantes-, mismas que deben ser resueltas por medio de sentencia.
En ejercicio razonable de las facultades que el artículo 242 del CPC, le confiere a la Jueza para determinar las medidas precautorias adecuadas - p.ej, prohibir la práctica de determinados actos-, para evitar el daño, cuando hubiere fundado temor de que una parte, antes de la sentencia, le cause al derecho de la otra parte una lesión grave y de difícil reparación. Ponderando, por un lado, el derecho subjetivo que tanto Nombre81093 como Nombre81093, reclaman, como sustento jurídico de la principal pretensión de su demanda, como también, la aparente consistencia legal del proceso de lesividad, del Estado. Que no supone, un juicio final, de fondo, sobre la procedencia de esta última acción, sino tan solo un juicio de probalidad, provisional, instrumental, de cara a la procedencia, temporal, de las medidas precautorias dispuestas. Siendo que se trata de una disputa, sobre un bien inmueble o porción de un bien inmueble, que tanto Nombre81093 como Nombre81093, reclaman como suyo; y que El Estado, reclama, por el contrario, como suyos, como terrenos afectados al dominio público.
Lo cual habrá de decidirse en sentencia de fondo. En fin, la Jueza no hizo sino un ejercicio de ponderación o balance entre el interés privado, de los señores Nombre81093 y Nombre81093, Nombre81093 , y el interés público, que no necesariamente es siempre el de la Administración sino, la expresión de los intereses individuales coincidentes de los administrados, como lo define la Ley General de la Administración Pública. Que no son sino, en este caso, los intereses coincidentes de los costarricenses, sufragistas, a un desarrollo sostenible, esto es a un desarrollo social y económico del individuo y la colectividad en armonía con la naturaleza, en virtud del derecho a un ambiente sano y ecológicamente equilibrado, expresados, en este caso, en virtud de nuestro sistema de representación por delegación, en lo dispuesto, con igual coincidencia - al menos mayoritaria-, por los legisladores, en las normas constitucionales y legales supra citadas.
Lo cual supone, entre otras cosas, el establecimiento y declaratoria de parques nacionales, reservas biológicas, refugios de vida silvestre, reservas forestales y zonas protectoras, así como su garantía, defensa y preservación ambiental, mientras no sea derogado el régimen jurídico administrativo, precitado. Siendo como lo es, expresión de la potestad y voluntad legislativa mayoritaria, delegada por el cuerpo electoral, en la Asamblea Legislativa, por medio del sufragio. Cosa distinta es que el interés individual de los señores Nombre81093 y Nombre81093, Nombre81093 , o bien de su abogado, sea disidente, en el presente juicio, con esa visión del mundo, con ese interés público positivizado. Lo cual -como admite- constituye su posición, que se respeta, pero no se comparte. Las pretensiones del proceso de lesividad son de nulidad de planos catastrados e inscripciones registrales. Ergo no es cierto - según su argumento-, que se trate de una lesividad por razones de oportunidad o conveniencia.
Tampoco se trata de una revocación unilateral y oficiosa de la Administración, en sede administrativa. En razón de lo cual tampoco aplica el supuesto indemnizatorio que esa figura presupone. El tema de la indemnización pende de las resultas de los procesos - ordinario y de lesividad -, acumulados. Sin que se pueda decidir, por ende, anticipadamente, dentro de los procesos incidentales, de medidas cautelares, menos con carácter final, definitivo. Téngase en cuenta, a mayor abundamiento y sin perjuicio de lo expuesto que ni siquiera se esbozó -para su análisis- la eventualidad de imponer el otorgamiento de una contracautela. En razón de lo cual se rechaza el alegato de violación por desaplicación del párrafo tercero del artículo 37 de la Ley Orgánica del Ambiente - que no del 36 de la Ley de Biodiversidad-, que establece que: "...Las fincas particulares afectadas según lo dispuesto por este artículo, por encontrarse en parques nacionales, reservas biológicas, refugios de vida silvestre, reservas forestales y zonas protectoras, quedarán comprendidas dentro de las áreas protegidas estatales solo a partir del momento en que se hayan pagado o expropiado legalmente, salvo cuando en forma voluntaria se sometan al Régimen Forestal.
Tratándose de reservas forestales, zonas protectoras y refugios de vida silvestre y en caso de que el pago o la expropiación no se haya efectuado y mientras se efectúa, las áreas quedarán sometidas a un plan de ordenamiento ambiental que incluye la evaluación de impacto ambiental y posteriormente, al plan de manejo, recuperación y reposición de los recursos.". (negrita suplida. Así reformado el párrafo anterior por el artículo 72, inciso c) de la Ley Forestal, N° 7575 del 13 de febrero de 1996, que a su vez fue reformado por el 114 de la Ley de Biodiversidad, N° 7788 de 30 de abril de 1998). Siendo como lo es, una cuestión - pretensión procesal indemnizatoria- a decidir entonces por el fondo en sentencia. En general, el apelante no clarifica la pertinencia o no de las medidas precautorias dispuestas, no desestima la urgencia o necesidad alegada por el Estado en cuanto a los posibles resultados adversos y sobrevinientes que puedan darse al no acogerse la cautelar pretendida.
Los argumentos restantes, como son, en síntesis: Que no son invasores, sino adquirentes de buena fe, de una propiedad enclavada en el Parque Nacional; un día la Fundación Neotrópica dijo ser dueña de determinadas tierras, trazó una Linea, las traspaso al Estado y así se amplió el Parque Nacional Tortuguero; esa Fundación reunió y donó lo que no era suyo y ahora, por ese traspaso funcionarios estatales pretenden deslegitimar la buena fe y actividad Agrícola y silvicultural que ejercen así como su derecho de propiedad registral; reprochan que pueden ingresar a su finca, a destruir casas, cercas, sacar ganado para que deambule, quemar aperos, y destruir su patrimonio de agricultores sencillos; ahora se les despoja de su tierra, sin indemnización previa, pese a tener título de propiedad y posesión; la lesividad es negación por la negación misma, de su derecho al cual tuvieron acceso, y derecho por "rectificación"; no es cierto que anulando la rectificación del plano quedan en el limbo; son adquirentes de buena fe - al amparo de la publicidad registral-, de su anterior propietaria, que la inscribió por Información Posesoria, de buena fe y públicamente, con audiencia a órganos y entes públicos y reconocimiento en el sitio, y su propiedad está consolidada por haber pasado ya los plazos de prescripción, se desestiman, por su improcedencia, dentro de los presentes procesos de medidas cautelares, siendo como lo son, cuestiones sobre el fondo del proceso o procesos principales, a determinarse en sentencia
POR TANTO
Por las razones dadas, se confirman las resoluciones apeladas.
