Drafted by Judge Castro García; and, BACKGROUND I- Proven facts (hechos probados). The proven facts are affirmed because they are supported by the evidence contained in the record. The following fact of this nature is added on appeal: 5./ The southern boundary (lindero sur) of the property possessed by [Nombre1], when it was acquired in 2001, which adjoins the property possessed by [Nombre2], runs in a straight line from east to west, from the melina tree toward the posts and fence found during the judicial inspection (reconocimiento judicial), and as far as [Dirección3]. (Evidence: sketch in image 327 of the PDF case file; testimony of [Nombre5] and [Nombre6], associated on 9-11-16). 6./ The existing fence located behind the rustic house, which runs from east to west, does not correspond to what was conveyed to [Nombre1] in 2001 when she took possession of the property to live there (testimony of [Nombre5] and [Nombre6], associated on 9-11-16). 6. The existing fruit trees and hand-dug well (pozo artesanal), situated to the east of the disputed area possessed by [Nombre2], were installed by [Nombre1] (evidence: testimony under examination of a party (declaración confesional) by [Nombre2], testimony of [Nombre5] and [Nombre6], judicial inspection, and sketch associated on 08-11-2016).
II - Within the statutory period, the plaintiff appeals (images 367 to 371 of the PDF case file) the trial-court judgment n. 32-2017 issued at 13:37 hours on 28 de febrero del 2017 (image 360 of the PDF case file). The appealed decision dismissed the claim for a superior possessory right, reasoning that the property forms part of the State forest estate (patrimonio forestal del Estado) and is therefore property in the public domain (bien demanial). The appellant argues that the judgment treats as proven the plaintiff’s possession of the land as owner. She contends that the evidence concerning the agricultural activities conducted on the property since 2000 can be established from the testimony, which the court below (a quo) failed to assess. She states that, during his examination, the defendant admitted that he knew that the fence separating his land from the plaintiff’s had been there for more than 30 years.
He thereby acknowledged that the plaintiff has possessed the property for many years (answer 5), satisfying the first requirement for the action brought, namely standing to sue (legitimación activa), as a prerequisite for a superior possessory right. She adds that the witness [Nombre7] testified: “... [Nombre8] built the fence about 5 years ago... and has been there for 16 years... there was a house where she lived for more than 3 years... and she keeps cattle there.” She likewise cites the testimony of witness [Nombre6]: “... the plaintiff came to the land in 2000... from the time we arrived, we always had little pigs and cassava crops....” She also states that he testified: “she bought it from a cooperative; we had another house made of melina wood, but it fell down, so another one was built.” She contends that this testimony is consistent with the description in the judicial inspection concerning the house located on the disputed land.
She considers that his statement is not arbitrary merely because [Nombre6] is the son of [Nombre1], as he described the actual conditions on the land and identified the person who has carried out agricultural work there. She argues that the judge incorrectly assessed the evidence. This requires this Court to modify the proven and unproven facts (hechos no probados) in the judgment so as to establish that [Nombre1] has carried out agricultural work on the disputed land since 2000, openly and with the acquiescence of the defendant and the witnesses. She has exercised possession for more than ten years, and the defendant, taking advantage of the fact that the plaintiff is a woman who lives alone, has attempted to dispossess her of at least one manzana of that property. She argues that this was proven through the testimony of [Nombre5], who described the problems that have arisen with the defendant and how he removed the plaintiff’s cattle from the land and broke her fence.
She adds that the witness [Nombre7] also stated that the defendant had disturbed the plaintiff’s possession and described the problems that had arisen concerning the placement of the fence. She maintains that this establishes [Nombre2]’s standing to be sued (legitimación pasiva). As to the identity of the property (identidad del bien), she argues that it was proven that the disputed land is located in Tablillas de Los Chiles and is an unregistered property. The parcel described in the complaint is the same one observed during the judicial inspection. As a ground of appeal, she claims that the evidence was not assessed, because the judgment stated that, although the testimony establishes the location of the fence involved in this dispute and which party exercised possession over the land, its status as property in the public domain cannot be disregarded. In that regard, she argues that she is aware of the special legal regime applicable to the disputed tract of land, but that the trial court failed to consider the plaintiff’s proof that she exercised possession over that portion of land, which is suitable for agricultural use (aptitud agraria).
In addition, the testimony under examination of a party and the statements of [Nombre6] and [Nombre9] acknowledge that the plaintiff worked the land, always cultivated it, and kept cattle there. She claims that it was decided, without basis, that [Nombre1] had not possessed the land because the property is in the public domain, when the judicial inspection in fact records the actual condition of the land: cultivated, stocked with cattle, and properly maintained. She argues on appeal that it is easy for the defendant to take advantage of all the work and effort that [Nombre1] devoted to that property over many years. She requests a ruling on everything submitted for adjudication and on the dispute itself, without leaving the parties’ claims unresolved, as occurred here, where the entire body of evidence was not assessed. She argues that this proceeding sought a declaration of a superior possessory right, not ownership.
Although all the requirements were satisfied, the evidence was not assessed. She points out that the Procuraduría, as an interested entity, did not seek recovery of the land (reivindicación) either. Although the land lies within a protected wilderness area (área silvestre protegida), the reality in the country is different, and these protected lands are nevertheless occupied and worked. The dispute presented should therefore have been adjudicated. In this particular case, the court limited itself to ruling on the identity of the property, disregarding a more realistic assessment of the matter. She requests that the appealed judgment be reversed, that the action filed be granted in all respects, and that the plaintiff be declared to have a superior possessory right over the defendant with respect to the land that is the subject of the dispute.
III- With respect to the challenge concerning the erroneous assessment of the action filed, the argument is rejected, since a reading of the judgment shows that the action for a better right to possession (acción de mejor derecho de posesión) was adjudicated through an analysis of the claims asserted, and the factual and legal grounds, based on the evidence contained in the record, that led to the conclusions stated in the appealed decision were set forth. However, despite mentioning that the matters noted during the judicial inspection (reconocimiento judicial) were considered and inferring from the witness testimony that the plaintiff exercised possession during periods from 2000 through 2013, the classification of the wetland (humedal) existing on the property as public-domain property (demanialidad), and its inclusion within the Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte, make this property part of the State Natural Heritage (Patrimonio Natural del Estado), which does not permit possession by private individuals and therefore requires dismissal of the complaint. This was the position stated in the judgment, which this Chamber does not share for the reasons set forth below.
IV- Given the factual circumstances of the action filed, the plaintiff claims a better right to possession with recovery-of-property effects (efectos reivindicatorios) against a private individual regarding property forming part of the aforementioned protected wilderness area (área silvestre protegida), as established in the record, and containing a wetland. This is consistent with the study issued by SINAC (image 76, PDF-format case file). Regarding the Publician action (acción publiciana), the Sala Primera de la Corte Suprema de Justicia has held: “VI.- … its purpose is to protect the lawful possessor against the unlawful possessor, in order to obtain restoration of the possession of which the former has been unlawfully deprived. (Doctrine of Articles 317 to 322 of the Código Civil and 277 and 286 ibidem). It is therefore an action for restitution (acción restitutoria): ‘...This action is available to an acquirer with valid title (justo título) and good faith; its purpose is to secure restoration of definitive possession of movable or immovable property.
This action may be brought against a possessor without title, a possessor in bad faith, and one who has title and good [Nombre10] , . Mexican Civil Law. Volume III, Mexico, Editorial Porrúa S.A. 1981, 5th Edition, pp. 691 and 692). In summary, the essential purpose of this action is recovery of the property. Domestic case law has held in this regard: ‘...The action for a better right to possession, originating in the Roman-law remedy known as the “publiciana,” is based in our legal system on Articles 317, 318, 319, and 322, as well as provisions 277 and 286 of the Código Civil, and is intended to protect the lawful possessor against the unlawful possessor, so that the former may obtain restoration of the possession of which he or she has been improperly deprived, or obtain a declaration of his or her preferential right over a prior possessor... (See the decision of the Sala Iera. de la Corte Suprema de Justicia of 1990, issued at 15:00 on June 6, 1990, corresponding to Voto No.16).
The requirements for this action to succeed are: active and passive standing (legitimación activa y pasiva) and identity of the property. Accordingly, to establish standing, it is important to determine who has held actual and effective possession of the property; under domestic case law in this field, which this Court endorses, it is indispensable for the party seeking recognition of a right of possession to prove beyond doubt that he or she has exercised stable, effective, and specific possessory acts (actos posesorios) over the property. The following holding from that case law bears citation: ‘...V.- It should be emphasized that, in actions such as those litigated in this proceeding, which, as the Tribunal Superior correctly stated, are based essentially on questions concerning the better right to possess, because they concern unregistered real property whose possession is disputed for the purpose of registering it in the Registro Público de la Propiedad, it is very important to determine who has held actual and effective possession of the property.
It is an indispensable requirement that the party seeking recognition of a right of possession conclusively prove that he or she performed effective, specific, and stable possessory acts over the property, in observance of the governing principles and tenets of agrarian law (derecho agrario), which seek fulfillment of the social function of property through the dynamic and productive exercise of its principal attribute, possession....’ (In this regard, Judgment No. 31-93. (Sala Primera de la Corte Suprema de Justicia, 10:00 on May 21, 1993).
V- Regarding the plaintiff’s grounds of appeal concerning effective possession of the property. In view of the appealed ruling and the contention that the judgment denies the plaintiff’s possession because it classifies the parcel as public-domain property, this Chamber must first assess the exercise of possessory acts in the disputed area. The challenged decision deemed it proven that the area in dispute is wetland terrain located in Tablillas de Los Chiles, [Dirección4] Los Chiles, Provincia de Alajuela, on a property known as El Achiotal. It has an approximate area of one and a half manzanas. [Nombre11] to the north with [Nombre1] , to the south with [Nombre2] , to the east with [Nombre4] and to the west with a road. The evidentiary basis consists of the sketch associated with the case file at 16:12:58 on 08/11/2016, the judicial inspection associated with it at 09:06:33, and the addendum associated with it at 09:06:48 on 09/11/2016 (first fact).
It was also established that the disputed area contains approximately one manzana of wetland, while the remainder contains remnants of concrete blocks and cement, fruit trees, and a well. The northern boundary was found to be currently demarcated by a three-strand barbed-wire fence. The evidentiary basis consists of the aforementioned sketch and judicial inspection, as well as the witness testimony of [Nombre7] , [Nombre6] and [Nombre5] associated with the case file on November 09, 2016 (second fact). It was deemed proven that the described property is located in the northern border zone and forms part of the Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte. This is inferred from report N° SINAC-ACAHN-OTAT-049-205 in images 76 to 84). None of the cited facts was challenged on appeal, and after reviewing them, this Chamber adopts them upon confirming that they are supported by the referenced evidence.
In this regard, the plaintiff alleges in her complaint that she is the possessor with the better right to the property described above, which she has possessed for more than 15 years and on which, since 2000, she has conducted agricultural activity (actividad agraria) by keeping animals, planting fruit trees, and constructing associated infrastructure (wells and pigsties). In her action, she states that the area was delivered to her demarcated by stakes and that she has maintained fences, firebreaks (rondas), cleared vegetation (chapeas), and preserved trees. She stated that she had disputes only with the adjoining defendant, [Nombre2] , who claims part of her land and who, in January 2013, dispossessed her of approximately one manzana by taking advantage of the fact that she had to relocate to central Los Chiles. During that period, the defendant’s farmworker was observed on her property.
She claimed that she currently has only 4.000 thousand meters because a fence was erected from one side to the other. She stated that in July she was notified of the judicial decision in the summary possessory proceeding (interdicto), which recognized possession in favor of the defendant and ordered that the fence be placed where it had previously stood. However, he installed it in a location that did not correspond to that boundary. The defendant, for his part, opposed the complaint and acknowledged that the property claimed by the plaintiff is the one he possesses. He stated that the plaintiff neither works nor lives on the property. He denied that the Comité had placed the plaintiff in possession of two manzanas adjoining his property. He stated that [Nombre1] had never respected the existing fence, to the point that he filed a summary possessory proceeding in which he prevailed, processed under number13-000027-0298-AG (images 121 to 126 of the digital case file).
In this case, a judicial inspection was conducted (digital case file/documents/date 09/11/2016 09:06:33 and 09/11/2016 09:06:48), during which a property located at [Dirección5] was observed; access to it was gained through a half-manzana portion belonging to the plaintiff that is not at issue in the proceeding. The a quo judge who conducted that proceeding recorded that the disputed area lies south of that portion belonging to the plaintiff and that a three-strand fence in good condition was visible. A few meters and a half from the dwelling located in the portion possessed by the plaintiff stands the fence; behind the house there is a pass-through gate, through which the disputed portion is entered, where a hand-dug well in use was found. To the west are concrete blocks where, according to the plaintiff, pigsties had stood. The inspection proceeded eastward, where various species of fruit trees and another remnant of a pigsty were found.
The southern portion was not traversed because it consists of a one-manzana wetland area, and a melina tree serving as a boundary marker was identified. All of this forms part of the dispute. It was stated that the approximate disputed area is one and a half manzanas, most of which is wetland. The house located at the entrance was described as lying outside the subject matter of the dispute; it is rustic, uninhabited, made of wood, with a wooden floor, and appears to have been recently erected. It was also stated that, in the area outside this dispute, four head of cattle and fresh manure were found northeast of the property. Along the southern boundary, three meters from the fence’s current location, there are three madero negro and capirote trees aligned with the melina tree, forming the original fence line. A sketch was prepared (image 327, digital case file in PDF format) depicting what was described during the judicial inspection: the melina tree identified by the plaintiff as the former and actual boundary with the property possessed by the defendant; a zone depicted as a wetland area; and a northern sector depicting a well, concrete blocks, fruit trees, and a concrete slab.
This is followed by the three-strand wire fence beginning at [Dirección2] and running eastward to the rear boundary. Beyond it, a dwelling and cattle are depicted. This Court is thus able to determine that the disputed area is precisely the portion lying south of the straight fence located behind the depicted house, which contains a wetland area and, to the east, a section of firm ground where the hand-dug well, concrete blocks, fruit trees, and concrete slab are located. This evidence establishes the requirement of identity of the property for the Publician action filed by the plaintiff.
VI- This must be assessed comprehensively together with the statements made by the witnesses and the confessing party who testified at the oral trial (juicio verbal), in order to determine whether the appellant is correct in her grounds of appeal concerning the appellant plaintiff’s exercise of actual possession (posesión). For his part, defendant [Nombre2] gave evidence by confession (prueba confesional) (expediente digital/documentos/fecha 09/11/2016 09:07:19), in which he admitted, contrary to his own interests (artículo 338 del Código Procesal Civil applied supplementarily pursuant to Transitorio I de Ley 9343), that an artisanal well exists on the property at issue (fundo en litis), that it was not installed by the declarant, and that the fruit trees were not planted by him, explaining that because it was a squatter settlement (precario), other persons had introduced them and they already existed when he arrived at the site.
From this response, it is deemed admitted that the features existing on the property, as observed during the aforementioned judicial inspection (reconocimiento), do exist and were not introduced by the defendant, namely, the well and the fruit trees. Regarding responsibility for what was found in the area at issue, the possession exercised, and the parties’ presence at the site, witness [Nombre5] (expediente digital/documentos/fecha/09/11/2016 09:08:44) stated that he knew both parties. He knew that there were problems because [Nombre2] erected the current fence, which had not existed before, near the plaintiff’s house; only the other fence had been there. He stated that the plaintiff previously had a pigsty and that everything was divided up around her. This occurred in 2014. He believes that [Nombre2] sought to take advantage of the fact that [Nombre1] is a single, hardworking woman. In the past, he saw the now-deceased [Nombre12] and his son removing her fence and driving out her cattle, because she was alone.
He stated that the cows were always roaming everywhere in 2015. He knew that the defendant entered the property in 2000 through a distribution by a cooperative. At that time, the parcels were sold by that organization’s Board of Directors, and [Nombre2] was one of its leaders. He testified that he knew that the plaintiff had been given two manzanas, since almost everyone was allotted that amount. He knew that the adjoining property (colindancia) to the north initially belonged to Julio and later to others, and also adjoined [Nombre4] and the road. Regarding the division between the properties, he stated that the rear boundary was laid out by the directors, who placed stakes. [Nombre1] presumably erected that fence, unless it was already there. He mentioned that he had seen the new fence one or two years earlier. He did not know who built it. He stated that the disputed area contains fruit trees and the open field where horses, pigsties, and cattle had been present since 2001 and 2002.
He noted that there had been a house in the disputed area for a long time, approximately 10 or 12 years. He had heard that its zinc roofing was stolen. The house belonged to [Nombre1] and was different from the current one. He stated that there had always been a structure there and that there is a well built by the plaintiff, although he did not know whether it was outside or inside the disputed area. It did, however, belong to her parcel. He explained that [Nombre1] had never caused environmental damage at the site, and he had no knowledge that MINAE had ever been required to appear there. He explained that her cattle drank water from the swamp, but after the fence was erected, and because he had seen the plaintiff’s fence being cut on two occasions, they could no longer do so. He stated that the deceased [Nombre12] had been allotted one property and had encroached on another because he was confrontational.
He had seen him in the disputed area driving out the woman’s cattle and tearing down her fence. He stated that the defendant had worked his property normally, though not extensively, mentioning that some cassava was present. He had seen [Nombre1] working on her parcel and in the disputed area. In response to the judge, he stated that he had not seen a house on [Nombre2]’s property, where there were some coconut trees. He had seen some cassava plants on [Nombre2]’s property but had not seen him cultivating the area that he said belonged to [Nombre1]. In response to the State Attorney (Procuradora), he stated that he had known the property since it belonged to [Nombre13], when it was a single farm during his school years. There had been cattle, and then the Board arrived and divided the land. He further stated that water remains in the wetland but dries up in the summer. This testimony establishes that the area claimed by the plaintiff forms part of the land that she had possessed for more than 15 years and that was delivered to her by those identified as the Cooperative.
It also establishes that the plaintiff lived at the site with her family, the use made of the land and the infrastructure introduced there, and the location of the boundary by the melina tree referred to by the witness. It further establishes that the defendant’s farmhand took steps to interfere with possession and intended to dispossess (despojar) her of the area that she now possesses. This is consistent with the testimony of witness [Nombre6] (expediente digital/documentos/fecha 09/11/2016 09:08:15 at minute 00:50 of the recording), who, when asked whether he had an interest in the proceeding, explained that he was [Nombre1]’s son, knew the parties, had lived at the site with his family, had built the well, and identified the property as belonging to his mother. He stated that his mother arrived in 2001, lived at the site for 10 years, and left for San José to study ten years ago. He stated that the problem arose because he believed that the defendant wanted the “open field” (wetland) because it was dry.
He mentioned that they had always crossed that area to reach the melina tree on the other side of the property, which was the reference point for the defendant’s property. He stated that they lived on the property and kept pigs and horses in the open field or swamp, and that a dispute now exists. He added that the defendant had again planted crops on the land. He stated that his mother purchased the parcel from a cooperative when he was a child. He explained that she was shown the property, which extended from the melina tree to the other side of the swamp. It measured two manzanas. Regarding its demarcation (demarcación), he remembered walking the land to see what had been sold. The adjoining landowner at the rear was named [Nombre4], with [Nombre14] and [Nombre7] on the other side. It adjoined [Nombre7] to the south, while the front of his mother’s property adjoined [Nombre11] and the road.
He explained that they lived there for more than ten years, but because of the difficult conditions caused by the heavy rainfall and the need to make school attendance easier, they were unable to remain at the site as they had until then. His older siblings, however, were always there. He mentioned that the house was a different one, located farther north. Because it was made of melina wood, it collapsed. He explained that the existing well is more than eleven years old and was built at his mother’s request by [Nombre15], who lived near Caño de Lencho. He identified the swamp as the disputed area, measuring between one and one-and-a-half manzanas. He stated that when he left the site, he saw the deceased [Nombre12] erecting the fence and later saw the defendant planting tubers. He stated that the boundary fence between [Nombre16] and [Nombre2] followed the melina trees in a straight line to the other side of the swamp.
Since his arrival, he said, that fence had served as the reference point. Previously, he and his brother had placed wooden posts along the boundary, which he regarded as the division between the properties. He mentioned that there had been pigsties and that he maintained them because he lived there. They remained there for 15 years, and he drew water from the well. He described two pigsties where animals were kept that used the swamp and were either sold or consumed. He stated that they had always owned cows and had previously owned horses. The animals ranged throughout the entire property because the current fence is new. He first saw it two years ago. He testified that the deceased [Nombre17] built it. Regarding the fruit trees, he explained that they are located in the area at issue and that his family planted them. The improvements (trabajos) made by his mother consisted of the pigsty, the well, and the cows that had been kept in the swamp area, which had always remained unchanged.
He testified that he previously maintained the fences on his mother’s property, but they left in order to make school attendance easier. He stated that every afternoon after school he came to tend to the animals. He estimated that the boundary between [Nombre2] and his mother lies to the south, at the melina tree on the southern side of the open field. In response to the defendant’s questions concerning the Cooperative, he said that he had been a child at that time. In response to the State Attorney, he stated that he was 24 years old and had arrived at the site at approximately eight years of age, between 2000 and 2001. He remembered that they walked the land to measure it when the property was delivered to his mother. It was marked with a type of stake, and his mother stood at the corner of the property while both that property and [Nombre14]’s property were measured. This occurred in 2004 or 2006.
He stated that he was in first grade or otherwise attending school and that conditions were difficult because, if he attended in the afternoon, he had to take a detour when a deep pool formed and prevented passage. Later, he and neighbor [Nombre3] built a bridge from wooden poles for crossing, but when it rained, the floodwaters carried it away, and walking along the other side was also dangerous. He explained that the floodwaters reached the Corozo trees. He stated that he knew the disputed area, which he called the open field or swamp. One corner is drier and remains dry during the rainy season. He mentioned that during storms the water level rose by one meter. There were Corozo trees, mango trees, and guava trees in the area at issue, some of which remain. He knew the fence at [Dirección6] of the swamp, where there is a large ceiba tree through which the boundary passes, as well as the melina trees, which do not grow because of the abundance of water.
He clarified that, long ago, he saw [Nombre2] planting crops on the other side of the swamp. The witness explained that he visits the property on holidays, once every three months, because of his studies. This Chamber finds that, even though the declarant is the plaintiff’s son, his testimony must be considered because it is consistent with the previous witness’s testimony regarding the plaintiff’s acts of possession (actos posesorios) since 2000 or 2001, her presence in the area at issue, the construction of wells and pigsties, and the cultivation of fruit trees, as well as the defendant’s acts of interference and dispossession (despojo). This must be considered together with the defendant’s admission in his confession that he was not the person who installed the well or planted the fruit trees. Those features were observed during the judicial inspection and are adjacent to the wetland area, which the plaintiff states in the complaint forms part of the property in her possession.
On behalf of the defendant, testimony was received from [Nombre7] (expediente/documentos/fecha 09/11/2016 09:07:41), who stated that she knew both parties and lived in Achiotal. She knew that [Nombre1] erected a fence adjoining a ceiba tree 5 years ago in an area that did not belong to her. She stated that this caused the dispute between the parties and led them to initiate judicial proceedings. She said that [Nombre1] was given a piece of land 16 years ago on the firm ground, but that it did not extend “over there.” She did not know why [Nombre1] moved the fence to a place that did not belong to her. She stated that the house located on [Nombre1]’s portion was unoccupied. Regarding [Nombre1]’s cattle, she knew that they roamed freely, whether on the road, on [Nombre2]’s property, or on the witness’s parcel. In response to the plaintiff’s questions, she stated that she did not know the size of the disputed area because she was not an engineer and did not know how to calculate it, but she knew the area at issue. [Nombre1] was given half a manzana of land by those whom she identified as the Directors, after she spoke to them and said that she lived in Nicaragua and wanted to move there.
She testified that [Nombre2]’s property was larger. She stated that many years ago [Nombre1] lived on the land in a different house, after which it was abandoned; the current house is new. She did not know what condition the former house was in because the witness did not visit anyone and was unfamiliar with [Nombre1]’s dwelling. She explained that she only saw it from a distance. She stated that the plaintiff lived there for approximately three years and then ceased living there. She had almost never entered the property, except when she testified in the prior judicial proceeding. She explained that she could see the plaintiff because her own house was located on a hill, but that she was unfamiliar with the property. Regarding the disputed fence, she stated that she knew it because it had been attached to a tree and did not follow its current location, where it had stood for approximately three years; she did not know where it had been before that.
She stated that the cows had been there for approximately four years. The witness stated that she owned two manzanas of land allocated by the Board, since the land was intended for cultivation. Not all neighbors were given two manzanas.
In response to the questions posed by the representative of the Office of the Attorney General, the declarant stated that she had lived in Achiotal for 16 years and that, by 4 de junio del 2000, she was already living on the property. She answered that the swamp (suampo) had always remained in the same condition as observed today; it had not changed. Not all of the disputed area is swamp, but as regards the swamp, Mrs. [Nombre1] and [Nombre2] had divided it and erected the fence. She did not know what happened afterward, but [Nombre1] modified it. They were going to share the swamp area, but later the fence appeared by the ceiba tree, giving rise to the legal dispute between the parties. She stated that there are no trees in the area other than two corozo trees because it fills with water in winter. There are large trees around it. In response to the judge’s questions, she stated that she had seen [Nombre1] in the area for approximately 11 years and still sees her, clarifying that she did not leave, as she had indicated previously.
She explained that [Nombre1] had lived on the property and then moved to the center of Achiotal, and that she had only recently seen the newly built house. The agreement between them concerning the swamp area was reached approximately 9 years ago. It appears that the fence posts fell down. There had previously been no fence, and [Nombre1]’s cows roamed through that portion of the land; however, because [Nombre2] grows crops, they agreed to erect the fence to prevent damage to them. For this Chamber, the fact that the witness does not know the plaintiff’s property and stated that she never visited it, but observed the property (fundo) from her house on a hill, is sufficient reason to disregard her testimony insofar as she asserts that the disputed area belongs to the defendant rather than the plaintiff. Furthermore, the purported agreement between the parties to the dispute to divide the flooded area between them was not even mentioned by the defendant in his answer to the complaint or in subsequent filings.
Accordingly, that evidence is not considered useful for discrediting the plaintiff’s acts of possession (actos posesorios) over the disputed area or her continued possession through her use of that strip. In analyzing the requirements of the Publician action (demanda publiciana), this court finds that these statements establish the plaintiff’s standing to sue (legitimación activa), because they demonstrate that she began her possession in the year 2000 and, from that time onward, lived at the site with her family, constructed a hand-dug well and pigsties, and had a house, all in the firm-ground area, while the flooded portion was used by livestock. Furthermore, the boundary (lindero) of the property placed in her possession was defined by reference to the melina tree described during the judicial inspection (reconocimiento judicial), located to the north and mentioned by witnesses [Nombre6] and [Nombre5].
Those declarants stated that the correct southern boundary, as delivered to her at the time by the entity known as the Cooperativa, adjoins the defendant’s property and corresponds to the location of the melina tree, continuing in a straight line and encompassing the muddy or wetland area that came into the defendant’s possession as a result of the erection of the new fence. That fence was erected pursuant to the order issued in voto 115-F-14 in the possessory injunction proceeding (proceso interdictal), which was decided in favor of [Nombre2] and concerned the removal of a fence six months before the summary action was filed. It must be clarified that such a proceeding concerns the current and temporary possession established at the time that litigation occurred (Article 457 of the Código Procesal Civil, applied on a supplementary basis). The subject matter of the present case concerns definitive and permanent possession.
Based on the evidence submitted in the case at bar, it may be concluded that the plaintiff did in fact possess the property beginning in the year 2001, when she settled there and lived with her family, until she was required to relocate to central Los Chiles, without relinquishing her use of the property, because she continued to keep livestock and other animals there, which were tended by her children. Those animals had access to the flooded area to obtain water and roam, as testified by witnesses [Nombre6] and [Nombre5]. That possession was indeed interrupted as a result of the decision in the aforementioned possessory injunction proceeding and the order requiring erection of the fence, which prevented the plaintiff from using the disputed area, because the possessory-injunction protection (tutela interdictal) sought by the defendant herein was found to be well-founded in that litigation.
Nevertheless, in the ordinary proceeding (proceso ordinario) under consideration, it is possible to analyze and assess broader matters concerning the longstanding possession that the plaintiff has demonstrated. As to standing to be sued (legitimación pasiva), it was established through the statements of witnesses [Nombre6] and [Nombre5] that the defendant erected the new fence and disregarded the boundary that had been assigned to the plaintiff since the year 2000. Bearing the burden of proof (Article 317 of the Código Procesal Civil, applied on a supplementary basis), the plaintiff demonstrated through the witnesses she presented in this proceeding that her boundary runs from the melina tree northward to the public road and that, consequently, the area they call the swamp forms part of her possession. The defendant, for his part, denies this but offers nothing other than the statement of [Nombre7], whose contents are disregarded for the reasons stated above.
He should have rebutted the identification of that boundary on the southern side of the plaintiff’s property, which uses the melina tree as its reference point. This court finds that the plaintiff has materially possessed the property and has established her standing to sue, because she demonstrated that she exercised possession beginning in the year 2001, under the terms of Article 277 of the Código Civil and Article 297(2) regarding the applicable period. As to standing to be sued, it is deemed established by the conclusions drawn from the aforementioned testimony of [Nombre6] and [Nombre5]. Their statements prove that the defendant dispossessed (despojó) the plaintiff of the disputed area by erecting the fence, thereby depriving her of possession of the area where the hand-dug well and fruit trees are located. He acknowledged that he had not constructed or planted them and that they were already there when he took possession of that portion of the land, although he alleged that others had created or planted them.
The plaintiff, however, demonstrated that they belonged to her. She also made use of the area identified as the swamp, which constitutes a wetland ecosystem (ecosistema de humedal), as observed during the judicial inspection and recorded in the SINAC report (images 76 to 84 of the file in pdf format). This Court takes into consideration the statement of witness [Nombre5] that, on two occasions, he observed the plaintiff’s farmhand, identified as [Nombre12], knocking down the plaintiff’s fence, thereby allowing her livestock to escape. It also takes into account his express statement that the disputed area had been possessed by the plaintiff since the year 2001, which is consistent with the testimony of witness [Nombre6].
VII- The challenged decision bases its dismissal of the claim on the legal nature of the property in dispute. First, it classifies the property as public-domain property (bien demanial) because it is located in the northern border zone and lies entirely within the Refugio Nacional de Vida Silvestre Corredor Norte, created by decree 22962 of 15 de febrero de 1994. This is according to official letter SINAC-ACAHN-OTAT-049-2015 of the Sistema Nacional de Areas de Conservación -Area de Conservación Arenal Huetar Norte. (image 76 to 84, previously cited). The field study concluded that the property is traversed by the Río Frío-Marillal wetland (humedal), code CED6, and described its associated flora as clavillo, dormilona grande, mat grasses, water lilies, and corozo palms. It also noted the existence of flooded land and water-saturated surfaces. It should be noted that, because this land is subject to the wildlife-refuge management-category regime (régimen de categoría de manejo de refugio de vida silvestre), it is administered by the Ministerio de Ambiente y Energía.
It is clear that, because it is also located in the border zone, it is property that cannot be alienated or claimed exclusively by private parties through any in rem claim (pretensión real) of ownership or possession against the State, as stated in the judgment under appeal. Nevertheless, in resolving the dispute presented, sight cannot be lost of the fact that a population carries out farming and residential activities on these properties subject to these special regimes. Therefore, pursuant to constitutional provision 42 and Article 10 of the Código Civil, in order to address the social problems actually faced by these residents, given that the dispute is between private parties claiming physical possession (posesión material), and without prejudice to the rights of the State, in accordance with Article 286 thereof, this Court considers it possible to resolve the dispute in the matter sub judice by determining who has exercised possession in the disputed area.
It is understood that the possession recognized is not capable of giving rise to acquisitive prescription (usucapión), given the nature of the property, and that such recognition does not diminish the authority of the Ministry responsible for administering that protected wildlife area (área silvestre protegida). The Ministry is empowered to issue any orders necessary to preserve the environment and the wetland ecosystem present there. It should be noted that the wetland identified has suffered no harm, according to the witnesses who testified on that matter in response to questions from the State Attorney representing the State, who appeared at the oral trial hearing. No adverse impact was found from the presence of those persons, their activities in keeping a small number of cattle, building pigsties, or cultivating fruit trees. This has been a low-impact agricultural use that has not disrupted the ecological balance of the site, thereby fulfilling one of the objectives of sustainable development (desarrollo sostenible) that guides the body of national and international environmental law.
For that reason, the Court does not find persuasive the State Attorney’s argument, made in a written submission (image 69 to 75 of the case file in PDF format), that because this wetland area forms part of the Patrimonio Natural del Estado, it cannot be used and no right whatsoever may be asserted over it. It is true that this land is an area forming part of that heritage, but it is not affected by the present ruling, because what is recognized is a superior right of possession (mejor derecho de posesión) as between two private parties, neither of whom may ever obtain any ownership right, and who could at most obtain some type of permit or authorization if granted by the Ministry administering the refuge, in accordance with the law and the management plan (plan de manejo) that must exist to regulate the uses and purposes of those areas (Articles 16, 17, 18, 25, 51 of the Ley de Conservación de Vida Silvestre N. 7317).
It is apparent that the protected wildlife area affecting the property in dispute falls under the Refugio Nacional de Vida Silvestre management category. It is governed by Articles 82, 83, 84, and 87 of the law cited above. Those provisions assign such areas the purpose of protecting and researching wild flora and fauna. They are classified into three types: state-owned, mixed-ownership, and privately owned refuges. The resources they contain fall under the authority and management of the Dirección General de Vida Silvestre del Ministerio de Recursos Naturales y Energía, according to the text of the provision. It likewise states that persons seeking to undertake development activities and projects involving the exploitation of natural resources require authorization from that ministry. It is important to emphasize that, under the provisions cited, the uses of these protected wildlife areas differ from those assigned to the Parque Nacional or Reserva Biológica categories, whose more restrictive purposes are incompatible with any commercial or agricultural activity.
It should be noted that the continuing presence of residents who settle on such land and use it through small-scale agricultural activities is a social reality in the area where the property in dispute is located. In this case, a dispute has arisen between private parties concerning a property containing a wetland and located within the aforementioned refuge; it has not been established that the farmers using it have caused environmental harm, and neither holds any permit or authorization, although they have been present for many years with the knowledge and acquiescence of the competent environmental authorities. This does not diminish in any way the environmental oversight authority of the relevant entities and ministries. The fact remains that disputes over the use of the land exist, and the Administration of Justice must provide a solution in the interest of social peace for the residents of those areas.
Accordingly, the Court does not consider that this ruling affects the public domain or the Patrimonio Natural del Estado, since Article 286 of the Código Civil provides: “The manner of using and benefiting from public property shall be governed by the respective administrative regulations, but disputes arising between private parties concerning a superior right or preference regarding the use and enjoyment of public property shall be resolved by the Courts.” Thus, this ruling is issued without prejudice to the interests and rights of the State and is intended to resolve a private dispute. This leads this appellate court to reverse the judgment under review, which dismissed the claim on the ground that, although possession of the property had been established, its public nature, resulting from its containing a wetland and forming part of the aforementioned Refuge, precluded recognition of any right of possession.
VIII- Therefore, in view of the foregoing reasoning and with respect to the defenses of lack of a legal right (falta de derecho) and the general defense of sine actione agit raised by the defendant, those defenses must be rejected because the plaintiff is entitled to bring this action seeking recognition of a superior right of possession, having established its requirements, as reasoned above regarding standing to sue (legitimación activa), standing to be sued (legitimación pasiva), and the identity of the property. She established that she has possessed the disputed area since 2001 by carrying out agricultural acts evidencing possessory dominion (actos de dominio posesorio agrícola), and established that the southern boundary of her property runs from the melina tree mentioned by the witnesses; that she installed the well and pigsty, planted the fruit trees, and made use of the existing wetland. The defense of res judicata (cosa juzgada) was denied by an interlocutory ruling.
IX- In view of the foregoing, based on the matters set forth above and Articles 1, 2, 54, 55, and 56 of the Ley de Jurisdicción Agraria and Articles 263, 277, and 279 of the Código Civil, the judgment is partially reversed insofar as it dismissed the claim brought by [Nombre1] against [Nombre18]. In its place, the defenses of lack of a legal right and sine actione agit are denied, and the claim is granted insofar as it is declared that [Nombre1] has a superior right of possession to that of [Nombre2] over the unregistered property (finca sin inscribir) located in the community of Tablillas de Los Chiles, [Dirección7], in the province of Alajuela, which forms part of the Refugio Nacional de Vida Silvestre Corredor Frontera Norte. The property has an approximate area of one and one-half manzanas and partially contains a wetland area. The property is known as el Achiotal. It is bounded by [Nombre11] to the north, [Nombre1] to the south, [Nombre4] to the east, and a road to the west. [Nombre18] is ordered, within fifteen calendar days after this judgment becomes final and at his own expense, to remove the fence erected from one side to the other across the property possessed by [Nombre1], adjacent to the existing dwelling, to vacate the wetland area and the firm ground where the hand-dug well, fruit trees, and remains of pigsties are located, and to leave the area in the possession of [Nombre1]. [Nombre18] is warned that, in the event of disobedience to the authorities, certified copies of the pertinent records may be forwarded for prosecution for the offense of disobedience to authority. [Nombre18] is ordered to refrain from bringing cattle onto the property over which the plaintiff’s superior right of possession is recognized and to respect the former boundary between the two properties that was removed, which runs from the melina tree south of [Nombre1]’s property in a straight line to the ceiba tree and onward to [Dirección8].
This ruling is issued without prejudice to the interests and rights of the State, since it does not recognize in favor of the plaintiff possession for purposes of acquisitive prescription (posesión ad usucapionem), nor does the recognition of a superior right of possession decreed herein substitute for the respective permits and authorizations that must be obtained from the Ministerio de Ambiente y Energía to carry out any activity. The possessor is likewise obligated to comply with the legal rules and orders governing the protection of wetlands as ecosystems that provide an environmental service (servicio ambiental) of great importance to the environment, as well as the regulations specific to the Refugio Nacional de Vida Silvestre Corredor Frontera Norte. With respect to the remaining matter of costs, no ruling is issued because that issue is unrelated to the appeal.
POR TANTO
The judgment is partially reversed insofar as it denied the claim brought by [Nombre1] against [Nombre18]. Instead, the defenses of lack of legal right and sine actione agit are denied. The claim is granted, and it is declared that: [Nombre1] has a superior right of possession (mejor derecho de posesión) than [Nombre2] over an unregistered property (finca sin inscribir) located in Tablillas de Los Chiles, [Dirección7], Province of Alajuela, which forms part of the Refugio Nacional de Vida Silvestre Corredor Frontera Norte. It has an approximate area of one and one-half manzanas and partially contains a wetland area (área de humedal). The property is known as el Achiotal. [Nombre11] to the north with [Nombre1], to the south with [Nombre2], to the east with [Nombre4], and to the west with a road. [Nombre18] is ordered, within fifteen calendar days after this judgment becomes final and at his own expense, to remove the fence placed from side to side across the parcel (fundo) possessed by [Nombre1], adjacent to the existing dwelling, to vacate the wetland area and the firm ground where the hand-dug well (pozo artesanal), fruit trees, and remnants of pigsties are located, which he occupies, and to surrender possession thereof to [Nombre1]. [Nombre18] is warned that, in the event of disobedience to authority, certified copies of the relevant records may be issued so that he may be prosecuted for the offense of disobedience to authority. [Nombre18] is ordered to refrain from bringing cattle onto the parcel over which the plaintiff is recognized as having the superior right of possession, and to respect the boundary (colindancia) that existed between the two parcels and was removed, which runs from the melina tree to the south of [Nombre1]’s parcel in a straight line to the ceiba tree and as far as [Dirección8].
This ruling is issued without prejudice to the interests and rights of the State, because it neither recognizes ownership rights nor possession for adverse possession (posesión ad usucapionem) in favor of the plaintiff, and because the recognition of a superior right of possession decreed herein does not replace the respective permits and authorizations that must be obtained from the Ministerio de Ambiente y Energía for the performance of any activity. Likewise, the possessor is obligated to comply with the legal rules and ordinances governing the protection of wetlands as ecosystems that provide an environmental service (servicio ambiental) of great importance to the environment, as well as the regulations specific to the Refugio Nacional de Vida Silvestre Corredor Frontera Norte. In all other respects concerning costs, the judgment is affirmed.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las catorce horas y diez minutos del quince de marzo de dos mil dieciocho.- PROCESO ORDINARIO establecido por [Nombre1] , mayor, soltera, de oficios del hogar, vecina de Los Chiles, Alajuela, cédula de residencia CED1 ; contra [Nombre2] , mayor, nicaragüense, casado una vez, guarda de seguridad, vecino de Grecia, Alajuela, cédula de residencia CED2 . Se tiene como terceros interesados en el proceso a la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Silvia Quesada Casares, mayor, abogada, vecina de San José, cédula de identidad CED3 - - ; y al INSTITUTO DE DESARROLLO RURAL, cédula jurídica CED4 - - - , representado por su apoderada general judicial Grace Ávila Calvo, mayor, soltera, abogada, cédula de identidad CED5 - - . Actúa como defensor público agrario de la parte actora, el licenciado Ignacio Rodríguez Sancho y Doriana Garita Solano. El letrado Hubert Rojas Araya, carné uno uno tres dos. Tramitado ante el Juzgado agrario del Segundo Circuito Judicial de Alajuela, San Carlos.-
RESULTANDO
Redacta la jueza Castro García;y,
RESULTANDO
I- Hechos probados. Se avalan los hechos probados por encontrarse sustentados en los elementos de prueba constantes en autos. De esta naturaleza se agrega en esta instancia: 5./ El lindero sur la finca en posesión de [Nombre1] , al adquirirse en el año 2001 que colinda con el inmueble en posesión de [Nombre2] , discurre de este a oeste en línea recta desde el árbol de melina, hacia los postes y cerca encontrada en el reconocimiento judicial y hasta [Dirección3] . (pb./ croquis en imagen 327 expediente modo pdf, declaración testimonial de [Nombre5] y [Nombre6] asociado en fecha 9-11-16). 6./La cerca existente ubicada detrás de la casa rústica que corre de este a oeste no coincide con lo entregado a [Nombre1] en el año 2001 cuando tomó posesión del inmueble para habitarlo (declaración testimonial de [Nombre5] y [Nombre6] asociado el 9-11-16). 6. Los árboles frutales y pozo artesanal existentes y situados al este de la zona en litis en posesión de [Nombre2] fueron incorporados por [Nombre1] (pb/ declaración confesional de [Nombre2] y testimoniales de [Nombre5] y [Nombre6] , reconocimiento judicial y croquis asociado el 08-11-2016.)
II - La parte actora recurre (imagen 367 a 371 expediente modo pdf) dentro del plazo legal la sentencia de primera instancia n. 32-2017 de las 13:37 horas del 28 de febrero del 2017 (imagen 360 expediente modo pdf). La resolución apelada, declaró sin lugar la demanda de mejor derecho de posesión al razonar el fundo es parte del patrimonio forestal del Estado y por ello es un bien demanial. Refuta la apelante, la sentencia tiene como hecho demostrado la posesión en calidad de propietaria que mantiene la actora sobre el terreno. Sobre el desarrollo de actividades agrícolas desde el año 2000 en el fundo se concluye de la prueba testimonial y no se valoró por la a quo. Indica, el demandado aceptó en el interrogatorio que se le practicó, tenía conocimiento que la cerca que delimita su terreno con el de la actora tenía más de 30 años de estar ahí. De tal forma que reconoció, la accionante posee el fundo hace muchos años (respuesta 5), cumpliéndose con el presupuesto de la acción incoada con el primer requisito de un mejor derecho de posesión, la legitimación activa.
Agrega, la testiga [Nombre7] declara: "... [Nombre8] hizo la cerca hace como 5 años...y tiene de estar ahí 16 años... había una casa donde esta vivió más de 3 años... y tiene ganado ahí". De igual forma cita, el testigo [Nombre6] depuso: "... la actora llegó al terreno desde el 2000...desde que llegamos siempre tuvimos chanchitos, siembros de yuca....", menciona también declaró: "ella lo compró a una cooperativa, teníamos otra casa hecha de melina, se cayó entonces se hizo otra". Aduce, los testimonios concuerdan con lo descrito en el reconocimiento judicial respecto a la casa que existe en el terreno en disputa. Estima, su declaración no es antojadiza por ser [Nombre6] el hijo de [Nombre1], pues describió la realidad que hay en el terreno y quien ha sido la persona que ha ejercido labores agrarias dentro del mismo. Reprocha, el juez realizó una errónea valoración probatoria. Lo que conlleva a este Tribunal modificar los hechos probados y no probados de la sentencia, para que quede acreditado que [Nombre1] ha sido la persona que ha ejercido labores agrarias sobre el terreno en discusión desde el año de 2000, a vista y paciencia del demandado y los testigos.
La posesión que ha desarrollado es por más de diez años y el demandado aprovechándose que la actora es una señora que vive sola ha intentado despojarla de al menos una manzana del ese fundo. Argumenta, lo anterior se demostró con el testimonio de [Nombre5] , que describe los problemas que se han suscitado con el demandado y cómo esa persona ha sacado del terreno el ganado de la actora y le ha partido la cerca. Agrega, la declarante [Nombre7] refiere también que el accionado ha perturbado la posesión de la actora y los problemas que han habido con la delimitación de la cerca. Ante esto, señala, se demuestra la legitimación pasiva de [Nombre2] . En cuanto a la identidad del bien, refuta, se demostró que el terreno en litis se sitúa en la localidad de Tablillas de Los Chiles, y es finca sin inscribir. La heredad especificada en la demanda es la misma observada en el reconocimiento judicial.
Como agravio reclama falta de valoración probatoria, pues en la sentencia se indicó que a pesar de que de los testimonios vertidos de determina la ubicación de la cerca parte de este conflicto, y cual parte ha ejercido la posesión sobre el terreno en no es posible obviar la condición de demanial que ostenta. Al respecto arguye, conoce del régimen especial aplicable al área del terreno en conflicto; pero no se consideró que se demostró por la actora que ejerció la posesión sobre esa parte de tierra que tiene aptitud agraria. Además que en la confesional y declaración de [Nombre6] y [Nombre9] se reconoce que la accionante trabajado el terreno, siempre lo ha sembrado y ha mantenido ganado ahí. Reclama, sin fundamento, se decide que [Nombre1] no ha poseído el terreno, por ser el fundo demanial, cuando lo cierto es que en el reconocimiento judicial se consigna la realidad del terreno, sembrado, con ganado y debidamente asistido.
Apela, para el demandado es fácil aprovechar todo el trabajo y esfuerzo que [Nombre1] realizó por muchos años sobre ese inmueble. Reclama, se resuelva sobre todo lo sometido a debate, el conflicto y no se dejen inconclusas las gestiones planteadas por las partes. Como en este caso donde no se valoró la totalidad del acervo probatorio. Refuta, en este proceso se solicitó la declaratoria de un mejor derecho de posesión, no de propiedad. A pesar de cumplirse con todos los requisitos, no se valoran los elementos de prueba. Hace ver, la Procuraduría como ente interesado tampoco solicitó la reivindicación del terreno. Que si bien se encuentra dentro de área silvestre protegida, la realidad del país es otra y a pesar de ello estos terrenos protegidos son ocupados y trabajados. Por lo que se debió resolver el conflicto planteado. En el caso concreto, se limitó únicamente a pronunciarse sobre la identidad del bien, dejando de lado una valoración más real del asunto.
Pide se revoque la sentencia apelada, se declare con lugar en todos sus extremos la demanda presentada decretando que la actora tiene un mejor derecho de posesión sobre el demandado del terreno que es objeto de litigio.
III- Respecto al reproche de la errónea valoración de la acción interpuesta se rechaza el alegato, pues de la lectura de la sentencia se observa se ha resuelto la acción de mejor derecho de posesión, mediante el análisis de las pretensiones de la acción y se expuso los motivos de hecho y derecho con vista de la prueba constante en autos que le hicieron llegar a las conclusiones vertidas en la pieza apelada. Sin embargo, y a pesar de mencionar que fue observado lo citado en el reconocimiento judicial y deducir de las declaraciones testimoniales que la actora ejerció la posesión por periodos del 2000 y hasta el 2013, la calificación de demanialidad del humedal que existe en el fundo y ser parte del Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte, hacen que este inmueble sea parte del Patrimonio Natural del Estado, que no permite el ejercicio de posesión por particulares y deniega la demanda. Criterio expuesto en el fallo, no compartido por esta Cámara por las razones que se expondrán más adelante.
IV- Dado el cuadro fáctico de la acción planteada se reclama un mejor derecho de posesión con efectos reivindicatorios, contra un particular en un inmueble que forma parte del área silvestre protegida citada según consta en autos y contiene un humedal. Lo anterior acorde con el estudio emitido por el SINAC (imagen 76 expediente modo pdf). Cabe citar, sobre la acción publiciana la Sala Primera de la Corte Suprema de Justicia ha resuelto: “VI.- … tiene por objeto la tutela del poseedor legítimo frente al ilegítimo, a fin de lograr la restitución de la posesión de la cual ha sido ilegítimamente privado. (Doctrina de los artículos 317 a 322 del Código Civil y 277 y 286 ibidem). Es pues una acción restitutoria:"...Esta acción compete al adquirente con justo título y buena fe; tiene por objeto se le restituya en la posesión definitiva de una cosa mueble e inmueble. Se da esta acción en contra del poseedor sin título, del poseedor de mala fe y del que tiene título y buena [Nombre10] , .
Derecho Civil mexicano. Tomo III, México, Editorial Porrúa S.A. 1981, 5ta. Edición, pgs. 691 y 692). En síntesis, la finalidad esencial de esta acción radica en la recuperación del bien. La jurisprudencia patria en este sentido ha estimado: "...La acción de mejor derecho de posesión, originada en la defensa del Derecho Romano conocida como "publiciana", tiene su fundamento en nuestro ordenamiento jurídico en los artículos 317, 318, 319 y 322, así como en los numerales 277 y 286 del Código Civil, y tiende a tutelar al poseedor legítimo frente al ilegítimo, con el objeto de que logre la restitución de la posesión de que ha sido indebidamente privado, bien para que se declare su derecho preferente respecto de un poseedor anterior... (Consúltese Resolución de las 15:00 horas del 6 de junio de 1990 de la Sala Iera. de la Corte Suprema de Justicia de 1990 que responde al Voto No.16). En cuanto a los requisitos de esta acción para que prospere consisten en: legitimación activa y pasiva e identidad del bien.
Siendo así, para el cumplimiento de la legitimación se torna de importancia determinar quién ha ostentado la posesión, real y efectiva sobre el inmueble, resultando indispensable, -conforme a la jurisprudencia patria en esta disciplina, la cual se comparte por este Tribunal-, para la parte que pretende el reconocimiento de su derecho de posesión, demostrar, en forma indubitable, haber ejercido actos posesorios estables y efectivos, concretos sobre el bien. Merece citarse lo así resuelto por dicha jurisprudencia:"...V.- Cabe destacar que en acciones como las que se ventilan en este litigio, las cuales, como bien lo afirmó el Tribunal Superior, se fundan, en esencia, sobre cuestiones de mejor derecho de poseer, dado que se refieren a un inmueble no inscrito, sobre el que se discute la posesión, a efecto de proceder a inscribirlo en el Registro Público de la Propiedad, es muy importante determinar quién ha ostentado la posesión, real y efectiva, sobre el inmueble.
Es requisito indispensable que la parte que pretende el reconocimiento de su derecho de posesión, demuestre, en forma contundente, haber realizado actos posesorios efectivos, concretos y estables sobre el bien, de manera que se observen los postulados y principios rectores del derecho agrario, que tienden al cumplimiento de la función social de la propiedad, a través de un dinámico y productivo ejercicio de su principal atributo, la posesión...." (En este sentido Sentencia No. 31-93. (Sala Primera de la Corte Suprema de Justicia 10:00 horas del 21 de mayo de 1993).
V- Sobre los agravios de la actora sobre la efectiva posesión sobre el inmueble. Visto lo resuelto objeto del recurso y el agravio referido a que el fallo niega la posesión de la actora en virtud de calificar la sentencia que la parcela es bien de dominio público, procede esta Cámara a valorar el ejercicio de los actos posesorios sobre la zona en discusión en forma primaria. La resolución impugnada tuvo por demostrados los hechos que el área en litis es terreno de humedal, sito en Tablillas de Los Chiles, [Dirección4] Los Chiles de la Provincia de Alajuela, finca conocida como el Achiotal. Cabida de aproximadamente manzana y media. [Nombre11] al norte con [Nombre1] , al sur con [Nombre2] , al este con [Nombre4] y al oeste con calle. Como fundamento probatorio se tiene el croquis asociado al expediente a las 16:12:58 del 08/11/2016, el reconocimiento judicial asociado a las 09:06:33 y la adición asociada a las 09:06:48 del 09/11/2016 (hecho primero).
Además, que la zona en conflicto tiene un área aproximada de una manzana de humedal, y en el resto del sector se encuentran vestigios de blocks y cemento, árboles frutales y un pozo. El lindero Norte se encontró deslindado actualmente con una cerca de alambre de púas a tres hilos. La base probatoria se funda en el croquis y reconocimiento judicial referido supra, además de las declaraciones testimoniales de [Nombre7] , [Nombre6] y [Nombre5] asociadas al expediente el 09 de noviembre del 2016 (hecho segundo). Se tuvo por demostrado que el inmueble descrito se ubica en la zona fronteriza norte y en forma parte del Refugio Nacional de Vida Silvestre Corredor Fronterizo Norte. Lo que se deduce del informe N° SINAC-ACAHN-OTAT-049-205 en imagen 76 a 84). Ninguno de los hechos citados fueron objeto de apelación y revisados por esta Cámara, fueron prohijados al constatarse se encuentran fundados en las pruebas referidas.
En relación con lo anterior, la actora reclama en su demanda es la poseedora con mejor derecho del fundo ya descrito, sobre el cual ha poseído por más de 15 años y desde el año 2000, ha desarrollado actividad agraria manteniendo animales, introduciendo frutales y haber edificado infraestructura asociada (pozos y chiqueros). Señala en su acción, el área se le entregó delimitada mediante estacas, ha mantenido cercas, rondas, chapeas, conservado árboles. Describiendo haber conflictos solamente con el colindante demandado [Nombre2] , que le reclama una parte de su terreno y que en enero del 2013 le despojó de una manzana aproximadamente aprovechando que se debió trasladar a Los Chiles centro. Periodo dentro del cual se observó al peón del demandado dentro de su finca. Reclamó, actualmente solo cuenta con 4.000 mil metros debido a la colocación de una cerca de lado a lado. Describió, en julio se le notificó la decisión judicial interdictal que resolvió reconocer la posesión favor del demandado y se ordenó se colocara la cerca por donde estaba.
Sin embargo, se instaló por él en un sitio que no correspondía. Por su parte, el accionado, rechazó la demanda y reconoció que la finca reclamada por la actora es la que mantiene en posesión. Señalando que la accionante no trabaja, ni vive en el fundo. Negó que el Comité hubiera puesto en posesión dos manzanas a la actora, que colinda con él. Señalando que [Nombre1] nunca ha respetado la cerca existente, al punto de haber presentado un interdicto del que resultó victorioso que se instruyó bajo el número13-000027-0298-AG (imagen 121 a 126 de expediente digital). En este caso, se celebró un reconocimiento judicial (expediente digital/documentos/fecha 09/11/2016 09:06:33 y 09/11/2016 09:06:48) donde se logró observar un fundo ubicado en la [Dirección5] , al que se ingresó por un sector de media manzana de la actora que está fuera del proceso. Se consignó por la a quo que celebró esa actuación, el área en litis se ubica al sur de esa zona de la accionante y se observa una cerca en buen estado, a tres hilos.
De la casa de habitación en la parte en posesión de la actora a escasos metros y medio se sitúa la cerca, detrás de la casa hay un portillo pasa manos y se entra en la parte en litis, encontrando un pozo artesanal en uso, al oeste existen unos blocks donde se mencionó por la actora habían unos chiqueros. El recorrido se hizo al este, donde existen diversas especies de frutales, encontrando otro vestigio de chiquero. Al sur no se recorre por ser área de humedal de una manzana, y se identificó un árbol de melina que es punto que delimita. Todo lo cual es parte de lo discutido. Se mencionó, la cabida aproximada en litis es de manzana y media, siendo la mayoría de humedal. Se describió que la casa ubicada al inicio esta fuera del objeto en litis, es rústica no está habitada, es de madera, con piso de madera y aparente de reciente levantamiento. Se afirmó también, sobre la zona fuera de esta discusión, se encontraron cuatro cabezas de ganado, presencia de boñiga fresca al noreste de la finca.
En el lindero sur, a tres metros de la ubicación actual de la cerca hay tres árboles de madero negro y capirote que iban en una línea con la melina que era la línea original de la cerca. Se confeccionó un croquis (imagen 327 expediente digital modo pdf) que refleja lo descrito en el reconocimiento judicial, en donde se grafica el árbol del melina que identifica la actora como la colindancia antigua y real con la finca en posesión del demandado, una zona que se dibuja como área de humedal, un sector al norte donde se representó un pozo, bloques, frutales y un planche de cemento. Seguido de la cerca a tres hilos de alambre que inicia desde [Dirección2] y al este hasta el fondo. Luego de la misma, una vivienda y dibujo de ganado. Logrando determinarse por esta Instancia que la zona en litis es precisamente el área que queda al lado sur de la cerca lineal ubicada detrás de la casa graficada, que tiene zona de humedal y parte al este de terreno firme, donde se asienta el pozo artesanal, los bloques de cemento, los frutales y un planche de cemento. Con tales probanzas se acredita el presupuesto de la identidad del bien requerido para la acción publiciana interpuesta por la actora.
VI- Ello debe ser valorado en forma integral con lo dicho por los testigos y confesante que declararon en el juicio verbal celebrado, a fin de verificar si lleva razón la apelante en sus agravios respecto al ejercicio de la efectiva posesión de la actora apelante. Por su parte, el demandado [Nombre2] rindió prueba confesional (expediente digital/documentos/fecha 09/11/2016 09:07:19) donde aceptó, contrario a sus intereses (artículo 338 del Código Procesal Civil aplicado supletoriamente por Transitorio I de Ley 9343), en el fundo en litis existe un pozo artesanal que no fue introducido por el declarante y que los frutales no fueron plantados por él, explicando que al ser un precario, fueron otras personas que las incorporaron y al haber llegado al lugar ya existían. De tal respuesta, se tiene por aceptado que lo existente en el fundo, observado en el reconocimiento mencionado, existe y no fue introducido por el accionado, sea el pozo y los árboles frutales.
Respecto a la autoría de lo encontrado en la zona en litis, la posesión ejercida y la presencia de las partes en el sitio, el testigo [Nombre5] (expediente digital/documentos/fecha/09/11/2016 09:08:44) indicó conocer a ambas partes. Saber, existen problemas porque [Nombre2] puso la cerca actual que antes no existía, cerca de la casa de la actora; solo estaba la otra. Afirmó, anteriormente la actora tenía un chiquero y le dividieron todo. Eso sucede en el 2014. Considera, [Nombre2] quiso aprovechar que [Nombre1] es una mujer sola, luchadora. Observó a [Nombre12] hoy fallecido y su hijo en el pasado, quitando la cerca de ella y sacándole su ganado; pues es sola. Afirmó, siempre andaban las vacas por todo lado en el año 2015. Conoce, el demandado se introdujo en el año 2000 mediante una repartición de una cooperativa. Las parcelas en ese momento eran vendidas por la Directiva de esa organización y [Nombre2] fue parte de los líderes.
Depuso, saber que le dieron dos manzanas a la actora, pues a casi todos les entregaron esa cantidad. Conoce, las colindancias al norte era de Julio al inicio y luego con otros, además de [Nombre4] y calle. Indicó sobre la división entre las fincas, la del fondo se levantó por lo directivos que ponían estacas. [Nombre1] seguramente puso esa cerca, sino es que estaba antes. Mencionó, la cerca nueva la observó hace uno o dos años. No sabe quién la hizo. Indicó, el área de conflicto tiene árboles frutales, el llano donde habían caballos, chiqueros y ganado a partir del año 2001 y 2002. Citó, en el área en discusión hubo una casa por mucho tiempo; por 10 o 12 años. A la cual escuchó le robaron el zinc. La casa era de [Nombre1] y diferente a la actual. Afirmó, siempre ha habido construcción, hay un pozo que lo hizo la actora; que no sabe si esta fuera o dentro. Pero era de la parcela de ella. En el lugar, explicó, [Nombre1] nunca ha causado daños al ambiente y no le consta que el MINAE haya tenido que apersonarse al sitio.
Detalló, el ganado de ella tomaba agua del suampo, pero al colocar la cerca y haber observado que le cortaban la cerca a la actora en dos ocasiones, no pueden hacerlo. Señaló, [Nombre12] , el finado, tenía un fundo que le habían dado y se había metido en otro por ser conflictivo. Lo ha visto en el área del conflicto sacando el ganado de la señora y botándole la cerca. Indicó, el fundo del demandado lo ha trabajado normalmente pero no tanto, mencionando la existencia de alguna yuca. A [Nombre1] la ha visto trabajando en su parcela y la zona en conflicto. A la jueza le contestó, no haber observado casa en el inmueble de [Nombre2]; donde tiene unos cocos. Haber observado algunas plantas de yucas en el fundo de [Nombre2], y no mirarlo cultivando en la zona que indica le corresponde a [Nombre1]. A la Procuradora contestó conocer el fundo desde que era de [Nombre13] , cuando era una sola finca en sus tiempos de colegio.
Había ganado, luego vino la Directiva y repartieron. Además, que el agua del humedal permanece y en el verano se seca. Con este testimonio se acredita que la zona reclamada por la actora es parte de lo que poseyó desde hacía más de 15 años y se le entregó por quienes identifican como la Cooperativa. Así como que la actora vivía en el sitio con su familia, el uso e infraestructura introducida, la ubicación de la colindancia por el árbol de melina que refiere el testigo. Así como que el peón del demandado ha desplegado actos para perturbar la posesión y la intención de despojar la zona que ahora posee. Ello coincide con lo indicado por el testigo [Nombre6] declaró (expediente digital/documentos/fecha 09/11/2016 09:08:15 en minuto 00:50 de grabación) que ante la pregunta de si tenía interés en el proceso, explicó ser el hijo de [Nombre1], conocer a las partes, haber vivido en el lugar con su familia, construir el pozo, e identificar es el fundo de su progenitora.
Señaló, su madre llegó en el año 2001, vivió 10 años en el sitio e irse a San José a estudiar; hace diez años. Afirmó, el problema surge porque considera que el demandado quiere el "llano" (humedal) debido a la sequedad. Menciona, ellos siempre habían pasado por el lugar para llegar a la melina al otro lado del fundo, que era el punto de referencia de de la finca del demandado. Citó, en la finca vivían, tenían cerdos, caballos en el llano o suampo y ahora existe conflicto. Agregó, el accionado nuevamente volvió a sembrar en el terreno. Indicó, su madre compró la parcela cuando él era pequeño a una cooperativa. Describió, a ella se le mostró el inmueble que abarcaba desde el árbol de melina al otro lado del suampo. Eran dos manzanas. Sobre la demarcación recuerda haber caminado para ver lo vendido. La colindante en la parte de atrás se llama [Nombre4], al otro lado [Nombre14] y [Nombre7].
Al sur se colinda con [Nombre7] y la parte de frente de la finca de su madre [Nombre11] con calle. Explicó, vivieron ahí por más de diez años, pero debido a las difíciles condiciones dada la abundante lluvia y la necesidad de facilitar la asistencia a la escuela, no pudieron estar en el lugar como hasta ese momento. Pero sus hermanos mayores siempre estaban ahí. Mencionó, la casa era otra, situada más al norte. Como era de melina se cayó. Explicó, el pozo existente tiene más de once años y se hizo por encargo de su madre por [Nombre15], que vivía por el Caño de Lencho. Identificó el suampo como el área de conflicto, que mide de una manzana a manzana y media. Afirmó, cuando se va del sitio, observó al finado [Nombre12] poner la cerca, y luego al demandado plantando tubérculos. Manifiesta, la cerca divisoria entre [Nombre16] y [Nombre2], eran los árboles de melina, se seguía directo al otro lado del suampo.
Desde que él llegó, indica, esa cerca era el punto de referencia. Antes el y su hermano colocaron en la divisoria unos palos y para él es una división entre terrenos. Mencionó habían chiqueros y él los mantenía por vivir ahí. Estuvieron por 15 años y del pozo él jalaba agua. Describe, eran dos chiqueros donde se mantenían animales que usaban el suampo, se comercializaban o consumían. Indicó siempre han tenido vacas y antes caballos. Que pasaban en todo el terreno porque la cerca actual es nueva. Tal, la visualizó hace dos años. Declaró, [Nombre17] el finado, fue quien la hizo. Respecto a los frutales, detalló, están en la zona en litis y ellos los sembraron. Los trabajados que hizo su madre fue el chiquero, pozo y las vacas que se han mantenido en la zona de zuampo. Mismo que ha estado siempre igual. Depuso, a las cercas del fundo de su madre antes él daba el mantenimiento, pero se fueron por los motivos de facilidad de asistencia a la escuela.
Citó, todas las tardes después del colegio venía a ver los animales. Estima, la colindancia entre [Nombre2] y su madre es al sur, donde esta el árbol de melina al costado sur del llano. A las preguntas de la demandada responde sobre la Cooperativa, que era pequeño en ese tiempo. Contesta a la Procuradora, tener 24 años y haber llegado al lugar de unos 8 años entre el 2000 a 2001. Recuerda, caminaron para medir cuando le entregaron a su madre el fundo. Se marcó con una especie de estaca y su madre se paró en la esquina de la finca y se midió, tanto esa finca como la de [Nombre14] . Ello ocurre en el año 2004 o 2006. Indicó, estaba en primer grado o en la escuela, y era difícil pues si era en la tarde se debía dar la vuelta al formarse un charco profundo que impedía transitar. Luego, con el vecino [Nombre3] se hizo un puente con palos por donde se atravesaba, pero cuando lluvia, se lo llevaba "la llena" y por la otra parte era también riesgoso caminar.
Detalló, la llena llegaba hasta los árboles de Corozo. Indicó, saber cuál es el área de conflicto que él llama llano o suampo. Hay una parte que es una esquina que es más seca y en invierno se mantiene seca. Mencionó, en épocas de tormenta el nivel de agua se crecía; en un metro. En la zona en litis habían corozos, mangos, guayaba y algunos se mantienen. Conoce la cerca del [Dirección6] del suampo, donde hay un gran ceiba donde pasa la división y los melinas que no crecen por haber mucha agua. Aclaró, hace mucho observó a [Nombre2] plantando al otro lado del suampo. Explicó el testigo, el visita el fundo en días festivos, una vez cada tres meses dados sus estudios. Estima esta Cámara, aún y cuando el declarante es hijo de la actora, su declaración debe ser considerada al coincidir con lo depuesto por el testigo anterior sobre los actos posesorios desde el año 2000 o 2001 por la actora, respecto la presencia en la zona en litis, la construcción de pozos y chiqueros, cultivo de frutales; además de los actos de perturbación y despojo del actor.
Lo que debe ser complementado con lo aceptado en confesión del accionado sobre no haber sido él la persona que introdujo el pozo ni los frutales. Mismos que se observaron en el reconocimiento judicial y quedan aledaños a la zona de humedal, que indica la actora en la demanda es parte de su finca en posesión. Por parte de el accionado se recibió el testimonio de [Nombre7] (expediente/documentos/fecha 09/11/2016 09:07:41) mencionó conocer a ambas partes, vivir en Achiotal. Sabe, a [Nombre1] hizo una cerca pegada a un árbol de ceiba hace 5 años y ahí no le correspondía a ella. Afirma, por ello surgió el conflicto entre las partes e iniciaron procesos judiciales. Indicó, a [Nombre1] se le entregó un pedazo de tierra hace 16 años en la parte firme y no hasta "allá". Sin saber el motivo por el cual movió la cerca donde no le correspondía. Indica, la casa ubicada en la parte de [Nombre1] no está habitada.
Sobre el ganado de [Nombre1], conoce anda deambulando, tanto en la calle, en la finca de [Nombre2] o en la parcela de la testiga. A las preguntas de la parte actora indicó, no saber cuando mide el área de conflicto pues no es ingeniera y no sabe calcular; pero conoce la zona en litis. A [Nombre1] le dieron media manzana de terreno por quién identifica como los Directivos, pues fue a hablar diciendo vivía en Nicaragua y quería irse a habitar ahí. Declaró, la finca de [Nombre2] es más grande. Afirmó, hace muchos años [Nombre1] vivió en el terreno en otra casa, después quedó abandonado, la actual casa es nueva. La antigua casa no sabe en que condición estaba; pues la testigo no visita a nadie ni conocía la vivienda de [Nombre1]. Explicó, ella solo la veía desde lejos. Indicó, la actora habitó ahí por unos tres años y luego no vivió más. Casi nunca ha ingresado al fundo; salvo cuando atestiguó en el anterior proceso judicial.
Detalló, ella la veía porque su casa se ubica en una loma; pero no conoce el inmueble. Sobre la cerca en conflicto manifestó, si la conoce porque estaba en un árbol y no va en el sitio actual, donde esta hace unos tres años; antes no sabe. Citó, las vacas han estado desde unos cuatro años. Indica la testiga, ella tiene terrenos entregados por la Directiva de dos manzanas; pues era para sembrar. No a todos los vecinos se les entregó dos manzanas. A las preguntas de la representante del ente procurador respondió la declarante tener 16 años de habitar en Achiotal, y el 4 de junio del 2000 ya en la finca. Contesta, el suampo siempre ha estado en las mismas condiciones que se observan en la actualidad; no ha cambiado. No toda el área de conflicto es suampo, pero respecto a éste, doña [Nombre1] y [Nombre2] lo habían dividido y ponen la cerca. Sin saber que pasó luego y [Nombre1] la modificó. Iban a compartir la parte de suampo y después la cerca apareció en la ceiba y nace el problema legal entre las partes.
Mencionó, en el área no hay más árboles que dos árboles de corozo, porque en invierno se llena. Alrededor si hay árboles grandes. A las preguntas de la jueza contestó, veía a [Nombre1] en la zona hace como 11 años, y siempre la ve aclarando que no se fue, como lo había indicado antes. Explica, ella estuvo viviendo en la finca y luego se fue al centro de Achiotal, hace poco que ve esa casa recién construida. Sobre el acuerdo entre ellos, sobre la zona de suampo, fue hace como 9 años. Parece que a la cerca se le cayeron lo postes. Antes no había cerca y ese sector del terreno andaban las vacas de [Nombre1], pero como [Nombre2] siembra, acordaron levantar la cerca para evitar daños a los cultivos. Para esta Cámara, el hecho de que la testiga no conozca la finca de la actora e indique nunca la visitó, haber observado el fundo desde su casa que queda en una loma, es razón suficiente para no considerar su testimonio cuando afirma que el sector en litis le corresponde al demandado y no a la actora.
Además sobre ese acuerdo entre las partes en conflicto sobre repartir la zona inundada entre ambos, ni siquiera fue mencionado por el accionado en la contestación de la demanda o en escritos posteriores. Por lo que no se considera útil esa probanza a efectos de desacreditar los actos posesorios de la actora sobre la zona en litis y su permanencia mediante el uso de esa franja. En análisis a los presupuestos de la demanda publiciana, indica esta instancia que de estas declaraciones logra acreditarse la legitimación activa de la actora al demostrarse que inicia su posesión en el año 2000 y a partir de ese momento vivió en el sitio con su familia, se hizo un pozo artesanal, chiqueros, tuvo una casa todo en la zona firme y que en la parte inundada era utilizada por el ganado, aunado a que el límite de su inmueble dado en posesión es en referencia al árbol de melina descrito en el reconocimiento judicial al norte y referido por los testigos [Nombre6] y [Nombre5].
Indican esos declarantes, el lindero sur correcto y que le fue entregado en su momento por la denominada Cooperativa es con el demandado y corresponde al lugar donde se ubica el árbol de melina y en línea directa, abarcando la zona de lodo o humedal que quedo en posesión del demandado a raíz de la colocación de la cerca nueva. Misma que se coloca en virtud de lo ordenado en el voto 115-F-14 del proceso interdictal resuelto a favor de [Nombre2] y donde se discutió por haberse removido una cerca seis meses antes de la interposición de la demanda sumaria. Aclarando que tal versa sobre la posesión actual y momentánea acreditada en el momento de llevarse a cabo esa litis (artículo 457 del Código Procesal Civil aplicado supletoriamente). El objeto del presente asunto, versa sobre aspectos de posesión definitiva y permanente. Con la prueba aportada en el subjúdice, se logra concluir que efectivamente la actora poseía el fundo a partir del año 2001 en el que se asentó directamente al vivir con su núcleo familiar, hasta que debió ubicarse en Los Chiles centro, sin perder el uso del inmueble, pues mantenía su ganado y animales que asistían sus hijos.
Animales que tenían acceso a la zona de inundación para abastecerse de agua y deambular; tal y como lo declararon el testigo [Nombre6] y [Nombre5] . Esa posesión efectivamente fue interrumpida en virtud de lo resuelto en el proceso interdictal citado, y haberse ordenado la colocación de la cerca que impidió el uso de la zona en litis a la actora, por encontrar fundamento la tutela interdictal invocada por el aquí demandado en esa litis. No obstante, dentro del proceso ordinario en estudio es posible analizar y valorar aspectos más amplios y referidos a la posesión de antigua data que logra demostrar la accionante. Respecto a la legitimación pasiva, se logra acreditar al indicar los testigos [Nombre6] y [Nombre5] que el demandado colocó la nueva cerca e irrespetó el lindero que se le había entregado a la actora desde el año 2000. La actora llevando la carga probatoria (artículo 317 del Código Procesal Civil aplicado supletoriamente) logra demostrar con los testigos que aporta a este proceso, que su lindero discurre a partir del árbol de melina al norte con calle pública y por ello la zona de lo que denominan suampo es parte de su posesión.
Por su parte el demandado lo niega, pero no aporta más que la declaración de [Nombre7] cuyo contenido no se considera por las razones apuntadas supra. Debió haber desvirtuado el reconocimiento de ese lindero al sur del fundo de la actora que toma como punto de referencia el árbol de melina. Para esta instancia la actora ha poseído materialmente el fundo acreditándose la legitimación activa, pues demostró haber ejercido la posesión desde el año 2001 en los términos del artículo 277 del Código Civil y 297 inciso 2) sobre el plazo. Respecto a la legitimación pasiva, procede tenerla por demostrada en virtud de las conclusiones a que se arriba de las declaraciones testimoniales de [Nombre6] y [Nombre5] ya citadas. Con tales, se tiene por probado que el demandado despojó a la actora del área en litis con la colocación de la cerca, que conduce a privarle de la posesión de la zona donde se asienta el pozo artesanal y los frutales que aceptó no se realizaron por él, sino que ya estaban cuando llega a tomar posesión de esa parte de terreno; alegando fueron realizados por otros.
Sin embargo, la actora demostró que eran de suyas. Además de que aprovechaba lo que se identifica como el suampo y que corresponde a ecosistema de humedal, según se observó en el reconocimiento judicial y se hizo constar en el informe del SINAC (imagen 76 a 84 expediente modo pdf). Toma en consideración esta Sede lo indicado por el testigo [Nombre5] respecto a que el peón del actor identificado como [Nombre12], en dos ocasiones lo observó derribando la cerca de la actora y con ello su ganado se salía. Y de la manifestación expresa que el área en conflicto era poseída por la accionante desde el año 2001; lo que concuerda con lo dicho por el testigo [Nombre6].
VII- La pieza impugnada funda su denegatoria de demanda en la naturaleza jurídica del fundo en litis. En primer orden, la califica de demanial por ubicarse en la zona fronteriza norte y estar inmensa dentro del Refugio Nacional de Vida Silvestre Corredor Norte creado por decreto 22962 del 15 de febrero de 1994. Según oficio SINAC-ACAHN-OTAT-049-2015 del Sistema Nacional de Areas de Conservación -Area de Conservación Arenal Huetar Norte. (imagen 76 a 84 ya citada). Estudio de campo que concluyó que el predio se encuentra bañado por el humedal Río Frío-Marillal código CED6, que describe como flora asociada clavillo, dormilona grande, hierbas de estera lirio de agua, palma de corozo. Además, la existencia de terrenos inundados y superficies saturadas de agua. Cabe señalar, estos terrenos al estar sometidos al régimen de categoría de manejo de refugio de vida silvestre, esta administrado por el Ministerio de Ambiente y Energía.
Queda claro, que al estar además en zona fronteriza es un bien que no resulta susceptible de ser enajenado o ser reclamado de forma excluyente por particulares en cuando alguna pretensión real de propiedad o posesión contra el Estado; tal y como se afirma en la sentencia recurrida. Sin embargo, no puede perderse de vista en la resolución del conflicto planteado, que existe una población que desarrolla actos de cultivo y vivienda en esos fundos sometidos a estos regímenes especiales. Por ello, en virtud del ordinal 42 constitucional y 10 del Código Civil, en aras de dar solución a los problemas sociales que ahí existen en la realidad de esos pobladores, ser el conflicto entre particulares que reclaman una posesión material y sin perjuicio de los derechos del Estado, acorde con el artículo 286 Ibídem, estima este Tribunal es posible resolver la discordia presente en el subjúdice en cuanto determinar quién ha ejercido la posesión en la zona disputada.
Entendiéndose que la posesión a reconocer no es apta para usucapir, dada la naturaleza del fundo y sin que ello le reste competencias al Ministerio administrador de esa área silvestre protegida. Que está en la facultad de girar las ordenanzas que sean necesarias, a fin de preservar el ambiente y el ecosistema de humedal presente. Cabe citar, el humedal encontrado no ha sufrido daño, según lo manifestaron los testigos que declararon al respecto ante las preguntas de la Procuradora representante del Estado que se apersonó a la audiencia de juicio verbal. No se encontró afectación por la presencia de esas personas, las labores de mantener el poco ganado o bien construir chiqueros y cultivar frutales. Ha sido un uso agrícola de bajo impacto que no ha roto el equilibro ecosistémico del sitio, cumpliendo con uno de los objetivos del desarrollo sostenible que guía el bloque normativa ambiental nacional e internacional.
Por tal razón, es que no se estima lleva razón el ente procurador cuando alegó mediante memorial (imagen 69 a 75 de expediente modo pdf) que esa zona al humedal es parte del Patrimonio Natural del Estado, no es posible utilizarlo o alegar derecho alguno. Resulta cierto que ese terreno es una zona que integra ese patrimonio, pero con lo que aquí se resuelve no resulta afectado, pues lo que se reconoce es un mejor derecho de posesión entre dos particulares, que nunca podrán acceder a ostentar derecho de propiedad alguno, y cuando mucho, algún tipo de permiso y autorización si el Ministerio que administra ese refugio lo concediera, acorde con la ley y el plan de manejo que debe existir para regular los usos y destinos de esas áreas (artículos 16, 17, 18, 25, 51 de la Ley de Conservación de Vida Silvestre N. 7317). Se denota, el área silvestre protegida que afecta el predio en discusión, es de la categoría de manejo de Refugio Nacional de Vida Silvestre.
Su regulación se encuentra en los artículos 82, 83, 84 y 87 de la ley citada supra. Les otorga el fin de protección e investigación de la flora y fauna silvestres. Se clasifican en tres tipos: refugios de propiedad estatal, mixta y privada. Los recursos que contiene quedan bajo la competencia y manejo de la Dirección General de Vida Silvestre del Ministerio de Recursos Naturales y Energía; según el texto de la norma. De igual forma, se señala que las personas que pretendan desarrollar actividades y proyectos de desarrollo y explotación de los recursos naturales, requieren de la autorización de ese ministerio. Importante resaltar, acorde con los ordinales citados, los usos de estas áreas silvestres protegidas son diversos a los que se asignan a las categorías de Parque Nacional o Reserva Biológica, que tienen fines más restrictivos con su uso que resultan incompatibles con cualquier actividad comercial o agrícola.
Cabe citar, es una realidad social que en la zona donde se sitúa la finca en litis, se mantiene la presencia de pobladores que se asientan en tales y aprovechan la tierra mediante actos agrarios de baja escala. En este caso, se ha planteado un conflicto entre particulares en una finca con humedal ubicado dentro del refugio referido, al cual no se ha determinado se hubiere provocado un daño al ambiente por las personas agricultoras que lo utilizan y que carecen ambas de permiso o autorización alguna, pero que han estado presentes a lo largo de muchos años a vista y paciencia de las autoridades ambientales competentes. Ello no resta competencia alguna a las entidades y ministerios sobre la función fiscalizadora ambiental. Lo cierto es que los conflictos están presentes por el uso de los terrenos y debe procederse a emitir la solución por parte de la Administración de Justicia, en aras de la paz social de los pobladores de esas zonas.
Por lo que no se estima que con lo aquí resuelto se afecte el dominio público o el Patrimonio Natural del Estado, al regir el artículo 286 del Código Civil que indica: " El modo de usar y aprovecharse de las cosas públicas se rige por los respectivos reglamentos administrativos, pero las cuestiones que surjan entre particulares, sobre mejor derecho o preferencia al uso y aprovehcamiento de las cosas públicas, serán resueltas por los Tribunales." De tal modo que lo que aquí se resuelve se hace sin perjuicio de los intereses y derechos del Estado y tiene como fin dar solución a un conflicto particular. Lo que conlleva a esta instancia a revocar la sentencia venida en alzada, que declaró sin lugar la demanda por estimar que a pesar de acreditarse la posesión sobre el fundo, al ser de naturaleza pública por contener humedal y formar parte del Refugio referido, no es posible reconocer derecho de posesión alguno.
VIII- Por ello, en virtud de lo razonado y respecto de la excepción de falta de derecho y genérica de sine actione agit interpuestas por el demandado, cabe rechazarlas por tener derecho la actora de interponer esta acción de mejor derecho de posesión al demostrar sus presupuestos, según lo ya razonado supra respecto a la legitimación activa, pasiva e identidad del bien. Pues acreditó ser la la poseedora desde el año 2001 del área en litis, al haber desplegado actos de dominio posesorio agrícola y acreditar que el lindero sur de su finca corre desde el árbol de melina al que hicieron referencia los testigos, haber introducido el pozo, chiquero y frutales y ejercer uso sobre el humedal existente. La defensa de cosa juzgada fue denegada de forma interlocutoria.
IX- En virtud de lo anterior, con fundamento en lo expuesto y los artículos 1, 2, 54, 55 y 56 de la Ley de Jurisdicción Agraria, 263, 277, 279 del Código Civil, se revoca parcialmente la sentencia en cuanto denegó la demanda de [Nombre1] contra [Nombre18] . En su lugar, se deniegan las defensas de falta de derecho y sine actione agit y se acoge la demanda en cuanto se decreta que [Nombre1] tiene mejor derecho de posesión que [Nombre2] sobre finca sin inscribir ubicada en la localidad de Tablillas de Los Chiles, [Dirección7] de la provincia de Alajuela que es parte del Refugio Nacional de Vida Silvestre Corredor Frontera Norte. Area de aproximadamente manzana y media y que contiene en parte área de humedal. Finca conocida como el Achiotal. [Nombre11] al norte con [Nombre1] , al sur con [Nombre2] , al este con [Nombre4] y al oeste con calle. Se ordena a [Nombre18] elimine en el plazo de quince días naturales firme esta sentencia y a su costa, la cerca colocada de lado a lado en el fundo en posesión de [Nombre1] aledaña a la casa de habitación existente y desaloje el área de humedal y la zona firme donde se ubica el pozo artesanal, los árboles frutales y vestigios de chiqueros que ocupa y se deje en posesión de [Nombre1] .
Apercibido [Nombre18] que en caso de desobediencia a la autoridad podrán ser testimoniadas piezas a fin de procesarse por el delito desobediencia a la autoridad. Se ordena a [Nombre18] abstenerse de introducir ganado al fundo que se reconoce el mejor derecho de posesión de la actora y se respete la colindancia que existió entre ambos fundos que se eliminó, que parte del árbol de melina al sur del fundo de [Nombre1] en línea recta al árpbol de ceiba y hasta [Dirección8] . Se resuelve sin perjuicio de los intereses y derechos del Estado, al no reconocerse con lo que se falla derecho de posesión ad usucapionem a favor de la actora, ni que se sustituya el reconocimiento de mejor derecho de posesión que aquí se decreta, de los respectivos los permisos y autorizaciones que deban obtenerse para el ejercicio de cualquier actividad por parte del Ministerio de Ambiente y Energía. Así como la obligación de la poseedora de respetar las normas legales y ordenanzas que regulan la protección de los humedales como ecosistemas que brindan un servicio ambiental de alta importancia al ambiente, y las regulaciones propias del Refugio Nacional de Vida Silvestre Corredor Frontera Norte. En lo demás respecto a costas, no se emite pronunciamiento por no ser tema vinculado al recurso de apelación.
POR TANTO
Se revoca parcialmente la sentencia en cuanto denegó la demanda de [Nombre1] contra [Nombre18] . En su lugar, se deniegan las defensas de falta de derecho y sine actione agit. Se acoge la demanda y se declara: [Nombre1] tiene mejor derecho de posesión que [Nombre2] sobre finca sin inscribir ubicada en la localidad de Tablillas de Los Chiles, [Dirección7] de la provincia de Alajuela que es parte del Refugio Nacional de Vida Silvestre Corredor Frontera Norte. Area de aproximadamente manzana y media y que contiene en parte área de humedal. Finca conocida como el Achiotal. [Nombre11] al norte con [Nombre1] , al sur con [Nombre2] , al este con [Nombre4] y al oeste con calle. Se ordena a [Nombre18] elimine en el plazo de quince días naturales firme esta sentencia y a su costa, la cerca colocada de lado a lado en el fundo en posesión de [Nombre1] aledaña a la casa de habitación existente y desaloje el área de humedal y la zona firme donde se ubica el pozo artesanal, los árboles frutales y vestigios de chiqueros que ocupa y se deje en posesión de [Nombre1] .
Apercibido [Nombre18] que en caso de desobediencia a la autoridad podrán ser testimoniadas piezas a fin de procesarse por el delito desobediencia a la autoridad. Se ordena a [Nombre18] abstenerse de introducir ganado al fundo que se reconoce el mejor derecho de posesión de la actora y se respete la colindancia que existió entre ambos fundos que se eliminó, que parte del árbol de melina al sur del fundo de [Nombre1] en línea recta al árbol de ceiba y hasta [Dirección8] . Se resuelve sin perjuicio de los intereses y derechos del Estado, al no reconocerse con lo que se falla derecho de propiedad ni posesión ad usucapionem a favor de la actora, ni que se sustituya el reconocimiento de mejor derecho de posesión que aquí se decreta, de los respectivos los permisos y autorizaciones que deban obtenerse para el ejercicio de cualquier actividad por parte del Ministerio de Ambiente y Energía. Así como la obligación de la poseedora de respetar las normas legales y ordenanzas que regulan la protección de los humedales como ecosistemas que brindan un servicio ambiental de alta importancia al ambiente, y las regulaciones propias del Refugio Nacional de Vida Silvestre Corredor Frontera Norte. En lo demás respecto a costas, se confirma.
