Goicoechea, at fifteen hours thirty-five minutes, on veintiuno de diciembre de dos mil diecisiete.- APPEAL filed in the present proceeding brought against [Nombre01 001], [...]; Nombre02 for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of NATURAL RESOURCES. Judges Rosaura García Aguilar, Ana Isabel Solís Zamora, and Rosaura Chinchilla Calderón participated in deciding the appeal. Attorney Wilberth Montenegro Reyes, private defense counsel for the accused, and attorney Héctor Chacón Chang, representing the Ministerio Público, Fiscalía Adjuta de Impugnaciones del Segundo Circuito Judicial de San José, appeared before this Court.

BACKGROUND:

I.By judgment number 38-2017, issued at thirteen hours thirty minutes, on treinta y uno de enero de dos mil diecisiete, the Tribunal Penal del Tercer Circuito Judicial de San José, Desamparados seat, ruled: “THEREFORE: In accordance with the foregoing, Articles 39 and 41 of the Constitución Política, 11 of the Declaración Universal de Derechos Humanos, 8 subsection 2 of the Convención Americana de Derechos Humanos; 1, 2, 3, 9, 16, 30, 31, 32, 33, 324, 326, 333, 335, 336, 341, 360, 363, 364, 365, 366 of the Código Procesal Penal, 1, 2, 3, 11, 30, 103 subsection 1 of the Código Penal, Article 33 and 58 subsection a) of the Ley Forestal, pursuant to the universal principle of in dubio pro reo, [Nombre01 001] is acquitted of all punishment and liability for the offense of VIOLATION OF THE LEY FORESTAL, to the detriment of NATURAL RESOURCES, with which he had been charged. The eviction (desalojo) of the persons residing in the structure located on property [Valor 001], owned by [Nombre01 004], is ordered, for which purpose the Municipalidad de Aserrí shall be charged with verifying that said eviction is carried out within fifteen business days after this judgment becomes final.

The demolition of the structure and restoration of property [Valor 001] to its original condition are ordered, for which purpose the Municipalidad de Aserrí shall be charged with carrying out this order once the occupants of said property have been evicted and this judgment has become final. No special award of costs is made. The termination of any precautionary measure (medida cautelar) imposed on the accused by virtue of these proceedings is ordered. Once this judgment becomes final, the case shall be closed.- Notice shall be given by a full reading at sixteen hours on siete de febrero del año dos mil diecisiete.-” (sic, page 265 of the principal case file).

II.Attorney Wilberth Montenegro Reyes, private defense counsel for the accused [Nombre01 001], filed an appeal against the foregoing ruling.

III.After the corresponding deliberation was conducted in accordance with Article 465 of the Código Procesal Penal (amended by Laws Nº 8837 and Nº 9021 and following the numbering indicated in the Fe de Erratas adopted by resolution of the Legislative Directorate

published in La Gaceta Nº 51 del 12 de marzo de 2012, which is the numbering used in this text), the Court considered the issues raised in the appeal.

IV. The relevant legal requirements were observed in the proceedings

Appellate Judge García Aguilar drafts the decision; and,

CONSIDERING:

I.Composition of the Court: Page 229 of the principal case file shows that an oral hearing (audiencia oral) was held on 9 de mayo de 2017 with Judge Sandra Eugenia Morales Zúñiga sitting as a substitute for Judge Ana Isabel Solís Zamora, together with Judges Joe Campos Bonilla and Rodrigo Obando Santamaría, the former as a regular judge and the latter as a substitute for Judge Rosaura Chinchilla Calderón, who was then authorized to be absent from the Court. However, as indicated in the heading of this judgment, regular Judges Chinchilla Calderón and Solís Zamora, together with substitute Judge Rosaura García Aguilar in place of Judge Campos Bonilla, who is on leave to perform other duties, participate in considering the merits of this matter and issuing this decision. Judge García Aguilar was selected in accordance with the provisions established for that purpose by the Presidencia de la Corte Suprema de Justicia.

Nevertheless, the complete change between the panel that attended the hearing and the panel rendering the decision does not affect the parties’ procedural interests or guarantees because, first, the Sala Constitucional has so ruled in binding decisions (Article 13 of the Ley de la Jurisdicción Constitucional), stating that: “...it is constitutionally valid for judges other than those who participated in the hearing to take part in deciding cases involving cassation arguments or oral hearings at which no evidence is received orally, or where the parties’ arguments are already in writing and nothing new is submitted, if and only if they are able to do so and there are justified reasons—which must be placed on the record—preventing those who attended the oral hearing from meeting at a nearby date to study and decide the matter...” (Sala Constitucional, N° 6681 de las 15:30 horas del 10 de diciembre de 1996 and Nº 17553 de las 12:23 h. del 30 de noviembre de 2007)” (Sala Constitucional, N° 6880 de las 15:05 horas del 22 de mayo de 2013).

Second, the grounds for appeal were not expanded and no evidence was presented at that hearing, and therefore the principle of oral proceedings (principio de oralidad) was not infringed. Furthermore, although the accused made final statements, his remarks are not only summarized in this decision, but, like the arguments of all the parties, could also be directly reviewed and assessed by the current panel through viewing the audiovisual recording made of that hearing. Finally, it must be noted that waiting until the original panel could be constituted or rescheduling the hearing would unduly delay the resolution of this case. That is not feasible, particularly given the time that has elapsed since the judgment was issued—for reasons unrelated to the current composition of this Court—which was the last act interrupting the limitation period for the criminal action (prescripción de la acción penal), a period that is short for offenses of this type. Accordingly, the applications shall be considered by this panel.

II.Admissibility of the appeal: To determine compliance with the formal requirements governing the challenge (impugnación), it is necessary to identify the capacity in which the appellant appears and whether he has standing to file the claim (subjective appealability (impugnabilidad subjetiva)), as well as to assess whether the challenged decision is subject to appeal (objective appealability (impugnabilidad objetiva)). Furthermore, both appellate theory and the national legal system (Articles 439, 459, and 460 of the Código Procesal Penal) establish that a challenge is admissible when it causes prejudice (agravio); that is, “The parties may challenge only judicial decisions that cause them prejudice, provided that they did not contribute to causing it. The appeal must be based on objections to the defects causing the adverse effect.” In this case, the existence of that final requirement is not apparent, since the accused [Nombre01 001] was acquitted on the basis of reasonable doubt of the offense charged, and his private defense counsel, attorney Wilberth E. Montenegro Reyes, challenges that decision seeking either a declaration that the criminal action is time-barred or a finding that no environmental damage was caused.

Even if those grounds could be granted—assuming this hypothetically and solely for purposes of this analysis—neither would entail modification of the acquittal already entered in favor of the accused. In other words, no legal advantage for [Nombre01 001] is apparent if granting the appeal would leave in place a decision producing the same favorable result for him. Nor is there any discernible interest in pursuing this appellate process, because such interest corresponds to the adverse effect and, if the latter is deemed nonexistent, there will likewise be no procedural utility in pursuing it. It should be noted that “In matters of appeal, legal scholarship establishes that ‘interest is the measure of the appeal,’ and further adds: ‘It is evident that if no interest exists as contemplated by law, the party’s appellate activity would lack any ground justifying procedural utility and, consequently, the normal course of the proceeding would be hindered by a futile activity’ (Nombre03, Recursos en Materia Penal.

Principios Generales, Marcos Lerner, s.f.e. p. 87). The existence of a procedural interest (interés procesal) corresponds to the prejudice caused by the challenged decision; if the decision is not adverse to the appellant’s interests, there is no procedural prejudice and the appeal is inadmissible” (Resolución Nº 500-2011 de las 8:55 horas del 10 de noviembre de 2011 del Tribunal de Casación Penal de San Ramón; a position similar to that adopted in judgment Nº 527-16 del 14 de abril de 2016 issued by the Tribunal de Apelación de Sentencia Penal, Segundo Circuito Judicial de San José, composed of Acón, Murillo, and Nombre04). From this perspective, this Chamber concludes that, because neither prejudice nor an interest in filing this appeal exists, the application must be dismissed as inadmissible (see, to similar effect, Nombre05, Nombre05. Proceso penal comentado. 4ª Ed., Editorial Jurídica-Continental, San José, 2009, p. 615, who considers that the existence of prejudice supports the conclusion that the party filing an appeal must possess an interest in challenging the decision).

It must nevertheless be taken into account that an acquittal based on reasonable doubt does not eliminate the possibility that the accused and acquitted person may be adversely affected by rulings concerning, for example, depending on the type of offense charged, a declaration that an instrument is false (declaratoria de falsedad instrumental), civil damages (reparación civil), or forfeiture (comiso), as considered in decision Nº 2010-0974 of the former Tribunal de Casación Penal, whose panel was partially similar to the current one and consisted of Chinchilla, García, and Nombre06. Therefore, notwithstanding the foregoing formal considerations establishing the inadmissibility of this challenge, this Chamber deems it appropriate to examine the merits of the complaint, not only under a broad interpretation of the rights afforded to the appellant, but also in application of the principle of access to justice (principio de acceso a la justicia) and the right to a defense (derecho de defensa), and in view of the relaxation of formal requirements governing appeals (desformalización del recurso de apelación), in order to comply with Article 8.2 of the Convención Americana sobre Derechos Humanos.

This position has been expressed by other national courts which, in cases similar to the one under review, have stated that “...it is not possible to establish categorically that an interest is lacking in every case. Moreover, if the right to appeal, whatever the form of appeal, is understood broadly—as this Chamber has accepted and applied—such a limitation arises from formalistic criteria that must be overcome in accordance with the prevailing standards of flexibility (decisions numbers 719-90 and 1208-98, among others, of the Sala Constitucional and the decision of dos de julio de 2004 of the Corte Interamericana sobre Derechos Humanos). Accordingly, the challenge—which also satisfies the remaining applicable requirements as to timeliness and form—must be formally admitted” (Voto Nº 2010-0974 of the former Tribunal de Casación Penal, composed of Chinchilla, García, and Nombre06). Accordingly, two of the three claims presented are examined on their merits below.

III.Attorney Wilberth E. Montenegro Reyes, private defense counsel (defensor particular) for the accused (encartado) [Nombre 001], appeals judgment Nº 038-2017 issued at 13.30 hours on 31 de enero de 2017 by the Criminal Court of the Third Judicial Circuit of San José, basing his challenges on three grounds, of which the third is addressed first for the reasons stated below. Indeed, as his third ground, the appellant alleges a violation of the right of defense (derecho de defensa) in connection with the order to demolish and vacate the structure, asserting that Ms. [Nombre01 004] owns the property and is not a third-party civil defendant (tercera civilmente demandada), and therefore the demolition of the structure cannot be ordered without affecting her right of defense. Citing several excerpts from the judgment, he asserts that the court below (a quo) contradicts itself because it deems it proven that [Nombre01 004] is an interested third party (tercera interesada), yet also states that “because she is not a civil defendant, her rights cannot be defended”; since Mrs. [Nombre01 004] is an older adult whom the State must protect, expelling her from her home without a prior opportunity to defend herself constitutes an unlawful and forced expropriation.

Likewise, he states that the court contradicts itself by asserting that [Nombre01 004] did participate in the proceedings as an interested third party and, despite being fully aware of that fact, orders that the property be vacated and her house demolished without giving her an opportunity to defend herself; moreover, from the outset of the case she was treated as an accused person, according to the complaint filed by the Sistema de Áreas de Conservación, but she was neither granted a dismissal (sobreseimiento) nor had her legal status adjudicated. Finally, he maintains that the trial court erred in considering a civil action unnecessary to order the demolition, because article 158 of the Ley Forestal imperatively requires it, and that if the Procuraduría General de la República did not file the corresponding civil action, it tacitly waived any civil, monetary, or other form of reparation; therefore, the ruling is ineffective, and he requests that it be reversed because the right of defense and the due process rights of all citizens were violated.

The representative of the Ministerio Público responds to the claim and requests that it be denied, arguing—in summary—that the appellant fails to show that the alleged defects caused him prejudice, since he was acquitted of the charged offense and the vacation and demolition orders concern property that does not belong to him. In this Chamber’s view, the appeal is inadmissible for lack of subjective standing to appeal (impugnabilidad subjetiva). Note that, on the one hand, the appellant’s foregoing challenges focus on attacking the order to vacate and demolish the structure built on the property belonging to Ms. [Nombre01 004], which was also erected within the protection zone of the Río [...]; and, on the other hand, they allege a violation of Mrs. [Nombre01 004]’s rights and a failure to respect her guarantees in connection with the manner in which she participated in the proceedings. Accordingly, the only person with an interest and standing to raise objections of this nature is Ms. [Nombre01 004], not attorney Montenegro Reyes.

The latter appears before this appellate court on behalf of the accused, and it is noted that the notice of appeal (folios 281 to 292) bears only the signature of the accused [Nombre01 001], with no signature or power of attorney granted by Ms. [Nombre01 004] appearing in the record. Although prosecutor Héctor Chacón Chang also pointed out the lack of such authority during the oral hearing held before this Chamber (audiovisual recording number 120018880276PE-09052017090251-2 Mutimedia--0), counsel did not submit it at that time either. In summary, it should be noted that “Under the principle that prejudice is personal, it must have been suffered by the appealing party; in the case of an appeal by defense counsel for the accused, it must have been suffered by the latter, who therefore may not invoke prejudice suffered by another party to the proceedings” (Ayán cited by Nombre05. Proceso penal comentado. 4ª Ed., Editorial Jurídica-Continental, San José, 2009, p. 616).

Consequently, it having been established that the harm alleged by the accused [Nombre01 001] was not suffered by him personally (indeed, the accused himself stated as much during the oral hearing held before this Court when, after being given the floor, he explained in summary that he had been charged even though “I have nothing to do with it because the property belongs to my mother”), but rather by the interested third party [Nombre01 004], it is evident that the appellant and this claim lack subjective standing to appeal and, accordingly, the claim must be declared inadmissible. This is especially so because the accused did not allege that he possessed the dwelling, nor did he establish that he held any other right concerning the land or the structure built upon it that would confer standing on him to raise the aforementioned complaint. Consequently, the argument must be declared inadmissible.

Nevertheless, acting on its own motion and in view of the possible existence of absolute defects (defectos absolutos) concerning the participation of the interested third party—which, if present, could be declared without a prior objection (articles 178 inciso a and 459 of the Código Procesal Penal)—this Chamber finds it necessary to make the following assessments, which rule out the existence of any defect relating to that issue. First, rather than revealing the alleged contradictions concerning Mrs. [Nombre01 004]’s participation in this case (as an accused person, interested third party, or third-party civil defendant), which instead arise from the appellant’s confusing and disorganized arguments, this Chamber concludes from its review of the procedural steps taken that [Nombre01 004] has not appeared in these proceedings as an accused person—as attorney Montenegro claims. Although that designation appears, for example, in the official communication at folio 9, in the “Environmental Damage Assessment” (“Valoración de daños ambientales”) at folios 10 to 15, and in the applications at folios 19 and 22, among other documents, it resulted from a clerical error in the initial investigative steps.

This is because [Nombre01 004] was not formally charged with the unlawful acts at issue in this case, nor was any statement taken from her in the capacity of an accused person. The charging instrument itself shows that the only person to whom the criminal activity was attributed was [Nombre01 001] (folios 112 to 116 of the main case file), and therefore only he was questioned as an accused person (folios 43 and 44 of the main case file) and summoned as the accused to the preliminary hearing and trial (minutes and records at folios 168, 262, and 263 of the main case file); his mother, Ms. [Nombre01 004], was not. Likewise, from its analysis of the challenged judgment and the conduct of the case, this Court of Appeal determines that, at the prosecution’s request and based on the arguments presented by that office during the preliminary hearing of 16 de febrero de 2016, [Nombre01 004] was summoned to the criminal proceedings as an interested third party, not as a civil defendant.

In any event, the only civil action for damages (demanda civil resarcitoria) was brought by the Procuraduría General de la República against the defendant [Nombre01 001] (according to the corresponding case file), and therefore Mrs. [Nombre01 004] appeared in the aforementioned capacity of interested third party at the public oral trial held on 31 de enero de 2017 (see the preliminary-hearing minutes at folio 168, the trial record at folio 203, the summons at folio 249, and the trial minutes at folios 261 and 262 of the main case file). This panel also confirms that, during that public oral hearing, Mrs. [Nombre01 004] was represented by public defender Margarita Gamboa Fuentes, who presented closing arguments on her behalf and in defense of her rights and interests (see the trial record at folio 263 and hearing recording number c0000170131082348). Thus, regardless of whether that attorney objected to participating as legal counsel for an interested third party, as the appellant contends (even if this panel were hypothetically to assume that she shared the view—expressed on other occasions by her colleagues—that the Defensa Pública is responsible, pursuant to section 120 of the Código Procesal Penal, for representing absent civil defendants but not interested third parties), the fact remains that such legal advice and representation were actually and effectively provided.

Therefore, the appellant’s assertion that the interested third party was left without a defense is inaccurate, as is the assertion that the trial court ordered the vacation and demolition in violation of Ms. [Nombre01 004]’s rights and interests. She not only knew of the proceedings and their consequences but was also present at trial, where she received the corresponding legal advice, learned of the charged acts, heard the evidence presented and the parties’ closing arguments—including those of the prosecution and the Procuraduría General de la República—seeking the vacation and demolition of the structure in question. In this manner, Mrs. [Nombre01 004] had the opportunity to be duly informed that the structure built on the land registered in her Nombre01 encroached upon the protection zone of the Río [...], and to be apprised of the potential effects of the judgment on that structure erected on her property and within the described area.

She was also informed at the conclusion of the trial that the operative portion of the judgment would be read at 13:30 hours that same day (according to audiovisual recording number c003170131133524, at 10:15:35), and thus she had access to the ruling and the opportunity to challenge it, had she wished to do so, which she did not. Hence, this panel concludes that no defect whatsoever existed in Ms. [Nombre01 004]’s participation in these proceedings, and it likewise rejects the alleged infringement of the guarantees of due process and the right of defense, since those rights were safeguarded by the sentencing court. In summary, the inadmissibility of the claim is reaffirmed.

IV.As the first ground, attorney Montenegro Reyes alleges erroneous reasoning in the judgment and erroneous application of the law of criminal procedure, because the trial court acquitted his client on the basis of reasonable doubt when, in fact, the case was barred by the statute of limitations (prescripción). Since the limitation period was 3 years, pursuant to Article 31(a) of the Code of Criminal Procedure (Código Procesal Penal), if the acts occurred between 16 May 2011 and 16 May 2012, and the defendant was formally examined (indagado) on 18 December 2013, that period was interrupted and began to run again, reduced by half, until it expired on 18 June 2015. Accordingly, he asserts that the Public Prosecutor’s Office (Ministerio Público) filed the indictment after the statute of limitations had already run in this case; moreover, because the trial was held on 31 January 2017, the criminal prosecution (acción penal) was also long since time-barred and, therefore, the participation of the Office of the Attorney General of the Republic (Procuraduría General de la República) in that trial was untimely and unlawful, and its requests cannot be entertained.

In his response, prosecutor Héctor Chacon Chang states that the claim cannot succeed because, in summary, it was found proven that, on an unspecified date in 2011, a house was built on property in the San José Registry District (Partido de San José) N° [Valor 001], owned by [Nombre01 004], within the protection area (área de protección) of the [...] stream, in violation of the statutory boundaries and causing environmental damage (daño ambiental); furthermore, the building remains within that area, and the limitation period runs from the time such continued presence ceases, meaning that the criminal prosecution is not time-barred. This is compounded by the fact that [Nombre01 001] has not established the harm suffered, because the land is registered in the name of [Nombre01 004], who is neither listed as a defendant nor as the principal of the accused or his attorney. The alleged defect does not exist, and the statute-of-limitations defense (excepción de prescripción) must be denied.

To assess this preliminary defense requiring a special ruling (defensa de previo y especial pronunciamiento), Article 31(a) of the Code of Criminal Procedure provides that the period to be calculated is equal to the maximum sentence for offenses punishable by imprisonment, which may not be less than 3 years or exceed 10 years, except for offenses committed against minors. According to the indictment and request for committal to trial (solicitud de apertura a juicio) filed by the Public Prosecutor’s Office, [Nombre01 001] was charged with the offense of encroachment upon a protection area (invasión de una zona de protección), with the following allegations: “1.- The property in the San José Registry District, 1-[Valor 001]/ SJ [Valor 003], is located in [...] and is owned by [Nombre01 004], the mother of defendant [Nombre01 001].- 2.- On an exact date that could not be determined, but during the period between 16 May 2011 and 16 May 2012, defendant [Nombre01 001] hired personnel and machinery and carried out construction so that, under his orders and direction, they would build a two-story dwelling measuring approximately 120 square meters per floor, for a total of 240 square meters, within the aforementioned property in the locality of Aserrí, on the banks of the [...] River, without building permits from the Municipality of Aserrí or from Minae. 3.- That building was erected within the protection area of the [...] Stream, in violation of the boundaries established by law for land located near streams. 4.- For those purposes, the accused [Nombre01 001] personally undertook and instructed his subordinates to carry out earthworks (movimientos de tierra) and remove trees and shrubs comprising the plant material covering the site in order to erect the building, thereby eliminating the vegetation at the site and, through that work, causing harm to the environment. 5.- As a result, environmental damage was caused as a direct consequence of the building erected by defendant [Nombre01 001] within the protection area of the [...] Stream, because the building was erected within a protected area, and the impact was assessed at UN MILLON DOSCIENTOS MIL COLONES. 6.- As of 03 March 2015, that dwelling remains in the aforementioned protected area on the banks of the [...] River” (sic, pages 112 to 116 of the main case file).

The offense described is punishable by 3 months to 3 years of imprisonment under Article 58(a) of Ley Forestal N° 7575, meaning that the applicable limitation period is 3 years. Article 32 of the Code of Procedure, as amended by Ley Nº 9082 of 12 October 2012, likewise provides: “Limitation periods shall be governed by the principal penalty prescribed by law and shall begin to run, for completed offenses (infracciones consumadas), on the date of completion; for attempts, on the date on which the final act of execution occurred; and, for continuous or continuing offenses (delitos continuos o permanentes), on the date on which their continuing nature ceased” (emphasis supplied). Thus, when a protection area associated with a river or stream is encroached upon, the consequences of the unlawful act continue for as long as that area remains occupied or encroached upon, because “…to encroach entails acts of occupying the site, which take the form of establishing oneself there and exercising control over it,” according to decision N° 1131-2016 of the Third Chamber of the Supreme Court of Justice (Sala Tercera de la Corte Suprema de Justicia).

It has likewise been held that, under Article 58(a) of Ley Forestal, the term “encroach” is used “…in both of its meanings: entry by force and unlawful occupation,” according to ruling N° 388-2016 of the Criminal Judgment Appeals Court of the Third Judicial Circuit of Alajuela, San Ramón (Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela, San Ramón). This Chamber also finds that the effects of the described unlawful act are continuing insofar as they impair the protected legal interest (bien jurídico tutelado); accordingly, the aforementioned 3-year period for extinguishing the criminal prosecution can begin to run only when the occupation or encroachment carried out by the perpetrator ends or ceases. Decision N° 324-2015 of the Criminal Judgment Appeals Court of Cartago (Tribunal de Apelación de Sentencia Penal de Cartago) adopted a criterion similar to that stated above, explaining: “The offense of encroachment upon conservation areas is unquestionably a continuing offense, because the conduct is not completed upon construction of the access track; rather, its effects continue over time, continuously harming the protected legal interest—a healthy and ecologically balanced environment—given the consequences that encroachment upon that protection area has for the environment, including the removal of forest that affects animal and plant species and reduces oxygen production, as well as the resulting harm to the water resource protected there.

Consequently, its continuing nature, within the meaning of Article 32 of the Code of Criminal Procedure, ceases only when conditions are restored to the state in which they existed before the violation of the law.” From this perspective, because the cited period is calculated for “continuous” or “continuing” offenses from the date on which their continuing nature ended, it is necessary to determine when that condition was satisfied. In this matter, it has been established that, according to the indictment (point 6, pages 112 to 126), the private criminal complaint (querella) (as stated in allegation five of the corresponding file, pages 1 to 9), and even the facts found proven in the judgment (fact five on page 272 of the main file), the house built on property number 1-[Valor 001] in the San José Registry District, located on the banks of the [...] River, remained within the protection area described from at least 2011 through the end of January 2017—the last date on which the trial was held—and it was precisely for that reason that the trial court ordered its demolition in the challenged judgment.

Furthermore, the testimony of Nombre07 was received at trial. He is a highly experienced forestry technician who filed the complaint that initiated these proceedings and who testified, insofar as relevant, that “he has repeatedly passed by this site and observes that the structure is now complete; he states that the last day he passed by that location was yesterday [and because the trial was held on 31 January 2017, the witness was referring to 30 January 2017] and that the structure is still there” (page 275 of the main file). Therefore, irrespective of the fact that the defendant was formally examined on 18 December 2013 (pages 43 and 44), that the Public Prosecutor’s Office filed the indictment on 13 August 2015 (pages 112 to 116), and that the preliminary hearing (audiencia preliminar) was first scheduled and convened by a decision issued at 16:05 on 28 August 2015, the fact remains that the limitation period for the criminal prosecution has not elapsed as alleged; indeed, its calculation could not even begin at this time because the described protection area remains occupied, as confirmed by the present claim. For all the foregoing reasons, the statute-of-limitations defense must be denied.

V.As his second ground, the appellant alleges that the judgment contains erroneous reasoning, that the evidence was improperly assessed, and that the proven facts relating to the demolition order were incorrectly determined, because the prosecution evidence presented did not establish who was responsible for committing the criminal offense and, in addition, the expert evidence was not properly weighed when the demolition of the structure and the eviction of the property’s occupants were ordered, such measures amounting to a compulsory expropriation without legal basis. Citing several excerpts from the trial court’s decision, he states that the demolition lacks evidentiary support because it is based not on logical arguments but on the judge’s subjective assessments, and the judge neither explains the nature and type of the damage nor identifies the actual harm to nature or the environment.

He argues that the assessment determined the environmental damage to be “only one million one hundred ninety-nine thousand nine hundred ninety-five colones, meaning that it was extremely minor, almost negligible,” which is inconsistent with the magnitude asserted by the court below, which characterizes it as “catastrophic” without any support and also fails to identify what makes it serious for the community or what scientific evidence was used to determine that seriousness; furthermore, although reference is made to a serious risk to the persons living in the building, there is no technical report from the Comisión Nacional de Emergencias or the Municipality. He notes that point 6 of the environmental assessment report, entitled “Uses of the affected area,” states: “…residential indicator, 25%. The surrounding area is used for residential purposes; however, the protection area must not be used for this” (sic), from which it may be inferred that the affected area is used by local residents for residential purposes, and that such damage was not claimed by the Procuraduría General de la República—through the civil action for damages (acción civil resarcitoria)—because of the minimal harm to the environment, thereby establishing that the trial court’s assertion was unfounded; for these reasons, he requests that the appeal be granted and that the eviction and demolition orders be vacated.

The representative of the Ministerio Público responds to the claim and requests that it be denied because the challenged decision is supported by the study conducted by forestry engineer Ronald Mora Vargas, which establishes the existence of the environmental damage resulting from the construction of the dwelling and details that damage in the assessment submitted; he adds that, because this is an endangerment offense (delito de peligro), it is presumed that occupying an area located less than 50 meters from the riverbanks on sloping land places natural resources at risk, and that even if it did not cause such harm, the purpose of the law is to prevent the conduct creating the risk from becoming widespread, while the appellant has failed to show that the alleged defects caused him prejudice because the accused was acquitted, the property does not belong to him, and he is not the owner’s attorney-in-fact.

The alleged error is deemed nonexistent. First, this Chamber observes that the central issue raised is limited to the demolition order contained in the judgment, with the appellant alleging that the expert evidence was not adequately weighed before the order was issued and that the order rests on no evidentiary basis but only on the court’s subjective assessments, without specifying the characteristics or extent of the damage or harm to the environment. However, the appellant is not correct, because the trial court found it proven that, in 2011, a house was built on property registered in San José under number 1-[Valor 001]/ SJ [Valor 003], located in the locality of [...], on the banks of the river [...], owned by [Nombre01 004], and that the structure was erected within the protection area (área de protección) of Quebrada [...], in disregard of the legally prescribed boundaries. The trial court explained that the foregoing events, and particularly the construction along the banks of Río [...] in the locality of Aserrí, were established based on the testimony of Nombre07, a forestry technician who, in addition to filing complaint Nº ACOPAC-OSRP-DEN-OO24-12, which initiated the proceedings, explained at trial that, at the request of the Alcalde Municipal de Aserrí, he went with a municipal official to the described site to inspect the structure in question, where he took the measurements required in the performance of his duties and, using an instrument called a “clinometer” to measure the slope of land, determined beyond any doubt that the structure was being built within a protected area.

The trial court compared that testimony with the complaint and the photographs admitted at trial, reaching the conclusion that “The complaint document that he submitted states the same thing that this witness reported regarding the degree of the slope he measured on the day he visited the site, and that the result of this measurement was that the slope where the construction was taking place exceeded 40 percent; under the Ley Forestal, if this condition exists, the protection area shall be fifty meters (…) the photographs show tape that he [referring to witness Nombre07] placed on this structure on the first day he visited, when he informed the workers present that day that they were building within a protection area and, moreover, left a message with them asking the person in charge of the work to contact him so that the work could be stopped; these measures had no effect, as the work continued” (folio 275 of the main case file).

The trial court also relied on the testimony of survey engineer Nombre08, who works in the Departamento de Ciencias Forenses del Organismo de Investigación Judicial and prepared Forensic Report (Dictamen Criminalístico) Nº 2015-180-ING (folios 97 to 99 of the main case file), which, together with the inspection conducted at the site (folios 1 to 4 of the main case file), not only specifies how the land was measured using an accurate and appropriate instrument but also supports the conclusion that the entire structure is located within the protection zone. Accordingly, because this panel finds that the trial judge’s reasoning reflects an objective and comprehensive weighing of those items of evidence in accordance with the rules of rational sound judgment (sana crítica racional), the appellant’s assertions that the reasoning is based on subjective and unfounded assessments are untenable. Furthermore, this Appellate Court observes that the court below found as its fourth proven fact that the structure in question “…caused environmental damage as a direct consequence of the construction erected there within the protection area of Quebrada [...]”; in making that finding, the lower court relied on the testimony of forestry technician Nombre07, who, when asked about the effects caused by the structure, stated that the flow of this river had caused flooding affecting many families in the same area and that this had produced environmental and community-health consequences, in addition to polluting the river, while the area could no longer be reforested; he therefore recommended that the structure be demolished.

From that standpoint, although the appellant argues that the judge gives the damage a “catastrophic” connotation, the fact remains that the cited testimony supports the inference that its impact on the community could indeed be of that magnitude, particularly because it states that the structure had caused flooding and that river pollution would endanger public health. Contrary to the appellant’s assertion, it is likewise apparent that, although the site where the described structure was built is residential, the areas adjoining the riverbed must be protected because of the river’s presence, as determined by the “Environmental Damage Assessment” report prepared by Engineer Ronald Mora Vargas, an official of the Área de Conservación de Pacífico Central, Subregión Puriscal, an expert report admitted into evidence and introduced in the adversarial proceedings (folios 9 to 15 of the main case file), which states that, although the affected area is used for residential purposes, it must clearly be understood that “the protection area, however, must not be used for this” (emphasis added, point 6 of the report at folio 13 of the main case file).

In addition, the trial court found that Nombre07’s statements reinforced the information in point 4.4.5 of the study, insofar as the court below stated that “…for the Ecological Niche, the indicator is 100 percent. High impact. This damage is highly significant because vegetation is first removed or eliminated, then the soil is removed, and nothing remains of the ecosystem for flora and fauna; this confirms the extensive damage caused by the construction carried out in this area. This enables this Court to find that the construction caused environmental damage to the area protected by the State” (folios 275 and 276 of the main case file). The lower court later stated that the affected area was considered a life zone (zona de vida), that these protection areas are the last remnants of forests in urban areas, and that the harm affected hydrology, soils, and the ecosystem, among other things.

Moreover, this Chamber’s review of the cited study confirms that professional opinion. The study explains the factors considered in determining the economic valuation of the environmental damage caused by the construction of the aforementioned dwelling in the protection area of Río [...]; it states that earthworks (movimientos de tierra) disturbed 120 square meters of the protected zone, entailing not only the associated cost but also the resulting impact on other factors, including the affected life zone (25%); vegetation cover (cobertura vegetal) (50%); the ecosystem (75%), with the interventions being considered precarious because “the area may easily experience a landslide and cause further damage not only to nature but also to other persons”; hydrology, under its pollution indicator (25%), because “Soil runoff pollutes the water, also affects its quality, prevents microorganisms from using it, and alters the channel downstream”; soils, under the erosion (25%), drainage (25%), and removal (25%) indicators, because “Preparing the building pad causes mechanical soil erosion; likewise, rainfall washes the soil away, thereby draining the soil and removing its upper, fertile layer”; and the ecological niche (between 50% and 100%), explaining that “There was a partial alteration of the protection area, which continues both downstream and upstream,” and that “This damage is highly significant because vegetation is first removed or eliminated, then the soil is removed, and nothing remains of the ecosystem for flora and fauna” (folios 12 and 13 of the main case file).

Consequently, this Chamber concludes that the appellant is incorrect in asserting that neither the damage caused nor its extent was determined and that the judge lacked a scientific basis for his assessments. It should be noted that the appellant himself acknowledges the existence of the damage when he asserts that it occurred, and although he claims that its magnitude was less than that identified by the court below, in Engineer’s report.

It was also explained to Mora Vargas that these “ …percentages assigned to each harm caused are directly related to the actual carrying capacity of each one; for example, where 100% is assigned, the damage is total (…) Some damage has been valued at 25% of the initial investment because, within six months, the harm caused will reach its climax, and the phases immediately following it will involve adaptation and recovery (…) damage has also been valued at 75% of the initial investment because this damage will continue to produce aftereffects 36 months after it occurs ” (emphasis added, folio 13). In conjunction with the foregoing, even though the damage may have been quantified at the amount cited by the appellant, this does not mean that the harm was minor because, even if it were minor from an economic standpoint, the fact remains that the negative environmental impact occurred and reached different percentages depending on each factor, as stated above.

The public defender also agreed with this during her closing arguments at trial, asserting that the environmental damage (daño ambiental) and encroachment upon the protection zone (zona de protección) had been proven, but not that the accused was responsible for the event (audiovisual recording number c0000170131094532, at 10:09:55). Furthermore, this panel finds that the ruling on restoring matters to their original condition, together with the resulting order to vacate and demolish the structure, is a necessary effect of the decision in a case such as this one, involving the illegal encroachment upon a protection area (área de protección), because section 33(b) of the Ley Forestal declares the following to be such an area: “A strip measuring fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both sides along the banks of rivers, creeks, or streams, if the land is flat, and fifty horizontal meters if the land is rugged.” Accordingly, an express legal prohibition supports demolition when construction occurs within the specified area.

Likewise, the decision is supported by the legal system because, when used as a provisional measure (medida provisional), section 140 of the Code of Criminal Procedure authorizes the following: “At any stage of the proceedings and at the request of the injured party, the court may order, as a provisional measure, that matters be restored to the condition in which they existed before the act, provided that sufficient grounds exist for making such a determination”; whereas, on a definitive rather than provisional basis, restitution (restitución) of matters to their original condition is appropriate pursuant to Article 103(1) of the Criminal Code. Consequently, since the construction within a protection zone, the causation of environmental damage, and the legal basis for ordering the structure to be vacated and demolished were proven in this case, the appellant’s arguments that this judicial order is based on the trial judge’s subjective assessments are without merit.

Nor was it necessary for such damage to have been claimed by the Procuraduría General de la República through a compensatory civil action (acción civil resarcitoria), because a declaration of that damage does not depend on such an action but on verification of its actual existence, as undertaken by the trial court, whose reasoning this panel shares. Moreover, the legal provisions cited above establish restitution as an inherent consequence of criminal acts that, like the one charged, entail alteration of the original condition of matters and, in this particular case, harm to natural resources and a negative impact on the environment. Similarly, the application of restitution precludes compulsory expropriation (expropiación forzosa) (which could be ordered pursuant to Article 45 of the Political Constitution and Ley de Expropiaciones Nº 7495, as amended by Ley Nº 9286), which applies in circumstances different from those considered here, where the illegal occupation of a protection area adjacent to Río [...] and harm to the environment were established.

Furthermore, this panel finds that the seriousness of the damage and its impact on the community are clear, as is the identification of the evidence used by the trial judge to make that determination, including testimonial and expert evidence (prueba testimonial y pericial). Contrary to the appellant’s contention, no technical report from the Comisión Nacional de Emergencias or the Municipalidad was required to corroborate it, because our criminal justice system is governed by the assessment of evidence under the rules of rational sound judgment (sana crítica racional), and proof of an event does not require the identification of a predetermined item of evidence; rather, evidence may be freely used to establish it, provided that the evidence relied upon is lawful and was legally introduced into the proceedings (Articles 181 and 182 of the Code of Criminal Procedure). For the foregoing reasons, the appeal must be denied.

THEREFORE:

The third ground is declared inadmissible, and the first and second grounds of the appeal filed by attorney Montenegro Reyes are denied. Goicoechea, a las quince horas treinta y cinco minutos, del veintiuno de diciembre de dos mil diecisiete.- RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra [Nombre01 001], [...]; Nombre02 el delito de INFRACCIÓN A LA LEY FORESTAL, en perjuicio de LOS RECURSOS NATURALES. RESULTANDO:

I.Que mediante sentencia número 38-2017, de las trece horas treinta minutos, del treinta y uno de enero de dos mil diecisiete, el Tribunal Penal del Tercer Circuito Judicial de San José, sede Desamparados, resolvió: "POR TANTO: Conforme a lo expuesto, artículos 39 y 41 de la Constitución Política, 11 de la Declaración Universal de Derechos Humanos, 8 inciso 2 de la Convención Americana de Derechos Humanos; 1, 2, 3, 9, 16, 30, 31, 32, 33, 324, 326, 333, 335, 336, 341, 360, 363, 364, 365, 366 del Código Procesal Penal, 1, 2, 3, 11, 30, 103 inc. 1 del Código Penal, art. 33 y 58 inc. a) de la Ley Forestal, bajo el Principio Universal de In Dubio Pro Reo se absuelve de toda pena y responsabilidad a [Nombre01 001] del delito de INFRACCIÓN A LA LEY FORESTAL, que en perjuicio de LOS RECURSOS NATURALES se le venía atribuyendo. Se ordena el desalojo de las personas que se encuentren habitando la construcción situada en la finca [Valor 001] cuya propietaria es [Nombre01 004], para lo cual se delegará a la Municipalidad de Aserrí constatar que dicho desalojo se cumpla dentro de los quince días hábiles una vez firme esta sentencia.

Se ordena el derribo de la construcción y la restitución de las cosas a su estado original de la finca [Valor 001], para lo cual se delegará a la Municipalidad de Aserrí se cumpla con esta orden una vez verificado el desalojo de los habitantes de dicha propiedad y una vez firme esta sentencia. Se resuelve sin especial condenatoria en costas. Se ordena el cese de cualquier medida cautelar que vinieran soportando el acusado en virtud de la presente causa. Una vez firme se ordena su archivo.- Notifíquese mediante lectura integral a las dieciséis horas del día siete de febrero del año dos mil diecisiete.- " (sic, folio 265 del legajo principal).

II.Que contra el anterior pronunciamiento interpuso recurso de apelación el licenciado Wilberth Montenegro Reyes, defensor particular del encartado [Nombre01 001].

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal (reformado por leyes Nº 8837 y Nº 9021 y siguiendo la numeración indicada en la Fe de Erratas adoptada mediante acuerdo del directorio

legislativo publicado en La Gaceta Nº 51 del 12 de marzo de 2012, que es la que se usará en este texto), el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta la jueza de Apelación de Sentencia Penal García Aguilar; y,

CONSIDERANDO:

I.Conformación del tribunal: Consta en folio 229 del legajo principal, la realización de la audiencia oral en fecha 9 de mayo de 2017 con la integración de la jueza Sandra Eugenia Morales Zúñiga, quien por rol de sustitución participó en lugar de la jueza Ana Isabel Solís Zamora, y los jueces Joe Campos Bonilla y Rodrigo Obando Santamaría, el primero como titular y el segundo en sustitución de la jueza Rosaura Chinchilla Calderón, quien en ese momento se encontraba autorizada para ausentarse del Tribunal. Sin embargo, como se indica en el encabezado de la presente sentencia, para conocer el fondo de este asunto y emitir la presente resolución, intervienen las juezas titulares Chinchilla Calderón y Solís Zamora y, en sustitución del juez Campos Bonilla (quien goza de permiso para ejercer otras labores), la jueza suplente Rosaura García Aguilar, seleccionada conforme a las disposiciones que para tal efecto establece la Presidencia de la Corte Suprema de Justicia.

No obstante, la modificación total de la integración que asistió a la audiencia respecto de la que resuelve, no afecta los intereses procesales ni las garantías de las partes, debido a que, primero, así lo ha dispuesto la Sala Constitucional mediante pronunciamientos vinculantes (artículo 13 de la Ley de la Jurisdicción Constitucional) en los que ha indicado que: “...resulta constitucionalmente válido que en aquellas vistas o audiencias orales de casación en las que no se reciban elementos de prueba en forma oral o, que las argumentaciones de las partes consten ya por escrito, sin que se aporte nada nuevo, puedan intervenir otros jueces, distintos a los que participaron la vista, a la hora de tomar la decisión, si y sólo si, están en capacidad de hacerlo y existen razones justificadas (que deberán constar) que impidan que quienes estuvieron en la audiencia oral se reúnan en fecha próxima a estudiar y resolver el asunto...' (Sala Constitucional, N° 6681 de las 15:30 horas del 10 de diciembre de 1996 y Nº 17553 de las 12:23 h. del 30 de noviembre de 2007)» (Sala Constitucional, N° 6880 de las 15:05 horas del 22 de mayo de 2013).

En segundo lugar, porque en aquella audiencia no se ampliaron los motivos de apelación, ni se evacuó prueba alguna, por lo que no se infringe el principio de oralidad. Además, si bien el imputado hizo unas manifestaciones finales, su dicho no solo se resume en esta decisión, sino que tanto como los alegatos de todas las partes, han podido ser apreciados e inmediados por la actual integración, a partir de la visualización del soporte audiovisual que se hizo de dicha audiencia. Finalmente, es menester indicar que esperar a contar con la integración primigenia o volver a programar la audiencia implicaría demorar en demasía la resolución de este caso, lo que no es posible máxime el tiempo que ha transcurrido desde la emisión de la sentencia (por causas que resultan ajenas a la conformación actual de este tribunal), que fue el último acto interruptor del plazo de prescripción de la acción penal que, en este tipo de delitos, es corto. Por ello, procede conocer las gestiones con esta integración.

II.Admisibilidad del recurso: Para determinar el cumplimiento de los requisitos formales de la impugnación, debe identificarse en qué calidad se apersona el recurrente y si goza de legitimación para la formulación del reclamo (impugnabilidad subjetiva), así como ponderar si la resolución cuestionada admite la interposición del recurso (impugnabilidad objetiva). Además, tanto la teoría recursiva como el ordenamiento jurídico nacional (artículos 439, 459 y 460 del Código Procesal Penal), determinan que la impugnación es admisible cuando cause agravio; es decir, que “ Las partes sólo podrán impugnar las decisiones judiciales que les causen agravio, siempre que no hayan contribuido a provocarlo. El recurso deberá sustentarse en el reproche de los defectos que causan la afectación” sin que, en el presente caso, se advierta la existencia del último requisito, pues el encartado [Nombre01 001] fue absuelto por duda del delito endilgado y su defensor particular, licenciado Wilberth E. Montenegro Reyes, ataca dicha resolución pretendiendo la declaratoria de prescripción de la acción penal, o bien, la ausencia de provocación de un daño ambiental, motivos que, de ser amparables (asumiéndolo así hipotéticamente y solo para efectos de este análisis), en uno u otro supuesto, no conllevarían a la modificación de la decisión absolutoria ya adoptada en favor del imputado.

Con otras palabras, no se vislumbra una ventaja jurídica para [Nombre01 001] si, ante el eventual acogimiento de la apelación, se mantiene una decisión que produciría el mismo resultado (favorable) para su persona. Tampoco se detecta el interés para cumplir con esta dinámica impugnaticia en tanto dicho interés es correlativo al menoscabo y si este último se estima inexistente, de igual manera, faltará la utilidad procesal para su desarrollo. Obsérvese que “ En materia de recursos la doctrina establece que: "el interés es la medida del recurso", se agrega además "Es evidente que si no existe interés, tal cual lo aprecia la ley, la actividad impugnativa del sujeto carecería de un motivo que justifique una utilidad procesal y, como consecuencia, se entorpecería el normal desarrollo del proceso con una actividad inútil" (Nombre03, Recursos en Materia Penal. Principios Generales, Marcos Lerner, s.f.e. p. 87).

La existencia de un interés procesal es correlativa al agravio ocasionado con la decisión que se recurre, si la decisión no es gravosa para los intereses de la parte recurrente, no existe un agravio procesal y el recurso resulta inadmisible” (Resolución Nº 500-2011 de las 8:55 horas del 10 de noviembre de 2011 del Tribunal de Casación Penal de San Ramón; criterio similar al sostenido en la sentencia Nº 527-16 del 14 de abril de 2016 emitida por el Tribunal de Apelación de Sentencia Penal, Segundo Circuito Judicial de San José, integrado por Acón, Murillo y Nombre04). Desde esta óptica, en consideración de esta Cámara por no existir agravio ni, tampoco, interés para entablar este recurso, corresponde el rechazo, por inadmisible, de la gestión (ver en similar sentido Nombre05, Nombre05. Proceso penal comentado. 4ª Ed., Editorial Jurídica-Continental, San José, 2009, p. 615, quien considera que la existencia de un agravio lleva a afirmar la necesidad de que concurra un interés para impugnar por la parte que formula el recurso).

Ahora bien, debe tomarse en cuenta que una sentencia por duda no elimina la posibilidad de que la persona acusada y absuelta pueda resultar perjudicada por lo que se decida, por ejemplo, según sea el tipo de delito atribuido, sobre la declaratoria de falsedad instrumental, la reparación civil, o el comiso, conforme se ha valorado en la resolución Nº 2010-0974 del entonces Tribunal de Casación Penal, con una integración parcialmente similar a la actual (por Chinchilla, García y Nombre06). De ahí que, pese a lo indicado en punto a los aspectos formales que determinan la inadmisibilidad de la presente impugnación, esta Cámara estima procedente analizar, por el fondo, la queja formulada no solo de acuerdo con una interpretación amplia de los derechos reconocidos a la parte recurrente, sino en aplicación del principio de acceso a la justicia y del derecho de defensa y en atención a la desformalización del recurso de apelación para cumplir con el artículo 8.2 de la Convención Americana sobre Derechos Humanos; criterio externado por otros órganos jurisdiccionales nacionales cuando, en asuntos semejantes al analizado, han señalado que “…no es posible establecer, de forma imperativa, la falta de interés en todos los casos.

Por otra parte, si se asume el derecho al recurso, cualquiera que éste sea, de una forma amplia -tal y como esta Cámara lo ha venido aceptando y aplicando- aquella limitación surge de criterios formalistas que, conforme a los criterios de flexibilización imperantes (votos números 719-90 y 1208-98, entre otros, de la Sala Constitucional y resolución del dos de julio de 2004 de la Corte Interamericana sobre Derechos Humanos) deben superarse. En razón de lo anterior, debe admitirse formalmente la impugnación que, además, cumple con los restantes requisitos establecidos al efecto en cuanto a tiempo y forma” (Voto Nº 2010-0974 del entonces Tribunal de Casación Penal, integrado por Chinchilla, García y Nombre06). Así las cosas, se valoran a continuación por el fondo dos, de los tres, reclamos presentados.

III.El licenciado Wilberth E. Montenegro Reyes, defensor particular del encartado [Nombre 001], apela la sentencia Nº 038-2017 de las 13.30 horas del 31 de enero de 2017, emitida por el Tribunal Penal del Tercer Circuito Judicial de San José, basando sus cuestionamientos en tres motivos, de los cuales se prioriza el tercero en razón de lo que más adelante se dirá. En efecto, como tercer motivo, alega el recurrente la violación al derecho de defensa en relación con la orden de derribo y de desalojo de la obra, para lo cual afirma que la señora [Nombre01 004] es propietaria del inmueble y no es tercera civilmente demandada, por lo que no se puede disponer el derribo de la construcción sin la afectación de su derecho de defensa. Mediante la cita de algunos extractos de la sentencia, asevera que el a quo incurre en contradicciones pues tiene por acreditado que [Nombre01 004] es tercera interesada pero, de manera diversa, también asegura que “al no ser demandada civilmente, no se le pueden defender sus derechos”; tratándose doña [Nombre01 004] de una persona adulta mayor, a quien el Estado debe darle protección, por lo que expulsarla de su casa, sin previa defensa, constituye una expropiación ilegítima y forzada.

De igual forma, señala que el tribunal se contradice al afirmar que [Nombre01 004] sí formó parte del proceso como tercera interesada y, a pesar de ese pleno conocimiento, ordena el desalojo de la propiedad y el derribo de su casa, sin posibilidad de defensa; aparte de que, desde el inicio de la causa, se le tuvo como imputada, según la denuncia formulada por el Sistema de Áreas de Conservación, pero no se le sobreseyó ni resolvió situación jurídica. Sostiene, finalmente, que el juzgador se equivoca por considerar innecesaria la acción civil para ordenar el derribo pues el artículo 158 de la Ley Forestal así lo establece imperativamente y que si la Procuraduría General de la República no presentó la respectiva acción civil, tácitamente renuncia a cualquier reparación civil, pecuniaria o de otra especie, por lo que la resolución es ineficaz y solicita se revoque, dado que existe violación al derecho defensa y al debido proceso de todos los ciudadanos.

El representante del Ministerio Público contesta el reclamo y pide su rechazo, para lo cual –en síntesis- aduce que el recurrente no demuestra que los vicios le causen agravio pues fue absuelto del delito imputado y el desalojo y derribo recaen en una propiedad que no es suya. En consideración de esta Cámara, a falta de la impugnabilidad subjetiva, el recurso formulado resulta inadmisible. Nótese que, por un lado, los anteriores cuestionamientos del recurrente se concentran en atacar la orden de desalojo y de derribo de la obra construida en el inmueble perteneciente a la señora [Nombre01 004], la cual también fue levantada dentro de la zona de protección del Río [...]; y, por otra parte, alegando la vulneración de los derechos e irrespeto de las garantías de doña [Nombre01 004] en relación con la forma en que se dio su intervención dentro del proceso, por lo que quien tendría interés y legitimación para formular las objeciones de este carácter es solamente la señora [Nombre01 004] y no el licenciado Montenegro Reyes.

El último comparece en esta sede en representación del imputado, advirtiéndose que el escrito de interposición del recurso (folios 281 a 292) únicamente está rubricado por el encartado [Nombre01 001], sin que conste la firma ni poder alguno otorgado por la señora [Nombre01 004] y aunque la ausencia del mandato también la hizo ver el fiscal Héctor Chacón Chang durante la audiencia oral celebrada ante esta Cámara (registro audiovisual número 120018880276PE-09052017090251-2 Mutimedia--0), tampoco el abogado lo aportó en ese momento. En resumen, cabe señalar que “Conforme al principio de personalidad del agravio, el mismo debe haberse sufrido por la parte impugnante, en el caso del recurso del defensor del imputado, por este último, de modo que no puede invocar el perjuicio sufrido por otro sujeto procesal” (Ayán citado por Nombre05. Proceso penal comentado. 4ª Ed., Editorial Jurídica-Continental, San José, 2009, p. 616).

En consecuencia, habiéndose establecido que los menoscabos alegados por el encartado [Nombre01 001] no fueron experimentados por su persona (incluso, el propio imputado así lo manifestó durante la audiencia oral celebrada ante este Tribunal cuando, al dársele la palabra, en síntesis, explicó que a él lo habían acusado pese a que “no tengo nada que ver porque la propiedad es de mi mamá”), sino por la tercera interesada [Nombre01 004], es evidente que el apelante y este reclamo, carece de impugnabilidad subjetiva y, por ello, debe declararse inadmisible; máxime que tampoco el imputado alegó ser poseedor de la vivienda, ni acreditó ser titular de otro derecho en relación con el terreno o respecto de la obra construida, para estimarlo legitimado para la formulación de la aludida queja. En consecuencia, el alegato debe declararse inadmisible. Empero, esta Cámara, de oficio, ante la posible existencia de defectos absolutos respecto de la participación de la tercera interesada, que, de concurrir, serían declarables sin protesta previa (artículos 178 inciso a y 459 del Código Procesal Penal), determina la necesidad de hacer las siguientes valoraciones que permiten descartar la ausencia de cualquier vicio atinente al citado tema.

Primero, se observa que lejos de las señaladas contradicciones sobre la intervención de doña [Nombre01 004] en en esta causa (como encartada, tercera interesada o tercera civilmente demandada), que más bien responden a argumentos confusos y desorganizados del apelante, concluye esta Cámara que del estudio de las actuaciones procesales cumplidas, [Nombre01 004] no ha figurado en este proceso como acusada -según se afirma por el licenciado Montenegro- pues si bien esta denominación es insertada, por ejemplo, en el oficio de folio 9, en la “Valoración de daños ambientales” de folios 10 a 15 y en las solicitudes de folios 19 y 22, entre otros documentos, lo cierto es que responde a un error de carácter material de las primeras diligencias de investigación efectuadas. Lo anterior porque a [Nombre01 004] no se le imputaron formalmente los hechos ilícitos objeto del presente asunto, ni se le recibió declaración alguna en carácter de encartada.

De la propia pieza acusatoria deriva que la única persona a quien se le endilgó la actividad delictiva fue a [Nombre01 001] (folios 112 a 116 del legajo principal), por lo que solo a él se le indagó (folios 43 y 44 del legajo principal), y se le convocó como acusado a la audiencia preliminar y al debate (minuta y actas en folios 168, 262 y 263 del legajo principal); no así a su progenitora, señora [Nombre01 004]. Igualmente, del análisis de la sentencia impugnada y la tramitación del caso, determina este Tribunal de Apelación que fue a petición de la fiscalía y a partir de lo argumentado por dicha representación durante la audiencia preliminar del 16 de febrero de 2016, que [Nombre01 004] fue convocada al proceso penal como tercera interesada y no como como demandada civil pues, en todo caso, la única demanda civil resarcitoria fue ejercida por la Procuraduría General de la República contra el accionado [Nombre01 001] (según el respectivo legajo), y, por ello, doña [Nombre01 004] compareció en la citada condición de tercera interesada al juicio oral y público celebrado el 31 de enero de 2017 (ver minuta de la audiencia preliminar en folio 168, acta de debate en folio 203, orden de citación en folio 249 y acta de juicio en folios 261 y 262 del legajo principal).

Asimismo, constata esta integración que durante la referida audiencia oral y pública, doña [Nombre01 004] estuvo representada por la licenciada Margarita Gamboa Fuentes, defensora pública, quien emitió conclusiones en su Nombre01 y a favor de sus derechos e intereses (ver acta de debate en folio 263 y registro de la audiencia número c0000170131082348); por lo que, con independencia de que dicha profesional objetara su participación como asesora legal de una tercera persona interesada, según lo aduce el apelante (aun asumiendo hipotéticamente esta integración que tal profesional participara del criterio -externado en otras ocasiones por sus colegas- en el sentido que a la Defensa Pública le corresponde representar a demandados civiles ausentes, al tenor de lo dispuesto por el numeral 120 del Código Procesal Penal, no así a terceros interesados), lo cierto es que, de todas formas, dicha asesoría y representación legal fue ejercida de manera real y efectiva.

Por ende, no es certera la afirmación del recurrente de que se causó indefensión a la tercera interesada, ni que el tribunal de juicio haya resuelto el desalojo y derribo con vulneración de los derechos e intereses de la señora [Nombre01 004], pues ella no solo tuvo conocimiento del proceso y de sus consecuencias, sino que estuvo presente en el debate, donde contó con la respectiva asesoría legal, conoció los hechos acusados, escuchó la prueba evacuada y las conclusiones de las partes, incluidas las de la fiscalía y la Procuraduría General de la República, dirigidas al desalojo y derribo de la edificación de marras. De este modo, doña [Nombre01 004] tuvo la oportunidad de ser debidamente informada de que la obra construida en el terreno registrado a su Nombre01 invadía la zona de protección del Río [...], e impuesta de cuáles serían los eventuales alcances del fallo respecto de dicha construcción realizada en su inmueble y en el área descrita; comunicándosele también, al final del juicio, que la parte dispositiva de la sentencia sería leída a las 13:30 horas de ese mismo día (según registro audiovisual número c003170131133524, a las 10:15:35), por lo que tuvo acceso a lo resuelto y gozó de la posibilidad de combatirlo, si ese hubiera sido su interés, lo cual no hizo.

De ahí la conclusión de esta integración sobre la inexistencia de vicio o defecto alguno respecto de la participación de la señora [Nombre01 004] dentro de este proceso, descartándose, también, la alegada afectación de las garantías del debido proceso y de defensa, pues los citados derechos fueron salvaguardados por el tribunal sentenciador. En síntesis, se reitera la inadmisibilidad del reclamo.

IV.Como primer motivo, el licenciado Montenegro Reyes alega errónea fundamentación de la sentencia y de la aplicación de la ley procesal penal, pues el tribunal sentenciador absolvió por duda a su representado cuando en realidad la causa estaba prescrita, dado que por ser el plazo de prescripción de 3 años, conforme al artículo 31 inciso a) del Código Procesal Penal, si los hechos ocurrieron entre el 16 de mayo de 2011 y el 16 de mayo de 2012, y el encartado fue indagado el 18 de diciembre de 2013, dicho lapso se interrumpió y empezó a correr reducido a la mitad hasta cumplirse el 18 de junio de 2015. De esta manera, afirma que el Ministerio Público formuló la acusación cuando ya había operado la prescripción en la presente causa; amén de que, al celebrarse el debate el 31 de enero de 2017, la acción penal también estaba sobradamente prescrita y, por ello, la participación de la Procuraduría General de la República en dicho juicio fue extemporánea e ilegítima y sus peticiones no pueden ser atendidas.

En la contestación del fiscal Héctor Chacon Chang , señala que el reclamo no puede prosperar porque, en resumen, se tuvo por probado que, sin precisarse fecha pero en 2011, se construyó una casa en la finca del Partido de San José N° [Valor 001], propiedad de [Nombre01 004], la cual se levantó dentro del área de protección de la quebrada [...], irrespetando los límites legales y provocando un daño ambiental, aparte de que la construcción permanece dentro de dicha zona y la prescripción corre desde que cesa tal permanencia, por lo que la acción penal no ha prescrito; lo anterior unido a que [Nombre01 001] no acredita el agravio sufrido pues el terreno aparece registrado a Nombre01 de [Nombre01 004], quien no figura como acusada ni como poderdante del acriminado o de su abogado. El vicio alegado es inexistente y corresponde declarar sin lugar la excepción de prescripción. Para valorar esta defensa de previo y especial pronunciamiento, el numeral 31 inciso a) del Código Procesal Penal dispone que el lapso a computar es igual al máximo de la pena, en los delitos sancionables con prisión, el cual no puede ser inferior a 3 años ni exceder los 10 años, excepto en los delitos cometidos en perjuicio de menores.

De acuerdo con la acusación y solicitud de apertura a juicio formulada por el Ministerio Público, se endilgó a [Nombre01 001] la comisión del delito de invasión de una zona de protección, estableciéndose que: “1.- La finca del partido de San José 1-[Valor 001]/ SJ [Valor 003] se ubica en la localidad de [...] y es propiedad de [Nombre01 004], madre del encartado [Nombre01 001].- 2.- Sin poder determinar fecha exacta, pero durante el periodo comprendido entre el 16 de mayo del año 2011 y el 16 de mayo del año 2012 el encartado [Nombre01 001] construyó y contrató personal así como maquinaria, con la finalidad que –bajo sus órdenes y dirección- procedieran a construir una vivienda de aproximadamente 120 metros cuadrados, de dos plantas, para un total de 240 metros cuadrados, dentro de la citada propiedad, que se ubica en la localidad de Aserrí, ubicada a las márgenes del río [...], sin contar con permisos de construcción de parte de la Municipalidad de Aserrí, así como tampoco del Minae. 3.- Dicha edificación fue levantada, dentro del área de protección de la Quebrada [...], irrespetando los límites previstos por ley, tratándose de terrenos ubicados cerca de quebradas. 4.- Para tales efectos, el acriminado [Nombre01 001] se abocó a título personal así como a girar instrucciones a sus subalternos, para realizar movimientos de tierra, quitar árboles, y arbustos, que cubrían el materia vegetativo, a fin de levantar el inmueble, lo que provocó que la vegetación del lugar fuera eliminado, generando con dicha labor, una afectación al medio ambiente. 5.- Producto de ello, se generó un daño ambiental como consecuencia directa de la construcción que edificó el acusado [Nombre01 001], dentro del área de protección de la Quebrada [...], al levantar dicha edificación dentro de un área protegida, impacto que fue regulado en un monto de UN MILLON DOSCIENTOS MIL COLONES. 6.- Al día 03 de marzo del año 2015, dicha vivienda permanece en la zona protegida antes indicada a los márgenes del río [...]” (sic, folios 112 al 116 del expediente principal).

El delito descrito se encuentra sancionado con 3 meses a 3 años prisión según lo prevé el inciso a) del artículo 58 de la Ley Forestal N° 7575, por lo que el plazo de prescripción a computar es de 3 años. Asimismo, dispone el ordinal 32 del Código de rito, reformado por Ley Nº 9082 del 12 de octubre de 2012, que: “Los plazos de prescripción se regirán por la pena principal prevista en la ley y comenzarán a correr, para las infracciones consumadas, desde el día de la consumación; para las tentativas, desde el día en que se efectuó el último acto de ejecución y, para los delitos continuos o permanentes , desde el día en que cesó su permanencia” (el remarcado es suplido). De esta forma, cuando se produce la invasión de una zona de protección, ya sea de un río, arroyo o quebrada, las consecuencias del ilícito subsisten mientras se mantenga la ocupación o invasión de dicha área; en tanto “…invadir implica actos de ocupación del sitio, que se traducen en establecerse en el lugar y disponer del mismo” según resolución N° 1131-2016 de la Sala Tercera de la Corte Suprema de Justicia; interpretándose, igualmente, que en el supuesto del inciso a) del artículo 58 de la Ley Forestal, el vocablo invadir se utiliza “…en sus dos significados, ingresar por la fuerza y el de ocupación ilegal” , de acuerdo con el pronunciamiento N° 388-2016 del Tribunal de Apelación de Sentencia del Tercer Circuito Judicial de Alajuela, San Ramón.

También determina esta Cámara que los efectos del ilícito descrito son permanentes en cuanto a la afectación del bien jurídico tutelado, por lo que solo con la finalización o cese de la ocupación o invasión ejecutada por el agente, se puede dar inicio al cómputo del plazo de 3 años ya mencionado, para tener por extinguida la acción penal. En la resolución N° 324-2015 del Tribunal de Apelación de Sentencia Penal de Cartago, se adopta un criterio semejante al antes mencionado, explicándose que: “El delito de invasión de áreas de conservación es sin duda un delito permanente, dado que la acción no se agota con la construcción de la trocha, sino que sus efectos permanecen todo el tiempo, lesionando continuamente el bien jurídico (ambiente sano y equilibrado), dadas las implicaciones que la invasión de esa zona protectora tiene para el ambiente (eliminación de bosque que afecta las especies animales y vegetales, disminución en la producción de oxígeno) y también la afectación para el recurso hídrico allí protegido.

De tal forma, que solo el restablecimiento de las cosas al estado en que se encontraban antes de la infracción a la ley, cesa la permanencia en los términos del artículo 32 del Código Procesal Penal.” Desde esta perspectiva, dado que para los delitos “continuos” o “permanentes” el citado plazo se contabiliza desde el día en que finalizó su permanencia, lo que corresponde definir es el momento en que se cumplió dicha condición, teniéndose por establecido, en el presente asunto, que conforme a la acusación (punto 6, folios 112 a 126), a la querella (según hecho quinto del respectivo legajo, folios 1 a 9), e, incluso, a lo que en sentencia se tuvo por demostrado (hecho quinto en folio 272 del legajo principal), la casa construida en la finca del Partido de San José número 1-[Valor 001], ubicada en las márgenes del Río [...], al menos desde el año 2011 hasta finales de enero de 2017 (fecha última en que se produjo la celebración del debate), permanece dentro de la zona protegida descrita y, por ello, precisamente, el tribunal sentenciador ordenó su derribo en la sentencia impugnada.

A mayor abundamiento, durante el juicio se evacuó el testimonio de Nombre07, técnico forestal con vasta experiencia que interpuso la denuncia que inició este proceso, quien declaró, en lo que interesa, que “ ha pasado reiteradamente por este sitio y observa que la obra ya está terminada, declara que el último día que pasó por ese lugar fue ayer [y dado que el debate fue el 31 de enero de 2017, el declarante se refería al día 30 de enero de 2017] y que aún está la obra” (folio 275 del legajo principal). Por ende, con independencia de que el encartado fuera indagado el 18 de diciembre de 2013 (folios 43 y 44), que el Ministerio Público formuló la acusación el 13 de agosto de 2015 (folios 112 al 116) y que, por primera vez, se señaló y convocó la audiencia preliminar mediante resolución de las 16:05 horas del 28 de agosto de 2015, lo cierto es que el plazo de prescripción de la acción penal no ha transcurrido, conforme se alega; es más, su cómputo ni siquiera podría iniciarse en este momento, por encontrarse aún ocupada la zona de protección descrita, conforme se ratifica con el presente reclamo. Por todo lo expuesto, corresponde rechazar la excepción de prescripción.

V.El apelante alega, como segundo motivo, la errónea fundamentación de la sentencia, la inadecuada valoración probatoria y la incorrecta determinación de los hechos probados en relación con la orden de derribo, porque, a partir de la prueba de cargo evacuada, no se pudo determinar quién fue la persona responsable de la comisión del hecho punible y, unido a ello, se omitió una debida ponderación de la prueba pericial al momento de ordenar el derribo de la construcción y el desalojo de los ocupantes de la propiedad, tratándose lo dispuesto de una expropiación forzosa sin fundamento legal. Con cita de varios extractos de lo resuelto por el tribunal de juicio, señala que el derribo está ayuno de fundamento probatorio debido a que no se dan argumentos lógicos sino apreciaciones subjetivas del juzgador, quien no explica cuál y de qué tipo es el daño, ni identifica la afectación real a la naturaleza o al ambiente.

Arguye que en la valoración efectuada se consideró que el daño ambiental es de “apenas de un millón ciento noventa y nueve mil novecientos noventa y cinco colones, es decir fue muy levísimo, casi exiguo”, sin que corresponda a las magnitudes señaladas por el a quo, quien le atribuye un valor “catastrófico” sin sustento alguno, omitiendo también señalar en qué consiste la gravedad para la colectividad y cuáles fueron las pruebas científicas para determinarlo; aparte de que se habla de un grave riesgo para las personas que habitan la edificación pero no existe un informe técnico de la Comisión Nacional de Emergencias o de la Municipalidad. Refiere que en el punto 6 del informe de valoración ambiental, denominado “Usos de la zona afectada” se señala: “…indicador habitacional, 25%. El entorno a esta es de uso habitacional, sin embargo el área de protección no debe e utilizada para esta” (sic), por lo que se puede inferir que el área afectada es utilizada por los vecinos de la zona como uso habitacional, sin que tales daños fueran reclamados por la Procuraduría General de la República -mediante la acción civil resarcitoria- en virtud de la poca lesividad al ambiente, con lo cual se establece la infundada aseveración del tribunal de juicio; razones por las que solicita se declare con lugar el recurso, se revoque la orden de desalojo y el derribo.

El representante del Ministerio Público contesta el reclamo y solicita su rechazo debido a que la resolución cuestionada se apoya en el estudio realizado por el ingeniero forestal Ronald Mora Vargas, donde acredita la existencia de los daños ambientales derivados de la edificación de la vivienda, los cuales detalla en la valoración aportada; agregando que, por ser un delito de peligro, se parte de la presunción de que, por ocupar el área situada a menos de 50 metros de las márgenes del río y en un terreno en declive, ocurre una puesta en riesgo de los recursos naturales y aunque no lo provocara, la finalidad de la ley es impedir la generalización de la conducta generadora del riesgo, sin que demuestre el recurrente que los vicios alegados le ocasionen agravio porque el imputado fue absuelto, el inmueble no es de su propiedad, ni es apoderado de la dueña. El reproche se considera inexistente.

Primero, observa esta Cámara que el tema central del reclamo se circunscribe a la orden de derribo dispuesta en la sentencia, alegándose que para su emisión no se realizó una adecuada ponderación de la prueba pericial, sin que exista sustento probatorio sino apreciaciones subjetivas del órgano jurisdiccional, quien tampoco especifica las características ni alcances del daño o afectación al ambiente. Sin embargo, no le asiste razón al impugnante pues el tribunal sentenciador tuvo por demostrado que en el año 2011 se construyó una casa en la finca del partido de San José número 1-[Valor 001]/ SJ [Valor 003], localizada en la localidad de [...], ubicada a las márgenes del río [...], propiedad de [Nombre01 004] y que dicha construcción fue levantada dentro del área de protección de la Quebrada [...], irrespetando los límites legales previstos. Explicó el tribunal de juicio que los anteriores eventos y particularmente la construcción en las márgenes del Río [...] en la localidad de Aserrí, fue constatada con fundamento en el testimonio de Nombre07, técnico forestal, quien, además de formular la denuncia Nº ACOPAC-OSRP-DEN-OO24-12 que originó el proceso, explicó, durante el debate, que concurrió, en compañía de un funcionario municipal, al sitio descrito a solicitud del Alcalde Municipal de Aserrí, con el fin de inspeccionar la citada construcción, donde realizó las mediciones propias de su función y, mediante el uso de un aparato llamado “clinómetro” que es para medir las pendientes de terrenos, determinó, sin ninguna duda, que la indicada construcción se estaba realizando dentro de un área protegida.

El señalado testimonio fue contrastado por el tribunal de juicio con la denuncia y las fotografías incorporadas al debate, arribando a la conclusión de que “El documento de denuncia que él presenta indica lo mismo que refiriera este testigo en cuanto al grado de la pendiente que midiera el día que se presentó al lugar, y que el resultado de esta medición fue que la pendiente donde se lleva a cabo la construcción supera el 40 por ciento, según la Ley Forestal si esta situación se da, el área de protección será de cincuenta metros (…) en las fotos se aprecia una cinta que fuera colocada por él [refiriéndose al testigo Nombre07] en esta construcción el primer día que se presenta, que le hizo ver a los constructores que se encontraban ese día, que estaban construyendo dentro de área de protección, y aún más, dejó recado con ellos para que el encargado de la obra se comunicara con él a fin de detener esta obra, situaciones que no tuvieron efecto, ya que la obra continuó” (folio 275 del legajo principal).

También el tribunal de juicio se basó en el testimonio del ingeniero topógrafo Nombre08, quien labora en el Departamento de Ciencias Forenses del Organismo de Investigación Judicial y elaboró el Dictamen Criminalístico Nº 2015-180-ING (folios 97 a 99 del legajo principal), el cual, unido a la inspección practicada en el lugar (folios 1 a 4 del legajo principal), no solo especifica cómo se llevó a cabo la medición en el terreno mediante un aparato preciso e idóneo, sino que permite arribar a la conclusión de que la totalidad de la obra se encuentra dentro de la zona de protección. De ahí que, apreciándose por parte de esta integración que los razonamientos del juzgador de instancia responden a la ponderación objetiva e integral de tales elementos probatorios conforme a las reglas de la sana crítica racional, no tienen cabida los alegatos del recurrente en el sentido de que estos obedecen a apreciaciones subjetivas e infundadas.

Además, observa este Tribunal de Apelación que el a quo tuvo como cuarto hecho probado que debido a la citada edificación “…se generó un daño ambiental como consecuencia directa de la construcción ahí edificada dentro del área de protección de la Quebrada [...]” y para tal constatación, el órgano de instancia se afianzó en el testimonio del técnico forestal Nombre07, quien, al ser consultado sobre los efectos que ocasionó esta construcción, indicó que el cauce de este río había traído inundaciones a muchas familias de la misma zona y que, por ello, se suscitaron consecuencias ambientales y en la salud de la comunidad, aparte de producirse la contaminación del río, sin que en esta zona pueda reforestarse, por lo que recomendaba la destrucción de la obra; desde cuyo punto de vista se estima que si bien el recurrente aduce que el juzgador le otorga una connotación “catastrófica” al daño, lo cierto es que, con base en el indicado testimonio, se infiere que su impacto en la comunidad sí gozaría de tales alcances sobre todo cuando menciona que había ocasionado inundaciones y que por la contaminación del río, se pondría en riesgo la salud pública.

Contrario a lo afirmado por el apelante, igual se advierte que, pese a que el sitio donde se llevó a cabo la construcción descrita es residencial, en razón de la existencia del mencionado río, corresponde la protección de las áreas aledañas a su cauce, conforme lo determina el informe de “Valoración de Daños Ambientales”, elaborado por el Ingeniero Ronald Mora Vargas, funcionario del Área de Conservación de Pacífico Central, Subregión Puriscal, informe pericial admitido e incorporado al contradictorio (en folios 9 a 15 del legajo principal), donde se consignó que a pesar de que la zona afectada es de uso habitacional, claramente se advierte que “ sin embargo, el área de protección no debe ser utilizada para esta” (el subrayado no es del original, punto 6 del informe en folio 13 del legajo principal). En otro orden, para el tribunal de instancia las declaraciones de Nombre07 fortalecen lo referido en el punto 4.4.5 del señalado estudio, en tanto el a quo afirma que “…el Nicho Ecológico el indicador es 100 por ciento.

Alto impacto. Este daño es muy impactante porque primero es el retiro o eliminación de la vegetación, luego el retiro del suelo y no queda nada de ecosistema para la flora y fauna; lo que afirma el gran daño que se ha causado con la construcción realizada en esta zona. Esto permite a este Tribunal tener por demostrado el daño ambiental causado al área protegida por el Estado, por la construcción que se realizó” (folios 275 y 276 del legajo principal). Más adelante, el órgano de instancia refirió que el área afectada se consideró una zona de vida, que estas áreas de protección son los últimos vestigios de bosques en zonas urbanas y que la afectación se produjo en la hidrología, en los suelos y en el ecosistema, entre otros. Además, el señalado criterio profesional es confirmado por esta Cámara mediante la revisión del citado estudio, en el cual se explican los factores tomados en cuenta para establecer la valoración económica del daño ambiental provocado con la construcción de la vivienda ya mencionada en el área de protección del Río [...]; indicándose que se movilizaron 120 metros cuadrados de tierra de la zona protectora no solo con el respectivo costo que ello implica, sino también con el consiguiente impacto en otros factores, por ejemplo: en la zona de vida afectada (25%); la cobertura vegetal (50%); el ecosistema (75%), considerándose frágiles las intervenciones realizadas en la medida en que “el área se puede deslizar fácilmente y provocar otros daños no solo a lo natural sino que a otras personas”; la hidrología en su indicador de contaminación (25%) debido a que “El arrastre de suelo contamina el agua, asimismo afecta la calidad de la misma y los micoorganismos no pueden hacer uso de ella y además se altera el cauce aguas abajo”; los suelos en los indicadores de erosión (25%), drenaje (25%) y remoción (25%), debido a que “ Al hacer el plantel se produce la erosión mecánica del suelo, asimismo al llover hay lavado por lo que se drena el suelo y se remueve la capa superior y fértil del suelo”; y en el nicho ecológico (entre 50% y 100%), explicándose que “Hubo alteración parcial del área de protección la cual continúa aguas abajo y arriba” y que “Este daño es muy impactante porque primero es el retiro o eliminación de la vegetación, luego el retiro del suelo y no queda nada de ecosistema para la flora y la fauna” (folios 12 y 13 del legajo principal).

En consecuencia, concluye esta Cámara que no le asiste razón al apelante cuando asevera que no se determinó el daño provocado ni sus alcances y que el juzgador no contó con bases científicas que le permitieran justificar sus ponderaciones. Nótese que el mismo recurrente reconoce la existencia del daño cuando asegura que ocurre y aunque aduce una magnitud menor a la señalada por el a quo, en el informe del Ing. Mora Vargas también se explicó que estos “ …porcentajes asignados a cada daño provocado, están relacionados directamente con la capacidad real de soporte de cada uno de ellos, por ejemplo en los que se asigna un 100% el daño es total (…) Existen daños valuados en un 25% de la inversión inicial, pues en seis meses el daño provocado ha de llegar a su climax y las fases inmediatas a estas serán de adaptación y recuperación (…) también se han valorado daños en un 75% de la inversión inicial pues estos daños provocarán secuelas aún 36 meses después de su realización ” (el énfasis es suplido, folio 13).

Unido a lo anterior, aun y cuando el daño haya sido cuantificado en la suma referida por el recurrente, ello no significa que se trate de una afectación menor pues, aunque así lo fuera desde el punto de vista económico, lo cierto es que el impacto negativo en el ambiente se produjo y alcanzó distintos porcentajes según cada factor, conforme se indicó; apreciándose que en ello también concordó la defensora pública durante la emisión de sus conclusiones en el debate, al afirmar que se había tenido por demostrado el daño ambiental y la invasión de la zona de protección, no así que fuera el imputado el autor del evento (registro audiovisual número c0000170131094532, a las 10:09:55). Por otro lado, estima esta integración que el pronunciamiento acerca del restablecimiento de las cosas a su estado original, con la consiguiente orden de desalojo y derribo de la obra, es un efecto necesario de la decisión en un caso como el valorado, donde está de por medio la invasión ilegal de un área de protección dado que el numeral 33 inciso b) de la Ley Forestal declara como tal: “Una franja de quince metros en zona rural y diez metros en zona urbana, medidas horizontalmente a ambos lados, en la ribera de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado.” Por ende, existe una prohibición legal expresa que da sustento al derribo cuando se construye en la indicada área.

Asimismo, lo decidido encuentra fundamento en el ordenamiento jurídico pues si se utiliza como medida provisional, el numeral 140 del Código Procesal Penal autoriza que: “En cualquier estado de la causa y a solicitud del ofendido, el tribunal puede ordenar, como medida provisional, el restablecimiento de las cosas al estado que tenían antes del hecho, siempre que haya suficientes elementos para decidirlo”; mientras que, ya no en forma provisional sino definitiva, la restitución de las cosas a su condición original es procedente de conformidad con lo estipulado en el inciso 1) del artículo 103 del Código Penal. En consecuencia, si en el presente caso se tuvo por demostrada la construcción en una zona de protección, así como la provocación del daño ambiental y el amparo legal para ordenar el desalojo y derribo de la construcción, no son valederos los alegatos del recurrente de que dicha disposición jurisdiccional responde a las apreciaciones subjetivas del juzgador.

Tampoco se requiere que tales daños hayan sido reclamados por la Procuraduría General de la República mediante el ejercicio de la acción civil resarcitoria porque su declaratoria no depende de tal gestión, sino de su constatación en la realidad, como hizo el tribunal sentenciador y comparte su criterio esta integración; aparte de que las disposiciones legales antes citadas prevén la restitución como un efecto propio de las acciones delictivas que, como la acusada, conllevan la alteración del estado original de las cosas y, en el supuesto particular, producen una afectación a los recursos naturales e impacto negativo al ambiente. De igual manera, la aplicación de la restitución descarta la figura de la expropiación forzosa (que podría ordenarse al tenor del artículo 45 de la Constitución Política y de la Ley de Expropiaciones Nº 7495, reformada por Ley Nº 9286), la cual se da en supuestos diversos que los que acá han sido tomados en cuenta al comprobarse una ocupación ilegal de un área de protección aledaña al Río [...] y una lesión al ambiente.

Por demás, para esta integración existe claridad sobre la gravedad del daño e impacto en la colectividad, así como en la identificación de las pruebas utilizadas por el juzgador para su determinación, entre ellas de carácter testimonial y pericial, sin que -como lo alega el impugnante- se requiera de un informe técnico de la Comisión Nacional de Emergencias o de la Municipalidad que así lo corrobore, dado que nuestro sistema de justicia penal se rige por la valoración probatoria conforme a las reglas de la sana crítica racional y para la demostración de un evento no se requiere la identificación de un elemento probatorio previamente definido, sino que existe libertad para su comprobación, siempre que el elemento de prueba usado sea lícito e introducido legalmente al proceso (artículos 181 y 182 del Código Procesal Penal). Por lo expuesto, corresponde rechazar el recurso.

POR TANTO:

Se declara inadmisible el tercer motivo y se rechazan los motivos primero y segundo del recurso formulado por el licenciado Montenegro Reyes.
