SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At twelve thirty-two on treinta y uno de marzo de dos mil diecisiete.- PROTECTIVE MEASURE (MEDIDA DE SEGURIDAD) within the POSSESSORY PROCEEDING (PROCESO INTERDICTAL) brought by [Nombre1], of legal age, married, farmer, resident of Cartago, identity card CED1 - -; against UNKNOWN. The PROCURADURÍA GENERAL DE LA REPÚBLICA appears, represented by its advisory attorney José Barahona Vargas, of legal age, attorney, identity card CED2 - -. Attorney Mario Rosales Vargas, whose personal particulars are not stated in the record, acts as public defender for the plaintiff. Proceeding heard before the Juzgado Agrario de Cartago.- Judge Picado Vargas writes the opinion; and,
WHEREAS
I.By a ruling issued at thirteen thirty-five on doce de diciembre de dos mil dieciséis, the Juzgado Agrario de Cartago decided a protective measure within this tree-felling possessory proceeding, authorizing the felling (corta) of nineteen Targuá trees and the pruning (poda) of fourteen Jaúl trees, with the felling to be performed at the plaintiff’s expense and with the plaintiff assuming responsibility for ensuring that it does not affect third-party property or surrounding vegetation. It expressly did not authorize the plaintiff to use the timber because the trees are located within the river protection zone (zona de protección), ordering that the nearest Board of Education be the entity to use the timber (Associated Documents Tray 12/12/2016 13:35:00 am).-
II.The plaintiff’s public defender appeals the aforementioned ruling, stating as follows: SUBSTANTIVE GROUNDS FOR APPEAL (AGRAVIOS DE FONDO): 1.- He asserts that the felling of all the [Nombre2] trees should have been authorized because of their height and dangerous condition. 2.- He asserts that the sale of the timber resulting from the felling should be permitted because the plaintiff lacks the financial means to cover those expenses, since specialized equipment and personnel, payment for insurance policies, laborers, machinery, and other expenditures are required. He further states that several schools were asked whether they wished to sell the timber and responded that they did not, because the timber is firewood for formwork or coffins, which could be handled only through a company engaged in that business (Filings Tray 10:52:48 15/12/2016).-
III.The first ground for appeal is partially well-founded. Given the urgency inherent in this type of matter and the cursory nature of the judicial inspection (reconocimiento judicial) conducted by the lower court, this Tribunal went to the site to conduct a new inspection. That proceeding established that several of the trees which the challenged ruling had ordered felled have already fallen and that many of the trees whose felling is sought by the plaintiff were considered neither during the inspection conducted by the lower court—which did not even identify the trees involved—nor in the SINAC report. In view of that omission and the failure to mark certain trees (P12, P14 y P15), SINAC must be ordered to supplement report OSC-1304-2016 dated 5 de diciembre del 2016, issued by the Oficina Subregional de Cartago del SINAC, Lic. Luis Quirós Rodríguez and engineer Arnulfo Díaz Hernández (shown in images 31 to 35 of the electronic case file), with respect to the trees numbered in the private expert report (informe pericial privado) prepared by engineer Luis Meneses, who was retained by the plaintiff.
Specifically, the trees marked with blue spray paint by that professional with the numbers: 2, 3, 4, 6, 7, 8, 17, 18, 19, 20 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 37, 38, 39, 44, 45, 46 ,47, 50, 51, 52, 53, 54, 55, 56, 57 y 58 (page 68 of the printed case file). That report must be submitted to the Juzgado Agrario de Cartago within one month from the date of receipt of the official communication to be issued. Taking into account the trees’ health, the angle and direction of their lean, and their height-to-distance relationship with neighboring properties, this Tribunal finds that trees P13, P11, P10, P9, P8, P7, P5, P4 y P3 must be pruned rather than felled, as ordered in the challenged ruling; however, whether to perform the pruning is left to the plaintiff’s discretion, taking into account the cost-benefit balance. This does not apply to tree P6, which is very tall, with extensive branching and a southward lean toward homes located along the riverbank; accordingly, this Tribunal partially reverses the judgment insofar as it ordered that tree pruned and instead orders it felled.
Likewise, with respect to the trees identified by the blue numbers 9 y 10 (see engineer Meneses’s report), as well as P2, both engineers agreed that they should be felled because they are diseased trees on the verge of collapse, and this Tribunal orders their felling.
IV.The appellant’s second ground for appeal is well-founded. The fact that the trees are located within the river protection zone is not a reason to prevent the commercial use of the felled timber, since that area forms part of the plaintiff’s property. In a similar case, this Tribunal stated: “IV.- Furthermore, the trees for which felling was requested are located within the property of the Museo Nacional de Costa Rica; that is, they belong to the Museo, and therefore the trial judge may not so casually rule that the timber is to be donated to the nearest Board of Education, as the lower-court judge did. Accordingly, they form part of the natural assets of the plaintiff’s property, and it may not be ordered that they be delivered to the nearest Board of Education because they form part of the plaintiff’s assets. In view of the foregoing, the ruling must be partially reversed insofar as it summarily rejects the application concerning the felling of the tree that is not within the stream protection area.
It is likewise reversed insofar as it states that, if the timber is usable, it is to be granted to the nearest Board of Education for its use. The plaintiff shall dispose of the timber resulting from the tree to be felled as it deems appropriate.” TRIBUNAL AGRARIO, Voto No. 1032-F-15 of dieciséis horas y cuarenta y tres minutos del ocho de octubre de dos mil quince. In this particular case, the trees are located within the plaintiff’s property, and preventing the plaintiff from selling or otherwise economically disposing of the timber resulting from the felling would deprive the plaintiff of an attribute of the right of ownership, since Article 505 of the Código Civil establishes that the right of ownership is not limited to the surface of the land but extends to what is above the surface, and Article 5096 states that every crop, planting, or structure belongs to the owner. The fact that the trees are located within the river protection zone entails only environmental restrictions on tree felling; it does not mean that this zone is not an integral part of the plaintiff’s right of ownership.
Those restrictions entail the felling authorization granted in this proceeding due to the dangerous condition of the trees, pursuant to Article 474 of the Código Procesal Civil. There is therefore nothing preventing the plaintiff from selling the timber to cover the felling expenses. The ground for appeal is sustained, and the ruling is partially reversed solely insofar as it did not authorize the plaintiff to use the timber because the trees are located within the river protection zone and ordered that the nearest Board of Education be the entity to use it. Instead, the plaintiff is authorized to sell the timber resulting from the felling as the plaintiff deems appropriate. The authorized trees shall be felled immediately.
THEREFORE
The ruling is partially reversed solely insofar as it did not authorize the plaintiff to use the timber because the trees are located within the river protection zone and ordered that the nearest Board of Education be the entity to use it. Instead, the plaintiff is authorized to make reasonable use (aprovechamiento racional) of the timber resource resulting from the felling as the plaintiff deems appropriate. The authorized trees shall be felled immediately. The ruling is also reversed insofar as it ordered the pruning of trees P2 y P6; instead, their felling is ordered, as is the felling of the trees numbered 9 y 10 in blue lettering. Taking into account the trees’ health, the angle and direction of their lean, and their height-to-distance relationship with neighboring properties, this Tribunal finds that trees P13, P11, P10, P9, P8, P7, P5, P4 y P3 must be pruned rather than felled, as ordered in the challenged ruling; however, whether to perform the pruning is left to the plaintiff’s discretion, taking into account the cost-benefit balance.

VOTO N° 299-F-17 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las doce horas y treinta y dos minutos del treinta y uno de marzo de dos mil diecisiete.- MEDIDA DE SEGURIDAD dentro del PROCESO INTERDICTAL promovido por [Nombre1] , mayor, casado, agricultor, vecino de Cartago, cédula de identidad CED1 - - ; contra IGNORADO. Interviene la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por su procurador asesor José Barahona Vargas, mayor, abogado, cédula de identidad CED2 - - . Actúa como defensor público de la parte actora, el letrado Mario Rosales Vargas, de calidades desconocidas en autos. Tramitado ante el Juzgado Agrario de Cartago.- Redacta el juez Picado Vargas, y;
CONSIDERANDO
I.El Juzgado Agrario de Cartago, mediante resolución dictada a las trece horas treinta y cinco minutos del doce de diciembre de dos mil dieciséis, resolvió una medida de seguridad dentro del presente proceso interdictal de derribo autorizando la corta de diecinueve árboles de especie Targuá; la poda de catorce árboles de la especie Jaúl; siendo la corta a costo de la actora y que asume la responsabilidad de velar que la corta no afecten bienes de terceros o vegetación circundante. Expresamente, no autorizó a la actora a aprovechar la madera dado que los árboles se encuentran en la zona de protección del río, ordenando que sea la Junta de educación más cercana la que aproveche la madera (Bandeja de documentos asociados 12/12/2016 13:35:00 am).-
II.El defensor público del actor interpone recurso de apelación contra la referida resolución, manifestando lo siguiente: AGRAVIOS DE FONDO: 1.- Indica que debió autorizarse la corta de todos los árboles de [Nombre2] por su altura y peligrosidad. 2.- Indica que debe permitirse la comercialización de la madera que resulte de la corta, ya que la parte actora no está en condiciones económicas para sufragar dichos gastos, ya que se requiere de equipo y personal especializado, pago de pólizas, peones, maquinaria y otros rubros económicos. Además asegura se consultaron varias escuelas si deseaban comercializar la madera y manifestaron que no, pues la madera es leña para formalea o ataúdes, lo cual solo podría por medio de una empresa dedicada a ello (Bandeja de escritos 10:52:48 15/12/2016).-
III.Lleva parcialmente razón en el primer agravio. Este Tribunal, ante la urgencia que representa este tipo de asunto y lo laxo del reconocimiento judicial realizado por la a quo, se presentó al lugar de los hechos a realizar uno nuevo. De dicha diligencia, se extrae que varios de los árboles que la resolución impugnada había ordenado cortar ya se han venido al suelo y que muchos de los árboles que pretende su derribo la parte actora, no fueron tomados en cuenta ni en el reconocimiento practicado por la a quo (la cual ni siquiera identificó los árboles involucrados) ni por el informe del SINAC. Ante dicha omisión y la falta de marcación de algunos árboles (P12, P14 y P15) es necesario ordenar al SINAC que amplíen el informe OSC-1304-2016 de fecha 5 de diciembre del 2016 emitido por la Oficina Subregional de Cartago del SINAC Lic. Luis Quirós Rodríguez y el ingeniero Arnulfo Díaz Hernández (visibles a imágenes 31 a 35 del expediente electrónico) sobre los árboles numerados en el informe pericial privado rendido por el ingeniero Luis Meneses contratado por la parte actora.
Específicamente de los árboles marcados con spray azul por dicho profesional con los números: 2, 3, 4, 6, 7, 8, 17, 18, 19, 20 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 37, 38, 39, 44, 45, 46 ,47, 50, 51, 52, 53, 54, 55, 56, 57 y 58 (folio 68 del expediente impreso). Dicho informe deberán rendirlo ante el Juzgado Agrario de Cartago en el plazo de un mes a partir de la fecha de recibo del oficio que se expedirá. Tomando en cuenta las condiciones de sanidad de los árboles, su ángulo y dirección de inclinación, así como la relación altura-distancia con respecto a predios vecinos, este Tribunal considera que los árboles P13, P11, P10, P9, P8, P7, P5, P4 y P3 deben ser podados y no cortados, tal y como se ordenó en la resolución impugnada, pero queda a criterio de la parte actora el realizar o no la poda, tomando en cuenta el balance costo-beneficio. No así con el árbol P6, el cual, el cual es de gran altura y con una ramificación grande e inclinación hacia el sur, donde se encuentran casas de habitación a la orilla del río por lo cual, este Tribunal revoca parcialmente la sentencia en cuanto ordenó su poda, para en su lugar ordenar su corta.
De igual modo, con los árboles identificados con números azules como 9 y 10 (ver informe del Ingeniero Meneses) así como el P2, ambos ingenieros concordaron en su corta, por ser árboles enfermos y apunto del desplome, los cuales este Tribunal ordena su corta.
IV.Lleva razón el recurrente en su segundo agravio. El hecho de que los árboles se encuentren dentro de la zona de protección del río no es motivo para impedirle el aprovechamiento comercial de la madera cortada, pues dicha área forma parte de su propiedad. En un caso semejante, dijo este Tribunal: "IV.- Por otra parte los árboles solicitados cortar se encuentran dentro de la propiedad del Museo Nacional de Costa Rica, es decir le pertenecen al Museo, por lo que no puede la jueza de instancia resolver tan a la ligera en el sentido de que se ordena donar la madera a la Junta de Educación más cercana como lo resuelve la jueza ad quo. De ahí, son parte del patrimonio natural que tiene la propiedad de la actora, por lo que no se puede disponer el ordenar sean entregados a la Junta de Educación más cercana pues son parte de su patrimonio. En razón de lo expuesto se debe revocar parcialmente la resolución dictada en cuanto rechaza de plano la gestión sobre la corta del árbol que no está dentro del área de protección de la quebrada.
Igualmente se revoca en cuanto se indica que en caso de ser aprovechable la madera le sea otorgada a la Junta de Educación más cercana para que sea esta la que la aproveche. En cuanto a la disposición de la madera resultante del árbol que se cortará será la accionante la que disponga de la misma de acuerdo a su conveniencia." TRIBUNAL AGRARIO, Voto No. 1032-F-15 de las dieciséis horas y cuarenta y tres minutos del ocho de octubre de dos mil quince. En este caso particular, los árboles se encuentran dentro de la propiedad de la actora y el impedirle la comercialización o disposición económica de la madera resultante de la corta sería cercenarle el atributo de su derecho de propiedad, ya que el Código Civil en su artículo 505 establece que el derecho de propiedad no se limita la superficie de la tierra, sino que se extiende a lo que está sobre la superficie y el 5096 dice que toda siembra plantación u obra le pertenece al propietario.
El hecho de que estén en zona de protección del río solo implica limitaciones de carácter ambiental en cuanto a la corta de árboles, pero no significa que dicha zona no se parte integrante de su derecho de propiedad y dichas limitaciones implican la autorización de corta que en este proceso se ha otorgado, por la peligrosidad de los árboles conforme al numeral 474 del Código Procesal Civil. Nada impide entonces que el actor pueda comercializar la madera para sufragar las gastos de la corta. Se acoge el agravio y se revoca parcialmente la resolución, únicamente en cuanto no autorizó a la actora a aprovechar la madera dado que los árboles se encuentran en la zona de protección del río, ordenando que sea la Junta de educación más cercana la que aproveche la madera. En su lugar, se autoriza al actor a comercializar la madera que resulte de la corta a su conveniencia. Proceda a la corta de los árboles autorizados inmediatamente.
POR TANTO
Se revoca parcialmente la resolución, únicamente en cuanto no autorizó a la actora a aprovechar la madera dado que los árboles se encuentran en la zona de protección del río, ordenando que sea la Junta de educación más cercana la que aproveche la madera. En su lugar, se autoriza al actor a aprovechar racionalmente el recurso maderable que resulte de la corta a su conveniencia. Proceda a la corta de los árboles autorizados inmediatamente. También se revoca en cuanto ordenó la poda de los árboles P2 y P6, en su lugar se ordena su corta, así como de los árboles numerados con letras azules 9 y 10. Tomando en cuenta las condiciones de sanidad de los árboles, su ángulo y dirección de inclinación, así como la relación altura-distancia con respecto a predios vecinos, este Tribunal considera que los árboles P13, P11, P10, P9, P8, P7, P5, P4 y P3 deben ser podados y no cortados, tal y como se ordenó en la resolución impugnada, pero queda a criterio de la parte actora el realizar o no la poda, tomando en cuenta el balance costo-beneficio.
