Decision: 20 18-0095 Decision: 20 18-0095 Case File: 11-201523-0486 -PE( 13 ) CRIMINAL JUDGMENT APPEALS COURT (TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL). Segundo Circuito Judicial de San José. Goicoechea, at nine hours and forty-four minutes on treinta de enero de dos mil dieci ocho.- APPEALS (RECURSOS DE APELACIÓN) filed in the present proceeding brought against Nombre01, of legal age, Costa Rican, identity card number CED01, born in Guanacaste on 25 de febrero de 1946, son of Nombre01, single, retired, resident of Limón, Siquirres, Los Laureles, one kilometer north of Pulpería Evangélica, after the ICE bridge, in a shack; Nombre02 , of legal age, Costa Rican, identity card number CED02, born in Guanacaste on 20 de agosto de 1971, son of Nombre03 and Nombre04, single, banana plantation worker, resident of Limón, Siquirres, Los Laureles settlement, Dirección01; Nombre05 , of legal age, Costa Rican, identity card number CED03, born in Guanacaste on 30 de setiembre de 1980, son of Nombre06 and Nombre07 , single, farmer, resident of Limón, Siquirres, El Peje, Los Laureles, 600 meters west of Iglesia cuadrangular de Los Laureles, natural-colored house; for the offense of UNLAWFUL OCCUPATION (USURPACIÓN), to the detriment of [Nombre08 001].
Judge Mario Alberto Porras Villalta and associate judges Patricia Vargas González and Laura Murillo Mora participated in deciding the appeal. The following appeared before this Court: Giovanni Herrera Alvarado, public defender for defendant Nombre01; Dennia López Vargas, public defender for accused Nombre05 ; Argerie López Pérez, public defender for defendant Nombre02 ; and Allan Ramírez Villalobos, representative of Fiscalía de Siquirres.
FINDINGS:
I.By judgment number 109 -20 17, issued at seven hours and fifteen minutes on dieciocho de julio de dos mil diecisiete, the Tribunal Penal de Juicio del Segundo Circuito Judicial de la Zona Atlántica, Sede Siquirres, ruled: “POR TANTO: In accordance with the foregoing and Articles 39 and 41 of the Constitución Política, 8 of the Convención Americana sobre Derechos Humanos; 14 of the Pacto Internacional de Derechos Civiles y Políticos; 26 of the declaración Americana de Derechos y Deberes del Hombre; 10 and 11 of the Declaración Universal de Derechos Humanos; 1, 30, 31, 71, 73, and 225 subsection 03 of the Código Penal; and provisions 1 through 6, 9, 12, 13, 140, 141 and 142, 175 through 179, 184, 265, 303, 328, 330, 333, 335, 351, 352, and 363 through 367 of the Código Procesal Penal, it is unanimously ruled as follows: A. The claim of defective procedural activity (actividad procesal defectuosa) raised by defense counsel is denied.
B. Nombre05 is acquitted of all punishment and liability for one offense of Unlawful Occupation alleged to have been committed to the detriment of [Nombre08 001]. C. Nombre01 is acquitted of all punishment and liability for one offense of Assault with a Weapon (Agresión con Arma) alleged to have been committed to the detriment of [Nombre08 001]. D. Nombre01 AND Nombre02 are found criminally responsible as perpetrators of ONE OFFENSE OF UNLAWFUL OCCUPATION to the detriment of [Nombre08 001], and in that capacity each is sentenced to SIX MONTHS’ IMPRISONMENT, to be served at the place and in the manner prescribed by the applicable prison regulations, with credit for time spent in pretrial detention (preventiva). Because they meet the statutory requirements, they are granted the benefit of a suspended sentence (ejecución condicional de la pena) for a period of three years, subject to the warning that they must not commit an intentional offense punishable by imprisonment for more than six months.
E. The restoration of the property to its prior condition (restitución de las cosas a su estado anterior) is ordered; for that purpose, the appropriate police authorities are authorized to carry out the acts necessary to destroy the buildings and crops located on the properties possession of which belongs to the injured party, [Nombre08 001], and which are located at: [...], properties represented by cadastral plans N. [Valor 001], [Valor 002], [Valor 003] and [Valor 004]. Furthermore, with the assistance of Fuerza Pública, SENASA is ordered to inspect the indicated properties to determine whether livestock (semovientes) remain at the site and, if their return is not appropriate (to whoever proves ownership), to seize and dispose of the animals as provided by law and within its authority. No special award of costs (especial condenatoria en costas) is made; the costs of the proceedings shall be borne by the State. Once this judgment becomes final, the corresponding notice shall be sent to Registro Judicial. The full judgment shall be read at sixteen hours on veintiséis de julio del dos.” (sic).
II.Giovanni Herrera Alvarado, public defender for defendant Nombre01; Dennia López Vargas, public defender for accused Nombre05 ; and Argerie López Pérez, public defender for defendant Nombre02 , filed appeals against the foregoing ruling.
III.After conducting the corresponding deliberation in accordance with Article 465 of the Código Procesal Penal, the Court considered the issues raised in the appeals.
Criminal Judgment Appeals Judge Porras Villalta authors the opinion; and, Appeal filed by Dennia López Vargas, public defender for co-accused Nombre05 (see folios 524 through 529).
Error in ordering the restitution of the property [Valor 001] to the victim. In the sole ground of her appeal, the public defender alleges “[…] erroneous reasoning in the application of substantive and procedural law regarding the civil consequences of the punishable act […]” (see folio 524), specifically because the restitution of the property belonging to defendant Nombre05 (the property [Valor 001]) to the victim was ordered. The appellant objects to the judgment’s ordering of that measure (which—she asserts—is a civil consequence of the punishable act), despite the acquittal entered in favor of defendant Nombre05 and the fact that the victim did not bring a civil action for damages (acción civil resarcitoria). In support of her complaint, she argues as follows: A) During the adversarial proceedings (contradictorio), it was argued that, with respect to that property, there were two documents granting possession of it to two different persons.
According to the document at folio 07 of the case file, dated 02 de febrero de 2007, possession belongs to co-defendant Nombre05 , whereas the document submitted by the victim is dated 20 de julio de 2007 (see folio 36), which demonstrates the existence of a dispute over possession that cannot be resolved in these proceedings and for which the parties would have to institute the corresponding proceeding to determine who is the lawful possessor of that property. An analysis of the documentary and testimonial evidence does not make it possible to determine with certainty which party has the superior right to an unregistered property where both parties claim to hold the right of possession. B) The judge relies on articles 140 and 367 of the procedural code, reflecting confusion between what is established as a provisional measure (medida provisional) (provided for in section 140 of the Procedural Code) and what constitutes a civil consequence (provided for as such in article 103 of the Criminal Code).
In the case of Nombre05, moreover, it would not even be possible to impose a measure such as the one described in the preceding article, because a judgment of acquittal is being entered. C) The challenged decision grants “ultra petitas” (sic) relief because, although the victim was duly notified of his right to join the proceedings as a civil claimant (actor civil), so that he could claim whatever damages he considered appropriate, he stated that he did not wish to appear as a private prosecutor (querellante). Consequently, the judge could not adjudicate purely civil matters that the victim had not claimed. D) The ruling is further evidence of the judge’s erroneous interpretation of section 140 of the Code of Criminal Procedure, because she applied, as a final measure or as part of the penalty imposed, a provisional measure that had not been requested by the victim either. ORAL HEARING (appellate hearing).
During the oral hearing held before this appellate court at 10:00 hours on 11 de octubre de 2017, the appellant further specified her complaints, stating essentially as follows: my client, Nombre05 , was acquitted; it was not proven that he had committed any criminal act; the judgment ordered restitution with respect to the civil consequences; the only defendant who owned property on the right bank of Río Peje was Nombre05, whose property bordered the victim’s property; the victim claimed to possess all the properties on the right bank of the river; however, the adversarial proceedings included a private document (see folio 7) granting possession to Nombre05 ; the judge states that restitution had to be ordered and that the transfer of possession to the victim (20 de julio de 2007) predates the transfer to Mr. Nombre05 (02 de febrero de 2007); there is a problem: who held the superior right?; both have a document; this dispute over possession was not discussed at trial; defendant Nombre05’s possession was not discredited; thus, despite the acquittal (which is now final), the judge ordered restitution of the properties on the right bank of the river, including Mr.
Nombre05’s property; this is ultra petita; the judge relies on article 140 of the CPP; this situation (a precautionary measure (medida cautelar) provided for in article 140 CPP) must be requested by the victim, but neither the victim nor the Public Prosecutor’s Office requested it; restitution likewise cannot be ordered as a civil consequence because, under article 103 of the Criminal Code, there must be a judgment of conviction, which does not exist here; the defendant is therefore harmed because, although it was established that he was not committing an act of disturbance, he is required to remove structures from the property; she requests that this portion of the judgment be vacated and that the superior right of possession be litigated in another forum (the transcription is not verbatim). PROSECUTOR. Regarding the appeal on behalf of co-defendant Nombre05 , appellate prosecutor Ana Yanci Umaña Moreira stated, in summary, that this defendant’s participation—namely, that he had engaged in the acts of disturbance—could not be established, but the superior right of possession was analyzed at folio 513; the judge analyzed the evidence regarding the transfer of possession and the acts of unlawful occupation (usurpación) (pursuant to subsection 3° of article 225 of the Criminal Code); the appeal on behalf of this defendant challenges the restitution, but the ruling does not constitute ultra petita because the judge was required to rule on the matter.
The objection is denied. The defense attorney’s argument that restitution cannot be ordered when the defendant is acquitted of the criminal charge and no civil action for damages has been brought is not novel, as this appellate court has already had occasion to rule on the issue and does not share that position. Thus, based on the express provisions of article 366 of the Code of Criminal Procedure (which postdates article 103 of the Criminal Code, cited by the appellant in support of her position), the case law has interpreted that, even where the judgment is one of acquittal as to the criminal matters, the judge is authorized to order—even sua sponte—the restitution of objects involved in the proceedings: “[…] The judgment contains an error regarding the legal basis for ordering the eviction (desalojo), because the provision authorizing that measure is not article 142 of the Code of Criminal Procedure, but article 366 thereof.
The latter expressly provides: ‘A judgment of acquittal shall order ... the restitution of objects involved in the proceedings that are not subject to forfeiture (comiso)....’ In this specific case, the Court found it proven that the land occupied by the defendants belongs to the State and is used by the Ministerio del Ambiente y Energía as part of the Proyecto de Ordenamiento Territorial Zona Núcleo del Refugio de Vida Silvestre Barra del Colorado. Neither mere possession nor a right of possession may be asserted over this land, insofar as it is outside commerce and is not subject to acquisitive prescription (art. 262 of the Civil Code and Sentencia 733-F-00, de las 15:12 horas del 4 de octubre del 2000, de la Sala Primera de la Corte Suprema de Justicia). Once ownership of the property and its designation for nature conservation were established, the legal consequence was the removal of the occupants, as ordered in the judgment […]” (see Tribunal de Casación del Segundo Circuito Judicial de San José, voto N° 2004-00933 de las 11:00 horas del 09 de setiembre de 2004).
Similarly, also on the basis of article 366 of the Code of Criminal Procedure, restitution of property to its prior condition has been deemed appropriate even when an acquittal is entered, where there is a violation involving the maritime-terrestrial zone (zona marítimo terrestre) (see Tribunal de Casación del Segundo Circuito Judicial de San José, votos 2004-0919 y 2004-0933). This solution has even been adopted in the case of a judgment of acquittal for the offense of unlawful occupation: “[…] if, according to the proven facts, the accused in this case is occupying a property that was possessed by another person, the proper course is to order restitution in the same judgment so as not to delay unnecessarily the victim’s return to the property. In this regard, in a 1992 ruling involving a proven act of unlawful occupation, our Sala de Casación stated as follows: ‘It must be acknowledged that, in cases such as this one, the optimal course is for restitution of possession to be ordered in the same judgment that convicts the defendant of the offense of unlawful occupation, so as not to delay unnecessarily the victim’s return to the de facto control through which the victim subjected the unlawfully occupied property to his control and will.
Nevertheless, if such an order is omitted from the judgment, nothing prevents a subsequent ruling—in execution of that conviction—from ordering the unlawful occupant to vacate the property so that the victim may take possession of it, as occurred in the case under review. It bears noting that this solution not only derives from the correct application and interpretation of the law, but is also required by the most elementary rules of common sense: it would be absurd for the defendant, relying on the judgment convicting him of the offense of unlawful occupation, to legitimize and maintain possession of the same property that he entered in a manner satisfying the elements of the offense, unlawful, and culpable.’ Sala Tercera de la Corte Suprema De Justicia, V-107-F, de las ocho horas cincuenta y cinco minutos del tres de abril de mil novecientos noventa y dos.- That ruling applies to the case at bar, not only because it recognizes the need to avoid a legal absurdity—which would arise from acquitting someone of unlawful occupation because that person mistakenly believed that he had the superior right to possess the property and obtain its lawful award, and then allowing him to remain in possession until the victim’s superior right of possession is established, even though she acquired the right to possess that property despite any evidentiary and transactional difficulties that may have existed.
The evidence presented, together with the defense attorney’s technical and legal arguments, supports the view of the trial judge and this Court that, in this case, the property must be vacated and that, if Ms. Nombre09. believes that her right should prevail, she must raise that claim in another forum, whether civil or agrarian, depending on the nature of the property and its use. In light of the foregoing, the order restoring the property to Ms. [Nombre08 006]. cannot even be construed as a penalty (whether criminal or civil), but rather as a natural and logical consequence of the evidence presented at trial. [...] Accordingly, notwithstanding the acquittal entered on the criminal charge, the trial judge was required to order that the holder of title to the disputed property be placed in possession of it because she had the superior right of possession. In this regard, it should be noted that, in most cases, the disputed property is held by the acquitted defendant; therefore, if it is established that title to the property belongs to a third party (as occurred here), it must be restored to that party.

Article 366, paragraph 1º, of the Code of Criminal Procedure establishes that the judgment, even when it is one of acquittal, shall order the restitution of objects involved in the proceedings that are not subject to forfeiture, without specifying that such restitution must be made in favor of any particular person. This therefore means that, for those purposes, the judge must determine who has the superior right to the object, even when that person is a third party.
Although this provision could be interpreted as referring not to immovable property (bienes inmuebles) but rather to mere “objects” (movable property (bienes muebles)), that interpretation must be rejected, not only because forfeiture (comiso) also applies to property (Article 465 of the Code of Criminal Procedure), but also because Article 140 ibidem establishes that, at any stage of the proceedings and at the request of the injured party, the judge may order, as a provisional measure, the restoration of things to the condition in which they were before the act. If the trial judge has this authority as a provisional measure, there is all the more reason why the judge may order it as definitive restitution (restitución definitiva) when rendering the judgment on the merits, once the ownership of the property held by a particular person has been determined. Moreover, it must be reiterated that the order restoring the immovable property to Ms. [Nombre08 006]. could not even be interpreted as a penalty (either criminal or civil), but rather as a natural and logical consequence arising from the evidence presented at trial, on the basis of which it was established that she acquired it in 1999 and has exercised possession (posesión) over it ever since.
In this regard, it is understood that the aforementioned first paragraph of Article 366, which requires the judge to issue the corresponding ruling on this point, establishes that such a decision is to be made sua sponte (oficiosa), since ordering restitution does not require, as a precondition, that the injured party have brought a civil action for damages (acción civil resarcitoria), nor that the party have asserted a direct and express claim in that respect. The fact that, even though it is unnecessary, the injured party files such an action (through which a “judgment” ordering restitution could be obtained, as provided in Article 464 of the Code of Criminal Procedure) in no way means that the civil action was necessary. For the foregoing reasons, the appeal is denied […]” (see judgment of the Criminal Cassation Court of the Second Judicial Circuit of San José N° 2006-1115 at 09:18 on 20 de octubre de 2016, which in turn cites and relies upon judgment of the Third Chamber of the Supreme Court of Justice N° 107-F-92 at 08:55 on 03 de abril de 1992).
Similarly, that is, for the proposition that restitution is available even where no civil action for damages has been brought, reference may also be made to judgments of the Third Chamber N° 1462-2004 and N° 604-F-91. In light of the foregoing, it must be clarified that an order of restitution may obviously be issued whenever that measure is materially possible, as would occur, for example, when movable property is in the custody of the court (see the situation governed by Article 367 of the Code of Criminal Procedure). Likewise, in the case of immovable property, restitution (where appropriate) will always be feasible, insofar as the judicial authority may appear at the relevant parcel of land and, through a formal act, place it in the possession of the person legally entitled thereto. Clearly, this option would not be possible in cases involving movable property that, because it has not been seized (secuestrado) or placed in provisional custody (depósito provisional), cannot be located or may no longer exist; in such a case, the appropriate subsidiary measure would be monetary compensation through an award of damages (daños y perjuicios).
This appellate body is not unaware that the position outlined above—to the effect that sua sponte restitution is available, in principle, even where a criminal acquittal has been entered and notwithstanding that the owner of the immovable property has not brought a civil action for damages—is not entirely settled in the national legal community. The scholar Javier Llobet Rodríguez, while acknowledging the existence of the aforementioned line of case law (based on the direct and express provision contained in Article 366 of the Code of Criminal Procedure), advocates the opposite interpretation: that the 1996 Code of Criminal Procedure follows a classical system under which (according to the author Llobet Rodríguez) restitution requires that a civil action for damages be brought: “ […] The courts have interpreted that restitution may be ordered even if no civil action for damages has been filed, without prejudice to restitution being the relief sought when such an action is filed (Thus: Third Chamber, judgment 1462-2004 of 22-12-2004).
On that basis, the case law has established that when a conviction for unlawful occupation (usurpación) is entered, restitution of the property must be ordered. Even in cases of acquittal, this has been allowed where the judgment was based on recognition of an error by the occupant that does not eliminate unlawfulness (antijuricidad). Article 140 of the C.P.P. establishes that provisional restoration of things to their prior condition may be ordered as a precautionary measure (medida cautelar). It is unclear what Article 361 subsection d) means when referring to restitution. The reference would appear to relate to the delivery of seized objects to the person having the superior right, pursuant to Articles 366 and 367 of the C.P.P. It should be borne in mind that Article 366 of the C.P.P. itself uses the term ‘restitution’ of objects connected with the proceedings. It must be considered that, under the 1996 C.Nombre09., the classical system of civil actions applies, such that the action must be brought by the person claiming to have suffered harm and may not proceed sua sponte.
In this regard, it should be noted that Article 37 of the C.P.P. establishes that the purpose of the civil action is the restitution of the object involved in the punishable act, as well as compensation for the damages caused. A fundamental aspect of the civil action is the restoration of things to their prior condition, such that compensation for damages is merely subsidiary. Nevertheless, the courts (see: Third Chamber, judgment 1272-2008 of 29-10-2008) have increasingly ordered, sua sponte, the restoration of things to their prior condition, which is inconsistent with the system followed by the Code. Article 102 of the 1970 Criminal Code is usually invoked for this purpose, but that provision is based on a positivist system of civil actions, under which restoration to the prior condition and the payment of damages must be ordered sua sponte. It has gone unnoticed that this system was repealed by the 1973 C.P.P., which was confirmed by the 1996 C.Nombre09.; far from adopting a positivist concept of civil actions, they established the need for a civil plaintiff (actor civil) to appear and seek restoration to the prior condition and any resulting payment of damages […]” [see Llobet Rodríguez Javier, “PROCESO PENAL COMENTADO (CÓDIGO PROCESAL PENAL COMENTADO),” Editora Dominza y Editorial Jurídica Continental, San José, 6ª edición, 2017; páginas 545 y 546].
Following the foregoing position, the Cassation Court of the Second Judicial Circuit of San José held (in a case in which the trial court entered a conviction for the offense of wrongful retention (retención indebida) of a sewing machine and ordered the restitution of that movable property even though it had not been seized or confiscated) that, if no civil action was brought and the property was not confiscated, restitution could not be ordered sua sponte: “ […] The defendant’s counsel filed an appeal on the merits (recurso por el fondo). Counsel states that the defendant was convicted as the perpetrator of the offense of misappropriation (apropiación indebida), but that the court exceeded the scope of its authority and ordered the defendant to return the Singer machine, with the warning that failure to do so would constitute the offense of disobedience of authority (desobediencia a la autoridad).
Counsel states that the injured party never brought a civil action. The appeal is granted. The judgment stated that ‘pursuant to Article 103 of the Criminal Code, this Court considers it necessary to nullify the effects produced by the criminal act committed by the defendant. Accordingly, Ms. [Nombre08 007]. is ordered to return to Ms. [Nombre08 008]. a white, motorized Singer-brand sewing machine, together with its corresponding table, in usable condition, just as it was lent to her, with the legal warning that criminal proceedings will be brought against her for the offense of disobedience if she fails to comply with this order. For this purpose, the defendant is granted a period of fifteen days after the time limit becomes final. Certainly, if it has been established in the case under review that the defendant’s possession of the property belonging to the injured party is the product of a criminal act, it is evident that the legal system could not permit the effects of that unlawful act to continue and persist over time.
Ultimately, determining that the criminal act occurred while allowing the defendant to remain in possession of the property that was the object of the offense would promote unjust enrichment (enriquecimiento sin causa). This Court therefore elects to nullify the effectiveness produced by the criminal act (not its legal efficacy, which can result only from a lawful act) by ordering the return provided for herein. In any event, at the beginning of her testimony, the injured party stated that her interest was in recovering the sewing machine lent to the defendant. Furthermore, pursuant to Article 140 of the Code of Criminal Procedure, the judge may, even as a precautionary measure, order that things be restored to the condition in which they were before the act. Therefore, if this may be ordered even as a provisional measure, the restoration of things to their prior condition stands on even firmer ground once the commission of the charged offense has been established’ […] In this respect, the trial court followed the positivist conception of the civil action, and it must be acknowledged that this conception does in fact underlie Article 103 of the Criminal Code, since it assumes that every punishable act gives rise to civil compensation, which must be determined when the judgment of conviction is rendered, and that such compensation must even be ordered sua sponte.
However, this position differs from the one underlying the Code of Criminal Procedure, which is the later law, because the latter followed, in principle, the classical conception of the civil action, requiring the injured party or the party’s heirs to submit their civil claim in the criminal proceedings (Arts. 37, 111 and 368 of the Code of Criminal Procedure) (Cf. Llobet Rodríguez, Javier. Proceso penal comentado. San José, Editorial Jurídica Continental, 2003, p.351). Article 367 of that Code contains an exception in this respect, since seized objects must be delivered to the person having the superior right to possess them, even if no civil claim has been filed. This situation, however, does not apply to this specific case, because the sewing machine in question has not been seized. The judgment refers to Article 140 of the Code of Criminal Procedure, insofar as it provides that, at any stage of the case and at the request of the injured party, the court may order, as a provisional measure, the restoration of things to the condition in which they were before the act, provided that there are sufficient grounds to decide the matter.
This provision has been particularly relevant to offenses involving unlawful occupation (Cf. Llobet Rodríguez, Javier, op. Cit., p. 194), in which restoration to the prior condition entails the removal, by use of law enforcement, of the person allegedly unlawfully occupying the immovable property. That provision may likewise justify the provisional return of a seized object. Those situations, however, differ from the present matter, in which it is not even known where the property misappropriated by the defendant is located.
If the position taken in the judgment were followed, then in every criminal case civil reparation would have to be ordered sua sponte (de oficio), including restitution of the property, reparation of the damage, and compensation for losses (Art. 122 del Código Penal de 1941). As stated, that was not the approach underlying criminal procedural legislation. Furthermore, if it were considered that the accused commits the offense of disobedience to authority (desobediencia a la autoridad) if she fails to return the sewing machine, the ne bis in idem principle would be violated, since she would be punished twice for the same act (Art. 11 del Código Procesal Penal y 8 inciso 4) de la Convención Americana de Derechos Humanos). The appeal on points of law (recurso de casación) is granted. The judgment is reversed insofar as it states that Ms. [Nombre08 007]. is ordered to return to Ms. [Nombre08 008]. a white, motorized Singer sewing machine, with its corresponding table, in usable condition, just as it was lent to her, under legal warning that criminal proceedings for the offense of disobedience will be brought against her if she fails to comply with the order […]” (cfr.
Tribunal de Casación del Segundo Circuito Judicial de San José, voto N° 2004-0541 de las 09:12 horas del 03 de junio de 2004). Although this ruling is correct in holding that restitution of movable property (bien mueble) that has not been seized (secuestrado) or impounded (decomisado) is unavailable—in which case the only remaining option, as an alternative remedy, would be an award of damages—it is incorrect in rejecting the possibility of restitution in cases where no civil action for damages (acción civil resarcitoria) was brought. The foregoing doctrinal position is weakly supported because it is based on a very broad interpretation of artículo 366 del Código Procesal Penal, under which, according to the author Llobet Rodríguez, “it would appear” that the reference in artículo 366 del Código Procesal Penal to objects connected with the proceedings that are not subject to forfeiture (comiso) concerns the delivery of seized objects to the person having the superior right to them.
Plainly, that interpretation is built upon the phrase “it would appear,” a concept that is not only tentative, imprecise, and wholly non-assertive, but also subjective, thereby entirely undermining its legitimacy. In this regard, it must be emphasized that, under the general principle of law according to which distinctions may not be drawn where the law draws none, the aforementioned artículo 366 does not state that the objects connected with the proceedings that are not subject to forfeiture consist of “seized objects” (that is, movable property, as interpreted and understood by the above-cited legal scholar), because a comprehensive analysis of that provision shows that it also refers to objects not subject to forfeiture, which would also include real property (bienes inmuebles) (cfr. artículo 489 del Código Procesal Penal). With all the foregoing established, it is necessary to set out the reasons why co-accused Nombre05 was acquitted of the offense of unlawful occupation (usurpación), as well as why, notwithstanding that acquittal, the trial judge considered it appropriate to order restitution of the property to the victim [Nombre08 001], given that this appellate court finds no error whatsoever in the grounds for that judicial decision.
The relevant findings are as follows: A) ACQUITTAL. Although the trial established that this person engaged in certain conduct that clearly interfered with the victim’s right of possession (derecho de posesión), the three specific, precise, and concrete acts attributed to him by the Ministerio Público in the factual account set forth in the prosecution’s charging instrument (requisitoria fiscal) were not proven with certainty. Accordingly, in observance of the principles of charging (imputación) and consistency between the charge and the judgment (correlación entre acusación y sentencia), the judge determined that an acquittal was required. Indeed, as reasoned in the judgment, the prosecution’s charge states that Nombre05 “[…] together with Nombre01 and Nombre02 , interfered with the victim [Nombre08 001]’s lawful possession of his properties, intending unlawfully to occupy and take ownership of them, by planting banana plants, bringing in cattle, and threatening the victim with machetes (act N.02); unlawfully occupied the property of [Nombre08 001] in order to prevent the victim from entering it (act N.05); and, lastly, together with the other two accused and for the purpose of unlawfully occupying the victim’s property, planted banana plants across the river from the properties of [Nombre08 001] and brought in twenty head of cattle […]” (cfr. sentencia, folio 508 frente, línea 3 en adelante).
The testimonial evidence presented at trial (declarations by [Nombre08 009], [Nombre08 001], [Nombre08 011] and [Nombre08 012]) established that, during an eviction proceeding (acción de desahucio) carried out in diciembre de 2011, the accused Nombre05 was removed from one of the farms whose possession is attributed to the victim [Nombre08 001]. This circumstance partially coincides with the account in the fifth point of the charge, since it was never established that he attempted to prevent the victim from entering, as alleged therein. Thus, the constituent acts of the offense of unlawful occupation—namely, planting bananas, bringing cattle onto the property, threatening the victim with machetes when he attempted to enter the land, and blocking his passage—are circumstances unsupported by the testimonial or documentary evidence. The defendant Nombre05 claims to hold a possessory right over the farm at issue in the dispute, but does not acknowledge having invaded it during the period covered by the charge.
Indeed, according to the complainant’s own testimony, the accused Nombre01 was seen on the farm on one occasion, when he was removed and “detained” by the administrative police; however, there is no statement suggesting that Nombre05 subsequently reentered the property and committed acts interfering with the victim’s possession. The accused cannot be blamed for invading the victim’s land when he was observed at the location only once and was never seen bringing in cattle or planting crops. Moreover, the sole occasion on which the victim saw him removing bananas from the farm does not establish with certainty that they came from a plantation established by the defendant himself, because the prosecution evidence ([Nombre08 009] and [Nombre08 014]) indicates that his father, the victim herein, also had crops on the farm; thus, this could even have constituted a possible theft, which was never charged.
RESTITUTION (cfr. folio 516, línea 20 en adelante). Regarding the order restoring the land to the victim, the judgment explains that the decision is based on artículos 140 y 367 del Código Procesal Penal because his lawful possession of the disputed lands was established. With regard to this issue—the victim’s lawful possession, against which neither the document nor the possession alleged by the acquitted defendant Nombre05 may be asserted—and in connection with the conviction entered against co-defendants Nombre01 and Nombre02 , the judgment provides an extensive and coherent analysis of the evidence (cfr. folio 510 frente, línea 29 en adelante), explaining the following: (i) Version of co-accused Nombre02 . When testifying at trial, the accused Nombre02 made no statement concerning the possessory right claimed by the victim; rather, he appeared to acknowledge that the victim had told him that he had purchased one of those properties (from don Nombre10), without claiming a superior right over them.
Likewise, his statements provide no justification for his assertion that the witnesses wished to harm him, because he never explains the reason or motive for that malicious intent. Thus, he describes no dispute with [Nombre08 001] over possession of the property at issue in this litigation, stating instead that he owns several farms in the same location (Los Laureles), but that none of them adjoins those of the complainant herein. This circumstance is also reflected in expert report (dictamen pericial) DCF: 2016-01530-ING de folios 467 al 470, which makes clear that there is no overlap among the survey plans for the victim’s and Nombre02 ’s farms. (ii) The victim explained when, how, and from whom he acquired each of the four parcels at issue in this litigation. In this regard, the judge reasons as follows: “[…] the victim [Nombre08 001] stated during the adversarial proceedings that his property consists of four farms, which together total 25 or 30 hectares; two have title deeds and two do not.
Of the four, he stated that three were purchased from Nombre11, but only one was registered in the name of Nombre11, another in the name of Nombre12 , and the last in the name of Nombre11’s brother, called Nombre13. The fourth property belonged to Nombre14. He stated that they were purchased in 1997, but that the transaction was not legally formalized by documents until 2006. He clarified that, of the three properties he purchased from Nombre11 (one belonging to Nombre11, one to Nombre12 , and the other to Nombre13), Nombre13’s property does have a deed, which is at the I.D.A; and that, although Nombre12 has died, his children undertook to execute the conveyance once ‘the probate proceeding’ is completed […]” (cfr. folio 511 frente, línea 16 en adelante). (iii) The witness Nombre11 , the seller of three of the four parcels, corroborated the victim’s account, and—in the trial court’s view—his testimony was credible: “[…] Don Nombre11 also testified and, through his testimony, confirmed the information provided at trial by the victim.
Nombre11 acknowledges having transacted for three parcels with the victim, located near the mouth of the Río Reventazón: one registered in his own name, another that he had purchased from a Black man who died, and another that his brother had given him in payment of a debt. He states that this ‘oral’ sale—that is, a verbal sale—occurred about fifteen years ago, but that the conveyance was executed approximately seven years ago. In describing the properties, he stated that the three adjoin one another, that they are divided by a railway line, and that nearly all of them are bounded by the Río Peje […] As for Nombre11, he is a person who does not even have any relationship with the accused; his role in the proceedings is that of seller of the farms whose possession is disputed herein. His legal capacity to transfer title or possession of those properties has not been undermined in any way, nor is there any evidence suggesting that the information provided is false or manipulated.
Rather, he is an impartial person in these proceedings who is not even related to the complainant and who merely recounted facts within his personal knowledge […]” (cfr. folio 511 frente, línea 26 en adelante). (iv) Documentary evidence (prueba documental). The judge also analyzes the documentary evidence, consisting of certified copies of deeds (testimonios de escrituras) included in the case file at folios 32, which establish the history of the owners who have held title to the parcels in question and from whom the victim acquired them. That information fully coincides with the explanations provided in that regard by the victim and the witness Nombre11 (cfr. folio 511 vuelto, línea 27 en adelante).
On that basis, the following history of the four parcels is corroborated: (iv.a.) on 12 de setiembre de 1986, the IDA transferred a first tract of land to Nombre15, from whom Mr. Nombre11 acquired it (as he himself stated), subsequently selling it verbally and informally (“by word of mouth” or “on his word”) to the victim [Nombre08 001], although that property still appears registered under the name of Nombre08 of said witness; (iv.b.) on 25 de junio de 1988, the Instituto de Desarrollo Agrario subdivided (segrega) lot twenty-nine of the Neguev project in favor of Nombre10, who formally sold it to [Nombre08 001] on 09 de junio de 2008, as evidenced by the deed contained at folio 150 and the registry certification at folio 142 of the main case file; (iv.c.) regarding the property that, according to Nombre11, was purchased from his brother Nombre16, it follows from the testimony of Nombre17 and Nombre11 that, years after the sale had been made verbally, Nombre11 himself suggested that the victim seek out his brother Nombre13, better known as Nombre16, so that he could execute the deed of transfer, which was done on veinte de julio de 2007; that property, in turn, had been acquired through a purchase and sale from Mr.
Nombre18 on 26 de julio de 1983; (iv.d.) lastly, the property known as Dirección02, which appears registered under the name of Nombre08 of Nombre19 (see folios 169 through 180), was verbally sold by that registered owner to Filadelfo, according to the latter’s testimony; at that time, only a type of receipt was provided as proof of the transaction, and years later Nombre11 made the same type of sale (verbal) to [Nombre08 001]. With regard to this fourth tract of land, the judgment explains that the aggrieved party “[…] has acknowledged that he is in discussions with the heirs of Nombre19 in order to proceed with the transfer of the aforementioned property in the Registro Público […]” (cf. front of folio 512). Based on the foregoing, the trial judge was able not only to reconstruct the history of the owners who held title to the four properties until they were acquired by the complainant, given that those “word-of-mouth” or “on one’s word” transactions (verbal and informal) were not documented until years later, but also to determine that “[…] the properties described, although some are under the name of Nombre08 of the victim and others are not, form part of a single property (because they are adjoining), over which the victim [Nombre08 001] has exercised peaceful and public possession (posesión) from the very moment he acquired them from their owners or possessors […]” (cf. reverse of folio 512, lines 1 to 4).
(v) The victim’s exercise of possession in a lawful, peaceful, continuous, and public manner was also established through the statements of the prosecution witnesses [Nombre08 009] and [Nombre08 014], both of whom are his daughters. (vi) The defense witnesses [Nombre08 017] and [Nombre08 012] stated that the aggrieved party owns property adjoining the Peje River. (vii) The co-defendant Nombre01 made no statement whatsoever. (viii) The documents admitted as defense evidence and contained at folios 331 through 356 of the case record in no way disprove the victim [Nombre08 001]’s possession of the properties; rather, they are evidence that was also admitted as prosecution evidence, namely registry certifications and surveys establishing the victim’s registered ownership of two of the properties, as well as cadastral surveys (planos catastrados) illustrating the location of each property and corroborating the statements of the victim and the witnesses that those properties adjoin one another and may be regarded as a single property, because possession has been exercised over them as such.
It is against this entire background that the trial judge not only established the lawful dominion (dominio) that the victim had exercised over the land since 1997, but, on the basis of those factual and legal grounds, also correctly and soundly concluded that the copy of a private purchase-and-sale agreement submitted by co-defendant Nombre05 (on the basis of which he alleges that he is the person occupying the property) is not enforceable against the aggrieved party, who has the superior right to possess it because he had held the land for a much longer period, including long before the document at folio 36 was prepared; consequently, the appellant’s argument that the private bill of sale submitted by co-defendant Nombre05 bears a date several months earlier is unpersuasive. The subjective and biased nature of the public defender’s claim is evident, as she asserts that an analysis of the documentary and testimonial evidence does not make it possible to determine with certainty which party has the superior right to an unregistered property.
To the contrary, and as explained supra, the judgment assesses the documentary and testimonial evidence presented at trial in a manner that makes it possible to understand not only when and how the victim acquired the property claimed by the accused, but also that he had possessed it as owner, lawfully, peacefully, and publicly, since 1997. Indeed, as explained above, it is one of the four parcels, specifically the one that belonged to Mr. Nombre18 , who transferred it through a purchase and sale dated 26 de julio de 1983 to Mr. Nombre16 , also known as Nombre13; the latter verbally transferred it to his brother Nombre11 in payment of a preexisting debt; likewise, in 1997 Nombre11 sold it to Mr. [Nombre 001], although it was not until 20 de julio de 2007 that, at the suggestion of Mr. Nombre11 himself, the private document at folio 36 was prepared, whereby Nombre16 (also known as Nombre13) sold it to the victim [Nombre08 001].
This renders the appellant’s objection unfounded because, contrary to her assertion, evidence did exist and was duly analyzed, making it possible to establish with certainty the lawful and superior possessory right (derecho de posesión) held by Mr. [Nombre08 001] over this land; moreover, the accused entered the property long after the former had begun exercising dominion over it: “[…] There is no indication whatsoever suggesting the existence of a superior right over the properties, not even on the part of Nombre05, who stated that he was occupying the property and submitted a copy of a private purchase-and-sale agreement (folio 07). Upon analysis, it is clear that the victim has the superior right in light of the property’s history, insofar as the transfer of possession, both formally and in fact, occurred long before the accused Nombre01 was placed on one of the lots belonging to the victim.
Indeed, the victim, whose testimony is deemed credible for the reasons stated at the beginning of this section of the judgment, reported that, even though authorization had been granted for Nombre01 to work on the property, when an attempt was made to evict him from it, two days after an administrative eviction (desalojo administrativo) had taken place on the properties, Nombre05 was found there, having unlawfully entered the property with his family, because possession already belonged to the aggrieved party […]” (cf. front of folio 513). This appellate court does find it noteworthy that, although he stated at trial that he had purchased the right of possession over the land from his brother Nombre20 , co-defendant Nombre05 could not even explain how his brother had acquired it (cf. reverse of folio 499), which demonstrates the weakness and insufficiency of the title he presents and on which he bases his claim of entitlement to occupy the parcel. Based on the foregoing, the claim is denied.
Appeal filed by attorney Giovanni Herrera Alvarado, public defender for co-defendant Nombre01 (cf. folios 519 to 523).
II.FIRST GROUND (procedural): Disagreement with the assessment of the evidence (valoración de la prueba). In the first ground of his appeal, the public defender disputes the finding that the injured party is the lawful possessor (legítimo poseedor) of the properties (an essential element of the criminal offense), since that circumstance does not follow from a comprehensive and joint analysis of all the evidence presented; therefore, that conclusion is entirely unfounded. The challenge is denied. The issue questioned by defense counsel—that is, the trial court judgment’s reasoning concerning the status of the injured party [Nombre08 001] as lawful possessor of the four parcels at issue—was extensively and sufficiently analyzed in the preceding recital (considerando), which explains why no error or deficiency is found in the challenged judgment. Accordingly, the appellant herein must refer to what is stated there. The claim is denied.
III.SECOND GROUND (procedural): Violation of the principles of charging specificity (imputación) and congruence (congruencia). In this second section, the public defender raises the following claims: A) The principles of charging specificity and congruence were violated. Alleged fact 2 serves as a preamble to the specific, precise, and detailed facts that the prosecution’s charging instrument (requisitoria fiscal) describes immediately thereafter (in item 4), around which the defense defined and “centered” its strategy. Nevertheless, proven fact 2 contains no charge, since it is merely a description of the criminal offense of usurpation (usurpación), and it is evident that the judge omitted the phrase “Es así como” appearing between the second and third alleged facts. That phrase is not only an element that gives coherence to and connects the alleged facts, but also clarifies the defense’s argument.
Nor does the fact delimit the charged actions temporally or specify any of their other circumstances, such as the portion of the properties where crops were planted or the number and type of livestock introduced. B) The principle of congruence was violated because the acquitted co-defendant was acquitted due to the charging instrument’s lack of specificity. The claim is denied. No defect is apparent in the situation reported by the appellant, since the omission from the statement of proven facts of the phrase “Es así como,” which begins section 3 of the charging instrument, does not in any way alter the factual framework found to have been established, nor does it violate the principles of charging specificity and congruence. The judgment shows that the prosecution’s charge states the following: “[…] 1.- The injured party herein, [Nombre08 001], has been the owner and lawful possessor, since approximately the year two thousand seven and through the present date, of several properties that adjoin one another and have an approximate area of forty-one hectares, which are located in [...] and adjoin properties belonging to other neighboring owners. 2.- Since the date trece de diciembre de dos mil once, the injured party [Nombre08 001] has been disturbed in his lawful, current, peaceful, and public possession of his properties by defendants Nombre05 , Nombre01, and Nombre02 , who, with the intent to usurp and unlawfully take possession of the injured party’s properties, enter the property to plant plantain plants, bring livestock onto the property, and, when the injured party attempts to enter his properties, the accused, for the aforementioned purpose, threaten him with machetes, telling him that if he enters the property they will attack him with machetes, and tell him that those properties do not belong to him. 3.- Es así como on the date doce de diciembre de dos mil doce, after filing a request for administrative eviction (desalojo administrativo) with the Ministerio de Seguridad Pública, which was granted by resolution 2506-11-DM, the injured party [Nombre08 001] was placed in possession of his property at 13:30 hours, and on that occasion Mr.
Nombre21, who was on the property under orders from defendant Nombre01 to exercise unlawful acts of possession, was removed. 4.- On the date 23 de enero de 2012, at 10:55 hours, the injured party [Nombre08 001] arrived, accompanied by other persons, at his property located at the place previously indicated in item 1, and saw defendant Nombre01 inside his property. The injured party therefore told him to stop taking possession of his property, to which the defendant replied that he would enter as often as he pleased, that he was going to take the property from him, and threatened to kill him. He also lunged at him with a machete in hand and swung the machete at him twice from a distance of a meter and a half, whereupon the injured party stepped backward and dodged the blows, after which the defendant left the location [...] 6.- On the date 11 de febrero de 2012, at 10:00 hours, the injured party [Nombre08 001] was accompanied by several persons and was heading toward his property, located at the address previously indicated in item 1.
Defendants Nombre02 and Nombre01 were on the property and, with the intent to disturb the injured party’s lawful right of possession over his property, told him that if he entered the property they would beat him and attack him with a machete. The injured party therefore called the Fuerza Pública, whose officers came to the location and issued a police report to the defendants. 7.- On the date 28 de octubre de dos mil trece, the injured party went to his property, located at the address previously indicated in item 1, and confirmed that, for the purpose of usurping his entire property, the defendants had planted plantain plants on his property, specifically on the other side of the river, and had also brought in approximately 20 head of cattle. This was corroborated by the Organismo de Investigación Judicial during an inspection conducted on 16 de noviembre de 2013, in which the plantain crop and livestock could clearly be seen […]” (cf. folios 496 and 497; transcribed verbatim).
Of this entire alleged factual framework, only the following facts were found to have been fully established: “[…] PROVEN FACTS: The following facts are found to have been proven: 1.- The injured party herein, [Nombre08 001], has been the lawful possessor, since approximately the year two thousand seven and through the present date, of several properties that adjoin one another and have an approximate area of forty-one hectares, which are located in [...] and adjoin properties belonging to other neighboring owners. 2.- Since the date trece de diciembre de dos mil once, the injured party [Nombre08 001] has been disturbed in his lawful, current, peaceful, and public possession of his properties by defendants Nombre01 and Nombre02 , who, with the intent to usurp and unlawfully take possession of the injured party’s properties, enter the injured party’s property and, when he attempts to enter his properties, the accused, for the aforementioned purpose, threaten him with machetes, telling him that if he enters the property they will attack him with machetes, and tell him that those properties do not belong to him. 3.- On the date doce de diciembre de dos mil doce, after filing a request for administrative eviction with the Ministerio de Seguridad Pública, which was granted by resolution 2506-11-DM, the injured party [Nombre08 001] was placed in possession of his property at 13:30 hours, and on that occasion Mr.
Nombre21 was removed. 4.- On the date 11 de febrero de 2012, at 10:00 hours, the injured party [Nombre08 001] was accompanied by several persons and was heading toward his property, located at the address previously indicated in item 1. Defendants Nombre02 and Nombre01 were on the property and, with the intent to disturb the injured party’s lawful right of possession over his property, told him that if he entered the property they would beat him and attack him with a machete. The injured party therefore called the Fuerza Pública, whose officers came to the location and issued a police report to the defendants […]” (cf. reverse side of folio 497, line 25 onward; transcribed verbatim). As can be seen, with respect to the established facts supporting co-defendant Nombre01’s criminal liability (responsabilidad penal), the court found proven what is described in item 2) of the prosecution’s charging instrument (except as it relates to co-defendant Nombre05 ), as well as what is stated in item 6) of that instrument.
This is not only sufficient to support the conviction entered against him, but also does not in any way alter—to the detriment of the rights of the defense—the essence of the charge. In this regard, it is apparent that, in structuring his appellate argument, defense counsel overlooks the fact that the court found proven not only the account set forth in item 2) of the charging instrument (subject to the exception noted above), but also the specific, concrete, and fully detailed fact, in both time and place, described in item 6) of that prosecution charge. Counsel therefore fails to demonstrate how the ability to present a defense at trial was affected. Thus, although it is true that alleged fact number 2 is included merely as a “preamble,” omitting the phrase whose absence counsel objects to does not in any way undermine coherence. Based on the foregoing, this second ground of appeal is also denied.
Appeal filed by attorney Argerie López Pérez, public defender for co-defendant Nombre02 (cf. folios 530 to 535).
IV.FIRST GROUND (procedural): Disagreement with the assessment of the evidence (valoración probatoria). In the first ground of her appeal, the public defender for co-defendant Nombre02 objects to the assessment of the evidence for the following reasons: A) By adopting “part” of the arguments of the Public Prosecutor’s Office, the trial judge discredits the defense’s arguments and grants full credibility to the prosecution evidence (prueba de cargo), even though the adversarial proceedings (contradictorio) revealed “[…] many aspects that gave rise to reasonable doubts that, in the case of my client, he did not participate in the acts of which he was accused […]” (see folio 532; transcription is verbatim). B) How can the judge say that it was thanks to defense counsel (defensa técnica) that she reached a guilty verdict against the defendants, when the defense endeavored to demonstrate that “the matters” alleged were not actually proven, either in the accusation or at trial, as the Public Prosecutor’s Office claimed; for example, that it was not proven that the properties belonged to the victim, as he alleged; and that, on the contrary, there was reasonable doubt as to “who held” possession (posesión) of those lands.
The objection is denied. The appellant fails to demonstrate—or even identify—what those “many aspects” are that, according to her personal view, would have raised reasonable doubts regarding co-defendant Nombre02’s participation in the acts of which he was accused; what supposed doubts arise when the testimonial evidence (prueba testimonial) is compared with the documentary evidence; or how or why the police reports demonstrate a situation different from the one found to have been proven. Moreover, as was stated in the second recital (considerando) of this decision when the first ground of the appeal filed by the public defender for co-defendant Nombre01 was denied, the appellant must refer to the analysis in the first recital, which summarized the extensive and coherent reasoning provided by the trial judge in concluding that the victim is the lawful titleholder and actual possessor of the disputed tracts (fundos).
Furthermore, after reviewing the judgment in its entirety, this appellate body does not find that the judge held defense counsel responsible for the guilty verdict entered against the defendant herein, as the appellant asserts. The fact that defendant Nombre02 submitted documents establishing his title to other properties is wholly irrelevant to the decision on the merits of this case, because what he was accused of, and what was found to have been proven, is that, jointly and in agreement with co-defendant Nombre01, he interfered with the victim’s possession of the latter’s parcels. Moreover, no error or arbitrariness can be found in the judge’s analysis explaining why she gave no credence whatsoever to the defense account provided at trial by Mr. Nombre02. Although he stated that the prosecution witnesses wanted to harm him—the sole basis for rejecting the charges arising against him from the account they gave at trial—he could not even specify or provide any reason that would make this alleged ill will understandable or explainable: “[…] the statement given at trial by Nombre02, in his capacity as defendant, is analyzed.
He denied the acts and stated that he does not own any property adjoining those of [Nombre08 001]; that the victim had even told him that he had negotiated the purchase of a property with Mr. Nombre10; that it is the victim who harasses him by opening the gates so that his cattle escape; and that the conflict exists because the victim, [Nombre08 001], is bothered by his friendship with Nombre01. He also states that the prosecution witnesses merely want to harm him. An analysis of his statement reveals no assertion regarding the right of possession (derecho de posesión) claimed by the aggrieved party; rather, he appears to acknowledge that the victim himself had told him that he had purchased one of those properties, without the defendant claiming a superior right to them. He states that the witnesses want to harm him, but does not indicate the reason or in any way explain why there is hostility toward the aggrieved party […] There is no support for defendant Nombre02’s statements that the witnesses want to harm him, because he never explains the reason or motive for that malicious intent […]” (see folio 511, recto and verso; transcription is verbatim).
In addition, the judge also explained the reasons why, based on the immediacy (inmediación) afforded by the trial, she granted full credibility to the prosecution accounts provided by the testimonial evidence offered by the Public Prosecutor’s Office. Not even a possible motive was identified for the witnesses to give a false account or unjustly harm the defendants, and their accounts were fully consistent with the documentary evidence (see deeds and certifications added at folios 32, 142, 150, 161, 169 to 180, and 331 to 356): “[…] Both testimonies are credible in the opinion of the deciding judge. Although Mr. [Nombre08 001] has a special interest in the outcome of this case because he is the direct victim, this does not mean that his interest is illegitimate or that it led him to file a complaint concerning false acts or manipulate the information provided at trial. On the contrary, the acts he described at trial are consistent in their essential aspects with the documentary and expert evidence (prueba pericial) admitted into the record because, as will be explained, the right of possession that he claims is supported by the documentary and expert evidence admitted.
In addition, he provided a coherent, clear, and detailed account, free from any contradiction or intent to exaggerate the acts he endured, limiting himself instead to describing what, in his view, each defendant had done and acknowledging on occasion that at least one of them had not participated in preventing access to his property (Nombre05), which renders his testimony worthy of belief. There is no indication of any prior events giving rise to a conflict between the parties—whether familial, romantic, employment-related, or otherwise—apart from the matter before us concerning the right of possession and the acts of interference (actos perturbatorios) attributed to the defendants […] As for Nombre11, he is a person who does not even have any relationship with the defendants. His role in the proceedings is that of seller of the tracts whose possession is disputed here. His legal authority (legitimación) to transfer title or possession of those properties has not been called into question in any way, nor is there any evidence suggesting that the information provided was false or manipulated.
Rather, he is an impartial person in the proceedings who is not even related to the complainant and who merely recounted what he knew firsthand […] Although [Nombre08 014] and [Nombre08 009] are the victim’s daughters, the deciding judge does not regard them as accommodating witnesses. On the contrary, their statements are deemed worthy of belief because, although their interest is directly related to their father’s welfare, that alone does not mean that their statements at trial resulted from a plan involving lies, exaggeration, or manipulation of the information provided. There is not a single piece of evidence objectively suggesting that either of them made false statements; rather, they recounted only what they could remember. Their accounts did not appear memorized or rehearsed; instead, their verbal and nonverbal language was entirely spontaneous. Particularly in the case of [Nombre08 009], this judge observed lingering effects of harm extending beyond a mere land dispute, as her crying and gestures clearly described what occurred on one of the occasions involving an almost physical confrontation by the two defendants, Nombre01 and Nombre02, against the victim and the daughters themselves.
Thus, [Nombre08 014], [Nombre08 009], and the victim Nombre17 agree on the essential aspects of the sixth act in the accusation, which describes an act interfering with the victim’s lawful right of possession over his properties […]” (see folio 512 verso, line 3 onward; transcription is verbatim). Accordingly, all objections included in this first ground of appeal are denied.
Violation of the principle of continuity (principio de continuidad) in issuing the operative portion (parte dispositiva). Defense counsel (defensora) complains that, for purposes of issuing the operative portion, the judge scheduled 07:15 hours on 18 de julio de 2017. In response, the appellant (recurrente) informed the judge that she (defense counsel) is entitled to a breastfeeding hour (hora de la lactancia) and therefore begins work at 08:00 hours; despite this, the judge stated that the proceeding (diligencia) would remain scheduled for that time and did, in fact, commence it then. At 08:00 hours that day, the appellant appeared before the court to learn of the decision, whereupon the court assistant informed her that all parties who had appeared had already left (including the accused (imputado), Nombre02). The latter told the appellant attorney that he had appeared at approximately 07:30 hours and that, by then, the judge had already notified the operative portion and left; that the court assistant told him that he had been sentenced to 6 months; that the full judgment (sentencia) would be available on 26 de julio; that, during the continuation of the trial (debate), he had understood that the (reading of the) operative portion was scheduled for 07:30 hours; and that at “that” time only the co-accused (coimputado), Nombre05, was present.
Based on the foregoing, Ms. López Pérez asserts that the violation of due process (debido proceso) is more than evident; that the issuance of the operative portion is an essential part of the adversarial proceedings (contradictorio); that “[…] it is no secret to anyone that attendance is mandatory […]” (cf. folio 534); that the judge could have allowed a reasonable amount of time for the accused persons “who were missing,” and if they had not appeared within a reasonable period, the next step would have been to order their arrest (which would not have been necessary, because both appeared at 07:30 hours); that the judge decided to issue the operative portion despite the absence of legal defense counsel (defensa técnica), even though there was good cause (justa causa) for that absence; and that due process was also violated when the operative portion was issued in the complete absence of the accused, because missing the portion in which the judge resolved the dispute and explained why she had decided to convict him created in the defendant (encartado) a genuine sense of injustice.
The claims are denied. Defense counsel fails to demonstrate what prejudice was caused to the defendant by the fact that this legal professional was not present when the operative portion was issued, or by the fact that the accused arrived late for that proceeding (due to an error attributable solely to him), it being clear that by that procedural stage the adversarial proceedings had concluded and that, during that stage, the defense (both legal and personal (técnica y material)) could only perform the passive role of listening to the judicial decision adopted, together with a brief summary of the reasons supporting it. That decision, as well as its complete and final reasoning, appears in writing in the judgment document prepared subsequently, to which the defendant and his defense counsel had full access, to such an extent that both were able to learn its contents and challenge it, as they in fact did.
Moreover, what occurred on that occasion was even recorded on video (cf. certification at folio 495 vuelto), which—had they been interested—the parties could have obtained and played back, with the same result as if they had been present. Based on the foregoing, the objection is denied.
POR TANTO:
The three appeals filed by the public defenders of the accused persons are denied. Resolución: 20 18-0095 Resolución: 20 18-0095 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL . Segundo Circuito Judicial de San José. Goicoechea, a l ser las nueve horas cuarenta y cuatro minutos, del treinta de enero de dos mil dieci ocho .- RECURSO S DE APELACIÓN interpuesto s en la presente causa seguida contra Nombre01 , mayor, costarricense, cédula de identidad número CED01 , nacido en Guanacaste, el 25 de febrero de 1946, hijo de Nombre01 , soltero, de oficio pensionado , vecino de Limón, Siquirres, Los Laureles de la Pulpería Evangélica un kilometro al norte después del puente del ICE, un rancho ; Nombre02 , mayor, costarricense, cédula de identidad número CED02 , nacido en Guanacaste, el 20 de agosto de 1971, hijo de Nombre03 y Nombre04 , soltero, de oficio operario de bananera , vecino de Limón, Siquirres, asentamiento Los Laureles, Dirección01 ; Nombre05 , mayor, costarricense, cédula de identidad número CED03 , nacido en Guanacaste, el 30 de setiembre de 1980, hijo de Nombre06 y Nombre07 , soltero, de oficio agricultor , vecino de Limón, Siquirres, el Peje, los Laureles, de la Iglesia cuadrangular de Los Laureles, 600 metros al oeste, casa color natural ; por el delito de USURPACIÓN en perjuicio de [Nombre08 001] .
Intervienen en la decisión del recurso, el juez Mario Alberto Porras Villalta y las co-juezas Patricia Vargas González y Laura Murillo Mora . Se apersonaron en esta sede el licenciado Giovanni Herrera Alvarado, defensor público del encartado Nombre01; la licenciada Dennia López Vargas defensora pública del imputado Nombre05 ; la licenciada Argerie López Pérez defensora pública del encartado Nombre02 y el licenciado Allan Ramírez Villalobos, representante de la Fiscalía de Siquirres .
RESULTANDO:
I.Que mediante sentencia número 109 -20 17 , de las siete horas quince minutos del dieciocho de julio de dos mil diecisiete , el Tribunal Penal de Juicio del Segundo Circuito Judicial de la Zona Atlántica, Sede Siquirres , resolvió: " POR TANTO: De conformidad con lo expuesto y con los artículos 39 y 41 de la Constitución Política, 8 de la Convención Americana sobre Derechos Humanos; 14 del Pacto Internacional de Derechos Civiles y Políticos; 26 de la declaración Americana de Derechos y Deberes del Hombre; 10 y 11 de la Declaración Universal de Derechos Humanos; 1, 30, 31, 71, 73, 225 inciso 03 del Código Penal; numerales 1 a 6, 9, 12, 13, 140, 141 y 142, 175 al 179, 184, 265, 303, 328, 330, 333, 335, 351, 352, 363 a 367 del Código Procesal Penal, por unanimidad se resuelve: A. Se rechaza la actividad procesal defectuosa incoada por la defensa técnica. B. Se absuelve de toda pena y responsabilidad a Nombre05 de un delito de Usurpación acusado como cometido en daño de [Nombre08 001].
C. Se absuelve de toda pena y responsabilidad a Nombre01 por un delito de Agresión con Arma acusado como cometido en daño de [Nombre08 001]. D . Se declara a Nombre01 Y Nombre02 , autores responsables de UN DELITO DE USURPACIÓN en daño de [Nombre08 001] , y en ese carácter se les impone una pena de SEIS MESES DE PRISIÓN pena que deberán descontar en el lugar y forma que indiquen los respectivos reglamentos penitenciarios, previo abono de la preventiva sufrida. Por cumplir con los presupuestos legales se les otorga el beneficio de ejecución condicional de la pena por el plazo de tres años, bajo el apercibimiento de no cometer delito doloso sancionado con pena de prisión mayor a seis meses. E. Se ordena la restitución de las cosas a su estado anterior, para lo cual se autoriza la ejecución por medio de las autoridades policiales que correspondan, de los actos necesarios para la destrucción de las edificaciones y sembradíos que se encuentren ubicados en las fincas cuya posesión corresponde al ofendido [Nombre08 001] y que están ubicadas en: [...], fincas representadas por los planos catastrados N. [Valor 001], [Valor 002], [Valor 003] y [Valor 004]; asimismo, con la colaboración de la Fuerza Pública, se ordena a SENASA proceda a realizar una inspección en los fundos indicados para examinar la permanencia de semovientes en el lugar, y en caso de que no corresponda su devolución (a quien demuestre ser su dueño) proceda al decomiso y disposición de los animales, conforme la ley y sus competencias lo dispongan.
Se resuelve sin especial condenatoria en costas, son los gastos del proceso a cargo del Estado. Una vez firme esta sentencia hágase la respectiva comunicación al Registro Judicial. Para la lectura integral de la sentencia, se señalan las dieciséis horas del veintiséis de julio del dos. " (sic).
II.Que contra el anterior pronunciamiento, el licenciado Giovanni Herrera Alvarado, defensor público del encartado Nombre01, la licenciada Dennia López Vargas defensora pública del imputado Nombre05 y la licenciada Argerie López Pérez defensora pública del encartado Nombre02 , interpusieron recurso de apelación.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta el juez de Apelación de Sentencia Penal Porras Villalta ; y, Recurso de apelación de la licenciada Dennia López Vargas, defensora pública del coimputado Nombre05 (cfr. folios 524 a 529) .
Error al disponerse la restitución de la finca [Valor 001] al ofendido. En el único motivo de su recurso, la defensora pública denuncia “[…] una errónea fundamentación intelectiva en cuanto a la aplicación de la ley sustantiva y procesal respecto a las consecuencia civiles del hecho punible […]” (cfr. folio 524), concretamente al haberse ordenado la restitución de la propiedad del encartado Nombre05 (la finca [Valor 001]) al ofendido. La recurrente se muestra inconforme con que en sentencia se haya dispuesto dicha medida (la cual –asegura‒ es una consecuencia civil del hecho punible) pese a que se dictó una absolutoria a favor del encartado Nombre05 y a que el ofendido no ejerció la acción civil resarcitoria. En sustento de su queja, argumenta lo siguiente: A) Durante el contradictorio se debatió que, con respecto a dicha finca, existían dos documentos en los cuales se otorgaba la posesión de la misma a dos personas distintas.
Según el documento de folio 07 del expediente, fechado 02 de febrero de 2007, la posesión corresponde al coimputado Nombre05 , mientras que el aportado por el ofendido está fechado 20 de julio de 2007 (cfr. folio 36), lo que evidencia un problema de posesión que no puede ser resuelto en esta sede, y que tendrían las partes que interponer el proceso correspondiente para determinar quién es el legítimo poseedor de dicha finca. Del análisis de la prueba, tanto documental como testimonial, no puede tenerse certeza de cuál de las partes tiene un mejor derecho sobre una finca que se encuentra sin inscribir, donde ambas partes indican tener el derecho de posesión. B) La jueza se fundamenta en lo dispuesto en los artículos 140 y 367 del código de rito, en lo cual existe una confusión respecto de lo que se establece como una medida provisional (prevista en el numeral 140 del Código Procesal) y lo que es una consecuencia civil (prevista así en el artículo 103 del Código Penal).
En el caso de Nombre05, incluso, no cabría la posibilidad de imponer una medida como la descrita en el artículo anterior, pues se está dictando una sentencia absolutoria. C) La resolución que se impugna incurre en “ultra petitas” (sic), pues, pese a que el ofendido fue debidamente notificado de su derecho a constituirse como actor civil, para así poder reclamar los daños que considerara pertinentes, indicó que no deseaba contituirse en querellante. Por ello, no podía entrar la juzgadora a resolver aspectos meramente civiles que no habían sido reclamados por aquel. D) Lo decidido no es más que una prueba de la errónea interpretación de la juzgadora en cuanto a lo dispuesto en el numeral 140 del Código Procesal Penal, al aplicar como medida definitiva o como parte de la sanción impuesta, una medida provisional que tampoco fue solicitada por la parte ofendida. AUDIENCIA ORAL (vista de apelación).
Durante la audiencia oral celebrada ante este tribunal de apelación a las 10:00 horas del 11 de octubre de 2017, la impugnante precisó un poco más sus reclamos, pues señaló (en esencia) lo siguiente: se absolvió a mi representado Nombre05 ; no se demostró que exista alguna acción (delictiva) suya; el fallo se dispuso, en cuanto a consecuencias civiles, la restitución; el único imputado que tenía propiedad al margen derecho del Río Peje era Nombre05, la cual colindaba con la propiedad del ofendido; el ofendido decía que todas las propiedades al margen derecho del río estaban en posesión suya; pero en el contradictorio hay un documento privado (cfr. folio 7) donde se le da la posesión a Nombre05 ; la jueza indica que debía darse la restitución, y que el traslado de la posesión del ofendido (20 de julio de 2007) es anterior al del señor Nombre05 (02 de febrero de 2007); existe un problema: ¿cuál tenía el mejor derecho?; ambos tienen un documento; este problema de posesión no fue discutido en el debate; no se desacreditó la posesión del imputado Nombre05; así, pese a la absolutoria (ya firme), la jueza establece la restitución de las propiedades al margen derecho del río, incluso la del señor Nombre05; esto es una ultra petita; la jueza se funda en el artículo 140 del CPP; esta situación (medida cautelar prevista por el artículo 140 CPP) debe ser a solicitud del ofendido, pero ni éste ni el Ministerio Público la solicitaron; como consecuencia civil, tampoco puede ordenarse la restitución, pues (conforme el artículo 103 del Código Penal) debe existir sentencia condenatoria, la cual no existe; se le causa así un agravio al imputado, pues pese a que se acreditó que no está realizando un acto perturbatorio, se le obliga que quite construcciones sobre la propiedad; solicita que se anule ese extremo de la sentencia y el mejor derecho de posesión se discuta en otra vía (la transcripción no es literal).
FISCAL. Respecto del recurso a favor del coimputado Nombre05 , la fiscal de impugnaciones, licenciada Ana Yanci Umaña Moreira, indicó (en resumen) que a este encartado no se le pudo demostrar su participación, esto es, que actuara en los actos perturbatorios, pero a folio 513 sí se analizó el mejor derecho de posesión; la jueza hizo un análisis de las pruebas sobre traslado de posesión y los actos de usurpación (conforme al inciso 3° del artículo 225 del Código Penal); en el recurso a favor de este imputado se plantea una inconformidad con la restitución, pero lo resuelto no constituye una ultra petita, ya que la jueza debía resolver. Sin lugar el reparo. El cuestionamiento que plantea la abogada defensora, al argumentar que la restitución no puede disponerse cuando se absuelve penalmente al imputado y cuando no se ha ejercido la acción civil resarcitoria, no resulta novedoso, siendo que este tribunal de apelación ya ha tenido la oportunidad de pronunciarse al respecto y no comparte tal posición.
Así, con fundamento en lo que dispone de manera expresa el artículo 366 del Código Procesal Penal (que es una norma posterior al artículo 103 del Código Penal, que la impugnante cita en apoyo de su tesis), la jurisprudencia ha interpretado que aún en el supuesto de que se trate de un fallo absolutorio en cuanto a los extremos penales, el juzgador sí está facultado para ordenar ‒incluso de oficio‒ la restitución de los objetos afectados al procedimiento: “ […] Existe un error en el fallo en cuanto al fundamento jurídico para ordenar el desalojo, pues la norma que autoriza esa medida no es el artículo 142 del Código Procesal Penal, sino el 366 ibídem. En esta se regula en forma expresa “La sentencia absolutoria ordenará....la restitución de los objetos afectados al procedimiento que no estén sujeto al comiso...”. En el caso en concreto el Tribunal tuvo por demostrado que el terreno ocupado por los imputados pertenece al Estado y es utilizado por el Ministerio del Ambiente y Energía, como parte del Proyecto de Ordenamiento Territorial Zona Núcleo del Refugio de Vida Silvestre Barra del Colorado.
Sobre estos no puede alegarse la simple posesión o bien el derecho de posesión, en el tanto están fuera del comercio y resultan imprescriptibles (art. 262 del Código Civil y Sentencia 733-F-00, de las 15:12 horas del 4 de octubre del 2000, de la Sala Primera de la Corte Suprema de Justicia). Acreditada la pertenencia del predio y su destino a la preservación de la naturaleza, la consecuencia jurídica era la expulsión de los ocupantes, conforme se decretó en el fallo […]” (cfr. Tribunal de Casación del Segundo Circuito Judicial de San José, voto N° 2004-00933 de las 11:00 horas del 09 de setiembre de 2004). En el mismo sentido, siempre con base en lo dispuesto por el artículo 366 del Código Procesal Penal, se estimado la procedencia de la restitución de cosas al estado anterior aún en caso del dictado de una absolutoria, cuando se esté ante una infracción a la zona marítimo terrestre (cfr.
Tribunal de Casación del Segundo Circuito Judicial de San José, votos 2004-0919 y 2004-0933). Incluso, se ha optado por esta solución aún en el supuesto de una sentencia absolutoria por el delito de usurpación: “[...] si según los hechos probados, la aquí acusada se encuentra ocupando un predio que era poseído por otra persona, lo consecuente es ordenar la restitución en la misma sentencia, con el fin de no retardar innecesariamente el regreso de la ofendida al inmueble. Al respecto, en un fallo de 1992, nuestra Sala de Casación indicó, para un caso en que se comprobó el hecho de usurpación, lo siguiente: “Debe admitirse que lo óptimo es que, en casos como el presente, la restitución de la posesión se ordene en la misma sentencia que condena por el delito de usurpación, a efecto de no retardar innecesariamente el regreso del ofendido al poder de hecho por el cual sometía a su control y voluntad el inmueble usurpado, sin embargo, si tal disposición se omite en la sentencia, nada impide que con posterioridad a ella se dicte una resolución que -en ejecución de aquella condena- venga a ordenar el desalojo del inmueble por parte del usurpador para que el ofendido entre en su posesión, como sucedió en el caso en examen.
No sobra decir que tal solución es no solo la que deriva de la correcta aplicación y entendimiento de la ley, sino que además es la que imponen las normas más elementales del sentido común: resultaría absurdo que el imputado, amparándose a la sentencia que le condena por el delito de Usurpación, legitimara y mantuviese la posesión del mismo inmueble a que accedió en forma típica, antijurídica y culpable”. Sala Tercera de la Corte Suprema De Justicia, V-107-F, de las ocho horas cincuenta y cinco minutos del tres de abril de mil novecientos noventa y dos.- Este fallo es aplicable al subjúdice, no sólo porque advierte la necesidad de no mantener un sinsentido jurídico, el cual se daría al absolver a alguien por la usurpación, porque ostentaba una falsa creencia sobre su mejor derecho de poseer el bien y de obtener su adjudicación legal, y luego mantenerlo en la posesión hasta tanto se demuestre el mejor derecho de posesión de la ofendida, quien adquirió, con las dificultades probatorias y negociales que pudieran existir, el derecho a poseer ese bien.
La prueba habida, así como las consideraciones técnicas y jurídicas que hace el defensor, hacen prevalecer el criterio de la juzgadora de mérito y de este Tribunal, que en este caso debe ordenarse el abandono del predio, y que si la señora Nombre09. considera que su derecho debe prevalecer, así habrá de plantearlo en otra sede, civil o agraria, según sea la naturaleza del fundo y de su dedicación. De acuerdo con lo antes expuesto, se tiene que la orden de restitución del inmueble a favor de la señora [Nombre08 006]. ni siquiera podría interpretarse como una sanción (ni penal ni civil), sino más bien como una consecuencia natural y lógica, derivada de la prueba evacuada en el juicio [...] Así las cosas, no obstante la absolutoria dictada en cuanto a la imputación penal, el juez de mérito estaba obligado a ordenar que la titular del bien en litigio fuese puesta en posesión del mismo, por tener un mejor derecho de posesión.
Al respecto se tiene que en la generalidad de los casos el bien en discusión se encuentra en poder del acusado absuelto, por lo cual si se llegara a acreditar que la titularidad sobre el mismo corresponde a un tercero (como sucedió en la especie), debe restituírsele a éste. (El resaltado no es del original). El artículo 366 párrafo 1º del Código Procesal Penal establece que la sentencia, aún siendo absolutoria, ordenará la restitución de los objetos que estén afectados al procedimiento y que no estén sujetos a comiso, sin que precise que esa restitución deba hacerse en favor de un sujeto determinado. Ello implica, entonces, que a dichos efectos el juzgador deberá determinar cuál es la persona que tiene mejor derecho sobre el objeto, aún y cuando se trate de un tercero. Si bien podría interpretarse que esta norma no se refiere a bienes inmuebles sino más bien a simples "objetos" (muebles), tal tesis debe rechazarse, no sólo porque el comiso también es aplicable a propiedades (artículo 465 del Código Procesal Penal), sino además porque el numeral 140 ibidem establece que en cualquier estado del proceso y a solicitud del ofendido, el juez podrá ordenar, como medida provisional, el restablecimiento de las cosas al estado en que se encontraban antes del hecho.
Si el juzgador ostenta esta potestad como medida provisional, con mucha más razón puede decretarla como restitución definitiva al dictar la sentencia de fondo, donde que se haya determinado la titularidad del bien que ostenta determinada persona. Por otra parte, debe reiterarse que la orden de restitución del inmueble a favor de la señora [Nombre08 006]. ni siquiera podría interpretarse como una sanción (ni penal ni civil), sino más bien como una consecuencia natural y lógica, derivada de la prueba evacuada en el juicio, a partir de la cual se logró acreditar que ella lo adquirió en 1999 y desde entonces ha venido ejerciendo la posesión sobre el mismo. Al respecto se comprende que el artículo 366 párrafo 1º ya comentado, donde se le exige al juez que emita el respecto pronunciamiento en cuanto a este extremo, determina que esa decisión es oficiosa, pues a efectos de ordenar la restitución no se requiere que, como condición previa, la parte ofendida haya ejercido la acción civil resarcitoria, ni tampoco que en cuanto a ello haya formulado una pretensión directa y expresa.
El hecho de que aún y cuando no haga falta hacerlo, la parte ofendida plantee dicha demanda (con lo cual podría obtenerse por dicha vía una "condena" a restituir, según lo dispone el artículo 464 del Código Procesal Penal), de ningún modo implica que la acción civil era necesaria. Por lo expuesto, sin lugar el recurso […]” (cfr. voto del Tribunal de Casación Penal del Segundo Circuito Judicial de San José N° 2006-1115 de las 09:18 horas del 20 de octubre de 2016, que a su vez cita y se apoya en el voto de la Sala Tercera de la Corte Suprema de Justicia N° 107-F-92 de las 08:55 horas del 03 de abril de 1992). En este mismo sentido, es decir, que la restitución procede aunque no se haya ejercido acción civil resarcitoria, también pueden consultarse los votos de la Sala Tercera N° 1462-2004 y N° 604-F-91. Teniendo en cuenta lo anterior, se debe precisar que, obviamente, la orden de restitución podrá disponerse siempre que dicha medida sea materialmente posible, lo cual por ejemplo sucederá cuando, tratándose de un bien mueble, el mismo esté en poder del despacho judicial (cfr. hipótesis regulada por el artículo 367 del Código Procesal Penal).
De igual modo, tratándose de bienes inmuebles la restitución (de proceder) siempre será factible, en la medida en que la autoridad jurisdiccional podrá apersonarse al terreno respectivo y mediante un acto formal lo dejará en posesión de la persona legitimada para ello. Es claro que tal opción no sería posible en casos en los cuales se trate de bienes muebles que, al no estar secuestrados o entrados en depósito provisional, no se sepa dónde se hallan o si todavía existen, siendo en tal supuesto que, como medida subsidiaria, lo que corresponderá será una reparación económica mediante la condena al pago de daños y perjuicios. No desconoce este órgano de apelación que la posición antes reseñada, en el sentido de que la restitución oficiosa procederá ‒en principio‒ aún en el supuesto de que se haya dictado una absolutoria en lo penal y pese a que no se haya ejercido por el titular del inmueble la acción civil resarcitoria, no es del todo pacífica en el foro jurídico nacional, siendo que el tratadista Javier Llobet Rodríguez, aún reconociendo que existe la tendencia jurisprudencial supra referida (sustentada en la disposición directa y expresa que incorpora el artículo 366 del Código Procesal Penal), propugna una interpretación contraria, en el sentido de que el Código Procesal Penal de 1996 responde a un sistema clásico según el cual (sostiene el autor Llobet Rodríguez) se requiere, a efectos de disponer la restitución, del ejercicio de la acción civil resarcitoria: “ […] Se ha interpretado por los tribunales que es posible ordenar la restitución aunque no se haya presentado la acción civil resarcitoria, ello sin perjuicio de que la restitución pueda ser el reclamo que se formule cuando se interpone la misma (Así: Sala Tercera, voto 1462-2004 del 22-12-2004).
Con base en ello la jurisprudencia ha establecido que cuando se dicte una sentencia condenatoria por usurpación procede ordenar la restitución del bien. Incluso en casos de absolutoria se ha admitido ello cuando la sentencia se ha basado en la admisión de un error del ocupante que no elimina la antijuricidad. El artículo 140 del C.P.P. establece que como medida cautelar puede disponerse la restitución provisional de las cosas al estado anterior. No es claro a qué se refiere el artículo 361 inciso d) al referirse a la restitución. Pareciera que la referencia tiene relación con la entrega de los objetos secuestrados a quien tenga mejor derecho, de acuerdo a los artículos 366 y 367 del C.P.P. Téngase en cuenta que el mismo artículo 366 del C.P.P. hace mención al término ‘restitución’ de los objetos afectados al procedimiento. Debe considerarse que conforme al C.Nombre09. de 1996 rige el sistema clásico de la acción civil, de modo que se requiere que la misma sea ejercida por quien reclama que ha sufrido un daño, no procediendo de oficio.
Al respecto debe anotarse que el artículo 37 del C.P.P. establece como fin de la acción civil la restitución del objeto materia del hecho punible, así como la reparación de los daños y perjuicios causados. Aspecto fundamental de la acción civil es el restablecimiento de las acosas al estado anterior, de modo que la reparación de los daños y perjuicios es solamente subsidiaria. Sin embargo, los tribunales (véase: Sala Tercera, voto 1272-2008 del 29-10-2008), cada vez más han venido disponiendo la restitución de las cosas al estado anterior de oficio, lo que no es conforme al sistema seguido por el Código. Usualmente se invoca el artículo 102 del Código Penal de 1970 para ello, pero el mismo parte de un sistema positivista de la acción civil, de modo que la restitución al estado anterior y el pago de daños y perjuicios deben ordenarse de oficio. No se ha percatado que ese sistema fue derogado a partir del C.P.P. de 1973 y ello se ratificó con el C.Nombre09. de 1996 que lejos de partir de un concepto positivista de la acción civil, establecieron la necesidad de que se constituyera el actor civil reclamando la restitución al estado anterior y el eventual pago de daños y perjuicios […]” [cfr.
Llobet Rodríguez Javier, “PROCESO PENAL COMENTADO (CÓDIGO PROCESAL PENAL COMENTADO)”, Editora Dominza y Editorial Jurídica Continental, San José, 6ª edición, 2017; páginas 545 y 546]. Siguiendo la anterior posición, el Tribunal de Casación del Segundo Circuito Judicial de San José estimó (en un caso donde el tribunal de juicio dictó condenatoria por el delito de retención indebida de una máquina de coser, y ordenó la restitución de dicho bien mueble pese a que el mismo no había sido secuestrado o decomisado) que si no se planteó acción civil y no se ha decomisado el bien, no puede ordenarse de oficio la restitución: “ […] Se planteó por la defensa de la imputada recurso por el fondo. Indica que se condenó al imputado como autor del delito de apropiación indebida, pero el tribunal extralimitó su labor y le ordenó que devolviera la máquina Singer, bajo el apercibimiento de cometer el delito de desobediencia a la autoridad en caso contrario.
Indica que la parte ofendida nunca planteó la acción civil. El recurso se declara con lugar. En la sentencia se indicó que “de conformidad con lo dispuesto por el artículo 103 del Código Penal este Tribunal considera necesario enervar los efectos producidos por el hecho delictivo cometido por la imputada. En esa inteligencia, se le ordena a la señora [Nombre08 007]. la devolución de una máquina de coser marca Singer, color blanco, de motor, con su respectiva mesa, en estado de ser utilizada, tal y como le fuera prestada, a la señora [Nombre08 008]., bajo apercibimiento legal de seguirle causa penal por el delito de desobediencia, si no cumple con lo ordenado. Para tal efecto, se le concede a la imputada un plazo de quince días luego de la firmeza del plazo. Ciertamente, si en el caso de estudio se ha demostrado que la posesión ejercida por la imputada sobre el bien propiedad de la ofendida es producto de un hecho delictivo es evidente que el ordenamiento jurídico no podría consentir la proyección y perpetuación de los efectos de ese hecho antijurídico en el tiempo.
En definitiva, determinar la existencia del hecho delictivo y mantener a la imputada en posesión del bien objeto del delito sería favorecer un enriquecimiento sin causa. Por ello, este Tribunal opta por enervar la efectividad desplegada por el hecho delictivo (que no eficacia la cual solo puede ser consecuencia de un hecho debido) ordenando la devolución aquí dispuesta. En todo caso, la ofendida al iniciar su declaración indicó que su interés era recuperar la máquina de coser prestada a la imputada. Ahora bien, de conformidad con el artículo 140 del Código Procesal Penal, el juez aun como una medida, cautelar puede ordenar que las cosas sean restablecidas al estado en que se encontraban antes del hecho. Por lo tanto, si ello puede ser ordenado aún como medida provisional más solidez tiene esa restitución de las cosas al estado anterior cuando se ha comprobado la existencia del delito acusado” […] El juzgado siguió al respecto la concepción positivista de la acción civil, debiendo reconocerse que dicha concepción efectivamente se encuentra detrás del artículo 103 del Código Penal, puesto que parte de que todo hecho punible tiene como consecuencia la reparación civil, la que debe ser determinada al dictarse la sentencia condenatoria, debiendo dictarse incluso de oficio dicha reparación.
Sin embargo, dicha posición es diversa a la que inspira el Código Procesal Penal, que es ley posterior, ya que en principio siguió la concepción clásica sobre la acción civil, requiriéndose que la parte damnificada a sus herederos presenten su reclamo civil en el proceso penal (Arts. 37, 111 y 368 del Código Procesal Penal) (Cf. Llobet Rodríguez, Javier. Proceso penal comentado. San José, Editorial Jurídica Continental, 2003, p.351). El artículo 367 del citado Código contiene una excepción al respecto, puesto que debe disponerse la entrega de los objetos secuestrados a quien tenga mejor derecho para poseerlos, ello aun cuando no se haya presentado el reclamo civil. Este supuesto, sin embargo, no se aplica al caso concreto, ya que la máquina de coser en cuestión no ha sido secuestrada. En la sentencia se hace mención al artículo 140 del Código Procesal Penal, en cuanto indica que en cualquier estado de la causa y a solicitud del ofendido, el tribunal puede ordenar, como medida provisional, el restablecimiento de las cosas al estado que tenían antes del hecho, siempre que haya suficientes elementos para decidirlo.
Esta disposición ha tenido relevancia en particular con respecto a los delitos de usurpación (Cf. Llobet Rodríguez, Javier, op. Cit., p. 194), en los que el restablecimiento al estado anterior implica la expulsión utilizando la fuerza pública de la persona que estaría usurpando el inmueble. Igualmente puede justificar dicha norma la restitución provisional del objeto secuestrado. Sin embargo, esos supuestos son diversos a los correspondientes al presente asunto, en el que ni siquiera se sabe dónde se encuentra el bien apropiado por la imputada. Si se siguiera la posición sostenida en la sentencia entonces en todas las causas penales habría que disponer de oficio la reparación civil, ordenándose la restitución de la cosa, la reparación del daño y la indemnización de los perjuicios (Art. 122 del Código Penal de 1941). Esa no fue la concepción, como se dijo, de la que se parte en la legislación procesal penal.
Por otro lado, si se considerara que la imputada comete el delito de desobediencia a la autoridad en caso de no devolver la máquina de coser se estaría violentando el principio del ne bis in idem, puesto que se le estaría penando dos veces por el mismo hecho (Art. 11 del Código Procesal Penal y 8 inciso 4) de la Convención Americana de Derechos Humanos). Se declara con lugar el recurso de casación. Se revoca la sentencia en cuanto indica que se le ordena a la señora [Nombre08 007]. la devolución de una máquina de coser marca Singer, color blanco, de motor, con su respectiva mesa, en estado de ser utilizada, tal y como le fuera prestada, a la señora [Nombre08 008]., bajo apercibimiento legal de seguirle causa penal por el delito de desobediencia, si no cumple con lo ordenado […]” (cfr. Tribunal de Casación del Segundo Circuito Judicial de San José, voto N° 2004-0541 de las 09:12 horas del 03 de junio de 2004).
Si bien este pronunciamiento resulta acertado al afirmar que no procede la restitución de un bien mueble que no ha sido secuestrado o decomisado (en cuyo caso sólo quedaría la opción de disponer, como solución subsidiaria, la condena al pago de daños y perjuicios), no lleva razón al rechazar la posibilidad de la restitución en los casos en donde no se ejerció la acción civil resarcitoria. La anterior posición doctrinal que se comenta adolece de un débil sustento, pues parte de una interpretación muy laxa del artículo 366 del Código Procesal Penal, según la cual (refiere el autor Llobet Rodríguez) “pareciera” que la alusión que hace el artículo 366 del Código Procesal Penal a la restitución de los objetos afectados al procedimiento que no estén sujetos al comiso, se refiere a la entrega de los objetos secuestrados a quien tenga mejor derecho. Es notorio que tal interpretación se estructura a partir de la palabra “pareciera”, concepto no sólo dubitativo, impreciso y nada asertivo, sino además subjetivo, lo cual la deslegitima por completo.
En este sentido debe hacerse hincapié en que, a partir del principio general de Derecho según el cual no es dable distinguir donde la ley no lo hace , el artículo 366 que se comenta no señala que los objetos afectados al procedimiento que no estén sujetos al comiso consisten en “objetos secuestrados” (es decir, bienes muebles, como lo interpreta y entiende el tratadista supra citado), pues si se analiza dicha norma de modo integral se aprecia que también se alude a objetos que no estén sujetos al comiso, dentro de los cuales también entrarían los bienes inmuebles (cfr. artículo 489 del Código Procesal Penal). Teniendo claro todo lo anterior, es necesario reseñar las razones a partir de las cuales fue absuelto el coimputado Nombre05 del delito de usurpación, así como por qué, pese a ello, la jueza de mérito estimó procedente disponer la restitución del inmueble a favor del ofendido [Nombre08 001], siendo que este órgano de apelación no advierte yerro alguno en los fundamentos de tal decisión jurisdiccional.
Al respecto se tiene lo siguiente: A) ABSOLUTORIA. Si bien en juicio se acreditaron algunas conductas desplegadas por esta persona que claramente perturban el derecho de posesión del ofendido, no se probaron con certeza los tres hechos específicos, puntuales y concretos que, según la descripción fáctica que se plasma en la requisitoria fiscal, le fueron atribuidos al mismo por parte del Ministerio Público. Debido a ello, en respeto de los principios de imputación y de correlación entre acusación y sentencia, la juzgadora estimó que lo que correspondía era el dictado de una absolutoria. En efecto, y según se argumenta en la sentencia, en la acusación fiscal se alude a que Nombre05 “[…] junto a Nombre01 y Nombre02 , perturbó en la posesión legítima de sus propiedades al ofendido [Nombre08 001], con la intención de usurpar y adueñarse de sus propiedades, al sembrar plantas de plátano, ingresar ganado y amenazar con machetes al ofendido (hecho N.02); usurpar la propiedad de [Nombre08 001], con el fin de impedir que el ofendido ingresara a la misma (hecho N.05) y por último, junto a los otros dos imputados y con el fin de usurpar la propiedad del agraviado, sembrar matas de plátano al otro lado del río de las propiedades de [Nombre08 001], e ingresar veinte cabezas de ganado […]” (cfr. sentencia, folio 508 frente, línea 3 en adelante).
Se demostró, a partir de la prueba testimonial evacuada en juicio (declaraciones de [Nombre08 009], [Nombre08 001], [Nombre08 011] y [Nombre08 012]), que en una acción de desahucio cumplida en el mes de diciembre de 2011 se procedió a la expulsión del imputado Nombre05 de una de las fincas cuya posesión se atribuye al ofendido [Nombre08 001]. Esta circunstancia coincide parcialmente con lo narrado en el punto quinto de la acusación, pues nunca se acreditó que (conforme se indica en dicha pieza) tratara de impedir el ingreso del ofendido. Así, los actos típicos del delito de usurpación (a saber, sembrar plátanos, ingresar ganado a la propiedad, amenazar al ofendido con machetes cuando éste intenta ingresar al fundo, e impedirle el paso) son situaciones que no arroja la prueba testimonial ni documental. El encartado Nombre05 dice tener un derecho de posesión sobre la finca objeto de la litis, pero no reconoce haberla invadido dentro del período que comprende la acusación; incluso, según el testimonio del propio denunciante, el avistamiento del encausado Nombre01 en la finca se dio en una ocasión en la que es expulsado y “detenido” por parte de la policía administrativa, pero no existe manifestación alguna que sugiera que Nombre05 ingresara nuevamente al predio y ejecutara actos perturbatorios de la posesión del ofendido.
No es posible achacar al imputado un conducta de invasión al fundo del agraviado si solo una vez se le observó en el sitio, y si nunca se le vio ingresar ganado y realizar siembras; además, el único momento en que el ofendido lo vio sacar plátanos de la finca, no implica de forma certera que se tratara de una plantación hecha por el propio encartado, porque la prueba de cargo ([Nombre08 009] y [Nombre08 014]) señala que su padre, el aquí ofendido, también tenía siembras en la finca, por lo que podría hablarse inclusive de un posible hurto, que nunca fue acusado. RESTITUCIÓN (cfr. folio 516, línea 20 en adelante). En lo relativo a la orden de restitución del terreno a favor del agraviado, en el fallo se explica que tal decisión se sustenta en los artículos 140 y 367 del Código Procesal Penal, ello debido a que se acreditó su legítima posesión sobre los fundos en conflicto. En torno a este tema (la legítima posesión a cargo del ofendido, con respecto a la cual no resultan oponibles el documento ni la posesión que alegó el encartado absuelto Nombre05 ) y con ocasión del fallo condenatorio que se dictó en contra de los coencartados Nombre01 y Nombre02 , en el fallo se expone un amplio y coherente análisis de la prueba (cfr. folio 510 frente, línea 29 en adelante), explicándose lo siguiente: (i) Versión del coimputado Nombre02 .
Al declarar en juicio, el imputado Nombre02 no externa manifestación alguna en cuanto al derecho de posesión que alega tener el agraviado; más bien pareciera reconocer que éste le había contado haber comprado una de esas propiedades (a don Nombre10), sin que alegue tener un mejor derecho sobre las mismas. Asimismo, no hay justificación en sus manifestaciones cuando señala que los testigos quieren hacerle daño, porque no explica, en ningún momento, la razón o motivo de esa maligna intención. Así, no expone algún conflicto con [Nombre08 001] por la posesión del inmueble objeto de esta litis, siendo que refirió que tiene unas fincas en el mismo sitio (Los Laureles), pero que no colindan de forma alguna con las del aquí denunciante, situación que también se ve reflejada con el dictamen pericial DCF: 2016-01530-ING de folios 467 al 470, quedando claro que no existe ningún traslape en los planos de las fincas del ofendido y de Nombre02 .
(ii) El ofendido explicó cuándo, cómo y de quién adquirió cada una de las cuatro parcelas objeto de este litigio. Al respecto, la jueza razona lo siguiente: “[…] el ofendido [Nombre08 001], refirió en el contradictorio que su propiedad se compone de cuatro fincas, las que juntas suman 25 o 30 hectáreas, hay dos que cuentan con títulos de propiedad y otras dos que no; de las cuatro, según indicó, tres fueron compradas a Nombre11, pero solo una estaba a Nombre08 de Nombre11, la otra a Nombre08 de Nombre12 y la última a Nombre08 de un hermano de Nombre11, llamado Nombre13. La cuarta propiedad era de Nombre14. Refirió que se compraron en el año 1997, pero con documentos se legalizó hasta el año dos mil seis. Aclaró que de las tres propiedades que le compró a Nombre11 (una de Nombre11, una de Nombre12 y la otra de Nombre13), la de Nombre13 sí tiene escritura, que está en el I.D.A, que la que está a Nombre08 de Nombre12 , a pesar de que éste falleció, los hijos se comprometieron a hacer el traspaso una vez se efectúe ‘la mortual’ […]” (cfr. folio 511 frente, línea 16 en adelante).
(iii) El testigo Nombre11 , vendedor de tres de las cuatro parcelas, ratificó la versión del ofendido, siendo que ‒en criterio del tribunal de mérito‒ las deposiciones resultan creíbles: “ […] Don Nombre11 , también declaró y verificó con su dicho la información que brindó en juicio el ofendido. Nombre11 reconoce haber negociado tres parcelas con el ofendido, las que están ubicadas por la boca del Río Reventazón, un de ellas inscrita a su nombre, otra que él le había comprado a un sujeto de raza negra que falleció, y la otra que un hermano suyo le dio en pago de una deuda. Refiere que esa venta ‘de boca’, o sea, de palabra, se dio hace unos quince años, pero que hace aproximadamente siete años se hizo el traspaso. Al describir las propiedades, indicó que las tres colindan entre sí, las divide una línea de tren, y casi todas tienen como lindero el Río Peje […] En cuanto a Nombre11, es una persona que tan siquiera tiene relación con los imputados, su papel en el proceso es el de vendedor de la propiedad de los fundos, cuya posesión aquí se discute, no se ha desvirtuado de forma alguna, su legitimación para trasladar el dominio o la posesión de las mencionadas propiedades, tampoco existe elemento alguno que haga considerar que la información brindada es falsa o manipulada, sino que se trata de una persona imparcial en el proceso, que no es tan siquiera familiar del denunciante y que únicamente narró lo que le constaba […]” (cfr. folio 511 frente, línea 26 en adelante).
(iv) Prueba documental. La juzgadora también analiza la prueba documental, consistente en los testimonios de escrituras que aparecen agregados al expediente a folios 32, donde se constata el historial de propietarios que han venido ostentado la titularidad de las referidas parcelas, y de los cuales el ofendido las adquirió, siendo que tal información coincide plenamente con la explicación que al respecto brindaron éste y el testigo Nombre11 (cfr. folio 511 vuelto, línea 27 en adelante). A partir de ello se corrobora el siguiente historial de las 4 parcelas: (iv.a.) el 12 de setiembre de 1986, el IDA traspasa un primer terreno a Nombre15, persona de quien el señor Nombre11 (según éste así lo declaró) lo adquirió, para ‒posteriormente‒ vendérselo verbal e informalmente (“de boca” o de “palabra”) al ofendido [Nombre08 001], siendo que dicho inmueble aún aparece inscrito a Nombre08 de dicho deponente; (iv.b.) el 25 de junio de 1988, el Instituto de Desarrollo Agrario segrega el lote veintinueve del proyecto Neguev a Nombre10, mismo que vende a [Nombre08 001], formalmente, en fecha 09 de junio de 2008, tal y como consta en escritura que rola a folio 150 y en certificación registral de folio 142 del legajo principal; (iv.c.) Con respecto al fundo que, según se indica por parte de Nombre11, le fue comprado a su hermano Nombre16, se desprende de los testimonios de Nombre17 y de Nombre11 que años más tarde de que la venta se hiciera de forma verbal, el mismo Nombre11 sugiere al ofendido que busque a su hermano Nombre13, más conocido como Nombre16, para que le haga la escritura de traspaso, acto que se lleva a cabo el veinte de julio de 2007, propiedad que a su vez había adquirido mediante compra venta al señor Nombre18 el 26 de julio de 1983; (iv.d.) Por último, la finca conocida como Dirección02, que aparece inscrita a Nombre08 de Nombre19 (ver del folio 169 al 180), fue vendida en forma verbal por dicho propietario registral a Filadelfo, conforme al testimonio de éste; en aquel momento únicamente se brindó una especie de factura como comprobante del negocio, y años más tarde Nombre11 realizó una venta de la misma especie (verbal) con [Nombre08 001].
Con relación a este cuarto terreno, en el fallo se explica que el agraviado “[…] ha reconocido que se encuentra en conversaciones con los herederos de Nombre19 , a fin de proceder al traspaso en el Registro Público de la propiedad mencionada […]” (cfr. folio 512 frente). A partir de lo anterior, la jueza de instancia no sólo logra reconstruir el historial de propietarios que han ostentado la titularidad de los cuatro fundos hasta ser adquiridos por el denunciante, siendo que tales transacciones “de boca” o “ de palabra” (verbales e informales) no se documentaron hasta años después, siendo que ‒además‒ se logró determinar que “ […] las propiedades descritas, si bien unas a Nombre08 del ofendido y otras no, forman parte de un solo fundo (dado que son colindantes) sobre el cual el ofendido [Nombre08 001] ha ejercido la posesión de forma pacífica y pública, desde el momento mismo en que las adquiere de sus propietarios o poseedores […]” (cfr. 512 vuelto, líneas 1 a 4).
(v) Ese ejercicio de la posesión por parte del ofendido, de forma legítima, pacífica, continua y pública, también se acreditó a partir de las declaraciones de las testigos de cargo [Nombre08 009] y [Nombre08 014], ambas hijas suyas. (vi) Los testigos de descargo [Nombre08 017] y [Nombre08 012] señalaron que el agraviado tiene una propiedad que colinde con el río Peje. (vii) El coimputado Nombre01 no emitió declaración alguna. (viii) Los documentos admitidos como prueba de descargo y que rolan de a folios 331 a 356 de los autos, no desacreditan de forma alguna la posesión que sobre las fincas tiene el ofendido [Nombre08 001], sino que se trata de probanzas que forman parte de las admitidas como prueba de cargo, sea, certificaciones registrales y planos que comprueban la propiedad registral que tiene el ofendido sobre dos de las fincas, los planos catastrados que ilustran la ubicación de cada fundo y que acreditan el dicho del ofendido y los testigos de que tales fincas colindan entre sí y que pueden verse como una sola, pues así se ha ejercido la posesión sobre las mismas.
Es a partir de todo este contexto que la juzgadora de mérito no sólo establece el legítimo dominio que ha venido ejerciendo el ofendido sobre los terrenos, ello desde el año 1997, sino que partiendo de esa base fáctica y jurídica concluye de modo acertado y fundado que la copia de una compra venta privada aportada por el coencartado Nombre05 (con fundamento en la cual alega que es él quien está ocupando el inmueble) no es oponible al agraviado, quien ostenta un mejor derecho a poseerlo pues ha detentado los terrenos desde mucho tiempo antes, incluso mucho tiempo antes de que se confeccionara el documento de folio 36, de modo que no resulta atendible el argumento de la recurrente en el sentido de que la carta venta privada que presentó el coencartado Nombre05 aparece fechada unos meses antes. Resulta notorio el carácter subjetivo y parcializado del reclamo de la defensora pública, según el cual ella asegura que del análisis de la prueba, tanto documental como testimonial, no puede tenerse certeza de cuál de las partes tiene un mejor derecho sobre una finca que se encuentra sin inscribir.
Contrario a ello y conforme se explicó supra, en la sentencia existe una valoración de los elementos evacuados en juicio, tanto documentales como testimoniales, que permite comprender no sólo cuándo y cómo adquirió el ofendido la propiedad que reclama el encartado, sino ‒además‒ que la ha venido poseyendo a título de dueño, de forma legítima, pacífica y pública, desde el año 1997. En efecto, tal y como se explicó atrás, se trata de una de las cuatro parcelas, en concreto la que perteneció al señor Nombre18 , quien mediante compra venta del 26 de julio de 1983 se la traspasó al señor Nombre16 , cc Nombre13; de manera verbal, éste se la traspasó a su hermano Nombre11 en pago de una deuda preexistente; de igual modo, en 1997 Nombre11 se la vendió al señor [Nombre 001], aunque no fue hasta el 20 de julio de 2007 que, por sugerencia del propio señor Nombre11 , se confeccionó el documento privado de folio 36 donde Nombre16 (c.c.
Nombre13) se la vende al ofendido [Nombre08 001]. Ello determina la improcedencia del reparo de la recurrente, pues ‒contrario a lo que ella sostiene‒ sí existió prueba, que fue debidamente analizada, que permitió establecer de modo certero el legítimo y mejor derecho de posesión que ostenta el señor [Nombre08 001] sobre este terreno, siendo que –además‒ el ingreso del encartado se dio mucho tiempo después de que aquel estuviera ejerciendo el dominio sobre el fundo: “[…] No existe indicio alguno que sugiera la existencia de un mejor derecho sobre los inmuebles, tan siquiera por parte de Nombre05, quien señaló estar ocupando el inmueble y aportó una copia de compra venta privada ( folio 07), que al ser analizada, es claro, que el ofendido cuenta con un mejor derecho, por los antecedentes de la finca, en cuanto al traslado de la posesión que tanto formal como de hecho, se realizó desde mucho tiempo antes de que el encausado Nombre01, fuera ubicado en uno de los lotes pertenecientes al ofendido.
Inclusive, el ofendido, a quien se le da credibilidad por las razones que se apuntaron al inicio de éste apartado de la sentencia, refirió que aún y cuando se había brindado autorización para que Nombre01 trabajara en el inmueble, al tratar de desalojarlo de éste, dos días después de un desalojo administrativo que operó en las fincas, se ubicó a Nombre05, que había ingresado con su familia al fundo de forma ilícita, esto porque la posesión ya le pertenecía al agraviado […]” (cfr. folio 513 frente). Sí llama la atención de este tribunal de apelación que, pese a que en juicio indicó que él le había comprado el derecho de posesión del terreno a su hermano Nombre20 , el computado Nombre05 ni siquiera pudo explicar cómo fue que aquel lo adquirió (cfr. folio 499 vuelto), lo que da cuenta de la debilidad e insuficiencia del título que exhibe y sobre el cual sustenta su alegato de tener derecho a ocupar la parcela. Con base en lo anterior, se declara sin lugar el reclamo.
Recurso de apelación del licenciado Giovanni Herrera Alvarado, defensor público del coimputado Nombre01 (cfr. folios 519 a 523).
Inconformidad con la valoración de la prueba. En el primer motivo de su recurso, el defensor público se muestra inconforme con que se estableciera que el ofendido es el legítimo poseedor de las fincas (elemento esencial del tipo penal), siendo que tal situación no se deriva del análisis integral y conjunto de la totalidad de la prueba evacuada, por lo que tal conclusión carece de todo fundamento. Sin lugar el reproche. El aspecto que cuestiona el defensor, esto es, la fundamentación del fallo de instancia en torno a la condición que ostenta el ofendido [Nombre08 001] como legítimo poseedor de las cuatro parcelas objeto del litigio, fue amplia y suficientemente analizado en el anterior considerando, donde se explica por qué al respecto no se advierte yerro o deficiencia algunos en la sentencia impugnada. En razón de ello, el aquí recurrente deberá remitirse a lo que ahí se expone. Sin lugar la queja.
Violación de los principios de imputación y congruencia. En este segundo apartado, el defensor público reclama lo siguiente: A) Se quebrantaron los principios de imputación y congruencia. El hecho acusado 2 sirve de preámbulo a los hechos concretos, precisos y circunstanciados que la requisitoria fiscal describe inmediatamente después (en el punto 4), sobre los cuales la defensa definió y “giró” su estrategia. No obstante, el hecho probado 2 no contiene ninguna imputación, pues es la simple descripción del tipo penal de usurpación, siendo evidente que la jueza suprimió la frase “Es así como ” contenida entre los hechos segundo y tercero de la acusación, lo cual no sólo es un elemento que da coherencia e hilvana los hechos acusados, sino que clarifica el alegato de la defensa; tampoco delimita temporalmente las acciones imputadas, ni precisa ninguna de sus otras circunstancias, por ejemplo, en qué sector de las propiedades se sembraba, o la cantidad y tipo de ganado introducido.
De todo este cuadro fáctico acusado, sólo se tuvieron por plenamente demostrados los siguientes hechos: “[…] HECHOS PROBADOS : Se tienen como hechos probados los siguientes: 1.- El aquí ofendido [Nombre08 001], es legítimo poseedor desde el año dos mil siete aproximadamente y hasta la fecha, de varias propiedades que colindan entre sí y que tienen una extensión aproximada de cuarenta y un hectáreas, mismas que se ubican en [...] y tiene como colindantes a otros propietarios de propiedades vecinas. 2.- Que el ofendido [Nombre08 001] desde la fecha trece de diciembre de dos mil once, ha sido perturbado en la posesión legítima, actual, pacífica y publica de sus propiedades, por parte de los imputados Nombre01 y Nombre02 , quienes con la intención de usurpar y adueñarse ilegítimamente de las propiedades del ofendido, quienes ingresan a la propiedad del ofendido y cuando éste intenta ingresar a sus propiedades, los encartados con el fin antes dicho, lo amenazan con machetes diciéndole que si ingresa a la propiedad lo van a machetear, le dicen que esas propiedades no son de él. 3.- En fecha doce de diciembre de dos mil doce, el ofendido [Nombre08 001], luego de interponer una solicitud de desalojo administrativo ante el Ministerio de Seguridad Pública, la cual le fue concedida mediante resolución 2506-11-DM, es puesto en posesión de su propiedad al ser las 13:30 horas y es expulsado en esa ocasión el señor Nombre21. 4.- En fecha 11 de febrero de 2012, a las 10:00 horas, el ofendido [Nombre08 001] iba en compañía de varias personas y se dirigía hacia su propiedad, sita en la dirección ya indicada en el punto 1 anterior, siendo que en la misma se encontraban los encartados Nombre02 y Nombre01, quienes con la intención de perturbar el legítimo derecho de posesión que tiene el ofendido sobre su propiedad, le dijeron que sí entraba a la propiedad lo iban a golpear y le iban a volar machete, por lo que el ofendido llamó a la Fuerza Pública, quienes se presentaron al lugar y le confeccionaron un parte policial a los encartados […]” (cfr. folio 497 vuelto, línea 25 en adelante; la transcripción es literal).
Como se aprecia, en lo que atañe a los hechos acreditados que sustentan la responsabilidad penal del coimputado Nombre01, se tuvo por demostrado lo que se describe en el punto 2) de la requisitoria fiscal (salvo en lo relativo al coencartado Nombre05 ), así como lo que se indica en el punto 6) de dicha pieza, lo cual no sólo es suficiente para sustentar la decisión condenatoria dictada en su contra, sino que con ello de ningún modo se está variando (en detrimento de las garantías de defensa) la esencia de la acusación. Al respecto se aprecia cómo, a efectos de estructurar su alegato impugnaticio, el abogado defensor deja de lado que no sólo se tuvo por demostrado lo narrado en el punto 2) de la requisitoria (con la salvedad antes referida), sino también el hecho específico, concreto y bien circunstanciado (temporal y espacialmente) que se describe en el punto 6) de dicha acusación fiscal, de modo que no se demuestra por parte de dicho profesional de qué modo se vio afectada la posibilidad de defensa en juicio.
Así, si bien es cierto que el hecho acusado que se identifica como número 2 se incluye a título de simple “preámbulo”, de ningún modo se pierde la coherencia al no haberse incluido la frase que echa de menos. Con base en lo anterior, se rechaza también este segundo motivo del recurso.
Recurso de apelación de la licenciada Argerie López Pérez, defensora pública del coimputado Nombre02 (cfr. folios 530 a 535).
Inconformidad con la valoración probatoria. En el primer motivo de su recurso, la defensora pública del coimputado Nombre02 se muestra inconforme con la valoración probatoria, por lo siguiente: A) Tomando “parte” de los alegatos del Ministerio Público, la jueza de mérito desacredita los alegatos de la defensa y otorga total credibilidad a la prueba de cargo, aún y cuando en el contradictorio salieron a la luz “[…] muchos aspectos que generaron dudas razonables de que en el caso de mi defendido no tuvo participación en los hechos que se le acusaron […]” (cfr. folio 532; la transcripción es literal). B) Cómo puede la juzgadora (decir) que es gracias a la defensa técnica que arriba a la condenatoria contra los imputados, cuando aquella se avocó a demostrar que “las cosas”, ni en la acusación ni en el juicio, se demostraron realmente, como lo pretendió el Ministerio Público; por ejemplo, que no se demostró que las propiedades le pertenecían al ofendido, según éste así lo alegaba; y que, al contrario, hubo duda razonable en cuanto a “quiénes ostentaban” la posesión de esas tierras.
Sin lugar el reparo. No demuestra (ni lo indica siquiera) cuáles son esos “muchos aspectos” que, conforme al criterio personal de la recurrente, habrían generado dudas razonables en torno a la participación del coimputado Nombre02 en los hechos que se le acusaron; cuáles serían las supuestas dudas que se generan al cotejar la prueba testimonial con la documental; o cómo o por qué los informes policiales demuestran una situación distinta a la demostrada. Por otra parte, y lo mismo que se indicó en el considerando segundo de esta resolución al declararse sin lugar el primer motivo del recurso de apelación del defensor público del coimputado Nombre01, la aquí impugnante deberá remitirse a lo analizado en el primer considerando, donde se reseñó la amplia y coherente motivación que desarrolló la jueza de instancia a efectos de concluir que el ofendido es el legítimo titular y efectivo poseedor de los fundos en disputa.
Por otra parte, luego de analizada la sentencia en su integralidad, no encuentra este órgano de apelación que la juzgadora responsabilice a la defensa técnica de la condenatoria dictada en contra el aquí encartado, conforme lo asegura la recurrente. Ninguna relevancia tiene en la resolución de fondo de este caso que el encartado Nombre02 aportara documentos de los cuales se derive su titularidad sobre otras propiedades, pues lo que se le acusa y se tuvo por demostrado es que, en conjunto y acuerdo con el coimputado Nombre01, procedió a perturbar la posición del ofendido en torno a las parcelas de éste. Por otra parte, ningún yerro o arbitrariedad se detectan en el análisis que expone la juzgadora a efectos de negarle todo crédito al relato defensivo que expuso en debate el señor Nombre02, pues pese a que él señaló que los testigos de cargo querían hacerle daño (único fundamento para rechazar los cargos que surgen en contra suya del relato que éstos brindaron en juicio), ni siquiera pudo precisar ni dio razón alguna que haga comprensible o explicable esa supuesta maledicencia: “[…] se analiza la declaración vertida en juicio por Nombre02 , en su calidad de imputado, quien negó los hechos y señaló que no tiene ninguna propiedad que colinde con las de [Nombre08 001], que incluso el ofendido le había contado que negoció una propiedad con don Nombre10, que es el ofendido quien lo molesta a él, abriéndole los portillos para que el ganado de su propiedad se salga, y que el conflicto ocurre porque al ofendido [Nombre08 001] le molesta su amistad con Nombre01, asimismo, señala que los testigos de cargo lo que quieren es hacerle daño.
Al analizar su declaración, no se desprende manifestación alguna en cuanto al derecho de posesión que alega tener el agraviado, más bien, pareciera reconocer que el mismo ofendido le había contado haber comprado una de esas propiedades, sin que el imputado alegue tener un mejor derecho sobre las mismas. Señala que los testigos quieren hacerle daño, pero no indica cuál es la razón, ni justifica de forma alguna el porqué de la enemistad con el agraviado […] No hay justificación en las manifestaciones del encausado Nombre02, cuando señala que los testigos quieren hacerle daño, porque no explica en ningún momento, la razón o motivo de esa maligna intención[…]” (cfr. folio 511 frente y vuelto; la transcripción es literal). Aunado a ello, la juzgadora también expuso las razones que, a partir de la inmediación que propicia el debate, le llevaron a otorgarle plena credibilidad a las versiones de cargo que aportó la prueba testimonial ofrecida por el Ministerio Público, pues no se detectó siquiera algún motivo por el cual quisieran rendir una versión falsa o perjudicar inmerecidamente a los encartados, la cual incluso coincide de modo pleno con el contenido de la prueba documental (cfr. escrituras y certificaciones agregadas a folios 32, 142, 150, 161, 169 a 180 y 331 a 356): “[…] Ambos testimonios, son creíbles a criterio de quien resuelve.
Don [Nombre08 001], si bien tiene un interés especial en lo que aquí se resuelva, por ser el ofendido directo, ello no significa que su interés sea ilegítimo y que lo haya llevado a plantear denuncia por hechos falsos o a manipular la información brindada en juicio, por el contrario, los hechos que señaló en debate son contestes en los aspectos medulares con la prueba documental y pericial incorporada a los autos, pues tal y como se indicará, el derecho de posesión que alega le corresponde, se encuentra respaldado con la documental y pericial incorporada, además, narró en forma coherente, clara y circunstanciada, sin ningún vicio de contradicción o intención de exagerar los hechos sufridos, sino que se conformó con señalar lo que a su criterio fue realizado por cada uno de los encausados, reconociendo en ocasiones que al menos uno de ellos no había participado del impedimento de ingreso a su finca (Nombre05), lo que convierte su testimonio en merecedor de credibilidad.
No existe noticia de hechos previos generadores de un conflicto entre las partes (familiares, pasionales, laborales o de otra índole), más que el que nos ocupa por el derecho de posesión y los actos perturbatorios endilgados a los imputados […] En cuanto a Nombre11, es una persona que tan siquiera tiene relación con los imputados, su papel en el proceso es el de vendedor de la propiedad de los fundos, cuya posesión aquí se discute, no se ha desvirtuado de forma alguna, su legitimación para trasladar el dominio o la posesión de las mencionadas propiedades, tampoco existe elemento alguno que haga considerar que la información brindada es falsa o manipulada, sino que se trata de una persona imparcial en el proceso, que no es tan siquiera familiar del denunciante y que únicamente narró lo que le constaba […] [Nombre08 014] y [Nombre08 009], a pesar de ser hijas del ofendido, no son consideradas por quien resuelve, testigos complacientes, contrario a ello, se estima que su dicho es merecedor de credibilidad, porque si bien su interés se relaciona directamente con el bienestar de su padre, ello no implica por sí solo que lo indicado en juicio, sea el resultado de un plan que implique mentir, exagerar o manipular la información brindada.
No existe un solo elemento que objetivamente sugiera que ambas hicieron manifestaciones falsas, sino que narraron solo aquello que pudieron recordar, no se notó en ellas un relato aprehendido o aleccionado, más bien, su lenguaje verbal y no verbal, resultó absolutamente espontáneo, y muy especialmente en el caso de [Nombre08 009], pudo notar ésta juzgadora, rezagos de una afectación que va más allá de un simple conflicto por tierras, sino que con su llanto y sus gestos, describió claramente lo sucedido en una de las ocasiones que implicó confrontación casi física de los dos imputados Nombre01 y Nombre02, contra el ofendido y ellas mismas. Así es que [Nombre08 014], [Nombre08 009] y el ofendido Nombre17, coinciden en los aspectos primordiales, del hecho sexto de la acusación , que describe un acto perturbatorio del legítimo derecho de posesión que tiene el ofendido sobre sus propiedades […]” (cfr. folio 512 vuelto, línea 3 en adelante; la transcripción es literal). Así las cosas, se declaran sin lugar todos los reproches que se incluyen en este primer motivo de apelación.
Violación al principio de continuidad al dictarse la parte dispositiva. Reclama la defensora que, a efectos del dictado de la parte dispositiva, la jueza señaló las 07:15 horas del 18 de julio de 2017. Ante ello, la recurrente le indicó a la juzgadora que ella (la defensora) goza de la hora de la lactancia, por lo que ingresa a laborar a partir de las 08:00 horas; pese a esto, la jueza indicó que mantenía la hora de la diligencia, siendo que ‒en efecto‒ la inició a esa hora. A partir de las 08:00 horas de ese día, la aquí impugnante se apersonó al tribunal para conocer de la decisión, pues el auxiliar le manifiesta que ya se habían retirado todas las partes que se presentaron (incluido el imputado Nombre02). Éste le indicó a la abogada aquí recurrente que él se apersonó aproximadamente a las 07:30 horas y que (para entonces) la jueza ya había notificado la parte dispositiva y se había retirado; que el auxiliar le indicó que lo habían condenado a 6 meses; que la sentencia completa estaba para el 26 de julio; que en la continuación del debate él entendió que la (lectura de la) parte dispositiva era a las 07:30 horas; que a “esa” hora sólo estuvo el coimputado Nombre05.
A partir de lo anterior, la licenciada López Pérez asegura que es más que evidente la violación al debido proceso; que el dictado de la parte dispositiva es parte esencial del contradictorio; que “[…] para nadie es un secreto la obligatoriedad de la presencia […]” (cfr. folio 534); que (la jueza) pudo haber dado un tiempo prudencial a los imputados “que hacían falta”, y si en un plazo razonable los mismos no se hubieran presentado, lo que seguía era ordenar su captura (lo que no hubiera sido necesario, pues ambos se presentaron a las 07:30 horas); que la jueza decidió dictar la parte dispositiva a pesar de la ausencia de la defensa técnica, aún cuando existía justa causa (para ello); también hay violación al debido proceso al dictarse la parte dispositiva en completa ausencia del imputado, siendo que el pasar por alto la parte donde el juzgador resuelve el conflicto y por qué tomó la determinación de condenarle, creó en el encartado una real sensación de injusticia.
Sin lugar los reclamos. No logra demostrar la abogada defensora qué agravio se le generó al encartado por el hecho de que dicha profesional en Derecho no estuviese presente al momento en que se procedió al dictado de la parte dispositiva, o que el imputado (por un error atribuido sólo a él) llegara tarde a dicha diligencia, siendo claro que ya para esa fase procesal estaba cerrado el contradictorio y durante la misma la defensa (técnica y material) sólo podría cumplir el rol pasivo de escuchar la decisión jurisdiccional adoptada, así como una breve reseña de las razones que la sustentan. Tal decisión, así como su fundamentación completa y definitiva, aparecen plasmadas por escrito en la sentencia documento que se confeccionó posteriormente, al cual el encartado y su defensora tuvieron pleno acceso, a tal punto que ambos estuvieron en condiciones de conocer su contenido e impugnarlo, como en efecto lo hicieron.
Es más, lo ocurrido en dicha oportunidad hasta quedó grabado en vídeo (cfr. constancia de folio 495 vuelto), de donde ‒si hubiera sido de su interés‒ las partes podían obtenerlo y reproducirlo, con iguales resultados en caso de que hubieran estado presentes. Con base en lo anterior, se declara sin lugar el reproche
POR TANTO:
Se declaran sin lugar los tres recursos interpuestos por la defensa pública de los imputados.
