SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At thirteen hours and forty-three minutes on the twenty-first of March, two thousand eighteen.- ORDINARY PROCEEDING instituted by [Nombre1], of legal age, married, identification card CED1, resident of Bagaces, Guanacaste, against [Nombre2], of legal age, married, identification card CED2, resident of Cañas, Guanacaste. Roberto Segnini Villalobos, bar card CED3, and Mariela Angulo Pizarro appear as legal counsel (apoderado judicial) and public defender, respectively. The Instituto de Desarrollo Rural (INDER), identification card CED4 - -, was admitted as an interested third party (tercero interesado), represented by its general legal attorney-in-fact (apoderado general judicial), Luis Miranda Guadamúz, of legal age, married, attorney, identification card CED5 - -, resident of Liberia. Heard before the Agrarian Court of the First Judicial Circuit of Guanacaste, Liberia.- RECITALS:

  1. 1The plaintiff filed this ordinary action, valued at fifteen million colones, seeking a judgment declaring that: 1) The plaintiff is the owner and cultivated rice on 9.6 hectares at [Dirección1]. 2) The defendant applied Diuron herbicide to his sugarcane crop at [Dirección2] between 21 de abril and the first week of mayo del 2014, and, as a result, the rice-growing area at [Dirección3] was severely affected. 3) The negligent application of the herbicide to the sugarcane caused the plaintiff serious material and economic damage, for which the defendant is liable; accordingly, the defendant must be ordered to pay the damages and lost profits (daños y perjuicios) caused to the plaintiff’s rice crop, itemized as follows: a) Damages equal to the value of the rice that would have been produced on the 9.6 cultivated hectares: ¢11113000,043; b) Lost profits: statutory interest (interés legal) pursuant to Article 1163 of the Civil Code until judgment is entered and this case concludes: three million five hundred thousand colones. 4) The defendant be ordered to pay both categories of costs (ambas costas) (fs. 71,72, 76,77).
  2. 2The defendant timely and properly answered this complaint and opposed it by raising the defenses (excepciones) of LACK OF ACTIVE AND PASSIVE STANDING (FALTA DE LEGITIMACIÓN ACTIVA Y PASIVA) and LACK OF A CURRENT LEGAL INTEREST (FALTA DE INTERÉS ACTUAL) (f. 98).
  3. 3Judge Ruth Alpízar Rodríguez of the Agrarian Court of the First Judicial Circuit of Guanacaste, Liberia, in judgment number 71-S- 2016, issued at fifteen hours on dos de marzo del año dos mil dieciséis, ruled: “THEREFORE (POR TANTO): The defenses of lack of passive and active standing and lack of a current legal interest raised by the defendant are denied. This ordinary action instituted by [Nombre3] against [Nombre2] is declared PARTIALLY GRANTED, as set forth below; any relief not awarded shall be deemed denied, and any relief awarded differently from that requested shall be deemed modified accordingly:1) The defendant is ordered to pay the plaintiff the damages and lost profits caused to the rice crop at [Dirección4], in abril y mayo del dos mil catorce, for the income not received due to the value of the rice lost as a result of the reduced yield harvested from six point four hectares, which is fixed at FIVE MILLION THREE HUNDRED SEVENTY-SIX THOUSAND SIX HUNDRED ONE COLÓN AND SEVENTY-FIVE CÉNTIMOS (¢5376601,75).2) From the date the foregoing award becomes final (adquiera firmeza) until payment in full, the defendant shall pay interest on that amount at the statutory rate, which for these purposes shall be the rate paid by the Banco Nacional de Costa Rica on six-month certificates of deposit denominated in colones.3) This proceeding is resolved without a specific award of costs.- (folios 162 a 173)
  4. 4The defendant filed an appeal (recurso de apelación), expressly stating the grounds relied upon to challenge the trial court’s reasoning. (folios 176 a 179)
  5. 5The statutory requirements have been observed in the conduct of the proceeding, and no errors or omissions capable of rendering the judgment null and void are apparent.-

Drafted by Judge Picado Vargas; and, CONSIDERATIONS (CONSIDERANDO)

I. The list of facts deemed proven is adopted because it is consistent with the evidentiary record (acervo probatorio).-

II. The findings regarding the unproven facts are affirmed because they lack evidentiary support.-

III.The defendant’s Agrarian Public Defender appeals the aforementioned decision, asserting the following: SUBSTANTIVE GROUNDS FOR APPEAL (AGRAVIOS DE FONDO): She contends that the plaintiff did not prove the damages and lost profits that the defendant was ordered to pay because, since the plaintiff was carrying out a pilot plan of [Nombre4], it did not produce good yields and generated losses. On this point, she considers [Nombre5]’s testimony biased because he is an employee of [Nombre4] and has an interest in holding a third party liable, thereby absolving his employer of any liability. Nor are the statistics used to calculate the lost profits credible, since this was the first time the plaintiff had participated in the pilot plan and the statistics were provided by CONARROZ itself. Furthermore, the defendant was not negligent because, according to [Nombre6]’s testimony, the necessary mechanisms were used to perform the spraying in accordance with the regulations in force; the 200-meter strip that was not burned was maintained; a 2.5 nozzle, which is the recommended type and minimizes spray drift (deriva de pulverización), was used; and that nozzle, together with the strip, wall, and firebreak (ronda), means that the defendant could not have been responsible for the damage attributed to him (folios 176 a 179).-

IV.We are dealing with an ordinary proceeding (proceso ordinario) in which compensation for damages and losses (daños y perjuicios) to a rice plantation is sought due to the use of an herbicide applied on an adjoining farm devoted to sugarcane cultivation. Pursuant to articles 2, 98 and 101 of the Ley Orgánica del Ambiente and article 32 of the Ley de Protección Fitosanitaria, the liability regime applicable to this case is strict liability (Responsabilidad Objetiva), since the application of pesticides (chemical, biological or biochemical substances in agriculture) inherently constitutes a hazardous activity, and, under these provisions, those who carry it out are required to compensate for the damages and any resulting losses they cause. This is what case law (jurisprudencia) and legal scholarship (doctrina) have termed the theory of created risk (teoría del riesgo creado): “V. (...) It is the Ley de Protección Fitosanitaria number 7664 and the Ley de Aviación Civil number 5050 of 11 de diciembre de 1972 that govern it.

The former provides: ‘Those who import, manufacture, formulate, rebottle, repackage, distribute, store, transport, sell, and apply chemical, biological, or related substances for agricultural use shall be required to compensate for the damages and losses that their acts or omissions cause to agriculture, livestock farming, human health, and the environment’ (article 32). The latter establishes: ‘Any natural or legal person who uses aircraft intended for agricultural aviation shall be liable for damage caused to persons or third-party property on the surface’ (article 107). Both clearly establish strict liability; neither requires the victim to prove any subjective element of attribution (elemento subjetivo de imputación). It is therefore sufficient to prove the damage and the causal relationship (relación de causalidad) in order to attribute civil liability (responsabilidad civil) to the parties who are objectively required to answer for it under the cited provisions.

In a case similar to the present one, the Chamber recognized strict liability, which is more imperative than ever in the face of ecological problems (Sala Primera de la Corte Suprema de Justicia, Voto No. 607-F-02 de las 16:15 horas del 7 de agosto del 2002.).-” This Court has stated the following regarding the application of the strict-liability regime to damage caused by agrochemicals: “VII.- (...) However, given what occurred in this matter, the legal analysis of the grounds for appeal (agravios de la apelación) cannot be limited solely to matters relating to the purchase and sale of a product, as the plaintiff seeks, because there is a subsequent stage: its application by air. Moreover, in the case of damage caused by products, modern consumer-law scholarship has developed novel criteria that are not confined to the contractual sphere, owing to the particular implications of their production, processing, marketing, and use.

In this regard, the Ley 7472 de Promoción de la Competencia y defensa Efectiva del Consumidor governs the rights of consumers and the obligations of merchants and manufacturers in articles 32 and 34. One of the most important is precisely the right to information (derecho de información). Section 35 of that Law also establishes a strict-liability regime by imposing on the producer, supplier, or merchant the duty to answer regardless of the existence of fault if the consumer suffers harm because of the good or service, inadequate or insufficient information concerning it, or its use and risks. Only a person who proves that they had no involvement in the damage is relieved of liability. It further states that legal representatives or persons responsible for businesses are liable for acts or events attributable to employees or assistants. In this case, however, given the matters in dispute, it is not alleged that the duty to provide information was breached, since the plaintiff alleges the erroneous delivery of a product; nor can this therefore be deemed a case of liability for a defective product, and neither would the allegation, even if proven, provide grounds for applying the performance warranty (garantía de funcionamiento) governed by sections 43 of the cited Law and 452 of the Código de Comercio.

VIII.- Furthermore, in matters of contractual or noncontractual, strict or fault-based civil liability (responsabilidad civil contractual o extracontractual, objetiva o subjetiva), regardless of whether the subject matter is agricultural, civil, or commercial, a claim may be allowed only if there is damage or loss attributable to or caused by the party being sued. Damage means ‘any impairment, loss, or detriment to a person’s patrimonial or non-patrimonial legal sphere (the injured party), resulting in the deprivation of a legally protected interest whose preservation could objectively have been expected had the harmful event not occurred. Under this view, there is no civil liability in the absence of damage, just as there is no damage without an injured party. Furthermore, only damage that is proven (its actuality or existence) is compensable, this being a question of fact reserved to the sound discretion of the adjudicator…’ (Sala Primera de la Corte Suprema de Justicia, voto Nº114 de las 16:00 horas del 2 de noviembre de 1979).

In addition to being actual, certain, effective, and deserving of legal protection, the damage must have been caused by a third party and must still exist when the action is filed. There must also be a causal relationship between the unlawful act (hecho ilícito) and the damage sustained.” Tribunal Agrario, Voto No. 814-F-03 de las 14:45 horas del 16 de diciembre del 2003.- Strict liability is not confined to the consumer-law perspective; it also arises from legislation governing agrochemicals. The defendant is therefore incorrect in asserting that it does not apply to the present matter, as the Sala Primera has held: “V. (...) It is the Ley de Protección Fitosanitaria number 7664 and the Ley de Aviación Civil number 5050 of 11 de diciembre de 1972 that govern it. The former provides: ‘Those who import, manufacture, formulate, rebottle, repackage, distribute, store, transport, sell, and apply chemical, biological, or related substances for agricultural use shall be required to compensate for the damages and losses that their acts or omissions cause to agriculture, livestock farming, human health, and the environment’ (article 32).

The latter establishes: ‘Any natural or legal person who uses aircraft intended for agricultural aviation shall be liable for damage caused to persons or third-party property on the surface’ (article 107). Both clearly establish strict liability; neither requires the victim to prove any subjective element of attribution. It is therefore sufficient to prove the damage and the causal relationship in order to attribute civil liability to the parties who are objectively required to answer for it under the cited provisions. In a case similar to the present one, the Chamber recognized strict liability, which is more imperative than ever in the face of ecological problems (Sala Primera de la Corte Suprema de Justicia, Voto No. 607-F-02 de las 16:15 horas del 7 de agosto del 2002.).-” Applying agrochemicals is an activity that entails a risk to consumers, the environment, and agricultural producers, which creates strict liability for anyone who assumes that risk by engaging in the activity.

On another occasion, the Sala Primera stated: “VII. (...) The basis of this theory is very simple. This is not the fault-based liability (responsabilidad subjetiva) provided for in section 1045 of the Código Civil, because under that theory the injured party must prove the causal nexus (nexo causal) between the harmful agent’s act and the losses sustained. Under strict liability, the mere existence of damage gives rise to the presumption that the harmful agent was responsible for causing it and must therefore compensate for the damages and losses caused by their conduct. This does not arise from an arbitrary act but from pure logic, because anyone who, even while engaging in lawful conduct, assumes a risk involving danger must answer for all damage that such danger may cause. There are many examples of this. If a person handles gunpowder or any kind of flammable material, whether in a factory, in a commercial activity, or for personal amusement, and an accident occurs that affects any neighbor, it is not the injured party who should be required to prove the causal nexus between the conduct undertaken and the damage caused.

Instead, the legal system starts from the culpability of the person who assumed the risk and danger, and that person could be relieved of liability only by proving that they were not directly responsible for the damage caused. The burden of proof (carga de la prueba) is thus reversed, and the defenses (eximentes), which could be applied by analogy in the environmental sphere, would be those established in the Ley General de la Administración Pública, which also provides for the State’s strict liability, namely ‘force majeure,’ ‘fault of the victim,’ or ‘act of a third party’ (article 190).-” (Voto de la Sala Primera N° 398-F-01 de las 16:00 horas del 6 de junio del 2001).- Based on the foregoing judgment, the strict-liability regime extends beyond the contractual or noncontractual context in which the legal relationship between the parties originated. Legal scholarship has interpreted article 704 of the Código Civil as excluding from compensation damage that is not necessarily the result of the breach or that is a remote consequence of the act.

This provision is understood to apply both to contractual and noncontractual civil liability (In that regard, RIVERO SÁNCHEZ (Juan Marcos) Responsabilidad Civil. Tomo II. San José, Editorial Areté, 2001, p. 141). Accordingly, in the sale, distribution, and handling of pesticides, the applicable form of liability is strict liability under the theory of created risk in hazardous activities. That theory establishes that anyone who profits from a hazardous activity (such as selling chemical substances like pesticides) must be liable for the damage they cause; it is found in the Ley de Protección Fitosanitaria, its Reglamento, the Reglamento sobre Registro, Uso y Control de Plaguicidas Agrícolas y Coadyuvantes, the Decreto Ejecutivo que crea Permiso de Operación para la Venta o Expendio de Sustancias Químicas, Biológicas o Afines, and the Ley General de Salud itself. According to the most recent Italian scholarship on damages, the Theory of Created Risk “allows strict-liability criteria to be applied even in cases where, because no business activities are being carried out, the association ‘risk-benefit-liability’ could not be made.

Accidents occurring outside activities that are strictly profit-making are therefore ultimately encompassed by the premise that anyone who employs sources of risk must bear the adverse consequences of their actions.” ALPA ([Nombre7]). Nuevo Tratado de la Responsabilidad Civil, Milán, Giuffré Editori, 1999, p.p.383-384. The scholar Pacchioni states that “when a person organizes an economic activity of their own for profit, that person must certainly bear the disadvantages of their actions and compensate for damage caused to third parties, even when not at fault.” PACCHIONI ([Nombre8].) Diritto Civile Italiano, Parte II, Vol. IV, Papua, 1940, p.11.- Accordingly, this theory proceeds from the general principle articulated in the late nineteenth century by the jurist Vittorio Emanuele Orlando, namely that “anyone who, in operating an enterprise or carrying out any activity whatsoever, causes damage to another’s rights that constitutes a direct or indirect consequence of that activity must compensate for the damage, irrespective of the fact that, in the harmful event, the agent was not negligent or imprudent, or that the event itself, considered in isolation, may appear attributable to an unforeseen event or force majeure.” ORLANDO (Vittorio Emanuele).

Essay on a Theory of the Legal Basis of Civil Liability (Saggio di una teoria sul fondamento guiridico della responsabilitá civile), Roma, 1893, Archivio di diritto pubblico, p.242. In his seminal work “Jurisdiction and Procedure” (“Jurisdicción y procedimiento”), Professor Carnelutti, analyzing this theory in 1934, concludes that “rather than imposing new duties on the entrepreneur, the principle of risk facilitates the distribution of industrial risks.” [Nombre9] (). Giurisdizione e Procedura, Milano, Giuffré, 1987, p.213. . In the present case, at issue is the liability alleged against the defendant, a sugarcane producer, for the damage caused to the rice plantation of the plaintiff, its neighboring landowner, through the application of the agrochemical Diuron. This is a case of strict civil liability (responsabilidad civil objetiva), in which this appeal disputes and challenges causation (relación de causalidad), considered in light of the theory of created risk (teoría del riesgo creado), because the defendant’s activity derives a benefit founded on the risk inherent in the need to apply chemical substances.-

V.Taking into account the considerations explained in the preceding recital (considerando), the Court finds that the appellant’s claims of error are without merit, given that the causal link (nexo de causalidad) between the defendant’s application of the agrochemical Diuron and the damage suffered by the plaintiff’s rice plantation has been fully established. The claim of error is intended to demonstrate that there was fault on the part of the injured party (the plaintiff) or a third party (CONARROZ), and that the defendant’s application of the agrochemical was not the event that caused the damage. The existence of the damage and the causal link have been fully established through an assessment of the evidence as a whole and in accordance with the system of free evaluation of evidence (libre valoración probatoria) under Article 54 of the Ley de Jurisdicción Agraria. Although he did not expressly acknowledge it in the complaint, when giving evidence by confession (prueba confesional), the defendant admitted that he had applied Diuron to his sugarcane plantation during the first half of 2014 (see audio on the attached CD recorded on 5 de agosto del 2015).

According to the expert report (dictamen pericial) prepared by engineer Oscar Rojas, appearing at folio 120, Diuron “is a systemic herbicide absorbed by the roots and transported acropetally through the xylem toward the stems and leaves, where it acts by inhibiting affected plants. It is used to control weeds in non-agricultural areas. It is a selective herbicide for certain crops, including sugarcane.” In other words, this herbicide may be applied to sugarcane, but not to rice (see the photocopy of Agroguía at folio 60, in which rice is not included among the crops to which the products may be applied), because the rice plant differs from sugarcane, and the herbicide affects the rice stems, leaves, and panicles by inhibiting photosynthesis, thereby causing the plant to dry out. According to the expert assessment (peritaje), Diuron was applied on the defendant’s property ([Dirección5] ) between 19 de abril and the first week of mayo del 2014, causing phytotoxicity (fitoxicidad) in the rice plants, which were undergoing the “grain-filling” process; after being absorbed by the roots, its effects first appeared as foliage damage, consequently reducing rice productivity and producing empty grain unsuitable for sale (folio 121).

That expert assessment, prepared by an expert appointed from the Poder Judicial’s list of experts, was based on a field inspection conducted by the expert himself (who is not an employee of CONARROZ) and on other specialized technical and scientific evidence: the “Complaint Response Report” issued by the Departamento de Operaciones Regionales de Bagaces of the Servicio Fitosanitario del Estado, specifically by engineer Gerardo Villarreal Mayorga, who also conducted a field inspection of both plots (those of the plaintiff and the defendant, 56 and [Dirección6], respectively); he concluded that, on the plaintiff’s plot, an area of 6.5 hectares of rice had been affected by scorching caused by a substance phytotoxic to rice, and recommended that a residue analysis be performed (folios 56 to 57). At folio 58 is Record No.6026 concerning “Official Sampling for the Analysis of Pesticide Residues in Vegetables, Water, Soil, and Sediments,” carried out by the Servicio Fitosanitario del Estado on the plaintiff’s property, specifically on the foliage of the plaintiff’s rice plants, in which a Diuron concentration of 0.062 milligrams was found (reverse of folio 58).

The statement by the technical witness (testigo-técnico) challenged by the appellant, Mr. [Nombre5] , that Diuron was the agent external to the pilot plan that caused the damage to the rice plants, is supported by the expert evidence (prueba pericial) of engineer [Nombre10] and the sampling conducted by the Servicio Fitosanitario del Estado, and not solely by [Nombre4]’s Report at folio 22, as the appellant attempts to argue. This Court therefore finds that the witness was not unduly accommodating, despite his employment relationship with CONARROZ, because there is scientific certainty regarding the incompatibility of that agrochemical with rice and its high concentration in the plaintiff’s rice plantation, at least within the 6.5 hectares of rice affected. That witness clearly stated that the Sistema Fitosanitario del Estado performed sampling in both affected and unaffected areas and that he observed upright panicles containing empty grain, which is consistent with engineer Rojas’s expert evidence.

Accordingly, the damage suffered is attributable neither to the plaintiff nor to [Nombre4], because the causal link has been fully established. It should be recalled that, in matters of strict liability (Responsabilidad objetiva), there is no requirement to prove intent or fault (negligence, lack of expertise, or recklessness) on the part of the person who caused the damage, but rather the objective occurrence of the damage and the causal link, which directly attributes it to the defendant’s handling of Diuron between 19 de abril and the first week of mayo del 2014. Although the witness cited by the appellant, [Nombre6], stated that the pesticide was applied to the sugarcane using a 2.5-point nozzle, the compelling residue samples taken from the rice plants clearly demonstrate the presence of the pesticide and the damage caused to the foliage and grain. Indeed, witness [Nombre11] , an employee of the defendant, emphatically stated that his workers called him and that the defendant instructed them to continue “spraying” the product even though it was windy.

This shows that, despite the risks involved in the application, the defendant assumed the risk that now renders him liable for the damage inflicted upon his neighbor. The claim of error is rejected, and the judgment is affirmed as to the matters appealed.-

VOTO N° 247-F-18 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las trece horas y cuarenta y tres minutos del veintiuno de marzo de dos mil dieciocho.- PROCESO ORDINARIO establecido por [Nombre1] , mayor, casado, cédula CED1 , vecino de Bagaces, Guanacaste contra [Nombre2] , mayor, casado, cédula CED2 , vecino de Cañas, Guanacaste. Intervienen como apoderado judicial y defensora pública respectivamente Roberto Segnini Villalobos, carnet CED3 , y Mariela Angulo Pizarro. Se tuvo como tercero interesado al Instituto de Desarrollo Rural (INDER), cédula CED4 - - , representado por su apoderado general judicial Luis Miranda Guadamúz, mayor, casado, abogado, cédula de identidad CED5 - - , vecino de Liberia. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia.-

RESULTANDO:

  1. 1La parte actora plantea esta demanda ordinaria, estimada en quince millones de colones para que en sentencia se declare: 1) El actor es propietario y cultivó arroz en la [Dirección1] , en 9.6 hectáreas. 2) El demandado aplicó herbicida Diurón en su cultivo de caña de la [Dirección2] entre el 21 de abril a la primera semana de mayo del 2014, y en consecuencia se afectó gravemente el área cultivada de arroz de la [Dirección3] . 3) Por la aplicación negligente del herbicida en la caña se produjo un grave daño material y económico al actor, responsabilidad del demandado, por lo que se le debe condenar al pago de los daños y perjuicios causados al arroz del actor, que desglosa así: a) Daños por el valor del arroz que se hubiese producido en las 9.6 hectáreas cultivadas: ¢11113000,043; b) Perjuicios: el interés legal conforme al artículo 1163 del Código Civil hasta el momento de dictarse sentencia y el fenecimiento de la presente causa: tres millones quinientos mil colones. 4) Se condene a la parte demandada al pago de ambas costas (fs. 71,72, 76,77).
  2. 2La parte demandada contestó en tiempo y forma la presente demanda y se opuso a la misma interponiendo las excepciones de FALTA DE LEGITIMACIÓN ACTIVA Y PASIVA, FALTA DE INTERÉS ACTUAL (f. 98).
  3. 3La Jueza Ruth Alpízar Rodríguez, del Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia en sentencia número 71-S- 2016, de las quince horas del dos de marzo del año dos mil dieciséis, resolvió: "POR TANTO: Se rechazan las excepciones de falta de legitimación pasiva y activa y falta de interés actual interpuestas por la parte demandada. Se declara PARCIALMENTE CON LUGAR la presente demanda ordinaria establecida por [Nombre3] contra [Nombre2] , en la forma que se dirá, entendiéndose denegado lo que no se otorgue y modificado lo que se conceda en forma diferente a como fue pedido:1) Se condena al demandado a pagar al actor los daños y perjuicios causados al cultivo de arroz de la [Dirección4] , en abril y mayo del dos mil catorce, por lo dejado de percibir en cuanto al valor del arroz por la disminución del rendimiento de lo cosechado en seis punto cuatro hectáreas, lo que se fija en la suma de CINCO MILLONES TRESCIENTOS SETENTA Y SEIS MIL SEISCIENTOS UN COLÓN CON SETENTA Y CINCO CÉNTIMOS (¢5376601,75).2) A partir de la fecha en que adquiera firmeza la condena anterior y hasta su efectivo pago, deberá el demandado pagar, sobre la suma dicha, intereses a la tasa legal, que para los efectos será la que pague el Banco Nacional de Costa Rica por los certificados de depósito a seis meses plazo, en colones .3) Se resuelve este proceso sin especial condenatoria en costas.- (folios 162 a 173)
  4. 4La parte demandada, interpuso recurso de apelación con indicación expresa de las razones en que se apoyó para refutar la tesis del juzgado de instancia. (folios 176 a 179)
  5. 5En la substanciación del proceso se han observado las prescripciones legales, y no se observa la existencia de errores u omisiones capaces de producir la nulidad del fallo.-

Redacta el juez Picado Vargas, y;

CONSIDERANDO

I. Se prohíja el elenco de hechos tenidos por demostrados por ser acordes al acervo probatorio.-

II. Se comparten los hechos no probados por estar ayunos de elementos de prueba.-

III.La Defensora Pública Agraria de la parte demandada interpone recurso de apelación contra la referida resolución manifestando lo siguiente: AGRAVIOS DE FONDO: Sostiene que la actora no demostró los daños y perjuicios a los que se le condena pagar ya que como éste desarrollaba un plan piloto del [Nombre4] éste no tenía buen rendimiento y producía pérdidas. Considera en ese punto que el testimonio de [Nombre5] es complaciente por ser empleado de [Nombre4] y tiene interés en responsabilizar a un tercero y así eximir a su patrono de alguna responsabilidad. Tampoco son creíbles las estadísticas con las que se calcularon los perjuicios pues era la primera vez que el actor se sometía al plan piloto y las estadísticas las suministra le propio CONARROZ. Aunado a ello, no hubo negligencia en el demandado ya que de acuerdo con el testimonio de [Nombre6] se utilizaron los mecanismos necesarios para llevar a cabo la fumigación de acuerdo con la normativa vigente ; se dejó la franja de 200 metros que no fue quemada; se utilizó una boquilla 2.5 que es la recomendada lo cual reduce al máximo la deriva de pulverización, lo cual junto con la franja, el muro y la ronda hace que el demandado no hay podido ser responsable de los daños que se le atribuyen (folios 176 a 179).-

IV.Nos encontramos en un proceso ordinario en el cual se pretende una indemnización de daños y perjuicios a una plantación de arroz por el uso de un herbicida aplicado en una finca colindante que se dedica al cultivo de caña de azúcar. De acuerdo con los artículos 2, 98 y 101 de la Ley Orgánica del Ambiente y el artículo 32 de la Ley de Protección Fitosanitaria, el régimen de responsabilidad aplicable a este caso es el de Responsabilidad Objetiva, ya que la aplicación de plaguicidas (substancias químicas, biológicas o bioquímicas en la agricultura) conllevan en sí una actividad riesgosa, la cual, de acuerdo a esta normativa, los que la realicen están obligados a resarcir los daños y eventuales perjuicios que ocasiones. Es lo que se ha denominado la teoría del riesgo creado en la jurisprudencia y doctrina: "V. (...) Son las Leyes de Protección Fitosanitaria número 7664, y la de Aviación Civil número 5050 del 11 de diciembre de 1972, las que la regulan.

La primera dispone: “Quienes importen, fabriquen, formulen, reenvasen, reempaquen, distribuyan, almacenen, transporten, vendan y apliquen sustancia químicas, biológicas o afines para uso agrícola, estarán obligados a resarcir los daños y perjuicios que, con sus acciones u omisiones, ocasionen a la agricultura, la ganadería, la salud humana y el ambiente” (artículo 32). La segunda establece: “Toda persona física o jurídica que utilice aeronaves destinadas a la aviación agrícola responderá por los daños que cause a las personas o bienes de terceros en la superficie” (artículo 107). Ambas determinan claramente una responsabilidad objetiva, ninguna obliga a la víctima a demostrar algún elemento subjetivo de imputación. Por ello basta con que se pruebe el daño y la relación de causalidad para imputar la responsabilidad civil a los sujetos que objetivamente deben responder, según las normas citadas.

La Sala en un caso similar al presente, admitió la responsabilidad objetiva, hoy más que nunca obligada frente a problemas de orden ecológico (Sala Primera de la Corte Suprema de Justicia, Voto No. 607-F-02 de las 16:15 horas del 7 de agosto del 2002.).- Ha señalado este Tribunal sobre la aplicación del régimen de responsabilidad objetiva en materia de daños ocasionados por agroquímicos: "VII.- (...) Sin embargo, dado lo acontecido en este asunto, no puede limitarse el análisis jurídico de los agravios de la apelación únicamente a lo relacionado con la compraventa de un producto, como lo pretende la actora, por cuanto existe una fase posterior, la de su aplicación vía aérea. Aún más, tratándose de daños producidos por productos, la doctrina moderna en materia de derecho del consumidor, ha desarrollado criterios novedosos, que no se limitan a la esfera contractual, por las implicaciones propias de la producción, elaboración, comercialización y uso de tales.

En ese sentido, la Ley 7472 de Promoción de la Competencia y defensa Efectiva del Consumidor, en sus artículos 32 y 34, regula los derechos de los consumidores y las obligaciones de comerciantes y fabricantes. Uno de los más importantes es precisamente el derecho de información. El numeral 35 de dicha Ley establece además un régimen de responsabilidad objetiva, al imponer al productor, proveedor o comerciante, el deber de responder independientemente de la existencia de culpa, si el consumidor resulta perjudicado por razón del bien o el servicio, de informaciones inadecuadas o insuficientes sobre ellos o de su utilización y riesgos. Solo se libera quien demuestra ha sido ajeno al daño. Además, indica los representantes legales o encargados de los negocios son responsables por los actos o hechos producidos por los dependientes o auxiliares. En este caso, sin embargo, dado lo debatido, no se discute se haya faltado al deber de información, pues lo que se alega por el actor es una entrega errónea de un producto, ni puede considerarse por ello se esté en presencia de responsabilidad por defecto del producto, así como tampoco lo alegado da pie para aplicar, de haberse comprobado el hecho, la garantía de funcionamiento regulado en los numerales 43 de la Ley citada y 452 del Código de Comercio.

VIII.- Por otro lado, en materia de responsabilidad civil, contractual o extracontractual, objetiva u subjetiva, independientemente de tratarse de materia agraria, civil o comercial, para ser admitido el reclamo debe existir un daño o perjuicio, el cual debe ser imputable u originado por quien se demanda. Por daño se entiende “ todo menoscabo, pérdida o detrimento de la esfera jurídica patrimonial o extrapatrimonial de la persona (damnificado), el cual provoca la privación de un bien jurídico, respecto del cual era objetivamente esperable su conservación de no haber acaecido el hecho dañoso. Bajo esta tesitura, no hay responsabilidad civil si no media daño, así como no existe daño si no hay damnificado. Por otra parte, solo es daño indemnizable el que se llega a probar (realidad o existencia), siendo ello una cuestión de hecho reservada al prudente arbitrio del juzgador…”(Sala Primera de la Corte Suprema de Justicia, voto Nº114 de las 16:00 horas del 2 de noviembre de 1979).

Aparte de tener que ser real, cierto, efectivo y merecedor de amparo jurídico, se requiere el daño sea causado por un tercero y esté subsiste a la hora de plantearse la demanda. Debe mediar además una relación de causalidad entre el hecho ilícito y el daño acontecido." Tribunal Agrario, Voto No. 814-F-03 de las 14:45 horas del 16 de diciembre del 2003.- La responsabilidad objetiva no sólo se limita desde la óptica del consumidor, sino también se deriva de la legislación sobre agroquímicos, por lo que no lleva razón la demandada en estimar que no es aplicable la misma al presente asunto, tal y como lo ha estimado la Sala Primera: "V. (...) Son las Leyes de Protección Fitosanitaria número 7664, y la de Aviación Civil número 5050 del 11 de diciembre de 1972, las que la regulan. La primera dispone: “Quienes importen, fabriquen, formulen, reenvasen, reempaquen, distribuyan, almacenen, transporten, vendan y apliquen sustancia químicas, biológicas o afines para uso agrícola, estarán obligados a resarcir los daños y perjuicios que, con sus acciones u omisiones, ocasionen a la agricultura, la ganadería, la salud humana y el ambiente” (artículo 32).

La segunda establece: “Toda persona física o jurídica que utilice aeronaves destinadas a la aviación agrícola responderá por los daños que cause a las personas o bienes de terceros en la superficie” (artículo 107). Ambas determinan claramente una responsabilidad objetiva, ninguna obliga a la víctima a demostrar algún elemento subjetivo de imputación. Por ello basta con que se pruebe el daño y la relación de causalidad para imputar la responsabilidad civil a los sujetos que objetivamente deben responder, según las normas citadas. La Sala en un caso similar al presente, admitió la responsabilidad objetiva, hoy más que nunca obligada frente a problemas de orden ecológico (Sala Primera de la Corte Suprema de Justicia, Voto No. 607-F-02 de las 16:15 horas del 7 de agosto del 2002.).- El aplicar agroquímicos es una actividad que implica un riesgo, tanto al consumidor como al medio ambiente, como al productor agrario, lo cual genera responsabilidad de tipo objetivo para quien asuma dicho riesgo al dedicarse a dicha actividad.

Ha dicho la sala Primera en otra oportunidad: "VII. (...) El fundamento de esta tesis es muy simple. No se trata de la responsabilidad subjetiva prevista en el numeral 1045 del Código Civil, porque en tal hipótesis el damnificado debe probar el nexo causal entre la acción del agente dañino y los perjuicios sufridos. En la objetiva la simple existencia del daño reputa la responsabilidad en el agente dañino de haber sido el causante de ese daño, y por tal quien deberá indemnizar los daños y perjuicios causados con su conducta. Esto no deriva de un acto arbitrario sino de pura lógica, pues quien, incluso en una conducta lícita, asume un riesgo donde exista peligrosidad, debe responder por todo cuanto daño pueda causar esa peligrosidad. Existen muchos ejemplos al respecto. Si una persona manipula pólvora, o cualquier tipo de material inflamable, sea en una fábrica, en una actividad comercial, o por su propia diversión, en caso de ocurrir un siniestro con efectos en cualquier vecino, no ha de ser el damnificado el llamado a probar el nexo de causalidad entre la conducta ejercida y el daño causado, más bien el ordenamiento jurídico parte de la culpabilidad de quien asumió el riesgo y la peligrosidad, y solo para eximirlo de la responsabilidad podría probar no ser el responsable directo del daño causado, así la carga de la prueba se invierte, y los eximentes, como por analogía podría aplicarse para el ámbito ambiental, serían los previstos en la Ley General de la Administración Pública donde también se prevé la responsabilidad objetiva del Estado, siendo ellos “fuerza mayor”, “culpa de la víctima” o “hecho de un tercero” (artículo 190).- (Voto de la Sala Primera N° 398-F-01 de las 16:00 horas del 6 de junio del 2001).- Con base en lo dispuesto en la anterior sentencia, el régimen de responsabilidad objetiva trasciende el ámbito contractual o extracontractual en que se haya originado la relación jurídica entre las partes.

La doctrina ha interpretado que el artículo 704 del Código Civil excluye de la indemnización los daños que no sean necesariamente producto del incumplimiento, o que sean una consecuencia lejana de la acción. Este numeral se entiende aplicable a la responsabilidad civil contractual como a la extracontractual (En ese sentido RIVERO SÁNCHEZ (Juan Marcos) Responsabilidad Civil. Tomo II. San José, Editorial Areté, 2001, p. 141). Por ello, en materia de venta, distribución y manejo de plaguicidas, el tipo de responsabilidad es objetiva por la teoría del riesgo creado en actividades peligrosas. Dicha teoría establece que quien lucra de una actividad riesgosa (como el vender sustancias químicas como lo son los plaguicidas) debe ser responsable de los daños que éstos generan y lo encontramos en la Ley de Protección Fitosanitaria, su Reglamento, así como en el Reglamento sobre Registro, Uso y Control de Plaguicidas Agrícolas y Coadyuvantes, y el Decreto Ejecutivo que crea Permiso de Operación para la Venta o Expendio de Sustancias Químicas, Biológicas o Afines y la misma Ley General de Salud.

La Teoría del Riesgo Creado, según la doctrina italiana más reciente en material de daños, “permite aplicar criterios de responsabilidad objetiva incluso en aquellos casos en que, al no existir un ejercicio de actividades empresariales, no se podría realizar la asociación “riesgo-beneficio-responsabilidad”. Los accidentes que se producen fuera de las actividades lucrativas propiamente dichas terminan siendo absorbidas, entonces, por la premisa según la cual todo aquel que emplea fuentes de riesgo debe soportar las consecuencias negativas de su acción.” ALPA ([Nombre7]). Nuevo Tratado de la Responsabilidad Civil , Milán, Giuffré Editori, 1999, p.p.383-384. El maestro Pacchioni, indica que “cuando un sujeto organiza una actividad económica propia, con fin de lucro, debe, ciertamente, padecer las desventajas de su obrar, y resarcir los daños ocasionados a terceros, aun cuando él no fuera culpable”.

PACCHIONI ([Nombre8].) Diritto Civile Italiano, Parte II, Vol. IV, Papua, 1940, p.11.- Por ello, esta teoría parte del principio general, enunciado desde finales del siglo XIX por el jurista Vittorio Emanuele Orlando, que “todo aquel que en el ejercicio de una empresa o de una actividad cualquiera causa al derecho ajeno un daño que se presenta como consecuencia directa o indirecta de tal actividad, debe resarcir el daño, sin que tenga importancia el hecho de que en el evento dañosos el agente no haya pecado de negligente o imprudente, ni en el vento mismo, aisladamente considerado, puede aparecer dependiente del caso fortuito o de una fuerza mayor”. ORLANDO (Vittorio Emanuele). Saggio di una teoria sul fondamento guiridico della responsabilitá civile, Roma, 1893, Archivio di diritto pubblico, p.242. El maestro Carnelutti, en su obra cumbre “Jurisdicción y procedimiento”, llega a la conclusión, en 1934, analizando esta teoría, que “el principio del riesgo más que establecer nuevos deberes a cargo del empresario, viabiliza la distribución de los riesgos de la industria”. [Nombre9] ().

Giurisdizione e Procedura, Milano, Giuffré, 1987, p.213. . En el presente caso, se discute la responsabilidad que se le reprocha a la demandada, productora de caña de azúcar, por los daños ocasionados a la plantación de arroz de la actora su colindante, al aplicar el agroquímico Diurión. Es un caso de responsabilidad civil objetiva, en el cual se discute y se agravia en este recurso sobre la relación de causalidad, a la luz de esta teoría del riesgo creado, en razón de que la actividad de la demandada se basa en un beneficio fundado en el riesgo que reviste la necesidad de aplicar sustancias químicas.-

V.Tomando en cuenta las consideraciones explicadas en el anterior considerando, considera no lleva razón la recurrente en sus agravios, dado que el nexo de causalidad entre la aplicación del agroquímico Diurón del demandado y los daños sufridos en la plantación de arroz del actor está plenamente demostrado. El agravio va dirigido a demostrar que medió culpa de la víctima (el actor) o de un tercero (el CONARROZ) y que la aplicación del agroquímico de parte del demandado fue no fue el hecho generador del daño. La existencia del daño y el nexo de causalidad está plenamente demostrado analizando la prueba en conjunto y de acuerdo al sistema de libre valoración probatoria del artículo 54 de la Ley de Jurisdicción Agraria. Pese a no reconocerlo expresamente en la demanda, el demandado al rendir prueba confesional reconoció haber aplicado el Diurón en su plantación de caña de azúcar en el primer semestre del año 2014 (ver audio en CD adjunto grabado el 5 de agosto del 2015).

De acuerdo al dictamen pericial realizado por el ingeniero Oscar Rojas, visible a folio 120, el Diurón “es un herbicida sistémico, absorbido por las raíces con transporte acrópeta, vía xilema, hacia los tallos y hojas que actúa inhibiendo en las plantas afectadas. Es utilizado para el control de malas hierbas en áreas no agrícolas. Es un herbicida selectivo para algunos cultivos, incluyendo la caña de azúcar”. Es decir, este herbicida puede ser aplicado a la caña de azúcar, mas no al arroz (ver fotocopia de Agroguía donde no se incluye el arroz dentro de los productos aplicables a folio 60), cuya planta es distinta a la de la caña y afecta los tallos, hojas y espiga del arroz inhibiendo la fotosíntesis lo cual produce que la planta se seque. De acuerdo al peritaje, la aplicación del Diurón se hizo en la finca del demandado ([Dirección5] ) entre el 19 de abril y la primera semana de mayo del 2014 y provocó una fitoxicidad en las matas de arroz que estaban en el proceso de “llenado del grano” y al ser absorbido por las raíces se manifestó primeramente en el daño al follaje, lo cual tuvo como consecuencia la disminución en la productividad del arroz produciendo grano vano no apto para la comercialización (folio 121).

Dicho peritaje, realizado por un perito designado de la lista d peritos del Poder Judicial, se basó en una inspección de campo realizada por el mismo perito (que no es funcionario del CONARROZ) y en otra prueba técnico-científica especial: el “Informe de Atención a Denuncia” emitido por el Departamento de Operaciones Regionales de Bagaces del Servicio Fitosanitario del Estado, específicamente por el ingeniero Gerardo Villarreal Mayorga, quien también hizo una inspección de campo en ambas parcelas (del actor y del demandado, 56 y [Dirección6], respectivamente); y concluyó que en la parcela del actor había un área de 6.5 hectáreas de arroz afectadas por una quema causada por un producto fitotóxico al arroz y recomienda realizar un análisis de residuos (folios 56 a 57). A folio 58 se encuentra el Acta No.6026 de “Muestreo Oficial para el Análisis de Residuos de Plaguicidas en Vegetales, Agua, Suelo y Sedimentos” realzado por el Servicio Fitosanitario del Estado, el cual se realizó en la finca del actor, propiamente en el follaje de las matas de arroz del actor encontrándose una concentración de Diurón del 0.062 miligramos en los follajes (folio 58 vuelto).

Lo dicho por el testigo-técnico cuestionado por la recurrente, el señor [Nombre5] , en cuanto a que el Diurón fue el agente externo al plan piloto que generó el daño en las plantas de arroz se encuentra respaldado por la prueba pericial del ingeniero [Nombre10] y los muestreos del Servicio Fitosanitario del Estado, no solo por el Informe del [Nombre4] de folio 22 como trata de argumentar la recurrente, por lo que considera este Tribunal que no es complaciente pese a su relación laboral con la empresa CONARROZ, dado que hay certeza científica de la incompatibilidad de dicho agroquímico con el arroz y su alto nivel de concentración en la plantación de arroz del actor, al menos, en las 6.5 hectáreas de arroz afectadas. Dicho testigo afirmó claramente que se realizaron los muestreos de parte del Sistema Fitosanitario del Estado tanto en áreas afectadas como no afectadas y que èl pudo observar espigas erectas con grano vano, lo cual concuerda con la prueba pericial del ingeniero Rojas.

Por ello, no es atribuible ni al actor ni a [Nombre4] el daño sufrido, pues el nexo de causalidad está plenamente demostrado. Recordemos que tratándose de Responsabilidad objetiva no debe demostrarse si medió dolo o culpa (negligencia, impericia o imprudencia) de parte del agente generador del daño, sino la materialidad objetiva del daño y el nexo de causalidad, que imputa directamente el manejo de Diurón del demandado entre el 19 de abril y la primera semana de mayo del 2014. Si bien el testigo invocado por la recurrente [Nombre6] manifestó que se realizó la aplicación del plaguicida con la boquilla de 2.5 puntos en la caña, la contundencia de los muestreos de residuos en las plantas de arroz demuestra claramente la existencia del plaguicida y el daño ocasionado al follaje y al grano. Incluso el testigo [Nombre11] , empleado del demandado, fue enfático al afirmar que sus trabajadores lo llamaron y que éste dio de seguir “volando” el producto pese a que hacía viento, lo cual refleja que pese a lo riesgoso de la aplicación el demandado asumió el riesgo que ahora lo lleva a responder por los daños infringidos a su vecino. Se rechaza el agravio y se confirma la sentencia en lo que fue objeto de apelación.-
