Goicoechea, at nueve horas quince minutos, del seis de noviembre de dos mil diecisiete.- APPEAL (RECURSO DE APELACIÓN) filed in these proceedings brought against Nombre01, of legal age, Costa Rican, identity card number CED01, born in San José on 24 de diciembre de 1968, son of Nombre02 and Nombre03, divorced, employed as a waiter, resident of San José, Hatillo 7, 300 meters west and 200 meters south of Palacio del Mueble, walkway 4, house 276, a beige-colored house with cruise-style windows on the left; for the offense of VIOLATION OF THE LEY FORESTAL BY ENCROACHMENT UPON A PROTECTION AREA (ÁREA DE PROTECCIÓN), to the detriment of the ENVIRONMENT. Judge Mario Alberto Porras Villalta and associate judges Patricia Vargas González and Laura Murillo Mora participated in deciding the appeal. Juliana Yglesias Luconi, public defender for the accused, entered an appearance before this court.
WHEREAS:
I.By judgment number 594 -20 17, at nueve horas treinta minutos del cinco de junio de dos mil diecisiete, the Tribunal Penal del Tercer Circuito Judicial de San José, Sede Suroeste, Pavas, ruled: “POR TANTO: Pursuant to the foregoing and Articles 36, 39, 41 and 50 of the Constitución Política; 1, 4, 11, 16, 18 through 20, 30, 45, 50, 51, 59 through 63, 71, 73, 74, 103 subsections 1) and 2) of the Código Penal; section 58 subsection 1) of Ley Forestal number 7575; sections 1, 2, 3, 4, 5, 6, 8, 10, 37, 38, 40, 41, 76, 111 through 115, 140, 141, 142, 144, 180, 181, 182, 184, 265 through 270, 360, 361, 363, 364, 365, 367 and 368 of the Código Procesal Penal; Article 3 of the Ley Orgánica de la Procuraduría General de la República; 122, 123, 124 and 126 of the Código Penal de 1941 Reglas Vigentes sobre Responsabilidad Civil, in relation to section 57 of Ley Forestal number 7575; 1045 of the Código Civil; and Articles 41 and 45, in relation to Article 18 of Decreto de Honorarios Profesionales en Derecho Número 32493, effective as of 9 de marzo del 2005, it is hereby ordered: 1.
Nombre01 is found criminally responsible as the perpetrator of the offense of VIOLATION OF THE LEY FORESTAL BY ENCROACHMENT UPON A PROTECTION AREA, committed to the detriment of the ENVIRONMENT, and, in that capacity, is sentenced to THREE MONTHS’ IMPRISONMENT, which sentence shall be served at the place and in the manner prescribed by the applicable prison regulations, with credit for any pretrial detention (prisión preventiva) served. Because the convicted person meets the requirements established by law and the sentence imposed is less than three years, he is granted the Benefit of Conditional Execution of Sentence (Beneficio de Ejecución Condicional de la Pena) for a period of THREE YEARS, during which the convicted person may not commit any intentional offense punishable by more than six months’ imprisonment; otherwise, the benefit granted herein shall be revoked. The convicted person shall bear the costs of the criminal proceedings. 2.
The CIVIL CLAIM FOR DAMAGES (ACCIÓN CIVIL RESARCITORIA) brought by the State, through the Procuraduría General de la República, against the civil defendants Nombre01 and the corporation ROJAMOR ROJAS Y MORA S.A is GRANTED, and they are held jointly and severally liable for payment of the ECONOMIC DAMAGE caused, in the amount of FOUR MILLION FIVE HUNDRED NINETY THOUSAND COLONES (¢4.590.000). The civil defendants are ordered to pay the ATTORNEY’S FEES AND PROCEDURAL COSTS of the Civil Claim for Damages, which are awarded to the State and fixed in the amount of ONE MILLION FIFTY-FIVE THOUSAND SEVEN HUNDRED COLONES EXACTLY (¢1.055.700). The civil defendants are ordered to pay the ATTORNEY’S FEES of the private prosecution (querella), which are awarded to the State and fixed in the amount of TWO HUNDRED THOUSAND COLONES EXACTLY (¢200.000), for an aggregate total of ONE MILLION TWO HUNDRED FIFTY-FIVE THOUSAND SEVEN HUNDRED COLONES EXACTLY (¢1.255.700).
The civil defendants shall pay the amounts established within fifteen days after the judgment becomes final, with the warning that, should they fail to do so, judgment-enforcement proceedings (vía de ejecución de sentencia) may be commenced. 3. Pursuant to section 140 of the 3. Código Procesal Penal, restoration to the prior condition (restablecimiento de las cosas a su estado anterior) is ordered; accordingly, the structure built on the property registered in the San José district, record number , located in San Rafael de Escazú, cadastral plan number , which encroaches upon the protection area of Quebrada Quebradilla, shall be demolished. The bridge or access ramp built over the channel of the aforementioned stream shall be demolished, as shall the retaining wall built beside the fence structure erected along the bank of the stream channel. All debris resulting from the demolition process shall also be removed.
This work is entrusted to the Ministerio del Ambiente y Energía del Área de Conservación Pacífico Central and the Municipalidad de Escazú, which shall be notified of this decision. Before taking any action to comply with this order, those entities shall assess the impact that removal of the retaining wall and access ramp may cause and shall determine a means of proceeding that neither endangers the lives of third parties nor prevents restoration of the protected area. For this purpose, the company owning the property on which the retaining wall and access ramp are located shall authorize personnel from the Ministerio del Ambiente y Energía and the Municipalidad de Escazú to enter, both to conduct the corresponding studies and to demolish the aforementioned structures. Once the judgment becomes final, it shall be entered in the Registro Judicial, and the customary certified copies shall be forwarded to the Juzgado de Ejecución de la Pena and the Instituto Nacional de Criminología. The parties shall be duly notified through the full reading of the judgment.” (sic).
III.After conducting the corresponding deliberation pursuant to Article 465 of the Código Procesal Penal, the Court considered the issues raised in the appeal.
Drafted by Appellate Criminal Judgment Judge Porras Villalta; and,
CONSIDERING:
Insufficient reasoned justification (fundamentación intelectiva) and violation of in dubio pro reo. (1).- In her first ground, defense counsel explains that “[…] If we analyze the judgment under appeal, it is easy to see that the Court provides no explanation regarding my client to justify his conviction […] what the Court does is quote the various witness statements, one after another, linking them with phrases that, when analyzed as a whole, do not reflect any intellectual effort by the Court; there is no indication that, beyond what the witnesses stated, there is in substance the proper statement of reasons required by law; the evidence is used improperly because it is used excessively to give substance to the decision, quoting what the evidence for the prosecution and the defense indicated, while the Court’s own assessment is conspicuously absent […]” (cf. folio 536). (3).- In the third ground of appeal, defense counsel alleges a violation of the principle of in dubio pro reo, for the following reasons: 3.i.) It was established that the retaining wall at issue, as well as the access to the property, had existed since the accused purchased the property; that is, he was not the person who caused environmental damage, if any such damage could be established. 3.ii.) The property-registry report contained in the record establishes that no encumbrance (gravamen) or annotation concerning the Ley Forestal appears registered. 3.iii.) The documents identified in the preceding ground show that there was doubt regarding the environmental impact and, by extension, that doubt must apply to the accused’s guilt.
Both grounds of the complaint are without merit. The judgment on the merits explains with complete clarity, accuracy, and sufficiency why the act and the defendant’s responsibility for it were deemed proven, and no error can be discerned in that logical progression. In this regard, it was found that, at the time of the events, the accused was the president and attorney-in-fact with full powers (apoderado generalísimo) of ROJAMOR S.A., the legal entity holding registered title (titularidad registral) to the property in question, a fact that he admitted when testifying at trial; that he also acknowledged having ordered the remodeling work to be performed—for which he hired third parties, including Mr. Nombre04—which included widening the access ramp and rebuilding the retaining wall, upon which a gated structure was also erected, all within the protection zone (zona de protección) of the Quebradilla stream, in Escazú.
The judgment explains fully and plainly that, in addition, testimony was received at trial from several officials of the Municipalidad de Escazú (Nombre05, Nombre06, and Nombre07), whose accounts were corroborated by the reports they had prepared in writing at the time. They detected that the remodeling work had begun and was proceeding without any building permit and that, after one was issued as a result of an intervention by inspector Nombre05 (that permit authorized only minor work), it was found that the ramp had been widened to allow vehicle access and that the retaining wall had been rebuilt, with a gated structure erected upon it. Moreover, the former owner (Mr. Nombre08), who sold the property to the defendant, corroborated the municipal officials’ accounts by stating that the work depicted in the image at folio 7 was performed after that sale (cf. folio 508). All of this rules out the alleged defect of inadequate reasoning claimed by the public defender.
Instead, the dispute at trial centered on the lack of intent (dolo) alleged by counsel, who argued that her client acted under a mistaken perception of reality because he stated during the adversarial proceedings that he had acquired the property free of restrictions or limitations; that he had never intended to act outside the law and therefore, through an attorney named Nombre09, applied for the building permits before beginning the work; that those permits were ultimately granted; that “Nombre04” built a new bridge without first consulting him; and that he believed the building permit authorized him to repair the existing retaining wall and place a gated structure on top of it, while acknowledging that this was a mistake he made because of poor advice. That position, concerning the existence of a mistake and lack of intent, was rejected by the trial judge essentially for the following reasons: Nombre01 never applied for building permits before beginning the work.
In this regard, it was established that Mr. Nombre05 (a building inspector) observed the construction process while performing fieldwork and, upon noting that there “were” (sic) no permits and that the work continued, he was required to issue a stop-work order (orden de clausura) and refer the case to his colleagues at the Contraloría Ambiental. Likewise, in May 2007, the accused Nombre01 submitted two letters to the Municipalidad de Escazú, reporting that he was repairing a dwelling located at Dirección01, at a cost of one and a half million colones, and attaching a sketch—visible at folio 29—of the physical layout of the residence (cf. folio 509, line 18 et seq.). By virtue of the foregoing, the Departamento de Desarrollo Urbano of the Municipalidad de Escazú, through official letter DU-562-07-EXT, visible at folio 25, ordered the accused to pay fifteen thousand colones as construction tax “and 15.000.00 as a penalty relating to the building permit, for having performed the work without the corresponding license.” As reasoned in the judgment, this evidence completely discredits the accused’s account that he always complied with the law and applied for permits before building, because the evidence demonstrates the contrary and confirms that he began the work without permits and, when compelled to apply for them—as a consequence of the work having been shut down by inspector Nombre05, who observed the ongoing construction while inspecting the area—he was fined for doing so.
Witness Nombre05 explained that, when he went to the site, he observed that a ramp and a retaining wall were being built, and therefore left a warning notice; when he returned to the site for a second inspection, he confirmed that the work had continued and, because there were no permits, he shut down the project and referred the case to the Contraloría Ambiental. He specified that, when he was at the site, the ramp had just been “poured,” and the workers were working on the wall, noting that “when I served notice, the facing and the gates were not there.” The trial judge thus stated that it was entirely certain that, by the time officials from the Contraloría Ambiental of the Municipalidad de Escazú arrived at the site—which occurred on 07 de setiembre de 2007—that ramp and wall had already been erected, and it could be established that this occurred before 29 de mayo de 2007, that is, before the remodeling permit was granted.
The challenged judgment also explains that “[…] It is true that, after the shutdown, Mr. Nombre01 applied for a series of permits, but he did so to replace the mosaic floors with domestic ceramic tile, replace the fibrolit ceilings with gypsum, and apply two coats of paint throughout the house—work that had nothing to do with building a retaining wall with a gated structure on top or enabling vehicular access to the dwelling. As a natural consequence of the foregoing, it can be completely ruled out that Nombre01 misinterpreted the scope of the permit granted to him by the Municipalidad de Escazú, simply because, by the time it was granted—29 de mayo del 2007—he had already built the retaining wall and the ramp, which rules out any mistake in his conduct […]” (cf. folio 30). Similarly, the defense’s account that the construction foreman, motu proprio and without consulting the defendant, built a ramp that allowed vehicle access was rejected as illogical: “[…] the accused’s account that one of the contractors performed that work without his consent, taking advantage of his absence, cannot be accepted.
If we assess that account against the most basic rules of rational sound judgment (sana crítica racional), logic, experience, and common sense, it is apparent that it is not credible. It is wholly illogical that a construction foreman or worker would take it upon himself to make decisions concerning the property and carry out substantial improvements without first consulting its owner, at the risk of having the cost of the materials used deducted from his payment and forfeiting payment for the labor. It is well known that construction workers quote every job they are going to perform and may charge by the hour or by the project; they constitute a trade that is highly exacting in carrying out work and always charges for any additional detail that was not quoted or included, precisely because their profit depends on the number of working hours they must devote to it. Accordingly, it is not credible that Mr.
Nombre04 took materials from the project—sand, stone, cement, reinforcing rods, and formwork intended for remodeling the floors, walls, and roofs—and used them to build access to the dwelling, essentially because one of the workers fell into the stream while carrying materials. First, it must be noted that this access was not a minor or inexpensive project. No; the images at folio 7 show that it was a concrete ramp of considerable width that allowed automobiles to enter, which logically means that a substantial number of worker-hours were devoted to assembling the supports and foundations for the access and then pouring the driving surface—work that undoubtedly entailed a considerable cost in materials and labor. It should also be noted at this point that, if the remodeling to be performed on the house consisted of replacing the ceilings, painting the walls, and installing floor tiles, there was no need for aggregates to make concrete—cement, sand, and stone—or reinforcing rods and steel for trusses, because it is clear that those improvements are carried out using other types of materials.
The presence of those materials on the property, and in the quantity found there, supports the conclusion that the accused had contracted for the construction of that ramp, for which those materials were indispensable. In addition to what has been stated thus far, it is utterly laughable to suggest that the builder would have absorbed the cost of the labor and diverted that substantial quantity of materials to construct the ramp for occupational-safety reasons concerning his employees, who, it bears noting, are well known to work under extreme conditions, build infrastructure from scratch, and adapt to surrounding conditions. In this case, it must be noted that the existing access to the property appeared to be in good condition and allowed people to pass safely, all of which warrants rejecting the defense’s theory. It is simply neither credible nor logical that the construction foreman would have donated his time and materials to improve the accused’s property to his own financial detriment and would have done so behind the accused’s back; this was an illogical exculpatory account offered by the accused to evade criminal and civil liability for his actions.
It should also be noted that, had the events occurred as don Nombre01 described them, the expected action of a law-abiding citizen would have been to demolish the ramp and leave the access as it was; however, that is not what occurred, because the images on case-file page 7 show that the former access was completely closed off and rendered unusable by the retaining wall (muro de contención) that was repaired and erected […]” (cf. case-file page 513, last line onward). The judgment on the merits (fallo de mérito) also addressed the argument raised by the defense at trial—which was again reiterated in these proceedings, where the appellant disregards and obscures the reasons given by the trial judge for rejecting it—namely, that the accused claimed he had acquired the property without any type of restriction. In that regard, the court not only invoked the principle that no one may plead ignorance of the law—specifically, of the prohibition established in Article 33 of the Ley Forestal, which protects as a protected area (zona protegida) “a strip fifteen meters wide in rural areas and ten meters wide in urban areas, measured horizontally on both sides along the banks of rivers, streams (quebradas), or brooks, if the land is flat, and fifty meters horizontally if the land is sloping”—but the judge also correctly stated that “[…] Had the accused Nombre01 followed the ordinary and lawful process for construction, he could have determined the restrictions affecting his property; because he failed to comply with the law, he cannot benefit from his own failure […]” (cf. case-file page 516; the transcription is verbatim).
In addition, in explaining why the accused could not claim that he was unaware that, before commencing the work, he was required to obtain a construction permit (permiso constructivo) from the local government to carry out the remodeling of the retaining wall, the judge found that, under the rules of experience (reglas de la experiencia), he should have known this not only as a matter of general knowledge but also because he had pursued higher education in business administration and had even worked as a restaurant manager. This reasoning applies equally to his alleged ignorance of the restriction imposed by the Ley Forestal, since, as the judgment correctly notes, the accused knew—as a matter of public and notorious fact (hecho público y notorio)—that a stream runs in front of his home. Moreover, the judge also considered that señor Nombre08 had warned the accused that the existing ramp did not permit vehicular access and that the Municipalidad had denied him permission to build a wall to protect the property (cf. case-file page 516).
The foregoing shows that, subtly and implicitly, defense counsel bases the second ground of her challenge on two premises that do not arise from the trial judgment: (i) that señor Nombre01 was not the person who built the wall and ramp, but that those structures had already existed even before he purchased the property; and (ii) that she not only asserts that those structures caused no environmental harm (daño ambiental) in this case, but also appears to assume that the occurrence of such harm is one of the objective elements (elementos objetivos) required to establish the offense of encroachment into a protected area (delito de invasión de zona protegida). Regarding the first objection, it must be noted that the trial court found it proven that the accused, through workers he had hired, carried out a “remodeling” of the property, by which he not only enlarged the ramp, increasing its dimensions to permit vehicular access, but also rebuilt the retaining wall and erected a gated structure on top of it.
As explained supra, he himself acknowledged responsibility for the second of those works, although he claimed mistake (error), believing that the work on the wall was covered by the permit issued by the Municipalidad, while attributing the first work to the foreman. That account was entirely rejected in the judgment, as explained supra. Furthermore, although the reasoning of the judgment (fundamentación de la sentencia) contains errors insofar as it found that the unlawful conduct carried out by the accused caused environmental harm—an issue that will be examined in the following recital (considerando)—this in no way undermines the finding of criminal liability (responsabilidad penal) set forth in the judgment, and it is apparent that the appellant confuses the two issues despite their clear distinction. In addition, the provision governing that statutory offense (tipo penal)—Article 58, subsection 1, of the Ley Forestal—imposes a sentence of three months to three years’ imprisonment simply upon anyone who “[…] encroaches upon a conservation or protected area, regardless of its management category, or upon other forest areas or lands subject to the forestry regime (régimen forestal), regardless of the area occupied and irrespective of whether they are privately owned lands belonging to the State or other agencies of the Public Administration, or privately owned lands.
The perpetrators of or participants in the act shall have no right to any compensation for any construction or work they may have carried out on the encroached lands […]”. As reasoned in the judgment on the merits, in defining this statutory offense the legislature nowhere required the occurrence of environmental harm as an objective element; consequently, the claim raised is immaterial. Furthermore, it is important to note that the mere remodeling of preexisting structures qualifies as encroachment upon the protective zone (zona protectora) of a stream channel, as was found proven in this case. The objections raised under both grounds are denied.
Insufficient and contradictory reasoning supporting the “civil judgment” (specifically, the ecological or environmental damage (daño ecológico o ambiental), as well as its economic quantification). Defense counsel challenges the civil judgment because it does not analyze whether the economic assessment of the ecological damage appearing at folios 57 through 64 reflected the factual circumstances, particularly since documentary evidence issued by government institutions existed that contradicted it. The aforementioned environmental impact study (estudio de impacto ambiental) contains a series of “variables” used to assign an economic value, on a percentage basis, to the damage caused, but those variables did not exist in the area alleged to have been affected. Specifically, the following objections are raised: 2.i.) The item identified as “C” (cf. folio
In addition, the judge finds damage arising from the remodeling carried out by Mr. Nombre01, relying on the report at pages 49 to 63 (which, in essence, consists of an economic assessment of the environmental damage (daño ambiental) existing in the area), without comparing that expert evidence (pericia) with site-visit report CP1-001-005, appearing at pages 118 and 119, issued by three officials of the Sistema Nacional de Áreas de Conservación, who inspected the site on 25 de noviembre de 2008 from 9:00 to 11:50 in the morning in response to a request submitted by Deputy Attorney Juan Carlos Rojas Peñaranda, seeking an analysis of the environmental impact (impacto ambiental) of the remodeling work at issue in these proceedings and a quantification of the possible loss and damages caused. It is in this context that, after observing and analyzing the remodeling work, the report concludes that the site is located in an urban area with a high concentration of residences, housing developments, condominiums, and shopping centers; that the protection area (área de protección) of the creek is completely encroached upon by numerous dwellings, yards, access bridges, and walls (from which it is understood that such encroachment is caused not only by the property of the defendant herein, but also by all those other structures); and that, given the existing circumstances, it is not feasible to conduct an economic assessment of the environmental damage.
It is clear that, despite its critical importance, this report was not specifically analyzed by the trial judge (jueza de mérito), nor did she compare it with the report cited in support of her decision; in this regard, she merely states that environmental damage was found in the affected area (understood to mean damage caused by the structures existing on the property in question), without considering that the wall had already existed and was merely restored and remodeled by Mr. Nombre01. Furthermore, the judge discounts “a study” (apparently referring to the report at page 162) “which stipulated that the structure built at the front of the property did not affect the watercourse in terms of its hydraulic dynamics,” because—the judge argues—it is clear to her that the assessment was conducted solely to consider the flow of the body of water, but never assessed whether the work affected the environment, as was indeed determined by the expert report at pages 49 et seq.
Nevertheless, the trial court (tribunal de mérito) fails to consider not only that the natural flow of the water is an essential part of the environment, but also that the report at pages 118 and 119 (which was prepared specifically in the context of determining environmental damage arising specifically from the work attributed to defendant Nombre01, and which she does not even analyze) appears to contradict the conclusions of the study cited in support of the decision rendered. Finally, and this is the most significant error evident in the analysis set forth in the challenged judgment, the judge does not consider that the official from the Sistema de Áreas de Conservación himself (engineer Gilberto Brooks Jhonson, who prepared the document at pages 49 et seq.) states that it cannot be asserted that the retaining wall (muro de contención) existing in the creek bed (cauce de la quebrada) was built by the accused; and that the house being remodeled was built many years ago (cf. pages 51 and 52), this being the factual basis upon which that professional economically assessed the environmental damage.
As can be seen, the trial judge did not consider that these premises might have affected the conclusions she reached. Furthermore, that expert estimated the environmental damage (as a whole) that he identified in this area, consisting of the “[…] ENCROACHMENT UPON THE PROTECTION AREA AND THE BED OF THE QUEBRADA QUEBRADILLO THROUGH THE STRUCTURES (FENCES ON THE RETAINING WALL AND EXPANSION OF THE EXISTING DWELLING) […]” (cf. page 60). As can be seen, this economic calculation was based on the entire remodeling of the house and the fences on the retaining wall (without itemizing one component separately from the other), even though the facts supporting the complaint do not even mention the expansion of the existing dwelling, being limited instead to the access bridge and the wall and fence structure (cf. page 43). All of the foregoing entirely undermines the civil judgment (condenatoria civil) entered against the defendant (including costs), and therefore points 2.vi.) and 2.vii.) of this second ground of appeal are granted as to those matters, and the case is remanded (reenvío) to the originating office for new proceedings in accordance with law. In all other respects, the challenged judgment remains undisturbed. Because it is unnecessary, no ruling is made on the remaining objections included in this section of the appeal.
POR TANTO:
Points 2.vi.) and 2.vii.) of the second ground of the appeal (recurso de apelación) filed by the public defense are granted. Accordingly, the trial court judgment (fallo de instancia) is partially vacated, solely insofar as it granted the civil action for damages (acción civil resarcitoria) and ordered the payment of costs (costas). In this regard, the case is remanded (reenvío) to the court of origin for new proceedings in accordance with law. In all other respects, the challenged judgment remains undisturbed. As it is unnecessary, no ruling is issued regarding the other objections included in this section of the appeal. The first and third grounds of the challenge are denied. Resolución: 20 17-1333 Resolución: 20 17-1333 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, a l ser las nueve horas quince minutos, del seis de noviembre de dos mil diecisiete.- RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra Nombre01 , mayor, costarricense, cédula de identidad número CED01 , nacido en San José, el 24 de diciembre de 1968, hijo de Nombre02 y Nombre03 , divorciado, de oficio salonero , vecino de San José, Hatillo 7 del palacio del Mueble 300 metros oeste y 200 sur alameda 4, casa 276, casa color beige, con ventanales estilo crucero a mano izquierda ; por el delito de INFRACCIÓN A LA LEY FORESTAL POR INVASIÓN DE UN ÁREA DE PROTECCIÓN , en perjuicio de l MEDIO AMBIENTE . Intervienen en la decisión del recurso, el juez Mario Alberto Porras Villalta, las co- juezas Patricia Vargas González y Laura Murillo Mora . Se aperson ó en esta sede la licenciada Juliana Yglesias Luconi defensora pública del imputado .
RESULTANDO:
I.Que mediante sentencia número 594 -20 17 , de las nueve horas treinta minutos del cinco de junio de dos mil diecisiete , el Tribunal Penal del Tercer Circuito Judicial de San José, Sede Suroeste, Pavas , resolvió: "POR TANTO: De conformidad con lo expuesto y los artículos 36, 39, 41 y 50 de la Constitución Política, 1, 4, 11, 16, 18 al 20, 30, 45, 50, 51, 59 al 63, 71, 73, 74, 103 inciso 1) y 2) del Código Penal, numeral 58 inciso 1) de la Ley Forestal número 7575, ordinales 1, 2, 3, 4, 5, 6, 8, 10, 37, 38, 40, 41, 76, 111 al 115, 140, 141, 142, 144, 180, 181, 182, 184, 265 al 270, 360, 361, 363, 364, 365, 367 y 368 del Código Procesal Penal, artículo 3 de la Ley Orgánica de la Procuraduría General de la República, 122, 123, 124 y 126 del Código Penal de 1941 Reglas Vigentes sobre Responsabilidad Civil en relación al numeral 57 de la Ley Forestal número 7575; 1045 del Código Civil, artículo 41, 45 en relación con el 18 del Decreto de Honorarios Profesionales en Derecho Número 32493, vigente a partir del 9 de marzo del 2005, se resuelve; 1.
Se declara a Nombre01 autor responsable de un delito de INFRACCIÓN A LA LEY FORESTAL POR INVASIÓN DE UN ÁREA DE PROTECCIÓN cometido en perjuicio del MEDIO AMBIENTE y, en tal carácter, se le impone el tanto de TRES MESES DE PRISIÓN, sanción que deberá descontar en el lugar y forma que lo indiquen los respectivos reglamentos penitenciarios, previo abono de la preventiva que hubiere sufrido. Por contar el condenado con los requisitos establecidos por la ley y, siendo la pena impuesta menor a tres años, se le concede el Beneficio de Ejecución Condicional de la Pena, por el plazo de TRES AÑOS, dentro de los cuales el condenado no podrá cometer delitos dolosos que se sancionen con pena mayor a seis meses de prisión, caso contrario se le revocará el beneficio aquí concedido. Son las costas del proceso penal a cargo del sentenciado. 2. Se declara CON LUGAR la ACCIÓN CIVIL RESARCITORIA promovida por El Estado, por intermedio de la Procuraduría General de la República en contra de los demandados civiles Nombre01 y la sociedad anónima ROJAMOR ROJAS Y MORA S.A y, se les condena al pago solidario del DAÑO ECONÓMICO causado, ordenándose pagar la suma de CUATRO MILLONES QUINIENTOS NOVENTA MIL COLONES (¢4.590.000).
Se condena a los demandados civiles a pagar las COSTAS PERSONALES Y PROCESALES de la Acción Civil Resarcitoria, los cuales se conceden en favor del Estado y se fijan en la suma de UN MILLÓN CINCUENTA Y CINCO MIL SETECIENTOS COLONES EXACTOS (¢1.055.700). Se condena a los demandados civiles a pagar las COSTAS PERSONALES de la Querella, los cuales se conceden en favor del Estado y se fijan en la suma de DOSCIENTOS MIL COLONES EXACTOS (¢200.000) para un gran total de UN MILLÓN DOSCIENTOS CINCUENTA Y CINCO MIL SETECIENTOS COLONES EXACTOS (¢1.255.700). Los montos fijados deberán pagarlos los demandados civiles dentro de los quince días de la firmeza de la sentencia, bajo apercibimiento de que, en caso de no hacerlo, se podrá acudir a la vía de ejecución de sentencia. 3. De conformidad con el numeral 140 del 3. Código Procesal Penal se ordena el restablecimiento de las cosas a su estado anterior, en virtud de lo cual se dispone la demolición de la obra que fue construida en la finca del Partido de San José, matrícula , ubicada en San Rafael de Escazú, plano catastro número , invadiendo el área de protección de la Quebrada Quebradilla.
Se dispone la demolición del puente o rampa de acceso construido sobre el cauce de la citada quebrada, como del muro de contención construido junto a la estructura de verjas, levantadas al margen del cauce de la quebrada. Se ordena además la limpieza de todos los escombros que resulten del proceso de demolición. Se comisiona esa labor al Ministerio del Ambiente y Energía del Área de Conservación Pacífico Central y a la Municipalidad de Escazú, las cuales deberán ser notificadas de esta decisión. Dichas entidades, de previo a cualquier acción encaminada a cumplir con esta orden, deberá medir el impacto que la eliminación del muro de contención y de la rampa de acceso puede provocar, debiendo buscar la forma en la cual no se ponga en peligro la vida de terceras personas y pueda recuperarse la zona protegida. Para ello, la sociedad dueña de la propiedad donde se ubica el muro de contención y la rampa de acceso deberá autorizar el ingreso del personal del Ministerio del Ambiente y Energía y de la Municipalidad de Escazú, tanto para efectuar los estudios correspondientes, como para destruir las citadas obras.
Una vez firme la sentencia inscríbase en el Registro Judicial y envíense los testimonios de estilo para ante el Juzgado de Ejecución de la Pena y el Instituto Nacional de Criminología. Mediante la lectura integral del sentencia quedarán las partes debidamente notificadas. " (sic).
II.Que contra el anterior pronunciamiento, la licenciada Juliana Yglesias Luconi defensora pública del imputado , interpus o recurso de apelación.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta el juez de Apelación de Sentencia Penal Porras Villalta ; y,
CONSIDERANDO:
Fundamentación intelectiva insuficiente y quebranto al in dubio pro reo. (1).- En su primer motivo explica la abogada defensora que “[…] Si analizamos la sentencia que se recurre es fácil notar que la exposición del Tribunal con respecto a mi representado justificando su condena es inexistente […] lo que se hace por parte del Tribunal es citar las diversas declaraciones de los testigos una y otras uniéndose con frases que analizadas de manera integral no denotan un esfuerzo intelectual por parte del Tribunal, no se logra observar que mas allá de lo dicho por los testigos exista en el fondo una debida fundamentación requerida por la ley, se hace un uso inadecuado de la prueba, porque se utiliza de manera excesiva para darle contenido al fallo citando la de cargo y descargo indicaron extrañándose la valoración propia del Tribunal […]” (cfr. folio 536). (3).- En el tercer motivo de apelación, reclama la defensora el quebranto del principio in dubio pro reo, por lo siguiente: 3.i.) Quedó acreditado que el muro de contención objeto de la discusión, así como el acceso a la propiedad, existían desde que el imputado compró la propiedad, es decir, no fue él quien ocasionó (si se pudiera determinar) un daño ambiental. 3.ii.) El estudio registral de la propiedad que consta en autos, determina que no aparece inscrito algún gravamen o anotación con respecto a la ley forestal. 3.iii.) Con los documentos indicados en el motivo anterior se ve que existió duda sobre la afectación ambiental y, por “resorte”, debe recaer esa duda en la culpabilidad del imputado.
Sin lugar ambos motivos de la queja. En el fallo de mérito se explica con toda claridad, corrección y suficiencia, por qué se llegaron a tener por demostrados el hecho y la responsabilidad del encartado en el mismo, sin que en ese iter lógico se advierta yerro alguno. Al respecto se consideró que, para el momento de los hechos, el acusado era el presidente y apoderado generalísimo de ROJAMOR S.A., persona jurídica que ostenta la titularidad registral de la propiedad en cuestión, extremo que, al declarar en juicio, aquel admitió; que también reconoció haber dispuesto la realización de los trabajos de remodelación (para lo cual contrató a terceras personas, entre ellas al señor Nombre04), mismos que incluyeron la ampliación de la rampa de acceso y la reconstrucción del muro de contención, sobre el cual ‒además‒ se erigió una estructura con verjas, todo ello dentro de la zona de protección de la quebrada Quebradilla, en Escazú.
En la sentencia se explica con amplitud y sencillez que, aunado a ello, en juicio se recibieron las declaraciones de varios funcionarios de la Municipalidad de Escazú (Nombre05, Nombre06 y Nombre07), cuyos relatos se vieron respaldados por los informes que en su momento confeccionaron por escrito, quienes detectaron que las obras de remodelación se iniciaron y desarrollaban sin contar con permiso constructivo alguno, y que luego de extendido éste a raíz de una intervención del inspector Nombre05 (dicho permiso sólo autorizaba trabajos menores), se constató la ampliación de la rampa para permitir el acceso de vehículos, así como la reconstrucción del muro de retención, siendo que sobre éste a su vez se levantó una estructura con rejas. Es más, el propietario anterior (señor Nombre08), quien le vendió el inmueble al encartado, corroboró lo narrado por los funcionarios municipales, al mencionar que las obras cuya imagen aparece a folio 7 fueron realizadas después de esa venta (cfr. folio 508).
Todo esto permite descartar el supuesto vicio de falta de fundamentación que denuncia la defensora pública. En este caso la discusión en juicio se centró, más bien, en la falta de dolo que adujo dicha profesional en Derecho, al argumentar que su representado actuó bajo una falsa representación de la realidad, pues él señaló en el contradictorio que adquirió la propiedad sin afectaciones o limitaciones; que nunca quiso actuar al margen de la ley, por lo que a través de un abogado llamado Nombre09 solicitó los permisos de construcción antes de comenzar las obras; que finalmente éstos le fueron concedidos; que “Nombre04” construyó un puente nuevo sin consultarle antes; que él consideró que el permiso de construcción le autorizaba a reparar el muro de contención existente y ponerle encima una estructura de verjas, aceptando que ese fue un error que cometió por mala asesoría. Tal posición, relativa a la existencia de un error y falta de dolo, fue desacreditada por la juzgadora, en esencia, por lo siguiente: Nombre01 nunca solicitó los permisos de construcción antes de iniciar las obras.
Al respecto se tiene que don Nombre05 (inspector de construcciones) observó el proceso constructivo cuando estaba realizando labores de campo y, al advertir que no “habían” (sic) permisos y que la obra siguió su curso, debió emitir la orden de clausura y pasar el caso a sus compañeras de la Contraloría Ambiental. Asimismo, el acusado Nombre01 presentó dos notas a la Municipalidad de Escazú, en el mes de mayo de 2007, informando que estaba realizando una reparación de una casa de habitación, situada en la Dirección01, labores que ascendían al millón y medio de colones, aportando un croquis ‒visible a folio 29‒ de la planta física de la vivienda (cfr. folio 509, línea 18 en adelante). En virtud de lo anterior, el Departamento de Desarrollo Urbano de la Municipalidad de Escazú, mediante oficio DU-562-07-EXT visible a folio 25, le previno al endilgado el pago de la suma de quince mil colones por concepto de impuesto de construcción “y 15.000.00 por concepto de multa al permiso de construcción, por haber realizado las obras sin la respectiva licencia”.
Según se razona en el fallo, esas probanzas desacreditan por completo la versión del imputado, en el sentido de que él siempre respetó la ley y pidió los permisos antes de construir, porque la evidencia demuestra lo contrario y confirma que él comenzó las obras sin permisos y, al verse forzado a solicitarlos (como consecuencia de que la obra le había sido clausurada por el inspector Nombre05 que, en un recorrido por la zona, observó la construcción que se estaba haciendo), fue multado por ello. El testigo Nombre05 explicó que, cuando él fue al sitio, observó que se estaba construyendo una rampa y un muro de contención, por lo cual dejó una nota preventiva y, al regresar al sitio en una segunda inspección verificó que los trabajos habían continuado y, ante la ausencia de permisos él clausuró la obra y pasó el caso a la Contraloría Ambiental; precisó que, cuando él estuvo en el sitio, la rampa estaba recién “chorreada” y los operarios estaban laborando en el muro, apuntando que “cuando notifiqué no estaba el enchape ni las verjas”.
De este modo la jueza de mérito indica que se tiene total certeza que, para el momento en que los funcionarios de la Contraloría Ambiental de la Municipalidad de Escazú se presentaron al sitio (lo cual ocurrió el 07 de setiembre de 2007) esa rampa y ese muro estaban ya levantados, pudiéndose establecer que ello ocurrió antes del 29 de mayo de 2007, es decir, antes de que se otorgara el permiso de remodelación. En el fallo impugnado también se explica que “[…] Ciertamente don Nombre01 solicitó luego de la clausura una serie de permisos pero ello lo hizo para cambiar los pisos de mosaico por cerámica nacional, para sustituir los cielos de fibrolit por gypsum y pintar a dos manos toda la casa, obras que nada tenían que ver con construir un muro de contención con una estructura de verjas encima y habilitar un acceso vehicular a la vivienda. Como consecuencia natural de lo anterior se puede desechar por completo que, Nombre01 hizo una mala interpretación de los límites del permiso que le fue dado por la Municipalidad de Escazú sencillamente porque, para el momento en que le fueron dados -29 de mayo del 2007- ya había construido el muro de contención y la rampa, lo cual permite desechar que se esté ante un error en su actuar […]” (cfr. folio 30).
De igual manera, se rechazó, por resultar ilógica, la versión defensiva según la cual fue el maestro de obras quien, de motu proprio y sin consultarle al encartado, construyó una rampa que permitía el acceso a un vehículo: “[…] la versión rendida por el imputado en el sentido de que esa obra la hizo uno de los contratistas, sin su consentimiento, aprovechando su ausencia, no resulta de recibo. Si analizamos la citada versión contra las más básicas reglas de la sana crítica racional, la lógica, la experiencia y el sentido común se advierte que la misma no es creíble. Es absolutamente ilógico que un maestro de obras o un operario dispongan de la propiedad y realicen mejoras sustanciales sin consultarlas antes con su propietario, con el riesgo de que se le sea descontado del pago los materiales utilizados y perdiendo el pago de la mano de obra. Es bien sabido que los operarios de construcción cotizan todo trabajo que vayan a hacer y pueden cobrar por hora o bien por proyecto, siendo un gremio que se comporta de forma muy recelosa en la ejecución de la obras y cualquier detalle extra que no se hubiera cotizado o incluido siempre lo cobran, precisamente porque la ganancia que tienen depende de las horas de trabajo que deben destinar.
En esa medida no es creíble que don Nombre04 haya tomado el material de la obra -arena, piedra, cemento, varillas, formaleta para remodelar los pisos, paredes y techos- y los empleara para construir un acceso a la vivienda, básicamente porque uno de los operarios se cayó a la quebrada cuando llevaba material. En primer lugar debe señalarse que ese acceso no era una obra de poca monta y costo. No, se si aprecian las imágenes de folio 7 se evidencia que se trataba de una rampa en concreto con un ancho considerable que permitía el acceso de automóviles, lo cual lógicamente supone que se destinaron una importante cantidad de horas de operario para montar los soportes y bases del acceso para luego chorrear la superficie de rodamiento, obra que, sin duda alguna tenía un costo considerable en materiales y mano de obra. Inclusive en este punto debe señalarse que, si la remodelación que se iba a hacer a la casa era el cambio de los cielorrasos, la pintura de las paredes y el enchape de los pisos, no era necesario contar con agregados para obtener concreto -cemento, arena, piedra-, más varillas y acero para cerchas, porque es claro que esos arreglos se hacen con otro tipo de materiales.
La presencia de los mismos en la propiedad y en la cantidad que lo había permite concluir que era porque el acusado había contratado la construcción de esa rampa, por lo cual esos materiales eran imprescindibles. Además de lo hasta aquí dicho, resulta absolutamente risible que el constructor hubiere asumido la pérdida del costo de la mano de obra y desviado esa importante cantidad de materiales para la confección de dicha rampa, por razones de seguridad ocupacional para sus empleados, los cuales valga señalar es bien sabido laboran bajo condiciones extremas y construyen desde cero infraestructura y se adecuan a las condiciones del entorno. En este caso es preciso hacer notar que el acceso que había a la propiedad era uno que se podía ver en buen estado y que permitía el paso de personas en condiciones de seguridad, todo lo cual permite desechar la tesis de la defensa. Sencillamente no es creíble y lógico que el maestro de obras hubiera donado el tiempo y el material para mejorar la propiedad del imputado en detrimento de sus finanzas y lo hubiera hecho a sus espaldas, siendo esa una versión de descargo ilógica que brindó el imputado para evadir la responsabilidad penal y civil por sus acciones.
Inclusive debe llamarse la atención que, de haber sucedido los hechos como don Nombre01 lo señaló, la acción esperable de un ciudadano respetuoso con la ley era demoler la rampa y dejar el acceso tal como estaba, sin embargo eso no fue lo que ocurrió porque las imágenes de folio 7 denotan que ese antiguo acceso fue cerrado por completo, quedando condenado con el muro de contención que se reparó y levantó […]” (cfr. folio 513, última línea en adelante). En el fallo de mérito también hubo pronunciamiento en cuanto al alegato que esgrimió la defensa en juicio (que de nuevo fue reiterado en esta sede, donde la impugnante ignora e invisibiliza las razones que al respecto expuso la jueza de instancia para rechazarlo), centrado en que el encartado adujo que él adquirió la propiedad sin ningún tipo de limitación. Al respecto no sólo se invocó el principio de que nadie puede alegar ignorancia de la ley (concretamente, de la prohibición que contempla el artículo 33 de la Ley Forestal, al tutelar como zona protegida “una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado”), sino que, con toda corrección, la juzgadora señala que “[…] De haber seguido el imputado Nombre01 el orden natural y legal para construir habría podido determinar las restricciones que existían sobre su propiedad, siendo que, al no cumplir con la ley no es posible que resulte beneficiado de su propia falta […]” (cfr. folio 516; la transcripción es literal).
Aunado a esto, a efectos de explicar por qué el encartado no podía alegar que desconocía que para realizar la remodelación (del muro de contención) era indispensable contar, de previo al inicio de las obras, con un permiso constructivo otorgado por el gobierno local, la jueza consideró que, conforme a las reglas de la experiencia, ello no sólo debía conocerlo por cultura general, sino ‒además‒ porque él cursó estudios superiores en administración de empresas y hasta laboró como gerente de un restaurante. Este razonamiento es igualmente aplicable al alegado desconocimiento de la limitación impuesta por la ley forestal, siendo que, como bien se señala en el fallo, por tratarse de un hecho público y notorio el encartado sabía que una quebrada pasa frente a su vivienda. Pero es que, además, la juzgadora también analiza que el señor Nombre08 le advirtió al acusado acerca de que la rampa existente no permitía el acceso vehicular, y que la Municipalidad le había denegado el permiso para construir un muro que protegiera la propiedad (cfr. folio 516).
De lo hasta aquí expuesto se aprecia que, de modo sutil e implícito, la defensora sustenta el segundo motivo de su queja en dos premisas que no se derivan del fallo de instancia, a saber, (i) que el señor Nombre01 no fue quien construyó el muro y la rampa, sino que dichas obras ya existían ‒incluso‒ desde antes de que él comprara el inmueble; y (ii) no sólo asegura que en este caso dichas obras no generaron un daño ambiental, sino que ‒además‒ parece asumir que la producción de éste es uno de los elementos objetivos que se requieren para la configuración del delito de invasión de zona protegida. Respecto del primer reparo se debe indicar que el tribunal de instancia tuvo por demostrado que el encartado, a través de trabajadores contratados por él, realizó una “remodelación” en la propiedad, en virtud de la cual no sólo amplió la rampa, ampliando sus dimensiones a efectos de que permitiera el acceso vehicular, sino que -además- reconstruyó el muro de contención, erigiendo sobre él una estructura con rejas.
Tal y como se explicó supra, él mismo reconoció la paternidad de la segunda de esas obras, aunque adujo un error al haber creído que los trabajos en el citado muro estaban comprendidos en el permiso otorgado por la municipalidad; mientras que la primera se la endosó al maestro de obras. Tal versión fue del todo descartada en el fallo, según se explicó supra. Por otra parte, si bien en este caso existen yerros en la fundamentación de la sentencia, en cuanto se tuvo por demostrado ese daño ambiental, derivado de la conducta ilícita desplegada por el encartado (extremo que se analizará en el siguiente considerando), ello en modo alguno desacredita el juicio de responsabilidad penal asentado en el fallo, siendo notorio cómo la impugnante confunde ambas cuestiones, pese a su evidente diferenciación. Aunado a ello, la norma que regula ese tipo penal (artículo 58 inciso 1° de la Ley Forestal) sanciona con pena de tres meses a tres años de prisión, simplemente a quien “[…] invada un área de conservación o protección, cualquiera que sea su categoría de manejo, u otras áreas de bosques o terrenos sometidos al régimen forestal, cualquiera que sea el área ocupada; independientemente de que se trate de terrenos privados del Estado u otros organismo de la Administración Pública o de terrenos de dominio particular.
Los autores o participes del acto no tendrán derecho a indemnización alguna por cualquier construcción u obra que hayan realizado en los terrenos invadidos […]”. Tal y como se razonó en la sentencia de mérito, al estructurar este tipo penal en ninguna parte el legislador exigió, como elemento objetivo, la producción de un daño ambiental, de ahí lo inconducente que resulta el reclamo planteado. Además, es importante señalar que la sola remodelación de obras preexistentes, califica como una invasión a la zona protectora del cauce de una quebrada, conforme se tuvo por acreditado en la especie. Sin lugar los reproches que se plantean en ambos motivos.
Insuficiente y contradictoria fundamentación de la “condena civil” (concretamente, del daño ecológico o ambiental así como de su cuantificación económica). Reprocha la defensora la condena civil, por cuanto no se analiza si la valoración económica del daño ecológico visible de folios 57 al 64 se adecuaba a la realidad de los hechos, máxime que existía prueba documental emitida por instituciones del gobierno que la desvirtuaba. En el referido estudio de impacto ambiental se encuentra una serie de “variables” que se utilizan para, porcentualmente, darle valor económico al daño ocasionado, pero las mismas no existían en la zona que se dice afectada. En concreto, se reprocha lo siguiente: 2.i.) El punto señalado como “C” (cfr. folio
POR TANTO:
Se declaran con lugar los puntos 2.vi.) y 2.vii.) del segundo motivo del recurso apelación interpuesto por la defensa pública. En virtud de ello, se anula parcialmente el fallo de instancia, sólo en cuanto se declaró con lugar la acción civil resarcitoria y se dispuso la condena en costas. Al respecto, se ordena el reenvío a la oficina de origen para una nueva sustanciación conforme a Derecho. En lo demás, el fallo impugnado permanece incólume. Por resultar innecesario, se omite pronunciamiento en cuanto a los demás reparos que se incluyen en este apartado del recurso. Sin lugar los motivos primero y tercero de la impugnación.
