Res: 2018-101 Tribunal de Apelación de Sentencia Penal de Cartago. At ten forty-seven on veintiocho de febrero de dos mil dieciocho.
Appeal filed in the present proceedings against [Nombre [Nombre1]], [...], for the offenses of encroachment upon the protection area of a spring (invasión del área de aprovechamiento de una naciente), illegal logging and unlawful harvesting of timber (tala ilegal y aprovechamiento ilegal de madera), land-use change (cambio de uso de suelo), and tree girdling (anillado de árboles), to the detriment of Natural Resources. Judges Giovanni Mena Artavia, Ivette Carranza Cambronero, and [Nombre2] participated in deciding the appeal. Attorney [Nombre3] appeared in the appeal in her capacity as State Attorney.
Findings:
1. By judgment 21-2017, issued at sixteen thirty-five on quince de febrero de dos mil diecisiete, the Tribunal Penal de Cartago, Sede Turrialba, ruled: "POR TANTO: In accordance with the reasoning set forth above and Articles 39 and 41 of the Constitución Política; 11 of the Declaración Universal de Derechos Humanos; 8, subsection two, of the Convención Americana sobre Derechos Humanos; 1, 30, and 31 of the Código Penal; and 1, 9, 45, 47, 140, 141 through 145, 182, 184, 265 through 269, 360, 361, and 363 through 366 of the Código Procesal Penal, and applying the universal principle of in dubio pro reo, [Nombre [Nombre1]] and [Nombre [Nombre4]] are ACQUITTED of all punishment and liability for one offense of ENCROACHMENT UPON THE PROTECTION AREA OF A SPRING, one offense of ILLEGAL LOGGING AND UNLAWFUL HARVESTING OF TIMBER, one offense of LAND-USE CHANGE, and one offense of TREE GIRDLING, to the detriment of NATURAL RESOURCES, as charged by the Ministerio Público and the Private Prosecutor.
The civil action for damages (Acción Civil Resarcitoria) brought by LA PROCURADURÍA GENERAL DE LA REPÚBLICA EN REPRESENTACIÓN DEL ESTADO against [Nombre [Nombre1]] and [[Nombre5]] is declared withdrawn. The request to restore matters to their prior state is denied. Any precautionary measure (medida cautelar) imposed upon the defendants as a result of these proceedings is hereby lifted. No special award of costs is made. The costs of the proceedings shall be borne by the State." 2. Attorney [Nombre3] filed an appeal against the foregoing ruling.
3. Following the corresponding deliberation in accordance with Article 466 of the Código Procesal Penal, as amended by Ley 8837, published on nueve de diciembre de dos mil once (Creation of the Appeal Against Judgment), the Court considered the issues raised in the appeal.
4. The relevant legal requirements were observed throughout the proceedings.
CONSIDERING:
I.Attorney [Nombre3], acting in her capacity as counsel for the Office of the Attorney General of the Republic (Procuraduría General de la República), appeals judgment 21-2017 of the Cartago Criminal Court, Turrialba Seat, issued at dieciséis horas treinta y cinco minutos del quince de febrero del dos mil diecisiete (although she cites it incorrectly, it is understood that this is the judgment to which she refers). In her sole ground for appeal (motivo de impugnación), she alleges that the judgment lacks adequate reasoning, in violation of Article 142 of the Code of Criminal Procedure (Código Procesal Penal). She states that, in her closing arguments, she requested restoration to the prior condition (restitución de las cosas al estado anterior), allowing the site to regenerate without human intervention. In its judgment, the court below (a quo) denied her request because the defendants could not be held responsible for committing any act detrimental to natural resources; consequently, they also could not be held liable under the civil claim for damages (acción civil resarcitoria), and it was therefore inappropriate to require them to restore matters to their prior condition.
The appellant maintains that the defendants’ responsibility for the offenses of logging and unlawful exploitation of forest resources, and land-use change (cambio de uso del suelo) in a forest area, was indeed proven, since these acts were observed by [Nombre6]. Nevertheless, the accused acted under an unavoidable indirect mistake of law (error de prohibición indirecto invencible), which made it inappropriate to seek either a criminal or civil judgment against them. In any event, once the commission of the unlawful act and the environmental damage had been proven, restoration to the prior condition was requested. Violations affecting forest resources were detected at the site of the events, in contravention of Ley Forestal, specifically Articles 58(a) and 61(a), (b), and (c). The harm to the environment was determined through an appraisal of environmental damage (avalúo del daño ambiental).
The events were corroborated by the testimony of [Nombre7] and [Nombre8], officials of SINAC and MINAE, and by official communications OT-546 del siete de setiembre del dos mil diez and OT-562-2010 del ocho de setiembre del dos mil diez. It was also determined that the site was a forest area containing bodies of water. It was established that the property belongs to the Asociación de Desarrollo Indígena Cabécar and had been allocated to [Nombre9]. This was corroborated by the testimony of [Nombre10]. Nevertheless, the Office of the Attorney General’s request was denied without justification. She therefore asks that the appeal be granted, that the ruling be reversed as to the challenged issue, and that the matter be remanded or, alternatively, that restoration to the prior condition be ordered by directing the accused not to engage in any activity that would impede regeneration of the affected area.
The ground must be denied: As is clear from the analytical reasoning of the judgment, defendants [[Nombre11]] and [[Nombre5]] were acquitted on the basis of reasonable doubt concerning their participation in the charged events (judgment, folios 439 to 441). The position of the Procuraduría General de la República—that they had acted under an indirect mistake of law—was not accepted by the a quo, which stated in this regard: “In her closing arguments, the representative of the private prosecution (querella) considered that the events alleged in her complaint against [[Nombre11]] and [[Nombre5]] had been proven in the present case, but that there was an unavoidable indirect mistake of law because the defendants caused the alleged damage to natural resources under the unavoidable mistaken belief that they had permission from the Asociación de Desarrollo Indígena Cabecar to do so. The Court respects the Attorney’s argument but finds that, before the existence of a mistake of law could be analyzed, it would first be necessary for the defendants’ participation in the alleged events to have been proven and, once that had occurred, to determine that the conduct satisfied the stages of statutory definition of the offense (tipicidad) and unlawfulness (antijuridicidad), as well as even the first subelement of culpability, namely capacity for culpability (capacidad de culpabilidad).
Only in that event would an analysis of awareness of unlawfulness (conocimiento de antijuridicidad) be applicable, at which point it would be appropriate to examine the complainant’s position. Nevertheless, in this adjudicator’s view, applying that issue to the specific case would be pointless because, according to the considerations set forth supra by the Court, it has not even been proven that the accused committed any act detrimental to natural resources” (judgment, folio 141, front and reverse). Thus, if the appellant sought to establish the need to order restoration on the basis of the existence of the criminal act, she should have challenged the trial court’s conclusion that the accused had not participated in it. For that purpose, it was insufficient merely to offer an alternative interpretation of the evidence, as the appellant does; rather, she was required to identify the errors committed by the court when analyzing that evidence.
An appeal is, ultimately, a challenge to defects in the judgment. In any event, although it is questionable whether civil restitution (restitución civil) was appropriate under the terms established by Article 103(1) of the Criminal Code and Articles 122 and 123 of the “Rules on civil liability currently in force” (Reglas vigentes de responsabilidad civil) of the 1941 Criminal Code—since the claimed liability concerns environmental damage caused on a property and not an item that can be returned to the injured party—the fact remains that civil obligations cannot properly be imposed upon defendants when an acquittal has been entered and the basis for that acquittal is not being challenged. The preceding statements warrant a more detailed explanation, which follows. First, restitution is understood as: “1. Crim. A means of satisfying civil liability arising from a criminal offense that consists of returning the same property to its lawful possessor or owner” (Real Academia Española (2017).
Diccionario Panhispánico del Español Jurídico. Volumen II. Madrid: Santillana Educación S.L., p. 1831). It is therefore quite strained to apply that concept to a field such as environmental law, in which there is no property to be returned to a possessor or owner. Rather, modern States, including Costa Rica, have recognized the need to protect forest resources and establish preventive protection (tutela cautelar) for them, for which legal mechanisms exist to secure the protection of those resources. Where the right to a healthy environment has been impaired, measures intended to reverse the resulting environmental damage may be imposed. Article 123 of the “Reglas vigentes sobre responsabilidad civil” in Title IV of Book I of the 1941 Criminal Code provides: “The convicted person shall return to the injured party the item that was the subject of the criminal act, together with compensation for all deterioration or impairment; if unable to do so, the convicted person shall be required to pay its value according to an expert appraisal as of the date of the offense.
If such an appraisal cannot be conducted because the item has been destroyed or has disappeared, the judges shall determine its value on the basis of the information in the proceedings. Restitution shall be ordered even when the item is in the possession of a third party, without prejudice to the rights granted to that party by civil law” (emphasis added). The provision under discussion is extremely complex because it refers to a series of concepts requiring analysis, such as what is meant by “the item that was the subject of the criminal act,” when an item is deemed to be “in the possession of a third party” and when it is not, and its concluding proviso that the rights granted to the third party by civil law are preserved. Regarding what may be understood by “the item that was the subject of the criminal act,” there is a clear imprecision arising from the conflation of two entirely distinct legal concepts.
An “item” (cosa) is one thing, understood as: “5. f. Law. A tangible object, as distinguished from rights created over it and personal obligations” (Real Academia Española, 2017), whereas the “subject of the criminal act,” or material object of the offense (objeto material del delito), is identified as the right infringed by the criminal conduct (Bolaños, [Nombre12]. In view of this conceptual imprecision, it may be maintained that the legislative wording was intended to refer to the restitution of property harmed in result-based offenses (delitos de resultado), because: “In result-based offenses, the result consists primarily in the injury to a particular object. This object is called the object of the action and must not be confused with the object of protection, or legally protected interest (bien jurídico), which may also be intangible in nature.
All offenses entail a material injury (to the legally protected interest); only a certain number of them require a material injury (to the object of the action).” ([Nombre13], [Nombre14]. (1996). Manual de Derecho Penal. Santa Fe, Bogotá: Temis, p. 85). In such result-based offenses, restitution of the item is appropriate whenever possible; if the perpetrator of the offense is unable to make restitution, Article 123 of the 1941 Criminal Code provides that payment of its value is appropriate. The provision also states that restitution is appropriate even when the item “is in the possession of a third party,” which requires analyzing what that wording may be understood to mean. Article 277 of the Civil Code provides: “The right of possession consists of a person’s authority to hold, under that person’s power and control, the item that is the subject of the right” (emphasis added). Accordingly, when Article 123 of the 1941 Criminal Code states that restitution must be ordered even when the item is in the possession of a third party, that circumstance expressly refers to situations in which the item is possessed by a third party, who may seek to enforce their rights before the courts in order to obtain the “return or restoration of an item or property improperly held by another person” (Real Academia Española (2017).

In the present matter, the accused were alleged to have altered the existing forest ecosystem by cutting down a significant number of trees in a protected and forested area, but within land lawfully possessed by them. It is therefore inaccurate to speak of restitution, because there is no one to whom anything can be returned. What is sought instead is the natural or assisted regeneration of the ecosystem, not civil restitution in the strict sense. Because this is not a case of civil restitution, it is necessary to examine when measures intended to reverse the resulting environmental damage may properly be imposed. Such measures must necessarily be expressly authorized by law (reserva legal), since they entail affirmative or negative obligations for persons accused of damaging the environment, as well as for possessors and owners of the properties on which such environmental harm has occurred, including the obligation to refrain from exercising the various rights arising from ownership.
For this reason, various provisions of the legal system contemplate the possibility of demolishing works that affect the State Natural Heritage (patrimonio natural del Estado), as established by Article 13 of the Ley de la Zona Marítimo Terrestre, or Article 36 of the Ley Forestal, which authorizes eviction from properties subject to the forestry regime (régimen forestal) or devoted to forestry activities (actividad forestal); Article 55 of the Ley de uso y conservación del suelos N° 7779, which expressly provides that the State may “take the appropriate measures to prevent damage to the soil or, insofar as possible, restore the prior condition when the damage has already occurred”; or the various environmental protection measures (medidas protectoras del ambiente) established by Article 99 of the Ley Orgánica del Ambiente, including the demolition of buildings or works that damage the environment (subsection h) and the imposition of obligations to compensate for or stabilize the environment or biological diversity (subsection g).
Nevertheless, those provisions establish an administrative procedure (procedimiento administrativo) that must be followed before any such protective measures may be ordered, because the authorities of the Ministerio del Ambiente y Energía are responsible for conducting a technical review of each case and recommending the most appropriate measures, while potential affected parties must be afforded due process (debido proceso). In the present matter, there is no technical assessment indicating which measures should be adopted, because there are no works to demolish, nor was it possible to establish the defendants’ criminal liability (responsabilidad penal) for the alleged conduct so as to determine that they must bear the environmental responsibility (responsabilidad ambiental) for implementing those protective measures. It is therefore impossible for this court to grant a claim such as that of the Procuraduría General de la República, which requests that the defendants, in their capacity as owners of the property, be ordered to refrain from carrying out any activity that would impede the regeneration of the affected area.
Accordingly, the majority of this Tribunal considers that the proper course is to deny the present ground of appeal against the judgment (motivo de apelación de sentencia). However, in order to protect the fundamental right (derecho fundamental) enshrined in Article 50 of the Constitución Política and the precautionary principle (principio precautorio) governing environmental matters, it is ordered that this judgment be communicated to the Área de Conservación Amistad Pacífico of the Ministerio del Ambiente y Energía so that it may monitor the area affected in this matter and, if necessary, order the appropriate protective measures.
II.Dissenting opinion (voto salvado) of Judge [Nombre15]: I respectfully depart from the majority’s view and consider that the appeal should be granted, because even if the acquittal is upheld on the terms stated by the trial court, there is a defect in the reasoning for denying restitution (restitución). The court reasoned as follows: “…given that restoration of matters to their prior state was requested, the Court must add that, for this authority to award the items claimed in the civil action (acción civil), grant the civil claim if it had been maintained, and order restoration of matters to their prior state, not only must the alleged damage have been proven, but also the causal relationship (relación de causalidad) between the alleged event, in turn caused by the civil defendants, and the injury warranting monetary compensation and restoration of matters to their prior state in this specific case.
In this regard, Article 1045 of the Código Civil establishes that any person who, through willful misconduct, fault, negligence, or recklessness, causes harm to another is obligated to repair it, and our criminal procedure permits the corresponding claim to be brought within these proceedings. However, to determine whether the substantive right materialized and whether the defendants participated in a manner supporting a claim for restoration of matters to their prior state, reference must be made to the proven events set forth in this judgment, which did not establish the events alleged against defendants [[Nombre11] ] and [[Nombre5] ] in these civil proceedings. Quite the contrary, this authority has no basis or grounds for granting the relief sought in these criminal proceedings, because it was not proven that defendants [[Nombre11] ] and [[Nombre5] ] committed the alleged acts, nor was the event giving rise to civil liability established, which could have served as the basis for a civil judgment in favor of the plaintiff or for restoration of matters to their prior state in this specific case.
How can the requested restoration be imposed upon the criminal and civil defendants when their participation in the alleged acts was not even proven? In the Court’s view, ordering the defendants to restore matters to their prior state pursuant to the principle of forest permanence (irreductibilidad del bosque) and the provisions cited by the private complainant (querellante) would be possible only if it had been shown that the defendants committed a crime or at least a criminally wrongful act—that is, conduct satisfying the statutory elements and being unlawful, but not culpable—in which case it would be appropriate to order the defendants to restore matters to their prior state” (judgment, fol. 442 front and back, boldface in the original). The wording of this point begins somewhat confusingly; nevertheless, it ultimately appears clear that, for the court below (a quo), the propriety of the restitution order depends on a finding that the accused participated in the alleged acts, thus linking it to civil liability.
It does not explain, however, why this must be so, particularly considering that restitution in this case does not even require the parties subject to adjudication to participate, since the relief requested is that the site be allowed to regenerate without human intervention. It should be added that a clear distinction has long been drawn between the obligation to compensate for the damage and losses caused—to which the considerations stated by the court below might indeed apply—and restitution. In this regard, it has been stated: “Article 103 of the current Código Penal provides that one of the civil consequences of every crime is the return of the property that was the object of the punishable act or, failing that, payment of its corresponding value; this is also reiterated imperatively by Article 123 of the Código Penal de 1941, which provides that the convicted person must return to the injured party the property that was the object of the punishable act and, if unable to do so, shall be obligated to pay its value.
These provisions must necessarily be read in conjunction with the procedural rules, particularly the final paragraph of Article 399 of the Código de Procedimientos Penales, which provides that the return of the physical object of the crime may be ordered even if no civil action has been filed, although it does not mandate such an order. In other words, a claim for damage and losses arising from the crime must be brought through a civil action for compensation (acción civil resarcitoria), because the procedural rules so require; however, that same condition does not exist when the return of the physical object of the crime is at issue. This is so, as this same Chamber has previously held, because restitution does not constitute a form of compensation in the strict sense (Sentencia Nº 52 F 10:35 hrs. 31 enero 1990, Sala Tercera)” (decision 604-F, at 9:25 on 7 de noviembre de 1991; to the same effect, from the same Chamber, see 518-00, at 9:55 hrs on 19 de mayo del 2000; and see 1338-11, at 17 hrs on 3 de noviembre del 2011, among many others).
Subsequently, in proceedings conducted under the current Código Procesal Penal, it was stated: “Accordingly, by operation of law, and regardless of whether the interested parties requested it, the law requires that matters be restored to the state existing before the crime. This is expressly provided by Articles 103 of the Código Penal and 361 of the Código Procesal Penal, in a circumstance distinct from the items that may be awarded as a result of a claim for compensation. Therefore, restoring matters to their status ex ante (that is, before the crime) is a legal consequence intended to give retroactive effect to the judicial declaration and undo the consequences of the unlawful conduct. Because those purposes serve the public interest, the legal provision does not condition their fulfillment upon the filing of a civil action for compensation” (Sala III, decision 911-10, at 10:41 hrs on 27 de agosto del 2010).
The court was therefore required to explain why it considered Articles 103 of the Código Penal, 123 of the provisions currently in force concerning civil liability from the Código Penal de 1941, and 361 of the Código Procesal Penal, as well as the extensive and consistent case law on the issue, inapplicable to this particular case. Because it failed to do so, the judgment lacks adequate grounds. The judgment must therefore be vacated as to that specific matter and the case remanded.
POR TANTO:
By majority vote, the appeal filed by the Procuraduría General de la República is denied. Judge [Nombre15] dissents.

Res: 2018-101 Tribunal de Apelación de Sentencia Penal de Cartago. A las d iez horas cuarenta y siete minutos del veintiocho de febrero de dos mil dieciocho.
Recurso de apelación interpuesto en la presente causa seguida contra [Nombre [Nombre1]] , [...] , por los delito s de Invasión del área de aprovechamiento de una naciente, Tala Ilegal y Aprovechamiento Ilegal de Madera, Cambio de Uso de Suelo y Anillado de Árboles , en perjuicio de Los Recursos Naturales . Intervienen en la decisión del recurso los jueces Giovanni Mena Artavia, Ivette Carranza Cambronero y [Nombre2] . Se apersonaron en apelación la licencia da [Nombre3] en condición de Procuradora .
Resultando:
1. Que mediante sentencia 21-2017 de la s dieciséis horas treinta y cinco minutos del quince de febrero de dos mil diecisiete , el Tribunal Penal de Cartago, Sede Turrialba , resolvió: "POR TANTO : De conformidad con los razonamientos expuestos y artículos 39 y 41 de la Constitución Política; 11 de la Declaración Universal de Derechos Humanos; 8 inciso segundo de la Convención Americana sobre Derechos Humanos; 1, 30, 31, del Código Penal; 1, 9, 45, 47, 140, 141 a 145, 182, 184, 265 a 269, 360, 361, 363 a 366 del Código Procesal Penal, en aplicación del principio universal de in du bio pro reo, se ABSUELVE de toda pena y responsabilidad a [Nombre [Nombre1]] y [Nombre [Nombre4]] de un delito de INVASIÓN DEL ÁREA DE PROTECCIÓN DE UNA NACIENTE, un delito de TALA ILEGAL Y APROVECHAMIENTO ILEGAL DE MADERA, un delito de CAMBIO DE USO DE SUELO y un delito de ANILLADO DE ÁRBOLES, en perjuicio de LOS RECUERSOS NATURALES, que le venía atribuyendo el Ministerio Público y el Querellante.
Se declara desistida la Acción Civil Resarcitoria promovida por LA PROCURADURÍA GENERAL DE LA REPÚBLICA EN REPRESENTACIÓN DEL ESTADO incoada contra [Nombre [Nombre1]] y [[Nombre5] ]. Se rechaza la solicitud de restitución de las cosas al estado anterior. Se ordena levantar cualquier tipo de medida cautelar que pese sobre los imputados producto de la presente causa. Se resuelve sin especial condenatoria en costas. Son los gastos del proceso a cargo del Estado." 2. Que contra el anterior pronunciamiento,l a licenciad a [Nombre3] interpuso el recurso de apelación.
3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.
4 . Que en los procedimientos se han observado las prescripciones legales pertinentes.
CONSIDERANDO:
I.La licenciada [Nombre3] , en su condición de abogada de la Procuraduría General de la República, apela la sentencia 21-2017 del Tribunal Penal de Cartago, Sede Turrialba, de las dieciséis horas treinta y cinco minutos del quince de febrero del dos mil diecisiete (aunque la cita incorrectamente, se entiende que se trata de ella). En su único motivo de impugnación, se queja de una falta de fundamentación de la sentencia en violación del artículo 142 del Código Procesal Penal. Afirma que, en conclusiones, solicitó la restitución de las cosas al estado anterior, permitiendo la regeneración del lugar sin intervención humana. En sentencia, el a quo rechazó su petición porque a los acusados no se les pudo atribuir la comisión de acción alguna en perjuicio de los recursos naturales, de manera que tampoco se les podía poner a responder por la acción civil resarcitoria y consecuentemente no procedía obligarlos a realizar la restitución de las cosas al estado anterior.
Considera la impugnante que sí se demostró la responsabilidad de los imputados en la comisión de los delitos de tala y aprovechamiento ilegal del recurso forestal y cambio de uso del suelo en zona de bosque, ya que ello fue observado por [Nombre6] . No obstante, los encartados incurrieron en un error de prohibición indirecto invencible, lo que hacía improcedente pedir la condena penal y civil. De todas formas, demostrada la comisión del ilícito y daño ambiental, se requirió la restitución de las cosas al estado anterior. En el lugar de los hechos se detectaron violaciones al recurso forestal, en contravención de lo dispuesto en la Ley Forestal en sus artículos 58 inciso a) y 61 incisos a), b) y c). El perjuicio del ambiente se determinó a través del avalúo del daño ambiental. La confirmación de los hechos se vio plasmada con los testimonios de [Nombre7] y [Nombre8] , funcionarios del SINAC y MINAE y los oficios OT-546 del siete de setiembre del dos mil diez y OT-562-2010 del ocho de setiembre del dos mil diez.
Se determinó además que el lugar era zona de bosque con presencia de cuerpos de agua. Se acreditó que el fundo pertenece a la Asociación de Desarrollo Indígena Cabécar, y había sido adjudicado a [Nombre9] . Ello se corroboró con el testimonio de [Nombre10] . Sin embargo, la petición de la Procuraduría fue rechazada sin sustento. Por ello pide se acoja el recurso, se revoque la resolución en el aspecto impugnado y se disponga el reenvío o, en su defecto, se ordene la restitución de las cosas al estado anterior, ordenando a los encartados, no realizar actividad que impida la regeneración de la zona afectada. El motivo debe declararse sin lugar: Como se desprende con claridad de la lectura de la fundamentación analítica del fallo, a los imputados [[Nombre11] ] y [[Nombre5] ] se les absolvió por duda en cuanto a su participación en los hechos acusados (sentencia, fs. 439 a 441). La tesis de la Procuraduría General de la República de que ellos habían actuado al amparo de un error de prohibición indirecto, no fue aceptada por el a quo, el que señaló al respecto: “La señora representante de la querella, en sus conclusiones consideró que en el presente caso se habían demostrado los hechos acusados en su querella en contra de [[Nombre11] ] y [[Nombre5] ], pero que en este caso existía un error de prohibición indirecto invencible por cuanto los imputados incurrieron en la realización de los daños a los recursos naturales acusados, por un error invencible al considerar que tenían permiso por parte de la Asociación de Desarrollo Indígena Cabecar para realizarlos.
El Tribunal respeta el argumento de la señora Procuradora, pero estima que para que proceda el análisis de la existencia de un error de prohibición sería necesario que que (sic) se haya demostrado la participación de los encausados en los hechos acusados y una vez lo anterior, determinar que dicha acción haya superado los estadios de tipicidad y antijuridicidad, e incluso el primer subelemento de la culpabilidad, que es la capacidad de culpabilidad y solo en ese caso resultaría aplicable un análisis sobre el conocimiento de antijuridicidad, momento en el cual competería verificar la tesis de la querellante, no obstante a criterio de este Juzgador este aspecto aplicado al caso concreto, resultaría ocioso ya que según las consideraciones vertidas supra por el Tribunal, ni siquiera se tiene por demostrada la realización de una acción en perjuicio de los recursos naturales por parte de los acusados” (sentencia, f. 141 fte. y vto.).
Así, si la recurrente pretendía sustentar la necesidad de disponer la restitución en la existencia del hecho punible, debió haber atacado la conclusión del tribunal de mérito de que los encartados no habían participado en el mismo. Para ello no era suficiente formular una interpretación alternativa del material probatorio, en la forma en que lo hace quien apela; más bien, correspondía señalar los errores cometidos por el tribunal al analizar esa prueba. El recurso es, a fin de cuentas, una crítica a los vicios del fallo. En todo caso, aun cuando es cuestionable si resultaba procedente la restitución civil, en los términos establecidos por los artículos 103 inciso 1) del Código Penal, 122 y 123 de las Reglas vigentes de responsabilidad civil del Código Penal de 1941, pues la responsabilidad que se reclama es por un daño ambiental producido en un fundo y no por una cosa que pueda ser devuelta al damnificado, lo cierto es que no resulta procedente establecer obligaciones de índole civil a los imputados, cuando ha recaído una sentencia absolutoria cuyo fundamento no está siendo cuestionado.
Las anteriores afirmaciones, merecen una explicación más detallada, lo que de seguido se pasa a realizar. En primer lugar, debe señalarse que la restitución es entendida como: “1. Pen . Modalidad de satisfacción de la responsabilidad civil derivada del delito que consiste en devolver el mismo bien a su legítimo poseedor o propietario” (Real Academia Española (2017). Diccionario Panhispánico del Español Jurídico. Volumen II. Madrid: Santillana Educación S.L., pág. 1831), por lo que es bastante forzado sostener dicho concepto en una materia como la ambiental, en donde no existe ningún bien que devolver a un poseedor o propietario, sino que los Estados modernos, incluido el costarricense, han visto la necesidad de proteger los recursos forestales y establecer una tutela cautelar de los mismos, para lo cual existen los mecanismos legales para conseguir la protección de dichos recursos y en caso de que se hayan producido alteraciones a el derecho a contar con un ambiente sano, resulta posible establecer medidas tendientes a revertir el daño ambiental producido.
El artículo 123 de las "Reglas vigentes sobre responsabilidad civil" del Título IV del Libro I del Código Penal de 1941, dispone: "Deberá el condenado restituir al ofendido, con abono de todo deterioro o menoscabo, la cosa objeto del hecho punible, y si no pudiere hacerlo, estará obligado a satisfacer su valor conforme a estimación pericial referida a la fecha de la infracción. Si tal estimación no fuese posible hacerla por haber sido destruida o haber desaparecido la cosa, los jueces fijarán el valor respectivo, ateniéndose a los datos del juicio. La restitución se ordenará aun cuando la cosa se hallare en poder de un tercero, dejando a salvo los derechos que la ley civil confiere a éste" (el subrayado se suple). La norma de comentario resulta ser sumamente compleja, toda vez que hace alusión a una serie de conceptos que deben ser analizados, como lo que se entiende por "la cosa objeto del hecho punible" o, cuándo una cosa se entiende que se encuentra "en poder de un tercero" y cuando no, así como cierra indicando que se dejan a salvo los derechos que la ley civil confiere al tercero.
En cuanto al tema de lo que puede entenderse por "cosa objeto del hecho punible", se observa una clara imprecisión, al mezclar dos conceptos jurídicos totalmente diversos, pues algo muy distinto es una "cosa", entendido como: "5. f. Der. Objeto material, en oposición a los derechos creados sobre él y a las prestaciones personales" (Real Academia Española, 2017), frente al "objeto del hecho punible" u objeto material del delito, que se identifica como el derecho violentado con la acción delictiva (Bolaños, [Nombre12]. (s.a.) El objeto material de la acción delictiva. Aspectos jurídicos y filosóficos. Recuperado de http://www.saber.ula.ve/bitstream/123456789/23604/1/articulo3.pdf el 01 de marzo de 2018). Tomando en cuenta dicha imprecisión conceptual, es posible sostener que la formulación legislativa quiso hacer referencia a la restitución de aquellos bienes lesionados en los delitos de resultado, pues: "En los delitos de resultado, el resultado consiste, ante todo en la lesión de un determinado objeto, este objeto se denomina objeto de acción y no se debe confundir con el objeto de protección o bien jurídico que puede tener también una naturaleza ideal.
Todos los delitos importan una lesión material (la del bien jurídico); sólo un número determinado de ellos requiere una lesión material (la del objeto de la acción)". ([Nombre13], [Nombre14]. (1996). Manual de Derecho Penal. Santa Fe, Bogotá: Temis, p. 85). En esos delitos de resultado procede la restitución de la cosa, siempre que ello sea posible, pues en caso de que el autor del delito no pudiere hacerlo, el artículo 123 del Código Penal de 1941 dispone que lo que procede es satisfacer su valor. También dispone la norma que, la restitución procede aun cuando la cosa "se hallare en poder de un tercero", lo que implica analizar que puede entenderse por tal formulación. Según indica el artículo 277 del Código Civil: "El derecho de posesión consiste en la facultad que corresponde a una persona de tener bajo su poder y voluntad la cosa objeto del derecho" (El subrayado es suplido). De acuerdo con lo anterior, cuando el artículo 123 del Código Penal de 1941 indica que la restitución se debe ordenar aun cuando la cosa se hallare en poder de un tercero, dicha circunstancia hace referencia expresa a aquellos supuestos en los que la cosa sea poseída por un tercero, quien tendrá la opción de acudir a hacer valer sus derechos ante los tribunales de justicia para conseguir la “Devolución o reintegro de alguna cosa o bien que es detentada indebidamente por otra persona” (Real Academia Española (2017).
Diccionario Panhispánico del Español Jurídico. Volumen II. Madrid: Santillana Educación S.L., pág. 1831). Si en el presente asunto, lo que se le atribuyó a los encartados fue el haber alterado el ecosistema forestal existente al haber talado una importante cantidad de árboles en zona de protección y boscosa, pero dentro de un terreno que legítimamente es poseído por los encartados, no resulta acertado hablar de una restitución, puesto que no hay a nadie a quien devolverle nada, sino que lo que se pretende es conseguir la regeneración natural o inducida del ecosistema, pero no una restitución civil propiamente dicha. Al no encontrarnos ante un supuesto de restitución civil, cabe analizar cuando es posible sostener que procede establecer medidas tendientes a revertir el daño ambiental producido, lo cual necesariamente debe ser objeto de reserva legal, puesto que dichas medidas implican obligaciones de hacer o de no hacer para los derechos de las personas acusadas de dañar el medio ambiente, pero también para los poseedores y propietarios de los fundos en los que se haya cometido dichos perjuicios ambientales, como lo es la obligación de no ejercer los distintos derechos derivados del dominio.
Es por eso que, distintas normas del ordenamiento jurídico contemplan la posibilidad de que se realicen derribos de obras que afecten el patrimonio natural del Estado, como lo estable el artículo 13 de la Ley de la Zona Marítimo Terrestre, o el artículo 36 de la Ley Forestal, que autoriza el desalojo de inmuebles sometidos a régimen forestal o dedicados a la actividad forestal, el artículo 55 de la Ley de uso y conservación del suelos N° 7779, que expresamente dispone que el Estado puede “tomar las medidas pertinentes a fin de evitar daños al suelo o restablecer, en lo posible, la situación anterior, cuando el daño ya se haya producido”, o las diferentes medidas protectoras del ambiente que establece el artículo 99 de la Ley Orgánica del Ambiente, entre las que se incluyen la demolición de construcciones u obras que dañen el ambiente (inciso h) y la imposición de obligaciones compensatorias o estabilizadoras del ambiente o la diversidad biológica (inciso g).
No obstante, en dichas normas se establece un procedimiento administrativo que debe ser cumplido antes de poder disponerse alguna de dichas medidas protectoras, pues son las autoridades del Ministerio del Ambiente y Energía las encargadas de supervisar técnicamente cada caso y recomendar cuáles son las medidas más adecuadas, a lo que debe concederse el debido proceso a los posibles afectados. En el presente asunto, no se cuenta con un criterio técnico que señale cuáles son las medidas que deben adoptarse pues no existen obras que demoler, ni tampoco se logró determinar la responsabilidad penal de los imputados en la conducta acusada, como para establecer que son ellos quienes deben correr con la responsabilidad ambiental de cumplir con dichas medidas protectoras, por lo que resulta imposible en esta sede acceder a una pretensión como la de la Procuraduría General de la República, en la que solicita que se le ordene a los imputados, en su condición de propietarios del fundo, no realizar actividad alguna que impida la regeneración de la zona afectada.
Por lo anterior, es criterio de la mayoría de este Tribunal que lo que corresponde es declarar sin lugar el presente motivo de apelación de sentencia, pero en aras de proteger el derecho fundamental consagrado en el artículo 50 de la Constitución Política y el principio precautorio que rige en materia ambiental, se ordena comunicar esta sentencia al Área de Conservación Amistad Pacífico del Ministerio del Ambiente y Energía, para que le brinde seguimiento a la zona afectada en este asunto y disponga, en caso de ser necesario, las medidas protectoras que correspondan.
II.Voto salvado del juez [Nombre15] : Respetuosamente me aparto del criterio de mayoría y considero que debe declararse con lugar el recurso, pues aun manteniendo la absolutoria en los términos planteados por el tribunal de juicio, sí se aprecia un defecto en la fundamentación del rechazo de la restitución. El tribunal argumentó lo siguiente: “…siendo que se peticionó la restitución de las cosas al estado anterior el Tribunal tiene que agregar que para que ésta autoridad pudiera autorizar los rubros de la acción civil y declarar con lugar la demanda civil en caso que se hubiera sostenido y para que pueda ordenar la restitución de las cosas al estado anterior, no solamente debe de haberse demostrado el daño pretendido, sino también la relación de causalidad entre el suceso demandado y a su vez provocado por los demandados civiles y la lesión que motiva la autorización de un resarcimiento económico y la restitución de las cosas al estado anterior, en el caso concreto.
En este sentido el artículo 1045 del Código Civil establece que la persona que por dolo, falta, negligencia o imprudencia causa a otro un daño, está obligado a repararlo, y nuestro proceso penal permite la posibilidad de ejercer la correspondiente demanda dentro de esta causa. Sin embargo, para determinar si se concretó el derecho de fondo y la participación de los encausados para reclamar la restitución de las cosas al estado anterior, debe remitirse a los eventos probados de este fallo, los cuales no pudieron determinar los acontecimientos demandados en esta instancia civil a los demandados [[Nombre11] ] y [[Nombre5] ]. Todo lo contrario, esta autoridad no tiene base ni fundamento para conceder lo peticionado dentro de este proceso penal, porque no se demostró que los imputados [[Nombre11] ] y [[Nombre5] ] hubieran realizado los hechos acusados, ni se determinó el hecho generador de la responsabilidad civil, que pudiera haber sido el fundamento para una condenatoria civil a favor de la actora o la restitución de las cosas al estado anterior en el caso concreto.
Como pretender la restitución solicitada a cargo de los imputados y demandados civiles, si ni siquiera se demostró su participación en los hechos acusados. Ordenar la restitución de las cosas al estado anterior, a cargo de los imputados en aplicación del principio de irreductibilidad del bosque y las normas citadas por la querellante, a criterio del Tribunal solo sería posible en caso que se hubiera demostrado que los imputados cometieron un delito o al menos un injusto penal, acción típica y antijurídica pero no culpable, situación en la cual sería procedente ordenar a cargo de los imputados la restitución de las cosas al estado anterior” (sentencia, f. 442 fte. y vto., la negrita es del original) . La redacción del punto inicia un poco confusa; no obstante, al final parece quedar claro que, para el a quo, la procedencia de la orden de restitución depende de que se haya determinado la participación de los encartados en los hechos acusados, yendo entonces de la mano de la responsabilidad civil.
No explica, sin embargo, por qué tendría que ser así, sobre todo tomando en cuenta que la restitución, en este caso, ni siquiera exige una participación de los justiciables, ya que lo que se pide es que se permita la regeneración del lugar sin intervención humana. Debe agregarse que, desde vieja data, se ha establecido una clara distinción entre la obligación de reparar los daños y perjuicios causados (a la que sí podrían serle aplicables las consideraciones expuestas por el a quo) y la restitución. Al respecto se ha dicho: “el artículo 103 del Código Penal vigente señala que una de las consecuencias civiles de todo delito es la restitución de las cosas objeto del hecho punible o en su defecto el pago del respectivo valor; aspecto que reitera el artículo 123 del Código Penal de 1941 también en forma imperativa, al disponer que el condenado deberá restituir al ofendido la cosa objeto del hecho punible y si no pudiere hacerlo, estará obligado a satisfacer su valor.
Estas disposiciones deben necesariamente relacionarse con la normativa procesal, en especial con el párrafo final del artículo 399 del Código de Procedimientos Penales, al señalar que la restitución del objeto material del delito podrá disponerse aunque la acción civil no se hubiere formulado, aunque no lo ordena en forma imperativa. En otros términos, el reclamo de los daños y perjuicios provenientes del delito debe hacerse por medio de la acción civil resarcitoria, porque así lo condiciona la normativa procesal; sin embargo esa misma condición no existe cuando se trata de la restitución del objeto material del delito. Ello es así, conforme lo ha interpretado anteriormente esta misma Sala, porque la restitución no constituye una forma de indemnización en sentido estricto (Sentencia Nº 52 F 10:35 hrs. 31 enero 1990, Sala Tercera)” (voto 604-F, de las 9:25 horas del 7 de noviembre de 1991; en igual sentido, de la misma sala, v. 518-00, de las 9:55 hrs del 19 de mayo del 2000; y, v. 1338-11, de las 17 hrs del 3 de noviembre del 2011, entre muchos otros).
Posteriormente, en un proceso tramitado con el vigente Código Procesal Penal se señaló: “Siendo así, por disposición legal, y con independencia de que haya sido o no solicitado por los interesados, es menester de ley restituir las cosas al estado previo al delito. Así lo dispone de manera explícita los artículos 103 del Código Penal y 361 del Código Procesal Penal, en un supuesto diferente de las partidas que se pueden conceder a causa de la gestión resarcitoria. Por ende, la restitución de las cosas a su status ex ante (o sea, anterior al delito), es una consecuencia de ley que procura retrotraer los efectos de la declaratoria judicial y deshacer las consecuencias de la ilicitud. Siendo esos propósitos de interés público, la norma legal no condiciona su cumplimiento al ejercicio de la acción civil resarcitoria” (Sala III, v. 911-10, de las 10:41 hrs del 27 de agosto del 2010). Lo cierto es que correspondía entonces al tribunal explicar por qué consideró que en el caso particular no resultaba aplicable lo dispuesto en los numerales 103 del Código Penal, 123 de las normas vigentes sobre responsabilidad civil del Código Penal de 1941 y 361 del Código Procesal Penal, así como la copiosa y uniforme jurisprudencia sobre el punto. Al no haberlo hecho, la sentencia deviene en infundada. De ahí que deba anularse el fallo en ese particular, disponiéndose el reenvío.
POR TANTO:
Por mayoría, se declara sin lugar el recurso de apelación formulado por la Procuraduría General de la República. El Juez [Nombre15] salva el voto.
