Enforcement of Judgment (Ejecución de Sentencia) proceedings instituted before the Juzgado Contencioso Administrativo y Civil de Hacienda by MANUEL SALVADOR LINARES PÉREZ, whose marital status and occupation are not stated, against the MUNICIPALIDAD DE SAN CARLOS, represented by its mayor, Alfredo Córdoba Soro, a business administrator, and by the president of the Concejo Municipal, Gerardo Salas Lizano, divorced, a merchant. Otto Giovanni Ceciliano Mora, a resident of Heredia, appears as special counsel of record (apoderado especial judicial) for the judgment creditor (ejecutante). The natural persons are of legal age and, subject to the exceptions stated, married, attorneys, and residents of Alajuela.

CONSIDERING
I.According to the findings of fact made by the lower court, the Sala Constitucional, through ruling No. 14502 of 11:47 a.m. on October 21, 2005, granted an amparo proceeding filed by Mr. Manuel Salvador Linares Pérez against the Municipalidad de San Carlos because the respondent entity had issued Mr. Eladio Rodríguez Argüello several construction and earthworks (movimientos de tierras) permits for property adjoining that of the amparo petitioner (amparado) without first requiring the environmental impact assessment (evaluación de impacto ambiental, EIA) issued by the Secretaría Técnica Nacional Ambiental (SETENA). It deemed that omission contrary to the protection of the right to the environment enshrined in Article 50 of the Constitución Política and therefore ordered the respondent entity not to repeat in the future the acts or omissions that warranted granting that amparo proceeding. It also imposed an unliquidated award (condenó en abstracto) for payment of the costs, damages, and losses caused by the facts underlying the decision granting the amparo proceeding.
Mr. Linares Pérez instituted proceedings before the Juzgado Contencioso Administrativo y Civil de Hacienda to enforce that constitutional ruling. In those proceedings, he sought payment of the following items: 1. For pecuniary damage, the sum of ¢33,664,400.00. 2. For psychological harm, the amount of ¢50,000,000.00. 3. For damage arising from economic and family destabilization and danger to human life, the sum of ¢250,000,000.00. 4. Environmental damage (amount unspecified). 5. Interest in the amount of ¢74,284,608.66. 6. Costs of the amparo proceeding, in the sum of ¢500,000.00. 7. Costs of enforcing the judgment, in the amount of ¢58,393,000.00. 8. Interest on the costs of the amparo proceeding, in the amount of ¢240,000.00. 9. Interest on the costs of enforcing the judgment, in the amount of ¢4,829,300.00. The Municipalidad de San Carlos denied the complaint and raised the defenses of res judicata; failure to exhaust administrative remedies; lack of a current interest; lack of standing and capacity to be sued; failure to state a legal right; and the general plea sine actione agit.
The lower court rejected the defenses of lack of standing and capacity to be sued, as well as the defense of lack of a current interest. It denied the general plea of “sine actione agit.” It upheld the defense of failure to state a legal right. It dismissed the claims for pecuniary damage, psychological harm, damage arising from economic and family destabilization and danger to human life, as well as environmental damage. It partially granted the assessment of attorneys’ fees for the amparo proceeding, awarding only the sum of ¢150,000.00. It denied the assessment of interest on the costs of the amparo proceeding. It resolved these enforcement proceedings without a special award of costs. Dissatisfied, the judgment creditor filed an appeal on points of law, which was admitted by this Chamber.
Appeal on substantive grounds
II.First. He states that the lower court dismissed the complaint because it found that, before enforcing the constitutional ruling, he should have instituted declaratory proceedings (proceso declarativo) to determine the amount of the damages and losses caused. In his view, the reasoning set forth in the challenged judgment is erroneous and contrary to the constitutional decision. He emphasizes that the Sala Constitucional ordered the payment of costs, damages, and losses, expressly stating that these were to be assessed during enforcement-of-judgment proceedings before the administrative courts. Accordingly, he asserts that there is a clear defect and contradiction between the judgment issued by the Constitutional Court, which carries substantive res judicata effect (cosa juzgada material), and the judgment challenged here. He states that the lower court expects his client to institute declaratory proceedings to determine the pecuniary, psychological, non-pecuniary, and emotional damage, as well as the losses suffered because of the Municipality’s misconduct, which he considers contrary to the constitutional judgment being enforced and in violation of the principle of prompt and effective justice (justicia pronta y cumplida).
He contends that the challenged court sets forth premises and rules contrary to what the Sala Constitucional had already ordered, which he considers contrary to res judicata. He emphasizes that the constitutional judgment establishes the occurrence of the claimed damage and orders that it be recognized and assessed in enforcement-of-judgment proceedings; thus, he argues, it cannot properly be addressed in declaratory proceedings as the A quo seeks to require. He bases his appeal on Articles 133, 135, 137(i), and 183 of the Código Procesal Contencioso Administrativo.
III.Regarding the matters in dispute, with respect to the alleged pecuniary and environmental damage, the lower court determined that the judgment creditor sought to recover the full value of his property and the cost of appraisals (avalúos) of it; however, it found that the constitutional judgment being enforced had never determined that Mr. Linares Pérez’s property had been affected or that any environmental violation had occurred. It stated that the Sala Constitucional granted the amparo proceeding because a permit had been issued without a prior environmental impact study (estudio de impacto ambiental), but that the same Chamber cautioned: “this Chamber has repeatedly held that its jurisdiction is not that of a technical body capable of conclusively determining, according to technical parameters of that nature, whether the right to a healthy environment has been violated (…) Therefore, in this matter, the role of the constitutional judge cannot extend to verifying the technical criteria at issue but must be limited to determining whether the competent government agencies have fulfilled the obligation imposed on them by Article 50 of the Constitución Política.” Based on the foregoing, the lower court found that neither the existence of any environmental harm nor any impact on the judgment creditor’s property could be treated as facts underlying the amparo proceeding, and it therefore denied the alleged damages.
Separately, regarding psychological harm and the claim for damage arising from economic and family destabilization and danger to human life, the lower court noted that the appellant sought compensation under those headings because the earthworks performed on the neighboring property had caused instability on his property and that this situation had caused him emotional harm. In that regard, the lower court determined that the constitutional judgment had made no assessment concerning Mr. Linares Pérez’s land. It reiterated that the facts forming part of the amparo proceeding confined the enforcement judge’s authority to assessing any damage caused by the issuance of a permit without an environmental impact study; however, any assessment of possible damage to the judgment creditor’s property was not among the matters decided in the constitutional ruling and was therefore not enforceable in these proceedings. Finally, for informational purposes, it added that the judgment creditor could pursue those claims through declaratory proceedings.
IV.Before ruling on the objection raised, it is necessary to clarify certain matters concerning the enforcement of damages (ejecución de daños y perjuicios) awarded in constitutional proceedings through decisions in amparo proceedings (amparos). In this regard, this Chamber has stated: “[…] It is the responsibility of the judges charged with determining the amount of damages (liquidación) to determine whether the damages claimed were caused by the events on the basis of which the Constitutional Chamber issued the judgment being enforced. Accordingly, when hearing appeals in proceedings to determine the amount of such damages, this Chamber has previously considered whether the relief claimed by the enforcing party may be deemed encompassed within the decision rendered in constitutional proceedings (see, to this effect, judgments numbers 14 of 16 hours on 2 de marzo, 41 of 15 hours on 18 de junio, and 65 of 14 hours on primero de octubre, all of 1993, 557 of 15 hours 35 minutos on 4 de agosto de 2000, and 850 of 10 hours on 21 de julio de 2011, and 557 of 15 hours 35 minutos on 4 de agosto de 2000).
In judgment-enforcement proceedings (proceso de ejecución de sentencia), the only admissible claims shall be those intended to give practical effect to what was ordered by the Constitutional Chamber, because the scope and content of any decision at that stage are determined by the terms of the decision being enforced, in accordance with the principle of the immutability of res judicata (intangibilidad de la cosa juzgada) (Articles 162 to 165 of the Código Procesal Civil, in relation to provision 156 of the CPCA). That principle requires enforcement to be carried out under the same terms imposed in the final judgment, thereby delimiting the permissible scope of action. With respect to the damages arising from a constitutional judgment, when granting an amparo proceeding, this Chamber held in the decision transcribed above: ‘(…) it should be borne in mind that, by their nature, judgments of this kind contain an award in the abstract (condenatoria en abstracto), without any factual findings, and do not prejudge—because those matters were not subject to analysis—the existence of the damages, the causal nexus (nexo de causalidad), or their quantification.
The Chamber limits itself to determining the constitutional violation. The procedure in those proceedings is entirely different from that of adjudicatory proceedings (proceso de cognición). It contains no findings of fact. Its determination is based on the alleged violation, the report submitted by the official, and a legal analysis. Under the Ley Reguladora de la Jurisdicción Constitucional, its enforcement falls within the jurisdiction of the contentious-administrative courts (jurisdicción contencioso administrativa). By its nature, it may be said to constitute sui generis enforcement, as this Chamber has established in stating that: “When seeking enforcement of damages, the successful amparo petitioner must necessarily establish the factual predicates demonstrating a causal relationship between the damages declared in the abstract and the specific case. Mere calculation and valuation, as in adjudicatory proceedings, are insufficient.
The causal nexus between the damages awarded and those alleged must be closely related. In enforcement proceedings concerning the payment of damages awarded in an amparo proceeding, their extent must be assessed by weighing the circumstances in which the fundamental rights were violated, as well as whether the facts underlying the award constitute the cause of the damages claimed.” (The following decisions may be consulted: No. 296 of 11 hours 35 minutos on 6 de marzo de 2014 and No. 1130 of 09 hours 35 minutos on 27 de octubre de 2016).’
V.This Chamber agrees with the arguments set forth in the challenged judgment. Damages sought to be enforced in contentious-administrative proceedings as a result of their award in constitutional proceedings must have a causal nexus with the facts underlying the Constitutional Chamber’s decision. In this case, the amparo proceeding was granted because the respondent municipality was found to have breached the duties imposed by provision 50 of the Constitución Política by granting construction permits and earthworks (movimientos de tierra) permits without first obtaining an environmental impact study (estudio de impacto ambiental). That was the subject matter of the decision. In the judgment-enforcement proceedings, however, the claimant seeks compensation for property, environmental, and psychological damage, as well as economic and family destabilization, allegedly caused by the earthworks performed by his neighbor under permits granted by the municipality.
It should be noted that there is no causal relationship between the damages claimed by the enforcing party and the relief awarded by the Constitutional Chamber. The judgment being enforced determined that the right protected under the aforementioned article 50 had been violated because the respondent municipality failed to obtain SETENA’s prior opinion when it granted construction and earthworks permits to Mr. Eladio Rodríguez Argüello. For that reason, it warned the municipality of its duty not to commit such an omission in the future and, as a consequence, issued an award in the abstract for costs and damages. Thus, the Constitutional Chamber’s decision is limited to identifying the violation committed by the local government entity when it granted a permit without first obtaining the environmental impact study, an omission it deemed contrary to the duty imposed by the aforementioned provision, under which the State must guarantee, defend, and preserve the right to a healthy and ecologically balanced environment.
Nevertheless, the decision rendered there does not concern the actual performance of the earthworks, which constitutes the cause of the damages alleged by the appellant. The order to pay the damages caused by the conduct adjudged contrary to the Constitution (Carta Magna) means that any damages claimed in enforcement proceedings must arise from a cause-and-effect relationship with the specific infringement of the constitutional rights violated. The initial enforcement filing seeks payment for a series of damages resulting from the aforementioned earthworks. Although there may have been a chain of causes that produced the alleged harm, the fact remains that the claim asserted here was not directly and immediately caused by the conduct assessed in constitutional proceedings and, consequently, is not conduct upon which any damages subject to enforcement may be based. An examination of his claims establishes that the property, psychological, and environmental damage he claims arose from the alleged irregularities in the earthworks in question, which, according to his assertions, irreparably affected his property and also harmed his psychological well-being.
Those facts were not part of the analysis conducted by the Constitutional Chamber; that is, no determination was made as to whether that specific conduct was contrary to the Constitution. Accordingly, if the damages he seeks to recover were based on that action (earthworks performed on the adjoining property), he may not demand compensation through these proceedings, because that constitutes a different cause that was not examined in the judgment being enforced, and doing so would violate res judicata (cosa juzgada). For the foregoing reasons, the Court’s reasoning is correct and, consequently, the objection shall be rejected.
VI.In view of the foregoing, the appeal filed shall be denied; pursuant to provision 150.3 of the Código Procesal Contencioso Administrativo, the appellant shall bear the costs incurred through its filing.
POR TANTO
The appeal on points of law (recurso de casación) filed by the enforcing party is denied, and that party shall bear the costs incurred through its filing.

RESULTANDO

CONSIDERANDO
I.Conforme el elenco de hechos probados por el Juzgado, la Sala Constitucional, mediante el voto No. 14502 de las 11 horas 47 minutos del 21 de octubre de 2005, declaró con lugar un recurso de amparo interpuesto por el señor Manuel Salvador Linares Pérez contra la Municipalidad de San Carlos, por cuanto la entidad recurrida otorgó al señor Eladio Rodríguez Argüello varios permisos de construcción y movimientos de tierras sobre un inmueble aledaño al del amparado, sin haber requerido con anterioridad, la evaluación de impacto ambiental que otorga la Secretaría Técnica Nacional Ambiental (SETENA). Tal omisión la consideró contraria a la protección del derecho al ambiente contenido en el artículo 50 de la Constitución Política, en virtud de lo cual ordenó al ente recurrido no incurrir a futuro en los actos u omisiones que dieron mérito a la acogida de ese amparo. Asimismo, condenó en abstracto al pago de las costas, daños y perjuicios causados con los hechos que sirvieron de base a la declaratoria con lugar del amparo.
El señor Linares Pérez interpuso ante el Juzgado Contencioso Administrativo y Civil de Hacienda proceso de ejecución del referido voto constitucional. En este solicitó el pago de los siguientes rubros: 1. Por concepto de daño material, la suma de ¢33,664,400.00. 2. Por daño psíquico, el monto de ¢50,000,000.00. 3. Por daños de desestabilización económica y familiar y peligro de la vida humana, la suma de ¢250,000,000.00 4. Daños ambientales (sin especificar monto). 5. Intereses en ¢74,284,608.66. 6. Costas del recurso de amparo, la suma de ¢500,000.00. 7. Costas de ejecución de sentencia en ¢58,393,000.00. 8. Intereses sobre costas de recurso de amparo en ¢240,000.00. 9. Intereses sobre costas de ejecución de sentencia en ¢4,829,300.00. La Municipalidad de San Carlos contestó de forma negativa la demanda y planteó las excepciones de cosa juzgada, falta de: agotamiento de la vía administrativa, de interés actual, de legitimación activa y pasiva, de derecho y la genérica sine actione agit.
El Juzgado rechazó las excepciones de falta de legitimación activa y pasiva, así como la excepción de falta de interés actual. Denegó la expresión genérica “sine actione agit”. Declaró con lugar la excepción de falta de derecho. Rechazó las pretensiones de daño material, daño psíquico, daño de desestabilización económica, familiar y peligro de la vida humana, así como el daño ambiental. Acogió parcialmente la liquidación de costas personales del recurso de amparo, concediendo únicamente la suma de ¢150,000.00. Declaró sin lugar la liquidación de intereses sobre las costas del recurso de amparo. Resolvió el presente asunto de ejecución sin especial condenatoria en costas. Inconforme, la parte ejecutante estableció recurso de casación que fue admitido por esta Sala.
Casación por motivos sustantivos
II.Primero. Señala, el Juzgado rechazó la demanda en tanto indicó que previo a la ejecución del voto constitucional, debió iniciar un proceso declarativo que determinase la cuantía de los daños y perjuicios causados. A su entender, el criterio vertido en la sentencia impugnada es erróneo y contrario a la resolución constitucional. Destaca, la Sala Constitucional condenó al pago de costas, daños y perjuicios, indicando expresamente que estos se debían liquidar en ejecución de sentencia de lo contencioso administrativo. En virtud de lo anterior, asevera, existe un claro vicio y contradicción entre la sentencia que genera cosa juzgada material emitida por el Órgano Constitucional, y la sentencia aquí recurrida. Menciona, el Juzgado pretende que su representado inicie un proceso declarativo, con el fin de que se determinen los daños materiales, psicológicos, morales y emocionales, así como los perjuicios sufridos a causa del mal actuar de la municipalidad, lo cual, estima, contrario a la sentencia constitucional ejecutada y violatorio del principio de justicia pronta y cumplida.
Manifiesta, el Tribunal recurrido plantea presupuestos y resuelve contrario a lo ya ordenado por la Sala Constitucional, lo cual, considera, contrario a la cosa juzgada. Resalta, en la sentencia constitucional se evidencia el surgimiento de los daños reclamados y en esta se ordena su reconocimiento y valoración en proceso de ejecución de sentencia, no siendo viable, arguye, su tramitación en un proceso declarativo como lo pretende el A quo. Apoya su recurso en los numerales 133, 135, 137 inciso i y 183 del Código Procesal Contencioso Administrativo.
III.En lo que resulta objeto de disconformidad, con respecto a los daños material y ambiental endilgados, el Juzgado determinó, el ejecutante pretende cobrar el valor total de su inmueble y costo de avalúos sobre el bien; sin embargo, estimó, la sentencia constitucional ejecutada nunca determinó que se había afectado el inmueble del señor Linares Pérez, ni que hubo infracción al ambiente. Señaló, la Sala Constitucional declaró con lugar el amparo por haberse otorgado un permiso sin contar de manera previa con un estudio de impactado ambiental, pero la misma Sala advirtió: “esta Sala ha reiterado que su competencia no es la de un órgano técnico que pueda, en definitiva, establecer bajo parámetros de esas características si se ha producido una infracción al derecho a un medio ambiente sano (…) De manera que, en este asunto, el papel del juez constitucional no puede extenderse al de verificador de los criterios técnicos en cuestión, sino que deberá limitarse a constatar si las dependencias estatales competentes han cumplido la obligación que les impone el artículo 50 de la Constitución Política”.
Con lo anterior, el Juzgado consideró que no se podía tener como hechos base del amparo la existencia de alguna afectación al ambiente ni al inmueble del ejecutante, razón por la cual denegó los daños endilgados. Por otra parte, sobre el daño psíquico y la pretensión de daños de desestabilización económica y familiar y peligro de la vida humana alegados, el Juzgado analizó que el recurrente pretendía indemnización por esos rubros en virtud de que los movimientos de suelo hechos en el fundo vecino, habían provocado inestabilidad en su inmueble y, tal situación, le había generado afectaciones emocionales. A ese respecto, el Juzgado determinó que en la sentencia constitucional no se había valorado nada en relación con el terreno del señor Linares Pérez. Reiteró, con los hechos que forman parte del amparo se delimita la actuación del juez ejecutor a la valoración de eventuales daños generados por el otorgamiento de un permiso sin un estudio de impacto ambiental, pero toda aquella valoración acerca de posibles daños en el inmueble del ejecutante, no formó parte de los extremos resueltos en el voto constitucional y, por ende, no susceptibles de ejecución en este proceso. Finalmente, añadió con carácter informativo que el ejecutante podría reclamar tales extremos acudiendo a la sede declarativa.
IV.Previo a resolver el reproche formulado, se hace necesario efectuar algunas precisiones en torno a la ejecución de daños y perjuicios otorgados en sede constitucional en resolución de amparos. Sobre el particular, esta Sala ha señalado: “[…] Corresponde a los jueces encargados de la liquidación determinar si los daños reclamados fueron causados por los hechos con base en los cuales la Sala Constitucional dictó la sentencia ejecutada. Por ello, al conocer de recursos en procesos de liquidación de esos daños y perjuicios, esta Sala se ha ocupado en otras oportunidades de analizar si aquello reclamado por el ejecutante puede estimarse comprendido en lo resuelto en sede Constitucional (ver en este sentido, las sentencias números 14 de las 16 horas del 2 de marzo, 41 de las 15 horas del 18 de junio y 65 de las 14 horas del primero de octubre, todas de 1993, 557 de las 15 horas 35 minutos del 4 de agosto de 2000 y 850 de las 10 horas del 21 de julio de 2011 y 557 de las 15 horas 35 minutos del 4 de agosto de 2000).
En el proceso de ejecución de sentencia, las únicas pretensiones admisibles serán las que tiendan a dar efectividad práctica a lo ordenado por la Sala Constitucional, pues los alcances y contenidos de lo que se resuelva en esa etapa están fijados por lo establecido en la resolución que se ejecuta, en atención al principio de intangibilidad de la cosa juzgada (artículos 162 a 165 del Código Procesal Civil, en relación con el canon 156 del CPCA). Dicho postulado, impone que la ejecución ha de realizarse con base en los mismos términos impuestos en la sentencia firme, cerrando el marco de acción. Ahora bien, en torno a los daños y perjuicios que se derivan de un fallo constitucional, al declarar con lugar un recurso de amparo, esta Sala en la resolución antes transcrita sostuvo: “(…) conviene tener presente que por su naturaleza, este tipo de sentencias contienen una condenatoria en abstracto, sin ninguna consideración fáctica, no prejuzga, por no haber sido objeto de análisis, sobre su existencia, ni su nexo de causalidad o cuantificación.
La Sala se limita a determinar la violación constitucional. El procedimiento en esa sede, es absolutamente distinto al de un proceso de cognición. No contiene hechos probados. Su consideración se fundamenta en la violación que se acusa, el informe rendido por el funcionario y un análisis de derecho. Su ejecución, por mandato de la Ley Reguladora de la Jurisdicción Constitucional, corresponde a la jurisdicción contencioso administrativa. Por su naturaleza, puede decirse que se trata de una ejecución sui géneris, tal y como lo ha establecido esta Sala al señalar que: “Al ejecutar los daños y perjuicios el amparado deberá necesariamente establecer los presupuestos de hecho conducentes a evidenciar una relación de causalidad entre los daños y perjuicios declarados en abstracto y el caso concreto. No basta, como en el de cognición, con la sola liquidación y valoración. El nexo de causalidad entre los daños y perjuicios condenados deben guardar íntima relación con los acusados.
Tratándose de ejecuciones referidas al pago de daños y perjuicios acordados en un recurso de amparo, su entidad debe ser valorada ponderando la situación en la cual los derechos fundamentales fueron vulnerados, además, si los hechos base de la condenatoria configuran causa de los daños reclamados.” (Se pueden consultar los siguientes votos: No. 296 de las 11 horas 35 minutos del 6 de marzo de 2014 y No. 1130 de las 09 horas 35 minutos del 27 de octubre de 2016).
V.Esta Cámara comparte los argumentos esbozados en la sentencia cuestionada. Los daños que se pretenden ejecutar en sede contencioso administrativa producto de su otorgamiento en la vía constitucional, deben tener un nexo de causalidad con los hechos que fundamentaron la decisión de la Sala Constitucional. En este caso, el recurso de amparo fue declarado con lugar por cuanto se consideró que la municipalidad recurrida había incumplido los deberes impuestos por el canon 50 de la Constitución Política, al otorgar permisos de construcción y movimientos de tierra sin contar previamente con un estudio de impacto ambiental. Ese fue el objeto de dicha resolución. Ahora bien, en ejecución de sentencia, el accionante pretende se le pague una indemnización por daño material, ambiental, psíquico y desestabilización económica y familiar, cuya causa obedece a los movimientos de tierra que hizo su vecino, respaldados en los permisos que le otorgó la municipalidad.
Nótese, no existe una relación causal entre lo solicitado por el ejecutante en cuanto a los daños reclamados y lo concedido por la Sala Constitucional. En la sentencia ejecutada se determinó que hubo violación al derecho protegido en el artículo 50 citado, al haber omitido la municipalidad recurrida contar con el criterio previo de SETENA, cuando otorgó los permisos de construcción y de movimientos de tierra al señor Eladio Rodríguez Argüello. Por tal motivo, le apercibió sobre su deber de no incurrir a futuro con tal omisión y, consecuencia de lo anterior, condenó en abstracto al pago de costas, daños y perjuicios. Así, la resolución de la Sala Constitucional se circunscribe a advertir la violación por parte del ente local al otorgar un permiso sin obtener de previo el estudio de impacto ambiental, omisión que consideró contraria al deber impuesto por el referido canon, en cuanto a que el Estado deberá garantizar, defender y preservar el derecho a un ambiente sano y ecológicamente equilibrado.
No obstante, lo allí resuelto no tiene relación con la ejecución de los movimientos de tierra propiamente dicha, lo cual constituye la causa de los daños alegados por el recurrente. La condena al pago de los daños y perjuicios ocasionados con la conducta juzgada como contraria a la Carta Magna, implica que aquellos que fueren reclamados en sede de ejecución, deben derivarse de un vínculo de causa-efecto, del quebranto concreto de los derechos constitucionales violentados. En el escrito inicial de la ejecución, se solicita el pago de una serie de daños producto de los movimientos de tierra mencionados. Si bien podría existir una cadena de causas que provocaron el detrimento endilgado, lo cierto es que lo aquí argüido no tiene como causa directa e inmediata la conducta valorada en sede constitucional y, consecuentemente, sobre la cual deben recaer los eventuales daños por ejecutar. Del examen de sus pretensiones, se constata que tanto el daño material, como psicológico y ambiental que reclama, provienen de las presuntas irregularidades que se dieron en los movimientos de tierra referidos, lo que, según su dicho, afectó irreparablemente su finca y eso también provocó afectaciones en su psique.
Esos hechos no formaron parte del análisis realizado por la Sala Constitucional, es decir, no se determinó si esa conducta en particular fue contraria a la Constitución. De ahí que si los daños que pretende materializar fueron justificados en esa acción (movimiento de tierras hechos en la finca colindante), no puede exigir se le indemnice en esta vía, al ser esta una causa diversa y no examinada en la sentencia que se ejecuta, porque ello supondría un quebranto a la cosa juzgada. Por lo anterior, lleva razón el Juzgado en sus consideraciones y, por consiguiente, procederá el rechazo del reproche.
VI.En mérito de lo expuesto, procederá declarar sin lugar el recurso planteado, de conformidad con el canon 150.3 del Código Procesal Contencioso Administrativo, deberá la parte recurrente sufragar las costas generadas con su ejercicio.
POR TANTO
Se declara sin lugar el recurso de casación planteado por la parte ejecutante, quien deberá sufragar las costas generadas con su ejercicio.
