Appeal filed in the present proceeding brought against [Nombre1], of legal age, divorced, born on diecinueve de octubre de mil novecientos sesenta y tres, holder of identity card number CED1, for the offenses of violation of Ley Forestal, in the form of encroachment upon a river protection area (área de protección), disobedience of authority (desobediencia a la autoridad), and usurpation of public-domain property (usurpación de bienes de dominio público), in material concurrence of offenses (concurso material), to the detriment of Los Recursos Naturales. Judge Ivette Carranza Cambronero and Judges [Nombre2] and [Nombre3] participated in deciding the appeal. Attorneys [Nombre4], in her capacity as public defender for the accused, and [Nombre5], representative of the Ministerio Público, appeared in the appeal.

Findings:

1. By judgment number 208-2016, issued at sixteen fifty-six hours on veintitrés de setiembre del año dos mil dieciséis, the Criminal Court of the Second Judicial Circuit of the Southern Zone, San Vito de Coto Brus seat, ruled: “POR TANTO: In accordance with the foregoing, Articles 39 and 41 of the Constitución Política, Article 8 of the Convención Americana de Derechos Humanos, Articles 1, 22, 30, 31, 45, 50, 59, 63, 71, 76, 103, 227 and 314 of the Código Penal, Article 33 subsection b in relation to Article 58 subsection a of Ley Forestal, and Articles 1, 2, 3, 6, 9, 12, 142, 265 to 268, 360 et seq. of the Código Procesal Penal, [Nombre1] is hereby found criminally responsible as the perpetrator of the offenses of VIOLATION OF LEY FORESTAL, in the form of encroachment upon a river protection area, DISOBEDIENCE OF AUTHORITY, and USURPATION OF PUBLIC-DOMAIN PROPERTY, in material concurrence of offenses, and, in that capacity, the following sentences are imposed upon him: ONE YEAR OF IMPRISONMENT FOR THE FIRST OFFENSE, SIX MONTHS OF IMPRISONMENT FOR THE SECOND, AND ONE YEAR OF IMPRISONMENT FOR THE THIRD; pursuant to Article 75 concerning the penalty for material concurrence of offenses, the sentence imposed is TWO YEARS AND SIX MONTHS OF IMPRISONMENT, to be served at the place and in the manner established by prison regulations.

Likewise, in consideration and protection of the legally protected interest (bien jurídico) of Los Recursos Naturales, restoration of matters to the condition in which they existed before the events occurred is ordered; therefore, once this judgment becomes final, through the appropriate means and before the competent authority, the persons living in the dwelling associated with the charged acts committed by the person convicted herein, located in the [Dirección1] Vegas settlement in limoncito de Coto Brus, two hundred meters before the [Dirección2] limoncito bridge, on the right bank of the river in question, shall be evicted, and said structure shall be demolished. As the requirements established in sections 59 to 62 of the Código Penal have been met, the convicted person is granted the BENEFIT OF A CONDITIONALLY SUSPENDED SENTENCE (beneficio de condena de ejecución condicional) for a probationary period of THREE YEARS, with the warning that if, during said period, he commits a new intentional offense punishable by imprisonment exceeding six months, the benefit shall be immediately revoked.

Pursuant to Article 265 et seq. of the Código Procesal Penal, the accused is one of the parties exempt from paying the expenses of the criminal proceeding, and no costs, strictly defined, have been incurred; therefore, the expenses of the criminal proceeding shall be borne by the State. Once the judgment becomes final, it shall be entered in the Registro Judicial, and the customary certified copies shall be sent to the JUZGADO DE EJECUCIÓN DE LA PENA, INSTITUTO NACIONAL DE CRIMINOLOGÍA, and CENTRO DE INFORMACIÓN PENITENCIARIA. The parties are hereby duly notified of the ruling through its reading. THAT IS ALL. [Nombre6]. CRIMINAL COURT OF THE SECOND JUDICIAL CIRCUIT OF THE SOUTHERN ZONE, SAN VITO DE COTO BRUS SEAT.” 2. Attorney [Nombre4] filed an appeal against the foregoing ruling.

3. After the corresponding deliberation was conducted in accordance with Article 466 of the Código Procesal Penal, as amended by Ley 8837, published on nueve de diciembre de dos mil once (Creation of the Appeal from Judgment), the Court considered the issues raised in the appeal.

4. The relevant legal requirements were observed throughout the proceedings.

Drafted by Judge [Nombre7]; and,

Considerations:

I.Because it satisfies the applicable requirements, the Court considers the appeal from the criminal judgment filed by [Nombre8], public defender for the accused [Nombre1], against criminal judgment number 208-2016, issued at 16:56 hours on 23 de setiembre de 2016 by the Court of the Second Judicial Circuit of the Southern Zone, San Vito de Coto Brus Seat. That judicial ruling sentenced the accused [Nombre9] to a total of two years and six months of imprisonment for the offenses of violation of Ley Forestal, in the form of encroachment upon a river protection area, disobedience of authority, and usurpation of public-domain property, in material concurrence of offenses. It also ordered restoration of matters to their prior condition.

II.In the first ground of appeal (motivo), the complainant alleges a lack of legal reasoning (fundamentación jurídica) concerning the theory of criminal liability (teoría del delito), specifically culpability (culpabilidad). In this regard, she argues that during the trial she asserted that the conduct under investigation was covered by a justification defense (causa de justificación), namely necessity as a justification (estado de necesidad justificante), and that her theory was rejected by the trial judge, even though the evidence presented (prueba evacuada) established that, at the time of the events, the accused [Nombre9] and his family were in danger because they had no housing. In that regard, the prosecution witnesses (testigos de cargo) stated that, prior to these events, he had been evicted from a plot of land and therefore had to move into a borrowed house, but later had nowhere to live.

For that reason, the accused built his house at the location alleged in the charge. Those same prosecution witnesses said that they saw secondhand lumber at the site for construction of the dwelling, which appeared to have come from a house that had been dismantled and that they intended to rebuild. Furthermore, according to the complainant, testimony was received from [Nombre10], the teacher of the accused’s five children, who stated that the accused was the person responsible for caring for these minors. She also stated that this family had lived on plots of land, then near the road, and for a time in a borrowed house; that they have very limited financial resources; and that she recalled that the youngest child received special education services and that, at the time of trial, the accused’s grandchildren were attending school. According to the appellant (recurrente), the defendant (imputado) testified to the same effect and told the court that he was very poor and living in extreme poverty, that one of his daughters was living in La Carpio and had many problems, and that he therefore resolved the matter in this way, using lumber that had been given to him.

He also showed the judge the parts of his body where the illness from which he suffers was evident, in the form of sores. Defense counsel believes that the danger faced by the defendant was imminent at the time of the events and that “…This danger was not caused voluntarily; see the defendant’s statement, in which he indicates that when the officials arrived at the location, one of them, named [Nombre11], told him to build the house in a location similar to the one where he was building, and therefore they are (sic) [Nombre12] does not observe or does not realize the lesser harm that he may have caused…” (see appeal, folio 143). The appellant further argues that, in that context, the accused’s action was the only viable means available to him to protect his family. In that regard, “Mr. [Nombre13]” (sic), a prosecution witness, stated that they were willing to help the accused, but that he did not meet the requirements and therefore could not qualify as a beneficiary or be awarded a plot of land.

Defense counsel concludes that none of these elements was analyzed by the sentencing court (tribunal sentenciador), which rejected the theory presented on the understanding that there were social-welfare institutions and community leaders to whom the accused could have turned, without considering that he did not meet the requirements imposed by those institutions. She contends that the prejudice caused lies in the imposition of an unjust conviction and requests that her client be acquitted of all punishment and liability before this Court. The claim is rejected. A preliminary observation is that, although review of the judgment is difficult because, through an inadvisable drafting technique, the trial judge chose to provide only a cursory, nearly nonexistent account of the defense testimony received at the hearing, the appellant’s arguments are unfounded. First, it is readily apparent that defense counsel relies on a circular and irrelevant fallacy that undermines the validity of her claim, because she asserts that the defendant is so impoverished that his only means of survival was to build a house on the banks of a river, as charged; at the same time, however, she acknowledges that the evidence showed that the accused does not meet the requirements to receive assistance from any social-welfare institution.

This suggests, instead, that his poverty is therefore not so severe. She also alleges that building the house at the prohibited location was his family’s only means of survival; nevertheless, the defendant himself stated that the dwelling was also intended for one of his daughters, regarding whose circumstances no evidence whatsoever was presented at trial that would support a finding that this family’s only possible option was the conduct undertaken by her father, the accused herein, to resolve her housing problem. In that context, the fact that the defendant suffers from a serious illness involving ulcers on his body does not, by itself, establish that he is entirely unable to work or that he is ineligible for all state assistance. Accordingly, in the view of this appellate court (tribunal de alzada), the trial court properly rejected the defense theory presented. It must be clarified, however, that contrary to the trial judge’s assertion, it likewise cannot be accepted that, in cases where it is actually proven that the perpetrator acted under necessity as a justification arising from extreme economic hardship, that justification must be rejected merely because the conduct involved encroachment upon a protected area in which natural resources are protected, or because the land was unsuitable.

Such an approach amounts to the outright criminalization of poverty and is incompatible with our democratic system governed by the rule of law. Clearly, the issue must be examined on a case-by-case basis. Moreover, it cannot be overlooked that, in rejecting the defense theory, the court below (a quo) relied on the fact that it had been proven at trial that the accused had built another dwelling at the same location and sold it to a third party, demonstrating that his unlawful conduct was not merely a consequence of his economic circumstances. In this regard, the judgment states: “…the Court considers that the accused’s conduct is nothing more than a business and a means of subsistence, rather than an act of necessity as claimed by the defense, because although the accused has no dwelling, the witnesses established that this is not the first house that he has built in a protected area; in fact, it is the second, and the first house that he built, as witness [Nombre14] states, he sold as if it were his own property to an individual named ‘LUMAS,’ and this (sic) second house, the defendant’s daughter states (sic), is occupied by her at the location, after she purchased the house from her father; and in addition to all of the foregoing established at trial, there is the witness’s statement that the accused lives on plot [Dirección3], a plot from which his eviction has been ordered repeatedly, revealing (sic) conduct by the defendant driven not by necessity, as he has sought to introduce at trial as justification for his action, but by the exploitation of natural resources protected by the State (sic) in order to derive financial gain from them…” (cf. folio 131 verso).

This reasoning is accepted insofar as it is consistent with the record (see folios 129 verso and 130 of the challenged judgment) and does indeed support the conclusion that the accused has made a way of life out of encroaching upon public land, rather than addressing a human need in the only manner available to him. Finally, without further argument, the appellant introduces another issue into the discussion, arising from her assertion that, according to her, the defendant was told to build his house elsewhere and did not realize the harm that he might cause. She appears to suggest the existence of a mistake of law (error de prohibición); however, that factual circumstance was not established in the adversarial proceedings (contradictorio), and the appellant therefore raises a matter that is not amenable to review. For all the foregoing reasons, the claim is denied.

III.In the second ground, the complainant alleges a violation of the principle of proportionality (principio de proporcionalidad) and a lack of justification for the sentence because, in her view, the trial judge did not rely on the factors established in Article 71 of the Criminal Code, but instead imposed sentences above the prescribed minimum without stating the reasons for doing so. She adds that, with respect to the offense of usurpation of public-domain property (usurpación de bienes de dominio público), no reasons were given for not imposing a fine and that, additionally, the trial judge ordered the eviction and demolition of the dwelling that had been built without adequately analyzing the issue. The appellant further contends that the principle of proportionality was violated because no explanation was given as to why the sentence imposed serves its purposes. In the third ground of her appeal, the accused’s public defender alleges the erroneous application of the rules governing concurrence of offenses (concurso de delitos) and of Article 21 of the Criminal Code, because the trial judge found a real concurrence of offenses (concurso material de delitos) without explaining the reasons for doing so, when what occurred in this case was a single act and, therefore, an ideal concurrence of offenses (concurso ideal de delitos).

The appellant states that the accused’s sole purpose was to build a dwelling and that this single act, carried out by the same means, harmed several legally protected interests of different kinds. In both claims, the alleged prejudice consists of the very existence of the defect and the imposition of an incorrect sentence as a result thereof. The accused’s public defender requests that the appeal be granted, that the judgment be vacated, and that a new sentence be imposed by this Court, or, alternatively, that the corresponding remand be ordered. The claims are partially granted and, because they are related, are resolved jointly. For a better understanding, it is appropriate to begin with the factual findings deemed proven in the judgment, according to which: “...1-On April 29, 2011, at approximately 16:00 hours, the accused [Nombre15], IN THE COMPANY OF TWO OTHER ACCUSED PERSONS, entered and invaded the protection area (área de protección) of the Limoncito River, in Coto Brus, 200 meters from the protection zone (zona de protección), where they proceeded to lay the foundations for the construction of a dwelling, without any permit from the State Forestry Administration to perform such work. 2- On April 29, 2011, an Administrative Precautionary Measure (Medida Cautelar Administrativa) was issued against the accused herein, [Nombre9], by means of an order issued at 16: hours on April 29, 2011, imposing the following measures: ‘1) Suspend construction work within the protection area on the right bank of the Limoncito River.’ 3- The foregoing administrative measure of the Ministry of Environment, Energy and Telecommunications of the Canton of Coto Brus was personally served on the accused [Nombre16] at 16:00 hours on April 29, 2011. 4- On an unspecified date between April 29, 2011 and June 10, 2011, the accused [Nombre9], with full knowledge of the measures ordered against him and in complete disregard of the authority, disobeyed the administrative measure and built the aforementioned dwelling. 5- Since April 29, 2011, the accused [Nombre1] has been usurping and illegally residing on the property recorded in the Public Registry of Real Property under real-property folio number 6022438-0000 and 6022440-000; owned by the Instituto de Desarrollo Agrario, specifically in the IDA Reserve located in Las Vegas de Limoncito in Coto Brus, without holding title to the property or any right of possession authorizing him to do so.

PROVEN FACTS OF THE PRIVATE COMPLAINT (HECHOS PROBADOS DE LA QUERELLA). SOLE FACT: Between April 29 and June 10, 2011, the accused [Nombre15] invaded the protection area of the Limoncito River, which runs through property belonging to the Instituto de Desarrollo Agrario, located in Coto Brus, 200 meters before reaching the bridge, by constructing a dwelling ten meters from the bank of that river, thereby usurping public-domain property, while disregarding the order issued and personally served upon him on April 29, 2011 by the State Forestry Administration to suspend construction work within the protection zone, thus also committing the offense of disobedience of authority (desobediencia a la Autoridad).” (See folio 126 verso).

In light of these facts, the trial judge indeed found that the offenses of violating the Ley Forestal by invading a river protection area, disobedience of authority, and usurpation of public-domain property were in real concurrence. The judge provided no further reasoning on this point beyond stating that the offenses were committed at different times (see folio 132 verso). The first issue that is immediately apparent is that the offenses of usurpation of public-domain property and violation of the Ley Forestal by invading a protection area concern the same unlawful conduct proscribed by two different criminal provisions, one of which is a special provision; they therefore exclude one another, and only the latter applies. Accordingly, the judgment contains an error in the application of substantive law that must be corrected.

Now, as to the nature of the concurrence between the offense of violating the Ley Forestal and the offense of disobedience of authority, this chamber finds, by majority vote, that the trial court correctly determined that they were in real concurrence. The reason is as follows: what distinguishes ideal concurrence from real concurrence is the unity of legal action (unidad de acción jurídica) present in the former. Article 21 of the Criminal Code provides: “There is ideal concurrence when a single act or omission violates several legal provisions that do not exclude one another.” Therefore, resolving the defense’s argument requires determining whether the requirement of unity of action (unidad de acción) was satisfied as between the offense of invasion established in the Ley Forestal and the offense of disobedience of authority. An examination of the provisions at issue leads to the conclusion that this is not even possible, given their nature.

Indeed, the first of those offenses is consummated by invading a protection or conservation area contemplated by law; disobedience, for its part, is committed by failing to comply with or enforce an order issued by a public official in the performance of the official’s duties. It is therefore clear from their current wording that the first is an offense of commission (delito de acción) and the second an offense of omission (delito de omisión). Naturally, as the most authoritative scholarship has stated, “There is no ideal concurrence between an offense of commission and an offense of omission, whether pure or commission by omission. Acting and omitting are distinct actions” (Castillo [Nombre17], Criminal Law, General Part, vol. I. San José, C.R. Editorial Jurídica Continental. 2010, p. 619). Indeed, how could conduct concur with an absence of conduct when the manner in which each manifests itself in reality does not coincide?

The same author recognizes an exception when the offense of omission is a continuing offense (delito permanente) and the offense of commission serves to maintain the unlawful state created. However, that exception is not present in the case under review because the invasion had already been consummated when the defendant was ordered to cease his conduct, long before he decided to disobey the order issued. Consequently, it cannot be maintained that the invasion was the means used to disobey, since it preceded the disobedience itself. The defense’s argument on that point is therefore unfounded.

Furthermore, the appeal is denied insofar as it challenges the order in the judgment requiring restoration of matters to their prior condition (restablecimiento de las cosas al estado anterior), because, once the existence of the offense was established, this was a necessary consequence authorized by Article 367 of the Code of Criminal Procedure.

Accordingly, by majority vote, the third and fourth grounds of this same appeal are partially granted. The challenged judgment is reversed, and the proven facts are reclassified as the offenses of violating the Ley Forestal by invading a river protection area and disobedience of authority, in real concurrence. On this issue, Judge [Nombre7] partially dissents. Accordingly, the judgment and the trial that preceded it are vacated solely with respect to determination of the sentence to be imposed; the matter is therefore remanded to the court of origin so that, with a newly constituted panel, it may conduct a new trial. In all other respects, the judgment remains undisturbed.

IV.Dissenting opinion of Judge [Nombre7]. With all due respect, I depart from my colleagues’ position regarding the determination that the offenses of violating the Ley Forestal and disobedience constitute material concurrence (concurso material), rather than ideal concurrence (concurso ideal). Several considerations must be addressed concerning concurrence of offenses. Thus, it should be recalled that, in order to determine whether there is ideal or material concurrence of offenses, the first step is to examine whether there is a single course of conduct in the legal sense (unidad de acción en sentido jurídico). To that end, it is necessary to analyze whether there is a functional nexus (vínculo funcional) between the conduct under consideration, which shares a common phenomenological context, that is, conduct carried out at the same time and place. In other words, the actual perspective of the perpetrator’s plan and what the perpetrator intended must be taken into account, but always in light of the material reality (pragma material), meaning what is objectively established at the factual level.

Accordingly, in cases where no such functional nexus exists, there is material concurrence of offenses: completely separate unlawful acts that are subject to independent degrees of culpability. It is also important to bear in mind that, pursuant to Article 21 of the Penal Code (Código Penal), ideal concurrence exists when a single act or omission violates several legal provisions that are not mutually exclusive. Article 22 of that same body of law exhaustively establishes the contrary circumstances, namely, those in which the legal provisions are mutually exclusive: the special provision prevails over the general provision; a provision that fully encompasses another takes precedence over the latter; and a provision that the law has not expressly or tacitly subordinated to another applies in place of the ancillary provision. Therefore, outside these circumstances, where material concurrence has also been ruled out, the matter constitutes ideal concurrence because no mutually exclusive provisions have been violated.

Likewise, the most authoritative legal scholarship suggests, as a distinguishing criterion, examining the acts that comprise the execution plan (plan ejecutivo) for the various statutory offenses (tipos penales), and establishes that, in cases of ideal concurrence, those acts may take three forms: (a) when several acts constituting the execution of the concurrent statutory offenses are identical in the specific case—for example, killing two people with a single gunshot; (b) when the several acts constituting the execution of the concurrent statutory offenses are partially identical, that is, one part of the conduct contributes to satisfying the elements of an offense under both criminal statutes, which therefore concur—for example, the concurrence between bodily injury and robbery. (See [Nombre18], El concurso de delitos en el derecho penal costarricense. Litografía e imprenta Lil, S.A., San José, pp.61, 1981).

Thus, for this judge, it is clear that the perpetrator’s personal intent does not, by itself, resolve the issue; rather, what matters is the specific harm to the legally protected interests (bienes jurídicos) within the framework of legislative protection and its legal and social assessment. That is, the magnitude of the wrongfulness of the unlawful acts established in the material world must be determined solely on the basis of the underlying political conception (cf. [Nombre19]. Manual de Derecho Penal. Parte General. Editorial Temis s.a. Bogotá. Segunda Edición, pp.477, 2004.). (See, to that effect, ruling number 2015-735, Criminal Judgment Appeals Court of Cartago, First Section, issued at 14:12 hours on 13 de noviembre de 2015).

Accordingly, it is clear to this minority position that, under the aforementioned parameters, the first matter to be determined is whether a functional nexus exists between the various acts, in order to establish whether there is a single course of conduct in the legal sense. In that regard, in the present case, the trial judge overlooked the fact that, although the acts occurred successively over time, it was proven that they were carried out for the sole purpose of constructing a dwelling on the riverbank, a prohibited area. This can readily be inferred from the statements of the prosecution witness, [Nombre14], an official of the Sistema Nacional de Áreas de Conservación (SINAC), according to whom, from the first moment he approached the accused, [Nombre9], he observed him with other individuals carrying out construction on the bank of the Limoncito River, and the accused told him that he had nowhere to live because he had been evicted from his former residence.

Immediately thereafter, the accused was served notice of the administrative precautionary measure (medida cautelar administrativa) ordering suspension of the construction work (see reverse of folio 129). Subsequently, the administrative authority discovered that the accused had completed the work, in accordance with the facts found to be proven and discussed above. In other words, as argued, it is evident that the accused’s sole purpose was to construct a dwelling in the prohibited area, for which purpose he encroached upon the area and disobeyed the order of a public authority directing him not to do so. Furthermore, it is clear that this same act violated multiple legally protected interests covered by two other provisions that are not mutually exclusive, insofar as the offenses of violating the Ley Forestal and disobedience of authority are concerned. This constitutes ideal concurrence of offenses.

On this point, I disagree with the majority’s position that, because the offense of disobedience of authority is omissive in nature, it cannot concur with the offense of violating the Ley Forestal in the form of encroachment upon a protected area (invasión a un área protegida). In the undersigned judge’s view, notwithstanding the foregoing, there is no legal or ontological obstacle to such concurrence, since it cannot be overlooked that the offense of disobedience of authority involves bimodal conduct (acción bimodal); that is, the statutorily prohibited conduct (acción típica) may consist either of actively engaging in specific conduct or of refraining from doing what was ordered, without this affecting its status as a pure omission offense (delito de omisión propia), understood as the omission to fulfill the legal duty imposed by the provision. Nevertheless, in both cases, the alteration caused by the perpetrator at the material level may violate multiple legally protected interests, in which case there is ideal concurrence of offenses, as I believe occurred in the present case.

Por tanto

The first ground of appeal filed by [Nombre8], public defender for the accused, [Nombre1], is unanimously denied. By majority vote, the second and third grounds of that same appeal are partially granted. The challenged judgment is reversed, and the proven facts are reclassified as the offenses of violating the Ley Forestal, in the form of encroachment upon a river protection area (área de protección de un río), and disobedience of authority, in material concurrence. On this issue, Judge [Nombre7] partially dissents. Accordingly, the judgment and the trial that preceded it are declared null and void solely with respect to the determination of the sentence to be imposed; consequently, the matter is remanded to the court of origin so that, with a newly constituted panel, it may conduct a new trial. 1 1 *110004910636PE* Contra: [Nombre1] Delito: Infracción a la Ley Forestal y otros Ofendido: Los Recursos Naturales Res: 2017-414 Tribunal de Apelación de Sentencia Penal de Cartago, sección Primera. A las once horas cuarenta y siete minutos del dieciocho de agosto de dos mil diecisiete.

Recurso de apelación interpuesto en la presente causa seguida contra [Nombre1] , mayor, divorciado, nacido el diecinueve de octubre de mil novecientos sesenta y tres, con cédula de identidad número CED1 , por el delito de Infracción a la Ley Forestal en la modalidad de invasión en un área protección de un río, Desobediencia a La Autoridad, Usurpación de bienes de dominio público, en concurso material, en perjuicio de Los Recursos Naturales. Intervienen en la decisión del recurso la jueza Ivette Carranza Cambronero, y los jueces [Nombre2] y [Nombre3] . Se apersonaron en apelación las licenciadas [Nombre4] en calidad de defensora pública del imputado y [Nombre5] , representante del Ministerio Público.

Resultando:

1. Que mediante sentencia número 208-2016 de las dieciséis horas cincuenta y seis minutos del día veintitrés de setiembre del año dos mil dieciséis, el Tribunal Penal del Segundo Circuito Judicial de la Zona Sur, sede San Vito de Coto Brus , resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política, artículo 8 de la Convención Americana de Derechos Humanos, artículos 1, 22, 30, 31, 45, 50, 59, 63, 71, 76, 103, 227 Y 314 del Código Penal, artículos 33 inciso b en relación con el artículo 58 inciso a de la Ley Forestal, artículos 1, 2, 3, 6, 9,12, 142, 265 a 268, 360 y siguientes del Código Procesal Penal, se declara a [Nombre1] , autor responsable de los delitos de INFRACCIÓN A LA LEY FORESTAL en la modalidad de invasión en un área protección de un río, DESOBEDIENCIA A LA AUTORIDAD, USURPACIÓN DE BIENES DE DOMINIO PÚBLICO, en concurso material, en tal carácter se le impone las siguientes penas: UN AÑO DE PRISIÓN POR EL PRIMERO, SEIS MESES DE PRISIÓN POR EL SEGUNDO, Y UN AÑO DE PRISIÓN POR EL TERCERO, en aplicación del artículo 75 en cuanto a la penalidad del concurso material, la pena a imponer es de DOS AÑOS SEIS MESES DE PRISIÓN, pena que deberá de descontar en el lugar y forma que establezcan los reglamentos penitenciarios.

Así mismo en atención y protección del bien jurídico de los Recursos Naturales, se ordena restituir las cosas al estado en que se encontraban previo a suceder los hechos, por lo que se va a ordenar a la firmeza de la presente sentencia, por los medios correspondientes y ante la autoridad respectiva, el desalojo de las personas que viven en la vivienda a que ha hecho referencia los hechos acusados realizados por parte del aquí condenado, ubicado en el asentamiento [Dirección1] Vegas en limoncito de Coto Brus, doscientos metros antes del puente del [Dirección2] limoncito, al margen derecho del río en mención, así como la demolición de dicha obra. Al cumplirse con los requisitos establecidos en los numerales 59 a 62 del Código Penal, por un período de prueba de TRES AÑOS se concede al sentenciado el BENEFICIO DE CONDENA DE EJECUCIÓN CONDICIONAL, advirtiéndosele de que si en el período dicho incurriere en nuevo delito doloso sancionado con pena de prisión superior a seis meses, el beneficio le será inmediatamente revocado.

De conformidad con el artículo 265 y siguientes del Código Procesal Penal, el imputado es una de las partes exentas en el proceso penal del pago de los gastos del proceso y no se han generado costas estrictamente definidas, por lo que son los gastos del proceso penal a cargo del Estado. Firme el fallo, inscríbase en el Registro Judicial y envíense los testimonios de estilo ante el JUZGADO DE EJECUCIÓN DE LA PENA, INSTITUTO NACIONAL DE CRIMINOLOGÍA Y CENTRO DE INFORMACIÓN PENITENCIARIA. Quedan las partes debidamente notificadas de lo resuelto mediante lectura. ES TODO. [Nombre6] . TRIBUNAL PENAL DEL II CIRCUITO JUDICIAL DE LA ZONA SUR, SEDE SAN VITO DE COTO BRUS " 2. Que contra el anterior pronunciamiento, la licenciada [Nombre4] interpuso el recurso de apelación.

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.

4. Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta la Jueza [Nombre7] , y;

Considerando:

I.Por cumplir con los requisitos exigidos, se conoce el recurso de apelación de la sentencia penal incoado por [Nombre8] , defensora pública del encartado [Nombre1] , contra la sentencia penal número 208-2016, de las 16:56 horas, del 23 de setiembre de 2016, por el Tribunal del Segundo Circuito Judicial de la Zona Sur, Sede San Vito de Coto Brus. Dicho pronunciamiento judicial impuso al endilgado [Nombre9] un total de dos años y seis meses de prisión, por los delitos de infracción a la ley forestal, en su modalidad de invasión de un área de protección de un río, desobediencia a la autoridad, usurpación de bienes de dominio público, en concurso material. Igualmente, ordenó la restitución de las cosas al estado anterior.

II.En el primer motivo, la quejosa alega falta de fundamentación jurídica en relación a la teoría del delito, específicamente, en la culpabilidad. Al respecto, argumenta que durante el juicio alegó que existía una causa de justificación en la conducta investigada, un estado de necesidad justificante y su tesis fue rechazada por el juzgador, a pesar de que de la prueba evacuada se logró extraer que el endilgado [Nombre9] y su familia, para el momento de los hechos, se encontraban en peligro porque no tenían una vivienda. En ese sentido, los testigos de cargo manifestaron que, con anterioridad a estos hechos, lo habían desalojado de una parcela por lo que tuvo que irse a vivir a una casa prestada, pero luego no tenía donde vivir. Por esa razón, el acusado construyó su casa en el lugar que se acusa. Esos mismos testigos de cargo, dijeron que en el sitio observaron madera de segunda para la construcción de la vivienda, que parecía era de una casa que habían arrancado y pretendían volver a construir.

Además, según la quejosa, se recibió el testimonio de [Nombre10] , maestra de los cinco hijos del acusado, según la cual, el acusado fue quien se encargó de estas personas menores de edad. Además, manifestó que esta familia vivió en parcelas, luego cerca de la calle y un tiempo en una casa prestada; que son de muy bajos recursos económicos y que recuerda que el hijo menor era atendido con educación especial y que, para el momento del juicio, van a la escuela los nietos del acusado. Para la recurrente, el imputado declaró en ese mismo sentido e indicó al tribunal que era una persona muy pobre y en extrema pobreza, que una hija estaba viviendo en La Carpio y tenía muchos problemas, por lo que lo solucionó de esta forma, con madera que le habían regalado. Además, mostró al juez las partes de su cuerpo donde se podía evidenciar la enfermedad que padece, en un tipo de llagas. La defensora opina que el peligro al que el imputado estaba sometido era inminente para el momento de los hechos y que “…Este peligro no fue causado de manera voluntaria, véase de la declaración del imputado donde indica que cuando los funcionarios se presentan al lugar, uno de ellos llamado [Nombre11] le indica que construya la casa en un lugar semejante en el que estaba construyendo, por lo que son (sic) [Nombre12] no observa o no se percata del daño menor que pudo causar…” (ver recurso folio 143).

Por otra parte, arguye quien apela que, en ese contexto, la acción del endilgado era el único camino viable para la protección de su familia que aquel tenía. En ese sentido, “el señor [Nombre13]” (sic), testigo de cargo, indicó que ellos se encontraban anuentes a ayudar al encartado pero que no cumplía con los requisitos y por esa razón no podía ser beneficiario o adjudicársele una parcela. Concluye la defensora, que ninguno de estos elementos fue analizado por el tribunal sentenciador y rechazó la tesis planteada al entender que existen instituciones de bien social y líderes comunales a los que pudo acudir el acusado, pero no contempla que él mismo no cumplía con los requisitos que esas instituciones pedían. Considera que el agravio causado, radica en la imposición de una condena injusta y solicita se absuelva a su representado de toda pena y responsabilidad en esta Sede. La queja se rechaza.

Una primera observación que debe realizarse es que, aun y cuando, el análisis del fallo resulta dificultoso en virtud de que, en una inconveniente técnica de redacción, el juzgador de instancia optó por una referencia sucinta, casi ausente, de las declaraciones de descargo recibidas en audiencia, la recurrente no lleva razón en sus argumentaciones. En primer lugar, salta a la vista, que la defensora acude a una falacia circular e inatinente que le resta validez a su reclamo, por cuanto, aduce que el imputado ostenta una condición de pobreza tal que le llevó como única opción de sobrevivencia a la construcción de una casa en las márgenes de un río, según se acusa, sin embargo, simultáneamente, admite la interesada, que la prueba arrojó como resultado que el endilgado no reúne los requisitos para ser beneficiado por ninguna institución de bien social. De lo que se entiende, más bien, que su estado de pobreza no es, entonces, tan gravoso.

Por otra parte, alega que la construcción de la casa en el sitio prohibido, era el único medio de sobrevivencia de su familia, no obstante, el mismo imputado manifestó que la vivienda era también para una para una de sus hijas, alrededor de la cual, no se produjo prueba alguna en el juicio, como para entender que esta familia solo tenía como sola opción posible la conducta que desplegó su papá y aquí endilgado, para solucionar su problema de vivienda. En ese contexto, el que el imputado sea portador de una enfermedad grave, que implica que tenga úlceras en su cuerpo, tampoco acredita por sí mismo, que se encuentre incapacitado del todo para trabajar, o bien, que no sea merecedor de ayuda estatal alguna. De modo que, para este tribunal de alzada, bien hizo el tribunal de instancia en rechazar la hipótesis defensiva planteada. Sin embargo, debe aclararse que, contrario a lo que afirma el juzgador de instancia, tampoco puede admitirse que, en aquellos supuestos en que efectivamente se compruebe que el agente actúa bajo un estado de necesidad justificante derivado de una situación económica extrema, el mismo deba descartarse como causa de justificación solo porque se trata de la invasión de un área protegida, en protección a los recursos naturales, o porque los terrenos no sean aptos.

Semejante proceder encuadra en la simple criminalización de la pobreza, incompatible con nuestro sistema democrático de derecho. Evidentemente, el examen de la cuestión debe realizarse en cada caso concreto. Por lo demás, no puede soslayarse que el a quo echó mano para descartar la tesis defensiva a que se demostró en debate que el endilgado había realizado otra vivienda en el mismo y la había vendido a un tercero, lo que evidenciaba que su actuar ilícito no era consecuencia de su simple situación económica. Al respecto, se establece en el fallo, que: “…considera el tribunal que el actuar del encartado no es más que un negocio y una forma de subsistir y no de necesidad como refiere la defensa, porque si bien el encartado no tiene vivienda, se logra constatar mediante los testigos que no es la primera casa que construye en una zona protegida, de hecho es la segunda y la primera casa que construyó como refiere el testigo [Nombre14] , se la vende como si fuese de su propiedad un sujeto llamado ´LUMAS´, y ésta (sic) segunda casa refiere (sic) la hija del imputado quien vive en el lugar que le compró la casa a su padre, y aunado a todo lo anterior demostrado en debate, existe la declaración del testigo de que el acusado vive en la parcela [Dirección3], parcela a la que ha sido ordenado el desalojo en reiteradas ocasiones, devengando (sic) un actuar del imputado no de necesidad como ha querido introducir a debate como justificación de su acción, sino de aprovechamiento de los recursos naturales protegidos por el estado (sic), a fin de generar una ganancia económica de los mismos…” (cfr. folio 131 vuelto).

Razonamiento que se comparte en el tanto, corresponde con el mérito de autos (ver folios 129 vuelto y 130 del fallo impugnado), y efectivamente da pie para concluir que el endilgado ha hecho de la invasión de terrenos públicos su modo de vida, y no, que atiende una necesidad humana de la única manera que puede hacerlo. Finalmente, la recurrente introduce otro tema a la discusión, sin mayores argumentaciones y generado por su afirmación de que, según ella, al imputado se le dice que construya su casa en otro lado y no se percata del daño que podía causar. Pareciera se sugiere la existencia de algún error de prohibición, sin embargo, esa circunstancia fáctica no fue demostrada en el contradictorio, por lo que la recurrente plantea una situación que no resulta susceptible de análisis. Por todo lo expuesto, la queja se declara sin lugar.

III.En el segundo motivo, la quejosa reclama violación del principio de proporcionalidad y falta de fundamentación de la pena por cuanto, en su criterio, el juzgador no se basó en los elementos establecidos en el artículo 71 del Código Penal, sino que impuso penas superiores al mínimo establecido sin indicar las razones de su proceder. Añade que, tratándose del delito de usurpación de bienes de dominio público, tampoco se motivó porque no se impuso una pena de multa y que, adicionalmente, el juzgador ordenó el desalojo y demolición de la vivienda construida sin desarrollar un adecuado análisis del punto. Para quien recurre, adicionalmente, se lesionó el principio de proprocionalidad, puesto que no se explicó porque la pena impuesta atiende a sus fines. En el tercer motivo de su recurso, la defensora pública del acusado alega errónea aplicación de concursos y, del artículo 21 del Código Penal, por cuanto, el juzgador consideró la existencia de un concurso material de delitos sin explicar las razones de su proceder, cuando lo que se verifica en la especie es una unidad de acción y, por tanto, un concurso ideal de delitos.

Indica quien recurre, que el único fin del endilgado era construir una vivienda y con esa única acción se lesionaron varios bienes jurídicos de distinta naturaleza, con el mismo medio. En ambos reclamos, se señala como agravio la existencia misma del vicio y la imposición de una pena incorrecta gracias a este. Solicita la defensora pública del encartado, se declare con lugar el recurso, se anule la sentencia y se imponga una nueva pena en esta Sede, o bien, se ordene el reenvío correspondiente. Los reclamos se declaran parcialmente con lugar y, en virtud de su conexidad, se resuelven en forma conjunta. Para una mejor comprensión, conviene partir de la plataforma fáctica tenida por cierta en sentencia, según la cual: "...1-El 29 de abril del 2011, al ser las 16:00 horas aproximadamente, el imputado [Nombre15] EN COMPAÑÍA DE DOS IMPUTADOS MÁS, procedieron a ingresar e invadir el área de protección del río Limoncito, en Coto Brus, 200 metros de la zona de protección, donde procedieron a levantar los cimientos para una construcción de una vivienda, sin contar con permiso alguno de la Administración Forestal del Estado para realizar tales labores. 2- El 29 de abril del 2011, se le dictó Medida Cautelar Administrativa al aquí imputado [Nombre9] , mediante orden de las 16: horas del 29 de abril del 2011, ordenándose en la misma las siguientes medidas: "1) Suspender las obras de construcción dentro del área de protección al margen derecho del río Limoncito. 3- La anterior medida Administrativa del Ministerio de Ambiente Energía y Telecomunicaciones del Cantón de Coto Brus, le fueron notificadas en forma personal al imputado [Nombre16] a las 16:00 horas del día 29 de abril de 2011. 4- Sin precisar fecha exacta pero entre el 29 de abril de 2011 y el 10 de junio de 2011, el imputado [Nombre9] , teniendo pleno conocimiento de las medidas ordenadas en su contra y con pleno irrespeto por la autoridad desobedeció la medida administrativa y construyó la vivienda antes mencionada. 5- Desde 29 de abril de 2011, el imputado [Nombre1] , se encuentra usurpando y viviendo ilegalmente dentro el inmueble inscrito en el Registro Público de la Propiedad Inmueble bajo el folio Real número 6022438-0000 y 6022440-000; propiedad del Instituto de Desarrollo Agrario, propiamente en la Reserva del IDA sito en las Vegas de Limoncito en Coto Brus, sin contar con título de adquisición y sin derecho de posesión que le faculte hacerlo.HECHOS PROBADOS DE LA QUERELLA .

ÚNICO: Entre el 29 de abril y 10 de junio del año 2011, el imputado [Nombre15] procedió a invadir el área de protección del río Limoncito, el cual discurre en una propiedad del Instituto de Desarrollo Agrario, ubicada en Coto Brus, 200 metros antes de llegar al puente, mediante la construcción de una vivienda, a diez metros del margen de dicho río, usurpando con tal acción un bien de dominio público, haciendo caso omiso de la orden que le emitió y notificó personalmente en fecha 29 de abril del 2011 la Administración Forestal del Estado de suspender las obras de construcción dentro de la zona de protección, incurriendo a su vez en un delito de desobediencia a la Autoridad."(Cfr. Folio 126 vuelto).

Frente a esta relación fáctica, ciertamente, el juzgador de instancia entendió que los ilícitos de infracción a la ley forestal en su modalidad de invasión de un área protegida de un río, desobediencia a la autoridad y usurpación de bienes de dominio público concurren de forma material. Sobre el punto, no aportó mayores argumentaciones, más allá, de afirmar que se trata de delincuencias que fueron cometidas en momentos diferentes (ver folio 132 vuelto). Una primera cuestión que salta a la vista es que, tratándose de los delitos de usurpación de bienes de dominio público e infracción a la Ley Forestal por invasión a un área protegida, se trata de una misma conducta ilícita prevista en dos normas penales distintas, una de ellas de carácter especial, por lo que se excluyen entre sí, y solo resulta aplicable la última, en razón de lo cual, el fallo ostenta un error en la aplicación de la ley sustantiva que debe corregirse.

Ahora, en cuanto a la naturaleza del concurso entre los ilícitos de infracción a la Ley Forestal y el delito de desobediencia a la autoridad, por mayoría, este cámara considera que bien hizo el tribunal de instancia al entender que concurren de forma material. La razón es la siguiente: lo que distingue al concurso ideal del material es la unidad de acción jurídica que se presenta en el primero. El artículo 21 del Código Penal dispone: "Hay concurso ideal cuando con una sola acción u omisión se violan diversas disposiciones legales que no se excluyen entre sí". Por ello, la solución al planteamiento de la defensa pasa por determinar si entre el delito de invasión previsto en la Ley Forestal y el de desobediencia a la autoridad se cumplió el requisito de la unidad de acción. Un examen de las normas en cuestión lleva a concluir que ello ni siquiera es posible, en razón de su naturaleza. En efecto, el primero de eso delitos se consuma invadiendo un área de protección o conservación de las contempladas en la ley; la desobediencia, por su lado, se concreta al no cumplir o no hacer cumplir una orden impartida por un funcionario público en el ejercicio de sus funciones.

Es claro entonces, según sus redacciones actuales, que el primero es un delito de acción y el segundo lo es de omisión. Naturalmente, como lo ha referido la doctrina más connotada, "No hay concurso ideal entre un delito de acción y un delito de omisión, propia o impropia. El hacer y el omitir son acciones distintas" (Castillo [Nombre17] , . Derecho penal, parte general, t. I. San José, C.R. Editorial Jurídica Continental. 2010, p. 619). En efecto, ¿cómo podría concurrir un comportamiento con una ausencia de conducta si la forma de manifestación de ambos en la realidad no es coincidente? El mismo autor acepta una excepción, cuando el delito de omisión es un delito permanente y el de acción sirve para mantener el estado antijurídico creado. Sin embargo, esa excepción no se presenta en el caso bajo examen, porque la invasión ya se había consumado cuando se previno al justiciable que debía cesar en su conducta y mucho antes de que decidiera desobedecer la orden impartida. En consecuencia, no se puede sostener que la invasión fue el medio de desobedecer, en tanto fue previo a la desobediencia misma. De ahí que no lleve razón la defensa en ese particular.

Por otra parte, se rechaza el recurso en cuanto a la orden de restablecimiento de las cosas al estado anterior ordenado en sentencia, toda vez que, habiéndose acreditado la existencia del ilícito, se trata de una consecuencia necesaria, autorizada por la normativa en el artículo 367 del Código Procesal Penal.

De modo que, por mayoría, se declara parcialmente con lugar los motivos tercero y cuarto de esta misma impugnación. Se revoca la sentencia impugnada y se recalifican los hechos demostrados a los delitos de infracción a la Ley Forestal en su modalidad de invasión al área de protección de un río y desobediencia a la autoridad en concurso material. En cuanto a este extremo, la jueza [Nombre7] salva parcialmente el voto. Así las cosas, se ordena la nulidad de la sentencia y el debate que le precedió únicamente en en lo que atañe a la fijación de la pena que deberá imponerse, en razón de lo cual, se ordena el reenvío del asunto a su tribunal de origen, a fin que mediante su nueva integración se proceda a la celebración de nuevo juicio. En lo demás, el fallo permanece incólume.

IV.Voto salvado de la jueza [Nombre7] . Con todo respeto, me aparto de la posición de mis compañeros en cuanto a la determinación de que los delitos de infracción a la Ley Forestal y el delito de desobediencia concurren material y no, idealmente. En torno a la materia concursal, deben realizarse varias consideraciones. Así, recuérdese que, por una parte, a efectos de determinar la existencia de un concurso ideal o material de delitos, lo primero es examinar si nos encontramos frente a sola unidad de acción en sentido jurídico. Para ello, necesariamente debe analizarse si se verifica o no un vínculo funcional entre las conductas estudiadas, que comparten un cuadro fenomenológico común, es decir, son desplegadas en el mismo tiempo y espacio. Esto es, debe tomarse en cuenta la perspectiva cierta del plan del autor, lo querido por este, pero siempre de cara al pragma material, lo que objetivamente se verifica en el plano fáctico.

De modo que, en aquellos casos en los que tal vínculo funcional no exista, nos encontramos en presencia de un concurso material de delitos, de acciones ilícitas completamente separadas que reciben un grado de reproche independiente. Por otra parte, es importante tomar en cuenta que, de conformidad con el artículo 21 del Código Penal, existe concurso ideal cuando con una sola acción u omisión se violan diversas disposiciones legales que no se excluyen entre sí. El numeral 22 de este mismo cuerpo de leyes establece taxativamente los supuestos contrarios, sea, en los que las normas legales se excluyen entre si: la norma especial prevalece sobre la general, la que contiene íntegramente a otra se prefiere a ésta y aquella que la ley no haya subordinado expresa o tácitamente a otra, se aplica en vez de la accesoria. De modo que, fuera de estos supuestos y en los que, además, se haya excluido el concurso material, se tratará de un concurso ideal, por no existir la vulneración a normas excluyentes.

De igual forma, la más autorizada doctrina, sugiere como criterio de distinción, el estudio de las acciones que conforman el plan ejecutivo de los distintos tipos penales, y establece que, tratándose del concurso ideal, aquellas pueden encontrarse en tres formas: (a) cuando varios actos ejecutivos de los tipos penales en entran en concurrencia son, en el caso concreto idénticos, por ejemplo, matar a dos personas de un solo balazo. (b) Cuando hay una identidad parcial de los varios actos ejecutivos de los tipos penales concurrentes, sea, una de sus partes contribuye a realizar el tipo de una y de otra de las leyes penales, que por ello concurren, verbigracia, la concurrencia entre las lesiones y el robo. (Ver [Nombre18] , . El concurso de delitos en el derecho penal costarricense. Litografía e imprenta Lil, S.A., San José, pp.61, 1981). Así, para esta juzgadora, es claro que, el designio personal del autor por sí mismo, no define el punto, sino, más bien, la concreta afectación a los bienes jurídicos dentro del diagrama de tutela legislativa, su enjuiciamiento jurídico social.

Es decir, es solo a partir de la concepción política subyacente, que debe fijarse la magnitud del disvalor de las acciones ilícitas que se verifican en el plano del mundo material (Cfr. [Nombre19] . Manual de Derecho Penal. Parte General. Editorial Temis s.a. Bogotá. Segunda Edición, pp.477, 2004.). (Así, en resolución número 2015-735, Tribunal de Apelación de la Sentencia Penal de Cartago, Sección Primera, de las 14:12 horas de 13 de noviembre de 2015).

De modo que resulta claro, para esta posición minoritaria, que de acuerdo con los parámetros aludidos, lo primero que debe determinarse es la existencia de un vínculo funcional entre las distintas acciones, a efecto de determinar si existe o no, unidad de acción en sentido jurídico. En ese sentido, en la especie tenemos que, el juzgador soslayó que, aunque se trató de acciones que se verifican sucesivamente en el tiempo, se demostró que fueron ejecutadas con el único objetivo de construir una vivienda en el margen del río, una zona prohibida. Lo anterior, puede derivarse con entera facilidad, de las manifestaciones del deponente de cargo, [Nombre14] , funcionario del Sistema Nacional de Áreas de Conservación (SINAC), según el cual, desde el primer momento que abordó al justiciable [Nombre9] , lo observó con otros sujetos realizando una construcción en el margen del río Limoncito, este le manifestó que no tenía donde vivir porque había sido desalojado de donde vivía.

Es así como, acto seguido, el imputado fue notificado de la medida cautelar administrativa de suspender la obra de construcción (ver folio 129 vuelto). Posteriormente, la autoridad administrativa se percató de que la obra fue concluida por el endilgado, de acuerdo con lo que se tuvo por cierto, referido líneas atrás. Es decir, como se alega, es evidente que el único fin del imputado fue construir una vivienda en el área prohibida, para lo que invadió el área y desobedeció la orden de una autoridad pública que le prevenía de no hacerlo. Por otro lado, resulta claro que, con esta misma acción, resultaron vulnerados pluralidad de bienes jurídicos, previstos en otras dos normas que no se excluyen entre sí, en lo que concierne a este delito de infracción de la Ley Forestal y de desobediencia a la autoridad. Se trata de un concurso ideal delitos.

Al punto, disiento de la posición mayoritaria en cuanto a que, por ostentar el delito de desobediencia a la autoridad una naturaleza omisiva, no resulta susceptible de concurrir con el delito de infracción a la Ley Forestal en su modalidad de invasión a un área protegida. Para la suscrita, no obstante ello, no existe ningún obstáculo legal ni ontológico para que no sea así, puesto que, no puede soslayarse que el delito de desobediencia a la autoridad reviste una acción bimodal, esto es, la acción típica puede consistir en el despliegue activo de una conducta en concreto o bien, el abstenerse de hacer lo ordenado, sin que eso incida en su condición de delito de omisión propia, entendido como la omisión de cumplir el deber legal que impone la norma. No obstante, en ambos casos, la alteración que el agente provoque en el plano material resulta susceptible de infringir pluralidad de bienes jurídicos tutelados, caso en el cual, nos encontramos en presencia de un concurso ideal de delitos, como en mi criterio, se verifica en la especie.

Por tanto

Por unanimidad, se declara sin lugar el primer motivo de apelación interpuesto por [Nombre8] , defensora pública del acusado [Nombre1] . Por mayoría, se declara parcialmente con lugar los motivos segundo y tercero de esta misma impugnación. Se revoca la sentencia impugnada y se recalifican los hechos demostrados a los delitos de infracción a la Ley Forestal en su modalidad de invasión al área de protección de un río y desobediencia a la autoridad en concurso material. En cuanto a este extremo, la jueza [Nombre7] salva parcialmente el voto. Así las cosas, se ordena la nulidad de la sentencia y el debate que le precedió únicamente en lo que atañe a la fijación de la pena que deberá imponerse, en razón de lo cual, se ordena el reenvío del asunto a su tribunal de origen, a fin que mediante su nueva integración se proceda a la celebración de nuevo juicio. En lo demás, el fallo permanece incólume.
