SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At nine forty-one a.m. on doce de marzo de dos mil dieciocho.- PRELIMINARY INJUNCTION (MEDIDA CAUTELAR) within the POSSESSORY INJUNCTION PROCEEDING (PROCESO INTERDICTAL) brought by [Nombre1], of legal age, married, farmer, resident of San José, identification card CED1 - - ; against FRIENDS OF THE OSA, corporate identification number CED2 - - , represented by its general attorney-in-fact without limitation as to amount (apoderado generalísimo sin límite de suma), Max Villalobos Vargas, of legal age, married, administrator, resident of Puntarenas, identification card CED3 - - , and against him personally. Judge RUIZ RAMÍREZ writing for the Court; and,

WHEREAS

I.In its ruling of diez de enero del dos mil dieciocho, the Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur ordered: “In accordance with the foregoing, the preliminary injunctions requested by the plaintiff are denied, but the following are ordered sua sponte (de oficio): a) Both parties are directed to refrain from carrying out any type of activity in the restricted maritime-terrestrial zone (zona restringida marítima terrestre), as well as from altering, modifying, or adding improvements or structures to those already existing, with the warning that, should they fail to comply, proceedings for the offense of disobedience of authority may be brought against Mr. [Nombre2], as representative of the defendant company FRIENDS OF THE OSA, and against the plaintiff, Ms. [Nombre1]. This ruling shall be served on the representative of the defendant company, [Nombre2], SOLELY BY PERSONAL SERVICE through the Oficina Centralizada de Notificaciones de Golfito, in Puerto Jiménez, 75 meters south of Soda y Heladería Candy, across from the Supermercado.

The parties are advised that this judgment may be appealed before the Tribunal Agrario del II Circuito Judicial de San José. Should either party file an appeal, in addition to the written copy, please submit the appeal electronically. In view of the introduction of oral proceedings in agrarian matters, if a party wishes the appellate court to grant an oral hearing, that party must so indicate in the appeal itself or, alternatively, provide an email address at which notice may be served (Doc. Asociados 11/01/2018 Autosencia).

II.The plaintiff files an appeal against the ruling of diez de enero del dos mil dieciocho and states the following grounds of error:

  • 1)The entire property lies outside the maritime-terrestrial zone, with the following boundaries: North: [Dirección1] and [Nombre3] , South: Zona marítima terrestre, East: [Nombre4] and [Nombre5] , West: [Nombre3] , and [Nombre6] , as recorded in the private deed of treinta y uno de agosto del dos mil, which was given a legally certified date (fecha cierta) before notary Guillermo Valverde Smith. That is, because the property borders the restricted maritime-terrestrial zone and there are no fences, human error may have resulted in her corn crop being located within that restricted zone; if so, however, she would be willing to plant future crops within the area that does belong to her. She does not seek to claim possessory rights (derechos de posesión) or preliminary injunctions over the restricted maritime-terrestrial zone.
  • 2)She understands that preliminary injunctions are provisional and may be modified; what she seeks is the issuance, while the proceeding is pending, of preliminary injunctions against “Friends of the Osa” requiring it to cease harassing her and to allow her to continue cultivating her crops.
  • 3)She states that employees of “Friends of the Osa” previously destroyed other crops she had planted for personal consumption and that it has been difficult to plant other crops because the defendant’s employees have prevented her from doing so; consequently, the corn crop is now the only one she has left. As to the judge’s statement that he did not see the cabins the defendant had been constructing, this is because the defendant brought in materials and began building cabins, but construction was subsequently halted, as stated in allegation four of the complaint. However, on 18 de enero del 2018, the defendant company resumed construction work in the area.
  • 4)She considers the requested preliminary injunctions necessary for the following reasons: a) to prevent the continuity of her crops from being jeopardized; b) to prevent serious and irreparable harm, such as a potential forcible eviction (desahucio) by “Friends of the Osa,” which would endanger her possession.

III.In agrarian matters, the scope of atypical preliminary injunctions (medidas cautelares atípicas) has been expanded through a comprehensive analysis of agrarian and agro-environmental legislation; accordingly, reference is made to preliminary injunctions intended to protect agricultural production, those protecting the rights of rural producers, and those defending the environment and natural resources. There is an evident public interest in protecting agriculture as an essential activity, as well as constitutional obligations arising from environmental protection. To prevent their adoption from becoming an arbitrary act by the adjudicating judge, a series of prerequisites (presupuestos) has been established. They are: likelihood of success on the merits (apariencia del buen derecho, fumus bonis iuris), risk arising from delay (peligro de demora, periculum in mora), and the instrumentality and correlation of the preliminary injunction with the outcome of the proceeding.

Likelihood of success on the merits entails an assessment of the plausibility of the complaint’s substance, such that the matter is not legally untenable because it is unlawful or unreasonable. Risk arising from delay refers to the urgency with which the injunction must be issued to prevent harm to the party and to the general interest; finally, correlation and instrumentality of the injunction with the outcome of the proceeding means that the relief requested must serve as an instrument to guarantee the results of the proceeding. Substantive claims (pretensiones de fondo) may not be sought as a preliminary injunction because granting them would entail enforcing the judgment in advance without prior due process. IV.In this case, the plaintiff requests the following preliminary injunction: “... we request an on-site judicial inspection (inspección ocular in situ) and, once the facts have been verified, that preliminary injunctions be entered against the company ‘Friends Of The Osa’ and Mr. [Nombre7] , so that we may continue cultivating our crops without losing them, as specified by the applicable law, insofar as it is the judge’s duty to verify compliance with the three fundamental prerequisites for granting any type of preliminary injunction in relation to the outcome of the proceeding. Furthermore, that the defendants be ordered to refrain from continuing to disturb my possession in any manner whatsoever...” ( Carpeta Escritos 06/12/2017 Demanda inicial imagen 6)..- Given this request, it was necessary to conduct a judicial inspection (reconocimiento judicial), which took place on 10 de enero del 2018 ( acta de reconocimiento judicial incorporada el 11/01/2018 Carpeta Doc.

At the time of the judicial inspection, the only thing observed was a small area planted with corn, located within the Zona Marítimo Terrestre, which is State-owned, and no other type of crop was observed on the land at issue (terreno en litis) ( acta de reconocimiento judicial incorporada el 11/01/2018 Carpeta Doc. Asociados).- In accordance with the foregoing, the risk arising from delay prerequisite cannot be deemed established. Moreover, comparing the relief requested as a preliminary injunction with the relief sought in this proceeding, which expressly states: “...c) That I be permitted to continue cultivating the land for my family’s and my own subsistence. d) That the defendants cease disturbing me...( Carpeta Escritos 06/12/2017 Demanda inicial imagen 5) .” The relief sought through the preliminary injunction is virtually the same as that requested when the merits are decided by judgment, which would entail enforcement of a ruling in advance without judgment having been entered; the prerequisite of instrumentality and correlation of the preliminary injunction with the outcome of the proceeding is therefore also lacking.

In accordance with the foregoing, it is not appropriate to reverse the ruling that denied the preliminary injunction on the terms requested. Moreover, the arguments presented in the appeal are rejected because, at this stage of the proceeding, the appellant has been unable to refute that the corn crop is located within the Zona Marítimo Terrestre and has likewise failed to demonstrate that employees of “Friends of the Osa” destroyed other crops on the land at issue.”

V- Accordingly, because the prerequisites of risk arising from delay, instrumentality, and correlation were not established, the appealed ruling is affirmed.

THEREFORE

VOTO N° 194-F-18 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las nueve horas y cuarenta y uno minutos del doce de marzo de dos mil dieciocho.- MEDIDA CAUTELAR dentro del PROCESO INTERDICTAL establecido por [Nombre1] mayor, casada, agricultora, vecina de San José, cédula CED1 - - ; contra de FRIENDS OF THE OSA, cédula jurídica CED2 - - , representada por apoderado generalísimo sin limite de suma Max Villalobos Vargas, mayor, casado, administrador, vecino de Puntarenas, cédula CED3 - - , y en su condición personal. Actúa como abogado director de la parte actora, el licenciado Alejandro Chaverri Fernández, colegiado doce mil novecientos noventa y tres. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores.

Redacta la jueza RUIZ RAMÍREZ; y,

CONSIDERANDO

I.El Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur en resolución del diez de enero del dos mil dieciocho dispuso: " De conformidad con lo expuesto, se deniegan las medidas cautelares solicitadas por la parte actora pero de oficio se ordenan las siguientes así: a) Se le previene a ambas partes se abstengan de llevar a cabo cualquier tipo de actividad en la zona restringida marítima terrestre así como de alterar, modificar o de introducir mejoras o construcciones a las ya existentes bajo apercibimientos de que en caso de omisión, se podrá seguir en contra del señor [Nombre2] como representante de la sociedad demandada FRIENDS OF THE OSA y de la señora actora [Nombre1] causa por el delito de desobediencia a la autoridad. Notifíquese la presente resolución al representante de la empresa demandada [Nombre2] ÚNICAMENTE EN FORMA PERSONAL por medio de la Oficina Centralizada de Notificaciones de Golfito en Puerto Jiménez de Soda y Heladería Candy 75 sur frente al Supermercado.

Se hace saber a las partes que esta sentencia tiene recurso de apelación ante el Tribunal Agrario del II Circuito Judicial de San José. En caso de presentar recurso de apelación cualquiera de las partes, favor remitir además de la parte escrita, el recurso de apelación por formato electrónico. Por motivo de la inserción de la oralidad en materia agraria, si es el deseo de la parte que el Tribunal de alzada les confiera una audiencia oral, lo hagan saber en el mismo escrito de apelación, o en su defecto señalar un correo electrónico en donde se les pueda notificar (Doc. Asociados 11/01/2018 Autosencia).

II.La parte actora interpone recurso de apelación en contra de la resolución del diez de enero del dos mil dieciocho, y expone como agravios:

  • 1)La finca en su totalidad está fuera de la zona marítima terrestre, con los colindantes Norte: [Dirección1] y [Nombre3] , al Sur: Zona marítima terrestre, al Este: [Nombre4] y [Nombre5] , al Oeste: [Nombre3] , y [Nombre6] , tal y como aparece en la escritura privada del treinta y uno de agosto del dos mil, a la cual se le dio fecha cierta ante el notario Guillermo Valverde Smith. Es decir, que como la propiedad limita con la zona restringida marítimo-terrestre y debido a que no hay cercas, entonces puede ser que por un error humano, el cultivo de maíz que tiene está dentro de esa zona restringida, pero si es así, ella estaría dispuesta a sembrar futuros cultivos dentro de la zona que sí le corresponde. Dado que no pretende pedir derechos de posesión o medidas cautelares sobre la zona restringida marítimo-terrestre.
  • 2)Entiende, que las medidas cautelares son provisionales y que pueden variar, lo que pretende es que durante el transcurso del proceso, se emitan medidas cautelares contra " Friends of the Osa" , para que dejen de hostigarle y le permitan continuar con sus cultivos.
  • 3)Expone, anteriormente los empleados de " Friends of the Osa " han destruido otros sembradíos que tenía para consumo personal, y ha sido difícil sembrar otros cultivos, porque los empleados de la parte demandada no lo han permitido y por eso actualmente solo le queda el de maíz. Acerca de lo que menciona el juez de no haber visto las cabañas que estaba construyendo la parte demandada, esto es porque llevó materiales y empezó a construir cabañas, pero después la construcción fue detenida, tal y como fue indicado en el hecho cuarto de la demanda. Pero el día 18 de enero del 2018, la sociedad demandada inició de nuevo labores de construcción en la zona.
  • 4)Considera, las medidas cautelares que solicita si son necesarias por los siguientes motivos: a) evitar que se ponga en peligro la continuidad de sus cultivos. b) evitar una lesión grave y de difícil reparación como sería un eventual desahucio efectuado a la fuerza por "Friends of the Osa", con lo cual se vería en peligro su posesión.

III.En materia agraria el contenido de las medidas cautelares atípicas se ha ampliado, en un análisis comprensivo de la legislación agraria y agro ambiental, por ello se habla de las medidas cautelares que tienden a la tutela de la producción agraria, las que protegen los derechos de los productores rurales y en defensa del ambiente y los recursos naturales. Hay un interés público evidente en la tutela de la agricultura como actividad esencial, lo mismo que las obligaciones constitucionales derivadas de la protección del ambiente. A fin de que no se constituya en una actividad arbitraria de la persona juzgadora, se han definido una serie de presupuestos para la adopción de las mismas. Ellas son: la apariencia del buen derecho (fumus bonis iuris), el peligro de demora ( periculum in mora) y instrumentalidad y correlatividad de la medida cautelar con el resultado del proceso. En lo que respecta a la apariencia de buen derecho se trata de un juicio de verosimilitud sobre el contenido de la demanda, de manera que no se trate de una cuestión improponible, por ilegal o irrazonable.

El peligro de demora hace referencia a la urgencia con que debe ser dictada a fin de prevenir daños a la parte y al interés general; y finalmente el de correlatividad e instrumentalidad de la medida con el resultado del proceso; según el cual lo solicitado debe ser instrumento para garantizar los resultados del proceso, no pudiendo solicitarse como medida cautelar parte de las pretensiones de fondo, pues concederlas implicaría ejecutar anticipadamente la sentencia sin un debido proceso previo. IV.En este caso, la parte actora solicita como medida cautelar: "... solicitamos una inspección ocular in situ, y una vez comprobados los hechos, se tomen medidas cautelares contra la sociedad "Friends Of The Osa" y el señor [Nombre7] , para poder continuar con nuestros sembradíos y no perderlos, tal y como lo especifica la ley requerida en cuanto que es deber del juez verificar que se cumplan con los tres presupuestos fundamentales de aplicación de cualquier tipo de medida cautelar, con el resultado del proceso. Por otro lado que se ordene a los demandados abstenerse de seguir perturbando mi posesión de cualquier manera.. " ( Carpeta Escritos 06/12/2017 Demanda inicial imagen 6)..- Dada dicha solicitud, fue necesario realizar un reconocimiento judicial el cual fue llevado a cabo el 10 de enero del 2018 ( acta de reconocimiento judicial incorporada el 11/01/2018 Carpeta Doc. Asociados). Al momento de realizar el reconocimiento judicial, lo único que se pudo observar fue una pequeña área sembrada de maíz, la cual está dentro de la Zona Marítimo Terrestre, propiedad del Estado, sin que se apreciara la existencia de otro tipo de cultivos dentro del terreno en litis ( acta de reconocimiento judicial incorporada el 11/01/2018 Carpeta Doc.

Asociados).- Conforme a lo expuesto, no se podría tener por acreditado el presupuesto de peligro de mora. Aunado a lo anterior, confrontado lo solicitado como medida cautelar y la pretensión de este proceso en el que expresamente se indica: " ...c) Que se me permita seguir cultivando la tierra, por la subsistencia de mi familia y mía. d) Que los demandados dejen de perturbarme..( Carpeta Escritos 06/12/2017 Demanda inicial imagen 5) . Lo solicitado con la cautelar es prácticamente lo mismo requerido cuando se resuelva por el fondo en sentencia, lo cual implicaría una ejecución anticipada de un fallo sin dictar sentencia, por lo que se hecha también de menos el presupuesto de la instrumentalidad y correlatividad de la medida cautelar con el resultado del proceso. De conformidad con lo expuesto, no es procedente revocar la resolución que denegó la medida cautelar en los términos que fue solicitada.

Aunado a lo anterior, se rechazan los argumentos esbozados en el recurso de apelación, por cuanto hasta este momento procesal la parte recurrente no ha podido desvirtuar que el cultivo de maíz no se encuentra dentro de la Zona Marítimo Terrestre y tampoco demostró que los empleados de " Friends of the Osa" hayan destruido otros sembradíos dentro del terreno en litis".

V- De ese modo, al no haber acreditado los presupuestos de peligro de mora, de instrumentalidad y correlatividad, se confirma la resolución recurrida.

POR TANTO
