Heard before the Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos.-* * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * FINDINGS: * * * * * * * * * * * * * 1.- The plaintiff filed this action, valued at six million colones, requesting that the judgment declare the following: "I request that the judgment declare that the undersigned has a superior right of possession (mejor derecho de posesión) over a parcel of land located at [Dirección1] , , , San Carlos, Province of Alajuela. It is described in registered survey plan (plano catastrado) NO.A-1556019-2012 dated February 23, 2012, with an area of SIX HECTARES ONE THOUSAND FOUR HUNDRED TWENTY-FOUR SQUARE METERS. It is bounded to the north by: Ganadera Linda Vista Sociedad Anónima and an unnamed stream; to the south by the defendants and [Nombre4] ; to the east by: [Nombre5] ; and to the west by: the parties sued.

The property is land devoted to agriculture and pasture for livestock. 2- That the parties sued have no superior right, nor any superior right of possession over the property in dispute than the undersigned, and furthermore cannot be deemed possessors in good faith, since they have always known that the land does not belong to them. 3- That the co-defendants must be ordered to restore to me possession of the property that they wrongfully appropriated, the area of which is established in registered survey plan NO. A-1556019-2012 dated February 23, 2012, measuring SIX HECTARES ONE THOUSAND FOUR HUNDRED TWENTY-FOUR SQUARE METERS and described in the second factual allegation of this action. 4- That, should the land in dispute form part of any of the plans and title documents for the co-defendants' land, an order be issued to correct their stated area, excluding the area that belongs to me as a matter of right, and to annul said plan and the title it generated. 5- Consequently, the area of the land must be corrected in the registration before the Registro Nacional de la Propiedad under the real-property folio system for the co-defendant's property, namely number CED7, or any other property under which the land area at issue in this litigation is registered, which shall be the area determined by the expert appointed for that purpose. 6- That it be declared that the co-defendants were never sold the area at issue herein when they purchased the property now registered in the name of [Nombre3] S.A. under number CED7. 7- That, should the co-defendants oppose this action, they be ordered to pay the costs of these proceedings." (See image 25).- Likewise, the plaintiff complied with the direction in the terms appearing in images 28 and 29, and requested: "Regarding the claims against co-defendant IDA: I- That said land is part of the Reserva Chambacú and that this parcel remained untitled because it belongs to the plaintiff. II- That co-defendant IDA knows that the area in dispute was possessed first by the plaintiff's father, Mr. [Nombre6] , and later by the plaintiff, [Nombre1] . III- That the area at issue in the litigation does not form part of the land that IDA titled to co-defendant [Nombre3] Sociedad Anónima." I. PROVEN FACTS

The Court adopts the statement of proven facts, as it is well supported by the case record.*

II. UNPROVEN FACTS

Likewise, the Court adopts the determination concerning facts not proven.*

III.The plaintiff's agrarian public defender appealed the judgment, arguing: 1.- Lack of reasoning, because he considers the judgment contradictory, given that proven fact 1) acknowledges that the plaintiff was given, by public deed, a parcel of land on September 25, 1979, forming part of an unregistered property; and that plan A-1556019-2012 dated February 23, 2012, identifies the area claimed, from which it follows that he would prove that he holds a right of possession, since it is not registered and falls within the Programa de Titulación de Chambacú. This is stated in the document left to him by [Nombre6] ; on the other hand, he points out that the document admitted as evidence to aid the Court in reaching a decision, namely the deed submitted by witness [Nombre7] , dated October 8, 2010, concerns property registration number CED8 and has nothing to do with these proceedings, because the area he claims has no title and has not generated a deed.

He questions why the defendants delayed in submitting the property's deed and why it was the witness who produced it; in his view, the documentary evidence should have been assessed more thoroughly in relation to the expert evidence and the evidence submitted by INDER concerning the Zona de Titulación de Reserva Chambacú. He considers that the plaintiff complied with numeral 317 of the Código Procesal Civil, because he possessed the land and lived on the property for many years until he left, and that co-defendant* [Nombre3] S.A. has exercised possession in bad faith. 2.) Erroneous assessment of the evidence:* First, he considers that, pursuant to Article 317 of the CPC, [Nombre1] succeeded in proving his possession through his witness [Nombre8] , who described how he acquired it from his father; the witness also stated that his mother, [Nombre1] , possessed only the area she sold to Luiyi del Sur LDS S.A., but never possessed in her own name the area in dispute, only the area registered in her name.

He argues that witnesses [Nombre7] , [Nombre9] and [Nombre10] are accommodating witnesses and do not support the defendant's theory of the case regarding possession, and that they were shown to be unlawful occupants; they knew, he states, that the land area was not part of the property registered under Real Folio 187.709-000. He considers that deed 145-10-2010 does not show that [Nombre7] sold that other area to [Nombre3] S.A., the same area that she purchased from [Nombre1] , whom, he asserts, they chose not to call in the proceedings for reasons of convenience. It is not true that the plaintiff failed to establish the location of the land. Moreover, the document upon which the co-defendants rely is a mere photocopy and was introduced unlawfully; furthermore, how could she sell land that did not belong to her? Based on the foregoing, he requests that the defendants' possession be declared unlawful and that, because the substantive requirements have been proven, the judgment be reversed, given that the property is identified by the 2012 registered survey plan and that he has active standing pursuant to the public deed submitted.*

IV.All the grievances (agravios) raised by the appellant concern the statement of reasons (fundamentación) and the evaluation of evidence (valoración de la prueba). In agrarian matters, the principle of free evaluation of evidence (principio de libre valoración de la prueba) applies. In this regard, the Court has stated: “VI. …The assessment or evaluation of evidence (apreciación o valoración probatoria) consists of the selection process that the judge must undertake among the sources of evidence obtained in order to establish which of them are effective for resolving the dispute submitted for adjudication. Such selection allows the judge to choose between the divergent positions presented by each party to the procedural relationship (relación procesal). This process requires several basic intellectual steps identified by legal scholarship: In evidentiary activity, we always find three basic aspects: perception, representation or reconstruction, and deductive or inductive reasoning.

The judge cannot acquire knowledge of a fact without personally perceiving something through the judge’s own senses; for that purpose, as [Nombre11] states, contact between the judge and the reality to be adjudicated is unavoidable. The judge may observe the facts directly or indirectly through accounts given by other persons or through objects or documents. This is always a sensory operation, without which it would be impossible to assess the content and persuasive force of evidence. Once the facts have been perceived individually, their historical reconstruction must be undertaken; this cannot be done in isolation, since it must be carried out as a whole and with the care necessary to avoid admitting facts that distort reality or alter its meaning. General rules of experience are also valid for purposes of assessment…. Perception of the means, conditions, and place in which the facts occurred will subsequently enable the judge to perform an interpretive task.

Indeed, once the judge has perceived the means of evidence (medios de prueba), the judge must interpret the evidentiary data in order to give them legal meaning. Third, the judge must establish the degree of effectiveness warranted by each means of evidence, both from a formal standpoint (with respect to whether the means of evidence exists under the law and whether it was duly produced) and from a substantive standpoint (the sincerity or truthfulness of the source, in order to determine whether the witness is lying or whether the document has been altered). A fourth step would consist of verifying whether the judge is legally bound by any type of evidence (under the system of legal or predetermined evidence (prueba legal o tasada)). This would not apply when the judge is free to assess the evidence, as is the case in agrarian matters. Finally, the judge must reconstruct the disputed facts as, in the judge’s view, they occurred, considering and refining all sources of evidence as a whole. This entails assessing the evidence as a whole, from which the duty to state the reasons for the judgment (deber de motivación de la sentencia) derives. *

The agrarian judge (Juez agrario) comes into contact with the facts through direct and immediate “in situ” perception or observation. The agrarian judge’s conviction is a psychological act applied to a specific, living situation inherent in agrarian reality. The agrarian judge must examine the credibility of statements made by a witness or a party in order to properly assess their value. The judge must also analyze social experience, the environment—the agrarian world—in which the dispute arises, and even the culture and conduct of rural farmers. Accordingly, consideration must be given, on the one hand, to the authenticity and sincerity of each item of evidence when it involves documents, confessions, and testimony and, on the other hand, to determining its accuracy and credibility. This safeguards the principles of loyalty and probity (principios de lealtad y probidad) in the outcome of the evidentiary element. The parties to the proceedings have the right to know all relevant factors that contributed to the formation of the ruling. The grounds and reasoning of the ruling are what enable review by the higher judicial level. In other words, the agrarian judge associates a particular situation (that of the specific case) with similar real-world situations that the judge has come to know through experience (Tribunal Agrario, No. 206 de las 14:50 horas del 26 de marzo de 1999). *

V.In order to resolve the appellant’s grievances, given that this is an ordinary agrarian proceeding (proceso ordinario agrario) known as one concerning the “superior right of possession” (“mejor derecho de posesión”), this Court will set forth certain considerations regarding agrarian rights in rem (derechos reales agrarios), particularly agrarian property (propiedad agraria) and the superior right of possession. Referring to the function and structure of rights in rem (derechos reales), the Constitutional Chamber (Sala Constitucional) stated as follows: IV.-ON THE RIGHT TO PROPERTY.* Article 45 of the Constitución Política enshrines the right to property and does so as follows: “Property is inviolable; no one may be deprived of their property except for a legally established public interest, upon prior compensation in accordance with the law. In the event of war or internal unrest, prior compensation is not indispensable. The corresponding payment shall, however, be made no later than two years after the state of emergency has ended. *

For reasons of public necessity, the Asamblea Legislativa may, by a vote of two-thirds of all its members, impose restrictions upon property in the social interest”*

  1. 1TYPES OF PROPERTY, THEIR FUNCTION, AND THEIR STRUCTURE ARE THE CREATION OF THE LEGISLATURE. Under a broad interpretation of the foundational text for resolving the judicial consultation presented and determining whether a private-property standard (acquired through adverse possession (usucapión) and recorded in the Registro Público through Possessory Information Proceedings (Información Posesoria)) or a public agrarian-property standard (reserved to the State) should apply, it is necessary to recall what this Chamber stated concerning the different property regimes encompassed by that provision: “For those reasons, the concept of property under the aforementioned Article 45, in relation to Article 50, both constitutional provisions, includes forest property, agrarian property, ecological property, environmental property, etc., all of which have a constitutional basis in the cited articles and a specific legal regulation and nature...” [Nombre12]( ., No. 5893-95 de 9:48 horas del 27 de octubre de 1995).The meaning of that statutory interpretation must be explored more deeply. The treatment afforded to the protection of rights in rem in civil and agrarian matters is of great importance in all legal systems that have established a constitutional foundation rooted in the protection of fundamental human rights: alongside rights of economic freedom, which include private property and other derivative rights in rem, economic, social, and environmental rights and duties have also been enshrined. Private property and economic freedom enjoy constitutional protection under Articles 45 and 46 of our Constitution and, although it may seem obvious, their existence and protection arise from the continued existence of a Social State under the Rule of Law (Estado Social de Derecho), founded upon constitutional principles and values that enshrine not only rights in favor of private persons but also duties aimed at achieving economic development with equity, solidarity, and social justice.Consequently, if the constitutional rules and principles governing rights in rem are shared by both civil and agrarian matters, those two branches cannot be completely separated from Constitutional Law (Derecho de la Constitución), particularly regarding expropriation for purposes of public utility (expropiación con fines de utilidad pública). The function and structure of rights in rem are common to both fields, but their content differs. Function means the economic or social utility for which a particular right in rem was designed, and it will depend on the nature—civil, agrarian, ecological, or environmental—of the property to which that right applies. Structure refers to the set of rights and obligations of the holder of that right in rem, imposed by ordinary legislation and modified by special legislation to respond to the needs of each historical period. The differing structure and function of property, according to its nature, leads to recognition of different types of property: civil, urban, agrarian, forest, condominium, intellectual, and so forth.Reference is likewise made to civil, agrarian, forest, or ecological possession and adverse possession. Similarly, there are civil, water, and agrarian easements (servidumbres), and, more recently, ecological easements. In every case, the Constitution guarantees the protection of such rights in rem, not only to provide legal certainty (seguridad jurídica) to their holders but also to require fulfillment of the economic, social, and environmental function for which they were conceived. The Constitution also affords particular protection to all productive assets that form part of the State’s agricultural property and public domain (dominio público) and that may at some point serve the common good....2....From the texts cited above, it may be stated that, like the other fundamental rights enshrined in the Constitución Política, the right to property is not absolute, and the inviolability recognized by constitutional Article 45 cannot be read with the strictness attributed to it during the era of economic liberalism, when an individualistic notion of property was defended.On the contrary, private property may now be limited in various ways consistent with Constitutional Law. These new conceptions gave rise to advocacy for the social function of property (función social de la propiedad), which, while allowing the owner to exercise a series of prerogatives over it, also recognizes the social purposes it is called upon to fulfill when the State so requires in order to carry out public-utility projects for the benefit of the community. ...*
  2. 3ON THE AGRICULTURAL PROPERTY REGIME (RÉGIMEN DE LA PROPIEDAD AGRARIA). The Código Fiscal of 1885, the Ley de Terrenos Baldíos (No. 13 of January 10, 1939, repealed by the Ley de Tierras y Colonización No. 2825), the Ley de Informaciones Posesorias, and the Ley de Tierras y Colonización were the first laws to regulate the rational use of natural resources (recursos naturales) in order to conserve them. But they also encouraged the occupation, titling, and destruction of forests. During the second half of this century, interest in the production and exploitation of land prevailed, justified by the imposition of the economic and social function (función económica y social) of agricultural property (propiedad agraria). Indeed, Costa Rican agricultural-law scholarship had already embraced an agricultural culture that sought to put land into production so that it would fulfill its economic purpose: “(...) The land multiplied its fertility with the aid of mechanization and technology, which entails the increasing use of certain movable property (...).But while land shares its importance with movable agricultural capital, thereby losing its primacy, it has acquired new significance as the site of the assets constituting the agricultural and livestock operation (explotación agropecuaria) (...). Such assets are considered agricultural property in their economic aspect, as instruments or means of agricultural and livestock production, and in their social aspect, relating to their control and the distribution of their benefits (...). Agricultural property is characterized by the individual and social requirement that it necessarily be devoted to production in order to preserve the quality and productive capacity of the property. The social requirement of production is more evident in the rules authorizing the expropriation of agricultural assets that are not used in the operation or are used inefficiently, and in those prohibiting or limiting indirect forms of tenure and exploitation (...)” (BARAHONA ISRAEL, Rodrigo.Derecho Agrario, San José, Universidad de Costa Rica, 2nd edition, 1982, pages 228-229). The Ley de Terrenos Baldíos itself permitted private individuals to acquire land up to a maximum of 30 hectares. Except in that case, it was prohibited to fence off State-owned vacant lands (terrenos baldíos), clear woodland, erect buildings or establish crops on them, or extract firewood, timber, or other products. This made evident our legislature’s intent to conserve forest resources (recursos forestales). The Ley de Tierras y Colonización of 1961 regulated the economic and social function of property, giving it greater precedence than its environmental function (función ambiental). This reflected a cultural imperative not only to guarantee genuine “access” to property through the intervention of the Instituto de Tierras y Colonización, but also to require that productive assets fulfill their economic purpose (among others, Articles 1, 2, and 5).National legal scholarship stated that “Thus, since the enactment of the Ley de Tierras y Colonización, the occupation of State land has been unlawful. Occupations begun before it entered into force, however, are lawful within the limits and under the conditions established by the Ley General de Terrenos Baldíos or any other laws in force when the occupation began, and they may serve as the basis for acquisitive prescription (prescripción positiva)” (Barahona, ibid., p. 231). Thus, together with the economic and social function, the Ley de Tierras y Colonización enacted a series of provisions intended to conserve natural resources (Articles 1 and 68). In particular, it provided that lands on which no regime had been established for the conservation and proper use of the nation’s existing renewable natural-resource reserves (reservas de recursos naturales renovables) were failing to fulfill the social function of property (función social de la propiedad) (Ley de Tierras y Colonización, Article 153, subsection 4).Nevertheless, its excessive application, due to its inherent culture regarding the economic and social function, led to the abusive exercise of property rights (ejercicio abusivo del derecho de propiedad). Accordingly, it was also observed that “The unlawful appropriation of land in national reserves by private individuals takes on alarming proportions when carried out by owners of large estates for the purpose of expanding their acreage, and even more so when the objective pursued is limited to accumulating land without cultivating it” ([Nombre13], op. cit., p. 235). The legislature imposed on property, particularly agricultural property, a series of limitations aimed at fulfilling its economic and social function. The Ley de Tierras y Colonización expressly refers to both functions (Ley de Tierras y Colonización, Articles 6, 21 subsection 1, 58, 142, 144, and 150). On the one hand, it imposes on the State the obligation to provide persons who lack land or possess insufficient land with sufficient acreage for their individual and social development (Article 2).It also establishes the obligation to put the land into production, since failure to fulfill that economic and productive function (función económico productiva) could eventually result in its expropriation if it is uncultivated, abandoned, indirectly exploited, or insufficiently cultivated. It also penalizes the economically inefficient use of land suitable for agriculture when devoted to livestock farming (Article 144). Beneficiaries of the Instituto de Desarrollo Agrario are required, as one of their obligations, to conserve renewable natural resources (recursos naturales renovables), because failure to comply with these provisions may result in revocation of the parcel allotment. *

....Since 1990, this Tribunal Constitucional has more clearly recognized the dynamic nature of property rights and the possibility of imposing, within their structure—the set of rights and obligations of the owner—limitations in the social interest, in order to prevent the antisocial or abusive exercise of a right that is not unlimited. Within that context, it implicitly recognizes the existence of special forms of property, with distinct characteristics depending on the nature of the asset in question and its specific function: “The owner’s authority over property is determined by the function that the property fulfills. The object of property rights has undergone significant transformations. Today, protection is afforded not only to the rights of owners, but also to various general or social interests that coexist with them. Objective law (derecho objetivo) defines the scope of subjective rights (derechos subjetivos).

Each object of rights entails a particular form of appropriation. Thus, for example, the powers of ownership (facultades del dominio) relating to an agricultural tract are very different from those pertaining to property located in an intensively used urban area.” According to the Sala Constitucional, such limitations must be reasonable and must not deprive the right of its substance, since that would amount to a total deprivation of the right (Sala Constitucional, No. 5097-93 at 10:24 a.m. on October 15, 1993).- Judgment of the Sala Constitucional, No. 2012-16629.-*

VI. THE ACTION FOR RECOVERY OF OWNERSHIP AND THE PUBLICIAN ACTION

“The action for recovery of ownership (acción reivindicatoria) is an action in rem, with effects erga* omnes, whose essential purpose is the restitution of movable or immovable property to its lawful owner after being dispossessed of it by a third party who possesses it unlawfully. It is the quintessential ‘actio in re.’ Through this action, the owner exercises the ‘ius* possidendi’ inherent in the right of ownership. The most specialized legal scholarship on this subject attributes the following characteristics to this action: a) It is in rem: That is, it may be brought against anyone possessing the property without legal right; b) It is an action for recovery or restitution: Its basic objective is to obtain physical possession of the property; c) It seeks an order for relief: a judgment in favor of the plaintiff will impose specific conduct upon the defendant. The action for recovery of ownership constitutes the strongest procedural remedy against the most serious infringement an owner may suffer, namely dispossession of the property belonging to that owner.- (See [Nombre14], Roberto, ‘La acción reinvidicatoria,’ in Derecho Agrario Costarricense, San José, Costa Rica, Ilanud, 1992, page 69). There are three prerequisites for the validity of the action for recovery of ownership:

  • 1)Standing to sue (legitimación activa), under which the claimant must have the status of owner, it being specified that the owner must hold title;
  • 2)standing to be sued (legitimación pasiva), under which the possessor, or defendant, must perform possessory acts as an unlawful possessor; and
  • 3)identity of the property, as between the property claimed by the owner and that unlawfully possessed by the defendant or possessor.” (First Chamber of the Court, No. 230, at sixteen hours on the twentieth day of July, nineteen ninety). The ordinary action based on a superior right of possession (acción ordinaria de mejor derecho de posesión), or “Publician action” (publiciana), is also recognized as an action for restitution, as follows: “A fourth effect of original possession consists of the exercise of the plenary action for possession (acción plenaria de posesión), or Publician action. That action may not be brought by a derivative possessor. This action is available to an acquirer with color of title (justo título) and in good faith; its purpose is to secure restitution of definitive possession of movable or immovable property. This action may be brought against a possessor without title, a possessor in bad faith, and one who has title and good faith but whose possession is less longstanding than that of the plaintiff.” (See ROGINA VILLEGAS* (Rafael*), Derecho Civil Mexicano, Volume III, Mexico, Editorial Porrúa S.A., 1981, fifth edition, pages 691–692). “The Publician action owes its name to the praetor [Nombre15] and is of distinctly Romanist origin. We know that, under ancient Roman law, Quiritary ownership was acquired through mancipatio or in iure* censumo, as well as through Usucapio in the absence of the former two. A sale followed by delivery did not confer ownership of the property sold, since the purchaser acquired the property only in bonia; that is, mere possession thereof, which became ownership through acquisitive prescription (usucapión). But while the prescriptive period was running, if the seller claimed the property sold by means of the reivindicatio, the purchaser could raise the exceptio* rei* venditae or traditae. Through this defense of property sold and delivered, the purchaser defended against the former owner of the property; and to defend against a third party seeking to dispossess the purchaser or disturb the purchaser’s ownership, the purchaser had possessory interdicts for retention and recovery (interdictos de retener y recobrar). But if the possessor was dispossessed, the possessor could not bring the action for recovery of ownership unless the period required for acquisitive prescription had elapsed, and in such a case was entirely defenseless. To remedy this anomaly, the praetor [Nombre15] created the action bearing his name, the Publician action, giving it the character of a reinvidicatio* utilis, a fictitious action—fictas actio—through which the praetor created the fiction that the possessor had completed the period required for acquisitive prescription and claimed the property as its owner. When Roman law eliminated the distinction between Quiritary and Bonitary ownership, delivery became the normal method of acquiring rights in rem; if such delivery came from the lawful owner, it transferred ownership and, with it, the action for recovery of ownership; otherwise, it transferred only possession capable of ripening into ownership through acquisitive prescription. This distinction is important because, in order to litigate over property, its owner had to prove that the tradens was the lawful owner thereof and had therefore transferred lawful ownership, rather than possession. The difficulty of presenting such proof at trial led all owners to resort to the Publician action instead of bringing the action for recovery of ownership, particularly because the Publician action, being a fictitious action, did not carry the finality of res judicata (cosa juzgada) and always left the action for recovery of ownership available.- This resulted in the requirement that, to bring the Publician action, the possessor must have color of title, that is, a lawful basis for possessing the property.” (José* Gomez and Luis Muñoz, Elementos de Derecho Civil Mexicano, Vol. II, pages 352 to 354, cited by ROJINA VILLEGAS, op. cit., pages 691 and 692). “It is well known that the Publician action was granted under Roman law to afford protection in rem to a possessor in good faith whose possession was capable of ripening into ownership through acquisitive prescription, as against those who disturbed that possession. Through it, the property had been received under an instrument that was not legally sufficient under Quiritary law to transfer ownership. Moreover, it was also granted to an acquirer who derived title from a non-owner when disturbed by a third party having no title whatsoever. Under our law, the question of whether the Publician action continues to exist involves two fundamental issues: the first is determining whether a possessor under a claim of ownership, whose possession is capable of ripening into ownership through acquisitive prescription, although strictly speaking still a non dominus, may seek relief against dispossession by a third party having no title whatsoever beyond the time limit and other specific conditions governing the interdict for recovery (interdicto de recobrar), which is subject to a one-year limitation period. Furthermore, recognition of the Publician action would resolve the issue of a conflict between two possessory titles, one of which is stronger than the other. (See MONTES, Vicente L., La propiedad privada en el Sistema de Derecho Civil Contemporáneo, Madrid, Editorial Civitas S.A., 1980, first edition, pages 294 and 295). From all the foregoing, it may therefore be stated that ‘Ultimately, in both the action for recovery of ownership and the Publician action, the plaintiff is not the current possessor, and in both cases seeks to recover possession as a consequence of the plaintiff’s right; and, in the second case, because the current possessor has the inferior position.... Thus, in my opinion, the Publician action could be recognized as an action in rem for recovery available to a possessor ad usucapionem....’ (See MONTES, op. cit., page 295 et seq.). With respect to the Publician action, which is the one relevant here, the case law has established the following: ‘III. The action based on a superior right of possession, originating in the Roman-law remedy known as the “Publician action,” is based in our legal system on Articles 317, 318, 319, and 322, as well as Sections 277 through 286 of the Civil Code, and is intended to protect the lawful possessor against the unlawful possessor so that the lawful possessor may obtain restitution of the possession of which that possessor has been improperly deprived, or so that the possessor’s preferential right over a prior possessor may be declared.’ In other words, it follows that our case law regards the Publician action as having effects of recovery, although it may also have declaratory effects. Nevertheless, in our view, these are two different actions because, as stated above, the historical nature of the Publician action is fundamentally that of an action in rem concerning possession, whose effects are restitutory. Indeed, our Civil Code, in Book II, Title I, ‘On Ownership,’ Chapter VI, governs ‘Rights to Restitution and Compensation,’ the chapter in which the Publician action was included and Article 322 of which provides: ‘The ordinary action concerning the right of possession may be brought against anyone claiming to have a superior right to possess.’ And if it was included in that chapter, it is because it is indeed an action intended to secure restitution of possession.- In the present case, the plaintiff brings a typical Publician action.-*

VII.In the opinion of this Tribunal, the evidence submitted in these ordinary proceedings was properly assessed by the trial judge, in accordance with Article 54 of the Ley de Jurisdicción Agraria, who stated the factual, legal, and equitable grounds for dismissing the ordinary claim asserting a superior right of possession (mejor derecho de posesión). In any event, regarding the first ground of appeal, the appellant is incorrect in alleging that the judgment lacked supporting grounds or that proven facts 1 and 2 may contradict the remaining evidence introduced into the proceedings. It is one thing for the plaintiff to have purportedly acquired a right of possession by virtue of a gift from his father, and quite another for him to have actually and effectively exercised agricultural possession (posesión agraria), which the plaintiff has not proven. In contrast, the defendants have proven that both Luiyi del Sur LDS S.A. and [Nombre3] Sociedad Anónima have maintained a productive agricultural activity consisting of maintaining pastures and conducting livestock operations, treating the property as a single productive unit.

In addition, the defendants proved that they are the legitimate registered owners of the disputed property, since, according to the evidence admitted by the court on its own motion (prueba para mejor proveer), the land in question corresponds to public deed 73-1, executed at 19 hours on 19 de abril del 2005 before Notary Greivin Jiménez Méndez, by virtue of which [Nombre1] sold Luiyi del Sur LDS Sociedad Anónima the property registered under number CED8, consisting of land used for pasture, agriculture, woodland, and a house, as well as an unregistered property measuring approximately diez manzanas of pastureland, which he also sold to that company. Since then, both Luiyi del Sur LDS Sociedad Anónima and [Nombre3] Sociedad Anónima have exercised possession as owners, treating the property as a single productive unit. Therefore, it is not true that the judgment lacks supporting grounds, since these elements readily support the conclusion that the plaintiff lacks standing to sue (legitimación activa), having failed to prove the legitimate exercise of agricultural possession for more than one year (lack of a legal right and lack of a current interest).

Moreover, there is a lack of standing to be sued (legitimación pasiva), because the plaintiffs not only hold legitimate title to ownership and agricultural possession but have also proven the continuous exercise of agricultural possessory acts (actos posesorios agrarios), at least since 2005, thereby fulfilling the social function of property and agricultural possession (Articles 45 of the Constitución Política and 1 and 4 of the Ley de Tierras y Colonización). Furthermore, regarding the alleged improper assessment of the evidence, this Tribunal finds that the appellant is likewise incorrect, because the court below conducted a comprehensive review of the evidence submitted by both parties, and the evidence submitted by the plaintiff, [Nombre1] , was insufficient to establish the essential requirements of an action asserting a superior right of possession. Merely presenting a document transferring possessory rights was insufficient; it was necessary to prove the exercise of agricultural activity.

It should be noted that it was found unproven that the plaintiff had performed any agricultural acts of exploitation during the preceding ten years (the first fact found unproven), which decidedly weighs against the plaintiff, since he lacks standing to sue. The testimony of [Nombre9] (audio dated 16/12/15, minutes 31 et seq.) is insufficient because the witness had not visited the property for 10 years and, before then, had visited it only sporadically; the witness had no personal knowledge of whether the plaintiff conducted any agricultural or livestock activity. Conversely, the witnesses [Nombre16] , [Nombre7] and [Nombre10] concur in their testimony regarding the exercise of agricultural possession by Luiyi del Sur LDS Sociedad Anónima and subsequently by [Nombre3] Sociedad Anónima (in accordance with the evidence deemed established in fact 8). It should be noted that [Nombre7] ’s company was the entity that commenced the property’s productive development by clearing the land and repairing fences for the conduct of agricultural and livestock activities on the disputed land, which formed a single productive unit with the registered property.

It follows from the foregoing that, regardless of whether or not the property is registered, it is the defendants who have proven that their possessory title coincides with their exercise of productive agricultural activity (livestock farming) for more than ten years. For that reason, the defendant cannot be deemed an unlawful possessor (poseedora ilegítima). It should be recalled that, under Costa Rican law, specifically Article 279 of the Código Civil, the right of possession is acquired independently of the right of ownership: 1°.- By consent of the owner, and 2° By maintaining possession for more than one year. Both circumstances are present in this case. It is also important to recall that good faith is presumed under our legal system (Articles 284-286 of the Código Civil). Accordingly, the possession exercised by the defendants is deemed legitimate, in the capacity of owners and in good faith. *

VII.It follows from all the foregoing that the appellant is incorrect in asserting that the evidence was not properly assessed or that the judgment is contradictory. The appealed judgment must therefore be affirmed in all respects.*

Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos.-* * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * RESULTANDO: * * * * * * * * * * * * * 1.- La parte actora interpuso la presente demanda estimada en la suma de seis millones de colones, solicitando que se declare en sentencia lo siguiente: "Solicito que en sentencia se declare que el suscrito tiene un mejor derecho de posesión sobre un terreno que se localiza en [Dirección1] , , , San Carlos, de la Provincia de Alajuela. Se describe en el plano catastrado NO.A-1556019-2012 de fecha 23 de febrero 2012, con una medida de SEIS HECTÁREAS UN MIL CUATROCIENTOS VEINTICUATRO METROS CUADRADOS. Colinda al norte con: Ganadera Linda Vista Sociedad Anónima y Quebrada sin nombre, al sur con Los demandados y [Nombre4] , al este con: [Nombre5] y al oeste con: Los accionados El inmueble es terreno dedicado a agriculturas y repasto para la ganadería. 2- Que los accionados no tienen mejor derecho, ni mejor derecho de posesión sobre el inmueble de la litis que el suscrito, quienes además no pueden ser considerados poseedores de buena fe, ya que siempre han sido conocedores que el terreno no les pertenece. 3- Que se debe ordenar a los codemandados me restituyan en la posesión del inmueble que se apropiaron indebidamente, cuya cabida esta determinada en plano catastrado NO. A-1556019-2012 de fecha 23 de febrero 2012, con una medida de SEIS HECTÁREAS UN MIL CUATROCIENTOS VEINTICUATRO METROS CUADRADOS y se describe en le hecho segundo de esta acción. 4- Que en caso que el terreno en litis forme parte de alguno de los planos y titulo de los terrenos de los codemandados, se ordene corregir la cabida de los mismos, dejando fuera el área que me pertenece por derecho y se anule dicho plano y el titulo que genero. 5- Consecuentemente, se deberá corregir la cabida de terreno en la registración ante el Registro Nacional de la Propiedad del sistema de folio real de la finca de la codemandada, a saber la número CED7, o bien cualquier otra que tenga inscrita el área de terreno que es objeto de este litigio, y que será el área que el perito nombrado al efecto determine. 6- Se declare que a los codemandados, nunca se les vendió el área aquí objeto de contienda, cuando compraron la finca que hoy día tienen registrada su nombre [Nombre3] S.A., bajo el número CED7. 7- Se le condene a los codemandados en caso de oposición a esta acción a pagar las costas de este proceso." (Ver imágenes 17 a 23).-* El Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, en resolución de las catorce horas del veintiuno de mayo de dos mil doce, previene a la parte actora definir las pretensiones en cuanto al Instituto de Desarrollo Rural.

(Ver imagen 25).- Así mismo, el actor hace cumplimiento de la prevención e los términos visibles a imágenes 28 y 29; y solicita: "En cuanto a las pretensiones contra la coaccionada IDA: I- Que dicho terreno es parte de la Reserva Chambacú y que ese lote se quedó sin titular por que le pertenece al actor. II- Que la codemandada IDA conoce que esa área de la litis la poseyó primeramente el padre del actor, señor [Nombre6] y luego el actor [Nombre1] . III- Que esa área objeto del litigio no forma parte del terreno que el IDA le titulo a la codemandada [Nombre3] Sociedad Anónima."   • 1)Se acepta como prueba para mejor resolver la escritura pública aporta a los autos el día ocho de enero del año en curso, correspondiente al contrato de compra-venta celebrado en fecha ocho de octubre del dos mil diez, en que la empresa Luiyi del Sur S.A vende la finca matrícula número ciento ochenta y siete mil setecientos nueve - cero cero* cero, a la codemandada [Nombre3] Sociedad Anónima.
  • 2)Se rechazan las excepciones de prescripción y sine actine* agit y se acogen las excepciones de falta de derecho, falta de legitimación activa y falta de legitimación pasiva, opuestas por los demandados.
  • 2)Se declara sin lugar en todos los extremos peticionados, la demandada ordinaria agraria incoada por [Nombre1] CONTRA [Nombre3]* S.A, [Nombre2] y el Instituto de Desarrollo Rural.
  • 3)Se condena al actor al pago de las costas procesal y personales en que han incurrido los codemandados; fijándose las costas personales en un quince por ciento de la estimación de la demanda, al ser patrocinado por la defensa pública agraria.-" (Ver escritorio virtual del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, documento asociado en fecha 28/07/2016 08:50:14 a.m. y 30/08/2016 10:42:28 a.m. corrección de error material en la fecha).-* * * * * * * * * * * * * 4.- El licenciado Ignacio Rodríguez Sancho, en autos conocido como el Defensor Público Agrario de la parte actora,* interpuso recurso de apelación con indicación expresa de las razones en que se apoyaron para refutar la tesis del juzgado de instancia, (Ver escritorio virtual del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, documento asociado en fecha 05/08/2016 06:41:33 p.m.).-* * * * * * * * * * * * * 5.- En la substanciación del proceso se han observado las prescripciones legales, y no se observa la existencia de errores u omisiones capaces de producir la nulidad del fallo.-* Redacta el Juez Ulate Chacón, y, * CONSIDERANDO:*

I. HECHOS PROBADOS

El Tribunal comparte la relación de hechos probados, al tener buen sustento en los autos.*

II. HECHOS NO PROBADOS

De igual modo, se prohija lo dispuesto en cuanto a hechos indemostrados.*

III.El defensor público agrario de la parte actora apeló el fallo aduciendo: 1.- Falta de fundamentación, pues considera que el fallo es contradictorio, dado que en el hecho 1) reconoce que al actor le donaron en escritura pública un terreno, el 25 de setiembre de 1979, parte de una finca sin inscribir; y que el plano A-1556019-2012 del 23 de febrero del 2012, identifica el área reclamada, por lo que se supone que él demostraría que le asiste derecho de posesión, pues no está inscrito y corresponde al Programa de Titulación de Chambacú. Así lo dice el documento que le dejó [Nombre6] ; por otro, señala, el documento admitido como prueba para mejor proveer, que fue la escritura presentada por el testigo [Nombre7] , del 8 de octubre del 2010 se refiere a la finca matrícula número CED8, no tiene nada que ver con este juicio, porque el área que reclama no tiene título, ni ha generado escritura. Se cuestiona porqué los demandados se tardaron en presentar la escritura de la finca y fue el testigo quien la aportó; a su juicio faltó hacer una mejor valoración de la prueba documental en relación a la pericial y a la aportada por INDER, en cuanto a la Zona de Titulación de Reserva Chambacú.

Considera que el actor cumplió con el numeral 317 del Código Procesal Civil, pues poseyó el terreno y vivió en la finca por muchos años hasta que salió y que la codemandenada* [Nombre3] S.A. ha desplegado una posesión de mala fe. 2.) Mala valoración probatoria:* En primer término, considera que conforme al artículo 317 del CPC, a través de su testigo [Nombre8] . [Nombre1] logra demostrar su posesión, pues relación como adquirió de su padre; también relató que su madre [Nombre1] poseyó solamente el área que vendió a Luiyi del Sur LDS S.A. pero que nunca poseyó a su nombre el área en litis, sola la registrada a su nombre. Aduce que los testigos [Nombre7] , [Nombre9] y [Nombre10] son complacientes y no aportan a la teoría del caso de la demandada, en cuanto a la posesión, demostrándose que son ocupantes ilegales; conocía, señala que el área de terreno no era parte de la finca registrada al Folio Real 187.709-000.

Considera que de la escritura del 145-10-2010 no se desprende que [Nombre7] le vendiera esa otra área a [Nombre3] S.A., misma que le compró a [Nombre1] , a quien, afirma, no llevaron al juicio por conveniencia. No es cierto que el actor no lograra demostrar la ubicación del terreno. El documento en el que se amparan los codemandados, además, es una simple fotocopia, y se introdujo de manera ilegal, además, cómo iba a vender un terreno que no era de ella. Por lo anterior, solicita se declare ilegal la posesión de los demandados, y al demostrarse los presupuestos de fondo, se revoque el fallo, dado que el inmueble está identificado con el Plano catastrado del 2012, y ostenta legitimación activa conforme a la escritura pública aportada.*

IV.Todos los agravios planteados por el recurrente están relacionados con la fundamentación y la valoración de la prueba. En materia agraria rige el principio de libre valoración de la prueba. Al respecto, el Tribunal ha indicado: “VI. …La apreciación o valoración probatoria consiste en la actividad de selección que debe realizar el juez, entre las fuentes de prueba obtenidas, a fin de establecer cuáles de ellas son las eficaces para resolver el conflicto sometido a su conocimiento. Dicha selección le permite decidirse por una de las tesis divergentes presentadas por cada parte de la relación procesal. Dicha actividad requiere de varios pasos intelectivos básicos, que ha señalado la doctrina: En la actividad probatoria encontramos siempre tres aspectos básicos que son la percepción, la representación o reconstrucción y el razonamiento deductivo o inductivo. El conocimiento de un hecho por parte del juez no se puede obtener sin que él mismo perciba algo con los propios sentidos y para ello, tal como lo afirma [Nombre11], es inevitable el contacto entre el juez y la realidad acerca de la cual se debe juzgar.

El contacto del juez con la observación de los hechos puede hacerse de una forma directa o de un modo indirecto a través de la relación que hacen otras personas de algunas cosas o documentos. Se trata siempre de una operación sensorial, sin la cual sería imposible apreciar el contenido y la fuerza de convicción de una prueba. Una vez percibidos aisladamente los hechos, debe procederse a su reconstrucción histórica, y ésta no puede ser hecha en forma aislada, ya que se requiere que se efectúe en su conjunto y con el cuidado necesario para que no se admitan hechos que alteren la realidad o la hagan cambiar de significado. Son también válidas para la apreciación, las reglas generales de la experiencia…. La percepción de los medios, las condiciones y el lugar en el cual se desarrollaron los hechos, le va a permitir luego desarrollar una labor interpretativa. En efecto, una vez que el juez ha percibido los medios de prueba, debe realizar una interpretación de los datos probatorios para darles significado jurídico.

En tercer lugar, es necesario que el Juez establezca el grado de eficacia que merezca cada medio de prueba, tanto desde el punto de vista formal (en cuanto a la existencia del medio de prueba en la ley y si se ha producido debidamente) como material (la sinceridad o veracidad de la fuente, para determinar si el testigo no miente, o si el documento ha sido o no alterado). Un cuarto paso consistiría, en verificar si el Juez tiene alguna vinculación legal con algún tipo de prueba (en el sistema de prueba legal o tasada). Ello no se aplicaría cuando el Juez puede apreciar libremente la prueba, como es el caso de la materia agraria. Finalmente, el Juez debe lograr una reconstrucción de los hechos discutidos, tal y como a su criterio fueron sucediendo, tomando y depurando todas las fuentes de prueba, en su conjunto. Se trata de apreciar en conjunto la prueba, de lo cual se deriva el deber de motivación de la sentencia. *

El Juez agrario entra en contacto con los hechos mediante la percepción u observación “in situ”, directa e inmediata. La convicción del juez agrario es un acto psicológico aplicado a una situación concreta, viva, propia de la realidad agraria. El Juez Agrario debe examinar la credibilidad de lo que dice un testigo, o de una parte, para justipreciar su valor. Pero también debe analizar la experiencia social, el medio -mundo agrario- en donde se desenvuelve el conflicto, e incluso la cultura y el comportamiento del campesino. Por ello debe tenerse en cuenta, por un lado la autenticidad y sinceridad de cada prueba cuando se trate de documentos, confesiones y testimonios; por otro lado, determinar su exactitud y credibilidad. Con ello se garantizan los principios de lealtad y probidad en el resultado del elemento probatorio. Las partes dentro del proceso tienen derecho a conocer todos los factores relevantes que han contribuido a la formación del fallo. Los motivos y fundamentación del fallo son los que permiten el control en la vía jerárquica superior Es decir, el juez agrario se asocia una situación particular (del caso concreto), con situaciones semejantes de la realidad que el juez con su experiencia logra conocer (Tribunal Agrario, No. 206 de las 14:50 horas del 26 de marzo de 1999). *

V.Con el fin de resolver los agravios del apelante, siendo este proceso ordinario agrario, denominado de "mejor derecho de posesión", este Tribunal procederá a realizar algunas consideraciones sobre los derechos reales agrarios, en particular, sobre la propiedad agraria y el mejor derecho de posesión, la Sala Constitucional refiriéndose al tema de la función y la estructura de los derechos reales indicó lo siguiente: IV.-SOBRE EL DERECHO DE PROPIEDAD.* El artículo 45 de la Constitución Política consagra el derecho de propiedad, y lo hace de la siguiente manera: "La propiedad es inviolable; a nadie puede privarse de la suya si no es por interés público legalmente comprobado, previa indemnización conforme a la ley. En caso de guerra o conmoción interior, no es indispensable que la indemnización sea previa. Sin embargo, el pago correspondiente se hará a más tardar dos años después de concluido el estado de emergencia. *

Por motivos de necesidad pública podrá la Asamblea Legislativa, mediante el voto de los dos tercios de la totalidad de sus miembros, imponer a la propiedad limitaciones de interés social"*

  1. 1LAS PROPIEDADES, SU FUNCIÓN Y ESTRUCTURA ES OBRA DEL LEGISLADOR. En una interpretación amplia del texto base para resolver la consulta judicial planteada, y para determinar si se debe aplicar o no un criterio de propiedad privada (adquirida por usucapión e inscrita en el Registro Público mediante Información Posesoria), o un criterio de propiedad agraria pública (reservada al Estado), es necesario recordar lo indicado por esta Sala, en cuanto a los diferentes regímenes de propiedades que abarca dicha norma: “Por tales razones, se incluyen, dentro del criterio de propiedad del referido numeral 45, en relación con el 50, ambos constitucionales, la propiedad forestal, la propiedad agraria, la propiedad ecológica, la propiedad ambiental, etc., todas con asidero constitucional en los citados artículos y con una específica regulación y naturaleza jurídicas...” [Nombre12]( ., No. 5893-95 de 9:48 horas del 27 de octubre de 1995).La inteligencia de dicha interpretación normativa debe ser profundizada. El tratamiento de la protección de los derechos reales, en materia civil y agraria, tienen una gran importancia en todos los ordenamientos jurídicos que han consolidado una base constitucional arraigada en la protección de los derechos humanos fundamentales: junto a los derechos de libertad económica, entre los cuales se encuentra la propiedad privada y demás derechos reales derivados, también se han consagrado derechos-deberes económicos, sociales y ambientales. La propiedad privada y la libertad económica, encuentran protección constitucional en los artículos 45 y 46 de nuestra Carta Magna y, aunque parece obvio, su existencia y defensa obedecen a la permanencia de un Estado Social de Derecho, basado en principios y valores constitucionales, en los cuales se consagran no solo derechos a favor de los particulares, sino también deberes, con miras a alcanzar un desarrollo económico, con equidad, solidaridad y justicia social.En consecuencia, si las normas y principios constitucionales de los derechos reales, tanto en materia civil, como agraria, son comunes, no es posible escindir, completamente, las dos materias del Derecho de la Constitución, con mayor razón, tratándose del tema de la expropiación con fines de utilidad pública. La función y la estructura de los derechos reales son comunes en ambas materias, pero su contenido es diverso. La función es la utilidad económica o social para el cual fue diseñado un derecho real particular, y la misma dependerá de la naturaleza (civil, agraria, ecológica, ambiental) del bien sobre el cual recae tal derecho. La estructura, se refiere al conjunto de derechos y obligaciones del titular de ese derecho real, impuestos por la legislación ordinaria, y modificados por la legislación especial, para responder a las necesidades de cada momento histórico. La diversa estructura y función de los bienes, de acuerdo a su naturaleza, conduce a hablar de diversos tipos de propiedad: la civil, la urbana, la agraria, la forestal, la horizontal, la intelectual, y así sucesivamente.También se habla de posesión y usucapión civil, agraria, forestal o ecológica. Igualmente, de servidumbres civiles, de aguas, agrarias, y más recientemente de servidumbres ecológicas. En cualquier caso, la Constitución es garante de la protección de tales derechos reales, para brindar no solamente seguridad jurídica a sus titulares, sino también, para obligar el cumplimiento de la función económica, social y ambiental, para la cual fueron concebidos. Pero la Constitución también protege, con particular atención, todos los bienes productivos que forman parte de la Propiedad agrícola del Estado y su dominio público, y que en algún momento pueden ser de utilidad para el bien común....2....De los textos citados con anterioridad se puede afirmar que, al igual que el resto de derechos fundamentales consagrados en la Constitución Política, el derecho de propiedad no es absoluto y la inviolabilidad que reconoce el numeral 45 constitucional no puede leerse con la rigurosidad con que se entendía en la época del liberalismo económico, cuando se defendía una noción individualista de la propiedad.Por el contrario, actualmente la propiedad privada puede ser limitada de diversas maneras que van en consonancia con el Derecho de la Constitución. A partir de estas nuevas concepciones fue que se comenzó a propugnar por la función social de la propiedad, la cual además de permitirle al propietario ejercer una serie de prerrogativas sobre esta, no se olvida de los fines sociales que también está llamada a cumplir cuando el Estado así lo requiera para alcanzar proyectos de utilidad pública a favor de la colectividad. ...*
  2. 3SOBRE EL RÉGIMEN DE LA PROPIEDAD AGRARIA. El Código Fiscal, de 1885, la Ley de Terrenos Baldíos (No. 13 del 10 de enero de 1939, derogada por la Ley de Tierras y Colonización No. 2825), la Ley de Informaciones Posesorias y la Ley de Tierras y Colonización, fueron las primeras normativas en ocuparse de una regulación en el uso racional de los recursos naturales, para conservarlos. Pero también propiciaron la ocupación, titulación y destrucción de los bosques. En la segunda mitad de este siglo, prevalecieron el interés en la producción y la explotación de la tierra, lo cual venía justificado por la imposición de la función económica y social de la propiedad agraria. En efecto, la doctrina agraria costarricense ya se había manifestado por una cultura agraria tendiente a poner a producir la tierra para cumplir con su destino económico: “(...) La tierra multiplicó su feracidad con el auxilio de la mecanización y la técnica, que supone el uso creciente de ciertos bienes muebles (...).Pero si la tierra comparte su importancia con el capital mueble agrario, perdiendo su primacía, ha adquirido un nuevo relieve como asiento de los bienes que constituyen la explotación agropecuaria (...). Dichos bienes son considerados propiedad agraria en su aspecto económico, en cuanto a instrumentos o medios de producción agropecuaria, y en su aspecto social, relativo a su control y a la distribución de sus beneficios (...). La propiedad agraria, se caracteriza por la exigencia individual y social de la necesaria destinación a la producción, para preservar la calidad y la capacidad productiva del bien. La exigencia social de la producción se hace más obvia en las normas que autorizan la expropiación de los bienes agrarios no utilizados en la explotación o empleados deficientemente y en las que vedan o limitan las formas indirectas de tenencia y explotación (...)” (BARAHONA ISRAEL, Rodrigo.Derecho Agrario, San José, Universidad de Costa Rica, 2ª edición, 1982, página 228-229). La misma Ley de Terrenos Baldíos permitió la adquisición de tierras por particulares, hasta un máximo de 30 hectáreas. Quedó prohibido, salvo ese caso, cerrar con cercas los terrenos baldíos propiedad del Estado, derribar montes o establecer en ellos construcciones o cultivos o extraer leña, madera u otros productos. Con ello era evidente la intención de nuestro legislador de conservar los recursos forestales. La Ley de Tierras y Colonización de 1961, reguló la función económica y social de la propiedad con mayor prevalencia que la ambiental. Ello era una exigencia cultural, en garantizar no solamente el “acceso” real a la propiedad, a través de la intervención del Instituto de Tierras y Colonización, sino también exigir que se cumpliera con el destino económico de los bienes productivos (entre otros, artículo 1, 2 y 5).La doctrina patria afirmó que “A partir pues, de la promulgación de la Ley de Tierras y Colonización es ilegal la ocupación de tierras del Estado. Pero las comenzadas antes de su vigencia son lícitas, dentro de los límites y condiciones establecidas por la Ley General de Terrenos Baldíos u otras cualesquiera vigentes al iniciarse la ocupación y sirven a los efectos de la prescripción positiva” (Barahona, ibid, p. 231). Fue así como en la Ley de Tierras y Colonización, junto a la función económica y social, se dictaron una serie de disposiciones tendientes a conservar los recursos naturales (artículo 1 y 68). En particular, se establecía que las tierras que no tuvieren implantado el régimen de conservación y uso adecuado de las reservas que en ellas existían de recursos naturales renovables de la nación estaban incumpliendo la función social de la propiedad (Ley de Tierras y Colonización, artículo 153 inciso 4).Sin embargo, su aplicación desmedida, por la cultura que le era inherente, en cuanto a la función económica y social, llevaron al ejercicio abusivo del derecho de propiedad. Por ello también se advierte que “La apropiación indebida de tierras en las reservas nacionales por particulares adquiere caracteres alarmantes cuando es realizada por propietarios de latifundios con el fin de aumentar su cabida y más aún si el propósito que se persigue se limita a acaparar tierras sin cultivarlas” ([Nombre13] , op. cit., p. 235). El legislador impuso a la propiedad, en particular a la propiedad agraria una serie de limitaciones dirigidas a cumplir su función económica y social. La Ley de Tierras y Colonización hace referencia expresa a ambas funciones (Ley de Tierras y Colonización, artículos 6, 21 inciso 1, 58, 142, 144, 150). Por un lado, le impone la obligación al Estado de dotar a personas carentes de tierras o que las poseen en forma insuficiente, dotarlos de terrenos suficientes para su desarrollo individual y social (artículo 2).También se establece la obligación de producir la tierra, pues el incumplimiento de esa función económico productiva implicaría eventualmente la expropiación de las mismas si se encuentran incultas, abandonadas, explotadas indirectamente, o insuficientemente cultivadas. Y castiga el ejercicio antieconómico de terrenos aptos para la agricultura destinados a la ganadería (artículo 144). Se les impone a los beneficiarios del Instituto de Desarrollo Agrario, como una de sus obligaciones, la conservación de los recursos naturales renovables, pues la falta a estas disposiciones puede implicar la revocatoria de la parcela. *

....Este Tribunal Constitucional, a partir del año 1990, reconoce más claramente el carácter dinámico del derecho de propiedad, y la posibilidad de imponer dentro de su estructura –conjunto de derechos y obligaciones del propietario- limitaciones de interés social, para evitar el ejercicio antisocial o abusivo de ese derecho que no es ilimitado. Dentro de dicho contexto reconoce, implícitamente, la existencia de propiedades especiales, con particularidades distintas atendiendo a la naturaleza del bien de que se trate, y su función específica: “El poder del propietario sobre la propiedad está determinado por la función que ésta cumpla. El objeto del derecho de propiedad ha sufrido transformaciones importantes. Actualmente, no sólo se tutela el derecho de los propietarios, sino también diversos intereses generales o sociales que coexisten con aquél. El derecho objetivo enmarca del contenido de los derechos subjetivos.

Cada objeto de derecho implica una peculiar forma de apropiación. Así por ejemplo las facultades del dominio relativas a un fundo agrícola son muy distintas de las correspondientes a una finca ubicada en el sector urbano de intensa utilización.” Dichas limitaciones, según la Sala Constitucional, deben ser razonables y no vaciar el contenido del derecho, pues pasaría a ser una privación total del mismo (Sala Constitucional, No. 5097-93 de las 10:24 horas del 15 de octubre de 1993).- Sentencia de la Sala Constitucional, No. 2012-16629.-*

VI. LA ACCION REIVINDICATORIA Y LA ACCIÓN PUBLICIANA

"La acción reivindicatoria es una acción de naturaleza real, con efectos erga* omnes, cuya finalidad esencial es la restitución de la cosa mueble o inmueble a su propietario legítimo, y de la cual ha sido despojado por un tercero quien la posee ilegítimamente. Es la "actio in re" por excelencia. Con esta acción el propietario ejercita el "ius* possidendi" ínsito en su derecho de dominio. La doctrina más especializada en esta materia atribuye a esta acción las siguientes características: a) De naturaleza real: O que puede ejercitarse contra cualquiera que posea la cosa sin derecho; b) En recuperatoria o restitutoria: Su objetivo básico es obtener la posesión material del bien; c) Es de condena: la sentencia favorable al actor impondrá un determinado comportamiento al demandado. La acción reivindicatoria constituye el más enérgico remedio procesal frente a la agresión más radical que puede sufrir el propietario y que es el despojo de la cosa que le pertenece.-( Ver [Nombre14] , Roberto, "La acción reinvidicatoria" En Derecho Agrario Costarricense, San José, Costa Rica, Ilanud, 1992, página 69).

Son tres los presupuestos de validez de la acción reivindicatoria: 1). Legitimación activa, según la cual el titular debe ostentar la calidad de propietario señalándose que el propietario debe ser el dueño; 2) legitimación pasiva; según la cual el poseedor, o demandado, debe ejercer sus actos posesorios como poseedor ilegítimo y 3) identidad de la cosa, entre el bien reclamado por el propietario y el poseído ilegítimamente por el demandado o poseedor." ( Sala Primera de la Corte, No 230 de las dieciséis horas del veinte de julio de mil novecientos noventa). La acción ordinaria de mejor derecho de posesión o "publiciana", también es reconocida como una acción restitutoria, veamos: " Un cuarto efecto de la posesión originaria consiste en el ejercicio de la acción plenaria de posesión o acción publiciana. Dicha acción no puede ejercitarse por un poseedor derivado. Esta acción compete al adquirente con justo título y buena fe; tiene por objeto que se le restituya en la posesión definitiva de una cosa mueble o inmueble.

Se da esta acción en contra del poseedor sin título, del poseedor de mala fe y del que tiene título y buena fe, pero una posesión menos antigua que la del actor." (Ver ROGINA VILLEGAS *( Rafael*), Derecho Civil Mexicano, Tomo III, México, Editorial Porrúa S.A. 1981, quinta edición, página 691-692) "La acción publiciana debe su nombre al pretor [Nombre15] y es de neta raigambre romanista. Sabemos que en el antiguo Derecho Romano la propiedad quiritaria se adquiría por mancipatio o por in iure* censumo así como por la Usucapio o falta de las dos anteriores. La venta seguida de tradición no confería el dominio de la cosa vendida, ya que el comprador solamente adquiría la cosa in bonia; es decir, su simple posesión, la cual devenía dominio por medio de la usucapión. Pero mientras transcurría el plazo prescriptivo si el vendedor demandaba por medio de la reivindicatio la cosa vendida el comprador oponía la exceptio* rei* venditae o traditae.

Con esta excepción de cosa vendida y entrega se defendía del antiguo dueño de la cosa; y para defenderse de tercera persona que quisiera despojarle o perturbarle en su propiedad, tenía los interdictos de retener y recobrar. Pero si el poseedor era despojado de su posesión no podía interponer la acción reivindicatoria si no había transcurrido el término para usucapir, y en tal caso se hallaba completamente indefenso. Para subvenir a esta anomalía, el pretor [Nombre15] creó la acción de su nombre, la publiciana, dándole carácter de reinvidicatio* utilis, acción ficticia -fictas actio- por medio de la cual el pretor fingía crear que el poseedor había cumplido el plazo de la usucapión y demandaba la cosa en calidad de dueño. Cuando se borró el derecho romano la distinción entre la propiedad quiritaria y la bonitaria, convirtiéndose la tradición en el modo normal de aquirir los derechos reales, dicha tradición si provenía de su dueño legítimo, transfería el dominio y con ella acción reivindicatoria; pero si no, sólo transmitía la posesión apta para usucapir.

Esta distinción es importante, ya que el dueño de una cosa para litigar sobre ella tenía que probar que el tradens era legítimo propietario de ella y por tanto le había transferido el dominio legítimo y no la posesión. La dificultad de aportar en juicio tal prueba, hizo que todos los propietarios recurrieran a la acción publiciana en vez de ejercitar la reivindicatoria; y más cuando la acción publiciana, por ser una acción ficticia, no lleva en sí la santidad de cosa juzgada y siempre dejaba libre la acción reivindicatoria.- Esto hizo que para el ejercicio de la acción publiciana se requiriere en el poseedor justo título, es decir, un origen legítimo de la cosa poseída." ( José* Gomez y Luis Muñoz, Elementos de Derecho Civil Mexicano, T. II, páginas 352 a 354, citado por ROJINA VILLEGAS, op, cit., páginas 691 y 692). "Sabido es que la acción publiciana se concedió en el Derecho romano, para otorgar protección real al poseedor de buena fe que ostentaba una posesión hábil para la usucapión frente a los perturbadores.

Mediante ella se había recibido por un título no idóneo según el derecho quiritario para transmitir la propiedad. Por otra parte, se concedió también al adquirente que traía de un no-propietario, cuando era perturbado por un tercero sin título alguno. En nuestro Derecho, el problema de la subsistencia de la acción publiciana envuelve dos cuestiones fundamentales: la primera, consiste en averiguar si un poseedor a título de dueño, que ostenta una posesión hábil para la usucapión, aunque en rigor sea todavía un non dominus, puede reaccionar frente al despojo producido por un tercero sin título alguno, más allá del plazo y demás condicionantes específicos del interdicto de recobrar, que prescribe al año. Además, la admisión de la acción publiciana resolvería la cuestión del enfrentamiento entre dos títulos posesorios, de los cuales uno se presenta con mayor fortaleza que el otro. (Ver MONTES, Vicente L., La propiedad privada en el Sistema de Derecho Civil Contemporáneo, Madrid, Editorial Civitas S.A., 1980 primera edición, páginas 294 y 295).

De todo lo anterior, se puede afirmar entonces que "En definitiva, tanto en la reivindicatoria como en la publiciana, el actor no es poseedor actual, y en ambos supuestos trata de recuperar la posesión como consecuencia de su derecho; y en el segundo, de la peor condición del actual poseedor... Así, a mi juicio, la acción publiciana podría admitirse como acción real recuperatoria a disposición del poseedor ad usucapionem..." ( Ver MONTES op. cit., página 295 pp.). Respecto de la acción publiciana, que es la que aquí nos interesa, la Jurisprudencia ha establecido lo siguiente: "III. La acción de mejor derecho de posesión, originada en la defensa del Derecho romano conocida como "publiciana", tiene su fundamento en nuestro ordenamiento jurídico en los artículos 317, 318, 319 y 322, así como en los numerales 277 a 286 del Código Civil, y tiende a tutelar al poseedor legítimo frente al ilegítimo, con el objeto de que logre la restitución de la posesión de que ha sido indebidamente privado, bien para que se declare su derecho preferente respecto de un poseedor anterior." En otros términos, se desprende que nuestra Jurisprudencia ve en la acción publiciana, efectos recuperatorios, pero también puede tener efectos declarativos.

Sin embargo, a nuestro entender, se trata de dos acciones diversas, pues como se dijo más arriba, la naturaleza histórica de la publiciana, es fundamentalmente la de ser una acción real posesoria cuyos efectos son restitutorios, véase incluso, que nuestro Código Civil, en el Libro II, Titulo I "Del dominio", Capítulo VI se regula lo relativo a los "Derechos de restitución e indemnización", capítulo dentro del cual fue incluida la acción publiciana en cuyo artículo 322 establece: "La acción ordinaria sobre el derecho de posesión, puede dirigirse contra cualquiera que pretenda tener mejor derecho de poseer." Y si fue incluida dentro de dicho capítulo es porque efectivamente se trata de una acción que tiende a la restitución de la posesión.- En el presente caso el actor presenta una típica acción publiciana.-*

VII.A juicio de este Tribunal, la prueba aportada dentro de este proceso ordinario ha sido apreciada adecuadamente por el juzgador de primera instancia, de conformidad con lo dispuesto en el artículo 54 de la Ley de Jurisdicción Agraria, argumentando las razones de hecho, derecho y equidad para rechazar la demanda ordinaria de mejor derecho de posesión. En todo caso, en cuanto al primer agravio, no lleva razón el recurrente en cuanto a la falta de fundamentación del fallo o a una posible contradicción de los hechos probados 1 y 2, con el resto de la prueba traída al proceso. Una cosa es que el actor haya adquirido, supuestamente, un derecho de posesión, en virtud de una donación de su padre, y otra cosa distinta es el ejercicio de la posesión agraria, de forma real y efectiva, lo cual no ha demostrado la parte actora. Por el contrario, la parte demandada, ha demostrado que tanto Luiyi del Sur LDS S.A. y [Nombre3] Sociedad Anónima, han mantenido una actividad agraria productiva, consistente en el mantenimiento de repastos y una actividad ganadera, teniéndola como una sola unidad productiva.

Pero, además de eso, la parte demandada demostró que son los titulares registrales legítimos del inmueble en conflicto, al corresponder el referido terreno, según la prueba admitida para mejor proveer, con el documento de escritura pública 73-1, otorgada a las 19 horas del 19 de abril del 2005 ante notario Greivin Jiménez Méndez, en virtud de la cual [Nombre1] le vendió a Luiyi del Sur LDS Sociedad Anónima, la finca matrícula CED8, que es terreno de pastos, agricultura, montaña y una casa; además de una finca sin inscribir con una medida aproximada de diez manzanas de potrero, la cual también vendió, a la referida sociedad. Desde entonces, tanto Luiyi del Sur LDS Sociedad Anónima, como [Nombre3] Sociedad Anónima, han ejercido la posesión a título de dueños, como una sola unidad productiva. De manera tal que no es cierto que exista una falta de fundamentación del fallo, pues con dichos elementos se puede concluir con facilidad que el actor carece de legitimación activa, al no haber demostrado el ejercicio de la posesión agraria, de manera legítima, por más de un año (falta de derecho y falta de interés actual).

Además, hay falta de legitimación pasiva, al ostentar los actores no solo un título legítimo de propiedad y posesión agraria, sino haber demostrado el ejercicio continuo de actos posesorios agrarios, al menos desde el año 2005, con el consecuente cumplimiento de la función social de la propiedad y de la posesión agraria (artículos 45 de la Constitución Política y 1 y 4 de la Ley de Tierras y Colonización). Por otra parte, en cuanto a la incorrecta valoración de la prueba, considera este Tribunal tampoco lleva razón el recurrente, toda vez que el a-quo realizó un estudio integral de los elementos probatorios aportados por ambas partes, siendo la prueba aportada por el actor, [Nombre1] , insuficiente para poder demostrar los presupuestos esenciales de una acción de mejor derecho de posesión. No bastaba con presentar un documento traslativo posesorio, era necesario demostrar el ejercicio de la actividad agraria.

Véase que se tubo por indemostrado que el actor haya realizado actos agrarios de explotación en los últimos diez años (hecho primero tenido por indemostrado), lo cual definitivamente pesa de manera negativa para el actor, pues no hay legitimación activa para demandar. La declaración de [Nombre9] (audio del 16/12/15 minutos 31 ss.), resulta insuficiente, pues tiene 10 años de no visitar la finca, y antes de eso la visitaba esporádicamente; no le consta si él desarrollaba alguna actividad agropecuaria. En sentido opuesto, los testigos [Nombre16] , [Nombre7] y [Nombre10] , coinciden en su declaraciones en cuanto al ejercicio de la posesión agraria por parte e Luiyi del Sur LDS Sociedad Anónima y luego por [Nombre3] Sociedad Anónima (de acuerdo con los elementos probatorios, tenidos por acreditados en el hecho 8). Véase que fue la empresa de [Nombre7] , la que activó el desarrollo productivo del inmueble, limpiando el terreno y reparando cercas para el ejercicio de la actividad agropecuaria, en el terreno en conflicto, el cual conformaba una sola unidad productiva con el inmueble inscrito.

De lo anterior se concluye que, independientemente de que el inmueble esté inscrito o no, lo cierto es que es a la parte demandada quien ha demostrado la coincidencia del título posesorio con el ejercicio de la actividad agraria productiva (ganadería), por más de diez años. Por esa razón, no puede ser considerada, la demandada, como poseedora ilegítima. Debe recordarse que de acuerdo a la legislación costarricense, específicamente el artículo 279 del Código Civil, se establece que independientemente del derecho de propiedad, se adquiere el derecho de posesión: 1°.- Por consentimiento del propietario, y 2° Por el hecho de conservar la posesión por más de un año. Ambas circunstancias se dan en este caso. Además, es importante recordar que en nuestro ordenamiento jurídico se presume la buena fe (artículos 284-286 del Código Civil). De ahí que se considera que la posesión ejercida por los demandados, es legítima, a título de dueños y de buena fe. *

VII.De todo lo anterior, se desprende que no lleva razón el recurrente al indicar que no se ha valorado adecuadamente la prueba, o que el fallo sea contradictorio. Lo procedente es confirmar la sentencia recurrida, en todos sus extremos.*
