UNKNOWN PERSON DECISION N° 81-C-2018 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At eleven thirty-five a.m. on February sixth, two thousand eighteen.- DEMOLITION INTERDICT (INTERDICTO DE DERRIBO) filed by [Nombre1], of legal age, married, identification card CED1 - -; against UNKNOWN. The PROCURADURÍA GENERAL DE LA REPÚBLICA participates in the proceeding, represented by [Nombre2], identification card CED2 - -. [Nombre3] acts as agricultural public defender for the petitioner. Proceeding heard before the Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores.- Opinion drafted by Judge ALPÍZAR RODRÍGUEZ; and, WHEREAS (CONSIDERANDO):

I.In the ruling of January 18, 2018, the trial judge, without stating specific reasons, ordered that this matter be referred directly to the court of second instance for a determination of jurisdiction, stating only that this was being done in light of the position taken by the State, represented by the PGR, upon appearing as a statutory third party (tercero legal) (associated documents folder: file 18/01/2018 16:21:50). That procedure is incorrect because, although its observations are certainly important and must be analyzed by the courts in its capacity as overseer of legality (contralor de legalidad), the State’s participation in this type of proceeding does not make it a party vested with the power to raise defenses. The court below (a quo) should therefore have analyzed the entity’s statements and, if it considered them well-founded, issued an interlocutory judgment declining subject-matter jurisdiction (auto-sentencia de inhibitoria objetiva), stating the specific reasons why it considered itself to lack jurisdiction to hear this matter; such reasons are also conspicuously absent from the referenced ruling.

Nevertheless, given the determination made herein, that error has no effects on due process that would require the court, on its own motion, to declare any procedural nullity (nulidad procesal) (sections 26 of the Ley de Jurisdicción Agraria, 502 of the Código de Trabajo, and 197 through 198 of the Código Procesal Civil, applied supplementarily). Furthermore, because jurisdiction is a matter reviewable by the court on its own motion, as it constitutes a procedural prerequisite (presupuesto procesal) necessary for the validity of the proceeding, and in the interests of procedural economy, as well as because this Court has functional jurisdiction to do so, it shall review whether any jurisdictional issue exists.

II.Subject-matter jurisdiction in agricultural matters is defined generally in Articles 1 and 2 subsection h) of the Ley de Jurisdicción Agraria, while territorial jurisdiction is governed by sections 15 and 16. Those provisions empower judges in this field to adjudicate or resolve disputes relating to the conduct of agricultural or agro-environmental activities, or activities connected thereto, within the territory under their jurisdiction. Agricultural landholding (fundo agrario) means one devoted to such activities or capable of being devoted to them. In the latter situation, it is important to consider the size and location of the land and the type of production that may be carried out on it. Under a systematic interpretation, the agricultural courts have been deemed competent to hear not only disputes involving real property suitable for or devoted to traditional agricultural and livestock production, but also those involving innovative techniques such as hydroponic cultivation and others, as well as proceedings concerning land devoted to or suitable for agroforestry or agritourism, land of environmental interest, and land covered by forest.

Accordingly, it must be assessed in each specific case whether the land that is the subject of the claims in the complaint falls within the parameters described. In addition to the objective element (the property in dispute), however, jurisdiction must be determined by analyzing the subjective criteria (the parties involved) and the nature of the claims and disputes giving rise to the complaint.

III.In this demolition interdict, the PGR, upon appearing as a statutory third party, states that the trees whose felling is sought are on land belonging to [Dirección1], which the plaintiff claims is the subject of a pending concession application, without proving it. It therefore requests that a lack of subject-matter jurisdiction be declared and that the proceeding be referred for adjudication to the Tribunal Contencioso Administrativo y Civil de Hacienda, because the requested relief would affect public-domain property (bien de dominio público) subject to a special Administrative Law regime and because contentious-administrative jurisdiction cannot be extended by consent. It relies on Articles 7-f of Ley 2825; 10 and 50-1 of the Código Procesal Contencioso Administrativo, and cites decisions 530/2008, 582/2009, 647/2009, 33/2010, 495/2013, 674/2013, 629/2014, 1104/2014, 678/2015, and 1258/2015 of the Sala Primera and 377/2014, 582/2014, 849/2014, 872/20141 255/2015, 394/2015, and 679/2015 of the Tribunal Agrario (pleadings folder: file 09/01/2018 01:23:23).

The complaint reveals only that the plaintiff asserts that the trees—whose species he does not identify—that he seeks to have felled are located within the inalienable border strip with Panamá, on a parcel measuring approximately 9500 square meters, which had been leased by his wife and is currently the subject of a pending concession application (pleadings folder: file 23/11/2017 08:27:27). As required, no information is provided concerning the nature or current use of the land, a deficiency that the trial court should have ordered corrected before admitting the proceeding, since this is an important factor in determining its jurisdiction. The record shows that a judicial inspection (reconocimiento judicial) was conducted on December 6, 2017, which states that the trees are “pilón” trees and records their location within the protection area of a stream, their distance from buildings, and other information, but does not in any way describe the nature of the land on which they are located (associated documents folder: file 11/12/2017 9:58:43).

Despite the absence of that information, it is important to emphasize that the property’s size and location support the presumption that it is an agricultural landholding. Nevertheless, the trial court shall take note of the foregoing for future cases, because a judicial inspection was conducted without taking the opportunity to place on the record the information omitted by the plaintiff.

IV.The conclusion reached in the preceding whereas clause constitutes a legally sufficient basis for finding that the trial court has jurisdiction to hear this type of proceeding, since the location of the land within the publicly owned border strip does not alter the nature of the land. Its classification as public-domain property (demanio público) confers special characteristics upon the property that may and must be protected, defended, or enforced by any Costa Rican court, irrespective of its subject-matter jurisdiction. Nor does this case involve a dispute related to an administrative relationship or act, or one in which the powers of the State’s administrative function are at issue (see, in this regard, the analysis in decision 9928 of June 9, 2010, of the Sala Constitucional). The fact that a concession application is pending is likewise not a permissible basis for determining jurisdiction, particularly in proceedings such as this one, in which standing to be sued (legitimación pasiva) is so broad that they may be brought against any person, pursuant to section 474 of the Código Procesal Civil, applied supplementarily.

In accordance with the foregoing, because the matter involves land whose size permits agricultural activity to be carried out and because the asserted dispute may functionally be resolved in this forum, the trial court is ordered to continue processing this proceeding.

THEREFORE (POR TANTO):

The Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur (Corredores) shall continue processing this proceeding.

VOTO N° 81-C-2018 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las once horas y treinta y cinco minutos del seis de febrero de dos mil dieciocho.- INTERDICTO DE DERRIBO interpuesto por [Nombre1] , mayor, casado, cédula CED1 - - ; contra IGNORADO. Interviene en el proceso , la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por [Nombre2] , cédula CED2 - - . Actúa como defensor público agrario de la parte promovente, [Nombre3] . Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores.- Redacta la jueza ALPÍZAR RODRÍGUEZ , y;

CONSIDERANDO:

I.En resolución del 18 de enero de 2018, la persona juzgadora de instancia, sin expresar razones concretas, ordenó remitir directamente este asunto a segunda instancia para que se definiese la competencia, indicando únicamente que lo hacía por lo indicado por el Estado, representado por la PGR, al apersonarse como tercero legal (carpeta documentos asociados: archivo 18/01/2018 16:21:50). Dicho procedimiento es incorrecto, dado que aunque ciertamente sus observaciones son importantes y deben ser analizadas por los tribunales, como contralor de legalidad, la participación del Estado en este tipo de proceso, no lo convierte en parte como para tener las facultades de interponer excepciones. Debió el a quo entonces analizar lo expresado por esa entidad y si consideraba que llevaba razón, emitir el auto-sentencia de inhibitoria objetiva, expresando las razones concretas por las cuáles consideraba no tenía competencia para tramitar este asunto, lo que además se hecha de menos en la resolución referida.

No obstante, dicho error no tiene, dado lo que se resuelve, efectos sobre el debido proceso, que impliquen declarar de oficio alguna nulidad procesal (numerales 26 de la Ley de Jurisdicción Agraria, 502 del Código de Trabajo y 197 a 198 del Código Procesal Civil, aplicados supletoriamente). Además, al ser el tema de la competencia un aspecto revisable de oficio por tratarse de un presupuesto procesal necesario para la validez del proceso, por economía procesal y por tener competencia funcional para ello, a revisar si existe algún problema al respecto.

II.La competencia agraria por razón de la materia está definida genéricamente en los artículos 1 y 2 inciso h) de la Ley de Jurisdicción Agraria, y en lo que respecta a la territorial se regula en los numerales 15 y 16. Dichas normas facultan a las personas juzgadoras de esta disciplina para dirimir o resolver los conflictos relacionados con el ejercicio de actividades agrarias o agroambientales, o conexas a éstas, en el territorio que sea de su competencia. Se considera fundo agrario aquél destinado a dichas actividades, o que pueda destinarse a ellas. Para éste último supuesto, es importante tomar en cuenta la medida, la ubicación del terreno y el tipo de producción que se puede desarrollar en él. Con una interpretación hermenéutica se ha entendido compete a los tribunales agrarios conocer además de los conflictos que versen sobre inmuebles con aptitud o dedicados a la producción agropecuaria tradicional, aquellos en los que se utilicen técnicas novedosas como los cultivos hidropónicos y otras, e igualmente los procesos referidos a terrenos destinados o con aptitud agroforestal, agroturístico y de interés ambiental, así como los cubiertos por bosque.

En ese sentido, debe valorarse en cada caso en concreto, si el terreno objeto de las pretensiones de la demanda está comprendido dentro de los parámetros explicados. Pero además del elemento objetivo (bienes en conflicto), para determinar la competencia deben analizarse los criterios subjetivos (partes involucradas) y la naturaleza de las pretensiones y conflictos que originan la demanda.

III.En el presente interdicto de derribo, la PGR, al apersonarse como tercero legal, señala que los árboles cuyo derribo se pide están en un terreno de la [Dirección1] , que el actor afirma tener en trámite de concesión, sin demostrarlo, por lo que solicita se declarare la incompetencia en razón de la materia y se remita el proceso, para su conocimiento, al Tribunal Contencioso Administrativo y Civil de Hacienda, por involucrar lo pretendido la afectación de un bien de dominio público, sujeto a un régimen especial de Derecho Administrativo y por ser improrrogable la jurisdicción contenciosa administrativa. Se fundamenta en los artículos 7-f de la Ley 2825; 10, 50-1 del Código Procesal Contencioso Administrativo y cita los votos de la Sala Primera 530/2008, 582/2009, 647/2009, 33/2010, 495/2013, 674/2013, 629/2014, 1104/2014, 678/2015 y 1258/2015 y del Tribunal Agrario 377/2014, 582/2014, 849/2014, 872/20141 255/2015, 394/2015 y 679/2015 (carpeta de escritos: archivo 09/01/2018 01:23:23).

Del escrito de demanda únicamente se desprende que el actor afirma que los árboles -no indica especies- que se pretende derribar se encuentran dentro de la faja fronteriza inalienable con Panamá, en un terreno que mide aproximadamente 9500 metros cuadrados, que estuvo arrendado por su esposa y actualmente está en trámite de concesión (carpeta de escritos: archivo 23/11/2017 08:27:27). No se indica, como era lo debido, los datos sobre la naturaleza o destino actual del terreno, lo cual debió prevenir el Juzgado de instancia antes de cursar el proceso, por ser un elemento importante para definir su competencia. Consta que se realizó un reconocimiento judicial el 6 de diciembre de 2017, en el cual se indica los árboles son de "pilón", se ubican en el área de protección de una quebrada, la distancia a edificaciones y otros datos, pero en forma alguna se describe la naturaleza del terreno dónde se ubican (carpeta documentos asociados: archivo 11/12/2017 9:58:43).

Pese a la falta de esos datos, es importante resaltar que la medida del inmueble y la ubicación son datos que permiten presumir se trata de un fundo de naturaleza agraria. Sin embargo, tome nota del Juzgado de instancia de lo indicado, para futuros casos, pues se realizó un reconocimiento judicial y no se aprovechó para hacer constar esa información, omitida por la parte actora.

IV.Lo concluido en el considerando anterior, es motivo legal suficiente para considerar que el Juzgado de instancia tiene competencia para tramitar este tipo de proceso, pues el hecho de que se ubique el terreno en la franja fronteriza demanial no elimina la naturaleza del terreno. La calificación de demanio público le otorga características especiales al inmueble, que pueden y deben ser tuteladas, defendidas o aplicadas por cualquier tribunal costarricense, independientemente de la materia. Y no se está en presencia de un conflicto relacionado con una relación o acto de naturaleza administrativo ni uno en el cual se discutan facultades de la función administrativa estatal (ver al respecto lo analizado en voto 9928 de 9 de junio de 2010 de la Sala Constitucional).
