BACKGROUND (RESULTANDO):

  1. 1By Judgment No. 261-2016, issued at eight a.m. on veintidós de junio de dos mil dieciséis, the Tribunal de Juicio de Heredia ruled: “THEREFORE (POR TANTO): In accordance with the foregoing; Articles 28, 36, and 39 of the Constitución Política; Article 8 of the Convención Americana sobre Derechos Humanos; Article 14 of the Pacto Internacional de Derechos Civiles y Políticos; Article 26 of the declaración Americana de Derechos y Deberes del Hombre; Articles 10 and 11 of the Declaración Universal de Derechos Humanos; Articles 1, 2, 6 through 9, 16, 45, 141 through 144, 180 through 184, 265, 324, 326, 341, 343, 360, 363, 365, and 366 of the Código Procesal Penal; and Articles 1, 4, 11, 17, 18, 20, 23, 30, 45, 268, 270, 277, and 339 of the Código Penal; by unanimous vote of this Court, the accused [[Nombre1] ] IS ACQUITTED OF ALL PENALTY AND LIABILITY for the offenses of DISTRIBUTION OF POISONED OR ADULTERATED SUBSTANCES (due to the conduct not constituting an offense [atipicidad]) AND BREACH OF PUBLIC-DUTY OBLIGATIONS (due to the statute of limitations [prescripción]), with which he had been charged to the detriment of PUBLIC HEALTH.Any precautionary measure (medida cautelar) imposed upon the accused in these proceedings is hereby terminated.   2. 2Appearing in the appeal proceedings against the foregoing ruling are attorney [Nombre2] . , as representative of the Ministerio Público, and attorney [Nombre3] , as public defender of the accused, [[Nombre1] ].
  3. 3Following the corresponding deliberations, in accordance with Article 465 of the Código Procesal Penal, the Court proceeded to hear the appeal.
  4. 4The relevant statutory requirements have been observed throughout the proceedings.

Appellate Judge [Nombre7] drafts this decision; and, CONSIDERING (CONSIDERANDO)

I.Attorney [Nombre2] . , coordinating prosecutor of the fiscalía Adjunta Penal Ambiental del Ministerio Público, files an appeal against the decision issued by the Tribunal de Juicio del Primer Circuito Judicial de Heredia, Resolution No. 261-2016, at 8:00 a.m. on 22 de junio de 2016. The sole ground of appeal alleges: “Disagreement with the legal reasoning; incorrect application of Sections 18, 268, 270, and 277 of the Código Penal.” He argues that, in order to apply the rule in Article 18 of the Código Penal concerning improper omission or commission by omission (omisión impropia o comisión por omisión), the guarantor position (posición de garante) of the perpetrator (sujeto activo) must be determined. That position arises from three sources:

  • 1)the duty to protect legally protected interests (bienes jurídicos) against risks that may affect them—for example, the duty of parents toward their children, caregivers toward the infants entrusted to them, and lifeguards toward swimmers;
  • 2)the duty to monitor sources of risk, such as that of an owner of dangerous animals; and
  • 3)the duty to control sources of danger, such as that of an air traffic controller, the person responsible for an atomic plant, or the security chief of a factory. He states that, in his view, the person responsible for an aqueduct—as the defendant was on the date of the events—falls within this category. In support of his argument, he cites ruling 384-2015 of the Tribunal de Apelación de Sentencia del Segundo Circuito Judicial de San José. The appellant states that the full Tribunal Penal de Heredia determined that defendant [Nombre [Nombre8]] was responsible for the Acueducto de [Nombre [Nombre9]]. This raises the question of whether, under those circumstances, he occupied a guarantor position and could therefore have committed the offense of distributing poisoned or adulterated substances. The appellant answers that question affirmatively, considering that the defendant committed the offense established in Section 270 of the Código Penal under the theory of commission by omission. He asserts that this is where the trial court erred by incorrectly applying Sections 268 and 270 of the Código Penal. The appellant transcribes the reasoning of the trial court through which it excluded the defendant’s liability. The court essentially stated that, because the infestation occurred on a Saturday, its origin was not solely the actor’s failure to chlorinate the water—the avoidance nexus (nexo de evitación)—but was also attributable to other circumstances, such as torrential rainfall and agricultural activities that contaminated the water. He argues that, through this reasoning, the judgment conflates the requirements of the objective elements of the offense (tipicidad objetiva) under Sections 268 and 270 of the Código Penal, without recognizing that the latter establishes an autonomous criminal offense that depends on the preceding provisions only with respect to the penalty to be imposed. He maintains that the conduct found proven falls within the operative verb defining the offense in Section 270 of the Código Penal, specifically because it was established that, through the defendant’s omission in failing to shut down the aqueduct system, the contaminated water reached users. In other words, substances hazardous to health were distributed by a perpetrator who knew of their harmful nature; accordingly, in his view, [Nombre10] should have been convicted. He maintains that Section 270 establishes an abstract-endangerment offense (delito de peligro abstracto), such that the distribution of substances or things hazardous to health is sufficient: the unlawfulness (antijuridicidad) of the conduct is established through the distribution itself, and it is not necessary for the perpetrator to have contaminated the hazardous substance or item, a requirement that he states is present in Section 268 of the Código Penal. He indicates that the elements of the offense (tipicidad) under Section 270 of the Código Penal require the perpetrator to know of the harmful nature of the substance and knowingly distribute it, which, in his view, was established in the proceedings. The defendant’s knowledge that the water contained contaminants (bacteria), which he was required to eliminate or attempt to destroy through chlorine disinfection but failed to do, is what would give rise to his criminal liability. He therefore argues that the reasoning finding that the defendant’s conduct did not constitute an offense is erroneous, because he could have prevented distribution by closing the distribution valve and chlorinating the water. He thus concludes that a legal provision was incorrectly applied in this case because Article 270 of the Código Penal was not applied. He also considers that the law was applied incorrectly when the court found an apparent concurrence of statutory provisions (concurso aparente de normas) between Articles 270 (and its relationship to Article 268) and 277 of the Código Penal, because the criteria of specificity, subsidiarity, and absorption (especialidad, subsidiaridad y consunción) required for that type of concurrence were not met. He requests that the appeal be granted, that the judgment of acquittal be vacated, and that the case be remanded for resolution in accordance with law.-

II.The claim is unfounded, for the reasons set forth below. For this Sentencing Appeals Chamber to properly address the resolution of this matter, it is necessary to fully understand the reasons given by the Trial Court in this case for ruling out the criminal liability of the person on trial herein, since, in principle, the judgment’s account, based on its reasoned assessment of the evidence concerning the existence of the alleged facts, which constitutes recital IV (considerando IV) of the judgment at issue, begins by stating that the alleged facts were indeed proven and that the accused failed to perform an act inherent to his duties (See reverse of folio 160 of the case file). The court states that the following is clear: “...the position held by the accused as a public official under an obligation to chlorinate the water pursuant to a work schedule lawfully assigned to him by a supervisor.” (see cited folio 160, reverse).

In its analysis, the Trial Court even rejects the arguments made by the accused personally and by defense counsel that the fact that the accused was returning from vacation justified his failure to chlorinate the water or, alternatively, to shut off the water supply to residents of the districts served by this aqueduct. The judgment likewise does not accept the alleged inability to open a padlock, since he had master keys for the performance of his duties and, as the judgment states, given the emergency that was unfolding, as a last resort he should have cut the padlock and entered the place where he was required to perform his duties (See the reasoning on the front and reverse of folio 161). The Court is also clear that the accused’s omission caused an epidemic of diarrhea and vomiting among at least 150 people in the communities served by the aqueduct, due to the heavy rains that occurred during the weekend of 24 and 25 de setiembre de 2011.

It therefore ultimately concludes as follows regarding those grounds of justification: “The full Court rejects, precisely in view of the statements made by the witness [Nombre [Nombre11]], the justifications advanced by the accused personally, concluding that he did indeed fail to perform his duties because, regardless of whether or not he could have prevented the epidemic that occurred as an outbreak of diarrhea and vomiting among that population, chlorination of the water reservoir was a duty entrusted to the accused that he was required to perform, and it is clear that he failed to do so without any acceptable excuse, since he had the tools needed to cut or break a padlock and enter the [Nombre [Nombre12]] plant or station, for two purposes: first, to clone (sic) the water on Saturday and Sunday; or, second, since a torrential-rain event had occurred between Saturday and Sunday, causing the water to become turbid and thereby creating an emergency involving possible contamination, to close the distribution valve or valves to prevent contaminated water from reaching the population” (Compare folio 162 of the case file).

To fully understand the scope of the arguments referred to in the judgment at issue, it is necessary to consider the account of the alleged facts charged by the Public Prosecution Service, which is contained in the indictment at folio 76 et seq., specifically beginning at folio 77, where the facts alleged against the person on trial are set forth verbatim as follows: “FIRST: The defendant [[Nombre1] ] has worked for the Municipalidad de [[Nombre13] ] since 1990 and, within that period, has served approximately since 1999 in the position of plumber 1 within that municipal government. SECOND: The aqueduct of the canton of [Nombre [Nombre9]] is administered by the municipal government of that locality and provides water service to the residents of 8 districts, namely: [Nombre [Nombre9]], [Nombre [Nombre14]], [Nombre [Nombre15]], [Nombre [Nombre16]], [Nombre [Nombre17]], [Nombre [Nombre18]], [Nombre [Nombre19]] and [Nombre [Nombre20]].

The districts located in the eastern sector, namely [Nombre [Nombre15]], [Nombre [Nombre19]], [Nombre [Nombre20]] and [Nombre [Nombre16]], are supplied by five open-air or surface-water intakes, specifically: intake of the [...]) and its main collection site, known as [Nombre [Nombre21]]. THIRD: The surface waters supplying the eastern districts of [Nombre [Nombre9]] are collected in tanks and subsequently directed to chlorination systems for disinfection, after which they are deposited in storage tanks and then distributed to homes through the municipal pipeline. FOURTH: Although the exact date cannot be determined, beginning approximately in 2011, the defendant [[Nombre1] ], in his capacity as a plumber, was assigned by his supervisor, pursuant to an internal rotating work schedule, to chlorinate the surface waters at the aqueduct collection plant supplying the districts of [[Nombre22] ], [[Nombre23] ], [[Nombre24] ] and [[Nombre25] ] one weekend every two weeks, specifically at the chlorination system known as ‘[Nombre [Nombre12]],’ located directly on the southeast side of the [Dirección2] sports field in [[Nombre26] ].

That same site also contains a stopcock or valve used to discontinue water distribution in the event of an emergency or required repairs to the aqueduct, a fact well known to the defendant [[Nombre1] ], since he was required to use it on numerous occasions in the course of his position as a plumber. FIFTH: On 24 and 25 de setiembre de 2011, at the chlorination system described in the third fact, the defendant [[Nombre1] ], in his capacity as a municipal official, failed to disinfect the surface waters using chlorine, knowing that this task had been assigned to him by his supervisor pursuant to the internal rotating work schedule. This occurred despite the fact that the defendant [[Nombre1] ] held a position of guarantor (posición de garante) with respect to the health of the people to whom the Municipalidad de [[Nombre13] ] supplies water; nevertheless, he grossly neglected an act inherent to his duties, thereby breaching his duty of integrity (deber de probidad).

SIXTH: On 24 and 25 de setiembre de 2011, despite knowing that excessive rainfall had occurred that weekend in the canton of [Nombre [Nombre9]] and that purification of the water depended on the chlorination process he was required to perform but did not carry out, the defendant [[Nombre1] ] failed to close the valve or stopcock through which the surface water stored in the collection tanks was conveyed to residents’ homes. Through his inaction, the defendant [[Nombre1] ] thus allowed those waters to be distributed to the districts of [Nombre [Nombre15]], [Nombre [Nombre19]], [Nombre [Nombre20]] and [Nombre [Nombre16]], despite knowing that they were harmful because he knew that no disinfection process had been applied to the water intended for community use. This occurred even though he was able to perform the operation of closing the stopcock or valve. SEVENTH: As a result of the defendant [[Nombre1] ]’s omission, approximately 15.000 thousand people suffered adverse health effects from an outbreak of diarrhea and vomiting in [Nombre [Nombre9]], particularly in the districts of [Nombre [Nombre15]], [Nombre [Nombre19]], [Nombre [Nombre20]] and [Nombre [Nombre16]], which arose from the bacterial density present in the water from the municipal aqueduct, exceeding the recommended level because of the defendant’s failure to chlorinate it.” (folios 77 and 78 of the case file and transcription from the reverse of folio 152 through the reverse of folio 153 of the judgment).

With that alleged factual framework now clear, we note that the Trial Court considered in this case that the liability of the person on trial herein was not established, based on the following statements: “Nevertheless, as will be explained in the legal analysis of these proven facts, the indictment does not identify the pure-omission offense (delito de omisión propia) that should have been charged and instead identifies a classification that was inapplicable, even from the standpoint of commission by omission (omisión impropia), such that this Court cannot, as will be explained in the legal analysis, find conduct satisfying the elements of the offense of Distribution of Poisoned or Adulterated Substances. Even if a possible reclassification as a violation of health measures and violation of measures for the prevention of epidemics (artículo 277 del Código Penal) were considered, there are additional elements which, when placed within the proven facts in accordance with the statements of the aforementioned witness [Nombre [Nombre11]], also weaken the ability to attribute the harm to the population, as a violation of the legally protected interest of public health, exclusively to the accused—even under this classification of the offense, which the Court considers should have been applied and charged.” (Compare front and reverse of folio 162).

The judgment later states that, under its legal view of the facts: “...only a breach of duties (incumplimiento de deberes) is shown, which was proven but time-barred, and not the offense of Distribution of Poisoned Substances committed by omission, since what should have been charged was precisely the offense of violating health measures on the basis of the decree cited by the environmental prosecutor’s office itself, although this follows from the stated offense classification, as determined after an analysis of an apparent concurrence of laws (concurso de normas).” (see folio 163). More specifically, recital V (considerando V) addresses the legal considerations on which the Court relied in finding that the criminal liability of the accused herein could not be established in this case. For those purposes, we transcribe the essential portions of the lower court’s analysis: “It is clear that, pursuant to artículo 339 del Código Penal, the accused’s omission clearly constituted the offense of breach of duties in the performance of his functions, insofar as he failed to perform an act inherent to his position and falling within the scope of his obligations as a plumber one or municipal official required to ensure the potability of the water.

This is a mere-conduct offense imposing a duty to act, regardless of whether harmful contamination resulted, because the harm here is in fact associated with a breach of the duty of integrity or responsibility as a public official. Nevertheless, although all elements of the offense have been established in this case, the criminal action is time-barred under the applicable penalty, because the limitation period established for this matter is one year, pursuant to artículos 31 y 33 del Código Procesal Penal, since the penalty consists of disqualification from the position held. Given that more than that one-year period elapsed from one act capable of interrupting the limitation period, namely the scheduling of the preliminary hearing, to another such act, namely the setting of the case for trial—from 24 de diciembre de 2013 to 23 de junio de 2015 (folios 88 y folio 129)—or even taking into account the second scheduling of the preliminary hearing, which occurred on 23 de junio de 2014 as recorded at folio 90, it is evident that the criminal action for this offense is time-barred.

Nevertheless, as to the other alleged offense, namely the circulation of poisoned or adulterated substances, pursuant to Article 270 in conjunction with Article 268, both of the Criminal Code, what is actually present is an apparent concurrence of provisions (concurso aparente de normas), since, in the unanimous opinion of the Court, the offense that should have been charged was Violation of Health Measures (Violación de medidas sanitarias) under Article 277 of the same code. This is because the proven conduct is precisely a violation of measures imposed by law, specifically in this case Executive Decree number 32327-S, which required disinfection in Article 12, the function of dosing the disinfectant in Article 13, as well as other actions (health measures) in cases of contamination emergencies, as established in Articles 14 and 15. That is, in accordance with the parameters specified in the decree itself and, at the dosing points, pursuant to Article 14, with Articles 15 and 16 also setting forth the obligations during ordinary operations and in a state of emergency.

Furthermore, this conduct likewise falls within the statutory definition of the offense (tipicidad) if the measures imposed by the competent authority are not complied with, as also occurred in this case, since there were clear directives from the immediate supervisor regarding the actions that the accused was required to undertake as the public official responsible for chlorinating the aqueduct or, as applicable, for closing the water-distribution valves during an emergency.” (see folios 163, front and back). It then expressly proceeds to consider the implications of Article 18 of the Criminal Code in light of its reasoning and why, in this case, the offense of improper omission (omisión impropia), based on the perpetrator’s guarantor position (posición de garante), was inapplicable. In this regard, it states: “...considering the guarantor duties arising from control over sources of risk, such as those that might be held by an air traffic controller, the custodian of an atomic energy plant or of radioactive substances, or the custodian of a water-treatment plante [sic], as in this case, in this last example an offense by omission could not be fitted to the circulation of poisoned or contaminated substances, insofar as that statutory definition describes an act of contaminating the water, as the accused’s public defender stated in her closing arguments; thus, conduct by omission would be impossible, because the water contamination does not arise from an omission but from a natural event or, in this case, from an agricultural activity that cannot be attributed to the accused.

In those cases in which it applies, specifically from a normative standpoint, the perpetrator must manifest conduct different from that ordered, namely, the failure to perform the mandated action. But the perpetrator must have the ability to carry out the mandate, because otherwise the conduct would not fall within the statutory definition. The point is that the result that must always occur as a consequence of the failure to perform the mandated action must be attributed entirely to the perpetrator; and in this case, as has been demonstrated, the water contamination occurred on Saturday, but as a result of torrential rain. Thus, the failure to chlorinate the water could only be regarded as a possible contributing cause (concausa) of the infestation, and the result of the epidemic cannot be attributed to the accused in its entirety, since such attribution is diluted by the other circumstances that were proven and that contributed to the epidemic.

In other words, the substantive unlawfulness (antijuricidad material) in this case did not result solely from the perpetrator’s failure to chlorinate the water—under the avoidance nexus (nexo de evitación)—but was also due to other circumstances: the torrential rains and the agricultural activity that contaminated the water, as the witness testified. Therefore, in the Court’s opinion, what should have do [sic] been charged was the offense defined in Article 277 of the Criminal Code and no other, such as Articles 268 and 270 of that same lethal code [sic], because both offenses contemplate specific acts committed with intent to act (dolo de hacer), rather than omission; that is, the water could not be poisoned or contaminated through conduct by omission so as to permit the application of those provisions under the rule governing the offense of improper omission.” (Literal transcription of folios 163 back and 164).

In the view of this Criminal Judgment Appeals Chamber, what defeats the Public Prosecutor’s claims in this appeal is that Article 18 of the Criminal Code provides literally: “The punishable act may be committed by action or omission. When the law punishes the act on account of the result produced, whoever fails to prevent it shall be liable if, under the circumstances, that person could have done so and was legally required to prevent it” (the transcription is literal; emphasis added). As can be seen, then, the fundamental issue underlying this case, according to the charge originally brought by the Public Prosecutor, is not, as alleged in the appeal before us, that the perpetrator lacks a guarantor position, but rather that the charging instrument attributes, as having been committed through commission by omission (comisión por omisión), an endangerment offense (delito de peligro), rather than a result offense (delito de resultado), whereas the legislative design of the doctrine established in the cited Article 18 of the Criminal Code applies only to result offenses.

Accordingly, if, under the facts presented here, the allegation had involved a statutorily defined result of injury or even death, it would have been possible to consider whether the defendant should be held liable for those offenses under a theory of commission by omission; but because that was not the case, it is not even appropriate to revisit those issues. Therefore, the proper disposition in this case is to deny the appeal from the judgment filed by the Public Prosecutor’s representative.-

THEREFORE:

The appeal filed by the representative of the Public Prosecutor’s Office is hereby denied. RECURSO DE APELACIÓN DE SENTENCIA interpuesto en la presente causa seguida contra [[Nombre1] ], [...], por los delitos de CIRCULACIÓN DE SUSTANCIAS ENVENENADAS O ADULTERADAS E INCUMPLIMIENTO DE DEBERES DE LA FUNCIÓN PÚBLICA en perjuicio de LA SALUD PÚBLICA. Intervienen en la decisión del recurso, los jueces Jorge Luis Morales García, Martín Alfonso Rodríguez Miranda y la jueza María Gabriela Rodríguez Morales. Se apersonan en Apelación de Sentencia, el licenciado [Nombre2] . , en condición de representante del Ministerio Público y el licenciado [Nombre3] , en calidad de defensor público del encartado [[Nombre1] ].

RESULTANDO:

  1. 1Que mediante sentencia número 261-2016 de las ocho horas del día veintidós de junio de dos mil dieciséis, el Tribunal de Juicio de Heredia, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 28, 36 y 39 de la Constitución Política; 8 de la Convención Americana sobre Derechos Humanos; 14 del Pacto Internacional de Derechos Civiles y Políticos; 26 de la declaración Americana de Derechos y Deberes del Hombre; 10 y 11 de la Declaración Universal de Derechos Humanos; artículos 1, 2, 6 al 9, 16, 45, 141 al 144, 180 al 184, 265, 324, 326, 341, 343, 360, 363, 365 y 366 del Código Procesal Penal; artículos 1, 4, 11, 17, 18, 20, 23, 30, 45, 268, 270, 277 y 339 del Código Penal; por voto unánime de este Tribunal SE ABSUELVE DE TODA PENA Y RESPONSABILIDAD al encartado [[Nombre1] ] de los delitos de CIRCULACIÓN DE SUSTANCIAS ENVENENADAS O ADULTERADAS (por atipicidad) E INCUMPLIMIENTO DE DEBERES DE LA FUNCIÓN PÚBLICA (por prescripción) que se le vinieron atribuyendo en perjuicio de LA SALUD PÚBLICA. Se ordena la cesación de cualquier medida cautelar que se haya impuesto en esta causa contra el endilgado. Se resuelve el presente asunto sin especial condenatoria en costas, quedando a cargo del Estado los gastos de enjuiciamiento. Oportunamente archívese el expediente y sáquese del libro de entradas. HÁGASE SABER. [Nombre4] , [Nombre5] y [Nombre6] . Jueces de Juicio".
  2. 2Que contra el anterior pronunciamiento, se apersonan en Apelación de Sentencia, el licenciado [Nombre2] . , en condición de representante del Ministerio Público y el licenciado [Nombre3] , en calidad de defensor público del encartado [[Nombre1] ].
  3. 3Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal procedió a conocer del recurso.
  4. 4Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez de Apelación de Sentencia [Nombre7] , y;

CONSIDERANDO

I.El licenciado [Nombre2] . , fiscal coordinador de la fiscalía Adjunta Penal Ambiental del Ministerio Público, interpone recurso de apelación de sentencia contra el fallo dictado por el Tribunal de Juicio del Primer Circuito Judicial de Heredia, resolución número 261-2016 de las 8:00 horas del 22 de junio de 2016. En el único motivo de apelación de sentencia se alega: "Inconformidad con la fundamentación jurídica, incorrecta aplicación de los numerales 18, 268, 270 y 277 del Código Penal". Alega que para aplicar la regla del artículo 18 del Código Penal, referida a la omisión impropia o comisión por omisión, se debe determinar la posición de garante del sujeto activo, misma que tiene tres fuentes generadoras

  • 1)el deber de proteger los bienes jurídicos frente a los riesgos que puedan afectarlos, por ejemplo, los padres respecto a los hijos, las niñeras con relación a los infantes a su cargo, el salvavidas respecto de los bañistas.
  • 2)el deber de vigilancia de fuentes de riesgo, así por ejemplo el dueño de animales peligroso s y
  • 3)el deber de control de fuentes de peligro, caso del controlador aéreo, el encargado de una planta atómica, el jefe de seguridad de una fábrica y señala que considera que en este supuesto se encuentra el responsable de un acueducto como lo era el imputado a la fecha de los hechos. Se cita en apoyo de su argumentación el voto 384-2015 del Tribunal de Apelación de Sentencia del Segundo Circuito Judicial de San José. Indica el recurrente que el Tribunal Penal de Heredia en pleno determinó que el imputado [Nombre [Nombre8]] era el encargado del Acueducto de [Nombre [Nombre9]], ante lo cual se plantea la pregunta de si en dicha situación estaba en posición de garante y por ello podría haber cometido el delito de circulación de sustancias envenenadas o adulteradas, pregunta que responde afirmativamente el recurrente, considerando que el imputado cometió el delito que establece el numeral 270 del Código Penal bajo la teoría de la comisión por omisión, ahí es donde apunta se equivoca el Tribunal sentenciador, aplicando erróneamente los numerales 268 y 270 del Código Penal. Transcribe el recurrente la argumentac i ón del Tribunal de Juicio por la cual exclu y ó la responsabilidad del justiciable, en donde esencialmente se dijo que por haber ocurrido la infestación en un día sábado, esta no tuvo como génesis únicamente la falta de cloración (nexo de evitación) del agente, sino que se debió a otras situaciones como las lluvias torrenciales y la actividad agropecuaria que contaminaron las aguas. Alega que con esa argumentación lo que hace la sentencia es entremezclar exigencias de tipicidad objetiva de los artículos 268 y 270 del Código Penal, sin advertir que este último tiene un tipo penal autónomo, que sólo depende de las normas anteriores en cuanto a la sanción a imponer. Sostiene que la conducta tenida por probada encuadra en el verbo típico descrito en el numeral 270 del Código Penal, concretamente al haberse demostrado que por la omisión del imputado de discontinuar el sistema del acueducto, el agua contaminada llegó hasta los usuarios, es decir, se materializó la distribución de sustancias peligrosas para la salud a sabiendas de su carácter nocivo por parte del sujeto activo, motivo por el cual a su criterio debió habé [Nombre10] sele condenado. Sostiene que el numeral 270 contiene un delito de peligro abstracto, por lo que basta con que se dé la distribución de sustancias o cosas peligrosas para la salud, la antijuridicidad de la conducta se materializa con la distr i bución, ni se requiere que el sujeto activo haya sido el que realizó la contaminaci ó n de la sustancia o cosa peligrosa, exigencia que dice si se encuentra presente en el numeral 268 del Código Penal. Indica que lo que exige la tipicidad del numeral 270 del C ódigo Penal es que el sujeto activo conozca el carácter nocivo de la sustancia y a sabiendas distribuya la misma, lo que a su criterio qued ó demostrado en el proceso. El conocimiento del imputado de que el agua tenía agentes contaminantes (bacterias), la cual él debía eliminar o intentar destruir a través de la desinfección con cloro, lo que no hizo, es lo que le generaría la responsabilidad penal. Por ello, arguye que es erróneo el razonamiento al considerar atípica la conducta del justiciable, pues este pudo evitar la distribución mediante el cerramiento de la válvula de distribución y haber clorado el agua. Concluye así que en este caso se dio una errónea aplicación de un precepto legal, por la no aplicación del artículo 270 del Código Penal. Estima también que existe un error en la aplicación de la ley cuando se considera que existe un concurso aparente de normas entre los artículos 270 (y su relaci ó n con el 268) y el 277, todos del Código Penal, por no darse los criter i os de especialidad, subsidiaridad y consun c ión, necesarios para que exista dicho tipo concursal. Insta se declare con lugar el recurso de apelación interpuesto, se anule la sentencia absolutoria dictada y se ordene el reenvió, para que se resuelva el presente caso conforme a derecho.-

II.El reclamo no resulta procedente , por las razones que se dirán . Para efectos de abordar adecuadamente, por parte de esta Cámara de Apelación de Sentencia, la resolución del presente asunto es necesario entender a cabalidad, cuáles fueron las razones que esgrimió el Tribunal de Sentencia en este caso, para así descartar la responsabilidad penal del aquí justiciable, toda vez que, en principio la enunciación que hace la sentencia, a partir del análisis intelectivo de la prueba en relación con la existencia de los hechos acusados, que constituye el considerando IV del fallo en cuestión, inicia afirmando que los hechos que se acusan fueron efectivamente acreditados y que, en relación con el acusado, el mismo omitió realizar un acto propio de sus funciones (Ver folio 160 vuelto del expediente). El tribunal indica que es clara: "... la posición que tenía el imputado como funcionario público con una obligación de clorar el agua mediante un rol de trabajo que se le había ordenado legítimamente por una jefatura".

(ver folio citado 160 vuelto). Incluso en su análisis, el Tribunal Sentenciador descarta los alegatos de defensa material y técnica, relacionados con que la circunstancia de que el imputado venía reincorporándose de unas vacaciones, justificaran el que no realizara la cloración del agua o, en su defecto, el cierre del suministro del agua a los vecinos de los distritos que atendía este acueducto. Tampoco se acepta, por parte del fallo, la argumentada imposibilidad de abrir un candado, toda vez, que en sus labores contaba con llaves maestras y, en el último caso, tal y como lo refiere la sentencia, ante la situación de emergencia que se estaba produciendo, debió haber recurrido a cortar el candado y acceder al lugar en donde debía cumplir con sus funciones (Ver la argumentación a folio 161 frente y vuelto). También es claro el Tribunal en qué esa situación omisiva del aquí imputado ocasionó una epidemia de diarrea y vómitos en, al menos, 150 personas de estas comunidades que atendía el acueducto, por las fuertes lluvias que ocurrieron el fin de semana del 24 y 25 de setiembre de 2011.

Así, termina concluyendo, sobre esas causales de justificación lo siguiente: "El Tribunal en pleno desecha precisamente, considerando lo mencionado por el testigo [Nombre [Nombre11]], las justificación de defensa material del acusado, concluyendo que efectivamente el mismo incumple sus funciones, en tanto independientemente de que, hubiera o no impedido la epidemia que se da como brote de diarrea y vómito en tal población, la cloración del depósito de aguas en las manos del imputado era un deber que el mismo debía haber cumplido, y es claro que lo omitió sin excusas atendibles para no haberlo realizado, ya que tenía las herramientas para cortar o romper un candado y entrar a la planta o estación de [Nombre [Nombre12]], con dos objetivos, el primero clonar (sic) el agua, los días sábado y domingo, o en segundo lugar, habiendo ocurrido un evento de lluvia torrencial entre el sábado y el domingo lo que hizo que el agua se pusiera turbia, constituyéndose con ello una emergencia de posible contaminación, cerrar las válvulas o válvula de distribución para evitar que agua contaminada llegara a la población" (Confrontar folio 162 del expediente).

Para efectos de comprender a cabalidad los alcances de las argumentaciones que alude el fallo en cuestión es necesario tener en cuenta la relación de hechos acusados que imputó el Ministerio Público, misma que contiene la acusación de folio 76 y siguientes, específicamente a partir del folio 77, donde tenemos los hechos imputados al justiciable y que literalmente dicen: "PRIMERO: El encartado [[Nombre1] ], labora para la Municipalidad de [[Nombre13] ] desde el año 1990, lapso dentro del cual aproximadamente desde 1999, se desempeña en el puesto de fontanero 1 dentro de dicho ayuntamiento municipal. SEGUNDO: El acueducto del cantón de [Nombre [Nombre9]] es administrado por el ayuntamiento municipal de dicha localidad, el cual brinda el servicio de agua a los habitantes de 8 distritos a saber: [Nombre [Nombre9]], [Nombre [Nombre14]], [Nombre [Nombre15]], [Nombre [Nombre16]], [Nombre [Nombre17]], [Nombre [Nombre18]], [Nombre [Nombre19]] y [Nombre [Nombre20]].

Los distritos ubicados en el sector Este correspondientes a: [Nombre [Nombre15]], [Nombre [Nombre19]], [Nombre [Nombre20]] y [Nombre [Nombre16]], son abastecidos por cinco tomas a cielo abierto o superficiales, específicamente: toma del [...]) y su principal sitio de captación denominada [Nombre [Nombre21]]. TERCERO: Las aguas superficiales que abastecen a los distritos del Este de [Nombre [Nombre9]], son captadas en tanques para posteriormente direccionarlas hacia sistemas de cloración, para su respectiva desinfección y finalmente son depositadas en tanques de almacenamiento para luego ser distribuidas a las viviendas por la tubería municipal. CUARTO: Sin poder precisar fecha exacta pero sí aproximadamente desde el año 2011, al encartado [[Nombre1] ], en su condición de fontanero, le fue asignado por parte de su jefatura un fin de semana cada dos semanas, según un rol interno rotativo de trabajo, realizar la labor de cloración de las aguas superficiales de la planta de captación del acueducto que abastece a los distritos de [[Nombre22] ], [[Nombre23] ], [[Nombre24] ] y [[Nombre25] ], específicamente en el sistema de cloración denominado "[Nombre [Nombre12]] propiamente al costado sureste de la cancha [Dirección2] deportes de [[Nombre26] ].

Mismo sitio en el cual se ubica, además una llave de paso ó válvula para discontinuar la distribución de las aguas ante alguna emergencia o reparaciones requeridas en el acueducto, lo cual es bien conocido por el encartado [[Nombre1] ] ya que con ocasión de su puesto de fontanero en múltiples ocasiones debió hacer uso de ella. QUINTO: Los días 24 y 25 de setiembre de 2011. en el sistema de cloración descrito en el hecho tercero, el encartado [[Nombre1] ], en su condición de funcionario municipal, omitió realizar el proceso de desinfección de las aguas superficiales, mediante la utilización de cloro, a sabiendas que así le había sido asignado por su jefatura según rol interno rotativo de trabajo. Lo anterior, a pesar de ostentar el encartado [[Nombre1] ], una posición de garante respecto a la salud de las personas a las que la municipalidad de [[Nombre13] ] le suministra agua; no obstante desatendió, groseramente, un acto propio de sus funciones con lo cual lesionó el deber de probidad que le asistía.

SEXTO: Los días 24 y 25 de setiembre de 2011, el encartado [[Nombre1] ], a pesar de conocer que ese fin de semana había llovido en exceso en el cantón de [Nombre [Nombre9]] y la purificación de las aguas dependía del proceso de cloración que él debió realizar pero que no ejecutó, omitió cerrar la válvula o llave de paso que permite el traslado del agua superficial almacenada en los tanques de captación hacia las viviendas de los administrados, siendo que con su inactividad del encartado [[Nombre1] ] permitió la distribución de dichas aguas hacia los distritos de [Nombre [Nombre15]], [Nombre [Nombre19]], [Nombre [Nombre20]] y [Nombre [Nombre16]], a sabiendas de su carácter nocivo, por cuanto conocía que no había aplicado ningún proceso de desinfección al líquido destinado para el uso de la colectividad. Lo anterior a pesar que le era posible realizar la maniobra de cerrar la llave de paso o válvula.

SÉTIMO: Producto de la omisión del encartado [[Nombre1] ] aproximadamente 15.000 mil personas se vieron afectadas en su salud con un brote de diarrea y vómitos, en [Nombre [Nombre9]], especialmente en los distritos de [Nombre [Nombre15]], [Nombre [Nombre19]], [Nombre [Nombre20]] y [Nombre [Nombre16]], el cual se generó a raíz de la densidad bacteriana presente en el agua proveniente del acueducto municipal, superando el valor recomendado debido a la ausencia de cloración por parte del encartado". (folios 77 y 78 del expediente y transcripción de folio 152 vuelto a 153 vuelto de la sentencia). Ahora bien, teniendo claro ese cuadro fáctico acusado, observamos que el Tribunal de Sentencia, en este caso, considera que la responsabilidad del aquí justiciable no se llega a concretar con fundamento en las siguientes manifestaciones: "No obstante a ello, tal y como se dirá en el análisis jurídico de estos hechos demostrados, la acusación no determina el delito de omisión propia que debía haber sido acusado, y señala una tipología que no era la aplicable, incluso desde el punto de vista de una omisión impropia, para que pueda este Tribunal tal y como se dirá en el análisis jurídico, considerar una acción típica de un delito de Circulación de sustancias envenenadas o adulteradas.

Incluso si se advirtiera una posible recalificación para una violación de medidas sanitarias y violación de medidas para la prevención de epidemias (artículo 277 del Código Penal), se advierten además elementos que, dispuestos dentro de los hechos probados conforme a lo manifestado por el citado testigo [Nombre [Nombre11]], incluso ésta tipología de delito, la que considera el Tribunal que debió ser la aplicada y acusada, también se debilita para poder achacar el daño a la población, como violación al bien jurídico salud pública, exclusivamente al imputado". (Confrontar folio 162 frente y vuelto). Más adelante se apunta que ante su visión jurídica de los hechos: "...solo se muestra un incumplimiento de deberes, acreditado pero prescrito, pero no un delito de omisión impropia de circulación de sustancias envenenadas, ya que lo que debía haberse acusado era precisamente un delito de violación de medidas sanitarias con sustento en el decreto que la misma entidad fiscal ambiental refiere, aunque ello atendiendo la tipicidad indicada, determinada luego de un análisis de un aparente concurso de normas".

(ver folio 163). Más específicamente en el considerando V, se aborda las consideraciones jurídicas que tuvo el Tribunal para considerar que en este caso no se podía sustentar la responsabilidad penal del aquí imputado, a esos efectos, transcribimos, en lo fundamental, lo que analizó el a quo: "Es claro que conforme lo que expresa el artículo 339 del Código Penal la omisión del acusado claramente tipificó un delito de incumplimiento de deberes en sus funciones, en tanto omitió realizar un acto propio de su función, dentro del espectro de sus obligaciones como fontanero uno o funcionario municipal que debía garantizar la potabilidad del agua, ello como mero delito que obliga a un hacer, haya o no existido un resultado dañoso de contaminación, dado que el daño aquí efectivamente es relacionado con una falta al deber de probidad o de responsabilidad como funcionario público. No obstante, y pese a que se determinan todos los elementos del delito en este caso, la acción penal conforme a la penalidad que se arrostra está prescrita, en virtud de que el plazo que se dispone para este asunto como plazo de prescripción es de un año, conforme la normativa de los artículos 31 y 33 del Código Procesal Penal, en tanto la penalidad es de inhabilitación para la función que se desempeña, y siendo que de un acto capaz de interrumpir la prescripción como lo es el señalamiento de audiencia preliminar al otro como lo es el señalamiento a juicio transcurre más de ese año, del 24 de diciembre de 2013 al 23 de junio de 2015 (folios 88 y folio 129) o incluso considerando el segundo señalamiento de audiencia preliminar que ocurre el 23 de junio de 2014 según consta al folio 90, es evidente que la acción penal para el caso de esta delincuencia esta prescrita.

No obstante para la otra delincuencia acusada, sea la circulación de sustancias envenenadas o adulteradas, conforme a los artículos 270 en correlación con el artículo 268 ambos del Código Penal, ciertamente lo que ocurre es un concurso aparente de normas, ya que a juicio del Tribunal en pleno lo que debió ser acusado era un delito de Violación de medidas sanitarias a la luz del artículo 277 del mismo cuerpo legal, y esto por cuanto la acción que se acredita es precisamente una violación a las medidas impuestas por ley, en este caso específicamente, el decreto ejecutivo número 32327-S, que imponía la utilización de la desinfección en su artículo 12, la función de dosificar el desinfectante en su artículo 13, más otras acciones (medidas sanitarias) en casos de emergencia de contaminación, tal y como surge en sus artículos 14 y 15. Es decir, conforme a los parámetros que indica el mismo decreto, y en los puntos de dosificación, conforme al artículo 14, indicándose además en el artículo 15 y 16 las obligaciones en una función ordinaria y en un estado de emergencia.

Por otro lado igualmente cabe la tipicidad de esta acción si se incumplen las medidas impuestas por la autoridad competente, lo que igualmente ocurría en este caso, ya que habían directrices claras de la jefatura inmediata de las acciones que debía llevar a cabo el imputado como funcionario público encargado de la cloración del acueducto, o en su caso de cerrar las válvulas de distribución de agua en una emergencia". (ver folios 163 frente y vuelto). Luego de esto expresamente entra a considerar las implicaciones del artículo 18 del Código Penal según su argumentación y, por qué, en este caso no era aplicable el delito de omisión impropia sustentado en la posición de garante del sujete agente. Al respecto nos dice: "...considerando los deberes de garante surgidos del control de fuentes de riesgo así como las podría tener un controlador aéreo, el cuidador de una planta de energía atómica o de sustancias radioactivas, o el cuidador de una plante (sic) de tratamiento de aguas como sucede en este caso, no podría acoplarse en este último ejemplo un delito por omisión para una circulación de sustancias envenenadas o contaminadas, en tanto aquella descripción típica lo que indica es una acción de contaminar el agua, tal y como lo mencionó en sus conclusiones la defensa pública del acusado, por lo que la acción omisiva sería imposible, ya que la contaminación del agua no viene de una omisión sino de un hecho de la naturaleza, o para el caso, de una actividad agropecuaria que no es achacable al imputado.

Para los casos que se aplica, precisamente desde el punto normativo, el agente debe exteriorizar una conducta distinta de la ordenada, esto es la no ejecución de la acción mandada . Pero tiene que tener una posibilidad de realización del mandato, ya que si no la tiene su comportamiento sería atípico. Lo que pasa es que el resultado que siempre se tiene que dar como consecuencia de la no ejecución de la acción mandada debe serle atribuido enteramente al sujeto activo, y en este caso como queda demostrado, es para el sábado que ocurre la contaminación del agua, pero por los efectos de una lluvia torrencial, por lo que la no cloración del agua solo podría considerarse como una posible concausa de la infestación y no se le puede atribuir al acusado el resultado de la epidemia en su totalidad ya que ello se diluye en las otras circunstancias que quedan probadas y que coadyuvan en el evento de la epidemia.

Es decir, la antijuricidad material en el caso no solo fue resultado de una falta de cloración (nexo de evitación) del agente sino fue debido a otras situaciones, las lluvias torrenciales y la actividad agropecuaria que contamina las aguas, tal y como lo declaró el testigo. Por eso a juicio del Tribunal, lo que debió hacer (sic) sido acusado era la tipicidad del artículo 277 del Código Penal y no otra, como por ejemplo los artículos 268 y 270 de ese mismo cuerpo letal (sic) por cuanto ambos tipos consideran acciones determinadas con un dolo de hacer y no de omisión, es decir no se podría envenenar o contaminar el agua con una acción omisiva, para que se pudiera aplicar dichas normas mediante la regla del delito de omisión impropia". (Transcripción literal de folios 163 vuelto y 164). A criterio de esta Cámara de Apelación de Sentencia Penal lo que viene a dar al traste con las pretensiones del Ministerio Público en la presente impugnación es que el numeral 18 del Código Penal establece literalmente: "El hecho punible puede ser realizado por acción o por omisión.

Cuando la ley reprime el hecho en consideración al resultado producido, responderá quién no lo impida si podía hacerlo, de acuerdo con las circunstancias, y si debía jurídicamente evitarlo" (la transcripción es literal, el subrayado es suplido). Como puede verse entonces, el problema básico que subyace en este caso, conforme a la acusación que originalmente imputó el Ministerio Público, no es, como resulta alegado en el recurso que aquí nos ocupa, que no concurra en el sujeto agente la posición de garante, sino que, en la pieza acusatoria lo que se atribuye como cometido por la vía de la comisión por omisión es un delito de peligro y no uno de resultado, siendo que el diseño legislativo para el instituto que contempla el numeral 18 del Código Penal citado es solamente los delitos de resultado. Así las cosas, si en el presente supuesto de hecho, la atribución hubiese sido un resultado típico de lesiones o incluso muerte, se podría haber entrado a considerar si el justiciable tendría que responder por dichas delincuencias en la formulación de comisión por omisión, pero como eso no se dio así, ni siquiera resulta válido replantearse estos aspectos. Por ello, lo procedente en este caso es declarar sin lugar el recurso de apelación de sentencia interpuesto por la representación del Ministerio Público.-

POR TANTO:
